Preferential-track plenary proceeding (proceso de conocimiento de trámite preferente) brought before the Administrative Litigation Court, Sixth Section of the Second Judicial Circuit of San José, by the CONTRALORÍA GENERAL DE LA REPÚBLICA, represented by the associate managers of its Legal Advisory and Management Division, attorneys Rosa María Fallas Ibáñez and Luis Diego Ramírez González; against the INSTITUTO DE DESARROLLO AGRARIO, represented by its executive president, Carlos Alberto Bolaños Céspedes, and RONALD ELIZONDO SOLANO, a farmer and resident of San José. Also appearing are attorney Carmelina Vargas Hidalgo, divorced, as special litigation counsel (apoderada especial judicial) for the defendant Institute, and attorney Blanca Iris Navarro Miranda, single, as counsel for co-defendant Elizondo Solano. The natural persons are of legal age and, subject to the exceptions noted, married, attorneys, and residents of Heredia.

BACKGROUND

  1. 1Based on the facts it set forth and the legal provisions it cited, the plaintiff instituted a preferential-track plenary proceeding seeking a judgment declaring: “1) That the resolution of the Board of Directors of the Instituto de Desarrollo Agrario contained in Article 32 of session number 016-04, dated 3 de mayo del 2004, be annulled solely insofar as it concerns the issuance of title (titulación) to a property in favor of Mr. Ronald Elizondo Solano, described in cadastral survey plan (plano catastrado) number SJ-600333-1999.2) That public deed number 47, executed before Notaries Public Giovanni Varela Dijeres and Alba Iris Ortiz Recio at 8 hours on 24 de mayo del 2004, which formalized and recorded the title issued by the Instituto de Desarrollo Agrario, be annulled solely insofar as it concerns the issuance of title to a property in favor of Mr. Ronald Elizondo Solano.3) That the registration entry for the property recorded under the Real Property Folio (Folio Real) system as registration number 1-561877-000 (titled property), issued by the Registro Nacional, be annulled.4) That it be declared that the property recorded under Real Property Folio registration number 1-561877-000 (titled property) was unlawfully registered in favor of Mr. Ronald Elizondo Solano.5) That the property recorded under the Real Property Folio system as registration number 1-561877-000 (titled property) be declared State Natural Heritage (Patrimonio Natural del Estado) and transferred to the Ministerio del Ambiente y Energía, and that the Notaría del Estado be ordered to prepare the deed transferring that property to the State and to process its registration with the Registro Público, with the corresponding change in its legal classification.6) That the State be placed in possession of that property and that Mr. Ronald Elizondo Solano be evicted.7) That the defendants be ordered, with the amount to be determined subsequently (en abstracto), to pay the damages (daños y perjuicios) caused.” At a hearing held at 8 hours 22 minutes on 3 de agosto de 2009, the claims numbered 4), 5), and 6) in the complaint were amended and established as follows: “4) That the property recorded under Real Property Folio registration number 1-561877-000 was technically and legally registered improperly in favor of Mr. Ronald Elizondo Solano. 5) That the property described in cadastral survey plan number SJ-60033-1999 is State Natural Heritage and that, consequently, the authority competent to administer it is the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET); the Instituto de Desarrollo Agrario must take the appropriate actions to prepare the deed transferring it to the State and process its registration with the Registro Público, with the corresponding change in its legal classification. 6) That the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) be placed in possession of that property and that Mr. Ronald Elizondo Solano be evicted.”
  2. 2The co-defendants denied the claims. The Instituto de Desarrollo Agrario raised the preliminary defense (defensa previa) of lack of subject-matter jurisdiction (incompetencia en razón de la materia), which was rejected by oral judgment no. 766-2008 of the Administrative Litigation Court, Sixth Section, at 8 hours 30 minutes on 3 de octubre de 2008.
  3. 3The First Chamber of the Supreme Court of Justice, by decision no. 000028-C-S1-2009 at 10 hours 30 minutes on 15 de enero de 2009, with Justice Escoto Fernández dissenting, ruled: “By majority vote, jurisdiction over this proceeding is declared to lie with the Administrative Litigation Procedural Court.”
  4. 4The conciliation hearing was scheduled for 11 hours 30 minutes on 3 de octubre de 2008; however, no conciliation proceedings took place, and the hearing was therefore declared unsuccessful.
  5. 5At the preliminary hearing (audiencia preliminar) held at 8 hours 22 minutes on 3 de agosto de 2009, the parties’ representatives addressed the Court.

The corresponding writs (mandamientos) shall be issued to the Registro Público. The parties are advised that any matter established in this decision must be enforced before the Enforcement Judge of this Court, if necessary for the proper enforcement of this judgment.8) IDA is ordered to pay, with the amount to be determined subsequently, damages in favor of the State or Central Public Administration, represented in this case by the Contraloría General de la República. The existence and amount of those damages shall be determined during the judgment-enforcement phase (fase de ejecución de sentencia).9) The interim measures (medidas cautelares) ordered by this Court at the interim-measures hearing held at eight thirty-five a.m. on ocho de octubre del dos mil ocho, through oral decision number 700-2008, shall remain in effect until this judgment becomes final (firmeza).10) IDA is ordered to pay the procedural costs and attorneys’ fees (costas procesales y personales) of this proceeding. The complaint is also denied with respect to the following matters: 1) Mr. Ronald Elizondo Solano is released from liability for payment of damages; 2) Mr. Ronald Elizondo Solano is released from liability for payment of the procedural costs and attorneys’ fees of this proceeding.”

CONSIDERING

I.By Executive Decree no. 3667-G of 18 de marzo de 1974 (published in Supplement no. 64 of the Official Gazette La Gaceta, no. 72 of 17 de abril de 1974), the State transferred to the then Instituto de Tierras y Colonización (ITCO), now the Instituto de Desarrollo Agrario (hereinafter IDA), a tract of land measuring 267.239 hectares for the creation of the land-titling program known as “Parrita-Puriscal.” At session 055-02, held on 12 de agosto de 2002, article 2, the IDA Board of Directors approved the Regulations for Land Titling in National Reserves (Reglamento para la Titulación de Tierras en Reservas Nacionales; hereinafter, the Regulations), for the purpose of legalizing land tenure (tenencia) in areas occupied by persons who lacked title to the property. That same year, pursuant to those regulations, Mr. Ronald Elizondo Solano applied to IDA for title to parcel no. 92691, located within the “Parrita-Puriscal” program area and identified by cadastral survey plan SJ-600333-99, consisting of forested uplands and scrubland (terreno de montaña y tacotales).

The real property in question was transferred to Mr. Elizondo Solano and registered in his name with the Registro Público de la Propiedad Inmueble. Sometime later, by decision no. 02063-07 at 14 hours 40 minutes on 14 de febrero de 2007, the Constitutional Chamber declared the Regulations unconstitutional. The Contraloría General de la República filed suit against IDA and Mr. Elizondo Solano. It seeks the annulment of the following acts and contracts: the resolution of the IDA Board of Directors, article 32 of session 016-04 of 3 de mayo de 2004, solely insofar as it concerns the issuance of title in favor of Mr. Ronald Elizondo; public deed no. 47, executed before Notaries Public Giovanni Varela and Alba Iris Ortiz at 8 hours on 24 de mayo de 2004, in which that title was formalized; and the registration entry for property Real Property Folio registration number 1-561877-000. It further requests a declaration that the real property in question was unlawfully registered in favor of Ronald Elizondo Chaves; that it is State Natural Heritage and must therefore be transferred to the Ministerio de Ambiente y Energía (now MINAET); and that the Notaría del Estado be ordered to prepare the deed transferring the property to the State and to process its registration with the Registro Público, with the corresponding change in its legal classification.

It also requests that the State be placed in possession of the property; that Ronald Elizondo Solano be evicted; and that the co-defendants be ordered, with the amount to be determined subsequently, to pay the damages caused, as well as all costs and attorneys’ fees (ambas costas). The proceeding was designated for preferential processing (trámite preferencial). The defendants denied the claims. IDA raised an objection (excepción) based on lack of subject-matter jurisdiction, which was denied by interlocutory ruling (interlocutoriamente). The Court granted the complaint except as to damages, procedural costs, and attorneys’ fees, from payment of which it released Mr. Elizondo Solano. Dissatisfied with the decision, the co-defendants filed an appeal in cassation.

IDA’s Appeal in Cassation

II.The appellant disagrees with the Tribunal’s ruling that the land at issue in these proceedings forms part of the State’s natural heritage (patrimonio natural del Estado) because it is mostly covered by forest. He refers to the documents on which the appealed judgment was based. In his claim, he challenges both the assessment of the evidence and the application of legal rules. He notes that the Tribunal failed to assess the contents of certificate ACOPAC-OTC-065, dated 25 de noviembre de 2002, issued by M.Sc. Julio Bustamante, Coordinador Ordenamiento Territorial, Área de Conservación Pacífico Central, Sistema Nacional de Áreas de Conservación del MINAET, the contents of which he transcribes. In his view, the Tribunal disregards the significance of everything stated therein and merely relates Article 33 to Article 13, both of the Ley Forestal (no. 7575 de 5 de febrero de 1996 and its amendments), to conclude that, because the titled land is covered by forest, it forms part of the State’s natural heritage.

He adds that it omits analysis of other provisions contained in Article 13 of that Law, such as the requirement that forests and forestlands (terrenos forestales) within national reserves be declared inalienable areas, a condition not met by lands titled by the IDA. He further states that the parcel in question is not located within any area of the State’s natural heritage demarcated by the MINAET, much less within the category of public-domain property (dominio público), as the lower-court judges confusingly interpreted it. With regard to ruling 2063-2007 of the Sala Constitucional, which annulled the Reglamento, he asserts that it lists the property comprising the State’s natural heritage and analyzes public-domain property. Nevertheless, he maintains that the Tribunal failed to consider these matters and improperly interpreted the constitutional ruling. In his view, the Sala Constitucional held that its ruling had declaratory and retroactive effects as of the effective date of the regulations declared unconstitutional, such that property within the public domain that had been titled under the annulled Reglamento could be recovered.

He argues that the Tribunal omitted any analysis of public-domain property and merely stated that, because the land in question forms part of the State’s natural heritage, the titling in favor of Mr. Elizondo Solano lacked legal basis and the land therefore had to be recovered. As a result of this omission, he contends, the Tribunal erroneously concluded that, following the annulment of the Reglamento, the IDA was required to annul through administrative proceedings all titles arising from the titling projects, which he considers arbitrary and unconstitutional. In his view, the Sala Constitucional determined that all lands within the public domain that had been titled under the annulled Reglamento were recoverable; it did not at any time order the annulment of all titles issued. Therefore, he believes that if Mr. Elizondo Solano’s land does not qualify as public-domain property, his title could not be invalidated as ordered by the challenged judgment.

He criticizes the failure to analyze Articles 13, 14, 15, 16, 17, 18 and 33 of the Ley Forestal with respect to the true legal nature of the land at issue. He believes no consideration was given to the fact that the property has not been declared inalienable, is not subject to the public-domain category, and is not located within any area forming part of the State’s natural heritage, circumstances supporting the conclusion that the titled property does not possess that status. Furthermore, he states that the Tribunal found it proven that the parent property from which the parcel titled and registered in the name of co-defendant Elizondo Solano was subdivided (segregada) had been transferred free of charge to the ITCO, now the IDA. He maintains that this circumstance authorized the entity he represents to process the title requested by Mr. Elizondo Solano. However, he challenges the Tribunal’s annulment of that title based on an erroneous interpretation of Sala Constitucional ruling no. 2063 de 14 de febrero de 2007 and Decreto no. 34654-MGP de 13 de julio de 2008.

He further argues that the Tribunal treated the IDA’s failure to obtain a certificate of soil-use conformity (estudio de uso conforme de suelo), as required for processing Mr. Ronald Elizondo’s title, as evidence against it. He explains that, in this regard, the judgment failed to consider that the land titled by the IDA has remained in Mr. Elizondo Solano’s possession for more than 20 years and has formed part of the titling project since abril de 1974; it is therefore plainly unreasonable to expect that the land would have been used in accordance with techniques introduced by the Ley de Uso, Manejo y Conservación del Suelo, de 1998, and its Reglamento de 2001. He notes that the soil-use conformity certificate issued by agronomist Germán José Aguilar in julio de 2009 shows that the land measures a total of 35 hectáreas 82,59 metros cuadrados, of which 90,42% has been used in conformity with the soil and only 9,38%, approximately tres hectáreas, has not.

He maintains that this evidence clearly establishes that the land has suffered no damage and that, consequently, its original conditions and nature have been safeguarded and protected by Mr. Ronald Elizondo through rational use, circumstances the Tribunal did not consider in its analysis. As legal support, he cites Article 33 of the Ley Forestal and Articles 32 and 36 of the Ley Orgánica del Ambiente and explains their contents.

III.He argues that the Tribunal improperly assessed the evidence when it deemed the land depicted in cadastral plan SJ-600333-1999 to be part of the State’s natural heritage (patrimonio natural del Estado). He identifies six items of evidence on which, he says, that assertion was based and which, he contends, were incorrectly assessed. They are as follows: First, the certification issued by the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, contained in official letter ACOPAC-OTC-065, dated 25 de noviembre de 2002. He states that it indicates that the property lies outside protected wildlife areas (áreas silvestres protegidas), meaning that it is not located within any of the categories established in Article 32 of the Ley Orgánica del Ambiente, namely, forest reserve, protective zone, national park, biological reserve, national wildlife refuge, wetland, or natural monument.

The Tribunal did not take this circumstance into account, even though it had already been brought to its attention both at the hearing on the interim measure (medida cautelar) and at the preliminary hearing. The Tribunal also deemed it irrelevant that the property was not subject to section 33 of the Ley Forestal, a provision governing matters related to protection areas (áreas de protección) along the banks of rivers, streams, springs (nacientes), etc. Nevertheless, he objects, it linked that provision to section 13 of the same Law and concluded that the certification merely indicated that the land was not located within a protection area, which was irrelevant because, when those provisions are read together, the State’s natural heritage consists of properties covered by forests, regardless of whether they are located within or outside national reserves or protection areas. He asserts that this interpretation is erroneous.

He maintains that the certification is clear that the property described in plan SJ-600333-1999 is not subject to Article 33 of the Ley Forestal and does not form part of a protected wildlife area, yet the lower-court judges insisted on assigning it protected status even though it had not previously been so declared by executive decree or specific legislation. He notes that this certification was a prerequisite for the admissibility of the titling application submitted to the IDA; therefore, had it stated that the land was subject to the public domain (dominio público), title would not have been granted. Second, cadastral plan SJ-600333-1999. In assessing it, he states, the Tribunal confined itself to considering and emphasizing that the property contains forest and is “per se” part of the State’s natural heritage, disregarding the established fact that the property also contains pasture areas where livestock-grazing activities have been carried out without affecting the forested area.

He argues that, on the contrary, this area has been cared for and protected for more than ten years, both during the actual and effective possession (posesión real y efectiva) that he has exercised since acquiring the property and during the possession exercised by the previous possessors. The Tribunal likewise failed to assess this circumstance, despite its having been brought to its attention. Third, the sworn statements concerning possession of the property, attached to the application filed with the IDA. Those statements described the nature of the land as mountainous, a condition it had before the titling proceeding. He explains that although the parcel, which has a total area of 35 hectares 82,59 square meters, does indeed contain an area with forest cover (cobertura de bosque), it also contains grazing areas and other areas that, out of a conservationist spirit, have been left to regenerate naturally.

He clarifies that it was necessary and imperative to conduct the titling proceeding before the administrative entity because, given the registry encumbrance (afectación registral) over such an extensive area of land registered in the IDA’s name since 1974, it was materially and legally impossible at that time, in 2002, to initiate and bring possessory-information proceedings (proceso de información posesoria) before the competent Agrarian Court. Fourth, the judicial inspection conducted at 10 hours 30 minutes on 29 de setiembre de 2008. He asserts that this proceeding confirmed the extensive presence of forest cover and also noted matters such as difficult access, the absence of crops or agricultural activities, cattle in the pasture area, humid climatic conditions, barbed-wire fencing around the land, a zinc-roofed house in the pasture area, the existence of a stream, some burned trees, and the fact that no one lived on the land. All of this led the Tribunal to the following conclusions:

  • 1)the existence of forest and a stream makes the property part of the State’s natural heritage;
  • 2)no one lives on the land, which allowed it to determine that the property is not used as a means of subsistence;
  • 3)there are no crops or agricultural activities, other than eight head of cattle, and therefore the land is not used for agricultural or livestock-production purposes; and
  • 4)access to the property is difficult, which would make it impossible to market meat and agricultural products. He reiterates that the Tribunal categorically held that the property’s forest cover and stream were sufficient to classify it as part of the State’s natural heritage, disregarding in its assessment the property’s pasture area and the “silvopastoral” activity conducted there, which allows forest to coexist with livestock activity while precautionary protection measures are implemented. He contends that, by incorrectly assessing this evidence, the decision-making body resorted to subjective considerations that reveal a lack of knowledge of agrarian activity, which over the years has incorporated third-generation rights, including the pursuit of agroforestry activities and recognition of forest possession (posesión forestal), understood as possession exercised over forested land or land suitable for forestry. He notes that the property’s forested area has always been protected and conserved as an important resource and that the property is even properly fenced, as the Tribunal observed at the site. He criticizes another factor considered in reaching its conclusions: the fact that he has not resided on the property, based on which the Tribunal concluded that the property could not be regarded as a means of subsistence. He maintains that this further demonstrates the Tribunal’s lack of knowledge. First, except in the case of land intended for residential use, permanent residence on a property is not a “sine qua non” requirement for obtaining title to it. As to whether the property is a means of subsistence or the sole means of subsistence, he objects that this is not a factor capable of invalidating the titling proceeding, because that proceeding does not concern whether the possessor uses the land as a means of subsistence. If subsistence were used as the standard, this would present an entirely different situation, such as an unlawful-occupancy dispute (conflicto de ocupación en precario). He further notes that the Tribunal was again mistaken in stating that no crops or agricultural activities were found on the land and in its assessment of access to the property. He points out that livestock was found on the property, as the Tribunal confirmed, meaning that livestock-farming activity does exist. He argues that agricultural activity does not consist solely of planting perennial or short-cycle crops; cattle raising, whether for beef or dairy production, is an agrarian activity. As regards access to the land, he states that these are the normal conditions in rural communities, where dirt or gravel roads predominate; thus, this is likewise not a valid and objective criterion for discrediting a titling proceeding, nor is it a basis for seeking to dispossess him of land that he has possessed for more than ten years. Fifth, the technical evidence prepared by the Instituto Geográfico Nacional del Ministerio de Obras Públicas y Transportes, contained in official letter DEGEQ-047-09 of 30 de marzo de 2009 (folios 548 to 551 of the court record). He argues that this evidence should not have been considered because of the imprecision it reflects, which was acknowledged even by the entity that issued the report. Even so, he states, assuming that it concerns the same property, the report acknowledges that a large portion consists of pasture areas and that these have remained unchanged since 1997, the date of the first aerial photograph used for the study, thereby confirming the undeniable fact that he has continued to protect the forest resource. Sixth, the Land-Use Conformity Study (Estudio de Uso Conforme de Suelos) requested by the Contraloría General de la República from the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) in official letter DJ-0018-2009 and issued in official letter DST-217-2009 of 23 de julio de 2009. He explains that the lower-court judges assessed the following from that report: “a) It was never prepared during the titling process conducted by the IDA, even though it was mandatory for the institution; b) The report divides the property into Sector A: Pasture 3.36 hectares (9.58%), Brushland 5.23 hectares (14.91%), Forest 6.30 hectares (17.95%); Sector B: Forest 7.13 hectares (20.33%); Sector C: Pasture 2.90 hectares (8.27%); Sector D: Scrubland 10.16 hectares (28.96%); c) The report prepared by the INTA made it possible to reach the following conclusions: i) a high percentage of the hectares consists of forest; the brushland and scrubland zones are areas of natural regeneration that must be protected; therefore, the property in its entirety is part of the State’s natural heritage; H) the titled property is subject to Article 33 of Ley Forestal 7575 and lies within a forest protection area; ii) the pasture zone has low fertility and is therefore unsuitable for agricultural activities and also unsuitable for livestock activities. It thus determines that the property does not qualify for agrarian purposes; that the property titled by the IDA constitutes part of the State’s natural heritage, pursuant to Articles 13, 14, 15, 16, 17, 18 and 33 of Ley Forestal 7575, making it immune from attachment, not subject to acquisitive prescription, and inalienable because it is public-domain property; therefore, the Tribunal cannot accept the arguments that the right to obtain title derives from the possessory rights exercised by the undersigned and my family, since possession by private parties creates no rights over such land; and that because the property formed part of the State’s natural heritage and had a public-domain character (naturaleza demanial) before, during, and after the administrative proceeding before the IDA, the administrative acts are rendered absolutely null and void.” Regarding the foregoing, he states that when he submitted the documentation requested by the IDA for the titling proceeding, a land-use conformity study was not among the requirements. He therefore maintains that he fully complied with the requirement to submit all requested documentation, which did include a MINAE certification establishing that the property to be titled was not included within any conservation area administered by MINAE. He states that this was confirmed by the certification issued by the Sistema Nacional de Áreas de Conservación ACOPAC-QTC-065 of 25 de noviembre de 2002, which indicates that the property described in plan SJ-600333-1999 was located outside every Protected Wildlife Area. He again insists that the existence of forest in one part of the property does not, by that fact alone, make it part of the State’s natural heritage, since that requires a prior declaration subjecting it to the public domain.

He challenges the characterization of the property recorded under real-property folio registration 1-561877-000 as State Natural Heritage (patrimonio natural del Estado), public-domain property (bien de dominio público), in which the right of possession is ineffectual, and its consequent public-domain status (demanialidad). He explains that the property described in the indicated cadastral plan is not located within a Protected Wildlife Area (Área Silvestre Protegida), according to the classification contained in Article 32 of the Ley Orgánica del Ambiente; the restriction under Article 33 of the Ley Forestal concerns the protection of both sides of watercourses; there has been no prior declaration subjecting it to the public domain, through an Executive Decree and a Law of the Republic, and therefore it is not public-domain property. He elaborates that such properties are those created and designated by the Constitución Política or by a specific law, which is not the case here.

He refers to judgment no. 2063-07 of the Sala Constitucional and the analysis made in that decision regarding the public-domain status of property assigned to the public domain. According to the appellant in cassation (casacionista), that judgment establishes that property may be assigned to the public domain only when so provided by the Constitución Política or when it is expressly included by law; such inclusion must not be arbitrary, capricious, or the result of chance, and must necessarily be preceded by technical studies justifying it. He recalls that no such designation exists with respect to his property. He also refers to the procedure that he believes must be followed to incorporate property into the State Natural Heritage. He argues that the Court granted the claim without even evaluating the evidence in the record in accordance with the rules of reasoned evaluation (sana crítica).

He objects that, because the proceeding was declared a matter solely of law (proceso de puro derecho), the taking of the proposed testimonial evidence was ruled out. He states that his title was granted two years before the Regulations were annulled; that is, when he applied for it, the IDA had the standing and authority to grant it, even though the Court now considers that there was no legal basis for doing so because the Regulations had been declared unconstitutional. He insists that this declaration could not be deemed retroactive to the detriment of the thousands of property titles granted by the ITCO and the IDA throughout the national territory, including his own, since their actions were always preceded and informed by good faith. He alleges that Article 27 of the Ley de Uso, Manejo y Conservación de Suelos was erroneously interpreted. That article requires the IDA to obtain land-use capability studies (estudios de capacidad de uso de la tierra) before acquiring land for titling purposes; according to the Court’s interpretation, the provision makes no distinction based on whether the land acquired by the IDA is purchased with public funds or obtained through a simple conveyance.

In his view, this provision concerns the establishment of rural settlements (asentamientos campesinos), not titling programs involving large tracts of land. He also considers sections 58, 59, 60, 61, 62 and 63 of the Reglamento a la Ley de Uso, Manejo y Conservación de Suelos to have been violated by the requirement of a conforming-use study (estudio de uso conforme). This is because the administrative entity responsible for conducting those studies was created in November 2001, and it was not until 2006 that it was assigned the function of preparing those reports. He again refers to the contents of official letter DST-217-09 of 23 de julio de 2009 and states that its text does not say that the property is unsuitable for livestock farming. Rather, he believes, it provides recommendations on how to make better use of the grazing areas and improve forage quality. He therefore considers erroneous the Court’s statement that the title granted to him is void because a conforming-use study was not conducted before titling.

As legal support, he alleges an improper interpretation of Articles 13, 14, 15, 16, 17, 18 and 33 of the Ley Forestal, because not all land having forest cover (cobertura boscosa) forms part of the State Natural Heritage; the assignment of real property to the public domain arises from an express legal provision, and in this case no declaration to that effect has been made under the terms of Article 32 of the Ley Orgánica del Ambiente. He asserts that the Court disregards this and assumes powers it does not possess, since a declaration of public-domain status may be made only by MINAET, pursuant to Article 36 of the Ley Orgánica de Ambiente, after technical studies have been conducted to justify the public purpose, a provision the Court did not analyze in its judgment. He further asserts that it likewise omits section 37 of the Ley Orgánica del Ambiente, under which the incorporation of property into the public domain must necessarily be preceded by purchase or expropriation, with prior compensation, unless the owner voluntarily submits to the forestry regime (régimen forestal); that provision must necessarily be read in conjunction with section 2 of the Ley Forestal.

The latter authorizes the Executive Branch, through MINAET, to establish protected wildlife areas on privately owned land, regardless of their management category; such land may be included voluntarily, purchased, or expropriated, following scientific or technical studies that justify the public interest by law. He further adds that there is a “gap in the application of the legal rule,” because the Court did not even consider Article 22 et seq. of the Ley Forestal, which creates the Forest Conservation Certificate (Certificado para la Conservación del Bosque), through which owners and even possessors of land with forest cover are compensated for protecting the forest. As new evidence, he submits a certification from the Fondo Nacional de Financiamiento Forestal, number PSA-065-2009 of 17 de septiembre de 2009, stating the number of contracts, how many hectares they represent throughout the country, and the persons to whom the benefits of the Pago de Servicios Ambientales are granted.

He maintains that the State provides incentives to persons who own forested properties so that they will protect them, as was clearly demonstrated in his case by the study conducted by the INTA, according to which conforming use has been maintained on 90,42 percent of the property; in other words, the areas with forest cover have been cared for and protected. Regarding the application of section 33 of the Ley Forestal, he reiterates that although its purpose is to protect springs (nacientes), streams (quebradas), small watercourses (yurros), and any other channel through which water resources flow, its protection affects all classes of property, whether public or private, even those subject to the granting of concessions. Consequently, he maintains, it is not a basis for justifying the nullity of his property title. Regarding the alleged violation of Article 27 of the Ley de Uso, Manejo y Conservación de Suelos, he asserts that it results from an improper interpretation, because that article concerns land acquired by the IDA for titling purposes within rural settlements; thus, it is mandatory for that Institute to have land-use capability studies before acquiring a property with its own funds.

He argues that it is of paramount importance to the outcome of this case to note that the Ley Forestal introduces an amendment to Article 7 of the Ley de Informaciones Posesorias, under which the possessor of a protected wildlife area, regardless of its management category, may obtain title to it through adverse-possession title proceedings (proceso de información posesoria), upon demonstrating ten years of possession exercised for at least ten years before the wildlife area was declared. He further states that, in cases involving forested land where there has been no prior assignment to the public domain, title may be obtained by demonstrating ten years of possession and the protection of the natural resource. He therefore maintains that it is viable and legally permissible to obtain title to real property located within any category of protected wildlife area under the stated conditions.

It is likewise legally permissible to obtain title to land with forest cover that has not been incorporated into the public domain, upon demonstrating ten years of possession and protection of the forest. He declares that the failure to apply other provisions within the body of applicable law (bloque de legalidad) led the Court to issue a judgment contrary to the legal system, since it confined itself almost entirely to interpreting Articles 13, 14 and 15 of the Ley Forestal and Article 27 of the Ley de Uso, Manejo y Conservación de Suelos, which was precisely the only legal basis invoked by the plaintiff to seek the nullity of administrative acts, the nullity of public deeds, the transfer of his property to MINAET, and his eviction from the property in dispute.

IV.Although both appeals raise objections regarding the assessment of evidentiary elements, it is appropriate first to define the statutory concept of the State’s natural heritage (patrimonio natural del Estado), which is central to the claims, in the terms used by this Chamber in a case similar to the present one: “IV.- … Pursuant to section 13 of the Ley Forestal, ‘The State’s natural heritage shall consist of the forests (bosques) and forest lands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets....’ Thus, the provision establishes three categories of property comprising that heritage: a) forests and forest lands in national reserves; b) forests and forest lands in areas declared inalienable; and c) forests and forest lands on properties registered in its name and on properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets.

Accordingly, the position expressed by IDA—that the property at issue in these proceedings cannot be considered part of the State’s natural heritage because it is not located within a national reserve, protected wildlife area (área silvestre protegida), forest reserve, or biological reserve—stems from an improper interpretation of the cited section. In this regard, section 13 ibid. clearly establishes that a forest-covered property belonging to the State, a municipality, an autonomous institution, or another agency of the Public Administration forms part of the State’s natural heritage, without the Legislature requiring that the property fall within any of the aforementioned protection categories” (no.1070-F-S1-2010, de las 9 horas 45 minutos del 3 de setiembre de 2010). It is an established fact that the land at issue in these proceedings formed part of a property that first belonged to the State, which transferred it without registration to IDA, an entity that registered it in the Registro in its own name and subsequently subdivided a parcel, which it transferred to Mr.

Ronald Elizondo Solano; even before its registration, a substantial portion of it was covered by forest. Therefore, the criterion for determining whether the property formed part of the State’s natural heritage cannot be limited to whether a private individual holds registered title; rather, the property’s history must be investigated to ascertain whether it was under the ownership of the State or any of its institutions and whether it is covered by forest, both of which are answered affirmatively, as analyzed in the challenged judgment.

V.Both co-defendants assert that the ruling improperly assessed the evidence. Their claims seek to establish that the evidence in the case file (expediente) demonstrates that the property at issue in these proceedings lies outside any protected wildlife area, forest reserve, and/or biological reserve. However, the Tribunal’s essential basis for partially granting the action was that the property is covered by forest, a condition that existed before it was transferred to Mr. Elizondo Solano and that, among other reasons, led to the invalidation of the agreement of the Junta Directiva del IDA, article 32, adopted at session 16-04 de 3 de mayo de 2004. In other words, the allegations made by both IDA and Mr. Elizondo Solano are irrelevant for purposes of modifying the decision, because the grounds for appeal do not challenge the legal reasoning provided by the Tribunal. The judges below properly considered the decision of the Sala Constitucional because the judgment found that the agreement of the Junta Directiva del IDA, article 32, adopted at session 016-04 del 13 de mayo de 2003, was issued pursuant to regulations that the aforementioned Chamber declared unconstitutional.

This was one of the grounds weighed in the judgment when granting the action insofar as it sought a declaration invalidating the cited agreement, with the consequent invalidation of all subsequent acts and contracts that made it possible to transfer title to the property at issue in these proceedings to a private individual. Voto no. 2063, repeatedly cited, defined the scope of its effects in the following terms: “XV.-EFFECTS OF THE DECLARATION OF UNCONSTITUTIONALITY.- Pursuant to articles 90, first paragraph, and 91 of the Ley de la Jurisdicción Constitucional, the finding of unconstitutionality made in this judgment with respect to the Reglamento para la Titulación de Tierras en Reservas Nacionales, approved by the Junta Directiva del Instituto de Desarrollo Agrario, approved by the Junta Directiva del Instituto de Desarrollo Agrario under article 11 of session number 055-02, del doce de agosto del dos mil dos, and published in the Diario Oficial La Gaceta number 173, del diez de agosto del dos mil dos, shall have declaratory and retroactive effect as of the date on which these regulations entered into force, namely el doce de agosto del dos mil dos.

Consequently, property that was in the public domain (dominio público) and was titled pursuant to the regulations now invalidated must be recovered, without prejudice to any financial liability of the State arising from this unconstitutionality.” Thus, the appellants’ assertion lacks any factual or legal basis. The property at issue in this dispute, as part of the State’s natural heritage, unquestionably constitutes public-domain property, which the State is required to recover as ordered by the constitutional decision. Based on the foregoing, the alleged defects did not occur. In any event, this Chamber finds that the evidence was properly assessed in accordance with the rules of sound judgment (sana crítica). The Tribunal analyzed the evidence, and both the documentary evidence and the judicial inspection established that the property at issue in this dispute has extensive forest cover (cobertura boscosa); this was the determining factor in classifying the property as part of the State’s natural heritage, consistently with section 13 of the Ley Forestal.

Furthermore, although under Decreto Ejecutivo no. 3667-G, de 17 de abril de 1974, the State transferred the land in question to ITCO, now IDA, so that this autonomous institution could carry out the “Parrita-Puriscal” titling program, among others, that transfer of title was subject to certain conditions specified in the same decree. In this regard, section one clearly states: “The land located in the following cantons is hereby transferred free of charge to the Instituto de Tierras y Colonización, provided that it does not fall within the exceptions established by laws numbers 2825 de 14 de octubre de 1961 and its amendments; 4465 de 25 de noviembre de 1969; or consist of land in the public or private domain or land that, for other legal reasons, cannot be transferred: III Desamparados, IV Puriscal, V Tarrazú, VI Aserrí, XVI Turrubares, XVII Dota and León Cortés in the province of San José; canton VI Aguirre, IX Parrita, and district V Jacó of canton 1º in the province of Puntarenas…” (emphasis not in the original).

In this case, because the property was covered by forest and under State ownership, it formed part of the State’s natural heritage, which, under the literal terms of the aforementioned decree, precluded transfers to IDA and from IDA to private individuals. Similarly, section 14 of the Ley Forestal provides that the forest lands and forests constituting the State’s natural heritage “…shall be immune from attachment and inalienable; their possession by private individuals shall create no rights in their favor, and the State’s action for recovery (acción reivindicatoria) of such land shall not be subject to any limitation period. Consequently, they may not be registered in the Registro Público through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished as provided in this law.” Moreover, the appellants’ assertion that the Tribunal failed to consider that the land has been in the possession of private individuals does not constitute a claim that this Chamber may entertain, because the Ley Forestal is clear that such property is inalienable, that its possession by private individuals creates no rights in their favor, and that the State’s action for recovery is not subject to any limitation period. In view of the foregoing, the appeals on points of law (recursos de casación) must be denied.

VI.In view of the foregoing, the appeals on points of law must be denied, with costs assessed against the parties who filed them, pursuant to article 150 inciso 3) del Código Procesal Contencioso Administrativo.

González Camacho Carmenmaría Escoto Fernández Note by Magistrada Escoto Fernández The undersigned member concurs with the ruling issued and therefore joins it; however, she disagrees with the arguments set forth at the end of recital (considerando) IV regarding the assertion that “the fact that the Tribunal did not consider that the land has been in the possession of private parties does not constitute a claim cognizable by this Sala, because the Ley Forestal is clear in providing that such property is inalienable, that its possession by private parties shall create no rights in their favor, and that the State’s action for recovery is not subject to limitation.” This is because this judge takes the view that there may be cases in which private persons have possessed property covered by mountains or forests for many years and who, pursuant to the provisions of section 7 of the Ley de Informaciones Posesorias and the decision of the Sala Constitucional, with which she concurs, may indeed acquire forestland through adverse possession (usucapión), provided that the requirements established for that purpose by the legal system are met.

In the relevant part of that decision, the Sala held: “Currently, following the amendment enacted by Ley Forestal No.7575 of 13 de febrero de 1996, the operative text of the challenged provision reads: “Article 7.-When the real property to which the possessory-title proceeding (información posesoria) relates lies within a protected wild area (área silvestre protegida), regardless of its management category, the applicant for title must demonstrate that he or she holds the legal rights arising from ten-year possession, exercised for at least ten years before the effective date of the law or decree by which that wild area was created. Properties located outside those areas that contain forests may be titled only if the applicant demonstrates that he or she holds the legal rights arising from ten-year possession, exercised for at least ten years, and has protected that natural resource, on the understanding that the property must be properly demarcated and enclosed by fences or cleared boundary paths.

Without exception, the registered cadastral plans submitted in possessory-title proceedings must be certified by the Ministerio del Ambiente y Energía, through the competent entity, which shall certify whether the property for which title is sought lies inside or outside such protected wild areas.”. .. it follows that acquisition of ownership is a prerequisite for titling the real property. In other words, a distinction is drawn between the point at which ownership is acquired through adverse possession and the point at which that circumstance is asserted in a possessory-title proceeding in order to obtain a title eligible for registration in the Registro Público. Accordingly, adverse possession is regarded as a means of acquiring ownership and other possessable rights in rem (derechos reales poseíbles), while titling is the procedure through which, once the requirements for adverse possession have been established, a registrable ownership title is conferred.

Adverse possession is an original means of acquiring a possessable right in rem through the passage of time, subject to the statutory requirements. The acquisitive legal effect of adverse possession occurs automatically through the passage of time, together with qualifying possession that satisfies the conditions established for possession for purposes of adverse possession (posesión ad usucapionem) and the other requirements prescribed by law. In general terms, the Código Civil establishes the following requirements for acquisitive prescription (prescripción positiva): a title transferring ownership, good faith, and possession under specific conditions…In general terms, it has been accepted that possession may be acquired by original title or derivative title. The first case arises when title is based solely on the unilateral act of will of the acquirer. In the second case, both the acquirer and the preceding possessor participate, and the origin of the acquisitive event lies in the disposition made by that possessor.

Article 278 of the Código Civil provides that the right of possession becomes effective through occupation or delivery (tradición) of the right or thing concerned. Article 485 thereof, in turn, provides that ownership of movable property may be acquired through occupation. The typical form of possession by original title is occupation. Delivery, for its part, is the quintessential derivative means of acquiring possession and involves the preceding possessor. It is the handing over of the thing in order to transfer it to the person receiving possession. Its legal nature lies in the transfer of possession. In modern law, delivery means any transfer of possession carried out with the consent of the preceding possessor—any derivative means of acquiring possession. Delivery as a transfer of possession occurs when the acquirer obtains possession and the preceding possessor simultaneously loses it through an assignment made for consideration or gratuitously.

In this case, possession is obtained when the acquirer carries out the transferor’s intent by occupying the thing, subjecting it to the acquirer’s control, or complying with the acts and formalities prescribed by law. It should be recalled that these are the means of acquiring possession which, upon satisfaction of the statutory requirements, becomes possession for purposes of adverse possession… In that regard, the case-law development undertaken by the Sala Primera de la Corte Suprema de Justicia concerning forest ownership (propiedad forestal) may be summarized as follows: forest ownership is a distinct type of ownership with its own characteristics and particularities and a special legal regime; forest ownership is conceived fundamentally for conservation, not for production or participation in private commerce; forest legislation has passed through three stages, but it was not until the enactment of Ley No.7032 de 7 de abril de 1986 that a better-conceived instrument became available for addressing the complex forestry problem; Ley No.7032 de 7 de abril de 1986 was declared unconstitutional, and No.7171 de 28 de junio de 1990 was enacted again using the text of the former law; the protection of natural resources has made significant progress in recent times; international instruments concerning fundamental rights and developments in case law have brought about changes in domestic legislation aimed at protecting the right to a healthy and ecologically balanced environment; legislative changes have extended to the Constitution itself, and the right to the environment is now conceived as a true human right; development in this field has advanced to such an extent that a genuine legal classification has been formulated: ecological law (derecho ecológico); under the Ley Forestal, the State forest estate (patrimonio forestal del Estado) encompasses the entire national territory and is subdivided into three areas: the area subject to the forestry regime (régimen forestal), forestry operations (aprovechamientos forestales) on privately owned land, and national reserves (reservas nacionales); the forestry regime is defined as the body of legal, economic, and technical provisions that give substance to conservation; the forestry regime contains three subareas: a.- protective zones (zonas protectoras), b.- national parks, forest reserves, and biological reserves, and c.- forests and forestland; the term national reserves has been used since Ley de Tierras y Colonización No.2825 del 14 de octubre de 1961 to identify all lands referred to by the Código Fiscal de 1865, and subsequently by Ley No.13 de 19 de enero de 1939, as national public lands (baldíos nacionales); these are properties that are not privately owned—they are not registered in the Registro Público under the terms of Articles 267 and 486 of the Código Civil—and that are also not registered in the name of the State or its institutions; national public lands constitute the remainder left by the two preceding forms of ownership; following the principles of the Código Civil, Ley General de Baldíos Nacionales No.13 de 10 de enero de 1939 declared them to belong to the State within the boundaries of the Republic; Ley de Tierras y Colonización No.2825 de 14 de octubre de 1961 maintained the same approach and expanded the zones declared inalienable by the preceding law; in general, these reserves have been subject to limits—as to area—and to limitations on their possession and registration through possessory-title proceedings; all lands regarded as national reserves are immediately dedicated to the purposes of forestry legislation; on such lands, the State may create forest reserves, protective zones, national parks, wildlife refuges, and biological reserves, thereby forming the forest estate; legislative authorization is required in order to settle or convey them, and when they are possessed by third parties, those parties acquire no rights, while the State’s right of recovery is not subject to limitation; under the regulations currently in force, exploitation (aprovechamiento) in national reserves may be undertaken only pursuant to a concession granted by the State; exploitation of forest resources on privately owned land does not exclude such land from the State forest estate; the State forest estate applies to all national property on which natural forest resources exist; on lands where natural resources exist, private parties wishing to exploit timber resources must prepare technical forestry plans and obtain long-term concessions; the State grants a series of incentives for the management and regulation of privately owned forests and forestland; as regards national parks and biological reserves,…

(see decisions of the Sala Primera de la Corte Suprema de Justicia number 189 at 10:20 hours on 30 de octubre de 1991 and 51 at 15:15 hours on 26 de mayo de 1995). With respect to agricultural ownership (propiedad agraria), it should be noted that when the social function of ownership is recognized, the right of ownership is structured as a right-duty, involving a specific manner of exercising the powers of ownership and imposing obligations on the owner, such as the productive use of the land. Given that the factual premise of the challenged provision—Article 7, first paragraph, of the Ley de Informaciones Posesorias—could apply where agricultural possession (posesión agraria) had been exercised over the land for which title is sought before its dedication to the public domain (afectación al dominio público), it is necessary to identify the elements characterizing the doctrine of agricultural adverse possession (usucapión agraria), as was done above with the general regime governing ordinary civil adverse possession.

According to the case law, that doctrine is founded on a general principle of Agricultural Law: the economic and social function of agricultural ownership. That principle fundamentally comprises two aspects: a subjective aspect of an economic nature, consisting of the owner’s obligation to produce, improve, and respect the environment; and an objective or social aspect, entailing the State’s obligation to provide property to persons who are capable of producing but lack land. By virtue of the foregoing, agricultural labor constitutes the basis of agricultural adverse possession, as the instrument through which ownership of land is acquired. In agricultural adverse possession, possession assumes a central role as a mandatory element for acquiring the right of ownership. The doctrine of agricultural adverse possession in Costa Rica coincides structurally with general adverse possession under the Código Civil; however, its function differs because of the introduction of the principles described above.

The elements characterizing agricultural adverse possession include a special conception of the possessor’s intent (animus), which must be manifested through acts of agricultural possession (actos posesorios agrarios). This is reflected most strongly in the economic appropriation of the profits obtained through work performed on the property.

Anyone who works the land in that manner is presumed to do so as owner. Moreover, just title (justo título) consists of agricultural labor, and the fact that it need not be evidenced by a document allows acquisition to occur against a title registered in the name of a third party in the Public Registry… Likewise, the right to property is infringed because, without reasonable grounds, a more burdensome requirement—having personally exercised possession for ten years—is imposed on anyone seeking to acquire by adverse possession (usucapir) land that is subsequently declared a protected wildlife area (área silvestre protegida), thereby limiting access to that fundamental right.-. POR TANTO The action is partially granted and, consequently, the judicial interpretation of Article 7 of the Ley de Informaciones Posesorias No.139 of 14 de julio de 1941, the text of which corresponds to the amendment enacted by Ley Forestal No.7174 of 28 de junio de 1990, is declared unconstitutional insofar as it requires, in order to obtain title to land located within national parks, biological reserves, forest reserves, or protection zones, personal possession dating back ten years before the effective date of the law or decree establishing the protected wildlife area, and insofar as possession conveyed by prior possessors does not benefit the claimant in such cases.

This judgment is declaratory and has retroactive effect, without prejudice to rights acquired in good faith.” (Judgment of the Sala constitucional issued at 15 hours 45 minutes on 5 de agosto de 1997, constituting vote no. 4587-97, concerning an action of unconstitutionality (acción de inconstitucionalidad) against Article 7 of the Ley de Informaciones Posesorias No. 139 of 14 de julio de 1941, as amended; it should be noted that the emphasized text does not appear in the original). Since the previous century, particularly during the 1970s, this country has shown special concern for a sustainable development model and therefore resolved to undertake a broad and significant process of conserving the natural resources within its territory. To that end, a complex conservation system with multiple modalities has been established, under which both private and public property are guaranteed, as is protection for those who successfully demonstrate that they care for forests or mountains or engage in reforestation or silvicultural activities under sustainable management plans (planes de manejo sostenibles), provided that all other requirements are met, including, among others, the time period required in each case.

*080009031027CA* Res: 001088-F-S1-2011 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las ocho horas cincuenta y cinco minutos del ocho de agosto de dos mil once.

Proceso de conocimiento de trámite preferente establecido en el Tribunal Contencioso Administrativo, Sección Sexta del Segundo Circuito Judicial de San José por la CONTRALORÍA GENERAL DE LA REPÚBLICA, representado por sus gerentes asociados de la División de Asesoría y Gestión Jurídica, la licenciada Rosa María Fallas Ibáñez y el licenciado Luis Diego Ramírez González; contra el INSTITUTO DE DESARROLLO AGRARIO, representado por su presidente ejecutivo, Carlos Alberto Bolaños Céspedes y RONALD ELIZONDO SOLANO, agricultor, vecino de San José. Figuran además, como apoderada especial judicial del Instituto demandado, la licenciada Carmelina Vargas Hidalgo, divorciada y del codemandado Elizondo Solano, la licenciada Blanca Iris Navarro Miranda, soltera, abogada. Las personas físicas son mayores de edad y con las salvedades hechas, casados, abogados y vecinos de Heredia.

RESULTANDO

  1. 1Con base en los hechos que expuso y disposiciones legales que citó, la parte actora estableció proceso de conocimiento de trámite preferente, a fin de que en sentencia se declare: “1) Que se anule el acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, contenido en el Artículo 32 de la sesión número 016-04 – de fecha 3 de mayo del 2004, únicamente, en lo que se refiere a la titulación de una finca a favor del señor Ronald Elizondo Solano, descrita en el plano catastrado número SJ-600333-1999.2) Que se anule la escritura pública número 47, otorgada ante los Notarios Públicos Giovanni Varela Dijeres y Alba Iris Ortiz Recio, a las 8 horas del día 24 de mayo del 2004, que formalizó y protocolizó la titulación emitida por el Instituto de Desarrollo Agrario, únicamente, en lo que se refiere a la titulación de una finca a favor del señor Ronald Elizondo Solano.3) Que se anule el asiento registral de inscripción de la finca inscrita bajo el sistema de Folio Real matrícula número 1-561877-000 (finca titulada), emitido por el Registro Nacional.4) Que se declarare que la finca inscrita bajo el Folio Real matrícula número 1-561877-000 (finca titulada) fue inscrita ilegalmente a favor del señor Ronald Elizondo Solano.5) Que se declare la finca inscrita bajo el sistema de Folio Real matrícula número 1-561877-000 (finca titulada), Patrimonio Natural del Estado y su traslado al Ministerio del Ambiente y Energía, debiéndose ordenar a la Notaría del Estado confeccionar la escritura de traspaso de dicha finca a favor del Estado, así como tramitar su inscripción en el Registro Público con el respectivo cambio de naturaleza.6) Que se ponga en posesión de esa finca al Estado y se ordene el desalojo del señor Ronald Elizondo Solano.7) Que se condene a los demandados, en abstracto, al pago de los daños y perjuicios ocasionados.” En audiencia de las 8 horas 22 minutos del 3 de agosto de 2009, se ajustaron las pretensiones, numeradas en el escrito de demanda, como 4),5) y 6), fijándose éstas de la siguiente manera: “4) Que la finca inscrita a folio real matrícula número 1-561877-000 fue inscrita técnica y jurídicamente de forma indebida a favor del señor Ronald Elizondo Solano.5) Que la finca descrita en el plano catastrado número SJ-60033-1999 es Patrimonio Natural del Estado y por ende, el competente para ejercer su administración es el Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET), debiendo el Instituto de Desarrollo Agrario adoptar las acciones pertinentes para confeccionar la escritura de traspaso a favor del Estado, así como, tramitar su inscripción en el registro Público con el respectivo cambio en su naturaleza.6) Que se ponga en posesión de esa finca al Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) y se desaloje al Señor Ronald Elizondo Solano."
  2. 2Los codemandados contestaron negativamente. El Instituto de Desarrollo Agrario opuso la defensa previa de incompetencia en razón de la materia, la cual fue rechazada mediante sentencia oral no. 766-2008 del Tribunal Contencioso Administrativo, Sección Sexta de las 8 horas 30 minutos del 3 de octubre de 2008.
  3. 3La Sala Primera de la Corte Suprema de Justicia, mediante resolución no. 000028-C-S1-2009 de las 10 horas 30 minutos del 15 de enero de 2009, y con voto salvado de la Magistrada Escoto Fernández, resolvió: “Por mayoría, se declara que el conocimiento del presente proceso corresponde al Tribunal Procesal Contencioso Administrativo.”
  4. 4Para la audiencia de conciliación, se señalaron las 11 horas 30 minutos del 3 de octubre de 2008, no obstante, no hubo proceso conciliatorio por lo que se dio por fracasada la audiencia.
  5. 5En la audiencia preliminar de las 8 horas 22 minutos del 3 de agosto de 2009, hicieron uso de la palabra los representantes de las partes.
  6. 6El Tribunal Contencioso Administrativo, Sección Sexta, integrado por la Jueza Marianella Álvarez Molina, los Jueces Otto González Vilchez y Roberto Garita Navarro, en sentencia no. 1842-2009 de las 7 horas 30 minutos del 31 de agosto de 2009, dispuso: “Se declara con lugar la presente demanda, en los siguientes términos:1) Se ordena anular el acuerdo de la Junta Directiva del Instituto de Desarrollo Agrario, contenido en el Artículo 32 de la sesión número 016-04 , de fecha 3 de mayo del 2004, únicamente, en lo que se refiere a la titulación de una finca a favor del codemandado Ronald Elizondo Solano, descrita en el plano catastrado número SJ-600333-1999 .2) Se ordena anular la escritura pública número 47, otorgada ante los Notarios Públicos Giovanni Varela Dijeres y Alba Iris Ortiz Recio, a las 8 horas del día 24 de mayo del 2004, que formalizó y protocolizó la titulación emitida por el Instituto de Desarrollo Agrario, únicamente, en lo que se refiere a la titulación de una finca a favor del señor Ronald Elizondo Solano.3) Se ordena anular el asiento registral de inscripción de la finca inscrita bajo el sistema de Folio Real matrícula número 1-561877-000 (finca titulada), emitido por el Registro Nacional.4) Se declara que la finca inscrita a folio real matrícula número 1-561877-000 fue inscrita técnica y jurídicamente de forma indebida a favor del señor Ronald Elizondo Solano.5) Se declara el inmueble descrito en el plano catastrado número SJ-60033-1999 como Patrimonio Natural del Estado y por ende, el competente para ejercer su administración es el Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET).6) Se le ordena a la Procuraduría General de la República, por medio de la Notaría del Estado, confeccionar la nueva escritura de traspaso, del inmueble objeto de este proceso, con su respectivo cambio de naturaleza, y hacer las gestiones pertinentes para inscribir esa escritura en el Registro Público de la Propiedad Inmueble.7) Se ordena desalojar del inmueble objeto de este proceso al Señor Ronald Elizondo Solano y poner en posesión de esa finca al Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET). Expídanse, los mandamientos respectivos al Registro Público. Se le indica a las partes que cualquier aspecto establecido en esta resolución, deberá ser ejecutado ante el Juez Ejecutor de este Tribunal, si así fuere necesario, para la debida ejecución de esta sentencia.8) Se condena al IDA al pago en abstracto de los daños y perjuicios a favor del Estado o Administración Pública Central, representada en este caso por la Contraloría General de la República. Daños y perjuicios que se determinaran en su existencia y cuantía en la fase de ejecución de sentencia.9) Se ordena mantener las medidas cautelares dictadas por este Tribunal, en la audiencia de medida cautelar, efectuada a las ocho horas y treinta y cinco minutos del ocho de octubre del dos mil ocho, mediante resolución oral, número 700-2008, hasta la firmeza de esta sentencia.10) Se condena al IDA, al pago de las costas procesales y personales de este proceso. Asimismo, se declara sin lugar la demanda en los siguientes aspectos: 1) Se exonera del pago de los daños y perjuicios al señor Ronald Elizondo Solano; 2) Se exonera del pago de las costas procesales y personales de este proceso, al señor Ronald Elizondo Solano.”
  7. 7Los codemandados formulan sendos recursos de casación indicando las razones en que se apoyan para refutar la tesis del Tribunal.
  8. 8En los procedimientos ante esta Sala se han observado las prescripciones de ley.

CONSIDERANDO

I.Por Decreto Ejecutivo no. 3667-G del 18 de marzo de 1974 (publicado en el Alcance no. 64 del Diario Oficial La Gaceta, no. 72 del 17 de abril de 1974), el Estado traspasó al entonces Instituto de Tierras y Colonización (ITCO), hoy Instituto de Desarrollo Agrario (en adelante IDA), un terreno con un área de 267.239 hectáreas, para crear el programa de titulación denominado “Parrita-Puriscal”. La Junta Directiva del IDA, en sesión 055-02, celebrada el 12 de agosto de 2002, artículo 2, aprobó el Reglamento para la Titulación de Tierras en Reservas Nacionales (Reglamento en lo sucesivo), con la finalidad de legalizar la tenencia en áreas en donde existían personas poseyendo, pero sin de títulos de propiedad. Ese mismo año, el señor Ronald Elizondo Solano, solicitó al IDA, con base en la normativa dictada, título de propiedad de la parcela no. 92691, ubicada en el área del programa “Parrita-Puriscal”, cuyo plano catastrado es el SJ-600333-99, terreno de montaña y tacotales.

El inmueble referido, fue traspasado al señor Elizondo Solano e inscrito a su nombre en el Registro Público de la Propiedad Inmueble. Tiempo después, la Sala Constitucional, por resolución no. 02063-07, de las 14 horas 40 minutos del 14 de febrero de 2007, declaró la inconstitucionalidad del Reglamento. La Contraloría General de la República interpuso demanda contra el IDA y el señor Elizondo Solano. Solicita, se anulen los siguientes actos y contratos: el acuerdo de la Junta Directiva del IDA, artículo 32 de la sesión 016-04 del 3 de mayo de 2004, únicamente en lo que se refiere a la titulación a favor del señor Ronald Elizondo; la escritura pública no. 47 otorgada ante los Notarios Públicos Giovanni Varela y Alba Iris Ortiz, a las 8 horas del 24 de mayo de 2004, donde se formalizó esa titulación; el asiento registral de inscripción de la finca folio real matrícula 1-561877-000. Pide, además, se declare que el inmueble en cuestión fue inscrito ilegalmente a favor de Ronald Elizondo Chaves; es Patrimonio Natural del Estado y, por ende, debe ser traslado al Ministerio de Ambiente y Energía (hoy MINAET); se ordene a la Notaría del Estado confeccionar la escritura de traspaso de dicho bien a favor del Estado, así como tramitar su inscripción en el Registro Público con el respectivo cambio de naturaleza.

Solicita, también, se ponga en posesión de ese predio al Estado, se ordene el desalojo de Ronald Elizondo Solano; se condene a los codemandados, en abstracto, al pago de los daños y perjuicios ocasionados, así como a ambas costas. El proceso fue declarado de trámite preferencial. Los demandados contestaron en forma negativa. El IDA interpuso excepción de incompetencia en razón de la materia, la cual fue rechazada interlocutoriamente. El Tribunal declaró con lugar la demanda, excepto en relación a daños, perjuicios y costas, tanto procesales como personales, en que exoneró de su pago al señor Elizondo Solano. Inconformes con lo resuelto, los codemandados formulan recurso de casación.

Recurso de casación del IDA

II.El recurrente se muestra disconforme con lo resuelto por el Tribunal, al haber determinado que el terreno objeto de este proceso forma parte del patrimonio natural del Estado, por estar en su mayoría, cubierto de bosque. Se refiere a los documentos que sirvieron de base a la sentencia recurrida. En el reclamo, cuestiona la valoración de las pruebas realizada, así como la aplicación de normas jurídicas. El Tribunal, advierte, no valoró el contenido de la constancia ACOPAC-OTC-065, de 25 de noviembre de 2002, emitida por el M.Sc. Julio Bustamante, Coordinador Ordenamiento Territorial, del Área de Conservación Pacífico Central, Sistema Nacional de Áreas de Conservación del MINAET, cuyo contenido transcribe. En su criterio, el Tribunal le resta importancia a todo lo que en ella se dice y se limita a relacionar el artículo 33 con el 13, ambos de la Ley Forestal (no. 7575 de 5 de febrero de 1996 y sus reformas), para concluir que el terreno titulado, por estar cubierto de bosque, es patrimonio natural del Estado.

Omite, añade, el análisis de otros extremos que contiene el numeral 13 de la citada Ley, como es que los bosques y terrenos forestales de las reservas nacionales han de ser declaradas áreas inalienables, condición que no reúnen los terrenos titulados por el IDA. La parcela en cuestión, amplía, tampoco se encuentra en alguna área del patrimonio natural del Estado delimitada por el MINAET, mucho menos dentro de la categoría de dominio público, como confusamente interpretan los juzgadores de instancia. Con relación al voto 2063-2007 de la Sala Constitucional, mediante el cual se anuló el Reglamento, afirma, se enumeran allí los bienes que conforman el patrimonio natural del Estado, y se hace un análisis sobre los bienes de dominio público. No obstante lo anterior, asegura, el Tribunal no consideró estos aspectos y realizó una indebida interpretación del voto constitucional. La Sala Constitucional, opina, dispuso que lo resuelto tiene efectos declarativos y retroactivos a la fecha de vigencia de la normativa declarada inconstitucional, de manera que procede la recuperación de los bienes que siendo de dominio público hayan sido objeto de titulación al tenor del reglamento anulado.

El Tribunal omitió, arguye, el análisis sobre los bienes de dominio público y simplemente indica que al ser el terreno en cuestión patrimonio natural del Estado, la titulación a favor del señor Elizondo Solano carece de sustento legal, por lo que debe ser recuperado. Como consecuencia de esa desatención, discute, erróneamente concluyó el Tribunal que con la anulación del Reglamento, el IDA, vía administrativa, debía anular todos los títulos nacidos de los proyectos de titulación, lo cual considera arbitrario e inconstitucional. En su criterio, la Sala Constitucional determino que eran recuperables todos aquellos terrenos que siendo de dominio público hubiesen sido titulados al tenor del Reglamento anulado; en ningún momento ordenó que se anularan todos las titulaciones realizadas. De tal manera que, opina, si el terreno del señor Elizondo Solano, no reúne la condición de dominio público, su título no podía ser invalidado, según dispuso la sentencia impugnada.

Recrimina la falta de análisis del contenido de los artículos 13, 14, 15, 16, 17, 18 y 33 de la Ley Forestal, respecto de la verdadera naturaleza jurídica del terreno de marras. Estima, no se consideró, que el bien no ha sido declarado inalienable y que no se encuentra afecto a la categoría de dominio público, ni dentro de alguna área de patrimonio natural del Estado, aspectos que permiten concluir que el predio titulado no tiene esta última condición. Por otro lado, dice, el Tribunal tuvo por demostrado el traspaso de forma gratuita al ITCO, hoy IDA, de la finca madre de la cual se segregó la parcela titulada e inscrita a nombre del codemandado Elizondo Solano. Esa circunstancia, asegura, legitimaba a su representada para tramitar el título pedido por el señor Elizondo Solano. Sin embargo, combate, por una errónea interpretación del voto de la Sala Constitucional no. 2063 de 14 de febrero de 2007 y del Decreto no. 34654-MGP de 13 de julio de 2008, el Tribunal lo anuló.

Este también, aduce, valoró como prueba, el incumplimiento del IDA en la obtención del estudio de uso conforme de suelo, como requisito para la tramitación del título al señor Ronald Elizondo. El fallo, explica no consideró a ese respecto, que el terreno titulado por el IDA ha permanecido en posesión del señor Elizondo Solano por más de 20 años y ha formado parte del proyecto de titulación desde abril de 1974, por lo que a todas luces resulta caprichoso esperar que el terreno haya sido aprovechado siguiendo las técnicas que vino a implementar la Ley de Uso, Manejo y Conservación del Suelo, de 1998, y su Reglamento de 2001. El certificado de uso conforme de suelo expedido por el ingeniero agrónomo Germán José Aguilar, de julio de 2009, anota, revela que el terreno en su totalidad mide 35 hectáreas 82,59 metros cuadrados, de las cuales en un 90,42% se ha ejercido un uso conforme al suelo y en un escaso 9,38%, tres hectáreas aproximadamente, no se ha hecho.

Con dicha prueba, sostiene, queda claro que el terreno no ha sufrido daño alguno y, consecuentemente, sus condiciones y naturaleza originarias han sido resguardadas y protegidas por don Ronald Elizondo, con un uso racional, circunstancias que no han sido consideradas por el Tribunal en su análisis. Como respaldo normativo, cita los preceptos 33 de la Ley Forestal, 32 y 36 de la Ley Orgánica del Ambiente y explica su contenido.

III.El Tribunal, manifiesta, incurrió en una indebida apreciación de la prueba al considerar el terreno plasmado en el plano catastrado SJ-600333-1999, patrimonio natural del Estado. Son seis los elementos probatorios que dice sirvieron de base para tal aseveración, los cuales recrimina fueron erróneamente apreciados. Estos son: Primero, la constancia emitida por el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, contenida en el oficio ACOPAC-OTC-065, fechada 25 de noviembre de 2002. En ella se indica, dice, que la propiedad se encuentra fuera de áreas silvestres protegidas, sea, que no se halla dentro de alguna de las categorías establecidas en el artículo 32 de la Ley Orgánica del Ambiente, llámese reserva forestal, zona protectora, parque nacional, reserva biológica, refugios nacionales de vida silvestre, humedales, monumentos naturales, situación que no fue tomada en consideración por el Tribunal, a pesar de que ya se le había indicado tanto en la audiencia de la medida cautelar como en la audiencia preliminar tal circunstancia.

También estimó irrelevante, que la finca no estuviera afectada por el numeral 33 de la Ley Forestal, disposición que regula lo relacionado con las áreas de protección en las riberas de los ríos, quebradas, nacientes, etc. Sin embargo, reprocha, hizo una relación entre éste canon y el 13 de esa misma Ley, concluyendo que lo que esa constancia indicó, era que ese terreno no se encontraba ubicado en un área de protección, lo cual era irrelevante, pues de la relación de esos preceptos, se deriva, que el patrimonio natural del Estado, esta constituido por los inmuebles que se encuentren cubiertos de bosques, independientemente de que se ubiquen dentro o fuera de las reservas nacionales o áreas de protección. Esa exégesis, afirma, es errónea. La constancia referida, sostiene, es clara en que la finca descrita en el plano SJ-600333-1999 no está afectada por el artículo 33 de la Ley Forestal y no es parte de área silvestre protegida, pero los juzgadores de instancia insistieron en darle una categoría de protección, sin que de previo así hubiera sido declarado mediante decreto ejecutivo o ley específica.

Esa constancia, anota, era un requisito de admisibilidad de la solicitud de titulación por parte del IDA, por lo que de haber indicado que el terreno estaba con afectación a dominio público no se hubiera titulado. Segundo, el plano catastrado SJ-600333-1999. En su valoración, determina, el Tribunal se limitó a considerar y recalcar que la finca tiene bosque y “per se” es patrimonio natural del Estado, dejándose de lado el hecho cierto de que la finca también tiene áreas de potrero, en la que se ha realizado una actividad agraria de pastoreo de semovientes sin afectar el área de bosque. Esta área, arguye, más bien se ha cuidado y protegido durante más de diez años, tanto en la posesión real y efectiva que él ha realizado desde el momento mismo de la adquisición del inmueble, como la ejercida por los anteriores poseedores, situación que tampoco fue valorada por el Tribunal, a pesar de que se le señaló.

Tercero, las declaraciones juradas sobre la posesión del inmueble, adjuntas a la solicitud ante el IDA. En ellas, se indicó la naturaleza del terreno como de montaña, teniendo esa condición antes del procedimiento de titulación. El predio, expone, que mide en su totalidad 35 hectáreas 82,59 metros cuadrados, si bien efectivamente tiene un área con cobertura de bosque, tiene también superficies de repasto y otras en las cuales, por un espíritu proteccionista, se ha dejado para regeneración natural. El proceso de titulación, aclara, fue necesario e imperativo realizarlo ante el ente administrativo, en razón de que al existir una afectación registral de un área tan extensa de tierras inscritas a nombre del IDA desde 1974, era material y legalmente imposible en ese entonces, año 2002, promover e interponer un proceso de información posesoria ante el Juzgado Agrario competente. Cuarto, el reconocimiento judicial llevado a cabo a las 10 horas 30 minutos del 29 de setiembre de 2008.

En esta diligencia, asegura, se corroboró la amplia existencia de cobertura boscosa, apreciando además aspectos tales como difícil acceso, carencias de siembras o actividades agrícolas, ganado en el área de potrero, condiciones climáticas de humedad, cercas del terreno con alambre de púas, casa de zinc en el área de potrero, existencia de una quebrada, algunos árboles quemados, que no se vive en el terreno; todo lo cual llevó al Tribunal a las siguientes conclusiones:

  • 1)la existencia de bosque y una quebrada que lo convierte en patrimonio natural del Estado,
  • 2)no se vive en el terreno, lo que le permitió determinar que la finca no se tiene como medio de subsistencia y;
  • 3)no existen siembras o actividades agrícolas, salvo ocho cabezas de ganado, y, por ende, el terreno no es utilizado para fines de producción agropecuaria;
  • 4)el acceso a la propiedad es difícil, lo que imposibilitaría una comercialización de carne y productos agrícolas. El Tribunal, repite, considera en forma tajante que el hecho que la finca tenga una cobertura boscosa y una quebrada, es suficiente para tenerla como patrimonio natural del Estado, dejando de lado en sus apreciaciones, el área de potrero que tiene y la actividad “silvopastoril” que se realiza en ella, la cual permite la coexistencia de bosque en combinación con la actividad ganadera, ejerciendo las medidas precautorias de protección. Con la errónea apreciación de esta prueba, manifiesta, cae el órgano decisor en consideraciones subjetivas que muestran desconocimiento sobre la actividad agraria, que ha venido con el transcurso de los años incorporando los derechos de la tercera generación, que incluyen como parte de ella el ejercicio de actividades agroforestales, con el reconocimiento de una posesión forestal concebida como aquella que se realiza sobre terrenos con bosque o de aptitud forestal. En el área de bosque que tiene la finca, advierte, siempre se ha protegido y conservado ese importante recurso, teniendo incluso debidamente cercada la finca, lo que fue apreciado el por Tribunal en el sitio. Otro elemento que analiza para llegar a sus conclusiones, censura, radica en el hecho de que él no ha residido en la finca y, por esa razón consideran que el inmueble no podría afirmarse que sea un medio de subsistencia. Ello, sostiene, sigue demostrando la falta de conocimiento del Tribunal. Primero, en el hecho de que no es un requisito “sine qua non” para la titulación de un inmueble, exceptuándose el caso de un terreno para uso habitacional, que se tenga que residir en forma permanente dentro de éste. En cuanto al medio de subsistencia o único medio de subsistencia, reprocha, no es un elemento para desvirtuar el procedimiento de titulación, en razón de que este no versa sobre si el poseedor tiene el terreno como un medio o no de subsistencia, ya que de medirse la subsistencia como parámetro, se estaría ante una hipótesis totalmente diferente, como sería un conflicto de ocupación en precario. Ahora bien, apunta, sobre la afirmación de que en el terreno no se localizaron siembras o actividades agrícolas y, en el acceso a la propiedad, nuevamente se equivoca en su criterio. Existe y fue comprobado por el Tribunal, señala, que dentro de la finca se localizaron semovientes, es decir, que hay actividad pecuaria. La actividad agrícola, argumenta, no va encaminada únicamente a la siembra de cultivos perennes o cultivos de corto ciclo, la ganadería ya sea de engorde o lechera es actividad agraria. Con respecto a la accesibilidad al terreno, indica, son las condiciones normales de las comunidades rurales, en donde predominan caminos de tierra o lastre, por lo que tampoco es un criterio válido y objetivo para desacreditar un proceso de titulación y, tampoco lo es para pretender despojarlo de un terreno que ha poseído por más de diez años. Quinto, la prueba técnica elaborada por el Instituto Geográfico Nacional del Ministerio de Obras Públicas y Transportes, contenida en el oficio DEGEQ-047-09 del 30 de marzo de 2009 (folios 548 a 551 del expediente judicial). Esta prueba, denuncia, no debió considerarse por la imprecisión que refleja, la cual es reconocida incluso por la entidad que extendió el informe. Aún así, expresa, en el supuesto de que se trate de la misma finca, se reconoce en ella, que en un amplio sector existen áreas de pasto y, que no ha sufrido variación desde 1997, fecha de la primera fotografía aérea utilizada para el estudio, lo que afirmaría el hecho innegable de la protección de que ha venido realizando del recurso forestal. Sexta, el Estudio de Uso Conforme de Suelos solicitado por la Contraloría General de la República al Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), en el oficio DJ-0018-2009 y, que se emite en el oficio DST-217-2009 del 23 de julio de 2009. De este informe, expone, los juzgadores de instancia valoraron lo siguiente: “a) Nunca fue elaborado durante el trámite de titulación realizado por el IDA, siendo obligatorio para la institución; b) Que el informe sectoriza la finca en Sector A: Potrero 3.36 hectáreas (9.58%), Charral 5.23 hectáreas (14.91%), Bosque 6.30 hectáreas (17.95%); Sector B: Bosque 7.13 hectáreas (20.33%); Sector C: Potrero 2.90 hectáreas (8.27%); Sector D: Matorral 10.16 hectáreas (28.96%); c) Que el informe elaborado por el INTA le permitió llegar a las siguientes conclusiones: i) porcentaje elevado de hectáreas que son bosque, que las zonas de charral y matorral son áreas de regeneración natural, que deben ser protegidas, así la finca es patrimonio natural del Estado en su totalidad; H) que el inmueble titulado está afectado por el artículo 33 de la Ley Forestal 7575 y que esta comprendido dentro de un área de protección forestal; ii) que la zona de potrero tiene una fertilidad baja, así no es apta para el desarrollo de actividades agrícolas y tampoco es adecuada para actividades ganaderas. Así determina que el inmueble no califica para fines agrarios; que el inmueble titulado por el IDA constituye patrimonio natural del Estado, de conformidad con los artículo 13, 14, 15, 16, 17, 18 y 33 de la Ley Forestal 7575, lo que lo hace inembargable, imprescriptible e inalienable al ser un bien de dominio público, por lo que no es de recibo para el Tribunal las alegaciones en cuanto a que el derecho de titulación se deriva de los derechos de posesión ejercidos por el suscrito y mi familia, al ser terrenos en donde la posesión por particulares no causa derecho alguno; que al ser la propiedad patrimonio natural del Estado y tener una naturaleza demanial antes, durante y después del procedimiento administrativo ante el IDA, vicia de nulidad absoluta las conductas administrativas”. Sobre lo anterior, indica, al momento de presentar la documentación que solicitaba el IDA para el procedimiento de titulación, no se incluía como requisito un estudio de uso conforme. Así, sostiene, cumplió a cabalidad con la presentación de toda la documentación solicitada, dentro de la cual sí era necesario aportar una certificación del MINAE mediante la cual se dejara constancia que el inmueble a titular, no estuviera incluido dentro de alguna área de conservación administradas por el MINAE. Esto último, expresa, se pudo corroborar con la constancia que emite el Sistema Nacional de Áreas de Conservación ACOPAC-QTC-065 del 25 de noviembre de 2002, que indica que el inmueble descrito en el plano SJ-600333-1999, se encontraba fuera de cualquier Área Silvestre Protegida. De nuevo insiste, en que la existencia de bosque en un sector de la finca, no significa que por ese sólo hecho es patrimonio natural del Estado, pues para ello requiere de una declaratoria previa de afectación al dominio público. Combate, la apreciación de la finca folio real matrícula 1-561877-000, como patrimonio natural del Estado, bien de dominio público, en el que es nugatorio el derecho de posesión y, su consecuente demanialidad. La finca que se describe en el plano catastrado indicado, explica, no se encuentra dentro de Área Silvestre Protegida, según la clasificación que contiene el artículo 32 de la Ley Orgánica del Ambiente; la afectación del artículo 33 de la Ley Forestal está referida a la protección de ambos lados de las afluentes de agua; no existe declaratoria previa de afectación a dominio público, mediante Decreto Ejecutivo y Ley de la República, por lo que tampoco es un bien demanial. Estos, desarrolla, son aquellos creados y designados por la Constitución Política o mediante ley específica, lo que en la especie no sucede. Se refiere, al voto no. 2063-07 de la Sala Constitucional y el análisis que en dicha resolución se hace sobre la demanialidad de los bienes afectados a dominio público. Según el casacionista, de dicho voto se desprende, que un bien sólo podrá ser afectado al dominio publico, cuando así lo establezca la Constitución Política o cuando por norma expresa se le incluya, inclusión que no deberá ser arbitraria, ni caprichosa, ni consecuencia del azar y, necesariamente estar precedida de estudios técnicos que lo justifiquen. En el caso de su propiedad, recuerda, no existe tal afectación. Alude, también, al procedimiento que estima debe seguirse para incorporar un bien al patrimonio natural del Estado. El Tribunal, arguye, acogió la demanda, sin tan siquiera haber valorado, de acuerdo a la reglas de la sana crítica, la prueba que consta en el expediente. Reprocha, que por haberse declarado el proceso de puro derecho, se descartó la recepción de la prueba testimonial propuesta. Indica, que su título le fue otorgado dos años antes de que el Reglamento fuera anulado, es decir, que al momento de solicitarlo, el IDA tenía la legitimación y la competencia para concederlo, aunque ahora el Tribunal estime que no existía sustento normativo para ello, dada la declaratoria de inconstitucionalidad del Reglamento. Insiste, esa no podría considerarse con efectos retroactivos en perjuicio de los miles de títulos de propiedad otorgados por el ITCO y el IDA en todo el territorio nacional, incluido el suyo, puesto que sus actuaciones siempre estuvieron precedidas y permeadas de buena fe. Alega erróneamente interpretado el artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos, que establece la obligación para el IDA de contar con estudios de capacidad de uso de la tierra antes de adquirir terrenos para fines de titulación, norma que según la exégesis del Tribunal, no hace exclusión alguna entre si los terrenos que adquiere el IDA son con fondos públicos o por simple traspaso. Esta norma, opina, esta referida a la conformación de asentamientos campesinos, no para programas de titulación, que involucran grandes extensiones de tierra. Considera también infringidos, los numerales 58, 59, 60, 61, 62 y 63 del Reglamento a la Ley de Uso, Manejo y Conservación de Suelos, al exigirse el estudio de uso conforme. Esto por cuanto la entidad administrativa encargada de realizar esos estudios fue creada en noviembre de 2001 y no fue sino hasta el año 2006, que se le otorgó como función realizar esos informes. Se refiere de nuevo al contenido del oficio DST-217-09 del 23 de julio de 2009 e indica que en su texto no se dice que el inmueble no sea apto para el ejercicio de una actividad ganadera. Lo que da, estima, son recomendaciones de cómo aprovechar de una mejor manera las áreas de repasto y cómo mejorar la calidad del forraje. Así, considera un error la afirmación del Tribunal, de que el título que se le otorgó es nulo por no haberse realizado de previo a la titulación, un estudio de uso conforme. Como respaldo normativo, acusa indebida interpretación de los artículos 13, 14, 15, 16, 17, 18 y 33 de la Ley Forestal, pues no todo terreno que tenga cobertura boscosa es patrimonio natural del Estado; ya que la afectación al dominio público de un bien inmueble, nace por norma expresa y en este caso no ha habido declaratoria en ese sentido, en los términos del precepto 32 de la Ley Orgánica del Ambiente. Obvia el Tribunal y se otorga funciones que no le competen, afirma, ya que la declaratoria de dominio público únicamente la podrá realizar el MINAET, al tenor de lo dispuesto por el artículo 36 de la Ley Orgánica de Ambiente, previa realización de estudios técnicos que justifiquen el fin público, norma que no entró a analizar en su sentencia. Omite de igual forma, asevera, el canon 37 de la Ley Orgánica del Ambiente, según el cual la incorporación de un bien al dominio público estará necesariamente precedida de una compra o expropiación, previa indemnización, salvo que el propietario se someta en forma voluntaria al régimen forestal; norma que necesariamente se debe relacionar con la disposición 2 de la Ley Forestal. Esta, autoriza al Poder Ejecutivo, por intermedio del MINAET, para que en terrenos de dominio privado se puedan establecer áreas silvestres protegidas independientemente de su categoría, las que podrán ser incluidas voluntariamente, compradas o bien expropiadas, previos estudios científicos o técnicos que justifiquen el interés público mediante ley. Asimismo, agrega, se denota una “laguna en la aplicación de la norma jurídica”, ya que ni tan siquiera consideró el Tribunal, lo establecido por el artículo 22 y siguientes de la Ley Forestal, que crea el Certificado para la Conservación del Bosque, mediante el cual se retribuye a los propietarios e incluso a los poseedores de terrenos con cobertura boscosa, para que protejan el bosque. Como prueba nueva, aporta una certificación del Fondo Nacional de Financiamiento Forestal, número PSA-065-2009 del 17 de septiembre de 2009, en donde se indica el número de contratos y cuanto representan en hectáreas en todo el país, a quienes se les entregan los beneficios del Pago de Servicios Ambientales. El Estado, asegura, incentiva a aquellas personas que tienen fincas con bosque para que las protejan, como bien quedó demostrado en su caso, con el estudio realizado por el INTA, según el cual en un 90,42 por ciento de la finca se ha ejercido un uso conforme, es decir, se han cuidado y protegido las áreas con cobertura boscosa. En cuanto a la aplicación de la norma 33 de la Ley Forestal, reitera, si bien ésta tiene como finalidad la protección de las nacientes, quebradas, yurros y cualquier otro medio por donde discurra recurso hídrico; su resguardo afecta a toda clase de inmuebles, ya sean públicos y privados, sujetas incluso al otorgamiento de concesiones. En consecuencia, sostiene, no es argumento para justificar la nulidad de su título de propiedad. Sobre la supuesta violación al artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos, asevera, es producto de una indebida interpretación, ya que ésta se refiere a los terrenos que adquiera el IDA para fines de titulación, pero en asentamientos campesinos; así es imperativo para este Instituto disponer de estudios de capacidad de uso de suelos, antes de adquirir una finca con fondos propios. Es de suma importancia para las resultas de este caso, plantea, señalar que la Ley Forestal introduce una reforma al artículo 7 de la Ley de Informaciones Posesorias, según el cual el poseedor de un área silvestre protegida cualquiera que sea su categoría de manejo, podrá titularla mediante proceso de información posesoria, previa demostración de una posesión decenal ejercida por lo menos diez años antes de la declaratoria de la zona silvestre. Además, en aquellos casos de terrenos con bosque, menciona, en donde no haya de previo una afectación al dominio público, podrán ser tituladas demostrando una posesión decenal y, la protección del recurso natural. Por ello, sostiene, es viable y legalmente procedente titular bienes inmuebles insertos dentro de alguna de las categorías de áreas silvestres protegidas, bajo las condiciones indicadas. Y, es también legalmente asequible titular terrenos con cobertura de bosque no incorporados al dominio público, con la demostración de la posesión decenal y, la protección del bosque. La falta de aplicación de otras normas del bloque de legalidad, declara, llevó al Tribunal a emitir una sentencia contraria al ordenamiento jurídico, pues se limitó prácticamente a la interpretación de los artículos 13, 14 y 15 de la Ley Forestal y el 27 de la Ley de Uso, Manejo y Conservación de Suelos, que fue precisamente el único fundamento jurídico de la parte actora, para solicitar la nulidad de actos administrativos, nulidad de escrituras públicas, el traslado de su propiedad al MINAET y su desalojo del bien en litigio.

IV.Pese a que en ambos recursos existen objeciones respecto a la valoración de elementos probatorios, se considera oportuno proceder primero a delimitar el concepto normativo de patrimonio natural del Estado, eje central de los reclamos, en los términos en que esta Sala se ha referido en un caso similar al presente: “IV.- … Conforme al numeral 13 de la Ley Forestal “El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio...” De esta forma, son tres posibilidades las que brinda la norma, respecto a los bienes que integran dicho patrimonio: a) bosques y terrenos forestales de las reservas nacionales; b) bosques y terrenos forestales de las áreas declaradas inalienables, y c) bosques y terrenos forestales de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio.

De esta forma, el criterio externado por el IDA, respecto a que la finca objeto de este proceso no puede considerarse parte del patrimonio natural del Estado, ya que no se localiza dentro de una reserva nacional, un área silvestre protegida, una reserva forestal o biológica, surge de una indebida interpretación del ordinal citado. En este sentido, el mandato 13 ibídem es claro al determinar, que una propiedad cubierta de bosque, y que pertenezca al Estado, una municipalidad, institución autónoma u otro organismo de la Administración Pública, forma parte del patrimonio natural del Estado, sin requerir el Legislador, que la propiedad debiera formar parte de alguna de las categorías de protección indicadas” (no.1070-F-S1-2010, de las 9 horas 45 minutos del 3 de setiembre de 2010). Es un hecho demostrado, que el terreno objeto de este proceso formaba parte de un bien, que primero fue propiedad del Estado, quien lo trasladó sin inscribir al IDA, ente que lo inscribió en el Registro a su nombre, y posteriormente segregó un lote, el cual traspasó al señor Ronald Elizondo Solano, siendo que desde antes de su inscripción, estaba cubierto de bosque en buena parte.

Por lo tanto, el criterio para determinar si el inmueble formaba parte del patrimonio natural del Estado no se puede limitar a que un particular ostente la titularidad registral, sino que debe investigar los antecedentes de la finca, con el afán de precisar, si estuvo dentro del dominio del Estado o alguna de sus instituciones; y si está cubierta de bosque, aspectos que tienen respuesta afirmativa según se analiza en la sentencia cuestionada.

V.Ambos codemandados advierten que el pronunciamiento incurrió en una indebida valoración de la prueba. Sus reclamos tienen por finalidad acreditar, que las probanzas que constan en el expediente, dan fe de que la finca objeto de este proceso, está fuera de toda área silvestre protegida, reserva forestal y/o biológica. Pero, el criterio del Tribunal, para acoger la demanda parcialmente es, en lo esencial, que el inmueble está cubierto de bosque, situación que existía antes de ser traspasado al señor Elizondo Solano, lo que, entre otras razones motivó la nulidad del acuerdo de la Junta Directiva del IDA, artículo 32, tomado en la sesión 16-04 de 3 de mayo de 2004. Dicho de otro modo, lo alegado tanto por el IDA como por el señor Elizondo Solano, resulta irrelevante, a los efectos de modificar lo resuelto, ya que los agravios no combate la argumentación jurídica dada por el Tribunal. El voto de la Sala Constitucional fue apreciado de manera correcta por los juzgadores de instancia, ya que en el fallo se consideró, que el acuerdo de la Junta Directiva del IDA, artículo 32, tomado en la sesión 016-04 del 13 de mayo de 2003, fue dictado con fundamento en la normativa que la Sala aludida declaró inconstitucional, siendo este uno de los motivos ponderados en la sentencia, para acoger la demanda en lo relativo a declarar la nulidad del citado acuerdo, y con la consecuente nulidad de los restantes actos y contratos posteriores, que permitieron trasladar el dominio de la finca objeto de este proceso, a nombre de un particular.

El voto no. 2063, de reiterada cita, dimensionó sus efectos en los siguientes términos: “XV.-DE LOS EFECTOS DE LA INCONSTITUCIONALIDAD QUE SE DECLARA.- Al tenor de lo dispuesto en los artículos 90 párrafo primero y 91 de la Ley de la Jurisdicción Constitucional, la estimación de inconstitucionalidad que se hace en esta sentencia en relación con el Reglamento para la Titulación de Tierras en Reservas Nacionales, aprobado por la Junta Directiva del Instituto de Desarrollo Agrario, aprobado por la Junta Directiva del Instituto de Desarrollo Agrario por el artículo 11 de la sesión número 055-02, del doce de agosto del dos mil dos, y publicado en el Diario Oficial La Gaceta número 173, del diez de agosto del dos mil dos, tiene efectos declarativos y retroactivos a la fecha de vigencia de este cuerpo reglamentario, sea el doce de agosto del dos mil dos, lo anterior, de manera que procede la recuperación de los bienes que, siendo de dominio público, hayan sido objeto de titulación al tenor de la normativa que ahora se anula, lo anterior, sin perjuicio de la responsabilidad patrimonial del Estado que derive de esta inconstitucionalidad”.

De esta forma, la afirmación de los recurrentes carece de fundamento fáctico y jurídico. El bien objeto de esta litis, sin lugar a dudas, como parte del patrimonio natural del Estado, constituye un bien de dominio público, el cual el Estado está obligado a recuperar, según dispuso el voto constitucional. Con base en lo expuesto, los vicios denunciados no ocurrieron. En todo caso, esta Sala considera que la prueba fue valorada de forma correcta, conforme a las reglas de la sana crítica. El Tribunal analizó las probanzas, quedando acreditado tanto de la documental, como del reconocimiento judicial, que en la finca objeto de esta contienda, existe una amplia cobertura boscosa, y ese fue el elemento que determinó calificar el inmueble como patrimonio natural del Estado, lo cual es conforme a lo preceptuado en el numeral 13 de la Ley Forestal. A mayor abundamiento de razones, si bien conforme al Decreto Ejecutivo no. 3667-G, de 17 de abril de 1974, fue el Estado quien traspasó los terrenos aludidos a favor del ITCO, hoy IDA, con el fin de que esta institución autónoma procediera al programa de titulación “Parrita-Puriscal”, entre otros, dicha transferencia de dominio, estaba limitada por ciertas condiciones, que se puntualizaron en el mismo decreto.

En este sentido, el numeral primero es claro al indicar: “Traspásese en forma gratuita al Instituto de Tierras y Colonización en tanto no estén comprendidos dentro de las excepciones que indican las leyes números 2825 de 14 de octubre de 1961 y sus reformas; 4465 de 25 de noviembre de 1969; o se trate de terrenos de dominio público privado o que por otras causas legales no pueden ser traspasados los terrenos ubicados en los cantones: III Desamparados, IV Puriscal, V Tarrazú, VI Aserrí, XVI Turrubares, XVII Dota y León Cortés de la provincia de San José, cantón VI Aguirre, IX Parrita y el distrito V Jacó del cantón 1º de la provincia de Puntarenas…” (el destacado no corresponde al original). En este sentido, en la especie, al tratarse de un inmueble cubierto de bosque, y estar dentro del dominio del Estado, formaba parte del patrimonio natural del Estado, lo que, conforme al tenor literal del decreto aludido, impedía los traspasos al IDA, y de este a particulares.

En igual sentido, la Ley Forestal en el ordinal 14, determina que los terrenos forestales y bosques que constituyen el patrimonio natural de Estado, “…serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.” Por otro lado, lo indicado por los recurrentes respecto a que el Tribunal no consideró que el terreno ha estado en posesión de particulares, no resulta un reclamo atendible ante esta Sala, por ser la Ley Forestal clara, en el sentido de que se trata de bienes inalienables, cuya posesión por particulares no causará derecho alguno a su favor, siendo imprescriptible la acción reivindicatoria del Estado. Conforme a lo expuesto, los recursos de casación deberán ser declarados sin lugar.

VI.Conforme a lo costas a cargo de sus promoventes, conforme al artículo 150 inciso 3) del Código Procesal Contencioso Administrativo.

POR TANTO

Se declaran sin lugar los recursos de casación formulados, con sus costas a cargo de quienes los promovieron.

González Camacho Carmenmaría Escoto Fernández Nota de la Magistrada Escoto Fernández La suscrita Integrante comparte lo dispuesto en el voto dictado, por lo cual lo conforma; sin embargo, difiere de los argumentos esbozados al final del considerando identificado como IV respecto a que “el Tribunal no consideró que el terreno ha estado en posesión de particulares, no resulta un reclamo atendible ante esta Sala, por ser la Ley Forestal clara, en el sentido de que se trata de bienes inalienables, cuya posesión por particulares no causará derecho alguno a su favor, siendo imprescriptible la acción reivindicatoria del Estado.” Ello por cuanto la esta juzgadora es del criterio de que podrían darse eventualmente casos con muchos años de poseer bienes cubiertos de montaña o de bosques por personas privadas, quienes, acorde a lo dispuesto en el numeral 7 de la Ley de Informaciones Posesorias y resolución de la Sala Constitucional, la cual comparte bien pueden adquirir mediante usucapión terrenos de bosques en tanto se cumplan los requisitos que para ello el ordenamiento jurídico prevé.

Dicha Sala en tal resolución, en lo de interés dispuso: “Actualmente, por la reforma efectuada por la Ley Forestal No.7575 de 13 de febrero de 1996, el texto vigente de la disposición cuestionada dice: “Artículo 7.-Cuando el inmueble al que se refiere la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre. Las fincas ubicadas fuera de esas áreas y que tengan bosques, sólo podrán ser tituladas si el promovente demuestra ser el titular de los derechos legales de posesión decenal, ejercida por lo menos durante diez años y haber protegido ese recurso natural, en el entendido de que el inmueble tendrá que estar debidamente deslindado y con cercas o carriles limpios.

Sin excepción alguna, los planos catastrados que se aporten en diligencias de información posesoria, deberán ser certificados por el Ministerio del Ambiente y Energía, por medio del ente encargado, el cual dará fe de si el inmueble que se pretende titular se encuentra dentro o fuera de esas áreas silvestres protegidas.”. .. se desprende que la titulación del bien inmueble tiene como requisito la adquisición de la propiedad. O sea, que se distingue el momento de adquisición de la propiedad por usucapión del momento en que esa situación se hace valer en el procedimiento de información posesoria para obtener un título inscribible en el Registro Público. De ahí que se considere la usucapión como un modo de adquisición de la propiedad y de otros derechos reales poseíbles, y a la titulación como el procedimiento por medio del cual, comprobados los requisitos de la usucapión, se confiere el título de propiedad inscribible.

La usucapión es un modo originario de adquirir un derecho real poseíble por el transcurso del tiempo con los requisitos de ley. El efecto jurídico adquisitivo de la usucapión se produce de manera automática con el transcurso del tiempo unido a una posesión hábil que reúna las condiciones fijadas para la posesión ad usucapionem, y a los demás requisitos establecidos en la ley. En términos generales, el Código Civil establece como requisitos para la prescripción positiva: el título traslativo de dominio, la buena fe, y la posesión en condiciones específicas…En términos generales, se ha admitido que la posesión se adquiere a título originario y a título derivativo. El primer caso se presenta cuando el título se funda únicamente en el acto de voluntad unilateral del adquirente. En el segundo caso se produce una doble intervención del adquirente y del poseedor precedente, y el origen del fenómeno adquisitivo está en la disposición de ese poseedor.

El artículo 278 del Código Civil dispone que el derecho de posesión se hace efectivo por la ocupación o tradición del derecho o cosa de que se trata. Por su parte, el artículo 485 ibídem señala que por la ocupación puede adquirirse el dominio de las cosas muebles. La figura típica de la posesión a título originario es la ocupación. Por su parte, la tradición es la forma derivativa de adquisición de la posesión por excelencia, en ella interviene el anterior poseedor. Es la entrega de la cosa para trasladarla a quien recibe la posesión. Su naturaleza jurídica estriba en la transmisión de la posesión. En derecho moderno tradición es todo traspaso posesorio que se realiza con la voluntad del anterior poseedor -todo medio de adquisición derivativa de la posesión-. La tradición como traspaso posesorio ocurre cuando el adquirente obtiene la posesión y simultáneamente el poseedor precedente la pierde por la cesión hecha a título oneroso o gratuito.

En este caso, la posesión se obtiene cuando el adquirente cumple la voluntad del transmitente ocupando la cosa, sujetándola a su voluntad o cumpliendo los actos y las formalidades de ley. Debe recordarse que esos son los modos de adquirir la posesión que al cumplir los requisitos de ley se convierte en posesión ad usucapionem… En ese sentido, el desarrollo que en materia de propiedad forestal ha realizado la Sala Primera de la Corte Suprema de Justicia, se puede sintetizar como sigue: la propiedad forestal es un tipo diferente de propiedad con características y particularidades propias y un régimen especial; la propiedad forestal se concibe fundamentalmente para conservar, no para producir ni ser parte del comercio de los hombres; la normativa forestal presenta tres momentos, pero no es sino a partir de la promulgación de la Ley No.7032 de 7 de abril de 1986, que se contó con un instrumento mejor concebido para hacerle frente al complejo problema forestal; la Ley No.7032 de 7 de abril de 1986, fue declarada inconstitucional, y la No.7171 de 28 de junio de 1990, se promulgó nuevamente con el texto de la anterior; la tutela de los recursos naturales ha sufrido avances significativos en los últimos tiempos; los instrumentos internacionales de derechos fundamentales y el desarrollo jurisprudencial han provocado cambios en la legislación interna tendientes a proteger el derecho a un ambiente sano y ecológicamente equilibrado; los cambios en la legislación han alcanzado a la propia constitución y actualmente se concibe al derecho al ambiente como un verdadero derecho humano; el desarrollo en este tema ha sido tal que se ha podido formular una verdadera clasificación jurídica: el derecho ecológico; de acuerdo con la Ley Forestal el patrimonio forestal del Estado incluye todo el territorio nacional y se subdivide en tres áreas: la comprendida por el régimen forestal, los aprovechamientos forestales en terrenos de propiedad privada y las reservas nacionales; el régimen forestal se define como el conjunto de disposiciones jurídicas, económicas y técnicas que dan contenido a la conservación; el régimen forestal tiene tres subáreas: a.- zonas protectoras, b.- parques nacionales, reservas forestales y biológicas, y c.- bosques y terrenos forestales; el término reservas nacionales se utiliza a partir de la Ley de Tierras y Colonización No.2825 del 14 de octubre de 1961, para identificar todas aquellas tierras denominadas por el Código Fiscal de 1865, y luego por la Ley No.13 de 19 de enero de 1939, como baldíos nacionales; se trata de los inmuebles que no están sometidos a la propiedad privada -no están inscritos en el Registro Público en los términos de los artículos 267 y 486 del Código Civil- y aquellos que tampoco están inscritos a nombre del Estado o de sus instituciones; los baldíos nacionales resultan ser el remanente de las dos formas de propiedad anteriores; siguiendo los lineamientos del Código Civil, la Ley General de Baldíos Nacionales No.13 de 10 de enero de 1939, los declaró pertenecientes al Estado, dentro de los límites de la República; La Ley de Tierras y Colonización No.2825 de 14 de octubre de 1961, mantuvo la misma orientación y amplió las zonas declaradas por la ley anterior como inalienables; en general esas reservas han tenido límites -en cuanto a la superficie-, límites para poseerlas y para inscribirlas mediante el procedimiento de informaciones posesorias; todas las tierras consideradas como reservas nacionales quedan afectadas en forma inmediata a los fines de la normativa forestal; sobre ellas el Estado puede crear reservas forestales, zonas protectoras, parques nacionales, refugios de vida silvestre y reservas biológicas, conformando así el patrimonio forestal; para poder colonizarlas o enajenarlas se requiere autorización legislativa, y cuando son poseídas por terceros, éstos no adquieren ningún derecho, siendo imprescriptible el derecho del Estado para reivindicar; de acuerdo con la regulación vigente el aprovechamiento en reservas nacionales solo se puede practicar mediante concesión otorgada por el Estado; el aprovechamiento del recurso forestal en terrenos de propiedad privada no excluye estas tierras del patrimonio forestal del Estado; el patrimonio forestal del Estado es aplicable a todos los bienes nacionales donde existan recursos naturales forestales; en las tierras donde existan recursos naturales, para poder explotar los recursos maderables los privados deben elaborar planes técnicos forestales y obtener concesiones a largo plazo; el Estado otorga una serie de incentivos para el manejo y reglamentación de los bosques y terrenos forestales de dominio particular; en cuanto a los parques nacionales y reservas biológicas,…

(véanse sentencias de la Sala Primera de la Corte Suprema de Justicia número 189 de las 10:20 horas del 30 de octubre de 1991 y 51 de las 15:15 horas del 26 de mayo de 1995). En cuanto a la propiedad agraria debe indicarse que cuando se reconoce la función social de la propiedad, el derecho de propiedad se configura como un derecho-deber, en el que existe una forma específica de ejercer las facultades del dominio, y se imponen al titular obligaciones como la utilización productiva de la tierra. Dado que el supuesto de hecho de la norma impugnada -artículo 7 párrafo primero de la Ley de Informaciones Posesorias- podría aplicarse en la hipótesis en que sobre el terrero que se pretende titular, antes de su afectación al dominio público, se haya ejercido posesión agraria, resulta necesario señalar los elementos que caracterizan el instituto de la usucapión agraria, como se hizo arriba con el régimen general de la usucapión civil ordinaria.

De acuerdo con la jurisprudencia, el fundamento de ese instituto lo constituye un principio general de Derecho Agrario: la función económico social de la propiedad agraria. Ese principio se integra fundamentalmente con dos aspectos: uno subjetivo, de orden económico, que consiste en la obligación del propietario de producir, mejorar y respetar el ambiente, y otro objetivo o social, que entraña la obligación del Estado de dotar de propiedad a quien está en condiciones de producir pero carece de tierra. En virtud de lo anterior, el trabajo agrario constituye el fundamento de la usucapión agraria al ser el instrumento por medio del cual se adquiere la propiedad de la tierra. Para la usucapión agraria la posesión adquiere un valor central como elemento obligatorio para adquirir el derecho de propiedad. El instituto de la usucapión agraria en Costa Rica coincide con la usucapión general del Código Civil en su estructura, sin embargo, difiere de ella en su función por la introducción de los principios antes expuestos.

Dentro de los elementos que caracterizan la usucapión agraria se encuentra una concepción especial del animus del poseedor que debe proyectarse por medio del ejercicio de actos posesorios agrarios. Este se refleja con mayor intensidad en la apropiación económica de las ganancias obtenidas por el trabajo sobre el fundo. Se presume que el que trabaja la tierra de esa forma lo hace a título de dueño. Por otra parte, el justo título lo constituye el trabajo agrario, y su no exigencia como documento permite que la adquisición pueda darse contra un título inscrito a nombre de un tercero en el Registro Público… Asimismo, el derecho de propiedad se ve lesionado puesto que sin motivo razonable se impone un requisito más grave -haber ejercido personalmente la posesión durante los diez años- al que pretende usucapir un terreno que posteriormente es declarado área silvestre protegida, lo cual limita el acceso a ese derecho fundamental.-.

POR TANTO Se declara parcialmente con lugar la acción y, en consecuencia, que es inconstitucional la interpretación judicial del artículo 7 de la Ley de Informaciones Posesorias No.139 de 14 de julio de 1941, cuyo texto corresponde a la reforma producida por la Ley Forestal No.7174 del 28 de junio de 1990, de acuerdo con la cual para titular terrenos comprendidos en parques nacionales, reservas biológicas, reservas forestales o zonas protectoras, se requiere posesión personal con diez años de antelación a la fecha de vigencia de la ley o el decreto que crea el área silvestre protegida, y que no favorece en estos casos la posesión transmitida por anteriores poseedores. Esta sentencia es declarativa y sus efectos retroactivos, sin perjuicio de derechos adquiridos de buena fe“. (Sentencia de la Sala constitucional de las 15 horas 45 minutos del 5 de agosto de 1997 que es voto no. 4587-97 referente a una acción de inconstitucionalidad contra el artículo 7 de la Ley de Informaciones Posesorias No. 139 de 14 de julio de 1941 y sus reformas, debiéndose indicar que lo destacado no pertenece al original).

Este país desde el siglo anterior, en particular la década de los 70, ha mostrado especial preocupación por un modelo de desarrollo sostenible, de ahí que dispuso dar un amplio e importante proceso de conservación de los recursos naturales en su territorio. Para ello se ha configurado un sistema complejo y conservación con múltiples modalidades pero donde se garantiza tanto la propiedad privada como la pública y la tutela a quienes logran demostrar que cuidan los bosques, montañas o realizan actividades de reforestación o silviculturales con planes de manejos sostenibles, en el tanto y cuanto se cumplan con los demás requisitos como lo son entre otros el tiempo requerido según cada caso.
