OutcomeResultado
The First Chamber denied the cassation appeal, confirmed that the time-bar defense could be reconsidered at judgment and that the Association lacked standing to pursue its claims concerning coastal delimitation and boundary-marker placement, and imposed costs on the cassation applicant.
SummaryResumen
The First Chamber denied the cassation appeal filed by the Asociación Nacional de Habitantes de las Zonas Costeras de Costa Rica against the judgment dismissing its action concerning Executive Decree No. 36642-MP-MOPT-MINAET and the methodologies for delimiting the public area of the zona marítimo-terrestre (maritime-terrestrial zone). It held that an interlocutory rejection of a preliminary time-bar defense may be reconsidered when judgment is rendered and therefore does not acquire res judicata effect. The Chamber also confirmed that the Association lacked standing: its claims did not seek to protect the public-domain status of the maritime-terrestrial zone or the environment as indivisible collective goods, but instead concerned particular proprietary interests associated with boundary-marker placement, its costs, and the possession of identifiable coastal inhabitants. Harm to the collective does not automatically establish personal harm or standing to seek individualized relief. Because no subjective right, legitimate interest, or direct injury to the Association’s corporate legal sphere was established, the appeal was denied and costs were imposed on the cassation applicant.

This means that, if the parties invoke it or the trial court considers it necessary, the defense rejected by the judge at the preliminary stage may be reexamined at that later stage, because the ruling was interlocutory and therefore does not have res judicata effect. In this case, the Tribunal correctly determined that the Association did not appear to defend the public-domain status of the maritime-terrestrial zone or the environment themselves, but instead to challenge a topographic methodology for boundary-marker placement and to demand that those services be provided free of charge. The latter directly affects the proprietary spheres of identified or identifiable persons, depriving the claim of its asserted diffuse nature. The claimant does not hold a subjective right or legitimate interest capable of supporting its claims. Consequently, because the substantive requirements for standing were not established, the ground of appeal must be rejected.

Case No. 19-001693-1027-CA Decision 001484-F-S1-2026 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE (SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA). San José, at 10:21 a.m. on 17 September 2026.
Proceedings on the merits, brought by the ASOCIACIÓN NACIONAL DE HABITANTES DE LAS ZONAS COSTERAS DE COSTA RICA, represented by Victoria Eugenia María Quirós Ramírez, in her capacity as legal representative, and attorney Adriana Rojas Rivero as special litigation counsel; against the STATE, represented by Silvia Quesada Casares, counsel for the Procuraduría General de la República, and the JUNTA ADMINISTRATIVA DEL REGISTRO NACIONAL, represented by attorney Alberto Herrera Porras. The plaintiff files a cassation appeal against judgment N.º 63-I-2023, issued at 2:40 p.m. on 31 July 2023 by the Tribunal Contencioso Administrativo y Civil de Hacienda, rendered by judges Laura Gómez Chacón, Amy Miranda Alvarado, and Carlos José Mejías Rodríguez.

Background.
Procedural Ground for Challenge
II.The first ground alleges a violation of the procedural rules of the legal system under Article 137(i), based on inconsistency with res judicata. The appellant states that, in its judgment, the Tribunal ruled on the expiration defense raised by the State’s representative and held that the complaint’s challenge was time-barred, despite the existence of a prior decision, N.º 885-2021, issued by the case-management judge. That decision determined that the measure challenged in this case, Decreto 36642-MP-MOPT-MINAET, which entered into force on 14 July 2011, is a generally applicable rule with continuing effects and that Article 40 of the CPCA therefore applies; accordingly, it rejected the preliminary defense of expiration of the action raised by the co-defendants. The appellant asserts that the parties did not challenge that ruling and that it therefore became final. It argues that the Tribunal’s ruling disregards the procedural principle of preclusion, distorts res judicata, and disregards the judicial independence of the case-management judge, who, under Article 90 ibidem, is legally responsible for deciding preliminary defenses.
III.Among the preliminary defenses established for this subject matter, Article 66(1) of the CPCA includes, among other defenses: “k) Limitation or expiration of the right, when evident and manifest.” As a general rule, the proper procedural time to raise this type of defense is when answering the complaint. Their “preliminary” nature stems from the fact that they prompt an examination before consideration of the merits of the dispute, in order to ensure the validity of the proceedings and give effect to the principle of procedural economy, because they prevent the continuation of litigation whose characteristics would preclude a ruling on the substantive claim. Nevertheless, the legislature established an exceptional framework for some of them—expiration, limitation, res judicata, and settlement—under which the period during which they may be raised is extended, since they may be asserted at any time before the conclusion of the oral trial.
The judicial body competent to analyze them varies according to the procedural stage at which they are raised. Thus, if they are raised—and substantiated—between the filing of the answer and the conclusion of the preliminary hearing, they are examined by the judge responsible for that stage. If they are raised after the preliminary hearing but before the oral-trial stage concludes, they are examined by the adjudicating tribunal (Article 67(1) and (2) of the CPCA). According to the appellant, the first of those circumstances occurred in this dispute; therefore, in its view, the ruling at the preliminary hearing became final, such that the issue could not be reexamined because it had the status of res judicata. Contrary to its argument, however, the special rules governing administrative litigation preclude that conclusion under the circumstances that occurred in this matter. Consideration must be given to Article 67(2) ibidem, under which, if preliminary defenses are raised before the preliminary hearing concludes, “they shall be decided on an interlocutory basis, without prejudice to their being analyzed again when judgment is rendered,” as well as Article 92(7) of the same legislation, which provides: “No appeal shall lie from the rejection of preliminary defenses, without prejudice to their subsequent examination when judgment is rendered (...).” This means that, if the parties so request or the tribunal deciding the merits deems it necessary, a defense rejected by the judge at the preliminary stage may be reexamined at that later stage, because the ruling was interlocutory and therefore does not have res judicata effect.
In this regard, reference may be made to the decision issued by this Chamber in Voto N.º 688-F-S1-2018 at 9:35 a.m. on 19 July 2018: https://nexuspj.poder-judicial.go.cr/document/sen-1-0034-857176. The situation is different when the defense was sustained at that stage before trial, because, pursuant to Article 92(6) of the same body of law, if the preliminary expiration defense were sustained, that ruling would be subject to cassation. Accordingly, because the alleged violation has not been established, the procedural objection must be denied.
Substantive Ground for Challenge
IV.A single ground is raised alleging a violation of the substantive rules of the legal system, pursuant to Article 138(a) of the CPCA, due to improper assessment of the evidence. The plaintiff alleges both improper assessment of the evidence and erroneous application or interpretation of Article 1(1) and Article 10(1)(a), (b), and (c) of the CPCA. It maintains that the Tribunal conducted an incomplete and cursory analysis of the certificate of legal representation, denying it active standing solely on the ground that the association is a legal entity whose “purpose of operation” has no direct relationship connecting it to the subject matter of the dispute. The appellant argues that this interpretation disregards the literal wording of that certificate, which states that the purposes and objectives shown constitute only a summary and not the entirety of its internal rules. It contends that the Tribunal engaged in unnecessary formalism by omitting the full text of its bylaws, Article Three(f) of which expressly includes the objective of representing residents of coastal areas before government bodies to protect and defend the areas they occupy and their structures in and around the maritime-terrestrial zone.
Because the complaint seeks to challenge the uncertainty and coastal-demarcation methodology affecting its members’ property rights, the subject matter of the dispute fully coincides with its organizational, collective, and diffuse-interest advocacy purposes, pursuant to Article 10.1(b) and (c) of the CPCA and constitutional case law. It further asserts that the Chamber disregarded crucial information contained in the same certificate, specifically its registered address in Montezuma de Cóbano, Puntarenas. On that basis, it maintains that the plaintiff has standing in two capacities: first, as a group governed by bylaws that protects the collective interests of its members; and second, in its individual capacity as a resident and legal entity directly affected in the area where it is domiciled. Finally, it argues that the Tribunal failed to fulfill its role as guarantor of legality by conducting a superficial assessment and departing from the substantive law and the social context of the matter.
V.The Tribunal of First Instance sustained the defense of lack of active standing after finding no substantive legal relationship or legitimate interest directly connecting the plaintiff Association to the relief sought in the complaint. In comparing the organization’s purpose with the subject matter of the proceedings, the judicial body determined that the certificate of legal representation submitted by the plaintiff limits its sphere of action to promoting unity, cooperation, and the internal organization of residents of coastal communities, which are essentially private, civil-law purposes. By contrast, the complaint seeks to challenge the methodologies and costs governing the placement of boundary markers under Decreto Ejecutivo N.º 36642-MP-MOPT-MINAET, while also demanding that those services be provided free of charge and that public policies be established. Because the Association was not formed for organizational advocacy or judicial activism concerning the framework established by Ley N.º 6043, the judgment concludes that the challenged provisions do not directly affect its legal sphere and that there is an evident confusion between the potential legitimate and individual interests of coastal residents and the organizational interest of the plaintiff legal entity.
The Tribunal likewise rejected the theory that the proceedings concern diffuse interests. Relying on the case law of the Constitutional Chamber (Sala Constitucional) and the First Chamber, it reasoned that, although the public-domain status of the maritime-terrestrial zone is of that nature, in this specific case the plaintiff does not seek to defend that status itself or a related collective environmental right. Instead, its claims challenge the economic and methodological aspects of a technical demarcation that directly affect the property interests of identified or identifiable private persons, depriving the matter of a diffuse nature. Finally, the Tribunal emphasized that the plaintiff lacked standing to assert claims for the benefit of third-party entities, such as the Asociación de Desarrollo Integral de Osa de Dominical, because no legal or associative relationship between them had been established. For all the foregoing reasons, because the substantive prerequisite of active standing was not established, the Tribunal sustained the defense on the merits and denied the complaint in its entirety.
VI.To decide the ground raised, it is essential to analyze this Chamber’s line of case law concerning the nature of diffuse interests and the conditions required for compensation based on their infringement. In this regard, a diffuse interest has been defined as a procedural situation in which standing extends among the members of a particular category of persons affected by unlawful acts, constituting an indeterminately held “right to seek redress” that entitles a person to oppose violations harming a community. Because of their direct connection to the values of the Constitution, standing criteria in this area are broader and more flexible; nevertheless, diffuse interests must not be confused with merely collective or organizational interests. Diffuse interests have a dual nature: they are collective because they are shared by an amorphous body of persons in the same situation, and individual insofar as the benefit or harm, whether actual or potential, indivisibly reaches each of its members.
With respect to compensable damage arising from the infringement of such interests, this Chamber has determined that supra-individual harm is not equivalent to the sum of particular damages or to harm to individuals’ private property. It is a single, general injury suffered by society as a whole or by an indeterminate group of persons linked by the same condition, where the effect is communal and reaches individual spheres indivisibly by reason of each person’s inclusion in the group. Consequently, because the collective interest is indivisible, an action concerning harm to the collective may be brought by any person, but any compensatory sums are, in principle, payable to society at large or to the indeterminate group directly harmed. It is therefore a rule of legal doctrine and case law that harm caused to the collective does not automatically give rise to a presumption of personal harm or, by itself, confer standing to seek individual relief.
Finally, it must be recalled that the liability of the Public Administration for its material or formal conduct is governed by the objective-liability nature derived from Article 190 of the Ley General de la Administración Pública (LGAP). Under this framework, the adjudicator must rigorously verify the existence of actual, quantifiable, and individualized harm, as well as an adequate causal connection between the challenged administrative conduct and the resulting harm. Only through an objective and logical showing that the harm would not have occurred in the absence of the public body’s conduct does the obligation arise to provide full reparation for the affected subjective rights of others, whether the harm resulted from failures in public services or from the individual conduct of public servants in the performance of their duties. Reference may be made in this regard to judgments N.º 451-F-S1-2013 at 2:00 p.m. on 10 April 2013 (https://nexuspj.poder-judicial.go.cr/document/sen-1-0034-581525) and 1365-F-S-2017 at 3:30 p.m. on 07 November 2017 (https://nexuspj.poder-judicial.go.cr/document/sen-1-0004-771642).
VII.When the reasoning of the Tribunal of First Instance is compared with this Chamber’s binding case law, discussed in the preceding section, it is evident that the claimant’s argument lacks legal support for the following reasons. This Chamber has held that diffuse interests protect an indivisible collective interest whose benefit or harm uniformly affects an amorphous body of persons in the same situation. In this specific case, the Tribunal correctly determined that the Association is not appearing to defend the public-domain status of the maritime-terrestrial zone or the environment itself, but rather to challenge a topographical methodology for placing boundary markers and to demand that those services be provided free of charge. The latter directly affects the individual property spheres of identified or identifiable persons, depriving the claim of its alleged diffuse nature. It has likewise been established that harm to the collective does not automatically give rise to a presumption of personal harm or confer standing to seek individualized relief.
By attempting to invoke a general interest to overturn provisions affecting the economic or possessory circumstances of coastal residents individually, the plaintiff Association confuses collective interests with personal claims. Under the objective-liability framework cited by the Chamber (Article 190 of the LGAP), the existence of a right to seek redress or enforceable standing requires proof of actual, quantifiable, and individualized harm arising from administrative conduct. The challenged Executive Decree governs technical procedures of the Instituto Geográfico Nacional that do not directly, currently, or concretely injure the Association’s organizational legal sphere, since its purposes under its bylaws are civil and private, rather than the legal representation of persons for the purpose of challenging the Public Administration’s regulatory activity. This Chamber finds that the Tribunal of First Instance properly applied the distinguishing criteria developed in this Chamber’s case law for determining standing to represent diffuse interests.
The plaintiff holds neither a subjective right nor a legitimate interest capable of supporting its claims. Consequently, because the substantive prerequisites of active standing have not been established, the ground must be rejected.
VIII.In light of the foregoing, the cassation appeal filed by the plaintiff is denied. Costs are imposed upon it pursuant to Article 150.3 of the CPCA.
THEREFORE
The appeal is denied. Costs shall be borne by the appellant.

CONSIDERANDO
Antecedentes.
Agravio procesal
