CONSIDERANDO
I.Sociedad de Usuarios de Aguas de los Angeles de Guacimal instituted ordinary proceedings against the State, seeking the following declarations: “1. The legal existence and validity of the concession (concesión) granted to the society I represent by resolution R-0993-2011- AGUAS-MINAET (sic) to use 74.72 liters per second of water from the río Veracruz and, therefore, the expiration (caducidad) ordered by the Ministerio de Ambiente y Energía in resolution R-0993-2011-AGUAS-MINAET (sic) <understood to mean the year 2010> is Null (sic) and without any legal force or effect. 2. That SETENA or SECRETARIA (sic) TECNICA (sic) NACIONAL AMBIENTAL must continue processing expediente D-13384-2014-SETENA, bringing its actions into compliance with the applicable legal provisions and with the authorized water flow. 3. That The (sic) State is obligated to REFUND (sic), with interest, to the society I represent the annual fee improperly paid for the use of the water, paid under (sic) licenses that were subsequently annulled.” At the preliminary hearing (audiencia preliminar), held on 31 de enero del año 2019, the plaintiff clarified that its request for nullity (nulidad) concerned resolution Nro. R-209-2017-MINAE issued at 14 hours and 55 minutes on 07 de junio del año 2017.
The State’s representative, for her part, opposed the complaint and, in general terms, raised the defenses (excepciones) of expiration, lack of legal entitlement, and lack of a current interest. By resolution Nro. 05-2023-VII issued at 10 hours on 17 de febrero del año 2023, the Court composed of Judges Gustavo Irías Obando, José Martín Conejo Cantillo, and Francisco Hidalgo Rueda denied the defense of lack of a current interest and sustained the defense of lack of legal entitlement, dismissing the complaint in its entirety and ordering the plaintiff to pay the costs of the proceedings. Dissatisfied, the plaintiff filed an appeal on points of law (recurso de casación), which was admitted by this Chamber. -
II.The appellant alleges three grounds of cassation error (vicios de casación). First, it alleges failure to apply Article 31 of the Código Procesal Contencioso Administrativo (CPCA). It states that resolution Nro. R-209-2017-MINAE issued at 14 hours and 55 minutes on 7 de junio del año 2017 declared the expiration of the water-use concession (concesión de aprovechamiento de aguas) for the Río Veracruz, which had been granted through resolution R-0993-2010-AGUAS-MINAET. It reports that it filed administrative appeals (recursos administrativos) against that act in order to exhaust administrative remedies (agotar la vía administrativa), but they were not considered on the merits. The decision of the Tribunal Contencioso Administrativo states that administrative act (acto administrativo) Núm. R209-2017-MINAE was not affected by any ground of nullity and became effective and final because the interested party did not file the appropriate appeals in a timely and proper manner.
The appellant adds that filing the appeals would have had the sole effect of exhausting administrative remedies, which is optional, and was not necessary for the act to become final. In other words, it considers the filing of the appeals unnecessary because they are optional by law. It asserts that the Court should have applied Article 31, subsection 3), of the CPCA because administrative remedies had not been exhausted and the presiding judge (juez de trámite) failed to grant the eight-day period before service of process so that the hierarchical superior of the respondent Entity could review the challenged administrative conduct. It next alleges failure to apply Articles 17, l9, 51, and 52, subsection c), of the Ley Orgánica del Ambiente. It explains that the concession was granted in 2010 and was subject to prior assessments by SETENA, as required by Articles 17, 19, 51, and 52, subsection c), of the Ley Orgánica del Ambiente.
It adds that the plaintiff was barred from using the concession without prior authorization from SETENA; therefore, the 10-year period cannot be calculated from the date the concession was granted when the law itself bars its use without the aforementioned prior authorization. It further states that the judgment fails to apply the Ley Orgánica del Ambiente as indicated above and holds that the plaintiff bears sole responsibility for the expiration. It also states: “…the failure to apply those provisions of the Ley Orgánica del Ambiente, used in this case to dismiss the complaint on the ground that the concession’s ten-year term had expired, gives no effect to the provisions of the Ley del Ambiente requiring approval of the concession as a prerequisite to its implementation.” Lastly, it alleges misapplication of Articles 178 and 181 of the Ley de Aguas of 27 de agosto del año 1942. It states that Article 17 of Ley Nro. 7554 (Ley Orgánica del Ambiente) provides that an environmental impact assessment (evaluación de impacto ambiental), conducted by SETENA, is an indispensable requirement for commencing activities.
In its view, the Ley de Aguas was thereby amended because the payment obligation arises when the activity begins; here, the activity had not begun because SETENA had not completed the environmental impact assessment, and there was therefore no basis for paying a nonexistent obligation. It adds that the waters had likewise not been used when the expiration was declared and that, absent a legal basis, the State is obligated to reimburse the amounts paid. -
III.As relevant here, the Court noted that the complaint had been improperly framed because the plaintiff failed to rebut the administrative actions taken by MINAE and SETENA. It expressly stated: “…given the vagueness of the action brought, which, it bears repeating, amounts to no more than a series of subjective arguments by the plaintiff regarding what it believed the Public Administration’s conduct should have been in processing the administrative proceeding instituted against it, which ultimately culminated in the determination to declare expired the water concession originally granted through resolution R-0993-2010 AGUAS-MINAET, but without making any specific challenge based on nullity against the contested act, either when the plaintiff submitted written statements or, much less, through its legal representative in the oral closing arguments, beyond stating that the matter was decided without considering the provisions of the Ley Orgánica del Ambiente or while they were still within the period granted by SETENA to obtain environmental feasibility (viabilidad ambiental); these latter allegations were made by plaintiff’s counsel at the Preliminary Hearing, where he sought to confuse the Court by stating that, because the Sala Constitucional had annulled the environmental feasibility granted to his client’s project, they had to apply for it again, and that the concession was declared expired while the period for doing so was still running (…)”. –
IV.Regarding the grounds for reversal presented by the appellant, it first alleges failure to apply Article 31, subsection 3), of the CPCA. It stated that it had filed administrative appeals against resolution Nro. R-209-2007-MINAE of 07 de junio del año 2017, which declared the expiration of the water-use concession for the Río Veracruz. Nevertheless, it argued that those appeals were never considered on the merits and that the Court therefore failed to apply Article 31, subsection 3), of the CPCA by not giving the head of the Ministerio de Ambiente y Energía an opportunity to be heard so that the latter could review the administrative conduct challenged. This Chamber does not agree with the reasoning presented. The purpose of Article 31, subsection 3), of the CPCA is to enable the head or hierarchical superior to consider and examine the administrative actions of subordinate officials. In this matter, the plaintiff did exhaust administrative remedies when, through its own inaction, it untimely filed its appeal against resolution Nro. R-209-2007-MINAE of 07 de junio del año 2017; because its appeal was unsuccessful, that act became final—that is, the final act became definitive by virtue of the dismissal of the untimely appeal.
This Chamber does not consider it necessary for the presiding judge to have notified the head of the challenged administrative conduct in the judicial proceedings when the latter was already fully aware of it, having dismissed the untimely appeal. Accordingly, the circumstance contemplated in Article 31, subsection 3), of the CPCA concerning failure to exhaust optional administrative remedies does not apply. The ground for reversal is therefore rejected. -
V.As the second ground, it alleged failure to apply sections 17, 19, 51, and 52(c) of the Ley Orgánica del Ambiente. It argued that the concession granted in the year 2010 was subject to prior assessments by the Secretaría Técnica Nacional Ambiental (SETENA), and therefore the company it represented was barred from using the concession without prior authorizations. It maintained that the Tribunal failed to consider the foregoing. This Chamber finds no merit in that argument. As reflected in the court record, and as determined in the challenged judgment, the environmental viability (viabilidad ambiental) referred to by the plaintiff was indeed granted by SETENA on two occasions (resolution Nro. 100-2010-SETENA at 08 hours and 35 minutes on 19 de enero del año 2010, ordinary session Núm. 006-2010 on 18 de enero del año 2010, article 09, and resolution Nro. 2661-2012-SETENA at 10 hours and 20 minutes on 17 de octubre del año 2012, ordinary session Núm. 0107-2012 on 16 de octubre del año 2012).
However, it was the plaintiff itself that did not make use of the granted water-use right (aprovechamiento del agua), because it failed to construct the intake works (obra de captación). This was confirmed by the Dirección de Aguas through inspections documented in official communications AT-1943-2012, AT-1519-2014, and DA-UHTPNOB-0102-2017 dated 21 de febrero del año 2017, the latter conducted by the Unidad Hidrológica Tempisque Pacífico Norte of the Dirección de Aguas. It was likewise established—and this panel finds it noteworthy—that the plaintiff requested the closure of the two proceedings conducted before SETENA. The challenged judgment so found, stating: “The record also shows that, by means of a letter dated 02 de julio del 2012, the company requested that expediente D1-1053-2009-SETENA be closed because it had failed to timely submit a request to extend the environmental viability, and that, in response to a new application filed on 03 de julio del 2012, resolution N° 2661-2012-SETENA at 10:20 hours on 17 de octubre del 2012 communicated the decision adopted by the Comisión Plenaria de la SETENA at its ordinary session N° 0107-2012 on 16 de octubre del 2012, where, in article 30, it agreed to grant environmental viability to the Project for a period of two years within which to commence the works; this was processed under expediente D1-8255-12.
It should be carefully noted that the foregoing concerns the environmental viability under the responsibility of SETENA (…) Subsequently, with respect to this latter expediente as well, the representative of the applicant company again requested its closure, stating that the company had decided not to continue with the environmental proceeding. Consequently, resolution N° 1710-2015-SETENA at 10:10 hours on 30 de julio del 2015 communicated the decision adopted by the Comisión Plenaria at its ordinary session N° 105-2015, article N° 04, on that same date, granting the request and ordering the closure of expediente N° D1-13384-2014-SETENA.” As can be seen, the plaintiff’s claim regarding the continuation of proceeding number D-13384-2014-SETENA is futile because it was the plaintiff itself that requested closure of the proceeding after deciding not to continue the process before SETENA. Moreover, these factual circumstances and the reasoning set forth in the lower-court decision have not been challenged in this cassation appeal (recurso de casación), and this Tribunal cannot properly reverse the challenged judgment when the appellant in cassation (casacionista) fails to contest the reasoning provided by the Tribunal. The claim therefore fails. –
VI.As its final ground, it alleged the improper application of sections 178 and 181 of the Ley de Aguas. It reiterates that the law establishes, as a prerequisite for beginning exploitation of the concession, an environmental impact assessment (evaluación de impacto ambiental) conducted by SETENA. In its view, the obligation to pay the corresponding water-use fee (canon) arises only when use of the concession begins. It emphasized that, because no activity had been carried out, there was no payment obligation and it therefore seeks reimbursement of the amounts paid. The challenged judgment correctly stated that the payment made by the plaintiff covered the periods from the III quarter of the year 2011 through the IV quarter of the year 2016, dates preceding the declaration of expiration (caducidad) of the water concession by resolution Nro. R2009-2017-MINAE (see image 21 of the digital court record, certification issued by the Coordinadora del Departamento Administrativo Financiero de la Dirección de Agua del MINAE).
As indicated in the preceding section, no impediment imposed by the defendant authority preventing SUDAGUA from using the concessioned water resource has been established; its failure to do so resulted from its own inaction. Accordingly, because the appellant in cassation neither challenges nor refutes the grounds relied upon by the Tribunal Contencioso Administrativo, this ground for cassation meets the same fate as the preceding one, and the alleged error is rejected.-
VII.Consequently, the appeal is denied, and resolution Nro. 05-2023-VII at 10 hours on 17 de febrero del año 2023 of the Tribunal Contencioso Administrativo y Civil de Hacienda is affirmed. -

The appeal is declared unfounded. CONSIDERANDO
I.Sociedad de Usuarios de Aguas de los Angeles de Guacimal interpuso proceso de conocimiento en contra del Estado, con la finalidad de que se declare lo siguiente: "1. La existencia y vigencia legal de la concesión otorgada a la sociedad que represento por resolución R-0993-2011- AGUAS-MINAET (sic) para aprovechar 74.72 litros por segundo de agua del río Veracruz y, por lo tanto, es Nula (sic) y sin ningún valor ni efecto jurídico, la caducidad acordada por el Ministerio de Ambiente y Energía en resolución R-0993-2011-AGUAS-MINAET (sic) <entiéndase año 2010>. 2. Que el SETENA o SECRETARIA (sic) TECNICA (sic) NACIONAL AMBIENTAL debe continuar con la tramitación del expediente D-13384-2014-SETENA, ajustando su actuación a la normativa legal pertinente y de acuerdo al caudal de agua concedido. 3. Que El (sic) Estado queda obligado a DEVOLVER (sic), con sus intereses, a la sociedad que represento el canon anual pagado indebidamente para el aprovechamiento del agua, pagadas al amprado (sic) de licencias que fueron posteriormente anuladas.” En audiencia preliminar, celebrada el día 31 de enero del año 2019, la parte actora aclaró que su solicitud de nulidad corresponde a la resolución Nro. R-209-2017-MINAE de las 14 horas con 55 minutos del día 07 de junio del año 2017.
Por su parte, la representación Estatal contestó de forma negativa la demanda, y, en términos generales, opuso la excepción de caducidad, falta de derecho y falta de interés actual. El Tribunal integrado por los jueces Gustavo Irías Obando, José Martín Conejo Cantillo y Francisco Hidalgo Rueda, mediante resolución Nro. 05-2023-VII de las 10 horas del día 17 de febrero del año 2023, declararon sin lugar la excepción de falta de interés actual, y acogieron la falta de derecho, declarando sin lugar la demanda en todos sus extremos, condenando a la parte actora al pago de las costas del proceso. Inconforme, la parte demandante formula recurso de casación, el cual fue admitido por esta Sala. -
II.El casacionista argumenta tres vicios de casación. El primero de ellos, aduce, falta de aplicación del artículo 31 del Código Procesal Contencioso Administrativo (CPCA). Señala, la resolución Nro. R-209-2017-MINAE de las 14 horas con 55 minutos del día 7 de junio del año 2017, dictó la caducidad de la concesión de aprovechamiento de aguas en el Río Veracruz, la cual fue otorgada mediante resolución R-0993-2010-AGUAS-MINAET. Informa, interpuso los recursos administrativos contra dicho acto, con el fin de agotar la vía administrativa, sin embargo, el mismo no fue conocido por el fondo. La resolución del Tribunal Contencioso Administrativo, señala que el acto administrativo Núm. R209-2017-MINAE, es un acto que no posee ningún vicio de nulidad, y el mismo adquirió eficacia y firmeza ya que la parte interesada no interpuso los recursos correspondientes en tiempo y forma. Agrega el recurrente, la presentación de los recursos tendrían efecto únicamente para agotar la vía administrativa, la cual es facultativa, no así para que el acto adquiriera firmeza.
En otras palabras, considera innecesario la interposición de los recursos ya que estos son potestativos por ley. Advierte, el Tribunal debió aplicar el numeral 31 inciso 3) del CPCA, ya que el agotamiento de la vía administrativa no se dio, y el juez de tramite omitió conceder el plazo de 8 días previos al emplazamiento, a efecto de que el superior jerárquico de la Entidad demandada, revisara la conducta administrativa impugnada. Posteriormente, alega falta de aplicación de los artículos 17, l9, 51 y 52 inciso c) de la Ley Orgánica del Ambiente. Explica, la concesión fue otorgada en el año 2010 y estaba sujeta a evaluaciones previas a cargo de SETENA, tal y como lo ordena los artículos 17,19,51 y 52 inciso c) de la Ley Orgánica del Ambiente. Añade, la accionante estaba impedida de hacer uso de la concesión sin la previa autorización por parte de SETENA, por lo que no es posible aplicar el plazo de los 10 años desde que fue otorgada la concesión, cuando la misma ley impide hacer uso de ella sin la previa autorización ya indicada.
Informa, además, la sentencia deja de aplicar la Ley Orgánica del Ambiente en los términos anteriormente indicados, señalando que el actor es el único responsable de la caducidad. Refiere también: “…la falta de aplicación de esas disposiciones de la Ley Orgánica del Ambiente, utilizada en este caso para rechazar la demanda argumentando vencimiento del plazo de diez años de la concesión, no concede valor a las disposiciones de la Ley del Ambiente que exige la aprobación de la concesión como acto previo a su ejecución”. Por último, argumenta indebida aplicación de los artículos 178 y 181 de la Ley de Aguas del 27 de agosto del año 1942. Señala, la Ley Nro. 7554 (Ley Orgánica del Ambiente) en su artículo 17, dispone sobre la evaluación de impacto ambiental a cargo de SETENA como requisito indispensable para iniciar actividades. A su criterio, la Ley de Aguas quedó modificada, ya que es al inicio de la actividad donde se genera la obligación de pago, y en este caso, la actividad no había iniciado porque SETENA no había finalizado la evaluación del impacto ambiental, por lo que no existía causa para el pago de una obligación inexistente. Tampoco -añade-, las aguas se habían utilizado cuando se declaró la caducidad, y ante la falta de causa legal, el Estado está obligado de reintegrar las sumas pagadas. -
III.En lo de interés, el Tribunal advierte sobre una indebida técnica al plantear la demanda, ya que el actor no logró contrarrestar las conductas administrativas emitidas por el MINAE y el SETENA. Expresamente indicó: “…dada la vaguedad de la acción emprendida, la cual, se insiste, no pasa de ser una serie de argumentaciones subjetivas de la parte actora de lo que ella estimó debió haber sido el proceder de la Administración Pública respecto a la tramitación del procedimiento administrativo incoado en su contra, que a la postre, culminó con la determinación de declarar caduca la concesión de agua otorgada en su momento mediante la resolución R-0993-2010 AGUAS-MINAET, pero sin que hubiere realizado un reproche puntual de nulidad sobre el acto atacado, ni en las oportunidades en que se refirió la actora por escrito, ni mucho menos por su mandatario judicial en las conclusiones rendidas a viva voz, más que decir que se resolvió sin considerar lo dispuesto en la Ley Orgánica del Ambiente, o cuando aún estaban dentro del plazo conferido por la SETENA para obtener la viabilidad ambiental, alegatos estos últimos que lanzó el letrado de la accionante en la Audiencia Preliminar, donde pretendió confundir al Tribunal diciendo que como la Sala Constitucional había anulado la viabilidad ambiental otorgada al proyecto de su representada, tuvieron que tramitar una nueva, y que estando en plazo para ello fue que se declaró la caducidad de la concesión (…)”. –
IV.En orden a la exposición de los agravios planteados por el casacionista, en primer lugar, argumenta falta de aplicación del artículo 31 inciso
V.Segunda causal, adujo, falta de aplicación de los apartados 17, 19, 51 y 52 inciso c) de la Ley Orgánica del Ambiente. Estimó, la concesión otorgada en el año 2010 estaba sujeta a evaluaciones previas a cargo de la Secretaría Técnica Nacional Ambiental (SETENA), por lo que su representada estaba impedida de hacer uso a la concesión sin previas autorizaciones. Lo anterior, consideró, no fue apreciado por el Tribunal. Lo anterior no es de recibo por esta Cámara. Tal y como consta en el expediente judicial, y así lo dispuso la sentencia rebatida, la viabilidad ambiental que señala la parte accionante, sí fue otorgada por SETENA en dos ocasiones (resolución Nro. 100-2010-SETENA de las 08 horas con 35 minutos del día 19 de enero del año 2010, sesión ordinaria Núm. 006-2010 del día 18 de enero del año 2010, artículo 09, y resolución Nro. 2661-2012-SETENA de las 10 horas con 20 minutos del día 17 de octubre del año 2012, sesión ordinaria Núm. 0107-2012 del día 16 de octubre del año 2012).
Sin embargo, es la misma parte demandante quien no hizo uso del aprovechamiento del agua concedida, al no realizar la obra de captación. Lo anterior quedó constatado por la Dirección de Aguas mediante inspecciones realizadas en oficios AT-1943-2012, AT-1519-2014 y DA-UHTPNOB-0102-2017 del día 21 de febrero del año 2017, esta última por parte de la Unidad Hidrológica Tempisque Pacífico Norte de la Dirección de Aguas. Quedó igualmente demostrado, y llama la atención de este órgano colegiado, que la parte accionante solicitó el archivo de los dos procedimientos llevados ante SETENA, y así lo estableció la sentencia rebatida al indicar: “Consta también en autos, que mediante nota fechada 02 de julio del 2012 la sociedad solicitó el archivo del expediente D1-1053-2009-SETENA, al no haber presentado en tiempo la solicitud de prórroga de la viabilidad ambiental y que ante una nueva solicitud realizada el 03 de julio del 2012, por resolución N° 2661-2012-SETENA de las 10:20 horas del 17 de octubre del 2012, se comunicó lo resuelto por la Comisión Plenaria de la SETENA en su sesión ordinaria N° 0107-2012 del 16 de octubre del 2012, donde en su artículo 30 acordó otorgar la viabilidad ambiental al Proyecto por un período de dos años para el inicio de las obras, lo cual fue tramitado bajo el expediente D1-8255-12.
Nótese bien, que lo anterior está referenciado hacia la viabilidad ambiental a cargo de la SETENA (…) Luego, también sobre este último expediente tramitado, la representación de la sociedad gestionante, volvió a solicitar su archivo, manifestando que habían decidido no continuar con el trámite ambiental. A raíz de ello, mediante resolución N° 1710-2015-SETENA de las 10:10 horas del 30 de julio del 2015, se comunicó lo resuelto por la Comisión Plenaria en su sesión ordinaria N° 105-2015, artículo N° 04 tomado en esa misma fecha, donde acogió la solicitud realizada y se ordenó el archivo del expediente N° D1-13384-2014-SETENA”. Como se logra observar, el reclamo de la parte actora, en cuanto a la continuación con el trámite número D-13384-2014-SETENA, resulta estéril por cuanto fue la misma parte quien solicitó el archivo del procedimiento, al decidir no continuar con la gestión ante SETENA.
Además, estas situaciones fácticas y los razonamientos esgrimidos en la resolución de instancia, no han sido rebatidos en el presente recurso de casación, y para este Tribunal resulta improcedente revocar el fallo impugnado, si el casacionista no ataca los razonamientos dados por el Tribunal, por lo que el reclamo no prospera. –
VI.Último motivo, señaló, indebida aplicación de los numerales 178 y 181 de la Ley de Aguas. Insiste, la ley establece como requisito previo para el inicio de la explotación de la concesión, una evaluación de impacto ambiental a cargo de SETENA. A su criterio, es desde el inicio del aprovechamiento de la concesión cuando se genera la obligación de pago del canon correspondiente. Resaltó, al no haberse realizado ninguna actividad, no existía obligación de pago, por lo cual, pretende la devolución de lo pagado. Lleva razón la sentencia impugnada al señalar que la erogación hecha por la parte actora, corresponde a los períodos que van desde el III trimestre del año 2011, al IV trimestre del año 2016, fechas anteriores a la declaratoria de caducidad de la concesión de aguas, mediante resolución Nro. R2009-2017-MINAE (ver imagen 21 del expediente judicial digital, certificación de la Coordinadora del Departamento Administrativo Financiero de la Dirección de Agua del MINAE).
Como se indicó en el apartado anterior, no se ha demostrado algún impedimento por parte de la autoridad demandada, para que SUDAGUA hiciera uso del recurso hídrico concesionado, no hacerlo fue producto de su propia inercia. Por lo anterior, al no rebatir el casacionista, ni contrarrestar el fundamento utilizado por el Tribunal Contencioso Administrativo, este motivo casacional lleva la misma suerte de la anterior, por lo que se rechaza el agravio.-
VII.En consecuencia, se rechaza el recurso interpuesto y se confirma la resolución Nro. 05-2023-VII de las 10 horas del día 17 de febrero del año 2023 del Tribunal Contencioso Administrativo y Civil de Hacienda. -
POR TANTO
Se declara sin lugar el recurso.
