RESULTS

  1. 1Based on the facts alleged and the legal provisions cited, the plaintiffs filed an ordinary complaint, the amount in controversy being deemed indeterminate, seeking a judgment declaring: “a) The absolute nullity of resolution number 851-01-TAA issued at 15:40 on November 20, 2001, and resolution Nº 890-01-TAA issued at 10:49 on December 6, two thousand one, by the Tribunal Ambiental Administrativo in the proceeding (sic) brought against Hotel L. S.A., processed under file number 71-99-TAA. b) In lieu thereof, that Hotel L., S.A., C., and A. be released from all liability, and that the Tribunal Ambiental Administrativo be ordered to respect A.’s private property right and to release Hotel L., S.A. and C. from all liability. c) That the notations recorded on the survey plan and the administrative warning (advertencia administrativa) placed on the deed of Hotel L., S.A., Nº 15286, be removed. d) That the State be ordered to (sic) pay both categories of costs in this proceeding and the damages caused.”

CONSIDERATIONS

I.Messrs. C. and A., the latter in his personal capacity and as representative of Hotel L., S.A. (hereinafter L.), sue the State. They seek a judgment declaring the absolute nullity of resolutions nos. 851-01-TAA issued at 15 hours 40 minutes on November 20, 2001, and 890-01-TAA issued at 10 hours 49 minutes on December 6, 2001, by the Tribunal Ambiental Administrativo. They explain that, in the first resolution, that body found them liable for constructing a culvert and allowing materials to be deposited in the public zone (zona pública) of Golfito; it also referred to the commencement and expansion of a land fill (relleno) and the construction of a wall, the latter matters forming the basis of the dispute. As a precautionary measure (medida precautoria), it ordered that the Municipality of that locality be notified of the prohibition against issuing construction permits within an area of 1382.56 m2.

It further ordered them to “remove fences and other structures” restricting access to the sea, while maintaining that area in the best condition and allowing free access. The other decision denied the motion for reconsideration (recurso de revocatoria) that they had filed against the first. They essentially contend that the purpose of the administrative proceeding (procedimiento administrativo) was to investigate a complaint concerning the commencement and expansion of the land fill and the construction of the wall within the maritime-terrestrial zone (zona marítimo-terrestre), on property no. [...] that includes the 1382.56 m2 strip facing the sea, although it was later clarified that the affected area was the beach. Nevertheless, they state, that property is privately owned and registered in the name of co-plaintiff A. In lieu of the relief ordered in those resolutions, they request that they be released from all liability.

They further request that the aforementioned Tribunal be ordered to respect co-plaintiff A.’s private property right; that the notations recorded on the survey plan and the administrative warning placed on L.’s “deed” be removed; and that the defendant be ordered to pay both categories of costs and damages. The State’s representatives opposed the claims. They raised the preliminary defenses of procedural defects in the complaint and acquiescence to the challenged act. Of these, the first was denied and the second was partially granted, with the action being declared inadmissible only insofar as it concerned plaintiff C. The proceeding continued with respect to Mr. A. and L. The State also raised the defense of lack of legal entitlement, as well as expiration with respect to the requested relief concerning the notation of the marginal warning (advertencia marginal) on the property registered in the Registro Público under registration no. [...], entered at the request of the Procuraduría General de la República.

This defense was denied by interlocutory ruling (resolución interlocutoria). In its judgment, the Juzgado rejected the defense of lack of legal entitlement. It partially granted the complaint. It annulled the aforementioned resolutions of the Tribunal Ambiental Administrativo. It ordered the defendant to pay both categories of costs of the proceeding. It denied the remaining requested relief. The Tribunal affirmed the judgment of the A quo.

II.The representatives of the State challenge the decision before this Chamber. They set forth five sections. First: regarding the environmental damage caused by filling in the coastal public domain (demanio costero), they allege that, in the Second Whereas Clause, the challenged judgment adopted the section on facts not proven from the Trial Court’s judgment, concerning the failure to demonstrate that the filling occurred in the beach area and the environmental damage caused by the co-plaintiffs. They indicate that the A quo stated that official letter no. 99-229 of 8 de octubre de 1999 from the Instituto Geográfico Nacional vaguely refers to fill affecting part of the sea. However, because it is inconclusive, it fails to demonstrate that the fill encroached upon the beach zone. It therefore deemed it unproven that the fill was located on public-domain property. They contend that, in point C of the Third Whereas Clause, the Ad quem found that the filling of the coastline had not been technically or factually proven.

It considered that the photographs and the certification issued by the Municipalidad de Golfito were not conclusive for those purposes. It further stated that the plaintiff acknowledged that it had undertaken the filling, the purpose of which was “…to prevent erosion caused by tidal ebb and flow against the edge of the coastline, so what purpose does the lower court judgment’s reference to the lack of a permit serve?” Thus, they add, the Superior Court recognized that the fill did affect the edge of the coastline. Nevertheless, contradicting the body of evidence to be analyzed, it stated: “Nor has the environmental damage resulting from the reported acts been demonstrated, as the A Quo found, such that it would be futile to delve into an issue abandoned by the party with an interest in proving that damage.” As they noted in their appeal, they explain, the Tribunal Ambiental Administrativo, in compliance with due process (debido proceso), found that environmental damage had occurred, consisting of the filling of 1.382,56 m2 of shoreline.

Based on articles 111 of the Ley Orgánica del Ambiente; 1, subsection 1); 2 and 3, subsection 1), of the Ley de Aguas, it ordered the removal of fences restricting free access to the sea. They allege an indirect violation of those provisions due to an error of law. They continue that the plaintiff first had that filled area recorded in the cadastral registry for purposes of adverse-possession proceedings (información posesoria). It later prepared survey map no. [...], the surface area of which, as recorded in the minutes of the judicial site inspection (reconocimiento judicial) at folios 576 to 578, does not correspond to the measurements observed at the site. This showed that the topographic survey conducted in agosto de 1999 and registered in the cadastral registry on 13 de setiembre de ese año was completed promptly to provide a land-registry basis over the public domain, that is, after the evidence received in the administrative proceeding on 2 de setiembre siguiente.

They maintain that the public reports in the administrative record prove that the coastline was filled in. Nevertheless, they object, the judges at both levels ignored them. They reiterate that there was an error of law in the assessment of the evidence, under the requirements of articles 318, subsection 3), and 370, both of the Código Procesal Civil, which recognize its authentic evidentiary value. As they explain, the report of the Instituto Geográfico Nacional is conclusive when it states that the filled area “…affects the portion of the sea in the bahía de Golfito.” They state that this is consistent with official letter no. 990473 of 15 de octubre de 1999 from the Catastro Nacional, which showed that “…survey map [...] encompasses land belonging to the Océano Pacífico,” supplementing official letter no. [...] of 6 de setiembre de 1999, which likewise established that the marine coastline had been affected.

They add that the Tribunal Ambiental Administrativo confirmed this “in situ” during the inspections of 4 de febrero and 20 de julio, ambos meses de 1999, in which representatives of the co-plaintiffs participated, and that the photographs of 18 de junio de 1999 also reveal it. Consistent with the foregoing, they note that on 31 de agosto de 1999 the Secretary of the Concejo Municipal de Golfito certified the absence of a permit to perform filling works in the marine environment of the coastal sector at kilómetro 3 in the names of: “Hotel L. S.A…; A.…; C....” They contend that the Mayor and the Inspector General of the Municipality reiterated that certification on 10 de setiembre de 1999. Likewise, at the oral hearing of 2 de setiembre de 1999, when engineer A. B., vice president of the Tribunal Ambiental Administrativo, asked Mr. A. whether the tide reached the filled area, he replied: “It came in especially around the part where the culverts were; it caused extensive scouring around the culverts and kept coming onto the road.” They assert that, in filings dated 23 setiembre de 1999 and addressed to the Director of the Catastro Nacional, Messrs.

C. and A. requested cancellation of survey maps [...] and [...]. This occurred 21 days after the aforementioned hearing of 2 de setiembre de 1999, when they became aware of the adverse effect of encompassing areas of the seashore without land-registry support. They explain that if the area of property no. [...] is 4.804 m2, according to survey map [...], and a portion in the relevant sector that the Compañía Bananera segregated from property no. [...], under survey map [...], measures 2.556,11 m2, the two portions total 7.362,11 m2. Accordingly, they reason, as the Catastro Nacional also found, survey map [...] (8.810,58 m2) encompasses filled areas of the Océano Pacífico measuring approximately 1.450,47 m2, which even exceeds the 1.382,56 m2 shown on survey map [...]. This also demonstrates that the swimming pool depicted between vertices 11-16 of registered survey map [...] is another filled area of that Ocean, which was not included in survey map [...] (vertices 3-4).

They point out that, as of 26 de mayo de 1970, only the “Mean high-tide contour” and “BAHIA DE GOLFITO” appear north of vertices 0-10 of registered survey map [...], thereby establishing that parent property no. [...], registered on 25 de noviembre de 1965, likewise did not include the area that has now been filled and is depicted in registered survey maps [...] and [...], the latter describing property no. [...]. They conclude that these evidentiary items, submitted with the answer to the complaint, and their analysis by the Instituto Geográfico Nacional and the Catastro Nacional in the administrative proceeding, were not assessed in the judgments at either level, thereby giving rise to the defect of indirect violation of the law. They report that, when answering the complaint, the State offered as evidence the judicial site inspection conducted on 24 de marzo de 2006, the minutes of which state: “The seawater meets the wall along its entire length or course, covering approximately fifty or sixty centimeters of its height at low tide.” They emphasize that, even at low tide, the wall forming the filled area prevents the sea from advancing over the edge of the coastline damaged by the plaintiff’s actions.

For that reason, they insist, the challenged judgment also indirectly violates articles 330 and 409 of the Código Procesal Civil by failing to consider what was observed during that evidentiary proceeding, which established how the wall, measuring approximately 2,40 m high and 46,70 m long, impedes the ebb and flow of the tides. They note that the findings of the judicial site inspection are consistent with the testimony of engineer M. M., an official of the Instituto Geográfico Nacional, at the hearing of 2 de setiembre de 1999: “…there is a wall that I believe borders the entire property, where it stops the water current, and so one imagines or concludes, upon observing the conditions, that the tide is indeed being prevented from operating normally in that area, from rising and falling, that is, the high tide and the low tide, which is the lowest tide. So one says, well, there may be a situation here involving encroachment upon the sea, and the question then is to what extent that situation is occurring.

And I believe that we observed that perfectly well there.” They state that, following the aforementioned hearing of 2 de setiembre de 1999, during the suspension of the administrative proceeding, the co-defendants executed the sale contained in the deed granted before Notary M. at 16 horas del 10 de febrero de 2001, which was filed with the Diario on 9 de febrero siguiente. On 21 de ese mes, it resulted in the registration of property no. [...] in the province of [...]. They assert that, in that deed, they used survey map [...], registered in the cadastral registry on 13 de setiembre de 1999, that is, 11 days after the oral hearing, and included the filled area, which is also depicted in survey map [...]. Consequently, they argue, evidence was indeed introduced into the judicial record, both documentary evidence—the administrative record and registered survey maps—and the judicial site inspection, which was conducted with technical participation from the Instituto Geográfico Nacional and whose data were incorporated into the minutes of the inspection.

They state that the challenged judgment fails to properly analyze or assess the body of evidence submitted by the State’s representatives to establish the environmental damage caused by filling in the seacoast. They allege a breach of the principle of normative hierarchy (principio de jerarquía normativa) established in article 6 of the Ley General de Administración Pública, in conjunction with articles 1, 7, 8, 19, 20 and 22 of the Código Civil, which, in this specific case, maintain the superiority of articles 1 and 20 of the Ley de Aguas de 1884 and of provisions 1, subsection 1); 2 and 3, subsection 1), of the current Ley de Aguas over acts arising from private agreements. Accordingly, they add, the decisions of the Tribunal Ambiental Administrativo, which applied provisions treating seashores as part of the public domain, must be upheld. Second: regarding the administrative sanction imposed in compliance with due process, they argue that the A quo stated on its own motion that the Municipalidad de Golfito was not a party to the administrative proceeding.

This purported lack of an opportunity to defend itself (indefensión) was said to extend to L., because no acts were attributed to it and its two representatives were held liable without their participation having been proven. They explain that, based on those considerations, that court distinguished between the order to remove the fences and the prohibition against granting construction permits for the filled area. On this point, they criticize the Ad quem’s decision as more onerous because it stated that the State’s argument was not a permissible ground for appeal at this level, since it concerned a matter decided by the competent administrative bodies and therefore should not be examined further. It further stated that the State’s objections lacked a factual basis and, without more, chose to reject the third ground of appeal concerning that issue. Regarding the environmental damage caused by filling in the seacoast, they reiterate, as they stated on appeal, that the Municipalidad de Golfito was indeed a party to the administrative proceeding.

Its legal representative, the Mayor, was summoned to the field inspection in decision no. 199-99 de 12 horas 42 minutos del 24 de junio de 1999. The decision attributing the alleged acts, namely no. 258-99-TAA, named the Municipality as a respondent and again summoned its Mayor to the oral hearing of 2 de setiembre de 1999. He even answered a question by stating that the filled area “…is beach, because where the sea is, there is beach.” They allege that this statement was also ignored in the challenged judgment. In their view, the administrative proceeding did not deny the Municipalidad de Golfito or the representatives of L. an opportunity to defend themselves. They state that the A quo found it proven that the Mayor of that Municipality, C. and A. participated in the inspection by the Tribunal Ambiental Administrativo and that, as the evidence established, they were notified of the commencement of the proceeding. They emphasize that, accordingly, neither L. nor its representatives, who also participated in their personal capacities, were denied an opportunity to defend themselves. They state that decision no.

258-99-TAA commenced the administrative proceeding (procedimiento administrativo) concerning the environmental impact caused by the fill (relleno), among other matters, pursuant to Article 101 of the Ley Orgánica del Ambiente. That decision was challenged by Messrs. C. and A., personally and as officers and shareholders of L., but they did not address any of the objections and doubts referred to in the judgments of both instances. The appeal (recurso) was denied. Subsequently, the Tribunal Ambiental Administrativo issued Decision No. 851-01-TAA, which was also served on those persons. A., personally and as representative of L., challenged it. Decision No. 890-01-TAA denied the appeal. Based on this account, they argue that, during the administrative proceeding, it became clear that the Municipalidad de Golfito had not authorized the fill. Rather, on June 16, 1999, it shut down the works through Inspector F. They add that, in its ruling No. 851-01-TAA, the Tribunal Ambiental Administrativo established, on the basis of the evidence appearing at folios 39, 40, 63, 72, 241 and 319 of the administrative record (expediente administrativo), the existence of environmental damage (daño ambiental), consisting of a fill measuring 1.382,56 m2, and ordered the removal of the fences because they interfered with public use and the free passage of persons.

On that occasion, they add, the following provisions were cited as the legal basis: Articles 3, subsection IV, of the Ley de Aguas; 1, 2, 3, 4, 71, 101, 105, 106 and 111 of the Ley Orgánica del Ambiente; and 11 and 45 of the Ley de Biodiversidad. Decision No. 890-O1-TAA added sections 10, subsection 1); and 2 and 3, subsection 1), of the Ley de Aguas, while deleting as inapplicable the reference to Article 20 of Ley 6043. They explain that, although that latter Law does not apply to land located in coastal cities, the seashore must nevertheless be respected as national property. In their view, Article 101 of the Ley Orgánica del Ambiente, applied in this case by the Tribunal Ambiental Administrativo, establishes strict environmental liability (responsabilidad ambiental de carácter objetivo), which may extend jointly and severally not only to a company’s shareholders, but also to its representatives and even to the holders of the activities, who in this case participated in the administrative proceeding personally and as representatives of the company against which the complaint was filed.

They rely on judgments Nos. 1669-00, 6514-02 and 4822-07 of the Sala Constitucional, and No. 2569-09 of the Tribunal Contencioso Administrativo, Sección IV, and summarize that, because the filling works were never authorized by the Municipalidad de Golfito, the appropriate course—and the one adopted—was to prevent further environmental damage. Under Article 111, subsections a) and b), of the Ley Orgánica del Ambiente, they assert, the powers of the Tribunal Ambiental Administrativo include adopting appropriate measures to prevent future acts or conduct that would increase such damage. That is what occurred in this matter, they insist, in which the removal of the fences affecting the coastal landscape, as well as common use of and free passage along the seashore, was ordered. They therefore allege a violation of Articles 318, subsection 3), and 370 of the Código Procesal Civil regarding the evidentiary value of the administrative record, which demonstrates that the order issued by the Tribunal Ambiental Administrativo complied with due process (debido proceso) and fell within its discretionary authority.

Third: regarding the claimant’s requested removal of the warning notation (nota de advertencia), which the courts of both instances rejected, they specify, as they state they argued on appeal, that this matter was not raised when the proceeding was instituted, but only when the complaint was formally filed. Consequently, they contend, it is an inadmissible form of relief under Articles 60, subsection c), and 21, subsection a), of the Ley Reguladora de la Jurisdicción Contencioso Administrativa because it is time-barred (caduco) under Article 175 of the Ley General de la Administración Pública, as they claim they argued in the motion asserting expiration (incidente de caducidad) of August 13, 2007 and reiterated on appeal. They state that the determination of this issue was deferred until judgment because the judge reasoned that it was necessary to determine whether the warning notations resulted from the position adopted by the Tribunal Ambiental Administrativo.

They object that this is impossible because, while the decisions of that Tribunal date from November and December 2001, the warning notation entered by the Registro at the request of the Procuraduría dates from August 31, 1999 and was served on the co-claimants on September 6, 1999. Accordingly, they argue, it is not a consequence of the decision rendered by that administrative body. On that premise, they add, the defenses of lack of entitlement (falta de derecho) and expiration (caducidad) raised in the answer to the complaint, in the filing of August 13, 2007 and on appeal should likewise be sustained with respect to that claim, because Article 175 of the Ley General de Administración Pública had not been amended when the events relevant to this proceeding occurred. They allege that the judgment under review erred by calculating the period from service on the claimant on September 6, 1999 until the proceeding was instituted on February 11, 2002.

That is incorrect, they object, because no warning notation was challenged when the proceeding was instituted; it was not challenged until the complaint was formally filed on May 17, 2004, by which time more than four years and eight months had elapsed. Article 175 of the Ley General de la Administración Pública therefore applies and was violated through the erroneous assessment of the evidence used to determine the starting and ending points for calculating the period. For the reasons stated, they maintain, the challenged judgment must be quashed insofar as it rejected the corresponding ground of appeal and denied the asserted expiration. To maintain the warning notations, consideration must be given to what they stated in answering the complaint, where they pointed out the contents of Official Letter No. PGR-162-99: “If, when registering the survey plan, the Catastro Nacional were to identify any defect or flaw affecting the registration in the Registro Público, the appropriate course—in order to avoid liability and exercise the oversight authority also vested in it—would be to report it and cause a warning notation to be entered, notifying this Office of the situation if grounds existed for pursuing other administrative or judicial actions.” They add that Opinion C-050-96 of March 26, 1996 also addressed this authority and that it has been recognized by the Sala Constitucional in judgments Nos. 1975-91 and 6170-98, in which it stated: “In the case before us, there are indications that the registration of the survey plan [...] contains irregularities, because it included a portion of the maritime-terrestrial zone (zona marítimo terrestre) that had not previously been registered in the name of any private party…

The challenged action, namely the warning notation placed on the survey plan by the Director del Catastro, is a precautionary measure (medida precautoria) legally grounded in Articles 110 of the Reglamento a la Ley del Catastro Nacional and 66 of the Reglamento del Registro Nacional; it does not create any encumbrance (gravamen) over the land, because its registration falls within the exclusive authority of the Registro Público. Regarding that notation, this Sala shares the respondent’s view that the warning notation affects no property right because such a right could never have encompassed property forming part of the State’s inalienable patrimony. The purpose of the notation is to warn potential third-party purchasers of the land referred to in the survey plan so that they are aware of the legal restrictions affecting that property… Accordingly, because registration of the disputed survey plan is an administrative act (acto administrativo) alleged to be void, the warning notation added by the Director de Catastro does not restrict the private-property right lawfully exercised by the appellant over a large portion of the land referred to in that survey plan, and the appeal must therefore be dismissed.” Accordingly, they reiterate, that warning notation does not constitute a restriction on the right to property, as the co-claimants assert.

In light of the extensive evidence described concerning the impact on the coastal marine area, they conclude, it is clear that the action taken by the Registro at the request of the Procuraduría was lawful. Fourth: regarding the order requiring their client to pay the costs of both instances, they assert that the claims for compensation for damages and losses and those seeking cancellation of the warning notation were denied. They argue that the claimant did not appeal the denial of the compensation claim, but limited its appeal to the warning-notation issue. Therefore, they state, sections 59.2; 98, subsection c); and 103 of the Ley Reguladora de la Jurisdicción Contencioso Administrativa must be applied in conjunction with Article 222, first paragraph, of the Código Procesal Civil, which exempts a party from payment when some claims have been denied, demonstrating reciprocal defeat (vencimiento recíproco) or sufficient grounds for litigation.

They rely on judgments Nos. 523-F-2005, 73-F-95 and 1070-F-04 of this Sala, as well as judgment No. 56-2008 of the Tribunal Contencioso Administrativo, Sección Primera. They criticize the Ad quem for finding that there was no denial of claims resulting in reciprocal defeat, apparently because the State did not file a counterclaim (contrademanda). But that was not possible under subsection 7) of Article 173 of the Ley General de la Administración Pública, both before and after its amendment, by virtue of Article 200, subsection 6), of the Código Procesal Contencioso-Administrativo. Therefore, they allege, that provision was directly disregarded through failure to apply it. They also allege a violation of Article 98, subsection 2), of the Código Procesal Civil, which requires judges to ensure equal treatment of the parties, which did not occur. Without any justification, they argue, the challenged judgment overlooks the existence of sufficient grounds for litigation, thereby incurring the related defect of inadequate reasoning (falta de motivación) and, consequently, violating Article 155, subsection 3), item e), Ibidem., which requires reasons to be given for all disputed aspects concerning costs.

Fifth: as a final consideration, they state that, in responding to allegation 58 of the complaint, the State asserted: “The registration of parcel [...] is vitiated by absolute nullity (nulidad absoluta), because it was unlawfully recorded over public property not included within the parent parcel. That illegality will be determined in another proceeding. For this purpose, it should be recalled that the State’s cause of action and right are not subject to prescription.” They explain that this is so because Article 173, subsection 7), of the Ley General de la Administración Pública, both before and after its amendment by Article 200, subsection 6), of the Código Procesal Contencioso-Administrativo, precludes the filing of a counterclaim in this matter. The judgments of both instances correctly held that the question of the nullity of the claimant’s registration is a matter for another proceeding, because this litigation has not focused on determining title to the property or its legitimacy.

Indeed, they conclude, no claim in the proceeding has sought recognition or a declaration of an in rem right (derecho real) over the land that is the subject of the environmental complaint. They therefore request that, when this appeal is decided, account be taken of the fact that the ruling: “…does not in any way prejudge the validity of the titles,” as acknowledged in the challenged judgment.

III.The judgments of both instances highlight the subject matter of these proceedings, not only for purposes of resolving the dispute, but also to reject the arguments made by the defendant’s representatives that stray from that subject. Thus, the Trial Court found it established, among other matters: “9.- That the area of land affected according to the reported facts, involving the commencement and expansion of construction of fill adjacent to Hotel L. and the construction of a concrete wall, is located within the surface area of the property registered with the Registro Público under Real Property Folio Registration number [...] pursuant to the registration made on 21 de febrero del 2001, title to which is held by (sic) Mr. A.” “14.- That the property concerning which the facts related to the commencement and expansion of fill at a site adjacent to Hotel L., as well as the construction of a wall in the maritime-terrestrial zone (zona marítimo terrestre), were reported is located within the zone that, for purposes of applying the Ley de Zona Marítimo Terrestre and according to the information supplied by the Instituto Geográfico Nacional, falls within the ‘city’ category and is currently registered as part of the property recorded under Real Property Folio Registration number [...], which is privately owned and whose registered owner is Mr.

A.” The Trial Court also stated that, in resolution no. 851-01-TAA of 15 horas 40 minutos del 20 de noviembre de 2001, the Tribunal Ambiental Administrativo merely issued a “precautionary measure (medida precautoria),” consisting of notifying the Municipalidad de Golfito: “…that the issuance of construction permits is prohibited within the 1382,56 m2 area. Likewise, it must proceed to remove fences and other items that restrict free access to the sea. It must also maintain the area in the best possible condition and permit free access” (established fact no. 11 of the first-instance judgment). That same judgment listed as unproven two matters of central importance to resolving this dispute: “1.- That, as a result of either the commencement and expansion of fill through the placement of material, or the construction of a wall or culvert, as applicable, these works were carried out in areas belonging to the public domain (demanio público), whether in the public area of the maritime-terrestrial zone or the beach area running adjacent to Hotel L.… 2.- That the ruling contained in resolution No. 851-01-TAA of the Tribunal Ambiental Administrativo at 15:40 hrs. del 20 de noviembre del 2001, in relation to the resolution issued by the same Tribunal at 15:49 hrs. del 06 de diciembre del 2001, determined that environmental damage had occurred as a consequence of conduct attributable to the persons investigated.” On that basis, the court of first instance (A quo) structured its decision, essentially highlighting a series of inconsistencies in the actions and decisions of the Tribunal Ambiental Administrativo, which, amid confusion and ambiguity, failed from the outset to specify the nature of the area where the acts attributed to the co-plaintiffs took place or the applicable legislation.

Moreover, it merely issued an interim or precautionary measure (medida cautelar o precautoria), directed not at them but at the Municipalidad de Golfito, an entity that did not even appear in the administrative proceeding. Nevertheless, the A quo observed that, given the property right invoked in his favor by one of the co-plaintiffs, which had been proven, that measure could indirectly have impaired his private ownership, for example by preventing him from obtaining construction permits. On this basis, it granted some of the relief sought by the claimants. In any event, that court also found it established that the reported works were performed within private property and were in no way carried out in or harmful to the public domain, another basis that decisively influenced the granting of the claim. In addition, its reasoning that the investigation conducted by the Tribunal Ambiental Administrativo was directed exclusively at matters concerning the nature of, or the legal regime applicable to, the land on which the acts were performed is inherently relevant; this “…per se, does not imply a finding of environmental damage, absent proof or reasonable doubt in that regard under the in dubio pro natura principle (principio indubio pro natura)….” This is because, it cautioned, “…when environmental damage is at issue, ownership of the property in relation to which such damage is alleged to have occurred is entirely irrelevant, since it is the damage itself that may be held against the private party or the administration that causes it.” In this regard, it considered that, in addition to the fact that ultimately no penalty was imposed on the alleged violators and it was not conclusively determined that the area belonged to the public domain, in any event, “…environmental damage attributable to the persons investigated, or the creation of a danger capable of triggering measures pursuant to the in dubio pro natura principle, which was also invoked but not reasoned through, was neither demonstrated nor at least substantiated, as applicable.” It therefore deemed the interim or precautionary measure improper, reaffirming this by stating that the measure was not based, among other prerequisites, on verification of a danger or risk to environmental integrity.

In summary, it observed: “Having identified what the undersigned considers to be significant defects that are glaringly apparent in the challenged acts, the plaintiff’s representative is correct in asserting that the ‘precautionary measure issued’ unlawfully impaired his property right, making the claim meritorious, as shall indeed be declared in this judgment, because it undermines the factual premise upon which the Tribunal Ambiental Administrativo based its resolutions.… Thus, a prohibition issued in those terms, whether or not characterized as a precautionary measure, is unlawful and indirectly impairs ownership and, consequently, the property right over real property, in violation of Article 45 of the Constitution.” It also emphasized that these proceedings are not intended to analyze potential nullities in the property title or in the registration act alleged at one point to be unlawful.

Nor is it a subject of the dispute, much less a matter for determination, whether the property registered in Mr. A.’s name belongs to the public domain. In conclusion, this was the basis of the judgment issued by the Trial Court, which, in this particular case, defined and delimited not only the contours to which the State’s appeal necessarily had to relate, but also the grounds of error that should have been raised before this Chamber, given that the appellate court endorsed the A quo’s established and unproven facts and also affirmed its decision on the merits.

IV.The foregoing highlights the following matters, which necessarily must be specifically challenged before it can be reviewed whether the conclusion set forth in the appealed judgment, which affirmed the first-instance judgment, should be reversed: 1.- It was not demonstrated that the works were carried out in the public domain. 2.- Instead, it was found established that they occurred on privately owned land belonging to one of the co-plaintiffs. 3.- In any event, the dispute over where they were carried out and the applicable legal regime becomes immaterial if injury or a risk of environmental damage was not demonstrated. 4.- The same applies to the debate over ownership matters, rights in rem (derechos reales), and alleged nullities of registrations, transfers, and surveys, which do not form part of the subject matter of these proceedings. 5.- The ruling of the Tribunal Ambiental Administrativo was not directed against the persons investigated but toward the Municipalidad, which was a party to the proceeding. 6.- Moreover, the measure ordered had no justification based on actual damage or even a risk of harm to the environment. 7.- Nevertheless, it was found to have impaired the plaintiff, and the claim was therefore granted on the terms specified in the operative part of the A quo’s judgment, as affirmed by the Ad quem. 8.- In any event, it was not found that the works in question harmed or endangered the environment.

Among the appellate court’s reasons for endorsing the first-instance judgment, particular emphasis should be placed on its observations concerning the appeal and the appellant’s duty to state specific grounds of error regarding the A quo’s decision, without which the appellate body would be unable to modify that decision. Having issued that caution, it stated: “…the appeal filed in this (sic) dispute will be examined exclusively from this perspective, omitting analysis of allegations concerning matters debated at first instance or those that merely reiterate arguments without explaining the reasons why an error is deemed to exist or why the first-instance judgment is considered to lack a factual or legal basis.” This clarification means that the grounds presented by the A quo to justify its ruling, which the appellate court did not examine because the appeal provided no basis for doing so, must remain undisturbed.

It should also be noted that the State’s representatives did not request supplementation of the Ad quem’s judgment. This means that they found no reason to believe that it had failed to resolve any of the grounds of error or, alternatively, that they waived the right to raise that omission, resulting in procedural preclusion (preclusión procesal) on that specific issue. Consequently, pursuant to Article 608 of the Código Procesal Civil, this Chamber cannot examine the basic points considered by the A quo in its reasoning if the appellate body did not address them because the appeal prevented it from doing so, as the appellate court itself emphasized.

V.The Ad quem reaffirmed the Trial Court’s conclusion by stating that the record did not establish the existence of a beach or public area within the fill area. It stated and reiterated that this was not a subject of the adversarial proceedings or of the dispute. It added another element concerning a certification by the Secretario del Concejo Municipal, which, it noted, proves only the lack of a permit to carry out filling work or to assign responsibility to the person who performed the act. But that certification was immaterial, it stated, because Mr. A. acknowledged that he had performed those acts, and it was also established that various persons and even public institutions had customarily filled the site to prevent erosion caused by tidal ebb and flow against the shoreline. It therefore concluded that the certification “…does not provide conclusive evidence concerning the actual subject matter of these proceedings.”

VI.Regarding the rules protecting public-domain assets (bienes demaniales), the Superior Court held that no violation had occurred, since the complaint did not seek to dispute the property regime applicable to the strip of land or fill that the State claims belongs to the public domain, which is consistent with the ruling of the Court. Indeed, its reasoning indicates that this issue loses relevance because neither harm nor a risk of harm to the environment was established. In addition to these considerations, the appellate court (Ad quem) found that the legal nature of that land is not a claim that may be adjudicated in this litigation, because, with respect to the property regime, what the plaintiff requests is that the Tribunal Ambiental Administrativo be ordered to respect Mr. A.’s private ownership, release the co-plaintiffs from liability, and remove the notations from the survey plan and the administrative warning imposed on L.’s “deed.” On this point, it added: “Regarding respect for the property right claimed by the plaintiff, it is reiterated that this applies strictly within the sphere of the Tribunal Ambiental Administrativo.” In any event, it also found that matters concerning potential challenges to legal transactions were not at issue in the proceeding.

It insisted that the recognition or declaration of a real property right (derecho real) over the land associated with the environmental complaint also falls outside the subject matter under examination. It rejected the State’s arguments regarding alleged manipulation in the preparation of survey plans and the processing of registry entries, matters which it found “…do not permit adjudication of the subject matter of the proceeding because they are unrelated to it….” It affirmed that no sanction had been imposed on the co-plaintiffs, but only a precautionary measure (medida cautelar) on the Municipalidad, adding that any dispute concerning compliance with due process in the administrative proceedings does not properly constitute a ground of appeal (agravio), nor may it be revisited in this matter, since it does not even concern anything addressed in the appealed judgment. It stated unequivocally: “Nor has the environmental damage resulting from the reported acts been proven, as the trial court (A Quo) likewise found it had not been established; therefore, it is pointless to delve into an issue abandoned by the party responsible for proving such damage.” As to the remaining matters, it noted that the defendant had not actually asserted grounds of appeal, but merely arguments and opinions. Finally, it clarified that it had not prejudged “…in any way the validity of the titles on which its arguments are based….” It upheld the award of costs against the losing party.

VII.From the foregoing, it is clear that the Chamber cannot reverse the finding that the land on which the works were performed was proven to be privately owned. It is also clear that the sanction imposed by the Tribunal Ambiental Administrativo was not justified by the alleged harm or risk of injury to the environment. Likewise, the plaintiff’s interests were adversely affected, providing the basis for granting the complaint. Indeed, those matters were not subject to review by the appellate body because, as it stated and explained, the appeal contained inconsistencies, not only because it focused on matters unrelated to the subject of the dispute, but also because much of it consisted of arguments that did not qualify as specific grounds of appeal against the trial court’s decision. This is so much the case that those issues were not even challenged in the appeal in cassation (recurso de casación), because although assertions were made seeking to refute that the plaintiff had been adversely affected, the argument focuses on the administrative warning notation imposed on L.; however, the fact remains that, with respect to that requested relief, although the statute-of-limitations defense (defensa de caducidad) was denied, the relief itself was nevertheless rejected in the trial court judgment, and the Tribunal upheld that denial.

VIII.In another vein, it is evident that, in the first section of the appeal, the cassation appellants (casacionistas) refer to environmental damage caused by filling coastal public-domain land. Based on these matters, they advance a series of objections that converge on alleged errors in the assessment of evidence. The appellate court did, in fact, reject the State’s appeal on the following basis: “…the appellant’s challenge is purely argumentative, since the record did not establish the existence of a beach area on the fill site; there simply is no technical and factual evidence from which it could be concluded that a beach area existed or exists there, or that the fill was placed on a beach area or public zone….” It further found: “Nor has the environmental damage resulting from the reported acts been proven, as the trial court likewise found it had not been established; therefore, it is pointless to delve into an issue abandoned by the party responsible for proving such damage.” Based on these two premises, the Tribunal, like the Court, found that the alleged environmental damage had not been proven and that it had not been established that the fill affected coastal public-domain land or was placed within a public zone, an issue that, in any event, is secondary to the former.

It is true, as the appellants assert, that the Tribunal accepted the plaintiff’s statement when Mr. A. acknowledged having performed the work to prevent erosion caused by tidal ebb and flow. However, those statements do not establish that the work was situated on and affected public-domain land. That Chamber included those statements to emphasize that the certification issued by the Concejo Municipal de Golfito was not suitable evidence of those matters, since it merely reported the absence of a permit to perform the filling work. Thus, identifying the person who performed the work became unnecessary in light of the acknowledgment made by the person who carried it out. But this in no way means that he accepted responsibility for having performed it in a public zone or conceded the allegation that he had caused environmental damage; on the contrary, he consistently disputed those allegations.

This is the basis for the reference to that subject in the challenged judgment, and it cannot be construed as a recognition “per se” of the matters in dispute. This is so not only because the plaintiff has consistently challenged the rulings of the Tribunal Ambiental Administrativo, to the point of bringing this action to have them declared null and void, but also because the judges at both levels so ruled, rejecting the defense presented by the State’s representatives, as well as, in the case of the appellate court, the arguments comprising the appeal. As that judicial body correctly noted, appeals cannot merely reiterate the defensive arguments raised at the various procedural stages, particularly in the answer to the complaint. Specific challenges to the dispositive reasoning set forth in the contested ruling were required, aimed, as explained above, not only at establishing the public-domain nature of the land where the works were performed, but, above all, at demonstrating actual or potential harm to the environment.

Indeed, it should be noted that the rulings of the Tribunal Ambiental Administrativo do not establish the existence of any specific damage or risk, since the investigated persons were not even subjected to the precautionary measure which, as stated, was directed solely at the Municipalidad. In this regard, before this Chamber, the appellants persist in presenting arguments that do not qualify as genuine claims of error against the Tribunal. This is particularly so when they list a large number of legal provisions they allege were violated without explaining, one by one, the nature of each violation. All of this precludes altering that ruling because the Chamber’s jurisdiction is limited to hearing specific objections that would authorize it to exercise its review of legality. The same applies to references to the history of cadastral plans, the surface areas described therein, discrepancies in measurements, and the possessory-information proceeding (información posesoria), none of which they successfully frame as objections to specific aspects of the challenged judgment. In any event, that dispute is superfluous because no injury or specific risk of harm to the environment was conclusively established.

IX.Regarding the public reports in the administrative record, such as the one issued by the Instituto Geográfico Nacional, as well as the official communications from the Catastro Nacional, which, in the view of the cassation appellants, establish that the fill was placed on the seacoast or affects this part of the Bahía de Golfito, it is not true, as they allege, that the judges at both levels ignored them or that, as a result, there was an error of law in their assessment. As already explained, they have not effectively challenged the findings that the works were performed on land forming part of Mr. A.’s private property and that the works did not create environmental danger or harm. The same must also be said regarding the Tribunal Ambiental Administrativo’s “in situ” verification during the inspections conducted on 4 de febrero and 20 de julio, both in 1999, with the participation of the co-plaintiffs, and regarding the photographs dated 18 de junio de 1999.

On this point, it is clear that reliable technical and scientific evidence was required to establish the actual existence of environmental damage or a specific risk that it would occur. That omission is likewise not remedied by the certification issued by the Secretary of the Concejo Municipal de Golfito and reiterated by the Alcalde and the Inspector General del Municipio, to which the cassation appellants refer. As the appellate court correctly stated, it establishes only the absence of a permit to perform filling work. The same must be said of co-plaintiff A.’s statements, where the appellants indicate that he explained that the tide entered the area where the culvert was located and continued into the street, which does not in itself establish harm to the environment.

X.Regarding the circumstances mentioned by the appellants concerning survey plans, registry entries, property areas, subdivisions (segregaciones), and transfers, it is not true that the trial and appellate authorities failed to assess them. Rather, both agreed that they were not part of the subject matter of the dispute. Nor do they reliably establish that the reported acts did not occur on privately owned land or that they affected the environment; as to the latter issue, it bears repeating that it was not established by the information obtained from the Instituto Geográfico Nacional, from the Catastro Nacional during the administrative proceedings, or from the results of the judicial inspection (reconocimiento judicial). The testimony of Mr. M. M., transcribed in support of the cassation appellants, merely conveys a personal opinion that is in no way conclusive regarding environmental damage. According to their quotation from that statement, it is noteworthy that this person says he imagines that the tide is being prevented from functioning normally, adding that there may be a lack of respect for the sea and that he believes this is what he observed at the site. But he does not categorically demonstrate actual harm or explain the existence of a specific risk of harm to the environment.

XI.The appellants’ line of argument concerning the violations of legal provisions they allege is striking. As noted above, they do not explain in detail how each provision was infringed, rendering the appeal procedurally defective. Moreover, in essence, they attempt to justify those violations so that the rulings of the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo) may remain in force. Nevertheless, what follows from those rulings is the issuance of interim measures (medidas cautelares) against the Municipalidad de Golfito; and as to the harm they might cause the plaintiff, it bears repeating that no effective challenge has been made that would permit that conclusion to be overturned. In any event, the decisions likewise disclose no environmental harm, much less any attributable to the respondents, who are the co-plaintiffs here and against whom the interim measure was not even directed, although it was deemed harmful at both levels of adjudication, without the appeal succeeding in establishing otherwise.

XII.The matters of due process (debido proceso) and administrative sanctions (sanción administrativa) are tangential to the subject of the dispute. Whether or not the Municipalidad de Golfito was a party to the administrative proceeding has no bearing on granting the claim. Nor does whether L. or its representatives suffered any denial of the right to a defense (indefensión). The absence of authorization from the Municipality for the fill does not, by itself, establish strict liability (responsabilidad objetiva) for environmental damage if such damage was not proven. Nor is such damage established merely because the Tribunal Ambiental Administrativo stated, in some sense, that it did exist. Its decisions, which are challenged in these proceedings, neither specify nor direct any ruling against the persons to whom the conduct was attributed. They therefore provide no sufficient basis for deeming that harm established.

XIII.The third ground of the appeal concerns the portion of the claim relating to removal of the warning notation (nota de advertencia); but, as the appellants themselves acknowledge, that request was denied by the adjudicative bodies at both levels, in which case the objections raised in that section and the request that the matter be declared time-barred (caducidad) are inadmissible. They request that the defense of lack of legal entitlement (falta de derecho) be upheld, and that is what occurred at first instance; indeed, the plaintiff appealed the denial of the corresponding relief, and the Tribunal upheld the judgment on that point as well. Lastly, although the co-plaintiffs asserted that the warning notation constitutes a limitation on the right to property, that argument led nowhere because the corresponding relief was denied.

XIV.The final section of the appeal sets forth a concluding observation, requesting consideration of the following statement made in the response to the complaint: “The registration of the property [...] is void ab initio, since it was unlawfully entered in respect of public property not encompassed by the parent property. That illegality will be determined in separate proceedings. For that purpose, it should be recalled that the State’s cause of action and right are not subject to a statute of limitations (imprescriptibles).” They explain that section 173, subsection 7), of the Ley General de la Administración Pública, both before and after its amendment by artículo 200, subsection 6), of the Código Procesal Contencioso Administrativo, precludes the filing of a counterclaim (contrademanda) in this matter. They add that the judgments at both levels correctly held that the issue of the invalidity of the plaintiff’s registration is a matter for determination in separate proceedings, since this litigation has not focused on resolving the property title or its legitimacy.

Indeed, they conclude, no claim has been brought in these proceedings seeking recognition or declaration of a real property right (derecho real) over the land that was the subject of the environmental complaint. They therefore request that, when this appeal is decided, it be taken into account that the ruling: “…in no way prejudges the validity of the titles,” as acknowledged in the challenged judgment. In fact, it is clear that those statements likewise do not constitute a grievance against the challenged decision, and therefore no ruling by this Chamber is warranted, although the appellants’ own statements plainly acknowledge that the proceedings have not concerned recognition or declaration of a real property right over the place where the reported acts occurred, as has been left undisturbed.

XV.Regarding the order requiring the State to pay both categories of litigation costs (ambas costas del proceso), which has been challenged, the majority of this Chamber considers that imposing them on the unsuccessful party is mandated by law. Accordingly, there are no grounds for overturning the judgment where, in ordering the losing party to make that payment, the trial judge merely applied artículo 221 del Código Procesal Civil. By contrast, exemption from costs (exoneración) is discretionary and may be granted in the specific circumstances established by law in ordinal 222 Ibidem., as well as in numeral 98 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa. In this regard, an appeal in cassation (recurso de casación) might be available where that discretion has been improperly exercised. The Tribunal’s judgment upheld the A quo’s decision to order the unsuccessful party to make that payment; therefore, there is no basis for cassation review (revisión casacional) of that ruling.

XVI.For all the foregoing reasons, the appeal must be dismissed, with its costs borne by the State (artículo 611 del Código Procesal Civil).

POR TANTO

The appeal is dismissed. Its costs shall be borne by the State.

I.The undersigned members do not share the view expressed by the majority of this Chamber in recital XV (considerando XV) of the foregoing judgment insofar as it denies cassation review in cases where only the general rule ordering the unsuccessful party to pay both categories of costs is applied, that is, where no provision concerning exemption from those costs is invoked or applied. Indeed, the majority’s case-law rationale begins with the premise that exemption from payment of costs is discretionary and that no error or violation of law occurs when that discretion is not exercised or applied; accordingly, it is said that, absent a violation of law, cassation proceedings cannot review or modify the ruling ordering the unsuccessful party to pay costs because, it bears repeating, the majority of this Chamber considers that a legal violation can occur only when the corresponding exemption provision is applied (among many others, see the judgments of this Chamber no. 1001- F-2002, de las 11 horas 50 minutos del 20 de diciembre del 2002; la 249-F-2003, de las 11 horas 45 minutos del 7 de mayo del 2003 y la 306-F-2006, de las 10 horas 20 minutos del 25 de mayo del 2006).

At first, this chain of reasoning appears logical because, under that premise, if exemption is discretionary, the judge is not required to grant it; consequently, if the judge does not order or grant such an exemption, the provisions governing the matter are not violated. Ergo, if no provisions are violated, there can be no cassation review (see the decisions of this Chamber no. 765 de las 16 horas del 26 de septiembre del 2001 y 561-F-2003, de las 10 horas 30 minutos del 10 de septiembre del 2003). This line of reasoning allows them to conclude that, in that specific circumstance—the mere imposition of costs or the failure to apply the exemptions—the matter “cannot be reviewed by this court” (from this same adjudicative body, judgment n° 419-F-03, de las 9 horas 20 minutos del 18 de julio del 2003), because it is a situation “not subject to cassation” (judgment n° 653-F-2003, de las 11 horas 20 minutos del 8 de octubre del 2003).

Thus, in the opinion of our distinguished colleagues, an appeal in cassation is unavailable when the discretion to grant an exemption is not exercised (see a contrario sensu recitals III and VIII, respectively, of decisions 541-F-2003, de las 11 horas 10 minutos del día 3 y 563-F-2003 de las 10 horas 50 minutos del día 10, ambas de septiembre del 2003). The majority has thus held that “…an award of costs against the unsuccessful party, as occurred here, is not reviewable by this Court, given that the Tribunal merely applied the provision in accordance with its terms” (emphasis not in the original; see recital X of decision no. 68-F-2005, de las 14 horas 30 minutos del 15 de diciembre del 2005). In notarial matters, it has been stated even more emphatically that: “…the Tribunal ordered the complainant to pay the costs of the claim for damages, a ruling which, it bears repeating, is not subject to cassation.” (recital X of judgment n° 928-F-2006, de las 9 horas 15 minutos del 24 de noviembre del 2006).

II.However, in the opinion of the undersigned, the improper failure to apply the provisions permitting exemption from costs unquestionably violates the legal system (Ordenamiento Jurídico) and, specifically, the provisions authorizing such exemption, whether due to error or an improper assessment by the judges in the particular dispute. Thus, although it is a discretionary power, it is not immune from cassation review, since a violation of law may occur both through its exercise and through its non-application; to that extent, an improper omission is not, and must not be, synonymous with arbitrariness, in such a case committed by the judge. This is especially so where the judge has been vested with authority subject to specific conditions that limit judicial discretion in this area. Consequently, on this particular issue, we consider that merely applying the general rule of artículo 221 del Código Procesal Civil (ordering the unsuccessful party to pay both categories of costs) does not foreclose an appeal in cassation; on the contrary, the matter is admissible for review on the merits, provided that the statutory requirements are met, where there may have been an omission to apply the statutory provisions authorizing exemption from such costs (cánones 55 de la Ley de Jurisdicción Agraria y 193 del Código Procesal Contencioso Administrativo).

Notwithstanding the foregoing, in the specific case under review, the undersigned members concur with the Tribunal’s decision on the merits insofar as it ordered the unsuccessful party to pay those costs, a circumstance that leads us to reject the grievance and, with it, the appeal brought on this ground.

Proceso ordinario establecido en el Juzgado Contencioso Administrativo y Civil de Hacienda, por A., […], en su condición personal y como apoderado del HOTEL L. SOCIEDAD ANÓNIMA y C., farmacéutico; contra el ESTADO, representado por los procuradores José Joaquín Barahona Vargas y Mauricio Castro Lizano. Figura además, como apoderado especial judicial de los actores, Fabián Volio Echeverría. Todos son mayores, […].

RESULTANDO

  1. 1Con base en los hechos que expuso y disposiciones legales que citó, los actores establecieron demanda ordinaria, cuya cuantía se fijó inestimable, a fin de que en sentencia se declare: "a) La nulidad absoluta de la resolución número 851-01-TAA de las 15:40 horas del 20 de noviembre del 2001, y de la resolución Nº 890-01-TAA dictada a las 10:49 horas del 6 de diciembre de dos mil uno, por el Tribunal Ambiental Administrativo en procedo (sic) seguido contra Hotel L. S.A., que se tramita bajo el expediente número 71-99-TAA. b) En su lugar, se libere de toda responsabilidad al Hotel L., S.A. a C. y a A., y se ordene al Tribunal Ambiental Administrativo respetar el derecho de propiedad privada de A., y excluir de toda responsabilidad al Hotel L., S.A. y a C.. c) Se eliminen las anotaciones inscritas en el plano y la advertencia administrativa impuesta en la escritura del Hotel L., S.A., Nº 15286. d) Se condene al Estado al (sic) pagar ambas costas de este juicio y los daños y perjuicios causados.”
  2. 2La representación estatal contestó negativamente. Planteó las defensas previas de defectos procesales de la demanda y acto consentido. También opuso la excepción de falta de derecho y la de caducidad en cuanto a la petitoria relativa a la anotación inscrita en el Registro Público.
  3. 3El juez Felipe Córdoba Ramírez, en sentencia no. 2535-2009 de las 14 horas 30 minutos del 30 de octubre del 2009, dispuso: “De conformidad con los hechos que informan el proceso y citas legales mencionadas, se resuelve: Téngase por rechazadas en cuanto a los accionantes Hotel L. Sociedad Anónima y A., las defensas de defectos formales entre los escritos de interposición de la demanda y formalización, así como acto consentido. Se tiene por rechaza (sic) la excepción de caducidad y de falta de derecho. Se declara con lugar parcial (sic) presente demanda, entendiéndose rechazada en lo no expresamente concedido. Se anulan las resoluciones dictadas por el Tribunal Ambiental Administrativo número ochocientos cincuenta y uno-cero uno-TAA de las quince horas con cuarenta minutos del veinte de noviembre del dos mil uno y la número ochocientos noventa-cero uno-TAA dictada a las diez horas con cuarenta y nueve minutos del seis de diciembre de dos mil uno. Se condena al Estado al pago de ambas costas del (sic) derivadas del presente proceso ordinario."
  4. 4El Tribunal Contencioso Administrativo, Sección Octava, integrado por los jueces Isaac Amador Hernández, Carlos Espinoza Salas, Francisco Jiménez Villegas, en sentencia no. 60-2010-VIII de las 15 horas del 29 de junio de 2010: resolvió: “En lo que ha sido objeto de impugnación y por los motivos apelada.”

CONSIDERANDO

I.Los señores C. y A., este último en su carácter personal y como representante del Hotel L., S.A. (L., en adelante), demandan al Estado. Piden se declare en sentencia la nulidad absoluta de las resoluciones nos. 851-01-TAA de las 15 horas 40 minutos del 20 de noviembre de 2001 y 890-01-TAA de las 10 horas 49 minutos del 6 de diciembre de 2001, dictadas por el Tribunal Ambiental Administrativo. Explican que con la primera, ese órgano los encontró responsables de construir una alcantarilla y permitir el depósito de materiales en la zona pública de Golfito, aludiéndose también al inicio e incremento de un relleno y a la edificación de un muro; estos últimos aspectos han sido base de la contienda. Como medida precautoria, acordó notificar al Ayuntamiento de esa localidad, la prohibición para otorgar permisos de construcción en una zona de 1382.56 m2. Además, “retirar cercas y otros” que limiten el acceso al mar, manteniendo esa área en las mejores condiciones y con libertad de acceso.

En el otro pronunciamiento se rechazó el recurso de revocatoria que plantearon contra el anterior. En esencia, aducen, el objeto del procedimiento administrativo era la investigación de una denuncia por el inicio e incremento del relleno y la construcción del muro en la zona marítimo-terrestre, dentro de la finca no. [...] que incluye la franja de 1382.56 m2 frente al mar, aunque luego se aclaró que lo afectado fue la playa. No obstante, señalan, ese inmueble es propiedad privada inscrita a nombre del codemandante A.. En lugar de lo dispuesto en esas resoluciones, solicitan se les libere de toda responsabilidad. Además, se ordene al citado Tribunal a respetar el derecho de propiedad privada del coactor A.. Se eliminen las anotaciones inscritas en el plano y la advertencia administrativa impuesta en la “escritura” de L.. Asimismo, se imponga al demandado el pago de ambas costas, daños y perjuicios.

La representación estatal se opuso. Planteó las defensas previas de defectos procesales de la demanda y acto consentido. De estas, se denegó la primera y se aceptó de manera parcial la segunda, declarándose inadmisible la acción solo en lo atinente al actor C.. El proceso continuó respecto al señor A. y a L.. También opuso el Estado la excepción de falta de derecho. Asimismo, la de caducidad en cuanto a la petitoria relativa a la anotación de la advertencia marginal sobre la finca inscrita en el Registro Público, matrícula no. [...], hecha a solicitud de la Procuraduría General de la República. Esta defensa se denegó en forma interlocutoria. En sentencia, el Juzgado rechazó la falta de derecho. Declaró parcialmente con lugar la demanda. Anuló las citadas resoluciones del Tribunal Ambiental Administrativo. Condenó al accionado a pagar ambas costas del proceso. Rechazó los restantes extremos petitorios. El Tribunal confirmó la sentencia del A quo.

II.Impugnan ante esta Sala los representantes del Estado. Plantean cinco apartados. Primero: en cuanto al daño ambiental por relleno del demanio costero, alegan, el fallo recurrido, en el Considerando Segundo, prohijó el acápite de hechos no probados de la sentencia del Juzgado, relativos a la falta de demostración del relleno en el área de playa y del daño ambiental que causaron los coactores. El A quo, indican, afirmó que el oficio no. 99-229 de 8 de octubre de 1999 del Instituto Geográfico Nacional, vagamente hace referencia a un relleno que afecta parte del mar. Pero no logra demostrar, por no ser concluyente, haberse incorporado en la zona de playa. Así, tuvo por no probado que el relleno sea en un bien de dominio público. El Ad quem, sostienen, en el Considerando Tercero, punto C, estableció que no se probó, de manera técnica ni fáctica, el relleno en la costa. Estimó que las fotografías y lo certificado por la Municipalidad de Golfito no son contundentes a esos fines.

Además, que la parte actora reconoció como acción propia la del relleno, cuyo propósito fue “…evitar la erosión producto del flujo y reflujo mareal en contra del borde de la costa, entonces para qué es útil en la sentencia de grado referirse a la falta del permiso”. De este modo, agregan, el Superior reconoció que el relleno sí afectó el borde de la costa. Sin embargo, en forma contradictoria con el elenco probatorio que se analizará, señaló: “Tampoco ha sido demostrado tal y como lo tuvo por acreditado el A Quo, el daño ambiental producto de los hechos denunciados, de tal forma que, estéril resulta ahondar en un tema abandonado por la parte interesada en probar tal daño”. Como lo anotaron en el recurso de apelación, explican, el Tribunal Ambiental Administrativo, cumpliendo el debido proceso, tuvo por cierto el daño ambiental, consistente en el relleno del litoral, en una extensión de 1.382,56 m2.

Con fundamento en los artículos 111 de la Ley Orgánica del Ambiente; 1, inciso 1); 2 y 3, inciso 1), de la Ley de Aguas, ordenó el retiro de cercas que limitan el libre acceso al mar. Acusan violación indirecta de esa normativa por error de derecho. Esa área de relleno, continúan, primero fue catastrada por la parte actora, para información posesoria. Luego levantó el plano no. [...], cuya superficie, conforme se consigna en el acta del reconocimiento judicial de folios 576 a 578, no coincide con las medidas que se apreciaron en el sitio. Eso puso en evidencia que el levantamiento topográfico, de agosto de 1999, catastrado el 13 de setiembre de ese año, se hizo con prontitud para un soporte registral sobre el domino público, es decir, luego de la prueba que se recibió en sede administrativa el 2 de setiembre siguiente. Consideran que los informes públicos del expediente administrativo comprueban el relleno en la costa del mar.

No obstante, objetan, son ignorados por los juzgadores de ambas instancias. Reiteran que existe un error de derecho en la apreciación de la prueba, según los presupuestos de los artículos 318, inciso 3), y 370 ambos del Código Procesal Civil, que reconocen su auténtico valor. Según detallan, el informe del Instituto Geográfico Nacional es concluyente, cuando afirma que el área de relleno “…afecta la parte de mar en la bahía de Golfito”. Eso coincide, 1999, el cual evidenció que: “…el plano [...] abarca terrenos correspondientes al Océano Pacífico”, lo cual es complemento del no. [...] de 6 de setiembre de 1999, donde igualmente se acreditó la afectación de la costa marina. Lo anterior, añaden, lo corroboró “in situ” el Tribunal Ambiental Administrativo, en las inspecciones del 4 de febrero y del 20 de julio, ambos meses de 1999, donde participaron los personeros de los coaccionantes, y lo revelan las fotografías del 18 de junio de 1999.

En concordancia con lo expuesto, señalan, el Secretario del Concejo Municipal de Golfito certificó, el 31 de agosto de 1999, la falta de permiso para realizar obras de relleno del medio marino del sector costero del kilómetro 3, a nombre de: “Hotel L. S.A…; A.…; C....”. Esa constancia fue reiterada por el Alcalde y el Inspector General del Municipio el 10 de setiembre de 1999, sostienen. Asimismo, en la comparecencia oral del 2 de setiembre de 1999, don A., ante la pregunta del ingeniero A. B., vicepresidente del Tribunal Ambiental Administrativo, relativa a si la marea llegaba al área de relleno, contestó: “Sobretodo se metía en la parte donde estaban las alcantarillas, ahí socavaba mucho tanto en las alcantarillas, se iba metiendo en la calle”. Aducen que los señores C. y A., en escritos del 23 setiembre de 1999, dirigidos al Director del Catastro Nacional, solicitaron la cancelación de los planos [...] y [...].

Esto, 21 días después de la citada comparecencia del 2 de setiembre de 1999, cuando adquirieron conciencia del efecto negativo que les representaba abarcar áreas de la ribera del mar sin respaldo registral. Explican que si la cabida de la finca no. [...] es de 4.804 m2, según plano [...], y una parte en el sector de interés que segregó la Compañía Bananera de la finca no. [...], con el plano [...], tiene 2.556,11 m2, ambas porciones suman 7.362,11 m2. Entonces, justifican, al igual que lo hizo el Catastro Nacional, se constata que el plano [...] (8.810,58 m2), abarca áreas rellenas del océano Pacífico, en una extensión aproximada de 1.450,47 m2, incluso superior a los 1.382,56 m2 del plano [...]. Con lo cual, también se demuestra que la piscina descrita entre los vértices 11-16 del plano catastrado [...], es otro relleno de ese Océano, que no contenía el plano [...] (vértices 3-4). Hacen notar que para el 26 de mayo de 1970, al norte de los vértices 0-10 del plano catastrado [...], se aprecia únicamente el “Contorno de marea alta mediana” y la “BAHIA DE GOLFITO”, determinándose así que la finca madre no. [...], inscrita el 25 de noviembre de 1965, tampoco comprendió el sector hoy rellenado y descrito en los planos catastrados [...] y [...], este último que describe la finca no. [...].

Concluyen, estos elementos probatorios aportados al contestar la demanda y su análisis por parte del Instituto Geográfico Nacional y el Catastro Nacional en sede administrativa, no fueron valorados en las sentencias de ambas instancias, incurriéndose en el vicio de violación indirecta de la ley. Informan que cuando el Estado contestó, ofreció como prueba el reconocimiento judicial, practicado el 24 de marzo de 2006, cuya acta consigna: “El agua del mar topa contra el muro en toda su extensión o trayecto a lo largo de todo el muro, cubriendo aproximadamente unos cincuenta o sesenta centímetros de su altura en marca baja”. Obsérvese, enfatizan, que aún en marea baja, el muro que constituye el área de relleno, impide el avance del mar sobre el borde de la costa dañada por acción de la parte actora. Por eso, insisten, la sentencia recurrida también infringe, por violación indirecta, los artículos 330 y 409 del Código Procesal Civil, al no tomar en cuenta lo apreciado en esa diligencia probatoria, que constató cómo el muro de aproximadamente 2,40 m de altura y 46,70 m de largo, impide el flujo y reflujo de las mareas.

Lo que constató el reconocimiento judicial, acotan, es coincidente con el testimonio del funcionario del Instituto Geográfico Nacional, ¡ingeniero M. M., en la comparencia del 2 de setiembre de 1999: “…hay un muro que creo bordea todo el terreno, donde para la corriente del agua entonces uno se imagina o analiza de ver la condición de que en verdad se está impidiendo que la marea trabaje normalmente en esa zona, de subir y bajar, o sea lo que es la marea alta y la bajamar que es la marea totalmente baja. Entonces dice uno bueno aquí hay una situación talvez de irrespeto al mar, entonces hasta donde se está irrespetando esa situación. Y creo que eso sí lo observamos perfectamente ahí”. Refieren, luego de la citada audiencia del 2 de setiembre de 1999, durante la suspensión del procedimiento administrativo, los codemandantes suscribieron la compraventa contenida en la escritura otorgada ante el notario M., a las 16 horas del 10 de febrero de 2001, presentada al Diario el 9 de febrero siguiente.

Ella dio lugar, el 21 de ese mes, a la inscripción de la finca no. [...] del partido de [...]. En esa escritura, aseveran, utilizaron el plano [...], catastrado el 13 de setiembre de 1999, es decir, 11 días después de la comparecencia oral, y abarcaron la zona del relleno, también descrita en el plano [...]. Por consiguiente, denuncian, sí se aportó prueba al expediente judicial, tanto documental (expediente administrativo y planos catastrados), como la práctica del reconocimiento judicial, con participación técnica del Instituto Geográfico Nacional, cuyos datos fueron incorporados al acta de reconocimiento judicial. La sentencia impugnada, manifiestan, no analiza ni valora, en debida forma, el acervo probatorio aportado por la representación estatal, para acreditar el daño al ambiente con el relleno de la costa del mar. Acusan quebranto del principio de jerarquía normativa, previsto en el artículo 6 de la Ley General de Administración Pública, en relación con los numerales 1, 7, 8, 19, 20 y 22 del Código Civil, que para el caso concreto mantienen la superioridad de los artículos 1 y 20 de la Ley de Aguas de 1884, y de los preceptos 1, inciso 1); 2 y 3, inciso 1), de la actual Ley de Aguas, sobre actos derivados de convenios particulares.

En esa virtud, agregan, se deben mantener las resoluciones del Tribunal Ambiental Administrativo, que observaron disposiciones sobre las riberas del mar como dominio público. Segundo: atinente a la sanción administrativa que cumplió el debido proceso, arguyen, el A quo indicó, oficiosamente, que la Municipalidad de Golfito no fue parte en el procedimiento administrativo. Indefensión que se dice alcanzó a L., pues no le imputó hechos y tuvo por responsables a sus dos representantes sin tener por demostrada su participación. Según explican, con esas consideraciones, ese órgano distinguió entre la orden de retirar las cercas y la prohibición de otorgar permisos constructivos sobre el área de relleno. Sobre este aspecto, censuran, es más gravosa la decisión del Ad quem, cuando afirmó que el alegato del Estado no es un agravio posible en esta instancia, por tratarse de un asunto que decidieron los órganos administrativos competentes, de modo que no debe ahondarse en el tema.

Además, agregó que los reproches estatales no tienen sustento fáctico y sin más optó por rechazar el tercer agravio referente a esa temática. Sobre el daño ambiental por el relleno de la costa del mar, reiteran, según lo indicaron al apelar, la Municipalidad de Golfito sí fue parte del procedimiento administrativo. Su representante legal, el Alcalde, fue citado a la inspección de campo en la resolución no. 199-99 de 12 horas 42 minutos del 24 de junio de 1999. La que imputó los hechos, es decir, la no. 258-99-TAA, tuvo como denunciado al Municipio y citó nuevamente a su Alcalde, a la comparecencia oral del 2 de setiembre de 1999. Incluso, contestó una pregunta, indicando que el área rellenada “…es playa, porque donde está el mar, es playa”. Esa declaración, acusan, también fue ignorada en la sentencia recurrida. En su criterio, el procedimiento administrativo no causó indefensión a la Municipalidad de Golfito, ni a los personeros L..

Afirman que el A quo tuvo por probado que en la inspección del Tribunal Ambiental Administrativos, participaron el Alcalde de ese Ayuntamiento, C. y A., a quienes, según se tuvo por acreditado, se les comunicó el inicio del procedimiento. En este sentido, recalcan, no hubo indefensión para L. ni para sus personeros, quienes igualmente intervinieron a título personal. Exponen que la resolución no. 258-99-TAA, dio curso al procedimiento administrativo por la afectación ambiental del relleno, entre otros, con fundamento en el artículo 101 de la Ley Orgánica del Ambiente. Esa resolución fue impugnada por los señores C. y A., a título personal y como personeros y socios de L., pero no se refirieron a ninguno de los cuestionamientos y dudas a que aluden las sentencias de ambas instancia. El recurso se rechazó. Después el Tribunal Ambiental Administrativo dictó la resolución no. 851-01-TAA y también se les notificó a esas personas.

A., en su calidad personal y como representante de L., la impugnó. En resolución no. 890-01-TAA se denegó el recurso. Con este recuento, aducen que durante el curso del procedimiento administrativo, quedó claro que la Municipalidad de Golfito no autorizó el relleno. Más bien, el 16 de junio de 1999, clausuró las obras por intermedio del inspector F.. Acotan, el Tribunal Ambiental Administrativo, en su pronunciamiento no. 851-01-TAA, constató con la prueba visible a folios 39, 40, 63, 72, 241 y 319 del expediente administrativo, el daño ambiental, consistente en un relleno de 1.382,56 m2, y ordenó el retiro de las cercas por afectar el uso público y libre tránsito de las personas. En esa oportunidad, agregan, se citaron, como fundamento jurídico, los artículos 3, inciso IV, de la Ley de Aguas; 1, 2, 3, 4, 71, 101, 105, 106 y 111 de la Ley Orgánica del Ambiente; 11 y 45 de la Ley de Biodiversidad.

La resolución no. 890-O1-TAA adicionó los numerales 10, inciso 1); 2 y 3, inciso 1) de la Ley de Aguas, suprimiéndose por improcedente la mención al artículo 20 de la Ley 6043. Lo anterior, reseñan, por cuanto, si bien a los terrenos ubicados en las ciudades costeras no les resulta aplicable esta última Ley, aún así deben respetar la ribera del mar como propiedad nacional. Es su criterio, el canon 101 de la Ley Orgánica del Ambiente, aplicado en la especie por el Tribunal Ambiental Administrativo, establece la responsabilidad ambiental de carácter objetivo, que puede trascender, en forma solidaria, no sólo a los socios de una empresa, sino también a sus representantes y hasta a los titulares de las actividades, que en este caso intervinieron en el procedimiento administrativo a título personal y como representantes de la sociedad denunciada. Se apoyan en los votos nos. 1669-00, 6514-02 y 4822-07 de la Sala Constitucional, y no 2569-09 del Tribunal Contencioso Administrativo, Sección IV, y sintetizan que si las obras de relleno nunca fueron autorizadas por la Municipalidad de Golfito, lo que cabía, y así se estableció, fue impedir la continuación de mayores daños ambientales.

Según la Ley Orgánica del Ambiente, en sus precepto 111, incisos a) y b), es parte de las competencias del Tribunal Ambiental Administrativo, aseveran, adoptar las medidas pertinentes para evitar a futuro comportamientos o conductas que lo incrementen. Así sucedió en este asunto, insisten, donde se ordenó el retiro de las cercas que afectan el paisaje costero, lo mismo que el uso común y el libre tránsito de la ribera del mar. Por ello acusan quebranto de los artículos 318, inciso 3), y 370 del Código Procesal Civil, en cuanto al valor probatorio del Ambiental Administrativo cumplió el debido proceso y es de su resorte potestativo. Tercero: sobre la pretendida eliminación de la nota de advertencia por la parte actora, rechazada por los órganos de ambas instancias, precisan como así dice que lo indicaron al apelar, que ese aspecto no fue alegado en la interposición del proceso, sino en la deducción de la demanda.

En consecuencia, censuran, se trata de un extremo petitorio inadmisible en los términos de los artículos 60, inciso c), y 21, inciso a), de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, por estar caduco según el numeral 175 de la Ley General de la Administración Pública, como afirman que lo reiteraron en la apelación. Ese cuestionamiento quedó diferido para conocerse en la sentencia, expresan, pues la juzgadora argumentó que era necesario determinar si las notas de advertencia eran producto del criterio adoptado por el Tribunal Ambiental Administrativo. Lo anterior no es posible, recriminan, toda vez que mientras las resoluciones de ese Tribunal son de noviembre y diciembre de 2001, la nota de advertencia adoptada por el Registro, a solicitud de la Procuraduría, es del 31 de agosto de 1999, y se notificó a los codemandantes el 6 de setiembre de 1999. Por ello, argumentan, no es una consecuencia de lo resuelto por ese árgano administrativo.

En este predicado, agregan, respecto a ese extremo cabe igualmente acoger las excepciones de falta de derecho y de caducidad opuestas al contestar la demanda, en el escrito del 13 de agosto de 2007 y en la apelación, pues cuando sucedieron los hechos que interesan en este proceso no había sido modificado el artículo 175 de la Ley General de Administración Pública. El fallo recurrido, acusan, yerra cuando computa el plazo entre la notificación a la parte actora, el 6 de setiembre de 1999, y la interposición del proceso que ocurrió el 11 de febrero de 2002. Eso es incorrecto, reprochan, porque en la interposición no se impugnó ninguna nota de advertencia, sino que se hizo hasta la deducción el 17 de mayo de 2004, cuando ya habían transcurrido más de cuatro años y ocho meses, siendo aplicable el numeral 175 de la Ley General de la Administración Pública, infringido por la errada valoración de la prueba, para determinar los extremos de cómputo de su plazo.

En razón de lo expuesto, afirman, se debe casar la sentencia combatida, en tanto rechazó el correspondiente agravio de la apelación y denegó la caducidad invocada. Para mantener las notas de advertencia, debe considerarse lo que expresaron al contestar la demanda, donde hicieron ver el contenido en el oficio no. PGR-162-99: “Si el Catastro Nacional al hacer la inscripción del plano notare algún defecto o vicio que afecte la inscripción del Registro Público, lo pertinente -para salvar responsabilidades y ejercer el control que también le compete- es que se lo ponga en conocimiento y haga consignar una nota de advertencia, dando cuenta a este despacho de la situación si hubiere base para llevar adelante otras acciones administrativas o judiciales”. Agregan que a esta potestad también se refirió el dictamen C-050-96 del 26 de marzo de 1996, y ha sido reconocida por la Sala Constitucional, en los votos nos. 1975-91 y 6170-98, quien indicó: “En el caso que nos ocupa existen indicios de que la inscripción del plano [...], presenta irregularidades, pues se incluyó en el mismo parte de la zona marítimo terrestre no inscrita de previo a nombre de ningún particular…

La actuación que se recurre, sea la anotación de advertencia que hace el Director del Catastro en el plano, es una medida precautoria, fundamentada legalmente en los artículos 110 del Reglamento a la Ley del Catastro Nacional y 66 del Reglamento del Registro Nacional, que no tiene la virtud de crear gravamen alguno sobre los terrenos pues la inscripción de ellos es atribución exclusiva del Registro Público y en cuanto a la señalada anotación, esta Sala comparte el criterio del recurrido cuando estima que la nota de advertencia no afecta derecho de propiedad alguno, porque éste nunca podría haber abarcado lo que es patrimonio inalienable del Estado. Se pretende con tal anotación advertir a terceros potenciales adquirentes de los terrenos a que se refiere el plano, a efecto de que tengan conocimiento de las limitaciones legales que afectan a esa propiedad… Así las cosas y siendo la inscripción del plano cuestionado un acto administrativo que se acusa de nulo, la nota de advertencia agregada por el Director de Catastro no limita el derecho de propiedad privada que legítimamente ejerce el recurrente en gran parte de los terrenos a que se refiere el señalado plano, por lo que se debe declarar sin lugar el recurso”.

Así las cosas, recapitulan, esa nota de advertencia no constituye una limitación al derecho de la propiedad, como la afirman los coactores. Ante la abundante prueba reseñada sobre la afectación del área marino costera, concluyen, es claro que la actuación del Registro, a requerimiento de la Procuraduría, es conforme a derecho. Cuarto: en cuanto a la imposición a su representado del pago de ambas costas, aseveran, las pretensiones indemnizatorias por daños y perjuicios y las referidas a la cancelación de la nota de advertencia fueron denegadas. Sobre el rechazo del reclamo indemnizatorio, argumentan, la parte actora no formuló recurso de apelación; lo limitó al aspecto de la nota de advertencia. Por ende, manifiestan, debe aplicarse lo previsto en las disposiciones 59.2; 98, inciso c); y 103 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa, en relación con el canon 222, párrafo primero, del Código Procesal Civil, que exime del pago cuando parte de las pretensiones han sido denegadas, lo que evidencia un vencimiento recíproco o motivos suficientes para litigar.

Se apoyan en las sentencias nos. 523-F-2005, 73-F-95 y 1070-F-04 de esta Sala. Asimismo en el voto no. 56-2008 del Tribunal Contencioso Administrativo, Sección Primera. Le censuran al Ad quem considerar que no hubo denegatoria de pretensiones de vencimiento recíproco, al parecer, porque el Estado no contrademandó. Pero eso no era posible por el inciso 7), del artículo 173, de la Ley General de la Administración Pública, tanto antes como después de su reforma, en virtud de la norma 200, inciso 6), del Código Procesal Contencioso-Administrativo. Por tanto, denuncian, hay inobservancia directa de este precepto por falta de aplicación. También del precepto 98, inciso 2), del Código Procesal Civil, que exige a los juzgadores asegurar a las partes igualdad de tratamiento, lo que no ocurrió. Sin ninguna justificación, aducen, la sentencia impugnada obvia que existen suficientes motivos para litigar, incurriendo en el vicio anexo de falta de motivación y, por consiguiente, quebranto del numeral 155, inciso 3), punto e), Ibidem., que obligan a la fundamentación de todos los aspectos debatidos sobre el tema de costas.

Quinto: como consideración final, opinan que el Estado, al contestar el hecho 58 de la demanda, señaló: “La inscripción de la finca [...] está viciada de nulidad absoluta, pues en forma ilegítima fue asentada sobre un bien público no comprendido por la finca madre. Esa ilegalidad será determinada en otro proceso. Para tal propósito recuérdese que la acción y el derecho del Estado son imprescriptibles”. Ello es así, justifican, porque el artículo 173, inciso 7), de la Ley General de la Administración Pública, antes y después de su reforma por el canon 200, inciso 6), del Código Procesal Contencioso-Administrativo, impide el ejercicio de la contrademanda en este asunto. Las sentencias de ambas instancias, en forma atinada, sostuvieron que el tema de la nulidad de la inscripción de la actora es cuestión de otro proceso, pues este litigio no se ha centrado en dilucidar el título de propiedad o su legitimidad.

Efectivamente, concluyen, ninguna pretensión del proceso ha sido entablada para que se reconozca o declare un derecho real sobre los terrenos objeto de la denuncia ambiental. Por eso, ruegan que al resolverse este recurso, se tome en cuenta que lo dispuesto: “…no prejuzga en modo alguno acerca de la bondad de los títulos”, como se reconoce en el fallo combatido.

III.En las sentencias de ambas instancias se pone de relieve la materia de este proceso, a los fines no solo de resolver el litigio, sino también de rechazar las argumentaciones de los representantes del demandado que se alejan de ese objeto. Es así como el Juzgado tuvo por demostrado, entre otros aspectos: “9.- Que el área de terreno afectada conforme los hechos denunciados por el inicio e incremento de la construcción de un relleno contiguo al Hotel L. y la construcción de un muro de concreto, se encuentra comprendida dentro del área de superficie de la finca inscrita ante el Registro Público, bajo el número de Matrícula de Folio Real [...] según inscripción efectuada el 21 de febrero del 2001, y de la cual es titular del dominio al (sic)señor A.”. “14.- Que el inmueble respecto del que se acusaron los hechos relacionados con el inicio e incremento de un relleno en sitio contiguo al Hotel L., así como la construcción de un muro en zona marítimo terrestre, se encuentra ubicado dentro de la zona que corresponde, a propósito de la aplicación de la Ley de Zona Marítimo Terrestre y conforme la información suministrada por el Instituto Geográfico Nacional a la categoría ‘ciudad’ y en la actualidad registralmente se encuentra constituida como parte del inmueble inscrito bajo el número de Matrícula de Folio Real [...], cuya naturaleza lo es privada, y del que aparece como titular el señor A.”.

También señaló ese despacho, que el Tribunal Ambiental Administrativo, en la resolución no. 851-01-TAA de las 15 horas 40 minutos del 20 de noviembre de 2001, lo que hizo fue emitir una “medida precautoria”, consistente en notificar a la Municipalidad de Golfito: “…que se prohíbe el otorgamiento de permisos de construcción en la zona de los 1382,56 m2. Así mismo, debe proceder a retirar cercas y otros que limiten el libre acceso al mar. Además, mantener la zona en las mejores condiciones y permitir el libre acceso” (hecho probado no. 11 del fallo de primera instancia). En ese mismo fallo, se consignaron como indemostrados dos aspectos de medular importancia para la solución de esta litis: “1.- Que con ocasión, ya sea en su caso del inicio e incremento de un relleno mediante la colocación de material, así como la construcción de un muro, o alcantarilla según sea su caso, se hallan realizado éstas en áreas que correspondan al demanio público, ya sea a la zona pública de la zona marítimo terrestre, o él área de playa, que discurre contiguo al Hotel L.… 2.- Que lo resuelto conforme la resolución del Tribunal Ambiental Administrativo de las 15:40 hrs. del 20 de noviembre del 2001 No. 851-01-TAA, en relación con la dictada por el mismo Tribunal de las 15:49 hrs. del 06 de diciembre del 2001, haya determinado la producción de un daño al ambiente generado como consecuencia de actuaciones reprochables a los investigados”.

A partir de allí, el A quo estructuró su decisión, destacando, en esencia, una serie de inconsistencias en las actuaciones y decisiones de Tribunal Ambiental Administrativo, quien con confusión y ambigüedad, no logró precisar, desde el inicio, la naturaleza del área donde se llevaron a cabo los actos atribuidos a los coactores, ni la legislación aplicable. Además, lo que hizo fue dictar una medida cautelar o precautoria, que no dirigió a ellos sino a la Municipalidad de Golfito, entidad que ni siquiera figuró en el procedimiento administrativo. No obstante, el A quo advirtió que ante el derecho de propiedad que uno de los coactores ha invocado a su favor, y así se ha probado, indirectamente esa medida le ha podido generar una afectación en su dominio privado, como pudiese ser la imposibilidad de obtener permisos de construcción. En este predicado, acogió parte de las pretensiones invocadas por los coaccionantes.

En todo caso, ese juzgador también tuvo por acreditado, que las obras objeto de denuncia se verificaron dentro de propiedad la privada y, en modo alguno se llegaron a realizar en el demanio público ni lo afectaron, base también de influencia decisiva para el acogimiento de la demanda. Aunado a ello, es de suyo relevante el razonamiento que hizo, atinente a que la investigación realizada por el Tribunal Ambiental Administrativo, se dirigió a aspectos relacionados, en exclusiva, a la naturaleza o régimen aplicable a los terrenos sobre los que se efectuaron los actos, lo cual “… per se, no implica la constatación de un daño al ambiente, salvo demostración o duda razonable al respecto al amparo del principio indubio pro natura…”. Esto, habida cuenta, advierte, “…que cuando se trata de daños al ambiente, es de total irrelevancia la titularidad de los bienes respecto de los que tal daño se arguye producido, siendo el daño en sí mismo, el susceptible de reproche frente al administrado o a la administración misma que lo produce”.

En este sentido, consideró que al lado de que, en última instancia, no se les impuso sanción alguna a los presuntos infractores, ni se determinó a ciencia cierta que el área correspondía al demanio público, de todas maneras, “… no fue demostrado o al menos acreditado ya sea en su caso, un daño al medio ambiente reprochable a los investigados, o la generación de un peligro susceptible de activar medidas en función de operar el principio de in dubio pro natura que también fue invocado, más no razonado”. Con todo, calificó de improcedente la medida cautelar o precautoria, lo que reafirma indicando que no se fundamentó, entre otros presupuestos, en la verificación de un peligro o riesgo a la integridad del ambiente. En síntesis, repara: “Apuntados los que al parecer del suscrito corresponden con vicios importantes que se denotan de forma grosera en los actos impugnados, lleva razón la representación de la parte actora, al afirmar que con la ‘medida precautoria dictada’, se afectó su derecho de propiedad de forma ilegítima, lo cual hace procedente la demanda como en efecto así será declarado en este fallo, al romper la premisa fáctica sobre la que el Tribunal Ambiental Administrativo erigió sus resoluciones…

De esta manera una prohibición en los términos dictados como medida precautoria o no, resulta ilegítima, y constituye de forma indirecta una afectación al dominio, y en tanto al derecho de propiedad sobre un inmueble en contravención con el artículo 45 constitucional”. Asimismo, enfatizó, el proceso no tiende al análisis de posibles nulidades del título de propiedad, ni al acto de inscripción que, en determinado momento, se acusó de ilegítimo. Tampoco es objeto del debate, mucho menos de pronunciamiento, si los bienes registrados a nombre del señor A. son demaniales o no. En conclusión, esta ha sido la base de la sentencia emitida por el Juzgado, la cual perfiló y delimitó, en el caso concreto, no solo los contornos a los que se imponía referir el recurso de apelación del Estado, sino también los agravios que se debieron invocar ante esta Sala, en orden a que el Tribunal avaló los hechos probados y no probados del A quo, y además confirmó su decisión de fondo.

IV.De lo indicado, resaltan los siguientes aspectos que, necesariamente, deben ser materia de impugnación concreta, para que pueda revisarse si procede o no revertir el criterio plasmado en la sentencia recurrida, confirmatoria de la de primera instancia: 1.- No se demostró que las obras se realizaron en el demanio público. 2.- Más bien se tuvo por acreditado que acaecieron en terrenos de dominio privado de uno de los coactores. 3.- La discusión sobre dónde se efectuaron y el régimen jurídico aplicable, en todo caso, deviene intrascendente si no se patentizó lesión o peligro de daño al ambiente. 4.- De igual manera ocurre con el debate sobre cuestiones de titularidad, derechos reales y supuestas nulidades de inscripciones, traspasos y planos, que no forman parte del objeto del proceso. 5.- El pronunciamiento del Tribunal Ambiental Administrativo no se dirigió directamente en contra de los investigados sino hacia la Municipalidad, quien fue parte del procedimiento. 6.- Además, la medida dispuesta no encontró justificación alguna de daño real o al menos peligro de perjuicio al ambiente. 7.- Sin embargo, se consideró que sí afectó a la parte actora y por ello se acogió la demanda en los términos que se especificaron en el dispositivo del fallo del A quo confirmado por el Ad quem. 8.- De cualquier manera, no se tuvo por cierto que las referidas obras afectaran o pusieran en riesgo al ambiente.

Entre los razonamientos del Tribunal, al avalar la sentencia de primera instancia, deben resaltarse las consideraciones emitidas en torno al recurso de apelación, en punto al deber del impugnante de formular cargos específicos sobre la decisión del A quo, sin lo cual el órgano de alzada estaría imposibilitado para modificar ese criterio. Hecha esa advertencia destacó: “… es exclusivamente desde esta óptica que se examinará el recurso de apelación formulado en ésta (sic) litis, omitiendo el análisis de las alegaciones referidas a cuestiones debatidas en primera instancia o bien de aquellas que constituyan una reiteración de argumentaciones, sin fundamentar las razones por las que considera la existencia de un yerro o la carencia de fundamentación fáctica o jurídica de la sentencia de instancia”. Con esta aclaración, se entiende que aquellos aspectos que expuso el A quo para justificar su pronunciamiento, los cuales el Tribunal no examinó por cuanto la apelación no dio margen para hacerlo, deben mantenerse incólumes.

Nótese, además, los representantes estatales no solicitaron que se adicionara la sentencia del Ad quem. Ello significa que no encontraron motivo alguno para estimar que dejó de resolver alguno de los agravios, o bien, renunciaron a denunciarlo, generando preclusión procesal en ese particular. En consecuencia, según lo dispuesto en el artículo 608 del Código Procesal Civil, la Sala no puede examinar los puntos básicos que consideró el A quo para razonar su sentencia, si el órgano de alzada no los abordó, en virtud de que la apelación lo impidió, como así lo destacó el Tribunal.

V.El Ad quem reafirmó el criterio del Juzgado al indicar que en los autos no quedó demostrada la existencia de una zona de playa o pública sobre el área del relleno. Dijo e insistió que no fue objeto del contradictorio ni de la litis. Incorporó un elemento más, que se relaciona con una certificación del Secretario del Concejo Municipal que, según acota, solo demuestra la falta de permiso para realizar labores de relleno o señalar responsabilidades del ejecutor de la acción. Pero carece de sentido, adujo, porque el señor A. reconoció como suyas esas acciones, como también se acreditó la práctica de varias personas e incluso instituciones públicas en rellenar el sitio para evitar la erosión producto del flujo y reflujo mareal en contra del borde de la costa. Por eso estimó que esa certificación “… no permite construir prueba contundente para el objeto propio del proceso”.

VI.En cuanto a la normativa tutelar de los bienes demaniales, sostuvo el Superior que no existe quebranto alguno, pues no se ha pretendido en la demanda discutir el régimen de propiedad que subsiste sobre la franja de tierra o relleno que el Estado alega del demanio público, lo cual es consecuente con el pronunciamiento del Juzgado. Incluso, cuando de su criterio se desprende que pierde relevancia ese asunto, porque tampoco se patentizó lesión o peligro de daño al medio ambiente. Aunado a estas consideraciones, el Ad quem estimó que la naturaleza jurídica de ese terreno no es pretensión dilucidable en esta litis, pues en punto al régimen de propiedad lo que la actora solicita que se ordene al Tribunal Ambiental Administrativo es respetar el dominio privado del señor A., excluir de responsabilidad a los codemandantes y que se eliminen las anotaciones en el plano y la advertencia administrativa impuesta en la “escritura” de L..

Sobre este particular agregó: “El punto del respeto al derecho de propiedad que para sí reclama la parte actora, se recalca que lo es estrictamente en el ámbito del Tribunal Ambiental Administrativo”. De cualquier manera, también consideró que no han sido objeto del proceso las cuestiones atinentes a posibles impugnaciones de negocios jurídicos. Insistió que el reconocimiento o declaración de un derecho real sobre los terrenos relacionados con la denuncia ambiental también escapa al eje temático en examen. Descalificó las argumentaciones del Estado sobre supuestas maniobras en la elaboración de planos y el trámite de inscripciones registrales, cuestiones sobre las cuales estimó “…no permiten dilucidar el objeto del proceso porque no guardan relación con éste…”. Avaló que no hubo sanción impuesta a los codemandantes, sino solo una medida cautelar a la Municipalidad, a lo cual agrega que cualquier discusión sobre el cumplimiento al debido proceso en sede administrativa no es propiamente un agravio, ni se puede retomar en este asunto, pues ni siquiera se refiere a algo que atañe a la sentencia apelada.

Fue contundente al establecer:”Tampoco ha sido demostrado, tal y como lo tuvo por no acreditado el A Quo, el daño ambiental producto de los hechos denunciados, de tal forma que, estéril resulta ahondar en un tema abandonado por la parte interesada en probar tal daño”. En lo demás, señaló que el demandado no formuló propiamente agravios, sino simples argumentos y opiniones. Finalmente, aclaró que no se ha prejuzgado “…en modo alguno acerca de la bondad de los títulos en los que ampara sus argumentos…”. Mantuvo la condenatoria en costas al perdidoso.

VII.De lo expuesto, está claro que la Sala no puede revertir el criterio conforme al cual se logró acreditar que los terrenos donde se hicieron las obras son de dominio privado. Además, que la sanción impuesta por el Tribunal Ambiental Administrativo no se justificó en el pretendido daño o peligro de lesión al ambiente. Asimismo, que la parte actora sufrió afectación en sus intereses, base para el acogimiento de la demanda. Incluso, esos aspectos no fueron materia de control del órgano de alzada, pues como dijo y justificó, la apelación presentó inconsistencias, no solo porque se centró en temas ajenos al objeto del debate, sino también por cuanto en mucho venía planteada mediante argumentaciones que no calificaron como agravios concretos contra la decisión del A quo. Esto es así, al punto que esas cuestiones ni siquiera se combatieron en el recurso de casación, pues aunque se emiten afirmaciones tendientes a desacreditar que la parte actora se vio afectada, el argumento se centra en la nota de advertencia administrativa impuesta a L., pero lo cierto fue que sobre ese extremo petitorio, aunque se denegó la defensa de caducidad, de todas maneras se rechazó en la sentencia de primera instancia y el Tribunal confirmó esa denegatoria.

VIII.En otro orden de ideas, es notorio cómo en el primer acápite del recurso, los casacionistas aluden a un daño ambiental por el relleno del demanio costero. A partir de estos aspectos, hacen gravitar una serie de reproches, que convergen en supuestos errores de apreciación probatoria. Ciertamente, el Ad quem rechazó la apelación del Estado, sobre la base de que: “…el criterio de impugnación del apelante, es puramente argumentativo ya que en los autos no quedó demostrada la existencia de una zona de playa sobre el área del relleno; simplemente no hay demostración técnica y fáctica que permita concluir que ahí hubo o hay una zona de playa, y que el relleno se asentó sobre un área de playa o de zona pública…”. Asimismo, al estimar que: “Tampoco ha sido demostrado, tal y como lo tuvo por no acreditado el A Quo, el daño ambiental producto de los hechos denunciados, de tal forma que, estéril resulta ahondar en un tema abandonado por la parte interesada en probar tal daño”.

Con fundamento en estas dos premisas, para el Tribunal, al igual que lo consideró el Juzgado, no se probó el supuesto daño ambiental, ni tampoco se tuvo por cierto que el relleno afectara el demanio costero o se asentara sobre una zona pública, aspecto que en todo caso cede frente al anterior. Es verdad, como lo afirman los recurrentes, que el Tribunal aceptó el dicho de la parte actora, cuando el señor A. reconoció haber realizado la obra para evitar la erosión producto del flujo y reflujo mareal. Sin embargo, de esas afirmaciones no se desprende que estuvo asentado y afectó zona demanial. La incorporación de esas manifestaciones las hizo esa Cámara para destacar cómo la certificación del Concejo Municipal de Golfito no es apta para acreditar esos aspectos, pues se limitó a dar cuenta de la ausencia de permiso para realizar las labores de relleno. De esta manera, el propósito de identificar a la persona quien las realizó devino innecesario, ante el reconocimiento hecho por su ejecutor.

Pero en modo alguno implica que haya aceptado la responsabilidad de haberlas hecho en zona pública, ni que se allanara a la denuncia de cometer un daño ambiental, pues contrariamente, siempre combatió esas imputaciones. En ello radica la referencia que se hace en la sentencia impugnada sobre esa temática, sin que pueda trascender a un reconocimiento “per se” de los temas en debate. No solo porque la parte actora siempre ha objetado las resoluciones del Tribunal Ambiental Administrativo, al punto de promover esta demanda para lograr que se decrete su nulidad. Sino también, porque los Juzgadores de ambas instancias así lo han declarado, rechazando la defensa de la representación estatal, lo mismo que las argumentaciones que conformaron la apelación, en el caso del Ad quem. Como bien lo señaló este órgano jurisdiccional, en los recursos no basta con reiterar las manifestaciones de defensa que se plantearon en los diversos estadios procesales, sobre todo, en la contestación a la demanda.

Precisaba la invocación de censuras específicas en contra de los razonamientos decisorios que se plasmaron en la resolución cuestionada, en punto según quedó expuesto, no solo a patentizar la naturaleza demanial del terreno donde se efectuaron las obras, sino sobre todo, la afectación real o potencial al ambiente. Incluso, nótese, las resoluciones del Tribunal Ambiental Administrativo no desprenden la existencia de daño o riesgo concreto, pues ni siquiera se le impusieron a las personas investigadas la medida cautelar que, como se dijo, solo fue dirigida a la Municipalidad. En este sentido, los recurrentes persisten, ante esta Sala, en emitir argumentos que no califican como verdaderos cargos contra el Tribunal. Máxime, cuando enlistan una gran cantidad de normas jurídicas que acusan vulneradas, sin explicitar una a una en qué radica ese quebranto. Todo ello impide variar ese pronunciamiento, pues su competencia se restringe a conocer de las inconformidades concretas que autorizarían su función contralora de legalidad.

Así sucede con las referencias al historial de planos catastrados, superficies descritas en ellos, contradicciones resultantes en las medidas y trámite de información posesoria, sin que logren plantearlas como objeciones contra aspectos concretos del fallo recurrido. De todas formas, esa discusión deviene superflua en tanto no se patentizó, contundentemente, lesión o peligro concreto de daño al medio ambiente.

IX.Respecto a los informes públicos del Nacional, lo mismo que los oficios del Catastro Nacional, para acreditar, a juicio de los casacionistas, que el relleno se hizo en la costa del mar o que afecta esta parte en la Bahía de Golfito, no es cierto que fueron ignorados por los juzgadores de ambas instancias, según denuncian, ni que por eso existe un error de derecho en su apreciación. Como ya se justificó, no se ha combatido con eficacia que las obras se hicieron en terrenos que forman parte de la propiedad privada del señor A., como tampoco que infligieron peligro o detrimento ambiental. Lo propio debe señalarse también, respecto a que el Tribunal Ambiental Administrativo corroboró “in situ”, en las inspecciones del 4 de febrero y 20 de julio, ambas de 1999, con participación de los coaccionantes; también de las fotografías del 18 de junio de 1999. Sobre el particular, es claro, precisaba de prueba técnica, científica, fehaciente, que estableciera la realidad del daño ambiental o el peligro concreto de causarse.

Esa omisión tampoco se suple con la certificación del Secretario del Concejo Municipal de Golfito, reiteradas por el Alcalde y el Inspector General del Municipio, a que aluden los casacionistas. Como bien lo indicó el Ad quem, solo es determinante de la falta de permiso para realizar obras de relleno. Lo mismo debe decirse de las declaraciones del coactor A., cuando los recurrentes indican que él explicó que la marea se metía en la parte donde estaba la alcantarilla y se iba introduciendo en la calle, de lo que por si mismo no se desprende perjuicio al entorno ambiental.

X.Sobre las vicisitudes que los recurrentes mencionan relativas a planos, inscripciones registrales, cabidas de inmuebles, segregaciones y traspasos, no es cierto que no se valoraran por las autoridades de primera y segunda instancia. Lo que ocurrió es que ambas coincidieron en que no forman parte del objeto del debate. Tampoco demuestran, fehacientemente, que los hechos denunciados no sucedieron en terrenos de dominio privado o que afectaron el ambiente, aspecto este último, se insiste, que no se logró acreditar con los datos emanados del Instituto Geográfico Nacional, del Catastro Nacional en sede administrativa, ni con el resultado del reconocimiento judicial. El testimonio del señor M. M., trascrito en interés de los casacionistas, solo da cuenta de una opinión personal que en modo alguno es contundente respecto al daño ambiental. Según la cita que ellos hacen de la referida declaración, es destacable cómo esa persona estima imaginarse que se está impidiendo a la marea funcionar normalmente, agregando que talvez existe irrespeto al mar y que cree que así lo observó en el lugar. Pero no es categórico en evidenciar un daño real o en explicar la existencia de un peligro concreto en detrimento del ambiente.

XI.Llama la atención la línea argumentativa de los recurrentes, en punto a los quebrantos de las disposiciones jurídicas que denuncian. Según, se adelantó, no explican, detalladamente, cómo se conculcaron cada una de ellas, lo que implica informalidad del recurso. Pero además, en síntesis, tratan de justificar esas infracciones para que se mantengan los pronunciamientos del Tribunal Ambiental Administrativo. No obstante, con ellos lo que se desprende es el dictado de medidas cautelares hacia la Municipalidad de Golfito y, en cuanto a los perjuicios que pudiesen ocasionar a parte actora, se reitera, no se ha emitido censura eficaz que permita revertir ese criterio. De todas formas, las resoluciones tampoco patentizan agravio ambiental, mucho menos atribuido a los denunciados, aquí coaccionantes, a quienes ni siquiera se dirigió la medida cautelar, aunque sí fue considerada perjudicial en ambas instancias sin que la impugnación tenga la virtud de establecer lo contrario.

XII.La temática del debido proceso y la sanción administrativa es tangencial respecto al objeto del debate. No es influyente que la Municipalidad de Golfito fuera o no parte en el procedimiento administrativo para el acogimiento de la demanda. Tampoco que L. o sus personeros hayan sufrido alguna indefensión. La falta de autorización del Municipio para el relleno, no atribuye, por sí mismo, la responsabilidad objetiva por daño ambiental, si es que este no fue acreditado. Tampoco se hace patente solo porque el Tribunal Ambiental Administrativo haya mencionado, en algún sentido, que sí existió. En sus resoluciones, cuestionadas en este proceso, no se especifica ni se dirige pronunciamiento alguno contra las personas a quienes se les imputó. Entonces, no es base suficiente para tener por cierta esa lesión.

XIII.El tercer reproche del recurso versa sobre el extremo de la demanda atinente a la eliminación de la nota de advertencia; pero como bien lo reconocen los casacionistas, esa petición fue rechazada por los órganos de ambas instancias, en cuyo caso las inconformidades que se plantean en ese apartado y el propósito de que se declare la caducidad en lo que a ello concierne, devienen inadmisibles. Se pide que se declare con lugar la defensa de falta de derecho y así sucedió en primera instancia; incluso, la parte actora apeló del rechazo de la respectiva pretensión, y el Tribunal confirmó el fallo también en ese punto. Por último, si los coactores afirmaron que esa nota de advertencia constituye una limitación al derecho de la propiedad, a nada condujo ese argumento, por la denegatoria del correspondiente extremo.

XIV.En el último apartado del recurso se emite una consideración final, para que se tome en cuenta que al contestarse la demanda se señaló: “La inscripción de la finca [...] está viciada de nulidad absoluta, pues en forma ilegítima fue asentada sobre un bien público no comprendido por la finca madre. Esa ilegalidad será determinada en otro proceso. Para tal propósito recuérdese que la acción y el derecho del Estado son imprescriptibles”. Justifican que el precepto 173, inciso 7), de la Ley General de la Administración Pública, antes y después de su reforma operada por el artículo 200, inciso 6), del Código Procesal Contencioso Administrativo, impide el ejercicio de la contrademanda en este asunto. Agregan que los fallos de ambas instancias, en forma atinada, sostuvieron que el tema de la nulidad de la inscripción de la parte actora es cuestión debatible en otro proceso, pues este litigio no se ha centrado en dilucidar el título de propiedad o su legitimidad.

Efectivamente, concluyen, ninguna pretensión del proceso ha sido entablada para que se reconozca o declare un derecho real sobre los terrenos objeto de la denuncia ambiental. Por eso, ruegan que al resolverse este recurso, se tome en cuenta que lo dispuesto: “…no prejuzga en modo alguno acerca de la bondad de los títulos”, como se reconoce en el fallo combatido. En realidad, es obvio que esas manifestaciones tampoco constituyen un agravio contra la resolución combatida, por lo que no cabe pronunciamiento alguno de esta Sala, aunque sí resulta ser evidente que del propio dicho de los casacionistas, se acepta que el proceso no ha versado en el reconocimiento o declaratoria de un derecho real sobre el lugar donde se realizaron los actos denunciados, como se ha dejado incólume.

XV.En cuanto a la condenatoria al Estado a pagar ambas costas del proceso, que ha sido objeto de reproche, la mayoría de esta Cámara estima que la imposición al vencido lo es por imperativo legal. De forma, no existe mérito para quebrar el fallo cuando el juzgador de instancia lo que ha hecho, al disponer ese pago a cargo del perdidoso, es tan sólo dar aplicación al artículo 221 del Código Procesal Civil. Al contrario, la exoneración constituye una facultad, que puede darse ante supuestos concretos que determina la Ley en el ordinal 222 Ibidem., lo mismo que en el numeral 98 de la Ley Reguladora de la Jurisdicción Contencioso Administrativa En este sentido, es cuando se hace un uso indebido de esa facultad, que podría, eventualmente, tener cabida el recurso de casación. La sentencia del Tribunal mantuvo el criterio del A quo de condenar a la parte perdidosa a ese pago, por ello, no existe base para la revisión casacional sobre ese pronunciamiento.

XVI.Por todo lo expuesto, se debe rechazar el recurso, con sus costas a cargo del Estado (artículo 611 del Código Procesal Civil).

POR TANTO

Se declara sin lugar el recurso. Son sus costas a cargo del Estado.

I.Los suscritos integrantes no comparten el criterio plasmado por la mayoría de esta Sala en el considerando XV del fallo anterior, en cuanto deniega el control casacional para aquellos casos en los que tan sólo se hace uso de la regla general de la condena al vencido en el pago de ambas costas, es decir, cuando no se actúa o aplica ninguna norma atinente a la exoneración de ellas. En efecto, el fundamento jurisprudencial de mayoría, parte de que la exoneración en el pago de las costas es una facultad, en la que no se produce yerro ni infracción normativa cuando no se ejercita o aplica; por ello, se dice, si no hay violación legal, no es posible en casación entrar a valorar o modificar lo resuelto sobre la condena al vencido, pues se repite, para la mayoría de esta Sala, sólo puede haber infracción jurídica cuando se actúa la norma correspondiente a la exoneración (entre muchas pueden verse las sentencias de esta Sala no. 1001- F-2002, de las 11 horas 50 minutos del 20 de diciembre del 2002; la 249-F-2003, de las 11 horas 45 minutos del 7 de mayo del 2003 y la 306-F-2006, de las 10 horas 20 minutos del 25 de mayo del 2006).

La concatenación parece en principio lógica, pues con esta premisa, si la exoneración constituye una facultad, el juzgador no está obligado a exonerar; y por ende, si no ordena o realiza tal exoneración, no viola las normas que corresponden al tema. Ergo, si no se da violación de normas, no puede haber revisión casacional (consúltense las resoluciones de esta Sala no. 765 de las 16 horas del 26 de septiembre del 2001 y 561-F-2003, de las 10 horas 30 minutos del 10 de septiembre del 2003). Esta relación de ideas, les permite concluir, que en ese supuesto específico (la simple condena o la inaplicación de las exoneraciones) “no puede ser objeto de examen en esta sede” (de este mismo órgano decisor, sentencia n° 419-F-03, de las 9 horas 20 minutos del 18 de julio del 2003), pues se trata de una hipótesis “no pasible de casación” (fallo n° 653-F-2003, de las 11 horas 20 minutos del 8 de octubre del 2003).

Así, en opinión de los distinguidos compañeros: no tiene cabida el recurso de casación cuando no se hace uso de la facultad exoneratoria (véanse a contrario sensu los considerandos III y VIII, por su orden de las resoluciones 541-F-2003, de las 11 horas 10 minutos del día 3 y 563-F-2003 de las 10 horas 50 minutos del día 10, ambas de septiembre del 2003). De esta forma se ha estimado por la mayoría que “… la condena en costas al vencido, como aquí sucedió no es revisable en esta Sede, habida cuenta de que el Tribunal se limitó a actuar la norma en los términos por ella dispuestos” (el destacado no es del original, véase el considerando X del voto no. 68-F-2005, de las 14 horas 30 minutos del 15 de diciembre del 2005). Y en materia notarial, con mayor contundencia, se ha señalado que: “…el Tribunal le impuso el pago de las costas de la pretensión resarcitoria a la denunciante, pronunciamiento que, se repite, no tiene casación”. (considerando X de la sentencia n° 928-F-2006, de las 9 horas 15 minutos del 24 de noviembre del 2006).

II.Sin embargo, en parecer de los suscritos, la indebida inaplicación de los preceptos que permiten la exoneración de costas, infringe, sin duda, el Ordenamiento Jurídico y, en concreto, las normas que la autorizan, ya sea por error o inadecuada apreciación de los jueces en el conflicto específico. En ese tanto, aunque se trate de una facultad, es lo cierto que no se encuentra inmune al control casacional, pues tanto en su ejercicio como en su inaplicación, puede operar una violación de ley, y en esa medida, la indebida omisión no es ni debe ser, sinónimo de arbitrariedad, en tal caso, cometida por el propio Juzgador. Máxime si se trata de un apoderamiento al juez otorgado con supuestos específicos que limitan su poder discrecional en esta materia. En consecuencia, en este particular aspecto, estimamos que con la sola aplicación de la regla general del artículo 221 del Código Procesal Civil (condenatoria al vencido al pago de ambas costas), no se cierran las puertas al recurso de casación, pues al contrario, el asunto es admisible para su examen de fondo (siempre y cuando se cumplan los requisitos de ley) ante un eventual vicio omisivo en la aplicación de las disposiciones legales que autorizan la exoneración de dichas costas (cánones 55 de la Ley de Jurisdicción Agraria y 193 del Código Procesal Contencioso Administrativo).

No obstante lo anterior, en el caso concreto de examen, estos integrantes comparten lo dispuesto en el fondo por el Tribunal, en cuanto se impuso al vencido el pago de ellas, circunstancia que nos lleva a rechazar el agravio, y con él, el recurso que en este sentido se formula.
