In proceedings for an advance confession (confesión anticipada) and acknowledgment of a document (reconocimiento de documento) brought by QUEBRADORES DE UJARRAS SOCIEDAD ANÓNIMA against SERGIO MARTÍNEZ SOLANO, the Contraventional and Small Claims Court of Paraíso de Cartago sustained the objection for lack of subject-matter jurisdiction (excepción de incompetencia) raised by the respondent and referred the matter to the Contentious-Administrative and Civil Treasury Court. Disagreeing with the decision, the applicant’s representative appealed, and the matter was therefore submitted to this Chamber for review.

WHEREAS

I.The claimant filed a request for the taking of evidence (recepción de prueba) consisting of an advance confession and acknowledgment of a document. This was because it had been the target of a campaign of complaints filed with the Tribunal Ambiental Administrativo, which affected its image, operations, and business activities, damaging its commercial reputation and public confidence and having a very serious impact on the company’s finances and good name. It further stated that its commercial reputation had been tarnished and diminished by the effect of sending letters and requests to other public entities, such as SETENA, Dirección Nacional de Minas, and Municipalidad de Paraíso. It also stated that, according to an investigation conducted by the claimant, there was a high probability that the person giving the confession had participated in the aforementioned events; therefore, it had a significant interest in conducting this proceeding in order to prepare the corresponding legal action (folio 2).

II.The respondent raised the preliminary defense (defensa previa) of lack of subject-matter jurisdiction (folio 62). He asserted that the questions intended for him concerned the duties he performed within the Ministerio de Ambiente y Energía y Telecomunicaciones. Accordingly, because he held the status of a public official and because the State had an interest arising from potential liability, jurisdiction lay with the contentious-administrative courts (jurisdicción contencioso administrativa) (folio 62). The Contraventional and Small Claims Court of Paraíso de Cartago sustained the objection and referred the matter to the Contentious-Administrative and Civil Treasury Court. The claimant appealed (folio 74). It argued that the Contraventional Court stated that the facts concerning which the confession was sought occurred while the person giving the confession served as a public official at the Ministerio de Ambiente y Energía and therefore requested that the matter be heard by the contentious-administrative courts.

However, the purpose of the facts underlying the advance confession is to determine whether Mr. Martínez Solano’s actions were undertaken in his personal capacity or as a public official, which is precisely what he must confess. The appellant concluded by stating that the judge erred in declaring that his conduct necessarily binds the State, because his status as a public official had not been established. The Contraventional and Small Claims Court of Paraíso admitted the appeal and sent it to the Civil Court for Claims of Greater Amount of Cartago. That court, in turn, submitted it to this Chamber for review (reverse of folio 97).

III.Section 29 of the Código Procesal Civil establishes that, for this type of confession, jurisdiction lies with the judge of the domicile of the person giving the confession. In the case under consideration, the confession is requested as evidence taken in advance (prueba anticipada). According to the claimant’s statements appearing at folio 1, the domicile of the person giving the confession is in Paraíso, Provincia de Cartago. Pursuant to the aforementioned section 29 and section 33 of the Código Procesal Civil, which establishes that prorogation of jurisdiction (prórroga) is permissible only on territorial grounds and with respect to contentious civil proceedings, jurisdiction over the matter lies with the Contraventional and Small Claims Court of Paraíso, because the domicile of the person giving the confession is Paraíso de Cartago. From the request appearing at folios 1 through 3, it may be inferred that the purpose of the confession is to determine the following: “…According to the investigation, there is a high probability that the person giving the confession participated in the aforementioned events, since there are several documents purportedly signed by him, as well as evidence of various kinds that may ultimately connect him to the matters stated; therefore, conducting this proceeding is of the utmost importance for the purpose of preparing the corresponding legal action…”.

From the foregoing transcription, it cannot be inferred that the events occurred while he was serving as an official or that the confession is to be given in his capacity as a public official. The appellant likewise states this when noting that “this representation does not seek to disregard the fact that he is currently a public official, but rather that, at the time of the events, this has not been established…”. Therefore, because the outcome of the confession remains pending, there is, at this stage, no State interest sufficient for these proceedings to be heard in the contentious-administrative forum (sede contencioso administrativa).

IV.Consequently, it is declared that jurisdiction over these proceedings lies with the Contraventional and Small Claims Court of Paraíso de Cartago.

En proceso de confesión anticipada y reconocimiento de documento de QUEBRADORES DE UJARRAS SOCIEDAD ANÓNIMA contra SERGIO MARTÍNEZ SOLANO, el Juzgado Contravencional y de Menor Cuantía de Paraíso de Cartago, acogió la excepción de incompetencia planteada por el demandado y remitió el asunto al Juzgado Contencioso Administrativo y Civil de Hacienda. Inconforme con lo resuelto, el representante de la gestionante apeló, por lo que se envió en consulta ante esta Sala.

CONSIDERANDO

I.La parte actora presentó solicitud de recepción de prueba confesión anticipada y reconocimiento de documento. Toda vez que, ha sido objeto de una campaña de denuncias ante el Tribunal Ambiental Administrativo, las cuales afectaron la imagen, operatividad y giro comercial, generando una lesión a la buena imagen mercantil y la confianza del público, un impacto muy serio en las finanzas y el buen nombre de la empresa. Además indicó, que el buen nombre comercial ha sido manchado y desmejorado por el efecto del envió de notas y solicitudes ante otros entes públicos como Setena, Dirección Nacional de Minas y la Municipalidad de Paraíso. Manifestó también, de acuerdo con una investigación que se realizó la actora, existe un alto grado de probabilidad de que el confesante haya participado en los hechos antes mencionados, por ende, tiene sumo interés llevar a cabo esta diligencia, para preparar el proceso legal respectivo (folio 2).

II.La parte demandada opuso la defensa previa de falta de competencia por razón de la materia (folio 62). Consideró, las preguntas que se le quieren hacer son sobre las tareas que desarrolló dentro del Ministerio de Ambiente y Energía y Telecomunicaciones. Por lo anterior, al contar con la envestidura de funcionario público, y al existir un interés del Estado por una posible responsabilidad, la competente es la jurisdicción contencioso administrativa (folio 62). El Juzgado Contravencional y de Menor Cuantía de Paraíso de Cartago, acogió la excepción opuesta y remitió el asunto al Juzgado Contencioso Administrativo y Civil de Hacienda. La parte actora apeló (folio 74). Arguyó, el Juzgado Contravencional señala que los hechos a confesar se dan mientras el confesante ha fungido como funcionario público en el Ministerio de Ambiente y Energía, por lo que solicita que el asunto sea de conocimiento de la jurisdicción contencioso administrativa.

Sin embargo, los hechos que dan origen a la confesión anticipada, tienen como propósito determinar si las actuaciones del señor Martínez Solano se realizaron en su condición personal o bien como funcionario público, lo que precisamente deberá confesar. Concluye el apelante diciendo, se equivoca el juzgador al proclamar que su actuación vincula ineludiblemente al Estado, por no estar demostrada la condición de funcionario público. El Juzgado Contravencional y Menor Cuantía de Paraíso, admitió el recurso de apelación y lo envió al Juzgado Civil de Mayor Cuantía de Cartago. Éste a su vez, lo envió en consulta ante esta Sala (folio 97 vuelto).

III.El numeral 29 del Código Procesal Civil, establece que para este tipo de confesión es competente el juez del domicilio del confesante. En el caso bajo estudio, se pide la confesión como prueba anticipada. De las manifestaciones de la actora que corren a folio 1, el domicilio del confesante se encuentra en Paraíso de la Provincia de Cartago. De conformidad con los ordinales 29 citado y 33 del Código Procesal Civil, que establece que la prórroga solo es procedente por el territorio y respecto de los procesos civiles contenciosos, el competente para conocer del asunto es el Juzgado Contravencional y de Menor Cuantía de Paraíso, por ser el domicilio del confesante, Paraíso de Cartago. De la solicitud que corre de folios 1 al 3, se colige que el objeto de la confesión es que se determine lo siguiete; “…De acuerdo a lo investigado existe un grado alto de probabilidad que el confesante haya participado en los hechos antes mencionados, ya que consta varios escritos supuestamente firmados por su persona, asó como prueba de diversos tipos que eventualmente lo pueden relacionar con lo manifestado, por ende cobra sumo interés llevar a cabo esta diligencia, con la finalidad de preparar el proceso legal respectivo…”.

De lo trascrito, no se puede deducir que los hechos se dieran mientras fungiera como funcionario, o que la confesión sea en calidad de funcionario público, y así lo indica el apelante cuando señala que “esta representación no trata de obviar que sea funcionario público en este momento, sino que para el momento de los hechos no se demuestra…”, por lo que, al estar pendiente el resultado de la confesión, no existe, en este estadio, el interés estatal necesario para que las presentes diligencias sean conocidas en la sede contencioso administrativa.

IV.Consecuentemente, se declara que el conocimiento del presente proceso corresponde al Juzgado Contravencional y de Menor Cuantía de Paraíso de Cartago.

POR TANTO

Se declara que el conocimiento del presente proceso corresponde al Juzgado Contravencional y de Menor Cuantía de Paraíso de Cartago.
