Res. 000895-F-S1-2026 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at nine hours and thirty-two minutes on the twenty-sixth of June of two thousand and twenty-six.
Plenary proceeding (proceso de conocimiento) brought by the MUNICIPALITY OF SAN RAFAEL DE HEREDIA, represented by its Mayor, Verny Valerio Hernández, national identity card (cédula de identidad) 1-0902-0177, against the INSTITUTO COSTARRICENSE DE ELECTRICIDAD (ICE), represented by Marys Palacios Carrillo, national identity card 8-0790-1189; the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), represented by Andrés Alvarado Ramírez, professional license card (carné profesional) 24211; and the STATE, represented by Attorney Alonso Arnesto Moya, national identity card 1-0884-0748. The matter was processed under expediente 12-000631-1028-CA and the consolidated expediente 16-000104-1027-CA, both including a counterclaim (reconvención) filed by the State. The representatives of the STATE and of the INSTITUTO COSTARRICENSE DE ELECTRICIDAD filed appeals on points of law (recursos de casación) against judgment number 11-2023-V, issued at 15:30 hours on February 15, 2023, by the Administrative and Civil Tax Court (Tribunal Contencioso Administrativo y Civil de Hacienda), rendered by the adjudicators Ileana Isabel Sánchez Navarro, Marianella Álvarez Molina, and Juan Luis Giusti Soto.

WHEREAS
I.The Administrative and Civil Tax Court, by judgment No. 11-2023-V issued at 15:30 hours on February 15, 2023, ruled: "The evidence submitted for better adjudication offered by the State is admitted. The request for withdrawal (desistimiento) filed by the legal representative of the Municipality of San Rafael de Heredia is granted, and the plenary proceeding brought by it against the Instituto Costarricense de Electricidad, the Sistema Nacional de Áreas de Conservación, and the State is declared terminated. That matter is resolved without a special award of costs. In the counterclaim filed by the State against the Municipality of San Rafael de Heredia, the defense of lack of right (falta de derecho) submitted by the Municipality is sustained, and the counterclaim is dismissed. The costs of the counterclaim shall be borne by the State" (see images 637 to 652 of the court file). Against said ruling, the State's representative filed an appeal on points of law on grounds of both procedural and substantive defects in the judgment; for its part, the representative of the Instituto Costarricense de Electricidad raised substantive defects.

II.With respect to the first argument, the State alleges a violation of due process (debido proceso) on the ground that the challenged judgment introduces novel factual elements to the detriment of the State's right of defense, thereby incurring a defect of incongruence (vicio de incongruencia). It contends that the judgment violates due process and its essential elements, giving rise to the appeal pursuant to articles 16, 57, 95, 119 subsection 1), 137 subsections 1.b) and 1.h), and 220 of the Code of Administrative Contentious Procedure (Código Procesal Contencioso Administrativo), in relation to articles 32.1 and 61.2 of the Code of Civil Procedure (Código Procesal Civil). The appeal is grounded in the violation of due process and the State's right of defense, since the challenged judgment introduced novel factual elements that were not raised by the parties, thereby incurring a defect of incongruence for ruling beyond the scope of the petition (extra petita).
The State argues that this conduct breaches the essential principles governing the judicial function and gives rise to annulment of the judgment pursuant to the Code of Administrative Contentious Procedure and the Code of Civil Procedure. It maintains that the trial court held that the State had not proven that the property in dispute was not privately owned prior to Decree-Law 65 of 1888 and that the State held dominion (dominio) over it, and furthermore that MINAE had failed in its duty to delimit the inalienable zone (zona inalienable). Those arguments were used to dismiss the counterclaim and uphold the defense of lack of right, even though they were never raised by the Municipality in its complaint, its answer, its exceptions, or its closing arguments — and indeed, that party had been declared in default on the counterclaim in the consolidated case. The incorporation of these facts by the adjudicators was done on their own initiative, without affording the parties an opportunity to respond, making them surprise elements extraneous to the procedural debate.
Art. 95 of the Code of Administrative Contentious Procedure permits the expansion of legal grounds, but requires that parties be given a period to respond — a safeguard that was omitted in this case, directly prejudicing the State's right of defense. Consequently, the judgment incurs a clear defect of incongruence by deciding issues not submitted to adversarial proceedings (Art. 137.1.h del CPCA), a situation that the settled case law of the Court of Cassation has classified as extra petita and that entails the absolute nullity of the judgment. Had due process been respected, the State would have been able to demonstrate that the constitutional judgments relating to the delimitation of the inalienable zone were duly complied with, that said delimitation was carried out between 2012 and 2014, and that the Constitutional Chamber itself acknowledged compliance. It would also have been shown that the property falls within the protected zone, a fact that the challenged judgment itself takes as established.
Additionally, the State would have been able to rebut the assertion regarding the failure to prove State ownership, since that ownership derives directly from legal norms that establish a presumption in favor of the State over property not registered in the name of private parties, shifting the burden of proof to whoever claims a different right; this is so because the primordial or original dominion of the State predates any private holding, and in this case the Municipality raised no exception based on such factual circumstances. Finally, the counterclaim did not seek to annul the registry registration but rather to require application of Art. 13 of the Ley Forestal, as in force at the time the property was registered in the name of the Municipality. By rendering judgment without a hearing or any opportunity to debate facts introduced on the court's own initiative, the principles of due process and congruence were violated, which justifies annulment of the judgment so that the trial court may re-adjudicate in conformity with the factual framework defined by the parties.
III.From an analysis of the judgment it is established that the decision rested on two grounds. The first held that it is legally valid for registered property (inmueble) No. 156766 to be registered in the name of the Municipality of San Rafael de Heredia, on the basis that the Municipality holds the status of a Public Administration entity pursuant to Art. 1 of the General Law of Public Administration (Ley General de la Administración Pública), No. 6227, and that the Ley Forestal, No. 7575, contains no prohibition against local governments appearing as registered title holders (titulares registrales) of properties forming part of the Natural Heritage of the State (patrimonio natural del Estado). On the contrary, the very text of the law — Art. 13 — expressly acknowledges that such heritage may encompass lands "belonging to municipalities," which demonstrates that the legislature admitted the possibility of municipal entities holding registered title to this type of property.
The judgment likewise provides that the legislation contemplates that lands shall be registered in the name of the State "where applicable (cuando proceda)," a phrase that denotes a criterion of application that is neither automatic nor uniform, but rather conditioned on the legal particularities of each case. Accordingly, not all properties forming part of the Natural Heritage need necessarily be registered in the name of the State; they may remain — as appropriate — in the name of municipalities or other public entities, provided they are duly registered in the Real Estate Registry (Registro Inmobiliario) of the National Registry and were acquired through valid legal means. Note the judgment's statement: "Now, that registered ownership of the property by the municipalities and other public administrations, and in this case by the Municipality of San Rafael de Heredia, is not inconsistent with its designation, by its nature, as Natural Heritage of the State, and therefore does not preclude the authority of the State, and specifically of MINAE, to exercise administration over such heritage"; that is to say, although the judgment acknowledges that the municipality retains registered title, it determines that administration of the Natural Heritage is a prerogative of MINAE, which is not inconsistent with its designation — quite the contrary, it accords with Art. 13 of the Ley Forestal itself, which expressly provides: "MINAE shall administer the heritage," and with Art. 32 of the Organic Environmental Law (Ley Orgánica del Ambiente).
Second, the judgment states that in ruling No. 12109-2008 of the Constitutional Chamber, a prolonged omission by the State in the delimitation, oversight, and recovery of zones declared inalienable by Decree-Law No. 65 of 1888 was established as proven, attributable in particular to MINAE; and moreover that even in that context and in the — unaccepted — scenario that the property must be formally incorporated into the State domain, this would only be legally viable through an expropriation procedure, since the parcel (finca) has been registered in the name of the Municipality of San Rafael de Heredia since 1997, with no record of the State having previously exercised dominion prior to the cited norm. At this point it is appropriate to make a legally significant clarification: before addressing its analysis of the second ground, the judgment expressly states: "Now, without prejudice to the fact that the reasons set out are sufficient to dismiss the State's claim that the Municipality of San Rafael de Heredia be ordered to transfer parcel No. 156766 to the State's name." This statement makes unmistakably clear that the adjudicating body considered the first ground developed to be autonomous, complete, and legally sufficient to dismiss the claim formulated by the State in its counterclaim; consequently, the decision unfavorable to the State was fully supported by that first line of reasoning, without any need to resort to additional arguments to reach the conclusion of the judgment.
Under this perspective, the second ground analyzed by the judgment did not constitute a decisive or determinative element of the ratio decidendi, but was incorporated as a complement, without any real bearing on the final outcome of the judgment. Therefore, that reasoning lacks causal effect with respect to the result of the proceedings, since it was not indispensable to the formation of the judicial decision under review, and this Chamber finds no defect of due process or right of defense; in any event, the fact remains that the State did not prove that it had been the possessor or owner of the property — it merely made arguments to that effect.
IV.In this first ground of error, the State's representative also challenges defects of incongruence in the judgment for extra petita, contending that the court "…could not decide on matters not sought in the counterclaim or not raised in the exceptions, based on facts adduced in the adversarial proceedings, without thereby incurring the defect of extra petita…" and that the State had no opportunity to rebut the novel factual arguments — along with the corresponding submission of evidence — centering its argument on the fact that constitutional ruling 12109-2008 was supplemented by ruling 412-2011 of January 14, 2011, and that MINAE began the physical delimitation of the inalienable zone in 2012, which concluded in 2014, the year in which steps were taken to recover the lands; therefore, it is argued, it is untenable for the trial court to deny the counterclaim by asserting, in 2023, that the inalienable zone has not been delimited.
Furthermore, the State contends that it is erroneous to assert that the State's dominion over property 4-156766-000 prior to Decree-Law 65 of 1888 was not proven. This Chamber notes that the State's representative conflates procedural grievances with substantive matters, which impedes resolution of the appeal and departs from proper appellate technique; however, it must be noted that such argumentation lacks merit. The defect of incongruence consists of a discrepancy between what is sought by the acting party and what is granted by the decision-maker. It may occur when a ruling omits a decision on a matter submitted for adjudication (infra petita), when it grants more than what was sought (ultra petita), when what is decided does not correspond to what was petitioned (extra petita), or when the ruling contains contradictory provisions. For this ground to succeed, the described inconsistency must appear in the operative part (parte dispositiva) of the judgment, not in its reasoning section (parte considerativa).
In order to determine the existence of this infraction, the facts invoked as the basis for the petition must be taken into account, since incongruence is understood in terms of the cause of action expressed therein; see, in this regard, this Chamber's rulings No. 942-F-S1-2020 of 10:40 hrs. of March 19, 2020; No. 01301-2023 of 09:22 hrs. of July 27, 2023; and No. 00018-2024 of 10:15 hrs. of January 11, 2024. Furthermore, it should be noted that the court found the following as established facts: "3. That parcel No. 156766-000 is the result of the consolidation of parcels No. 115703-000, 115704-000, and 115705-000, and they originate from parcel 5050346000 (same prior evidence). 4. That the nature of the land of parcel No. 156766 is forest reserve and 'is encumbered by the Ley Forestal, given that it is largely located within the Reserva Forestal Cordillera Volcánica Central and to a lesser extent within the Parque Nacional Braulio Carrillo, as shown by the plans thereof' (see prior evidence). 5.
That parcel No. 156766-000 was registered in the name of the Municipality of San Rafael de Heredia on August 27, 1997 (same prior evidence)," and as a consequence, the counterclaim was dismissed. Therefore, the arguments raised by the appellant lack merit and cannot be considered a defect of incongruence, since this Chamber has consistently held that a fully dismissive judgment cannot be challenged on grounds of incongruence. Along these lines, it has been held: "When a judgment dismisses the claims of the complaint and all other pretensions asserted by the litigants (a fully dismissive judgment), as occurs in this matter, it cannot properly be said that the adjudicator has failed to rule on something that was requested, or has exceeded its authority by ruling ultra or extra petita, because in reaching that conclusion the adjudicator has in fact decided on the merits — only in the negative — on all matters raised.
That is, a fully dismissive judgment cannot be challenged for incongruence, since in such a decision it is impossible to identify any of the cases in which the defect arises, namely: deciding on matters not sought (extra petita), deciding on more than what was sought (ultra petita), or deciding on less than what was sought (infra petita). (Ruling No. 948 of 9 hours 40 minutes of August 12, 2010, and ruling 476–2011 of 11 hours 25 minutes of April 7, 2012)," as repeated in ruling No. 666-2021 of 15 hours 35 minutes of March 18, 2021 of the First Chamber; accordingly, this ground of error must be rejected.
Appeal on points of law on substantive grounds
V.The ground of appeal is based on improper application and failure to apply substantive law pursuant to Art. 138 subsection c) of the CPCA. The appellant argues the failure to apply Art. 13 of the Ley Forestal, as well as Art. 45 of the Constitution, the Expropriation Law (Ley de Expropiaciones), and the General Law of Public Administration. The appellant maintains that the challenged judgment adopted the municipality's argument that its property could not be transferred to the State without a prior expropriation process, on the ground that Art. 13 of the Ley Forestal permits parcels forming part of the Natural Heritage of the State to be registered in the name of other public entities. Based on that interpretation, the court held that registration in favor of the State was not mandatory in all cases and that, therefore, an expropriation procedure was required, relying on precedent 314-F-S1-2021 of the First Chamber.
On that basis, the judgment denied the counterclaim filed by the State; however, the appellant considers that interpretation erroneous, since public properties forming part of the Natural Heritage of the State — even when registered in the name of municipalities — must be registered in the name of the State when they contain forest or possess forestry suitability (aptitud forestal), as is the case here. The appellant submits that this is the correct interpretation of Art. 13, second paragraph, of the Ley Forestal, in accordance with constitutional case law, since membership in the State's heritage is indispensable to ensure its proper planning, administration, conservation, and self-protection of public domain assets (autotutela demanial). The appellant insists that the precedent cited by the court is not applicable, since that case concerned a property legitimately registered in the name of a private party, whereas in the present proceeding the property belongs to a public entity and is located primarily within protected areas, so that it fully forms part of the Natural Heritage of the State.
The appellant contends that in such cases expropriation does not apply but rather the administrative transfer of the property, as expressly provided by the Ley Forestal; and that the expression "where applicable (cuando proceda)" contained in Art. 13 does not confer discretion on the State, nor does it make the transfer conditional on the will of the titleholder — rather, it must be understood in a legal sense: registration is applicable when the land can be registered as an individualized parcel. There are cases in which registration is not applicable, such as with large inalienable tracts encumbered as a whole, but this does not apply to specific parcels with forest cover (cobertura boscosa) registered in the name of lesser public entities. The appellant considers that only in cases of properties legitimately belonging to private parties would it be necessary to resort to expropriation or direct purchase, and when registration is irregular, nullification of the title proceeds without indemnification liability for the State, as has been repeatedly recognized by administrative and constitutional case law.
Consequently, the appellant concludes that the challenged judgment incurred an erroneous interpretation of substantive law by improperly requiring an expropriation process and denying the transfer provided for in Art. 13 of the Ley Forestal, thereby constituting the ground of cassation provided in Art. 138 subsection c) of the CPCA, which requires reversal of the judgment and a ruling in favor of the counterclaim in all its aspects.
VI.The State's argument has two perspectives and proceeds from Art. 13 of the Ley Forestal: on one hand, it maintains that Natural Heritage of the State found on public properties containing forest or possessing forestry suitability must be registered in the State's name even when registered in the name of municipalities. On the other hand, it maintains that in such cases expropriation does not apply but rather administrative transfer of the property, and that the expression "where applicable (cuando proceda)" in Art. 13 of the Ley Forestal must be understood to mean that registration is applicable when the land can be registered as an individualized parcel. In order to determine whether the challenged judgment involves an improper application and/or failure to apply substantive law, it is appropriate to reproduce the provision in its entirety: "ARTICLE 13. — Constitution and administration.
The Natural Heritage of the State shall comprise the forests and forest lands of the national reserves, of the areas declared inalienable, of the parcels registered in its name, and of those belonging to municipalities, autonomous institutions, and other bodies of the Public Administration, except for properties securing credit operations with the National Banking System (Sistema Bancario Nacional) that enter into their patrimony. / MINAE shall administer the heritage. Where applicable, through the Procuraduría General de la República, it shall register the lands in the Public Property Registry (Registro Público de la Propiedad) as individualized parcels of State property. / Non-governmental organizations that acquire real property with forest or of forestry suitability, using funds from donations or from the public treasury, obtained in the name of the State, shall transfer them to the State's name" (underlining not in the original).
This article thus expressly recognizes that the Natural Heritage of the State may comprise forests and forest lands belonging to municipalities, autonomous institutions, and other entities of the Public Administration, which implies a broad legal conception of public environmental domain. This provision confirms that formal ownership of the property does not constitute the determining element for its incorporation into the Natural Heritage of the State; rather, the defining criterion is its legal designation for the public purpose of conservation, and when the conditions provided by the Ley Forestal are met, such properties will be subject to its special protection regime. Accordingly, municipal corporations in their capacity as autonomous territorial entities pursuant to Art. 170 of the Constitution shall exercise ownership of the property within the limits imposed by the national public interest in environmental matters.
This situation does not imply a conflict between municipal autonomy and state public domain; on the contrary, it constitutes a manifestation of the principle of unity of the public environmental heritage. Under this reasoning, there is no legal confrontation between municipal property and state administration when a property belonging to a municipality forms part of the Natural Heritage of the State under Art. 13 of the Ley Forestal — rather, a normative articulation takes shape under the principle of State unity. In this scenario, the law does not transfer registered ownership (titularidad dominical) of the property from the municipal entity to the central State, but instead subjects the property to a special legal protection regime of national scope that prevails over local autonomy by reason of the superior public interest at stake. A legal dissociation is produced between registered ownership and functional competence: while the municipality retains registered title to the property, the State — through MINAE — exercises environmental leadership and the authority to regulate, control, and supervise, derived from the pro-environment principle and the constitutional duty of the State to guarantee a healthy and ecologically balanced environment; this is further consistent with Art. 3 of the Regulation to the Ley Forestal (Reglamento a la Ley Forestal), which provides: "MINAE shall be the head of the Forestry Sector and shall carry out its functions through SINAC…" and with this Chamber's judgment No. 1239-S-S1-2020 of 11 hours 50 minutes of March 31, 2020, so that the municipal corporation must observe the restrictions of the Ley Forestal and the guidelines of SINAC as administrator.
This distribution of competencies does not in any way imply subordination or loss of municipal autonomy; on the contrary, it constitutes a manifestation of the principle of administrative coordination of a cross-cutting nature in environmental protection. Under this reasoning, Art. 13 of the Ley Forestal does not establish a confrontation between municipal property and state property; it recognizes a legitimate and valid limitation on the exercise of municipal property rights, grounded in the environmental public interest, which responds to the ecological State model adopted by the Costa Rican legal order. Another element of particular relevance is Art. 14 of the said law, which expressly provides that forest lands and forests forming part of the Natural Heritage of the State shall be non-attachable (inembargables) and inalienable, establishing that possession exercised by private parties shall generate no rights in their favor and that the State's revindicatory action (acción reivindicatoria) with respect to such property is imprescriptible.
From a reading of this provision it is apparent that the legislature expressly introduces a distinction only with respect to possession exercised by private parties, without extending that prohibition to municipalities, autonomous institutions, or other bodies forming part of the Public Administration, which is legally determinative in light of the criterion of statutory interpretation. Indeed, the norm conceives of the State as a legal unit, even when organized under schemes of administrative or territorial decentralization, and under no circumstances can such entities be considered third parties. Consequently, the correct interpretive approach (hermenéutica) to the provision leads to the conclusion that the legislature did not intend to exclude municipalities from the possibility of carrying out acts of administration or management of properties of the Natural Heritage of the State, which constitutes a coherent manifestation of the principle of legality and the principle of State unity, pursuant to which the Natural Heritage is not fragmented — which is characteristic of its special legal regime.
VII.Regarding the State's assertion that expropriation does not apply but rather the administrative transfer of the property, and that the expression "where applicable" in Art. 13 of the Ley Forestal must be understood to mean that registration is applicable when the land can be registered as an individualized parcel: this Chamber considers that the appellant's position is not correct, because the property under analysis bears the character of a public domain asset (bien integrante del dominio público) and the Municipality of San Rafael de Heredia currently holds registered title to the property in a valid manner as set forth in the preceding Whereas clause. In this context, the expression "where applicable (cuando proceda)" contained in Art. 13 of the Ley Forestal cannot be interpreted in a merely factual-registry sense, limited solely to the possibility of individualizing the property as a parcel, but must rather be analyzed in conformity with the literal text of Art. 13 of the Ley Forestal; no valid or sufficient legal condition enabling the registry transfer of the property to the State can be derived therefrom, inasmuch as the municipality holds possession and registered title to the property in a legitimate manner in harmony with the normative framework established in the cited legal provision.
Consequently, registration of the property in favor of the State is not warranted, since it would imply disregarding a validly constituted registered title and violating the principle of registry legality (principio de legalidad registral), without prejudice to the fact that, in the event the State seeks to acquire dominion over the property, it must necessarily resort to the legally authorized legal avenues, with full respect for the due process governing the matter, as indicated by the judgment under review. In addition to the foregoing, this ground of error must be rejected.
VIII.The State also alleges a violation of Articles 193(b) and 197(2) of the CPCA, on grounds of improper assessment of the record, by exempting the defendant Municipality from costs on the principal claim and imposing them on the State with respect to the counterclaim. The State argues that the justification offered for the withdrawal—namely, attributing responsibility to the former mayor and invoking inaccurate information—is inconsistent, particularly given that the same attorney-at-law authenticated both complaints and the withdrawal. These circumstances, it contends, demonstrate a lack of good-faith standing (buen derecho) and of procedural loyalty (lealtad procesal), which warranted a costs award against the Municipality pursuant to Art. 197.2 of the CPCA, a point the Tribunal improperly disregarded. The State further considers that the economic consequences of the withdrawal motion should be reversed on the ground that there is sufficient merit to impose both categories of costs against the Municipalidad de San Rafael de Heredia—a provision that the trial court infringed as a result of its erroneous reading of the consolidated case files, which contain evidence of the abusive conduct and omissions of that local government entity in both proceedings.
On the other hand, the State argues that the same Tribunal violated Art. 193(b) of the CPCA by failing to apply it when it imposed on the State the costs of the counterclaim. The State submits that the record demonstrates that the nature of the issues in dispute—namely, the defense of the Natural Heritage of the State (Patrimonio Natural del Estado)—justifies and constitutes sufficient grounds for litigating and for having filed the counterclaim. It indicates that the counterclaim was aimed at defending the Natural Heritage of the State, a constitutional and legal duty derived from Article 50 of the Constitución Política and from Articles 1 and 13 of the Ley Forestal, which require the State to ensure the conservation, protection, and administration of forests and to promote the registration of forest lands in its name. Accordingly, the State submits that it should not bear the costs of the counterclaim as ordered in the challenged judgment, and likewise petitions this Chamber of Cassation to reverse that ruling.
IX.With respect to the point argued regarding the exemption from costs on the claim filed by the Municipalidad de San Rafael de Heredia, the challenged judgment bases that exemption on the fact that the Municipalidad de San Rafael is the registered owner of property N°156766 in the Province of Heredia since August 27, 1997, and found it proven that the predecessor parcels are fincas 115703, 115704, and 115705. It also found that the land is forest in nature, subject to the Ley Forestal, and that it was not disproven that ICE's works are located on a parcel different from N°156766. It is for this reason that the judgment rests on the finding that there were sufficient grounds to file the complaint, and it was alleged—in ICE's answer—that said property must be transferred to the State's name and removed from the Municipality's patrimony, since the Municipality had given its approval for the construction of the works.
The judgment further notes that "regardless of whether [the Municipality] had previously given its consent for the construction work—a matter not examined in connection with the withdrawal of the complaint—according to the plaintiff's theory of the case, not only was damage caused to the parcel in question as a result of the felling of trees and poor road maintenance, but in addition, the use that ICE made of the land on which it built, which the State allegedly tolerated, is incompatible with the forest nature of that parcel, thereby violating, in the plaintiff's view, the provisions of numeral 18 of Ley N°7575." To analyze this portion of the appeal, it is necessary to begin with the provisions of Article 197, which reads as follows: "1) Absent a contrary agreement between the parties, there shall be no costs award in the event of a withdrawal, acquiescence, or extrajudicial satisfaction of the claim, before or during the preliminary hearing. 2) When such withdrawal, acquiescence, or extrajudicial satisfaction occurs after the preliminary hearing has taken place, if the interested party so requests within three business days following notification of the order closing the proceedings, payment of personal and procedural costs incurred shall be imposed by way of addition, provided that the Tribunal finds merit for such an award…." This Chamber agrees with the considerations the Tribunal relied upon in exempting the petitioning party from costs on the withdrawal motion filed prior to the rendering of judgment, given that the Municipality brought the action in safeguarding the public interest in environmental protection, in accordance with the Ley Forestal; accordingly, Art. 197(2) of the Código Procesal Contencioso Administrativo was not violated.
Addressing the grievance asserting that the judgment infringed Art. 193(b) of the CPCA by imposing on the State the costs of the counterclaim, this Chamber agrees that the State acted on a legally reasonable basis in defense of the Natural Heritage of the State, and that the crux of the matter is precisely the determination of whether this heritage should be State property or whether it falls within the patrimony of the Municipalidad de San Rafael de Heredia. Together with the State's constitutional obligation to guarantee the defense, conservation, and sustainable use of environmental wealth and natural heritage, the conclusion is that the State had sufficient grounds to litigate, as manifested in the filing of the counterclaim. Consequently, this ruling on costs must be quashed and the State exonerated from the costs of the counterclaim pursuant to Art. 197.2 of the Código Procesal Contencioso Administrativo.
Cassation appeal filed by the Instituto Costarricense de Electricidad on substantive grounds
X.The Instituto Costarricense de Electricidad files a cassation appeal for violation of substantive rules of the legal order, pursuant to Article 138(a) of the Código Procesal Contencioso Administrativo (CPCA), specifically for improper assessment of evidence and erroneous exemption of the Municipality from payment of costs following the withdrawal of the complaint. It alleges that the Tribunal violated Articles 82.4 and 197(2) of the CPCA by failing to assess comprehensively the documentary evidence in the case file. The judgment failed to analyze the abundant evidence submitted by ICE and the co-defendants, which led to incorrect conclusions—particularly the finding that the Municipality had sufficient grounds to sue merely by virtue of being the registered owner of the property. The Tribunal ignored the fact that the Municipality never demonstrated that ICE had carried out recent construction without municipal permits, nor that any environmental damage existed, even though that was its evidentiary burden, and the Municipality also failed to produce the administrative file it had offered as evidence.
On the contrary, ICE submits that it extensively proved that the only works performed were executed between 1991 and 1998, a period during which it held a legal monopoly in telecommunications and possessed all corresponding municipal and environmental permits. The administrative evidence demonstrates that the repeater station project was duly authorized by the Municipality and by the competent environmental authorities, including the approval of the environmental impact assessment (evaluación de impacto ambiental, EIA), construction permits, and institutional coordination in accordance with the principle of administrative coordination. ICE further submits that the evidence shows that the complaint filed by the Municipality was imprecise, lacking dates, specific facts, and evidentiary support, and that the municipal regulations on telecommunications licenses did not even exist at the time of the allegedly recent acts complained of.
All of this, it argues, demonstrates the plaintiff's lack of standing to sue. Subsequently, the Municipality modified its theory of the case by introducing the subject of a concession fee (canon), which generated greater legal uncertainty, particularly in light of contradictions by the Ministry of the Environment regarding ownership of the land. However, those doubts, ICE contends, do not undermine the lawfulness of the works or the permits granted. ICE further adds that the Tribunal also failed to assess evidence revealing errors in the consolidation of the parcels donated to the Municipality, which casts doubt on the clarity of title to the land at issue in the proceedings. Additionally, the Municipality's abusive procedural conduct is highlighted: it filed two separate proceedings with identical objects, based on inaccurate information—as it expressly acknowledged in its withdrawal brief—without submitting any evidence whatsoever.
This is compounded by its unjustified failure to appear at the preliminary hearing and by the withdrawal filed one business day before the oral trial, generating unnecessary expenditure and undermining the principle of good-faith conduct in litigation (buena fe procesal). Despite these circumstances, the Tribunal exempted the Municipality from paying costs, relying erroneously on the fact that ICE did not prove that the works were located on a different parcel, without analyzing the complete absence of evidence on the part of the plaintiff regarding the facts it imputed. The Institute therefore submits that the right of action was exercised in an abusive manner and that the Tribunal improperly assessed the record, for which reason the Municipality should have been ordered to pay both categories of costs pursuant to Art. 197.2 of the CPCA.
XI.The defendant Institute proceeds from the premise that the Tribunal violated Articles 82.4 and 197(2) of the CPCA by failing to assess comprehensively the documentary evidence in the case file. In this regard, it must necessarily be clarified that the granting of a withdrawal motion does not require assessment of evidence in the terms of Article 82.4 of the Código Procesal Contencioso Administrativo, since the merits of the dispute are neither examined nor resolved; this is so because the possibility of the party re-filing the action is not foreclosed, and no finding of lack of standing is triggered in the terms advanced by the appellant. Consequently, it cannot be considered that said provision was violated. As to the alleged transgression of Art. 197(2) of the CPCA, and in order to avoid unnecessary repetition, reference is made to Considerando IX, in which the reasoning is set out as to why the Municipality had sufficient grounds to litigate; accordingly, it will be held that Art. 197(2) of the Código Procesal Contencioso Administrativo was not violated.
XII.In light of the foregoing, the appeal filed by the State will be declared partially granted; the judgment will be quashed solely with respect to the imposition of costs on the State regarding the counterclaim, and the State will instead be exonerated therefrom; and the appeal filed by the Instituto Costarricense de Electricidad will be declared without merit. This appeal is resolved without a special costs award, as sufficient grounds for litigating exist—the exception provided under numeral 150(3) of the Código Procesal Contencioso Administrativo.
Por tanto
The appeal filed by the State is declared partially granted; the judgment is quashed insofar as it ordered the State to pay costs with respect to the counterclaim, and the State is instead exonerated therefrom. The appeal filed by the Instituto Costarricense de Electricidad is declared without merit. Proceso de conocimiento interpuesto por la MUNICIPALIDAD DE SAN RAFAEL DE HEREDIA representada por su Alcalde, Verny Valerio Hernández, cédula de identidad 1-0902-0177 contra el INSTITUTO COSTARRICENSE DE ELECTRICIDAD (ICE), representado por Marys Palacios Carrillo, cédula de identidad 8-0790-1189, el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), representado por Andrés Alvarado Ramírez, carné profesional 24211 y el ESTADO, representado por el procurador Alonso Arnesto Moya, cédula de identidad 1-0884-0748. Tramitado en el expediente 12-000631-1028-CA y el expediente acumulado 16-000104-1027-CA, ambos con reconvención del Estado. La representación del ESTADO y del INSTITUTO COSTARRICENSE DE ELECTRICIDAD formularon recurso de casación contra la sentencia número 11-2023-V de las 15:30 horas del 15 de febrero de 2023, del Tribunal Contencioso Administrativo y Civil de Hacienda, dictada por las personas juzgadoras Ileana Isabel Sánchez Navarro, Marianella Álvarez Molina y Juan Luis Giusti Soto.

CONSIDERANDO
I.El Tribunal Contencioso Administrativo y Civil de Hacienda, mediante sentencia Nº 11-2023-V de las 15:30 horas del 15 de febrero de 2023, resolvió: “Se admite la prueba para mejor resolver ofrecida por el Estado. Se acoge la solicitud de desistimiento formulada por el representante legal de la Municipalidad de San Rafael de Heredia y se declara terminado el proceso de conocimiento planteado por ésta contra el Instituto Costarricense de Electricidad, el Sistema Nacional de Áreas de Conservación y el Estado. Ese asunto se resuelve sin especial condenatoria en costas. En la reconvención formulada por el Estado contra la Municipalidad de San Rafael de Heredia, se acoge la defensa de falta de derecho presentada por ésta, y se declara sin lugar la contrademanda. Son las costas de la reconvención a cargo del Estado” (ver imágenes 637 a 652 del expediente judicial). Contra dicha resolución la representación estatal interpuso recurso de casación por vicios procesales y sustantivos en la sentencia, por su parte, la representación del Instituto Costarricense de Electricidad señala vicios sustantivos.
Casación interpuesta por el Estado por razones procesales
II.En cuanto al primer aspecto argumenta lesión al debido proceso porque -indica- que el fallo recurrido introduce elementos fácticos novedosos en detrimento del derecho de defensa del Estado, con lo que incurre en el vicio de incongruencia. Señala que la sentencia quebranta el debido proceso y con ello los elementos esenciales, dando cabida al recurso de acuerdo con los artículos 16, 57, 95, 119 inciso 1), 137 incisos 1.b) y 1.h) y 220 del Código Procesal Contencioso Administrativo, en relación con los artículos 32.1 y 61.2 del Código Procesal Civil. El recurso se fundamenta en la violación al debido proceso y al derecho de defensa del Estado, ya que la sentencia impugnada introdujo elementos fácticos novedosos que no fueron planteados por las partes, incurriendo así en un vicio de incongruencia por extra petita. Afirma que esta actuación quebranta los principios esenciales que rigen la función jurisdiccional y habilita la nulidad del fallo conforme al Código Procesal Contencioso Administrativo y al Código Procesal Civil.
Sostiene que el Tribunal de instancia sostuvo que el Estado no acreditó que el inmueble en discusión no hubiese sido de dominio particular antes del Decreto-Ley 65 de 1888 y que lo ostentaba el Estado, así como que el Ministerio de Ambiente y Energía (MINAE) incumplió su deber de delimitar la zona inalienable. Tales argumentos fueron utilizados para rechazar la reconvención y acoger la excepción de falta de derecho, pese a que nunca fueron alegados por la Municipalidad en la demanda, ni en la contestación, ni en las excepciones o conclusiones e incluso dicha parte fue declarada rebelde de la reconvención en la causa acumulada. La incorporación de estos hechos por parte del juzgador se realizó de oficio y sin otorgar oportunidad de contradicción, los convierte en sorpresivos y ajenos al debate procesal. El artículo 95 del Código Procesal Contencioso Administrativo permite la ampliación de fundamentos, pero exige conceder a las partes un plazo para pronunciarse, garantía que en este caso fue omitida, lesionando directamente el derecho de defensa del Estado.
En consecuencia, el fallo incurre en un claro vicio de incongruencia por resolver sobre aspectos no sometidos al contradictorio (artículo 137.1.h del CPCA, situación que la jurisprudencia reiterada de la Sala de Casación ha calificado como extra petita y que determina la nulidad absoluta de la sentencia. De haberse respetado el debido proceso, el Estado habría podido demostrar que las sentencias constitucionales relacionadas con la delimitación de la Zona Inalienable fueron debidamente cumplidas, que dicha delimitación se ejecutó entre los años 2012 y 2014 y que la propia Sala Constitucional reconoció el cumplimiento. Asimismo, se habría evidenciado que el inmueble se encuentra dentro de la zona protegida, circunstancia que incluso la sentencia impugnada da por sentada. También se habría podido rebatir la afirmación relativa a la falta de acreditación del dominio del Estado, ya que dicho dominio deriva directamente de normas legales que establecen una presunción a favor del Estado sobre los bienes no inscritos a nombre de particulares, trasladando la carga probatoria a quien alegue un derecho distinto, ello es así porque el dominio primigenio u originario del Estado es previo a cualquier detentación particular y en este caso, la municipalidad no opuso excepción alguna basada en tales circunstancias fácticas.
Finalmente, la reconvención no tuvo como objeto anular la inscripción registral sino exigir la aplicación del artículo 13 de la Ley Forestal, vigente al momento de la inscripción del inmueble a nombre de la municipalidad. Al dictarse sentencia sin audiencia, ni posibilidad de debate sobre hechos introducidos oficiosamente, se vulneraron los principios del debido proceso y de congruencia, lo que justifica la anulación del fallo, de forma que el A quo vuelva a dictar el fallo conforme al marco fáctico definido por las partes.
III.Del análisis de la sentencia se constata que la decisión se sustentó en dos aspectos, el primero, dispuso que resulta jurídicamente válido que el inmueble N°156766 sea propiedad registral de la Municipalidad de San Rafael de Heredia y obedece a que, la Municipalidad ostenta la condición de Administración Pública conforme al artículo 1 de la Ley General de la Administración Pública, N.º 6227 y la Ley Forestal, N.º 7575, no establece prohibición alguna para que los gobiernos locales figuren como titulares registrales de inmuebles que integren el patrimonio natural del Estado. Por el contrario, el propio texto legal -artículo 13- reconoce de forma expresa que dicho patrimonio puede comprender terrenos “pertenecientes a las municipalidades”, lo cual evidencia que el legislador admitió la posibilidad de que los entes municipales ostenten la titularidad registral de este tipo de bienes. Asimismo, el fallo dispone que la normativa contempla que los terrenos deberán inscribirse a nombre del Estado “cuando proceda”, expresión que denota un criterio de aplicación no automático, ni uniforme sino condicionado a las particularidades jurídicas de cada caso.
Entonces, no todos los inmuebles que integran el patrimonio natural deben necesariamente figurar inscritos a nombre del Estado, pudiendo permanecer —según corresponda— a nombre de municipalidades u otros entes públicos, siempre que estén debidamente inscritos en el Registro Inmobiliario del Registro Nacional y lo haya adquirido por medios legales válidos. Nótese cuando la sentencia afirma: “Ahora bien, esa titularidad sobre el inmueble por parte de los ayuntamientos y otras administraciones públicas, y en este caso de la Municipalidad de San Rafael de Heredia, no resulta contradictoria con su afectación, por su naturaleza, como patrimonio natural del Estado y por consiguiente, no inhibe la potestad de éste, y concretamente del Ministerio de Ambiente y Energía, en orden a ejercer la administración de dicho patrimonio”, es decir, que aunque el fallo reconoce que la titularidad la mantenga el ayuntamiento, determina que la administración del patrimonio natural es potestad del Ministerio indicado, lo que no resulta contradictorio con su afectación, por el contrario acorde al mismo artículo 13 de la Ley Forestal que expresamente establece: “El Ministerio del Ambiente y Energía administrará el patrimonio” y el ordinal 32 de la Ley Orgánica del Ambiente.
En segundo lugar, señala la sentencia que en resolución N.° 12109-2008 de la Sala Constitucional, se tuvo por acreditada una conducta omisiva prolongada del Estado en la delimitación, vigilancia y recuperación de las zonas declaradas inalienables por el Decreto Ley N.° 65 de 1888, particularmente atribuible al Ministerio de Ambiente y Energía, además que incluso en ese contexto y en el supuesto —no admitido— de que el inmueble deba incorporarse formalmente al dominio estatal, ello solo sería jurídicamente viable mediante el procedimiento de expropiación, por cuanto la finca se encuentra inscrita a nombre de la Municipalidad de San Rafael de Heredia desde 1997, sin que conste el ejercicio previo del dominio por parte del Estado con anterioridad a la citada norma. En este punto resulta oportuno realizar una precisión de relevancia jurídica y es que la sentencia, antes de abordar el análisis del segundo motivo, expresamente consigna: “Ahora bien, sin perjuicio de que las razones expuestas son suficientes para rechazar la pretensión del Estado para que se ordene a la Municipalidad de San Rafael de Heredia que proceda a traspasar la finca N°156766 a nombre del Estado”, esta manifestación permite advertir de forma inequívoca que el órgano jurisdiccional consideró que el primer fundamento desarrollado era autónomo, completo y jurídicamente suficiente para desestimar la pretensión formulada por el Estado en su reconvención y en consecuencia, la decisión desfavorable a dicha parte se encontraba plenamente sustentada con base en ese primer razonamiento, sin que resultara necesario acudir a argumentos adicionales para arribar a la conclusión del fallo.
Bajo esa perspectiva, el segundo motivo analizado por la sentencia no constituyó un elemento decisivo o determinante en la ratio decidendi, sino que se incorporó como complemento, sin incidencia real en el sentido final de la sentencia. Por ende, dicho razonamiento carece de eficacia causal respecto del resultado del proceso, al no haber sido imprescindible para la formación de la decisión jurisdiccional que se conoce, de manera que esta Cámara no observa vicio de indefensión o debido proceso y en todo caso, es lo cierto que el Estado no demostró que hubiese sido poseedor o propietario del inmueble, únicamente realizó argumentaciones.
IV.En este primer cargo, también recrimina el casacionista estatal vicios de incongruencia de la sentencia por extra petita, al sostener que el Tribunal “…no podían decidir sobre cuestiones no peticionadas con la contrademanda o que no hubiesen sido planteadas con las excepciones, según los hechos aducidos en el contradictorio, sin incurrir de esa forma en el vicio de extra petita…” y que el Estado no tuvo la oportunidad de rebatir los argumentos fácticos novedosos –con el consiguiente aporte de los medios probatorios correspondientes– centrando su alegato en que el voto constitucional 12109-2008 fue complementado por el voto 412-2011 de 14 de enero de 2011 y que el MINAE inició la delimitación física de la zona inalienable en el año 2012, que concluyó en 2014, año en que empezaron las gestiones para recuperar los terrenos y por ello, no tiene cabida que el a quo deniegue la reconvención afirmando en el año 2023, que la zona inalienable no está delimitada.
Además, apunta que es errado afirmar que no se acreditó el dominio del Estado sobre el inmueble 4-156766-000, antes del Decreto-Ley 65 de 1888. Esta Sala observa que la representación del Estado entremezcla agravios procesales con aspectos sustantivos lo que entorpece la resolución del recurso y se aleja de la correcta técnica; sin embargo, debe indicarse que dicha argumentación carece de fundamento. El vicio de incongruencia consiste en una discrepancia entre lo pedido por la parte que acciona y lo concedido por quien resuelve el conflicto. Puede presentarse cuando se omite pronunciamiento sobre algún extremo sometido a debate (infra petita), se otorga más de lo rogado (ultra petita), lo resuelto no guarda correspondencia con lo peticionado (extra petita) o bien, por contener disposiciones contradictorias. Para que esta figura proceda, la disonancia explicada, debe darse en la parte dispositiva del fallo, no así en su parte considerativa.
A efecto de determinar la existencia de esta infracción deben tenerse en cuenta los hechos aludidos como sustento de la petición, puesto que la incongruencia se entiende en función de la causa de pedir que en ellos se expresa; al respecto pueden consultarse los votos de esta Cámara, no. 942-F-S1-2020 de las 10:40 hrs. del 19 de marzo de 2020, el voto no. 01301-2023 de las 09:22 hrs. del 27 de julio de 2023, voto no. 00018-2024 de las 10:15 hrs. del 11 de enero de 2024. Por otra parte, cabe destacar, que el Tribunal tuvo como hechos probados: “3. Que la finca N°156766-000 es el resultado de la reunión de las fincas N°115703-000, 115704-000 y 115705-000 y provienen de la finca 5050346000 (misma prueba anterior). 4. Que la naturaleza del terreno de la finca N°156766 es de reserva forestal y "se encuentran afectadas por Ley Forestal, dado que están en gran parte dentro de la Reserva Forestal Cordillera Volcánica Central y en menor proporción en el Parque Nacional Braulio Carrillo tal y como lo muestran los planos de las mismas" (ver la prueba anterior). 5.- Que la finca N°156766-000 fue inscrita a nombre de la Municipalidad de San Rafael de Heredia el 27 de agosto de 1997 (misma prueba anterior)” y como consecuencia, se dispuso la desestimación de la contrademanda.
Por ello, lo argumentado por el casacionista carece de fundamento y no podría considerarse un vicio de incongruencia, toda vez que esta Cámara de forma reiterada ha indicado, que no puede atacarse por incongruencia, una sentencia totalmente desestimatoria. En esa línea se ha considerado: “Cuando una sentencia desestima las súplicas de la demanda y las demás pretensiones deducidas por los litigantes (sentencia desestimatoria), como ocurre en la especie, mal puede decirse que el juzgador se ha abstenido de fallar algo de lo que se ha pedido, o excedido por resolver ultra o extra petita, porque al hacerlo con ese contenido el sentenciador ha decidido de mérito, sólo que negativamente, sobre todas las cuestiones planteadas. Sea, que la sentencia totalmente desestimatoria no puede ser atacada por incongruencia, pues en esa decisión no es posible descubrir, ninguno de los casos en que se da el vicio, como son decidir sobre cuestiones no pedidas (extra petita), o sobre más de lo pedido (ultra petita), o sobre menos de lo suplicado (mínima petita).
(Voto no. 948 de las 9 horas 40 minutos del 12 de agosto de 2010 o el voto 476 – 2011 de las 11 horas 25 minutos del 07 de abril de 2012)”, así en el voto no. 666-2021 de las 15 horas 35 minutos del 18 de marzo de 2021 de Sala Primera; por lo anterior, se deberá proceder con el rechazo del agravio.
Casación por razones sustantivas
V.El motivo de casación se fundamenta en la aplicación indebida y falta de aplicación de la norma sustantiva según el artículo 138 inciso c) del CPCA. Argumenta la falta de aplicación del artículo 13 de la Ley Forestal, así como del artículo 45 constitucional, la Ley de Expropiaciones y la Ley General de la Administración Pública. Sostiene el casacionista que la sentencia impugnada acogió la tesis de la municipalidad según la cual, el inmueble de su propiedad no podía ser traspasado al Estado sin un proceso previo de expropiación, al considerar que el artículo 13 de la Ley Forestal permite que las fincas que integran el Patrimonio Natural del Estado estén inscritas a nombre de otras entidades públicas. Con base en esa interpretación, el Tribunal estimó que la inscripción a favor del Estado no era obligatoria en todos los casos y que, por ello debía acudirse al procedimiento expropiatorio, apoyándose en el precedente 314-F-S1-2021 de la Sala Primera.
En virtud de esto, la sentencia denegó la reconvención interpuesta por el Estado, no obstante, considera que dicha interpretación es errónea, pues las propiedades públicas que integran el Patrimonio Natural del Estado —aun cuando se encuentren inscritas a nombre de municipalidades— deben inscribirse a nombre del Estado cuando contienen bosques o poseen aptitud forestal, como ocurre en este caso. Manifiesta que esta es la correcta inteligencia del artículo 13, párrafo segundo de la Ley Forestal, conforme a la jurisprudencia constitucional, ya que la pertenencia al patrimonio del Estado resulta indispensable para garantizar su adecuada planificación, administración, conservación y autotutela demanial. Insiste que el precedente citado por el Tribunal no es aplicable, ya que en aquel asunto se trataba de un inmueble inscrito legítimamente a nombre de un particular, mientras que en este proceso el bien pertenece a un ente público y se localiza mayoritariamente dentro de áreas protegidas, por lo que integra plenamente el Patrimonio Natural del Estado.
Manifiesta que en estos supuestos no procede la expropiación sino el traspaso administrativo del inmueble, conforme lo dispone expresamente la Ley Forestal y la expresión “cuando proceda” contenida en el artículo 13 no otorga discrecionalidad al Estado, ni supedita el traspaso a la voluntad del ente titular, además indica, que debe entenderse en sentido jurídico: procede la inscripción cuando el terreno es susceptible de ser registrado como finca individualizada. Existen casos en los que no resulta procedente inscribir, como ocurre con grandes extensiones inalienables afectadas en bloque, pero ello no aplica a fincas concretas con cobertura boscosa inscritas a nombre de entes públicos menores. Considera que solo en los casos de inmuebles pertenecientes legítimamente a particulares sería necesario acudir a la expropiación o a la compra directa y cuando la inscripción sea irregular, procede la nulidad del título sin responsabilidad indemnizatoria para el Estado, como lo ha reconocido de forma reiterada la jurisprudencia administrativa y constitucional.
En consecuencia, concluye que la sentencia impugnada incurrió en una errónea interpretación de la norma sustantiva, al exigir indebidamente un proceso expropiatorio y negar el traspaso previsto en el artículo 13 de la Ley Forestal, configurándose la causal de casación prevista en el artículo 138 inciso c) del CPCA, lo que impone la revocatoria del fallo y la declaratoria con lugar de la reconvención en todos sus extremos.
VI.El argumento del Estado tiene dos perspectivas y parte del artículo 13 de la Ley Forestal, por un lado, sostiene que el patrimonio natural del Estado en propiedades públicas cuando contienen bosques o poseen aptitud forestal deben inscribirse a su nombre a pesar de que se encuentren inscritas a nombre de las Municipalidades. Y por otra parte, manifiesta que en estos supuestos, no procede la expropiación sino el traspaso administrativo del inmueble y la expresión “cuando proceda” del artículo 13 de la Ley Forestal, debe entenderse que corresponde la inscripción cuando el terreno es susceptible de ser registrado como finca individualizada. Para dilucidar si en la sentencia impugnada existe una indebida aplicación y/o falta de aplicación de la norma sustantiva, conviene transcribir de manera íntegra el ordinal: “ARTICULO 13.- Constitución y administración. El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. / El Ministerio del Ambiente y Energía administrará el patrimonio.
Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. / Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de este” (el subrayado no corresponde al original). Entonces este artículo reconoce expresamente que el Patrimonio Natural del Estado puede estar integrado por bosques y terrenos forestales pertenecientes a las municipalidades, instituciones autónomas y demás entes de la Administración Pública, lo cual implica una concepción jurídica amplia del dominio público ambiental. Esta disposición confirma que la titularidad formal del bien no constituye el elemento determinante para su incorporación al Patrimonio Natural del Estado, en realidad, el criterio definitorio es su afectación legal al fin público de conservación, cuando se cumplen las condiciones previstas por la Ley Forestal y quedarán sometidos a su régimen especial de protección.
De manera que, las corporaciones municipales en su condición de entes territoriales autónomos conforme al artículo 170 de la Constitución Política, ejercerán la titularidad del inmueble dentro de los límites que impone el interés público nacional en materia ambiental. Esta situación no supone una contradicción entre la autonomía municipal y el dominio público estatal, por el contrario, constituye una manifestación del principio de unidad del patrimonio ambiental público. Bajo este razonamiento, no existe una confrontación jurídica entre la propiedad municipal y la administración estatal cuando un bien perteneciente a una municipalidad integra el Patrimonio Natural del Estado conforme al artículo 13 de la Ley Forestal antes bien, se configura una articulación normativa bajo el principio de unidad del Estado. En este supuesto, la ley no traslada la titularidad dominical del inmueble del ente municipal al Estado central, sino que somete ese bien a un régimen jurídico especial de protección ambiental, de alcance nacional, que prevalece sobre la autonomía local debido al interés público superior comprometido.
Jurídicamente se produce una disociación entre la titularidad dominical y la competencia funcional, mientras la municipalidad mantiene la titularidad registral del bien, el Estado —a través del Ministerio de Ambiente y Energía— ejerce la rectoría ambiental y la potestad de regulación, control y fiscalización derivada del principio pro ambiente y del deber constitucional del Estado de garantizar un ambiente sano y ecológicamente equilibrado, además, acorde con el artículo 3 del Reglamento a la Ley Forestal que establece: “El Ministerio de Ambiente y Energía, será el rector del Sector Forestal y realizará sus funciones por medio del Sistema Nacional de Áreas de Conservación (SINAC)…” y la sentencia de esta Sala número 1239-S-S1-2020 de 11 horas 50 minutos del 31 de marzo de 2020, por lo que la corporación municipal deberá observar las restricciones de la Ley Forestal y los lineamientos del SINAC como administrador.
Esta distribución de competencias no implica de ninguna forma una subordinación, ni pérdida de autonomía municipal por el contrario constituye una manifestación del principio de coordinación administrativa de carácter transversal en la protección ambiental. Bajo este razonamiento, el artículo 13 de la Ley Forestal no establece una confrontación entre propiedad municipal y propiedad estatal, reconoce una limitación legítima y válida al ejercicio de la propiedad municipal, fundada en el interés público ambiental, que responde al modelo de Estado ecológico adoptado por el ordenamiento jurídico costarricense. Otro elemento de especial relevancia lo constituye el numeral 14 de la referida ley, el cual dispone expresamente que los terrenos forestales y bosques que integran el patrimonio natural del Estado serán inembargables e inalienables, estableciendo que la posesión ejercida por los particulares no generará derecho alguno a su favor y que la acción reivindicatoria estatal respecto de dichos bienes es imprescriptible.
De la lectura de esta disposición se advierte que el legislador introduce una diferenciación expresa únicamente respecto de la posesión ejercida por los particulares, sin extender dicha prohibición a las municipalidades, instituciones autónomas u otros organismos que conforman la Administración Pública, lo cual resulta jurídicamente determinante a la luz del criterio de interpretación normativa. En efecto, la norma concibe al Estado como una unidad jurídica, aun cuando se organice bajo esquemas de descentralización administrativa o territorial y de ninguna forma pueden ser considerados terceros. En consecuencia, la correcta hermenéutica de la norma conduce a afirmar que el legislador no pretendió excluir a las municipalidades de la posibilidad de ejercer actos de administración o gestión de bienes del patrimonio natural del Estado, lo que constituye una manifestación coherente del principio de legalidad y del principio de unidad del Estado, conforme a los cuales el patrimonio natural no se fragmenta, lo cual es propio de su régimen jurídico especial.
VII.En cuanto a la afirmación de la representación estatal de que, no procede la expropiación sino el traspaso administrativo del inmueble y la expresión “cuando proceda” del artículo 13 de la Ley Forestal debe entenderse que procede la inscripción cuando el terreno es susceptible de ser registrado como finca individualizada. Esta Sala considera que la postura del recurrente no resulta correcta porque el inmueble objeto de análisis reviste el carácter de bien integrante del dominio público y actualmente la Municipalidad de San Rafael de Heredia es la titular del bien inmueble, de forma válida en los términos del Considerando anterior. En este contexto, la expresión “cuando proceda”, contenida en el artículo 13 de la Ley Forestal, no puede ser interpretada en sentido meramente factico-registral, circunscrito a la sola posibilidad de individualizar el inmueble como finca, sino que debe analizarse conforme a la literalidad del artículo 13 de la Ley Forestal y no se desprende la configuración de un presupuesto jurídico válido, ni suficiente que habilite la transferencia registral del bien inmueble al Estado, en tanto la municipalidad ostenta la posesión y titularidad del mismo de manera legítima en armonía con el marco normativo establecido en la citada disposición legal.
En consecuencia, no corresponde la inscripción del inmueble a favor del Estado, por cuanto ello implicaría desconocer una titularidad válidamente constituida y vulnerar el principio de legalidad registral, sin perjuicio de que, en el supuesto de que el Estado pretenda adquirir el dominio del inmueble deberá necesariamente recurrir a las vías jurídicas legalmente habilitadas, con pleno respeto del debido proceso que rige la materia, como lo indica la sentencia de marras. Amén de lo expuesto, se deberá proceder con el rechazo del agravio.
VIII.El Estado también alega violación de los artículos 193 inciso b) y 197 inciso 2) del CPCA, por indebida apreciación de los autos, al eximir de las costas de la demanda a la Municipalidad reconvenida e imponerlas al Estado por la reconvención. Señala que la justificación ofrecida para el desistimiento sea, atribuir la responsabilidad al anterior alcalde y alegar información inexacta -considera- resulta inconsistente, máxime cuando la misma profesional en Derecho autenticó ambas demandas y el desistimiento. Estas circunstancias -apunta- evidencian la falta de buen derecho y de lealtad procesal, lo que hacía procedente la condenatoria en costas a cargo de la municipalidad, conforme al artículo 197.2 del CPCA, extremo que fue indebidamente desatendido por el Tribunal y considera que las consecuencias económicas de la gestión de desistimiento, debe ser revocado al estimar que existe merito suficiente para la condenatoria en ambas costas en contra de la Municipalidad de San Rafael de Heredia, precepto que infringió el tribunal de instancia fruto de su errada lectura de los expedientes acumulados donde constan las actuaciones abusivas y omisiones de dicho ente local en ambas causas.
Por otro lado -argumenta- que el mismo tribunal violentó el inciso b) del artículo 193 del CPCA por falta de aplicación con la condena en costas de la reconvención a cargo del Estado -señala- que ha quedado demostrado de los autos, la naturaleza de las cuestiones debatidas, sea la defensa del Patrimonio Natural del Estado, justifica y constituye motivo suficiente para litigar y haber contrademandado. Indica que la contrademanda tuvo como finalidad la defensa del Patrimonio Natural del Estado, deber constitucional y legal que deriva del artículo 50 de la Constitución Política y de los artículos 1 y 13 de la Ley Forestal, que obligan al Estado a velar por la conservación, protección y administración de los bosques y a promover la inscripción de los terrenos forestales a su nombre. En consecuencia, estima que el Estado no debe asumir las costas de la reconvención como dispuso en la sentencia impugnada, extremo que igualmente peticiona sea revocado por esta Sala de Casación.
IX.En cuanto al extremo argüido, de la exoneración en costas de la demanda interpuesta por la Municipalidad de San Rafael de Heredia, la sentencia impugnada fundamenta la exoneración en que, la Municipalidad de San Rafael es la propietaria registral del inmueble N°156766 de la Provincia de Heredia, desde el 27 de agosto de 1997 y tuvo por probado que los antecedentes son las fincas 115703, 115704 y 115705. También que el terreno es de naturaleza forestal, afectado a la Ley Forestal y que, no fue desacreditado que las obras del ICE, se encuentren en una finca distinta a la N°156766. Es por esto, que la sentencia se fundamenta en que hubo razones suficientes para presentar esta demanda y se alegó -en la contestación del ICE- que dicho inmueble debe ser traspasado a nombre del Estado y dejar de formar parte del patrimonio del ayuntamiento pues contó con el aval de este último para construir las obras.
Además indica, que “Con independencia de que anteriormente hubiese brindado su consentimiento para la realización de las construcciones, cuestión que no se examina con ocasión del desistimiento de la demanda, según la teoría del caso de la actora, no solamente se ocasionaron daños a la finca de referencia derivados de la tal(sic) de árboles y el mal mantenimiento de los caminos, sino que además, el uso que le dio el ICE, y que supuestamente toleró el Estado al terreno en el que el primero construyó, no es compatible con la naturaleza forestal de dicha finca, violentándose según su criterio, las disposiciones del numeral 18 de la Ley N°7575”. Para analizar este apartado del recurso es necesario partir de lo dispuesto en el artículo 197 que se transcribe a continuación: “1)Salvo acuerdo de las partes en contrario, no habrá condenatoria en costas, en caso de que se produzca desestimiento, allanamiento o satisfacción extraprocesal de la pretensión, antes de la audiencia preliminar o en el transcurso de esta. 2) Cuando se produzca con posterioridad a la realización de la audiencia preliminar, si la parte interesada lo reclama, dentro de los tres días hábiles posteriores a la notificación del auto que tenga por concluido el proceso, se impondrá, por adición, el pago de las costas personales y procesales causadas, siempre que el Tribunal halle mérito para la condenatoria…”.
Esta Sala coincide con las consideraciones que tuvo el Tribunal para eximir de costas a la parte accionante de la gestión de desistimiento acaecida antes del dictado de la sentencia, habida cuenta de que la Municipalidad interpuso la acción en resguardo del interés público en protección del ambiente, acorde con la Ley Forestal, por lo que no se violentó en ordinal 197 inciso 2 del Código Procesal Contencioso Administrativo. En atención al planteamiento de agravios, que sostiene que la sentencia conculcó el artículo 193 inciso b) del CPCA, por la condena en costas de la reconvención a cargo del Estado, esta Cámara coincide que el Estado desplegó su conducta en un planteamiento jurídicamente razonable en defensa del Patrimonio Natural del Estado y precisamente, el quid es la determinación si este patrimonio debe ser propiedad del Estado o si incumbe a la Municipalidad de San Rafael de Heredia, aunado a la obligación constitucional del Estado de garantizar la defensa, conservación y uso sostenible de la riqueza ambiental y patrimonio natural, se concluye que existió motivo suficiente para litigar del Estado manifestado en la interposición reconvención. En consecuencia, este extremo deberá ser casado y exonerar al Estado de las costas de la contrademanda en los términos del artículo 197.2 del Código Procesal Contencioso Administrativo.
Casación interpuesta por el Instituto Costarricense de Electricidad por razones sustantivas
X.El Instituto Costarricense de electricidad interpone recurso de casación por violación de normas sustantivas del ordenamiento jurídico, conforme al artículo 138 inciso a) del Código Procesal Contencioso Administrativo (CPCA), específicamente por indebida apreciación de la prueba y errónea exoneración de la Municipalidad del pago de costas tras el desistimiento de la demanda. Alega que el Tribunal violentó los artículos 82.4 y 197 inciso 2) del CPCA al no valorar de forma integral la prueba documental existente en el expediente. La sentencia omitió analizar abundante prueba aportada por el ICE y por los codemandados, lo que condujo a conclusiones incorrectas, particularmente al considerar que la Municipalidad tenía razones suficientes para demandar únicamente por ser propietaria registral del inmueble. El Tribunal ignoró que la Municipalidad nunca demostró que el ICE hubiese realizado construcciones recientes sin permisos municipales, ni que existiera daño ambiental, pese a que esa era su carga probatoria y tampoco aportó el expediente administrativo que había ofrecido como prueba.
Por el contrario, sostiene que el ICE acreditó ampliamente que las únicas obras realizadas se ejecutaron entre 1991 y 1998, periodo en el cual contaba con monopolio legal en telecomunicaciones y con todos los permisos municipales y ambientales correspondientes. La prueba administrativa demuestra que el proyecto de la estación repetidora fue debidamente autorizado por la Municipalidad y por las autoridades ambientales competentes, incluyendo la aprobación del estudio de impacto ambiental, permisos de construcción y coordinaciones institucionales conforme al principio de coordinación administrativa. Asimismo -sostiene-que se evidencia que la demanda presentada por la Municipalidad era imprecisa, carente de fechas, hechos concretos y sustento probatorio e incluso la normativa municipal sobre licencias en telecomunicaciones no existía al momento de los supuestos hechos recientes alegados. Todo ello demuestra la falta de derecho de la actora para demandar.
Posteriormente, la Municipalidad modificó su teoría del caso, introduciendo el tema del cobro de canon, lo que generó mayor incertidumbre jurídica, especialmente ante contradicciones del Ministerio de Ambiente respecto a la titularidad del terreno. No obstante, dichas dudas -apunta- no desvirtúa la legalidad de las obras ni los permisos otorgados. Agrega que el Tribunal también omitió valorar prueba que evidencia errores en la reunión de fincas donadas a la Municipalidad, lo cual pone en duda la claridad de la titularidad del terreno objeto del proceso. Adicionalmente, se destaca una conducta procesal abusiva de la Municipalidad, al haber interpuesto dos procesos con objetos idénticos, basados en información inexacta como reconoció expresamente en su escrito de desistimiento, sin aportar prueba alguna. A ello se suma su inasistencia injustificada a la audiencia preliminar y el desistimiento presentado un día hábil antes del juicio oral, generando gastos innecesarios y afectando el principio de buena fe procesal.
Pese a estas circunstancias, el Tribunal eximió a la Municipalidad del pago de costas, basándose erróneamente en que el ICE no demostró que las obras se ubicaran en otra finca, sin analizar la falta absoluta de prueba de la actora sobre los hechos que imputó. Por lo anterior, sostiene que existió un ejercicio abusivo del derecho de acción y que el Tribunal incurrió en indebida apreciación de los autos, razón por la cual debió condenar a la Municipalidad al pago de ambas costas conforme al artículo 197.2 del CPCA.
XI.El Instituto demandado parte de la premisa que el Tribunal violentó los artículos 82.4 y 197 inciso 2) del CPCA al no valorar de forma integral la prueba documental existente en el expediente. Al respecto debe necesariamente precisarse, que el acogimiento de la gestión de desistimiento, no requiere valoración de la prueba en los términos del artículo 82.4 del Código Procesal Contencioso Administrativo, debido a que no se está conociendo o resolviendo el objeto de la litis y esto es así, porque no se enerva la posibilidad de que la parte pueda volver a entablar la acción y no da lugar a disponer una falta de derecho, en los términos que plantea el recurrente, en consecuencia no podría considerarse que se haya conculcado dicho numeral. En cuanto a la transgresión del ordinal 197 inciso 2) del CPCA, que indica el recurrente, a efectos de evitar reiteraciones innecesarias, se remite a lo dispuesto en el Considerando IX, en el que se motiva y razona lo relativo a que la Municipalidad tuvo motivo suficiente para litigar y por ende, se dispondrá que no se violentó en ordinal 197 inciso 2 del Código Procesal Contencioso Administrativo.
XII.En mérito de lo expuesto, se procederá a declarar parcialmente con lugar el recurso planteado por el Estado, se casará la sentencia únicamente, en cuanto se condenó al Estado en las costas respecto a la reconvención, para en su lugar exonerarlo y se declarará sin lugar el recurso interpuesto por el Instituto Costarricense de Electricidad. Se resolverá este recurso sin condenatoria en costas por existir motivo suficiente para litigar excepción dispuesta en el numeral 150 inciso 3) del Código Procesal Contencioso Administrativo.
POR TANTO
Se declara parcialmente con lugar el recurso planteado por el Estado, se casa la sentencia en cuanto condenó al Estado en costas respecto a la reconvención, para en su lugar exonerarlo. Se declara sin lugar el recurso interpuesto por el Instituto Costarricense de Electricidad.
