Enforcement of Judgment (Ejecución de Sentencia) brought before the Administrative Litigation Court by BERNAL GAMBOA MORA, occupation not stated, against the STATE, represented by State Attorney Paula Azofeifa Chavarría. The natural persons are of legal age, single, residents of San José, and, with the exception noted, attorneys.
BACKGROUND

CONSIDERING
I.In ruling on the amparo proceeding filed by Mr. Bernal Gamboa Mora through decision number 2010-221, issued at 10:55 a.m. on January 8, 2010, the Constitutional Chamber ordered the State to pay the costs, damages, and losses caused by the events underlying that ruling, to be assessed through enforcement-of-judgment proceedings before the Administrative Litigation jurisdiction (jurisdicción Contencioso Administrativo). That decision determined that the Ministerio de Salud had failed to definitively eliminate the environmental problem caused by Tostadora El Dorado S.A., thereby violating the judgment creditor’s right to enjoy a healthy and ecologically balanced environment. This was because Mr. Bernal alleged that, during his visits to the Tribunal Contencioso Administrativo, he experienced strong coffee odors that affected not only him but also his guide dog, given his visual disability. On September 30, 2010, the amparo petitioner (amparado) instituted enforcement-of-judgment proceedings against the State to enforce the unliquidated award (condenatoria en abstracto) issued by the Constitutional Chamber, principally requesting payment of ¢1.800.000,00 for moral damages (daño moral), plus ¢300.000,00 for the costs associated with filing the amparo proceeding, as well as the costs of the enforcement proceedings.
The State’s representative opposed the claim. The Court partially granted the enforcement of judgment. It ordered the State to pay ¢1.000.000,00 for subjective moral damages and ¢75.000,00 for attorney’s fees. It also ordered payment of the corresponding statutory interest on the amounts awarded, from the date the judgment became final until payment in full. All costs of the enforcement proceedings were imposed on the judgment debtor (parte ejecutada). Dissatisfied with the ruling, the State filed an appeal in cassation based on violations of procedural and substantive rules.
Cassation for procedural defects (vicios procesales)
II.In her first ground of appeal, she alleges infringement of Articles 162 and 317 of the Código Procesal Civil (hereinafter CPC). She argues that these enforcement proceedings are based on a decision issued by the Constitutional Chamber and that the causal link (nexo causal) between the challenged conduct and the damages claimed by the parties must be determined. She states that, in determining the extent of the damage and the causal link, it is important to assess the amounts claimed in relation to the events underlying the judgment entered against the State, so that any compensation awarded is proportional and reasonable in relation to the damage the party alleges he suffered. Regarding this challenge, she contends that the first Background section of the decision being enforced describes precisely the events that the judgment creditor considered a violation of his right to a healthy and ecologically balanced environment.
The Court, however, overlooked that the coffee odor perceived by Mr. Bernal occurred “around midday, just before or after lunchtime,” an aspect that, in her view, was essential to determining the existence and extent of the damage. She asserts that res judicata (cosa juzgada) was violated because, contrary to the constitutional decision, the challenged ruling fails to address the periods during which Mr. Gamboa Mora was exposed to those emissions, thereby distorting the criterion used to determine the extent of the damages awarded. In her second ground of appeal, she alleges that the challenged ruling lacks reasoning (falta de motivación) because it fails to state the factual and legal grounds supporting the conclusion that moral damages existed and that the judgment creditor should receive compensation of ¢1.000.000,00. Although moral damages may be established without evidence proving their existence, she argues, they must be determined according to the standards of reasonableness, proportionality, sound rational judgment (sana crítica racional), and the general principles of law, taking into account the circumstances of the case and assessing whether the damage is real and actual and whether the legally protected interest is material.
In her opinion, there was no assessment of the particular case or of the judgment creditor’s situation because the ruling does not specify why compensation for moral damages is appropriate or why he is entitled to that amount and at that level. She contends that the ruling rests on false premises, causing serious harm to the State because it is ordered to pay a large sum of money without adequate legal and factual grounds, thereby violating Articles 153 and 155 of the CPC.
III.Regarding the first ground of appeal, she alleges a violation of res judicata because, in her view, the event identified by the judgment creditor as infringing his fundamental right was considered only partially, thereby distorting the criterion used to determine the extent of the damage. She further argued that, if the existence of damage and its causal link were established, the amounts claimed should be assessed in relation to the events that gave rise to the judgment against the State, so that the amount awarded would be reasonable and proportional. Because this latter argument is substantive rather than procedural, it must be duly analyzed in Considering V of this decision. When hearing appeals in cassation filed in these assessment proceedings (procesos de liquidación) in which a violation of res judicata is alleged, this Chamber must determine whether the relief claimed by the judgment creditor and awarded by the lower courts falls within the scope of the constitutional ruling or is contrary to the final adjudication (ejecutoriado).
Thus, for the discomfort allegedly caused, the judgment creditor seeks compensation for moral damages in the amount of ¢1.800.000,00, plus ¢300.000,00 corresponding to the filing of the amparo proceeding. In ruling, the Court found that the violation of Mr. Bernal’s fundamental right to a healthy and ecologically balanced environment affected him emotionally because, as a blind person dependent on the assistance of a guide dog, he could have experienced feelings of concern that he should not have had to endure; it therefore awarded him ¢1.000.000,00. In ruling on the existence of the alleged moral damages, the enforcement judge (jueza ejecutora) stated verbatim: “…the Constitutional Chamber found that the Administration violated, to the detriment of Mr. Gamboa Mora, his right to a healthy and ecologically balanced environment established in Article 50 of the Constitución Política, as well as the right to health established in Article 21 of the Constitution (…) the causal link arises from the discomfort and concern felt by the plaintiff as a result of the conduct for which the Constitutional Court held the State accountable, to the detriment of the plaintiff’s fundamental rights…”.
As is apparent from the challenged decision, there can be no doubt that the Judge recognized the existence of the moral damages alleged by Mr. Bernal on the basis of the constitutional judgment. This adjudicatory body therefore finds no inconsistency between the two decisions, and the challenge must consequently be rejected.
IV.In her second ground of appeal, the appellant in cassation (casacionista) alleges that the judgment lacks reasoning because, in her view, the challenged decision fails to identify the factual and legal grounds supporting its conclusion as to the nature of the moral damages. Regarding the alleged procedural defect, it should be emphasized that lack of reasoning in a judgment, as a ground of appeal reviewable through the extraordinary appeal in cassation (recurso extraordinario de casación) under Article 137(d) of the CPCA, must not be understood as a mechanism for challenging the judgment’s legal grounds. It arises when the judgment contains no reasoning or when its reasoning is so confusing or contradictory that the rationale leading to the decision stated in the judgment’s operative portion (parte dispositiva) cannot be clearly understood. That is not the case here because the challenged decision shows that the Judge, albeit not exhaustively, distinguished between subjective and objective moral damages (daño moral objetivo).
Regarding non-economic injury (lesión extrapatrimonial), she emphasized that it could be inferred from the circumstantial evidence (indicios) submitted by the judgment creditor. She noted that Mr. Bernal claimed to have been disturbed by the strong coffee odor affecting the building housing the offices of the Tribunal Contencioso. She stressed that Mr. Gamboa Mora is blind and relies on the assistance of a guide dog to move about easily. She underscored that, according to the judgment creditor, the odor disturbed the animal, which affected the quality of its work as a guide dog. She stated that the causal link arose from the discomfort and concern that Mr. Bernal should not have had to endure, which were caused by the conduct for which the State was held accountable. Based on all those reasons, she concluded by setting the financial compensation that, in her view, was due to the judgment creditor. All of the foregoing demonstrates that the lack of reasoning alleged by the appellant in cassation is likewise absent in this case; that ground of appeal must therefore be rejected.
Cassation for violation of substantive rules (normas sustantivas)
V.In its third ground, it argues that certain facts were deemed proven in contradiction with the evidence in the record. It notes that, according to the judgment being enforced, Mr. Gamboa Mora reported a strong smell of coffee just before or after lunchtime. It argues that the enforcing party’s presence at the Courthouses is not permanent but occasional, so much so that the proceedings did not establish how many cases he handles in his capacity as a litigation attorney. Nor, it states, was it determined on how many occasions that professional appeared just before or after lunchtime, and there is no evidence that the odor persisted throughout the entire period during which the building was open; it therefore concludes that the alleged harm is incapable of assessment. Nevertheless, it alleges, the Court based its measurement of the harm on the assumption that the odor remained present at all times and that the enforcing party suffered for a long period, of which there is not even the slightest indication.
It objects that, in his application for the writ of amparo (recurso de amparo) or in his claim for assessment of damages (liquidación), he did not allege the existence of harm, but merely emphasized an odor that he found bothersome. Accordingly, it considers that no amount should be awarded for non-pecuniary damages (daño moral). It insists that no unjust disturbance of his emotional state was established, nor any injury affecting his honor, dignity, privacy, or life. It contends that the rules governing the evaluation and burden of proof (carga de la prueba) were thereby violated because the assessment of the harm was based on mere probabilities and assumptions, without weighing the alleged harm against the facts and rights deemed violated by the Sala Constitucional; thus infringing Articles 155, 317, 330, and 417 of the CPC and Article 196 of the Ley General de la Administración Pública.
In its fourth objection, it alleges a violation of the principles of reasonableness and proportionality because the circumstances of the enforcing party were not considered, disregarding the fact that he is not a judicial officer but a litigation attorney who allegedly has some cases and only occasionally appeared at the Courthouse offices. It emphasizes that Mr. Gamboa Mora’s circumstances must be considered, yet no reference was made to any problem involving his guide dog beyond mere discomfort, which cannot suffice to award him any amount for non-pecuniary damages. It emphasizes that, considering the short time during which the enforcing party perceived the odor, the amount awarded must be negligible. It contends that the Court also cannot base its assessment on affected third parties, as the enforcing party seeks, because the harm must be individualized and subjective. It states that the case law cited by Mr.
Gamboa Mora concerning persons deprived of liberty reveals that even he does not consider his claim to have any basis. It concludes that, in an abuse of rights (abuso del derecho), he seeks compensation for harm that was not established and that his claim must therefore be dismissed in its entirety or, alternatively, that an amount proportionate to the factual circumstances of the case should be awarded.
VI.It may be gathered from the objections identified as the third and fourth that both concern the same issue, since the appellant in cassation (casacionista) seeks to demonstrate that the award of non-pecuniary damages to Mr. Bernal was improper and that the decision was unreasonable and disproportionate. The appellant emphatically maintains that the non-pecuniary injury (lesión extrapatrimonial) recognized in favor of the enforcing party was assessed without any indication of how many cases he handles or how often he visits those offices, and that the harm was established merely on the assumption that the odor remained present at all times and that Mr. Bernal suffered from it for a long period. This Chamber has held that subjective non-pecuniary damages (daño moral subjetivo) do not require direct evidence because, based on the circumstances of the case and through the application of human presumptions (presunciones humanas), their existence may be inferred; that is, they are assessed in re ipsa.
It has also held that, based on experience, common sense, equity, and the general principles of law, the Judge determines the amount of non-pecuniary damages with some degree of discretion. It has further stated that, because such damages have no specific value, the Courts are empowered to award and quantify them, seeking a fair determination, since their effects are confined to the emotional state of the affected person. This means that “…starting from the harmful event and the circumstances surrounding the injured party, and applying human presumptions, the adjudicator may infer, even without direct corroborating evidence, distress such as worry, sadness, anguish, pain, and stress, because it may be presumed that, when faced with a particular harmful event and the circumstances in which it occurred, the affected person experienced them” (Judgment no. 97 of 16 hours 3 minutes on 29 de enero de 2009).
“…A human presumption is a logical judgment by the judge whereby a fact is deemed probable on the basis of general maxims of experience, which indicate the normal manner in which things and events occur. …” (Decision no. 878-F-2007 of 8 hours 15 minutes on 14 de diciembre de 2007). To the same effect, see no. 001-F-S1-2009 of 9 hours 5 minutes on 6 de enero de 2009 and 000650-F-S1-2011 of 8 hours 45 minutes on 9 de junio de 2011. The judge’s assessment within that mandatory framework ensures that the quantification is consistent with the law and does not lead to disproportionate compensation that unjustifiably benefits or harms either party. In other words, it must maintain a fair balance derived from the specific factual circumstances. As this Chamber has repeatedly held, “the task, therefore, is not to quantify suffering, since it is incapable of assessment, but to establish monetary compensation for the injury, the only mechanism available to remedy, at least in part, the wrong suffered.” (Decision no. 537 of 10 hours 40 minutes on 3 de setiembre de 2003.
In similar terms, nos. 845-F-2007 of 10 hours 5 minutes on 23 de noviembre de 2007 and 001-F-S1-2009 of 9 hours 5 minutes on 6 de enero de 2009, both issued by this Chamber). In this case, the enforcing party sought an award of ¢1.800.000,00 for non-pecuniary damages based on the fact that he was affected by the coffee odors perceived in the building housing the offices of the Tribunal Contencioso; however, he was awarded ¢1.000.000,00 on that ground. When filing the enforcement action (demanda de ejecución), he reiterated what he had stated before the Sala Constitucional: that “just before or after lunchtime,” he smelled coffee, which he found quite bothersome and concerning because his guide dog appeared uncomfortable, thereby affecting its performance. In this Chamber’s view, the award of non-pecuniary damages is justified, but the amount awarded is not, for the reasons set forth below.

Against that background, it is logical to infer that any person would find it bothersome to have to perceive strong and unpleasant odors, but this does not necessarily mean that a situation of that nature can cause subjective non-pecuniary damages. Nevertheless, the case under review has particular characteristics that cannot be overlooked, such as the disability the enforcing party states that he has and his dependence on his guide dog for mobility. In the view of this adjudicative body, there can be no doubt that Mr. Gamboa Mora may have felt concerned and uneasy about his dog’s possible reaction and performance when exposed to the emissions perceived in those judicial offices, particularly considering that this type of animal has a highly developed sense of smell.
Thus, although the award of subjective non-pecuniary damages to Mr. Bernal is justified, the amount awarded is deemed excessive, disproportionate, and unreasonable, since there is no basis for awarding ¢1.000.000,00 as compensation for the concern that Mr. Bernal alleged he experienced. The enforcing party merely stated that the discomfort he claims disturbed him was limited to the “concern” caused by perceiving that his guide dog was uncomfortable with the coffee emissions. It should be noted that Mr. Bernal offered so few indications, as emphasized by the State’s representative, that he did not clearly state how long he remained at the offices of the aforementioned Tribunal, how many times per week he visited that building, or how many cases were under his responsibility. Consequently, this adjudicative body must confine itself to the enforcing party’s statements in assessing the subjective non-pecuniary damages of which he claims to have been a victim; accordingly, in this Chamber’s judgment, that injury must be compensated in the amount of ¢150.000,00, an amount by which Mr.
Gamboa Mora may be deemed to have received equitable, reasonable, and proportionate redress and which will undoubtedly compensate him for the harm inflicted; therefore, this ground of appeal must be upheld.
VII.In view of the foregoing reasons, the appeal is partially granted, modifying the appealed judgment solely with respect to the amount awarded for non-pecuniary damages, which is set at ¢150.000,00 rather than the amount awarded.

The appeal filed is declared partially well-founded. Only the amount awarded for subjective non-pecuniary damages is modified and is hereby set at ¢150.000,00; the remainder of the decision remains unchanged.

Ejecución de Sentencia establecida en el Juzgado Contencioso Administrativo por BERNAL GAMBOA MORA, no indica ocupación; contra el ESTADO, representado por la procuradora, Paula Azofeifa Chavarría. Las personas físicas son mayores de edad, solteros, vecinos de San José, y con la salvedad hecha, abogada.
RESULTANDO

CONSIDERANDO
I.La Sala Constitucional, al resolver el recurso de amparo formulado por el señor Bernal Gamboa Mora, mediante el voto número 2010-221, de las 10 horas 55 minutos del 8 de enero de 2010, condenó al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, a liquidar en vía de ejecución de sentencia ante la jurisdicción Contencioso Administrativo. Dicho fallo determinó, que el Ministerio de Salud no erradicó de forma definitiva, el problema ambiental generado por la empresa Tostadora El Dorado S.A., vulnerando así el derecho del ejecutante a disfrutar de un ambiente sano y ecológicamente equilibrado. Lo anterior, por cuanto don Bernal alegó, que durante sus visitas al Tribunal Contencioso Administrativo, su perro guía, dada su condición de persona con discapacidad visual. El 30 de setiembre de 2010, el amparado promovió proceso de ejecución de sentencia en contra del Estado, a fin de hacer efectiva la condenatoria en abstracto emitida por la Sala Constitucional, solicitando en lo medular, la cancelación de ¢1.800.000,00 por concepto de daño moral, más ¢300.000,00 atinentes a las costas por la presentación del recurso de amparo, así como las del proceso de ejecución.
El representante estatal contestó negativamente. El Juzgado declaró parcialmente con lugar la ejecución de sentencia. Condenó al Estado al pago de ¢1.000.000,00 por daño moral subjetivo y a ¢75.000,00 por concepto de costas personales. Asimismo, sobre las sumas concedidas, ordenó cancelar los intereses legales correspondientes, a partir de la firmeza de la sentencia y hasta su efectivo pago. Ambas costas de la ejecución quedaron a cargo de la parte ejecutada. Inconforme con lo resuelto, la representación estatal formula recurso de casación, basado en la violación de normas procesales y sustantivas.
Casación por vicios procesales
II.En su primer agravio acusa transgredidos los cardinales 162 y 317 del Código Procesal Civil (en lo sucesivo CPC). Aduce, el presente proceso de ejecución, tiene su base en una resolución emitida por la Sala Constitucional, respecto de la cual, debe determinarse el nexo causal de la conducta reprochada y de los daños pretendidos por las partes. Resulta importante, dice, para determinar la magnitud del daño y el nexo de causalidad, que se ponderen los rubros liquidados con los hechos que dieron base a la condenatoria que recayó sobre el Estado; de manera que si corresponde otorgar una indemnización, esta resulte proporcional y razonable al daño que alega la parte haber sufrido. En punto al reproche, reclama, el resultando primero del voto ejecutado, describe con exactitud los hechos por los cuales el ejecutante consideró violentado su derecho a un ambiente sano y ecológicamente equilibrado, sin embargo el Juzgado pasó por alto que el olor a café percibido por don Bernal se dio “cerca del medio día, justo antes o después de la hora de almuerzo”, aspecto que, en su criterio, resultaba vital para determinar la existencia y magnitud del daño.
Apunta, se violenta la cosa juzgada, por cuanto contrario a lo resuelto por el fallo constitucional, la resolución recurrida, omite referirse a los períodos de tiempo en que el señor Gamboa Mora estuvo sometido a esas emanaciones; tergiversándose con ello, el parámetro para determinar la magnitud del daño otorgado. En su segundo agravio, recrimina una falta de motivación en la resolución recurrida, por cuanto omite indicar los fundamentos fácticos y jurídicos que hacen concluir que existió un daño moral y que el ejecutante debe ser indemnizado en la suma de ¢1.000.000,00. Si bien el daño moral puede establecerse sin que exista prueba de su existencia, increpa, éste debe determinarse tomando como parámetro la razonabilidad, la proporcionabilidad, la sana crítica racional y los principios generales del derecho y atendiendo a las circunstancias del caso, valorando si el daño es real y efectivo y si el interés jurídicamente tutelado es relevante.
Según su opinión, no se aprecia una valoración del caso concreto, ni de la situación del ejecutante, ya que no se concreta el por qué, resulta procedente la indemnización por daño moral y la razón por la cual le corresponde tal monto y en esa magnitud. Censura, se parte de premisas falsas para arribar a lo resuelto, aspecto que causa un grave perjuicio al Estado ya que se le condena a la cancelación de una alta suma de dinero, sin que exista una debida fundamentación jurídica y fáctica; quebrantándose así los numerales 153 y 155 del CPC.
III.Respecto del primer agravio, reprocha violación a la cosa juzgada, ya que en su criterio se tomó en forma parcial el hecho que el ejecutante señaló como lesivo de su derecho fundamental; por cuanto se tergiversa el parámetro para determinar la magnitud del daño. Arguyó además, que de determinarse la existencia de un daño y su nexo de causalidad, deben ponderarse los rubros liquidados con los hechos que generaron la condenatoria dispuesta contra el Estado; ello, a fin de que la suma que se otorgue resulte razonable y proporcional. Atendiendo a que la naturaleza de este último alegato es de fondo y no procesal, corresponde efectuar su debido análisis en el considerando V de esta resolución. Ahora bien, atañe a esta Sala, al conocer de los recursos de casación formulados en estos procesos de liquidación, cuando se acusa violación de la cosa juzgada, establecer si lo reclamado por el ejecutante y lo concedido por los juzgadores de instancia se encuentra comprendido en lo resuelto en sede constitucional o si resulta contrario a lo ejecutoriado.
Así, por las molestias supuestamente causadas, pretende el ejecutante se le compense por el daño moral sufrido, con la suma de ¢1.800.000,00, más el tanto de ¢300.000,00 correspondientes a la presentación del recurso de amparo. Por su parte, el Juzgado al resolver, estimó que al lesionarse el derecho fundamental de don Bernal a un ambiente sano y ecológicamente equilibrado, se le afectó en lo emocional, ya que al ser una persona no vidente y depender de la asistencia de un perro guía, pudieron habérsele generado sentimientos de preocupación que no tenía que soportar; de ahí que le fuera concedido el tanto de ¢1.000.000,00. La jueza ejecutora al resolver respecto a la existencia del daño moral que se acusa, literalmente perjuicio del señor Gamboa Mora, su derecho a un ambiente sano y ecológicamente equilibrado establecido en el artículo 50 de la Constitución Política, así como el derecho a la salud establecido en el artículo 21 de la Constitución (…) el nexo de causalidad se deriva de la molestia y preocupación sentida por el señor actor, como producto de las actuaciones que le fueron reprochadas al Estado por el Tribunal Constitucional en detrimento de los derechos fundamentales del actor…” .
Tal y como se desprende de lo resuelto en el fallo impugnado, no queda lugar a dudas, que la Juzgadora reconoció la existencia del daño moral alegado por don Bernal, con base en lo dispuesto en la sentencia constitucional; de ahí que no observe este órgano decisor disonancia alguna entre ambas resoluciones, lo que lleva al rechazo del embate.
IV.En el segundo de sus agravios, el casacionista acusa falta de motivación de la sentencia, ya que a su juicio, la resolución recurrida omite señalar los fundamentos fácticos y jurídicos que conduzcan a concluir en qué consistió el daño moral. En lo relativo al vicio procesal endilgado, es preciso destacar que la falta de motivación de la sentencia, como agravio susceptible de ser revisado mediante el recurso extraordinario de casación, en los términos del canon 137 inciso d) del CPCA, no debe entenderse como un mecanismo para cuestionar los fundamentos jurídicos del fallo. Surge cuando no existe motivación de aquel, o su desarrollo resulta confuso o contradictorio, de forma que impida tener claridad, en cuanto a los razonamientos que derivaron en la decisión adoptada en la parte dispositiva de la sentencia. En la especie ese no es el caso, pues de lo manera prolija, hace una diferencia entre el daño moral subjetivo y objetivo.
En lo relativo a la lesión extrapatrimonial, enfatizó, que esta se infiere de los indicios ofrecidos por la parte ejecutante. Hizo referencia a que don Bernal, acusó haberse sentido molesto por el fuerte olor a café que afectaba a las instalaciones del edificio que alberga las oficinas del Tribunal Contencioso. Resaltó que el señor Gamboa Mora, es una persona no vidente y que depende de la ayuda de un perro guía para desplazarse con facilidad. Subrayó, que según lo manifestado por el ejecutante, ese olor incomodó al animal, lo que repercutió en su calidad de trabajo como perro guía. Expresó que el nexo causal se deriva de la molestia y la preocupación que don Bernal no tenía por qué soportar, producidas por las actuaciones que le fueron reprochadas al Estado. Concluyó fijando con base en todas esas razones, la compensación económica que a su juicio le correspondía al ejecutante. Todo lo anterior denota, que tampoco se presenta en este caso, la falta de motivación que aduce existe el casacionista; razón por la cual se impone el rechazo de ese agravio.
Casación por violación a normas sustantivas
V.En su tercer motivo recrimina, existieron hechos que se tuvieron por demostrados en contradicción con la prueba que consta en el proceso. Señala, nótese que según lo indicado en el voto que se ejecuta, el señor Gamboa Mora refiere a un fuerte olor de café justo antes o después de la hora del almuerzo. Arguye, la presencia del ejecutante en los Tribunales, no es una condición permanente sino ocasional, tanto que no se demostró dentro del proceso, cuántos expedientes tiene a su cargo, dada su condición de abogado litigante. Tampoco, dice, se verificó en cuantas ocasiones dicho profesional, se apersonó justo antes o después de la hora del almuerzo, ni consta que el olor persistiera por todo el lapso en el que se encontraba abierto el edificio; con lo que concluye, que el supuesto daño resulta inapreciable. No obstante alega, el Juzgado basó su medición del daño, suponiendo que el olor se mantenía en todo momento y que el ejecutante sufrió por un largo período de tiempo, de lo cual no existe ni siquiera un indicio.
Reprocha, no manifestó en su escrito de interposición del recurso de amparo o el de liquidación, la existencia de un daño; limitándose a resaltar un olor que le resultó molesto. Por lo anterior, estima, no corresponde suma alguna por daño moral. Insiste, no se acreditó una perturbación injusta en sus condiciones anímicas, ni agravio alguno que lesionaran su honor, dignidad, intimidad o su vida. Reclama, de esa forma se quebrantan las reglas de la valoración y la carga de la prueba, dado que la apreciación del daño se basó en meras probabilidades y suposiciones, omitiéndose la ponderación del supuesto daño, en relación con los hechos y derechos considerados violentados por la Sala Constitucional; infringiéndose así los preceptos 155, 317, 330 y 417 del CPC y 196 de la Ley General de la Administración Pública. En su cuarto reproche, acusa transgredidos los principios de razonabilidad y proporcionabilidad, por cuanto no se atendieron las condiciones del ejecutante, dejando de lado el hecho de que no se trata de un funcionario judicial, sino de un abogado litigante que supuestamente tiene algunos casos y que de manera ocasional se apersonaba a las oficinas de los Tribunales.
Resalta, debe tomarse en cuenta la condición del señor Gamboa Mora, no obstante no se hizo referencia a algún problema que se le haya presentado con su perro guía más que una molestia; aspecto que no puede ser suficiente para otorgarle suma alguna por daño moral. Resalta, tomando en cuenta el corto tiempo que el ejecutante percibió el olor, la suma a conceder debe ser ínfima. Aduce, tampoco puede el Juzgado basar su valoración en terceros afectados, como lo pretende el ejecutante, ya que el daño debe ser individualizable y subjetivo. Refiere, la jurisprudencia invocada por el señor Gamboa Mora, relacionada con privados de libertad, revela cómo ni él mismo, considera que su petitoria tenga sustento. Concluye, en abuso del derecho, pretende se le indemnice por un daño que no quedó acreditado y que por ende debe ser rechazado en todos sus extremos o bien conceder una suma proporcional con las circunstancias fácticas del caso.
VI.De lo planteado en los reproches identificados como tercero y cuarto se extrae que ambos giran en torno a un mismo tema, ya que el casacionista pretende hacer ver la improcedencia del reconocimiento del daño moral a don Bernal y de lo irrazonable y desproporcional que resulta esa decisión. El recurrente es enfático en que la lesión extrapatrimonial reconocida al ejecutante, fue fijada sin que existieran indicios de cuántos procesos tiene este a su cargo y cuántas veces acude a esas oficinas; concretándose ese daño con la mera suposición de que el olor se mantuvo en todo momento y que don Bernal lo sufrió durante un largo período de tiempo. Esta Sala ha señalado que el daño moral en su vertiente subjetiva no requiere de prueba directa, en tanto de las condiciones del caso, aplicando presunciones humanas, puede derivarse su existencia, esto es, que se valora in re ipsa. Se ha señalado también, que el Juez con base en su experiencia, el sentido común, la equidad y los principios generales del derecho, fija la suma por daño moral con algún margen de discrecionalidad.
Asimismo ha referido, que al no tener un valor concreto, los Tribunales están facultados para decretarlo y cuantificarlo, buscando una fijación justa, pues sus efectos se agotan en las condiciones anímicas del afectado. Ello supone que “…partiendo del evento lesivo, y de las condiciones que rodeaban al damnificado, aplicando presunciones humanas, el juzgador puede inferir, aún sin prueba directa que lo corrobore, aflicciones tales como preocupación, tristeza, aflicción, dolor, estrés, porque resulta presumible que ante un determinado evento lesivo y las particularidades en las que se produce, el afectado las haya experimentado” (Sentencia no. 97 de 16 horas 3 minutos del 29 de enero de 2009). “…La presunción humana es un juicio lógico del juez, en virtud del cual se considera probable un hecho, con fundamento en las máximas generales de la experiencia, que indican cuál es el modo normal como suceden las cosas y los hechos. …” (Fallo no. 878-F-2007 de las 8 horas 15 minutos del 14 de diciembre de 2007).
En el mismo sentido, consúltense la no. 001-F-S1-2009 de las 9 horas 5 minutos del 6 de enero de 2009 y 000650-F-S1-2011 de las 8 horas 45 minutos del 9 de junio de 2011. La valoración del juez dentro de ese marco inexorable, permite que su cuantificación sea acorde a derecho y no lleve a indemnizaciones desproporcionadas que beneficien o perjudiquen injustificadamente a una de las partes. Es decir, deben guardar un justo equilibrio derivado del cuadro fáctico específico. Como lo ha reiterado esta Sala, “no se trata, entonces, de cuantificar el sufrimiento, pues es inapreciable, sino de fijar una compensación monetaria a su lesión, único mecanismo al cual se puede acudir, para así reparar, al menos en parte, su ofensa”. (Resolución no. 537 de las 10 horas 40 minutos del 3 de setiembre de 2003. En similares términos, las números 845-F-2007 de las 10 horas 5 minutos del 23 de noviembre de 2007 y 001-F-S1-2009 de las 9 horas 5 minutos del 6 de enero de 2009, ambas de esta Sala).
En la especie, el ejecutante solicitó el reconocimiento de ¢1.800.000,00 por concepto de daño moral, basado en el hecho de que se vio afectado con los olores a café percibidos en el edificio que alberga las oficinas del Tribunal Contencioso; sin embargo por ese extremo, le fue otorgado el tanto de ¢1.000.000,00. Al formular la demanda de ejecución, reiteró lo expresado ante la Sala Constitucional, respecto a que “justo antes o después de la hora de almuerzo”, sintió un olor a café el cual le resultó bastante molesto y preocupante pues su perro guía se mostró incómodo, lo cual repercutió en su desempeño. Para esta Cámara, se justifica el reconocimiento del daño moral, más no la suma concedida por las razones que se expondrán. La única alteración al fuero interno que mencionó el ejecutante, fue la preocupación que se le generó al notar a su perro guía incomodo con las emanaciones que afectaban el edificio.
Bajo ese panorama, es lógico inferir que a cualquier persona le resulte molesto tener que percibir olores fuertes y desagradables, pero no por ello, concluir que pueda generarse de una situación de esa naturaleza, un daño moral subjetivo. Sin embargo, el caso que se somete a estudio reviste características particulares que no pueden pasarse por alto, como lo es la discapacidad que señala sufrir el ejecutante y la dependencia de su perro guía para desplazarse. En criterio de este órgano decisor, resulta indudable que el señor Gamboa Mora pudo haberse sentido preocupado e inquieto por la eventual reacción y el desenvolvimiento que podría tener su perro ante las emanaciones que se percibían en esas oficinas judiciales, máxime tomando en cuenta que este tipo de animales tienen el sentido del olfato muy desarrollado. Así, aún y cuando se justifica el reconocimiento del daño moral subjetivo otorgado a don Bernal, el monto conferido se considera excesivo, desproporcional e irrazonable, ya que no se encuentra razón alguna para conceder el tanto de un ¢1.000.000,00 como compensación a la preocupación que adujo don Bernal haber padecido.
El ejecutante se limitó a señalar que la molestia que aduce le perturbó, se redujo a la “preocupación” que le produjo el percibir a su perro guía incomodo con las emanaciones a café. Nótese que fueron tan pocos los indicios ofrecidos por don Bernal, tal y como lo subrayó la representación estatal, que no se indicó con claridad, cuanto tiempo permanecía en las oficinas del referido Tribunal, la cantidad de visitas que hacía a ese edificio en la semana o bien cuantos expedientes tenía bajo su conocimiento. Lo anterior, hace que este órgano decisor deba limitarse a las manifestaciones del ejecutante para ponderar el daño moral subjetivo, del cual aduce haber sido victima; de ahí que esa afectación, deba indemnizarse a juicio de esta Sala con la suma de ¢150.000,00, monto con el que puede tenerse al señor Gamboa Mora como equitativo, razonable y proporcionalmente resarcido, lo que sin duda le brindará una compensación al daño infligido; de ahí que este agravio deba acogerse.
VII.En mérito de las razones expuestas, se acoge parcialmente el recurso, modificando la sentencia recurrida, únicamente en cuanto al monto otorgado por concepto de daño moral; el cual se fija en la suma de ¢150.000,00 y no lo otorgado.
POR TANTO
Se declara parcialmente con lugar el recurso interpuesto. Se modifica únicamente lo atinente al importe concedido por concepto de daño moral subjetivo, el cual se fija en la suma de ¢150.000,00, quedando incólume el resto de la resolución.
