SummaryResumen
The First Chamber of the Supreme Court of Justice granted the State’s cassation challenge to a judgment that had dismissed a damages action but exempted the claimant from costs. The action attributed the diversion of a branch of the Ceibo River, and resulting damage to two properties, crops, timber, and structures, to the MOPT and the Municipalidad de Buenos Aires. The lower court rejected the claims because no suitable technical evidence established the alleged diversion works or the required causal link, although it considered the nature of the disputed events sufficient grounds for good-faith litigation. The Chamber held that this justification did not satisfy the exception in article 193(b) of the Código Procesal Contencioso Administrativo (Administrative Litigation Procedure Code). Because the claimant failed to prove essential elements of liability, the general rule requiring an award of costs against the unsuccessful party applied. The Chamber quashed the judgment solely as to costs and ordered the claimant to pay both personal and procedural costs.

Proceedings on the merits (proceso de conocimiento) in an oral and public trial, brought by Álvaro Vargas Barrantes, represented by Attorney Rafael López Gutiérrez, against Municipalidad de Buenos Aires, represented by Attorney Johnny Vidal Atencio, and the State, represented by Procurator Attorney Omar Rojas Valverde. The State filed a cassation appeal (recurso de casación) against judgment 2023004834, issued at 16:26 on 27 October 2023 by the Administrative Litigation and Civil Treasury Court (Tribunal Contencioso Administrativo y Civil de Hacienda), composed of Judges Rodolfo Marenco Ortiz, Jonatán Canales Hernández, and Paulo André Alonso Soto.
Drafted by Justice Rivas Loáiciga REASONS
I.On 16 May 2019, Mr. Álvaro Vargas Barrantes brought proceedings on the merits against Municipalidad de Buenos Aires and the Ministry of Public Works, based on the following relevant facts: he stated that he owns one registered property and another unregistered property in Buenos Aires, Puntarenas, on the banks of the Río Ceibo. He alleged that, on 26 May 2018, the river entered his properties because of works performed by MOPT at the request of Municipalidad de Buenos Aires, an intervention carried out without the corresponding permits from the governing institutions. He asserted that, during those works, the machinery diverted one of the river’s branches at the place known as La Motomba, which belongs to PINDECO. He stated that this diversion extends approximately 7 kilometers before rejoining the natural channel that the river had followed for more than one hundred years. He argued that the work performed by the Administration divided his property in two and caused him serious material damage through the loss of a quantity of timber that he had stacked for sale; in addition, an African oil-palm planting or crop was lost, as were structures and materials, to which must be added the loss in value of the property caused by the river’s intrusion.
He stated that the material damage amounted to ¢ 1.683.860.00. Based on the foregoing relevant facts, he requested that the judgment declare: “That the defendants be ordered in the judgment to restore the original course of the Río Ceibo channel, to pay the damages they caused me, and to pay both categories of costs in this action.” The State opposed the claim and raised the defenses of lack of standing to sue and to be sued and lack of legal entitlement. The Municipality opposed the claim. The Court ruled: “The defenses of lack of standing to sue and to be sued are rejected. The defense of lack of legal entitlement raised by the State is granted. Consequently, the claim brought by Mr. Ángel Álvaro Vargas Barrantes against the State and Municipalidad de Buenos Aires is denied. No special award of costs.” Dissatisfied with the ruling, the State filed a cassation appeal.
II.As its sole procedural ground of challenge, it alleges, pursuant to Article 138(c) of the Código Procesal Contencioso Administrativo, that the challenged judgment was inadequately reasoned because it exempted the claimant from paying costs without stating the factual and legal grounds justifying that decision, contrary to Article 57 of the same Code. It states that the Court referred only to the “nature of the facts in dispute” as sufficient grounds for litigation, without explaining why this constituted a basis for exemption. As its sole substantive ground, it alleges a direct violation of Article 193 of the Código Procesal Contencioso Administrativo, in conjunction with Article 73.1 of the Código Procesal Civil, because those provisions were not properly applied in the challenged ruling, pursuant to Article 138(c) of the CPCA. It states that the challenged judgment granted the defense of lack of legal entitlement and denied the claim, ruling without a special award of costs.
It argues that the unsuccessful party was improperly exempted from paying those costs when they should have been imposed by the Court on its own motion. It states that the Court incorrectly applied Article 193(b) of the CPCA by finding sufficient grounds for litigation, even though it concluded that no causal connection existed and that there was no technical evidence of a diversion of the Río Ceibo attributable to MOPT, characterizing the claimant’s allegations as merely subjective assessments and attributing the damage to a natural event constituting force majeure. It argues that exemption from costs cannot be considered justified in an unfounded claim that subjected the State to unnecessary proceedings. It notes that, according to Voto 141-F-TC-2022, issued at 10:30 on 7 July 2022, sufficient grounds for litigation must be based on objective information rather than subjective beliefs.
III.Both grounds will be considered jointly because they concern the same aspect of the judgment: the decision to rule without a special award of costs against the claimant. Although one is characterized as a procedural ground and the other as a substantive ground, both essentially challenge the propriety of the exemption granted under Article 193 of the Código Procesal Contencioso Administrativo. The analysis must therefore focus on whether, based on the facts deemed established—which remain undisturbed because they were not disputed at this stage—it was appropriate to apply the exception under subsection (b) of that provision. Under the first paragraph of Article 193 of the CPCA, the general rule is that the Court must, on its own motion, order the unsuccessful party to pay costs, and an exemption applies only in the exceptional circumstances established by the legislature, including when, in the Court’s judgment, the nature of the issues in dispute provides sufficient grounds for litigation.
In this case, the trial court exempted the claimant from costs, stating that “the nature of the facts in dispute provided sufficient valid grounds for litigating in good faith.” However, the factual findings established in the judgment—which led to the rejection of the damages claim because no work to divert the Río Ceibo channel attributable to MOPT was proven, because suitable technical evidence was lacking, and because the alleged causal connection was not demonstrated (unproven facts 1 and 2)—show that the decision to apply the exception under Article 193(b) of the CPCA is inconsistent with the scope of that statutory provision, since the claim was rejected for failure to prove essential elements of liability. Consequently, the appeal must be granted on this point, the judgment must be quashed solely with respect to costs, and the unsuccessful claimant must be ordered to pay attorney fees and procedural costs, in accordance with the general rule in Article 193 of the CPCA.
IV.In view of the foregoing and pursuant to Article 150(2) of the Código Procesal Contencioso Administrativo, the appeal will be granted and the challenged judgment will be set aside solely with respect to this issue. Ruling on the merits in its place, the claimant is ordered to pay both categories of costs.
THEREFORE
The appeal is granted. The challenged judgment is quashed solely insofar as it ruled without a special award of costs. Ruling on the merits in its place, the claimant is ordered to pay both categories of costs. CONSIDERANDO
