*080007211027CA* RES: 001675-F-S1-2012 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, at eight fifty-five a.m. on the thirteenth of December, two thousand twelve. Preferential ordinary proceeding (proceso de conocimiento de trámite preferente) instituted before the Tribunal Contencioso Administrativo by the CONTRALORÍA GENERAL DE LA REPÚBLICA, represented by its Comptroller General, Rocío Aguilar Montoya; against the INSTITUTO DE DESARROLLO AGRARIO, represented by its Executive President, Rolando González Ulloa, an educator residing in Alajuela, vested with powers of a general attorney-in-fact without limitation as to amount; BERTILIO BARRANTES SOLÍS, a farmer residing in Limón; and the ESTADO, represented by agrarian counsel Víctor Bulgarelli Céspedes, residing in Heredia. Also appearing as representatives of the Contraloría General de la República are Licda. Karen Susana Zamora Gallo, unmarried; and, as special litigation counsel for co-defendant Barrantes Solís, Licda. Blanca Iris Navarro Miranda, unmarried, an attorney residing in Heredia. The natural persons are of legal age and, except as otherwise stated, married, attorneys, and residents of San José.
WHEREAS
1. Based on the facts alleged and the legal provisions cited, the plaintiff instituted a preferential ordinary proceeding, seeking a judgment ordering: “1) That the resolution of the Junta Directiva del Instituto de Desarrollo Agrario contained in Article 31 of Session number 005-05 dated 7 de febrero de 2005 be annulled solely insofar as it concerns the granting of title to a property in favor of Mr. Bertilio Barrantes Solís, described in cadastral plan (plano catastrado) number L-908302-2004;
2. Judge Alexander Castillo Aguilar, in judgment n.° 637-2008 at 14 hours 30 minutes on 3 de setiembre de 2008, granted the interim measure, ordered that notice of the action be recorded against property n.° 7-14344-000, and ordered Mr. Bertilio Barrantes Solís to refrain from any conduct that could harm the natural resources existing on the aforementioned property.
3. The co-defendant Instituto answered as set forth at folios 84 to 104 and raised the preliminary defense (defensa previa) of lack of jurisdiction. It also waived conciliation proceedings at folio 102.
4. Co-defendant Barrantes Solís answered as set forth at folios 109 to 119 and raised the defenses (excepciones) of lack of standing to sue and be sued, failure to state a legal right, and limitation of actions (prescripción). In addition, at folios 120 to 123, he filed a counterclaim (reconvención) against the plaintiff, seeking a judgment declaring: “1- That this counterclaim be granted in all respects requested; 2- That it be declared that the improvements made to the property described in the first factual allegation of this counterclaim were made by Mr. Bertilio, in good faith and through his sole efforts, or, alternatively, that the judgment order the State to pay the corresponding compensation for the damages and losses caused to Don Bertilio; 3- That said payment be based on the value determined by the expert or experts appointed for that purpose.- Since the existing trees were cared for and tended by Don Bertilio; 4- That said improvements consist of: tending the property, clearing boundary paths, which has been done every two months throughout all these years, and planting the trees that are currently on the property, which must be valued as of their production date and according to the market price of the timber when it would have been ready to be placed on the market, as I had planned to do, all of which must be valued by the corresponding expert requested in this same instrument; 5- That the State be ordered to pay both the procedural costs and attorney’s fees of this counterclaim; 6- That the counterclaim defendant State be ordered to pay damages and losses, which I describe as follows: A- Economic Damage: I request the inclusion, as an item, of the economic loss suffered, consisting of the loss of the property and the investment in maintaining the property for more than 28 years; B- Non-Pecuniary Damage: Logically, this action has caused serious harm to my client, who is therefore suffering distress; it must be remembered that he is elderly, 75 years of age to be exact, and has several health problems, and this terrible action brought against him has caused him sleeplessness and emotional confusion, all of which has triggered a cascading series of adverse effects on my client’s health, since before this entire action he considered himself the lawful owner and possessor of his property, and because for so many years the State never took any steps to recover this land; C- Losses: I consider these to be the product of the improvements made, as well as the price paid for this portion of land of which he is now being dispossessed, with even Mr.
Bertilio’s eviction being sought, without regard for his age, the insecurity he now faces in finding employment at such an advanced age, and the fact that he spent the best years of his life caring for property that he believed was his, only suddenly to find himself embroiled in this action, which deprives him of all the legal certainty he had obtained from an institution created to protect farmers, as is the case with the IDA; the contrast between that purpose and the outcome he faces today is a very severe blow for a rural farmer such as Don Bertilio.- Losses that must also be established through the corresponding and necessary expert appraisal.” 5. Judge Alexander Castillo Aguilar, in judgment n.° 470-2009 at 10 hours on 12 de marzo de 2009, ruled: “Pursuant to arts (sic) 49 of the Constitution and 1, 2, 36 and 43 of the CPCA, and based on the reasoning set forth above, the subject-matter jurisdiction defense must be denied, and this jurisdiction is hereby declared competent to hear the matter.” 6.
The representative of the co-defendant Instituto expressed disagreement with the ruling in judgment n.° 470-2009; consequently, the matter was referred for consultation to the Sala Primera de la Corte Suprema Justicia, and that Chamber, by resolution n.° 000627-C-S1-2009 at 10 hours 50 minutes on 25 de junio de 2009, with Magistrate Carmenmaría Escoto Fernández dissenting, ordered: “It is declared that jurisdiction over this proceeding lies with the Tribunal Contencioso Administrativo y Civil de Hacienda.” 7. The Tribunal Contencioso Administrativo, Sección Sexta, by resolution at 8 hours 50 minutes on 29 de octubre de 2009, declared the proceeding subject to preferential processing.
8. The counterclaim defendant plaintiff answered as set forth at folios 377 to 389 and raised the defenses of formal defects precluding a decision on the merits, lack of standing to be sued, and failure to state a legal right.
9. The Tribunal Contencioso Administrativo, Sección Sexta, by order n.° 307-2010 at 11 hours 45 minutes on 2 de febrero de 2010, joined the parties to the proceedings on its own motion and ruled: “The necessary passive joinder of parties (litis consorcio pasiva) is deemed complete and, consequently, the Estado and the Instituto de Desarrollo Agrario, together with the Contraloría General de la República, are deemed co-defendants in the counterclaim filed by Bertilio Barrantes Solís. The counterclaim shall be served upon the Estado and the Instituto de Desarrollo Agrario under the terms set forth in Considerando III of this order. The procedural acts identified in recital IV of this judgment shall remain in effect.” 10. The Estado denied the claim and raised the defenses of lack of standing to be sued and failure to state a legal right.
11. Counsel for the Estado and the co-defendant Instituto appealed resolution n.° 307-2010; and the Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, composed of Judges Joaquín Villalobos Soto, Jazmín Aragón Cambronero, and Hubert Fernández Argüello, by resolution n.° 430-2010 at 13 hours 30 minutes on 30 de agosto de 2009, ordered: “The appealed resolution, Nº 307-2010 at eleven forty-five a.m. on the second of February, two thousand ten, is reversed insofar as it ordered the joinder of the Estado and the Instituto de Desarrollo Agrario as necessary passive co-parties (litis consortes pasivos necesarios) to the counterclaim filed by Bertilio Barrantes Solís.- The intervention of the Procuraduría General de la República in this matter is ordered, pursuant to Articles 1, 3 subsection a) of the Ley Orgánica de esa Procuraduría and 16 of the Código Procesal Contencioso Administrativo, with respect to the processing of the counterclaim.” 12.
The preliminary hearing (audiencia preliminar) was held on 23 de noviembre de 2010 and 28 de julio de 2011, and the parties were given the opportunity to be heard on both occasions. On the first date, the Tribunal Procesal Contencioso Administrativo ruled on the defense alleging formal defects in the pleading that precluded a decision on the merits and reserved the limitation-of-actions defense raised by the co-defendant counterclaimant for determination in the judgment on the merits.
13. The Tribunal Contencioso Administrativo, Sección Sexta, composed of Judges Otto González Vílchez, Marianella Álvarez Molina, and Cynthia Abarca Gómez, in judgment no. 175-2011-VI at 11:20 a.m. on August 18, 2011, with the latter dissenting, ruled: “Principal action: The statute-of-limitations defense (excepción de prescripción) is denied. The defense of lack of active and passive standing (falta de legitimación activa y pasiva) is denied. The defense of failure to state a legal right (falta de derecho) is denied. Consequently, the principal action brought by the Contraloría General de la República, with the State participating as an supporting party (coadyuvancia), against the Instituto de Desarrollo Agrario (IDA) and Bertilio Barrantes Solís is granted in all respects, as follows:
15. The Institute, as co-defendant, the State’s counsel, and the co-defendant/counterclaimant filed cassation appeals (recursos de casación), expressly stating the grounds on which they relied to challenge the Tribunal’s position.
16. The statutory requirements have been observed in the proceedings before this Chamber.

CONSIDERING
I.The Contraloría General de la República (hereinafter CGR) instituted proceedings against the Instituto de Desarrollo Agrario (hereinafter IDA) and Bertilio Barrantes Solís. It stated that, through Decreto Ejecutivo 11363-A of March 24, 1980, the Poder Ejecutivo transferred, free of charge, to the Instituto de Tierras y Colonización (hereinafter ITCO) an area of 160.000 hectares for the land-titling program known as “Limón 034,” occupied by persons who had not regularized their possession. It added that the land was registered in the name of ITCO under registration no. 7-26501-000. It indicated that, through Article 2 of Session 055-02 of August 12, 2002, the Junta Directiva del IDA approved the Reglamento para la Titulación en Reservas Nacionales (hereinafter RTRN). It argued that, in February 2004, co-defendant Bertilio Barrantes Solís submitted an application to IDA for the processing of title in national reserve lands and, consequently, for issuance to him of title to the property located within the “Limón 034” area.
It stated that the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía (hereinafter MINAE) issued certification SINC-DS-OFAU-C-1228-2004, of March 2004, indicating that the property described in plan L-908302-2004 constitutes Patrimonio Natural del Estado. It asserted that the plan identifies part of the property’s classification as mountain land. It claimed that IDA neither requested nor obtained the certifications required for title issuance by Section 27 of the Ley de Uso, Manejo y Conservación de Suelos (hereinafter Ley 7779) or by its Regulations. It asserted that, through official letter STA-010-2005 of January 2005, the supervisors of the national reserve land-titling program recommended that the Junta Directiva del IDA subdivide and transfer to Mr. Barrantes Solís the land identified by plan L-908302-2004, measuring 45 hectares 7.113,47 m2. It noted that, in Session 05-005 of February 7, 2005, the Junta Directiva del IDA approved, in Article 31, the granting of title to 11 parcels, including the land described above.
It continued that, through public deed no. 145, executed before Notary Ana Isabel Sibaja Rojas on February 18, 2005, the subdivision (segregación) of the property in favor of Mr. Barrantes Solís was formalized and registered under registration no. 7-114344-000. It added that, in ruling 2063-2007 at 2:40 p.m. on February 14, 2007, the Sala Constitucional annulled the RTRN as unconstitutional. Finally, it indicated that Decreto Ejecutivo no. 34415-MAG of February 14, 2008, repealed Decreto Ejecutivo 11363-A, under which the lands had originally been transferred to ITCO. It requests that the judgment declare: a) the resolution of the Junta Directiva in Session 005-05 void solely insofar as it concerns Mr. Barrantes Solís’s property; b) public deed no. 145 executed before Notary Sibaja Rojas, which notarized the aforementioned grant of title, void; c) the registration of property 7-114344-000 unlawful; d) that the aforementioned property is Patrimonio Natural del Estado, transferring it to MINAE and, in turn, ordering the Notaría del Estado to prepare the corresponding deed of transfer and arrange for its registration in the Registry with the appropriate change in classification; e) that MINAE be placed in possession of the property, with the corresponding eviction of Mr.
Barrantes Solís; and f) that the co-defendants be ordered to pay costs. As interim relief, it requested: a) entry of a notice of the action in the Registry; and b) an injunction directing Mr. Bertilio to refrain from conduct harmful to the natural resources of the property at issue. The Tribunal granted the requested measure. The co-defendants opposed the action. IDA raised the defense of lack of jurisdiction (excepción de incompetencia). Mr. Bertilio raised the defenses of the statute of limitations, failure to state a legal right, and lack of standing in both its active and passive forms. This Chamber held that jurisdiction over the matter belonged to the Tribunal Contencioso. Co-defendant Barrantes Solís filed a counterclaim, requesting a judgment declaring that the State must pay him: a) the value of the improvements he made to the property, specifying what they consisted of; b) the damages caused and compensation for emotional distress (daño moral); and c) both categories of costs.
On its own motion, the Tribunal joined the State and IDA to the proceedings as counterclaim defendants. The counterclaim defendants opposed the counterclaim. They raised the defenses of failure to state a legal right and lack of passive standing. The Tribunal de Apelaciones reversed the joinder of IDA but maintained that of the State. The Tribunal denied the defenses. It granted the action. It held IDA liable, with the amount to be determined, for damages. It denied the counterclaim. It ordered IDA to pay the costs of the principal action. Dissatisfied, the co-defendants filed cassation appeals.
IDA’s Appeal
II.In the sole claim admitted, it asserts that the judges failed to consider that MINAE, through its Conservation Areas (Áreas de Conservación), had failed to fulfill its administrative and custodial obligations, as required at that time by Ley Forestal no. 4465 of 25 de noviembre de 1969 (hereinafter Ley 4465), as well as Article 34 of Ley Orgánica del Ambiente (hereinafter LOA), Ley de Biodiversidad, and Ley de Conservación de la Vida Silvestre. It adds that, in doing so, the judges appear unaware that IDA is not the entity primarily responsible for ensuring compliance with the laws protecting that heritage. It states that the Court proceeds from the premise that Decreto Ejecutivo no. 11363-A of 24 de marzo de 1980 was repealed by Decreto Ejecutivo no. 34415-MAG of 10 de abril de 2008, which is true; however, it is also true that the former was not declared unconstitutional by decision 2063-2007 of the Constitutional Chamber.
Thus, it argues, the effects of the repeal are not the same as those of that ruling. It adds that the judges erred in interpreting Decreto 34415-MAG, which merely authorized IDA to request, by formal judicial communication (exhorto), the closure of property 26501-000 (transferred to ITCO), and not the cancellation of the properties created through the land-titling project. It states that the adjudicative body also failed to analyze the following: a) IDA is an autonomous institution created by Ley 6735, whose scope of authority places it in charge of administering, on behalf of the State, the “national reserves” (reservas nacionales), which constitute an integral part of its assets until they have been transferred to the forest estate (patrimonio forestal), pursuant to Article 32 of that Law. b) IDA did not arbitrarily initiate the national land-titling programs (programas nacionales de titulación), which were undertaken pursuant to a mandate and function assigned by the Executive Branch. c) The Decree by which the State transferred to the then ITCO the lands encompassed by land-titling project 034-Limón (Decreto 11363-A) is a valid and effective administrative act (acto administrativo), in accordance with the circumstances contemplated in Article 128 of the LGAP. d) The Board of Directors’ resolution, Article 31 of session 005-05, is a valid administrative act issued by IDA within the scope of its duties and authority, for the purpose of serving a public interest, in strict adherence to the principle of legality (principio de legalidad). e) The lands under examination were lawfully transferred to IDA by Decreto 3667-G for the sole purpose of granting title to the possessors, without promoting the appropriation of lands suited for forestry or having characteristics associated with the natural heritage of the State (patrimonio natural del Estado).
Moreover, it cannot be construed that there was any attempt to covertly dispossess the possessors of their lands. As its final objection, it states that the Court ordered it to pay damages (daños y perjuicios), in an amount to be determined, for having granted title to the land at issue, because that land was not part of the areas transferred by decree for the purpose of granting title to their possessors. Nevertheless, it adds, the judges failed to analyze that IDA had no duty to evict occupants from and safeguard those lands, a task that, in its view, falls to the State.
III.For purposes of assessing the appellant’s arguments, it is appropriate to define the statutory concept encompassed by the natural heritage of the State, since the claim centers on this issue. In this regard, this Chamber has repeatedly held that, pursuant to Article 13 of Ley Forestal: “The natural heritage of the State shall consist of the forests and forest lands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the National Banking System and becoming part of its assets...” Thus, the provision establishes three categories of property comprising that heritage: a) forests and forest lands within national reserves; b) forests and forest lands within areas declared inalienable; and c) forests and forest lands within properties registered in its name and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies, except for real property securing credit transactions with the National Banking System and becoming part of its assets.
Accordingly, IDA’s position that the property at issue in these proceedings cannot be considered part of the natural heritage of the State because it is not located within a national reserve, a protected wildlife area (área silvestre protegida), or a forest or biological reserve arises from an improper interpretation of the cited article. In this respect, Article 13 thereof clearly provides that a forest-covered property belonging to the State, a municipality, an autonomous institution, or another Public Administration body forms part of the natural heritage of the State, without the Legislature requiring that the property belong to any of the indicated protection categories. (Resolución 1070-2010 de las 9 horas 40 minutos del 3 de setiembre de 2010).
IV.In the challenged judgment, the Tribunal stated that the protection of wooded areas (zonas boscosas) is a duty of both the centralized and decentralized Administration. It added that, in order to protect the fundamental right to a healthy and ecologically balanced environment, the legal system establishes a series of technical and legal mechanisms for the effective protection of that right. The judges noted that these areas are subject to their own legislation (Ley Forestal), which means that their administration falls within the authority of MINAE, through the Sistema Nacional de Áreas de Conservación. However, they stated that the IDA was not authorized to grant title at the time of the application because, pursuant to Ley de Titulación de Tierras number 5064 of 22 de agosto de 1972 (hereinafter Ley 5064), the then ITCO was prohibited from granting title (titular) to forest lands or lands suitable for forestry (terrenos de vocación forestal).
Indeed, they noted that Decreto Ejecutivo number 11363-A, issued on 24 de marzo de 1980 and published in the Diario Oficial La Gaceta number 74 of 18 de abril de 1980, transferred, free of charge, an area of 160.000 hectares to the Instituto de Tierras y Colonización for the creation of the land-titling program (programa de titulación) known as “Limón 034.” They explained that this Decreto Ejecutivo was issued precisely on the basis of the laws previously cited and discussed (Ley Forestal number 4465 of 25 de noviembre de 1969 and Ley de Titulación de Tierras number 5064 of 22 de agosto de 1972). They also recounted that Article 2 of that Decreto provides: “The ITCO shall not grant property titles in those areas that, in the judgment of the Dirección Forestal and pursuant to the Ley Forestal in force, are or should be declared Forest Reserves or reserves of another kind.” Thus, the judges pointed out that the regulation in question, like the laws on which it was based, prohibited the ITCO from granting title in wooded areas or areas suitable for forestry.
Specifically, they stated that, as can also be seen from the evidence, forest had existed on the land awarded to co-defendant Barrantes Solís since 1960, and therefore he occupied that property while forest cover (cobertura boscosa) existed. They also asserted that, although human intervention on that land was evident in 1985, the forest did not cease to exist. In addition, they explained that even if Mr. Bertilio Barrantes Solís had applied for title to that land between 1978 and 1985, the ITCO could not have granted it because the legislation in force at that time prohibited the granting of title in wooded areas or areas suitable for forestry. They added that the Instituto Geográfico Nacional study, official letter number DEGEO-107-09 of 18 de agosto de 2009, established that by 1998 not only did forest continue to exist on the land under review, but the parcel also showed regeneration in the grassland area.
This is important, they said, because it demonstrates that the land in question is located in a mountainous area where the forest persists when human intervention ceases. The judges further added that the administrative acts (conductas administrativas) performed by the IDA, which are the subject of these proceedings, are also void for other reasons. First, because the granting of title carried out by the IDA’s Junta Directiva in favor of co-defendant Barrantes Solís was based on the RTRN, which had been approved by the Junta Directiva at session 055-02 of 12 de agosto de 2002. They noted that this Reglamento was declared unconstitutional by a decision issued by the Sala Constitucional—judgment number 02063-07, at 14 hours 40 minutes on 14 de febrero de 2007. The judges asserted that, as a result, the granting of title by the IDA in favor of co-defendant Barrantes Solís was based on a regulation that ceased to exist within the body of applicable law (bloque de legalidad), and is therefore tainted by absolute nullity (nulidad absoluta) as a consequence of that declaration of unconstitutionality.
From the foregoing, this Chamber observes that the Tribunal’s position regarding the nullity of the IDA’s acts is not based solely on the declaration that the RTRN was unconstitutional, but also, and beforehand, on a fact deemed fundamental: that on the date of the title application submitted by Mr. Bertilio—febrero de 2004—the IDA was legally barred from granting titles in wooded areas or areas suitable for forestry, since the regulations then in force, including Decreto 11363-A, prohibited it from doing so at that time. In addition, pursuant to Sala Constitucional judgment 2063-2007, which annulled the RTRN, the declaratory effects of that judgment were retroactive to the date on which the RTRN took effect. Thus, although the ground for appeal seeks to establish an alleged error by the judges in assessing which entity was directly responsible for protecting the forest areas to which title had been granted—arguing that it was MINAE rather than the IDA—it is clear that the appellant in cassation (casacionista) is challenging a line of reasoning different from the one underlying the judgment.
Indeed, while the judges clarified their position that both the centralized and decentralized Administration are obligated to protect the environment, they identified as the central issue the IDA’s legal inability to grant the title under review. This is so regardless of whether the Sala Constitucional judgment was issued after the application submitted by Mr. Barrantes Solís, because the legal system did not, in fact, permit the IDA to grant it. Furthermore, the declaration of unconstitutionality defined its effects as running from the effective date of that regulation and established the liability of the State. In light of the foregoing, the appeal in cassation is unavailing on this specific point because it does not challenge the central holding of the judgment: that the IDA could not grant title in wooded areas because the legal framework in force on the date of the application prohibited it from doing so.
Additionally, and of essential importance to the resolution of this matter, the RTRN was declared unconstitutional, which renders void the IDA acts aimed at granting title to public-domain property (bienes de dominio público) that were based on that Reglamento. Once it was declared unconstitutional, the sanction imposed by the legal system was nullity, pursuant to section 88 of the Ley de la Jurisdicción Constitucional, which provides: “Judgments declaring unconstitutionality and ordering the consequent annulment of the challenged provision or acts shall have res judicata effect (cosa juzgada) and shall remove the provision or act from the legal system….” Accordingly, the appellant’s assertion lacks both factual and legal foundation. Based on the foregoing, the alleged defects must be rejected.
V.The appellant in cassation also claims that Decreto 11363-A of 24 de marzo de 1980 was repealed by Decreto 34415-MAG of 10 de abril de 2008; nevertheless, she notes that the effects of such repeal are not the same as those of a declaration of unconstitutionality. In this regard, the Tribunal reasoned that Decreto 11363-A of 24 de marzo de 1980 was repealed by Decreto 34415-MAG, published in the Diario Oficial La Gaceta number 70 on Thursday, 10 de abril de 2008. They added that Article 2 of the latter also authorized the IDA to: “…proceed by formal request (exhorto) to cancel the registration in the Registro Público of the properties: a) Partido de Limón, Folio Real 26501-000 (…).” The judges stated that this repeal left the granting of title in favor of Mr. Barrantes Solís without an underlying legal basis because, from that moment onward, the original property ceased to exist, together with the provision that had authorized the granting of title to that land.
The judges indicated that Decreto 34415-MAG also ordered the IDA to initiate proceedings to cancel the registrations in the Registro Público that arose from the mandate, which was not complied with because the Instituto did not pursue the nullity of the title through administrative proceedings (sede administrativa). From the foregoing, this Chamber notes that the appellant seeks to establish a distinction between the effects of repealing the Decreto and those of a declaration of unconstitutionality, an assessment that is irrelevant because that distinction was not addressed by the challenged judgment. What must be determined in this particular case is whether the Tribunal’s interpretation regarding the absence of an underlying legal basis for the granting of title is valid, not whether the repeal of a decree has the same effects as a declaration of unconstitutionality, since, it bears repeating, that issue is not a basis for the challenged decision.
In that regard, it is evident that Decreto 11363-A was indeed repealed by 34415-MAG. This occurred as a consequence of constitutional judgment no. 02063-07, after the oversight body, by official letter DFOE-ED-7-2007 dated 15 de marzo de 2007, requested that the Poder Ejecutivo repeal several Decretos, including 11363-A (whereas clause III of the Decreto in question). Consequently, that Decreto was indeed repealed, and the IDA was instructed to request, by formal request, the cancellation of the registration of several properties, including the one giving rise to these proceedings. From the foregoing, it is clear that, as the Tribunal reasoned, the granting of title to the property lacks an underlying legal basis, not only because the provision that gave rise to the transfer of the State-owned lands to the IDA (Decreto 11363-A) was repealed, but also because the RTRN had previously been declared unconstitutional and because Ley del ITCO no. 5064 prohibited it. The IDA was therefore barred from granting titles in areas of National Reserve (Reserva Nacional).
VI.Finally, it should be noted that the claims concerning alleged omissions by the Tribunal are without merit, insofar as it failed to establish that Decreto 11363-A is a valid and effective act and that Article 31 of Session 005-05 is a valid administrative act (acto administrativo) issued by the IDA within the scope of its duties and jurisdiction. In the opinion of this decision-making body, although they produced legal effects at the time, allowing the transfer of property to the IDA and its subsequent subdivision (segregación) in favor of third parties, it is undisputed that the effects of the declaration of unconstitutionality (inconstitucionalidad) of the RTRN were made retroactive to the time when the affected acts were issued, without prejudice to any liability that this entailed for the State. Thus, the argument that the IDA is an autonomous institution created by law, whose jurisdictional framework grants it the administration, on behalf of the State, of the “national reserves,” is likewise insufficient, as is the argument that the acts declared void were issued without justification by the IDA, since it is clear that, as such, it too is subject to the principle of legality (principio de legalidad).
Consequently, under the regulations in force at the time, titles could not be granted in Reserve areas, because both the Decree that transferred State property to the ITCO and the Regulation that permitted the transfer in favor of Mr. Barrantes Solís ceased to exist in the legal order. As a final matter, regarding the IDA’s claim that the Tribunal ordered it to pay damages for having issued titles in areas that it had no duty to clear or safeguard, this decision-making body finds, as the judges stated, that the unliquidated award (condena en abstracto) was based on the existence of an abnormal operation for which the State must be compensated. In that regard, there is no doubt that the IDA issued titles to parcels in the public domain (dominio público), despite the prohibition against doing so, a circumstance that placed such conduct wholly outside the bounds of legality. Accordingly, there is no indication that the Tribunal exceeded its authority by ordering it to pay damages in an amount to be determined.
The same applies to the assertion that the Tribunal failed to consider that the land had been in the possession of private individuals, which is not a claim that may be entertained by this Chamber, because the Ley Forestal is clear that these are inalienable assets (bienes inalienables), that possession by private individuals shall create no rights in their favor, and that the State’s action for recovery of ownership (acción reivindicatoria) is not subject to a statute of limitations (Sentencia 1070-2010 de las 9 horas 40 minutos del 3 de setiembre de 2010).
Appeal by Bertilio Barrantes Solís
VII.In the first of the two admitted substantive grounds (cargos de fondo), he alleges improper assessment of the evidence (indebida valoración probatoria). He argues that the Tribunal found that the land depicted in registered cadastral plan (plano catastrado) L-908302-2004 forms part of the State’s natural heritage (patrimonio natural del Estado). He states that this finding was based on study DEGEO-107-09 del 18 de agosto de 2009, prepared by the Instituto Geográfico Nacional (hereinafter IGN), which explains that forest had clearly existed at the site since 1960 and that a subsequent land-use change (variación en el uso de suelo) occurred. Thus, he notes, the judges stated that the area that was forested in 1960 had been converted to pasture and roads by 1985, with the forested area regenerating in 1998. Nevertheless, he states that the Tribunal did not mention that the photographic material used by the IGN was not produced on the land itself and therefore permits only an approximate location to be determined and cannot be considered evidence.
He contends that, during its judicial inspection (reconocimiento), the Tribunal found a forested area, as well as abandoned pasture areas and difficult access, and therefore considered agricultural activity at that location to be difficult. He asserts that these were value judgments made by the Tribunal, because it was not accompanied by a technical expert who could explain how life is conducted in that rural area and thereby verify those circumstances. Furthermore, he notes that the inspection was conducted more than one year and four months after the interim measure (medida cautelar) barring him from accessing the property had been granted, a circumstance that caused the forest’s natural regeneration. He maintains that a similar situation applies to the contents of official communication DST-023-10 del 27 de enero del 2010, which was also followed more than one year and four months after the interim measure was granted; accordingly, the judges erred in concluding that nearly 90% of the land is forest, because that condition resulted from the regeneration caused by the interim measure.
He argues that report DST-023-10 was not an admissibility requirement when the IDA considered his application for title, at which time only a MINAET certification attesting that no protected wilderness areas (áreas silvestres) were affected was required. He contends that it is unacceptable that the Tribunal failed to examine the testimony of Morales Castro and Padilla Brenes, who stated that Bertilio had possessed the property for more than 30 years. He alleges that the expert report (informe pericial) issued by Engineer Francisco Herrera Chavez was likewise not assessed; according to that report, the properties bordering his land to the north and south are agricultural farms, the parcel has fences consisting of living and dead posts, the paths remain clearly defined and can be traveled without difficulty, the pasture areas show a lack of maintenance for a period of one year, and other information demonstrates Bertilio’s possession.
Finally, he emphasizes that the neighboring properties are not located within any protected wilderness area and are agricultural in nature. In his second objection, he alleges improper application of substantive rules (normas sustantivas). He states that the judges emphasized that, in 1980—the year when the State transferred the land to the IDA—Ley Forestal no. 4465 de 25 de noviembre de 1969 (hereinafter Ley 4465) was in force, and that the Institute was therefore prohibited from granting titles in forested areas or land suited for forestry (vocación forestal). However, they failed to consider that it was the State itself that delegated the titling programs to the IDA. He adds that, although Ley 4465 dates from 1969, Ley de Informaciones Posesorias no. 139 de julio de 1941 allowed titles to be granted in protected wilderness areas when the applicant had possessed the land for 10 years. He further states that, for those reasons, the Tribunal erroneously held that possession of the land at issue was impermissible because it had been designated as part of the State’s natural heritage.
He adds that the judges asserted that, under Laws 4465 of 1969 and 7575 of February 1996, acquisitive prescription (prescripción positiva) did not apply because of the nature of the property, nor could the land be included in the IDA’s titling programs. He argues that he was compelled to apply to the IDA for title because, since the property was registered in the Institute’s name, he was unable to institute possessory-title proceedings (proceso de información posesoria). He explains that provisions 13, 14, and 15 of Ley 7575 amended Ley de Informaciones Posesorias de 1941 (Article 7), allowing titles to be granted in protected wilderness areas regardless of their management category. For that reason, he states, the claim seeking the annulment of Article 31 of Session 055-05 cannot be granted without disregarding his individual rights (derechos subjetivos), particularly because the State has allowed titles to be granted for forested land (he cites case law from the Tribunal Agrario in support of his position).
In summary, the judges did not address the argument presented, namely that persons possessing forested land or land suited for forestry may be entitled to a registrable property title (título inscribible de propiedad) under provision 7 of Ley de Informaciones Posesorias; instead, the ruling violates the categorization set forth in section 32 of Ley Orgánica del Ambiente no. 7554 de 4 de octubre de 1995 (hereinafter LOA). This is so, he emphasizes, because Ley 7575 amended provision 7 of the LIP, allowing titles to be granted for land with those characteristics. He further argues that section 46 of that Law created the Fondo Nacional de Financiamiento Forestal (hereinafter FONAFIFO) to encourage the protection of forested areas through the Pago de Servicios Ambientales. He therefore contends that the judicial panel made a one-sided interpretation of the evidence, ignoring that titles may legally be granted for forested areas or land suited for forestry because regulations exist that permit it.
VIII.Regarding the first objection, concerning improper assessment of the evidence, the Tribunal did indeed find, based on study DEGEO-107-09 del 18 de agosto de 2009 prepared by the IGN, that forest had existed at the location since 1960 and that, although a change occurred around 1985 involving pasture and roads, regeneration of the forested area was evident by 1998. The judges state that this finding was reinforced by the inspection conducted at the location on 22 de enero del 2010, from which they concluded that the property was unsuitable for agriculture because of its difficult access, abandonment, and luxuriant forest growth. This Chamber finds that, although the appellant asserts that those statements were merely value judgments because the inspection was conducted several months after the interim measure barring him from accessing the location had been granted, thereby allowing the forest to regenerate, the appeal on points of law (casación) cannot succeed.
Although the appellant in cassation (casacionista) asserts that official communications DEGEO-107-09 and DST-023-10 and other evidence were incorrectly assessed by the judges, it should be noted, in accordance with the ruling in Considerando III, that what matters is not whether forest exists in the area, because the nullity of the transfer resulted from the declaration that the RTRN was unconstitutional and the repeal of Decreto Ejecutivo 11363-A, which originally transferred the land to the ITCO. Thus, the allegation is insufficient to overturn the judgment and must therefore be rejected.
IX.In the second ground of appeal, the appellant argues that substantive rules were improperly applied because, in his view, the judges emphasized that in 1980—the date on which the State transferred the land to the IDA—Ley Forestal no. 4465 de 25 de noviembre de 1969 (hereinafter Ley 4465) was in force, and therefore that Institute could not grant title to forested areas or land suited for forestry. Nevertheless, he states, the judges failed to consider that it was the State itself that delegated the titling programs to the IDA. He adds that no consideration was given to the fact that, since 1941, the LIP permitted titling in protected wilderness areas (áreas silvestres protegidas) when the applicant had 10 years of possession, or that FONAFIFO promotes the conservation of forest areas. In this regard, this Chamber finds that, concerning the impossibility of granting title to forest areas, the appellant must abide by the provisions of recital IV of this decision.
As stated, not only did Ley del ITCO no. 5064 preclude the titling under review, but the titling of the property also lacked an underlying legal basis, since the provision that gave rise to the transfer of the land from the State to the IDA (Decreto 11363-A) was repealed, and the Reglamento through which the IDA processed that transfer was declared unconstitutional. Likewise, insofar as he claims that it was the State itself that delegated to the IDA the authority to grant title to such properties, the party is referred to the discussion in recital V of this decision, in which this adjudicatory body stated that such circumstance did not release the IDA from its obligation to conduct itself in accordance with the prevailing legal framework. Finally, regarding his position that, since 1941, the LIP permitted titling in protected wilderness areas when the applicant had 10 years of possession, the Tribunal stated that when land forms part of the State Natural Heritage (Patrimonio Natural del Estado), it is exempt from attachment, not subject to prescription, and inalienable.
In the judges’ view, this means that it is outside private commerce, as provided in sections 261, 262 and 263 of the Código Civil. They therefore reaffirmed that it is not valid to invoke positive or acquisitive prescription (prescripción positiva o adquisitiva), which rules out the theory of obtaining title through the mechanisms of the LIP; nor is there any limitation period that may be asserted to prevent the State or its institutions from seeking judicial recovery (reivindicación) of that land. In this regard, this Chamber emphasizes that, as stated in recitals III, IV and V of this judgment, the area in which the titling was processed is a forested area of forestry interest that, although transferred by the State to the IDA for titling purposes, has all the characteristics of property forming part of the public domain. This precluded the processing of a possessory title proceeding (información posesoria) with respect to that property under the LIP.
The properties at issue are indeed inalienable and not subject to prescription, and they could not be occupied for the purpose of obtaining title because they are clearly forest lands. This requires rejection of the ground. Accordingly, reliance on FONAFIFO as an argument for establishing that title could be granted to that property is likewise unavailing, since the properties belong to the public domain and, given their nature, could not, as reiterated, be possessed for the purpose of acquiring them through positive prescription.
Appeal by the State
X.The appellant argues that section 193 of the CPCA establishes the obligation to order the unsuccessful party to pay the costs of the proceedings, while also allowing that party to be exempted as an exception. He adds that when such an exemption is granted, the judges must state the reasons for their decision. He asserts that, in the present case, the Tribunal exempted the counterclaimant Barrantes Solís from paying costs despite having dismissed his counterclaim (contrademanda), without explaining the reason for doing so, since, he claims, the judges provided no basis establishing the existence of procedural good faith (buena fe procesal). Thus, he states, the judgment lacks reasons, leaving him without an effective defense because it prevents him from knowing and challenging the criteria on which the judges relied to grant this relief. He adds that, if recital II of the judgment were deemed to constitute the reason for granting the exemption, there would be a direct violation of the law due to failure to apply subsection a) of section 193 of the CPCA and improper application of subsection b of the same section.
XI.Section 193 subsection b) of the CPCA authorizes the Tribunal to exempt a party from costs when, in its judgment, there was sufficient cause to litigate. In this particular case, the judges found that this exemption should be extended to don Bertilio because he had acted in good faith. In this regard, this Chamber notes that Mr. Barrantes Solís’s ability to avoid these proceedings was limited by several factors. First, he was precluded from initiating a possessory title proceeding because the property he possessed was encompassed within a property owned by the IDA. Likewise, for titling purposes, he complied with the requirements and assessments established in that regard by the aforementioned Institute, which granted his request for title to the land in question. That circumstance cannot be construed as bad faith on his part because, as has been shown, the IDA processed other applications similar to his, and that Institute has maintained even before this instance that its actions were valid and in accordance with the law.
There was therefore no reason for don Bertilio reasonably to have considered his defense in the proceedings unnecessary. Thus, as reiterated, the co-defendant did not initiate the action but was brought into the proceedings. To that extent, and in accordance with the foregoing, he had sufficient cause to defend against the claim brought against him, since he acted in accordance with the regulations established by the IDA for the purpose of obtaining title to the property at issue in these proceedings, thereby becoming a defendant. Accordingly, although the explanation was brief, the exemption from costs granted by the Tribunal on the ground that Mr. Barrantes Solís acted in good faith is not considered improper. The ground must therefore be rejected.
XII.In view of the foregoing, the appeals shall be dismissed and costs imposed on the appellants pursuant to section 150 subsection 3) of the Código Procesal Contencioso Administrativo.
POR TANTO
The appeals are dismissed, with costs to be borne by those who filed them.

RESULTANDO
1. Con base en los hechos que expuso y disposiciones legales que citó, la parte actora estableció proceso de conocimiento de trámite preferente, a fin de que en sentencia: “1) Que se anule el acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, contenido en el Artículo 31 de la Sesión número 005-05 de fecha 7 de febrero de 2005, únicamente, en lo que se refiere a la titulación de una finca a favor del señor Bertilio Barrantes Solís, descrita en el plano catastrado número L-908302-2004;
2. El Juez Alexander Castillo Aguilar, en sentencia n.° 637-2008 de las 14 horas 30 minutos del 3 de setiembre de 2008, acogió la medida cautelar, ordenó la anotación registral de la demanda sobre la propiedad n.° 7-14344-000 y previno al señor Bertilio Barrantes Solís de abstenerse de cualquier conducta que atentara contra los recursos naturales existentes en la propiedad supra indicada.
3. El Instituto codemandado contestó conforme a folios 84 a 104 e interpuso la defensa previa de falta de competencia. Asimismo, a folio 102 renunció al proceso conciliatorio.
4. El codemandado Barrantes Solís contestó acorde a folios 109 a 119 y opuso las excepciones de falta de legitimación activa y pasiva, falta de derecho y prescripción. Además, a folios 120 a 123 planteó reconvención en contra de la actora, para que en sentencia se declare: "1- Se acoja la presente contrademanda en todos sus extremos solicitados; 2- Se declare que las mejoras realizadas en la propiedad descrita en el hecho primero de esta contrademanda fueron hechas por el señor Bertilio, las cuales fueron hechas de buena fe y con su único esfuerzo, o bien que se ordene en sentencia que el Estado deberá pagar lo correspondiente por los daños y perjuicios ocasionados a don Bertilio; 3- Que dicho pago será de acuerdo al valor que dictamine el perito o peritos nombrados al efecto.- Ya que los árboles existentes fueron cuidados y asistidos por don Bertilio; 4- Que dichas mejoras consisten en: asistencia de la finca, limpieza de carriles, que se hace cada dos meses durante todos estos años, así como la siembra de árboles que hoy día están en la propiedad, los cuales deberán ser valorados al tiempo de producción y conforme al precio de la madera en el mercado para cuando está estuviera lista para salir al mercado tal y como tengo planeado hacerlo, todo lo cual deberá ser valorado por el respectivo perito solicitado por en este mismo acto; 5- Se condene al Estado al pago de ambas costas de esta acción de contrademanda; 6- Que se condene al Estado reconvenido al pago de daños y perjuicios, los cuales describo de la siguiente forma: A- Daño Económico: Solicito que se incluya como partida el económico sufrido que consiste en la pérdida de la finca, la inversión de mantenimiento dado a la finca durante más de 28 años; B- Daño Moral: Lógicamente esta demanda le ha causado grave perjuicio a mi representado, por lo que está pasando por una angustia, hay que recordar que es persona mayor de edad, de 75 años para ser exactos y tiene varios problemas de salud, lo cual con esta demanda tan terrible que se le ha establecido le ha traído desvelo y confusión emocional, todo lo cual trae como consecuencia una cadena explosiva de males en la salud de mi representado ya que antes de toda esta demanda, el se consideraba como dueño y poseedor legítimo en su propiedad, y porque durante tantos años, el Estado nunca realizó gestión alguna para recuperar este terreno; C- Perjuicios: Los considero como el producto de las mejoras introducidas, así como el precio pagado por esta porción de tierra de la cual hoy se le está solicitando despojar e incluso se pide el desalojo del señor Bertilio, sin importar su edad, la inseguridad hoy día por ser tan mayor de edad en conseguir un trabajo, que los mejores años de su vida, se los pasó cuidando un bien que creyó era suyo y de pronto se ve envuelto en toda esta demanda que le hace perder toda seguridad jurídica, que había obtenido de una institución que nació con fines de proteger al agricultor, cual es el caso del IDA, y de eso al resultado que está obteniendo hoy es un golpe muy fuerte para un campesino como don Bertilio.- Perjuicios que deberán ser fijados también conforme al peritaje respectivo y necesario." 5.
El Juez Alexander Castillo Aguilar, en sentencia n.° 470-2009 de las 10 horas del 12 de marzo de 2009, resolvió: “De conformidad con los arts (sic) 49 Constitucional y 1, 2, 36 y 43 del CPCA, y del razonamiento la materia declarando que esta sí resulta ser la jurisdicción competente.
6. El representante del Instituto codemandado, manifestó su inconformidad por lo resuelto en la sentencia n.° 470-2009; razón por la cual se elevó en consulta a la Sala Primera de la Corte Suprema Justicia y, esa Cámara, mediante resolución n.° 000627-C-S1-2009 de las 10 horas 50 minutos del 25 de junio de 2009, con voto salvado de la magistrada Carmenmaría Escoto Fernández, dispuso: “Se declara que el conocimiento del presente proceso corresponde al Tribunal Contencioso Administrativo y Civil de Hacienda.” 7. El Tribunal Contencioso Administrativo, Sección Sexta, en resolución de las 8 horas 50 minutos del 29 de octubre de 2009, declaró el proceso de trámite preferente.
8. La actora reconvenida contestó conforme a folios 377 a 389 e interpuso las excepciones de defectos formales que impiden verter pronunciamiento en cuanto al fondo, falta de legitimación pasiva y falta de derecho.
9. El Tribunal Contencioso Administrativo, Sección Sexta, mediante auto n.° 307-2010 de las 11 horas 45 minutos del 2 de febrero de 2010, de manera oficiosa integró la litis y resolvió: “Se tiene por integrada la litis consorcio pasiva, y como consecuencia de ello, se tiene como codemandados dentro de la contrademanda presentada por Bertilio Barrantes Solís al Estado y al Instituto de Desarrollo Agrario conjuntamente con la Contraloría General de la República. Se ordena dar traslado al Estado y al Instituto de Desarrollo Agrario de la contrademanda en los términos consignados en el considerando III d este auto. Consérvense las actuaciones procesales indicadas en el considerando IV de esta sentencia.” 10. El Estado contestó negativamente y opuso las excepciones de falta de legitimación pasiva y falta de derecho.
11. La representación estatal y el Instituto codemandado apelaron la resolución n.° 307-2010; y, el Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, integrado por los jueces Joaquín Villalobos Soto, Jazmín Aragón Cambronero y Hubert Fernández Argüello, en resolución n.° 430-2010 de las 13 horas 30 minutos del 30 de agosto de 2009, dispuso: "Se revoca la resolución apelada, Nº 307-2010 de las once horas cuarenta y cinco minutos del dos de febrero del dos mil diez, en cuanto dispuso integrar al Estado y al Instituto de Desarrollo Agrario, como litis consortes pasivos necesarios, de la contrademanda interpuesta por Bertilio Barrantes Solís.- Se ordena la intervención de la Procuraduría General de la República en este asunto, en lo términos de los artículos 1, 3 inciso a) de la Ley Orgánica de esa Procuraduría y 16 del Código Procesal Contencioso Administrativo, en lo que se refiere a la tramitación de la reconvención.” 12.
La audiencia preliminar se celebró los días 23 de noviembre de 2010 y 28 de julio de 2011, teniendo las partes uso de la palabra en ambas oportunidades. Durante la primera fecha, el Tribunal Procesal Contencioso Administrativo resolvió la excepción de defectos formales del escrito que impiden verter pronunciamiento en cuanto al fondo y, reservó la excepción de prescripción opuesta por el codemandado reconventor, para el dictado de fondo.
13. El Tribunal Contencioso Administrativo, Sección Sexta, integrada por los jueces Otto González Vílchez, Marianella Álvarez Molina y Cynthia Abarca Gómez, en sentencia n.° 175-2011-VI de las 11 horas 20 minutos 18 de agosto de 2011, con voto salvado de la última, dispuso: “Demanda principal: Se declara sin lugar la excepción de prescripción. Se declara sin lugar la excepción de falta de legitimación activa y pasiva. Se rechaza la excepción de falta de derecho. En consecuencia, se declara con lugar en todos sus extremos la demanda principal establecida por la Contraloría General de la República con la coadyuvancia del Estado, contra el Instituto de Desarrollo Agrario (IDA) y Bertilio Barrantes Solís, en el siguiente sentido:1) Se anula el acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, contenido en el Artículo 31 de la Sesión número 005-05 de fecha 7 de febrero de 2005, únicamente, en lo que se refiere a la titulación de una finca a favor del señor Bertilio Barrantes Solís, descrita en el plano catastrado número L-908302-2004;
15. El Instituto codemandado, la representación estatal y el codemandado reconventor formulan recursos de casación indicando expresamente las razones en que se apoyan para refutar la tesis del Tribunal.
16. En los procedimientos ante esta Sala se han observado las prescripciones de ley.
Redacta la magistrada Escoto Fernández
CONSIDERANDO
I.La Contraloría General de la República (en adelante CGR), interpuso proceso contra el Instituto de Desarrollo Agrario (en lo sucesivo IDA) y Bertilio Barrantes Solís. Señaló, el Poder Ejecutivo, mediante Decreto Ejecutivo 11363-A del 24 de marzo de 1980, traspasó en forma gratuita al Instituto de Tierras y Colonización (en adelante ITCO), un área de 160.000 hectáreas para el programa de titulación denominado “Limón 034”, ocupado por quienes no habían regularizado su posesión. Agregó, dicho terreno se inscribió a nombre del ITCO, con la matrícula no. 7-26501-000. Indicó, la Junta Directiva del IDA, mediante artículo 2, de la sesión 055-02, del 12 de agosto de 2002, aprobó el Reglamento para la Titulación en Reservas Nacionales (en lo que sigue, el RTRN). Arguyó, el codemandado Bertilio Barrantes Solís, presentó ante el IDA en febrero de 2004, una solicitud para tramitar titulación en reservas nacionales y consecuentemente, se le otorgara título de propiedad de la finca ubicada en el área “Limón 034”.
Consideró, el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía (en adelante MINAE), emitió la certificación SINC-DS-OFAU-C-1228-2004, de marzo de 2004, en la cual indica, que la finca descrita en el plano L-908302-2004, constituye patrimonio natural del Estado. Afirmó, dicho plano refiere que parte de la naturaleza del bien es montaña. Aseveró, el IDA no gestionó y obtuvo las certificaciones que ordenan los preceptos 27 de la Ley de Uso, Manejo y Conservación de Suelos (en adelante Ley 7779), ni de su Reglamento para la titulación. Aseguró, mediante oficio STA-010-2005 de enero de 2005, los supervisores del programa de titulación en reservas nacionales, recomendaron a la Junta Directiva del IDA, segregar y traspasar a favor del señor Barrantes Solís, el terreno identificado por el plano L-908302-2004, con un área de 45 hectáreas 7.113,47 m2. Apuntó, la Junta Directiva del IDA, en sesión 05-005 del 7 de febrero de 2005, aprobó en su artículo 31, la titulación de 11 parcelas, entre las que se encontraba el terreno antes descrito.
Continuó, mediante escritura pública no. 145, otorgada ante la notaria Ana Isabel Sibaja Rojas, del 18 de febrero de 2005, se formalizó la segregación del inmueble a favor del señor Barrantes Solís, la cual fue inscrita bajo la matrícula no. 7-114344-000. Añadió, en resolución 2063-2007, de las 14 horas 40 minutos del 14 de febrero de 2007, la Sala Constitucional anuló por inconstitucional el RTRN. Finalmente indicó, el Decreto Ejecutivo no. 34415-MAG del 14 de febrero de 2008, derogó el Decreto Ejecutivo 11363-A, por el cual, originalmente habían sido traspasados los terrenos al ITCO. Solicita en sentencia se declare: a) nulo el acuerdo de Junta Directiva 005-05, únicamente en lo que refiere a la finca del señor Barrantes Solís; b) nula la escritura pública no. 145 otorgada ante la notaria Sibaja Rojas que protocolizó la titulación referida; c) la ilegalidad de la inscripción de la finca 7-114344-000; d) que la finca mencionada es patrimonio natural del Estado, trasladándola al MINAE, ordenando a su vez a la notaria del Estado, confeccionar la escritura de traspaso respectiva así como su inscripción en el Registro con su cambio de naturaleza; e) al MINAE en posesión del bien, con el correspondiente desalojo del señor Barrantes Solís; f) la condena a los codemandados al pago de las costas.
Como medida cautelar solicitó: a) anotar registralmente la demanda y b) prevenir a don Bertilio abstenerse de conductas que atenten contra los recursos naturales de la propiedad de examen. El Tribunal acogió la medida solicitada. Los codemandados contestaron de manera negativa. El IDA opuso la excepción de incompetencia. Don Bertilio formuló las defensas de prescripción falta de derecho y de legitimación en su doble modalidad. Esta Sala declaró que el conocimiento del asunto corresponde al Tribunal Contencioso. El coaccionado Barrantes Solís, reconvino, solicitando en sentencia se declare que el Estado debe cancelarle: a) el valor de las mejoras que realizó en el inmueble, indicando en qué consisten; b) los daños y perjuicios causados y daño moral; y c) ambas costas. De oficio el Estado y el IDA fueron integrados a la litis como contrademandados. Los reconvenidos contestaron negativamente.
Opusieron las defensas de falta de derecho y de legitimación pasiva. El Tribunal de Apelaciones revocó la integración del IDA a la litis, mantuvo la del Estado. El Tribunal rechazó las excepciones. Declaró con lugar la demanda. Condenó al IDA al pago en abstracto de daños y perjuicios. Rechazó la reconvención. Condenó al IDA al pago de las costas del proceso principal. Inconformes los coaccionados, acuden a casación.
Recurso del IDA
II.En el único cargo admitido, afirma, los juzgadores omiten valorar que el MINAE, a través de sus Áreas de Conservación, ha incumplido sus obligaciones de administración y cuido, como lo ordenaba a esa fecha la Ley Forestal no. 4465 de 25 de noviembre de 1969 (en lo sucesivo Ley 4465), así como el ordinal 34 de la Ley Orgánica del Ambiente (en adelante LOA), la Ley de Biodiversidad y la de Conservación de la Vida Silvestre. Agrega, de tal forma, parece no enterarse de que el IDA no es el principal encargado de velar por el cumplimiento de las leyes que resguardan ese patrimonio. Señala, el Tribunal parte de que el Decreto Ejecutivo no. 11363-A del 24 de marzo de 1980, fue derogado por el Decreto Ejecutivo no. 34415-MAG de 10 de abril de 2008, lo cual es cierto, sin embargo, también lo es que el primero no fue declarado inconstitucional por el voto 2063-2007 de la Sala Constitucional. De tal forma, aduce, los efectos de la derogatoria no son los mismos que los de ese fallo.
Añade, los juzgadores yerran al interpretar el Decreto 34415-MAG, el cual solo autorizó al IDA a solicitar mediante exhorto el cierre de la finca 26501-000 (traspasada al ITCO) y no la cancelación de las fincas nacidas del proyecto de titulación. Expresa, el órgano jurisdiccional omite también analizar, que: a) El IDA es una institución autónoma, creada mediante la Ley 6735, cuyo marco de competencia le otorga la administración a cargo del Estado, de las “reservas nacionales”, las cuales forman parte integral de su patrimonio en tanto no hayan sido traspasadas al patrimonio forestal, según el precepto 32 de esa Ley. b) El IDA no inició en forma antojadiza los programas nacionales de titulación, los cuales responden a un mandato y función asignadas por el Poder Ejecutivo. c) Que el Decreto mediante el cual el Estado le traspasa al entonces ITCO los terrenos que comprende el proyecto de titulación 034-Limón (Decreto 11363-A), es un acto administrativo válido y eficaz, conforme al supuesto del numeral 128 de la LGAP. d) El acuerdo de Junta Directiva, artículo 31 de la sesión 005-05, es un acto administrativo válido emitido por el IDA dentro del ámbito de sus funciones y competencia, con el fin de satisfacer un interés público, con estricto apego al principio de legalidad. e) Los terrenos de examen fueron legítimamente traspasados al IDA por el Decreto 3667-G, con el único fin de dotar de títulos a los poseedores, sin que se promoviera la apropiación de terrenos con vocación forestal o condiciones atinentes al patrimonio natural del Estado.
Más aún, no se puede interpretar que se haya promovido desplazar simuladamente a los poseedores de sus tierras. Expresa, como último reparo el Tribunal le condena en abstracto en daños y perjuicios por haber titulado el terreno en cuestión, por cuanto no formaba parte de las áreas que mediante decreto se traspasaron para la titulación de sus poseedores. Pese a ello, añade, no analizan que el IDA no tenía el deber de desalojar y custodiar esos terrenos, tarea que estima, corresponde al Estado.
III.A efecto de valorar los alegatos de la recurrente, resulta oportuno delimitar el concepto normativo que involucra el patrimonio natural de Estado, ya que el eje del reclamo gira en torno a este punto. Al respecto, esta Sala ha reiterado, que, conforme al numeral 13 de la Ley Forestal: “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio...” De esta forma, son tres posibilidades las que brinda la norma, respecto a los bienes que integran dicho patrimonio: a) bosques y terrenos forestales de las reservas nacionales; b) bosques y terrenos forestales de las áreas declaradas inalienables, y c) bosques y terrenos forestales de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.
De esta forma, el criterio externado por el IDA, respecto a que la finca objeto de este proceso no puede considerarse parte del patrimonio natural del Estado, ya que no se localiza dentro de una reserva nacional, un área silvestre protegida, una reserva forestal o biológica, surge de una indebida interpretación del ordinal citado. En este sentido, el mandato 13 ibídem es claro al determinar, que una propiedad cubierta de bosque, y que pertenezca al Estado, una municipalidad, institución autónoma u otro organismo de la Administración Pública, forma parte del patrimonio natural del Estado, sin requerir el Legislador, que la propiedad debiera formar parte de alguna de las categorías de protección indicadas. (Resolución 1070-2010 de las 9 horas 40 minutos del 3 de setiembre de 2010).
IV.El Tribunal en la sentencia combatida indicó, la protección de las zonas boscosas es tanto un deber de la Administración centralizada como de la descentralizada. Agregó, a efecto de proteger el derecho fundamental al ambiente sano y ecológicamente equilibrado, el ordenamiento establece una serie de mecanismos técnico jurídicos para la tutela efectiva de ese derecho. Mencionan los juzgadores, estas zonas se encuentran sujetas a su propia legislación (Ley Forestal), lo cual implica, que su administración compete al MINAE, a través del Sistema Nacional de Áreas de Conservación. Sin embargo, señalan, el IDA no estaba autorizado para conferir el título al momento de la solicitud, por cuanto, conforme a la Ley de Titulación de Tierras número 5064 del 22 de agosto de 1972, (en adelante Ley 5064) el entonces ITCO, estaba impedido para titular terrenos de bosque o de vocación forestal. En efecto, apuntan, por Decreto Ejecutivo número 11363-A, dictado el 24 de marzo de 1980, y publicado en el Diario Oficial La Gaceta número 74 del 18 de abril de 1980, se traspasó de forma gratuita al Instituto de Tierras y Colonización, un área de 160.000 hectáreas para crear el programa de titulación denominado "Limón 034".
Justamente, expresan, ese Decreto Ejecutivo se emitió con base en las leyes citadas y explicadas anteriormente (Ley Forestal número 4465 del 25 de noviembre de 1969 y Ley de Titulación de Tierras número 5064 del 22 de agosto de 1972). Asimismo, relatan, ese Decreto indica en su artículo 2 que: “El ITCO no otorgará títulos de propiedad en aquellas áreas que a juicio de la Dirección Forestal y de acuerdo con la Ley Forestal vigente, son o deban ser declaradas Reservas Forestales o de otra índole." Así, hacen notar los juzgadores, la normativa en cuestión prohibía, tal y como lo disponían las leyes que le sirvieron de sustento, que el ITCO titulara en zonas boscosas o de vocación forestal. Precisamente, refieren, como también se puede apreciar de las probanzas, ha existido bosque en el terreno adjudicado al codemandado Barrantes Solís desde 1960, por lo que éste ocupó esa propiedad existiendo cobertura boscosa.
También, aseveran, aunque se nota que en 1985 existió intervención humana en ese terreno, el bosque no dejó de existir. Adicionalmente, explican, aún en el supuesto de que el señor Bertilio Barrantes Solís, hubiese solicitado que se le titulara ese terreno entre los años de 1978 y 1985, el ITCO no podría haberlo hecho, ya que la legislación vigente en ese momento, prohibía la titulación en zonas boscosas o con vocación forestal. Añaden, del estudio del Instituto Geográfico Nacional, oficio número DEGEO-107-09 del 18 de agosto de 2009, se concluye que para 1998, no sólo seguía existiendo bosque en el terreno de examen, sino que el predio mostraba su regeneración en la zona de pastos. Esto es importante, dicen, porque demuestra que el terreno en cuestión se encuentra ubicado en un área montañosa, en la cual persiste el bosque cuando cesa la intervención humana. Adicionan los juzgadores, las conductas administrativas realizadas por el IDA, objeto de este proceso, también devienen nulas por otras razones.
Primero, por cuanto la titulación efectuada por la Junta Directiva del IDA a favor del codemandado Barrantes Solís, se sustentó en el RTRN, que fuera aprobado por la Junta Directiva en la sesión 055-02 del 12 de agosto de 2002. Este Reglamento, mencionan, fue declarado inconstitucional mediante resolución dictada por la Sala Constitucional –sentencia número 02063-07, de las 14 horas 40 minutos del 14 de febrero de 2007-. De lo anterior, aseguran los jueces, la titulación realizada por el IDA, a favor del codemandado Barrantes Solís, se sustenta en una normativa que dejó de existir dentro del bloque de legalidad, por lo que se encuentra viciada de nulidad absoluta, ello como consecuencia de la declaratoria de inconstitucionalidad en mención. De lo anterior, observa esta Sala, la tesis del Tribunal en cuanto a la nulidad de las conductas del IDA, no se basa únicamente en la declaratoria de inconstitucionalidad del RTRN, sino con anterioridad, en un hecho que se estima fundamental, cual es, que a la fecha de la solicitud de titulación planteada por don Bertilio – febrero de 2004-, el IDA se encontraba imposibilitado para conceder títulos en zonas boscosas o de vocación forestal, toda vez que la normativa vigente, entre la cual se incluye el Decreto 11363-A, lo impedían a esa data.
Adicionalmente, conforme al fallo de la Sala Constitucional 2063-2007, el cual anuló el RTRN, retrotrayendo sus efectos declarativos a su fecha de vigencia. De ahí que, si bien el cargo intenta establecer un supuesto error de los juzgadores al valorar cuál ente era el responsable directo del cuidado de las zonas forestales tituladas, (argumentando que mas que el IDA, era el MINAE), es indudable, el casacionista ataca una línea diversa a la que fundamenta el fallo. En efecto, sin dejar de lado que los jueces aclararon su posición en cuanto a que la Administración central como la descentralizada tienen la obligación de cuidar el ambiente, plantean como aspecto medular, la imposibilidad legal del IDA para conceder el título de examen. Ello, independientemente de que el fallo de la Sala Constitucional, hubiese sido dictado con posterioridad a la solicitud planteada por el señor Barrantes Solís, pues en efecto, el ordenamiento jurídico no se lo permitía.
Además, por cuanto dicha declaratoria de inconstitucionalidad, dimensionó sus efectos, a partir de la fecha de vigencia de esa regulación y sentando la responsabilidad del Estado. De lo manifestado, en cuanto a este punto específico, la casación no resulta útil, pues no combate el punto central del fallo, cual es, que la razón por la cual el IDA no podía otorgar un título en zonas boscosas, radica en que el marco normativo vigente a la fecha de la solicitud se lo impedía. Adicionalmente, y de importancia esencial para la resolución de este asunto, por cuanto el RTRN fue declarado inconstitucional, lo cual vicia de nulidad los actos del IDA dirigidos a la titulación de bienes de dominio público que se fundamentaron en ese Reglamento. Al haberse declarado inconstitucional, la sanción que impone el ordenamiento jurídico es la nulidad, al tenor del ordinal 88 de la Ley de la Jurisdicción Constitucional, el cual establece: “Las sentencias que declaren la inconstitucionalidad y pronuncien la anulación consecuente de la norma o los actos impugnados, producirán cosa juzgada y eliminarán la norma o acto del ordenamiento…”. De esta forma, la afirmación de la parte recurrente carece de fundamento fáctico y jurídico. Con base en lo expuesto, los vicios denunciados deben rechazarse.
V.La casacionista reclama asimismo, el Decreto 11363-A de 24 de marzo de 1980, fue derogado por el Decreto 34415-MAG, de 10 de abril de 2008, no obstante, apunta, los efectos de tal derogatoria no son los mismos que los de la declaratoria de inconstitucionalidad. Al respecto, el Tribunal argumentó, el Decreto 11363-A, del 24 de marzo de 1980, fue derogado por el Decreto 34415-MAG, publicado en el Diario Oficial La Gaceta número 70 del jueves 10 de abril de 2008. Agregan, este último autorizó además en su artículo 2º, al IDA, para que: “…mediante exhorto proceda a cancelar la inscripción en el Registro Público de las fincas: a) Partido de Limón, Folio Real 26501-000 (…)”. Refieren los jueces, tal derogatoria deja a la titulación realizada a favor del señor Barrantes Solís, sin sustento jurídico en su base, debido a que, a partir de ese momento, la propiedad originaria dejó de existir, junto con la norma que habilitó la titulación de ese terreno.
Indican los juzgadores, el Decreto 34415-MAG ordenó además al IDA iniciar los procedimientos para cancelar las inscripciones en el Registro Público que se generaron con el mandato que no fue atendido, ya que el referido Instituto, no gestionó en sede administrativa la nulidad del título. De lo expuesto, nota esta Sala, el recurrente pretende establecer una diferencia en cuanto a los efectos de la derogatoria del Decreto y los de una declaratoria de inconstitucionalidad, valoración que no viene al caso, pues tal diferenciación no ha sido objeto del fallo impugnado. Lo que en el caso concreto corresponde determinar, es la validez de la interpretación del Tribunal en cuanto a la ausencia de sustento jurídico de base para la titulación, mas no si la derogatoria de un decreto posee los efectos de una inconstitucionalidad, pues, se reitera, dicho aspecto no constituye un fundamento de la decisión recurrida.
En ese sentido, se observa, el Decreto 11363-A fue en efecto derogado por el 34415-MAG. Lo anterior tuvo lugar como consecuencia del fallo constitucional no. 02063-07, al solicitar el ente contralor mediante oficio DFOE-ED-7-2007 de fecha 15 de marzo de 2007 al Poder Ejecutivo, la derogatoria de varios Decretos, entre ellos el 11363-A (resultando III del Decreto en cuestión). En consecuencia, ese Decreto fue efectivamente derogado, encomendándose al IDA solicitar mediante exhorto, la cancelación de la inscripción de varias fincas entre las cuales se encuentra la que motiva este proceso. De lo expuesto, es indudable, la titulación del bien, como argumenta el Tribunal carece de sustento jurídico de base, mas, no solo porque la norma que dio pie al traspaso de los terrenos del Estado al IDA (Decreto 11363-A), fue derogada, sino además, en virtud de la inconstitucionalidad previa declarada del RTRN y en tanto lo impedía la Ley del ITCO no. 5064. De ahí que existiera una imposibilidad para el IDA de otorgar títulos en zonas de Reserva Nacional.
VI.Finalmente, debe acotarse, no son de recibo los reclamos en cuanto a supuestas omisiones del Tribunal, al dejar de establecer que el Decreto 11363-A es un acto válido y eficaz y que el artículo 31 de la Sesión 005-05 es un acto administrativo válido emitido por el IDA dentro del ámbito de sus funciones y competencia. En opinión de este órgano decisor, si bien en su momento surtieron efectos jurídicos, permitiendo el traspaso de bienes al IDA y su posterior segregación a favor de terceros, no se discute que los efectos de la inconstitucionalidad del RTRN fueron retrotraídos al momento de la emisión de los actos afectados, sin perjuicio de la responsabilidad que en ese sentido implicara para el Estado. De tal forma, no basta tampoco el argumento en el sentido de que el IDA es una institución autónoma creada por ley, cuyo marco de competencia le otorga la administración a cargo del Estado de las “reservas nacionales”, ni que los actos declarados nulos hayan sido emitidos en forma injustificada por el IDA, puesto que es claro que como tal, también está supeditado al principio de legalidad.
Por ende, de la normativa vigente a la fecha, no existía la posibilidad de conferir títulos en zonas de Reserva, toda vez que, tanto el Decreto que trasladó bienes del Estado al ITCO, como el Reglamento que permitió el traspaso a favor del señor Barrantes Solís, dejaron de existir en la vida jurídica. Como último aspecto, en cuanto al reclamo del IDA, en el sentido de que el Tribunal le condena en daños y perjuicios por haber titulado en áreas respecto de las cuales, no tenía el deber de desalojar y custodiar, estima este órgano decisor, según expresaron los juzgadores, la condena en abstracto, obedece a que existió un funcionamiento anormal que debe ser indemnizado a favor del Estado. En esa línea, es indudable, el IDA tituló parcelas en el dominio pública, a pesar del impedimento que pesaba en ese sentido, situación que coloca esas conductas, al margen de toda legalidad. En consecuencia, no se observa que el Tribunal se haya extralimitado al condenarle al pago en abstracto de daños y perjuicios.
En igual sentido, lo indicado respecto a que el Tribunal no consideró que el terreno ha estado en posesión de particulares, lo cual no resulta un reclamo atendible ante esta Sala, por ser la Ley Forestal clara, en el sentido de que se trata de bienes inalienables, cuya posesión por particulares no causará derecho alguno a su favor, siendo imprescriptible la acción reivindicatoria del Estado (Sentencia 1070-2010 de las 9 horas 40 minutos del 3 de setiembre de 2010).
Recurso de Bertilio Barrantes Solís
VII.En el primero de los dos cargos de fondo admitidos, reclama indebida valoración probatoria. Alega, el Tribunal consideró que el terreno descrito en el plano catastrado L-908302-2004, es patrimonio natural del Estado. Dice, lo anterior conforme al estudio DEGEO-107-09 del 18 de agosto de 2009 elaborado por el Instituto Geográfico Nacional (en adelante IGN), en el cual se expone, es clara la existencia de bosque en el lugar desde 1960 y una variación posterior en el uso de suelo. Así, menciona, los jueces señalaron, que el área que en 1960 era de bosques, en 1985 fue transformada a pastos y caminos, regenerando el área forestal en 1998. No obstante, expresa, el Tribunal no menciona que el material fotográfico utilizado por el IGN no fue elaborado en el terreno, por lo que solo permite una ubicación aproximada, sin que pueda ser considerado como prueba. Esgrime, en su reconocimiento, el Tribunal encontró área de bosque, asimismo, que las zonas de potrero están abandonadas y que el acceso es dificultoso, por lo que consideró difícil la actividad agrícola en este lugar.
Lo anterior, asevera, corresponde a criterios de valor esgrimidos por el Tribunal, toda vez que a efecto de constatar esos elementos, no se hicieron acompañar de un técnico que explicara cómo se desarrolla la vida en esa zona rural. Además, apunta, el reconocimiento se realizó más de un año y cuatro meses después de que se otorgara la medida cautelar que le impide acceder al inmueble, circunstancia que generó la regeneración natural del bosque. Asegura, similar situación ocurre respecto del contenido del oficio DST-023-10 del 27 de enero del 2010, el cual, también fue acatado más de un año y cuatro meses después de otorgarse la medida cautelar, por lo que los jueces se equivocan al concluir que casi un 90% del terreno es de bosque, ya que ello es consecuencia de la regeneración provocada por la medida cautelar. Arguye, el informe DST-023-10 no era un requisito de admisibilidad al momento en que el IDA atendió su solicitud de titulación, ocasión en la cual solo se requería la certificación del MINAET haciendo constar la no afectación de áreas silvestres.
Aduce, es inaceptable que el Tribunal no examinara las pruebas testimoniales de Morales Castro y Padilla Brenes, quienes indicaron que Bertilio cuenta con mas de 30 años de posesión del bien. Acusa, tampoco se valoró el informe pericial rendido por el Ing. Francisco Herrera Chavez, según el cual, sus colindancias norte y sur, corresponden a fincas agrícolas, que el predio tiene cercas conformadas por postes vivos y muertos, que los carriles se mantienen definidos y se puede transitar sin problema, que las áreas de potrero evidencian falta de mantenimiento de un período de un año y otros datos que evidencia la posesión de Bertilio. Finalmente, resalta, las fincas colindantes no se encuentran dentro de ninguna área silvestre protegida, revistiendo naturaleza agrícola. En el segundo reproche, argumenta, indebida aplicación de normas sustantivas. Expresa, los jueces resaltan el hecho de que, para el año 1980, -fecha cuando el Estado traspasó los terrenos al IDA-, regía la Ley Forestal no. 4465 de 25 de noviembre de 1969 (en lo sucesivo Ley 4465), por lo que ese Instituto estaba inhibido para otorgar títulos en áreas de bosque o de vocación forestal.
No obstante, no reparan en que es el mismo Estado quien delegó en el IDA los programas de titulación. Agrega, debe tomarse en cuenta que si bien la Ley 4465 data de 1969, la Ley de Informaciones Posesorias no. 139 de julio de 1941, permitía la titulación en áreas silvestres protegidas, cuando el promovente contara con 10 años de posesión. Adiciona, por esas razones, el Tribunal sostiene erróneamente que en el terreno de examen la posesión resulta improcedente, al estar afectado al patrimonio natural del Estado. Agrega, los jueces aducen que de acuerdo a las leyes 4465 del año 1969 y la 7575 de febrero de 1996, no aplica la prescripción positiva, en virtud de la naturaleza del bien, ni podían esas tierras ser objeto de los programas de titulación del IDA. Argumenta, tuvo que recurrir al IDA para titular, puesto que, al estar registrado el inmueble a nombre de ese Instituto, se le imposibilitaba acudir al proceso de información posesoria.
Explica, los preceptos 13, 14 y 15 de la Ley 7575, modificaron la Ley de Informaciones Posesorias de 1941 (artículo 7), permitiendo la titulación de áreas silvestres protegidas, cualquiera que sea su categoría de manejo. Por ello, menciona, la pretensión de nulidad del artículo 31 de la sesión 055-05, no puede declararse sin desconocer sus derechos subjetivos, máxime cuando el Estado ha permitido la titulación de tierras con bosque (cita jurisprudencia del Tribunal Agrario en apoyo de su tesis). Sintetiza, los jueces no entran a valorar la tesis planteada, en cuanto a que los poseedores de tierras con bosque o vocación forestal pueden tener derecho a un título inscribible de propiedad, conforme a la norma 7 de la Ley de Informaciones Posesorias, por el contrario, violenta la categorización que incluye el ordinal 32 de la Ley Orgánica del Ambiente no. 7554 de 4 de octubre de 1995 (en adelante LOA).
Lo anterior, resalta, por cuanto, la Ley 7575 modifica el precepto 7 de la LIP, permitiendo la titulación de tierras con estas características. Además, arguye, porque el numeral 46 de esa Ley, creó el Fondo Nacional de Financiamiento Forestal (en lo subsiguiente FONAFIFO), para incentivar la protección de las áreas boscosas mediante el pago de servicios ambientales. De ahí que, aduce, ese cuerpo colegiado haya hecho una interpretación sesgada de la prueba, ignorando que es legalmente posible titular las áreas con bosque o vocación forestal, pues hay normativa que así lo permite.
VIII.En cuanto al primer reproche, atinente a una indebida valoración probatoria, el Tribunal efectivamente tuvo por demostrado conforme al estudio DEGEO-107-09 del 18 de agosto de 2009 elaborado por el IGN, la existencia de bosque en el lugar desde 1960 y que no obstante, se mostró una variación alrededor del año 1985, que incluyó pastos y caminos, se evidenció la regeneración del área boscosa hacia 1998. Tal aseveración, dicen los jueces, se ve reforzada por el reconocimiento realizado en el lugar el 22 de enero del 2010, conforme al cual concluyeron, que por su difícil acceso, abandono y exhuberancia forestal, el bien no es apto para la agricultura. Estima esta Sala, si bien el recurrente asegura, que esas afirmaciones corresponden a meros juicios de valor puesto que el reconocimiento se realizó varios meses después de otorgada la medida cautelar, que le impedía el acceso al lugar, lo cual permitió una regeneración del bosque, se observa, la casación no es útil.
Aunque el casacionista afirma que los oficios DEGEO-107-09 y DST-023-10 y otras probanzas fueron incorrectamente apreciados por los jueces, debe hacerse notar, de acuerdo a lo resuelto en el considerando III, que lo que interesa no es la existencia o no de bosque en la zona, puesto que la nulidad del traspaso es consecuencia de la declaratoria de inconstitucionalidad del RTRN y de la derogatoria del Decreto Ejecutivo 11363-A, que originalmente traspasó los terrenos al ITCO. De tal forma, lo alegado no alcanza a quebrar el fallo, lo que obliga a su rechazo.
IX.En el segundo reproche, el recurrente argumenta indebida aplicación de normas sustantivas, porque estima los jueces resaltan el hecho de que, para el año 1980, -fecha cuando el Estado traspasó los terrenos al IDA-, regía la Ley Forestal no. 4465 de 25 de noviembre de 1969 (en lo sucesivo Ley 4465), por lo que ese Instituto no podía otorgar títulos en áreas de bosque o de vocación forestal. No obstante, dice, no reparan los jueces en que es el mismo Estado quien delegó en el IDA los programas de titulación. Agrega, no se valoró que la LIP permitía desde 1941 la titulación en áreas silvestres protegidas, cuando el promovente contara con 10 años de posesión, ni que el FONAFIFO promueve la conservación de zonas forestales. Al respecto, estima esta Sala, en cuanto a la imposibilidad para otorgar títulos en áreas forestales, debe estar el recurrente a lo dispuesto en el considerando IV de esta resolución.
Conforme se indicó, no solo impedía la Ley del ITCO no. 5064 la titulación objeto de examen, sino que además, la titulación del bien carece de sustento jurídico de base, toda vez que la norma que dio pie al traspaso de los terrenos del Estado al IDA (Decreto 11363-A), fue derogada y declarado inconstitucional el Reglamento a través del cual ésta fue tramitada por el IDA. Igualmente, en cuanto reclama, fue el propio Estado quien le delegó la facultad de titular tales bienes, remítase la parte a lo expuesto en el considerando V de esta resolución, conforme al cual, indicó este órgano decisor, tal situación no exime al IDA de su obligación de apegar su conducta al marco de legalidad imperante. Finalmente, en cuanto a su criterio, de que la LIP permitía desde 1941 la titulación en áreas silvestres protegidas, cuando el promovente contara con 10 años de posesión, el Tribunal indicó, cuando un terreno es Patrimonio Natural del Estado, este es inembargable, imprescriptible e inalienable.
Esto significa, opinan los jueces, que se encuentra fuera del comercio de los “hombres” según lo disponen los numerales 261, 262 y 263 del Código Civil. Por ello, ratifican, no es válido alegar prescripción positiva o adquisitiva, lo cual descarta la tesis de la titulación a través de los mecanismos de la LIP, sin que exista tampoco un plazo extintivo oponible para que el Estado o sus instituciones soliciten judicialmente la reivindicación de esos terrenos. Al respecto, enfatiza esta Cámara, como se indicara en los considerandos III, IV y V de este fallo, la zona donde se tramitó la titulación, es un área boscosa de interés forestal, que si bien fue traspasada por el Estado al IDA para efectos de titulación, presenta todas las características de un bien que forma parte del dominio público, lo cual impide que respecto de aquel, fuera tramitado un proceso de información posesoria al amparo de la LIP.
Se trata en efecto de bienes inalienables e imprescriptibles, que no podían ser objeto de ocupación para efectos de ser titulados, toda vez que su naturaleza es evidentemente forestal, lo que obliga al rechazo del cargo. Conforme a lo anterior, la invocación del FONAFIFO, como elemento argumentativo, a efecto de establecer la posibilidad de titular aquella finca, tampoco es de recibo, pues se está ante bienes del dominio público, que por su naturaleza, se reitera, no podían poseerse con la finalidad de obtener una prescripción positiva.
Recurso del Estado
X.Esgrime el casacionista, el ordinal 193 del CPCA señala la obligación de condenar al vencido en las costas del proceso, permitiendo a su vez exonerarle por vía de excepción. De tal forma, agrega, cuando tal exoneración tenga lugar, los jueces deben motivar el fallo. Expresa, en el caso de interés, el Tribunal exoneró del pago de costas al reconventor Barrantes Solís, no obstante haber declarado sin lugar su contrademanda, sin que se justifique la razón de ese proceder, pues afirma, los jueces no brindan ninguna razón que acredite la existencia de buena fe procesal. Así, menciona, la sentencia carece de motivación, causándole indefensión toda vez que imposibilita conocer y combatir los criterios que tuvieron los jueces para conceder este extremo. Agrega, en el caso de que se estimara que el considerando II de la sentencia constituye el motivo para exonerar, se estaría en presencia de una violación directa de ley, por falta de aplicación del inciso a) del cardinal 193 del CPCA, e indebida aplicación del inciso b del mismo numeral.
XI.El canon 193 inciso b) del CPCA establece la posibilidad para el Tribunal, de exonerar en costas cuando a su juicio, haya existido motivo bastante para litigar. En el caso concreto, los jueces estimaron que correspondía extender esta exoneración a don Bertilio, por cuanto su actuación fue de buena fe. Al respecto, nota esta Sala, las posibilidades del señor Barrantes Solís en cuanto a evitar este proceso, se vieron limitadas por diversas variables. Por una parte, se encontraba impedido para tramitar una información posesoria toda vez, que el bien que poseyó, estaba comprendido en una finca propiedad del IDA. Del mismo modo, se acogió para efectos de titulación, a los requisitos y valoraciones que en ese sentido emitió el Instituto en mención, el cual acogió su requerimiento para titular los terrenos en cuestión. Tal circunstancia no puede interpretarse como una actuación de mala fe de su parte, pues según se ha evidenciado, el IDA tramitó otras solicitudes similares a la suya, sosteniendo ese Instituto incluso ante esta instancia, que sus actuaciones han sido válidas y apegadas a la ley, de ahí que no existiese motivo para que razonablemente don Bertilio hubiese considerado que su defensa en el proceso era innecesaria.
De tal forma, se reitera, el codemandado no accionó, sino que fue traído al proceso, en ese tanto, y conforme a lo expuesto, tuvo motivo suficiente para oponerse al litigio en su contra, pues actuó conforme a las regulaciones dispuestas por el IDA a efecto de titular el bien objeto de este proceso, resultando por ello como parte demandada. De ahí que, a pesar de ser escueta, no se estime inadecuada la exoneración en costas brindada por el Tribunal al considerar que el señor Barrantes Solís actuó de buena fe. Por consiguiente, el reproche debe ser rechazado.
POR TANTO
Se declaran sin lugar los recursos, con las costas a cargo de quienes lo interpusieron.
