Ordinary proceeding brought before the Contentious-Administrative and Civil Treasury Court by TATIANA MORALES LEIVA, tourism business administrator, against the INSTITUTO COSTARRICENSE DE ELECTRICIDAD, represented by its general judicial attorneys-in-fact, Geovanni Bonilla Goldoni and Adriana Jiménez Calderón. Also appearing as special judicial attorneys-in-fact for the plaintiff are Roberto Yglesias Mora and Henry Campos Vargas; and, on behalf of the defendant entity, Karla Méndez Bonilla, single, and Juan Pablo Hernández Cortés. CONSIDERING
I.Ms. Tatiana Mora Leiva brings suit against Instituto Costarricense de Electricidad (hereinafter ICE). She essentially requests that the judgment declare: 1.- She owns property no. 5-105466-000 in the real-property folio system. 2.- The property appears in the Registro Público as encumbered by a transferred easement for electric transmission towers in favor of land owned by ICE. 3.- The compulsory easement (servidumbre forzosa) was established in 1986. 4.- The defendant did not exercise it, either legally or effectively, within her property during the 10 years following its original establishment. 5.- Under the applicable rules governing the return of expropriated or compulsorily encumbered property, because the Instituto did not timely use the referenced easement, which was established pursuant to the Ley de Constitución, Expropiación y Adquisición de Servidumbres del ICE, no. 6316, her property must be released from that encumbrance; moreover, an order of cancellation must be issued to the Registro Público. 6.- In the alternative, in accordance with the legislation, legal principles, case law, and legal scholarship concerning the real property right of easement (derecho real de servidumbre), it should be declared that, due to the failure to exercise adequately and effectively the essential substance, powers, and rights of the owner of the dominant estate (fundo dominante), the easement lapses and is extinguished through nonuse and negative prescription (prescripción negativa); the property should therefore be released from that encumbrance, which must be canceled in the Registry. 7.- All acts, actions, and activities undertaken on the land by ICE to construct the easement infrastructure, occurring more than 10 years after its establishment in 1986, are untimely, inappropriate, inequitable, irrational, abusive, illegal, unlawful, disproportionate, unfounded, and vitiated by absolute nullity (nulidad absoluta). 8.- At its own expense, the defendant must restore the land to the condition it was in before the work and construction, for which it shall have one year from the date the judgment becomes final. 9.- It must also compensate her for damages and losses. 10.- It must also pay statutory interest on any amount due, from the date the ruling becomes final until actual payment.
In the event that the easement is not declared extinguished, she requests, in the alternative to items 5 and following of the principal complaint, that it be ordered: 1.- That, as owner of the servient estate (fundo sirviente) and successor mortis causa, she has been subrogated to all rights of the original owner and grantor of the easement in question, her grandmother, Ms. María Clementina Alvarado García, arising from the easement agreement entered into with ICE in 1986. 2.- From its inception, the referenced agreement was affected by serious substantive defects concerning the absence of essential elements in its subject matter, consent, and price, because other matters, such as services, forms of use, and property, which should have been compensated by the defendant, were excluded. Because those defects give rise to absolute nullity, the transaction must be rescinded insofar as it concerns her, the parties must be restored to their original positions, and the encumbrance must be canceled in the Registro Público. 3.- If the matter is not so resolved, she requests rescission of the agreement and a declaration that ICE engaged in abusive actions not authorized by law and committed serious breaches of its contractual obligations under the legislation in force, thereby creating excessive supervening onerousness (excesiva onerosidad sobreviviente), which has made the easement over her property more burdensome and harmful and justifies termination of the contract insofar as it concerns her property, with restoration to the original conditions existing before the easement and issuance of an order canceling the encumbrance. 4.- At its own expense, the defendant must restore the land to the condition it was in before the easement, within one year from the date the judgment becomes final. 5.- It must also compensate her for damages and losses. 6.- It must also pay statutory civil interest. 7.- It must also pay both categories of litigation costs.
If neither the principal complaint nor the alternative claim just described is granted, she requests, in the alternative to items 5 and following of the former: 1.- Because ICE did not exercise its easement right in a timely manner or within a reasonable period, its belated actions to enjoy that right and perform the required infrastructure work constitute an abusive, excessive, irrational, and disproportionate exercise of its contractual and statutory powers, a situation warranting expropriation or acquisition of the land upon payment of fair compensation (justiprecio) consistent with current values, which the defendant must undertake and complete within six months after the judgment becomes final. 2.- Given the nature, scope, risks, hazards, and electromagnetic effects of the high-voltage electric lines, as well as those effects from the ICE electric substation adjacent to her land, and given the easement’s final location and dimensions and the change in circumstances relative to the original contract, her ownership rights in her estate were seriously impaired; the defendant must therefore expropriate, acquire, or compensate her for the property and complete the process within six months after the ruling becomes final or, alternatively, must do so for the strip that the expert determines to be the area compensable for the adverse impact of the high-voltage lines, or for the 20-meter-wide easement at its actual value and throughout its entire length, deducting in all cases any amount previously paid.
The judgment shall rule on ICE’s obligation to pay the market value of the land occupied by the bases of the towers in question, declaring that payment of 35% of the value of that land did not correspond to the actual impact. If the requested relief is not granted, ICE shall be ordered to relocate the entire easement to the section of the property that causes the least damage and loss, as determined by an expert during proceedings to enforce the judgment. 3.- The easement as originally established did not include a right of way (derecho de paso) or any form of access in favor of ICE over other portions of the property, not even within the same 20-meter strip used for the line-and-tower easement; it shall therefore be declared that the defendant does not possess that power and that, to exercise it, it must expropriate, compensate for, or contractually acquire that right for fair compensation to be determined during enforcement proceedings; until then, it may enter the property and access the towers only with her express permission. 4.- The defendant shall pay statutory interest on any amount finally determined until the principal is actually paid. 5.- It shall also pay attorney’s fees and procedural costs. The defendant asserted the defenses of statute of limitations, lack of legal entitlement, and lack of standing; it also invoked the expression “sine actione agit”.
II.- The Court partially upheld the defense of lack of standing (falta de legitimación) and fully upheld the defenses of lack of legal entitlement (falta de derecho) and statute of limitations (prescripción). It rejected the generic expression “sine actione agit.” It dismissed the complaint with respect to the claims seeking nullity of the instrument establishing the easement (servidumbre) and the alleged damages (daños y perjuicios). As to all other matters, it declared the action inadmissible. It ordered the plaintiff to pay all costs (ambas costas). The Tribunal partially reversed. It rejected the defenses of lack of standing and statute of limitations. It partially upheld the defense of lack of legal entitlement and, to the same extent, granted the complaint. It ordered ICE to pay the plaintiff the actual current value of the easement established on the property for the passage of electric power transmission lines, the amount of which shall be determined by an expert during enforcement of the judgment (ejecución de sentencia), with the defendant bearing the expert’s fees.
It also ordered payment of damages as follows: A.- Material and environmental damage caused to the property by the felling of trees, in an amount not exceeding the ¢1.000.000,00 set by the plaintiff as the maximum for that claim. B.- Environmental damage arising from impairment of the landscape or visual pollution affecting its scenic value as a result of the works performed by ICE on that property, likewise not exceeding ¢1.000.000,00 for the same reason stated above. The amount of such harm shall be determined by an expert during enforcement of the judgment, and the defendant shall bear the corresponding expenses. As consequential damages (perjuicios), it awarded statutory interest on the sums granted, accruing from the date the judgment becomes final until actual payment. It ordered that ¢89.300,00 be issued to ICE, pursuant to deposit no. 0786122 G, dated 29 de marzo de 1999, made to the order of the Juzgado Contencioso Administrativo, corresponding to reimbursement of the amounts acknowledged by the defendant as compensation for establishing the easement and installing the three poles for the power lines on the plaintiff’s property. It likewise ordered payment of all costs of the proceedings.
III.- Both parties appealed to this Chamber, which, by order no. 752-A-S1-2010, issued at 14 hours 10 minutes on 17 de junio de 2010, summarily rejected the procedural grounds of the plaintiff’s challenge and the appeal filed by the defendant. On substantive grounds, the plaintiff challenges what she considers to have been the rejection of several heads of compensation, specifically compensation for the loss of the beneficial use (usufructo) of the property after the termination of the easement and for the improper use of the land and roads through the defendant’s entry onto the property. She states that the easement was extinguished in 1997 due to nonuse. Nevertheless, the defendant subsequently invaded her property and exploited it by installing electric power transmission lines. On this point, she adds, a just ruling must state that such use was not lawful, even if a public interest was involved, because that interest cannot legitimize the uncompensated sacrifice of a citizen’s rights.
In her view, payment must be awarded for the exercise of this de facto possession (posesión de hecho), which the defendant has exercised in violation of the law. In this regard, she alleges a violation of Article 24 of Ley no. 6313 de Adquisiciones, Expropiaciones y Servidumbres del ICE and Articles 264, 295 and 1045 of the Código Civil, due to their failure to be applied, because she was not compensated, in her capacity as owner, for the de facto restriction she has suffered. She also challenges the rejection of the claim concerning future environmental harm not quantified when the complaint was filed. Based on Article 287 of the Código Procesal Civil, she argues that damages were calculated as of the filing date, subject to the reservation that subsequent damages would be calculated when appropriate. Nevertheless, she continues, the challenged judgment denies that claim. In this respect, she alleges violation of Articles 264, 295 and 1045 of the Código Civil because, as owner, she was not compensated for such harm, which had been timely claimed.
She further challenges the rejection of her claim for payment due to the loss of the land’s commercial value and the deterioration of the property’s environmental and overall balance. In her view, the magnitude of the easement’s impact on her property was not considered. As established, she argues, the easement divided the property into two portions. Because the easement is 20 meters wide, two unequal strips approximately 30 meters wide each remained, adversely affecting the property’s commercial value. She notes that enormous high-voltage structures were installed, depriving the remainder of the estate of any commercial appeal. She asserts that the judges did not properly assess that value. In this regard, based on Article 595 of the Código Procesal Civil, she alleges an error of law in the assessment of evidence (valoración de la prueba), insofar as the judgment holds that the easement did not severely impair the essential core of the property.
She further alleges violation, through erroneous interpretation, of Articles 330, concerning the assessment of evidence; 368, which recognizes photographs as evidence; 379 and 391, concerning private documents; and 409, concerning judicial inspection (reconocimiento judicial), all of the aforementioned code. Correspondingly, she adds, Article 45 of the Constitución Política, concerning the inviolability of private property, was violated, as were Articles 264 and 1045, concerning absolute ownership and compensation for damage to third parties.
IV.- It should be emphasized that the Tribunal neither ordered reversion (retrocesión) in favor of the plaintiff nor extinguished the easement right. The easement continues to exist and the encumbrance (gravamen) remains, precisely in view of the public-interest reasons that justify it and have warranted the expropriation (expropiación). In this regard, the fact is that the appeal did not effectively challenge the rejection of the relief sought concerning those matters, and those determinations therefore remain undisturbed. Accordingly, there can be no award of the damages through which the plaintiff seeks compensation for what she claims was the loss of the beneficial use of the property occurring after the purported termination of the easement and continuing until the property’s return, for damage arising from the use of the land and roads, for the de facto possession exercised there, or for the restriction on ownership. Furthermore, it should be considered that the Ad quem, with reference to the trial court judgment, found that the testimonial evidence had not established with certainty any improper use of land and roads on the plaintiff’s property, and the challenge under consideration here presents no ground that reliably supports a contrary conclusion. For the foregoing reasons, the corresponding claim of error is unfounded.
V.- Regarding the claim for compensation for future environmental harm not quantified in the complaint, the Ad quem issued two separate rulings. The first concerns the claim for “…one million colones, plus unquantified future damages, for material and environmental damage caused to her property, particularly to its flora and smaller and larger vegetation, especially through the improper felling of trees.” It granted that claim and ordered ICE to compensate the harm caused by the felling of trees. The second concerns the claim for “… one million colones plus future damages, for environmental damage relating to the scenic value of her property, as a result of the works performed by ICE, towers and cables.” It also granted that claim and stated that the compensation the defendant must pay the plaintiff for the expropriation required for the easement must include compensation under that heading.
For both items, it stated that the amounts would be determined by an expert during enforcement of the judgment, without exceeding the maximum sums set for those claims. In fact, it is unclear which of these matters the appellant in cassation (casacionista) is referring to, because her ground of appeal is very general and provides no details in this regard. In any event, the Tribunal granted both claims, which in principle would mean that the defendant suffered no prejudice. However, if the view is that those rulings excluded some form of future harm, the plaintiff should have moved to supplement the judgment on that point. If the objection concerns an award in an unspecified amount (condenatoria en abstracto) rather than a specific sum, the challenge should have been presented on that basis, alleging a violation of Article 156 of the Código Procesal Civil through improper application. Assuming that the challenge concerns the limitation of each of those claims to one million colones, it should have been expressly framed that way in the appeal.
In any event, the clarity and precision required by Articles 596 and 597 Ibídem serve, among other purposes, precisely to prevent the Chamber from having to speculate and formulate hypotheses about what the appellant intended to say, particularly where, as here, the matter involves an appeal restricted to the stated grounds (recurso en relación). This demonstrates the lack of proper form in the challenge, which is consequently inadmissible.
VI.- Lastly, the ground concerning compensation for the loss of the land’s commercial value and the deterioration of the property’s environmental and overall balance must also be rejected. This ground refers to the magnitude of the easement’s impact, the division of the property into two parts, and the installation of enormous high-voltage structures, which, according to the appellant, has deprived the remainder of the property of commercial appeal. First, the issue of the loss of the land’s commercial value was indeed considered in the challenged judgment, which expressly grants the claim and orders that it be included among the matters the expert must consider when determining the compensation the defendant must pay the plaintiff for the expropriation required for the easement. The challenge concerning the claim for payment due to the deterioration of the environmental balance resulting from the installation of enormous high-voltage structures is unfounded because the basis upon which the Tribunal denied that claim, as explained below, was not challenged in the appeal.
Indeed, the challenged judgment states that, according to the expert opinion (experticia) submitted by the biologist German Pochet Ballester, the area affected by an electromagnetic field with respect to persons and the environment extends 24 meters on both sides of the towers and 32 meters on both sides of the structures; nevertheless, despite this, it adds: “…that expert opinion is not conclusive as to the harm to human health caused by the transmission lines installed by the defendant Institute.” No objection to that finding, which arose from the assessment of the relevant evidence, has been raised in the appeal. Nor does the appeal challenge the Tribunal’s application, in this specific case, of the decisions of the Sala Constitucional, according to which: “…the harm caused by electric power transmission lines has not been reliably demonstrated, since harm to health resulting from high-voltage lines requires definitive proof because, in light of the most comprehensive and current technical criteria, it has not been established with absolute certainty; therefore, as to this (sic) claim, the denial contained in the trial court judgment must be affirmed.” VII.- In view of the foregoing, the appeal must be rejected, as must, given the manner in which the appeal is resolved, the offer of evidence to assist the court in reaching its decision (prueba para mejor proveer). The moving party shall bear the costs of the appeal (Article 611 of the Código Procesal Civil).
POR TANTO
The offer of additional evidence for the court’s consideration is denied. The appeal is dismissed; costs shall be borne by the plaintiff.

RESULTANDO

CONSIDERANDO
I.La señora Tatiana Mora Leiva demanda al Instituto Costarricense de Electricidad (ICE, en lo sucesivo). Pide se declare en sentencia, en lo fundamental: 1.- Ella es dueña de la finca no. 5-105466-000 del sistema de folio real. 2.- El inmueble aparece en el Registro Público soportando una servidumbre trasladada, de torres de tendido eléctrico a favor de un terreno del ICE. 3.- La servidumbre forzosa se constituyó en 1986. 4.- El demandado no la ejerció, legal ni efectivamente, dentro del fundo de su propiedad, en los 10 años siguientes a su constitución original. 5.- Según la normativa aplicable sobre devolución de bienes expropiados o gravados forzosamente, en razón de que el Instituto no usó en tiempo la referida servidumbre, que se estableció según la Ley de Constitución, Expropiación y Adquisición de Servidumbres del ICE, no. 6316, procede liberar su inmueble de ese gravamen; además, expedirse mandamiento de cancelación al Registro Público. 6.- Subsidiariamente, acorde con la legislación, principios normativos, jurisprudenciales y doctrinarios sobre el derecho real de servidumbre, se declare que la falta de ejercicio adecuado y efectivo del contenido esencial, facultades y derechos del titular del fundo dominante, la servidumbre decae y se extingue por falta de uso y prescripción negativa, disponiéndose la liberación de la finca de ese gravamen, debiendo cancelarse registralmente. 7.- Todos los actos, acciones y actividades desplegadas en el terreno por el ICE, para construir la infraestructura de la servidumbre, verificados después de 10 años a partir de su constitución en 1986, son extemporáneos, inoportunos, inequitativos, irracionales, abusivos, ilegales, antijurídicos, desproporcionados, infundados y viciados de nulidad absoluta. 8.- El accionado debe reponer, por su cuenta y costo, el terreno al estado que estaba antes de los trabajos, obras y construcciones, para lo cual tendrá el plazo de un año a partir de la firmeza de la sentencia. 9.- Además, indemnizar los daños y perjuicios. 10.- También, pagar los intereses de ley sobre cualquier monto que deba cancelar, desde la firmeza de lo resuelto y hasta su efectivo pago.
Ante el evento de que no se declare la extinción de la servidumbre, solicita se decrete, en subsidio de los puntos 5 y siguientes de la demanda principal: 1.- Que como titular del fundo sirviente y sucesora mortis causa, ella se ha subrogado en todos los derechos de la propietaria y constituyente original de la servidumbre en cuestión, su abuela, la señora María Clementina Alvarado García, emanados del contrato de servidumbre suscrito con el ICE en 1986. 2.- El referido acuerdo adoleció, desde el inicio, de graves vicios de fondo en cuanto a la falta de elementos esenciales en su objeto, voluntad y precio, al excluirse otros aspectos como servicios, modalidades de usos y bienes, que debieron compensarse por el demandado. Por esos defectos que generan nulidad absoluta, se debe rescindir el negocio en lo que a ella atañe, debiendo las partes ser repuestas en sus condiciones originales, cancelándose el gravamen en el Registro Público. 3.- De no resolverse así, pide se rescinda el pacto y se disponga que el ICE ha incurrido en acciones abusivas no autorizadas por el Derecho y en incumplimientos graves de sus obligaciones contractuales, establecidas en la legislación vigente, generando una excesiva onerosidad sobreviviente, que ha hecho más gravosa y perjudicial la servidumbre sobre su finca, justificando la resolución del contrato en lo referido a su propiedad, con reposición a las situaciones originales, previas a la servidumbre y expedirse mandamiento de cancelación del gravamen. 4.- El accionado debe reintegrar el terreno, por su cuenta y costo, al estado que tenía antes de la servidumbre, contando con un el plazo de un año a partir de la firmeza de la sentencia. 5.- Además, indemnizar los daños y perjuicios. 6.- También, los intereses civiles de ley. 7.- Además, ambas costas del proceso.
De no accederse a la demanda principal ni a la recién expuesta, pide se establezca, en subsidio de los puntos 5 y siguientes de la primera: 1.- Al no haber ejercido el ICE oportunamente ni dentro de un plazo razonable el derecho de servidumbre, sus acciones tardías para gozarla y hacer las obras de infraestructura requeridas, devienen en un ejercicio abusivo, excesivo, no racional y desproporcionado de sus facultades contractuales y legales, situación que amerita realizar una expropiación o adquisición del terreno, pagando un justiprecio acorde con los valores actuales, lo que el demandado debe realizar y terminar en el plazo de seis meses desde la firmeza del fallo. 2.- En orden a la naturaleza, alcances, riesgos, peligros, influencia electromagnética de las líneas eléctricas de alto voltaje, así como esa influencia desde la estación eléctrica del ICE contigua a su terreno, como por la ubicación y dimensiones finales de la servidumbre y cambio de circunstancias respecto del contrato original, se afectó gravemente el dominio en su fundo, debiendo el accionado proceder con la expropiación, adquisición o indemnización de la finca y completarla dentro del plazo de seis meses, luego de adquirir firmeza lo resuelto o, en su defecto, de la franja que el perito determine como área indemnizable por incidencia negativa de las líneas de alta tensión, o respecto de los 20 metros de ancho de servidumbre en su valor real y en toda su extensión, rebajando en todo caso cualquier monto previamente pagado.
Se pronunciará la sentencia sobre el deber del ICE de cancelar el valor de mercado del fundo ocupado por las bases de las torres en cuestión, declarando que el pago del 35% de ese terreno no correspondió a la afectación en la práctica. De no concederse lo indicado, se le ordenará reubicar la servidumbre completa, en aquella sección del inmueble que cause menos daños y perjuicios, según se determine por experto en ejecución de sentencia. 3.- Dentro de la servidumbre que en su origen se constituyó, no se contempló el derecho de paso ni modalidad alguna a favor del ICE, sobre otras porciones de la finca, ni siquiera dentro de la misma faja de 20 metros de servidumbre de líneas y torres, por lo que se declarará que el demandado no tiene esa facultad y que para ejercerla deberá determinará en ejecución y mientras ello no ocurra, solo podrá ingresar a las torres y a la finca con su expreso permiso. 4.- Sobre cualquier suma que se fije en firme, el accionado pagará los intereses legales hasta el efectivo pago del principal. 5.- También las costas personales y procesales. El demandado opuso las excepciones de prescripción, falta de derecho y de legitimación; asimismo, formuló el vocablo “sine actione agit”.
II.El Juzgado acogió parcialmente la defensa de falta de legitimación y en su totalidad las de falta de derecho y prescripción. Rechazó la expresión genérica “sine actione agit”. Declaró sin lugar la demanda con respecto a las pretensiones de nulidad de la escritura de constitución de la servidumbre y los daños y perjuicios alegados. En lo demás, decretó inadmisible la acción. Condenó en ambas costas a la accionante. El Tribunal revocó en forma parcial. Rechazó las excepciones de falta de legitimación y prescripción. Acogió en parte la de falta de derecho y en el mismo sentido declaró con lugar la demanda. Condenó al ICE a pagarle a la actora el valor real y actual de la servidumbre para el paso de líneas de transmisión de energía eléctrica constituida en el inmueble, cuya cuantificación se determinará por perito en ejecución de sentencia, con honorarios a cargo del accionado. También, a pagar daños y perjuicios así: A.- Daños materiales y ambientales causados al fundo por la tala de árboles, en monto que no podrá pasar el ¢1.000.000,00 fijado por la demandante como máximo de esa pretensión.
B.- Daños ambientales por afectación del paisaje o contaminación visual respecto al valor paisajístico con ocasión de las obras hechas por el ICE en ese inmueble, lo cual no podrá sobrepasar el ¢1.000.000,00 por el mismo motivo expuesto. La cuantificación de esas lesiones se determinará pericialmente al ejecutarse lo resuelto, debiendo el accionado cubrir los respectivos gastos. A título de perjuicios, impuso los intereses legales sobre las sumas otorgadas, a partir de la firmeza de la sentencia y hasta su efectivo pago. Ordenó girarle al ICE ¢89.300,00, según depósito no. 0786122 G, del 29 de marzo de 1999, a la orden del Juzgado Contencioso Administrativo, correspondiente a la devolución de los montos reconocidos por el accionado, como indemnización por constituir la servidumbre e instalación de los tres postes para las líneas eléctricas en el inmueble de la actora. Asimismo, el pago de ambas costas del proceso.
III.Ambas partes recurrieron ante esta Sala, quien en auto no. 752-A-S1-2010, de las 14 horas 10 minutos del 17 de junio de 2010, rechazó de plano los agravios procesales de la impugnación de la actora y el recurso interpuesto por el demandado. Por motivos de fondo, la accionante objeta lo que considera fue el rechazo de varios extremos indemnizatorios, en concreto, el resarcimiento por la pérdida del usufructo del fundo con posterioridad a la extinción de la servidumbre y el uso indebido de los terrenos y caminos, por los ingresos que hace el demandado. Indica, la servidumbre se extinguió en 1997 por no usarse. Sin embargo, luego el accionado invade su finca y la explota al instalar líneas de transmisión eléctrica. En este punto, agrega, una justa resolución debe hacer constar que ese uso no fue a derecho, aunque haya existido un interés público de por medio, el que no puede legitimar el sacrificio gratuito de los derechos de una ciudadana.
A su juicio, se debe reconocer el pago por el ejercicio de esa posesión de hecho que, contra ley, ha ejercido el accionado. Al respecto, acusa quebranto del artículo 24 de la Ley no. 6313 de Adquisiciones, Expropiaciones y Servidumbres del ICE; 264, 295 y 1045 del Código Civil, por falta de aplicación, pues no se le indemnizó, en su calidad de propietaria, la limitación de hecho que ha sufrido. También, combate el rechazo del rubro atinente a los detrimentos ambientales futuros, no cuantificados al momento de interponerse la demanda. Con base en el canon 287 del Código Procesal Civil, alega, se liquidaron daños y perjuicios a la fecha de plantearla, con la reserva de que los posteriores se liquidarían en su momento. No obstante, continúa, en el fallo impugnado se deniega ese reclamo. Sobre el particular, acusa infracción de los preceptos 264, 295 y 1045 del Código Civil, por cuanto no fue indemnizada, como propietaria, de esas lesiones pedidas oportunamente.
Además, censura el rechazo de su pretensión de pago por la pérdida del valor comercial del terreno y el deterioro en el equilibrio ambiental y general del inmueble. En su criterio, no se consideró la magnitud del impacto de la servidumbre sobre su propiedad. Tal y como fue constituida, aduce, dividió el inmueble en dos porciones. Al ser la servidumbre de 20 metros de ancho, quedaron dos franjas desiguales de aproximadamente 30 metros de ancho cada una, afectando el valor comercial del inmueble. Nótese, acota, se instalaron construcciones gigantes de alta tensión, las cuales hacen que el resto de la heredad carezca de cualquier atractivo comercial. Ese valor, afirma, no ha sido apreciado por los juzgadores en debida forma. Al respecto, con fundamento en el artículo 595 del Código Procesal Civil, alega error de derecho en la valoración de la prueba, en tanto en la sentencia se sostiene que no ha habido afectación severa del núcleo esencial del bien con la servidumbre.
Además, acusa quebranto, por interpretación errónea, de los numerales 330, sobre apreciación probatoria; 368, que reconoce valor de pruebas a las fotografías; 379 y 391, alusivos a los documentos privados; 409, del reconocimiento judicial; todos ellos del citado cuerpo normativo. Correlativamente, agrega, se vulneró el canon 45 de la Constitución Política, relativo a la inviolabilidad de la propiedad privada; como también el 264 y el 1045, del dominio absoluto y a la indemnización por los daños a terceros.
IV.Cabe destacar, el Tribunal no decretó la retrocesión a favor de la actora ni extinguió el derecho de servidumbre. Esta subsiste y el gravamen permanece, precisamente, considerando la existencia de razones de interés público que así lo justifican y han dado cabida a la expropiación. Sobre el particular, lo cierto es que en el recurso no se llegó a combatir, con eficacia, el rechazo de los extremos petitorios relativos a esos aspectos y por ello permanecen incólumes. Así las cosas, no cabe el reconocimiento de los daños y perjuicios, con los que la actora busca resarcirse por lo que aduce fue la pérdida del usufructo del inmueble operada luego de la pretendida extinción de la servidumbre y hasta la devolución del fundo, de los derivados del uso de terrenos y caminos, de la posesión de hecho que ha ejercido allí y de la limitación al dominio. Además, considérese que el Ad quem, con referencia al fallo de primera instancia, estimó que de la prueba testimonial no se ha acreditado, con certeza, el uso indebido de terrenos y caminos en el inmueble de la actora y en la impugnación que aquí se conoce, no se establece agravio alguno que, fehacientemente, conlleve a desprender lo contrario. En razón de lo
V.En cuanto a la petición indemnizatoria por los detrimentos ambientales futuros no cuantificados en la demanda, el Ad quem emitió dos pronunciamientos distintos. El primero se refiere a la pretensión de “…un millón de colones, más daños futuros no cuantificados, por daños materiales y ambientales causados a su inmueble, en particular en la flora y la vegetación menor y mayor, en particular por la tala indebida de árboles”. Ese extremo lo acogió y dispuso que el ICE deberá resarcir las lesiones irrogadas como consecuencia de la tala de árboles. El segundo alude al reclamo de “… un millón de colones más daños futuros, por daños ambientales en relación con el valor paisajístico de su inmueble, con ocasión de las obras hechas por el ICE, torres y cables”. Ese punto también lo declaró procedente e indicó que la indemnización que deberá reconocer el demandado a la actora, por concepto de expropiación para la servidumbre, ha de contemplar lo relativo al resarcimiento por ese concepto.
Para ambos rubros señaló, las cuantificaciones se determinarán por perito al ejecutarse la sentencia, sin exceder las sumas fijadas como máximo de esas pretensiones. En realidad, no se sabe a cuál de esos aspectos se refiere el casacionista, pues su agravio es muy general y no detalla sobre el particular. De todas maneras, el Tribunal acogió ambos extremos, lo que en principio supondría que no representa perjuicio alguno para el demandado. Ahora bien, si se piensa que esos pronunciamientos dejaron por fuera algún tipo de lesión futura, debió entonces gestionar la adición del fallo en ese punto. Si es que la inconformidad radica en la condenatoria en abstracto y no en suma concreta, la censura se debió plantear en ese sentido, alegándose quebranto del artículo 156 del Código Procesal Civil, por aplicación indebida. Asumiendo que el reproche radica en la limitación al millón de colones para cada uno de esos extremos, así se debió plantear, de modo expreso, en el recurso.
En todo caso, la claridad y precisión, que exigen los preceptos 596 y 597 Ibídem, entre otras cosas, es precisamente para evitar que la Sala tenga que entrar en suposiciones e hipótesis sobre lo que quiso decir el recurrente; máxime, tratándose de un recurso en relación como lo es el que aquí se analiza. Ello dice de la informalidad del reproche que, en consecuencia, resulta inadmisible.
VI.Por último, también debe desestimarse el agravio relativo a la indemnización de pago por la pérdida del valor comercial del terreno y el deterioro al equilibrio ambiental y general del inmueble, aludiéndose a la magnitud del impacto de la servidumbre, la división de la finca en dos partes, la instalación de construcciones gigantescas de alta tensión, que informa el casacionista, ha tornado el resto del bien sin atractivo comercial. En primer lugar, el tema de la pérdida del valor comercial del terreno sí fue valorado en la sentencia impugnada, donde expresamente se acoge el reclamo, disponiéndose que forma parte de los aspectos que deberá tomar en cuenta el perito, al determinar la indemnización que debe reconocer el demandado a favor de la actora, por concepto de expropiación para la servidumbre. La censura alusiva a la pretensión de cobro por el deterioro del equilibrio ambiental, en orden a la instalación de construcciones gigantes de alta tensión, deviene improcedente, pues la base para que el Superior denegara ese extremo, como se verá de seguido, no fue combatida en el recurso.
En efecto, nótese cómo se señala en el fallo impugnado, que según la experticia rendida por el biólogo German Pochet Ballester, la zona de influencia de un campo electromagnético para personas y el medio ambiente es de 24 metros a ambos lados de las torres y de 32 metros a ambos lados de las construcciones; sin embargo, con todo y ello, agrega: “…dicho peritaje no es categórico a los daños a la salud humana que provocan las líneas de transmisión colocadas por el Instituto demandado”. Ninguna objeción se ha planteado en el recurso contra ese criterio, derivado de la apreciación de la relacionada probanza. Tampoco se cuestiona la aplicación que el Superior hizo, en el caso concreto, de los fallos de la Sala Constitucional, según los cuales: “…no se ha logrado demostrar de manera fehaciente el daño que provoca las líneas de transmisión eléctrica, siendo que el daño a la salud producto de las líneas de alta tensión requiere de una probanza definitiva, pues a la luz de los criterios técnicos más completos y actuales, el mismo no ha sido determinado con absoluta certeza, por lo que en cuanto a éste (sic) extremo debe confirmarse la denegatoria contenida en la sentencia de instancia”.
VII.En mérito de lo establecido, el recurso debe rechazarse, como igualmente, por la forma en que este se resuelve, el ofrecimiento de la prueba para mejor proveer. Deberá correr la parte promovente con las costas de la impugnación (artículo 611 del Código Procesal Civil).
POR TANTO
Se deniega el ofrecimiento de la prueba para mejor proveer. Se declara sin lugar el recurso; son sus costas a cargo de la parte actora.
