I.In these proceedings, the plaintiff filed a brief setting out “new facts” and “new evidence” after the trial hearing had already been scheduled. The brief, which it called an “Amendment to the complaint,” led the Court to order that the proceedings be returned to the procedural stage. At the hearing granted, the State raised the res judicata defense, which was upheld in connection with the proceedings on the merits conducted in case file 11-001347-1027-CA (consolidated with case file 11-003975-1027-CA), in which final judgment No.0153-2012-VI was issued by the same Court at eight hours and forty-five minutes on 6 August 2012.
Cassation appeal on procedural grounds.
II.The appellant raises several issues and bases them on Article 137(b) of the CPCA. In summary, the appellant identifies as the first procedural defect that the procedural judge, Morera Rodríguez, should never have assumed jurisdiction to hear the matter because the proceedings had already passed the preliminary hearing stage and a date had even been set for the hearing on the merits. The appellant maintains that Article 35.6 of the Civil Procedure Code accords with Article 68 of the Administrative Litigation Procedure Code, provisions that allow defendants three days to amend the complaint. However, contrary to those provisions, the Court returned the proceedings to the preliminary hearing stage, an action the appellant considers anomalous and against which, it says, it timely filed motions for reconsideration and appeal. Nevertheless, the trial court maintained its ruling, and the Court of Appeals avoided ruling on the merits on the basis of a formality.
Consequently, the appellant states that the defect lies in the judge’s having assumed jurisdiction, thereby violating due process and the right of defense. The second ground for cassation alleged is violation of the principle of procedural preclusion established in Article 2.9 of the Civil Procedure Code, applicable by referral under Article 220 of the Administrative Litigation Procedure Code. The appellant states that returning the case file to the procedural stage contravened that principle because the procedural stages had proceeded successively and were complete. In particular, the appellant insists that it was not possible to reopen the procedural stage or reconsider the preliminary defenses that had been resolved by procedural judge Herrera in 2018, which definitively closed that discussion. The appellant states that reopening precluded stages would have been possible only through their annulment by the First Chamber, which is competent to do so.
Nevertheless, in the challenged ruling, the judge improperly annulled prior rulings, including the order that had declared res judicata resolved in favor of the plaintiffs, contravening the principle of procedural preclusion. The third ground for complaint alleges violation of Article 59 of the Administrative Litigation Procedure Code, which safeguards the principle of the natural judge and seeks to prevent unjustified changes of the procedural judge during the proceedings, thereby guaranteeing judicial impartiality and independence. In this case, the original procedural judge was replaced without justification by a new judge, who also annulled a final ruling on substantive res judicata. This creates an appearance of irregularity and possible interference with the decision, and the appellant therefore asks that a violation of the principle of the natural judge be declared.
III.In light of the foregoing in the preceding section, the appellant subsumes its arguments under an alleged defect resulting in a lack of defense. On that issue, this Chamber has stated as follows: “The objection is based on the grounds for cassation set out in the first paragraph, subsection b), of Article 137 of the CPCA: ‘Lack of defense by a party, not attributable to that party, when its rights of defense and due process are affected.’ In this regard, the Constitutional Chamber (Sala Constitucional) has repeatedly stated that these rights are grounded in Articles 39 and 41 of the Political Constitution, from which the principle of ‘both sides being heard,’ ‘due process of law,’ or the ‘adversarial principle’ derives (...).” (See, among others, judgment no. 4975, at 9 hours and 5 minutes on 15 April 2016, and this Chamber’s judgment no. 76-2017, at 13 hours and 45 minutes on 26 January 2017.) Nevertheless, in this Chamber’s view, the objection does not constitute a violation under that ground for cassation, because by filing the brief dated 12 March 2020, identified as an “Amendment to the complaint,” the plaintiff created the procedural requirement to provide the corresponding hearing, in guarantee of due process and precisely to prevent the defendants from being left without a defense.
Moreover, the appellant has neither explained nor demonstrated how, specifically, the challenged ruling effectively violated its right of defense. On the contrary, it appears that the appellant had the procedural opportunity to present its arguments and appeal the rulings, while the appeal filed was declared untimely (see images 2565 and 2566 of the case file for the proceedings on the merits). As to the alleged violation of the principle of the natural judge, this Chamber concludes that no such violation occurred, since the procedural judge assigned to the originating position (not the individual judge) was the one who ultimately heard the matter, and no substantial irregularity compromising the validity of the proceedings is apparent. Likewise, regarding the argument concerning procedural preclusion, it must be specified that the res judicata defense is a privileged defense, which permits it to be raised and considered at any stage of the proceedings.
This circumstance not only defeats the asserted theory of preclusion, but is also supported by the claimant’s own procedural conduct, since filing the aforementioned brief opened the matter for consideration. Accordingly, no violation of the principle of procedural preclusion is apparent. Consequently, the challenge is rejected.
IV.The appellant raises several issues under Article 137(d) of the CPCA, which can be grouped in one section. In the fourth ground for cassation, the appellant refers to violation of Article 64 of the Civil Procedure Code and insufficient reasoning regarding the identity of the subject matter of the proceedings. The appellant states that the challenged ruling contains errors, particularly because its analysis of res judicata omits the challenged acts in the complaint brought by AREBATICO and SITRAJAP in the 2015 complaint, creating a contradiction in its reasoning: it suggests that the 2012 judgment assessed legal acts that arose later, such as the environmental viability and the order to commence, which occurred in 2014. The appellant states that this demonstrates an error in the reasoning and asks that it be declared. The fifth ground alleges violation of Article 64 of the Civil Procedure Code for insufficient reasoning as to the identity of the cause.
The appellant states that although the judge says a thorough analysis was conducted, the challenged acts in both complaints were not examined and the grounds or causes for nullity alleged in each case file were not compared. By omitting that analysis, the ruling again suffers from a defect in its reasoning and from contradictions, and the appellant asks that this be declared. The sixth ground again alleges violation of Article 64 of the Civil Procedure Code for insufficient reasoning, because the judge incorrectly resolved the res judicata defense by stating that a complaint filed in 2015 could not be brought because a judgment already existed in 2019, which is illogical and temporally impossible and constitutes another defect in the reasoning of the challenged judgment. In addition, the appellant raises as a seventh ground insufficient reasoning for annulling a prior ruling on the court’s own initiative.
The appellant maintains that the challenged order-judgment sets aside a ruling issued by Judge Herrera Valverde without explaining where the supposed error or defect lay. It points out that the prior ruling was more detailed and gave a more complete analysis of the requirements for declaring substantive res judicata under Article 162 of the Civil Procedure Code then in force, equivalent to current Article 64 of the CPC, and argues that the ruling does not adequately justify the annulment on the court’s own initiative. The challenged ruling therefore also has a defect in its reasoning.
V.This Chamber’s case law has consistently characterized the ground of insufficient reasoning, provided for in Article 137(d) of the Administrative Litigation Procedure Code, as a strictly procedural defect that arises when a judicial ruling lacks reasoning, has insufficient reasoning, or has reasoning that is poorly structured. This defect is not limited to cases in which reasoning is entirely absent; it also arises when the judicial reasoning is unclear, fragmentary, ambiguous, or contradictory to the point that the logical and legal path followed by the judge to reach the conclusion in the dispositive section of the ruling cannot be reconstructed. A deficiency of that magnitude directly affects the parties’ procedural guarantees, particularly due process in its aspect as the right to obtain rulings that are properly grounded, reasoned, and consistent. In this case, according to the appellant, the ruling’s reasoning contains errors, particularly in its analysis of res judicata, because it fails to identify the acts challenged in the 2015 complaint and the legal acts that arose later, such as the environmental viability from 2013 and the order to commence from 2014.
The appellant also identifies a defect in the application of Article 64 of the Civil Procedure Code due to insufficient reasoning on the identity of the cause, since the challenged acts in both complaints were not examined and the grounds or causes for nullity alleged in each case file were not compared. The appellant further reiterates the alleged violation of Article 64 of the Civil Procedure Code for insufficient reasoning because the judge incorrectly resolved the res judicata defense. Such disagreement cannot be reviewed under the procedural ground invoked, as it is essentially a substantive objection intended to secure review of the application of the law to the specific case. In that regard, it is essential to avoid confusing this ground with an indirect means of reviewing the Court’s determination on the merits. It is therefore not suited to challenging the correctness of the interpretation or application of substantive law, for which separate grounds of challenge are available under Article 138 of the CPCA.
To hold otherwise would distort the specific purpose of this ground for cassation and exceed the proper limits of the appeal. The objection amounts to a mere disagreement in view, which cannot be reviewed on procedural grounds. Consequently, the challenge is rejected.
VI.In this ground, the plaintiff argues that the Court committed the defect provided for in Article 137(d) and (h) of the CPCA: insufficient reasoning and erroneous application of Article 193 of the CPCA. The plaintiff considers that the challenged ruling fails to justify the award of costs against the Asociación de Rescate de Valores Patrióticos, despite recognizing the existence of substantive res judicata arising from proceedings in which that organization was not a party. The plaintiff maintains that this is legally nonsensical, since the Association had valid reasons to litigate, given that the arguments and challenged acts were new and different from those examined in prior proceedings. It also states that the acts challenged in these proceedings occurred after the prior judgments and therefore could not have been covered by res judicata. The plaintiff says that the appeal also criticizes a rigid interpretation of Article 193, which treats the award of costs as automatic and requiring no reasoning, which it considers unconstitutional because it violates due process and the right of defense, in accordance with the Constitutional Chamber’s case law.
It also invokes Article 8 of the American Convention on Human Rights, which requires judicial decisions to be properly reasoned as part of the right to be heard and, under the principle of conventionality control, asserts that this obligation is binding. In conclusion, the plaintiff argues that the award of costs without reasoning, applied both to the aforementioned Association and to SINTRAJAP under these circumstances, violates due process and the right of defense, requiring annulment of the challenged judgment.
VII.In addressing the financial consequences of the proceedings, the Court held: “Under Article 193 of the Administrative Litigation Procedure Code, procedural and personal costs are a burden imposed on the losing party by virtue of having lost. Exemption from this award is possible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is based on evidence whose existence the opposing party did not know. In this case, there is no reason to exempt the plaintiff from application of the rule requiring costs to be awarded against the losing party, because the plaintiff knew in advance what had been decided in judicial case files N°11-003975-1027-CA, which was consolidated with N°11-001347-1027-CA, and N.º 12-001630-1027-CA. It is therefore necessary to impose both categories of costs on the losing claimant, as well as legal interest, calculated from the date the ruling setting the amount of costs becomes final until payment in full.
Those amounts must be liquidated during enforcement of the judgment.” From the analysis of the foregoing, this Chamber does not find the alleged error. It is important to emphasize that, as a general rule, the losing party is ordered to pay costs and is exempted from that payment only by way of exception. In this case, the Court justified the award of costs against the plaintiff simply on the ground that it was the losing party, and that reasoning provides its basis. That basis is sufficient, since it is not necessary to explain the reasons for the Court’s view when none of the grounds for exemption applied. The opposite would be true when the judicial authority departs from the general rule and exempts the losing party from paying costs; in that situation, the duty arises to state the reasons for applying the exemption grounds. That is not the situation here, and in accordance with the foregoing, this Chamber finds neither the alleged lack of reasoning nor a violation of law. Accordingly, the ground is rejected.
Cassation appeal on substantive grounds
VIII.As to the substantive grounds for cassation, the appellant relies on Article 138(c) of the Administrative Litigation Procedure Code, specifying the incorrect application of res judicata in violation of Article 64 of the Civil Procedure Code. The appellant maintains that the challenged ruling acknowledges that the parties are not identical, since the Asociación de Rescate de Valores Patrióticos and the Municipalidad de Limón are parties to the current proceedings but did not participate in the prior proceedings. Despite this, the judge declares that res judicata exists, which the appellant considers arbitrary and unlawful because it disregards an essential requirement of Article 64 of the Civil Procedure Code, namely, the identity of the parties. The appellant therefore asks that the judgment be declared defective on this ground. The appellant also raises as the ninth ground a further violation of Article 64 of the Civil Procedure Code, due to a lack of identity of cause and subject matter.
The appellant argues that in the prior proceedings (judgment No.0153-2012), SITRAJAP sought annulment of two administrative acts and stated the grounds for annulment. In the current proceedings, the appellant asserts, although some administrative acts partially coincide, the grounds for annulment and the legal basis differ; indeed, the judge herself acknowledges that the factual and legal basis is different. Consequently, the appellant maintains that the identity-of-cause requirement is not met, so res judicata does not apply, and that applying Article 64 of the Civil Procedure Code was arbitrary and unlawful. In addition, as the tenth ground for cassation, the appellant alleges violation of the in dubio pro actione principle, Article 4.1 of the Civil Procedure Code, and Article 41 of the Political Constitution, under Article 138(c) and (d) of the Administrative Litigation Procedure Code.
The appellant states that the defense of substantive res judicata was resolved in a 2018 ruling by Judge Herrera Valverde. However, without justification, judgment No.495-2023 sets aside that ruling, reexamines the defense, and proceeds to interpret the law to allow the defense, seeking to interpret Article 64 of the Civil Procedure Code in a way that denies access to justice. The appellant considers this a serious defect in the judgment and asks that it be declared.
IX.This Chamber must state that the in dubio pro actione principle means that, where there is reasonable doubt as to the admissibility of an action or appeal, the judge should favor allowing it to proceed, safeguarding the right of access to justice enshrined in Article 41 of the Political Constitution. Nevertheless, that principle is not absolute and cannot be applied indiscriminately, since it does not require claims to be admitted when the law is clear or when essential procedural requirements have not been met. Its application is limited to situations of genuine interpretive uncertainty, preventing dismissals based on mere excessive formalism. In that regard, the defense of substantive res judicata is a legitimate limit on access to justice, since it serves legal certainty and the stability of judicial decisions. Therefore, when the identity of the parties, subject matter, and cause is clearly established, the judge must uphold the defense; it is not appropriate to invoke the in dubio pro actione principle to reject it where those elements are absent. Whether they are present depends on the analysis of the matter. Accordingly, this principle has no application in this particular case, and in light of the foregoing, this tenth ground must be rejected.
X.Before analyzing the ground at issue, it is useful to clarify the scope of the defense under review, regarding which this Chamber has stated: “III.— (…) At this point, it is necessary to recall what this decision-making body has stated regarding res judicata: ‘… it should be noted that the legal doctrine invoked, under Article 162 of the Civil Procedure Code, has the effect of making the existence or nonexistence of the legal relationship declared in one proceeding undisputable in another proceeding, so that no ruling may be issued on claims that have already been decided in other litigation. Under Article 163 thereof, judgments issued in ordinary or abbreviated proceedings, as well as certain other expressly specified rulings, produce the effect of substantive res judicata. It is limited to the dispositive part of the judgment; nevertheless, the grounds used to reach that result (the considerations) are closely linked to the dispositive part, so it is often necessary to consult those grounds to determine what was actually decided.
Its purpose is to protect legal security and certainty: once a decision has been issued on a particular cause, that cause cannot be disputed in subsequent proceedings. Thus, this binding effect produces two procedural consequences: one negative, which prevents a ruling on the merits regarding a matter already litigated (exceptio rei iudicata), and another positive, under which the second ruling must respect what was decided in the first regarding matters resolved there and raised in the second. In this respect, it is a consequence of the proceedings and of the intention expressed in the Law; however, its effects extend indirectly beyond those proceedings and reach substantive legal relationships. This derives from the immutability of the judicial decision. For a judgment to affect another proceeding through res judicata, the subjective and objective requirements that give rise to it must converge in both proceedings, namely, identity of parties, cause, and subject matter (Article 163 ibidem).
If even one of these three elements is absent from the two proceedings, res judicata cannot be said to exist. The subjective element refers to the parties to the proceedings. The subjective limit, or identity of parties, concerns those who participated in the proceedings and who must be treated as parties in the formal sense (claimants, defendants, and intervening third parties). It follows that what matters is not the physical identity of the parties but their legal identity. This is of great importance because a judgment said to have res judicata effect cannot be invoked against someone who was not a party to the proceedings; that is, the obligations and constraints arising from it cannot be imposed on them (in this connection, judgment no. 180, at 9 hours and 25 minutes on 23 February 2001). The subject matter is the right recognized, declared, or modified in the judgment in relation to one or more specified assets, or the legal relationship declared, as the case may be.
Thus, aspects that were not part of the ruling, either because they were not included among the claims or because they were not resolved in the judgment, cannot produce res judicata. However, as to subject matter, res judicata extends to points that, although not expressly addressed in the judicial decision, are resolved implicitly as a necessary consequence of or an indispensable prerequisite to that decision, because they are indisputably ancillary to what was decided. The second aspect of the objective limit is identity of cause, namely, the factual situation stated in the complaint as the basis for the claim. It is formed by the set of facts alleged as the basis for the complaint and their effect on the legal situation of the claimants. Res judicata can exist only where the three elements referred to coincide. It is therefore necessary to analyze whether, in this case, those elements coincide in the manner asserted by the appellant.
No. 376, at 16 hours and 20 minutes on 21 June 2006’ (no. 000281-F-S1-2017, at 10 hours and 10 minutes on 17 March 2017). It should be clarified that the doctrine of res judicata is currently set out in Article 64 of the Civil Procedure Code. Nevertheless, the foregoing remains valid, and it also follows that, to determine whether substantive res judicata applies, the prior proceedings must be analyzed in relation to the current proceedings to verify whether the triple identity of parties, subject matter, and cause is met.”
XI.In the matter under review, the appeal filed will be partially granted, because the challenged ruling shows an erroneous and improper application of the doctrine of substantive res judicata, contrary to the statutory requirements set out in Article 163 of the Code of Civil Procedure, now Article 64 of the Code of Civil Procedure. For substantive res judicata to apply, what is known as the threefold identity must be present: identity of parties, object, and cause. In this regard, the case file shows that the object of the proceedings on the merits conducted in case file 11-001347-1027-CA was to determine the validity of a series of administrative acts issued in the international public tender procedure 2009LI-000001-0200, including the tender specifications and their amendments, the award decision, the concession contract and its addenda, the Comptroller’s endorsement, among others. The claims submitted for judicial determination in case file 11-001347-1027-CA were:
“1. The annulment of the administrative act awarding international public tender No. 2009LI-000001-00200, called ‘Tender specifications for the concession of public works with public service for the design, financing, construction, operation, and maintenance of the container terminal at Puerto Moín,’ to APM TERMINAL CENTRAL AMERICA B.V. This is requested because: — the tender was conducted in violation of the rules governing both the concession law and the procurement law; it was conducted under specifications that did not comply with Article 21, paragraphs 1, 2, and 3, of the Law on the Concession of Public Works with Public Services, which required all corresponding technical studies supporting the economic and environmental feasibility of the project to be concessioned; it also violated, by contrary implication, Articles 27 through 29, inclusive, of the cited concession law, since those provisions do not allow an offer to be modified after offers have been formally received; and the tender specifications and offer submission dates were modified without granting adequate time. In addition, 15 further concessions or benefits were granted to the awarded company after the date the offers were opened—benefits or concessions that, had they been disclosed, could have enabled other interested parties to submit offers.
2. Pursuant to Article 42(b) of the Code of Administrative Litigation Procedure, I request that the administrative act awarding international public tender No. 2009LI-000001-0200, called ‘Tender specifications for the concession of public works with public service for the design, financing, construction, operation, and maintenance of the container terminal at Puerto Moín,’ to APM TERMINAL B.V., be declared void because it lacks justification for the tender process and reasons for the administrative act based on unequivocal rules of science or technology, as the technical studies, including environmental and economic feasibility studies, were not available.
3. The defendants be ordered to pay the personal and procedural costs incurred. Personal costs are understood to include not only court-ordered payments for experts and fees of court officers, but also the attorney’s fees due under the applicable tariff.” And in the present litigation:
“1. Pursuant to Article 42(a) and (b) of the CPCA, I respectfully request a declaration that the following administrative acts are inconsistent with the legal system, together with all related acts or actions, and the annulment of all such acts:
a. Resolution No. 274-2009-SETENA of 10 February 2009, which allegedly granted Potential Environmental Viability.
b. The INTERNATIONAL PUBLIC TENDER WITH INTERNATIONAL INVITATION No. 2009LI-00001-00200 specifications for the concession of public works with public services.
c. Agreement No. 018-MOPT-H of 1 March 2011, by which the Executive Branch awarded the project to the sole bidder, APM TERMINALS CENTRAL AMERICA B.V.
d. Executive Decree 36443-MOPT-H declaring the project to be in the public interest.
e. The execution of the contract on 30 August 2011 by the Executive Branch, the Executive Presidency of the Junta Administradora Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA), and APM TERMINALS MOÍN SOCIEDAD ANÓNIMA and APM TERMINALS CENTRAL AMERICA B.V., arising from international public tender 2009LI-000001-00200, conducted for the ‘Concession of Public Works with Public Service for the Financing, Design, Construction, Operation, and Maintenance of the New Moín Container Terminal.’ f. The (sic) Agreement 5.1 of ordinary session 28-2011 of 24 November 2011, in which the Board of Directors of the National Concessions Council (CNC) approved the signing of an addendum.
g. Agreement No. 491-11 of ordinary session 41-2011, of 24 November 2011, in which the JAPDEVA Board of Directors approved the signing of an addendum to the contract signed on 30 August 2011.
h. Addendum No. 1 to the Concession Contract for Public Works with Public Service for the Design, Financing, Construction, Operation, and Maintenance of the Moín Container Terminal, signed on 29 November 2011 by the Executive Branch, the Executive Presidency of the Junta Administradora Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA), and APM TERMINALS MOÍN SOCIEDAD ANÓNIMA and APM TERMINALS CENTRAL AMERICA B.V., arising from international public tender 2009LI -00000 1-00200.
i. The execution, on 13 February 2012, of the ‘Concession Contract for Public Works with Public Service for the Design, Financing, Construction, Operation, and Maintenance of the Moín Container Terminal’ between the granting Administration (comprising the Executive Branch, the Ministry of Public Works and Transport, the National Concessions Council, the Ministry of Finance, and the Junta de Desarrollo Económico de la Vertiente Atlántica) and APM Termináis Moín, S.A.
j. Letter DCA-0692 from the Administrative Procurement Division of the Comptroller General of the Republic, which endorsed the contract with APM TERMINALS.
k. Resolution 2523-2014-SETENA, which granted Environmental Viability to the project.
l. The start order issued to APM TERMINALS MOÍN by means of letter UE-TCM-OF-0192-2014.
m. Resolution No. 0152-2015-SETENA of 25 January 2015 and related acts.
n. Resolution No. 0166-2015 of 2 February 2015 and related acts.
2. Pursuant to Article 42(c), (d), and (f) and Article 99(c) and (f) of the Organic Law of the Environment, if the foregoing acts are not declared void, I respectfully request that all these acts and related acts be cancelled due to the breaches of legal and contractual obligations identified in this complaint, and that execution of the environmental and construction guarantees be ordered.
3. Pursuant to Article 42(i) of the CPCA, I respectfully request that the Public Administration be ordered to refrain from adopting and executing any act intended to revive this concession.
4. Pursuant to Article 42(e), (g), and (j) of the CPCA and Article 99 of the Organic Law of the Environment, I respectfully request that the defendants be ordered to demolish and/or remove the works carried out, repair the environmental damage caused, and establish compensatory obligations for the damage caused.
5. Pursuant to Article 193 of the CPCA, I respectfully request that the defendants be ordered to pay the costs of these proceedings, since we have been forced to litigate this matter to annul or cancel the challenged acts.
6. Pursuant to Article 42(f) and (g) of the CPCA, Article 98 of the Organic Law of the Environment, Article 199 et seq. of the LGAP, and Article 67 et seq. of the Organic Law of the Comptroller General, if this complaint is upheld, we respectfully request that the Comptroller General of the Republic be ordered to conduct administrative investigations to sanction the officials responsible for the nullities or forfeitures declared in this complaint and recover damages from them.
7. Pursuant to Article 42(f) and (g) of the CPCA, if this complaint is upheld, and should the Court consider that some type of crime may have occurred in the facts and acts discussed here, I respectfully request that copies of the relevant documents be sent to the Ministerio Público for its proper investigation.
SUBSIDIARY CLAIMS. If the foregoing claims cannot be granted, we request that at least the following be granted:
1. Pursuant to Article 42(a) and (b) of the CPCA, I respectfully request a declaration that the following contract clauses are inconsistent with the legal system, together with all related acts or actions, and the annulment of all such acts:
a. Clauses 4.1 and 9.1 of the Contract awarded to APM TERMINALS by Agreement No. 018-MOPT-H.
b. Recital Thirteenth of award Agreement No. 018-MOPT-H of 1 March 2011, insofar as it required APM TERMINALS to rehire only 3% of the 1400 JAPDEVA employees who would be affected by this concession.
2. Pursuant to Article 42(c) and (d) of the CPCA, I respectfully request that APM TERMINALS and its contractors be ordered to process municipal land-use approval for all works intended to be located in the camp area, especially the industrial plant for manufacturing concrete structures and the fuel-supply area infrastructure associated with the TCM concession.
3. Pursuant to Article 42(c) and (d) of the CPCA, I respectfully request that APM TERMINALS and its contractors be ordered to process municipal construction permits, with the respective plans, for all works intended to be located in the camp area, especially the industrial plant for manufacturing concrete structures (sic) and the fuel-supply area infrastructure associated with the TCM concession.
4. Pursuant to Article 42(c) and (d) of the CPCA, I respectfully request that APM TERMINALS and its contractors be ordered to pay for obtaining municipal construction rights for the construction of the camp area, especially the industrial plant for manufacturing concrete structures and the fuel-supply area infrastructure associated with the TCM concession.
5. Pursuant to Article 42(c) and (d) of the CPCA, I respectfully request that APM TERMINALS and its contractors be ordered to pay the fee for using 10 hectares in the Maritime Terrestrial Zone to build the camp area, especially the industrial plant for manufacturing concrete structures and the fuel-supply area infrastructure associated with the TCM concession.
6. Pursuant to Article 42(c) and (d) of the CPCA, I respectfully request a determination as to whether APM TERMINALS failed to perform its contractual obligations or the Administration failed to meet its oversight obligations, and that fines be imposed for the violations found.
7. Pursuant to Article 42(j) of the CPCA, I respectfully request an order for execution of the environmental guarantee and that the defendants be ordered to demolish the illegal works and repair the environmental damage caused.
8. Pursuant to Article 193 of the CPCA, I respectfully request that the defendants be ordered to pay the costs of these proceedings, since we have been forced to litigate this matter to annul the challenged acts.
9. Pursuant to Article 42(f) and (g) of the CPCA, Article 98 of the Organic Law of the Environment, Article 199 et seq. of the LGAP, and Article 67 et seq. of the Organic Law of the Comptroller General, if this complaint is upheld, we respectfully request that the Comptroller General of the Republic be ordered to conduct administrative investigations to sanction the officials responsible for the nullities or forfeitures declared in this complaint and recover damages from them.
10. Pursuant to Article 42(f) and (g) of the CPCA, if this complaint is upheld, and should the Court consider that some type of crime may have occurred in the facts and acts discussed here, I respectfully request that copies of the relevant documents be sent to the Ministerio Público for its proper investigation.” At this point, the partial identity with the petitum advanced in the earlier litigation can be seen. In the original proceedings, the claimant’s request was generic; however, analysis of the matter involved a complete review of the tender specifications and their amendments, as well as the award decision, concession contract and its addenda, Comptroller’s endorsement, environmental impact studies, among other matters. Judgment No. 0153-2012-VI, issued at 8:45 a.m. on 6 August 2012 by the Administrative Litigation Court, ultimately held:
“With respect to the complaint filed by the JAPDEVA Workers’ Union (case file No. 11-3975-1027-CA): The defense of lack of standing to sue raised by the Comptroller General of the Republic is rejected. The defense of lack of standing to be sued raised by the Comptroller General of the Republic and the Public Services Regulatory Authority is granted. No ruling is made, as unnecessary, on the defense of lack of entitlement raised by the Comptroller and the aforementioned regulatory body. The defense of lack of entitlement raised by APM Terminal Central América B.V., the State, the National Concessions Council, and the Junta de Administración Portuaria de la Vertiente Atlántica (JAPDEVA) is granted in full. Accordingly, the complaint filed by the JAPDEVA Workers’ Union against APM Terminal Central América B.V. and APM Terminals Moín S.A., the State, the National Concessions Council, the Junta de Administración Portuaria de la Vertiente Atlántica (JAPDEVA), the Public Services Regulatory Authority, and the Comptroller General of the Republic is dismissed in its entirety…” Thus, a detailed review of the matter shows that Resolution 2523-2014-SETENA, which granted Environmental Viability to the project, was not considered in the prior proceedings because it was issued later.
The cited judgment did rule on the project’s Potential Environmental Viability for the Moín Container Terminal (TCM), but not on its Environmental Viability. Therefore, there is no identity on this particular point, and the proceedings must accordingly be limited to that administrative act and claims 2, 3, 4, 5, 6, and 7 insofar as they concern that administrative act. As for the subsidiary claims, there is no identity with those concerning municipal permits, the fee, possible execution of the environmental guarantee, or subsidiary claims 8, 9, and 10. In summary, there is partial identity as to the object.
The cause of action is different, specifically and only with respect to the matters identified above, because the factual and legal grounds supporting the present complaint, as to claims that do not coincide with case file 11-001347-1027-CA (consolidated with 11-003975-1027-CA) and therefore were not considered in Judgment No. 0153-2012-VI, are different. The claimant’s complaint sets out the following arguments: Environmental Viability; restrictions in the Maritime Terrestrial Zone; lack of municipal permits; failure to pay municipal fees for use of the Maritime Terrestrial Zone; payment of municipal taxes for permits and construction rights; and Environmental Viability in the absence of permits for quarry exploitation and commitments undertaken. On the remaining matters, there is identity with the earlier proceedings.
Lastly, as to identity of parties, the Asociación de Rescate de Valores Patrióticos and the Municipalidad de Limón did not participate in the litigation heard in case file 11-001347-1027-CA: the former as claimant and the latter as defendant. However, the defendant Municipality is part of the proceedings solely because of the subsidiary claims, which, as explained, were not part of the original proceedings; it is clear that no principal claim was brought against it. As for the Asociación, although it was not a party to the earlier litigation, it is clear that it is not legally permissible to seek to evade the effects of res judicata by adding another claimant and thereby reopening a dispute that has already been duly resolved. In other words, it is improper to endorse actions intended to reopen matters already decided, since that would constitute improper use of the proceedings and directly affect the principles of legal certainty and stability of judicial decisions.
Accordingly, pursuant to former Article 163 of the Code of Civil Procedure and current Article 64 of the Code of Civil Procedure, the ruling acquires definitive, binding, and immutable effect, preventing the same issue from being submitted to judicial determination again, even under the guise of adding another party who is also represented by the same attorney. Accordingly, the appeal on points of law filed by the claimant will be partially granted, as the threefold identity required for the doctrine of res judicata is partially established. Therefore, it is legally appropriate to partially annul challenged ruling No. 495-2023, issued at 10:30 a.m. on 13 April 2023, insofar as it granted the res judicata defense and declared the claims in the complaint inadmissible; in its place, the preliminary defense of res judicata will be partially granted on the terms set out above.
THEREFORE
The appeal filed by the claimant is partially granted. Accordingly, the Court’s ruling No. 495-2023, issued at 10:30 a.m. on 13 April 2023, is partially annulled insofar as it granted the defense of substantive res judicata and declared the complaint inadmissible. In its place, the preliminary defense of res judicata is partially granted, and the matter is remanded so that proceedings may continue with respect to the first claim relating to the administrative act described in item k), namely Resolution 2523-2014-SETENA, which granted Environmental Viability to the project; claims 2, 3, 4, 5, 6, and 7 are likewise limited to that administrative act; and the subsidiary claims concerning municipal permits, the fee, possible execution of the environmental guarantee, and subsidiary claims 8, 9, and 10.

Revisión del Documento Res. 001284-F-S1-2026 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas ocho minutos del veintiseis de agosto de dos mil veintiseis .
Proceso de conocimiento establecido por la ASOCIACIÓN DE RESCATE DE VALORES PATRIÓTICOS Y SINDICATO DE TRABAJADORES DE JAPDEVA (SINTRAJAP) contra APM TERMINALS (APM TERMINALS MOIN S.A Y APM TERMINALS CENTRAL AMERICA B.V), MUNICIPALIDAD DE LIMÓN, CONSEJO NACIONAL DE CONCESIONES, CONTRALORÍA GENERAL DE LA REPÚBLICA, el ESTADO y la JUNTA DE ADMINISTRACIÓN PORTUARIA Y DE DESARROLLO ECONÓMICO DE LA VERTIENTE ATLÁNTICA (JAPDEVA). Interviene como apoderado especial judicial de la parte actora el Lic. Bernal Gamboa Mora, cédula de identidad 1-987-523, en representación de la Contraloría General de la República el Lic. Raúl Castro Borbón, cédula de identidad 1-987-523, como apoderado especial judicial de AMP TERMINALS el Lic. Roberto Cordero Brenes, cédula de identidad número 1-1166-540, en representación del Estado la Licda. Andrea Calderón Gassmann, cédula de identidad 1-828-263, en representación de JAPDEVA la Licda. Karla Mora Rivera, cédula 1-1315-901 y en representación de la Municipalidad de Limón la Licda Alba Iris Ortiz Recio.
La representación de la parte accionante formuló recurso de casación contra la sentencia número 495-2023 de las diez horas y treinta minutos del trece de abril de dos mil veintitrés del Tribunal Contencioso Administrativo y Civil de Hacienda, dictada por la jueza Liana Morera Rodríguez.

CONSIDERANDO
I.En este proceso la parte actora presentó memorial con “hechos nuevos” y “prueba nueva”, cuando ya se había realizado el señalamiento de la audiencia de juicio, escrito que denominó “Ampliación de demanda”, lo que generó que el Tribunal ordenara la remisión del proceso a trámite. En la audiencia concedida, el Estado interpuso la excepción de cosa juzgada que fue acogida con relación al proceso de conocimiento que se tramitó en el expediente 11-001347-1027-CA (acumulado proceso 11-003975-1027-CA) cuya sentencia firme es No.0153-2012-VI de las ocho horas cuarenta y cinco minutos del seis de agosto del dos mil doce del mismo Tribunal.
Casación interpuesta por razones procesales.
II.La parte casacionista acusa varios aspectos y los sustenta en el artículo 137 inciso b) del CPCA. En síntesis, señala como primer vicio, que la jueza de trámite Morera Rodríguez nunca debió asumir competencia para conocer el asunto, por cuanto, el proceso ya había superado la etapa de la audiencia preliminar e incluso estaba fijada la fecha para la audiencia de fondo. Sostiene que el artículo 35.6 del Código Procesal Civil coincide con lo establecido en el artículo 68 del Código Procesal Contencioso Administrativo, normas que prevén otorgar tres días a los demandados para ampliar la demanda. No obstante, el Tribunal, contrario a dichas disposiciones, remitió el proceso nuevamente a la audiencia preliminar, actuación que considera anómala y contra la cual -sostiene- interpuso oportunamente los recursos de revocatoria y apelación, sin embargo, el Tribunal de instancia mantuvo su resolución y el Tribunal de Apelaciones evitó pronunciarse sobre el fondo por un formalismo.
En consecuencia, manifiesta que el vicio radica en que la jueza nunca debió adquirir competencia y esto, vulnera el debido proceso y el derecho de defensa. El segundo motivo de casación que arguye consiste en la violación al principio de preclusión procesal establecido en el artículo 2.9 del Código Procesal Civil, aplicable por remisión del artículo 220 del Código Procesal Contencioso Administrativo, señala que retrotraer el expediente a la etapa de trámite contravino dicho principio, ya que las etapas procesales se habían desarrollado de manera sucesiva y se encontraban concluidas. En particular -insiste- que no era posible reabrir la fase de trámite, ni el análisis de las excepciones preliminares que habían sido resueltas por el juez de trámite Herrera en el año 2018, lo que implica la clausura definitiva de esa discusión. La reapertura de etapas precluidas -indica- solo habría sido posible mediante su anulación por la Sala Primera, competente para ello.
No obstante, mediante la resolución impugnada la jueza anuló indebidamente resoluciones previas, incluso el auto que había declarado resuelto la cosa juzgada a favor de los actores, lo que contraviene el principio de preclusión procesal. El tercer agravio explica, implica la violación al artículo 59 del Código Procesal Contencioso Administrativo, que tutela el principio de juez natural y busca evitar cambios injustificados del juez de trámite durante el proceso, garantizando la imparcialidad e independencia judicial. En este caso, el juez tramitador original fue sustituido sin justificación por una nueva jueza, quien además anuló una resolución firme sobre la cosa juzgada material, situación que genera una apariencia de irregularidad y de posible interferencia en la decisión, por lo que solicita que se declare la violación al principio de juez natural.
III.En atención a lo expuesto en el considerando precedente, la parte recurrente subsume sus argumentos en un supuesto vicio de indefensión y sobre el particular, esta Cámara se ha referido de la siguiente manera: “el reparo se basa en las causales de casación previstas en el párrafo primero, inciso b) del numeral 137 del CPCA: “Indefensión de la parte, que no le sea imputable, cuando se le afecten los derechos de defensa y del debido proceso.” Al respecto, la Sala Constitucional, en forma reiterada, ha señalado, estos tienen sustento en los mandatos 39 y 41 de la Constitución Política, de los cuales deriva el principio de “bilateralidad de la audiencia” del “debido proceso legal” o “principio de contradicción” (...)”. (Véanse entre otros el fallo no. 4975 de las 9 horas 5 minutos del 15 de abril de 2016 y la sentencia de esta Sala no. 76-2017 de las 13 horas 45 minutos del 26 de enero de 2017)”.
No obstante, lo objetado no constituye infracción a dicha causal casacional, a criterio de esta Cámara, por cuanto la parte actora mediante la presentación del memorial de fecha 12 de marzo de 2020, identificado como “Ampliación de demanda”, generó la exigencia procesal de conferir la audiencia correspondiente, en garantía del debido proceso y precisamente, a efectos de evitar la configuración de un estado de indefensión a la parte demandada. Aunado a lo anterior, el recurrente no ha explicitado, ni demostrado de qué manera concreta la resolución cuestionada le ha producido una efectiva vulneración a su derecho de defensa, por el contrario se observa que tuvo la oportunidad procesal de realizar sus argumentos y recurrir las resoluciones, siendo que el recurso de apelación interpuesto fue declarado extemporáneo (ver imágenes 2565 y 2566 del expediente del proceso de conocimiento). En cuanto al vicio alegado de infracción alguna al principio del juez natural, esta Sala concluye que no se configura toda vez que la jueza de trámite de la casilla de origen (no de la persona juzgadora) fue quien finalmente conoció el asunto y tampoco se advierte irregularidad sustancial que comprometa la validez de lo actuado.
De igual modo, en relación con el argumento atinente a la preclusión procesal, debe precisarse que la excepción de cosa juzgada ostenta naturaleza privilegiada, lo que habilita su planteamiento en cualquier estadio del proceso y su conocimiento. Tal circunstancia no solo desvirtúa la tesis de la preclusión invocada, sino que además encuentra sustento en la propia conducta procesal de la parte accionante, quien, mediante la presentación del escrito supra mencionado, abrió el ámbito de cognición para su análisis, en ese sentido, no se aprecia que se haya producido una vulneración al principio de preclusión procesal. En consecuencia, la censura será rechazada.
IV.La parte casacionista alega varios aspectos con fundamento en el artículo 137 inciso d) del CPCA, que se pueden aglutinar en un apartado. En el cuarto motivo de casación refiere a la violación del artículo 64 del Código Procesal Civil y falta de motivación respecto de la identidad del objeto de los procesos. Señala que la resolución cuestionada incurre en errores, particularmente al analizar la cosa juzgada omite citar los actos impugnados en la demanda de AREBATICO y SITRAJAP en la demanda del año 2015, lo que genera una contradicción en su razonamiento, ya que sugiere que la sentencia del año 2012 valoró actos jurídicos surgidos posteriormente, como la viabilidad ambiental y la orden de inicio que ocurrieron en el año 2014, indica que esto evidencia un error de motivación que se solicita sea declarado. El quinto motivo, denuncia violación del artículo 64 del Código Procesal Civil por falta de motivación en cuanto a la identidad de la causa.
Señala que aunque la jueza afirma haber realizado un análisis profundo, no examinó los actos impugnados en ambas demandas, no comparó los motivos o causas de nulidad alegadas en cada expediente. Al omitir ese análisis, la resolución incurre nuevamente en un vicio de motivación y en contradicciones, por lo que se pide que así se declare. El sexto agravio, acusa la casacionista nuevamente violación del artículo 64 del Código Procesal Civil por falta de motivación, porque la jueza resolvió de forma errónea la excepción de cosa juzgada al afirmar que una demanda interpuesta en el año 2015 no podía presentarse porque ya existía una sentencia en 2019, lo cual resulta ilógico e imposible desde el punto de vista temporal y constituye otro defecto de motivación de la sentencia impugnada. Adicionalmente, apunta como séptimo agravio, falta de motivación para anular de oficio una resolución anterior.
Sostiene que el auto sentencia impugnado deja sin efecto una resolución dictada por el juez Herrera Valverde sin explicar dónde radicaba el supuesto error o vicio, destaca que esa resolución anterior era más detallada y realizaba un análisis más completo de los requisitos para declarar la cosa juzgada material conforme al artículo 162 del Código Procesal Civil vigente en ese momento, equivalente al actual artículo 64 del CPC y no justifica adecuadamente la anulación de oficio por ello, la resolución impugnada incurre también en un vicio de motivación.
V.La causal de falta de motivación, prevista en el artículo 137 inciso d), del Código Procesal Contencioso Administrativo, ha sido perfilada de manera constante por esta Sala en su jurisprudencia como un vicio de naturaleza estrictamente procesal, que se configura cuando la resolución jurisdiccional adolece de ausencia, insuficiencia o defectuosa estructuración de la fundamentación. Este defecto no se circunscribe únicamente a los supuestos de carencia absoluta de motivación, sino que también se materializa cuando el razonamiento judicial se presenta como oscuro, fragmentario, ambiguo o contradictorio, al punto de impedir la reconstrucción del iter lógico-jurídico seguido por la persona juzgadora para arribar a la conclusión contenida en la parte dispositiva del fallo. Una deficiencia de tal magnitud comporta, de manera directa, una afectación a las garantías procesales de las partes, singularmente al debido proceso, en su dimensión de derecho a obtener resoluciones debidamente fundadas, motivadas y congruentes.
En la especie, según la parte recurrente, la motivación de la resolución incurre en errores, particularmente al analizar la cosa juzgada cuando omite identificar los actos impugnados en la demanda del año 2015 y los actos jurídicos surgidos posteriormente, como la viabilidad ambiental de 2013, la orden de inicio de 2014 y señala vicio en la aplicación del artículo 64 del Código Procesal Civil por falta de motivación en cuanto a la identidad de la causa, ya que no examinó los actos impugnados en ambas demandas, ni comparó los motivos o causas de nulidad alegadas en cada expediente, además reitera el vicio del artículo 64 del Código Procesal Civil por falta de motivación, porque la jueza resolvió de forma errónea la excepción de cosa juzgada. Tal disconformidad no puede ser revisada a la luz de la causal procesal invocada, en tanto se trata esencialmente de un reproche de carácter sustantivo, mediante el cual se pretende generar la revisión de la aplicación del derecho al caso concreto.
En esa línea, resulta imprescindible evitar la confusión de esta causal con un mecanismo indirecto de revisión del juicio de mérito efectuado por el Tribunal. No le es propio, por tanto, servir de cauce para cuestionar la corrección en la interpretación o aplicación del derecho sustantivo, lo que cuenta con causales autónomas de impugnación conforme con lo dispuesto en el artículo 138 del CPCA, admitir lo contrario implicaría desnaturalizar la finalidad específica de este motivo casacional y desbordar los límites propios del recurso. Lo reprochado responde a una mera discrepancia de criterio, que no cabe ser revisada desde la vertiente procesal, en consecuencia, la censura será rechazada.
VI.En este cargo la parte actora aduce, que el Tribunal incurrió en el vicio previsto en el artículo 137 inciso d) y h) del CPCA, falta de motivación y errónea aplicación del artículo 193 del CPCA, considera que la resolución impugnada carece de justificación en cuanto a la condena en costas, a la Asociación de Rescate de Valores Patrióticos pese a que se reconoce la existencia de cosa juzgada material derivado de procesos en los que dicha organización no fue parte. Sostiene que esto constituye un sinsentido jurídico, puesto que la Asociación tenía razones válidas para litigar, dado que los argumentos y actos impugnados eran nuevos y distintos a los analizados en procesos anteriores. Asimismo, indica que los actos cuestionados en este proceso ocurrieron con posterioridad a las sentencias previas, por lo que no podían estar cubiertos por la cosa juzgada. Manifiesta que el recurso también critica la interpretación rígida del artículo 193, que considera la imposición de costas como automática y sin necesidad de motivación, lo cual estima inconstitucional por violar el debido proceso y el derecho de defensa, conforme a la jurisprudencia de la Sala Constitucional.
Además, invoca el artículo 8 de la Convención Americana sobre Derechos Humanos, que exige decisiones judiciales debidamente motivadas como parte del derecho a ser oído y que, bajo el principio de control de convencionalidad, afirma que esta obligación es vinculante. En conclusión, argumenta que la condena en costas sin motivación, aplicada tanto a la Asociación indicada como al SINTRAJAP en estas circunstancias, vulnera el debido proceso y el derecho de defensa, lo que conlleva la anulación de la sentencia que se impugna.
VII.Al referirse a la repercusión económica del proceso, el Tribunal dispuso: “De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, no se observa motivo para dispensar de la aplicación de la máxima de condena al vencido, ya que la parte actora sabía de antemano lo dispuesto dentro de los expedientes judiciales N°11-003975-1027-CA el cual fue acumulado con el N°11-001347-1027-CA y N.º 12-001630-1027-CA, por lo que es menester imponer ambas costas a la parte accionante vencida así como de los intereses legales, computados desde la firmeza de la resolución que fije el monto de las costas y hasta su efectivo pago, que deberán liquidarse en la fase de ejecución de sentencia”.
Del análisis de lo expuesto, no observa esta Sala la configuración del yerro argüido. Importa destacar que, por regla general, se condena al vencido al pago de las costas y solo por excepción, se le exonera de ese pago. En este caso, el Tribunal justificó la condenatoria en costas a cargo de la parte actora, por el simple hecho de ser la parte vencida y en ese razonamiento descansa su fundamentación, la cual resulta suficiente, puesto que no es necesario explicar los motivos de su criterio, toda vez que no se configuró ninguno de los supuestos de dispensa, contrario sería cuando, la autoridad judicial quiebra la regla general y exonera del pago de costas a la parte vencida, en esta hipótesis, sí surge el deber de sustentar las razones que mediaron en la decisión de aplicar los supuestos de exoneración. Sin embargo, no es esa la situación del subexamine y conforme con lo expuesto, esta Cámara no aprecia la falta de fundamentación aducida, ni violación de norma y por consiguiente, se impondrá el rechazo del cargo.
Casación por razones sustantivas
VIII.En cuanto a los motivos sustantivos de casación, el recurrente se fundamenta en el numeral 138 inciso c) del Código Procesal Contencioso Administrativo, puntualizando la incorrecta aplicación de la cosa juzgada por violación del artículo 64 del Código Procesal Civil. Sostiene que en la resolución impugnada se reconoce que no existe identidad de partes, ya que en el proceso actual intervienen la Asociación de Rescate de Valores Patrióticos y la Municipalidad de Limón como partes, quienes no participaron en los procesos anteriores y a pesar de ello, la jueza declara la existencia de cosa juzgada, lo cual -considera- una actuación arbitraria e ilegal, al desconocer un requisito esencial del artículo 64 del Código Procesal Civil sea, la identidad de partes. Por tanto, solicita que se declare que la sentencia incurre en este vicio. Además, señala como noveno agravio, nuevamente violación del artículo 64 del Código Procesal Civil, por falta de identidad de causa y objeto.
Argumenta que en el proceso anterior (sentencia No.0153-2012), el SITRAJAP planteó la nulidad de dos actos administrativos y los fundamentos de nulidad y en el proceso actual -afirma- que aunque algunos actos administrativos coinciden parcialmente, los motivos de nulidad y el sustento jurídico son distintos e incluso la propia jueza reconoce que existe un soporte fáctico y jurídico diferente; en consecuencia, sostiene que no se cumple el requisito de identidad de causa, por lo que no procede la cosa juzgada e implica la aplicación arbitraria e ilegal del artículo 64 del Código Procesal Civil. Adicionalmente, acusa como décimo motivo de casación, la violación al principio in dubio pro actione, el artículo 4.1 del Código Procesal Civil y del artículo 41 de la Constitución Política, con fundamento en el artículo 138 incisos c) y d) del Código Procesal Contencioso Administrativo. Señala que, la excepción de cosa juzgada material fue resuelta en resolución del año 2018 por el juez Herrera Valverde.
Sin embargo, sin justificación, la sentencia No.495-2023 deja sin efecto esa resolución, vuelve a analizar la excepción y procede a interpretar la normativa para admitir la excepción, buscando interpretar el artículo 64 del Código Procesal Civil de forma que busca denegar el acceso a la justicia, lo cual constituye un vicio grave en la sentencia y solicita su declaración.
IX.Esta Cámara debe indicar que el principio in dubio pro actione implica que, en caso de duda razonable sobre la admisibilidad de una acción o recurso, la persona juzgadora debe inclinarse por permitir su tramitación, en resguardo del derecho de acceso a la justicia consagrado en el artículo 41 de la Constitución Política. No obstante, dicho principio no es absoluto ni puede aplicarse de manera indiscriminada, ya que no obliga a admitir pretensiones cuando existe claridad normativa o cuando se incumplen presupuestos procesales esenciales. Su aplicación se limita a escenarios de incertidumbre interpretativa real, evitando rechazos por meros formalismos excesivos. En ese sentido, tratándose de la excepción de cosa juzgada material, este instituto constituye un límite legítimo al acceso a la justicia, en tanto responde a razones de seguridad jurídica y estabilidad de las decisiones judiciales. Por ello, cuando se acredita de forma clara la identidad de partes, objeto y causa, el juzgador debe acoger la excepción sin que resulte procedente invocar el principio in dubio pro actione o rechazarla en caso de que no exista dicha concurrencia y dependerá, del análisis del asunto, la determinación de su existencia o no, por ello no tiene cabida este principio para este asunto particular y en mérito de lo expuesto deberá rechazarse este cargo décimo.
X.Previo a entrar al análisis del cargo en cuestión, conviene precisar el alcance de la excepción objeto de examen, respecto de la cual, esta Cámara ha referido: “III.- (…) En este punto, es menester traer a colación lo dispuesto por este Órgano decisor sobre la cosa juzgada: “… cabe señalar que el instituto jurídico alegado, de acuerdo con lo establecido en el artículo 162 del Código Procesal Civil, tiene como efecto hacer indiscutible, en otro proceso, la existencia o inexistencia de la relación jurídica declarada, de modo que no podrá emitirse pronunciamiento alguno respecto a pretensiones que ya fueron definidas en otro litigio. De conformidad con el numeral 163 ibidem, las sentencias emitidas en proceso ordinario o abreviado, así como aquellas otras resoluciones señaladas en forma taxativa, producen la eficacia de la cosa juzgada material. Se halla limitada a la parte resolutiva del fallo, no obstante, el fundamento utilizado para arribar a ello (consideraciones), guarda un estrecho vínculo con la parte dispositiva, por lo que se hace frecuente que deba acudirse a dichas fundamentaciones para determinar qué se ha resuelto en realidad.
Tiene por finalidad, proteger la seguridad y la certeza jurídica, de modo que al existir resolución sobre una causa en particular, la misma no puede ser discutida en proceso ulterior, ergo, esta vinculación produce dos efectos de alcance procesal, uno de carácter negativo, que impide verter pronunciamiento de fondo respecto del tema ya debatido (exceptio rei iudicata) y otro de condición positiva, en virtud del cual el segundo pronunciamiento debe respetar lo que fue decidido en el primero, respecto de las cuestiones resueltas en aquel y se plantean en el segundo. En esta línea de exposición, es una consecuencia del proceso y de la voluntad manifestada en la Ley, empero, sus efectos trascienden indirectamente aquél y recaen sobre las relaciones jurídicas sustanciales. Lo anterior deriva de la inmutabilidad de la decisión jurisdiccional. Para que la sentencia incida en otro proceso mediante la cosa juzgada, es imprescindible que en ambos exista la convergencia de los presupuestos subjetivos y objetivos que le dan cabida, a saber: identidad de partes, causa y objeto (artículo 163 Ibídem).
Cuando uno solo de los elementos que componen esa triple identidad no esté presente entre ambos procesos, no podrá hablarse de cosa juzgada. El subjetivo, se refiere a las partes en el proceso. El límite subjetivo o identidad de partes se refiere a los sujetos que intervinieron en el proceso, a quienes debe tenérseles como partes en sentido formal (demandantes, demandados y terceros intervinientes). De ello se colige que lo relevante no es la identidad física de las partes, sino la identidad jurídica. Lo anterior es de suma importancia en tanto resulta inoponible una sentencia de la que se deduzca una presunta cosa juzgada, frente a quien no ha sido parte en el proceso; es decir, no se le pueden imponer las sujeciones y obligaciones derivadas de ella (en relación, sentencia no. 180 de las 9 horas 25 minutos del 23 de febrero del 2001). El objeto lo constituye el derecho reconocido, declarado o modificado en la sentencia, en relación con uno o varios bienes determinados, o la relación jurídica declarada, según el caso.
Ergo, no pueden producir cosa juzgada aquellos aspectos que no han formado parte del pronunciamiento, sea por no incluirse dentro de las pretensiones, o bien por no haber sido resueltos en sentencia. Empero, la cosa juzgada en cuanto al objeto se refiere, se extiende a aquellos puntos que sin haber sido materia expresa de la decisión jurisdiccional, por consecuencia necesaria o por depender indispensablemente de tal decisión, quedan resueltos tácitamente por su indiscutible accesoriedad con lo decidido. El segundo aspecto del límite objetivo es la identidad de la causa, sea, la situación de hecho enunciada en la demanda como fundamento de la pretensión. Está formada por el conjunto de hechos alegados como base de la demanda y su incidencia en la situación jurídica de quienes demandan. La existencia de cosa juzgada solo es posible cuando exista coincidencia de los tres elementos referidos.
Por ende, corresponde entonces analizar si en este caso se ha dado o no la identidad de esos elementos en la forma que propone el recurrente. No. 376 de 16 horas 20 minutos del 21 de junio de 2006” (no. 000281-F-S1-2017, de las 10 horas 10 minutos del 17 de marzo de 2017). Es necesario aclarar que actualmente el instituto de la Cosa Juzgada se encuentra contemplado en el ordinal 64 del Código Procesal Civil, sin embargo, lo reproducido mantiene su vigencia y además, se desprende que a fin de establecer la procedencia de la cosa juzgada material, es necesario realizar un análisis del asunto precedente respecto al actual, para verificar si se cumple con la triple identidad en lo tocante a sujetos, objeto y causa.
XI.En el sub examine, se impondrá el acogimiento parcial del recurso interpuesto, por cuanto la resolución impugnada evidencia una errónea e indebida aplicación del instituto de la cosa juzgada material, en contravención de los presupuestos normativos consagrados en el artículo 163 del Código Procesal Civil, actual ordinal 64 del Código Procesal Civil. En efecto, para que opere la cosa juzgada material se requiere la concurrencia de la denominada triple identidad: identidad de sujetos, de objeto y de causa. En esta línea, del análisis del expediente se desprende que el objeto del proceso de conocimiento tramitado en el expediente 11-001347-1027-CA, estriba en la determinación de validez de una serie de conductas administrativas que se han emitido dentro del procedimiento de licitación pública internacional 2009LI-000001-0200, que incluye el cartel de licitación y sus modificaciones, acto de adjudicación, contrato de concesión y sus adendas, refrendo contralor, entre otros.
Las pretensiones sometidas a conocimiento jurisdiccional en dicho expediente 11-001347-1027-CA fueron: “1. La nulidad del acto administrativo que adjudica la licitación internacional pública No. 2009LI-000001-00200 llamada "Cartel de licitación para la concesión de obra pública con servicio público para el diseño, financiamiento, construcción, operación y mantenimiento de la terminal de contenedores en puerto Moín" a favor de APM TERMINAL CENTRAL AMERICA B.V. Ello por cuanto: - la licitación se realizó violentando la normativa propia tanto de la ley de concesiones como de la ley de contratación, se hizo con un cartel que no cumplía con lo dispuesto por la Ley de Concesión de Obras Públicas con Servicios Públicos en su artículo 21 incisos 1, 2 y 3, cual era tener todos los estudios técnicos correspondientes que sustentaran la viabilidad económica y ambiental del proyecto a concesionar, además con violación a contrario sensu de las normas del 27 al 29, ambas inclusive de la ley de concesiones citada, pues en estas normas no se permite la modificación de la oferta luego de recibidas formalmente las ofertas y al modificar el cartel y las fechas de presentación de ofertas y no dar plazos adecuados.
Además al otorgar 15 concesiones o beneficios más a la empresa adjudicada, luego de la fecha de apertura de las ofertas, beneficios o concesiones que de haberse dado a conocer, pudieron permitir que otros interesados ofertaran. 2. De conformidad con el artículo 42 inciso b) del Código Procesal Contencioso Administrativo, solicito se declare nulo el acto administrativo que adjudica la licitación internacional pública No. 2009LI-000001-0200 llamada "Cartel de licitación para la concesión de obra pública con servicio público para el diseño, financiamiento, construcción, operación y mantenimiento de la terminal de contenedores en puerto Moín", a la empresa APM TERMINAL B.V., por carecer de una justificación del proceso licitatorio, de una motivación del acto administrativo, basado en reglas unívocas de la ciencia o la técnica por no tener los estudios técnicos como los estudios factibilidad ambiental y económico. 3.
Se condene a los demandados al pago de las costas personales y procesales causadas. Entendiendo por costas personales no solo las mandas judiciales para el pago de peritos, y honorarios de funcionarios judiciales, sino además los honorarios de abogado que corresponden según el arancel aplicable." Y en la presente litis: “1. De conformidad al artículo 42 incisos a y b del CPCA, respetuosamente solicito la declaración de disconformidad de las siguientes conductas administrativas con el ordenamiento jurídico y de todos los actos o las actuaciones conexas, así como la anulación de todos estos actos: a. La resolución número 274-2009-SETENA del 10 de febrero del 2009 que supuestamente otorgó la Viabilidad Ambiental Potencial. b. El Cartel de LICITACIÓN PÚBLICA CON INVITACIÓN INTERNACIONAL No 2009LI-00001-00200 de Concesión de Obra Pública con Servicios Públicos. c. El Acuerdo No 018-MOPT-H, del 1 de marzo del 2011, con el que el Poder Ejecutivo, adjudicó el proyecto al único oferente APM TERMINALS CENTRAL AMERICA B.V. d. El Decreto Ejecutivo 36443-MOPT-H de Interés Público. e. El acto de suscripción del contrato del día 30 de Agosto del 2011, por parte del Poder Ejecutivo, la Presidencia Ejecutiva de la Junta Administradora Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA) y las empresas APM TERMINALS MOÍN SOCIEDAD ANÓNIMA Y APM TERMINALS CENTRAL AMERICA B.V., derivado de la licitación pública internacional 2009LI-000001-00200 promovida para "Concesión de Obra Pública con Servicio Público para el Financiamiento, Diseño, Construcción, Operación y Mantenimiento de la Nueva Terminal de Contenedores de Moín". f. el(sic) acuerdo 5.1 de la sesión ordinaria 28-2011 del 24 de noviembre del 2011 en donde la Junta Directiva del Concejo Nacional de Concesiones (CNC) otorgó visto bueno para la firma de una adenda. g. El acuerdo No. 491-11 de la sesión ordinaria 41-2011, del 24 de noviembre del 2011 en donde la Junta Directiva de JAPDEVA aprueba la firma de una adenda, al contrato firmado el día 30 de Agosto del 2011. h. La adenda No. 1 al Contrato de Concesión de Obra Pública con Servicio Público para el Diseño, Financiamiento, Construcción, Operación y Mantenimiento de la Terminal de Contenedores de Moín, firmada el día 29 de noviembre del 2011 y suscrita por el Poder Ejecutivo, la Presidencia Ejecutiva de la Junta Administradora Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA), y las empresas APM TERMINALS MOÍN SOCIEDAD ANÓNIMA Y APM TERMINALS CENTRAL AMERICA B.V. derivado de la licitación pública internacional 2009LI -00000 1-00200. i. La suscripción del contrato del día 13 de febrero de 2012, entre la Administración concedente, (compuesta por el Poder Ejecutivo, el Ministerio de Obras Públicas y Transportes, el Concejo Nacional de Concesiones, el Ministerio de Hacienda y la Junta de Desarrollo Económico de la Vertiente Atlántica) junto con APM Termináis Moín, S.A, del el "Contrato de Concesión de Obra Pública con Servicio Público para el Diseño, Financiamiento, Construcción, Explotación y Mantenimiento de la Terminal de Contenedores de Moín. j. El oficio DCA-0692 de la División de Contratación Administrativa de la Contraloría General de la República que otorgó el Refrendo al contrato con APM TERMINALS. k. La Resolución 2523-2014-SETENA que otorgó la Viabilidad Ambiental al proyecto. l. La orden de inicio dada a la empresa APM TERMINALS MOÍN, otorgada mediante oficio UE-TCM-OF-0192-2014 m. La Resolución N° 0152-2015-SETENA del25 de enero del2015 y actos conexos. n. La Resolución N° 0166-2015 del 2 de febrero del 2015 y actos conexos. 2.
De conformidad al artículo 42 incisos c, d y f y el 99 incisos c y f de la Ley Orgánica del Ambiente, en caso de no declararse la nulidad de las anteriores conductas, respetuosamente solicito se ordene la cancelación de todas estos conductas y actos conexos, por los incumplimientos a las obligaciones legales y contractuales indicados en esta demanda; y se ordene la ejecución de la garantía ambiental y de construcción. 3. De conformidad al artículo 42 inciso i del CPCA, respetuosamente solicito Que se ordene a la Administración Pública, abstenerse de adoptar y ejecutar cualquier conducta que pretenda revivir esta concesión. 4. De conformidad al artículo 42 inciso e, g y j, del CPCA, y el 99 de la Ley Orgánica del Ambiente, respetuosamente solicito se condene a los demandados a demoler y o eliminar las obras efectuadas, a reparar el daño ambiental causado y a establecerles obligaciones compensatorias al daño causado. 5.
De conformidad al artículo 193, del CPCA, respetuosamente solicito se condene a los demandados al pago de las costas de este proceso, pues nosotros nos hemos vistos obligados a litigar en el presente asunto, para anular o cancelar los actos acá impugnados. 6. De conformidad al artículo 42 incisos f y g del CPCA, el 98 de la Ley Orgánica del Ambiente, el artículo 199 y siguientes de la LGAP y del 67 y siguientes de la Ley Orgánica de la Contraloría, al declararse con lugar esta demanda, respetuosamente solicitamos se ordene a la Contraloría General de la República, se realicen las investigaciones administrativas para sancionar y cobrar los daños y perjuicios a los funcionarios responsables de las nulidades o caducidades declaradas con esta demanda. 7. De conformidad al artículo 42 incisos f y g del CPCA, al declararse con lugar esta demanda, en caso de que el Tribunal considere pudo existir algún tipo de delito en los hechos y actos acá discutidos, respetuosamente solicito se testimonien piezas al Ministerio Público para su debida investigación.
PETITORIA SUBSIDIARIA. En caso de no poderse acoger las anteriores pretensiones, solicitamos al menos se concedan las siguientes: 1. De conformidad al artículo 42 incisos a y b del CPCA, respetuosamente solicito la declaración de disconformidad de las siguientes cláusulas del contrato con el ordenamiento jurídico y de todos los actos o las actuaciones conexas, así como la anulación de todos estos actos: a. Las cláusulas 4.1 y 9.1 del Contrato otorgado a la empresa APM TERMINALS mediante Acuerdo No 018-MOPT-H. b. El considerando Décimo Tercero del acuerdo No 018-MOPT-H de adjudicación 1 de marzo del 2011, en cuanto dispuso la obligación de la empresa APM TERMINALS a recontratar únicamente un 3% de los 1400 funcionarios de JAPDEVA que se verán afectados con esta concesión. 2. De conformidad al artículo 42 incisos c al d del CPCA, respetuosamente solicito se ordene a la empresa APM TERMINALS y sus contratistas, tramitar el uso de suelo municipal para todas las obras que se pretenden ubicar en el área de campamento, especialmente de la planta industrial de fabricación de estructuras de cemento y la infraestructura del área de abastecimiento de combustibles con ocasión de la concesión de la TCM. 3.
De conformidad al artículo 42 incisos c al d del CPCA, respetuosamente solicito se ordene a la empresa APM TERMINALS y sus contratistas, tramitar los permisos constructivos municipales con los planos respectivos, para todas las obras que se pretenden ubicar en el área de campamento, especialmente de la planta industrial de fabricación de estructuras de cementó(sic) y la infraestructura del área de abastecimiento de combustibles con ocasión de la concesión de la TCM. 4. De conformidad al artículo 42 incisos c al d del CPCA, respetuosamente solicito se ordene a la empresa APM TERMINALS y sus contratistas, realizar el pago por la obtención de los derechos constructivos municipales para la construcción del área de campamentos, especialmente de la planta industrial de fabricación de estructuras de cemento y la infraestructura del área de abastecimiento de combustibles con ocasión de la concesión de la TCM. 5.
De conformidad al artículo 42 incisos c al d del CPCA, respetuosamente solicito se ordene a la empresa APM TERMINALS y sus contratistas, realizar el pago del canon por la utilización de 10 hectáreas en la Zona Marítimo Terrestre para la construcción del área de campamentos, especialmente de la planta industrial de fabricación de estructuras de cemento y la infraestructura del área de abastecimiento de combustibles con ocasión de la concesión de la TCM. 6. De conformidad al artículo 42 incisos c al d del CPCA, respetuosamente solicito se determine si ha existido incumplimiento por parte de la empresa APM TERMINALS en sus obligaciones de ejecución del contrato, o de la administración en sus obligaciones de control, y se apliquen las multas por los incumplimientos detectados. 7. De conformidad al artículo 42 inciso j, del CPCA, respetuosamente solicito se condene a la ejecución de la garantía ambiental, y a los demandados a demoler las obras ilegales, así como a reparar el daño ambiental causado. 8.
De conformidad al artículo 193, del CPCA, respetuosamente solicito se condene a los demandados al pago de las costas de este proceso, pues nosotros nos hemos vistos obligados a litigar en el presente asunto, para anular los actos acá impugnados. 9. De conformidad al artículo 42 incisos f y g del CPCA, el 98 de la Ley Orgánica del Ambiente, el artículo 199 y siguientes de la LGAP y del 67 y siguientes de la Ley Orgánica de la Contraloría, al declararse con lugar esta demanda, respetuosamente solicitamos se ordene a la Contraloría General de la República, se realicen las investigaciones administrativas para sancionar y cobrar los daños y perjuicios a los funcionarios responsables de las nulidades o caducidades declaradas con esta demanda. 10. De conformidad al artículo 42 incisos f y g del CPCA, al declararse con lugar esta demanda, en caso de que el Tribunal considere pudo existir algún tipo de delito en los hechos y actos acá discutidos, respetuosamente solicito se testimonien piezas al Ministerio Público para su debida investigación”.
En este punto puede observarse la identidad parcial con el petitum deducido en la litis anterior, véase que en el proceso primigenio la parte accionante fue genérica en la pretensión, sin embargo, el análisis del asunto implicó un estudio completo del cartel de licitación, sus modificaciones, así como del acto de adjudicación, contrato de concesión y sus adendas, además del refrendo contralor, los estudios de impacto ambiental, entre otros y la sentencia No. 0153-2012-VI, de las ocho horas cuarenta y cinco minutos del seis de agosto del dos mil doce del Tribunal Contencioso Administrativo, determinó finalmente: “Respecto de la demanda planteada por el Sindicato de Trabajadores de JAPDEVA (expediente No. 11-3975-1027-CA): Se rechaza la defensa de falta de legitimación activa formulada por la Contraloría General de la República. Se acoge la defensa de falta de legitimación pasiva opuesta por la Contraloría General de la República y la Autoridad Reguladora de los Servicios Públicos.
Se omite pronunciamiento por innecesario sobre la defensa de falta de derecho opuesta por el órgano contralor y el mencionado ente regulador. Se acoge en su totalidad la defensa de falta de derecho opuesta por la empresa APM Terminal Central América B.V., el Estado, el Consejo Nacional de Concesiones, la Junta de Administración Portuaria de la Vertiente Atlántica (JAPDEVA). En consecuencia, se declara sin lugar en todos sus extremos la demanda incoada por el Sindicato de Trabajadores de JAPDEVA contra las empresas APM Terminal Central América B.V y APM Terminals Moín S.A., el Estado, el Consejo Nacional de Concesiones, la Junta de Administración Portuaria de la Vertiente Atlántica (JAPDEVA), la Autoridad Reguladora de los Servicios Públicos y la Contraloría General de la República…”. De manera que, del estudio detallado del asunto, se tiene que no fue conocido en el proceso anterior, la resolución 2523-2014-SETENA que otorgó la Viabilidad Ambiental al proyecto, puesto que fue posterior, es lo cierto que la sentencia mencionada, se pronunció sobre la viabilidad ambiental potencial del proyecto de la Terminal de Contenedores de Moín (TCM) pero no de la Viabilidad Ambiental y por tanto, no existe identidad en este punto particular y de forma conexa se deberá circunscribir el proceso a dicho acto administrativo y a las pretensiones 2, 3, 4, 5, 6 y 7 en cuanto al acto administrativo citado.
Respecto de las pretensiones subsidiarias, no existe identidad con aquellas relacionadas con los permisos municipales, lo relativo al canon, la eventual ejecución de garantía ambiental y las pretensiones subsidiarias 8, 9, 10. En síntesis, existe coincidencia parcial en cuanto al objeto. Relativo a la causa petendi es distinta, específica y únicamente en cuanto a lo señalado en líneas precedentes, pues los fundamentos fácticos y jurídicos que sustentan la presente demanda, en cuanto a las pretensiones no coincidentes con el proceso 11-001347-1027-CA (acumulado 11-003975-1027-CA) y por ende, no conocidas en la sentencia No. 0153-2012-VI, son distintas, toda vez que la fundamentación expuesta por la parte actora en su escrito de demanda, desarrolla los siguientes argumentos: respecto a la Viabilidad Ambiental, restricciones en la zona marítimo terrestre, la falta de permisos municipales, falta de pago de cánones municipales por uso de zona marítimo terrestre, pago de impuestos municipales por permiso y derechos de construcción y viabilidad ambiental por falta de permisos de explotación de tajos y compromisos adquiridos, en lo demás si existe coincidencia con el proceso anterior.
Por último, respecto a la identidad subjetiva, es lo cierto que la Asociación de Rescate de Valores Patrióticos y la Municipalidad de Limón, no intervinieron en la litis conocida en el expediente 11-001347-1027-CA, el primero como parte actora y el segundo como parte demandada. Ahora bien, la Municipalidad demandada forma parte del proceso debido únicamente a las pretensiones subsidiarias, que no forman parte del proceso primigenio conforme como se puntualizó, es claro que no existe pretensión principal deducida en su contra. En cuanto a la Asociación si bien, no formó parte de la litis anterior, es claro que no resulta jurídicamente admisible que, mediante la incorporación de un actor adicional, se pretenda eludir los efectos del instituto de la cosa juzgada, reabriendo un debate que ya ha sido debidamente zanjado; en otros términos, no es procedente prohijar este tipo de acciones orientadas a reabrir asuntos ya resueltos, puesto que ello implicaría un uso indebido del proceso y una afectación directa a los principios de seguridad jurídica y de estabilidad de las decisiones judiciales.
En consecuencia, conforme a lo dispuesto en el entonces artículo 163 del Código Procesal Civil y artículo 64 del Código Procesal Civil vigente, lo resuelto adquiere carácter definitivo, vinculante e inmutable, impidiendo que la misma cuestión sea nuevamente sometida a conocimiento judicial, aun bajo la apariencia de una nueva parte adicional que también es representada por el mismo abogado. En consecuencia, se acogerá parcialmente el recurso de casación interpuesto por la parte actora, al configurarse de forma parcial la triple identidad de los presupuestos para la procedencia del instituto de la cosa juzgada, así las cosas, resulta jurídicamente procedente anular parcialmente la resolución N° 495-2023 de las diez horas y treinta minutos del trece de abril del dos mil veintitrés recurrida, en cuanto acogió la defensa de cosa juzgada y declaró inadmisible las pretensiones formuladas en la demandada, en su lugar se acogerá parcialmente la defensa previa de cosa juzgada en los términos indicados.
POR TANTO
Se declara parcialmente con lugar el recurso planteado por la parte actora. En consecuencia, se anula parcialmente el pronunciamiento del Tribunal N° 495-2023 de las diez horas y treinta minutos del trece de abril del dos mil veintitrés, en cuanto acogió la defensa de cosa juzgada material y declaró inadmisible la demanda. En su lugar, se acoge parcialmente la defensa previa de cosa juzgada y se dispone el reenvío del asunto para que continúe con el trámite respectivo en cuanto las pretensiones primera relacionada con el acto administrativo descrito en el punto k), sea la resolución 2523-2014-SETENA que otorgó la Viabilidad Ambiental al proyecto y de forma conexa se deberá circunscribir las pretensiones 2, 3, 4, 5, 6 y 7 a dicho acto administrativo, también en cuanto las pretensiones subsidiarias relacionadas con los permisos municipales, lo relativo al canon, la eventual ejecución de garantía ambiental y además de las pretensiones subsidiarias 8, 9, 10. – Akah Luis Guillermo Rivas Loaiciga Rocío Rojas Morales Damaris Vargas Vásquez Jorge Leiva Poveda Carlos Guillermo Zamora Campos 1
