BACKGROUND
Opinion drafted by Justice López González LEGAL ANALYSIS
I.According to the facts that the Tribunal found to have been proven, the construction of the San José-Caldera highway is a State-owned public work awarded under a public-works concession with public service to Autopistas del Sol Sociedad Anónima (hereinafter Autopistas del Sol). For the construction phase, this concessionaire subcontracted Constructora San José – CaLdera Sociedad Anónima (hereinafter Constructora San José - Caldera). In agosto de 2009, at the site located between kilometers 33 and 34 of the highway known as Ruta Nacional no. 27, those companies excavated the land, lowered the grade where the highway was being built, and cut into the base. A landslide (deslizamiento de tierras) occurred, affecting two properties owned by Constructora Guter Martini Sociedad Anónima (hereinafter Constructora Guter), registration numbers 358581-000 and 016438-000, located in the provincia de Alajuela, Atenas, Pan de Azúcar de Concepción.
José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo, and Juan Manuel Víquez Quesada resided on those properties. On 18 de setiembre de 2009, Constructora San José – Caldera sent letters to Maylin Irías Murillo, Martín Irías Hernández, and “Manuel Irías Hernández,” stating that, in connection with the construction of the public work, cracks had been observed approaching the property, which could render the platform on which the homes were situated unstable. It also recommended that they vacate as soon as possible and stated that it would cover the respective moving and rental costs for as long as “the situation lasts.” In a letter dated 29 de octubre de 2009, it informed them that it was conducting the tests and measurements necessary to determine the current and future condition of the landslide affecting the properties. That same month, on an unspecified date, Maylin Irías Murillo and José Martín Víquez Quesada vacated the house in which they lived and remained away for one year.
During 2010 and 2011, Constructora San José – Caldera implemented technical mitigation and prevention measures and conducted topographic monitoring of the land. The landslide area has now been stabilized. In view of the foregoing, Constructora Guter, José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo, and Juan Manuel Víquez Quesada sued the Estado, the Consejo Nacional de Concesiones, Autopistas del Sol, and Constructora San José – Caldera, seeking a judgment that:
II.Dissatisfied with the judgment, Constructora San José Caldera and Autopistas del Sol filed appeals in cassation (recursos de casación). The former’s appeal was admitted in full, while the latter company’s appeal was admitted in part. The admitted grounds of appeal will be examined and decided in accordance with the cassation structure established by the Código Procesal Contencioso Administrativo (CPCA); that is, procedural defects first, followed by substantive challenges. It is also noted that the grounds have been regrouped and renamed in accordance with the arguments presented and the grounds established by that same body of law.

III.First. Under the heading “A- VIOLATION OF THE RULES OF CONSTITUTIONAL LAW AND RULES THE NONOBSERVANCE OF WHICH IS SANCTIONED BY ABSOLUTE NULLITY, ARTICLES 1 SUBSECTION 1) AND 2 SUBSECTION B), AND 5, 12 subsection 3), ALL OF THE CPCA, ARTICLE 49 OF THE CONSTITUCIÓN POLÍTICA, AND ARTICLE 97 SUBSECTION 1) OF THE LEY ORGÁNICA DEL PODER JUDICIAL ARE DEEMED TO HAVE BEEN VIOLATED,” Autopistas del Sol contends that the Tribunal could not assume jurisdiction and competence to determine legal situations governed by private law. It continues that, if there was no cause of action against the Estado and the CNC, as established in the judgment, the proper course was to declare that it lacked competence and refer the matter to the ordinary civil courts. It states that the competence of the Tribunal Contencioso is governed by the first provision, first subsection, of the Código Procesal Contencioso Administrativo (CPC), in conjunction with provisions 2.b, 5, and 12 of the same body of law.
Since the Estado and the CNC bear no administrative liability, “our client has no obligation whatsoever arising from the administrative conduct; the contentious-administrative jurisdiction established in 49 of the Constitución Política and article 97 subsection 1 of the Ley Orgánica del Poder Judicial is therefore exhausted (…) and the Tribunal should accordingly have refrained—on its own motion—from (sic) ruling on the merits of this matter.” It adds that it was ordered to pay property damage in violation of provision 126 of the CPCA, which provides that a judgment granting relief must be based on the proven facts, whereas the award in this case is not founded on them. It insists that there is no evidence that the claimant company’s property depreciated or sustained an objective and actual loss, and that not a single proven fact so states. Article 1045 of the Código Civil was therefore infringed.
IV.It is apparent that the appellant combines two defects, one procedural in nature (concerning the Tribunal’s alleged lack of competence to rule) and another substantive in nature (namely, the infringement of provision 1045 of the Código Civil). Nevertheless, the central point of its challenge is the former; it devotes only a few lines to the latter and, moreover, neither develops nor explains the violation beyond stating that it is not based on the established facts. Accordingly, this Sala confines its review to the challenge based on lack of competence and concludes that the appellant in cassation is incorrect. The decision of the Tribunal de lo Contencioso Administrativo y Civil de Hacienda to grant the claim in part solely against the private-party defendants was issued simultaneously with its dismissal based on the public entities’ lack of passive standing. The first of those rulings cannot under any circumstances divest that body of competence.
The Estado and the Consejo Nacional de Concesiones were sued together with the sociedades anónimas (private entities), such that the claimant sought to hold each of them liable, and this determines the competence of the contentious-administrative jurisdiction provided for in the first article, first paragraph, of the Código Procesal Contencioso Administrativo (CPCA). Moreover, an alleged supervening lack of competence resulting from the lack of standing determined by the Tribunal is inadmissible because, under provision 2.e of the same body of law, the contentious-administrative and public-finance civil jurisdiction must adjudicate “conduct or relationships governed by public law, even when they originate from private persons or such persons are parties thereto.” That is precisely what occurs in this matter, which concerns liability for injuries apparently occurring—as alleged—through the performance of an administrative agreement (convenio administrativo); that is, arising from the conduct of a private entity serving as a contractor for the Administración and therefore governed primarily and predominantly by public law (in this regard, the appellant in cassation is referred to recitals XX through XV of this judgment). In short, the ground of appeal shall be denied.
V.Second, under the first point, “A- DENIAL OF A DEFENSE, AFFECTING THE RIGHTS OF DEFENSE AND DUE PROCESS,” Autopistas del Sol alleges a violation of the right of defense and due process, of provision 119 of the CPCA, and a lack of congruence (incongruencia). It explains that the award of property damage is defective for lack of congruence because the judgment exceeded its bounds by awarding matters not requested and granting more than was sought; it awarded an item that was not at issue, namely, the amount of the depreciation and the objective and actual loss experienced by the property as a result of the subsidence and detachment, including the restrictions on use and enjoyment that this entails and will entail for the owner. It emphasizes that the claimant sought damages under article 122.m.i of the CPCA, meaning that the damage was to be established in the record. It therefore questions the basis on which the Tribunal determined that the property damage consisted of loss through depreciation and objective and actual loss, as well as loss of use and enjoyment.
It argues that the claimant company did not seek compensation for that item and that there is no evidence that the property depreciated or sustained an objective and actual loss, including loss of use and enjoyment. It stresses that the claimant company likewise did not request an award in the abstract; on the contrary, it requested that liability be imposed and the amount of damages fixed, which could have been done had there been evidence supporting the value or quantum of the injuries. It states that provision 122.m.i establishes that the Tribunal must rule on the amount of damages and consequential losses if their existence and amount are proven. Thus, because no request was made for an award in the abstract in the absence of evidence, the judgment granted relief beyond and in excess of that requested (extra y ultra petita).
VI.This Chamber has repeatedly held that inconsistency (incongruencia) arises when there is an evident dissonance or contradiction between the operative part of the judgment and the claims and defenses raised by the parties. In addition, when assessing congruence, it is essential to analyze the factual basis of the relief sought, since the facts (together with the legal arguments) constitute the foundation of the claims. That is, to determine or rule out the existence of the defect, the relationship between the cause of action (causa de pedir) and the relief sought must be examined; in other words, the circumstances alleged by the plaintiff and the defendants in support of their positions must be considered, since those circumstances define or limit the Tribunal’s ruling. Lastly, it remains to be noted that, in proceedings governed by the CPCA, in addition to comparing the relief sought with the relief granted, the operative part must be compared with the claims and defenses asserted both in the complaint and in the answer, as well as at the preliminary hearing and at trial (for example, article 67 of the aforementioned statute); furthermore, consideration must be given to rulings that this statute requires the adjudicator to issue sua sponte, such as those set forth in article 122 thereof.
VII.In the case at hand (sub júdice), according to the complaint, the single hearing (third part of 8 de abril de 2013, audio and video file), and the minutes (folio 1041), the plaintiff requested—among other matters—that the co-defendants be ordered to pay the material damages sustained by Constructora Guter, which, “according to the expert report of engineer Luis Alberto Rodríguez Astúa, amount to One Million Nine Hundred Eighty-Seven Thousand Nine Hundred Seventy-Eight dollars, legal tender of the United States of America ($1.987.978,00). That is, pursuant to article 122, subsection m) i, it is requested that the defendants be held jointly and severally liable for the payment of damages, with a ruling as to their existence and amount” (folio 54). As evidence, the plaintiff offered with its complaint an “Expert Assessment of Damages, prepared by engineer Luis Alberto Rodríguez Astúa, MBA, Official Expert of the Corte Suprema de Justicia and active member of the Instituto Costarricense de Valoración (ICOVAL)” (folio 58).
Subsequently, in replying to the answer filed by Constructora San José – Caldera, insofar as the material damage was concerned, it stated that it had “no objection to another expert appointed by Your Honor assessing the case again, either on the basis of the report by expert Rodríguez Astúa (as requested in the complaint) or by conducting a new expert assessment” (folio 352). Regarding the State’s answer, it explained that, because the land had belonged to the Irías family for more than 100 years and had been transferred without consideration, it did not know the actual value of the diminution in its assets and therefore retained an “official mathematical actuary of the Corte Suprema de Justicia so that this professional could determine how much (sic) is the estimated value of the harm they have been compelled to endure” (at folio 357). At the single hearing, third part, held on 8 de abril de 2012, the documentary evidence that the plaintiff had identified in its complaint as an “expert assessment” prepared by engineer Rodríguez Astúa was not admitted (10:47:08 of the audio and video file).
The presiding judge of the Tribunal then stated the following regarding the admission of the expert evidence for the assessment of that material damage, which had been offered by the plaintiff: “(…) there are two aspects to consider: the other expert evidence has already been taken and the reports submitted, so this evidence would be taken at the trial hearing (…); this evidence was not processed; thus, we make the following observation here: (…) if this evidence were admitted, since I must give the parties an opportunity to respond, the proceedings would have to be stayed, the expert appointed, his fees paid, his report prepared, the parties given an opportunity to respond, and this would then delay the trial by at least, at least 3 more months (…); the other point is a consideration that is always made: as I understand it, this expert is not being requested to prove the damage; the other two items of expert evidence would be those proving the damage, so you could consider having this expert appointed for a possible judgment-enforcement phase, where your complaint might or might not ultimately be granted and your right might or might not be declared, and the assessment would then fall to the enforcement judge assigned in due course, (…) who would appoint the expert and could potentially consider the reference that was made.
Beginning with that, I submit it for your consideration; if you want the assessment performed now, I will give the parties the floor, we will recess, and we will obviously continue with the taking of evidence, but it would entail staying the proceedings” (10:51:47 of the audio and video file). In response, counsel for the plaintiff stated: “we consider it appropriate, so as not to delay the proceedings further, to reserve the damages portion and subsequently proceed to the enforcement phase” (10:54:09). The judge thus concluded that the expert assessment of the damage would be conducted during the judgment-enforcement phase (10:54:26). None of the defendants objected or expressed disagreement. It is clear from the foregoing that, although the plaintiff initially requested a determination of both the existence of the diminution and its quantification, it later decided to limit the dispute to its existence, deferring the determination of its amount to the judgment-enforcement phase, as stated by the Tribunal.
For this reason, the judgment issued a ruling for an amount to be determined, but not as to the damage caused to properties 35381 and 16438, which consisted precisely of “subsidence caused by the cutting of the land for the highway-construction works, which affected a significant sector or area consisting of green spaces with fruit trees and other plants.” The Tribunal continued: “it is clear that the event that occurred in agosto de 2009 changed the exercise of the incidents of ownership over the property and restricted its use, enjoyment, alteration, and transfer. The cracks that formed, the landslide, displacement, and movement of earth impair its full and unrestricted disposition. The relief sought in these proceedings must consist of the value of the depreciation and the objective and actual loss sustained by the property because of the subsidence and detachment of part of the land that occurred on 23 agosto de 2009; it shall also encompass the restrictions on free use and enjoyment that this event has entailed and will entail for its owner, who, had the event not occurred, could have exploited it, provided those restrictions or limitations are permanent; for example, the impossibility of building, sowing, planting, or cultivating the land.
This must be determined with the assistance of expert technical evidence. Once that obligation ceases to be an obligation for value and becomes a monetary obligation, expressed as a sum of money, it must be adjusted for inflation from that time until extinguished by actual payment (articles 123, subsection 1, in fine, in relation to 125, subsection 3, CPCA), which shall be done during the enforcement phase of this judgment.” Autopistas del Sol further complains that the Tribunal awarded compensation for depreciation, objective and actual loss, and loss of use and enjoyment, even though, in its view, such relief was not requested. This Chamber disagrees with the appellant; as noted, compensation for material damage to the properties was sought from the filing of the complaint, and the harm to the real properties was established in the proceedings (without prejudice to the analysis to be conducted regarding the substantive defects): cracks, landslide, earth movement, and subsidence, the logical consequence of which is precisely the loss of value.
After the event, the properties no longer had the same value as before it, and their use and enjoyment were altered. The Tribunal limited compensation to these elements so that no other, different elements could be added during the enforcement phase; moreover, with respect to use and enjoyment, it ruled that the restriction had to be permanent to be compensable. Consequently, the alleged defect of inconsistency is not established: the material damage awarded to Constructora Guter was requested by the plaintiff, which agreed that its quantification would be deferred to the judgment-enforcement phase, and the Tribunal merely defined the nature of the claimed injury for which compensation would be awarded. Accordingly, this ground must be denied.
VIII.Third. As a single procedural defect, Constructora San José – Caldera (in the second ground of its appeal) alleges infringement of provisions 317 of the Código Procesal Civil and 10, 57, and 82.4 of the CPCA. It contends that the award for non-pecuniary harm (daño moral) and the determination of its amount fail to explain why ¢3.000.000,00 was awarded to some persons and ¢5.000.000,00 to others, thereby lacking an adequate statement of reasons. It is an unreasoned judgment. It acknowledges that, although compensation is determined on an equitable basis, the principles of rational evaluation in accordance with sound judgment (sana crítica racional), common sense, and experience must also be applied. It questions why, if the first point of the ninth recital stated that everyone had been affected equally, different amounts were subsequently awarded, resulting in disparate treatment for which no reasons were given.
It disagrees with the award for this harm based on their status as residents, because in the complaint, at the preliminary hearing, and during the trial phase, the request was based on their status as shareholders of the company that owned the land; during closing arguments, in an attempt to rectify the error, an association lacking legal personality was invoked as establishing standing under the cause of action for non-pecuniary harm, when the proper course was to invoke the situation established in articulo 10.4 of the CPCA. It clarifies that, in any event, the basis of its grievance is the absence of appropriate evidence justifying the award for non-pecuniary harm: the plaintiffs manufactured evidence among themselves through their testimony at trial, without presenting evidence concerning the existence and extent of subjective non-pecuniary harm, and submitted only a copy of an alleged record of psychological care resulting from the landslide, which is not evidence of a therapeutic process arising from non-pecuniary injuries.
It challenges the evidence on which the Tribunal relied. It observes that the copy of the psychological report is merely a copy, yet the Tribunal treated it as an expert opinion, and its author did not appear at trial to address it. Its own notice recommending evacuation does not have the significance attributed to it, since none of the affected persons stated that receiving it had caused them harm; as for their own statements, through which “they most crudely colluded to create their own evidence”
IX.It follows from the foregoing account that the appellant in cassation raises three objections: A) the judgment lacks reasoning concerning the amount awarded as compensation for non-pecuniary harm (daño moral) to the individual plaintiffs; B) in awarding compensation for non-pecuniary injuries (lesiones morales)—she argues—the principles of rational sound judgment (sana crítica racional), common sense, and experience must be applied, and evidence must be considered, which in this case—in her view—was not suitable, because the individuals “produced it among themselves” (b.1), and because the note sent by her and a mere copy concerning purported psychological care were submitted, neither of which has the character attributed to it by the Court (b.2); and C) the non-pecuniary harm was claimed by virtue of their status as shareholders of the company that owns the properties, not because they inhabited them.
The three claims presented shall be considered in the order dictated by the consequences they have for the judgment (as will be explained): point C shall therefore be resolved first because, although not expressly stated, it concerns an alleged inconsistency (incongruencia) regarding the non-pecuniary injury; then point A, concerning the lack of reasoning for the amount awarded; and lastly point B, concerning the failure to prove that harm. For now, suffice it to say that, pursuant to mandate 150 of the CPCA, nullity due to procedural defects (vicios procesales) produces, as a matter of principle, the remand of the case file to the Court so that it may issue the appropriate judgment; whereas, in the case of substantive defects (vicios sustantivos), the cassation court must decide the proceeding in that same ruling. Hence the order in which this decision is issued.
X.As stated, Constructora San José – Caldera alleges that the individual plaintiffs sought non-pecuniary damages in their capacity as shareholders of Constructora Guter Martini S.A.; however, the Court awarded them because they inhabited that company’s properties (point C). The appellant further asserts that, at the closing-arguments stage, the plaintiff, “to set the wrong right,” invoked an “association without legal personality” as the standing underlying the cause of action (causa petendi) for non-pecuniary harm, when the proper course was to invoke the situation established in article 10.4 of the CPCA. The appellant in cassation is incorrect. As indicated in recital IV (considerando IV), the congruence of a judgment (congruencia) is the consistent relationship that must exist between the ruling in its operative part and the claims and defenses asserted by the parties, which are in turn delimited by the law and the factual allegations, particularly those in dispute.
The circumstantial basis of the framework of claims therefore limits the dispute and the decision, without detracting—of course—from the scope of the principle of material truth (principio de verdad real) that informs contentious-administrative procedural legislation and the sua sponte rulings (pronunciamientos oficiosos) permitted by the relevant Code. In this case, it is apparent that, from the complaint onward, the plaintiff alleged the existence of a non-economic injury (lesión extrapatrimonial) of a non-pecuniary nature, based both on share ownership and on residing in and occupying the houses located on the properties. Thus, the complaint stated: a) that the individual plaintiffs inhabit the properties belonging to Constructora Guter Martini, which are their family homes, and have “deep roots” there because the Irías family—to which they belong—has resided on those lands for five generations (second fact); b) that these individuals are shareholders of that company (fact and third); c) that two dwelling houses are located on the lands (fourth fact); d) that the landslide “(…) gravely, irreversibly, and irreparably affected the two properties (…), thereby affecting the entire lives of all of us and the assets of Constructora Guter Martini S.A. (…) Currently, that landslide is 18 linear meters from one of our homes and 25 linear meters from the other residence.
At this time, the cracks closest to our homes are approximately 9 and 10 linear meters away (…)” (emphasis added, eighth fact); e) that Maylin, Juan David, and Juan Manuel moved to a furnished dwelling rented to them by one of the defendant companies, which caused them mental, family, and social distress; that they do not know what will happen to their actual residence; that they cannot sleep at night because of uncertainty concerning their home; that they are afraid because they left part of the family at the site; and that in February they also discovered the theft of belongings that had been in the dwelling, all of which compelled them to obtain psychological care (twelfth fact); and f) that José Martín, Adilza, and Maciel did not accept Constructora San José – Caldera’s proposal because, despite the fear and risk involved in living at the site, they believe that if they abandoned it, it would soon be stripped, which has compelled them to obtain psychological care (thirteenth fact).
In its legal grounds, the plaintiff stated: “(…) each and every one of the individual plaintiffs is a shareholder of that company, which operates, as explained, as a ‘family corporation.’ The provision of article 9 subsection b) is fully applicable here regarding groups and associations without legal personality whose legitimate interests are affected, even without the need for them to be organized into formal legal-person structures (…) In our case, we have full standing as plaintiffs (legitimación activa), because we have possessed those lands for many years, having inhabited the affected lands for five generations of the Irías family. Furthermore, we are the persons who have been dispossessed of our lands. As a result, our legitimate interests and individual rights (derechos subjetivos) have been affected. Indeed, it was to us that one of the defendant companies offered relocation. We, the individual plaintiffs, are (…) those who have suffered the non-pecuniary harm caused by the actors” (emphasis added, appearing at folio 21).
Consequently, contrary to the appellant’s argument, the Court clearly did not exceed the scope of the claims by awarding non-pecuniary damages based on the fact that José Martín Irías Hernández, Adilza Murillo Blanco, Maciel and Maylin, both Irías Murillo, and Juan Manuel Víquez Quesada resided in the dwellings located on Constructora Guter Martini’s properties, since relief had been sought on that very basis since the complaint. Therefore, the claim identified as point C) must be denied.
XI.With regard to the alleged lack of reasoning for the amounts awarded (point A), the following should be noted. This Chamber has repeatedly held that the reasoning of a judgment consists of setting forth or making clear the factual and legal reasons or grounds supporting the decision. Its absence is recognized in two situations. The first is nonexistence, namely, when the adjudicator fails to state the foundations of the decision. The second arises when the decision-making body’s reasoning is confusing or contains contradictions of such magnitude that they prevent the grounds on which it is based from being clearly ascertained. In the case at bar (sub júdice), the Court determined that the event affected everyone equally. It found that the copy of the psychological report reflected the impact caused by the landslide and showed that they received treatment. It considered that the note delivered by Constructora San José – Caldera and the recommendation that they leave their homes as soon as possible constituted news that disturbed their state of mind and psyche.
The cracks, subsidence, displacement, and sinking of the ground, it continued, are objective facts demonstrating the magnitude of the event and suggesting a danger to the persons’ physical safety. It explained that the other note from October 2009 also caused concern among the residents because it reflected uncertainty as to whether they could remain at and be present on the site; they were informed that work was underway to determine the landslide’s present and future condition, which added to their concern and uncertainty. It further found that the family unit had been disrupted by temporary separation when they left the place where they lived. It continued: “In José Martín’s case, he said that he witnessed the landslide, although his wife and children or son-in-law did not say the same. The latter did temporarily leave the house they inhabited, moving elsewhere for one year in response to the construction company’s offer, but they later returned.
That uprooting and separation of the family group warrants consideration. Moreover, this couple and their children occupied the house that sustained visible damage and is located closer to the landslide area, all of which exacerbates their distress. Maylin referred to an incident involving her minor child, explaining that she must ensure that he does not approach the subsidence, for obvious reasons concerning the risk of accidents. In light of the foregoing, the Court is inclined to set the non-pecuniary damages sought, on an equitable basis (en forma prudencial), at three million colones for José Martín, Adilza, and Maciel, and five million colones for Juan Manuel and his wife Maylin. These amounts shall be adjusted for inflation once the judgment becomes final and until extinguished by payment.” As is apparent from the foregoing account and quotation, the Court initially determined, as its basis, that each of the individual plaintiffs—José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo, and Juan Manuel Víquez Quesada—had suffered a non-pecuniary injury.
It then assessed the particular impact suffered by some of them. It thus considered Maylin, Juan Manuel, and their child’s departure from the house, as well as doña Maylin’s concern for the minor. On the basis of those considerations, the Court established that the compensation for Martín Irías Hernández, Adilza Murillo Blanco, and Maciel Irías Murillo should be ¢3.000.000,00, and that for Maylin Irías Murillo and Juan Manuel Víquez Quesada should be ¢5.000.000,00. Therefore, argument A) under the ground asserted must be rejected, because the Court did state the reasons for its determination.
XII.In point B) of the ground for review, Constructora San José – Caldera argues that, when awarding compensation for non-pecuniary injuries, the adjudicator must rely on the evidence and rational sound judgment (sana crítica racional). It further alleges that, in the present matter, the plaintiff produced the evidence in its favor and that the letter it submitted and the alleged psychological care do not possess the significance attributed to them. The claim must be denied for the following reasons. The allegation does not fall within the defect of inconsistency (incongruencia), nor does it identify any other procedural error. It challenges the failure to observe the rules of sound judgment (sana crítica) in assessing the evidence—as it states—and the facts—as must be added—which, strictly speaking, is properly raised as a ground based on the violation of substantive rules. Moreover, given the failure to specify the basis, this Chamber cannot examine the allegation as a substantive defect, insofar as it does not identify any substantive rules that were violated.
It must therefore be rejected. Notwithstanding the foregoing, and for the purpose of clarifying the matter for the appellant, it should be noted that this Chamber has stated on various occasions that subjective non-pecuniary harm (daño moral subjetivo) is assessed “in re ipsa”; that is, it depends on the adjudicator’s evaluation, based not on specific evidence but on indicia and the factual circumstances themselves, from which an impairment of the individual’s non-pecuniary sphere is logically inferred. Harm of this kind does not require direct proof; rather, the adjudicator must logically infer it—it bears repeating—from the established facts, through indicia and rational inferences. In other words, its recognition and assessment for compensation purposes are subject to the prudent judgment of the decision-making body. Consequently, it does not require analysis of specific items of evidence, because it involves logical deductions and the judge’s own experience.
Thus, the first point to be made is that, in the case at bar, the non-pecuniary damages awarded and the amounts granted are a reasonable inference from the circumstances proven: the landslide, the impact on the land and homes, the family separation, and the letters signed by Constructora San José – Caldera. Logically, that entire situation caused—as the Tribunal correctly noted—uncertainty and concern. The reference to the psychological report is merely one additional element demonstrating the effect on the individuals’ emotional state, but it does not determine the non-pecuniary harm. Lastly, it is necessary to note briefly that the non-pecuniary injury awarded here differs from psychological injury per se, which necessarily requires a psychological expert opinion (dictamen psicológico) in order to be established and compensated. In the present matter, compensation was not sought under this head—psychological harm—and it was therefore neither assessed nor awarded in the judgment. As for the letters they received from the company, this Chamber agrees with the Tribunal that they clearly created a state of uncertainty.
Cassation based on substantive violations
XIII.First. Constructora San José – Caldera—in the third ground of its appeal—alleges an indirect violation of provisions 702 and 1045 of the Código Civil due to failure to observe article 82.4 of the CPCA. It states that, according to the Tribunal and the expert evidence (prueba pericial), the large-scale landslide was caused by excavation of the land, which lowered the grade, cut into the base, and geologically destabilized cerro Pan de Azúcar. It disagrees, because in its view experts Laporte and Gómez Bonilla stated that the landslide originated from an unforeseeable event in “a geologically stable zone.” It asserts that expert Juan Guillermo Guzmán Alpízar made no serious contribution, since his conclusions “are not the product of fieldwork or of examining the supporting documentation that he should have assessed and studied in order to reach a professionally sound conclusion”; experts Laporte and Gómez discredited him by stating that it is impossible to determine the causes of the displacement merely by observing the land, without requesting or reviewing the plans and the reference and preliminary studies.
Nevertheless, the Tribunal relied almost entirely on this professional and did not assess the contributions of the other two experts. It emphasizes that Mr. Guzmán proceeded from an unscientific presumption—namely, that because he resides in the area, he knows it very well and therefore did not need to conduct a study or fieldwork. It states that the other experts did conduct fieldwork and verify the information. It stresses that Mr. Edwin Moya Solano has expertise in road construction and that his expert report was limited exclusively to assessing the grade, indicating that the landslide had stopped, based on the 1980 MOPT reference plans, the construction-project plans, and the remedial plans; thus, he contributed nothing regarding the cause of the landslide. The Tribunal, however, inferred other elements from that expert report to justify the causal relationship (relación causal) between the earthworks (movimiento de tierra) and the displacement of the land.
In its view, the determination of the causal link (nexo causal) must be analyzed through the reports of Mr. Gastón Laporte Molina, an expert witness (testigo perito), and Manuel Gómez Bonilla, a geological expert (perito geólogo), because both are highly qualified and their opinions, far from conflicting, were complementary. It emphasizes that neither was able to determine the cause of the landslide. It explains that the former referred to a combination of three factors—water, cutting, and soil conditions—as well as local effects such as paleosols or features that are not visible when the land is inspected without any cutting. He also indicated that hydrogeological studies and boreholes had been carried out for the project, showing that there was a layer of soil followed by rock. He further stated that there were large upright trees, rather than leaning trees, and that no cracks were visible in the land, which, when combined with the boreholes and cut slopes, showed no problems.
It continues that don Manuel Gómez stated categorically that he did not know the cause of the landslide and proposed hypothetical scenarios regarding possible causes, but was unable to determine it. Both experts, it asserts, described a situation of unpredictability, because preliminary studies were conducted and reference studies were available to establish the characteristics of the land and determine what works would be carried out and how. It therefore concludes that it did not act rashly or in breach of its duty of care (deber de cuidado), nor was it negligent or reckless; rather, it acted in accordance with the studies required for such cases under road-construction industry standards, and those studies did not indicate that the land presented an evident risk of failure. It argues that the Tribunal’s assertion that a specific, dedicated study of cerro Pan de Azúcar was indispensable before undertaking the earthworks is contrary to the rules of sound judgment, particularly common sense and the science applicable to this industry, because, as engineer Laporte stated, “in this field it is extremely difficult to predict everything; there is an element of unpredictability and a limit to investigation in linear projects; there comes a point when further investigation does not reduce unpredictability, and one cannot seek to achieve zero risk because zero risk does not exist.” It infers from all the foregoing that an unforeseen instability occurred and that Constructora immediately proceeded to implement a comprehensive solution with the assistance of experts such as Dr. José María Rodríguez Ortíz and the firm Insuma, selecting the former’s solution and stabilizing the slope.
It asserts that all agreed that the land had been stabilized and is currently stable, as shown by the photographs. Don Manuel Gómez indicated that the vegetation is characteristic of land with no risk of landslide and that there is no propensity for landslides in the event of an earthquake because a stable angle was achieved; don Gastón stated that the land was left in better condition than before the landslide. It concludes that no efficient cause (causa eficiente) can be inferred with certainty from the evidence and that article 1045 of the Código Civil was therefore violated, because the causal link was not established and, consequently, there is no compensable harm. It alleges that provision 702 ejúsdem was disregarded because this was an act of nature for which it cannot be held responsible, caused by unstable soil prone to landslides and failure, thereby giving rise to the defenses of force majeure (fuerza mayor) and fortuitous event (caso fortuito).
XIV.Based on the technical and testimonial evidence received, as well as the conduct of Constructora San José – Caldera, the Tribunal found it proven that the excavation of the land, which lowered the grade where the highway was being built, cut into the base and geologically destabilized cerro Pan de Azúcar, causing a large-scale landslide that severely, irreversibly, and irreparably affected the properties. It found that Constructora San José – Caldera’s expression of concern to the plaintiffs and its recommendation that they leave, with the company assuming payment of the rent, denoted the existence of a “relationship whose source transcends altruistic motivations to provide assistance at its own expense and is rooted in a sense of responsibility for its own actions.” It continued that the geologist Guzmán Alpízar stated that “the cause of the landslide lies in the earthworks (movimiento de tierras) performed at the base of the slope, in the work carried out for construction of the highway, and he ruled out a natural cause; he warned that the collapse would not have occurred on its own; that before the event, the land was stable; that the event was preventable and no technical measures were adopted to prevent it; that the required studies were not performed; that there is a landslide at the site, not a fault; he also stated that it is possible to build anywhere, provided that investments are made in analysis and design, which entails very high expenditures that sometimes make the project unfeasible.
It is true that the expert based his assertions on a surface-level observation of the site, his knowledge of it, and what he observed during his visit, but this does not mean that his conclusions may be disregarded, rejected, or set aside, since he also stated that he is a professional with knowledge and experience in the field of geology. This qualification gives his account a weight that prevents it from being rejected outright.” The Tribunal asserted that the foregoing was corroborated by Mr. Gastón Laporte, who stated that the landslide was caused by a combination of factors: soft ground, a watercourse, and the cut, with the cut acting as the triggering element that disrupted the existing equilibrium. Likewise, it said, Mr. de la Torre Lozano stated that the cause of the slope instability may be associated with unstable materials, conditions related to water levels, land-use changes (cambios de uso de suelo), and alteration of the topography.
Thus, it concluded, “the effective cause of the landslide or mass movement was the concessionaire’s intervention through acts performed in the execution or construction of the project; that is the element that triggered the rotational movement. Notwithstanding the particular characteristics of the soil and water composition, the fact remains that the company’s participation—its intervention at the site through construction of the highway—was the element that caused the soil to break away.” It added that the expert Laporte Molina stated that: there was no hydrogeological study for section 33+500, but rather a generic one; there was no evidence that the land in the area was unstable; a landslide was not foreseeable; no additional investigation was conducted, and the work was instead performed using the available information; and the recommendations were generic, not specific to section 33+500.
It further found that the witness de la Torre stated that no specific hydrogeological study was conducted for the slope in the section at issue, but that such a study was not conducted until after the landslide, in order to begin the mitigation work. It continued that the expert Gómez Bonilla explained that “Before beginning construction of a project such as route #27, slope-stability analyses must be conducted under zero-state conditions [beforehand] and with the proposed project incorporated, in order to determine the impact it would have from a geotechnical and geological standpoint. This requires investigation to ascertain, in addition to the geotechnical parameters, the geology, the location of the water table, if any, the frequency and intensity of seismic events, etc.; that in the section between PK33+000 and PK34+000, very good slope-stability studies were conducted after August 2009, when the landslide event occurred, but he does not know whether any such study existed before construction of the project; geological mapping should have identified the existence of a significant thickness of weathered rock and the presence of a water table, as evidenced by the existence of springs (nacientes) in the upper part of the slope; under these circumstances, had a slope-stability analysis existed, it would have revealed the natural stability under zero-state conditions and, when the cuts required to construct the project were applied, it would have been readily apparent that the cut would cause instability because the existing geological conditions did not permit removal of the natural support or alteration of the slope angle.” He concluded by stating: “It is evident to me that either no prior studies (zero state) were conducted at the site analyzed or, if they were conducted, their results were disregarded, because had they existed, the geological and geotechnical conditions and the surface manifestation of the water table would have required no further evidence to ascertain the existing slope’s vulnerability to changes in gradient, support, etc., and the formation of the landslide could therefore have been avoided.” (report (sic) at folios 497 to 502, Volume I of this file).
During the trial hearing, he reiterated that the documentation reviewed did not include hydrogeological studies for the area or structural analyses; he clarified that such studies are conducted beforehand to prevent masses from sliding and to prevent or minimize a landslide.” In this manner, it concluded that the co-defendant companies failed to conduct all the preliminary studies required for construction of the project, including hydrogeological studies and structural analyses for the specific area. Additionally, it found that, according to the expert Edwin Moya Solano, Constructora’s engineers were obligated to depart from the reference studies and that the design deteriorated. It thus established that the defendant companies had failed to adopt “the necessary precautions to prevent landslides such as the one underlying the complaint.” Lastly, it determined that “the damage was indeed foreseeable if the corresponding studies had been conducted, and subjective fault, based on a lack of diligence, may therefore be found.
The damage was caused by the failure to [foresee] the consequences of their own acts in carrying out the project. Although the co-defendants have argued in their defense that serious studies were conducted in the area, citing certain appendices in this regard, the fact remains that those studies and appendices are generic and date from 2006; specific studies for the area were conducted only after the event. Accordingly, that argument cannot be accepted.”
XV.First, for purposes of clarity, it must be noted that in this matter the plaintiff and Autopistas del Sol requested the appointment of an expert geologist (folios 58 and 105), for which Mr. Manuel Gómez Bonilla was appointed (folio 409). In addition, Autopistas del Sol requested an expert civil engineer (folio 105), and Mr. Edwin Moya Solano was appointed to that position (folio 574). At the third part of the single hearing, held on 8 de abril de 2012, Mr. Guillermo Guzmán Alpizar was admitted as an expert witness (testigo perito); in this regard, the presiding judge of the Tribunal stated: “he is the professional who signed section 36 in the evidentiary file; it considers substitution appropriate in the sense of what the parties have been indicating, namely, that he is a professional or technician who issued precisely one of the documents being challenged and will allow that evidence to be subjected to adversarial examination.
Therefore, from that standpoint, we deem it appropriate and admit Mr. Juan Guillermo Guzmán Alpizar as a witness (…)” (audio and video file 11:04:00). In response to the motions for reconsideration (recursos de revocatoria) filed by all the defendants, she stated: “(…) indeed, as to documents that have been paid for by the parties, that would be a rule that would make it nearly impossible for a jurisdiction as specialized as this one to receive other types of documents, not only in this case, but in all others, in any other case; in many other cases, witnesses or even experts retained by a party and paid by that party, as is understood and as the Tribunal understands it, have been admitted, and that is why the evidence is assessed under the rules of sound judicial discretion (sana crítica). Therefore, from that standpoint, the fact that a professional was openly paid to appear and render an opinion—whether by the plaintiffs, the co-defendants, or anyone else—is not, I repeat, sufficient grounds to exclude evidence because, I repeat, it will be assessed under the rules of sound judicial discretion.
Most importantly, and what leads us to maintain the decision we made, is that the parties are instead being afforded the opportunity to subject to adversarial examination one of the documents that was precisely among the grounds for their objection to the documentary evidence we admitted a few moments ago. Thus, what motivates the Tribunal is instead an effort to facilitate that adversarial examination, so that the parties have an opportunity to address the matter, question the person being proposed, and introduce additional elements for adjudication into the proceedings.” It was clarified that he was being received to address facts 7, 8, and 15 and the document he had prepared. At the same hearing, the testimony of Messrs. Gastón Laporte Molina and Germán de la Torre Lozano, a geologist and civil engineer, respectively, was admitted into evidence; on that occasion, the parties offering the evidence—the attorneys for Autopistas del Sol and Constructora San José – Caldera—specified that both professionals had participated in the mitigation process and the project’s construction process.
In summary, testimony was received from Guillermo Guzmán Alpizar, Gastón Laporte, and German de la Torre, and expert opinions were rendered by the engineers Manuel Gómez Bonilla and Edwin Moya Solano.
XVI.That said, and as the dispute was framed in the complaint and the answers thereto, it is clear that expert evidence (prueba pericial) is essential in this matter for determining the cause or causes of the landslide (deslizamiento). As recounted in the preceding recital (considerando), two professionals were appointed as expert witnesses (peritos). The report of the expert geologist Gómez Bonilla consisted of three documents: the initial report, which he subsequently supplemented on two occasions in response to the questions raised by Autopistas del Sol. In the first document, Mr. Manuel Gómez Bonilla concluded: “It is clear that a spoon-shaped landslide occurred, caused by the removal of the base supporting the natural slope (talud natural) when the grade line (rasante) of the San José – Caldera highway was cut, affecting the Plaintiffs’ properties, with the crest of the landslide located very close to the existing structures on the properties” (folio 433, underlining and boldface added).
In the supplement to this report (octubre de 2011), he stated that “between PK 33+000 and PK 34+000, very good slope-stability studies (estudios de estabilidad de taludes) were conducted after agosto de 2009, when the landslide became evident, but I do not know whether any such study existed before construction of the project (…) Under these circumstances, had a slope-stability analysis been conducted, the natural stability under baseline conditions (estado cero) would have been observed, and when the cuts required to construct the project were applied, it would have been very evident that the cut would cause instability because the geological conditions present would not allow the natural support to be removed or the angle to be changed. [.-] In accordance with the foregoing reasoning, either no studies were conducted before construction of the project (at the referenced analysis point), or, if they were conducted, they were disregarded” (folio 499).
He concluded: “It is clear that the work performed (studies and fieldwork) after the landslide appeared in agosto de 2009 was appropriate and highly effective, in accordance with good practice, in stabilizing the mass, as we can observe in the field after it withstood a rainy season (…) It is evident to me that either the prior studies (baseline conditions) were not conducted at the site analyzed or, if they were conducted, their results were disregarded, because had they existed, the geological and geotechnical conditions and the surface manifestation of the water table would have required no further evidence to identify the vulnerability of the existing slope to changes in gradient, support, etc., and the formation of the landslide could therefore have been avoided. [.-] It is also clear that the geological condition did not prevent the current slope from being stabilized, which means that mass movement (movimiento de masas) could have been minimized or avoided by performing the works beforehand and applying measures such as those applied (sic) after agosto de 2009 (…)” (folios 501 a 502).
In the second supplement and clarification of his report (abril de 2013, appearing at folios 1058 a 1065), when asked whether the studies contained in annexes 3, 4 and 5 were serious technical studies for determining slope stability in the geographic area encompassing, among others, PK 33+000 and PK 34+000, he stated: “Yes, of course, the studies submitted in Annexes 3, 4 and 5 are serious studies conducted in 2006 by INSUMA S.A. to consolidate the existing information and provide recommendations for defining the cuts and fills to be made along the San José-Caldera highway, principally in section II (Ciudad Colón-Orotina). [.-] Of the studies reviewed and analyzed by INSUMA S.A., 99% were basically geotechnical; only one hydrogeological study conducted for the Environmental Impact Study (Estudio de Impacto Ambiental) is cited. [.-] Since the studies conducted by IMSA S.A. in 1999, 18 areas or sections of the corridor were identified as having particular conditions requiring differentiated treatment, and these were likewise retained by INSUMA S.A. in its reports. [.-] In accordance with good practice, in addition to the geotechnical information, the hydrogeology of each of these particular sites or areas should have been analyzed comprehensively in order to define more reliably the slopes of the cuts to be made; however, only a few references are made to the occurrence of artesian aquifers (Si quiares-Río Grande intersection section), and nothing is mentioned regarding the remainder of the section. [.-] Likewise, the study should have been supplemented with a structural analysis of the entire corridor, and the reports reviewed do not mention that any such analysis was conducted (…)” (folio 1059).
When asked whether it was possible to determine the cause of the landslide from the existing information, he stated that, based on the available information, he had been able to “identify certain causes that could explain the occurrence of the event in section G, known as Pan de Azúcar. [.-] 1. To determine the stability parameters of a cut, a basic field observation is to examine the natural slopes in the specific area and its surroundings where similar geological conditions exist. General gradients of 38 -42 degrees are observed in subarea G. The current gradient of the landslide area, following its stabilization, falls within this range. [.-] 2. In the studies conducted by IMSA S.A. in junio y Julio 1999, section G is defined as 31+500 – 33+000, and two subareas corresponding to the contact between two geological formations are identified. In subarea 31+750 – 20+050 (ignimbrites), a slope cut with an angle of 76 degrees (1/4h-1v) is recommended for the rock and 53 degrees (3/4h-1v) for the soil.
In subarea 32+290 – 32+750 (weathered lava, the area of the plaintiffs’ property), a single slope of 53 degrees is recommended, and it is explained that the slope consists of colluvial material. [.-] 3. In the studies conducted by INSUMA S.A. in 2006 (Annex 3), section G is defined as 31+500 – 33+000. In Annex 4 (Table A5.1. Recommended geotechnical solution for cuts in section II, page 47), section G is defined as 31+540 – 31+580 and 32+000 – 32+300 (Figure 1). In Annex 5 (Table A-1. Recommended geotechnical solution for a cut in section II, page 13) (sic), section G is defined as 33+065 – 33+105 and 33+525 – 33+825 (Figure 2). Both tables identify two subareas; both are geologically described as the contact between ignimbrites and Aguacate lava (highly weathered rock), and the same slope amgle (sic) of 76 DEGREES (1/4H-1V) is recommended for the rock in both subareas, without considering the difference in the geological conditions of the subareas initially noted in the IMSA S.A. reports (1999).
(…) 5. The (sic) annexes 4 and 5, in the introductory note, define the specific solutions for the cuts and fills in section II (Ciudad Colón-Orotina), in the sectors where significant support measures must be undertaken. If we assume that the slope design presented in Table A5.1 of Annex 4 and/or Table A-1 of Annex 5 was applied during construction of the highway, specifically for section G (Pan de Azúcar, the area where the Plaintiffs’ property is located), an error was made in defining the slope parameters at an angle of 76 degrees (for the rock), and the original recommendation of IMSA S.A. (1999), which specified a single slope of 53 degrees, very similar to the 38-42 degree gradients currently found on the natural slopes in the area, was disregarded” (folios 1060 a 1062, underlining and boldface not in the original). Autopistas del Sol had requested that he answer whether, given the soil conditions, any other human or natural phenomenon could have caused the landslide without the earthworks (movimiento de tierra), to which the expert replied: “Given the natural condition of the terrain, which maintains a general angle of 38 – 42 degrees, very close to the 36-degree angle of repose of loose material (sand), it is highly likely that human activity involving ordinary use and/or the natural forces known at this time are not significant enough to be regarded as the cause of the landslide.
Natural forces act on the terrain over time and shape a stable slope with parameters defined by the conditions of the different variables involved (type of rock, structure, % moisture, earthquakes, etc.)” (folio 1063). He concluded: “Based on the investigation conducted, I must conclude that many studies were performed, with extensive detail concerning the most complex areas, as shown in the reports analized (sic), in order to characterize geotechnically the Route 27 corridor, principally section II, Ciudad Colón – Orotina. [.-] I must note that the information reviewed does not mention that any other studies were conducted to supplement the geotechnical information (hydrogeological, structural), specifically in the area of section G (Pan de Azúcar), where structural features are known to exist that should have been included in the analyses. (…) As a corollary, if the design prepared by INSUMA S.A., as presented in Tables A5.1 and/or A-1, was applied to the specific construction of the slope in the area of the plaintiffs’ property, that would be the cause of the landslide, because the resulting slope would have erroneous parameters that would not satisfy the definition of a stable slope” (folio 1065, underlining and boldface added).
During the single hearing (audiencia única) (fifth part, held on 28 de mayo de 2013), in response to questions from counsel for the plaintiffs, Mr. Manuel Gómez Bonilla stated that he had visited the area and reviewed the information in the case file (expediente), had confirmed the existence of a landslide that was stable, that effective mitigation works had already been performed, and that the slope had a stable angle; he said that in his first report he had recommended erosion-mitigation works. Counsel for the plaintiffs continued the examination: “Do you know the cause of that landslide? [expert geologist] The cause of the landslide, in my judgment, I do not know, but I can provide—and my report does provide—an explanation of what I believe it could be, because I do not know how they constructed the slope; what I know is the information contained in the case file, and I based my opinion on that.
In my view, when geotechnical studies were conducted in that specific area, the company that performed those studies determined a slope angle for that type of rock in that specific area, which they call section G. The company that performed the studies determined that there is a contact between two types of rock there, and it therefore specified two types of slope. For one type of rock, which it identified as ignimbrite, a fairly competent rock that supports slopes at steep angles, it determined that the slope should be ¼ to one, which is approximately a 78-degree gradient; and in the other part of that same section, on the other slope involving another type of rock, it determined that a slope of ¾ to one, which is approximately 56 degrees, should be constructed. In the information I reviewed, another company subsequently took the information that had been generated (and it is clear that it did not generate information, but rather analyzed the existing information and issued recommendations for constructing the slopes).
In that information, it applies, or at least recommends, for the slope in that area the design for the ignimbrite area, rather than the design for the weathered-lava area. Therefore, in my judgment, if that was what was used—I do not know whether that was the design they used—but if it was used, that would, in my view, be the cause of the landslide, because they would have constructed the slope at an angle that was inappropriate for that type of rock.” He further described that, because of the tilting of the terrain, there were leaning trees.
He explained that Imsa was the company that conducted the geotechnical studies for the area, which Insuma subsequently consolidated in 2006, and that it prepared a slope design; he identified Mr. Gastón Laporte as the professional responsible for Insuma. He was asked whether he knew if hydrological and hydrogeological studies had been conducted for the construction of the highway; he stated that, based on the information he reviewed, there were no hydrogeological studies on record for that area, nor was there any mention that such studies had been analyzed. Counsel for the plaintiff continued the examination: “Were the angles of the designs and preliminary designs that you were able to analyze, which (…) were prepared and designed first by Imsa and later by Insuma, appropriate for that type of situation? [Geologist expert witness] I could not answer that, because those angles are based on geotechnical studies that I did not conduct; to determine whether they were appropriate, I would have to conduct geotechnical studies and analyze them. [Counsel] Are geotechnical studies necessary in order to prepare those designs? [Geologist expert witness] Of course they are; it is necessary to conduct stability studies of the slopes that will be cut. [Counsel] Can a design for an area—a design like that—be prepared on the basis of a geotechnical study conducted hundreds of meters from the site? [Geologist expert witness] In my opinion, I would think that if the area is known and the geological area is the same, the information can be extrapolated; now, it all depends on the professional who is designing and using the information.
It is for that professional to determine whether to do so or whether to conduct a study at each site to be designed (…).” Subsequently, counsel for Autopistas del Sol questioned him about his answers in the addendum to the October 2011 report, question c, concerning his statement that studies had been conducted after August 2009 and that he did not know whether any had been conducted before construction of the project; he clarified that, for that report [of October 2011], he reviewed the studies in the case file, which postdated the landslide (deslizamiento). Counsel continued: “Based on those statements you made in that report, my client asked you to provide written clarification and posed the following question: are the studies contained in annexes 3, 4, and 5 (…) sound technical studies for determining slope stability in the geographical area encompassing, among others, PK 33+000 and PK 34+000 [question a) at folio 1059], and in your report of 10 de abril de 2013 [counsel read (only) the first paragraph of the answer] (…) do you maintain the opinion expressed in October 2011, in the previous report, that the prior geological and geotechnical studies considered appropriate under good practice were not conducted? [Geologist expert witness] At that time I did not know whether they had been conducted, (…); now, these studies in the annexes that you subsequently provided to me obviously predate the landslide and are sound studies. [Counsel] (…) Even with those studies 3, 4, and 5, was the landslide foreseeable? [Geologist expert witness] Studies are always conducted to prevent a landslide; obviously, in order to prevent an area that will be affected by a cut from sliding, all the interacting parameters must be known so that it can be modified.
Now, is it foreseeable that it will slide? Whenever a design is prepared, it is intended to prevent sliding, so I think that if one designs it so that it will not slide, then it would likewise be foreseeable, precisely because one is doing so to prevent it from occurring; if you want to do it that way, you can equally design it so that it does occur. [Counsel] Then, in your opinion, were those studies in annexes 3, 4, and 5 conducted to prevent a landslide? [Geologist expert witness] I think the people who conducted them are serious professionals and that this is the objective when conducting such studies. (…)” The engineer clarified that an “inferred fault” (falla inferida) is one in which a section of the fault has been established and the remainder is projected; it may or may not exist and is presented as an open question. He explained that when he mentioned the La Garita fault at the foot of the slope, it was a marginal note “because, in my opinion, it is not the Garita fault, but any other fault.
What I meant to emphasize was that publicly available information contained structural information and that, in the information I reviewed, I saw no mention of any structural analysis of the slopes that were designed; that is, structural-analysis information was not incorporated. I did not mean the Garita fault specifically, because I have not located it and what exists is a projection; if one wished to undertake the work, an investigation would have to be conducted in order to locate it. That particular fault does not necessarily have any relationship, or it might (…). I included it as a warning that it exists; in Costa Rica there are faults generally—countless faults (…)—which is why that type of structural analysis must be incorporated into slope-stability analysis. Now, in this instance it was a warning that the fault trace existed; I placed it there, very close, at the foot of the slope (…).
Here, instead, they are placing it along this trace somewhat north of the area, but it is a projected trace that they could readily alter, and if someone verifies it, they could redirect it elsewhere. In other words, that is what my annotation meant: this type of study must therefore be incorporated into slope-stability analysis.” He likewise reiterated his report, stating: “In the report prepared by Imsa, they identified two types of rock in this same area G. They determined that the contact between two types of rock was located at that site: ignimbrites and what they called weathered lavas. The designs presented here specify a slope of ¾ to 1, which is approximately a 56-degree inclination for the soil cut; when the cut reaches the ignimbrites, a slope of ¼ to 1 is specified, which is approximately 78 or 79 degrees. In the area of weathered lavas, Imsa determined that the ¾-to-1 slope they had designed for the soil was the same one that should be used for cutting the weathered lavas; that is, they defined a single slope for the entire cut.
The design shown here uses the same slope for both areas, hence my observation that, for some reason, they changed the design. [Counsel] Do you know the reason? [Geologist expert witness] I do not know why they changed it. [Counsel] Can the reason be inferred? [Geologist expert witness] It cannot be inferred. Now, in my opinion, when Insuma prepared its reports, it made clear that it had not generated new field data; what it was doing was reviewing, compiling, and consolidating all the information from the geotechnical studies, to put it more plainly. That is why I stated that the party that performed the fieldwork defined one slope, and when the designs were prepared or presented—I do not know whether they were preliminary or final—the slope angle was changed. (…) [Counsel] Based on the documents you reviewed, do you know whether those slope-cut designs were the ones implemented, carried out, or executed? [Geologist expert witness] No, I do not know.
I analyzed the ones presented to me; from this, I do not know whether they were final or preliminary, whether they were implemented, or what was implemented. (…).” Counsel for the State again asked him about answer a in the second supplemental report and proceeded to read the paragraphs, in response to which the professional explained that hydrogeological studies address matters such as the water table, springs (nacientes), and the factors that may affect slope stability, which must be known when preparing the design. Structural analysis—he specified—concerns faults and fracture zones and must likewise be conducted; it is an integral part of the variables that may affect the slope. He reiterated that these studies must be conducted beforehand, that they must form part of the slope-design analysis, and that they were not included in the information presented to him. On the other hand, with respect to the expert opinion of civil engineer Edwin Moya Solano, as the appellant in cassation correctly notes, it concerns the variation in the road grade (rasante) between kilometers 33 and 34 of the highway (folio 588), not the cause of the landslide, and is therefore irrelevant to that determination.
XVII.As stated in recital (considerando) XIV of this decision, the Court based its determination regarding the cause of the landslide on the testimony of witnesses Guzmán Alpízar, Laporte Molina, and de la Torre Lozano, as well as on the statements of expert witness (perito) Gómez Bonilla and a brief reference to the finding made by expert witness Moya Solano. As noted above (recital XVI), in the opinion of this Chamber, the conclusions of expert geologist Gómez Bonilla constitute the appropriate evidence for determining the causal link (nexo de causalidad) between the slope (talud) that was constructed, the works, and the 2009 landslide. The professional clearly stated that, although he did not verify which design was used, the designs prepared by Insuma in 2006 and provided to him, if they were the ones used, would have caused the landslide. He repeatedly stated this during his appearance, reiterating the findings of his report (particularly the April 2013 supplement).
It is evident—and logical—that the geologist’s visit occurred after stabilization and mitigation works had been performed; he did not participate in the construction and therefore cannot attest to the design used during the construction process. Autopistas del Sol’s questioning aimed at casting doubt on whether that design was actually used is striking, given that Autopistas del Sol itself provided it to the expert witness. Moreover, it is true that, at the hearing, the professional reaffirmed the report (the aforementioned supplement) insofar as it stated that the studies in Annexes 3, 4, and 5, conducted by Insuma in 2006, were sound. It should be clarified, however, that counsel read only the first paragraph of the response in the document, but not the paragraphs that followed, in which the engineer stated that 99% of the studies reviewed and analyzed by Insuma were essentially geotechnical (with the exception of a single hydrogeological study); and that, in his opinion, good practice required not only geotechnical information but also a comprehensive examination of the hydrogeology at each of those particular sites or areas, supplemented by a structural analysis of the entire corridor, which he did not observe.
He specifically stated that the studies were clearly sound and that the design was intended to prevent a landslide. In short, however, this Chamber understands that they were incomplete and that the purpose pursued by the design does not establish that the design itself was sound. In this case, the slope design submitted by Autopistas del Sol (and prepared by Insuma) was inadequate. The cut (corte) and the slope caused the landslide, as Mr. Gómez Bonilla determined in his report (folio 433). Accordingly, the appellant is incorrect in asserting that the expert geologist did not determine the cause. There was therefore no improper assessment of this evidence, which, it bears repeating, was the fundamental evidence. Consequently, this ground of appeal shall be dismissed. In addition to the foregoing, it is reiterated lastly that the expert opinion submitted by Mr. Moya Solano provides no information for determining the cause of the landslide.
XVIII.Second. Autopistas del Sol (in section H of its appeal) alleges the improper application and erroneous interpretation of legal rules. It explains that the Court identified two types of relationships: one among the State, the Consejo Nacional de Concesiones, and the concessionaire, and another between the concessionaire and third parties. The Court then determined that, in this case, liability rests with the concessionaire and Constructora San José - Caldera, subject to the rules and principles of Private Law, because, according to the legislature, those rules govern the external relationships arising from the concession agreement. In its view, this departs from the constitutional principle of administrative liability and constitutes an error, because it infers that the damage arose from a link or relationship among the concessionaire, Constructora San José – Caldera, and the plaintiffs, which is far removed from reality.
It specifies that the plaintiffs seek compensation for damage to their property allegedly caused by the construction project itself, which is a public work belonging to the State. Although the construction work is performed by private-law entities, it is confined to public areas—namely, the right-of-way (derecho de vía)—and is carried out under the State’s guidelines, direction, supervision, and oversight. The excavation occurred on State-owned land, not its own land; the claim arises from the construction work and not necessarily from its own particular conduct. It states that article 69.2 of the Regulations to the General Law on Public Works Concessions with Public Services (Reglamento de la Ley General de Concesión Obra Pública con Servicio Público) provides that the concessionaire shall bear sole liability for all damage unless it is attributable to the Granting Administration (Administración concedente) because of measures it imposed upon the concessionaire.
Clause 1.11.4 of the concession agreement provides likewise. In this case, as shown in the approved geometric design plans, which constitute the final geometric construction design plans for the project (sheets 27 and 28), the Granting Administration and the project supervisor, Imsa-Euroestudios, approved the construction designs between the stations corresponding to PK 32+800 and PK 34+200, which encompass the Balsa-Pan de Azúcar area. It is therefore clear that it was required to perform the works as authorized by the Granting Administration under that design “once the construction commencement order had been issued, since construction could not begin without those orders and/or instructions.” It insists that, under the concession agreement, approval of the design plans and the subsequent commencement order constitute orders and instructions from the Granting Administration that exempt it from subjective liability (responsabilidad subjetiva).
Through the oversight exercised by the Administration and the supervisor, it was determined and approved that the design plans for the Balsa-Pan de Azúcar area conformed to engineering practice and the relevant studies, specifications, and technical standards. Consequently, it performed the work in accordance with the obligations imposed by the Administration, and the exemption provided for in the Regulations and the agreement therefore applies. It cites judgment 5207-2004 of the Constitutional Chamber (Sala Constitucional). It continues that the General Law on Public Works Concessions with Public Services and its regulations, insofar as they concern the concessionaire’s liability to third parties, must be considered in relation to the legal relationship established or that may be established between the concessionaire and the third party. This, however, cannot exempt the State from potential liability when public administrations, in carrying out their public activities or duties, violate the rights of individuals.
It emphasizes that the State is always liable for damage and is required to compensate for unlawful injuries (lesiones antijurídicas) actually suffered by the governed party (administrado) as a consequence of the administrative function, whether through the acts or omissions of public entities or their contractors. It adds that, if the circumstances of the case permit, the concessionaire’s subjective civil liability may coexist, with respect to the injured third party, with the State’s strict liability (responsabilidad objetiva); likewise, the concessionaire may be exempted from liability while the State’s strict liability remains. It concludes that, in the present case, it should have been exempted and the existence of any direct strict liability on the part of the State should have been examined.
XIX.The Court stated that two public entities and two private entities are parties to these proceedings and are connected through the concession agreement for the San José – Caldera highway and the General Law on Public Works Concessions with Public Services (Ley General de Concesión de Obras Públicas con Servicios Públicos), no. 7762 (hereinafter, LGCOPSP). It held that internal liability (among the contracting parties) and external liability (the parties’ liability toward third parties) should naturally be determined in accordance with the pre-established rules. It reproduced clauses 1.3, 1.1, 1.2, and 1.11.4 of the agreement; the last of these provides that the concessionaire shall bear sole liability for all loss and damage of any kind caused to third parties, personnel, third-party property, or the environment as a result of the construction of the works or operation of the service, unless attributable to the grantor because of measures the grantor imposed upon the concessionaire.
It continued that article 18.f of the LGCOPSP establishes the concessionaire’s general obligation to compensate for loss and damage caused to third parties as a consequence of performing the concession. Provision 38 thereof provides that, with respect to rights and duties involving third parties, the concessionaire shall be governed by the rules of Private Law and shall be liable to the Granting Administration for any loss and damage arising from subcontracting. It continued that article 67 of the Regulations to the Law establishes that the concessionaire shall be governed by Private Law in its obligations and rights involving third parties, while article 69 provides that the concessionaire shall bear sole liability for damage caused to third parties, personnel, third-party property, or the environment, unless the injuries are attributable to the grantor because of measures it imposed upon the concessionaire.
The Court concluded that all these rules establish a system under which, when liability is shared between a public entity and a private-law entity holding a concession with it, the concessionaire bears sole liability for all damage to third parties caused by or in connection with the construction or operation of the concession. It concluded that the Granting Administration is excluded from third-party claims based on acts, events, or conduct arising from that relationship or caused by or in connection with its performance.
XX.The liability regime of the Public Administration and of the State generally derives from the Political Constitution (Constitución Política), articles 11 (principle of legality), 18 and 33 (equality in bearing public burdens), 34 (protection of vested rights and settled legal situations), 41 (right to full compensation for damage); 45 (protection of private property); 49 (protection of subjective rights and legitimate interests), 50 (liability for environmental damage); 74 (social solidarity), 148, 149, 154, 166 and 188 (liability of the President of the Republic, the Executive Branch, the Consejo de Gobierno, the Judiciary, and the directors of autonomous institutions, and 139 subsection 4), 140 and 191 (right to the proper functioning of public services). In this regard, judgments no. 5207-2004 of May 18, 2004, issued by the Constitutional Chamber, and no. 308-F-2006 of May 25, 2006, issued by this Court, may be consulted.
This constitutional principle of public liability was first developed by statute in the General Law of Public Administration (Ley General de la Administración Pública). It was subsequently developed in other statutes, such as the Administrative Procurement Law (Ley de Contratación Administrativa), the Law Regulating the Public Service of Paid Passenger Transportation by Taxi (Ley Reguladora del Servicio Público de Transporte Remunerado de Personas en Vehículos en la Modalidad de Taxi), the Law Regulating Paid Passenger Transportation by Motor Vehicles (Ley Reguladora de Transporte Remunerado de Personas Vehículos Automotores), and the General Law on Public Works Concessions with Public Services (Ley General de Concesión de Obra Pública con Servicio Público), the last of which applies to the present matter, as explained below.
XXI.The General Law on Concessions for Public Works with Public Services (Ley General de Concesión de Obras Públicas con Servicios Públicos), no. 7762, contains provisions defining the non-contractual liability (responsabilidad extracontractual) of the parties to an administrative contract (contrato administrativo) toward third parties harmed specifically by the performance of the agreement. In particular, with regard to the liable party. Thus, section 18(f) establishes that the concessionaire is obligated to “Compensate for the loss and damage caused to third parties as a consequence of the performance of the concession” (before the amendment made through Ley 8696 of 17 de diciembre de 2008—which renumbered the subsections—this provision was subsection (e)). Section 36 states that, during the construction phase, the “works shall be performed at the concessionaire’s risk (…)”. Lastly, section 38 provides: “Regime applicable to the Concessionaire’s relationships [.-] With respect to rights and duties concerning third parties, the concessionaire shall be governed by the rules of Private Law.
It shall be liable to the granting Administration for any loss and damage that may arise from subcontracting.” Among the obligations of the granting Administration set forth in Article 16, the legislature did not include compensation for the loss and damage caused by the concessionaire’s performance of the contract. This is because—as noted—that duty was imposed on the contractor, which is the party engaging in the harmful conduct under section 18(f). Accordingly, the effects of the concessionaire’s activity are not attributed to the granting Administration merely because it owns the public works and public service. Ownership alone is insufficient as a primary criterion of attribution (criterio de imputación); it is not logical for a public entity to be held liable for conduct that—even within the framework of an administrative contract—is not its own. Moreover, in the case of a contract governed by Ley 7762 (as in this matter), during the construction phase this is expressly included among the duties imposed on the concessionaire by section 36(e), under which it must “Adhere to the best construction procedures and to the approved construction plans for the works (…)”.
This exclusive attribution of liability to the concessionaire under the LGCOPSP is reinforced by the aforementioned section 36 thereof, which places the risk on the contractor. Finally, it need only be noted that Article 38 eliminates any doubt that might arise concerning the rules governing the concessionaire’s non-contractual liability toward third parties (and, generally, the relationships between them). In principle, it might be questioned whether the contractor’s status as a private party or the public nature of the works and service delegated to it should control, thereby allowing a reasoned choice of the liability regime applicable to the concessionaire: either the fault-based regime (régimen subjetivo) of private law or the predominantly strict regime (régimen objetivo) characteristic of administrative liability (responsabilidad administrativa). The legislature, however, resolved the issue by establishing in the aforementioned provision the “Regime applicable to the Concessionaire’s relationships [.-] With respect to rights and duties concerning third parties, the concessionaire shall be governed by the rules of Private Law.
It shall be liable to the granting Administration for any loss and damage that may arise from subcontracting.” Consistently with the foregoing, the General Regulations on Concessions for Public Works with Public Services (Reglamento General de Concesión de Obras Públicas con Servicios Públicos), Decreto Ejecutivo 27098, establishes in Article 69, regarding “Damage to third parties [.-] 69.1 During the term of the concession, the concessionaire is obligated to adopt all reasonable measures to prevent harm to third parties and to personnel working on the construction of the works or the operation of the service. It shall likewise take all precautions to prevent damage to third-party property and the environment. [.-] 69.2 The concessionaire shall be solely liable for all damage, of whatever nature, caused to third parties, personnel working on the project, third-party property, or the environment by reason of the construction of the works or operation of the service, unless the damage is attributable to the granting Administration because of measures it imposed on the concessionaire.” It is clear that these regulations implementing the LGCOPSP have the virtue of recognizing situations in which damage results from an action by the concessionaire that was specifically ordered or imposed by the Administration.
Thus, that administrative action is the source of the harm; it is the reason the concessionaire engages in the conduct that proves harmful to the third party. The regulatory provision therefore assigns the duty to compensate to the granting public entity.
XXII.In the case at bar (sub lite), as a starting point, the Tribunal found it proven that construction of the San José – Caldera highway is a public work of the State, granted as a public-works concession with public services to Autopistas del Sol, which in turn subcontracted Constructora San José – Caldera for that phase (as stated in proven facts nine and ten). The Tribunal likewise proceeded from the premise that this concession was processed and awarded in accordance with the LGCOPS (third recital (considerando), second point). Against this background, a contractual relationship is established in the first instance, while a relationship is also created among the users of the concessioned public works, the concessionaire, and the Public Administration. In addition, however, as noted, the existence of that contractual relationship and the performance of the construction work on the project also caused harm to third parties who were not users of the works: Constructora Guter Martínez and José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo, and Juan Manuel Víquez Quesada.
As the Tribunal determined and this Chamber agreed in the preceding recitals, by excavating the land and constructing the slope (following the design also contracted to the former), Autopistas del Sol and Constructora San José – Caldera caused a landslide that affected Constructora Guter Martínez’s two properties, on which two residences occupied by the individual plaintiffs were located. It was therefore the conduct of the concessionaire and its subcontractor that caused that specific damage, from which the non-economic harm (daños morales) subsequently arose. The effects of that conduct are attributable only to those who engaged in it, such that the obligation to compensate for that harm rests solely with Autopistas del Sol and Constructora San José - Caldera. This is because—it bears repeating—they performed that work and, in particular, because the LGCOPSP expressly so provided in Article 18(f).
The Tribunal’s judgment does not violate the constitutional principle of Public Administration liability, because no administrative conduct contributed to causing the damage in this matter. Mere ownership of the public works (and the repeatedly mentioned right-of-way (derecho de vía)) cannot—as the cassation appellant contends—serve as a criterion of attribution, because no constitutional or statutory provision supports that theory. Ownership of the works or public service is insufficient to impose joint and several liability (solidaridad) on a public entity for the duty to make reparation as though it were a joint tortfeasor, much less—as Autopistas del Sol argues—to impose the entirety of that obligation upon it. This is especially so where, as in the present contract, the subject matter included the design of the works. Although that is not a matter that may be asserted against the plaintiffs (who are third parties to that agreement), this position is nevertheless striking when advanced by a party that is itself bound by that expression of intent.
On this point, in view of part three of the third recital of the judgment and the conclusions of the State’s representative, it bears emphasizing by way of clarification that the contractual clauses (including those concerning liability toward third parties) govern the contracting parties, but not injured third parties; accordingly, the resolution of this matter is determined by law, not by the will of the State, the CNC, and Autopistas del Sol. Lastly, the appellant further argues that it implemented the plans approved by the granting Administration and the project supervisor, and that those plans, together with the notice to proceed (orden de inicio), are precisely orders and instructions from the grantor that exempt it from liability under the Regulations. This specific argument, in that level of detail, was introduced at this cassation stage (fase casacional) and therefore was not a subject of the proceedings.
Consequently, under Article 608 of the Civil Procedure Code (Código Procesal Civil) (applicable pursuant to section 220 of the CPCA), this Chamber is precluded from ruling on it. It must be clarified that the argument is new because, although Autopistas del Sol tersely stated in its answer to the complaint that the Administration had approved the plans, it did so as part of its allegations concerning ownership of the works and the right-of-way, to support attributing liability to the Public Administration and excluding its own. Moreover, the argument also does not coincide with that of the plaintiffs, who alleged in the complaint a failure to perform the oversight activity (actividad fiscalizadora) for which the State was responsible as grantor of the highway construction (folios 31 and 32). In other words, what the plaintiffs alleged against the State was an oversight failure during performance of the construction phase, not an administrative fault in the approval of the plans, which would indeed pertain to performance of the contract, but during its design and planning stage. Accordingly, for the reasons stated, this ground advanced by Autopistas del Sol is dismissed.
XXIII.Third. Constructora San José – Caldera alleges (in the first ground of its appeal) a violation of sections 1025 and 1046 of the Civil Code (Código Civil). It specifies that the judgment holds it jointly and severally liable with Autopistas del Sol but does not explain the basis for that joint and several liability, merely presuming it. This, it explains, violates Article 1025 and the privity-of-contract principle (principio de la relatividad de los contratos), because compensatory consequences are imposed on it by reason of a contract to which it is not a party. It states that one might suppose this is because of the alleged subcontracting relationship or the partners mentioned, but the judgment does not fully explain this, such that it cannot determine whether that assessment is correct. It further contends that section 1046 thereof was disregarded because there was no meaningful discussion of the joint and several nature of its payment obligation and that of Autopistas del Sol. It explains that the Tribunal found Autopistas del Sol liable for negligent conduct because it failed to carry out the necessary preliminary studies, but did not explain why Constructora San José – Caldera must answer for that alleged negligence.
XXVIV.The Tribunal found it proven that the construction of the San José-Caldera highway is a public work awarded as a concession to Autopistas del Sol (proven fact 9). It also found that, specifically for the construction phase, Autopistas del Sol subcontracted Constructora San José – Caldera (proven fact 10). Accordingly, it is clear that the party responsible for the construction work is the party that performed it, namely, Constructora San José – Caldera. It so acknowledged when it answered the complaint; in this regard, it admitted that it was the company that performed the earthworks (movimiento de tierra) and proceeded with construction (folios 108 and 113). As determined in recitals (considerandos) XIV and XV, the direct conduct of Constructora San José – Caldera caused the damage to Constructora Guter’s properties and the resulting injury to the natural persons who lived on those properties; that conduct consisted of making the cut and the slope (talud) in accordance with a technically inappropriate design.
The Tribunal criticized the lack of hydrogeological and structural studies and also determined that the excavation lowered the grade where the highway was being built, cut through the base, and geologically destabilized cerro Pan de Azúcar. It should be added that, as determined by the expert, that excavation and slope were based on flawed designs. On this point, it bears adding that the Tribunal emphasized that the civil-engineering expert, Edwin Moya Solano, stated that the engineers of this construction company were required to depart from the reference studies. Accordingly, the judgment against Constructora San José – Caldera does not disregard provisions 1025 and 1046 of the Código Civil.
XXV.Fourth. Autopistas del Sol (in ground G of its appeal) alleges a violation of the principles of reasonableness and proportionality. It states that the judgment orders payment to José Martín and Maciel in the amounts of ¢3.000.000,00 and to Juan Manuel and Maylin in the amounts of ¢5.000.000,00, taking into consideration the psychological report submitted concerning the impact of the landslide and the treatment received. Nevertheless, it asserts that the Tribunal failed to consider that the natural persons’ claim was based on their status as shareholders of the company that owned the property, and that no evidence was ever submitted showing that they were already shareholders at the time of the events, since the certification of share capital does not establish when the shares were acquired. Moreover, they did not make a claim as residents or occupants of the homes located on the land; but even if they had done so, there is no evidence to that effect.
All of this, it concludes, establishes an evident lack of standing (legitimación activa). It further argues that no witnesses helped prove the existence of the factors identified by the Tribunal; the psychological report is documentary evidence (prueba documental) that cannot be considered equivalent to expert evidence (prueba pericial) through which the existence of non-pecuniary damage (daño moral), or even psychological harm, could have been established. There is no evidence of non-pecuniary damage, and even if it could have been established “(even in re ipsa),” the amount awarded is entirely exorbitant and divorced from reality, bearing no relationship to the facts, which shows that it was determined arbitrarily and without any justification, thereby violating the constitutional principles of proportionality and reasonableness.
XXVI.In this ground, the appellant in cassation (casacionista) combines substantive defects with a procedural one. Indeed, its argument actually raises three objections: A) first, it asserts that the non-pecuniary damage was claimed by the plaintiffs as shareholders of the owner of the properties, rather than as occupants of the properties, which establishes their lack of standing with respect to the relief granted on this issue; B) it alleges that the non-pecuniary damage was not proven because it was not shown that they were shareholders or residents; and C) the amount of compensation was set arbitrarily and without justification, in violation of the principles of reasonableness and proportionality.
XXVII.As to point A, it appears to allege, in an extremely cursory manner, a lack of congruence (incongruencia) within a ground raising claims on the merits. It shall be rejected because it was not clearly explained. In addition, Autopistas del Sol is referred to recital VIII of this judgment, which rejected the similar ground raised by the other appellant company. It bears reiterating that compensation for this non-property damage (daño extrapatrimonial) was indeed sought on the basis that the natural-person plaintiffs lived in the houses situated on the properties affected by the landslide. Regarding point B), it is first noted that no relevant substantive provisions are mentioned. The constitutional principles cited concern the amount, not the determination of the damage. In any event, as stated in recital X of this judgment, it is for the judge to determine non-pecuniary damage through logical inferences drawn from the facts deemed proven, and therefore no analysis of specific evidence is required.
In the case at bar (sub júdice), in proven fact no. 2 of the challenged decision, the Tribunal established that the natural-person plaintiffs lived on the properties, relying for that purpose on the complaint, the witness Jesús Campos Fernández, and the statements of José Martín Irías Hernández, Adilza Murillo Blanco, and Maylin Irías Murillo. Likewise, in circumstance no. 13, it recounted that Maylin Irías Murillo and Juan Manuel Víquez Quesada vacated their home following the offer made by Constructora San José – Caldera, based on the statements of the aforementioned witness and Jose Martín Irías. In facts 6 and 7, it mentioned two separate letters from Constructora San José - Caldera addressed to the plaintiffs concerning the cracks and landslide and the recommendation to evacuate, based on that documentary evidence. In short, the Tribunal inferred the non-pecuniary damage from a body of circumstances proven by the evidence identified above.
The appellant does not challenge the assessment of that evidence so as to overturn those facts and, consequently, that logical inference. Ergo, this point must also be rejected. Lastly, regarding point C) concerning the reasonableness and proportionality of the monetary compensation awarded, as noted in recital IX of this judgment, the Tribunal determined that all the natural-person plaintiffs suffered non-pecuniary harm due to uncertainty and distress, and that, in the case of Maylin Irías Murillo and Juan Manuel Víquez Quesada, that state of mind was aggravated by concern for their minor child and by having left their home in accordance with Constructora Caldera’s proposal. These were the reasons given by the Tribunal for its decision. This Chamber agrees with them: seeing the properties where they live affected by a landslide and their houses damaged is a circumstance that undeniably causes distress; they do not feel protected within the physical space that constitutes every human being’s ultimate refuge, where they rest and carry out a substantial part of their activities, and all of this continued for more than a year.
This was anxiety experienced over a prolonged period. Accordingly, this Chamber finds that the amounts of ¢3.000.000,00 awarded by the Tribunal to José Martín Irías, Adilza Murillo, and Maciel Irías (respectively), and ¢5.000.000,00 to Maylin Irías and Juan Manuel Víquez, are reasonable in light of the period during which they remained in that state; it should be noted that, in the case of the latter two, their distress was heightened because they could no longer continue providing their minor child with a roof over his head, a home in which he could live and develop. In summary, this ground shall be rejected.
XXVIII.In view of the foregoing, the appeals filed by Constructora San José - Caldera and Autopistas del Sol shall be dismissed. The appellant companies shall bear the costs incurred through the filing of their appeals, as established by provision 150.3 of the CPCA.
POR TANTO
The appeals in cassation (recursos de casación) filed by Constructora San José – Caldera Sociedad Anónima and Autopistas del Sol Sociedad Anónima are dismissed, and those companies shall bear the costs incurred through the filing of their appeals.

RESULTANDO

CONSIDERANDO
I.Según los hechos que tuvo por demostrados el Tribunal, la construcción de la carretera San José-Caldera es una obra pública propiedad del Estado, otorgada en concesión de obra pública con servicio público a Autopistas del Sol Sociedad Anónima (en adelante Autopistas del Sol). Para la fase de construcción, esta empresa concesionaria subcontrató a Constructora San José – CaLdera Sociedad Anónima (en lo sucesivo Constructora San José - Caldera). En agosto de 2009, en el sitio ubicado entre los kilómetros 33 y 34 de la carretera, conocida como Ruta Nacional no. 27, las empresas dichas excavaron el terreno, bajaron la rasante de donde se construía la carretera y cortaron la base. Se produjo un deslizamiento de tierras, que afectó dos fincas propiedad de Constructora Guter Martini Sociedad Anónima (en adelante Constructora Guter), matrículas 358581-000 y 016438-000, sitas en la provincia de Alajuela, Atenas, Pan de Azúcar de Concepción.
En dichos predios habitaban los señores José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo y Juan Manuel Víquez Quesada. El día 18 de setiembre de 2009, Constructora San José – Caldera remitió notas a Maylin Irías Murillo, Martín Irías Hernández y “Manuel Irías Hernández”, en las que indicó que con motivo de la construcción de la obra pública, se han observado grietas que se aproximan a la propiedad, lo que podría tornar inestable la plataforma donde se ubican las viviendas. Asimismo, recomendó desalojar a la mayor brevedad y que cubriría los costos de la mudanza y alquileres respectivos durante el tiempo que “dure la situación”. En misiva del 29 de octubre de 2009, les informó que realizaba pruebas y mediciones necesarias con el fin de determinar el estado actual y futuro del deslizamiento que afectaba los predios. En ese mismo mes, sin precisar fecha exacta, Maylin Irías Murillo y José Martín Víquez Quesada desalojaron la casa que habitaban, y se mantuvieron fuera por el lapso de un año.
Durante los años 2010 y 2011, Constructora San José – Caldera implementó medidas técnicas de mitigación y prevención, y llevó a cabo un control topográfico del terreno. Actualmente, el área del deslizamiento fue estabilizada. En virtud de lo anterior, Constructora Guter, José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo y Juan Manuel Víquez Quesada demandaron al Estado, al Consejo Nacional de Concesiones, a Autopistas del Sol y a Constructora San José – Caldera, para que en sentencia se:
II.Inconformes, Constructora San José Caldera y Autopistas del Sol establecen recursos de casación. La impugnación de la primera fue admitida totalmente, la de la segunda sociedad lo fue en forma parcial. Los agravios admitidos se conocerán y se resolverán atendiendo a la estructura de la casación que prevé el Código Procesal Contencioso Administrativo (CPCA); esto es, en primer término los vicios procesales; posteriormente los reproches de índole sustantiva. Asimismo, se advierte que los cargos se reagrupan y renombran de conformidad con las argumentaciones esgrimidas y las causales establecidas por el mismo cuerpo legal.
Casación por violaciones procesales
III.Primero. Con el título “A- VIOLACIÓN DE LAS NORMAS DEL DERECHO CONSTITUCIONAL y NORMAS CUYA INOBSERVANCIA SEA SANCIONADA CON LA NULIDAD ABSOLUTA, SE CONSIDERAN COMO VIOLENTADOS LOS ARTÍCULOS 1 INCISO 1) Y 2 INCISO B), Y 5, 12 inciso 3), TODOS DEL CPCA, ARTÍCULO 49 DE LA CONSTITUCIÓN POLÍTICA, Y ARTICULO 97 INCISO 1) DE LA LEY ORGÁNICA DEL PODER JUDICIAL”, Autopistas del Sol recrimina el Tribunal no podía arrogarse jurisdicción y competencia en la determinación de situaciones jurídicas regidas por el Derecho Privado. Prosigue, si no existe causa con el Estado y el CNC como se estableció en sentencia, lo procedente era que se declarara incompetente y remitiera el asunto a la jurisdicción civil ordinaria. La competencia del Tribunal Contencioso, dice, está regulada en el mandato primero inciso primero del Código Procesal Contencioso Administrativo (CPC) en relación con lo preceptos 2.b, 5 y 12 del mismo cuerpo legal.
Al no haber responsabilidad administrativa del Estado y del CNC, “no existe deber alguno de nuestra representada derivada de la conducta administrativa, se agota así la jurisdicción Contencioso-Administrativa establecida en el 49 de la Constitución Política y el artículo 97 inciso 1 de la Ley Orgánica del Poder Judicial (…) por lo que el Tribunal debió abstenerse –de oficio- a (sic) fallar por el fondo este asunto”. Añade, se le condenó al pago del daño material, en violación del canon 126 del CPCA, el cual dispone que la sentencia estimatoria debe basarse en los hechos probados, y en este caso, la condenatoria no se funda en ellos. Insiste, no hay prueba de que el predio de la sociedad actora se depreció ni que fuera objeto de pérdida objetiva y efectiva, no hay un solo hecho probado que así lo consigne. Con lo cual se infringe el artículo 1045 del Código Civil.
IV.Se observa que la recurrente mezcla dos vicios, uno de índole procesal (relativo a la supuesta incompetencia del Tribunal para fallar) con otro de carácter sustantivo (cual es la trasgresión del mandato 1045 del Código Civil); sin embargo, el punto medular de su recriminación es el primero, al segundo dedica unas pocas líneas en las cuales –por demás- no desarrolla ni explica la violación más allá de indicar que no se funda en los hechos acreditados. Por lo anterior, esta Sala se limita a conocer el reclamo por incompetencia, y sobre ello se concluye que no lleva razón la casacionista. La decisión del Tribunal de lo Contencioso Administrativo y Civil de Hacienda de declarar parcialmente con lugar la demanda únicamente contra los accionados sujetos privados, es simultánea respecto a la denegatoria por falta de legitimación pasiva respecto de los sujetos públicos. El primero de esos decretos no puede bajo ninguna circunstancia enervar la competencia de ese órgano.
El Estado y el Consejo Nacional de Concesiones fueron demandados en conjunto con las sociedades anónimas (sujetos privados), de modo que la parte actora les exigió responsabilidad a cada uno de ellos, y ello determina la competencia de la jurisdicción contencioso administrativa prevista en el artículo primero párrafo primero del Código Procesal Contencioso Administrativo (CPCA). Por demás, resulta inadmisible una supuesta incompetencia sobrevenida como consecuencia de la falta de legitimación que determinó el Tribunal, ya que de conformidad con el canon 2.e del mismo cuerpo legal, la jurisdicción contencioso administrativa y civil de hacienda ha de conocer sobre “las conductas o relaciones regidas por el Derecho público, aunque provengan de personas privadas o sean estas sus partes”. Tal y como acontece en el presente asunto, en el cual se ventila la responsabilidad por lesiones ocurridas aparentemente –según se alega- por la ejecución de un convenio administrativo, es decir, originadas en la conducta del sujeto privado contratista de la Administración y que por ende está regida primaria y primordialmente por el Derecho público (en este sentido, remítase la casacionista a los considerandos del XX al XV de este fallo). En suma, el cargo será denegado.
V.Segundo, en el punto primero “A- INDEFENSIÓN, AFECTANDO DERECHOS DE DEFENSA Y DEBIDO PROCESO”, Autopistas del Sol denuncia violación al derecho de defensa y debido proceso, del canon 119 del CPCA e incongruencia. Detalla, hay vicio de incongruencia en la condenatoria por daño material, pues el fallo se extralimitó otorgando cuestiones no pedidas y concedió más de lo pedido; otorgó un aspecto que no fue objeto de debate, cual es el valor de la depreciación y pérdida objetiva y efectiva que experimentó la finca a causa del hundimiento y desprendimiento, comprendiendo las limitaciones de uso y disfrute que implica e implicará para el propietario. Resalta, la parte actora solicitó el daño con fundamento en el artículo 122.m.i del CPCA, sea que el daño constara en el expediente. Cuestiona entonces de dónde extrajo el Tribunal que el daño material es la pérdida por depreciación y pérdida objetiva y efectiva y el uso y disfrute.
La sociedad actora, argumenta, no pidió indemnización por ese rubro, ni hay prueba de que la propiedad se depreció, fue objeto de pérdida objetiva y efectiva, comprendiendo el uso y disfrute. Destaca, tampoco la empresa demandante peticionó se concediera en abstracto, por el contrario pidió que se condenara y fijara la cuantía del daño, lo que se habría podido hacer si constaran pruebas que sustentaran el valor o quantum de las lesiones. Expresa el canon 122.m.i establece que el Tribunal debe pronunciarse sobre la cuantía de los daños y perjuicios si se demuestra la existencia y su cuantía. De manera que al no pedirse que en ausencia de prueba, se condenara en abstracto se producen extra y ultra petita.
VI.En reiteradas ocasiones esta Sala ha manifestado que la incongruencia se produce cuando hay una evidente disonancia o contradicción entre la parte dispositiva del fallo y las pretensiones y excepciones opuestas por las partes. Además de lo anterior, respecto de la congruencia resulta indispensable analizar el fundamento fáctico del cuadro petitorio, ya que los hechos (junto con las alegaciones de derecho), constituyen el basamento de las pretensiones. Esto es, para determinar o descartar la existencia del vicio ha de examinarse la relación entre la causa de pedir y lo pedido, es decir, deben considerarse las circunstancias alegadas por la parte actora y la parte demandada para sustentar sus tesis, pues son éstas las que definen o limitan el pronunciamiento del Tribunal. Por último, resta señalar que en procesos regidos por el CPCA, además del contraste entre lo peticionado y lo concedido, se requiere confrontar la parte dispositiva con las pretensiones y excepciones esgrimidas tanto en la demanda como en la contestación, pero también en la audiencia preliminar y en el juicio (por ejemplo el artículo 67 del cuerpo legal de cita); así como considerar los pronunciamientos oficiosos que ese cuerpo legal impone al juzgador, como los contenidos en el artículo 122 ejúsdem.
VII.En el sub júdice, de conformidad con la demanda, la audiencia única (tercera parte del 8 de abril de 2013, archivo de audio y video), así como de la minuta (folio 1041), se tiene que la parte actora peticionó –entre otros aspectos- se condenara a los codemandados a cancelar los daños materiales sufridos por Constructora Guter, “de conformidad con el informe pericial del ingeniero Luis Alberto Rodríguez Astúa, consiste en la suma de un Millón Novecientos Ochenta y Siete Mil Novecientos Setenta y Ocho dólares, moneda de curso legal de los Estados Unidos de América ($1.987.978,00). Sea de conformidad con el artículo 122 inciso m) i, se solicita condenar solidariamente a los demandados al pago de daños y perjuicios, con pronunciamiento sobre su existencia y cuantía” (folio 54). Como probanzas, ofreció en su demanda un “Peritaje de Daños y Perjuicios, realizado por el ingeniero Luis Alberto Rodríguez Astúa, MBA, Perito Oficial de la Corte Suprema de Justicia y miembro activo del Instituto Costarricense de Valoración (ICOVAL)” (folio 58).
Posteriormente, al replicar la contestación de demanda de Constructora San José – Caldera, en lo que al daño material se refería, manifestó no tener “problema de que otro perito nombrado por Su Autoridad, valore nuevamente el caso, sea partiendo del informe del perito Rodríguez Astúa (como se solicitó en el escrito de demanda) o realizando un nuevo peritaje” (folio 352). En lo relativo a la del Estado, explicó, en razón de que los terrenos han sido propiedad de la familia Irías por más de 100 años y de que su transmisión ha sido a título gratuito, desconocía el valor real del detrimento patrimonial, por lo que contrató a un “actuario matemático oficial de la Corte Suprema de Justicia para que dicho profesional determinara cuanto (sic) es la estimación de los agravios que se han visto obligados a soportar” (que a folio 357). En la audiencia única, tercera parte, celebrada el 8 de abril de 2012, aquella prueba documental que la parte actora identificó en su demanda como “peritaje” elaborado por el ingeniero Rodríguez Astúa no fue admitida (10:47:08 del archivo de audio y video).
De seguido, en cuanto a la admisión de la prueba pericial para la valoración de ese daño material, y que fue ofrecida por la demandante, señaló la jueza presidente del Tribunal: “(…) hay dos aspectos a considerar: las otras pruebas periciales ya fueron evacuadas, rendidos los informes, entonces se estaría evacuando en la audiencia de juicio (…), esta prueba no se tramitó; entonces aquí hacemos la siguiente consideración, (…) si se admitiere esta prueba, que tengo que darle audiencia a las partes, tendría que suspenderse el proceso, hacer el nombramiento del perito, pagar sus honorarios, que el haga su informe, darle audiencia a las partes, y que esto después esto atrasaría el juicio por lo menos, por lo menos 3 meses más (…); la otra es que es una consideración que siempre se hace, que no se está pidiendo este perito –a lo que entiendo- para demostrar el daño, serían las otras dos pruebas periciales las que están probando el daño, entonces que usted valore este perito para una posible fase de ejecución de sentencia, donde eventualmente estaría acogida o no su demanda, declarado o no su derecho, y entonces la valoración correspondería al juez ejecutor que por turno corresponda, (…) nombraría el perito y que eventualmente podría verse la referencia que se hizo.
Empezando por eso lo someto a su consideración, si usted quiere la valoración de una vez, le doy la palabra a las partes, hacemos el receso, obviamente seguiremos con la prueba, pero implicaría la suspensión del proceso” (10:51:47 del archivo de audio y video). A esto, el abogado de la parte actora manifestó: “consideramos conveniente para no dilatar mas el proceso, convocarnos a la parte de los daños y posteriormente ir a la fase de ejecución” (10:54:09). De esta manera, concluyó la jueza que el peritaje sobre la valoración del daño se realizaría en la fase ejecución de sentencia (10:54:26). Ninguno de los demandados objetó ni se manifestó inconforme. De lo narrado, es claro que si bien inicialmente la parte actora peticionó se determinare la existencia del detrimento y su cuantificación, luego decidió limitar el debate a la existencia, difiriendo para la fase de ejecución del fallo el establecimiento de la cuantía, según lo dicho por el Tribunal.
Por este motivo, es que en la sentencia se decretó un pronunciamiento en abstracto con respecto de la cuantía, no así del daño ocasionado a las fincas 35381 y 16438, precisamente consistente en “un hundimiento a causa del corte del terreno por las obras de construcción de la carretera, que alcanzó un sector o área importante y que eran zonas verdes con árboles frutales y otras plantas”. Continuó el Tribunal, “claro que el evento ocurrido en agosto de 2009, cambió el ejercicio de los atributos del dominio sobre la finca, restringió su uso, goce, transformación y enajenación. Las grietas formadas, el deslizamiento, desplazamiento y moviendo de tierra, merman su cabal y libre disposición. La reparación pretendida en estos autos, habrá de consistir en el valor de la depreciación y pérdida objetiva y efectiva que terreno, acaecido en 23 agosto de 2009, lo que comprenderá además las limitaciones al libre uso y disfrute que ese evento ha implicado e implicará para su propietario y que de no haberse producido, éste podría explotar, siempre que esas restricciones o limitaciones sean permanentes; por ejemplo, la imposibilidad de construir, sembrar, plantar o cultivar la tierra.
Esto habrá de determinarse con auxilio técnico pericial. Una vez que esa obligación deje de ser de valor y se convierta en dineraria, en una suma de dinero, habrá de indexarse desde ese instante y hasta su extinción por pago efectivo (artículos 123, inciso 1, in fine, en relación con el 125, inciso 3, CPCA), lo que se hará en fase de ejecución de este fallo”. Por otra parte, recrimina además Autopistas del Sol que el Tribunal decretó pérdida por depreciación y pérdida objetiva y efectiva y el uso y disfrute, y en su parecer ello no fue peticionado. Discrepa esta Sala con la recurrente; tal y como se apuntó, desde la demanda se pretendió la indemnización por el daño material a las propiedades, en el proceso quedó acreditado (sin perjuicio del análisis que se hará respecto de los vicios sustantivos) la lesión a los inmuebles: grietas, deslizamiento, movimiento y hundimiento de tierra, cuya consecuencia lógica es precisamente la pérdida de valor.
Después del evento, las heredades no tienen el mismo valor que tenían de previo a éste, su uso y disfrute fue modificado. El Tribunal delimitó la indemnización a estos elementos, de manera que en la fase de ejecución no puedan anexarse otros diversos; es más en cuanto al uso y disfrute dispuso que la restricción para indemnizar debía ser permanente. En consecuencia, no se verifica el vicio de incongruencia aducido, el daño material concedido a Constructora Guter fue peticionado por la parte actora, quien aceptó que la cuantificación se difiriera a la fase de ejecución de sentencia, el Tribunal solamente delimitó en que consiste la lesión pedida que se indemnizará. En consecuencia, este cargo habrá de ser denegado.
VIII.Tercero. Como un único vicio procesal, Constructora San José – Caldera (en el segundo motivo de su recurso), esgrime infracción de los cánones 317 del Código Procesal Civil, 10, 57 y 82.4 del CPCA. Sostiene, en la condena por daño moral y su fijación, no se explica la razón por la cual se concede ¢3.000.000,00 a unos sujetos y ¢5.000.000,00 para otros, incurriendo en falta de fundamentación. Es un fallo inmotivado. Admite, si bien la indemnización es prudencial, también deben aplicarse los principios de la sana crítica racional, el sentido común y la experiencia. Cuestiona por qué si en el punto primero del considerado noveno, se dispuso que todos se afectaron por igual, se concedieron luego montos diversos, con un trato dispar que no se motiva. Disiente con la condenatoria por esta lesión por el hecho de ser habitantes, pues en la demanda, en la audiencia preliminar y en la fase de juicio, la solicitud fue por tratarse de socios de la empresa propietaria de los terrenos; en la etapa de conclusiones, para sanear el entuerto, se invocó como legitimación de la causa petendi del daño moral, una unión sin personalidad jurídica, cuando lo propio era invocar la situación que establece el articulo 10.4 del CPCA.
Aclara, en todo caso, lo que es el motivo del agravio es la ausencia de prueba idónea para justificar la condena por lesión moral, los actores produjeron la prueba entre sí a partir de sus testimonios en el debate, sin aportar elementos sobre la existencia y dimensión del daño moral subjetivo, solo presentaron una copia de supuesta atención psicológica como consecuencia del deslizamiento, que no es prueba de un proceso terapéutico derivado de lesiones morales. Ataca las probanzas en que se basó el Tribunal. Observa, la copia del informe psicológico es una mera copia, pero le da condición de dictamen pericial y quien lo elaboró no se llegó al debate a referirse a él. La nota de su parte donde recomienda salir no tiene el carácter que se le atribuye, pues ninguno de los afectados dijo que al recibirla se le hubiere producido daño; las propias declaraciones, en las que “de la manera más burda se pusieron de acuerdo para constituir su propia prueba”
IX.De la reseña se extrae que la casacionista plantea tres recriminaciones: A) falta de motivación del fallo con relación al monto que fue concedido por concepto de daño moral a las personas físicas demandantes; B) en la indemnización de las lesiones morales –dice- deben aplicarse los principios de la sana crítica racional, el sentido común y la experiencia, y recurrirse a pruebas, las que en este caso –en su criterio- no fueron idóneas, por cuanto los individuos “la produjeron entre sí” (b.1), y se aportó la nota enviada por ella y una simple copia de una supuesta atención psicológica que no tienen el carácter que les atribuyó el Tribunal (b.2); y C) el daño moral fue peticionado por su condición de socios de la empresa dueña de los inmuebles, no por ser habitantes de éstos. Se ordenará el conocimiento de los tres reclamos insertos según las consecuencias que producen en la sentencia (según se verá), de manera que se resolverá primero el punto C, pues aún y cuando no se menciona expresamente, está referido a una supuesta incongruencia respecto la lesión moral; de seguido el A que versa sobre la falta de motivación del quantum concedido; y por el último el B relativo a la no demostración de ese daño.
Baste decir por ahora que de conformidad con el mandato 150 del CPCA, la nulidad por vicios procesales (en tesis de principio) produce el reenvío del expediente al Tribunal a fin de que dicte el fallo según corresponda; y tratándose de vicios sustantivos, el órgano de casación debe, en esa misma resolución, fallar el proceso. De allí el orden en el cual se emite este pronunciamiento.
X.Según se dijo, denuncia Constructora San José – Caldera que el daño moral lo solicitaron las personas físicas demandantes en tanto accionistas de Constructora Guter Martini S.A., sin embargo, el Tribunal lo otorgó en razón de que ellos habitaban las propiedades de esa empresa (punto C). Puntualiza además la recurrente que en la etapa de conclusiones, la parte actora “para sanear el tuerto” al invocar como legitimación de la causa petendi del daño moral, invocó una “unión sin personalidad jurídica”, cuando lo propio era invocar la situación que establece el articulo 10.4 del CPCA. No lleva razón la casacionista. Como se señaló en el considerando IV, la congruencia de una sentencia es la relación consecuente que ha de exhibir entre lo fallado en la parte dispositiva y las pretensiones y excepciones opuestas por las partes, delimitadas a su vez por el derecho y las alegaciones fácticas, en particular, las controvertidas.
El fundamento circunstancial del marco pretensivo es por tanto límite del debate y del pronunciamiento, sin que ello demerite –claro está- el alcance del principio de verdad real que informa la legislación procesal contencioso administrativa y los pronunciamientos oficiosos que permite el Código de la materia. En este caso, se observa que desde la demanda, la parte actora refirió la existencia de una lesión extrapatrimonial de índole moral, con fundamentos tanto en la tenencia accionaria como en la residencia y habitación de las casas sitas en los predios. Así, señaló desde la demanda: a) que quienes son personas físicas habitan en las fincas pertenecientes a Constructora Guter Martini, que constituyen su habitación familiar, y tienen “gran arraigo” en ellos pues la familia Irías –a la que pertenecen- ha residido en dichos terrenos por cinco generaciones (hecho segundo); b) estos individuos son accionistas de esta sociedad (hecho y tercero); c) en los terrenos se ubican dos casas de habitación (hecho cuarto); d) el deslizamiento de tierra afectó “(…) de forma gravísima, irreversible e irreparable las dos propiedades (…), afectando con ello, la vida entera de todos nosotros y el patrimonio de Constructora Guter Martini S.A. (…) Actualmente, dicho deslizamiento se encuentra a 18 metros lineales de una de nuestras viviendas y a 25 metros lineales de la otra residencia.
En este momento, las grietas más cercanas a nuestras viviendas están aproximadamente a 9 y a 10 metros lineales (…)” (subrayado se agrega, hecho octavo); e) Maylin, Juan David y Juan Manuel se trasladaron a una vivienda amueblada que les alquila una de las empresas demandadas, lo cual les generó trastorno mental, familiar y social, desconocen qué pasaría con su verdadera residencia, no concilian el sueño por las noches por la incerteza sobre su casa, están atemorizados por haber dejado a parte de la familia en el lugar, asimismo que en febrero se percataron del hurto de sus pertenencias que habían en la vivienda, todo lo cual les ha obligado a recibir atención psicológica (hecho decimosegundo); y f) José Martín, Adilza y Maciel, no aceptaron la propuesta de la Constructora San José – Caldera, pues a pesar del temor y del riesgo que les representa vivir en el lugar, creen que de abandonarlo, en poco tiempo sería desmantelado, lo cual les ha obligado a recibir atención psicológica (hecho decimotercero).
En el fundamento de derecho, expresó la parte actora: “(…) todos y casa uno de las personas físicas actoras, somos accionistas de dicha sociedad, que funciona como se ha explicado como una “sociedad anónima familiar”. Acá resulta plenamente aplicable la disposición del artículo 9 inciso b), en cuanto a los grupos, las uniones sin personalidad, que vean afectados sus intereses legítimos, incluso sin necesidad de estar integradas en estructuras formales de personas jurídicas (…) En nuestro caso, estamos plenamente legitimados activamente, por cuanto somos poseedores, desde hace muchos años de dichos terrenos, pues hemos habitado los terrenos afectados, por cinco generaciones de la familia Irías. Por otra parte, somos las personas que hemos sido despojados de nuestros terrenos. Viendo con todo ello afectados nuestros intereses legítimos y derechos subjetivos. De hecho fue a nosotros que una de las empresas demandadas ofreció reubicar.
Somos nosotros, las personas físicas actoras (…) quienes hemos sufrido el daño moral provocado por los actores” (subrayado se agrega, visible a folio 21). Por consiguiente, es claro que contrario a lo alegado por la casacionista, el Tribunal no se extralimitó al conceder el daño moral considerando el hecho de que los señores José Martín Irías Hernández, Adilza Murillo Blanco, Maciel y Maylin, ambas Irías Murillo, y Juan Manuel Víquez Quesada, residían en las viviendas ubicadas en las fincas de Constructora Guter Martini, ya que ello fue peticionado por esa misma circunstancia desde la demanda. Ergo, el reclamo identificado como punto C) deberá denegarse.
XI.En lo tocante a la supuesta falta de motivación de los montos concedidos (punto A) debe apuntarse lo siguiente. En reiteradas oportunidades, esta Sala ha señalado que la motivación de un fallo consiste en plasmar o poner en manifiesto las razones o fundamentos, fácticos y jurídicos, por los que se adopta la decisión. Su ausencia se reconoce en dos hipótesis. La primera, por inexistencia, a saber, precisamente cuando el juzgador omite consignar los cimientos de su decisión. El segundo supuesto, cuando el despliegue argumentativo del órgano decisor resulta confuso o exhibe contradicciones de tal envergadura, que se erigen como obstáculo para determinar de forma diáfana los motivos que le sirven de base. En el sub júdice, el Tribunal determinó que el evento afectó a todos por igual. Consideró, la copia del informe psicológico da cuenta del impacto que les ocasionó el deslizamiento, y de que recibieron tratamiento.
Estimó, la nota entregada por Constructora San José – Caldera y la recomendación de salir de sus casas cuanto antes, es una noticia que altera el ánimo, la psiquis. Las grietas, el hundimiento, el desplazamiento y hundimiento del suelo, continuó, son datos objetivos que ponen de relieve la magnitud del evento y que sugieren peligro para la integridad física de las personas. Detalló, la otra nota de octubre de 2009 también generó preocupación a los moradores, ya que consigna un estado de hesitación para la permanencia y presencia en el lugar, se les indicó que se estaba trabajando en determinar el estado actual y futuro del deslizamiento, lo cual añadió al estado de preocupación e incertidumbre. Asimismo, estimó, se produjo una alteración del núcleo familiar, por separación transitoria, al abandonar el lugar donde habitaban. Prosiguió, “En el caso de José Martín, este dijo que él presenció el deslizamiento, aunque su esposa e hijos o yerno no dijeron lo mismo.
Respecto de éstos últimos, ellos sí hicieron abandono temporal de la casa que habitaban, se trasladaron a otro lugar por un año, en atención a la oferta de la Constructora, pero luego regresaron. Ese desarraigo y segregación del grupo familiar, es digno de considerar. Incluso, esta pareja y sus hijos ocupaban la casa que quedó con daños visibles y que se ubica más cerca del área del deslizamiento, todo lo cual agrava su angustia. La señora Maylin hizo referencia a un evento con su menor hijo, en el sentido que debe cuidar que este no se acerque al hundimiento, por evidentes razones de peligro de accidentes. Conforme a lo expuesto, el Tribunal se inclina por fijar el daño moral pedido, en forma prudencial, en las sumas de tres millones de colones, para José Martín, Adilza y Maciel, y en cinco millones de colones, para Juan Manuel y su esposa Maylin. Estas sumas serán indexadas a partir de su firmeza y hasta la extinción por pago”.
Como se observa de la reseña y trascripción, el Tribunal determinó en un inicio, o como base, una lesión moral sufrida por todos y cada uno de los actores personas físicas: José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo y Juan Manuel Víquez Quesada. De seguido valoró la afectación particular que sufrieron algunos de ellos. Estimó así el abandono que de la casa que hicieron Maylin, Juan Manuel y el hijo de ambos, así como la preocupación de doña Maylin por el menor. Con esas consideraciones el Tribunal, estableció que para los señores Martín Irías Hernández, Adilza Murillo Blanco y Maciel Irías Murillo la indemnización debía ser de ¢3.000.000,00, y en el caso de Maylin Irías Murillo y Juan Manuel Víquez Quesada, de ¢5.000.000,00. Ergo, el alegato A) de la causal esgrimida ha de rechazarse, pues el Tribunal sí consignó los motivos de su determinación.
XII.En el punto B) del cargo de análisis, sostiene Constructora San José – Caldera que al indemnizar lesiones morales, debe el juzgador recurrir a las pruebas y a la sana crítica racional. Asimismo, alega que en el presente asunto la parte actora produjo la prueba en su favor y que la nota que entregó y la supuesta atención psicológica no tienen el carácter que se les atribuyó. El reclamo deberá denegarse por lo siguiente. Lo alegado no se enmarca dentro del vicio de incongruencia, tampoco hace ningún otro yerro procesal. Se recrimina desatención a las reglas de la sana crítica al valorar las probanzas (según dice) y los hechos (se agrega), lo que en estricta técnica es propio de un cargo por violación de normas sustantivas. Además la indeterminación de la causal, esta Sala no puede entrar a conocer lo alegado como vicio por el fondo, en el tanto no identifica normas de esa índole violentadas.
Por ello deberá rechazarse. Pese a lo anterior, y con el fin de aclarar a la recurrente, conviene señalar que esta Sala ha manifestado en diversas oportunidades, que el daño moral subjetivo es de valoración “in re ipsa”, esto es, pende de las estimaciones del juzgador no sobre elementos probatorios concretos, sino sobre indicios y sobre el cuadro fáctico mismo, de los cuales se deduce por lógica una afectación en la esfera extrapatrimonial del individuo. Un detrimento de esa clase no requiere demostración directa, sino que por lógica el juzgador lo ha de deducir –se insiste- de los hechos acreditados, a través de indicios e inferencias racionales. En otras palabras, su reconocimiento y estimación para efectos indemnizatorios, está sujeto a la prudente apreciación del órgano decisor. En consecuencia, no necesita del análisis de particulares probanzas, pues se trata de deducciones lógicas y de la experiencia del propio juez.
Así, lo primero que ha de apuntarse es que el sub lite, el daño moral otorgado y las cuantías concedidas son sensata deducción de las circunstancias demostradas: el deslizamiento, la afectación a los terrenos y viviendas, la separación familiar, las notas suscritas por la Constructora San José – Caldera. Toda esa situación por lógica generó –como bien señaló el Tribunal- incertidumbre, preocupación. La referencia al informe psicológico es solamente un elemento más que pone en evidencia la afectación al estado de ánimo, pero no determina el daño moral. Por último, es necesario señalar brevemente que esta lesión extrapatrimonial concedida es diversa de una de tipo psicológico per se, que necesariamente requiere de dictamen psicológico para ser establecida y resarcida. En el presente asunto, no fue peticionado resarcimiento por este extremo (daño psicológico), por lo que no fue valorado ni otorgado en sentencia. En cuanto a las notas que recibieron por parte de la empresa, coincide esta Cámara con el Tribunal, claramente generan un estado de incertidumbre.
Casación por violaciones sustantivas
XIII.Primero. Constructora San José – Caldera (en el cargo tercero de su recurso) reprocha violación indirecta de los preceptos 702 y 1045 del Código Civil, por inobservancia del artículo 82.4 del CPCA. Expone, para el Tribunal, según la prueba pericial, el deslizamiento de tierras en gran escala fue provocado con la excavación del terreno, que bajó la rasante, cortó la base y desestabilizó geológicamente el cerro Pan de Azúcar. Discrepa, ya que en su parecer los peritos Laporte y Gómez Bonilla señalan que el deslizamiento se originó en un hecho impredecible en “una zona geológicamente establece”. Asevera, el perito Juan Guillermo Guzmán Alpízar no dio un aporte serio, pues sus conclusiones “no son fruto de un trabajo de campo y del estudio de la documentación de soporte que debió haber valorado y estudiado para llegar a una conclusión profesionalmente sólida”; los peritos Laporte y Gómez lo descalificaron al afirmar que no es posible determinar las causas del desplazamiento con la sola observación del terreno y sin pedir ni revisar los planos y estudios referenciales y preliminares.
No obstante, el Tribunal se basó prácticamente en este profesional, y no valoró el aporte de estos dos es que como es residente de la zona, la conoce muy bien, de manera que no debía hacer estudio ni trabajo de campo. Dice, los otros peritos sí hicieron trabajo de campo y verificaron la información. Resalta, el señor Edwin Moya Solano tiene conocimiento en la construcción de carreteras, y su peritaje se limitó a valorar exclusivamente la situación del rasante, indicando que el deslizamiento se detuvo, con base en los planos referenciales de 1980 del MOPT, los del proyecto de construcción y los de solución; de manera que no aportó nada referente a la causalidad del deslizamiento. Sin embargo, el Tribunal deduce de esta pericia otros elementos para justificar la relación causal entre el movimiento de tierra y el desplazamiento del terreno. En su parecer, es en los informes de los señores Gastón Laporte Molina, testigo perito, y Manuel Gómez Bonilla, perito geólogo, donde debe analizarse la determinación del nexo causal, pues son personas muy calificadas y sus criterios lejos de ser contrastantes, fueron complementarios.
Resalta, ninguno pudo determinar la causa del deslizamiento. Describe, el primero habló de la combinación de tres factores, agua, corte y condiciones del suelo, así como de los efectos locales como paliosuelos o elementos que no se tienen a la vista cuando se visita el terreno sin ningún corte. También indicó que se hicieron los estudios hidrogeológicos para el proyecto y perforaciones, que evidenciaban había una capa de suelo y luego roca. Señaló además que habían árboles grandes verticales, no inclinados, no se veían grietas en el terreno, lo que combinado con la perforación y taludes cortados, no mostraban problemas. Prosigue, don Manuel Gómez manifestó categóricamente que desconocía la causa del deslizamiento, y planteó situaciones hipotéticas de posibles causas, pero no la logró determinar. Ambos, afirma, refieren una situación de impredicibilidad ya que se hicieron los estudios preliminares y se tuvieron los estudios referenciales para establecer las características del terreno y definir qué y cómo se ejecutarían las obras.
Así, concluye, no actuó a la ligera, en violación al deber de cuidado, no fue negligente o imprudente, sino que lo hizo de acuerdo con los estudios que según la industria de la construcción de carreteras se requieren para estos casos, y de ellos no se desprende que fuera un terreno con riesgo evidente de falla. Arguye, es contrario a las reglas de la sana crítica que el Tribunal afirme era indispensable contar con un estudio particular y específico del cerro Pan de Azúcar antes de realizar el movimiento, en particular contra el sentido común y la ciencia que aplica a esta industria, pues como manifestó el ingeniero Laporte “en este campo difícilmente uno va a poder predecir todo, hay un factor de imprevisibilidad, hay un límite para la investigación en obras lineales, llega un momento en lo que no hace es disminuir la imprevisibilidad, no llegar a querer tener un riesgo cero porque el riesgo cero no existe”.
Desprende, de todo lo anterior se extrae que se dio una inestabilidad imprevista y la Constructora procedió de inmediato a implementar una solución integral con el auxilio de escogiendo la solución del primero y estabilizando el talud. Asevera, todos coinciden en que el terreno se estabilizó y actualmente es estable como evidencian las fotografías. Don Manuel Gómez indicó que la vegetación es propia de un terreno sin riesgo de deslizamiento y que no hay propensión a deslizamiento en caso de sismo, pues se alcanzó un ángulo de estabilidad; y don Gastón afirmó que el terreno quedó mejor que antes del deslizamiento. Concluye, de las probanzas no se puede inferir con certeza ninguna situación que sea causa eficiente, y por ello se trasgrede el artículo 1045 del Código Civil, ya que no se acreditó el nexo causal, por consiguiente no hay daño indemnizable. Acusa, se desatiende el canon 702 ejúsdem, ya que es un hecho de la naturaleza que no le es achacable, se da por el suelo inestable, propenso a deslizamientos y de fallamiento, con lo que se produjeron las eximentes de fuerza mayor y caso fortuito.
XIV.Según la prueba técnica y testimonial recibidas, así como en la conducta de Constructora San José – Caldera, tuvo por demostrado el Tribunal que la excavación del terreno, que bajó la rasante donde se construía la carretera, cortó la base y desestabilizó geológicamente el cerro Pan de Azúcar, lo que provocó un deslizamiento de tierra de gran escala que afectó en forma grave, irreversible e irreparable las propiedades. Estimó, el que Constructora San José – Caldera expresara su preocupación a los actores y les recomendara el abandono, asumiendo ella el pago del alquiler, denota la existencia de un “vínculo cuya fuente trasciende las motivaciones altruistas de auxilio, a costa del propio peculio, y se incardina en el sentimiento de responsabilidad por un hecho propio”. Prosiguió, el geólogo Guzmán Alpízar manifestó que “la causa del deslizamiento se sitúa en el movimiento de tierras realizado en la base del talud, en los trabajos ejecutados para la construcción de la carretera, y descartó que fuera por una causa natural; advirtió que por sí solo no habría tenido lugar el derrumbe; que antes del evento, el terreno estaba estable, que éste era evitable y que no se adoptaron medidas técnicas para prevenirlo, no se hicieron los estudios requeridos; que en el lugar hay un deslizamiento, no una falla; también señaló que es posible construir en cualquier lugar siempre que se invierta en análisis y diseño, lo cual supone inversiones muy altas que a veces lo hacen inviable.
Es verdad que el perito fundó sus aseveraciones en la observación superficial del lugar, en el conocimiento de este y en lo que apreció en su visita, pero no por ello cabe descartar sus conclusiones, desecharlas u orillarlas, pues también dijo que es un profesional, con conocimientos y experiencia en el campo de la geología. Esta cualidad le da un valor que impide rechazar de plano su versión”. Aseveró el Tribunal que lo anterior fue ratificado por el señor Gastón Laporte, quien expresó que la causa del deslizamiento obedeció a la combinación de factores: terreno suave, corriente de agua y el corte, con el corte como elemento disparador, que rompió el equilibrio existente. Asimismo, dijo, el señor de la Torre Lozano señaló que la causa de la inestabilidad del talud puede estar asociada a la inestabilidad de los materiales, condiciones asociadas a niveles de agua, cambios de uso de suelo, alteración de la topografía.
Así, concluyó, “la causa eficiente del deslizamiento o movimiento de masa, fue la intervención de la concesionaria con los actos de ejecución o construcción de la obra; es ese el elemento que dispara el movimiento bascular. Con todo y las peculiaridades de la composición del suelo y de las aguas, es lo cierto que es la participación de la empresa, la intervención en el lugar con la construcción de la carretera, el elemento que provoca el desprendimiento de suelos”. Añadió, el perito Laporte Molina manifestó que: para el trayecto 33+500 no hubo estudio hidrogeológico, sino uno genérico; no había evidencia de que el terreno de la zona era inestable; no era previsible un deslizamiento; no hubo investigación adicional sino que se trabajó con la información disponible; y las recomendaciones fueron genéricas, no específicas para el sector 33+500. Consideró además que el testigo de la Torre manifestó que no se hizo estudio hidrogeológico específico para el talud en el tramo en cuestión, sino que realizó hasta luego del deslizamiento para iniciar los trabajos de mitigación.
Continuó, el perito Gómez Bonilla explicó que “Antes de iniciar la construcción de una obra como la ruta #27, se deben realizar análisis de estabilidad de taludes en las condiciones de estado cero [antes de] y colocando la obra a construir para conocer el impacto que tendría desde el punto de vista geotécnico, geológico, para lo cual se debe investigar para conocer, además de los parámetros geotécnicos, la geología, la ubicación del nivel freático, si existe o no, la frecuencia e intensidad de eventos sísmicos, etc.; que en el tramo entre PK33+000 y PK34+000, se han realizado muy buenos estudios de estabilidad de taludes posteriores a agosto de 2009, cuando se dio el evento de deslizamiento, pero desconoce si existió alguno previo a la construcción de la obra; con un mapeo geológico debió reconocerse la existencia de un espesor importante de rocas meteorizadas, y la presencia de un nivel freático, evidenciado con la existencia de nacientes en la parte alta del talud; bajo estas circunstancias, de haber existido un análisis de estabilidad de taludes, se habría notado la estabilidad natural con el estado cero y al aplicar los cortes requeridos para construir la obra, hubiera sido muy evidente que se causaría inestabilidad con el corte que por las condiciones geológicas presentes, no permitiría remover el soporte natural y cambiar el ángulo del talud, y concluye señalando: “Me es evidente, que o no se realizaron estudios previos (estado cero), en el sitio analizado o de haberse realizado se hizo caso omiso a los resultados de los mismos, porque de haber existido, por las condiciones geológicas, geotécnicas y de manifestación superficial del nivel freático, no se requería de más evidencias, para conocer la vulnerabilidad de talud existente, a cambios de pendiente, soporte, etc., con lo cual se pudo evitar la formación del deslizamiento.” (informe (sic) de folios 497 a 502, Tomo I de esta carpeta).
Durante la audiencia de juicio, reiteró que en la documentación revisada no constaban los estudios hidrogeológicos para la zona, ni análisis estructurales; aclaró que esos estudios son previos, para evitar que se deslice las masas, para prevenir un deslizamiento o minimizarlo”. De esta manera, finaliza, las empresas codemandadas no hicieron todos los estudios previos requeridos para la construcción de la obra, entre ellos los estudios hidrogeológicos y análisis estructurales para la zona específica. Adicionalmente, valoró que según el perito Edwin Moya Solano, los ingenieros de la Constructora tenían la obligación de apartarse de los estudios de referencia y que el diseño se degradó. Así estableció por parte de las sociedades demandadas una omisión en adoptar “los recaudos necesarios para prevenir deslizamientos como el que nutre la demanda”. Determinó por último que “el daño sí era previsible, haciendo los estudios respectivos, con lo cual sí cabe hablar de culpa subjetiva, por falta de diligencia.
El daño se causó por no [prever] las consecuencias de sus propios actos ejecutores de la obra. Aunque los codemandadas han alegado en su defensa la práctica de estudios serios en el sector, señalando algunos anexos en ese sentido, es lo cierto que esos estudios y anexos son genéricos y datan de 2006, fue con posterioridad al evento que se hicieron estudios específicos para el sector. De modo que tal alegación no es de aceptación”.
XV.En primer término, y para efectos de claridad se torna necesario señalar que en el presente asunto la parte actora y Autopistas del Sol peticionaron un perito geólogo (folios 58 y 105), a lo cual se designó al señor Manuel Gómez Bonilla (folio 409). Además, Autopistas del Sol requirió un perito ingeniero civil (folio 105), cargo en el cual se nombró al señor Edwin Moya Solano (folio 574). En la audiencia única, parte tercera, celebrada el 8 de abril de 2012, se admitió al señor Guillermo Guzmán Alpizar en calidad de testigo perito; al efecto indicó la presidenta del Tribunal: “es el profesional que firmó el aparte 36 dentro legajo de pruebas, considera conveniente la sustitución en el sentido, de lo mismo que han venido indicando las partes, de que es un profesional o un técnico que emitió uno precisamente de los documentos que se están cuestionando y va a permitir que se someta dicha prueba al contradictorio.
Entonces, desde ese punto de vista, estimamos conveniente y admitimos al señor Juan Guillermo Guzmán Alpizar como testigo (…)” (archivo de audio y video 11:04:00). Ante los recursos de revocatoria presentados por todos los demandados, señaló “(…) efectivamente, sobre los documentos que han sido pagados por las partes, eso sería una regla que haría casi imposible que una jurisdicción tan especializada como ésta recibir otro tipo de documentos, no sólo en este caso, sino en todos los demás, en cualquier otro caso; en muchos otros casos se han admitido testigos o peritos inclusive de parte, pagados por la parte, se entiende y el Tribunal lo entiende así, y para eso es que la prueba se valora con la sana crítica, entonces, desde ese punto de vista no es aceptable el hecho que abiertamente un profesional haya sido pagado para venir a rendir un dictamen, repito, sea de los actores, sea de los codemandados, sea de quien sea, es motivo suficiente para rechazar una prueba, porque repito, será valorado bajo la sana crítica, y lo más importante que es lo que nos hace mantener la decisión que tomamos fue que más bien se les está brindando a las partes someter al contradictorio uno de los documentos que precisamente fue uno de los motivos de inconformidad que tuvieron con respecto de la prueba documental que admitimos hace unos momentos, entonces más bien lo que mueve al Tribunal es tratar de propiciar ese contradictorio, que las partes tengan la oportunidad de referirse y someter a interrogatorio a la persona que se está proponiendo y lograr traer más elementos de juicio al proceso”.
Se aclaró que recibía para referirse a los hechos 7, 8 y 15 y al documento que él elaboró. En la misma audiencia se admitió como prueba testimonial a los señores Gastón Laporte Molina y Germán de la Torre Lozano, geólogo e ingeniero civil respectivamente; en esa oportunidad los oferentes, los abogados de Autopistas del Sol y Constructora San José – Caldera precisaron que ambos profesionales estuvieron presentes en el proceso de mitigación y en el proceso constructivo de la obra. En síntesis, se evacuaron los testimonios de Guillermo Guzmán Alpizar, Gastón Laporte y German de la Torre; y rindieron pericias los ingenieros Manuel Gómez Bonilla y Edwin Moya Solano.
XVI.Dicho lo anterior, y tal y como fue planteado el debate desde la demanda y en las contestaciones, es claro que en este asunto la prueba pericial resulta fundamental a efecto de determinar la causa o causas del deslizamiento. Como se relató en el considerando que antecede, como peritos se designó a dos profesionales. El informe del perito geólogo Gómez Bonilla se compuso de tres documentos; el de informe inicial, que luego amplió en dos ocasiones, ante los cuestionamientos que le hiciere Autopistas del Sol. En el primero de los documentos, concluyó don Manuel Gómez Bonilla “Es claro que ocurrió un deslizamiento del tipo cuchara, originado por la remoción de la base que soportaba el talud natural, al cortar la rasante de la carretera San José – Caldera, que afectó las propiedades de los Actores, cuya cresta se ubica muy cerca de las construcciones existentes en las propiedades” (folio 433, subrayado y negrita se agregan).
En la adición a este informe (de octubre de 2011), señaló que “entre PK 33+000 y PK 34+000, se han realizado muy buenos estudios de estabilidad de taludes, posteriores a agosto de 2009, cuando fue evidente el deslizamiento, pero desconozco si existió alguno previo a la construcción de la obra (…) Bajo estas circunstancias, de haber existido un análisis de estabilidad de taludes, se habría notado la estabilidad natural con el estado cero y al aplicar los cortes requeridos para construir la obra, hubiera sido muy evidente que se causaría inestabilidad con el corte, que por las condiciones geológicas presentes no permitiría remover el soporte natural y cambiar el ángulo. [.-] De acuerdo con el razonamiento anterior, o no se realizaron estudios previos a la construcción de la obra (en el punto de análisis referido), o de haber existido, hicieron caso omiso a los mismos” (folio 499). Concluyó, “Es claro que los trabajos realizados (estudios y obras de campo), posterior a la aparición del deslizamiento, agosto del 2009, han sido apropiadas y muy eficientes, de acuerdo a la buena práctica, para estabilizar la masa, lo cual podemos observar en el campo, después de soportar una época de lluvias (…) Me es evidente, que o no se realizaron los estudios previos (estado cero), en el sitio analizado o de haberse realizado se hizo caso omiso a los resultados de los mismos, porque de haber existido, por las condiciones geológicas, geotécnicas y de manifestación superficial del nivel freático, no se requiere de más evidencias, para conocer la vulnerabilidad de talud existente, a cambios de pendiente, soporte, etc., con lo cual se pudo evitar la formación del deslizamiento. [.-] Es claro también, que la condición geológica no fue condicionante, para lograr la estabilidad del talud actual, con lo cual se podría haber logrado, realizando las obras previamente, minimizar o evitar el movimiento de masas, aplicando medidas como las aplicas (sic) después de agosto de 2009 (…)” (folios 501 a 502).
En la segunda ampliación y aclaración de su informe (abril de 2013, visible a folios 1058 a 1065), en cuanto se le preguntó si los estudios que constan en los anexos 3, 4 y 5 son estudios técnicos serios para la determinación de estabilidad de taludes en la zona geográfica donde se comprende entre otros los PK 33+000 y PK 34+000, manifestó “Sí desde luego que los estudios aportados en los Anexos 3, 4 y 5, son estudios serios los cuales fueron realizados en el 2006, por INSUMA S.A., para integrar la información existente y dar las recomendaciones para definir cortes y rellenos a realizar en la vía San José-Caldera, principalmente en el tramo II (Ciudad Colón-Orotina). [.-] Entre los estudios revisados y analizados por INSUMA S.A., el 99% fueron básicamente geotécnicos, solamente se cita un estudio hidrogeológico realizado para el Estudio de Impacto Ambiental. [.-] Desde los estudios realizados por IMSA S.A., en 1999, se determinó 18 zonas o secciones del corredor, donde se consideró que tenían condiciones particulares que requieren un tratamiento diferenciado, las cuales igualmente fueron mantenidas por INSUMA S.A., en sus informes [.-] En la buena práctica, además de la información geotécnica, debió analizarse en forma integral la hidrogeología en cada uno de estos sitios o zonas particulares, para con mayor propiedad definir los taludes de los cortes a realizar, sin embargo, solamente se hacen algunas citas de la aparición de acuíferos artesianos (tramo intersección Siquiares-Río Grande) y en el resto del tramo no se menciona nada. [.-] Igualmente, debió complementarse el estudio con un análisis estructural de todo el corredor y en los informes revisados no se menciona que se haya realizado (…)” (folio 1059).
Al responder si era posible determinar la causa del deslizamiento con la información existente, expresó que con la información disponible pudo “reconocer algunas causas que podrían explicar la ocurrencia del evento en la sección G, denominada Pan de Azúcar. [.-] 1. Para determinar los parámetros de estabilidad de un corte, una observación básica de campo es observar los taludes naturales del área específica y alrededores, donde se tiene condiciones geológicas similares. En la sub zona G se observan pendientes generales de 38 -42 grados. En este rango se ubica actualmente la pendiente del área deslizada, posterior a su estabilización. [.-] 2. En los estudios realizados por IMSA S.A., junio y Julio 1999, se define la sección G: 31+500 – 33+000 y se reconocen dos sub zonas, siendo el contacto entre dos formaciones geológicas. En la sub zona 31+750 – 20+050 (ignimbritas), se recomienda un corte talud para la roca con ángulo 76 grados (1/4h-1v) y 53 grados para el suelo (3/4h-1v). en la sub zona 32+290 – 32+750 (lavas meteorizadas, área de la finca de los demandantes), se recomienda un único talud de 53 grados y se explica que el talud está formado por material coluvial. [.-] 3.
En los estudios realizados por INSUMA S.A., en el 2006 (Anexo 3), se define la sección G: 31+500 – 33+000. En el Anexo 4, (tabla A5.1. Recomendación de solución geotécnica para cortes en el tramo II, página 47), se define la sección G: 31+540 – 31+580 y 32+000 – 32+300 (Figura 1). En el Anexo 5, (Tabla A-1. Recomendación de solución geotécnica para corte en el tramo II, página 13). (sic) se define la sección G: 33+065 – 33+105 y 33+525 – 33+825 (Figura 2). En ambas tablas se reconocen dos sub zonas, en las dos se describe geológicamente como contacto entre ignimbritas y lavas del Aguacate (roca muy meteorizada) y se recomienda el mismo ámgulo (sic) de talud para las dos sub zonas, 76 GRADOS (1/4H-1V), para la roca, sin considerar la diferencia en la condición geológica de las sub zonas, anotadas inicialmente en los informes de IMSA S.A. (1999). (…) 5. El (sic) los anexos 4 y 5, en la nota de presentación define las soluciones específicas para los cortes y rellenos del tramo II (Ciudad Colón-Orotina), en los sectores donde se deben realizar acciones importantes de soporte.
Si consideramos que en la construcción de la carretera se aplicó el diseño de los taludes presentados en la Tabla A5.1, del Anexo 4 y/o la Tabla A-1, del Anexo 5, específicamente para la sección G (Pan de Azúcar, zona donde se ubica la propiedad de los Demandantes), se cometió un error al definir los parámetros del talud con ángulo de 76 grados (para la roca) y se ignoró la recomendación inicial de IMSA S.A. (1999), donde definió un talud único de 53 grados, muy similar al encontrado actualmente en las pendientes naturales del área, de 38-42 grados” (folios 1060 a 1062, subrayado y negrita no es del original). Había peticionado Autopistas del Sol que respondiese si por la condición del suelo, cualquier otro fenómeno del ser humano o de la naturaleza, sin el movimiento de tierra, pudo provocar el deslizamiento, a lo cual respondió el perito que “Por la condición natural del terreno, que mantiene un ángulo general de 38 – 42 grados, muy cercano al ángulo de reposo del material suelto (arena), de 36 agrados, es muy probable que la acción antrópica de uso normal y/o los agentes naturales conocidos de estos tiempos no son significativos para considerárselos como el origen del deslizamiento.
Los elementos naturales actúan en el tiempo sobre el terreno y van conformando un talud estable, con parámetros definidos por la condición de las diferentes variables que actúan (tipo de roca, estructura, % de humedad, sismos, etc.)” (folio 1063). Concluyó “De la investigación realizada, debo concluir que se realizaron muchos estudios, abundando en detalle de las zonas con mayor complejidad, como consta en los informes analisados (sic), para caracterizar geotecnicamente el corredor de la ruta 27, principalmente en lo que respecta al tramo II, Ciudad Colón – Orotina. [.-] Debo notar, que en la información revisada no se menciona que se haya realizado otros estudios para complementar la información geotécnica (hidrogeológicos, estructurales), específicamente en el área de la sección G (Pan de Azúcar), donde se conoce de rasgos estructurales que debieron ser involucrados en los análisis. (…) Como corolario, si el diseño que realizó INSUMA S.A., como lo presentó en las tablas A5.1 y/o A-1, se aplicó para la construcción específica del talud para la zona de la finca de los demandantes, este sería el origen del deslizamiento, pues el talud resultante tendría parámetros erróneos, que no cumplirían con la definición de un talud estable” (folio 1065, se añade el subrayado y la negrita).
Durante la audiencia única (quinta parte, celebrada el 28 de mayo de 2013), ante las preguntas del abogado de la parte actora, manifestó don Manuel Gómez Bonilla que visitó el área y revisó la información del expediente, constató un deslizamiento que se encontraba estable, ya se habían hecho obras de mitigación efectivas, el talud tiene un ángulo de estabilidad; dijo, en su primer informe recomendó obras de mitigación para la erosión. Continuó el interrogatorio el abogado de los demandantes: “¿Conoce usted la causa de ese deslizamiento? [perito geólogo] La causa del deslizamiento, en mi criterio, yo no la conozco, pero sí puedo, en el informe me da, una construyeron el talud, lo que conozco es la información que representó en el estudios geotécnicos en esa área específica, la empresa que hizo esos estudios determinó un ángulo de talud para ese tipo de roca en esa zona específica que llaman la sección G, la empresa que hizo los estudios determinó que ahí hay un contacto de dos tipos de roca, entonces determinó dos tipos de talud, en un tipo de roca que la denominó como ignimbritas, que es una roca bastante competente y soporta taludes de ángulos altos, ellos determinaron que el talud era de un ¼ a uno, que es alrededor de 78 grados de inclinación, y en la otra sección de esa misma sección, en el otro talud en otro tipo de roca, ellos determinaron que debía construirse un talud de ¾ a uno, que es alrededor de 56 grados.
En la información que revisé, posteriormente, otra empresa agarró la información que había sido generada (y es clara en que ellos no generaron información, sino que analizaron la información existente y ellos dieron recomendaciones para construir los taludes), en esa información que revisé, se aplica, o por lo menos ellos recomiendan el talud para esa área con el diseño de la zona de ignimbritas, no con el diseño de la zona de lava meteorizada. Entonces, en mi criterio, si eso fue lo que se utilizó, desconozco sí ese fue el diseño que utilizaron, pero si se utilizó esa sería para mí la causa de que se haya deslizado, porque habrían construido el talud con un ángulo que no era el apropiado para ese tipo de roca”. Describió además que por la basculación del terreno, había árboles inclinados. Explicó que Imsa fue la que realizó los estudios geotécnicos para la zona, que después Insuma unió en el 2006 y efectuó un diseño de talud, identificó como profesional responsable de Insuma al señor Gastón Laporte.
Se le cuestionó si le constaba la realización de estudios hidrológicos e hidrogeológicos para la construcción de la carretera; afirmó que de la información que él revisó, no constan estudios hidrogeológicos para esa zona y no se menciona que hayan sido analizados. Prosiguió en el interrogatorio el abogado de la parte actora, “los ángulos de los diseños y prediseños que usted pudo analizar, que (…) realizó, que diseñó la empresa Imsa en su momento, después la empresa Insuma, ¿eran los correctos para ese tipo de situación? [Perito geólogo] Yo no podría contestarle eso, porque esos ángulos se basan en estudios geotécnicos que yo no realicé, para saber si es el correcto tendría que hacer estudios geotécnicos y analizar. [Abogado] ¿Es necesario para hacer esos diseños tener estudios geotécnicos? [Perito geólogo] Desde luego que sí, es necesario hacer estudios de estabilidad de los taludes que se van a cortar [Abogado] ¿Se puede hacer un diseño de un área, un diseño como ese contando con un estudio geotécnico que se hizo a cientos de metros del sitio? [Perito geólogo] En mi criterio yo pensaría que si se conoce el área y el área geológica es la misma, se puede extrapolar información; ahora todo depende del profesional que está diseñando y que está utilizando la información, es criterio de ese profesional si lo hace o no, o si hace en cada sitio que va a diseñar (…)”.
Posteriormente, el abogado de Autopistas del Sol le inquirió sobre sus respuestas en la adición del informe de octubre de 2011, pregunta c, relacionada con su afirmación de que se realizaron estudios posteriores a agosto de 2009 y que desconocía si hubo alguno previo a la construcción de la obra; a lo que aclaró que para ese informe [de octubre de 2011] revisó los estudios que habían en el expediente, que eran posteriores al deslizamiento. Continuó el abogado “A partir de estas manifestaciones que usted hizo en ese reporte, mi representada le pidió a aclaración por escrito, le formuló la siguiente pregunta ¿son los estudios que constan en los anexos 3, 4 y 5 (…) estudios técnicos serios para la determinación de estabilidad de taludes en la zona geográfica donde se comprende entre otros, los PK 33+000 y PK 34+000 [pregunta a) a folio 1059] y su reporte del 10 de abril de 2013 [el abogado leyó (únicamente) el primer párrafo de la respuesta] (…) mantiene usted la opinión expresada en octubre de 2011, en el reporte anterior, de que no se realizaron estudio geológicos geotécnicos previos que la buena práctica estima? [Perito geólogo] Yo en ese momento desconocía si se habían realizado, (…), ahora estos estudios de estos anexos que ustedes me aportaron posteriormente obviamente son anteriores al deslizamiento y son estudios serios. [Abogado] (…) Aún con dichos estudios 3, 4 y 5, ¿era previsible el deslizamiento? [Perito geólogo] Siempre se hace estudios para evitar que se deslice, el deslizamiento, obviamente para poder evitar que un área que se va afectar con un corte se deslice, se deben de conocer todos los parámetros que interactúan para poder modificarlo, ahora ¿es previsible que se vaya a deslizar?
Siempre que se hace un diseño es para que no se deslice, entonces pienso que si uno hace el diseño para que no se deslice, igualmente sería previsible, porque precisamente lo está haciendo para que no ocurra, si usted lo quiere hacer así, igual puede hacerlo para que ocurra. [Abogado] Entonces esos estudios, anexos 3, 4 y 5, ¿son estudios que se hicieron en su opinión para evitar un deslizamiento? [Perito geólogo] Pienso que la gente que los hizo es gente seria, que ese es el objetivo a la hora de hacer esos estudios. (…)” Aclaró el ingeniero que una “falla inferida” es cuando hay zona de la falla que está probada y el resto se proyecta, podría existir o no, se plantea como interrogante, explicó que cuando mencionó la falla La Garita al pie del talud, era una nota al margen “porque en mi criterio no es falla Garita, sino cualquier otra falla, yo lo que quise resaltar es que había en la información que se maneja públicamente información de estructura, y que en la información que revisé no vi que se mencionara ningún análisis estructural para los taludes que diseñaron, es decir, que no se involucró información de análisis estructural, no exactamente la falla Garita, porque yo no la tengo ubicada y lo que existe es una proyección, y que si quiere hacer un trabajo, habría que hacer un trabajo de investigación para poder ubicarla, no necesariamente esa falla tiene alguna relación o podría (…) yo lo puse como una llamada de atención de existe, en Costa Rica en general hay fallas, un sinnúmero de fallas (…) por eso se debe involucrar ese tipo de análisis estructural en la estabilidad de taludes, ahora, allí fue una llamada de atención de que existía ese trazo de falla, lo puse ahí, muy cerca, al pie del talud (…) aquí más bien lo están poniendo en este trazo un poco al norte del área, pero es un trazo que se hace proyectado, que perfectamente pueden variarlo y si alguien lo comprueba, pueden desviarlo por otro lado, es decir, a eso se refería mi anotación, a que por eso se tiene que involucrar ese tipo de estudios en la estabilidad de taludes”.
Reiteró asimismo su informe, en el sentido de “en el informe que realizó Imsa, ellos determinaron dos tipos de roca en esta misma zona G, ellos determinaron que en ese sitio se encontraba el contacto de dos tipos de roca, ignimbritas y el otro lo llamaron lavas meteorizadas, en los diseños que se presentan aquí, se establece un talud de ¾ a 1, que son como 56 grados de inclinación para el corte del suelo y cuando ya van a cortar en la ignimbritas se establece un talud de ¼ a 1, que es alrededor de 78, 79 grados; y Imsa en el área de lavas meteorizadas establecieron que el talud que diseñaron para el suelo de ¾ a 1 era el mismo que debía utilizarse en el corte de las lavas meteorizadas, es decir, definieron un solo talud para todo el corte; en el diseño que se ve acá, se ve el mismo talud empelado para las dos áreas, de ahí mi observación de que por alguna razón cambiaron el diseño. [Abogado] ¿Conoce usted la razón? [Perito geólogo] No conozco la razón de que lo hayan cambiado. [Abogado] ¿Se extrae la razón? [Perito geólogo] no se puede extraer, ahora, en mi opinión, Insuma cuando hizo sus informes fue claro de que ellos no generaron la información nueva en el campo, que ellos lo que estaban haciendo era revisando y conformando, juntando toda la información que había de estudios geotécnicos para ponerlo más claro, entonces, de ahí que, yo expresé, de que el que hizo el trabajo de campo definió un talud y cuando se diseñaron o se presentaron los diseños, no sé si son preliminares o definitivos, se cambió el ángulo del talud.
(…) [Abogado] Le consta a usted de la documentación que revisó, ¿si esos diseños de corte del talud fueron los que se implementaron, los que se realizaron o ejecutaron? [Perito geólogo] No, yo desconozco, yo analicé los que me presentaron, yo desconozco por esto si son definitivos o fueron preliminares, si los aplicaron o que aplicaron. (…)”. La procuradora le preguntó nuevamente sobre la respuesta a en la segunda ampliación del informe, para lo que procedió a la lectura de los párrafos, a lo que el profesional explicó que los estudios hidrogeológicos son de aspectos como el nivel freático, nacientes, de los factores que pueden afectar estabilidad el talud, y que se deben de conocer a la hora de hacer el diseño; el análisis estructural –precisó- es el de fallas y de zonas de fracturas que se debe realizar igualmente, es parte integral de las variables que puede afectar el talud. Reiteró se han de realizar de forma previa, deben ser parte del análisis para diseñar el talud, y que dentro de la información que se le presentó no estaban.
Por otra parte, en cuanto a la pericial del ingeniero civil Edwin Moya Solano, como bien señala la casacionista, ésta versa sobre la variación de la rasante entre los kilómetros 33 y 34 de la carretera (folio 588), no sobre la causa del deslizamiento, por lo que no es relevante para esa determinación.
XVII.Tal y como se reseñó en el considerando XIV de esta resolución, el Tribunal basó su determinación en cuanto la causa del deslizamiento en las declaraciones de los testigos Guzmán Alpízar, Laporte Molina y de la Torre Lozano, así como en las manifestaciones del perito Gómez Bonilla, y una breve referencia al señalamiento efectuado por el perito Moya Solano. Como se adelantó (considerando XVI), en criterio de esta Sala, las conclusiones del perito geólogo Gómez Bonilla son la prueba idónea para determinar el nexo de causalidad entre el talud efectuado, las obras y el deslizamiento de 2009. El profesional fue claro en afirmar que, si bien él no constató cuál fue el diseño aplicado, los diseños efectuados por Insuma en el 2006 que le fueron suministrados, si fueron los que se emplearon, habrían sido la causa del deslizamiento. Así lo refirió insistentemente en su comparecencia, reiterando su informe (en particular, la ampliación de abril de 2013).
Es evidente –y lógico- que la visita del geólogo se dio luego de obras de estabilización, mitigación, él no participó en la construcción, luego no puede dar fe del diseño utilizado durante el procedo edificativo. Llama la atención el interrogatorio de Autopistas del Sol para introducir dudas sobre si fue o no el diseño utilizado, cuando fue esa misma parte quien lo suministró al perito. Por otra parte, es cierto que en la audiencia, el profesional reafirmó el informe (la ampliación referida) en el sentido de que los estudios de los Anexos 3, 4 y 5, realizados en el 2006, por Insuma, son serios. Pero, valga aclarar que el abogado únicamente leyó el primer párrafo de la respuesta en el documento, no así los siguientes, donde el ingeniero había señalado que los estudios revisados y analizados por Insuma, el 99% fueron básicamente geotécnicos (con la excepción de un solo estudio hidrogeológico); y que en su parecer, en la buena práctica, además de la información geotécnica, debió examinarse en forma integral la hidrogeología en cada uno de estos sitios o zonas particulares, y además debió complementarse con un análisis estructural de todo el corredor, lo cual no observó.
Él puntualizó que claramente los estudios fueron serios, y que el diseño tiene por pretensión evitar un deslizamiento. Pero en suma, entiende esta Cámara que fueron incompletos, y que la intención que persigue del diseño no determina la corrección de éste. En este caso, no fue adecuado el diseño del talud que aportó Autopistas del Sol (y realizado por Insuma). El corte y el talud, son la razón del deslizamiento, así lo determinó el señor Gómez Bonilla en su informe (folio 433). Por lo dicho, no lleva razón la recurrente cuando afirma que el perito geólogo no determinó la causa. Luego, no se halla la indebida valoración de esta probanza, la cual se insiste era la fundamental. En consecuencia, el cargo será desestimado. A más de lo anterior, se insiste por último, que la pericia rendida por el señor Moya Solano no aporta elementos para la determinación de la causa del deslizamiento.
XVIII.Segundo. Autopistas del Sol (en el punto H de su recurso), esgrime indebida aplicación y errónea interpretación de normas jurídicas. Explica, el Tribunal estableció dos tipos de relaciones, una entre el Estado, el Consejo Nacional de Concesiones y la concesionaria, y otra entre la concesionaria y terceros, para luego determinar que en este caso la responsabilidad recae sobre ella y la Constructora San José - Caldera, sujeta a las normas y principios del Derecho Privado, pues son las que rigen las relaciones externas derivadas del contrato de concesión, según el legislador. Esto, opina, se separa del principio constitucional de responsabilidad administrativa, e implica un error pues se infieren daños de un vínculo o relación entre ella concesionaria, la Constructora San José – Caldera y los sujetos demandantes, lo cual dista de la realidad. Puntualiza, los actores reclaman lesiones en su propiedad, supuestamente producto de la obra constructiva en sí, la cual es una obra pública, que pertenece al Estado.
Si bien la obra constructiva es ejercida por sujetos de Derecho privado, se delimita en áreas públicas, sea el derecho de vía, y bajo los lineamientos, guías, supervisión y fiscalización del Estado. La excavación fue en terrenos del Estado, no suyos, el reclamo proviene de la obra constructiva y no necesariamente de su acción particular. Expresa, el artículo 69.2 del Reglamento de la Ley General de Concesión Obra Pública con Servicio Público, dispone que el concesionario será el único responsable de todo daño, a menos que le sean imputables a la Administración concedente por medidas que impusiere al concesionario. En igual sentido la cláusula 1.11.4 del contrato de concesión. En este caso, como se observa en los planos de diseño geométrico aprobados, que constituyen los planos de diseño geométrico definitivos de construcción para el (láminas 27 y 28), la Administración concedente y la supervisora del proyecto, Imsa-Euroestudios, aprobaron los diseños de construcción entre los estacionamientos que corresponden al PK 32+800 y PK 34+200, que contempla la zona Balsa-Pan de Azúcar, por lo cual es claro que debió realizar las obras tal y como fueron autorizadas por la Administración concedente según ese diseño “una vez otorgada la orden de inicio de construcción, ya que sin estas órdenes y/o instrucciones no podían iniciarse la construcción”.
Insiste, la aprobación de los planos de diseño y la posterior orden de inicio, constituyen a la luz del contrato de concesión, órdenes e instrucciones de la Administración concedente, que le eximen de responsabilidad subjetiva. Por medio de la fiscalización ejercida por la Administración y la supervisora se determinó y aprobó que los planos de diseños de la zona Balsa-Pan de Azúcar estaban de acuerdo con la práctica ingenieril y los estudios, especificaciones y normas técnicas referenciales. Por consiguiente, realizó la obra siguiendo las obligaciones que la Administración le impuso, por ello aplica la exoneración prevista en el Reglamento y el contrato. Cita la sentencia 5207-2004 de la Sala Constitucional. Continúa, la Ley General de Concesión de Obras Públicas con Servicios Públicos y su reglamento, en cuanto a la responsabilidad de la concesionaria ante terceros, deben ser vistas en relación con el vínculo jurídico que se establezca o llegue a establecer con el concesionario y el tercero, pero ello no puede exonerar al Estado de una eventual responsabilidad cuando sean vulnerados los derechos de los particulares, por las administraciones públicas en el despliegue de su giro o desempeño público.
Resalta, el Estado es siempre responsable del daño y está obligado a resarcir las lesiones antijurídicas efectivamente sufridas por el administrado como consecuencia de la función administrativa, sea a través de conductas positivas o negativas de los entes públicos o de sus contratistas. Añade, si las circunstancias del caso lo permiten, es posible que frente al tercero damnificado coincidan la responsabilidad civil subjetiva del concesionario con la responsabilidad objetiva del Estado; de igual manera que puede darse una exoneración de responsabilidad del concesionario pero mantenerse la responsabilidad objetiva del Estado. En el presente, finaliza, debió exonerársele y analizar si hay responsabilidad objetiva y directa del Estado.
XIX.El Tribunal señaló que en el presente proceso figuran dos sujetos públicos y dos sujetos privados, relacionados por el contrato de concesión de la carretera San José – Caldera y la Ley General de Concesión de Obras Públicas con Servicios Públicos, no. 7762 (en adelante LGCOPSP). Sostuvo, lo natural es que la responsabilidad interna (entre las partes contratantes) y la externa (las partes frente terceros), se defina con arreglo a las normas preestablecidas. Reprodujo las cláusulas 1.3, 1.1, 1.2 y 1.11.4 del convenio; la última señala que el concesionario será el único responsable de todo daño y perjuicio, de cualquier naturaleza, que con motivo de la construcción de la obra o la explotación del servicio, ocasione a terceros, al personal, a la propiedad de terceros o al ambiente, a menos que sean imputables a la concedente por medidas que ésta le haya impuesto al concesionario. Prosiguió, según el artículo 18.f de la LGCOPSP, establece como obligación general del concesionario indemnizar por los daños y perjuicios que ocasionen a terceros como consecuencia de la ejecución de la concesión.
El precepto 38 ibídem dispone que en lo referente a derechos y deberes con terceros, el concesionario se regirá por las normas del Derecho Privado, y será responsable ante la Administración concedente por los daños y perjuicios que se deriven de cualquier subcontratación. Continuó, el Reglamento a la Ley, canon 67, estatuye que en las obligaciones y derechos con terceros, el concesionario se regirá por el Derecho Privado, y en el mandato 69, que respecto de los daños ocasionados a terceros, al personal, a la propiedad de terceros o al ambiente, el concesionario será el único responsable, salvo que las lesiones sean imputables a la concedente por medidas que ésta le haya impuesto al concesionario. Todas estas normas, concluye, articulan un sistema según el cual tratándose de la concurrencia de responsabilidades entre un ente público y un sujeto de Derecho Privado con el cual se mantiene una concesión, el único responsable de todo daño a terceros, con motivo de la construcción o explotación de la concesión, es el concesionario. Finalizó, la Administración concedente está excluida de los reclamos de terceros por actos, hechos o conductas nacidas de esa relación, a causa o con motivo de su ejecución.
XX.El sistema de responsabilidad de la Administración Pública y del Estado en general, se desprende de la Constitución Política, artículos 11 (principio de legalidad), 18 y 33 (igualdad en el sostenimiento de las cargas públicas), 34 (resguardo de los derechos adquiridos y de las situaciones jurídicas consolidadas), 41 (derecho a la resarcibilidad plena de los daños); 45 (protección de la propiedad privada); 49 (tutela de los derechos subjetivos e intereses legítimos), 50 (responsabilidad por daños ambientales); 74 (solidaridad social), 148, 149, 154, 166 y 188 (responsabilidad del Presidente de la República, Poder Ejecutivo, Consejo de Gobierno, Poder Judicial y de los directores de las instituciones autónomas, y 139 inciso 4), 140 y 191 (derecho al buen funcionamiento del servicio público). En este sentido puede consultarse las sentencias no. 5207-2004 del 18 de mayo de 2004 de la Sala Constitucional y no. 308-F-2006 del 25 de mayo de 2006 de este Tribunal.
El desarrollo legal de este principio constitucional de responsabilidad pública se encuentra, en primer término, en la Ley General de la Administración Pública. Posteriormente, es desarrollada en otros cuerpos legales, tales como la Ley de Contratación Administrativa, la Ley Reguladora del Servicio Público de Transporte Remunerado de Personas en Vehículos en la Modalidad de Taxi, la Ley Reguladora de Transporte Remunerado de Personas Vehículos Automotores y la Ley General de Concesión de Obra Pública con Servicio Público, última que es la que debe aplicarse al presente asunto, como se verá de seguido.
XXI.La Ley General de Concesión de Obras Públicas con Servicios Públicos, no. 7762, contiene normas que definen la responsabilidad extracontractual de las partes de un contrato administrativo frente a terceros damnificados por la ejecución precisamente del convenio. En particular, en cuanto al sujeto responsable. Así, establece el canon 18 inciso f) que es obligación del concesionario “Indemnizar por los daños y perjuicios que se ocasionen a terceros como consecuencia de la ejecución de la concesión” (antes de la modificación efectuada mediante Ley 8696 del 17 de diciembre de 2008 –que corrió la numeración de los apartes-, este inciso correspondía al e). El mandato 36 señala que durante la etapa constructiva, las “obras se ejecutarán a riesgo del concesionario (…)”. Y por último dispone el numeral 38 “Régimen aplicable a las relaciones del Concesionario [.-] En lo referente a derechos y deberes con terceros, el concesionario se regirá por las normas del Derecho Privado.
Será responsable ante la Administración concedente por los daños y perjuicios que puedan derivarse de cualquier subcontratación.” Dentro de las obligaciones de la Administración concedente contenidas en el artículo 16, no incluyó el legislador el reparar los daños y perjuicios que produzca la ejecución del contrato por parte del concesionario. Y es que –como se vio- ese deber lo impuso al contratista, quien es quien despliega la conducta lesiva ordinal 18.f). De esta manera, los efectos de la actividad del concesionario no los atribuye a la Administración concedente por la mera titularidad de la obra y del servicio público. La titularidad por sí misma es insuficiente como criterio primigenio de imputación, no resulta lógico que la entidad pública deba responder por una conducta –que aún en el marco de un contrato administrativo- le es ajena. Y que además en el caso de un contrato regulado por la Ley 7762 (como el de este asunto), para la fase constructiva se enmarca expresamente dentro de los deberes que la Ley impone al concesionario en el precepto 36.e, en el sentido de que debe “Apegarse a los mejores procedimientos constructivos y a los planos de construcción de las obras aprobadas (…)”.
Esta atribución exclusiva de responsabilidad al concesionario en la LGCOPSP es reforzada por el mandato 36 ejúsdem ya citado que endosa el riesgo al contratista. Para finalizar, ha de señalarse solamente que el artículo 38 elimina cualquier duda que podría surgir sobre las normas que rigen esa responsabilidad extracontractual del concesionario con terceros (y en general, las relaciones entre éstos). En principio cabría cuestionarse si ha de seguirse la condición de sujeto privado del contratista o bien el carácter público de la obra y del servicio que le ha sido delegada, y así elegir –en forma fundada- el sistema de responsabilidad aplicable al concesionario, bien el subjetivo del derecho privado, bien el régimen –predominantemente- objetivo propio de responsabilidad administrativa. Sin embargo, el legislador esclareció la disyuntiva, al estatuir en el precepto mencionado el “Régimen aplicable a las relaciones del Concesionario [.-] En lo referente a derechos y deberes con terceros, el concesionario se regirá por las normas del Derecho Privado.
Será responsable ante la Administración concedente por los daños y perjuicios que puedan derivarse de cualquier subcontratación”. En este mismo sentido anotado, el Reglamento General de Concesión de Obras Públicas con Servicios Públicos, Decreto Ejecutivo 27098, establece en el artículo 69 que con relación a “Daños a terceros [.-] 69.1 Durante el plazo de la concesión, el concesionario está obligado a adoptar todas las medidas que sean razonables, para evitar daños a terceros y al personal que trabaja en la construcción de la obra o en la explotación del servicio. Igualmente deberá tomar todas las precauciones para evitar daños a la propiedad de terceros y al ambiente. [.-] 69.2 El concesionario será el único responsable de todo daño, de cualquier naturaleza, que con motivo de la construcción de la obra o la explotación del servicio se ocasione a terceros, al personal de la obra, a la propiedad de terceros o al ambiente, a menos que los daños le sean imputables a la Administración concedente por medidas que ésta le impuso al concesionario”.
Es claro que esta reglamentación de la LGCOPSP tiene la virtud de que reconoce situaciones en el que daño se produce por una actuación del concesionario que le había sido ordenada concretamente o impuesta por la Administración. Luego, es este accionar administrativo la génesis de las lesiones, es éste la razón por la cual el concesionario despliega la conducta que resulta perjudicial al tercero. Por ello, el precepto reglamentario atribuye el deber indemnizatorio al ente público concedente.
XXII.En el sub lite, como punto de partida, tuvo por demostrado el Tribunal que la construcción de la carretera San José – Caldera es una obra pública del Estado, otorgada en concesión de obra pública con servicios públicos a Autopistas del Sol, quien a su vez subcontrató para esa fase a Constructora San José – Caldera (así los hechos demostrados noveno y décimo). Asimismo, partió el Tribunal de que esta concesión se tramitó y otorgó de conformidad con la LGCOPS (considerando tercero, punto segundo). En este panorama, se tiene configurada en primer término una relación de carácter contractual; al tiempo que se crea un vínculo entre los sujetos usuarios de la obra pública concesionada, el concesionario y la Administración Pública. Pero además de ello, según se apuntó, la existencia de aquella relación contractual, la ejecución de las labores edificativas de la obra, a su vez generó daños a terceros, no usuarios de la obra, quienes son Constructora Guter Martínez y los señores José Martín Irías Hernández, Adilza Murillo Blanco, Maciel Irías Murillo, Maylin Irías Murillo y Juan Manuel Víquez Quesada.
Tal y como determinó el Tribunal y coincidió esta Sala considerandos que anteceden, Autopistas del Sol y Constructora San José – Caldera, al excavar el terreno y hacer el talud (siguiendo el diseño también contratado a la primera), provocaron un deslizamiento de tierra que afectó las dos propiedades de Constructora Guter Martínez, en las cuales se ubican dos casas de habitación que ocupaban las personas físicas actoras. Ha sido entonces la conducta de la concesionaria y la de su subcontratista la que generó ese particular daño, del cual luego se derivan las lesiones morales. Los efectos de esa conducta son atribuibles sólo a quienes la desplegaron, de suerte tal que la obligación de resarcir esos detrimentos pesa únicamente sobre Autopistas del Sol y Constructora San José - Caldera. Esto por cuanto –se insiste- han sido quienes realizaron esa labor, y en especial porque la LGCOPSP así lo estableció expresamente en el artículo 18.f.
La sentencia del Tribunal no violenta el principio constitucional de responsabilidad de la Administración Pública, pues no existe en este asunto conducta administrativa que haya coadyuvado en la generación del daño. La simple titularidad de la obra pública (y el tantas veces mencionado derecho de vía) no puede –como pretende el casacionista- ser criterio de imputación, pues no existe norma de rango constitucional ni legal que dé fundamento a esa tesis. La titularidad sobre la obra o del servicio público no es suficiente para endilgarle a un ente público solidaridad en el deber de reparar como si se tratare de una coautoría, mucho menos aún –como alega Autopistas del Sol- para hacerle recaer la totalidad de esa obligación. Máxime cuando en contratos como el presente, el objeto incluía el diseño de la obra, lo cual si bien no es un aspecto oponible a los actores (terceros respecto de ese acuerdo), si llama la atención este enfoque por parte de quien si está demarcado por esa voluntad.
En este punto, en razón del apartado tres del considerando tercero del fallo, así como de las conclusiones de la representante estatal, valga insistir a modo de aclaración, que las cláusulas contractuales (incluyendo las relativas a la responsabilidad frente a terceros) rigen para las partes contratantes, no así para de terceros damnificados; de manera que la solución de este asunto está dada por la Ley, no así por la voluntad del Estado, del CNC y de Autopistas del Sol. Por último, esgrime adicionalmente la recurrente que ejecutó los planos que aprobó la Administración concedente y la supervisora del proyecto, y que estos planos junto con la orden de inicio son precisamente órdenes e instrucciones de la concedente que le eximen de responsabilidad, según el Reglamento. Este preciso alegato, con ese detalle, se introduce en esta fase casacional, por lo que no fue objeto de debate. De allí que, de conformidad con el artículo 608 del Código Procesal Civil (aplicable según el 220 el precepto del CPCA), esta Sala está impedida de verter pronunciamiento al respecto.
Debe aclararse que es novedoso, pues aún y cuando al contestar la demanda, Autopistas del Sol refirió lacónicamente que la Administración aprobó los planos, ello fue como parte de las alegaciones de titularidad de la obra y del derecho de vía para fundar la atribución de responsabilidad a la Administración Pública y excluir la suya. Por demás, tampoco el argumento coincide con el de la parte actora, quien en la demanda invocó una omisión de la actividad fiscalizadora que le correspondía al Estado por ser el concedente de la construcción de la carretera (folios 31 y 32). En otras palabras, lo esgrimido por los demandantes respecto del Estado fue una inactividad fiscalizadora durante la ejecución de la fase constructiva; no así una falta administrativa en la aprobación de planos, lo cual correspondería sí a la ejecución del contrato, pero en su etapa de diseño y planificación. Así las cosas, por las razones anotadas, se declara sin lugar este cargo de Autopistas del Sol.
XXIII.Tercero. Acusa Constructora San José – Caldera (en el motivo primero de su recurso) trasgresión de los mandatos 1025 y 1046 del Código Civil. Puntualiza, la sentencia le condena solidariamente con Autopistas del Sol, pero no justifica el por qué de esa solidaridad, simplemente la presume. Con esto, explica, violenta el artículo 1025 y el principio de la relatividad de los contratos, pues se le imponen efectos resarcitorios en razón de un contrato del cual no es parte. Dice, podría pensarse que los es por la supuesta relación de sub-contratación o de los socios, que se mencionan, pero no se justifica del todo, de manera que no puede definir si esa apreciación es o no correcta. Asimismo, se inobserva el precepto 1046 ibídem, ya que no hay un mínimo tratamiento de la solidaridad en la obligación de pago de Autopistas del Sol y suya. Detalla, el Tribunal consideró que Autopistas del Sol es responsable por conducta negligente al no hacer los estudios previos necesarios, pero no explicó porque ella debe responder por esa supuesta negligencia.
XXVIV.Tuvo por demostrado el Tribunal que la construcción de la carretera San José-Caldera es una obra pública otorgada en concesión a Autopistas del Sol (así el hecho probado 9). Y que precisamente para la fase de construcción Autopistas del Sol la subcontrató a Constructora San José – Caldera (hecho probado 10). Así las cosas, es claro que es responsable de las labores constructivas quien las ejecutó, esto es, Constructora San José – Caldera. Así lo reconoció cuando contestó la demanda; en este sentido reconoció fue ella quien efectuó el movimiento de tierra y procedió a construir (folio 108 y 113). Tal y como se determinó en los considerandos XIV y XV, la conducta directa de Constructora San José – Caldera es la que ocasionó el daño en las propiedades de Constructora Guter y la consecuente lesión a las personas físicas que en esos predios habitaban, fue el corte, el talud, en ejecución de un diseño inapropiado según la técnica.
El Tribunal reprochó la falta de estudios hidrogeológicos y estructurales, asimismo, determinó que la excavación del terreno bajó la rasante donde se construía la carretera, cortó la base y desestabilizó geológicamente el cerro Pan de Azúcar. Se agrega, que esa excavación, el talud, respondió a diseños con falencias según determinó el perito. En este punto, conviene añadir que el Tribunal destacó que el perito ingeniero civil, Edwin Moya Solano, señaló que los ingenieros de esta empresa constructora tenían la obligación de apartarse de los estudios de referencia. Luego, respecto de la condena a la Constructora San José – Caldera no hay desatención de los cánones 1025 y 1046 del Código Civil.
XXV.Cuarto. Autopistas del Sol (en el agravio G de su recurso), arguye infracción de los principios de razonabilidad y proporcionalidad. Expone, el fallo condena a pagar a los señores José Martín y Maciel las sumas de ¢3.000.000,00 y a Juan Manuel y Maylin los montos de ¢5.000.000,00, tomando en consideración el informe psicológico aportado sobre el impacto del deslizamiento y del tratamiento recibido. No obstante, manifiesta, el Tribunal omitió valorar que el reclamo de las personas físicas lo fue por su participación como accionistas de la sociedad propietaria de los bienes, y que nunca se presentó prueba de que al momento de los hechos ya eran accionistas, la certificación del capital accionario no determina el momento de adquisición de las acciones. Además, no hicieron reclamo como moradores u ocupantes de las viviendas ubicadas en los terrenos; pero aún de haberlo hecho, no consta prueba en ese sentido.
Todo esto, concluye, determina una evidente falta de legitimación activa. Por otra parte, prosigue, no existieron testigos que contribuyeran a demostrar la existencia de los factores apuntados por el Tribunal; el reporte psicológico es una prueba documental que no puede equivaler a una pericial en la que se hubiere podido determinar la existencia de un daño moral o inclusive uno psicológico. No hay prueba del daño moral, y aún cuando se hubiese podido demostrar “(aún in re ipsa)” la fijación del monto es totalmente exorbitante y alejada de la realidad, sin relación con los hechos, lo que evidencia que fue determinado en forma antojadiza, sin justificación alguna, con violación por tanto de los principios constitucionales de proporcionalidad y razonabilidad.
XXVI.En este cargo, la casacionista mezcla vicios sustantivos con uno procesal. En efecto, del desarrollo se extrae que inserta en realidad tres recriminaciones: A) en primer término, asevera el daño moral se pidió como accionistas de la dueña de las fincas, no así por ocupar los predios, lo que determina la falta de legitimación en cuanto a este extremo concedido; B) alega no se demostró el daño moral, ya que no se demostró que fueran accionistas, tampoco moradores; y C) la fijación de monto del resarcimiento es antojadizo y sin justificación en infracción de los principios de razonabilidad y proporcionalidad.
XXVII.En lo tocante al punto A, parece reclamar de forma sumamente lacónica una incongruencia, dentro de un cargo donde plantea reclamos por el fondo. Se rechazará por no explicarse con claridad. A más de lo anterior, remítase Autopistas del Sol al considerando VIII de este fallo, que denegó el motivo similar formulado por la otra sociedad recurrente. Valga reiterar que la indemnización por este daño extrapatrimonial si fue peticionada con fundamento en que las personas físicas actoras viven en las casas sitas en las fincas afectadas con el deslizamiento. Respecto del punto B), se advierte en primer lugar que no hay mención de normas sustantivas atinentes. Los principios constitucionales que refiere están en función de la cuantía, no así de la determinación del daño. En todo caso, tal y como se expresó en el considerando X de esta sentencia, corresponde al juez determinar el daño moral a través de inferencias lógicas a partir de los hechos que ha tenido por acreditados, por lo que no requiere el análisis de probanzas particulares.
En el sub júdice, en el hecho probado no. 2 de la resolución impugnada, el Tribunal estableció que las persona físicas actoras habitan los terrenos, para ello se basó el Tribunal en la demanda, en el testigo Jesús Campos Fernández y en las declaraciones de José Martín Irías Hernández, Adilza Murillo Blanco y Maylin Irías Murillo. Asimismo, en la circunstancia no. 13, relató que Maylin Irías Murillo y Juan Manuel Víquez Quesada, por la oferta de Constructora San José – Caldera, desalojaron su vivienda, con base en las declaraciones del testigo recién citado y de Jose Martín Irías. En los hechos 6 y 7, mencionó sendas notas de Constructora San José - Caldera dirigidas a los actores, con relación a las grietas y deslizamiento y la recomendación de desalojo, con fundamento en esas pruebas documentales. En suma, el Tribunal infirió el daño moral de un cúmulo de circunstancias que fueron acreditadas con los elementos probatorios señalados.
La recurrente no objeta la apreciación de esas probanzas, para quebrar esos hechos y consecuentemente aquella inferencia lógica. Ergo, el punto también desestimarse. Por último, en lo relativo al punto C) sobre la razonabilidad y proporcionalidad de la fijación dineraria resarcitoria, según se apuntó en el considerando IX de este fallo, el Tribunal determinó que todos los sujetos personas físicas demandantes sufrieron un detrimento moral, en razón de la incertidumbre y preocupación, y en el caso de Maylin Irías Murillo y Juan Manuel Víquez Quesada dicho estado de ánimo se agravó por su hijo menor y haber abandonado su vivienda según la propuesta de Constructora Caldera. Estos fueron los motivos que rindió el Tribunal para su decisión. Esta Sala coincide con ellos, el observar que las propiedades donde habitan sufren un deslizamiento, que hubo afectación de sus casas, es un hecho que innegablemente ocasiona perturbación, no se sienten protegidos en el ámbito físico de resguardo último que tiene cualquier ser humano, donde descansan y desarrollan buena parte de sus actividades, todo durante más de un año.
Se trata de una intranquilidad por un tiempo prolongado. De manera que estima esta Sala que las sumas de ¢3.000.000,00 que el Tribunal concedió a José Martín Irías, Adilza Murillo y Maciel Irías (respectivamente) y de ¢5.000.000,00 a Maylin Irías y Juan Manuel Víquez, son razonables al lapso durante el cual se mantuvieron en ese estado, nótese que en el caso de los dos últimos la preocupación se acrecentó por el no continuar dando a su hijo menor un techo, una casa en la cual pudiera vivir y desarrollarse. En síntesis, el cargo se denegará.
XXVIII.En mérito de lo expuesto, procederá declarar sin lugar los recursos planteados por Constructora San José - Caldera y Autopistas del Sol. Deberán las sociedades recurrentes sufragar las costas generadas con su ejercicio, tal y como establece el canon 150.3 del CPCA.
POR TANTO
Se declaran sin lugar los recursos de casación planteados por Constructora San José – Caldera Sociedad Anónima y Autopistas del Sol Sociedad Anónima, quienes deberán sufragar las costas generadas con su ejercicio.
