Consolidated ordinary proceedings (procesos ordinarios acumulados) brought before the Agrarian Court (Juzgado Agrario) of the Second Judicial Circuit of Alajuela, under the following case numbers: the first, 09-000028-0298-AG, filed by FÉLIX QUIRÓS DÍAZ against MIGUEL MASÍS UGALDE and GREGORIA MORENO GÁMEZ, unmarried, homemaker; and the second, 11-000048-0298-AG, filed by MIGUEL MASÍS UGALDE and GREGORIA MORENO GÁMEZ, unmarried, homemaker, against FÉLIX QUIRÓS DÍAZ. Attorney Hubert Rojas Araya serves as special judicial attorney-in-fact (apoderado especial judicial) for Mr. Quirós Díaz. The natural persons are of legal age and, except as otherwise noted, married, farmers, and residents of San Carlos.

CONSIDERING
I.On January 30, 2009, Mr. Felix Quirós Díaz filed suit against Miguel Masís Ugalde and Gregoria Moreno Gamez. In that complaint, he stated that he is the owner of an unregistered property, currently used as agricultural land, located in Santa Clara de Florencia de San Carlos, province of Alajuela, bounded to the north by Felix and Alberto Quirós Díaz; to the south by Cristiam Jesús Masís Salas; to the east by the Santa Clara River; and to the west by a public road, with an area of 3.311,75 square meters, according to cadastral plan no. A-310230-96 of March 7, 1996. He stated that the land had belonged to his father for more than 30 years, until his father transferred the possessory rights (derechos posesorios) to him by means of a public instrument (escritura pública) executed on January 18, 1996, before notary public Manuel Chacón Arrieta. He asserted that he is the person who has cultivated and properly maintained it.
He stated that he was seriously ill in May 2008, at which time the co-defendants took advantage of the situation to encroach upon part of his property, on the northern side, where they built a shack and fences. He indicated that they acted in bad faith because they knew that the lot belonged to him, since they lived barely 400 meters from the site. In essence, he requested that the co-defendants and any other person present on the property be ordered to vacate it and restore it to him; demolish every structure they had built; place him in possession of the disputed property; refrain from disturbing, dispossessing, or in any way interfering with the possession and ownership he had maintained, with a warning that failure to comply would constitute the offense of disobedience of authority; pay the damages and losses caused, which he itemized as follows: ¢100.000,00 for removing 15 fence posts; removing the existing fence facing the public road; erecting another fence along the northern and eastern boundaries; and cutting down five fruit-bearing plantain plants; ¢200.000,00 for losses resulting from his inability to use and enjoy the property; and pay all legal costs.
The defendants answered the complaint out of time. They also instituted proceedings against Mr. Felix Quirós Díaz, alleging that, since May 2008, they have possessed an unregistered parcel of land located in Alajuela, Florencia de San Carlos, 650 meters south of the bridge over the Santa Clara River, on the road to Santa Rita, with an approximate area of 1.300,00 square meters. It is bounded to the north by Cristhian Masís Salas; to the south by Gilberto Chaves Zúñiga; to the east by the Santa Clara River; and to the west by a public road, with 42 meters of frontage, and it has no cadastral plan. They stated that the property is situated along the bank of the Santa Clara River and had been overgrown with brush, with fencing only along the southern boundary. They further stated that part of the property had been possessed by Mr. Jaime Portugués, from whom they acquired it together with the improvements, which consisted of a shack located on the southern side.
They added that they built two more shacks there, have lived there permanently, and have cultivated plantains, tiquizque, sweet peppers, cassava, sweet potatoes, sugarcane, and avocado trees. They related that, although the defendant claims the land as his own and asked them to vacate it, they refused his request because they have lived in the area for more than 12 years and the property had always remained unoccupied until Mr. Jaime Portugués began possessing it. They further explained that, although the plaintiff claims the property on the basis of an instrument through which he supposedly acquired it, that instrument pertains to property located elsewhere, and the identity-card number of the transferor belongs to another person. They also alleged a series of other inconsistencies, including its area and character. In essence, they sought a declaration that public instrument no. 161-19, by which the defendant apparently purchased the property, pertains to land different from the land they possess.
They added that cadastral plan no. A-310230-96 does not include the disputed property but instead concerns a different property, and that it likewise does not pertain to the property described in the cited public instrument. The property over which they have exercised possession differs in character, location, area, boundaries, and geographic and topographic reference from that described in instrument no. 161-19 and plan no. A-310230-96. They are the sole lawful possessors of the property. They requested that the defendant be ordered, under penalty for disobedience of authority, not to disturb them and to cease his threats and factual and legal actions against them, in view of the possession they have exercised. They also requested that he be ordered to pay the damages and losses caused, which they itemized as follows: for material damages, ¢550.000,00 in attorneys’ fees and ¢150.000,00 for travel expenses and other expenses incurred in attending to judicial proceedings; ¢1.000.000,00 for emotional distress; ¢750.000,00 for losses resulting from the deterioration of their physical and psychological health; and the legal costs of the proceedings.
Mr. Felix Quirós Díaz denied the allegations without raising defenses. The A quo partially granted the complaint filed by the latter and ordered the co-defendants to restore the property to the plaintiff; if they failed to do so voluntarily within five days after the judgment became final, their eviction would be carried out by law enforcement. It warned them that, in the future, they must refrain from disturbing or dispossessing the plaintiff of his rights of possession and ownership and that, if they failed to do so, they would be prosecuted for the offense of disobedience of authority. It further ordered them, at their own expense, to remove or destroy the structures built and the banana-family plantings and fruit trees introduced onto the property within five days; if they failed to do so, the plaintiff was authorized to carry out that work at the co-defendants’ expense. They were ordered to compensate the plaintiff for the losses caused, in an amount to be determined during enforcement of the judgment.
The court denied the claim for material damages and ordered them to pay all legal costs of the proceedings. As to the suit brought by Mr. Miguel Masís Ugalde and Ms. Gregoria Moreno Gámez against Mr. Felix Quirós Díaz, it dismissed all claims and ordered them to pay the legal costs. The judge further stated that the judgment was subject to appeal and that, if challenged, the notice of appeal had to be submitted both in writing and electronically; if they wished the Tribunal to grant them an oral hearing, they had to expressly request it in the corresponding appeal. The Ad quem rejected the alleged nullity and affirmed the decision. Dissatisfied, the unsuccessful parties filed an appeal in cassation (recurso de casación), asserting procedural and substantive grounds for error. Accordingly, the procedural grounds will be set forth and decided first.
Appeal in cassation on procedural grounds
II.First: They contend that the Tribunal did not rule on their complaint and did not examine the entire case record, but limited itself to considering broad issues and testimonial evidence. They state that, in their “…view, the greatest error we challenge in the issuance of the second-instance judgment is that it failed to take into account that… the A quo should also have issued, in the same ruling, a judgment in the proceeding instituted (sic) by the undersigned, which was entitled to the same weight and consideration as the proceeding instituted by Mr. QUIRÓS DÍAZ… and, in the case of the complaint filed by the undersigned, it treats it as subsidiary or less important, which is erroneous because both proceeding (sic) have the same standing before the law and the courts; the foregoing is apparent not only from the narrative structure but also from the order in which the analysis is addressed, something made more than evident by the fact that 21 pages out of a total of 29… were devoted to deciding the complaint filed by Mr.
QUIRÓS DÍAZ, while… only 7 pages were devoted to ruling on the complaint filed by the undersigned….” They insist that the Tribunal did not examine their complaint, which, in their view, violates the provisions of section 54 of the LJA. They argue that portions of the complaint were taken out of context, such as the assertion that they claimed ownership under a purchase and sale agreement, when their statement actually referred to the improvements acquired from Mr. Jaime Portugués. Therefore, they contend, it cannot be concluded that they lack standing because they have no instrument transferring possession. Second: They assert that, in accordance with the instructions of the Court, they requested an oral hearing in order to argue the appeal they had filed. They complain that, inexplicably, the Tribunal denied them that right without stating its reasons. They therefore maintain that their procedural rights were violated.
In their opinion, holding the hearing was not discretionary, as the Ad quem sought to suggest, and due process was consequently violated. Third: They challenge the manner in which the second-instance judges calculated the deadline for requesting supplementation and clarification of their judgment. They explain that notice was received by fax at 20 hours 30 minutes on February 26, 2013, and that their attorney did not learn of it until the following day. They argue that notice should have been deemed given on the immediately following day and that the period should not have begun to run until February 28, 2013. They add that, even if the date of notice and the deadline—which the Ad quem deemed to be 24 hours—were interpreted otherwise, the period would not have expired until February 28, 2013, at 20 hours 30 minutes. They point out that this was plainly outside business hours and that, in their view, the request filed on March 1 of that year was therefore timely.
They further assert that the period established in Article 58 of the Ley de la Jurisdicción Agraria (LJA) applies to the filing of a motion for reconsideration (recurso de revocatoria), whereas this matter involved a request for supplementation and clarification. They state that this is merely a procedural step intended to correct judgments. Regarding the Tribunal’s other basis for setting a 24-hour period pursuant to section 498 of the Código de Trabajo, they maintain that the provision applies to first-instance decisions. They continue that the LJA establishes no period for requesting supplementation and clarification; therefore, under section 6 of that statute, the applicable period is the three-day period established in section 158 of the Código Procesal Civil.
III.Before analyzing the objections, it is necessary to refer to what this Chamber has held regarding this category of errors: “III.- …On this point, the appeal before this Chamber, which is specific to agrarian matters, is not governed entirely by the provisions on cassation (casación) in the Code of Civil Procedure (CPC), since the Agrarian Jurisdiction Act refers to the appeal provided for beginning with section 556 of the Labor Code. Nevertheless, this Chamber has analyzed the circumstances that would permit consideration of claims such as the one alleged. Thus, for example, in judgment 583 of 11 hours 35 minutes on 14 de julio de 2004, it held: “V.- This Chamber has repeatedly stated […] that one characteristic of the appeal in cassation in this field is that it is limited exclusively to consideration of substantive issues. This follows from Article 559 of the Labor Code, applicable to this type of proceeding by express reference in section 61 of the Agrarian Jurisdiction Act.
However, now, with its new composition, this Court reconsiders that position on the basis of the following arguments. The aforementioned provision of the Labor Code states: “APPEAL IN CASSATION. SUMMARY DISMISSAL. Upon receipt of the record, the Chamber shall summarily dismiss the appeal if it was filed contrary to Articles 556 and 557. It shall do the same when the appeal seeks only the correction, reinstatement, or performance of procedural steps.” (Emphasis not in the original). For the case at bar, the second part of the article under discussion is relevant. Procedural scholarship has indicated that the grounds for cassation based on procedural matters, set forth in Article 594 of the Code of Civil Procedure, may arise during the three stages of the proceeding:
IV.In the first objection, lack of congruence is alleged. Regarding this violation, this Chamber has held: “…the congruence of the judgment, enshrined in Article 155, opening paragraph, of the Code of Civil Procedure and, in the case of the agrarian jurisdiction, derived from section 54 of the Act governing that field, consists of the necessary relationship and harmony that must be evident between the ruling set forth in the operative part of the judgment and the limits established by the parties’ substantive claims and the matters disputed. Thus, the judge may not omit a ruling on any disputed issue (minima petita), award more than was requested, that is, exceed the relief sought (ultra petita), or add matters not raised by the litigants (extra petita). It would also arise when the judgment contains contradictory rulings. In other words, there is no lack of congruence between the reasoning of the judgment and the ruling in its operative part.
No. 728 of 10 hours 5 minutes on 4 de octubre de 2007”. No. 749 of 9 hours on 17 de junio de 2010”. Judgment no. 176 of 9 hours 25 minutes on 14 de febrero de 2013. The appellants argue that the error arose because their counterclaim (reconvención) was not decided. It is clear that this is not an error involving lack of congruence, because the Ad quem did not omit a ruling on the matter from the operative part of the judgment; rather, it ruled on it by rejecting the counterclaim and affirming the Trial Court’s decision dismissing it. In the relevant portion of its reasoning, the Court stated: “…it follows that the a quo did in fact rule on the two complaints filed and processed under case files 09-000028-298-AG and 11-000048-298-298-AG… When deciding the complaints, the trial judge clearly distinguished between them in both the reasoning and the operative part, specifically referring to the facts stated by each party and to the evidence and claims set forth in the complaint filed by Miguel Masís and Gregoria Moreno; each of them was addressed, together with due explanation of why it was rejected.” Consequently, the alleged error did not occur, because a ruling was issued on the complaint filed by the appellants, although it was denied.
V.In another vein, they state that portions of the complaint were taken out of context and that it therefore cannot be concluded that they lack standing (legitimación) because they do not hold an instrument transferring title. If such a violation occurred, it would constitute a defect on substantive grounds, rather than the lack of congruence alleged by the appellants. In this field, although the appeal is governed by the anti-formalism principle (principio antiformalista), since it is not subject to special technical formalities, this does not dispense with the requirement to provide clear and precise reasons warranting allowance of the appeal. Accordingly, this adjudicative body has held: “…the specific nature of this type of appeal entails certain particularities that should be clarified. First, it must be stated that agrarian cassation does not require special formalities; this does not mean that it is informal, since the appeal must be technically organized by listing and structuring the objections to the judgment in order to demonstrate its lack of legal validity (Article 557 of the Labor Code).
From this standpoint, the appellant must necessarily explain the clear and precise reasons supporting the application. Each and every legal basis of the challenged judgment to which objection is made must be systematically contested. Under this interpretation, the aforementioned dispensation refers solely to the identification of the provisions of the Legal System that were violated or the type of violation committed.” Judgment no. 952 of 16 hours 20 minutes on 7 de diciembre de 2005. In the case under review, it is evident that, regarding the error they allege, they do not state the reasons supporting their position; they merely assert that it is untenable to find that they lack standing because they do not hold an instrument transferring title. Thus, it is not sufficient for them merely to argue that they disagree with the Ad quem’s ruling; they were required to explain clearly and precisely how the error occurred and how it affected the ruling. Given these deficiencies, the appropriate course is to reject the objection.
VI.In the second and third grounds of grievance, the appellants allege that they were denied a hearing before the Court without being given reasons and that the appellate judges improperly applied the 24-hour time limit for requesting supplementation and clarification (adición y aclaración). As stated in Considerando III, an appeal in cassation on procedural grounds in agrarian matters is admissible only for violations inherent in the challenged judgment, not for issues arising during the course of the proceeding, which by statutory mandate (sections 559 of the CT and 61 of the LJA) are excluded from its review. Consequently, those objections cannot be entertained by this Court.
Appeal in cassation on substantive grounds
VII.First: They complain that the evidence was improperly assessed. They state that the appellate court (Ad quem) made the same error as the Trial Court, because it granted Mr. Quirós Díaz’s claim and found that he had established the identity of the property, active standing (legitimación activa), and passive standing (legitimación pasiva). They point out that this finding is unfounded, inconsistent, unjust, and impartial, because it is detached from the contents of the case file. They argue that the evidence was not assessed as a whole, but only partially and out of context. They state that, at both the first and second instances, the judges began by explaining that the evidence would be assessed without being subject to the rules of ordinary law (Article 54 of the LJA), thereby merely seeking to evade their responsibility. They criticize the appellate court for failing to address the testimony of Gilberto Chaves Zúñiga, Florencio Moreno, Rafael Angel Murillo Araya, Jhonatan Elias Vargas Chinchilla, and Edin Gerardo Zúñiga Moreira, who, they note, gave an account of the facts different from the testimony of Melvín Méndez Blanco and Eladio Méndez Camacho.
They challenge the ruling in recital V concerning the existence of any nullity and ask: where is the analysis of the five witnesses and the documentary evidence they offered? They dispute the determination in recital VI regarding the Trial Court’s proper assessment of the evidence and ask: what evidence? They emphasize that the actual text of the judgment says the opposite of what it purports to convey. With regard to active standing, they complain that the court constructed a version of the facts that not even the plaintiff himself had presented in the complaint, thereby issuing a ruling “beyond the relief requested (ultra petita),” without conducting any legal analysis. They argue that the complaint did not provide a chronology of how Mr. Quirós Díaz acquired the property, but merely stated that he owned that unregistered parcel of land, described it, and provided its cadastral survey plan number.
It also stated that his father sold it to him by public deed dated January 18, 1996, but, they complain, nothing more. Consequently, they contend that there is no basis for the account accepted by the Court. In their view, those documents do not indisputably establish the claimant’s standing because the cadastral survey plan and the deed describe two different parcels. Regarding the sale, they state that the transferor is not the father of Mr. Felix Quirós Díaz and, therefore, this cannot be justified by claiming that it was an error, as the Trial Court held and the appellate court affirmed. They further state that the transfer deed describes a property different from the one shown on the cadastral survey plan, which, moreover, is unrelated to the property they possess. This is so, they say, because the sketch prepared by the expert states in its conclusions that the land they possess overlaps by only 43% with the land described in plan no. A-310230-1996.
They insist that the property described in public deed no. 161-19 does not match the property surveyed in the referenced plan. Accordingly, they emphasize that these documents are neither conclusive nor irrefutable. They likewise complain that it was not established in any way that Mr. Quirós Díaz had actually and effectively exercised possession (posesión) over the property in dispute, making it impossible to maintain that he conducted a productive agricultural activity or enterprise. They assert that, during his examination as a party (confesional), he admitted that he kept the property and the trees so that they would not be destroyed. He likewise admitted that he did not conduct any agricultural activity or construct any works. They also state that, when asked about the property located along the southern boundary, he said that it had belonged to his father, who sold it to Mr. Gilbert Chaves.
Likewise, in answering question 10, he stated: “Yes, yes, it is within the property I claim and within the property described in the cadastral survey plan appearing at folio 2 of the case file.” Consequently, they state, it follows that, at most, he has the deed of sale, but he never performed any possessory act, much less an agricultural one, because he conducted no agricultural activity and does not claim as his own the remainder of the land located north of the parcel in dispute, since he stated that it belonged to Mr. Gilbert Chaves. Moreover, he acknowledges that it is a river protection area (área de protección). With respect to the opposing party’s witnesses, they assert that they are friends of the plaintiff because, as children, they bathed in the river and were coworkers at the Santa Clara campus of Instituto Tecnológico de Costa Rica; even so, they contend, the witnesses agreed that he conducted no agricultural activity whatsoever, since they concurred that the land was brushland or forest and remained that way until the defendants entered the property and were accused of cutting down trees.
They state that Mr. Rafael Ángel Murillo Araya testified that the parcel is a river protection zone; that there was a community interest in keeping it clean to prevent its use for drug consumption; and that nothing was ever cultivated there. They add that, although all the witnesses agreed that the property belonged to Mr. Quirós Díaz because he had a supporting deed, they also stated that he did not use or enjoy it, which, in their opinion, means that he did not possess it. Nevertheless, they object that the Court disregarded that testimony and endorsed the Trial Court’s ruling without explaining why it did not find those witnesses credible, merely citing, they argue, the witnesses on whom the first-instance judgment was based. They state that the remaining witnesses were thus disregarded. Accordingly, they complain that the ruling has no basis “in the natural meaning of the evidence submitted to the case file and… is the product of an impartial reading thereof, and reveals a manifest failure to study and analyze the appeal brought before it.” They argue that the foregoing shows that the appellate court, in its eagerness to assist the claimant, grossly distorted the line of argument and justified the lack of actual and effective exercise of possession by claiming that the plaintiff used the lot as a forest reserve (reserva forestal).
They reproduce the first and third allegations of the complaint, which contradict what Mr. Quirós Díaz stated during his examination as a party, because he had not previously claimed that he devoted the property to forest. Second: with regard to the identity of the property, they complain that the Court affirmed the determination of the lower court (A quo) and added matters that were neither discussed in the proceedings nor included in the relief sought. They argue that deed no. 161-19 executed before notary public Manuel Chacón Arrieta does not constitute conclusive evidence (plena prueba), because it is defective due to subjective and objective contradictions. They insist that Mr. Heriberto Quirós Rodríguez, identity card no. 2-785-985, appeared as the seller, but the person registered under that identity document is a 15-year-old girl named Damaris Quirós Barboza, who had not yet been born when the sale document was executed.
As to the other matter, they assert that the land described does not match the property detailed in cadastral survey plan no. A-310230-1996 with respect to its boundaries, area, nature, location, and topographical and geographical references. The property claimed is described by its nature as land for construction and is located between the public road leading to Santa Rita de Florencia and the Santa Rita stream, with an area of 3.311,75 square meters; it is located 517.05 from the tie point (punto de amarre), whose reference is the bridge over that stream, and is bounded on the north and south by Heriberto Quirós Rodríguez, on the east by the Santa Rita stream, and on the west by the public road, with a frontage of 106,29 meters. By contrast, the cited deed no. 161-19 states that the land is agricultural, situated between the public road leading to Santa Rita de Florencia and the Santa Clara River, and has an area of one building lot (equivalent to one-quarter of a manzana), or approximately 1.747,24 square meters.
They further clarify that, in relation to the point of departure, it is located 300 linear meters from the bridge over the Santa Rita stream and is bounded on the north and south by the reserved remainder, on the east by the Santa Clara River, and on the west by the public road. Consequently, they point out, the properties bear no similarity whatsoever; rather, the inconsistencies are obvious and irreconcilable, especially, they argue, when compared with the property described in the first allegation of the complaint they filed. They note that, according to the topographical survey conducted by the expert, the property they possess is located 576,47 meters from the abutment of the bridge over the Santa Rita stream, measures only 1.457,28 square meters, fronts the road to Santa Rita, and is bounded on the north by Gilbert Chaves Zúñiga, on the south by Eusebio Gerardo Salas Mora, on the east by the Santa Rita stream, and on the west by the public road, with a frontage of 59,42 meters.
On that basis, they dispute the identity of the property declared in the judgment. They assert that their principal line of argument has been that the land they possess is entirely different from the claimant’s property; they complain that the judges neither considered nor assessed that argument, but instead devoted themselves to examining immaterial matters, some of which were even invented by the Court. Accordingly, they object to the statement in recital VI that: “if the plaintiff never derived any benefit from the property, this was because the very nature of the land included an express prohibition on land-use change (cambio de uso de suelo), which serves the higher interest of providing proper protection to stream protection areas, in accordance with the provisions of the Ley Forestal.” In their opinion, the foregoing failed to resolve the issue submitted for determination. Third: with regard to passive standing, they state that, applying the appellate court’s methodology “by contrary inference (contrario sensu),” if Mr.
Quirós Díaz lacks active standing, as was proven, then there is no identity of the property and, consequently, they likewise lack passive standing because the property they possess is different from the claimant’s property. Fourth: they state that they oppose the award of costs because they were required to appear in the proceedings after being sued and had to file their own complaint, given that the Trial Court, on an evident technicality, declared their response untimely. They assert that it cannot be overlooked that their home is at stake, which is why they had to defend it without sparing any effort. They add that it is merely a riverbank and is now the place where they live peacefully without disturbing anyone’s rights.
VIII.In the first two grounds for appeal, the appellants in cassation (casacionistas) allege indirect errors of law arising from errors in the assessment of the evidence. Regarding the assessment of evidence in agrarian matters, this Chamber held in judgment no. “712-F, issued at 15 hours 15 minutes on 26 de setiembre del 2005: IV. In the sub judice case, the dispute revolves around a specific issue: the assessment of the evidentiary record (material probatorio) as to which party breached the contract. The manner in which judges must assess evidence has varied throughout the history of Procedural Law. At an initial stage, prior to the nineteenth-century codifications, a system of legally prescribed evidence (prueba tasada) was used to determine the probative force of each item. Thus, the law assigned a value to each item of evidence in advance, without the adjudicator being able to decide independently which items better informed the conviction necessary to resolve the specific case.
Accordingly, specific means of evidence were required to establish each right, with the quantity varying for each one, while discrimination among witnesses was established a priori based on their gender, age, occupation, or social class. That system was superseded by the Spanish Ley de Enjuiciamiento Civil of 1855, which served as the basis for the procedural codes of Latin America, including Costa Rica. That Spanish legislation adopted the model of assessing evidentiary material in light of the rules of sound judicial assessment (sana crítica). This is an intermediate approach between legal proof (prueba legal) and free conviction (libre convicción). On the basis of sound judicial assessment, the judge may independently reach a conviction as to the truth of the facts on which the decision is based through the judge’s own assessment; however, that assessment is not entirely free, but is subject to the rules of formal logical thought and, simultaneously, to human experience.
On this point, legal scholarship, particularly Couture, has stated that a judge is not a reasoning machine but, essentially, a human being who becomes aware of the surrounding world and knows it through sensory and intellectual processes. In addition to logic, sound judicial assessment entails the proper evaluation of certain propositions derived from experience that every person uses in life. Therefore, the judicial authority is responsible for assessing the evidence through proper logical interconnection and also in light of the circumstances of the surrounding environment, as observed through experience. The purpose of the foregoing is to ensure that the adjudicator may not rely solely on discretion but must substantiate, on the basis of logic and experience, the reasons for the adjudicator’s conviction. This will also allow the higher court, if the judgment is challenged, to review whether the criteria applied by the court below (a quo) complied with those rules of proper human understanding.
A third system is known as free conviction. Under this system, the adjudicator’s decision need not necessarily be based on the evidence submitted by the parties to the proceeding. The adjudicator could even rule contrary to the proven facts and rely solely on the judge’s private knowledge. It is sufficient for the judge to affirm a moral certainty that the events occurred in a particular manner, without being required to set out the logical development of the reasoning. The Costa Rican Código Procesal Civil follows a hybrid of the rules of sound judicial assessment and legally prescribed evidence. This conclusion is drawn from provision 330, as well as from various rules—remnants of the former system—concerning the value of evidentiary means such as confessions, public instruments, documents that prevail over witness testimony, and the impossibility of proving certain facts solely through such testimony.
Moreover, Article 54, second paragraph, of the Ley de la Jurisdicción Agraria provides as follows: ‘When ruling on the merits of the matter, the judge shall assess the evidence according to conscience (a conciencia) and without strict adherence to the rules of ordinary law; however, in all cases, when analyzing the result of the evidence gathered in the proceeding, the judge must state the principles of equity or law on which the judge’s criterion is based.’ Although the similarity in terminology might initially suggest that this conforms to the free-conviction system, that is not actually the case, because the provision itself directs the adjudicator to provide legal or equitable grounds justifying the assessment. The matter was also addressed when the Sala Constitucional, in judgment n.º 11932, issued at 15 hours 37 minutes on 21 de noviembre del 2001, explained that evidence may not be assessed solely at the discretion of the judicial authority.
Rather, Article 54 requires the authority to ‘...analyze the result of the evidence gathered in the proceeding and state the principles of equity or law on which its criterion is based, thereby respecting the minimum requirements of the right of defense (derecho de defensa).’ In the cited decision, that Chamber refers to its judgment n.º 4448, issued at 9 hours on 30 de agosto de 1996, in which it stated: ‘Accordingly, assessing evidence according to conscience does not entail ruling arbitrarily, because every judge—as a public official—is subject to the principle of legality (principio de legalidad), which imposes a mandatory requirement that public action conform not only to the specific rules governing a particular subject but also to the entire body of law; therefore, a judge may not rule in disregard of constitutional principles and rights, since the judge is constrained by the rules of sound judicial assessment and the principles of reasonableness, which, when properly applied, ensure that judicial assessment accords with the Constitución Política.’ It must therefore be concluded that Article 54 of the Ley de Jurisdicción Agraria does not, in fact, permit the adjudicator to adopt a free-conviction system.
Moreover, given the duties to provide reasons that it imposes and in light of its interpretation in constitutional case law, it subjects the adjudicator to the rules of sound judicial assessment, insofar as the adjudicator must employ reasoning that is logical and consistent with intersubjective human experience to justify the ruling. Because the provision itself establishes that ordinary law is not binding, it must be understood that, unlike in civil proceedings, there is no legally prescribed evidence whatsoever. Accordingly, when agrarian judges are alleged to have improperly assessed evidence, what is actually being alleged is their failure to observe the rules of logic and experience that inform proper human understanding when substantiating their conviction.’ Similarly, see, among others, judgment no. 173, issued at 10 hours on 4 de marzo de 2008.” Judgment no. 1513, issued at 9 hours 25 minutes on 15 de noviembre de 2012.
Consequently, in examining those claims, the primary task is to determine whether, in assessing the evidentiary elements contained in the record, the adjudicators complied with the rules of logic and experience. It must also be recognized that no system of legally prescribed evidence exists in this field.
IX.Regarding the objection raised by the appellants in the claim under review, to the effect that the Court failed to address the testimony of Gilberto Chaves Zúñiga, Florencio Moreno, Rafael Ángel Murillo Araya, Jhonatan Elias Vargas Chinchilla, and Edin Gerardo Zúñiga Moreira, who, they claim, provide a version of the facts different from that given by the witnesses Melvín Méndez Blanco and Eladio Méndez Camacho, it is evident that they merely cite the witnesses without specifying the particular matters to which they refer, without precisely addressing what each of them stated, or explaining how their testimony would have contributed to deciding the matter differently. As to the contention that the judgment artificially constructed the facts and that, consequently, the claimant’s standing (legitimación activa) was not established, the relevant portion of recital VI of that judgment must be reproduced: “The construction of the factual account by the a quo, both in the proven and unproven facts and in the reasoning section of the challenged decision, is necessary in order to decide the merits of the matter.
Furthermore, the historical account is not an unsupported story, as the appellants allege, but rather derives precisely from the facts established in the judgment based on a comprehensive assessment of the evidence submitted to the record by both parties, as well as from the facts that could not be established during the proceedings and remain unsupported by evidence. Nor can the argument be accepted that the certified copy of the public deed and the cadastral plan submitted to the record by the plaintiff, Félix Quirós, fail to establish standing because of defects and inconsistencies identified in those documents. As the appellants correctly note, in this case there is an expert report clearly indicating that the area possessed by Miguel Masís and Gregoria Moreno corresponds to 43.99% of the area described in cadastral plan A-310230-1996 submitted by the plaintiff, Félix Quirós, amounting to an area of 1458.28 square meters, thereby confirming the overlap between the area claimed and the area possessed by the appellants.
It is important to emphasize that the use of percentages in the expert report does not result from a failure to physically inspect the land in dispute, but from the fact that the property described in cadastral plan A-310230-1996 is physically divided into two portions, one described as lot 1 and the other as lot 2. The lot described as number 2 is the one occupied by the appellants and at issue in these proceedings, because the plaintiff, Félix Quirós, claims only part of his land, as is clearly apparent from the facts and the relief sought in the complaint. Nor is the argument valid that the plaintiff, Félix Quirós, did not exercise acts of possession over the property in dispute because, as the appellants correctly point out, he admitted that he maintained the property and the trees so that they would not be reforested. This is consistent with the witnesses’ statements that, before the defendants entered the property, the plaintiff was the person who maintained it and whom they saw working there.” The judges then reproduced the relevant portions of the statements made by the witnesses Melvin Méndez Blanco, Rafael Ángel Murillo Araya, and Eladio Méndez Camacho, concluding: “…it follows that in this case, contrary to the appellants’ allegations, the plaintiff, Félix Quirós, proved that he acquired the property in dispute… from his father, Heriberto Quirós Rodríguez, and that, before Miguel Masís and Gregoria Moreno entered it, the plaintiff maintained it and ensured that the trees were not cut down.
Although Félix Quirós admitted that he had neither erected any structures nor conducted any agricultural activity, this was because the area borders the quebrada Santa Rita, where the protection-area setback must be observed in accordance with current legislation.” First, it must be noted that, contrary to what the appellants appear to understand, the proven facts, rather than being constructed from the factual circumstances set forth in the complaint, are based on the evidentiary materials contained in the case file. Furthermore, it is evident that the appellants did not properly challenge the reasons given by the Court in analyzing the testimonial evidence; instead, they merely stated that the other witnesses had said the opposite, without specifically identifying what they testified to or explaining how their testimony would have led to a different decision. Moreover, the Ad quem relied not only on that evidence and on the deed of sale dated 18 de enero de 1996 and cadastral plan no. A-310230-1996, but also on the findings recorded in the expert report, which the appellants did not challenge in any way.
It should be noted that there is no system of predetermined evidentiary weight (prueba tasada) in this area; consequently, the essential requirement is that the evidence be assessed as a whole, in accordance with the principles of logic and experience. In this Chamber’s view, that is what occurred, and the appellants have failed to undermine that assessment through their objections. On this matter, the Court stated: “…testimonial evidence established the possession exercised by Heriberto Quirós over the property in dispute and that he transferred it to the plaintiff, Félix Quirós, in 1996. In this regard, the witnesses Melvin Méndez Blanco, known as Marvin, Rafael Ángel Murillo Araya, and Eladio Méndez Camacho consistently stated that the property formed part of an estate belonging to Heriberto Quirós, who was known as ‘Beto,’ that he was Felix Quirós’s father, and that the property was transferred to the latter (see testimony at folios 239 to 242, 576 verso to 577 verso, and 580); therefore, the subjective element was fully established not only by the documentary evidence but also by the testimonial evidence contained in the record.
As for the objective element, a comparison of the information contained in the cadastral plan and the certified copy of the deed does not disclose the alleged inconsistencies, because the documents coincide as to the property’s location and the description of its boundaries. The cadastral plan indicates that it is land located in Santa Clara, bounded to the north and south by Heriberto Quirós Rodríguez, to the east by quebrada Santa Rita, and to the west by a public road. The public deed, in turn, describes a property in Santa Clara, bounded to the north and south by the reserved remainder, corresponding to the remainder of Heriberto Quirós Rodríguez’s estate, to the east by río Santa Clara, and to the west by a public road. The boundaries described show that the only area of discrepancy is the eastern boundary, where the adjoining watercourse is identified as either a river or a stream; nevertheless, irrespective of the name stated, the property does have a natural boundary, namely a stream (quebrada).” In addition, the Court relied on the expert’s report, an expert appraisal that will be addressed in greater depth when examining the identity of the property.
From the foregoing, it is clear that the Ad quem conducted a comprehensive review of the evidentiary materials, which the dissatisfied parties fail to challenge clearly and specifically; instead, they repeat the arguments advanced in their appeal from the Trial Court’s judgment without challenging the second-instance decision on specific factual and legal grounds. On the other hand, regarding the contention that Quirós Díaz’s possession of the disputed land was not established in any way, the following considerations must be made. Contrary to the cassation appellants’ view, the analysis of the evidence established forest possession (posesión forestal). It must be recalled that reference is currently made not only to agricultural activity, but also to forestry and environmental activity as components of the economic, social, and environmental function of agricultural property or possession (propiedad o posesión agraria).
Consequently, the fact that the plaintiff devoted the land at issue to forest conservation, far from detracting from his possession, reinforces it. This is particularly so because, as demonstrated, the parcel lies within the protection zone of quebrada Santa Rita. It must also be added that, in the case under review, it was established that Félix Quirós Díaz erected fences and performed maintenance activities on the property, including brush clearing (chapeas) and firebreak clearing (rondas); thus, contrary to the appellants’ assertions, the possession exercised by the plaintiff is beyond doubt.
X.- In the second objection, they challenge the ruling concerning the identity of the property. In this regard, contrary to the appellants’ arguments concerning the subjective and objective defects that purportedly undermine public deed no. 161-19, as the Court ruled, this is not the case. As to the former, it is clear that an error was made when recording the identity card number of Mr. Heriberto Quirós Rodríguez, since, as shown in the printout of the query made to the Tribunal Supremo de Elecciones (folio 530), his identity card number is 200785985, but it was recorded as 207850985. In addition, testimonial evidence establishes that Mr. Heriberto Quirós was the possessor of the land described in that public instrument and sold it in 1996 to his son Félix Quirós Díaz. It also establishes that the parcel occupied by the co-defendants is part of the property transferred to the plaintiff on that occasion.
Thus, the alleged inconsistencies concerning boundaries, area, nature, location, and topographic references are not significant enough to establish that this is a different property from the one sought to be recovered through an ownership action (reivindicar). It should be recalled that, in rendering their decision, the judges evaluated all the evidence as a whole—namely, documentary, testimonial, and expert evidence—and in no way determined that the deed in question constituted conclusive evidence; rather, as stated, the opposite was true, since they assessed all the evidentiary elements in accordance with the rules of logic and human experience. In this regard, the expert’s report was unequivocal in stating that the lot occupied by the co-defendants overlaps the plaintiff’s property by 43.99% of its total area. He also explained why the discrepancies were negligible when the bridge abutment located at the intersection of quebrada Grande and quebrada Santa Rita was used as the reference point.
He stated that a difference of 4.18, when the starting point is more than 500 meters away, is insignificant. The cassation appellants (casacionistas) do not challenge these matters in their appeal. Moreover, as regards the area, the discrepancy is with the public deed of sale, at which time the land had not been surveyed for cadastral purposes; however, when compared with the registered cadastral plan, the difference is minimal and, as the expert noted, may be attributable to the widening of the stream, which is one of the property’s boundaries, as well as to the construction of the road leading to Santa Rita. It is logical for boundaries to change over the years. The nature of the property is generally recorded based either on information provided by the possessors or by the professional himself, although what is essential is the nature established on the basis of accurate and actual data.
In any event, it too may change over time. Regarding the distance between the lot at issue and the bridge abutment, and the area of 1.457,28 square meters, the explanation, according to the expert’s analysis, is that this parcel represents only 43.99% of the plaintiff’s property described in plan no. A-310230-1996. This also clarifies the discrepancy concerning the distance from the reference point, since the area occupied by the co-defendants lies farther south. From the foregoing, it is beyond doubt that the challengers are incorrect, since it is untrue that the disputed property does not correspond to a portion of the property that the plaintiff has possessed for more than 15 years and has devoted primarily to forest and environmental conservation.
XI.In their third objection, they challenge passive standing (legitimación pasiva), without providing further details, because they claim to follow the methodology employed by the Trial Court, even though the decision they must challenge is that of the Court. Nevertheless, it must once again be stated that their assertions are incorrect, because it was established that they are occupying a portion of the property that the plaintiff has possessed. Passive standing was therefore established. On this point, the appellate court (Ad quem) ruled: “Contrary to the appellants’ assertions, passive standing was established in this case, not only because they expressly admitted that they entered the property without any permission and with full knowledge that the property had an owner, as demonstrated by the various actions taken by the plaintiff Félix Quirós to recover his land through the filing of possessory injunction proceedings (procesos interdictales) conducted under case numbers 08-000089-298-AG and 08-000163-298-AG, the first… against Jaime Giovanni Portugués on 21 de mayo del 2008 and the second… against Miguel Masís Ugalde on 08 de setiembre del 2008…
Note that… he claims the same property at issue in these proceedings, and the trespass problems on the land began in mayo de 2008; approximately one month later, defendants Miguel Masís and Gregoria Moreno entered the property with full knowledge of Mr. Félix Quirós’s claim. This is evidenced by the answer filed by defendant Miguel Masís in possessory injunction proceeding 08-000163-298-AG, in which he stated the following: ‘…It is precisely this fact that proves beyond any doubt the plaintiff’s bad faith, since he establishes 15 de julio del 2008 as the date on which my possession began, which is absolutely false, because by 12 de junio del 2008 the same plaintiff already placed me on the property, as may readily be seen in folios 12 to 14, front and back, where the Inspection Record prepared by the Agrarian Judge, Lic. Ignacio Rodríguez Sancho, on that same date was entered in the proceeding of the same nature brought against Mr.
Jaime Giovanni Portugués Chacón under case number 08-000089-298-AG before this Trial Court, in which the same plaintiff told the Judge that the undersigned had entered a few days after the defendant in that litigation, who, incidentally, entered during the first days of mayo del 2008, as he acknowledged in his answer in the aforementioned proceeding….’ The foregoing demonstrates not only that they had full knowledge that the property belonged to Mr. Félix Quirós, but also that they knew of the claims asserted by him through the possessory injunction proceeding….”
These are matters that the challengers do not contest in any respect, rendering their objection inadmissible.
XII.As regards costs, it must be stated that agrarian legislation expressly governs them. On this issue, the majority of this Chamber has repeatedly held that: “…in civil proceedings, as in agrarian proceedings, costs are imposed upon the losing party solely by virtue of having lost. This is without such an award implying a finding of recklessness or bad faith (sections 221 of the Código Procesal Civil and 55 of the Ley de la Jurisdicción Agraria [LJA]). Accordingly, those provisions are not violated when costs are imposed upon the losing party. Conversely, when that party is exempted from payment, the judges must justify their decision because it constitutes an exception to the rule. In that situation, the corresponding ruling may be challenged through a cassation appeal (recurso de casación) where there may have been errors arising from an improper application of the grounds for exemption or an improper exercise of the authority to grant an exemption.” No. 504 of 8 hours 40 minutes on 14 de abril de 2011.
Section 55 of the LJA provides: “Judgments, as well as rulings that terminate the proceedings, shall include a decision on costs. The losing party may be exempted from payment of attorney’s fees (costas personales), and even from litigation costs (costas procesales), when it is evident that the party litigated in good faith because, in the court’s judgment, there were sufficient grounds to litigate, or because the prevailing party’s claims ultimately proved disproportionate.” (Boldface added). In the matter under review, as stated in whereas clause I (considerando I) of this Judgment, the Court affirmed the Trial Court’s judgment, which required the unsuccessful co-defendants to pay the costs of the proceedings because it found that they had not answered the complaint on time and did not fall within any of the exceptions. It must be stated that an exemption, even under the circumstances governed by the provision, is discretionary rather than mandatory.
Under these circumstances, if the judge is not required to grant an exemption, the judge does not violate the aforementioned legal provision by declining to do so. There is no violation of the law when costs are imposed upon the losing party, because the judge is merely applying the provision according to its terms. Thus, it is beyond doubt that imposing costs does not mean that the losing party is deemed to have litigated recklessly or in bad faith. Moreover, although section 55 of the LJA, reproduced above, does not expressly state that costs are imposed upon the losing party, this is clearly evident from a comprehensive reading of the provision, because its second part establishes that, at the judges’ discretion, the losing party may be exempted from paying costs under the circumstances specified by the provision. This is plainly a matter in which judges enjoy discretion: if they find that the party who lost the proceedings may be exempted from paying costs, they may grant the exemption; otherwise, the proper course is to order that party to pay them. Consequently, the Ad quem did not commit the alleged violation by requiring the appellants to pay costs, and the objection must therefore be rejected. Accordingly, the challenges must be rejected.
POR TANTO
The appeal is rejected and the judgment under appeal is affirmed. Magistrate Escoto appends a note concerning costs.

I.The undersigned member does not share the view expressed by the majority of this Chamber in recital VI of the preceding judgment, insofar as it denies cassation review (control casacional) in cases where only the general rule requiring the losing party to pay both categories of legal costs (costas) is applied, that is, where no provision concerning exemption from such costs is invoked or applied. Indeed, the majority’s jurisprudential rationale proceeds from the premise that exemption from the payment of legal costs is a discretionary power whose non-exercise or non-application gives rise to neither error nor breach of law; accordingly, it is stated that, if there is no violation of law, cassation proceedings cannot assess or modify the ruling requiring the losing party to pay costs because, to reiterate, for the majority of this Chamber, a legal violation can arise only when the corresponding provision governing exemption is applied (among many others, see judgments of this Chamber no. 1001-F-2002, at 11 hours 50 minutes on 20 de diciembre de 2002; 249-F-2003, at 11 hours 45 minutes on 7 de mayo de 2003; and 306-F-2006, at 10 hours 20 minutes on 25 de mayo de 2006).
At first, the reasoning appears logical, because, under this premise, if exemption constitutes a discretionary power, the adjudicator is not required to grant it; therefore, if the adjudicator neither orders nor grants such exemption, the provisions governing the matter are not violated. Ergo, if no provisions are violated, cassation review is unavailable (see the decisions of this Chamber no. 765 at 16 hours on 26 de septiembre de 2001 and 561-F-2003, at 10 hours 30 minutes on 10 de septiembre de 2003). This line of reasoning allows them to conclude that, in that specific circumstance (the mere imposition of costs or the non-application of exemptions), the matter “cannot be examined at this level” (judgment no. 419-F-03, at 9 hours 20 minutes on 18 de julio de 2003, issued by this same adjudicative body), because it is a circumstance “not subject to cassation” (judgment no. 653-F-2003, at 11 hours 20 minutes on 8 de octubre de 2003).
Thus, in the opinion of my distinguished colleagues, an appeal in cassation (recurso de casación) is unavailable when the power to grant an exemption is not exercised (see, a contrario sensu, recitals III and VIII, respectively, of decisions 541-F-2003, at 11 hours 10 minutes on día 3, and at 10 hours 50 minutes on día 10, both in septiembre de 2003). The majority has therefore held that “… the order requiring the losing party to pay legal costs, as occurred here, is not reviewable at this level, given that the Court merely applied the provision according to its terms” (emphasis not in the original; see recital X of decision no. 68-F-2005, at 14 hours 30 minutes on 15 de diciembre de 2005). In notarial matters, it has been stated even more emphatically that: “…the Court required the complainant to pay the legal costs associated with the claim for damages, a ruling that, to reiterate, is not subject to cassation.” (recital X of judgment no. 928-F-2006, at 9 hours 15 minutes on 24 de noviembre de 2006).
II.However, in the view of the undersigned, the improper failure to apply the provisions permitting exemption from legal costs undoubtedly violates the Legal Order (Ordenamiento Jurídico) and, specifically, the provisions authorizing that exemption, whether due to error or to an improper assessment by the judges in the particular dispute. Accordingly, although it is a discretionary power, it is not immune from cassation review, because a violation of law may arise both from its exercise and from its non-application; to that extent, an improper omission is not, and must not be, synonymous with arbitrariness committed, in such a case, by the adjudicator. This is especially so where the judge has been granted authority subject to specific conditions that limit the judge’s discretionary power in this area. Consequently, with respect to this particular issue, I consider that the mere application of the general rule set forth in Articles 54, 55, and 61 of the Ley de la Jurisdicción Agraria (requiring the losing party to pay both categories of legal costs) does not foreclose an appeal in cassation; on the contrary, the matter is admissible for an examination on the merits (provided that the statutory requirements are met) where there may have been an omission in applying the legal provisions authorizing exemption from those costs (section 55 ibid.).
Notwithstanding the foregoing, in the specific case under review, this member agrees with the Court’s ruling on the merits insofar as it required the losing parties to pay those costs, since the claim against them was granted and the claim brought by them was dismissed.

Procesos ordinarios acumulados establecidos en el Juzgado Agrario Agrario del Segundo Circuito Judicial de Alajuela, bajo los siguientes números de expedientes: el primero 09-000028-0298-AG interpuesto por FÉLIX QUIRÓS DÍAZ; contra MIGUEL MASÍS UGALDE, y GREGORIA MORENO GÁMEZ, soltera, de oficios de hogar y el segundo 11-000048-0298-AG establecido por MIGUEL MASÍS UGALDE y GREGORIA MORENO GÁMEZ soltera, de oficios de hogar, contra FÉLIX QUIRÓS DÍAZ. Figura como apoderado especial judicial del señor Quirós Díaz, el licenciado Hubert Rojas Araya, abogado. Las personas físicas son mayores de edad y con la salvedad hecha, casados, agricultores y vecinos de San Carlos.
RESULTANDO

CONSIDERANDO
I.El 30 de enero de 2009, el señor Felix Quirós Díaz interpuso demanda contra Miguel Masís Ugalde y Gregoria Moreno Gamez. En dicho libelo señaló, es propietario del inmueble sin inscribir, que es hoy terreno de agricultura, situado en Santa Clara de Florencia de San Carlos, provincia de Alajuela, linda al norte: Felix y Alberto Quirós Díaz, al sur: Cristiam Jesús Masís Salas, al este: río Santa Clara y al oeste: calle pública, con una superficie de 3.311,75 metros cuadrados, según plano catastrado no. A-310230-96 del 7 de marzo de 1996. Refiere, dicho terreno perteneció a su padre por más de 30 años hasta que le traspasó los derechos posesorios, mediante escritura pública otorgada el 18 de enero de 1996, ante el notario público Manuel Chacón Arrieta. Manifiesta, es él quien lo ha cultivado y brindado el mantenimiento correspondiente. Expresa, en mayo de 2008 estuvo muy enfermo, momento cuando aprovecharon los codemandados para invadir parte de su inmueble, el costado norte, donde construyeron un rancho y cercas.
Indica, actuaron de mala fe, ya que saben el lote le pertenece, pues, vivían a escasos 400 metros del lugar. En lo medular, pide, se le ordene a los codemandados y cualquier otra persona quien se encuentre en el predio: a desalojarlo y restituirlo a su persona; a derribar toda construcción que hubieren edificado; ponerlo en posesión del inmueble en disputa; abstenerse de perturbar, despojar o en cualquier forma alterar la posesión y propiedad que ha mantenido, con el apercibimiento de incurrir en el delito de desobediencia a la autoridad; al pago de los daños y perjuicios causados, que enumeró de la siguiente forma: ¢100.000,00 por el derribo de 15 postes de cerca; quitar la existente frente a calle pública, levantar otra en los rumbos norte y este, así como por la corta de cinco plantas de plátano cosecheras; ¢200.000,00 atinentes a los perjuicios debido a la imposibilidad de usar y disfrutar el inmueble; así como al pago de ambas costas.
Los coaccionados contestaron la demanda extemporáneamente. Además, interpusieron proceso contra el señor Felix Quirós Díaz donde alegan, desde mayo de 2008, son poseedores de un terreno sin inscribir, ubicado en Alajuela, Florencia de San Carlos, 650 metros sur del puente sobre el río Santa Clara, camino a Santa Rita, con una medida aproximada de 1.300,00 metros cuadrados. Linda al norte: Cristhian Masís Salas; sur: Gilberto Chaves Zúñiga, este: río Santa Clara y al oeste: calle pública con un frente de 42 metros, y no cuenta con plano catastrado. Exponen, dicho predio es una orilla del río Santa Clara que se encontraba “encharralado”, con cercas únicamente en el lindero sur. Asimismo, que parte del fundo fue poseído por el señor Jaime Portugués, de quien adquirieron, junto con las mejoras que consistían en un rancho situado en el costado sur. Agregan, en dicho sitio construyeron dos ranchos más, han vivido ahí permanentemente, cultivado plátano, tiquizque, chile dulce, yuca, camote, caña de azúcar y árboles de aguacate.
Relatan, pese a que el demandado reclama el terreno como suyo y les solicitó que lo desocuparan, no accedieron a su pedido, dado que tienen más de 12 años de vivir en la zona y tal predio siempre estuvo desocupado hasta que lo empezó a poseer el señor Jaime Portugués. Por otro lado, explican, aunque el accionante reclama el fundo con base en una escritura donde supuestamente lo adquirió; no obstante, apuntan, corresponde a un inmueble con otra ubicación, y que la cédula del enajenante corresponde a otra persona. Además, arguyen de otra serie de inconsistencias, como la medida y su naturaleza. En lo medular pretenden, se declare que la escritura pública no. 161-19, mediante la cual el demandado aparentemente compró la propiedad corresponde a un terreno distinto al que poseen. Acotan, el plano catastrado no. A-310230-96 no incluye el predio en disputa, si no que se trata de otro distinto, y que tampoco atañe al descrito en el citado instrumento público.
La finca sobre la que han ejercido posesión es diferente en cuanto a naturaleza, situación, medida, linderos y referencia geográfica y topográfica, respecto a la descrita en la escritura no. 161-19 y en el plano no. A-310230-96. Son los únicos y legítimos poseedores del inmueble. Se ordene al accionado so pena de desobediencia a la autoridad, no perturbarlos, y que cese sus amenazas y acciones de hecho y derecho en su contra, en virtud de la posesión ejercida. Se le condene al pago de los daños y perjuicios provocados, que desglosan de la forma que sigue, por daños materiales: ¢550.000,00 de gastos de honorarios de abogado, ¢150.000,00 atinentes a viáticos y otros para atender gestiones judiciales; ¢1.000.000,00 relativos a daño moral y ¢750.000,00 por perjuicios en razón del deterioro de su salud física y psicológica, así como las costas del proceso. Don Felix Quirós Díaz contestó negativamente sin oponer excepciones.
El A quo declaró parcialmente con lugar la demanda incoada por éste último, de forma que ordenó a los codemandados restituir el bien al actor, de no hacerlo de manera voluntaria en el plazo de cinco días a partir de la firmeza del fallo, se ordenará el lanzamiento por medio de la fuerza pública. Les apercibió para que a futuro se abstengan de perturbar y despojar el derecho de posesión y propiedad del accionante y de no hacerlo se les procesará por el delito de desobediencia a la autoridad. Asimismo, que debían retirar o destruir a su costo las edificaciones construidas, las plantaciones de musáceas y árboles frutales introducidos en el fundo, en el lapso de cinco días, de no hacerlo el demandante quedaba autorizado a realizarlo a costa de los co-accionados. Cancelar al actor los perjuicios irrogados, a liquidar en la vía de ejecución de sentencia. Rechazó el pago del daño material y los condenó a cancelar ambas costas del proceso.
En cuanto a la demanda de don Miguel Masís Ugalde y doña Gregoria Moreno Gámez contra el señor Felix Quirós Díaz la declaró sin lugar en todos sus extremos y los condenó a pagar las costas. Además, agregó el juzgador que tal fallo contaba con el recurso de apelación y que de impugnarse, debía presentarse el escrito de interposición tanto en forma escrita como en formato electrónico, y que si era de interés que el Tribunal le concediera audiencia oral, debía manifestarlo alegada y confirmó lo resuelto. Inconformes los perdidosos interponen recurso de casación donde desarrollan agravios procesales y de fondo. De ahí, se

II.Primero: apuntan, el Tribunal no se pronunció sobre su demanda, no estudió la totalidad del expediente, si no que se limitó a examinar aspectos macros y testimoniales. Exponen, según su “…criterio el mayor yerro que reprochamos en el dictado de la sentencia de segunda instancia es que no haya tomado en cuenta que… el A-quo debió impartir en el mismo fallo también sentencia del expediente promovidos (sic) por los suscritos, el cual merecía el mismo valor y consideración que el promovido por el señor QUIRÓS DÍAZ… y en el caso de la demanda de los suscritos le da un tratamiento subsidiario o de menor importancia, cosa que resulta errónea en razón de que ambos proceso (sic) tienen la misma jerarquía ante la ley y la jurisdicción, y lo anterior se denota no solo en el eje narrativo, sino en el orden en que aborda el análisis, cosa que resulta más que evidente en el hecho de que se tomó 21 páginas de un total de 29… para resolver sobre la demanda interpuesta por el señor QUIRÓS DÍAZ y… únicamente s toma 7 páginas para pronunciarse sobre la demanda incoada por los suscritos…”.
Insisten, el Tribunal no examinó su demanda, lo que en su criterio, vulnera lo estipulado en el cardinal 54 de la LJA. Arguyen, se extrajeron porciones fuera de contexto de la demanda, como por ejemplo que alegaron su titularidad al amparo de una compraventa, cuando lo depuesto se refería a las mejoras adquiridas de don Jaime Portugués. De ahí, aducen, no es posible estimar que no tienen legitimación por carecer de título traslativo de la posesión. Segundo: aseveran, de consuno con lo dispuesto por el Juzgado, solicitaron la realización de audiencia oral con el objeto de defender el recurso formulado. Reprochan, de forma inexplicable el Tribunal les negó tal derecho, sin exponer las razones para ello. Así, señalan, se les infringieron sus derechos procesales. En su opinión, su realización no resulta discrecional, como quiso hacerlo patente el Ad quem, con lo que se vulnera el debido proceso.
Tercero: acusan, no comparten el cómputo que realizaron los jueces de segunda instancia del plazo para solicitar adición y aclaración de su sentencia. Explican, la notificación se recibió mediante fax, a las 20 horas 30 minutos del 26 de febrero de 2013, de cuyo conocimiento tuvo su abogada hasta el día siguiente. Dicha comunicación, argumentan debió tenerse por realizada el día inmediato siguiente y el plazo empezar a correr hasta el 28 de febrero de 2013. Adicionan, aún en el caso de que se interprete el día de la notificación y el plazo, que para el Ad quem es de 24 horas, se contraría hasta el 28 de febrero de 2013 a las 20 horas 30 minutos. Apuntan, es obvio que dicha hora es inhábil, por lo que en su criterio, el pedido presentado el primero de marzo de aquel año, fue realizado en tiempo. Por otra parte, aseveran, el plazo estipulado en el artículo 58 de la Ley de la Jurisdicción Agraria (LJA) es para interponer el recuso de revocatoria y aquí se trató de la solicitud de adición y aclaración.
Dicen, se trata de un mero trámite para rectificar los fallos. En lo tocante al otro fundamento del Tribunal para fijar el plazo de 24 horas de conformidad con lo establecido en el precepto 498 del Código de Trabajo, expresan, atiende a las resoluciones de primera instancia. Continúan, la LJA no contiene un plazo para el pedido de la adición y aclaración, por lo que de acuerdo con lo dispuesto en el cardinal 6 de esa norma, el lapso que se debe aplicar es el de tres días consagrado en el canon 158 del Código Procesal Civil.
III.De previo al análisis de las inconformidades es menester referir lo dispuesto por esta Cámara en cuanto a esta categoría de yerros: “III.- …Sobre el punto, el recurso ante esta Sala, propio de asuntos agrarios, no se rige en un todo por las disposiciones de la casación del Código Procesal Civil (CPC), pues la Ley de la Jurisdicción Agraria remite a la impugnación contemplada a partir del canon 556 del Código de Trabajo. Con todo, esta Cámara ha analizado las situaciones que darían cabida para el análisis de cargos como el acusado. Así, por ejemplo, en la sentencia 583 de las 11 horas 35 minutos del 14 de julio de 2004 estimó: “V.- Reiteradamente ha señalado esta Sala […] que una de las características del recurso de casación en esta materia, es su limitación a conocer, exclusivamente, aspectos de fondo. Ello al socaire del artículo 559 del Código de Trabajo, aplicable a este tipo de procesos, por expresa remisión del canon 61 de la Ley de Jurisdicción Agraria.
Empero, ahora, con su nueva integración, este Tribunal se replantea dicha posición, de conformidad con los siguientes argumentos. El referido numeral del código laboral dispone: “RECURSO DE CASACIÓN. RECHAZO DE PLANO. Recibidos los autos, la Sala rechazará de plano el recurso si se ha interpuesto contra lo que disponen los artículos 556 y 557. Lo mismo hará cuando en el recurso se pida únicamente la corrección, reposición o práctica de trámites procesales.”(Lo subrayado no es del original). Para el sub-júdice, interesa la segunda parte del artículo en comentario. La doctrina procesalista ha indicado que los motivos de casación por razones de índole procesal, dispuestos en el artículo 594 del Código Procesal Civil, pueden darse en las tres fases del proceso:
IV.En el primero de los reproches se acusa incongruencia, sobre esta infracción esta Sala ha resuelto: ”…la congruencia de la sentencia, consagrada en el artículo 155, párrafo inicial, del Código Procesal Civil, y en el caso de la jurisdicción agraria, derivada del numeral 54 de la Ley de esa materia, consiste en la necesaria relación y armonía que debe evidenciarse entre lo dispuesto en la parte dispositiva del fallo y los límites fijados por las pretensiones materiales de las partes y lo debatido. Así, el juez no puede omitir pronunciamiento sobre algún punto de contienda (mínima petita), otorgar más de lo pedido, sea superar lo pretendido (ultra petita), o bien, agregar extremos no contemplados por los litigantes (extra petita). También se daría cuando existan pronunciamientos contradictorios en la sentencia. Dicho en otros términos, no hay incongruencia entre las consideraciones de la sentencia y lo resuelto en la parte dispositiva.
No. 728 de las 10 horas 5 minutos del 4 de octubre de 2007”. No. 749 de las 9 horas del 17 de junio de 2010”. Sentencia no. 176 de las 9 horas 25 minutos del 14 de febrero de 2013. Los recurrentes arguyen, el error se produce dado que no se resolvió sobre su reconvención. Es claro, no se está ante el yerro de incongruencia, ya que el Ad quem no omitió en el dispositivo de la sentencia fallar al respecto, si no que lo hizo rechazando la contrademanda, al confirmar lo resuelto por el Juzgado en cuanto la declaró sin lugar. El Tribunal en lo de interés, en sus consideraciones, expresó: “…se desprende que el a quo efectivamente emitió pronunciamiento sobre las dos demandas presentadas, tramitadas bajo los hizo una clara diferencia al momento de resolver las demandas, tanto en la parte considerativa como en la dispositiva, haciendo referencia concreta a los hechos expuestos por cada una de las partes, las pruebas y pretensiones planteadas en la demanda presentada por los señores Miguel Masís y Gregoria Moreno, se hizo referencia a cada una de ellas acompañadas de la debida fundamentación del por qué se rechazaban las mismas”. Por consiguiente, no se produce el yerro acusado, porque se falló sobre lo demanda formulada por los impugnantes, solo que se hizo denegándola.
V.En otro orden de ideas, en cuanto aluden a que del libelo de demanda se extrajeron porciones fuera de contexto, por lo que no es posible concluir que carecen de legitimación al no contar con título traslativo de dominio. Dicha vulneración, de presentarse, configuraría un vicio por motivos de fondo, más no el recriminado por los recurrentes, de incongruencia. En esta materia, aunque el recurso se rige por el principio antiformalista, al no estar sujeto a formalidades técnicas especiales, ello no es óbice para que se requieran las razones, claras y precisas, que ameritan la procedencia del recurso. De ahí, que este Órgano decisor ha dispuesto: “…en la especificidad de este tipo de recurso presenta algunas particularidades que convienen ser precisadas. Así, en un primer plano, debe indicarse que en la casación agraria no se exigen formalidades especiales, aspecto que no conlleva a la informalidad, en tanto el recurso debe estar ordenado de forma técnica enumerando y estructurando los reproches a la sentencia para demostrar su falta de juricidad (artículo 557 Código de Trabajo).
Desde este plano el recurrente debe explicar necesariamente las razones claras y precisas sobre las cuales sustenta su gestión. Se deben combatir en forma sistemática todos y cada uno de los fundamentos jurídicos de la sentencia recurrida sobre los cuales se plantea la oposición. En esta inteligencia, la dispensa mencionada se refiere únicamente a la consignación de las normas del Ordenamiento Jurídico violadas, o el tipo de infracción cometida”. Sentencia no. 952 de las 16 horas 20 minutos del 7 de diciembre de 2005. En el subexamine, es evidente, en cuanto al yerro que aducen, no expresan los motivos que fundamentan su posición; únicamente manifiestan, no es factible estimar que carecen de legitimación al no tener título traslativo de dominio. Así, no es suficiente que se limiten a argumentar su descontento con lo resuelto por el Ad quem si no que les era necesario en lo fallado, por lo que ante tales carencias lo procedente es su rechazo.
VI.En el segundo y tercer agravios los impugnantes alegan, se les denegó la realización de la audiencia ante el Tribunal sin que se brindaran las razones para ello, así como que, los jueces de segunda instancia aplicaron indebidamente el plazo de 24 horas para pedir adición y aclaración. Según se expuso en el considerando III, el recurso ante casación por motivos procesales en materia agraria solo se admite por conculcaciones propias de la sentencia recurrida, no por cuestiones originadas durante el desarrollo del proceso, que por imperativo legal (cardinales 559 del CT y 61 de la LJA) se encuentran excluidas de su conocimiento. Consecuentemente, tales inconformidades no resultan de recibo ante esta instancia.
Recurso de casación por razones de fondo
VII.Primero: recriminan, se hizo una indebida apreciación probatoria. Exponen, el Ad quem incurrió en igual yerro que el Juzgado, ya que acogió la pretensión del señor Quirós Díaz y estimó que cumplía con la identidad del bien, legitimación activa y pasiva. Ello, apuntan, no tiene fundamento, es incongruente, injusto e imparcial, dado que resulta ajeno a la materialidad del expediente. Arguyen, la prueba no fue valorada en conjunto, si no que se hizo parcialmente y fuera de contexto. Manifiestan, tanto en primera como en segunda instancia los juzgadores iniciaron exponiendo que los elementos de convicción se apreciarían sin sujeción a las normas del derecho común (artículo 54 de la LJA), con lo que solo tratan de eludir su responsabilidad. Increpan, el Ad quem omite referirse a los testimonios de Gilberto Chaves Zúñiga, Florencio Moreno, Rafael Angel Murillo Araya, Jhonatan Elias Vargas Chinchilla y Edin Gerardo Zúñiga Moreira, quienes, señalan, dan una versión distinta de los hechos respecto a las deposiciones de Melvín Méndez Blanco y Eladio Méndez Camacho.
Objetan lo resuelto en el considerando V, sobre la existencia de nulidad alguna y se pregunta: dónde está el análisis de los cinco testigos y de la documental que ofrecieron? Refutan lo dispuesto en el considerando VI en cuanto a la correcta valoración probatoria del Juzgado y cuestionan: cuáles probanzas? Recalcan, el fallo en su materialidad dice lo opuesto a lo que pretende hacer creer. En lo atinente a la legitimación activa, reprochan, se hizo una construcción de hechos, que ni el propio actor realizó en el libelo de demanda, con lo que dice, resulta un pronunciamiento con “ultra petita”, sin realizar ningún examen jurídico. Argumentan, en la demanda no se brindó una cronología de la manera cómo adquirió el señor Quirós Díaz la finca, si no que se limitó a indicar que es dueño de dicho terreno sin inscribir, a describirla y proporcionar su número de plano catastrado. También que, su padre se la vendió mediante escritura pública del 18 de enero de 1996, pero, recriminan, solo eso.
Por consiguiente, acusan, no existe fundamento para la historia que acepta el Tribunal. Tales documentos, estiman, no demuestran de forma indubitable la legitimación del accionante, porque en su opinión, el plano catastrado y la escritura describen dos fundos distintos. En cuanto a la compraventa, manifiestan, el enajenante no es el padre de don Felix Quirós Díaz, y por ende, no se puede justificar aduciendo para ello, que se trató de un error como lo dispuso el Juzgado y avaló el Ad quem. Por otra parte, expresan, en la escritura de traspaso se describe un bien distinto al del plano catastrado el cual, además no se relaciona con el inmueble que poseen. Es tal dicen, que el croquis levantado por el perito en sus conclusiones señala, el terreno que poseen únicamente se traslapa un 43% en el que se describe en el plano no. A-310230-1996. Insisten, el inmueble descrito en la escritura pública no. 161-19 no coincide con el catastrado en el plano de referencia.
Por ende, recalcan, no son concluyentes e irrefutables. Igualmente, reprochan, no se acreditó de modo alguno que el señor Quirós Díaz hubiera ejercido de forma efectiva y real la posesión sobre la finca en litigio, por lo que no es posible sostener que desarrolló una actividad o empresa agraria productiva. Afirman, en su confesional admitió que mantuvo la propiedad y los árboles para que no fueran destruidos. Igualmente que no realizó ninguna actividad agraria y tampoco edificó obra alguna. También refieren, que cuando se le preguntó sobre la propiedad ubicada en el lindero sur, manifestó que fue de su padre, quien se la vendió a don Gilbert Chaves. Asimismo, al contestar la pregunta 10, indicó: “Si, si está dentro de la propiedad que reclamo, y dentro de la propiedad que se describe en el plano catastrado que está a folio 2 del expediente”. Por consiguiente, expresan, se extrae que a lo sumo cuenta con la escritura de compraventa, pero nunca ejerció acto posesorio, memos uno agrario, dado que no desplegó ninguna actividad agraria y no reconoce como suyo el resto de terreno que está al norte del fundo en disputa, pues, manifestó, le pertenecía al señor Gilbert Chaves.
Además, que reconoce se trata de un área de protección del río. En lo relativo a los testigos de la contraria, afirman son amigos del actor, porque de niños se bañaban en el río y fueron compañeros de trabajo en el Instituto Tecnológico de Costa Rica, sede Santa Clara, pero aún así, aducen, fueron contestes en apuntar no realizó actividad agraria alguna, puesto que coinciden era un charral o bosque, se mantuvo así hasta que ellos ingresaron al terreno y los acusan de cortar árboles. Exponen, el señor Rafael Ángel Murillo Araya, testificó el predio es una zona de protección del río; había un interés comunal de mantenerlo limpio, para evitar se utilizara para el consumo de drogas y nunca se cultivó nada. Agregan, aunque todos coinciden, era propiedad del señor Quirós Díaz porque tiene una escritura de respaldo, también expresan no lo disfrutó, lo cual en su opinión, significa no lo poseyó.
No obstante, objetan, el Tribunal omitió dichas deposiciones y prohijó lo resuelto por el Juzgado, sin explicar por qué tales testimonios no le merecían credibilidad, limitándose, arguye, a citar los que sirvieron de fundamento al fallo de primera instancia. Dejando, expresan, de lado los restantes testigos. Así, recriminan lo dispuesto no encuentra fundamento “en el sentido natural de la prueba traída al expediente y… es producto de una lectura imparcial de la misma, y evidencia una manifiesta ausencia de estudio y análisis del recurso elevado ante su instancia”. Argumentan, de lo expuesto se evidencia, el Ad quem en su afán de colaborar con el accionante torció de manera grosera la línea argumentativa y justifica la carencia de ejercicio real y efectivo, aduciendo que el actor empleó el lote como reserva forestal. Transcriben los hechos primero y tercero de la demanda, lo que resulta contradictorio con lo había manifestado que destinara la finca a bosque.
Segundo: en lo tocante a la identidad del bien, recriminan, el Tribunal avaló lo dispuesto por el A quo, y agregó elementos que ni siquiera fueron discutidos en el proceso ni objeto de pretensión. Arguyen, la escrituta no. 161-19 otorgada ante el fedatario público Manuel Chacón Arrieta no costituye plena prueba, dado que tiene defectos, en razón de las contradicciones subjetivas y objetivas. Insisten, como vendedor compareció el señor Heriberto Quirós Rodríguez cédula de identidad no. 2-785-985, pero quien aparece inscrita con ese documento de identidad es una señorita de nombre Damaris Quirós Barboza de escasos 15 años y quien no había nacido al suscribirse el documento de compraventa. Sobre lo otro, afirman, el terreno descrito no coincide en cuanto a linderos, medida, naturaleza, situación y referencias topográficas y geográficas respecto al inmueble detallado en el plano catastrado no. A-310230-1996.
El predio reclamado tiene por naturaleza terreno para construir y se ubica entre la calle pública de la vía que conduce a Santa Rita de Florencia y la quebrada Santa Rita, con una medida de 3.311,75 metros cuadrados, y del punto de amarre, cuya referencia es el puente sobre dicha quebrada, se ubica a 517.05, y linda al norte y sur: Heriberto Quirós Rodríguez, este: quebrada Santa Rita y oeste: calle pública con un frente de 106,29 metros. Por su parte, en la escritura no. 161-19 de cita se dice que el terreno es de agricultura, situado entre la calle pública que se dirige a Santa Rita de Florencia y el río Santa Clara, su cabida es de un solar (equivalente a un cuarto de manzana), sea unos 1.747,24 metros cuadrados. Además, aclaran, tomándose en relación con el extremo de partida se encuentra a 300 metros lineales del puente sobre la quebrada Santa Rita, como linderos tiene al norte y sur: resto reservado, este: río Santa Clara y oeste: calle pública.
Por consiguiente, apuntan, no tienen ninguna similitud, si no que sus incongruencias son evidentes e insalvables; menos aún, argumentan si se compara con el inmueble descrito en el hecho primero de la demanda interpuesta por ellos. Acotan, el bien que poseen según el levantamiento topográfico efectuado por el perito se encuentra a 576,47 metros del bastión del puente sobre la quebrada Santa Rita, mide tan solo 1.457,28 metros cuadrados, frente a la vía a Santa Rita, colinda al norte: Gilbert Chaves Zúñiga, Sur: Eusebio Gerardo Salas Mora, este: quebrada Santa Rita y oeste: calle pública con un frente de 59,42 metros. De ahí, refutan la identidad del bien declarada en sentencia. Aseveran, su principal línea argumentativa ha sido que el terreno que poseen es completamente distinto al del accionante; y reprochan, los juzgadores no lo consideraron ni valoraron, si no que se dedicaron a examinar aspectos intrascendentes e incluso inventados por el Tribunal.
Por ende, objetan lo inmueble, ello se debió a que la misma naturaleza del terreno contenía una prohibición expresa en el cambio de uso de suelo, lo cual, obedece a un interés superior de brindar la debida protección a las áreas de protección de las quebradas, conforme a las regulaciones de la Ley Forestal”. De lo anterior, en su opinión, no se resolvió el punto sometido a discusión. Tercero: en lo atinente a la legitimación pasiva, manifiestan, aplicando la metodología del Ad quem, “contrario sensu” , si el señor Quirós Díaz no tiene legitimación activa, según se probó, entonces no existe identidad del bien y consecuentemente tampoco cuentan con legitimación pasiva, dado que el inmueble que poseen es distinto al del accionante. Cuarto: manifiestan, se oponen a la condenatoria en costas, pues, debieron apersonarse al proceso al ser demandados y tuvieron que interponer su demanda, dado que el Juzgado con un evidente tecnicismo declaró extemporánea su contestación.
Afirman, no puede obviarse, está en juego su casa de habitación razón por la cual debían defenderlo sin escatimar ningún esfuerzo. Adicionan, es una simple orilla de río y ahora es el lugar donde viven con tranquilidad y sin perturbar derechos de nadie.
VIII.En los primeros dos agravios los casacionistas acusan errores indirectos de ley en razón de yerros en la apreciación de la prueba. En cuanto a la valoración probatoria en materia agraria, esta Cámara en el fallo no. “712-F de las 15 horas 15 minutos del 26 de setiembre del 2005, dispuso: IV. En el sub júdice la discusión gira en torno a un punto concreto: la apreciación del material probatorio, en cuanto a cuál de las partes incumplió el contrato. La forma cómo deben los jueces apreciar la prueba, ha variado a lo largo de la historia del Derecho Procesal. En una primera etapa, anterior a las codificaciones decimonónicas, se partía de un sistema tasado para discernir sobre la fuerza demostrativa de cada elemento. Así, la ley de antemano imponía valor a cada probanza, sin que el juzgador estuviera en la posibilidad de decidir, por sí mismo, cuáles elementos informaban mejor su convicción para resolver el caso concreto.
De esa manera, se requerían medios específicos para demostrar cada derecho, variando su cantidad en torno a cada uno, así como estableciendo, a priori, discriminaciones sobre los declarantes en razón de su género, edad, oficio o clase social. Ese sistema fue superado en la Ley de Enjuiciamiento Civil española, de 1855, que sirvió de base a los códigos procesales de América Latina, incluyendo a Costa Rica. En dicha legislación hispana se acogió el modelo de apreciar el material demostrativo a la luz de las reglas de la sana crítica. Se trata de la figura intermedia entre la prueba legal y la libre convicción. Con fundamento en la sana crítica, el juez puede llegar a un convencimiento por sí mismo sobre la certeza de los hechos sobre los cuales basa su decisión, a través de su propia valoración, pero, esta no es del todo libre, sino que está sujeta a las normas del pensamiento lógico formal y, de manera simultánea, a la experiencia humana.
Sobre el punto ha expresado la doctrina, en especial, Couture, que el juez no es una máquina de razonar, sino, esencialmente, un ser humano que toma conocimiento del mundo que le rodea y le conoce a través de sus procesos sensibles e intelectuales. La sana crítica es, además de lógica, la correcta apreciación de ciertas proposiciones de judicial estará encargada de apreciar las probanzas con una debida concatenación lógica y, además, bajo las circunstancias de su entorno, observadas mediante la experiencia. La finalidad de lo anterior es que el juzgador no podrá acogerse tan solo a su discrecionalidad, sino que deberá fundamentar, con base en la lógica y la experiencia, los motivos de su convicción. Esto, además, permitirá al superior, si se impugna el fallo, revisar si los criterios del a quo, se sujetaron a tales reglas del correcto entendimiento humano. Un tercer sistema es el denominado como de libre convicción.
En este, lo que decida el juzgador no deberá estar sujeto, necesariamente, a la prueba aportada por las partes al proceso. Incluso, podría resolverse contra los hechos probados y tener asidero tan solo en el saber privado del juez. Bastará con que este afirme tener la certidumbre moral de que los hechos sucedieron de tal manera, sin que se le pueda exigir el desarrollo lógico de su razonamiento. El Código Procesal Civil costarricense se enmarca en un híbrido entre las reglas de la sana crítica y la prueba tasada. Tal conclusión se extrae del precepto 330, así como de diversas regulaciones, resabios del sistema anterior, en torno al valor de los medios demostrativos como la confesión, los instrumentos públicos, los documentos que prevalecen sobre las declaraciones testimoniales y la imposibilidad de probar algunos hechos tan sólo con estas últimas. Por otra parte, la Ley de la Jurisdicción Agraria, en su artículo 54, párrafo segundo, dispone lo siguiente: “Al resolver sobre el fondo del negocio, el juez apreciará la prueba a conciencia y sin sujeción estricta a las normas del derecho común, pero, en todo caso, al analizar el resultado de la prueba recogida en el proceso, deberá expresar los principios de equidad o de derecho en que basa su criterio.”.
Aunque, por similitud de terminología, en principio, podría interpretarse que se ajusta al sistema de libre convicción, en realidad no es así, pues la propia norma ordena al juzgador dar argumentos de derecho o de equidad para justificar su apreciación. Asimismo, hubo pronunciamiento sobre el tema, cuando la Sala Constitucional, en su sentencia n.º 11932 de las 15 horas 37 minutos del 21 de noviembre del 2001, explicó que la prueba no puede valorarse al mero arbitrio de la autoridad judicial. Más bien, dicho numeral 54 la obliga a que “...analice el resultado de la prueba recogida en el proceso y exprese los principios de equidad o de derecho en que basa su criterio; respetando de tal modo los contenidos mínimos del derecho de defensa.” Dicha Sala, en el voto de cita, refiere a su sentencia n.º 4448 de las 9 horas del 30 de agosto de 1996, donde resolver en forma arbitraria, por cuanto todo juez –como funcionario que es- se encuentra sujeto al principio de legalidad, el cual constituye un imperativo de adecuación de la acción pública, no sólo de las normas específicas sobre un objeto determinado, sino a todo el bloque de legalidad; por lo que no puede fallar con desprecio de los principios y derecho constitucionales, ya que está limitado por las reglas de la sana crítica y principios de razonabilidad, que debidamente aplicados conducen a la armonía de la apreciación jurisdiccional con la Constitución Política” Entonces, debe concluirse, en realidad, el ordinal 54 de la Ley de Jurisdicción Agraria no permite al juzgador acogerse a un sistema de libre convicción.
Aún más, a partir de los deberes de fundamentar que se imponen y, a la luz de lo interpretado en la jurisprudencia constitucional, lo está sujetando a las reglas de la sana crítica, en el tanto, debe procurar un razonamiento lógico y acorde a la experiencia humana intersubjetiva para justificar lo que dispone. Por falta de sujeción al derecho común, según regula el propio precepto, habrá de entenderse que, a diferencia de los procesos civiles, no habrá prueba tasada alguna. En ese tanto, cuando se acuse una indebida valoración probatoria, por parte de los jueces agrarios, en realidad se estará acusando la inobservancia a las reglas de la lógica y de la su convicción.” En igual sentido, puede consultarse, entre otros, el fallo no. 173 de las 10 horas del 4 de marzo de 2008”. Fallo no. 1513 de las 9 horas 25 minutos del 15 de noviembre de 2012. En consecuencia, al entrar al análisis de dichos cargos lo primordial será determinar si los juzgadores al apreciar los elementos de convicción constantes en autos, lo hicieron con apego a las reglas de la lógica y de la experiencia. Además, habrá de partirse del hecho de que en esta materia no existe prueba tasada.
IX.Sobre lo recriminado por los impugnantes en el cargo de examen, en cuanto a que el Tribunal omitió referirse a los testimonios de los señores Gilberto Chaves Zúñiga, Florencio Moreno, Rafael Ángel Murillo Araya, Jhonatan Elias Vargas Chinchilla y Edin Gerardo Zúñiga Moreira, quienes dicen, proporcionan una versión distinta de los hechos a la referida por los deponentes Melvín Méndez Blanco y Eladio Méndez Camacho. Es evidente, se limitan a citar a los testigos sin precisar a cuáles aspectos concretos se refieren, sin aludir de manera precisa a lo manifestado por cada uno de ellos, ni apuntar el modo cómo contribuirían a fallar el asunto de forma distinta como se hizo. En lo atinente a que el fallo hizo una construcción artificiosa de los hechos, y que por ello no se acreditó la legitimación activa del accionante, ha de reproducirse en lo que interesa lo dispuesto en el considerando VI de dicha sentencia: “La construcción del cuadro fáctico realizado por el a quo, tanto en los hechos probados y no probados como en la parte considerativa de la resolución recurrida, es necesaria a efectos de resolver el fondo del asunto, además de que el recuento histórico no corresponde a una historia sin sustento alguno como lo alegan los recurrentes, sino que obedece precisamente a los hechos que se acreditaron en la sentencia conforme a la valoración integral de la prueba que fue aportada a los autos por ambas partes, así como a los hechos que no se lograron acreditar en el desarrollo del proceso y que se encuentran ayunos de prueba.
Tampoco es de recibo el argumento de que el testimonio de escritura pública y plano catastrado aportados a los autos por el actor Félix Quirós no demuestran la legitimación activa, debido a defectos e inconsistencias detectadas en los documentos. Como bien lo señalan los recurrentes, en este caso, existe informe pericial en el que se indicó claramente que el área poseída por Miguel Masís y Gregoria Moreno corresponde a un porcentaje de 43.99% del área descrita en el plano catastrado A-310230-1996 aportado por el actor Félix Quirós, la cual se refleja en un área de 1458.28 metros cuadrados, constatándose con ello, el traslape del área reclamada con la poseída por los recurrentes. Es importante resaltar que la referencia a los porcentajes realizados en el informe pericial, no se debe a una falta de constatación a nivel material del terreno en conflicto, sino a que el inmueble descrito en el plano catastrado A-310230-1996, materialmente se encuentra dividido en dos porciones, uno descrito como lote 1 y el otro lote 2, siendo el lote descrito como número 2, el que ocupan los recurrentes y sobre el cual versa el presente proceso, al ser reclamado por el actor Félix Quirós sólo una parte de su terreno, como bien se desprende de los hechos y de la petitoria de la demanda.
Tampoco es procedente el argumento de que el actor Félix Quirós no ejercía actos de posesión del inmueble en litis, debido a que, como bien lo señalan los recurrentes él admitió que mantenía la propiedad y los árboles para que no fueran reforestados. Lo anterior, es coincidente con lo manifestado por los testigos, al afirmar que antes de que ingresaran los demandados en el inmueble, el que le daba mantenimiento y lo veían trabajando era el actor”. De seguido, los juzgadores reprodujeron en lo de interés lo expresado por los testigos Melvin Méndez Blanco, Rafael Ángel Murillo Araya y Eladio Méndez Camacho, concluyendo: “…se desprende que en este caso, contrario a lo alegado por los recurrentes, el actor Félix Quirós demostró la adquisición del inmueble en litis… de su padre, el señor Heriberto Quirós Rodríguez y que previo al ingreso de Miguel Masís y Gregoria Moreno, el actor realizaba el mantenimiento y lo cuidaba de que no cortaran árboles.
Si bien en este caso, el señor Félix Quirós admitió no haber edificado ni desarrollado actividad agraria alguna, ello obedeció a que dicha área es colindante con la quebrada Santa Rita, en la cual, se debe respetar el margen del área de protección, de conformidad con la legislación actual”. En primer lugar debe señalarse, contrario a lo que parecen entender los recurrentes, los hechos probados, más que construirse con las situaciones fácticas desarrolladas en la demanda, se fundamentan en los elementos de convicción constantes en el debidamente las razones esgrimidas por el Tribunal al analizar las probanzas testimoniales, si no que se limitaron a indicar, los restantes deponentes externaron lo contrario; pero sin apuntar de forma concreta qué testificaron y el modo cómo llevarían a resolver de forma distinta a como se hizo. Además, el Ad quem no se basó solamente en dichas probanzas, ni en la escritura de compraventa del 18 de enero de 1996 y el plano catastrado no. A-310230-1996, si no que también lo hizo tomando en cuenta lo consignado en el informe pericial, sin que los impugnantes lo combatieren de modo alguno.
Nótese, en esta materia no existe prueba tasada, por ende, lo primordial es, se valore de manera conjunta, con apego a los principios de la lógica y la experiencia; lo cual en criterio de esta Cámara fue así, sin que los recurrentes logren desmeritarla por medio de sus objeciones. El Tribunal sobre el particular, señaló: “…mediante la prueba testimonial se constató la posesión que ostentó el señor Heriberto Quirós en el inmueble en conflicto y que éste lo traspasó al actor Félix Quirós en el año 1996. Al respecto, los testigos Melvin Méndez Blanco, conocido como Marvin, Rafael Ángel Murillo Araya y Eladio Méndez Camacho fueron contestes en afirmar que la propiedad era parte de una finca del señor Heriberto Quirós que se conocía como “Beto”, el cual era el papá de Felix Quirós y que dicha propiedad fue traspasada a éste último (ver testimonios a folios 239 al 242, 576 vuelto al 577 vuelto y 580); por lo que el aspecto subjetivo que dó totalmente acreditado no solo con la prueba documental, sino también con la testimonial que consta en autos.
En cuanto al elemento objetivo, se tiene que al realizar una comparación entre la información consignada en el plano catastrado y en el testimonio de escritura no se desprenden tales inconsistencias, debido a que existe coincidencia en la ubicación del inmueble y en la descripción de las colindancias. En el plano catastrado se indica que corresponde a un terreno ubicado en Santa Clara y quien tiene como lindero norte y sur al señor Heriberto Quirós Rodríguez, al este con quebrada Santa Rita y al oeste con calle pública. Por su parte, la escritura pública describe un inmueble en Santa Clara, que linda al norte y sur con resto reservado, que corresponde a resto de la finca del señor Heriberto Quirós Rodríguez, al este con río Santa Clara y oeste con calle pública. De las colindancias descritas, se desprende que en el único sector que no existe coincidencia es al este al consignar el nombre de río o quebrada con la que colinda, sin embargo, independientemente del nombre consignado, si cuenta con un límite natural que es una quebrada”.
Además, como apoyo utilizó el informe del experto, peritaje sobre el cual se ahondará al examinar lo pertinente a la identidad del bien. De lo anterior, es claro, el Ad quem realizó un estudio integral de los elementos de convicción sin que los inconformes lo combatan de manera clara y concreta, si no que repiten las argumentaciones externadas en su recurso de apelación del fallo del Juzgado, sin atacar la resolución de segunda instancia con especificas razones fácticas y jurídicas. Por otro lado, relativo a que no se acreditó de ninguna manera la posesión del señor Quirós Díaz sobre el terreno en disputa, han de hacerse las siguientes consideraciones. Distinto a lo que estiman los casacionistas, del análisis de las probanzas se tuvo por acreditada la posesión forestal. Ha de recordarse, en la actualidad no se hace referencia únicamente a la actividad agraria sino también forestal y ambiental como conformantes de la función económica, social y ambiental de la propiedad o posesión agraria.
En consecuencia, el hecho de que el actor destinara el terreno objeto del litigio a la conservación forestal, lejos de demeritar la posesión, la refuerza. Máxime si como ha sido demostrado, el predio está ubicado en la zona de protección de la quebrada Santa Rita. A lo expuesto, ha de agregarse, en el subexamine se comprobó, el señor Félix Quirós Díaz levantó cercas y realizó actividades de mantenimiento en el inmueble (chapeas y rondas), así, contrario a lo externado por los recurrentes, es indudable la posesión ejercida por el accionante.
X.En el segundo reproche, objetan lo dispuesto en cuanto a la identidad del bien. Al respecto ha de señalarse, contrario a lo argumentado por los recurrentes en lo relativo a los defectos subjetivos y objetivos que demeritan la escritura pública no. 161-19, según lo resolvió el Tribunal esto no es así. En cuanto a lo primero, es claro se trató de un error al momento de consignar la cédula de identidad del señor Heriberto Quirós Rodríguez, pues, como consta en la impresión de la consulta realizada en el Tribunal Supremo de Elecciones (folio 530) su número de cédula es el 200785985, pero se consignó como 207850985. Aunado a lo anterior, existe prueba testimonial que permite constatar, don Heriberto Quirós era el poseedor del terreno que se describe en dicho documento público y lo vendió en 1996 a su hijo Félix Quirós Díaz. Además, que el predio ocupado por los codemandados es parte del traspasado en aquella oportunidad al actor.
De ahí, las acusadas inconsistencias en lo tocante a linderos, medida, naturaleza, situación y referencias topográficas, no son del grado que conlleven a establecer se trata de un fundo distinto al que se pretende reivindicar. Recuérdese, los juzgadores al fallar valoraron en conjunto la totalidad de la prueba, a saber, documental, testimonial y pericial y de modo alguno, determinó que la escritura de cita constituía plena prueba, si no como se expresó, fue lo opuesto dado que valoraron todos los elementos de convicción con atención a las reglas de la lógica y experiencia humana. En este sentido, el dictamen del perito fue contundente al apuntar, el lote ocupado por los co-accionados, traslapa con el del actor en un 43.99% de su área total. Igualmente, explicó las razones por las que las discrepancias eran ínfimas, si se tomaba como punto de referencia el bastión del puente ubicado en la intersección de la quebrada Grande y la quebrada Santa Rita.
Expuso, una diferencia de 4.18 cuando el punto de partida se encuentra a más de 500 metros, resulta insignificante. Tales aspectos no los atacan los casacionistas en su recurso. Por otro lado, en lo concerniente a la medida, la discrepancia es con la escritura pública de compraventa, momento para el cual el terreno no había sido medido para efectos catastrales, pero si se compara con la del plano catastrado la diferencia es mínima, y como lo apuntó el perito puede deberse al ensanchamiento de la quebrada, que es uno de los linderos del inmueble, así como por la construcción de la carretera que conduce a Santa Rita. Los linderos es lógico que cambien con los años, la naturaleza por lo general se consigna sea por indicación de los poseedores o del propio profesional, aunque lo primordial es la que se compruebe con fundamento en datos ciertos y reales. En todo caso, también puede cambiar con el transcurso del tiempo.
En lo relativo a la distancia donde se encuentra el lote objeto de litigio con respecto al bastión del puente y la medida de 1.457,28 metros cuadrados, se explica, según lo analiza el perito, ese predio corresponde tan solo al 43.99% del inmueble del demandante que se describe en el plano no. A-310230-1996. De ahí, también se aclara lo concerniente a la disconformidad en la distancia respecto al punto de referencia, ya que el área ocupada por los codemandados se encuentra más al sur. De lo expuesto, es indudable no llevan razón los impugnantes puesto que no es cierto, el bien en disputa no corresponde a una porción del que posee el actor desde hace más de 15 años y destinándolo principalmente a la conservación forestal y ambiental.
XI.En el tercer reparo, atacan la legitimación pasiva, sin brindar mayores detalles, ya que aducen sigue la metodología empleada por el Juzgado, pese a que el fallo que deben combatir es el del Tribunal. No obstante, ha de indicarse, una vez más no llevan razón en sus asertos, dado que se acreditó se encuentran ocupando una porción del inmueble que ha venido poseyendo el actor. Por ende, se demostró la legitimación pasiva. Sobre el particular, el Ad quem dispuso: “Contrario a lo expuesto por los recurrentes, en este caso, si se logró acreditar la legitimación pasiva, no sólo al haberse admitido en forma expresa que ingresaron al inmueble sin contar con ningún permiso y con pleno conocimiento que el inmueble tenía dueño, lo cual, se demuestra con las diversas acciones realizadas por el actor Félix Quirós para recuperar su terreno con la interposición de los procesos interdictales tramitados bajo los expedientes números 08-000089-298-AG y 08-000163-298-AG, el primero… contra Jaime Giovanni portugués en fecha 21 de mayo del 2008 y el segundo… contra Miguel Masís Ugalde en fecha 08 de setiembre del 2008…
Obsérvese… reclama el mismo inmueble objeto del presente proceso y fue a partir del mes de mayo de 2008 que comenzaron los problemas de invasión dentro del terreno, siendo aproximadamente un mes después que los demandados Miguel Masís y Gregoria Moreno ingresaron en el inmueble teniendo pleno conocimiento del reclamo del señor Félix Quirós, lo anterior se evidencia con la contestación que realizó el demandado Miguel Masís en el proceso interdictal 08-000163-298-AG al manifestar lo siguiente: “…Es precisamente este hecho el que evidencia sin ninguna duda la mala fe del actor, toda vez que el establece como punto de partida la fecha de inicio de mi posesión para el día 15 de julio del 2008, cosa que resulta absolutamente falso, pues para el día 12 de junio del 2008 el mismo actor me ubica ya en la propiedad y ello basta ver los folios 12 a 14 frente y vuelto donde se asentó el Acta de Inspección realizada por el señor Juez Agrario, Lic. Ignacio Rodríguez Sancho, con la misma fecha dentro del proceso de igual naturaleza que se seguía en contra del señor Jaime Giovanni Portugués Chacón, bajo el expediente número 08-000089-298-AG, de este Juzgado, donde el mismo actor le indica al Juez que el suscrito había ingresado unos días después del demandado en esa litis, quien dicho sea de paso ingresó en los primeros días del mes de mayo del 2008, según lo reconoció en la contestación del citado proceso…”. Con lo inmueble le pertenecía al señor Félix Quirós y de los reclamos realizados por éste mediante el proceso interdictal…”.
Aspectos, que no atacan los impugnantes de modo alguno, lo cual torna improcedente su reparo.
XII.En lo que a las costas se refiere, es menester manifestar que hay normativa agraria que las regula de manera expresa. La mayoría de esta Sala en lo que a este tema concierne, reiteradamente ha señalado que: “…en los procesos civiles, como en los agrarios, la condenatoria en costas se impone al vencido por el solo hecho de serlo. Lo anterior, sin que dicha condenatoria implique una calificación de temeridad o mala fe (numerales 221 del Código Procesal Civil y 55 de la Ley de la Jurisdicción Agraria [LJA]). Por ello, no se produce quebranto de esos artículos si se condena al vencido. Contrariamente, cuando se exonera de ese pago, los juzgadores deben justificar su proceder, por ser la excepción a la regla. En este supuesto, el pronunciamiento respectivo es pasible del recurso de casación, ante la presencia de eventuales errores derivados de una mala aplicación de los casos de exención y un uso indebido de la facultad de exonerar”.
No. 504 de las 8 horas 40 minutos del 14 de abril de 2011. El precepto 55 de la LJA, estipula: “Las sentencias, así como las resoluciones que pongan fin al proceso, contendrán pronunciamiento sobre costas. La parte vencida podrá ser exonerada del pago de las costas personales, y aun de las procesales, cuando sea evidente que ha litigado de buena fe, por existir, a juicio del tribunal, motivo suficiente para litigar, o porque las pretensiones de la parte vencedora, en definitiva, resultaron desproporcionadas”. (La negrita es suplida). En el asunto de examen, según se expuso en el considerando I de esta Sentencia, el Tribunal confirmó la sentencia del Juzgado donde se impuso el pago de las costas del proceso a los codemandados perdidosos al estimar no contestaron en tiempo la demanda y no se encontraban en ninguno de los supuestos de excepción. Ha de manifestarse, la exoneración, aún en la hipótesis regulada por el canon, no es imperativa sino discrecional.
En esta circunstancia, si el juzgador no está obligado a exonerar, no incurre en infracción de la referida disposición legal, si no exime. No hay quebranto normativo cuando las costas se imponen al vencido, porque el juez se limita a aplicarla en los términos por ella dispuestos. Así, es indudable, que su imposición no significa que se tenga al perdidoso como litigante temerario o de mala fe. Por otra parte, aunque el canon 55 de la LJA reproducido, no señale de modo expreso que las costas se imponen al vencido, lo cierto, es que ello se deduce con claridad de su lectura integral, al establecer en su segunda parte que, a juicio de los juzgadores la parte perdidosa puede ser exonerada de cancelar las costas, en los supuestos que la norma dispone. Es indudable se está frente un extremo en el cual los jueces gozan de discrecionalidad, si estiman que quien perdió el proceso puede ser eximido de cancelarlas, caso contrario, lo conducente es condenarlo a su pago.
Consecuentemente, el Ad quem no incurrió en la vulneración acusada al imponerle a los recurrentes el pago de costas, por lo que debe rechazarse el reproche. En consecuencia, lo pertinente es el rechazo de las inconformidades.
POR TANTO
Se rechaza el recurso y confirma la sentencia recurrida. La magistrada Escoto suscribe nota sobre costas.

I.La suscrita integrante no comparte el criterio plasmado por la mayoría de esta Sala en el considerando VI del fallo anterior, en cuanto deniega el control casacional para aquellos casos en los que tan sólo se hace uso de la regla general de la condena al vencido en el pago de ambas costas, es decir, cuando no se actúa o aplica ninguna norma atinente a la exoneración de ellas. En efecto, el fundamento jurisprudencial de mayoría, parte de que la exoneración en el pago de las costas es una facultad, en la que no se produce yerro ni infracción normativa cuando no se ejercita o aplica; por ello, se dice, si no hay violación legal, no es posible en casación entrar a valorar o modificar lo resuelto sobre la condena al vencido, pues se repite, para la mayoría de esta Sala, sólo puede haber infracción jurídica cuando se actúa la norma correspondiente a la exoneración (entre muchas pueden verse las sentencias de esta Sala no. 1001- F-2002, de las 11 horas 50 minutos del 20 de diciembre de 2002; la 249-F-2003, de las 11 horas 45 minutos del 7 de mayo de 2003 y la 306-F-2006, de las 10 horas 20 minutos del 25 de mayo de 2006).
La concatenación parece en principio lógica, pues con esta premisa, si la exoneración constituye una facultad, el juzgador no está obligado a exonerar; y por ende, si no ordena o realiza tal exoneración, no viola las normas que corresponden al tema. Ergo, si no se da violación de normas, no puede haber revisión casacional (consúltense los votos de esta Sala no. 765 de las 16 horas del 26 de septiembre de 2001 y 561-F-2003, de las 10 horas 30 minutos del 10 de septiembre de 2003). Esta relación de ideas, les permite concluir, que en ese supuesto específico (la simple condena o la inaplicación de las exoneraciones) “no puede ser objeto de examen en esta sede” (de este mismo órgano decidor, sentencia no. 419-F-03, de las 9 horas 20 minutos del 18 de julio de 2003), pues se trata de una hipótesis “no pasible de casación” (fallo no. 653-F-2003, de las 11 horas 20 minutos del 8 de octubre de 2003).
Así, en opinión de los distinguidos compañeros: no tiene cabida el recurso de casación cuando no se hace uso de la facultad exoneratoria (véanse a contrario sensu los considerandos III y VIII, por su orden de las resoluciones 541-F-2003, de las 11 horas 10 minutos del día 3 y de las 10 horas 50 minutos del día 10, ambas de septiembre de 2003). De esta forma se ha estimado por la mayoría que “… la condena en costas al vencido, como aquí sucedió no es revisable en esta Sede, habida cuenta de que el Tribunal se limitó a actuar la norma en los términos por ella dispuestos” (el destacado no es del original, véase el considerando X del voto no. 68-F-2005, de las 14 horas 30 minutos del 15 de diciembre de 2005). Y en materia notarial, con mayor contundencia, se ha señalado que: “…el Tribunal le impuso el pago de las costas de la pretensión resarcitoria a la denunciante, pronunciamiento que, se repite, no tiene casación”. (considerando X de la sentencia no. 928-F-2006, de las 9 horas 15 minutos del 24 de noviembre de 2006).
II.Sin embargo, en parecer de la suscrita, la indebida inaplicación de los preceptos que permiten la exoneración de costas, infringe, sin duda, el Ordenamiento Jurídico y, en concreto, las normas que la autorizan, ya sea por error o inadecuada apreciación de los jueces en el conflicto específico. En ese tanto, aunque se trate de una facultad, es lo cierto que no se encuentra inmune al control casacional, pues tanto en su ejercicio como en su inaplicación, puede operar una violación de ley, y en esa medida, la indebida omisión no es ni debe ser, sinónimo de arbitrariedad, en tal caso, cometida por el propio Juzgador. Máxime si se trata de un apoderamiento al juez otorgado con supuestos específicos que limitan su poder discrecional en esta materia. En consecuencia, en este particular aspecto, estimo que con la sola aplicación de la regla general de los artículos 54, 55 y 61 de la Ley de la Jurisdicción Agraria (condenatoria al vencido al pago de ambas costas), no se cierran las puertas al recurso de casación, pues al contrario, el asunto es admisible para su examen de fondo (siempre y cuando se cumplan los requisitos de ley) ante un eventual vicio omisivo en la aplicación de las disposiciones legales que autorizan la exoneración de dichas costas (canon 55 íbid).
No obstante lo anterior, en el caso concreto de examen, esta integrante comparte lo dispuesto en el fondo por el Tribunal, en cuanto se impuso a los vencidos el pago de ellas, ya que acogieron la demanda en su contra y sin lugar la incoada por ellos.
