Ordinary proceedings (proceso de conocimiento) instituted before the Administrative and Civil Tax Court (Tribunal Contencioso Administrativo y Civil de Hacienda) by INVERSIONES MARINA MANUELA SOCIEDAD ANÓNIMA, represented by its general attorney-in-fact with unlimited authority (apoderado generalísimo sin límite de suma), Maurizio Micangeli Ceppo, married, businessman, domicile unknown; against the STATE, represented by Deputy State Attorney Gloria Solano Martínez, marital status not indicated, resident of Heredia. CONSIDERING
I.Inversiones Marina Manuela Sociedad Anónima owns the property registered in Heredia under real-property folio number 208.837-000, classified as pastureland and located in the Fifth District—Concepción—of the Fifth Canton—San Rafael—with an area of 28.000,00 square meters. Decreto Ejecutivo no. 25902-MIVAH-MP-MINAE, published in Supplement no. 15 to La Gaceta no. 66 of 7 de abril de 1997, amended Part Three of the Regional Urban Development Plan (Decreto Ejecutivo no. 13583-VAH-OFIPLAN of 13 de mayo de 1982), establishing an urban-development control area (área de control urbanístico) composed of districts in the provinces of San José, Alajuela, Heredia, and Cartago, provided that their respective municipalities had not adopted their own zoning plans (planes reguladores). A special protection zone (zona especial de protección) was also created within that area. The cantons affected by the urban-development control areas created under the cited Decreto no. 25902-MINAH-MP-MINAE include San Rafael de Heredia.
The representative of Inversiones Marina Manuela S.A. filed suit against the State seeking a declaration that Decreto no. 25902-MINAH-MP-MINAE is absolutely null and void because it is inconsistent with the legal system. The State’s representative opposed the complaint and raised the defenses of lack of a legal right, lack of interest, and lack of standing. At the preliminary hearing, the representative also raised the defense that the action was time-barred, which was summarily rejected because, in the plaintiff’s view, the challenged act is absolutely null and void [Article 40 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo, CPCA)]. The Court sustained the defense of lack of a current interest raised by the State and dismissed the complaint as inadmissible; it also exempted the plaintiff from paying costs because it found that the plaintiff had sufficient grounds to litigate. Dissatisfied, the plaintiff filed an appeal in cassation setting forth one ground, which it characterizes as procedural.
II.Sole ground: the plaintiff alleges a failure to state reasons (falta de motivación). It asserts that the judgment must contain all factual and legal elements supporting the decision. It adds that the judgment must set forth and describe a logical, coherent, detailed, and specific chain of reasoning (iter lógico). It states that the evidence must first be considered individually and within its general context and then assessed as a whole under the principle of unity of evidence (principio de unidad probatoria) (Article 330 of the Code of Civil Procedure). It notes that the judgment lists the following among the facts not proven: “1- That the property owned by my client was located within the expansion area of the urban grid; and 2- that it has not been shown that any public institution has denied or restricted any urban-development, agricultural, farming, or other type of project because the property is located within a special protection area.” It argues that this is contradictory because, if its land were within the expansion area of the urban grid (a survey map was submitted establishing that it lies outside that area), the restrictions of Decreto no. 25902-MIVAH-MP-MINAE challenged herein would not apply to it.
Furthermore, it objects that this regulation provides that the activity permitted in the area is predominantly agricultural; consequently, stating that no project of this kind has been denied or restricted is confusing and, in its view, leaves the judgment without adequate reasons. It challenges the sustaining of the defense of lack of interest on the ground that it was not shown that its property was within the urban expansion grid, even though the judgment should have stated that it had not been established that the property lay outside that area. It explains that the problem arises when a property is not within that zone, as is in fact the case, because if it were within the zone, the challenged Decree—which it asserts almost completely restricts the right to property—would not affect it. Thus, it argues, owning land within the area covered by that provision gives every owner a current interest, without any need to prove that a permit has been denied, because the Decree makes almost any application impossible.
As evidence, it submits a copy of case file 10-004623-1027-CA, involving an appeal before the Administrative Court in its capacity as the nonhierarchical appellate authority (jerarca impropio) of the Municipalidad de San Rafael de Heredia. It contends that, because the matter remains pending resolution in administrative proceedings and exhaustion of administrative remedies (agotamiento de la vía administrativa) is required, the denial of the building permit based on the challenged Decree is not yet final. It explains that a new fact (hecho nuevo) could arise only once the Court issues its decision and, therefore, Article 145 of the CPCA has not been violated.
III.The plaintiff’s representative offers as evidence a copy of expediente no. 10-004623-1027-CA, in which the Tribunal Contencioso Administrativo is hearing an appeal (recurso de apelación), acting as the nonhierarchical superior (jerarca impropio) of the Municipalidad de San Rafael de Heredia. As relevant here, this Collegiate Body has stated: “...provision 145, subsection 1), of the CPCA contains a mandatory formal requirement under which anyone offering documents during the processing of a cassation appeal (recurso de casación) must swear that they had no prior knowledge of them and that they concern new facts occurring after the judgment under appeal. That provision makes no distinction regarding the reason why the applicant was unaware of such documentary evidence concerning new events occurring after the challenged judgment. In that case, regardless of whether the documents existed before that decision or were issued afterward, the fact remains that the oath is required and, accordingly, must be provided.
That requirement must be fulfilled when the evidence is submitted... Furthermore, even assuming that requirement were waived, this Chamber considers that there are sufficient grounds for deciding the challenges brought by both parties, such that the evidence for better adjudication (prueba para mejor proveer) requested by the plaintiff’s attorney is unnecessary.” Judgment no. 981 of 8 hours 42 minutes on 23 de agosto de 2011. In this case, the proponent omits the oath prescribed by the administrative litigation procedural rules (normativa procesal contenciosa administrativa), rendering inadmissible the offer of the referenced item of evidence (elemento de convicción). As for the evidence for better resolution (prueba para mejor resolver) governed by provision 148 ibídem, as this Chamber has stated, it is for the judge to order; that is, it constitutes recognition of the judges’ authority to take evidence on their own initiative, in this case at the cassation stage.
Accordingly, it is for this Chamber to determine whether such evidence is appropriate and necessary, namely, when it comprises demonstrative elements deemed relevant to the proper resolution of the proceedings. This is without permitting its use to correct the parties’ omissions, negligence, or carelessness concerning their burden of proof, or to remedy shortcomings in their defense, since doing so would undermine equality between the litigants and could compromise the judges’ impartiality. Consequently, if such evidence is ordered, the right of defense at trial must be respected, and it may be introduced solely to clarify uncertain or doubtful matters arising from the evaluation of the evidence submitted by the parties. The decision to obtain it, however, always remains within the judges’ authority; in other words, it is subject to the judicial body’s discretion. When one of the parties proposes it, the decision whether to obtain it is likewise entirely discretionary.
In the matter under review (subexamine), the proponent could have offered it at the appropriate procedural stage but failed to do so; accepting it would therefore remedy her own neglect, which is improper. This Chamber likewise considers that, given how the matter was decided and what will be set forth below, the offered item of evidence is unnecessary. The evidence must therefore be rejected.
IV.A review of the record shows that the Tribunal upheld the objection based on lack of a current interest (falta de interés actual) raised by the State’s representative and, as a consequence, declared the complaint inadmissible. The judges based their decision on the following: “...the plaintiff did not undertake to demonstrate and establish whether the property she owns, registered under the real-property folio system as number 208837-000, located in district five (sic), Concepción, canton five (sic), San Rafael, Province (sic) of Heredia, lies within the expansion area of the urban grid, or whether any public institution had denied, prohibited, or restricted any urban-development, agricultural, farming, or other type of project proposed by the plaintiff because her property was located in a special protection area; she therefore has no current interest whatsoever in the outcome of these proceedings, since the plaintiff’s claim, as pleaded, constitutes merely the exercise of objective review of legality, without any relevant benefit or utility at present.” (Emphasis added).
Although the ground for appeal alleges a procedural defect—failure to state reasons—it is actually a substantive defect, because it alleges an improper evaluation of items of evidence. She argues that she submitted a registered survey plan (plano catastrado) showing that her property lies within the restricted area established by Decreto no. 25902-MIVAH-MP-MINAE—outside the urban expansion zone. However, a review of the case file confirms that, contrary to the plaintiff’s assertion, it contains no registered survey plan. The alleged failure to consider evidence (preterición probatoria) therefore did not occur. She further asserts that, among the facts not proven, it was deemed unestablished that the company’s property lies within the expansion area of the urban grid, which she considers contradictory because, if that were so, the restrictions in Decreto no. 25902-MIVAH-MP-MINAE would not apply to it.
A review of the challenged judgment shows that this is an evident clerical error that does not affect the substance of the ruling. This is because the Tribunal subsequently states clearly that the essential issue in the matter under review is that it was not proven that the claimant’s land lies in an area subject to the restrictions established in the aforementioned Decreto. That circumstance remains unchanged, since the appellant in cassation fails to demonstrate that her property is located in an area to which those limitations apply.
V.In a related vein, as regards the statement in the judgment that the claimant failed to establish that any type of project had been denied, prohibited, or restricted because her property was located in a special protection area, it is evident that she likewise fails at the cassation stage to prove what the Tribunal found lacking. In this regard, the copies of the administrative proceedings before the Tribunal Contencioso Administrativo acting as nonhierarchical superior are immaterial for that purpose because, as the appellant herself states, the matter remains pending resolution; until a final judgment is issued and becomes final, it is impossible to know whether her application was in fact denied. It is indisputable from the foregoing that the plaintiff lacks a current interest. “As this Chamber has repeatedly held (see judgments no. 8, of 15 hours 45 minutes on 5 de enero de 2000, and no. 6, of 14 hours 30 minutes on 6 de febrero de 1998), in matters submitted for adjudication, the Judge is required to examine, even on the Judge’s own motion, the substantive prerequisites of every action, namely: right, standing (legitimación), and interest.
These are necessary conditions for the issuance of a judgment granting relief and must therefore remain present throughout the proceedings. Thus, if one or more of them is found to be absent, the Judge may not rule on the merits of the dispute, thereby giving rise to what legal doctrine calls a judgment declining to reach the merits (sentencia inhibitoria)... Interest is the need for judicial protection experienced by a specific person, which leads that person to request the intervention of the appropriate judicial body so that it may resolve the legal dispute to which that person is a party. Accordingly, it may be said that the exercise of the right of action and the formulation of the claim are prompted by the frustration of an interest protected by the legal system—a legitimate interest (interés legítimo)—or of a subjective right (derecho subjetivo). It has also been said that interest is the utility that the holder of a subjective right or legitimate interest derives from judicial protection.
Therefore, because interest must, as stated, remain present throughout the proceedings, whenever its continued existence must be examined, the judge must assess utility by comparing the effects of the requested judicial decision with the utility that the person requesting it may obtain from such a ruling. If the absence of a judgment causes harm or loss to the person who requested protection, interest exists; if it does not, there is no interest. This is so because the cause of the litigation—the conflict of interests—has disappeared.” (Judgment no. 465 of 10 hours 45 minutes on 7 de mayo de 2009). In this case, it plainly was not established that the plaintiff was in a position in which the eventual decision would benefit or affect her in any way. Nor was it established what need for protection prompted her to request the intervention of the judicial body, or what damages and losses the absence of a ruling, or the decision itself forming the subject matter of the proceedings, would cause her. Consequently, as the Tribunal held, the plaintiff has no current interest in these proceedings.
VI.In view of the foregoing, the offered evidence must be rejected and the appeal denied, with costs assessed against the proponent [subsection 3) of provision 150 of the CPCA].
POR TANTO
The proposed evidence is rejected. The cassation appeal filed is denied, with costs assessed against the appellant.

Figura como apoderado especial judicial de la parte actora, el licenciado Juan Arturo Abdelnour Granados, divorciado, vecino de San José. Las personas físicas son mayores de edad y con las salvedades hechas, abogados.
RESULTANDO

CONSIDERANDO
I.La empresa Inversiones Marina Manuela Sociedad Anónima es propietaria del inmueble del Partido de Heredia, matrícula de folio real 208.837-000, su naturaleza es terreno de potrero, situado en el distrito Quinto –Concepción-, del cantón Quinto –San Rafael-, con una medida de 28.000,00 metros cuadrados. En el Decreto Ejecutivo no. 25902-MIVAH-MP-MINAE, publicado en el Alcance no. 15 a La Gaceta no. 66 del 7 de abril de 1997, se modificó la parte tercera del Plan Regional de Desarrollo Urbano (Decreto Ejecutivo no. 13583-VAH-OFIPLAN del 13 de mayo de 1982), donde se estableció un área de control urbanístico, compuesta por los distritos de las provincias de San José, Alajuela, Heredia y Cartago, siempre y cuando las respectivas municipalidades no hubieran dictado sus propios planes reguladores. En dicha área se creó también una zona especial de protección. Entre los cantones afectados por las áreas de control urbanístico creadas en el citado Decreto no. 25902-MINAH-MP-MINAE, se encuentra el de San Rafael de Heredia.
El representante de la compañía Inversiones Marina Manuela S.A. interpone demanda contra el Estado para que se declare la nulidad absoluta del Decreto no. 25902-MINAH-MP-MINAE por ser disconforme con el ordenamiento jurídico. La representación estatal contestó negativamente y opuso las excepciones de falta de: derecho, interés y legitimación activa. Además en la audiencia preliminar formuló la defensa de caducidad, la cual se rechazó en el acto, pues en criterio del actor, el acto impugnado es absolutamente nulo [artículo 40 del Código Procesal Contencioso Administrativo (CPCA)]. El Tribunal acogió la excepción de falta de interés actual opuesta por el Estado y declaró improcedente la demanda; asimismo exoneró del pago de costas a la actora al considerar que tenía motivo suficiente para litigar. Inconforme, la parte demandante formula recurso de casación donde desarrolla un motivo, al que califica de procesal.
II.Único: acusa falta de motivación. Asevera, la sentencia debe tener todos los elementos de hecho y derecho que respalden la decisión. Agrega, requiere de la existencia y descripción de un iter lógico y coherente, detallado y circunstanciado. Indica, tanto desde la óptica individualizada de las probanzas como a lo interno de su contexto general, para luego, valorarla en su conjunto, al abrigo del principio de unidad probatoria (artículo 330 del Código Procesal Civil). Apunta, entre los hechos no probados del fallo se tiene: “1- Que el inmueble propiedad de mi representada se encontrara dentro del área de negado o restringido por parte de alguna institución pública algún proyecto de desarrollo urbanístico, agrícola, agropecuario o de cualquier otra naturaleza por estar su inmueble en alguna área de protección especial”. Lo de expansión del cuadrante urbano (se aportó plano donde se acredita está fuera) no se le aplicarían las restricciones del Decreto no. 25902-MIVAH-MP-MINAE aquí impugnado.
Por otra parte, increpa, dicha regulación dispone que la actividad que puede desarrollarse es predominantemente agrícola, por lo que manifestar que no se le ha negado o restringido ningún proyecto de este tipo resulta confuso, lo que en su opinión, hace que la sentencia carezca de motivación. Refuta se acogiera la excepción de falta de interés porque no se demostró que su finca estuviera en el cuadrante de expansión urbana, pese, a que debió expresar que no se había acreditado que estaba fuera de tal área. realidad, porque si estuviera en ella, no le afectaría el Decreto impugnado, -el que afirma, limita casi de forma absoluta el derecho de propiedad-. Así, arguye, el hecho de tener un terreno en el área cubierta por esa norma, le confiere un interés actual a todo propietario, sin necesidad de probar se le haya negado algún permiso porque el Decreto casi imposibilita cualquier solicitud.
Aporta como prueba copia del expediente 10-004623-1027-CA, donde se tramita la apelación ante el Tribunal Contencioso Administrativo en su carácter de jerarca impropio de la Municipalidad de San Rafael de Heredia. Aduce, como el asunto está pendiente de resolución en sede administrativa, y al ser requisito el agotamiento de la vía administrativa, entonces no está en firme la denegatoria del permiso de construcción en razón del Decreto impugnado. por ende, no se vulnera lo estipulado en el cardinal 145 del CPCA.
III.El representante de la actora ofrece como prueba la copia del expediente no. 10-004623-1027-CA, donde el Tribunal Contencioso Administrativo conoce recurso de apelación, en su carácter de jerarca impropio de la Municipalidad de San Rafael de Heredia. En lo de interés, este Órgano Colegiado ha señalado: “El… precepto 145, inciso 1), del CPCA, contiene un requisito formal de carácter imperativo, en virtud del cual, quien ofrezca documentos durante el trámite del recurso de casación, debe jurar no haberlos conocido con anterioridad y que sean sobre hechos nuevos y posteriores a la sentencia recurrida. No discrimina esa norma respecto al motivo por el que el gestionante no conoció de esa documental relativa a hechos novedosos, acaecidos luego del fallo impugnado. En ese caso, ya sea que los documentos existiesen antes de esa resolución o que se emitieron con posterioridad, lo cierto es que el juramento se exige y, en tal predicado, ha de observarse.
Ahora bien, ese requisito debe cumplirse al presentarse la prueba… Por lo demás, y en la hipótesis de que se dispensara ese mandato, estima esta Sala que existen suficientes elementos de convicción para resolver las impugnaciones planteadas por ambas partes, de modo que la prueba que para mejor proveer gestiona el apoderado del actor resulta ser innecesaria”. Fallo no. 981 de las 8 horas 42 minutos del 23 de agosto de 2011. En la especie, el proponente omite el juramento estipulado en la normativa procesal contenciosa administrativa, lo cual hace improcedente el ofrecimiento efectuado del elemento de convicción reseñado. En lo relativo a la prueba para mejor resolver, normada en el canon 148 ibídem, según lo ha iniciativa probatoria oficiosa a cargo de los jueces, en este caso, casacionales. Así, corresponde a esta Sala decidir su conveniencia y necesidad, a saber, cuando constituyan elementos demostrativos que se consideren relevantes para la correcta resolución del proceso.
Lo expresado, sin que pueda hacerse para corregir las omisiones, negligencias o descuidos de los contendientes respecto a su carga probatoria o para paliar carencias en la defensa, pues, en estos supuestos se lesionaría la igualdad entre los litigantes y podría comprometer la imparcialidad de los juzgadores. Consecuentemente, de ordenarse ha de respetarse la garantía de defensa en juicio y deberá ser introducida únicamente para dilucidar aspectos inciertos o dudosos que surjan al ponderar las pruebas aportadas por las partes. Pero quedando la decisión de recabarla, siempre como facultad de los jueces, o sea, que compete a una valoración discrecional del órgano judicial. Y, cuando alguna de las partes la propone, compete a su entera discrecionalidad la decisión de recabarla. En el subexamine, la proponente pudo ofrecerla en el momento procesal oportuno, pero no lo hizo, de ser aceptada significaría paliar su propia incuria, lo cual no resulta procedente.
Asimismo, esta Cámara estima que por la manera como se resolvió el asunto y por lo que se expondrá en adelante, el elemento de convicción ofrecido resulta innecesario. De ahí que tal probanza ha de rechazarse.
IV.Del estudio de los autos, se aprecia que el Tribunal declaró la falta de interés actual interpuesta por la representación del Estado, y como consecuencia de ello, improcedente la demanda. Los jueces se fundamentaron en que: “…la actora no se ocupó de demostrar y comprobar si el inmueble de su propiedad, inscrito bajo el sistema de folio real número 208837-000, situado en el distrito cinco (sic) Concepción, del Cantón cinco (sic) San Rafael de la Provincia (sic) de Heredia, se encuentre dentro del área de expansión del cuadrante urbano o que a la actora se le haya negado, prohibido o restringido por parte de alguna institución pública algún proyecto de desarrollo urbanístico, agrícola, agropecuario o de cualquier otra naturaleza por estar situado su inmueble en alguna área de protección especial, por lo que carece de todo interés actual el resultado de este proceso, toda vez que la pretensión de la actora, en los términos planteados constituye el mero ejercicio de un control objetivo de legalidad, carente de todo provecho o utilidad relevante al día de hoy”.
(El subrayado es suplido). En el agravio aunque se alega un vicio procesal, –falta de motivación-, en realidad se trata de uno sustancial, ya que se acusa indebida apreciación de elementos de prueba. Argumenta, aportó un plano catastrado donde se demuestra su finca se encuentra en el área de restricción establecida en el Decreto no. 25902-MIVAH-MP-MINAE, -fuera de la zona de expansión urbana-. Sin embargo, del análisis del expediente se constata que, contrario a lo aseverado por la parte demandante, no hay plano catastrado alguno. De ahí, no se configura la aducida preterición probatoria. Por otro lado, afirma, en los hechos no probados, se tuvo como no acreditado que la propiedad de la empresa se encuentra en el área de expansión del cuadrante, lo que en su criterio es contradictorio, porque de ser así, no se le aplicarían las restricciones del Decreto no. 25902-MIVAH-MP-MINAE. Del examen del fallo recurrido, se observa, se esta ante un evidente error material, que no afecta la esencia de los resuelto.
Esto porque más adelante, el Tribunal con claridad señala que lo primordial en el subexamine es que no se probó que el terreno de la accionante se encuentre en una zona donde se apliquen las restricciones dispuestas en el Decreto de marras. Circunstancia que se mantiene, pues, la casacionista no logra demostrar su finca este ubicada en un área donde se apliquen las citadas limitaciones.
V.En otro orden de ideas, en lo tocante a que en la sentencia se restringido algún tipo de proyecto dado que su propiedad se ubica en una zona de protección especial, es evidente, ante casación tampoco consigue probar lo que echa de menos el Tribunal. A este respecto, las copias del proceso administrativo ante el Tribunal Contencioso Administrativo como jerarca impropio, resultan inconducentes a tal fin, porque como lo refiere el propio recurrente, el asunto está pendiente de resolución, y hasta tanto no se emita el fallo final y quede en firme, entonces no es posible conocer si en efecto le fue denegada su gestión. De lo expuesto, es indudable que la actora carece de interés actual. “Según ha dicho en forma reiterada esta Sala (véase los votos no. 8, de las 15 horas 45 minutos del 5 de enero de 2000 y no. 6, de las 14 horas 30 minutos del 6 de febrero de 1998), en los asuntos sometidos a su conocimiento, el Juez está obligado a analizar, incluso de oficio, los presupuestos sustanciales o de fondo de toda acción, a saber: derecho, legitimación e interés.
Se trata de condiciones necesarias para la emisión de una sentencia estimatoria, por lo que deben conservase durante todo el proceso. De modo que si se detecta la ausencia de uno o más de ellos, el Juzgador no podrá pronunciarse sobre el fondo de litigio, generándose de esta forma lo que en doctrina se conoce como sentencia inhibitoria... El interés es la necesidad de tutela en que se encuentra una persona en concreto y que lo determina a solicitar la intervención del respectivo órgano jurisdiccional, con la finalidad de que resuelva el conflicto jurídico en el cual es parte. De tal manera, se puede decir, que es la insatisfacción de un interés tutelado por el ordenamiento jurídico (interés legítimo) o un derecho sujetivo, la que provoca el ejercicio del derecho accionar y motiva a formular la pretensión. Se ha dicho también, que es la utilidad que para el titular de un derecho subjetivo o un interés legítimo se deriva de la tutela jurisdiccional.
Por ello, siendo imperioso, como ya se dijo, mantenerse durante el desarrollo de todo el proceso, cuando es necesario analizar su subsistencia, el juzgador debe hacer un juicio de utilidad, cotejando los efectos de la resolución jurisdiccional solicitada, con la utilidad que de tal pronunciamiento puede obtener quien la requiera. Si la falta de sentencia le produce daño o perjuicio a quien solicitó tutela, hay interés; si no lo ocasiona, no existe. Esto es así, por cuanto desaparece la causa del litigio, el conflicto de intereses”. (Sentencia no. 465 de las 10 horas 45 minutos del 7 de mayo de 2009). En la especie, es claro, no se logró acreditar que la demandante estuviera en una posición donde lo que se llegara a resolver le fuera de utilidad o le afectara de algún modo. Tampoco, cuál es la necesidad de tutela que requería al solicitar la intervención del órgano jurisdiccional, ni cuáles los daños y perjuicios que le provocaría la falta de pronunciamiento o la decisión misma, objeto de proceso. En consecuencia, según lo resolvió el Tribunal a la actora no le asiste interés actual en el presente proceso.
POR TANTO
Se rechaza la prueba propuesta. Se declara sin lugar el recurso de casación formulado, con sus costas a cargo de la recurrente.
