Ordinary proceeding (proceso ordinario) brought before the Agrarian Court of Liberia by ENTRE MARES E ISLAS SOCIEDAD ANÓNIMA, represented by its president and treasurer, both vested with unlimited general powers of attorney (poderes generalísimos sin límite de suma), Jacques Cloutier, a Canadian national, passport no. 044710111, single, builder, resident of the United States, and Manuel Burgos Sáenz, economist; against DARK CAVE D C SOCIEDAD ANÓNIMA, represented by its president, vested with an unlimited general power of attorney, Federico Chacón Castro, single, businessman, resident of Guanacaste. Also appearing as special judicial counsel (apoderado especial judicial) for the respective parties are attorneys Mauricio Rodríguez Méndez, resident of San Ramón, and Mario Alberto Piña Líos, whose marital status is not stated. The natural persons are of legal age and, subject to the exceptions noted, married, attorneys, and residents of San José.

BACKGROUND 1. Based on the facts it alleged and the legal provisions it cited, the plaintiff company filed an ordinary complaint, seeking a judgment declaring: “1 The absolute nullity of registered survey plan No. (sic) G-672530-2000 used in the possessory information proceeding (información posesoria) of Drak Cave D C S.A. No. (sic) 01-000393-387-AG, before the Agrarian Court of Liberia, because it overlaps and encroaches upon plan No. (sic) G-695623-2001, previously recorded in the National Cadastre, with the appropriate notice to be given to the National Cadastre for enforcement. 2 The absolute nullity of the possessory information proceedings in case file No. (sic) 01-000393-387-AG, before the Agrarian Court of Liberia, initiated by Dark Cave D C S.A., because they seek to register, as part of the property being titled, a portion of the property recorded in the Public Property Registry under registration number 22506-000, Guanacaste District, owned by Entre Mares e Islas S.A. The clerk of the Agrarian Court shall be notified so that the appropriate entries may be made in the cited case file. 3 The restitution of the portion of property No. (sic) 22506-000, Guanacaste District, usurped by Dark Cave D.C.

S.A., to its lawful owner, Entre Mares e Islas S.A., in accordance with the overlap sketches submitted herein and the original location of the fences according to plans G-503693-1998 and G 695823-2001. The police force shall be commissioned to place it in possession. 4 The restoration of the fences and boundary markers (mojones) to their former locations with respect to the area of which its principal, Entre Mares e Islas S.A., was dispossessed, the cost of which shall be paid by the defendant, Dark Cave D C S.A., as determined during enforcement of the judgment (ejecución de sentencia). 5 An order requiring Dark Cave D C S.A. to pay Entre Mares e Islas S.A. the damages caused by the destruction of the natural environment in the usurped area and the cost of its restoration, as determined during enforcement of the judgment. 6 An order requiring Dark Cave D C S.A. to pay both categories of costs (ambas costas) in this action.” 2.

The defendant denied the complaint and raised the defenses (excepciones) of lack of a legal right, lack of standing, and the statute of limitations, as well as the general plea of “sine actione agit.” 3. The defendant company filed a counterclaim (reconvención) against the plaintiff, seeking a judgment declaring: “1. That this counterclaim against Entre Mares e Islas S.A. be deemed duly filed. 2. […] that this counterclaim be granted in all respects. 3. […] that plans G- 503.693-98 and G-695.623-2001 were improperly prepared because they do not faithfully reflect the information in the surveyor’s field record (protocolo topográfico) from which they originated. 4. […] that plans G- 503.693-98 and G-695.623-2001 are absolutely null because they do not reflect the physical reality of the properties they purport to describe and that, consequently, their registration must be canceled. 5. […] that plan G-672.530-2000, which describes its principal’s property, has neither invaded nor overlapped whatsoever with plans G- 503.693-98 and G-695.623-2001 of the plaintiff and counterclaim defendant. 6.

That the possessory information proceeding being processed under case file No. (sic) 01-000393-387-AG-3 before this same court be allowed to continue until a decision on the merits is issued. 7. […] that any potential right the counterclaim defendant might have over the portion it seeks to portray as its property is time-barred and, therefore, it has no right to assert any claim. 8. That the portion of land at issue in this counterclaim remain in the possession of Dark Cave D.C. S.A. 9. That the counterclaim defendant be ordered to pay both categories of costs.” 4. The plaintiff and counterclaim defendant responded as set forth at folios 471 through 475, without raising any defenses.

5. Judge Rodrigo Valverde Umaña, in judgment no. 133-S-2009 at 8:00 a.m. on 9 September 200, ruled: “With respect to the (sic) principal complaint, the DEFENSES of lack of a legal right and lack of standing are GRANTED. Because it is unnecessary, no ruling is made regarding the remaining defenses. Accordingly, the PRINCIPAL COMPLAINT IS DISMISSED IN ALL RESPECTS. WITH RESPECT TO THE COUNTERCLAIM, this COUNTERCLAIM AGAINST ENTRE MARES E ISLAS S.A. is declare (sic) GRANTED, in the manner set forth below, and is understood to be denied insofar as relief is not awarded:

  • 1)Plans G- 503.693-98 and G-695.623-2001 were improperly prepared and are absolutely null because they do not faithfully reflect the information in the surveyor’s field record from which they originated and do not reflect the physical reality of the properties they purport to describe; consequently, their registration must be canceled once (sic) this decision becomes final.
  • 2)that (sic) plan G-672.530-2000, which describes the property of the defendant and counterclaim plaintiff, has neither invaded nor overlapped whatsoever with plans G- 503.693-98 and G-695.623-2001 of the plaintiff and counterclaim defendant.
  • 3)Once this judgment becomes final, the possessory information proceeding being processed under case file No. (sic) 01-000393-387-AG-3 before this same (sic) court is ordered to continue until a decision on the merits is issued.
  • 4)The portion of land at issue in this counterclaim shall remain in the possession of Dark Cave D.C. S.A.
  • 5)The plaintiff and counterclaim defendant is ordered to pay both categories of costs in this action.” 6. The plaintiff and counterclaim defendant appealed, and the Agrarian Tribunal of the Second Judicial Circuit of San José, composed of Judges Enrique Ulate Chacón, Antonio Darcia Carranza, and Carlos Picado Vargas, in judgment no. 0728-F-11 at 4:09 p.m. on 18 July 2011, ruled: “In view of all the foregoing, the judgment must be AFFIRMED.” 7. Attorney Mauricio Rodríguez Méndez, acting in the capacity stated above, files an appeal in cassation (recurso de casación), expressly stating the grounds on which he relies to challenge the position adopted by the lower Tribunal.

8. The statutory requirements have been observed in the proceedings before this Chamber.

CONSIDERATIONS

I.Entre Mares e Islas S.A. (hereinafter Entre Mares e Islas), in its complaint against Dark Cave DC S.A. (hereinafter Dark Cave), stated that it owns the property in Guanacaste, registration no. 22506-000, located in Santa Elena, canton of La Cruz, for which registered survey plan G-0695623-2001 exists and which amended plan no. G-503693-1998. It stated that the defendant acquired from Eladio Ponce Lara and Lemin Over Ibarra Lara the rights arising from the possessory information proceeding being processed under case file no. 01-000393-387-AG, the land being described in registered survey plan no. G-672530-2000. It asserted that, although its land borders to the southeast the property that is the subject of the possessory information proceeding, the petitioners in that proceeding concealed that fact from the Court. It further explained that, in November 2000, the parties pursuing that titling proceeding, now Dark Cave S.A., prepared registered survey plan G-672530-2000, including a portion of its parcel measuring approximately two and a half hectares.

It stated that Geotop Centroamericana Ltda. prepared a study demonstrating that the plan from the possessory information proceeding overlaps the plans for its property. It noted that, between July and August 2005, the fences dividing the two properties in the area of overlap were removed; that area was invaded and retained by the defendant, which remains in possession to date while also destroying the site’s vegetation and natural beauty. It argued that this prompted its objection to the titling proceeding, as a result of which the proceeding was stayed and the parties were ordered to resolve the matter through a declaratory proceeding (proceso declarativo). It seeks a judgment declaring: a) plan G-672530-2000 null because it overlaps plans G-503693-1998 and G-695623-2001, which describe its property; b) the possessory information proceeding, case file 01-000393-387-AG, null because it seeks to register a portion of its land; c) restitution of the usurped portion and restoration of the removed fences and boundary markers to their former locations, all at the defendant’s expense; d) that the defendant be ordered to pay damages and both categories of costs.

The defendant denied the complaint. It raised the defenses of lack of a legal right, lack of standing, the statute of limitations, and the general plea sine actione agit. It filed a counterclaim seeking a judgment declaring that: a) plans G-503693-1998 and G-695623-2001 were improperly prepared and do not faithfully reflect the surveyor’s field record from which they originated, and are therefore null; b) its plan G-672530-2000 does not overlap the aforementioned plans; c) the possessory information proceeding shall continue; d) any right held by the counterclaim defendant over the portion it claims is time-barred; e) it shall remain in possession of the disputed land; and f) both categories of costs shall be borne by the counterclaim defendant. The plaintiff and counterclaim defendant denied the counterclaim. It raised no defenses. The Court granted the defenses of lack of standing and lack of a legal right.

It dismissed the complaint and granted the counterclaim. It declared plans G-503693-98 and G-695623-2001 null and held that plan G-672530-2000 does not overlap the aforementioned plans. It ordered the possessory information proceeding to continue and the disputed area to remain in the possession of the defendant and counterclaim plaintiff. It imposed both categories of costs on the plaintiff and counterclaim defendant. The Tribunal affirmed. Dissatisfied, the plaintiff seeks cassation review.

II.The appellant offers as evidence for the court’s better determination (prueba para mejor proveer) the photograph appearing at folio 671, “but enlarged, in three photographs, with a note from Engineer Manuel Villegas Rodríguez. As well as the disk provided by PRIAS, of CENAT, on which the aforementioned photograph appears,” and requests a hearing procedure (trámite de vista). Furthermore, it should be noted that the guideline governing the admission of evidence at the cassation stage (etapa de casación) is that set forth in Article 609 of the Code of Civil Procedure (Código Procesal Civil; hereinafter, CPC), which states verbatim: “Prohibition on the admission of evidence. No evidence may be offered or admitted before the Cassation Chamber (sala de casación), nor shall it be permitted to admit any evidence for the court’s better determination, unless it consists of public documents that have an effective bearing on the decision of the dispute (litis), provided that they appear in the case record or were submitted with the appeal or with the brief expanding the appeal....” In other words, evidence that fails to meet the requirements established therein shall not be admitted.

It is also clear that the photograph offered already appears in the case record (expediente), and therefore its admission is improper and it must be rejected because it does not fall within the circumstances described by that provision. Likewise, it must be noted that, pursuant to Articles 6 and 61 of the Agrarian Jurisdiction Law (Ley de la Jurisdicción Agraria; hereinafter, LJA) and Articles 556 through 562 of the Labor Code (Código de Trabajo), a hearing procedure is not provided for in matters such as this one and must therefore be denied.

III.Although an indistinct series of grievances is intermingled in the appeal (recurso), an analysis of the challenge raised shows that it actually consists of four claims. In the first, she alleges a violation of Articles 2 and 23 of the LJA and provision 104 of the CPC. She argues that the defendant-counterclaimant seeks the nullification of two survey plans for her registered property without having raised a dispute over possession of the area at issue, and therefore there is no basis for the judgment to rule in those terms. She maintains that no ownership dispute was raised either, because the portion of the property that is the subject of the disagreement belongs to her both materially and of record. She asserts that the foregoing is supported by the property’s registration and the plans describing it, G-503693-98 and G-695623-2001, which, according to the expert appraisal (peritaje) conducted, include the disputed portion.

She states that although the counterclaimant merely alleges an error in the plans held by her, claiming that they were improperly prepared because they do not reflect the actual conditions of the land, the Court held in its judgment that the requirements for granting the recovery-of-ownership action (acción reivindicatoria) were not met. It thus nullified the plans on the basis of the defendant’s superior possessory right (mejor derecho de posesión), even though the defendant had not placed that issue in dispute. She argues that a right of possession (derecho de posesión) cannot prevail over her registered ownership when adverse possession (usucapión) has not been alleged. She recounts that the counterclaimant’s claim is based solely on the existence of plan G-672530-2000, prepared when Mr. Ponce Lara and Mr. Ibarra Lara were not the lawful possessors of the land. She specifies that the defendant also altered the conditions of the disputed area with machinery and constructed terraces in order to take possession of it.

She emphasizes that there is a closure error (error de cierre) in the plan that does not give the defendant standing to have her claim granted. She concludes that the defendant-counterclaimant lacks standing to sue (legitimación activa), because she does not seek to establish the real or personal right that justifies her action. In the second ground of challenge, she alleges a violation of provisions 153(3) and 154 of the CPC and provision 45 of the LJA, because no ruling was issued on all the matters in dispute. She states that if no possessory rights are claimed in the counterclaim and no ruling has been made regarding the extinctive prescription (prescripción negativa) of her right to bring an action, the court below (A quo) cannot grant the counterclaim. In the third objection, she alleges improper assessment of the evidence and a breach of the principles of law and equity in the reasoning supporting the judgment.

In essence, she refers to a series of acts by the defendant-counterclaimant which, in her view, show that the latter acted in bad faith by invading and taking possession of the overlapping land, possession that she retains to this day. Among them, she mentions the following: the defendant attempted to conceal her occupation of the overlapping segment and its inclusion in the possessory information proceeding (proceso de información posesoria), without identifying her as an adjoining landowner. She states, however, that the Court did not properly assess this because it found that there had been no unlawful dispossession (desapoderamiento ilegítimo), since the land belonged to the defendant. She further emphasizes that during the judicial inspection (reconocimiento), it was possible to observe that the boundary in the disputed area had been removed and terraces had been constructed with a tractor.

Nevertheless, she continues, the record did not include either the presence of the surveyor or the statements concerning the location where the fence had previously stood. She asserts that pages 670 and 671 show the overlap at issue and the duly demarcated area, where the fence had previously stood, together with the grove and vegetation that were destroyed a few months later. She argues that the photograph was taken in March 2005, when the counterclaimant used special machinery to alter the nature of the land. Regarding the facts deemed proven, she identifies several contradictions. As to the first, she notes that the trial judge found that her property corresponds to plan G-0695623-2001 and is registered under property number 225506-000, from which her standing to bring the recovery-of-ownership action concerning the portion of land at issue derives. Nevertheless, in recital (considerando) IV, the A quo states that she was unable to prove clearly and conclusively that she was the registered owner of the land in dispute, a finding she considers unfortunate.

As to the second, she alleges that deed 142, by which Jimmy Rodríguez Montero donated to Eladio Ponce Lara and Lemin Over Ibarra Lara, appears at page five and cannot be included as a proven fact because it contains statements by the parties. She states that although the defendant’s plan is said to date from 2000, in the names of Ponce Lara and Ibarra Lara, it is subsequently stated that in January 2001 Margarita Lara Salgado transferred possession to them, which is paradoxical. Additionally, she recounts that the application for possessory information (información posesoria) states that they had already possessed the property for 10 years, a claim drawn from deed no. 142. In her view, the testimony of witness Ricardo Bonilla establishes that Margarita Lara Salgado sold the disputed land to Federico Chacón, a circumstance the Court did not analyze. Regarding the third fact deemed proven, she states that the A quo failed to indicate that an objection had been filed in possessory information case file 01-000393-0387-AG, which, in her opinion, shows that the judges did not regard that objection as an important event.

With respect to the fourth fact deemed proven, she argues that although reference is made to deed no. 276 executed before notary Duarte Arauz, concerning the transfer of possession from Ponce Lara and Ibarra Lara to Dark Cave, it is not disclosed that the same document established “reservations” in favor of the purchaser in the event that superior rights over the property were ultimately declared. Regarding the fifth fact, she states that it is untrue that Dark Cave took possession of the property when it purchased the rights, because in answering the complaint it acknowledged that it had performed work in the disputed area during July and August 2005. She adds that although she offered several sworn statements as evidence to assist adjudication (prueba para mejor resolver), they were rejected, despite recording that Amancio Peña Carmona saw the fences along Federico Chacón’s boundary being removed.

She states that this declaration, appearing at page 677, was made two days before Dark Cave acquired the overlapping land, at a time when Federico was already recognized as its owner. She emphasizes that this is why the document selling possession to Dark Cave included a condition subsequent (condición resolutoria) providing that the work would be performed first and the transfer would occur afterward. Additionally, she states that deed no. 13, at page 678, contains a sworn statement by José Delgado Requene revealing that the fence posts on that property were cut with a chainsaw when the terraces were constructed; however, the Court rejected it as evidence to assist adjudication. Regarding the sixth fact, she contends that the A quo gave excessive weight to the expert appraisal submitted by Mr. Aquiles Chaves Arroyo, even though evidence in the record refutes that professional’s conclusions.

She states that the appraisal cannot be treated as conclusive evidence (plena prueba), because the document issued by surveyor Manuel A. Villegas Rodríguez shows that the closure error in the supporting traverse (poligonal de apoyo) is only three centimeters, producing an error of approximately 14 meters in the recorded survey plan (plano catastrado). She further states that this was corroborated by the testimony of Franklin Carazo Serrano, who explained that the displacements in the plan are insignificant and do not affect the measurement of the area because they are small and acceptable closure errors. She also asserts that although the appraisal states that no overlap exists, it subsequently calculates that area. Likewise, she notes that it states that the disputed areas do not correspond to any registered property and that the plans date from their registration in the cadastre, without verifying the dates mentioned in the survey protocols (protocolos de levantamiento), which are inconsistent.

She emphasizes that item four of the expert appraisal acknowledges the overlap with the plan of a registered property while simultaneously asserting that the area is not part of that property. In this regard, item 7, at page 579, contains a filing by her principal noting that the protocol pages for plan G-503693-98 are written in “handwriting,” apparently in blue ink, making them less legible; the judge was therefore asked to require Mr. Aquiles to transcribe the numbers on which he relied to determine the closure error. Nevertheless, when questioned by the A quo, he stated that he had relied on “…the information contained in the Surveyor’s Protocol survey on the different pages…,” meaning that he did not clarify the matter, yet the A quo still deemed the order complied with. She further states that when the expert was asked whether the closure error could occur in another part of the plan, he answered that although it causes the overlap, it could also occur elsewhere in the plan, thereby acknowledging the existence of the overlap.

She states that although engineer Carazo found a closure error of 27 centimeters, this prompted no questions from the A quo. She adds that the Court deemed the physical and geographical characteristics of the property established “in situ,” corresponding to the material and cartographic reality of the property described, which, she says, resulted from the changes made by the defendant to the disputed area. Regarding the seventh proven fact, she considers it inconsistent with the first fact deemed proven, since the latter first states that property 22506-000 corresponds to recorded survey plan G-0695623-2001, as demonstrated by the report of Geotop Centroamericana Limitada. She adds that the reports submitted by Geotop were not assessed by the judges. Regarding the eighth fact, she states that the plan conforming to the actual conditions is G-672530-2000, referring to page 579, a document that she asserts does not correspond to that plan.

She states that the A quo did not analyze the report prepared by Consultec concerning the environmental damage caused, appearing at pages 275 to 354. Regarding the sworn statement of Amancio Peña Carmona appearing at page 677, she asserts that he reported the damage done to the fence, from which she concludes that he later lied in his trial testimony when he stated that the disputed area had been used by doña Margarita’s children to grow corn and beans, which is incompatible with the defendant’s answer stating that the disputed area had not been used for agricultural or livestock purposes. Regarding the ninth fact deemed proven, it is likewise stated that the land was used for chaguite production and agriculture, which is inconsistent with the answer to the complaint. With respect to the tenth fact, she notes that it again relies on statements by witness Peña Carmona, who reported the damage to the boundary and later changed his account at trial.

That statement is therefore questionable, since he asserts that Margarita’s children cultivated an area where the defendant herself acknowledges that there was no agricultural production. She states that the eleventh fact, concerning the existence of a house, is false. Finally, she argues that the reference in the twelfth fact to the maintenance of the fences is accommodating. In the fourth objection, she alleges a violation of Article 45 of the Constitution and provisions 264, 266, 267, 295, and 296 of the Civil Code. She states that, according to proven fact number one, her principal owns the Guanacaste property registered under property number 22506-000, which is fully identified by plan G-0695623-000.

She adds that the defendant has standing to be sued (legitimación pasiva), insofar as the respondent’s survey plan (plano) overlaps the property, and the respondent also altered the boundaries, seeking to register part of the defendant’s property as her own.

IV.In her first challenge, the appellant in cassation focuses her claim on the alleged lack of standing (legitimación) of the defendant-counterclaimant. She insists that, in her counterclaim, the defendant does not seek to establish the real or personal right that justifies her action, since she did not raise a dispute over possession of the area at issue. The Court stated that, if the claim was based on an action for recovery of ownership (acción reivindicatoria), it is evident that the counterclaim defendant has both active and passive standing, and that her defenses and claims are intended to defeat the action for recovery of ownership. The judges added that her standing lies precisely in having a legal relationship with the relief sought in the proceedings. Such standing is conferred upon her by the legitimate claim seeking the nullity of survey plans G-503693-98 and G-695623-2001 and, consequently, recognition of the validity of survey plan G-672530-2000, which legitimizes her possession, so that the “proceedings” for possessory information (información posesoria) may continue.

They further added that failing to recognize that the counterclaimant’s claim is not based on asserting a “real right” is tantamount to disregarding the very nature of such claims. This Chamber observes that standing has been understood as the capacity to be a party in a specific proceeding; it may be active or passive, depending on the conditions established by law for that purpose with respect to the relief sought in the proceedings. Thus, active standing on the merits (legitimación ad causam activa), which is relevant to the case under consideration, is the capacity to sue or bring a counterclaim, a status arising from the position of the party in relation to the relief sought in the proceedings. In short, it is the necessary identity that must exist between the plaintiff and the right asserted at trial (no. 976-2006 of 7:40 a.m. on December 19, 2006). Indeed, the plaintiff states in her allegations that the defendant acquired possessory-information rights over unregistered land which, according to her interpretation, forms part of the property she owns, registration no. 22506-000 (facts four and nine of the complaint).

The plaintiff likewise states that the defendant invaded and appropriated the overlapping tract “and remains in possession thereof to this day,” which eliminates any doubt as to the possessory nature of the claims set forth in the complaint. For her part, in claim number eight, the counterclaimant requests: “That the portion of land at issue in this counterclaim remain in the possession of the company Dark Cave D.C. S.A.” She also requests an order directing the continuation of the possessory-information proceeding being processed under expediente 01-000393-387-AG-3. In view of the foregoing, it is indisputable that the defendant-counterclaimant has stated with unmistakable clarity claims seeking to have her remain in possession of the land at issue in the dispute and to obtain an order directing the continuation of the proceeding in which her right to possess the disputed strip of land is to be declared—a possession which, as the plaintiff herself acknowledges, the defendant maintains to this date. Accordingly, the claim alleging violation of provisions 2 and 23 of the LJA and 104 of the CPC cannot be sustained, and the ground of appeal must therefore be rejected.

V.In her second challenge, the appellant argues that the judges failed to rule on all the issues in dispute, since the counterclaim did not set forth claims concerning possessory rights and the challenged judgment did not rule on the extinguishing prescription (prescripción negativa) of her right to bring an action. In this regard, this adjudicatory body considers that, as to the allegation that the counterclaim does not include a declaration concerning possessory rights, pursuant to Whereas IV, that argument is unfounded because it is clear not only that the counterclaim includes such claims, but also that, according to the plaintiff’s own statements in the complaint, that company is currently in possession of the disputed land (fact 12 of the complaint). Regarding the failure to rule on the extinguishing prescription of the right to bring an action, this Chamber observes that such relief was indeed invoked as item 5) of the counterclaim.

Specifically, the counterclaimant requested that any right the plaintiff might have over the disputed land be declared time-barred. It was also included in the answer to the complaint. The Court stated that it had indeed been raised as an affirmative defense (excepción) in the answer to the complaint and as a claim in the counterclaim. The judges stated that it must be understood to have been granted when the defense of lack of a right to recover ownership was upheld. The judges further added that the court of first instance (A quo) stated that any relief not granted was deemed denied, since the judgment clearly granted the declaratory action seeking recognition of the superior right of possession. Based on the foregoing, the appellant is incorrect in asserting that the judgment failed to address that issue, and this challenge must therefore be rejected.

VI.In the third objection, the appellant in cassation (casacionista) includes a lengthy list of what, in her view, constitute errors in the assessment of evidence (errores de apreciación probatoria) committed by the Court. To assess the alleged errors, it should be noted that the judges based their ruling on the technical conclusion reached by the court-appointed expert (perito), Aquiles Chaves Arroyo, who expressly established that: “… The alleged overlapping area (área de traslape) of 2ha 6651-51 square meters does not correspond to a property registered in the Real Property Registry (sic).” Thus, the judges found that the disputed area “belongs to survey plan G-672530-2000, which describes the land for possessory-title proceedings (información posesoria) in the names of the possessors Eladio Ponce Lara and Lemín Over Ibarra Lara,” which, they added, was verified “in situ” by the Court. Nevertheless, this Chamber considers that, in the matter under review, the appellants overlook the fact that, at this procedural stage, it is not sufficient to state a series of general and merely argumentative disagreements; rather, as has been stated, the decision must be contrasted with the general violation that, in their view, occurred in the ruling.

Accordingly, the invocation of some of the assessment errors alleged by the plaintiff is unavailing and must therefore be rejected, since it is clear that they are not directed at challenging the grounds provided by the judges in the decision at issue. Thus, the assertions concerning the alleged contradiction are unavailing: namely, that the trial judge found it established that her property corresponds to survey plan G-0695623-2001, property registration number 225506-000, but subsequently stated that it could not be clearly and conclusively demonstrated that she was the registered owner of the land in dispute. This is because it is clear that, from the Court’s perspective—which was in turn based on the expert opinion of Aquiles Chavez—the disputed land does not belong to the plaintiff’s property. Nor is it relevant that the date of deed no. 142, by which Jimmy Rodríguez Montero donated his possession to Eladio Ponce Lara and Lemin Over Ibarra Lara, was omitted, since this is not a factual element capable of altering the outcome of the Court’s reasoning.

Additionally, it is indisputable that the summary of that public deed may be included among the facts deemed proven by the judges, since it sets forth the information contained in a public instrument which, because it was not alleged to be false, may properly form part of the body of evidence. Nor is it material for purposes of challenging the decision in this case what is alleged regarding the date on which the defendant’s survey plan was prepared, whether the possessory-title proceedings stated that Margarita Lara Salgado’s possession was being transferred to the defendant, or whether the application for possessory title stated that the applicants had 10 years of possession, since none of these facts has any significance in light of the position adopted by the expert and the Court that no overlap exists. By the same reasoning, it is immaterial to determine whether the land in dispute was in fact sold to the defendant by Margarita Lara, or whether the trial judge failed to mention that the plaintiff filed an objection in the possessory-title proceedings.

It is likewise of no consequence to the case whether, when possession was transferred from Ponce Lara and Ibarra Lara to Dark Cave, reservations were made in favor of the purchaser, or whether Dark Cave acknowledged in its answer to the complaint that it had performed work in the disputed area during July and August 2005. The same applies to the appellant’s assertion that the overlapping land was used for agriculture, while this was denied in the answer to the complaint. Under these circumstances, the foregoing assertions do not cast doubt on the results of the expert evidence (prueba pericial). The appellant in cassation further argues that the record of the judicial inspection (reconocimiento judicial) deliberately omitted the presence of the surveyor and contained no indication of where the fence had previously stood. In this regard, concerning an agrarian appeal in cassation (recurso de casación agraria) on procedural grounds, this Chamber has repeatedly stated that: “…following its new composition and an in-depth review of this position, a change occurred, opening the possibility of filing an appeal alleging certain procedural grounds, specifically in cases where the defects arose in the judgment as a procedural act; this does not apply to defects concerning the proceedings, which, by operation of law, are excluded from the review exercised by this Chamber.

This is because the former may be challenged only before this Chamber, whereas the latter may be remedied by the Court. Nevertheless, the circumstances in which such a challenge is possible have gradually been defined and are currently limited to defects arising from inconsistency (incongruencia) and amendment to the detriment of the appellant (reforma en perjuicio). Regarding the former, see decision no. 583-F-2004 of 11:35 a.m. on July 14, 2004. As to reformatio in pejus, it was incorporated as a ground beginning with ruling no. 1074-F-04 of 11:20 a.m. on December 16, 2004.” (Decision no. 178 of 9:50 a.m. on March 14, 2007). In light of the foregoing, it is beyond dispute that this adjudicative body lacks jurisdiction over defects in the proceedings. Without prejudice to the foregoing, and for the sake of completeness, this Chamber observes that neither in that proceeding (page 866) nor in the one conducted on October 24, 2006, is there any record of objections by the plaintiff’s representatives or of filings calling the court’s attention to any irregularity or inconsistency during the inspection; accordingly, the claim raised in that regard cannot be accepted.

Additionally, as to the argument that the results of the expert assessment of environmental damage contained in the report by the company Consultec were not analyzed, it is clear from page 358 of the case file that the report was submitted late. In any event, this adjudicative body notes that the report bears no relation to the grounds on which, as already stated, the ruling under review rests—namely, that the overlapping area is not part of the plaintiff’s property but is instead located within the survey plan of the applicants for title (titulantes). For that reason, the judges’ failure to refer in the judgment to the environmental-damage report causes no prejudice to the plaintiff and is immaterial for purposes of the appeal, since it does not challenge the essence of the decision. Accordingly, because the Court relied on the position of expert Aquiles Chavez that the overlapping area is not contained within the plaintiff’s property, any evidence or argument intended to demonstrate the origin of the property, its acquisition date, or the chain of transfers is unavailing, since that evidence clearly establishes that the land is not located within the plaintiff’s property.

VII.Regarding the evidence for a better determination of the case (prueba para mejor resolver), which she says was rejected, this Chamber considers, first, that it was evidence offered when the proceedings were ready for judgment, while the testimony and documentary evidence offered by the parties were already in the record and, in the Court’s view, were sufficient for purposes of deciding the case. In addition, the case file contains the statement given by witness Amancio Peña Carmona, who, although according to the plaintiff he would have been able to testify regarding his participation in the destruction of the fences along the boundary with Federico Chacón, in fact testified to precisely the opposite, expressly stating that no work had been performed there, but only simple fence repairs. As to the affidavit (declaración jurada) of José Delgado Requene, which she claims was rejected, unlike the others, it was not offered as testimonial evidence either in the complaint or in the response to the counterclaim (contestación a la reconvención), but only after the relevant stages had expired, as evidence for a better determination of the case offered in the appellate brief (page 807).

Thus, with respect both to the affidavits executed before a notary and to the photographic evidence offered, it was within the Court’s discretion to determine whether or not to admit them (art. 331 of the CPC), and their rejection did not entail any defect given an evidentiary record that was, moreover, extensive.

VIII.Finally, regarding the appellant’s assertion that the judges “overvalue” the expert opinion rendered by Mr. Aquiles Chaves Arroyo, even though the record contains evidence refuting that professional’s conclusions, this Chamber finds that both the expert opinion rendered by Mr. Aquiles Chaves Arroyo (folio 575), the technical evidence prepared by Engineer José Joaquín Castro García (folio 359), the testimony of Mr. Franklin Carazo Serrano (folio 537), and the technical reports rendered by the company Geotop (folios 486 and 637) establish the existence of closure errors (errores de cierre) in all the survey plans (planos) examined. Although both Chaves Arroyo and Carazo Serrano consider them to be minor and acceptable errors, Castro García’s position is clear in stating that “technically, I cannot reliably determine the claimed boundaries (linderos), because the documents essential for doing so lack the necessary consistency.” Likewise, regarding the suitability of the plaintiff’s plans, he stated: “they contain serious inconsistencies that prevent their use as the technical basis for such analysis.” For its part, Mr.

Chaves Arroyo’s expert opinion specified that the errors in the survey of the control traverse (poligonal de apoyo) used to prepare plan G-503693-1998 (which describes the plaintiff’s property) “make that plan unworthy of credibility.” From that perspective, he emphasizes that such errors “are substantial and unacceptable” and that there is a closure error causing an overlap (traslape) with plan G-672530-2000 (the plan from the defendant’s possessory information proceeding (información posesoria)). Finally, he states that plan G-672530-2000 “conforms to reality both on the ground and in its shape.” He adds that the closure errors in plan 672530-2000 are minor and acceptable. Similarly, the studies conducted by the company Geotop (folios 486 and 637) establish the existence of linear closure errors in all the plans, indicating that those found in the plaintiff’s original plan G-503693-98 are acceptable, but that, when calculating it from the surveyor’s field record (protocolo del topógrafo), it encountered difficulty understanding the handwriting and the way the numbers were written.

It also detected an error in the course table (derrotero) of plan G-695623-2001 (the plaintiff’s), stating that the azimuth (acimut) possibly contains a data-entry error. Regarding the defendant’s plan, G-672530-2000, it found differences between the field record and the plan, including more points in the field record’s course table than in the plan, as well as a different sketch in the field record. With respect to the expert examination conducted by this same company, taking into account Chaves Arroyo’s expert report, it found that: “…the existence of differences between the information in the field record and the plan’s course table causes registered cadastral plan (plano catastrado) G-672530-2000 to lose credibility.” Additionally, although the Court stated in its judgment that it had verified “in situ” the physical and geographical characteristics of the property and that they corresponded to the material and cartographic reality of the property described, this Chamber nevertheless observes that it failed to consider the various items of technical evidence identifying defects in the plans that undermined their credibility for purposes of reliably establishing the claimed boundaries.

Indeed, the judges expressed no opinion whatsoever regarding the reports rendered by Engineer José Joaquín Castro and the company Geotop. The decision contains no comment on the first study, appearing at folio 486, which identified course-table and closure errors in all the plans reviewed, nor on the study prepared by Castro García, who stated that he could not reliably determine the claimed boundaries because the documents used lacked the necessary consistency. Nor does the judgment refer to the second study prepared by Geotop, which reiterates the existence of an error in the course tables of the defendant’s plan, with a possible data-entry error in the inclusion of one of the azimuths, thereby also casting doubt on the credibility of plan G-672530-2000. Accordingly, it is clear that the judges’ failure to mention Geotop’s report constitutes an error in the assessment of the evidence (valoración probatoria), which prevents the Court from relying exclusively in its judgment on the expert opinion rendered by Mr.

Aquiles Chaves Arroyo, since the plans used for the various topographic and geodetic studies lack the consistency necessary for that purpose. Indeed, the assessments set forth in Geotop’s studies preclude assigning the degree of credibility that the Court gave to Mr. Chaves Arroyo’s expert opinion. Nevertheless, this adjudicatory body notes that the appeal on points of law (casación) is futile because, given the lack of conclusive evidence regarding the existence of an overlap in one direction or the other, essentially due to the inconsistency of the plans in question, none of the evidence submitted to the proceedings by the respective professionals is definitive in its findings for purposes of establishing whether the alleged superimposition of plans (sobreposición de planos), on which the complaint is based, exists. Accordingly, the lack of sufficient probative elements (elementos de convicción) confirming whether an overlap exists between the plans for the plaintiff’s property and the title sought by the defendant prevents acceptance of the former’s position. Along those lines, although for different reasons, the Court’s decision must stand, and this ground of appeal must be rejected.

IX.In her fourth challenge, she argues that her client owns the property in Guanacaste recorded under registration number 22506-000, which is fully identified by plan G-0695623-000. She adds that the defendant has passive standing (legitimación pasiva) because the defendant’s plan overlaps it and because the defendant also modified the boundaries, seeking to register part of the plaintiff’s property as her own. In this regard, in this Chamber’s view, the grievance does not satisfy the minimum requirements for consideration as such because it does not challenge the judgment. On the contrary, it merely asserts that the parties have standing (legitimación), without explaining how this relates to the ruling issued; consequently, the ground of appeal is procedurally defective and must be rejected.

X.In view of the foregoing, the appeal shall be denied. The judgment is affirmed. Costs are assessed against the appellant pursuant to provision 611 of the Código Procesal Civil.

POR TANTO

The judgment under appeal is affirmed. Its costs shall be borne by the party who filed the appeal.

Proceso ordinario establecido en el Juzgado Agrario de Liberia, por ENTRE MARES E ISLAS SOCIEDAD ANÓNIMA, representada por su presidente y tesorero, ambos con facultades de apoderados generalísimos sin límite de suma, Jacques Cloutier, de nacionalidad canadiense, pasaporte n.° 044710111, soltero, constructor, vecino de Estados Unidos y Manuel Burgos Sáenz, economista; contra DARK CAVE D C SOCIEDAD ANÓNIMA, representada por su presidente con facultades de apoderado generalísimo sin límite de suma, Federico Chacón Castro, soltero, empresario, vecino de Guanacaste. Figuran además, como apoderado especial judicial de las partes, respectivamente, los licenciados Mauricio Rodríguez Méndez, vecino de San Ramón y Mario Alberto Piña Líos, de estado civil no indicado. Las personas físicas son mayores de edad y con las salvedades hechas, casados, abogados y vecinos de San José.

RESULTANDO

1. Con base en los hechos que expuso y disposiciones legales que citó, la sociedad actora estableció demanda ordinaria, para que en sentencia se: “1 La nulidad absoluta del plano catastrado No. (sic) G-672530-2000 utilizado en la información posesoria de Drak Cave D C S.A. No. (sic) 01-000393-387-AG, del Juzgado Agrario de Liberia, por cuanto se sobrepone y traslapa con el plano inscrito anteriormente en el Catastro Nacional No. (sic) G-695623-2001, comunicándose lo pertinente al Catastro Nacional para su ejecución. 2 La nulidad absoluta de los procedimientos de información posesoria del exp. No. (sic) 01-000393-387-AG, del Juzgado Agrario de Liberia promovido por Dark Cave D C S.A. por intentarse inscribir como parte de la finca objeto de la titulación una porción de la finca inscrita en el Registro Público de la Propiedad, matrícula 22506-000, del Partido de Guanacaste, propiedad de Entre Mares e Islas S.A. Comuníquese al señor secretario del Juzgado Agrario para que haga las anotaciones pertinentes en el expediente citado. 3 La restitución de la porción usurpada por Dark Cave D.C.

S.A. de la finca No. (sic) 22506-000 del Partido de Guanacaste, a su legítima propietaria Entre Mares e Islas S.A. conforme con los croquis de traslape aquí presentados y la ubicación original de los cercados conforme a los planos G-503693-1998 y G 695823-2001. Para la puesta en posesión, comisiónese a la fuerza pública. 4 Las restitución de cercas y mojones a sus ubicaciones anteriores en cuanto al área de la que fue desposeída su representada Entre Mares e Islas S.A. cuyo costo deberá pagar la demandada Dark Cave D C S.A., según se determine en ejecución de sentencia. 5 La condenatoria a Dark Cave D C S.A., al pago de los daños ocasionados a Entre Mares e Islas S.A. por la Destrucción del ambiente natural del área usurpada y el costo de su restauración según se establezca en ejecución de sentencia. 6 La condenatoria a Dark Cave D C S.A. al pago de ambas costas de esta acción.” 2. La accionada contestó negativamente e interpuso las excepciones de falta de derecho, falta de legitimación y prescripción; así como la expresión genérica de “sine actione agit.” 3.

La sociedad demandada planteó reconvención en contra de la actora, a fin de que en sentencia se declare: "1. Que se tenga por establecida la presente reconvención en contra de la sociedad Entre Mares e Islas S.A. 2. […] con lugar en todos sus extremos la presente reconvención. 3. […] que los planos G- 503.693-98 y G-695.623-2001, están mal confeccionados, por no ser fiel reflejo de la información del protocolo topográfico que les da origen. 4. […] que los planos G- 503.693-98 y G-695.623-2001, son absolutamente nulos, por no reflejar la realidad material de los inmuebles que pretenden describir y que en consecuencia deben cancelarse su inscripción. 5. […] que el plano G-672.530-2000, que describe la propiedad de su representado no ha invadido ni traslapa en lo absoluto los planos G- 503.693-98 y G-695.623-2001, de la sociedad demandada reconvenida. 6. Se ordene la continuidad de las diligencias de información posesoria que se tramita bajo el expediente No. (sic) 01-000393-387-AG-3 en este mismo despacho judicial hasta el dictado de la resolución de fondo. 7. […] que cualquier eventual derecho que pudiere tener la sociedad reconvenida sobre la porción que pretende hacer creer es de su propiedad , se encuentra prescrito por lo que no le asiste derecho alguno para reclamo. 8.

Que la porción de terreno que es objeto de discusión en la presente reconvención se debe mantener, en posesión de la empresa Dark Cave D.C. S.A. 9. Que se condenen a la sociedad reconvenida al pago de ambas costas." 4. La actora reconvenida contestó conforme a folios 471 a 475 sin oponer excepciones.

El juez Rodrigo Valverde Umaña, en sentencia n.° 133-S-2009 de las 8 horas del 9 de setiembre de 200, resolvió: "En cuanto al (sic) demanda principal se DECLARAN CON LUGAR las EXCEPCIONES, falta de derecho, falta de legitimación. Por innecesario se omite pronunciamiento en cuanto al resto de las excepciones. Por lo anterior procede DECLARA SIN LUGAR, LA DEMANDA PRINCIPAL EN TODOS SUS EXTREMOS. EN CUANTO A LA RECONVENCIÓN, se declarar (sic) CON LUGAR , LA PRESENTE RECONVENCIÓN EN CONTRA DE ENTRE MARES E ISLAS S.A, en la forma en que se dirá, entendiéndose denegada en lo que no se otorgue:

  • 1)Que los planos G- 503.693-98 y G-695.623-2001, están mal confeccionados y son absolutamente nulos, por no ser fiel reflejo de la información del protocolo topográfico que les da origen y por no reflejar la realidad material de los inmuebles que pretenden describir y que en consecuencia deben cancelarse su inscripción una ves (sic) firme esta resolución.
  • 2)que (sic) el plano G-672.530-2000, que describe la propiedad de la demandada reconventora no ha invadido ni traslapa en lo absoluto los planos G- 503.693-98 y G-695.623-2001, de la sociedad demandada reconvenida.
  • 3)Se ordena con la firmeza esta sentencia, la continuidad de las diligencias de información posesoria que se tramita bajo el expediente No. (sic) 01-000393-387-AG-3, en este mimo (sic) despacho judicial hasta el dictado de la resolución de fondo.
  • 4)Que la porción de terreno que es objeto de discusión en la presente reconvención, se debe mantener en posesión de la empresa Dark Cave D.C. S.A.
  • 5)Se condena a la parte actora reconvenida al pago de ambas costas de esta acción." 6. La actora reconvenida apeló y, el Tribunal Agrario del Segundo Circuito Judicial de San José, integrado por los jueces Enrique Ulate Chacón, Antonio Darcia Carranza y Carlos Picado Vargas, en sentencia n.° 0728-F-11 de las 16 horas 9 minutos del 18 de julio de 2011, dispuso: “En razón de todo lo expuesto, procede CONFIRMAR la sentencia.” 7. El licenciado Mauricio Rodríguez Méndez, en su expresado carácter, formula recurso de casación indicando expresamente las razones en que se apoya para refutar la tesis del Tribunal de instancia.

8. En los procedimientos ante esta Sala se han observado las prescripciones de ley.

Redacta la magistrada Escoto Fernández

CONSIDERANDO

I.Entre Mares e Islas S.A. (en adelante Entre Mares e Islas), en su demanda contra Dark Cave DC S.A. (en lo sucesivo Dark Cave), manifestó, es propietaria de la finca de Guanacaste, matrícula no. 22506-000, situada en Santa Elena, cantón de La Cruz, de la cual existe el plano catastrado G-0695623-2001, que modificó el no. G-503693-1998. Dijo, la accionada adquirió de los señores Eladio Ponce Lara y Lemin Over Ibarra Lara, los derechos de la información posesoria que se tramita en expediente no. 01-000393-387-AG, terreno que se describe en el plano catastrado no. G-672530-2000. Aseguró, a pesar que su terreno colinda por el sur-este con la finca objeto de la información posesoria, los promotores de ese proceso ocultaron ese hecho al Juzgado. Además, explicó, en noviembre de 2000, los gestores de esa titulación, ahora de Dark Cave S.A., levantaron el plano catastrado G-672530-2000 incluyendo una porción de su predio de aproximadamente dos hectáreas y media.

Comentó, la empresa Geotop Centroamericana Ltda., elaboró un estudio en el cual se evidencia la superposición del plano de la información posesoria sobre los de su fundo. Apuntó, entre julio y agosto de 2005 fueron removidas las cercas que dividían ambas heredades en la zona del traslape, área que fue invadida y retenida por la demandada, quien a la fecha se mantiene en su posesión, destruyendo a su vez la vegetación y belleza natural del sitio. Argumentó, esto motivó su oposición al trámite de titulación, por lo cual el proceso se suspendió, ordenándose a las partes dirimir el asunto en un proceso declarativo. Solicita en sentencia, se declare: a) la nulidad del plano G-672530-2000, por cuanto se sobrepone a los planos G-503693-1998 y G-695623-2001, que describen su propiedad; b) la nulidad del proceso de información posesoria, expediente 01-000393-387-AG, por cuanto pretende inscribir una porción de su terreno; c) la restitución de la porción usurpada, así como las cercas y mojones removidos, a sus anteriores ubicaciones, todo a costa de la demandada; d) se condene a la accionada al pago de los daños y en ambas costas.

La demandada contestó de forma negativa. Opuso las excepciones de falta de: derecho y legitimación, prescripción y la declare que: a) los planos G-503693-1998 y G-695623-2001, están mal confeccionados y no son fiel reflejo del protocolo topográfico que los origina, por lo cual son nulos; b) su plano G-672530-2000, no traslapa los anteriormente indicados; c) se continúe con la información posesoria; d) cualquier derecho de la reconvenida sobre la porción que pretende, se encuentra prescrito; e) se le mantenga en la posesión del terreno en disputa; f) son ambas costas a cargo de la reconvenida. La actora reconvenida contestó negativamente. No opuso excepciones. El Juzgado acogió las de falta de: legitimación y derecho. Declaró sin lugar la demanda, con lugar la reconvención. Decretó la nulidad de los planos G-503693-98 y G-695623-2001 y que el plano G-672530-2000 no traslapa los anteriormente citados.

Ordenó continuar el proceso de información posesoria y mantener el área en pugna, en posesión de la demandada reconventora. Impuso ambas costas a la actora reconvenida. El Tribunal confirmó. Inconforme la accionante, acude ante casación.

II.La recurrente ofrece como prueba para mejor proveer la fotografía que consta a folio 671 “pero ampliada, en tres fotos, con una nota del Ing. Manuel Villegas Rodríguez. Así como el disco facilitado por PRIAS, del CENAT, en donde consta la referida foto” y pide trámite de vista. Por demás, se debe mencionar que el lineamiento a seguir respecto de la recepción de prueba en etapa de casación, es el estipulado en el artículo 609 del Código Procesal Civil (en adelante CPC), que a la letra señala: “Prohibición para recibir prueba. Ante la sala de casación no podrá proponerse ni recibirse prueba, ni le será permitido admitir alguna para mejor proveer, salvo que se trate de documentos públicos de influencia efectiva en la decisión de la litis, y siempre que consten en el proceso o que hayan sido presentados con el recurso o con el escrito de ampliación...”. Es decir, no se admitirá la que incumpla con los requisitos allí establecidos. Es claro además que la fotografía ofrecida ya consta en el no encontrase en las circunstancias descritas por ese canon. Del mismo modo, es menester advertir que, conforme a los preceptos 6 y 61 de la Ley de la Jurisdicción Agraria (en adelante LJA); 556 a 562 del Código de Trabajo, en asuntos como el presente no está previsto el trámite de vista, por lo cual deberá denegarse.

III.A pesar de que en el recurso se entremezclan una serie indistinta de agravios, del análisis de la censura planteada, se puede colegir, se trata en realidad de cuatro cargos. En el primero, reclama violación de los artículos 2 y 23 de la LJA, y del precepto 104 del CPC. Recrimina, la demandada reconventora plantea la nulidad de dos planos de su finca inscrita, sin haber planteado un conflicto de posesión del área que se discute, razón por la cual, no existe fundamento para que el fallo resuelva en esos términos. Sostiene, tampoco se presentó conflicto de propiedad porque la parte del fundo objeto del desacuerdo le pertenece material y registralmente. Lo anterior, afirma, conforme a la inscripción registral del bien y de los planos que lo describen, G-503693-98 y G-695623-2001, los cuales, según el peritaje realizado, contienen la porción en discordia. Dice, si bien la reconventora solo señala un error en los planos de los cuales es titular, alegando que están mal confeccionados por no reflejar la realidad del terreno, el Tribunal establece en su fallo, que no concurren los presupuestos para acoger la acción reivindicatoria.

Así, declara la nulidad de los planos con base en un mejor derecho de posesión de la demandada, sin que ésta lo haya discutido. Argumenta, el derecho de posesión no puede estar por encima de su propiedad inscrita, si no se ha alegado la usucapión. Relata, la pretensión de la reconventora se basa solo en la existencia del plano G-672530-2000, elaborado cuando los señores Ponce Lara e Ibarra Lara, no eran los legítimos poseedores del terreno. Precisa, la demandada cambió además las condiciones del área de controversia con maquinaria y construyó unas terrazas con el fin de apoderarse de ella. Recalca, existe un error en el cierre del plano que no le legitima para declarar con lugar su pretensión. Concluye, la demandada reconventora no cuenta con legitimación activa, por cuanto no pretende demostrar el derecho real o personal que justifica su accionar. En la segunda censura, endilga, violación de los ordinales 153 inciso 3) y 154 del CPC, canon 45 de la LJA, por cuanto no hubo pronunciamiento respecto de todas las cuestiones debatidas.

Enuncia, si en la reconvención no se pretenden derechos de posesión y no se ha resuelto sobre la prescripción negativa de su derecho de accionar, el A quo no puede declararla con lugar. En el tercer reparo, recrimina indebida valoración probatoria y quebranto de los principios de derecho y equidad al fundamentar el fallo. En esencia refiere una serie de actos de la demandada reconventora que considera, evidencian que de mala fe, invadió y se apropió del terreno de traslape, posesión que mantiene hasta la fecha. Entre ellas, menciona, las que a continuación se citan, a saber, que la accionada intentó ocultar la ocupación del segmento de trasposición y su inserción en el proceso de información posesoria, sin mencionarla como colindante. Sin embargo, dice, el Tribunal no lo valora adecuadamente, pues indica, no hubo desapoderamiento ilegítimo en tanto se trataba de un terreno propiedad de la demandada.

Destaca asimismo, en el acto del reconocimiento, se pudo apreciar que en el área en conflicto, la colindancia fue removida, construyéndose unas terrazas con tractor. A pesar de ello, continúa, no se quiso consignar en el ni la presencia del topógrafo, ni las indicaciones relativas al lugar donde antes estuvo la cerca. Asevera, a folio 670 y 671 se aprecia el traslape de interés y el área debidamente deslindada, lugar donde antes estaba la cerca, con la arboleda y vegetación que fue destruida unos meses después. Arguye, esa fotografía fue tomada en marzo de 2005, cuando la reconventora utilizó maquinaria especial para variar la naturaleza del terreno. En cuando a los hechos tenidos por demostrados, advierte varias contradicciones. En cuanto al primero, apunta, el juzgador de primera instancia acredita que su propiedad corresponde al plano G-0695623-2001 y que se encuentra inscrita bajo la matrícula 225506-000, de lo cual se deriva su legitimación para interponer la acción reivindicatoria, respecto a la porción de terreno de interés.

No obstante, en el considerando IV, el A quo indica, que no pudo demostrar en forma clara y contundente que fuera la dueña registral del terreno en litis, lo que encuentra desafortunado. En cuanto al segundo, acusa, a folio cinco consta la escritura 142 por la cual Jimmy Rodríguez Montero dona a Eladio Ponce Lara y Lemin Over Ibarra Lara, lo cual no puede incluirse como un hecho probado, por cuanto contiene las declaraciones de las partes. Dice, si bien se indica que el plano de la parte demandada es del año 2000, (a nombre de Ponce Lara e Ibarra Lara), posteriormente se señala que en enero de 2001, Margarita Lara Salgado les traspasa la posesión, lo cual es paradójico. Adicionalmente, relata, en la solicitud de información posesoria se indica que ya tenían 10 años de poseer, situación que se extrae de la escritura no. 142. A su juicio, la prueba del testigo Ricardo Bonilla, establece que el terreno en litigio lo vendió Margarita Lara Salgado a Federico Chacón, circunstancia que no analiza el Tribunal.

Menciona, en cuanto al tercer hecho tenido por probado, el A quo no indica que se planteó oposición en el expediente de información posesoria 01-000393-0387-AG, lo cual evidencia, en su opinión, que los jueces no interpretan esa oposición como un evento importante. Respecto al hecho cuarto tenido por demostrado, arguye, si bien se menciona lo relativo a la escritura no. 276 otorgada ante la notaria Duarte Arauz, (traspaso de la posesión de Ponce Lara e Ibarra Lara a Dark Cave), no se exterioriza que en ese mismo documento fueron establecidas “reservas” a favor del comprador, para el caso de eventuales declaratorias de mejor derecho sobre la finca. Relativo al hecho quinto, expone, no es cierto que Dark Cave haya entrado en posesión del bien al momento de la compra de los derechos, pues al contestar la demanda, reconoció haber realizado obras en la zona de conflicto durante julio y agosto de 2005.

Agrega, aunque ofreció varias declaraciones juradas como prueba para mejor resolver, esta fue rechazada, a pesar de que en ellas se hace constar, que Amancio Peña Carmona observó cuando en la colindancia de Federico Chacón se eliminaban las cercas. Refiere, esta declaración (visible a folio 677) tuvo lugar dos días antes de que Dark Cave adquiriera el terreno sobrepuesto, momento en el cual, ya se reconocía como dueño a Federico. Recalca, de ahí que se haya incluido en el documento de venta de la posesión a Dark Cave, una condición resolutoria en el sentido de que se realizarían primero esas obras y luego el traspaso. Adicionalmente, establece, en la escritura no. 13, (folio 678), aparece declaración jurada de José Delgado Requene, en la cual revela que en esa finca se cortaron los postes de la cerca con motosierra al momento de construirse las terrazas, sin embargo, fue rechazada por el Tribunal como elemento probatorio para mejor proveer.

En cuanto al hecho sexto, señala, el A quo sobrevalora el peritaje rendido por el señor Aquiles Chaves Arroyo a pesar de que hay probanzas en los autos que refutan lo que dicho profesional concluye. Establece, dicha pericia no puede tenerse como plena prueba, puesto que, del documento emitido por el topógrafo Manuel A. Villegas Rodríguez, el error de cierre de la poligonal de apoyo es de solo tres centímetros, lo cual origina un error en el plano catastrado de unos 14 metros. Además, indica, esto fue corroborado por la testimonial de Franklin Carazo Serrano, quien manifiesta que los desplazamientos en el plano no son importantes, ni afectan la medida del área, pues se trata de errores de cierre pequeños y aceptables. Igualmente, asegura, mientras relata que no existe traslape, luego calcula esa área. De la misma forma, anota, se afirma que las áreas en litigio no corresponden a ninguna finca inscrita y que los planos datan de la fecha de inscripción en el catastro, olvidando verificar las datas mencionadas en los protocolos de levantamiento, las cuales no son contestes.

Enfatiza, en el punto cuatro del peritaje, se reconoce la superposición con el plano de una finca inscrita, afirmando a la vez que no es parte de aquella. A este tenor, en el punto 7, folio 579, consta escrito de su representada, en el cual se advierte que los folios del protocolo del plano G-503693-98 están escritos en “manuscrita” y aparentemente con tinta azul lo que lo hace menos legible, por ello se le solicitó al juez requerir al señor Aquiles transcribir los números en que se basó para establecer el error de cierre. No obstante, ante la pregunta del A quo, indicó haberse basado en “…la información que tiene el levantamiento del Protocolo del Topógrafo en los diferentes folios…”, es decir, que no lo aclaró, sin que por ello el A quo dejara de tener por cumplida la prevención. Además, menciona, al preguntarse al perito si el error de cierre podía darse en otra parte del plano, contestó que aunque éste provoca el traslape, también podía darse en otra parte del plano, aceptando la existencia de la superposición.

Determina, aunque el ingeniero Carazo encontró un error de cierre de 27 centímetros, esto no provocó ningún cuestionamiento del A quo. Complementa, el Tribunal tuvo por su parte acreditadas “in situ” las características físicas y geográficas del inmueble, que corresponden a la realidad material y cartográfica del bien que se describe, lo cual dice, ocurre como producto de los cambios hechos por la demandada al área en conflicto. En cuanto al sétimo hecho probado, estima, se contradice con el hecho primero tenido por demostrado, toda vez que menciona primero que la finca 22506-000 es la que responde al plano catastrado G-0695623-2001, lo cual se demuestra con el informe de la empresa Geotop Centroamericana Limitada. Agrega, los informes rendidos por Geotop no han sido valorados por los jueces. En cuanto al hecho octavo, aduce que el plano que se ajusta a la realidad es el G-672530-2000, remitiendo al folio 579, pliego que afirma, no corresponde a ese plano.

Expresa, el A quo no analizó el informe elaborado por la empresa Consultec sobre el daño ambiental causado que consta en folios 275 a 354. Asegura, en cuanto a la declaración jurada de Amancio Peña Carmona visible a folio 677, éste reportó los daños realizados en la cerca, de lo cual deriva, que posteriormente mintió en su declaración en juicio, al indicar que la zona en conflicto fue utilizada para siembra de maíz y frijoles por los hijos de doña Margarita, lo cual es incompatible con la contestación de la demandada en cuanto a que el área en discusión no ha sido utilizada para fines agropecuarios. Referente al hecho noveno tenido por demostrado, igualmente se menciona que se utilizó para producción de chaguite y agricultura, lo cual es inconsistente con la contestación de la demanda. Concerniente al hecho décimo, nótese que de nuevo se basa en declaraciones del testigo Peña Carmona, quien alertó de los daños en la colindancia y luego cambió su versión en juicio.

Por ello, tal declaración es cuestionable, pues señala que los hijos de Margarita cultivaban en una zona donde la propia demandada reconoce que no hubo producción agrícola. Dice, es falso el hecho decimoprimero, relacionado a la existencia de una casa. Finalmente, aduce, la referencia del hecho décimosegundo en cuanto a que se daba mantenimiento a los cercos, es complaciente. En el cuarto reproche, esgrime violación al artículo 45 de la Constitución y preceptos 264, 266, 267, 295, 296, del Código Civil. Menciona, de acuerdo al hecho tenido por demostrado, número uno, su representada es propietaria de la finca de Guanacaste matrícula 22506-000, que se identifica plenamente con el plano G-0695623-000. Agrega, la demandada posee legitimación pasiva, por cuanto existe un traslape por parte del plano de la accionada, quien además modificó los linderos, pretendiendo inscribir parte de su propiedad como suya.

IV.En la primera censura, la casacionista centra su reclamo en la supuesta falta de legitimación de la demandada reconventora. Insiste para ello, en que la accionada no pretende demostrar en su contrademanda el derecho real o personal que justifica su accionar, pues no planteó conflicto de posesión respecto del área que se discute. El Tribunal indicó, si la acción se basó en una acción reivindicatoria, es evidente que la contrademandada tiene legitimación, tanto activa como pasiva, y su defensa y pretensiones están orientadas a enervar la reivindicación. Agregan los jueces, su legitimidad estriba justamente en tener una relación jurídica con la pretensión procesal. Tal legitimación se la concede la pretensión legítima, orientada a solicitar la nulidad de los planos G-503693-98 y G-695623-2001, y otorgar en consecuencia validez al plano G-672530-2000, que legitima su posesión, para darle continuidad a las “diligencias” de información posesoria.

Adicionan, desconocer que la pretensión de la contrademandante no parte del reclamo de un “derecho real”, es desconocer la naturaleza misma de tales pretensiones. Observa esta Sala, la legitimación ha sido entendida como la aptitud para ser parte en un proceso concreto, puede ser activa o pasiva, lo cual dependerá de las condiciones que para tal efecto establezca la ley en cuanto la pretensión procesal. Así, la legitimación ad causam activa, que interesa en el caso en estudio, es la capacidad para demandar (reconvenir), carácter que nace de la posición en que se halle el sujeto, respecto a la pretensión procesal promovida. En suma, es la identidad necesaria que debe darse entre el actor y el derecho que pretenda en juicio (no. 976-2006 de las 7 horas 40 minutos del 19 de diciembre de 2006). En efecto, la actora refiere en sus alegatos que la demandada, adquirió los derechos de información posesoria sobre un terreno sin inscribir, que acorde a su interpretación, forma parte de la finca de su propiedad, matrícula no. 22506-000 (hechos cuatro y nueve del escrito de demanda).

Asimismo, establece la accionante, que la demandada invadió y se apropió del terreno del traslape “y se mantiene hasta ahora en posesión del mismo”, lo cual elimina cualquier duda, en cuanto al carácter posesorio de las pretensiones esbozadas en la demanda. Por su parte la reconventora, en su pretensión número ocho, solicita: “Que la porción de terreno que es objeto de discusión en la presente reconvención se debe mantener en posesión de la empresa Dark Cave D.C. S.A.”. Asimismo, requiere, se ordene continuar con el proceso de información posesoria que se tramita en el demandada reconventora ha planteado con claridad meridiana, pretensiones dirigidas a que se le mantenga en posesión del terreno objeto de la disputa, así como en cuanto a que se ordene continuar con el proceso en el cual se declare su derecho a poseer la franja de terreno en discordia, posesión que según la propia actora reconoce, la accionada mantiene hasta esta fecha. De ahí que el reclamo por el cual se alega la violación de los preceptos 2 y 23 de la LJA y 104 del CPC no sea de recibo, debiéndose en consecuencia, proceder al rechazo del agravio.

V.En el segundo reproche, la recurrente sostiene, no hubo pronunciamiento de los juzgadores respecto de todas las cuestiones debatidas, toda vez que en la reconvención no se esbozaron pretensiones sobre derechos posesorios ni se resolvió en el fallo atacado sobre la prescripción negativa de su derecho de accionar. Al respecto, opina este órgano decisor, en cuanto al alegato en el sentido de que la contrademanda no incluye una declaratoria sobre derechos posesorios, conforme al Considerando IV, tal argumentación no es procedente, puesto que es claro, que no solo la reconvención incluye tales pretensiones, sino que del propio dicho de la actora en el escrito de demanda, resulta que a esta fecha, es esa sociedad la que posee el terreno objeto de disensión (hecho 12, escrito de demanda). Referente a no haberse resuelto lo relativo a la prescripción negativa del derecho a accionar, observa ésta Cámara, tal pretensión fue en efecto invocada como 5) de la reconvención.

En efecto solicitó se declarara la prescripción de cualquier derecho que la accionante pudiera tener sobre los terrenos objeto de contienda. También fue incluida en el escrito de contestación de la demanda. El Tribunal indicó, que en efecto fue planteada como excepción al plantearse la contestación de la demanda y como pretensión de la contrademanda. Señalaron los juzgadores, debe entenderse que esta fue acogida, al acogerse la falta de derecho para reivindicar. Asimismo, agregan los juzgadores, el A quo indicó que lo no concedido se entiende como denegado, pues es clara en cuanto a que admitió la acción declarativa del mejor derecho de posesión. De lo anterior, no lleva razón la recurrente en cuanto a que el fallo es omiso en ese respecto, razón que obliga al rechazo de dicho reproche.

VI.En el tercer reparo, el casacionista incluye una larga lista de lo que en su criterio, constituyen errores de apreciación probatoria en los que incurre el Tribunal. A efecto de valorar los supuestos yerros, debe hacerse notar, los jueces, sustentaron su fallo en la conclusión técnica a la cual arriba el perito nombrado por el Juzgado, Aquiles Chaves Arroyo, al establecer expresamente, que: “… La supuesta área de traslape de 2ha 6651-51 metros cuadrados no corresponde a una finca inscrita en el Registro de la Propiedad inmueble (sic)”. De tal forma, estimaron los juzgadores, el área de conflicto “pertenece al plano G-672530-2000 que describe el terreno para información posesoria a nombre de los poseedores Eladio Ponce Lara y Lemín Over Ibarra Lara”, lo cual, agrega, fue verificado “in situ”, por el Tribunal. No obstante, estima esta Cámara, en el asunto de análisis, las recurrentes olvidan que en esta instancia procesal no resulta suficiente manifestar una serie de disconformidades generales y meramente argumentativas, en tanto es menester, según se ha dicho, el contraste de lo decidido con la infracción general que, en su criterio, tuvo lugar en el fallo.

De ahí que no sea útil y en consecuencia deba rechazarse, la evocación de algunos de los errores de apreciación que plantea la actora, por cuanto es claro, no están dirigidos a atacar el fundamento brindado por los jueces en la resolución de interés. Así, resultan inútiles las manifestaciones respecto a la supuesta contradicción que se acusa, existió, al tener por acreditado el juzgador de primera instancia que su propiedad corresponde al plano G-0695623-2001, finca matrícula 225506-000, para posteriormente, indicar, que no se pudo demostrar en forma clara y contundente que fuera la dueña registral del terreno en litis. Lo anterior, por cuanto es claro, que desde la óptica del Tribunal, sustentada a su vez en la pericia del perito Aquiles Chavez, el terreno en pugna, no pertenece a la finca de la actora. Tampoco posee relevancia el que se haya dejado de mencionar la fecha de la escritura no. 142 en la cual Jimmy Rodríguez Montero donó su posesión a Eladio Ponce Lara y Lemin Over Ibarra Lara, puesto que no se trata de un elemento fáctico capaz de alterar el resultado de la intelección del Tribunal.

Adicionalmente, resulta indiscutible que el resumen de tal escritura pública si puede ser incluido como un hecho tenido por probado a juicio de los juzgadores, puesto que reseña la información contenida en un instrumento público, que al no haber sido argüido de falso, puede perfectamente integrar ese elenco probatorio. Tampoco es trascendente para los efectos impugnatorios del caso, lo que se aduce en cuanto a la fecha de elaboración del plano de la parte demandada, ni que en el proceso de información posesoria se haya señalado o no que se traspasaba a la accionada la posesión de Margarita Lara Salgado, o que en la solicitud de información posesoria se expresara que los solicitantes contaban con 10 años de posesión, puesto que ninguno de estos hechos tiene importancia alguna frente a la tesis asumida por el perito y el Tribunal, en cuanto a que no existe traslape. De la misma inteligencia, no reviste interés determinar si en efecto, el terreno en litigio fue vendido a la accionada por Margarita Lara, o si el juzgador de primera instancia dejó de mencionar si la actora planteó oposición en el proceso de información posesoria.

Carece igualmente de repercusión para el caso, si al traspasarse la posesión de Ponce Lara e Ibarra Lara a Dark Cave, se hicieron reservas a favor del comprador, o si Dark Cave reconoció en la contestación de la demanda haber realizado obras en la zona de conflicto durante julio y agosto de 2005. Tampoco en cuanto afirma la recurrente que el terreno de traslape se utilizó para agricultura mientras que ello se niega en la contestación de la demanda. Visto que las aseveraciones citadas no alcanzan a poner en entredicho los resultados de la prueba pericial, en estas condiciones. Ahora bien, la casacionista discute, que en el acta de reconocimiento judicial no se quiso consignar la presencia del topógrafo ni se hicieron indicaciones sobre el lugar donde antes estuvo la cerca. Al respecto, en cuanto al recurso de casación agraria por motivos procesales, esta Sala ha reiterado; que: “…a raíz de su nueva integración, y luego de una revisión profunda de esta postura, operó un cambio, dando apertura a la posibilidad de que el recurso sea formulado acusando algunos motivos procesales, concretamente en aquellos casos en que los vicios se hayan producido en la sentencia como acto procesal; no así los que se refieran al procedimiento, los que, por imperio de ley, se encuentran excluidos del control que ejerce esta Sala.

Lo anterior, en razón de que los primeros solamente pueden ser impugnados en esta sede, en tanto que los otros, pueden ser subsanados por el Tribunal. Con todo, los supuestos en los que se hace posible, se han ido definiendo, en la actualidad, circunscritos a los vicios por incongruencia y por reforma en perjuicio. Respecto del primero, puede verse resolución no. 583-F-2004 de las 11 horas 35 minutos del 14 de julio de 2004. En cuanto a la reformatio in pejus, se incorporó como causal a partir del fallo no. 1074-F-04 de las 11 horas 20 minutos del 16 de diciembre del 2004”. (Resolución no. 178 de las 9 horas con 50 minutos del 14 de marzo de 2007). Expuesto lo anterior, resulta inobjetable, éste órgano decisor no es competente para de vicios en el procedimiento. Sin perjuicio de lo anterior, y a mayor abundamiento de razones, observa esta Sala, ni en esa diligencia (folio 866) ni en la realizada el 24 de octubre de 2006, constan oposiciones de los representantes de la actora, ni escritos en los cuales se hubiese llamado la atención del despacho sobre alguna irregularidad o inconsistencia durante la celebración del reconocimiento, razón por la cual, no es de recibo el reclamo planteado en ese sentido.

Adicionalmente, en cuanto esgrime, que no fueron analizados los resultados del peritaje sobre daño ambiental contenidos en el informe de la empresa Consultec, es claro, conforme a folio 358 del expediente, que este fue aportado en forma tardía. En todo caso, nota este órgano decisor, el informe vertido no guarda relación con el fundamento en el que, como ya se ha dicho, se sustenta el fallo de examen cual es, que el área del traslape no es parte de la propiedad de la actora, sino que se ubica en el plano de los titulantes. Por ese motivo, del hecho de que los juzgadores no hagan relación en la sentencia al informe sobre daño ambiental, no resulta ningún perjuicio para la actora, ni reviste interés para efectos del recurso, pues no ataca la esencia de lo resuelto. Por lo anterior, es claro, al basarse el Tribunal en la tesis del perito Aquiles Chavez, en cuanto a que la zona de traslape no está contenida en la propiedad de la actora, resulta inútil cualquier prueba o argumento dirigido a demostrar el origen del bien, su fecha de adquisición, o la cadena de traspasos, pues conforme a esa probanza, es claro que el terreno no está ubicado en la finca de la actora.

VII.En cuanto a la prueba para mejor resolver, que dice, fue rechazada, estima esta Sala, en efecto, en primer término, se trata de prueba para mejor resolver ofrecida cuando el proceso estaba listo para dictar sentencia, constando en autos, la testimonial y documental ofrecida por las partes, que en criterio del Tribunal, resultaba suficiente a efecto del fallo. En forma complementaria, en el quien, si bien, de acuerdo a lo expresado por la actora, habría estado en condición de declarar sobre su participación en las labores de destrucción de las cercas en la colindancia de Federico Chacón, en la realidad testificó todo lo contrario, indicando expresamente que en ese lugar no se habían realizado trabajos, sino simple reparaciones de cercas. Referente a la declaración jurada del señor José Delgado Requene, que imputa, le fue rechazada, a diferencia de otras, ésta no fue ofrecida como testimonial, ni en el escrito de demanda ni en el de contestación a la reconvención, sino únicamente cuando se encontraban vencidas las etapas correspondientes, como prueba para mejor resolver ofrecida en el escrito de apelación (folio 807).

De tal manera, tanto respecto de las declaraciones juradas otorgadas ante notario, como de las pruebas fotográficas ofrecidas, quedaba al criterio del Tribunal determinar su aceptación, o no, (art. 331 del CPC) sin que su rechazo implicara alguna suerte de vicio ante un haber probatorio, que resultaba por demás amplio.

VIII.Finalmente, en cuanto recalca la casacionista, que los jueces “sobrevaloran” el peritaje rendido por el señor Aquiles Chaves Arroyo, a pesar de que hay prueba en los autos que refuta lo que dicho profesional concluye, estima esta Cámara, tanto en el peritazgo rendido por el señor Aquiles Chaves Arroyo (folio 575), como en la prueba técnica elaborada por el Ingeniero José Joaquín Castro García (folio 359), y testimonial del señor Franklin Carazo Serrano (folio 537), como en los informes técnicos rendidos por la empresa Geotop (folios 486 y 637), se determina la existencia de errores de cierre en todos los planos objeto de examen. Si bien, tanto Chaves Arroyo como Carazo Serrano, estiman, son errores pequeños y aceptables, es clara la posición de Castro García en cuanto a que, “técnicamente no puedo determinar los linderos reclamados de manera confiable pues los documentos fundamentales para eso, no tienen la consistencia necesaria”.

Asimismo, sobre la idoneidad de los planos de la parte actora, refirió: “tienen serias inconsistencias para utilizarlos como fundamento técnico para tal análisis”. Por su parte, el peritaje del señor Chaves Arroyo, precisó que los errores que presenta el levantamiento de la poligonal de apoyo para elaborar el plano G-503693-1998 (que describe el fundo de la actora), “conducen a no darle credibilidad a dicho plano”. Enfatiza desde esa arista, que tales errores, “son considerables y no aceptables” y existe un error de cierre que provoca el traslape con el plano G-672530-2000 (plano de la información posesoria de la demandada). Finalmente afirma, que el plano G-672530-2000 “se ajusta a la realidad tanto en el terreno, como en su forma”. Agrega que los errores de cierre existentes en el plano 672530-2000 son menores y aceptables. De la misma manera, los estudios realizados por la empresa Geotop, (folios folios 486 y 637), establecen la existencia de errores lineales de cierre en todos los planos, indicando, que los encontrados en el plano original de la actora G-503693-98, son aceptables, pero que, al calcularlo en el protocolo del topógrafo, encontró dificultad para comprender su letra y la grafía de los números.

También detectó un error en el derrotero del plano G-695623-2001, (de la actora) refiriendo que, posiblemente, el acimut contiene un error de digitación. En cuanto al plano de la demandada, G-672530-2000, encontró diferencias entre el protocolo y el plano, entre ellas, mas puntos en el derrotero del protocolo que en el plano, con un croquis diferente en el protocolo. En cuanto al examen pericial que realiza esta misma empresa tomando en cuenta el informe pericial de Chaves Arroyo, estimó que: “…al existir diferencias entre la información del protocolo y el derrotero del plano, provoca la pérdida de credibilidad del plano catastrado G-672530-2000”. Adicionalmente, si bien el Tribunal en su fallo indicó, que tuvo por acreditadas “in situ” las características físicas y geográficas del inmueble y que corresponden a la realidad material y cartográfica del bien que se describe, no obstante, observa esta Cámara, no prestó atención a la diversa prueba técnica que señaló falencias en los planos que afectaban su credibilidad a efecto de establecer los linderos reclamados de manera confiable.

En efecto, los juzgadores no emitieron criterio alguno respecto de los informes rendidos por el Ingeniero José Joaquín Castro y la empresa Geotop. No se incluye en la resolución ningún comentario sobre el primero de los estudios, visible a folio 486 en el cual se determinaron errores de derrotero y cierre de todos los planos revisados, tampoco en el elaborado por Castro García, que indicó no poder determinar los linderos reclamados de manera confiable, puesto que los documentos utilizados carecían de la consistencia necesaria. Tampoco se hace relación en la sentencia al segundo estudio elaborado por Geotop, el cual reitera la existencia de error en los derroteros del plano de la demandada, con un posible yerro al digitar la inclusión de uno de los acimutes, arrojando también duda sobre la credibilidad del plano G-672530-2000. De tal suerte, es claro que la falta de mención del informe de Geotop por parte de los juzgadores, implica un error en la valoración probatoria, que imposibilita al Tribunal para tener como único fundamento en su fallo, el peritaje rendido por el señor Aquiles Chaves Arroyo, toda vez que los planos utilizados para los diversos estudios topográficos y de geodesia, carecen de la consistencia necesaria a ese fin.

En efecto las valoraciones vertidas en los estudios de Geotop, impiden otorgar el grado de credibilidad que al efecto le ha otorgado el Tribunal al peritaje del señor Chaves Arroyo. No obstante, nota este órgano decisor, la casación resulta inútil, pues ante la falta de prueba contundente en cuanto a la existencia de un traslape en uno u otro sentido, debido básicamente a la inconsistencia de los planos en cuestión, ninguna de las probanzas aportadas al proceso por los respectivos profesionales resulta definitiva en sus hallazgos, a efecto de establecer si existe o no la alegada sobreposición de planos, alegato en el cual se funda la demanda. De tal suerte, la falta de elementos de convicción suficientes que ratifiquen si existe el traslape entre los planos de la propiedad de la actora y la pretendida titulación de la demandada, impide acoger la tesis de la primera. En esa línea, aunque por razones distintas, la decisión del Tribunal deberá mantenerse y habrá de rechazarse el cargo.

IX.En la cuarta censura, recrimina, su representada es propietaria de la finca de Guanacaste matrícula 22506-000, que se identifica plenamente con el plano G-0695623-000. Agrega, la demandada posee legitimación pasiva, por cuanto existe un traslape del plano de la accionada, quien además modificó los linderos, pretendiendo inscribir parte de su propiedad como suya. Al respecto, en criterio de esta Sala, el agravio no cumple los requisitos mínimos a efecto de ser tenido como tal, por cuanto no combate la sentencia. Al contrario, se limita a señalar que las partes tienen legitimación sin hacer referencia a la forma en que ello guarda relación con lo resuelto, razón por la cual, el cargo es informal, por lo que debe ser rechazado.

X.En mérito de lo expuesto, procederá denegar el recurso. Se confirma la sentencia. Se establecen las costas a cargo del recurrente conforme al canon 611 del Código Procesal Civil.

POR TANTO

Se confirma la sentencia recurrida. Son sus costas a cargo de quien lo interpuso.
