BACKGROUND 1. Based on the facts they set forth and the legal provisions they cited, the claimants in case files no. 09-000156-1027-CA, 09-000157-1027-CA and 09-000158-1027-CA instituted proceedings involving pure questions of law, seeking a judgment declaring: “An award of costs and the cessation of the activity are sought against all defendants. With respect to ICE, the annulment of the official communication dated 17 de setiembre de 1993 and resolution 5104-0152-2009 is sought. With respect to the State, a declaration is sought that the administrative actions preceding the issuance of the resolution granting the water concession were lawful, as well as the annulment of resolution R-321-2009-aguas-minaet. Against Incopesca, the annulment of decision AJDIP-2080-2006 is sought.” 2. At a consolidation hearing (audiencia de acumulación) held on 11 de marzo de 2009, Judge José Martín Conejo Cantillo, by resolution n.° 459-2009 issued at 8:47 a.m., ordered the consolidation of proceedings numbers 09-000156-1027-CA, 09-000157-1027-CA and 09-000158-1027-CA.
3. The State filed its answer as recorded at folios 1150 to 1159 and raised the preliminary defense (defensa previa) of lack of jurisdiction, which was decided by an interlocutory ruling, as well as the defenses (excepciones) of failure to establish a legal right, lack of a current interest, and lack of standing to sue and be sued. The co-defendant Asociación filed its answer as recorded at folios 942 to 954 and raised the defense of defective representation, which was decided at the preliminary hearing held on 14 de mayo de 2010, as well as the defenses of failure to establish a legal right and lack of standing to sue and be sued. Instituto Costarricense de Electricidad, for its part, filed its answer as recorded at folios 969 to 985 and raised the defenses of failure to establish a legal right and lack of a current interest. It likewise raised the preliminary defense of the statute of limitations (prescripción), which resolution n.° 26-35-2010, issued at 9:55 a.m. on 20 de julio de 2010, ordered reserved for decision in the judgment.
Finally, Instituto de Pesca y Acuacultura did not file an answer within the allotted period; it was therefore declared in default (rebelde), and the allegations of fact in the complaint were deemed admitted. It subsequently raised the defense that the administrative conduct was not subject to challenge (inimpugnabilidad de la conducta administrativa), which was decided by oral resolution n. ° 2632-2010 at 9:27 a.m. on 20 de julio de 2010.
4. The preliminary hearing (audiencia preliminar) was held on 22 de enero, 14 de mayo and 20 de julio, all in 2010, on which occasions all parties were heard.
5. Tribunal Contencioso Administrativo, Sección Sexta, composed of Judges Jorge Leiva Poveda, Cynthia Abarca Gómez and Marianella Álvarez Molina, ruled in judgment n.° 3471-2010 at 3:00 p.m. on 27 de agosto de 2010: “The statute-of-limitations defense raised by INSTITUTO COSTARRICENSE DE ELECTRICIDAD and the defense of lack of standing to sue and be sued raised by the ESTADO are denied. The defenses of failure to establish a legal right raised by all co-defendants and the defense of lack of interest raised by the ESTADO and INSTITUTO COSTARRICENSE DE ELECTRICIDAD are sustained. Consequently, the complaint filed by B, S.A., H, S.A., and A, S.A., against the ESTADO, INSTITUTO COSTARRICENSE DE ELECTRICIDAD, P and T is dismissed. The claimant shall bear the costs of these proceedings.” 6. The claimant files an appeal, expressly stating the grounds on which it relies to refute the Tribunal’s position.
7. In the proceedings before this Sala, all statutory requirements have been observed.

CONSIDERATIONS
I.In the complaint giving rise to these proceedings, filed on 3 de febrero de 2009 against T (hereinafter, the Asociación), Instituto Costarricense de Electricidad (hereinafter ICE), P and A, and the State, the representative of P S.A., B S.A., and A S.A. (hereinafter, the claimants) stated that they engage in tilapia production in the Arenal Tempisque irrigation district (hereinafter DRAT), using water supplied by SENARA’s canal network. He explained that the water used by DRAT comes from the flow released by the hydroelectric complex comprising the Arenal reservoir, which is used for fish-farming and agricultural activities. He noted that, in 1986, a project for producing tilapia in floating cages using the public-domain waters (aguas de dominio público) of that reservoir was launched under a cooperation agreement between the governments of Costa Rica and Germany. He argued that the Asociación subsequently continued that operation.
For this purpose, he added, it obtained permits from ICE and Incopesca. Nevertheless, he stated that, in order to operate the project, the Asociación had not obtained from Ministerio de Ambiente, Energía y Telecomunicaciones (hereinafter MINAET) a concession for the use and exploitation of water (concesión de uso y aprovechamiento de aguas). He alleged harm arising from environmental pollution and unlawful use of the public domain. In the judgment, he seeks declarations that: a) the Asociación unlawfully exploits the waters of Lago Arenal because it does not hold a water-use concession granted by MINAET; b) because a public-domain asset is being unlawfully exploited, MINAET, in its capacity as the competent administrative authority, must regulate and terminate that improper exploitation; c) MINAET must immediately terminate the exploitation by the association entity because it lacks the corresponding water concession; d) MINAET must, going forward, take all necessary administrative actions to prevent and prohibit the Asociación from commercially exploiting the public-domain waters of Lago Arenal; e) the administrative act issued by ICE in the official communication dated 17 de setiembre de 1993 is null and void; and f) the administrative act issued by the Junta Directiva de Incopesca, decision A.J.D.I.P / 280-2006 of 16 de junio de 2006, is null and void.
The defendants denied the allegations. The State raised the defenses of failure to establish a legal right, lack of standing to sue and be sued, lack of interest, and lack of jurisdiction. The latter was denied by interlocutory resolution no. 1975-2009 of 11 de setiembre de 2009. The Asociación alleged defective representation of the claimants and raised the defense of failure to establish a legal right. The preliminary defense was decided in resolution no. 1795-2010 of 14 de mayo de 2010. ICE’s counsel raised the defenses of failure to establish a legal right, lack of a current interest, and the statute of limitations. Incopesca was declared in default. The Tribunal denied the statute-of-limitations defense raised by ICE and the defense of lack of standing to sue and be sued raised by the State. It sustained the defenses of failure to establish a legal right raised by all co-defendants and the defense of lack of interest raised by the ESTADO and ICE.
It dismissed the complaint in its entirety, with both procedural costs and attorneys’ fees (ambas costas) to be borne by the claimant. Dissatisfied, counsel for the co-claimants seeks review on cassation (casación).
II.The appellant in cassation raises three objections. In the first, she alleges violation of Articles 11 of the Political Constitution (Constitución Política, hereinafter CP), and 11, 158, 166, 172, 182, and 188 of the General Law of Public Administration (Ley General de la Administración Pública, hereinafter LGAP), all due to failure to apply them; Article 1 of Ley 4334 due to improper application; and Articles 82 and 83 of the Fisheries and Aquaculture Law (Ley de Pesca y Acuicultura) No. 8436 (hereinafter Ley de Pesca). She states that the complaint sought a declaration of nullity of the administrative act (acto administrativo) issued by ICE in the official letter dated 17 de setiembre de 1993, whereby, on the basis of the cited provision of Ley 4344, it raised no objection to tilapia farming in the Arenal reservoir. She states that the complaint timely alleged that ICE lacks jurisdiction to grant commercial authorizations for the use of waters in Laguna Arenal.
She argues that Ley 4334 establishes a public purpose for those waters—the production of electricity—and prohibits the National Electricity Service (Servicio Nacional de Electricidad, hereinafter SNE) from granting water concessions (concesiones hidráulicas) where they would interfere with electricity generation, without consulting ICE. She states that the Court found that ICE had acted in accordance with the law because its powers remained in effect even though SNE had ceased to exist as such. In her view, by ruling in this manner, the Court improperly applied Article 1 of Ley 4334, because ICE is not authorized by law to rule on the commercial activities of private parties. She further states that the authority of that Institute to provide a consultative opinion concerning concessions for water resources ceased to exist when the Law Creating SNE (Ley de Creación del SNE) was repealed. She notes that even if the judges’ assertion were accepted—that ICE retains powers with respect to administrative conduct by other public entities and bodies that might affect the purpose for which the lagoon was built—it must be noted that the Association is a private-law entity; that is, it is neither a public entity nor a public body, which, under the Court’s reasoning, are the only parties that may request ICE’s opinion on this matter.
In the second objection, she alleges violation of Articles 82 and 83 of Ley de Pesca, as well as Articles 158, 166, 172, 182, and 188 of the LGAP. She argues that the complaint sought a declaration of absolute nullity (nulidad absoluta) of the administrative act issued by the Board of Directors of Incopesca, resolution A.J.D.I.P / 280-2006 of 16 de junio de 2006, whereby the Association was authorized to farm tilapia in floating cages in Laguna de Arenal. She contends that she also timely alleged that this act violated Articles 82 and 83 of Ley de Pesca because the Association failed to submit two requirements established by that legislation: the water concession (concesión de aguas) and the environmental impact assessment (evaluación de impacto ambiental). She notes that Incopesca acknowledged this when it filed its untimely response to the complaint, and that the Court accepted it as proven fact number 11.
Nevertheless, she states, in recital IX (considerando IX), the challenged judgment provides that, although the act was indeed issued without compliance with all formal requirements, those defects were remedied during the proceedings, bringing the act into compliance with the law under Article 188 of the LGAP and Article 82 of Ley de Pesca. Thus, she maintains, the Court acknowledges that the act was issued without compliance with expressly established requirements, thereby violating the aforementioned articles of Ley de Pesca and the LGAP. She emphasizes, however, that in the absence of those requirements, the act is void and cannot be cured (sanearse) or validated (convalidarse), because it constitutes a substantial violation of the legal system that requires the judge to declare its absolute nullity. She concludes that the judges erred in applying Article 188 of the LGAP because it establishes a power of the Public Administration, not of the judicial body.
Accordingly, she states, by deeming an absolute nullity to have been remedied, the Court failed to apply, and improperly applied, the cited provisions. She adds that, although the complaint sought an order holding the State liable for an omission (conducta omisiva), because it tolerated the Association’s exploitation of the lagoon’s waters without having the concession granted by MINAET, the Court held that the granting of the water concession to the Association, a process initiated during the proceedings, was not only lawful but legally mandatory for the public administrations, which in her view violates Article 82 of Ley de Pesca. In the third objection, she alleges violation of Article 193 of the CPCA. She emphasizes that the Court ordered her to pay costs, finding that in this case there was no reason to apply the statutory exceptions and depart from the principle that costs are imposed on the unsuccessful party. She maintains that she had sufficient grounds to litigate and that Article 193 was therefore violated when costs were imposed on the unsuccessful parties.
III.In the first ground of appeal, the appellant in cassation essentially argues that ICE lacks jurisdiction to grant commercial authorizations for the use of waters in Laguna Arenal because Ley 4334 establishes electricity generation as the public purpose of those waters. She further states that, following the repeal of Ley de Creación del SNE, that Institute lacks jurisdiction to provide a consultative opinion concerning concessions for water resources. She adds that the Association does not possess the public-law status that would allow it to invoke ICE’s jurisdiction. In this regard, the Court found that the alleged lack of jurisdiction did not arise in this case because that entity did not grant a permit on the terms alleged by the plaintiff, but merely stated that the Association’s use of the waters for aquaculture activities was not incompatible with electricity generation. The judges found that Article 1 of Ley 4334 expressly establishes ICE’s duty “to issue formal administrative measures such as the challenged measure,” so as not to affect the lake’s principal purpose.
The judges add that, although Servicio Nacional de Electricidad no longer exists, the jurisdiction of Instituto Costarricense de Electricidad in this area remains in effect “insofar as the body of law governs the powers of other public entities and bodies that may adopt administrative measures affecting the purpose for which the artificial lagoon of Arenal was constructed.” Article 1 of Ley 4334 establishes ICE’s duty to issue administrative acts in order to determine whether the activity in question affects the purpose reserved for the lagoon. That provision states: “Laguna Arenal, Laguna Cote, and Río Arenal (channel and waters) are hereby declared a national electricity reserve area, in accordance with the map prepared by Instituto Geográfico de Costa Rica (sheets 3247 III and 3247 IV). This area includes the banks to the extent necessary to ensure that the resources of this watershed are transformed into electrical energy usable for the country’s development.
Servicio Nacional de Electricidad shall not grant water concessions in that watershed if they could interfere with or affect its utilization, for which purpose it shall consult Instituto Costarricense de Electricidad on each occasion.” It is clear from the foregoing that the legislature not only established a national reserve for electricity generation in those waters, but also required that water concessions granted over them receive ICE’s opinion in order to determine whether they would interfere with or affect their use for energy production. In this case, the respondent Institute, by means of an official letter dated 17 de setiembre de 1993, signed by the then General Manager of ICE, engineer Mario Hidalgo P., stated “... that, for our part, there is no objection to your carrying out the commercial activity of tilapia farming ... in cages, in the area of San Luis de Tronadora on the shore of Embalse Arenal...” (Proven fact numbered 5).
From the foregoing, this Chamber does not find that, in issuing the cited administrative act, ICE exceeded its powers or engaged in conduct not authorized by Ley 4334, because the opinion issued merely indicates that the Institute did not object to the proposed activity and does not constitute a specific authorization to commence those productive operations. This is precisely the responsibility assigned to ICE by law, since it is clear that, by raising no objection to the aquaculture operations at issue, it merely stated that those waters’ hydroelectric resources would not be affected. Nor does this Chamber agree with the contention that, under the judges’ reasoning, only public entities or bodies may invoke ICE’s jurisdiction over the waters of Laguna de Arenal, a status that the applicant Association does not possess. In this regard, the Court did indeed state that, for as long as other public entities and bodies retain powers to adopt administrative measures that may affect the purpose of Embalse Arenal, ICE retains the jurisdiction conferred upon it by law.
That statement is far removed from the alleged objection, because the judgment does not limit ICE’s powers in this area to addressing applications from public entities; rather, it extends their validity over time for as long as public entities exist with powers relating to the reservoir’s water resources, a legal premise unrelated to the objection asserted, which must therefore be rejected.
IV.In the second objection, the appellant claims that administrative act (acto administrativo) A.J.D.I.P / 280-2006, issued by Incopesca, authorized the Asociación to farm tilapia in floating cages in Laguna de Arenal without satisfying two legally prescribed requirements, namely, the water concession (concesión de aguas) and the environmental impact assessment (evaluación de impacto ambiental). The appellant adds that the foregoing was acknowledged by that Institute and admitted by the Tribunal in proven fact number 11 of the challenged judgment. Nevertheless, the appellant argues that, in its considerando IX, the judgment under appeal provides that, although the act was issued without compliance with all formalities, those omissions were cured during the proceedings under section 188 of the LGAP and provision 82 of the Ley de Pesca. The appellant contends that the absence of those requirements renders the act defective and that it cannot be cured or validated, because it constitutes a substantial violation of the legal system.
The Tribunal stated that, although Incopesca issued the referenced act without some of the formalities required by the legal system having been satisfied at that time, all statutory requirements were in fact met during the proceedings, thereby bringing the application into compliance with the law pursuant to sections 188 of the LGAP and 82 of the Ley de Pesca. Additionally, the judges stated that, with respect to the omissions attributed to MINAET—the absolute nullity (nulidad absoluta) of the concession granted—it is clear that said body had jurisdiction to issue the act requested by the codefendant Asociación. Indeed, they reiterate that the fact that not all legal requirements had initially been met did not prevent the regulated party (administrado) from regularizing its legal status. They add that public administrations may take affirmative administrative action aimed at regularizing a regulated party’s legal status, which is not only lawful but also legally mandatory for them.
This Chamber notes that provision 82 of the Ley de Pesca expressly provides: “To develop aquaculture projects, the natural or legal person must obtain: a) An authorization granted by the I for farming aquatic organisms in marine or inland waters. b) A concession for the use and exploitation of water granted by MINAE. The foregoing is without prejudice to the other requirements established in other laws. The concession and authorization grant their holder temporary rights to use water and exploit fishery aquatic resources directly related to the activity. The term of the concession shall conform to the provisions of artículo 19 of the Ley de Aguas, and the term of the authorization shall be up to ten years, renewable by express act. The respective contract shall define the rights and duties, annual fees, guarantees, and limitations relating to authorizations and concessions for the development of aquaculture.
Renewals shall be governed by the Reglamento of this Law.” The cited provision states with unmistakable clarity that, to develop projects of this kind, the interested party must obtain authorization from Incopesca and a concession for the use and exploitation of water from MINAE (now MINAET), without prejudice to other requirements. However, the provision does not establish an obligation to hold the water-use concession as an act or prerequisite for obtaining the permit from Incopesca. For its part, provision 83 of the Ley de Pesca establishes: “To apply for an aquaculture authorization and a concession for water use, interested parties must submit the respective aquaculture projects together with an environmental impact assessment. (…) The concession may not be approved without such determination, which shall be binding on the parties. SETENA is required to issue its determination within the specified period; otherwise, the corresponding official shall incur disciplinary or civil liability…” It follows from that provision that, to apply for the aquaculture authorization (issued by Incopesca), as well as for the water concession (under the responsibility of MINAET), the applicant must submit the aquaculture project and environmental impact assessment.
In that regard, this Chamber notes that the codefendant Asociación obtained the permit to operate T no. 4100174, which was granted by Incopesca through resolution AJDIP/280-2006, dated 16 de junio de 2006 (page 379 of the expediente and proven fact number 9). By that date, the applicant had already obtained environmental approval (viabilidad ambiental) from Setena through resolution 981-2006 of 24 de mayo de 2006. (pages 376-378 of the expediente and proven fact numbered 13). Likewise, the Asociación applied to MINAET for a water concession, which was processed under expediente 13198 A, according to the notice published in the Diario Oficial La Gaceta number 12 of 19 de enero de 2009, and which was granted to it for agricultural use (fish farming), for a term of 10 years, pursuant to resolution R-0321-2009 AGUAS-MINAET, issued at 13 hours on 22 de abril de 2009. (Proven Fact designated 12); by which date it did, in fact, have environmental approval.
It is abundantly clear from the foregoing that, although some of these procedures were completed after Incopesca issued administrative act A.J.D.I.P / 280-2006, the Asociación held environmental approval both when the cited tilapia-farming permit was issued and when the water concession was granted, this being the only requirement in addition to the aquaculture project that is mandatory for those purposes under provision 83 of the Ley de Pesca. Thus, although the Tribunal found in its judgment that some requirements had not been obtained in a timely manner, they had been cured by the applicant, which authorized the relevant Public Administration to grant the permits. It is indisputable that the Asociación met the requirements necessary to develop the aquaculture project, without prejudice to the statutory authority to cure existing defects in the proceeding pursuant to provision 188 of the LGAP; accordingly, the claim must be rejected.
V.In the third ground, the appellants complain that the judgment ordered them to pay costs despite their having litigated in good faith and that, under section 193 subsection b) of the CPCA, the court could have refrained from awarding costs because they had sufficient grounds to litigate. As stated by the Tribunal, costs must necessarily be imposed on the unsuccessful party pursuant to provision 193. This Chamber notes that the cited provision of the applicable Code states that, “in judgments and interlocutory orders having the effect of a judgment, the unsuccessful party shall be ordered to pay attorney fees and procedural costs (costas personales y procesales), and such ruling shall be made sua sponte.” The cited provision continues: “Notwithstanding the foregoing, the unsuccessful party may be exempted from paying costs when: a) The judgment is rendered on the basis of evidence whose existence the opposing party could not reasonably have known and, because of that circumstance, the party’s opposition was justified. b) In the Tribunal’s opinion, the nature of the issues disputed provided sufficient grounds to litigate.” Thus, an award of costs against the unsuccessful party follows from the mere fact of being unsuccessful, that is, from losing the litigation, without this meaning that the party did not act in good faith or lacked sufficient grounds to litigate.
Therefore, in the view of the majority of this Chamber’s members, exemption is a discretionary power of the adjudicator; consequently, if the adjudicator does not exercise it, the alleged violation does not arise, since the Tribunal merely applied the provision, and the objection must therefore be rejected.
VI.In view of the foregoing, the appeal shall be denied and its costs imposed on the appellant pursuant to provision 150.3 of the Código Procesal Contencioso Administrativo.
POR TANTO
The appeal is denied. Its costs shall be borne by the party who filed it.

I.The undersigned members do not share the position adopted by the majority of this Chamber in considerando V of the preceding judgment insofar as it denies cassation review (control casacional) in cases where only the general rule ordering the unsuccessful party to pay both categories of costs is applied, that is, where no provision concerning exemption from such costs is invoked or applied. Indeed, the majority’s jurisprudential rationale proceeds from the premise that exemption from paying costs is a discretionary power and that no error or violation of law occurs when that power is not exercised or applied; accordingly, it is said that, absent a violation of law, a cassation court cannot assess or modify the ruling ordering the unsuccessful party to pay costs because, to reiterate, the majority of this Chamber considers that a legal violation can arise only when the relevant exemption provision is applied (among many others, see judgments of this Chamber no. 1001- F-2002, issued at 11 hours 50 minutes on 20 de diciembre de 2002; 249-F-2003, issued at 11 hours 45 minutes on 7 de mayo de 2003; and 306-F-2006, issued at 10 hours 20 minutes on 25 de mayo de 2006).
At first, the reasoning appears logical because, under this premise, if exemption constitutes a discretionary power, the adjudicator is not required to grant it; therefore, if the adjudicator does not order or grant such exemption, the provisions governing the matter are not violated. Consequently, if no violation of legal provisions occurs, there can be no cassation review (see resolutions of this Chamber no. 765, issued at 16 hours on 26 de septiembre de 2001, and 561-F-2003, issued at 10 hours 30 minutes on 10 de septiembre de 2003). This line of reasoning allows them to conclude that, in that specific situation—the mere award of costs or failure to apply the exemptions—the matter “cannot be reviewed before this court” (judgment n° 419-F-03 of this same adjudicative body, issued at 9 hours 20 minutes on 18 de julio de 2003), because it is a situation “not subject to cassation” (judgment n° 653-F-2003, issued at 11 hours 20 minutes on 8 de octubre de 2003).
Thus, in the opinion of our distinguished colleagues, a cassation appeal is unavailable when the discretionary power to grant an exemption is not exercised (see, a contrario sensu, considerandos III and VIII, respectively, of resolutions 541-F-2003, issued at 11 hours 10 minutes on day 3, and 563-F-2003, issued at 10 hours 50 minutes on day 10, both in septiembre de 2003). The majority has thus held that “…the award of costs against the unsuccessful party, as occurred here, is not reviewable by this Court, given that the Tribunal merely applied the provision on the terms prescribed therein” (See considerando X of vote no. 68-F-2005, issued at 14 hours 30 minutes on 15 de diciembre de 2005). And in notarial matters, it has been stated even more emphatically: “…the Tribunal ordered the complainant to pay the costs associated with the claim for compensation, a ruling that, it bears repeating, is not subject to cassation.” (considerando X of judgment n° 928-F-2006, issued at 9 hours 15 minutes on 24 de noviembre de 2006).
II.However, in the opinion of the undersigned, the improper failure to apply the provisions permitting exemption from costs unquestionably violates the legal system and, specifically, the rules authorizing such exemption, whether due to error or an improper assessment by the judges in the particular dispute. In that regard, although this is a discretionary power, it is nevertheless not immune from review on cassation (casación), since both its exercise and its non-application may constitute a violation of law; accordingly, an improper omission is not, and must not be, synonymous with arbitrariness committed, in such a case, by the judge himself or herself. This is particularly so where the judge has been granted authority subject to specific conditions that limit judicial discretion in this matter. Consequently, with respect to this particular issue, we consider that the mere application of the general rule set forth in Article 193 of the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo) (requiring the unsuccessful party to pay both categories of costs) does not preclude an appeal on cassation (recurso de casación).
On the contrary, the matter is admissible for a ruling on the merits (provided that the statutory requirements are met) where there may have been an omission in applying the statutory provisions authorizing exemption from those costs (sections 55 of the Agrarian Jurisdiction Law (Ley de la Jurisdicción Agraria) and 193 of the Administrative Litigation Procedural Code). Notwithstanding the foregoing, in the specific case under review, these members concur with the Tribunal’s ruling on the merits insofar as it required the unsuccessful party to pay those costs, because, all the arguments challenging the judgment having been rejected, they cannot proceed to analyze this issue. That circumstance leads us to reject this ground of appeal and, with it, the appeal filed in this respect.

Las personas físicas son mayores de edad y con las salvedades hechas, casados, abogados y vecinos de San José.
RESULTANDO
1. Con base en los hechos que expusieron y disposiciones legales que citaron, las accionantes en los expedientes no. 09-000156-1027-CA, 09-000157-1027-CA y 09-000158-1027-CA, establecieron procesos de puro derecho, a fin de que en sentencia se declare: “Contra todos los demandados se solicita la condena en costas y el cierre de la actividad. En relación al ICE se pretende la nulidad del oficio del 17 de setiembre de 1993 y la resolución 5104-0152-2009. En relación al Estado se pretende la declaratoria de legitimidad de las actuaciones administrativas previas al dictado de la resolución que otorgó la concesión de aguas y la nulidad de la resolución R-321-2009-aguas-minaet. Contra la Incopesca se pretende la nulidad del acuerdo AJDIP-2080-2006.” 2. En audiencia de acumulación celebrada el 11 de marzo de 2009, el juez José Martín Conejo Cantillo, en resolución n.° 459-2009 de las 8 horas 47 minutos ordenó la acumulación de los procesos números: 09-000156-1027-CA, 09-000157-1027-CA y 09-000158-1027-CA.
3. El Estado contestó conforme a folios 1150 a 1159 e interpuso la defensa previa de falta de competencia, la cual fue resuelta interlocutoriamente; así como las excepciones de falta de derecho, falta de interés actual, falta de legitimación activa y pasiva. La Asociación codemanda contestó acorde a los folios 942 a 954 y opuso la defensa de defectuosa representación, siendo resuelta en la audiencia preliminar efectuada el 14 de mayo de 2010; y, las excepciones de falta de derecho y falta de legitimación activa y pasiva. El Instituto Costarricense de Electricidad, por su parte, contestó conforme a folios 969 a 985 e interpuso las excepciones de falta de derecho y falta de interés actual. De igual forma, opuso la defensa previa de prescripción, la cual en resolución n.° 26-35-2010 emitida a las 9 horas 55 minutos del 20 de julio de 2010 dispuso reservar para el dictado de sentencia. Finalmente, el Instituto de Pesca y Acuacultura no contestó dentro del plazo otorgado al efecto, por lo que se le declaró rebelde y por contestados afirmativamente los hechos de la demanda. Posteriormente, interpuso la excepción de inimpugnabilidad de la conducta administrativa, la cual fue resuelta mediante resolución oral n. ° 2632-2010 de las 9 horas 27 minutos del 20 de julio de 2010.
4. La audiencia preliminar se celebró los días 22 de enero, 14 de mayo y 20 de julio, todos de 2010, oportunidades en las cuales todas las partes hicieron uso de la palabra.
5. El Tribunal Contencioso Administrativo, Sección Sexta, integrada por los jueces Jorge Leiva Poveda, Cynthia Abarca Gómez y Marianella Álvarez Molina, en sentencia n.° 3471-2010 de las 15 horas del 27 de agosto de 2010, resolvió: “Se rechaza la excepción de prescripción opuesta por el INSTITUTO COSTARRICENSE DE ELECTRICIDAD y la de falta de legitimación activa y pasiva opuesta por el ESTADO. Se acogen las de falta de derecho opuestas por todos los codemandados y la de falta de interés opuesta por el ESTADO y el INSTITUTO COSTARRICENSE DE ELECTRICIDAD. En consecuencia, se rechaza la demanda presentada por B, S.A., H, S.A., y A, S.A., contra el ESTADO, el INSTITUTO COSTARRICENSE DE ELECTRICIDAD, el P y la T. Son las costas de este proceso a cargo de la parte actora.” 6. La parte actora, formula recurso indicando expresamente las razones en que se apoya para refutar la tesis del Tribunal.
7. En los procedimientos ante esta Sala se han observado las prescripciones de ley.
Redacta la Magistrada Escoto Fernández, excepto el considerando V, que redacta el magistrado Rivas Loáiciga;
CONSIDERANDO
I.En la demanda origen de este proceso, interpuesta el 3 de febrero de 2009, contra la T (en lo que sigue (la Asociación), el Instituto Costarricense de Electricidad (en adelante ICE), el P y A y el Estado; el representante de las P S.A., B S.A., y A S.A., (en adelante las actoras), manifestó, estas se dedican a la producción de tilapia en el distrito de riego Arenal Tempisque (en lo subsecuente DRAT), utilizando aguas que proveen la red de canales del SENARA. Explicó, el agua que aprovecha el DRAT proviene del caudal liberado por el complejo hidroeléctrico que conforma el embalse Arenal, el cual es utilizado para actividades piscícolas y agrícolas. Apuntó, en el año 1986, se inició un proyecto de producción de tilapia en jaulas flotantes utilizando las aguas de dominio público del referido embalse, el cual se realizó en el marco de un convenio de cooperación entre los gobiernos de Costa Rica y Alemania.
Argumentó, con posterioridad, la Asociación, continuó dicha explotación. Para ello, agregó, obtuvo permisos del ICE y de Incopesca. No obstante, señaló, para explotar dicho proyecto, la Asociación no ha obtenido una concesión de uso y aprovechamiento de aguas por parte del Ministerio de Ambiente, Energía y Telecomunicaciones (en lo subsiguiente MINAET). Alegó perjuicio por contaminación ambiental y uso ilegal del dominio público. En sentencia solicita se declare: a) la Asociación explota de manera ilegítima las aguas del Lago Arenal, por cuanto no cuenta con la concesión para el uso de agua otorgada por MINAET; b) al explotarse ilegítimamente un bien de dominio público, MINAET en su condición de órgano administrativo competente, debe regular y hacer cesar esa explotación indebida; c) el MINAET debe cesar de inmediato la explotación por parte del ente asociativo, por cuanto carece de la respectiva concesión de aguas; d) el MINAET debe a futuro realizar todas las conductas administrativas necesarias para prevenir e impedir que la Asociación explote comercialmente las aguas de dominio público del Lago Arenal; e) la nulidad del acto administrativo emitido por el ICE en el oficio del 17 de setiembre de 1993; f) la nulidad del acto administrativo emitido por la Junta Directiva de Incopesca, acuerdo A.J.D.I.P / 280-2006 de 16 de junio de 2006.
Los demandados contestaron en forma negativa. El Estado opuso las excepciones de falta de derecho, legitimación activa y pasiva, interés e incompetencia. Esta última fue rechazada interlocutoriamente mediante resolución no. 1975-2009 de 11 de setiembre de 2009. La Asociación alegó defectuosa representación de las actoras y opuso la de falta de derecho. La defensa previa fue resuelta en resolución no. 1795-2010 del 14 de mayo de 2010. La representación del ICE opuso las de falta de derecho, interés actual y prescripción. Incopesca fue declarado rebelde. El Tribunal rechazó la prescripción opuesta por el ICE y la de falta de legitimación activa y pasiva interpuesta por el Estado. Acogió las de falta de derecho opuestas por todos los codemandados y la de falta de interés presentada por el ESTADO y el ICE. Rechazó la demanda en todos sus extremos, con ambas costas a cargo de la actora. Inconforme la representación de las codemandantes, acude a casación.
II.La casacionista plantea tres reproches. En el primero, alega violación de los artículos 11 de la Constitución Política (en adelante CP), 11, 158, 166, 172, 182 y 188 de la Ley General de la Administración Pública (en lo sucesivo LGAP), todos por falta de aplicación; 1 de la Ley 4334 por aplicación indebida, y 82 y 83 de la Ley de Pesca y Acuicultura no. 8436 (en lo que sigue Ley de Pesca). Indica, en la demanda se solicitó declarar nulo el acto administrativo emitido por el ICE en el oficio del 17 de setiembre de 1993, por el cual, con fundamento en el canon citado de la Ley 4344, no objetó que se realizara la actividad de cultivo de tilapias en el embalse Arenal. Manifiesta, oportunamente se alegó en la demanda, que el ICE es incompetente para otorgar autorizaciones de índole comercial, a fin de utilizar aguas en la Laguna Arenal. Aduce, la Ley 4334 establece un fin público para esas aguas –la producción de energía eléctrica- con prohibición al Servicio Nacional de Electricidad (en lo subsiguiente SNE), para dar concesiones hidráulicas en caso de que interfieran con el aprovechamiento eléctrico, sin consultar al ICE. competencias se mantienen a pesar de que el SNE haya dejado de existir como tal.
En su parecer, al resolver de esta forma, el Tribunal aplicó indebidamente el canon primero de la Ley 4334, puesto que el ICE no está autorizado por ley para pronunciarse sobre actividades comerciales de particulares. Además, indica, la competencia de dicho Instituto para conocer en consulta sobre la concesión de recursos hídricos, desapareció al derogarse la Ley de Creación del SNE. Apunta, aún y cuando se aceptara lo dicho por los juzgadores, en cuanto a que el ICE mantiene potestades respecto de conductas administrativas de otros entes y órganos públicos, que puedan afectar el fin con que fue construida la laguna, debe hacerse notar que la Asociación es una persona de derecho privado, es decir, no posee el carácter de ente ni órgano público, únicos que, conforme al criterio del Tribunal, pueden solicitar el criterio del ICE sobre esta materia. En el segundo, reclama quebranto de los preceptos 82 y 83 de la Ley de Pesca, así como de los ordinales 158, 166, 172, 182, 188, de la LGAP.
Argumenta, en la demanda se solicitó declarar la nulidad absoluta del acto administrativo emitido por la Junta Directiva de Incopesca, acuerdo A.J.D.I.P / 280-2006 de 16 de junio de 2006, por el cual, se autorizó a la Asociación a realizar cultivo de tilapia en jaulas flotantes de la Laguna de Arenal. Esgrime, también alegó oportunamente que dicho acto violentó los preceptos 82 y 83 de la Ley de Pesca, por cuanto la Asociación no presentó dos requisitos establecidos en esa normativa, a saber, la concesión de aguas, y la evaluación de impacto ambiental. Apunta, lo anterior fue reconocido por Incopesca, al contestar extemporáneamente la demanda, y así fue admitido por el Tribunal en el hecho probado número 11. No obstante, expresa, en el considerando IX, la sentencia recurrida dispone, que si bien es cierto, el acto se dictó sin cumplir todas las formalidades, también lo es que en el curso del proceso, aquellas se solventaron, poniéndose a derecho el acto, en los términos del numeral 188 de la LGAP y 82 de la Ley de Pesca.
Así, considera, el Tribunal admite que el acto fue emitido sin cumplir con requisitos establecidos expresamente, con lo cual, infringe los artículos dichos de la Ley de Pesca y de la LGAP. No obstante, enfatiza, a falta de tales requisitos, el acto está viciado de nulidad, sin que pueda sanearse ni convalidarse, pues constituye infracción sustancial del ordenamiento jurídico, que obliga al juez a declarar la nulidad absoluta. Concluye, yerran los juzgadores al aplicar el cardinal 188 de la LGAP, por cuanto establece una facultad para la Administración Pública, no para el órgano jurisdiccional. Así, dice, al tener por subsanada una nulidad absoluta, el Tribunal incurrió en falta de aplicación y aplicación indebida de los mandatos citados. Agrega, aunque se solicitó en la demanda, que se condenara al Estado por una conducta omisiva, al tolerar que la Asociación MINAET, el Tribunal dispuso, que el otorgamiento, iniciado el proceso de la concesión de aguas a la Asociación, no solo era lícito, sino jurídicamente obligatorio para las administraciones públicas, lo que en su criterio violenta el precepto 82 de la Ley de Pesca.
En el tercero, acusa violación del numeral 193 del CPCA. Recalca, el Tribunal le impuso el pago de las costas, al considerar, en la especie no encuentra motivo para aplicar las excepciones que fija la normativa, y quebrar el postulado de condena al vencido. Estima, tenía motivo suficiente para litigar, por lo cual ha violentado el canon 193 de cita al imponer las costas a las vencidas.
III.En el primer agravio, la casacionista en lo medular aduce, que el ICE es incompetente para otorgar autorizaciones de índole comercial, para la utilización de aguas en la Laguna Arenal, por cuanto la Ley 4334 establece como fin público para esas aguas, la generación eléctrica. Además, indica, dicho Instituto carece de competencia para conocer en consulta sobre la concesión de recursos hídricos, a partir de la derogatoria de la Ley de Creación del SNE. Añade, la Asociación carece del carácter público, que le permita invocar la competencia del ICE. Al respecto el Tribunal estimó, en la especie no se da la incompetencia señalada, por cuanto dicho ente no otorgó un permiso en los términos alegados por la parte actora, sino que, simplemente manifestó, que el uso de las aguas por la Asociación para actividades acuícolas, no resulta disconforme con la generación de energía eléctrica. Consideran los juzgadores, el artículo 1 de la Ley 4334 expresamente establece el deber del ICE “de emitir conductas administrativas formales como la impugnada”, con el fin de no afectar el destino principal del lago.
Agregan los jueces, que si bien el Servicio Nacional de Electricidad ya no existe, la competencia del Instituto Costarricense de Electricidad en esta materia se mantiene, “en el tanto el bloque de legalidad regule competencias de otros entes y órganos públicos que puedan adoptar conductas administrativas que afecten el fin con el que fue construída la laguna artificial del Arenal”. El numeral 1 de la Ley 4334, prevé el deber del ICE de emitir actos administrativos, a fin de establecer si la actividad en cuestión, afecta el destino reservado a la laguna. Dicha disposición refiere: "Declárase zona nacional de reserva de energía eléctrica, la laguna Arenal, la laguna Cote y el río Arenal (cauce y aguas), de acuerdo con el mapa elaborado por el Instituto Geográfico de Costa Rica (hojas 3247 III y 3247 IV). Dicha zona incluye las riberas, en la extensión necesaria para garantizar que los recursos de esta cuenca se transformen en energía eléctrica utilizable para el desarrollo del país.
El Servicio Nacional de Electricidad no otorgará concesiones hidráulicas en dicha cuenca, si pudieran interferir o afectar su aprovechamiento, para lo cual deberá consultar, en cada oportunidad, al Instituto Costarricense de Electricidad." De lo anterior claramente resulta, que el legislador no solo ha establecido en dichas aguas, una reserva nacional para la generación de energía eléctrica, sino además, que las concesiones hidráulicas que sobre éstas se confieran, deben contar con el criterio del ICE, a efecto de determinar, si de aquellas deriva interferencia o afectación a su aprovechamiento energético. En la especie, el Instituto codemandado, mediante oficio de 17 de setiembre de 1993, suscrito por el entonces Gerente General del ICE, ingeniero Mario Hidalgo P., manifestó “... que de nuestra parte no hay objeción a que realicen su actividad comercial de cultivo de tilapias ... en jaulas, en área de San Luis de Tronadora en la margen del Embalse Arenal...” (Hecho demostrado, numerado 5).
De lo anterior, no encuentra esta Sala que al emitir el acto administrativo de cita se hayan excedido potestades, o incurrido en conductas no autorizadas por la Ley 4334, toda vez que, del criterio emitido, solo deriva la no objeción por parte de dicho Instituto en cuanto a la actividad a realizar, mas no una autorización específica para la puesta en marcha de esas labores productivas. Tal es precisamente la responsabilidad establecida por ley para el ICE, pues está claro, que al no objetar las labores acuícolas de interés, simplemente se expresa la no afectación del recurso hidroeléctrico de esas aguas. Tampoco comparte esta Cámara el reclamo en el sentido de que, conforme al criterio de los juzgadores, solo entes u órganos públicos pueden invocar la competencia del ICE sobre las aguas de la Laguna de Arenal, carácter que no posee la Asociación solicitante. Al respecto, el Tribunal efectivamente expresó, que en el tanto se mantengan competencias de otros entes y órganos públicos, para adoptar conductas administrativas que puedan afectar la finalidad del embalse Arenal, el ICE mantiene la competencia conferida por ley.
Tal afirmación dista del cargo apuntado, toda vez que la sentencia no limita las potestades del ICE en esta materia, a la atención de solicitudes de entes públicos, sino que extiende su validez en el tiempo, hasta tanto existan entes públicos con competencias relacionadas al recurso hídrico del embalse, presupuesto jurídico que no guarda relación con el cargo aducido, lo que obliga a su rechazo.
IV.En el segundo reparo, reclama, el acto administrativo A.J.D.I.P / 280-2006, emitido por Incopesca, autorizó a la Asociación a realizar cultivo de tilapia en jaulas flotantes de la Laguna de Arenal, sin que se hubiese cumplido con dos requisitos dispuestos por ley, a saber, la concesión de aguas, y la evaluación de impacto ambiental. Agrega, lo anterior fue reconocido por ese Instituto, y admitido por el Tribunal en el hecho tenido por probado número 11 de la sentencia combatida. No obstante, arguye, en su considerando IX, la sentencia recurrida dispone, que si bien el acto se dictó sin que se cumplieran todas las formalidades, también lo es que en el curso del proceso, aquellas fueron solventadas, en los términos del numeral 188 de la LGAP y precepto 82 de la Ley de Pesca. Considera, la falta de tales requisitos, vicia el acto, sin que pueda sanearse ni convalidarse, en tanto se está ante una infracción sustancial del ordenamiento jurídico.
El Tribunal indicó, si bien Incopesca emitió el acto referido sin que se hubiere cumplido en ese momento con algunas de las formalidades requeridas por el ordenamiento jurídico, es lo cierto que en el curso del proceso se cumplió con todos los requisitos de ley poniéndose la solicitud a derecho conforme a los cánones 188 de la LGAP y el 82 de la Ley de Pesca. Adicionalmente, refieren los jueces, en cuanto a las conductas omisivas atribuidas al MINAET -nulidad absoluta de la concesión otorgada- es claro que dicho órgano tenía competencia para emitir el acto requerido por la Asociación codemandada. En efecto, reiteran el hecho de que en un inicio no se contara con todos los requerimientos legales para ésta, no era óbice para que el administrado regularizara su situación jurídica. Agregan, las administraciones públicas pueden adoptar conductas administrativas positivas tendentes a regularizar la situación legal del administrado, lo cual no sólo es lícito sino que les resulta además jurídicamente obligatorio.
Observa esta Sala, el mandato 82 de la Ley de Pesca, a la letra establece: "Para desarrollar proyectos de acuicultura, la persona física o jurídica deberá obtener: a) Una autorización otorgada por el I para el cultivo de organismos acuáticos en las aguas marinas o en aguas continentales. b) Una concesión de uso y aprovechamiento de aguas otorgada por el MINAE. Lo anterior sin perjuicio de los demás requisitos establecidos en otras leyes. La concesión y la autorización confieren a su titular los derechos de uso de agua y aprovechamiento de los recursos acuáticos pesqueros directamente relacionados con la actividad en forma temporal. El plazo de la concesión será de conformidad con lo dispuesto en el artículo 19 de la Ley de Aguas y el plazo de la autorización será hasta de diez años prorrogables mediante acto expreso. En el contrato respectivo serán definidos los derechos y deberes, los cánones anuales, las garantías y las limitaciones, relativos a las autorizaciones y las concesiones para el desarrollo de la acuicultura.
Las prórrogas se regirán por el Reglamento de esta Ley." El precepto citado, refiere con meridiana claridad que para desarrollar proyectos de esta especie, el interesado debe obtener la autorización del Incopesca y una concesión de uso y aprovechamiento de aguas del MINAE (hoy MINAET), sin perjuicio de otros requisitos. No obstante, de la norma no deriva la obligación de contar con la concesión de uso de aguas como acto o requisito previo para la obtención del permiso por parte de Incopesca. Por su parte, la disposición 83 de la Ley de Pesca, establece: “ Para solicitar la autorización acuícola y la concesión para el uso de aguas, los interesados deberán aportar los respectivos proyectos de acuicultura, junto con una evaluación de impacto ambiental. (…) La concesión no podrá aprobarse sin dicho criterio, el cual será vinculante para las partes. La SETENA está obligada a pronunciarse en el plazo señalado; en caso contrario, el funcionario correspondiente incurrirá en responsabilidad disciplinaria o civil…” De dicho mandato resulta, que para solicitar la autorización acuícola (emitida por Incopesca), así como para la concesión de aguas (a cargo de MINAET), el solicitante debe aportar el proyecto de acuicultura y la evaluación de impacto ambiental.
A ese respecto, nota esta Cámara, que la Asociación codemandada obtuvo el permiso para la explotación de T no. 4100174, el cual fue otorgado por Incopesca mediante acuerdo AJDIP/280-2006, del 16 de junio de 2006 (folio 379 del expediente y hecho tenido por demostrado, número 9). Que para esa fecha, la solicitante contaba ya con la viabilidad ambiental otorgada por Setena mediante resolución 981-2006 del 24 de mayo de 2006. (folios 376-378 del expediente y hecho probado, numerado 13). Asimismo, la Asociación solicitó al MINAET una concesión de aguas, la cual se tramitó en expediente 13198 A, según publicación hecha en el Diario Oficial La Gaceta número 12 del 19 de enero de 2009, la cual le fue otorgada para uso agropecuario (piscicultura), por un plazo de 10 años, según resolución R-0321-2009 AGUAS-MINAET, de las 13 horas del 22 de abril de 2009. (Hecho Probado denominado 12); data en la cual, efectivamente contaba con la viabilidad ambiental.
De lo anterior se desprende con nitidez que, si bien algunos de estos trámites fueron concluidos con posterioridad al dictado del acto administrativo A.J.D.I.P / 280-2006, emitido por Incopesca, tanto a la fecha de emisión del citado permiso para el cultivo de tilapia, como del otorgamiento de la concesión de aguas, la Asociación contaba con la viabilidad ambiental, único requisito adicional al proyecto de acuicultura, que conforme al canon 83 de la Ley de Pesca, resulta obligatorio en ese sentido. De tal forma, si bien el Tribunal en su sentencia estimó que algunos requerimientos no fueron obtenidos en tiempo, si habían sido subsanados por la solicitante, lo cual autorizaba a la Administración Pública del caso, a efecto de otorgar los permisos. Resulta indiscutible que la Asociación contó con los requisitos necesarios para desarrollar el proyecto de acuicultura, sin perjuicio de la potestad normada de subsanar los vicios existentes en el procedimiento conforme al precepto 188 de la LGAP, por lo que el reclamo debe rechazarse.
V.En el tercer cargo, recrimina, el fallo les condenó en costas, no obstante haber litigado de buena fe, y, que, conforme al cardinal 193 inciso b) del CPCA, existía la posibilidad de omitir la condenatoria, al contar con motivo suficiente para litigar. Según lo expone el Tribunal, las costas son un extremo de obligada imposición al vencido, por orden del precepto 193. Observa esta Cámara, el precepto citado del Código de la materia, expresa en “las sentencias y los autos con carácter de sentencia, se condenará al vencido al pago de las costas personales y procesales, pronunciamiento que deberá hacerse de oficio.” Continúa el canon de cita, “No obstante lo anterior, la parte vencida podrá ser exonerada del pago de las costas, cuando: a) La sentencia se dicte en virtud de pruebas cuya existencia verosímilmente no haya conocido la contraria y, por causa de ello, se haya ajustado la oposición de la parte. b) Por la naturaleza de las cuestiones debatidas haya existido, a juicio del Tribunal, motivo bastante para litigar.” De esta manera, la condenatoria en costas al vencido procede por el sólo hecho de serlo, es decir, al perder el litigio, sin que ello signifique que no haya habido buena fe, ni que su motivo para litigar haya sido insuficiente.
Así, en criterio de la mayoría de los integrantes de esta Sala, la exoneración es una facultad del juzgador; que como tal, si no hace uso de ella, no incurre en la violación señalada, puesto que el Tribunal se limitó a actuar la norma, por lo que debe rechazarse el reproche.
POR TANTO
Se declara sin lugar el recurso. Son sus costas a cargo de quien lo interpuso.

I.Los suscritos integrantes no comparten el criterio plasmado por la mayoría de esta Sala en el considerando V del fallo anterior, en cuanto deniega el control casacional para aquellos casos donde sólo se hace uso de la regla general de la condena al vencido en el pago de ambas costas, es decir, cuando no se actúa o aplica ninguna norma atinente a la exoneración de ellas. En efecto, el fundamento jurisprudencial de mayoría, parte de que la exoneración en el pago de las costas es una facultad, en la que no se produce yerro ni infracción normativa cuando no se ejercita o aplica; por ello, se dice, si no hay violación legal, no es posible en casación entrar a valorar o modificar lo resuelto sobre la condena al vencido, pues se repite, para la mayoría de esta Sala, sólo puede haber infracción jurídica cuando se actúa la norma correspondiente a la exoneración (entre muchas pueden verse las sentencias de esta Sala no. 1001- F-2002, de las 11 horas 50 minutos del 20 de diciembre de 2002; la 249-F-2003, de las 11 horas 45 minutos del 7 de mayo de 2003 y la 306-F-2006, de las 10 horas 20 minutos del 25 de mayo de 2006).
La concatenación parece en principio lógica, pues con esta premisa, si la exoneración constituye una facultad, el juzgador no está obligado a exonerar; y por ende, si no ordena o realiza tal exoneración, no viola las normas que corresponden al tema. En consecuencia, si no se da violación de normas, no puede haber revisión casacional (consúltense las resoluciones de esta Sala no. 765 de las 16 horas del 26 de septiembre de 2001 y 561-F-2003, de las 10 horas 30 minutos del 10 de septiembre de 2003). Esta relación de ideas, les permite concluir, que en ese supuesto específico (la simple condena o la inaplicación de las exoneraciones) “no puede ser objeto de examen en esta sede” (de este mismo órgano decisor, sentencia n° 419-F-03, de las 9 horas 20 minutos del 18 de julio de 2003), pues se trata de una hipótesis “no pasible de casación” (fallo n° 653-F-2003, de las 11 horas 20 minutos del 8 de octubre de 2003).
Así, en opinión de los distinguidos compañeros: no tiene cabida el recurso de casación cuando no se hace uso de la facultad exoneratoria (véanse a contrario sensu los considerandos III y VIII, por su orden de las resoluciones 541-F-2003, de las 11 horas 10 minutos del día 3 y 563-F-2003 de las 10 horas 50 minutos del día 10, ambas de septiembre de 2003). De esta forma se ha estimado por la mayoría que “… la condena en costas al vencido, como aquí sucedió no es revisable en esta Sede, habida cuenta de que el Tribunal se limitó a actuar la norma en los términos por ella dispuestos” (Véase el considerando X del voto no. 68-F-2005, de las 14 horas 30 minutos del 15 de diciembre de 2005). Y en materia notarial, con mayor contundencia, se ha señalado: “…el Tribunal le impuso el pago de las costas de la pretensión resarcitoria a la denunciante, pronunciamiento que, se repite, no tiene casación”. (considerando X de la sentencia n° 928-F-2006, de las 9 horas 15 minutos del 24 de noviembre de 2006).
II.Sin embargo, en parecer de los suscritos, la indebida inaplicación de los preceptos que permiten la exoneración de costas, infringe, sin duda, el Ordenamiento Jurídico y, en concreto, las normas que la autorizan, ya sea por error o inadecuada apreciación de los jueces en el conflicto específico. En ese tanto, aunque se trate de una facultad, es lo cierto que no se encuentra inmune al control casacional, pues tanto en su ejercicio como en su inaplicación, puede operar una violación de ley, y en esa medida, la indebida omisión no es ni debe ser, sinónimo de arbitrariedad, en tal caso, cometida por el propio Juzgador. Máxime si se trata de un apoderamiento al juez otorgado con supuestos específicos que limitan su poder discrecional en esta materia. En consecuencia, en este particular aspecto, estimamos que con la sola aplicación de la regla general del artículo 193 del Código Procesal Contencioso Admininistrtivo (condenatoria al vencido al pago de ambas costas), no se cierran las puertas al recurso de casación, pues al contrario, el asunto es admisible para su examen de fondo (siempre y cuando se cumplan los requisitos de ley) ante un eventual vicio omisivo en la aplicación de las disposiciones legales que autorizan la exoneración de dichas costas (cánones 55 de la Ley de la Jurisdicción Agraria y 193 del Código Procesal Contencioso Administrativo).
No obstante lo anterior, en el caso concreto de examen, estos integrantes comparten lo dispuesto en el fondo por el Tribunal, en cuanto se impuso al vencido el pago de ellas, porque al denegarse todos los argumentos para impugnar la sentencia, no les es posible entrar al análisis de este extremo, circunstancia que nos lleva a rechazar el agravio, y con él, el recurso que en este sentido se formula.
