PJEDITOR Document Res. 001139-F-S1-2024 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, at fourteen hours thirty-five minutes on thirty August two thousand twenty-four.

Ordinary proceedings (proceso de conocimiento) brought by ELOY MÉNDEZ RAMÍREZ against the ESTADO, the INSTITUTO DE DESARROLLO RURAL, and the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, in which the representative of INDER files a cassation appeal (recurso de casación) against resolution no. 636-2023, issued at 14 hours 11 minutes on 10 May 2023, ruling on the approval of a partial settlement (homologación de transacción parcial), as well as against its supplementation and clarification issued at 15 hours 7 minutes on 28 June 2023, both rendered by the Tribunal Contencioso Administrativo of the II Circuito Judicial de San José, composed of Judge Gerardo Antonio Pérez Alfaro. Participating in the proceedings are attorney Daniel Rojas Pochet, as special judicial attorney-in-fact for the plaintiff; attorney Jonathan Jiménez Ruiz, as special judicial attorney-in-fact for INDER; attorney Andrés Alvarado Ramírez, as special judicial attorney-in-fact for SINAC; and State Counsel Yannia Salas Víquez, representing the Estado.

Justice Castro García writes the opinion;

CONSIDERING

I.Cassation is characterized as an extraordinary proceeding, basically for two reasons. First, because not every judicial ruling is subject to such an appeal, but only those contemplated by law. Second, because the grounds for challenge at that review stage are not open-ended, but are likewise predetermined by the legal system. Regarding the first aspect, it should be noted, as a general rule, that judgments and interlocutory orders having the effect of a judgment (autos con carácter de sentencia) and capable of producing substantive res judicata (cosa juzgada material) are subject to cassation. In addition to this general formula, the CPCA itself identifies certain specific rulings for which this option is available. By way of example, these include a ruling declaring a complaint inadmissible (art. 62.3) and one sustaining the preliminary defenses (defensas previas) specified in subsection 6) of article 92 of the aforementioned Code.

Accordingly, ordinary interlocutory orders (autos comunes) and rulings that neither decide the merits of the matter nor terminate the proceedings may not proceed to the cassation stage. As to the grounds, it should be added that they are divided into procedural and substantive grounds. This is embodied in articles 137 and 138 Ibid. The former are set out in a broadly framed, comprehensive list and, where applicable, are tailored to the rules governing oral proceedings. As to substantive grounds, provision is made for possible infringement relating to evidence (through disregard of or contradiction with it, or through omission or improper assessment), commonly called an “indirect violation” (violación indirecta). In addition, as part of this latter group, there is strictly legal error, which occurs when a rule is improperly applied, incorrectly interpreted, or wrongfully left unapplied, known in Costa Rican legal tradition as a “direct violation” (violación directa).

II.Having identified the rulings subject to cassation and the applicable grounds, it is essential to address the requirements for admissibility. In this regard, it is worth recalling that the anti-formalistic orientation with which the CPCA entered the Costa Rican legal system permeates each and every one of its legal mechanisms. Thus, the cassation appeal is also freed from excessive admissibility requirements, so that the cassation court—as the apex of the system—may, in most cases, examine the alleged procedural or substantive violations, thereby fulfilling the essential purpose of this judicial instance and serving those who resort to it. Cassation has therefore been made less stringent with respect to admissibility, without abandoning its inherent technical character, nature, or essence, since its role and purpose within the modern procedural system ultimately remain intact.

III.Nevertheless, despite the informality promoted by current procedural legislation for filing a cassation appeal, a series of minimum and indispensable requirements concerning time, place, and form are logically established. They are created by law because they are indispensable to this particular extraordinary appeal, since without them there would be neither procedural order nor balance; however, they must be interpreted flexibly and reasonably, as it must be recalled that those specified in article 139 of the Code in question are the only requirements and formalities prescribed for the cassation appeal, as stated in subsection 5) of that same provision. Thus, subsection 1) of the provision just cited establishes that the appeal must be filed directly with the Sala Primera de la Corte Suprema de Justicia or the Tribunal de Casación de lo Contencioso Administrativo. This slightly modifies, for administrative litigation, the system previously in force under civil procedural legislation, because the Sala or Tribunal now not only rules on admissibility; pursuant to article 142.1 of the Code governing the subject matter, it also notifies the opposing party and grants it a period of 10 days to respond (serving notice through the method that party designated in accordance with the communication previously sent to it by the lower court).

The purpose is to standardize the Code’s appellate regime, since appeals, whether ordinary or extraordinary, are generally filed directly with the higher court responsible for hearing them. In another respect, the same statutory subsection establishes the filing period: 15 business days counted from the business day following notification of all parties. If a request for supplementation or clarification has been filed, that period shall begin to run on the business day following notification to all parties of the ruling on that request. After addressing the time and place of filing, subsection 2) lists a series of requirements concerning the “information” and “identification” of the appellant and the proceedings which, by their nature (“data,” “procedural information”), may be cured within three days pursuant to article 141 of the same body of law. The following must therefore be stated: a) the type of proceeding; b) the full names of the parties; c) the signature of the appellant or appellants, authenticated by an attorney; d) the time and date of the challenged ruling; e) the case number in which it was issued; and f) the method for receiving notices.

This completes the straightforward list of instrumental or procedural requirements governing the appeal. Only if an order to cure deficiencies (prevención) issued for that purpose is not complied with shall the appeal be summarily dismissed and the matter consequently closed; in that event, however, dismissal results not merely from the omission itself, but from the failure to comply with the court’s order.

IV.To the foregoing requirements is added one final substantive requirement (article 139.3 ibídem), necessary both for admissibility and for the subsequent consideration of the merits of the appeal. This is the statement of grounds for the appeal (motivación del recurso), which, given the characteristics of cassation, must be clear and precise. In this regard, it must contain, as the provision under discussion stipulates, the factual and legal basis of the case. The basis is factual insofar as the appellant disagrees with the facts deemed proven or unproven (which entails weighing the evidence) or with the circumstances surrounding the violation of procedural rules; and it is legal when the issue presented concerns the application, omission, or improper interpretation of any rule forming part of the body of applicable law (bloque de juricidad), including, of course, principles of constitutional rank, or when the violation also occurs by reflex or indirect effect after the facts established in the challenged judgment have been modified.

In both procedural and evidentiary violations, factual reasons may accompany the legal reasons—which are always necessary—and, accordingly, the stated grounds must address both dimensions, on pain of inadmissibility. It must also be clarified that, by express statutory mandate, the legal basis need not identify provisions concerning the weight of the evidentiary item or items that were improperly assessed. Likewise, it is not essential to cite the provisions establishing the requirements, deadlines, and basic rules for admitting the appeal. More important than citing the latter is complying with and applying them when preparing and filing the cassation appeal. Accordingly, the grounds required by law may be understood, grosso modo, as technical legal reasoning that mentions a series of articles or legal rules interlinked or connected with one another and reasonably related from a dual perspective: to the arguments raised in the appeal and to the judgment being challenged.

A legal basis exists insofar as a set of legal rules—or, where appropriate, a single rule—is cited that is pertinent and clearly connected with the challenged judgment, whether regarding its factual or legal basis, and with the arguments raised in the appeal. References to case law or occasional citations to legal scholarship may sometimes reinforce the allegations made, but generally are not essential to them. As the Sala Primera and this Tribunal de Casación have already held in interpreting article 139 in question, “the appeal must contain a minimum legal basis [...] the reasons supporting the application must be explained, addressing the legal arguments of the challenged judgment and providing at least some reference to a legal provision supporting it” (resolution no. 318-A-2008, issued at 14 hours 25 minutes on 8 May 2008). The requisite grounds therefore do not consist of a confused profusion of rules and arguments; a mixture of unintelligible assertions; a mere statement of opinions concerning the validity or justice of the case; or an account of the errors believed to have been committed in the challenged judgment without support in legal rules or criteria.

Thus, if the appeal entirely omits the technical legal relationship described above, or if the relationship it sets out is manifestly and evidently irrelevant or disconnected from the case, it must be deemed to lack “any legal basis whatsoever” and therefore to fail to satisfy the necessary requirement established in article 139.3, which is sanctioned by summary dismissal pursuant to article 140 subsection c), both provisions belonging to the same Code in question.

V.In the case at hand, INDER’s counsel seeks to submit for review by this Chamber resolution no. 636-2023, issued by the Administrative and Civil Court of the Treasury, Second Judicial Circuit of San José, at 14 hours 11 minutes on May 10, 2023, as well as the resolution ruling on the motion for supplementation and clarification at 15 hours 07 minutes on June 28, 2023, which ordered: “In accordance with the foregoing and with Article 76 of the Code of Administrative Procedure, the partial settlement agreement submitted is hereby approved; it was entered into under the following terms: "FIRST: Mr. ELOY MÉNDEZ RAMÍREZ undertakes to respect in perpetuity the forest areas and the State’s natural heritage in accordance with the regulations of the Ley Forestal and the Organic Environmental Law (Ley Orgánica del Ambiente). SECOND: In this same act, the representative of SINAC states that it is in agreement with the property described in cadastral plan 6-2200582-2020, insofar as that property does not encompass areas of the State’s natural heritage, as indicated in official letters SINAC-SE-IRT-136-2020 of August 08, 2020, issued by SINAC’s Department of Territorial Information and Regularization, and ACLAP-SRCB-1345-2013 of October 31, 2013.

THIRD: Given that the property described in plan 6-2200582-2020, which is the subject of the proceeding, does not encompass the State’s natural heritage, the petitioner withdraws the action against the State and SINAC for lack of a current legal interest, because no claims remain against the co-defendants. FOURTH: Each party shall bear its own costs in this matter. FIFTH: Notices. The parties designate the following addresses for notices arising from this agreement: Eloy Méndez Ramírez: Through his special litigation counsel, Daniel Rojas Pochet, at the email address [email protected], and, alternatively, by fax at 2290-1405 / 2201-8707. SINAC: At the email address [email protected] and, alternatively, at [email protected].” The agreement is binding and has the effect of res judicata (cosa juzgada). In the event of noncompliance, enforcement shall proceed in accordance with the judgment enforcement procedure.” (underlining and highlighting in the original.

VI.The cassation appellant (casacionista) structures his appeal around fifteen grounds for reversal (agravios), all alleging violations of substantive rules based on an improper assessment of the evidence and improper legal reasoning. He states that the grounds set forth in Article 134, subsection 1), and Article 138, subsections a), c), and d), of the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo) are present. In the first ground, he alleges that the judicial approval (homologación) granted by the Contentious-Administrative Court was based on an improper assessment of the evidence, thereby violating Article 82, subsection 4), of the CPCA. He considers that this error contravenes the rules of sound judicial judgment (sana crítica) and the principle of reasonable assessment of evidence, both of which are essential to due process. He asserts that the error lies in failing to recognize that survey plan number 6-2200582-2020 had been canceled in the Registro Nacional.

He states that, by approving the partial settlement without considering this cancellation, legal validity was granted to an invalid cadastral plan (plano catastral), thereby violating the fundamental rules governing the assessment of evidence and due process. In the second ground, he alleges that the Court erred by approving the partial settlement based on an incorrect assessment of report ACLAP-SRCB-1345-2013 of 31 de octubre de 2013, issued by the Área de Conservación La Amistad Pacífico of the Sistema Nacional de Áreas de Conservación. He maintains that the report analyzes only plans P-748062-2001 and P-1170755-2007, concluding that: 1. Plan P-748062-2001 contains 14.4 hectares of State Natural Heritage (Patrimonio Natural del Estado), and 2. Plan P-1170755-2007 contains 39.1 hectares of State Natural Heritage; however, the report does not analyze the property described in plan 6-2200582-2020 because that plan was prepared in 2020, after the report was issued in 2013.

He further notes that the report does not conclude that plan 6-2200582-2020 contains no State Natural Heritage areas and refers exclusively to plans P-748062-2001 and P-1170755-2007, not to plan 6-2200582-2020. In the third ground, he alleges that the partial settlement was erroneously approved based on an incorrect assessment of official communication SINAC-SE-IRT-136-2020 of 8 de agosto de 2020, issued by the Departamento de Información y Regulación Territorial of the Sistema Nacional de Áreas de Conservación, which states that, according to report ACLAP-SRCB-1345-2013, plan 6-2200582-2020 contains no areas declared to be State Natural Heritage. However, this official communication lacks a detailed technical and scientific method supporting that assertion. He emphasizes that report ACLAP-SRCB-1345-2013 analyzes only plans P-748062-2001 and P-1170755-2007, concluding that: 1. Plan P-748062-2001 contains 14,4 hectares of State Natural Heritage, and 2.

Plan P-1170755-2007 contains 39,1 hectares of State Natural Heritage. He contends that the report does not analyze plan 6-2200582-2020 because it was prepared in 2020, after the report was issued in 2013. Therefore, the report contains no conclusion regarding the absence of State Natural Heritage areas in plan 6-2200582-2020 and refers only to plans P-748062-2001 and P-1170755-2007. In the fourth ground, he maintains that the Court approved the partial settlement based on an incorrect assessment of official communication SINAC-SE-IRT-136-2020, because that communication states that, according to report ACLAP-SRCB-1345-2013, plan 6-2200582-2020 contains no areas declared to be State Natural Heritage. However, the official communication lacks a detailed technical and scientific method demonstrating that plan 6-2200582-2020 contains no State Natural Heritage areas. It merely relies on report ACLAP-SRCB-1345-2013, which analyzes only plans P-748062-2001 and P-1170755-2007.

He adds that official communication SINAC-SE-IRT-136-2020 contains no historical technical and scientific study of aerial or satellite imagery conclusively establishing the forest cover (cobertura boscosa) of the land described in plan 6-2200582-2020 from 1994 to the present; and, under Articles 13 and 15 of Ley Forestal no. 7575, forests belonging to the State and public institutions are immediately and automatically legally designated as State Natural Heritage if they are forested. Furthermore, Decreto Ejecutivo no. 28788-H of 2 de julio de 2000 ordered that the properties in Puntarenas, registration numbers 8508-000 and 12402-000, be donated to the Instituto de Desarrollo Agrario. In the fifth ground, he alleges that the Court approved the partial settlement based on an erroneous assessment of official communication SINAC-SE-IRT-136-2020, because that communication states that, according to report ACLAP-SRCB-1345-2013, plan 6-2200582-2020 contains no areas declared to be State Natural Heritage.

However, the official communication lacks a detailed technical and scientific method demonstrating that assertion. In his view, it merely relies on report ACLAP-SRCB-1345-2013, which analyzes only plans P-748062-2001 and P-1170755-2007, concluding that 1. Plan P-748062-2001 contains 14,4 hectares of State Natural Heritage, and 2. Plan P-1170755-2007 contains 39,1 hectares of State Natural Heritage. He states that report ACLAP-SRCB-1345-2013 does not analyze plan 6-2200582-2020 because it was prepared in 2020, after the report was issued in 2013. Therefore, the report contains no conclusion regarding the absence of State Natural Heritage areas in plan 6-2200582-2020 and refers only to plans P-748062-2001 and P-1170755-2007. In the sixth ground, he maintains that the Court approved the partial settlement based on an improper assessment of official communication SINAC-SE-IRT-136-2020, resulting in the failure to apply Articles 13 and 15 of Ley Forestal no. 7575, which protect forests belonging to the State and its public institutions by automatically incorporating them into the State Natural Heritage if they are forested.

He states that the official communication indicates that, according to report ACLAP-SRCB-1345-2013, plan 6-2200582-2020 contains no areas declared to be State Natural Heritage; however, the official communication lacks a detailed technical and scientific method precisely demonstrating that plan 6-2200582-2020 contains no State Natural Heritage areas. He emphasizes that it relies exclusively on report ACLAP-SRCB-1345-2013, which analyzes only plans P-748062-2001 and P-1170755-2007, and that the above-mentioned official communication contains no historical technical and scientific study of aerial or satellite imagery showing whether the land described in plan 6-2200582-2020 was forested from 1994 to the present. In the seventh ground, he alleges an improper assessment of official communication SINAC-SE-IRT-136-2020 and report ACLAP-SRCB-1345-2013 of 31 de octubre de 2013, both issued by the Sistema Nacional de Áreas de Conservación, resulting in the failure to apply Article 13 of Ley Forestal no. 7575, which protects forestlands or lands suitable for forestry (terrenos forestales o de aptitud forestal) belonging to the State and its public institutions by incorporating them into the State Natural Heritage.

He argues that neither official communication SINAC-SE-IRT-136-2020 nor report ACLAP-SRCB-1345-2013 contains the technical and scientific study by the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) that would conclusively establish that plan number 6-2200582-2020 falls outside categories VII and VIII, which correspond to forestlands and lands suitable for forestry and thus form part of the State Natural Heritage under Article 13 of Ley Forestal no. 7575. In the eighth ground, he maintains that the Court erred in approving the partial settlement by improperly assessing official communication SINAC-SE-IRT-136-2020, which states that, according to report ACLAP-SRCB-1345-2013, plan 6-2200582-2020 contains no areas declared to be State Natural Heritage; however, the official communication does not include a detailed technical and scientific method demonstrating that plan 6-2200582-2020 contains no State Natural Heritage areas, but merely asserts that the plan contains no such areas based on the aforementioned report.

He states that official communication SINAC-SE-IRT-136-2020 contains no historical photointerpretation study (estudio histórico foto-interpretativo) of aerial and/or satellite imagery conclusively establishing whether the land described in plan 6-2200582-2020 was forested from 1994 to the present. In his view, because there is no technical and scientific study conclusively determining the property’s forest cover since 1994, the judicial approval disregarded the constitutional environmental principles of precaution (precautorio), in dubio pro natura (indubio pro natura), non-regression in environmental matters (no regresión en materia ambiental), the irreducibility of forests (irreductibilidad del bosque), and the objective grounding of environmental protection (objetivación de la tutela ambiental), embodied in Article 50 of the Political Constitution (Constitución Política), which establish that the legal protection of forests must prevail at all times.

In the ninth ground, he alleges that the Court approved the partial settlement based on an improper assessment of report ACLAP-SRCB-1345-2013, which analyzes only plans P-748062-2001 and P-1170755-2007 and concludes that they contain 14,4 and 39,1 hectares of State Natural Heritage, respectively. Nevertheless, he notes that the report does not include a detailed technical and scientific method demonstrating that plan 6-2200582-2020 contains no State Natural Heritage areas and lacks a historical photointerpretation study of aerial and/or satellite imagery, which is necessary to determine conclusively whether the land described in plan 6-2200582-2020 was forested from 1994 to the present. He alleges that the report omits technical and scientific verification of that forest cover since 1994, when Article 15 of Ley de Disolución del Banco Anglo Costarricense no. 7471 established that assets not sold or transferred upon completion of the bank’s liquidation would become State property; furthermore, Decreto Ejecutivo no. 28788-H of 2 de julio de 2000 ordered that certain properties in Puntarenas be donated to the Instituto de Desarrollo Agrario.

In the tenth ground, he maintains that the defect lies in the Court’s improper assessment, when granting judicial approval, of official communication SINAC-SE-IRT-136-2020 and report ACLAP-SRCB-1345-2013, leading it to conclude that the property described in plan 6-2200582-2020 does not encompass State Natural Heritage. He states that neither official communication SINAC-SE-IRT-136-2020 nor report ACLAP-SRCB-1345-2013 contains a technical and scientific study by the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) conclusively demonstrating that plan 6-2200582-2020 falls outside categories VII and VIII, which consist of forestlands and lands suitable for forestry. He considers that the absence of an INTA technical and scientific study conclusively confirming that plan 6-2200582-2020 falls outside those categories means that approval of the settlement disregarded environmental principles of constitutional rank, such as the precautionary principle or in dubio pro natura, the principle of non-regression in environmental matters, the irreducibility of forests, and the objective grounding of environmental protection, also known as the principle of adherence to science and technology (principio de vinculación a la ciencia y la técnica).

In the eleventh ground, he alleges that the defect lies in the Court’s improper assessment, when granting judicial approval, of official communication SINAC-SE-IRT-136-2020 and report ACLAP-SRCB-1345-2013, which merely state that the property described in plan 6-2200582-2020 does not encompass State Natural Heritage. He emphasizes that neither official communication SINAC-SE-IRT-136-2020 nor report ACLAP-SRCB-1345-2013 contains any detailed technical and scientific method explaining and demonstrating why plan 6-2200582-2020 does not encompass State Natural Heritage.

It contends that the SINAC official communications lack a detailed account of their findings, as well as of the technical and evidentiary elements used to conclude that survey plan 6-2200582-2020 does not encompass Patrimonio Natural del Estado. It concludes that the judicial approval (homologación) of the settlement (transacción) disregarded the constitutional environmental principle of objective environmental protection (objetivación de la tutela ambiental), also known as the principle of adherence to science and technology (vinculación a la ciencia y a la técnica), enshrined in Article 50 of the Political Constitution. In the twelfth ground of appeal (agravio), it argues that the Court erred in approving the partial settlement based on an improper assessment of official communication SINAC-SE-IRT-136-2020, which states that, according to the survey of Patrimonio Natural del Estado conducted by Área de Conservación La Amistad Pacífico in report ACLAP-SRCB-1345-2013, survey plan 6-2200582-2020 does not contain areas declared to be Patrimonio Natural del Estado; however, official communication SINAC-SE-IRT-136-2020 lacks a detailed technical and scientific methodology supporting and demonstrating that survey plan 6-2200582-2020 does not contain any area of Patrimonio Natural del Estado, because it merely asserts that, according to report ACLAP-SRCB-1345-2013, the plan does not contain areas declared to be Patrimonio Natural del Estado.

It argues that official communication SINAC-SE-IRT-136-2020 contains no historical photo-interpretive study of aerial or satellite imagery demonstrating with certainty whether the land described in survey plan 6-2200582-2020 was covered by forest from 1994 to the present. Patrimonio Natural del Estado need not be formally declared as such, because Articles 13 and 15 of Ley Forestal no. 7575 protect natural resources by making forests belonging to the State and its public institutions immediately and automatically subject by law to Patrimonio Natural del Estado. It contends that the official communication omitted technical and scientific verification of forest cover (cobertura boscosa) dating back to 1994, because if the land had forest cover in that year, it would have been automatically incorporated into Patrimonio Natural del Estado. In the thirteenth ground, it alleges that, in granting approval, the Court improperly assessed documents SINAC-SE-IRT-136-2020 and ACLAP-SRCB-1345-2013 when it concluded that the property described in survey plan 6-2200582-2020 does not encompass Patrimonio Natural del Estado.

It alleges that both documents lack a technical and scientific land-capability study (estudio técnico-científico del uso conforme de las tierras) by Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA). It states that this study would be necessary to demonstrate with certainty that survey plan number 6-2200582-2020 falls outside Categories VII and VIII, areas of forestland and land suitable for forestry (terrenos forestales y de aptitud forestal) defined in Article 13 of Ley Forestal no. 7575, which include Patrimonio Natural del Estado. It asserts that the absence of this technical and scientific study means that the approval failed to apply constitutional environmental principles, such as the precautionary principle (principio precautorio), or in dubio pro natura (indubio pro natura), the principle of non-regression in environmental matters (principio de no regresión en materia ambiental), the principle of forest irreducibility (principio de irreductibilidad del bosque), and the principle of objective environmental protection, also known as the principle of adherence to science and technology, enshrined in Article 50 of the Political Constitution.

In the fourteenth ground of appeal, it argues that the approval determined that the property described in survey plan 6-2200582-2020 does not encompass Patrimonio Natural del Estado, disregarding the fact that forests belonging to the State and its public institutions are immediately and automatically subject by law to Patrimonio Natural del Estado. It states that the approval of the partial settlement lacks the historical photo-interpretive study of aerial and/or satellite imagery that SINAC must conduct to demonstrate with certainty that, from 1994 to the present, the land described in survey plan 6-2200582-2020 has had forest cover. It asserts that the absence of this study is crucial because, had it been established that the land had forest cover during those years, it would have been automatically incorporated into Patrimonio Natural del Estado pursuant to Article 15 of Ley de Disolución del Banco Anglo Costarricense no. 7471 of December 27, 1994; moreover, Decreto Ejecutivo number 28788-H of July 02, 2000 provided that the properties located in Puntarenas, registration numbers 8508-000 and 12402-000, were to be donated to Instituto de Desarrollo Agrario.

It emphasizes that, because no technical and scientific study existed to determine with certainty the property’s forest cover from 1994 to the present, the approval failed to apply the binding constitutional case law of Sala Constitucional de la Corte Suprema de Justicia, specifically ruling number 16975-2008 of November 12, 2008 and ruling number 7934-2013 of June 14, 2013, which establishes that forests belonging to the State and its public institutions are immediately and automatically subject by law to Patrimonio Natural del Estado. Finally, in the fifteenth ground, it alleges that the approval determined that the property described in survey plan 6-2200582-2020 does not encompass Patrimonio Natural del Estado, disregarding the fact that forestland and land suitable for forestry belonging to the State and its public institutions are immediately and automatically subject by law to Patrimonio Natural del Estado.

It argues that the approval of the partial settlement lacks the technical and scientific land-capability study by Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), which is necessary to demonstrate with certainty that survey plan number 6-2200582-2020 falls outside Categories VII and VIII, corresponding to areas of forestland and land suitable for forestry. It states that, because no technical and scientific study by INTA existed to determine with certainty that survey plan number 6-2200582-2020 falls outside areas of forestland and land suitable for forestry, the approval failed to apply the binding constitutional case law of Sala Constitucional de la Corte Suprema de Justicia, established in ruling number 16975-2008 of November 12, 2008 and ruling number 7934-2013 of June 14, 2013, which establishes that areas of forestland and land suitable for forestry belonging to the State and its public institutions are immediately and automatically subject by law to Patrimonio Natural del Estado.

VII.Having analyzed the foregoing arguments, it is evident that the appellant in cassation (casacionista) has not complied with the rules that must be observed when filing an extraordinary appeal in cassation (recurso extraordinario de casación). With respect to the claims of error based on the violation of substantive provisions, it must be noted that, at this procedural stage, it is not sufficient to state a series of errors; it is also necessary to indicate how each error occurred. In all fifteen claims of error, the appellant fails to develop his arguments beyond mere disagreements with the established facts and with the evidence (probanza) that he considers to have been improperly assessed. He overlooks the fact that this procedural instance is not an ordinary appeal (such as an appeal on appeal), nor is it sufficient to express a series of general and merely argumentative disagreements, since it is necessary, as stated above, to contrast the decision with the general violation that, in his view, occurred.

Based on the explanation provided in Considerando V, it is clear that both arguments, set forth in the grounds for the appeal, lack the legal reasoning that would systematically and specifically challenge the grounds of the appealed decision through other legal arguments, rather than through mere general disagreements. Mere references to reasons subjectively regarded as violations committed by the Tribunal are insufficient to support the arguments and, on that basis, seek to discredit the Judges’ assessment of certain matters and of evidence that the appellant considers to have been disregarded or improperly assessed. It is essential to cite the legal provisions he considers violated and connect or relate them to each item of evidence improperly assessed, or at least provide sufficient justification if he considers that to be the substantive law being challenged. Such analysis and effort are absent from these claims.

In view of these requirements, it is his duty, as an interested party, to demonstrate carefully and precisely the specific reasons why he considers his rights to have been violated and to identify the legal provisions he considers infringed, as a corollary to the claim asserted. In light of these requirements, the appeal in cassation must be self-contained and fully comprehensible, so that the Sala Primera or the Tribunal de Casación may perform its proper review function without being compelled to interpret the appeal or, even more so, to act as a trial judge in order to determine what the appellant means—that is, to clarify everything that should have been stated explicitly and comprehensibly. All the evidence alleged in those sections of the appeal to have been disregarded or improperly assessed lacks a legal analysis; that is, it is not connected to the legal grounds underlying the claims.

This analysis is absent, despite being a logical and indispensable requirement when alleging an indirect violation of provisions due to an error of fact (error de hecho) or an error of law (error de derecho) (artículos 138 incisos a), b) y 140 inciso c) del CPCA). Therefore, due to an error in the manner in which the appeal was presented, he fails to cite and analyze the substantive provisions allegedly violated, namely, those applicable to the case under review. The arguments cited contain no analysis whatsoever of the substantive provisions that were allegedly violated. In any event, it is noted that merely citing provisions or invoking a series of rules is insufficient; the analysis discussed herein must be carried out. Nor is the requirement satisfied by citing procedural rules or rules governing the assessment of evidence. All of the foregoing, it bears repeating, is an essential requirement of a technical and extraordinary remedy such as an appeal in cassation.

Each claim is independent, and this analysis must be conducted for each argument using the provisions applicable to the case. Thus, the allegations raised in the matter under review amount to nothing more than argumentative criticism and reproach of the decision, without explaining how, pursuant to canon 140 inciso c) del CPCA, the appealed decision contravenes the body of applicable law (bloque de legalidad), since the appellant neither invokes nor explains the substantive provisions allegedly violated by the judicial ruling. Under these circumstances, the stated arguments lack the reasoning required by the CPCA, and this cassation body will therefore also reject them.

VIII.In sum, because none of his objections has prevailed, the appeal must be denied. Pursuant to artículo 150.3 del Código Procesal Contencioso Administrativo, INDER, as appellant before the Sala, must be ordered to pay the costs incurred through the pursuit of this proceeding.

POR TANTO

The appeal is summarily denied. The costs incurred through the pursuit of this proceeding shall be borne by the appellant. Documento PJEDITOR Res. 001139-F-S1-2024 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas treinta y cinco minutos del treinta de agosto de dos mil veinticuatro.

Proceso de conocimiento interpuesto por ELOY MÉNDEZ RAMÍREZ; contra el ESTADO, el INSTITUTO DE DESARROLLO RURAL y el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN; en el cual, el representante del INDER interpone recurso de casación en contra de la resolución no. 636-2023 de las 14 horas 11 minutos del 10 de mayo de 2023, que resuelve sobre la homologación de transacción parcial, así como su adición y aclaración emitida a las 15 horas 7 minutos del 28 de junio de 2023, ambas dictadas por el Tribunal Contencioso Administrativo, del II Circuito Judicial de San José; integrado por el juez Gerardo Antonio Pérez Alfaro. Intervienen, el licenciado Daniel Rojas Pochet, como apoderado especial judicial del actor; el licenciado Jonathan Jiménez Ruiz, como apoderado especial judicial del INDER; el licenciado Andrés Alvarado Ramírez, como apoderado especial judicial del SINAC; y la procuradora Yannia Salas Víquez, en representación del Estado.

CONSIDERANDO

I.Se califica la casación como una instancia de carácter extraordinario, básicamente por dos razones. En primer término, porque no toda resolución judicial es pasible de tal recurso, sino tan sólo las contempladas en la ley. Y, en segundo lugar, porque las causales de impugnación en esa etapa revisora no son abiertas, sino preestablecidas, de igual modo, por el ordenamiento jurídico. En lo relativo al primer aspecto, cabe señalar, como regla general, que son susceptibles del recurso de casación las sentencias y los autos con carácter de sentencia capaces de producir cosa juzgada material. Frente a esta fórmula genérica, el propio CPCA, puntualiza algunas resoluciones particulares a las cuales se les concede esta opción. A manera de ejemplo, se encuentran en esta posibilidad: la que declara la inadmisibilidad de la demanda (art. 62.3) y la que declara con lugar las defensas previas indicadas en el apartado 6) del canon 92 del Código de cita.

Por ende, los autos comunes y las resoluciones que no definan el fondo del asunto o no pongan término al proceso, tienen vedado el paso recursivo a la etapa casacional. En lo que atañe a las causales, cabe agregar que opera la dualidad entre las procesales y las sustantivas. Así se plasma en los preceptos 137 y 138 Ibid. Para las primeras se efectúa un listado en términos amplios, de gran cobertura, y en los presupuestos que procede, ajustados a las reglas de la oralidad. Respecto de los sustantivos, se prevé la posible infracción de los elementos probatorios (por desapego o contradicción con ellos, o bien, preterición o indebida valoración), denominada comúnmente “violación indirecta”. Por otro lado, formando parte de este último grupo, se encuentra la infracción estrictamente normativa, que ocurre en el supuesto de una aplicación indebida, una incorrecta interpretación o una desaplicación reprochable de la norma, conocida en la tradición jurídica costarricense como “violación directa”.

II.Una vez hecha la mención de las resoluciones sobre las que cabe recurso de casación y sus causales, se hace imprescindible enfocar los requisitos necesarios para su admisibilidad. En este sentido, bueno es recordar que la vocación antiformalista con que irrumpe el CPCA en el ordenamiento jurídico costarricense permea todos y cada uno de sus propios institutos. De esta manera, el recurso de casación se libera también de excesivos requisitos de admisibilidad, con el fin de que el órgano casacional (como vértice del sistema) pueda ingresar, las más de las veces, al análisis de los quebrantos alegados, sean procesales o sustantivos, en cumplimiento del fin esencial de esta instancia jurisdiccional y de quien a ella acude. Es así como se ha establecido una casación menos rigurosa en lo relativo a los aspectos de admisibilidad, sin abandonar el tecnicismo que le es propio ni su naturaleza y esencia, pues al fin y al cabo se mantiene incólume su rol y finalidad dentro del régimen procesal moderno.

III.Ahora bien, pese a la informalidad que propugna la legislación procesal vigente para formular el recurso de casación, se articulan, como es lógico, una serie de requisitos mínimos e imprescindibles relativos al tiempo, lugar y forma. Se crean mediante ley, en tanto imprescindibles para este particular recurso extraordinario, ya que sin ellos no habría orden ni equilibrio procesal; empero, han de interpretarse de manera flexible y razonable, pues precisa recordar que los señalados en el artículo 139 del Código de referencia, son los únicos requisitos y formalidades previstos para el recurso de casación, según lo señala el inciso 5) de ese mismo precepto. De esta manera, en el apartado 1) de la norma recién citada, se establece que el recurso en mención deberá presentarse directamente ante la Sala Primera de la Corte Suprema de Justicia o ante el Tribunal de Casación de lo Contencioso Administrativo.

Se modifica, en forma leve para el contencioso administrativo, el sistema hasta ahora vigente en la legislación procesal civil, dado que ahora la Sala o el Tribunal no solo se pronuncia sobre la admisibilidad; de conformidad con el canon 142.1 del Código de la materia, lo pone en conocimiento de la parte contraria por el plazo de 10 días (notificándole por el medio que haya establecido, de acuerdo con la comunicación que le fue girada de previo por el órgano jurisdiccional de instancia). Se busca con esto la estandarización del régimen recursivo que presenta el Código, dado que, por regla, sean ordinarios o extraordinarios, se presentan directamente ante el superior encargado de conocerlos. En otro orden de ideas, en el mismo acápite normativo, se establece el plazo para su interposición: 15 días hábiles contados a partir del día hábil siguiente de notificadas todas las partes. Si se hubiere interpuesto adición o aclaración, el plazo indicado empezará a correr a partir del día hábil siguiente de notificadas todas las partes de lo resuelto sobre ello.

Superado el tiempo y lugar de presentación se enumeran, en el apartado 2), una serie de requisitos de “información” e “identificación” del recurrente y del proceso que, por su naturaleza (“datos”, “información de trámite”), pueden ser subsanados en el plazo de tres días, a tenor de lo dispuesto en el numeral 141 del mismo cuerpo normativo. Así, deberá indicarse: a) el tipo de proceso; b) el nombre completo de las partes; c) la firma del recurrente o recurrentes autenticada por abogado; d) hora y fecha de la resolución recurrida; e) número de expediente en el cual fue dictada y f) medio para recibir notificaciones. Con ello se completa el listado simple de exigencias instrumentales o adjetivas del recurso. Sólo en el evento de que se incumpla la prevención dictada al efecto, se dispondrá el rechazo de plano y, por ende, el archivo del asunto, pero en ese caso, no sólo por la omisión misma, sino por la desatención a lo prevenido judicialmente.

IV.A los anteriores requisitos se añade un último requerimiento material (artículo 139.3 ibídem), en tanto necesario para la admisibilidad y para la posterior valoración del recurso por el fondo. Se trata de la motivación del recurso, que por las características de la casación ha de ser clara y precisa. En este sentido debe contener, tal como lo dispone el precepto de comentario, la fundamentación fáctica y jurídica del caso. Fáctica, en la medida en que se muestre inconforme con los hechos que se han tenido por demostrados o por indemostrados (lo cual lleva a la ponderación de las probanzas) o con los las circunstancias acaecidas en la violación de normas procesales; y jurídica, cuando se trata de un problema que se expone acerca de la aplicación, omisión o indebida interpretación de cualquier norma que integre el bloque de juricidad, incluidos, por supuesto, los principios de rango constitucional o aquella que también opera por efecto reflejo o indirecto, después de que se modifican los hechos de la sentencia impugnada.

Tanto en la infracción procesal, como en la probatoria, puede concurrir, junto con las razones jurídicas (siempre necesarias), las de carácter fáctico, y en ese sentido, los fundamentos de referencia deberán ser dirigidos en ambas vertientes, so pena de inadmisibilidad. Por su parte, es necesario aclarar que de la fundamentación jurídica se exonera, por expreso mandato legal, la indicación de aquellos cánones relativos al valor del elemento o elementos probatorios mal apreciados. De igual forma, no es indispensable citar los preceptos que establecen los requisitos, plazos y reglas básicas para la admisión del recurso. Antes que la cita de estas últimas, lo imprescindible es que se cumplan, que se pongan en práctica al momento de elaborar e interponer la casación. Así las cosas, la fundamentación dispuesta por ley puede entenderse, grosso modo, como aquella argumentación técnico-jurídica en la que se mencionan una serie de artículos, o reglas jurídicas entrelazadas o concatenadas entre sí, y vinculadas razonablemente en una doble perspectiva: con los argumentos del recurso y con la sentencia que se ataca.

En la medida en que se cite un conjunto de normas jurídicas (o si es del caso, una sola de ellas) atinente y vinculada de manera clara con la sentencia combatida (ya sea en el sustento de hecho o derecho) y los argumentos del recurso, hay fundamentación jurídica. Los agregados jurisprudenciales o las eventuales citas doctrinales, reforzarán en ocasiones las alegaciones efectuadas, pero, por lo general, no hacen a su esencia. Como lo ha dispuesto ya la Sala Primera y este Tribunal de Casación, interpretando el artículo 139 de referencia, “se requiere que el recurso cuente con una fundamentación jurídica mínima [...] deben explicarse las razones en las cuales sustenta su gestión, combatiendo los argumentos de derecho de la sentencia recurrida y consignando, al menos, alguna referencia normativa que le dé sustento” (resolución no. 318-A-2008, de las 14 horas 25 minutos del 8 de mayo de 2008).

La fundamentación es, por tanto, ajena al despliegue confuso de normas y alegatos; a la mezcla de argumentos ininteligibles o a la simple exposición de opiniones sobre la procedencia o justicia del caso; o bien, al recuento de los desaciertos que se consideran cometidos en la sentencia recurrida sin respaldo en normas o criterios jurídicos. De allí que, si el recurso omite por completo esa relación técnico-normativa a la que se ha hecho referencia o la que realiza resulta impertinente o desvinculada al caso de manera manifiesta y evidente, habrá que entender que carece de “total fundamentación jurídica”, y, por tanto, incumple el necesario requisito establecido en el numeral 139.3, que se sanciona con el rechazo de plano, a tenor de lo dispuesto en el artículo 140 inciso c), ambos del mismo Código de referencia.

V.En la especie, el apoderado del INDER pretende someter a conocimiento de esta Sala la resolución no. 636-2023, dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda, Segundo Circuito Judicial de San José, a las 14 horas 11 minutos del 10 de mayo de 2023 y la que resolvió la adición y aclaración de las 15 horas 07 minutos del 28 de junio de 2023, mediante la cual dispuso: “De conformidad con lo expuesto, y con el artículo 76 del Código Procesal Contencioso Administrativo, se homologa el acuerdo de transacción parcial presentado, el cual se estableció en los siguientes términos: "PRIMERO: Que el señor ELOY MÉNDEZ RAMÍREZ, se compromete a respetar perpetuamente las áreas de bosque y patrimonio natural del Estado de conformidad con las regulaciones de la Ley Forestal y la Ley Orgánica del Ambiente. SEGUNDO: Que, en este mismo acto, la representación del SINAC manifiesta estar conforme con el inmueble descrito por el plano catastrado 6-2200582-2020 en el tanto, dicho inmueble no abarca áreas de patrimonio natural del Estado según lo indicado por los oficios SINAC-SE-IRT-136-2020 del 08 de agosto de 2020 emitido por el Departamento del Información y Regularización Territorial del SINAC y el informe ACLAP-SRCB-1345-2013 del 31 de octubre de 2013.

TERCERO: Siendo que, el inmueble descrito por el plano 6-2200582-2020 objeto del proceso no abarca patrimonio natural del Estado, la parte promovente desiste de la demanda contra el Estado y con el SINAC por carecer de interés actual porque no existen pretensiones contra los codemandados. CUARTO: Cada parte correrá con las costas propias de este asunto. QUINTO: Notificaciones. Las partes indican el siguiente lugar para notificaciones derivadas del presente acuerdo: Eloy Méndez Ramírez: Con su apoderado especial judicial, Daniel Rojas Pochet, mediante el correo electrónico [email protected], y subsidiariamente, el fax 2290-1405 / 2201-8707. SINAC: Mediante el correo electrónico [email protected] y subsidiariamente el correo [email protected]”. El mismo es de acatamiento obligatorio y produce cosa juzgada. En caso de incumplimiento, se procederá conforme al procedimiento de ejecución de sentencia.” (el subrayado y resaltado es del original.

VI.El casacionista presenta su recurso estructurado en quince agravios, todos por violación de normas sustantivas, alegando una indebida valoración de la prueba y una indebida fundamentación jurídica. Señala, se está en presencia de la causal del artículo 134 inciso 1) y el artículo 138 incisos a), c) y d) del Código Procesal Contencioso Administrativo. En el primer agravio, acusa la homologación efectuada por el Tribunal Contencioso Administrativo incurre en una indebida valoración probatoria, lo cual viola el artículo 82 inciso 4) del CPCA. Considera, este error transgrede las reglas de la sana crítica y el principio de valoración razonable de la prueba, esenciales para el debido proceso. Afirma, el error radica en no reconocer que el plano número 6-2200582-2020 estaba cancelado en el Registro Nacional. Manifiesta, al homologar la transacción parcial sin considerar esta cancelación, se otorgó validez jurídica a un plano catastral inválido, violando así las normas fundamentales de valoración de la prueba y el debido proceso.

En el segundo agravio, acusa el Tribunal incurre en un error al homologar la transacción parcial basándose incorrectamente en la valoración del informe ACLAP-SRCB-1345-2013 del 31 de octubre de 2013, emitido por el Área de Conservación La Amistad Pacífico del Sistema Nacional de Áreas de Conservación. Sostiene, dicho informe únicamente analiza los planos P-748062-2001 y P-1170755-2007, concluyendo que: 1. El plano P-748062-2001 presenta 14.4 hectáreas de Patrimonio Natural del Estado, y, 2. El plano P-1170755-2007 presenta 39.1 hectáreas de Patrimonio Natural del Estado; sin embargo, el informe no analiza el inmueble descrito en el plano 6-2200582-2020, ya que dicho plano fue elaborado en 2020, posteriormente a la emisión del informe en 2013. Además, menciona, el informe no concluye que el plano 6-2200582-2020 no presente áreas de Patrimonio Natural del Estado y se refiere exclusivamente a los planos P-748062-2001 y P-1170755-2007, no al plano 6-2200582-2020.

En el tercer agravio, acusa que se homologó erróneamente la transacción parcial basándose incorrectamente en la valoración del oficio SINAC-SE-IRT-136-2020 del 8 de agosto de 2020, emitido por el Departamento de Información y Regulación Territorial del Sistema Nacional de Áreas de Conservación, el cual afirma que, según el informe ACLAP-SRCB-1345-2013, el plano 6-2200582-2020 no presenta áreas declaradas como Patrimonio Natural del Estado. Sin embargo, este oficio carece de un método técnico-científico detallado que sustente esta afirmación. Destaca, el informe ACLAP-SRCB-1345-2013, analiza únicamente los planos P-748062-2001 y P-1170755-2007, concluyendo que: 1. El plano P-748062-2001 presenta 14,4 hectáreas de Patrimonio Natural del Estado, y 2. El plano P-1170755-2007 presenta 39,1 hectáreas de Patrimonio Natural del Estado. Plantea, el informe no analiza el plano 6-2200582-2020, ya que fue elaborado en 2020, posterior a la emisión del informe en 2013.

Por lo tanto, el informe no contiene ninguna conclusión sobre la ausencia de áreas de Patrimonio Natural del Estado en el plano 6-2200582-2020, y solo se refiere a los planos P-748062-2001 y P-1170755-2007. En el cuarto agravio, sostiene que el Tribunal homologó la transacción parcial basándose incorrectamente en la valoración del oficio SINAC-SE-IRT-136-2020, ya que dicho oficio indica que, según el informe ACLAP-SRCB-1345-2013, el plano 6-2200582-2020 no presenta áreas declaradas como Patrimonio Natural del Estado. Sin embargo, este oficio carece de un método técnico-científico detallado que demuestre que el plano 6-2200582-2020 no presenta ninguna área de Patrimonio Natural del Estado. Simplemente, se basa en el informe ACLAP-SRCB-1345-2013, el cual únicamente analiza los planos P-748062-2001 y P-1170755-2007. Agrega, el oficio SINAC-SE-IRT-136-2020 no contiene un estudio técnico-científico histórico de imágenes aéreas o satelitales que demuestre con certeza la cobertura boscosa del terreno descrito en el plano 6-2200582-2020 desde 1994 hasta la fecha, y, según los artículos 13 y 15 de la Ley Forestal no. 7575, los bosques del Estado y de las instituciones públicas cuentan con una afectación legal inmediata y automática al Patrimonio Natural del Estado si están cubiertos de bosque.

Además, el Decreto Ejecutivo no. 28788-H del 2 de julio de 2000 dispuso que los inmuebles en Puntarenas, matrículas 8508-000 y 12402-000, fueran donados al Instituto de Desarrollo Agrario. En el quinto motivo, acusa que el Tribunal homologó la transacción parcial basándose erróneamente en el oficio SINAC-SE-IRT-136-2020, ya que dicho oficio afirma que, según el informe ACLAP-SRCB-1345-2013, el plano 6-2200582-2020 no presenta áreas declaradas como Patrimonio Natural del Estado. Sin embargo, el oficio carece de un método técnico-científico detallado que demuestre esta afirmación. Simplemente, a su parecer, se basa en el informe ACLAP-SRCB-1345-2013, que únicamente analiza los planos P-748062-2001 y P-1170755-2007, concluyendo que 1. El plano P-748062-2001 presenta 14,4 hectáreas de Patrimonio Natural del Estado, y 2. El plano P-1170755-2007 presenta 39,1 hectáreas de Patrimonio Natural del Estado.

Indica, el informe ACLAP-SRCB-1345-2013 no analiza el plano 6-2200582-2020, ya que fue elaborado en 2020, posterior a la emisión del informe en 2013. Por lo tanto, el informe no contiene ninguna conclusión sobre la ausencia de áreas de Patrimonio Natural del Estado en el plano 6-2200582-2020 y solo se refiere a los planos P-748062-2001 y P-1170755-2007. En el sexto agravio, sostiene que el Tribunal homologó la transacción parcial basándose en una indebida valoración probatoria del oficio SINAC-SE-IRT-136-2020, resultando en la inaplicación de los artículos 13 y 15 de la Ley Forestal no. 7575, los cuales protegen los bosques del Estado y de sus instituciones públicas, incorporándolos automáticamente al Patrimonio Natural del Estado si están cubiertos de bosque. Expresa, dicho oficio señala que, según el informe ACLAP-SRCB-1345-2013, el plano 6-2200582-2020 no presenta áreas declaradas como Patrimonio Natural del Estado, sin embargo, este oficio carece de un método técnico-científico detallado que demuestre con precisión que el plano 6-2200582-2020 no presenta ninguna área de Patrimonio Natural del Estado.

Destaca, se basa únicamente en el informe ACLAP-SRCB-1345-2013, que analiza solo los planos P-748062-2001 y P-1170755-2007; y el oficio mencionado supra, no contiene un estudio técnico-científico histórico de imágenes aéreas o satelitales que demuestre si el terreno descrito en el plano 6-2200582-2020 estuvo cubierto de bosque desde 1994 hasta la fecha. En el sétimo motivo, acusa que se dio una indebida valoración probatoria del oficio SINAC-SE-IRT-136-2020 y del informe ACLAP-SRCB-1345-2013 del 31 de octubre de 2013, ambos emitidos por el Sistema Nacional de Áreas de Conservación, dejándose de aplicar el artículo 13 de la Ley Forestal no. 7575, que protege los terrenos forestales o de aptitud forestal del Estado y de sus instituciones públicas, integrándolos al Patrimonio Natural del Estado. Argumenta, ni el oficio SINAC-SE-IRT-136-2020, ni el informe ACLAP-SRCB-1345-2013 contienen el estudio técnico-científico del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) que demostraría con certeza que el plano número 6-2200582-2020 se encuentra fuera de las categorías VII y VIII, las cuales corresponden a terrenos forestales y de aptitud forestal, conformando así el Patrimonio Natural del Estado según el artículo 13 de la Ley Forestal no. 7575.

En el octavo agravio, sostiene que el Tribunal incurrió en un error al homologar la transacción parcial, realizando una indebida valoración del oficio SINAC-SE-IRT-136-2020, el cual indica que, según el informe ACLAP-SRCB-1345-2013, el plano 6-2200582-2020 no presenta áreas declaradas como Patrimonio Natural del Estado, sin embargo, este oficio no incluye un método técnico-científico detallado que demuestre que el plano 6-2200582-2020 no contiene áreas de Patrimonio Natural del Estado, limitándose a afirmar que el plano no presenta dichas áreas, basándose en el informe mencionado. Señala, el oficio SINAC-SE-IRT-136-2020 no contiene un estudio histórico foto-interpretativo de imágenes aéreas y/o satelitales que demuestre con certeza si el terreno descrito en el plano 6-2200582-2020 estuvo cubierto de bosque desde 1994 hasta la fecha. A su parecer, al carecer de un estudio técnico-científico que determine con certeza la cobertura boscosa del inmueble desde 1994, la homologación ignoró los principios ambientales constitucionales de precautorio, indubio pro natura, no regresión en materia ambiental, irreductibilidad del bosque y la objetivación de la tutela ambiental incorporados en el artículo 50 de la Constitución Política, que establecen la prevalencia de la protección jurídica del bosque en todo momento.

En el noveno motivo, acusa que el Tribunal homologó la transacción parcial basándose en una indebida valoración del informe ACLAP-SRCB-1345-2013, el cual solamente analiza los planos P-748062-2001 y P-1170755-2007, concluyendo que estos presentan 14,4 y 39,1 hectáreas de Patrimonio Natural del Estado, respectivamente. No obstante, menciona, el informe no incluye un método técnico-científico detallado que demuestre que el plano 6-2200582-2020 no presenta áreas de Patrimonio Natural del Estado, careciendo de un estudio histórico foto-interpretativo de imágenes aéreas y/o satelitales, necesario para determinar con certeza si el terreno descrito en el plano 6-2200582-2020 estuvo cubierto de bosque desde 1994 hasta la fecha. Acusa, el informe omite la comprobación técnica y científica de dicha cobertura boscosa desde 1994, cuando el artículo 15 de la Ley de Disolución del Banco Anglo Costarricense no. 7471 estableció que los bienes no vendidos o transferidos al finalizar la liquidación del banco pasarán a ser propiedad del Estado, además, el Decreto Ejecutivo no. 28788-H del 2 de julio de 2000 dispuso que ciertos inmuebles en Puntarenas fueran donados al Instituto de Desarrollo Agrario.

En el décimo agravio, sostiene que el vicio consiste en que la homologación del Tribunal valoró indebidamente el oficio SINAC-SE-IRT-136-2020 y el informe ACLAP-SRCB-1345-2013, concluyendo que el inmueble descrito en el plano 6-2200582-2020 no abarca Patrimonio Natural del Estado. Expresa, tanto el oficio SINAC-SE-IRT-136-2020, como el informe ACLAP-SRCB-1345-2013, no contienen un estudio técnico-científico del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) que demuestre con certeza que el plano 6-2200582-2020 se encuentra fuera de las categorías VII y VIII, que son terrenos forestales y de aptitud forestal. Considera, la ausencia de un estudio técnico-científico del INTA que confirme con certeza que el plano 6-2200582-2020 está fuera de estas categorías implica que la homologación de la transacción ignoró principios ambientales de rango constitucional, como el principio precautorio o indubio pro natura, el principio de no regresión en materia ambiental, la irreductibilidad del bosque y la objetivación de la tutela ambiental o el principio de vinculación a la ciencia y la técnica.

En el décimo primer motivo, acusa que el vicio consiste en que la homologación del Tribunal valoró indebidamente que el oficio SINAC-SE-IRT-136-2020 y el informe ACLAP-SRCB-1345-2013, simplemente indicando que el inmueble descrito en el plano 6-2200582-2020 no abarca Patrimonio Natural del Estado. Destaca, tanto el oficio SINAC-SE-IRT-136-2020, como el informe ACLAP-SRCB-1345-2013, no contienen ningún método técnico-científico detallado que argumente y demuestre por qué el plano 6-2200582-2020 no abarca Patrimonio Natural del Estado. Considera, los oficios del SINAC carecen de una relación detallada de sus resultados, así como de los elementos técnicos y probatorios utilizados para concluir que el plano 6-2200582-2020 no abarca Patrimonio Natural del Estado. Concluye, la homologación de la transacción ignoró el principio ambiental de rango constitucional de la objetivación de la tutela ambiental, o el principio de vinculación a la ciencia y a la técnica, incorporado en el artículo 50 de la Constitución Política.

En el décimo segundo agravio, sostiene que el error del Tribunal radica en homologar la transacción parcial mediante una valoración indebida del oficio SINAC-SE-IRT-136-2020, el cual señala que, según el levantamiento del Patrimonio Natural del Estado realizado por el Área de Conservación La Amistad Pacífico en el informe ACLAP-SRCB-1345-2013, el plano 6-2200582-2020 no presenta áreas declaradas como Patrimonio Natural del Estado; sin embargo, el oficio SINAC-SE-IRT-136-2020 carece de un método técnico-científico detallado que argumente y demuestre que el plano 6-2200582-2020 no presenta ninguna área de Patrimonio Natural del Estado, ya que simplemente se limita a afirmar que, según el informe ACLAP-SRCB-1345-2013, dicho plano no presenta áreas declaradas como Patrimonio Natural del Estado. Sostiene, el oficio SINAC-SE-IRT-136-2020 no contiene ningún estudio histórico foto-interpretativo de imágenes aéreas o satelitales que demuestre con certeza si el terreno descrito en el plano 6-2200582-2020 estaba cubierto de bosque desde 1994 hasta el presente.

No es necesario que el Patrimonio Natural del Estado sea declarado como tal, ya que los artículos 13 y 15 de la Ley Forestal no. 7575 protegen los recursos naturales para que los bosques del Estado y sus instituciones públicas tengan una afectación legal inmediata y automática al Patrimonio Natural del Estado. Considera, dicho oficio omitió la comprobación técnica y científica de la cobertura boscosa desde 1994, dado que, si el terreno tuvo cobertura boscosa en ese año, se incorporaría automáticamente al Patrimonio Natural del Estado. En el décimo tercer motivo, acusa que la homologación del Tribunal valoró indebidamente los documentos SINAC-SE-IRT-136-2020 y ACLAP-SRCB-1345-2013, al concluir que el inmueble descrito en el plano 6-2200582-2020 no abarca Patrimonio Natural del Estado. Acusa, ambos documentos carecen de un estudio técnico-científico del uso conforme de las tierras del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA).

Revela, este estudio sería necesario para demostrar con certeza que el plano número 6-2200582-2020 está fuera de las categorías VII y VIII, áreas de terrenos forestales y de aptitud forestal definidas en el artículo 13 de la Ley Forestal no. 7575, que incluyen el Patrimonio Natural del Estado. Afirma, la falta de este estudio técnico-científico implica que la homologación omitió aplicar los principios ambientales de rango constitucional, tales como el principio precautorio o indubio pro natura, el principio de no regresión en materia ambiental, el principio de irreductibilidad del bosque y el principio de objetivación de la tutela ambiental, o principio de la vinculación a la ciencia y a la técnica, consagrados en el artículo 50 de la Constitución Política. En el décimo cuarto agravio, sostiene que la homologación determinó que el inmueble descrito en el plano 6-2200582-2020 no abarca Patrimonio Natural del Estado, ignorando que los bosques del Estado y de sus instituciones públicas tienen una afectación legal inmediata y automática al Patrimonio Natural del Estado.

Expresa, la homologación de la transacción parcial carece del estudio histórico foto-interpretativo de imágenes aéreas y/o satelitales que debe realizar el SINAC para demostrar con certeza que, desde 1994 hasta el presente, el terreno descrito en el plano 6-2200582-2020 ha tenido cobertura boscosa. Afirma, la falta de este estudio es crucial, ya que, si se hubiera comprobado que el terreno tenía cobertura boscosa durante esos años, este se habría incorporado automáticamente al Patrimonio Natural del Estado, según lo dispuesto en el artículo 15 de la Ley de Disolución del Banco Anglo Costarricense no. 7471 del 27 de diciembre de 1994; además, el Decreto Ejecutivo número 28788-H del 02 de julio del 2000 dispuso que los inmuebles ubicados en Puntarenas, matrículas número 8508-000 y 12402-000, fueran donados al Instituto de Desarrollo Agrario. Destaca, al no existir un estudio técnico-científico que determinara con certeza la cobertura boscosa del inmueble desde 1994 hasta el presente, la homologación omitió aplicar la jurisprudencia constitucional de carácter vinculante de la Sala Constitucional de la Corte Suprema de Justicia, específicamente el voto número 16975-2008 del 12 de noviembre de 2008 y el voto número 7934-2013 del 14 de junio de 2013, que establece que los bosques del Estado y de sus instituciones públicas tienen una afectación legal inmediata y automática al Patrimonio Natural del Estado.

Finalmente, en el décimo quinto motivo, acusa que la homologación determinó que el inmueble descrito en el plano 6-2200582-2020 no abarca Patrimonio Natural del Estado, ignorando que los terrenos forestales y de aptitud forestal del Estado y de sus instituciones públicas tienen una afectación legal inmediata y automática al Patrimonio Natural del Estado. Argumenta, la homologación de la transacción parcial carece del estudio técnico-científico del uso conforme de las tierras del Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), necesario para demostrar con certeza que el plano número 6-2200582-2020 se encuentra fuera de las categorías VII y VIII, que corresponden a áreas de terrenos forestales y de aptitud forestal. Indica, al no existir un estudio técnico-científico del INTA que determinara con certeza que el plano número 6-2200582-2020 se encuentra fuera de áreas de terrenos forestales y de aptitud forestal, la homologación omitió aplicar la jurisprudencia constitucional de carácter vinculante de la Sala Constitucional de la Corte Suprema de Justicia, establecida en el voto número 16975-2008 del 12 de noviembre de 2008 y en el voto número 7934-2013 del 14 de junio de 2013, que establece que las áreas de terrenos forestales y de aptitud forestal del Estado y de sus instituciones públicas tienen una afectación legal inmediata y automática al Patrimonio Natural del Estado.

VII.Analizados los anteriores planteamientos, se observa que el casacionista no respeta, las reglas que es menester acatar a la hora de interponer un recurso extraordinario de casación. En relación con los agravios por violación de normas sustantivas, hay que indicar, no basta en esta etapa procesal, expresar una serie de yerros, también es necesario indicar, la forma cómo este se presentó. En todos los quince agravios, el recurrente no se preocupa por desarrollar las exposiciones más allá de las simples disconformidades de criterio con los hechos probados y con la probanza que estima indebidamente valorada. Olvida que esta instancia procesal, no corresponde a un recurso ordinario (como es el de apelación), ni resulta suficiente manifestar una serie de disconformidades generales y meramente argumentativas, en tanto es menester, según se ha dicho, el contraste de lo decidido con la infracción general que, en su criterio, tuvo lugar.

A partir de lo que se explicó en el considerando V, es claro que ambos alegatos, reseñados en los motivos del recurso, carecen de la fundamentación jurídica que, de manera sistemática y específica, combata los fundamentos de la resolución recurrida con otras razones normativas, y no con simples y genéricas disconformidades de criterio. No basta con hacer meras referencias a razones que subjetivamente se estimen como violaciones cometidas por el Tribunal para sustentar los planteamientos, pretendiendo, a partir de ello, desvirtuar la consideración de los Jueces sobre determinados extremos y en relación con probanza que estima fue preterida o indebidamente valorada. Es indispensable citar las normas jurídicas que estima lesionadas, vincularlas o relacionarlas con cada probanza indebidamente valorada, o al menos justificarla suficientemente, si estima que ese es el derecho de fondo combatido.

Ejercicio y esfuerzo que se extraña en estos cargos. En orden a tales exigencias, es deber suyo, como parte interesada, evidenciar con cuidado y precisión los motivos concretos por los que se estima vulnerado en sus derechos, y particularizar las normas jurídicas que considera violadas, corolario del cargo que realiza. El recurso de casación, en orden a tales exigencias, debe bastarse a sí mismo, en cuanto a su cabal entendimiento, para que la Sala Primera o el Tribunal de Casación lleve a cabo la labor contralora que le es propia y evitar que tenga que verse obligada a interpretarlo, más aún, realizar una labor de juez de instancia, a fin de desentrañar a qué se refiere el recurrente, es decir, esclarecer todo aquello que debió decir de modo explícito y comprensible. Toda la probanza acusada de preterida e indebidamente valorada en esos apartados del recurso, carecen de análisis normativo; es decir, no se encuentran relacionados a los fundamentos jurídicos de sus motivos.

Se extraña este análisis, requisito lógico e indispensable si se recurre violación indirecta de normas por error de hecho y de derecho (artículos 138 incisos a), b) y 140 inciso c) del CPCA). Ergo, por un error en la técnica del recurso, omite citar y analizar la normativa de fondo lesionada, sea aquella atinente al caso en estudio. En los planteamientos citados, no se encuentra un solo análisis a los preceptos de fondo que se habrían violentado. En todo caso, se advierte, no basta citar los preceptos o traer a colación una serie de normas, es necesario realizar el desarrollo aquí comentado. Tampoco citando normas procesales o de valoración probatoria se tiene por solventado el requerimiento. Todo lo anterior, se insiste, es un requisito esencial de un recurso técnico y extraordinario como el de casación. Cada cargo es independiente y este enfoque debe realizarse en cada planteamiento con las normas atinentes al caso.

Así, los alegatos traídos al asunto que se analiza, no van más allá de la simple referencia argumentativa y de reproche contra lo resuelto, sin que se refiera la forma en la que, conforme lo establece el canon 140 inciso c) del CPCA, la resolución recurrida contraviene el bloque de legalidad, ya que no esgrime ni explica la normativa sustantiva, que haya sido quebrantada por el fallo judicial. En estas condiciones, las argumentaciones indicadas resultan ayunas de la fundamentación exigida por el CPCA, motivo por el cual este órgano casacional también procederá a rechazarlas.

VIII.En suma, no habiendo prosperado ninguno de sus reproches, el recurso deberá rechazarse. Conforme a lo señalado por el artículo 150.3 del Código Procesal Contencioso Administrativo, deberá imponerse al INDER, recurrente ante la Sala, el pago de las costas generadas con el ejercicio de esta instancia.

POR TANTO

Se rechaza de plano el recurso. Son las costas generadas con el ejercicio de esta instancia a cargo de la parte recurrente.
