In the summary demolition proceeding (interdicto de derribo) filed by LA QUINTA DE DON VICTOR ROJAS E HIJOS SOCIEDAD ANÓNIMA, the representative of the Procuraduría General de la República raised an objection for lack of subject-matter jurisdiction (excepción de falta de competencia en razón de la materia) before the Juzgado Agrario de Cartago, which referred the matter to the Tribunal Agrario del Segundo Circuito Judicial de San José, an authority that rejected it. The representative of the State filed an objection (recurso de inconformidad), and for that reason this Chamber reviews the matter through consultation (consulta).

WHEREAS

I.The plaintiff entity’s special judicial attorney-in-fact (apoderada especial judicial) filed a summary demolition proceeding, stating that her principal owns the property recorded under real folio registration no. 188325-000, consisting of land designated as green areas and for construction, located in district two, San Diego, canton three, La Unión, in the province of Cartago; bounded on the north by: 3-101-454030 S.A., 3-101-492203-S.A., incorporated properties; on the south by: Quebrada C hagüite and a public road; on the east by: Quebrada Chagüite, Karen and Wainer, both Masis Araya, and Miguel Masis Barquero; and on the west by: Porfirio Madrigal Monge, Gregorio Pereira Acuña, María Isabel Calderón Cordero, a public street, rentas Inmobiliarias V:L. S.A., and 3-101-454030 S.A.; measuring: 25181.000 square meters according to registered survey plan C-1542028-2011. She states that approximately 12 years ago the company COFARMA planted a number of forest trees known as exotic species, which are now very large in size, height, and diameter and have the potential to fall, which she considers to pose a potential risk to infrastructure, her company’s employees, and the residents of adjoining properties.

She adds that three trees have already fallen naturally and several trees are similarly at risk, and therefore requests: “1) Authorization to fell the unstable trees belonging to forest species known as exotic species within the protection area (zona de protección) of Quebrada Sin Nombre. 2) Reforest the area with suitable trees, which would be planted immediately in accordance with the recommendation of Forestry Engineer Luis Diego Camacho Cornejo.”

II.The Juzgado Agrario de Cartago commenced the proceedings and ordered service of notice upon the Procuraduría General de la República, which, upon appearing, stated: “…that this proceeding seeks to lift a statutory prohibition contained in rules of Public Law against cutting trees located within a protection area, the harvesting of which is, in principle, a criminal offense (Ley Forestal, art. 33, 34 and 58 subsection b) (…). Jurisdiction, as is known, is a procedural prerequisite for the validity of proceedings and cannot be extended in administrative-litigation and civil public-finance matters. 2) The subject matter of this proceeding is the cutting of thirty-two trees, an environmental asset whose protection is a duty of the State pursuant to a constitutional mandate (…). The number is excessive and distorts the nature of this type of proceeding. […]. 3) According to the complaint, its first allegation, and the submitted registry certification, the property is not agricultural in nature, nor is the relief sought related to the pursuit of an activity of that nature, nor is the plaintiff an agricultural entrepreneur…” (folios 45-46).

By a ruling issued at 8 hours 43 minutes on 7 de diciembre de 2012, the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica referred the jurisdictional issue to the Tribunal Agrario del Segundo Circuito Judicial de San José. By ruling no. 050-C-13, issued at 8 hours 51 minutes on 25 de enero de 2012, that authority rejected the objection raised, stating: “…It follows from the foregoing that, because this is a proceeding in which a private person makes a claim concerning a natural resource, it falls within the subject-matter jurisdiction of the agrarian courts….” Disagreeing with the ruling, the representative of the State filed an objection, and the matter was referred to this Chamber for consultation.

III.The case under review concerns the cutting of 32 trees of the following species: Casuarina, Poro, and Ciprés, planted along the bank of a stream known as “Sin nombre,” located in San Diego, La Unión, Cartago; an area that, pursuant to Ley Forestal no. 7575, article 33 subsection a), constitutes a protection area and consequently forms part of the public domain (dominio público) over which the State exercises protection. However, Article 108 of the Ley de Biodiversidad provides: “In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative-litigation courts. As an exception to the foregoing rule, offenses against biodiversity shall be adjudicated by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or the public domain shall fall within the jurisdiction of the agrarian courts.” Therefore, because no administrative act is involved and this is an application by an interested private party, this Chamber determines that the application to cut these trees in the indicated area must be heard by the Agrarian Jurisdiction (Jurisdicción Agraria).

IV.Consequently, the proper course is to declare that jurisdiction over this proceeding lies with the Juzgado Agrario de Cartago.

THEREFORE

It is hereby declared that jurisdiction over this proceeding lies with the Juzgado Agrario de Cartago.

En proceso de interdicto de derribo establecido por LA QUINTA DE DON VICTOR ROJAS E HIJOS SOCIEDAD ANÓNIMA, el representante de la Procuraduría General de la República, planteó excepción de falta de competencia en razón de la materia ante el Juzgado Agrario de Cartago; quién refirió el asunto al Tribunal Agrario del Segundo Circuito Judicial de San José, autoridad que la rechazó. El representante del Estado, planteó recurso de inconformidad, motivo por el que conoce en consulta esta Sala.

CONSIDERANDO

I.La apoderada especial judicial de la entidad actora presentó interdicto de derribo, señalando que su representada es propietaria de la finca matrícula a folio real no. 188325-000, que es terreno de áreas verdes y para construir, situada en el distrito dos, San Diego, cantón tres, La Unión, de la provincia de Cartago; linda norte: 3-101-454030 S.A., 3-101-492203-S.A., propiedades incorporadas, sur: Quebrada C hagüite y camino público, este: Quebrada Chagüite, Karen y Wainer ambos Masis Araya, Miguel Masis Barquero; oeste: Porfirio Madrigal Monge, Gregorio Pereira Acuña, María Isabel Calderón Cordero, calle pública, rentas Inmobiliarias V:L. S.A., 3-101-454030 S.A., mide: 25181.000 metros cuadrados según plano catastrado C-1542028-2011. Señala que hace aproximadamente 12 años la empresa COFARMA, sembró una serie de árboles forestales denominados exóticos, que hoy día son de gran tamaño, altura diámetro, y con potencial de caída, lo que considera un riesgo potencial sobre la infraestructura, sobre los colaboradores de su empresa y los vecinos de las propiedades colindantes.

Agrega que ya se cayeron en forma natural tres árboles y en igual de condición de riesgo se encuentran varios árboles, por lo que solicita: “1) La autorización para talar los árboles que están inestables de especies forestales denominadas exóticas dentro de la zona de protección de Quebrada Sin Nombre. 2) Reforestar con árboles adecuados para zona que se sembrarían inmediatamente según recomendación del Ingeniero Forestal Luis Diego Camacho Cornejo”.

II.El Juzgado Agrario de Cartago, inició el trámite, ordenando notificar a la Procuraduría General de la República, la que al apersonarse señaló: “… que en este proceso se pretende levantar una prohibición legal contenida en normas de Derecho Público, de corta de árboles ubicados en un área de protección, cuyo aprovechamiento es, en principio constitutivo de delito (Ley Forestal, art. 33, 34 y 58 inciso b) (…). La competencia, se sabe, es un presupuesto procesal de validez de los trámites e improrrogable en materia contencioso administrativa y civil de hacienda. 2) El objeto de este proceso es la corta de treinta y dos árboles, bien medioambiental, cuya tutela es deber del Estado por mandato constitucional (…). El número es excesivo y desnaturaliza este tipo de procesos. […]. 3) Según el escrito de demanda, hecho primero y certificación registral aportada, la naturaleza del inmueble no es agraria, tampoco la pretensión se relaciona con el ejercicio de una actividad de esa naturaleza, ni la actora es empresaria agraria…” (folios 45-46).

El Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, mediante resolución de las 8 horas 43 minutos del 7 de diciembre de 2012 elevó ante el Tribunal Agrario del Segundo Circuito Judicial de San José, el conocimiento de la competencia. Esa autoridad mediante resolución no. 050-C-13 de las 8 horas 51 minutos del 25 de enero de 2012, rechazó la excepción interpuesta, señalando: “…De lo expuesto se concluye, al estarse en presencia de un proceso en el cual una persona particular plantea un reclamo en relación con un recurso natural, el mismo es parte de la competencia material de los tribunales agrarios…”. El representante del Estado en desacuerdo con lo resuelto, planteó su inconformidad, elevándo se en consulta ante esta Sala.

III.En el caso de estudio, está de por medio la corta de 32 árboles de las especies: Casuarina, Poro y Ciprés, sembradas en la margen de una quebrada “Sin nombre”, ubicada en San Diego, la Unión, Cartago; zona que según la Ley Forestal no. 7575, artículo 33 inciso a), corresponde a un área de protección y en consecuencia forma parte del dominio público sobre el cual ejerce tutela el Estado. Sin embargo, la Ley de Biodiversidad en su numeral 108 establece: “En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa. Como excepción a la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria.”; en virtud de lo cual y al no estar de por medio ningún acto administrativo y corresponder a una gestión de un particular interesado, esta Cámara determina que la solicitud de corta de estos árboles en la zona indicada, deberá conocerse ante la Jurisdicción Agraria.

IV.Consecuentemente, lo procedente es declarar que el conocimiento del presente proceso le corresponde Juzgado Agrario de Cartago.

Se declara que el conocimiento del presente proceso le corresponde al Juzgado Agrario de Cartago.
