PJEDITOR Document Res. 000624-F-S1-2024 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at fourteen hours two minutes on the thirteenth of June, two thousand twenty-four.

In the ordinary proceedings (proceso de conocimiento) brought by LITTLE DREAM SOCIEDAD ANÓNIMA, represented by its general attorney-in-fact with unlimited authority (apoderado generalísimo sin límite de suma), Francisco Alvarado Arrieta, against MUNICIPALIDAD DE CARRILLO GUANACASTE, represented by its Mayor, Carlos Gerardo Cantillo Álvarez, the plaintiff company files an appeal in cassation (recurso de casación) against judgment no. 31-2022, issued at 11 hours 40 minutes on 05 de abril de 2022 by the Administrative and Civil Court of the Treasury, Section VIII, composed of Judges Laura García Carballo, Jonatán Canales Hernández, and Paulo André Alonso Soto. CONSIDERING

I.According to the facts deemed proven in the judgment under appeal and not challenged by the appellant in cassation (casacionista), Little Dream Sociedad Anónima is the registered owner of the property in the province of Guanacaste, real property folio no. 68201, ownership interest 000, cadastral plan (plano catastrado) G-0735777-1988. By means of an unsigned note submitted on 30 de marzo de 2005 to Eng. José Valencia Álvarez, Cantonal Chief for Coco of the Instituto Costarricense de Acueductos y Alcantarillados, an application for water availability was filed for the construction of the Little Dream condominiums, specifying that 70 condominium units would be built. Lic. José M. Valencia Álvarez issued a certification dated 6 de abril de 2005 indicating the availability of water at the property identified by plan number G-735777-1988, in the name of Condominios Little Dream, specifying that: “AYA is able to provide said service once the interested parties comply with the (sic) requirements established in the customer service regulations pursuant to CHAPTER-IV-ARTS-18, 19).” On 12 de agosto de 2005, Little Dream S.A. submitted to the Municipalidad de Carrillo the application form for a construction permit (permiso de construcción) in the name of “Little Dream S.A,” legal entity identification number 3-1010394126, in Playas del Coco, concerning the property recorded under real property folio registration no. 68201, plan G-735777-88, for the construction of apartments with a total area of 2780,00 m2 and a project value of ¢233.210.000.

On 17 de enero de 2006, that company deposited the sum of ¢2.332.100.00 with the Banco Nacional de Costa Rica as payment of the construction tax, for the benefit of the Municipalidad de Carrillo. On 20 de enero de 2006, Eng. Juan José Rojas Pastrana of the Departamento de Ingeniería y Construcciones of the Municipalidad de Carrillo notified Little Dream S.A. that the construction-permit application had not been approved because the following requirements had not been submitted: “Application signed by the owner or legal representative.// Cadastral plan of the property, endorsed by the Municipalidad de Carrillo.// Legal entity identification document.// Certification of legal representation, original and certified. // Form or certification issued by the Departamento de Contabilidad stating that all municipal taxes are current.// Occupational Risk Insurance Policy (INS) // Environmental Viability Study (Estudio de Viabilidad Ambiental) (SETENA).// Please submit the requested items for the processing of the corresponding construction permit.” On 12 de octubre de 2006, the Departamento de Ingeniería y Construcciones of the Municipalidad de Carrillo notified Little Dream S.A. that the construction license (licencia constructiva) for the property identified by cadastral plan G-735777-88, Little Dream apartment project, had been denied, stating the following: “You are hereby informed that your construction permit has not been approved because the following requirements are missing: // (...) (*) Occupational Risk Insurance Policy (INS) // (...) (*) Environmental Viability Study (SETENA)// (...)// Please submit the requested items for the processing of the corresponding construction permit.” On 22 de enero de 2007, in connection with the construction work in Mapache Playas del Coco (sic), Inspector Mario Moraga informed the Mayor of the Municipalidad de Carrillo that: “LITTLE DREAM S..A PROJECT An inspection is conducted and 66 villas of 30 square meters each are verified; construction is fully completed.” Receipt no. 151645, dated 9 de marzo de 2007, shows that the Municipalidad de Carrillo received the sum of ¢2.332.100,00 as a fine for violating the Construction Law (Ley de Construcciones).

On 16 de diciembre de 2008, the Departamento de Ingeniería y Construcciones of the Municipalidad de Carrillo informed Little Dream S.A. that it had 30 business days to submit to the Municipalidad de Carrillo the construction permits for the swimming pool and jacuzzi, with an approximate area of 180 m2, and for a 35 m2 pavilion. On 5 de mayo de 2009, the representative of Little Dream S.A. submitted a new construction application to the Departamento de Ingeniería y Construcción of the Municipalidad de Carrillo for the construction of a condominium on the property identified by cadastral plan G-735777-88. On 12 de mayo de 2009, that Department informed Little Dream S.A. as follows: “Because you do not have a Construction Permit, and pursuant to Art. 93 and 94 of the Ley de Construcciones, you are granted a non-extendable period of thirty days to obtain the aforementioned license for the project detailed below: Completed Apartments and Parking Areas having the same areas as those shown on construction plans C.F.I.A A/OC-351460, and an 80 m2 swimming pool and pavilion with an area of 35 m2. // You are reminded that, for the issuance of the corresponding Construction Permit, in addition to satisfying the requirements, you must pay the Construction Tax corresponding to 1% of the assessed project amount, as well as the applicable fine; otherwise, if you fail to comply with this provision within the stated period, action will be taken as appropriate under the law.” By official letter MC-VM-622-2009 dated 25 de junio de 2009, the Departamento de Catastro y Bienes Inmuebles of the Municipalidad de Carrillo denied the application for endorsement of cadastral plan G-735777-1988.

By official letter SG-AJ-0902-2010-SETENA, Msc. Sonia Espinoza Valverde, Secretary General of the Secretaría Técnica Nacional Ambiental of the Ministerio de Ambiente, Energía y Telecomunicaciones, certified at 10 hours and 20 minutes on 29 de julio de 2010, in relation to the project at issue, that: “...upon review of the database maintained by this Secretariat concerning whether LITTLE DREAM S.A. applied for Environmental Viability or has a case file for the Apartment Construction project located on the road to Ocotal, 4 kilometers south of Súper Compro de Playas del Coco, there is no record that any proceeding in this regard was undertaken by said (sic) legal entity.” On 16 de agosto de 2010, according to official letter OCPC-RCH-2010-39 and in response to Eng. Maureen Brenes Acuña’s inquiry as to whether the project had water availability, Lic. Olman Jiménez Cerdas of the AyA Office in Sardinal de Carrillo, Guanacaste, replied: “In response to your official letter MC-IM-605-10, I state: ‘The project is supplied through a half-inch meter. // It currently lacks adequate infrastructure and production capacity to supply the project and therefore does not have water availability. // The availability letter has already expired and does not indicate what is to be built or whether the project is viable. // Furthermore, pursuant to the aforementioned RCH-2008-037 of 18-01-2008, availability will be granted only for family housing.

(A copy of the directive is attached). // Accordingly, the aforementioned project does not have water availability.’” By certification dated 9 de marzo de 2011, the Departamento de Administración Tributaria of the Municipalidad de Carrillo stated that, according to the accounting records, Little Dream S.A. is registered as a taxpayer under the Real Property Tax Law (Ley del Impuesto de Bienes Inmuebles), but is not registered as a taxpayer for “Services, Fees and Taxes and Other Services,” under the Ley de Impuestos Municipales del Cantón de Carrillo and its services, or under the Liquor Law and its Regulations (Ley de Licores y su Reglamento). By a decision issued at 09 hours 47 minutes on 10 de marzo de 2011, pursuant to provisions 169 of the Constitución Política; 162 of Ley 7794; 15 and 57 of Ley 4240; and 74, 88 and 96 of Ley 833, the Alcalde Municipal ordered Little Dream S.A. to vacate and demolish the unlawful buildings and structures.

The operative portion (parte dispositiva) stated: “POR TANTO: In view of the foregoing factual and legal arguments, and it having been conclusively established that both the aforementioned regulations and the deadlines and extensions that operated even in favor of the regulated party (administrado) were not complied with, LITTLE DREAM S.A., legal entity identification number 3-101-394126, is hereby ordered, within the non-extendable and mandatory period of five business days counted from service of this decision, to proceed finally and voluntarily to vacate and demolish the unlawful buildings and structures erected on the property identified by Cadastral Plan number G-735777-88; failing which, upon expiration of said period, this Municipalidad shall proceed with the eviction and/or demolition in the exercise of the authority conferred upon it by law, with the resulting expenses to be borne by the company.

This decision may be challenged by filing a motion for reconsideration (recurso de Revocatoria) before this Alcaldía and an appeal (recurso de Apelación) before the corresponding superior authority within five days counted from service of this Decision. That is all. Let notice be served.” Said decision was served upon the interested party on 12 de marzo de 2011. Mr. José Francisco Alvarado Arrieta, acting as the general attorney-in-fact without limitation as to amount (apoderado generalísimo sin límite de suma) of Little Dream S.A., filed an incidental motion to stay the administrative act (incidente de suspensión del acto administrativo) and an appeal. Acting as the two-tier hierarchical superior (superior jerárquico bifásico), the Sección Tercera del Tribunal Contencioso Administrativo y Civil de Hacienda stated as follows in decision no. 460-2013, issued at 15 hours 45 minutes on 31 de octubre de 2013: “XIII.- Conclusion.

This Tribunal must state explicitly that, given how the events occurred and considering that from the outset the project encountered implementation problems because it lacked essential elements such as an adequate drinking-water supply, an environmental impact study (estudio de impacto ambiental), and a duly endorsed property plan, these circumstances clearly show that urban-planning standards were circumvented and submission to the applicable regulatory instruments was evaded. These actions constitute clear defiance by the appellant of the land-use planning framework (ordenamiento territorial), leading to the unequivocal conclusion that, under these circumstances, it was not possible for the local government to grant the construction license. The procedure established in provisions 93 et seq. of the Ley de Construcciones was duly followed, and the owner was given the opportunity to regularize the development and comply with all statutory requirements.

Nevertheless, it is clear in this case that two insurmountable legal requirements remain unmet: environmental viability and water availability, which initially led to the closure of the construction work. Even so, the developer disregarded the closure orders issued since 2006 and continued and completed the construction work, assuming at its own risk the harmful consequences caused by its own negligence. Given the flagrant breach of the legal obligations and duties imposed upon the regulated party, the Alcalde had no alternative in this case but to order the eviction and demolition, as was strictly required; consequently, the action taken by the municipal authority was in accordance with law. Therefore, no illegality is found in the decision, nor any violation of the principle of administrative legality or due process, because the challenged municipal actions conform to the legal system, and the grounds for grievance asserted must be rejected as legally unfounded.

Accordingly, the proper course is to affirm the decision of the Alcalde de Carrillo issued at 9:47 hours on 10 de marzo el 2011; and, because no further appeal remains, the administrative remedies (vía administrativa) shall be deemed exhausted. Because the judicial case being heard before this same Tribunal, expediente No. 11-001707-1027-CA, orders that a copy of this decision be added to the record so that the judge handling the matter may take whatever action is appropriate under the law.// POR TANTO // The decision of the Alcalde de Carrillo issued at 9:47 hours on 10 de marzo del 2011 is affirmed. The administrative remedies are deemed exhausted.

II.Based on the foregoing, Little Dream S.A. filed suit against the Municipalidad de Carrillo, seeking: “(…) that the Municipalidad de Carrillo Guanacaste be ordered to grant my client the construction permits (permisos de construcción) corresponding to the already completed LITTE DREAMS project located on the road to Ocotal Guanacaste, Cantón de Carrillo.// I further request that the respondent be ordered to pay both categories of costs incurred in these proceedings.” The respondent Municipality opposed the claim and raised defenses of lack of standing (falta de legitimación activa) and lack of a legal right (falta de derecho). The Tribunal Contencioso Administrativo y Civil de Hacienda, Sección VIII, composed of judges Laura García Carballo, Jonatán Canales Hernández and Paulo André Alonso Soto, ruled as follows in judgment no. 31-2022 at 11 hours 40 minutes on 05 de abril de 2022: “The defense of lack of standing is denied. The defense of lack of a legal right is granted. The claim filed by LITTLE DREAM S.A. against the MUNICIPALIDAD DE CARRILLO GUANACASTE is dismissed. Costs shall be borne by the claimant and awarded to the respondent Municipalidad. Once this decision becomes final, the interim measure (medida cautelar) shall be lifted.” Dissatisfied with the ruling, the claimant filed an appeal in cassation (recurso de casación).

III.In its first ground of appeal (agravio), it alleges the existence of incomplete mandatory joinder (litisconsorcio necesario incompleto). It maintains that, when filing the complaint (fact 11), it stated that there were a large number “of occupants, that is, owners” who had not been notified of the demolition ordered by the Municipalidad. It explains that, although a commercial corporation appears as the claimant in this matter, the actual situation is that there are 66 apartments under construction that have independent owners, and the underlying relationship is that of a de facto condominium (condominio de hecho). It continues that, prior to any administrative eviction (desalojo administrativo), the law requires notice to all occupants and even a determination as to whether there are minors, older adults, and persons with disabilities; all of which must be observed with even greater reason in the case of a demolition. It objects that the judgment erred in treating the existence of other owners of the property registered in the Partido de Guanacaste, folio real no. 68201, derecho 000, as an unproven fact; this is because, from the outset of the proceedings, the claimant’s representative referred to that situation in the eleventh fact of the complaint, and the Municipalidad—in its answer—acknowledged that it was aware of the existence of those occupants.

IV.The asserted ground is denied. In accordance with the doctrine established in provisions 106 of the repealed Código Procesal Civil (Ley 7130; in force when the complaint was filed) and 22.1 of the current Código Procesal Civil (Ley 9342), mandatory joinder (litisconsorcio necesario) arises when, by operation of law or because of the nature of the substantive legal relationship (relación jurídica material), the persons affected by the decision must act jointly as joined parties (litisconsortes), so that they are bound by the proceedings and, consequently, by the effects of the judgment. Mandatory joinder entails the existence of substantive legal relationships regarding which no ruling may be issued by dividing them or characterizing them solely in relation to some of the parties, because the decision encompasses and binds them all. The presence of all parties is indispensable for the procedural relationship (relación procesal) to be complete and for a judgment on its merits to be rendered.

In this case, mandatory joinder does not arise in any of its forms. Note that the relief sought in the complaint is: “(…) that the Municipalidad de Carrillo Guanacaste be ordered to grant my client the construction permits corresponding to the already completed LITTE DREAMS project located on the road to Ocotal Guanacaste, Cantón de Carrillo. // I further request that the respondent be ordered to pay both categories of costs incurred in these proceedings.” That claim in no way binds the alleged occupants of the apartments in the Little Dreams project, because no relief is sought against them, nor is any type of obligation demanded of them. Moreover, the respondent municipality did not file a counterclaim (reconvención) asserting any claim against those alleged “de facto condominium owners.” Nor does the nature of the substantive legal relationship at issue in these proceedings require the participation of those alleged occupants.

As follows from the facts alleged in the complaint, and as the judgment found proven, on 12 de agosto de 2005 the claimant corporation, as owner of the property registered in the Partido de Guanacaste under folio real no. 68201, derecho 000, submitted to the Municipalidad de Carrillo a construction-permit application form in the name of “Little Dream S.A,” corporate identification number 3-1010394126, in Playas del Coco, concerning the identified property, for the construction of apartments having a total area of 2780,00 square meters and a construction value of ¢233.210.000. Accordingly, the substantive legal relationship underlying these proceedings arises from the application that Little Dream S.A filed on its own behalf with the Municipalidad de Carrillo to obtain the corresponding construction permits for its apartment project, which were denied; hence, as the relief sought in the complaint, it asks that the municipality be ordered to grant the respective permits.

The underlying substantive legal relationship originated in that formal application to the municipal entity and its corresponding denial, in which there were no participants other than the applicant corporation and the Municipalidad; it is between them that the dispute concerning whether the requested construction permits are legally proper must be resolved. The claimant-appellant now argues that this case involves incomplete mandatory joinder because the apartment occupants were not notified of the demolition order issued by the Municipalidad, which affects them. Nevertheless, that argument cannot be accepted, because that fact concerns a potential substantive defect (vicio de fondo) in the municipal administrative acts (actos administrativos) ordering the demolition of the work undertaken without construction permits; however, in its complaint, the claimant did not seek annulment (pretensión anulatoria) of any of those municipal acts.

It therefore cannot rely on that alleged circumstance—now characterized as a procedural defect—when it is clear that it falls outside the scope of, and bears no relationship to, the subject matter of the proceedings, because the validity of the act ordering the demolition is not at issue, as analyzed supra with respect to the relief sought and the substantive legal relationship underlying this litigation (litis). Consequently, the objection raised shall be denied.

V.In the second ground of appeal, it challenges unproven facts 1), 3), and 10). It alleges an error in the assessment of the testimony given by municipal engineer Lucas Baldioceda and the documentary evidence at folio 135, which contains a document signed by that professional setting forth the construction requirements for Cantón de Carrillo. It notes that this evidence does not state that those are construction requirements for a single-family dwelling (vivienda unifamiliar), as counsel for the Municipalidad de Carrillo sought to portray them on the day of trial. In the same vein, it contends that folio 124 contains a letter dated 16 de octubre de 2014, signed by Engineer Lucas Baldioceda Rodríguez—who was no longer the municipal engineer—and sent to the then municipal engineer Celso Cortés, in which he confirms that the events occurred exactly as described by Carlos Arroyo Quirós (representative of Grupo Mapache), and that the requirements subsequently imposed by the Municipalidad de Carrillo did not exist during the years when the Little Dreams Project was constructed.

It asserts that the foregoing makes clear that the Municipalidad de Carrillo changed the construction requirements after the permit applications had been filed and sought to require the developer to comply with them when the work was already at an advanced stage. It argues that, as a result, Articles 82.5, 87, 89, and 90 of the Ley de Construcciones and the principle of legitimate expectations (principio de confianza legítima) were violated.

VI.The argument asserted is insufficient to overturn the challenged judgment because it does not comprehensively contest the legal and factual grounds supporting it, as explained below. The appellant in cassation states that the then municipal engineer—Lucas Baldioceda—provided her in the year 2005 with a document setting out the requirements for construction in the canton of Carrillo, which were listed as follows: “1. Construction application on the form provided by the Municipality (signed by the owner or the property’s legal representative, and also by the applicant, if applicable), which must bear a municipal revenue stamp for 100.00 one hundred colones) // 2. Submit a copy of the property deed or registry report. // 3. Submit a copy of the property’s registered cadastral plan (plano catastrado). // 4. Submit a form or certificate issued by the Accounting Department establishing that all municipal taxes are current. // 5.

Submit the construction plans, duly signed by a civil engineer, construction engineer, or architect duly admitted to the C.F.I.A., whether for new construction or an addition up to a second story. // 6. Approval from the Ministry of Health of Carrillo. // 7. Submit a copy of the receipt evidencing payment of the occupational-risk insurance policy (I.N.S). // 8. Payment of 1% of the value of the work (license granting the right to build)” (page 125 of the court record). As was deemed proven and has not been refuted by the moving party: “6) On 20 de enero de 2006, Engineer Juan José Rojas Pastrana of the Engineering and Construction Department of the Municipalidad de Carrillo informed Little Dream S.A. that the application for a building permit had not been approved because the following requirements had not been submitted: ‘Application signed by the owner or legal representative.// Registered cadastral plan for the property, endorsed by the Municipalidad de Carrillo.// Corporate identification card.// Certification of corporate authority, original and certified. // Form or certificate issued by the Accounting Department establishing that all municipal taxes are current. // Occupational-Risk Insurance Policy (INS) // Environmental Feasibility Study (Estudio de Viabilidad Ambiental) (SETENA).// Please submit the requested items so that your respective building permit may be processed.’” In this regard, the Tribunal analyzed: “In the present case, this Chamber observes that the plaintiff requests that the Municipalidad de Carrillo be ordered to grant it the building permits for the already completed project known as Little Dream S.A., on the grounds that the plaintiff did timely comply with all the requirements initially requested by the municipal corporation and that no action for annulment has been brought against the various administrative acts issued in this matter, meaning that those acts are final and effective.

Thus, a review of the proven facts shows that the Municipalidad de Carrillo—received—the building-permit application dated 12 de agosto de 2005 and proceeded to deny the building permit on 20 de enero de 2006, identifying the following grounds for denial: [those already stated in proven fact 6)]. That said, it is clear that, even assuming that Engineer Lucas Baldioceda Rodríguez had initially requested certain requirements from it, (…) the fact remains that the first denial shows that the plaintiff—originally—failed to establish before the Engineering and Construction Department and the engineer in charge that it had satisfied all the requested requirements; accordingly, it cannot claim the existence of a subjective right (derecho subjetivo) in its favor either.” In other words, even hypothetically assuming that the only requirements requested from the plaintiff for processing the building permit were those recorded in the document signed by engineer Lucas Baldioceda, the fact remains that the applicant did not fully comply with those requirements either and therefore could not seek to benefit from a nonexistent subjective right.

It should be noted that the appellant likewise makes no effort to disprove that sixth proven fact, and therefore the judgment remains undisturbed on this point and the grievance is ineffectual for purposes of quashing the judgment. In addition to the foregoing, as a second ground for rejecting the objection raised, the lower Tribunal noted as follows: “The plaintiff’s theory has always been—and has mistakenly remained, as will be explained below—that it complied with ‘all’ the requirements originally requested of it; as demonstrated above, however, this was not the case. Nevertheless, under the Political Constitution, it must be recalled that ‘The administration of local interests and services in each canton shall be entrusted to the Municipal Government (..),’ pursuant to Article 169 of the Constitution. This constitutional article has been implemented, among other provisions, through the Municipal Code, the Construction Law, the Urban Planning Law, and the so-called ‘Regulations Governing Construction, Repairs, and Additions; as well as Plan Endorsements, Inspection of Works, Earthworks (movimientos de tierra), and Demolition Permits’; pursuant to Resolution N° 2 adopted during special session N° 30-2003 on 1° de octubre de 2003 by the Municipalidad de Carrillo, based on Article 13(c) of the Municipal Code, which has now been repealed by Municipal Regulation N° 27, Resolution 2 dated 3 de julio de 2018, but was in force at the time of the events giving rise to these proceedings; Article 7 thereof provided: ‘Article 7º—For purposes of processing the respective municipal building permit, which includes new construction, repairs, additions, earthworks, or demolition of an existing structure, interested parties must submit the following documents to the Construction Department: // a) The application for a construction, repair, addition, earthworks, or demolition permit, on the form that the Municipality shall provide for that purpose.

The form must be signed by the property owner or by the owner’s legal representative vested with sufficient authority for that act, as well as by the construction applicant where the applicant and owner are not the same person. // b) The interested party must submit with the application a photocopy of the property deed, a literal registry certification (certificación literal), or a registry report establishing the characteristics of the real property and identifying its owner; a copy of the certification of corporate authority and of the corporate identification card if the owner is a legal entity; and, when applicable, a copy of the judgment or equivalent judicial, administrative, or private document establishing ownership rights or the lawful exercise of possession. A photocopy of the property’s registered cadastral plan must also be provided. In case of doubt, the information shall be verified with the Cadastral Department; furthermore, when construction is undertaken along a national route, MOPT shall specify the applicable setback. // c) The application must be accompanied by a municipal revenue stamp in the amount of (100,00) colones, which shall be affixed to the cover page of the application form. // d) With the application, the interested party must provide a certificate issued by the Accounting Department establishing that all municipal taxes, fees, and/or services are current. // e) Designate a location within the canton for receiving notices by any means authorized by law, namely: a place of residence within the Municipality’s jurisdictional boundaries, post-office box, fax, or telephone number. // f) Before work begins, establish that the occupational-risk insurance policy was paid to INS, where applicable. // g) Based on the assessed value of the construction, the interested party must pay the construction tax, equivalent to 1% of the value of the work.

In the case of social-interest housing or construction, the tax shall be 0,5%, pursuant to applicable law and regulations. // h) Any other item that must be submitted pursuant to a legal or regulatory provision or technical standard, or that the official processing the application deems it appropriate to request. (…) In relation to the foregoing, it is clear that the “right to build” is not an absolute right but is subject to public-order considerations and to the body of public law regulating planning, land-use planning (ordenación territorial), construction, etc., which expressly establishes the legal requirements that every building must satisfy so that cities may achieve the best possible urban development while also protecting the environment in accordance with the various existing regulations. This Tribunal notes that, among the requirements established by the aforementioned Municipal Regulation, environmental feasibility (viabilidad ambiental), municipal endorsement of the registered cadastral plan, and water availability were indeed not expressly identified as requirements; as will be explained, however, this is because they are governed by other provisions, not because they are unregulated.

This Chamber also observes that the plaintiff company did not initially submit each and every requirement set forth in the Municipal Regulation exactly as required, including even those which it claims were specified by the Municipal Engineer surnamed Baldioceda. This conclusion follows from the denial of the building permit dated 20 de enero de 2006, in which the Municipal Corporation clearly stated: “It has not been approved because the following requirements have not been submitted: Application signed by the owner or legal representative.// Registered cadastral plan for the property, endorsed by the Municipalidad de Carrillo. // corporate identification card// Certification of corporate authority, original and certified. // Form or certificate issued by the Accounting Department establishing that all municipal taxes are current. // Occupational-Risk Insurance Policy (INS)// Environmental Feasibility Study (SETENA).” Thus, it should be noted that Regulation N° 30 of the Territorial Corporation itself refers in subsection h) to any other requirements that, pursuant to a legal or regulatory provision or technical standard, the official processing the application may deem pertinent, as Engineer Juan José Rojas Pastrana, the Acting Municipal Engineer responsible for reviewing and analyzing this application—and no other person, according to the documentary evidence—deemed them to be in this case; this circumstance authorized the official in question, meaning the Municipal Administration, to require, in addition to the specified materials or requirements, items that were not prescribed by the Municipal Regulation but were prescribed by other regulatory provisions (…) (emphasis added).

The appellant insists that municipal engineer Baldioceda requested only certain requirements from it for processing the building permit and that the Municipality subsequently sought to expand those requirements when the work was already underway; however, it entirely fails to contest the Tribunal’s legal reasoning concerning the regulatory authority contained in Article 7 of Municipal Regulation no. 27—which was in force at the time of the events at issue here—under which, in addition to the requirements expressly established in that provision, the official processing the application could also require others deemed pertinent pursuant to a legal or regulatory provision or technical standard.

Likewise, the appellant fails to rebut the Court’s legal analysis regarding the statutory requirement to obtain environmental viability (viabilidad ambiental), municipal approval (visado municipal) of the cadastral plan (plano catastrado), and water availability (disponibilidad de agua), as indispensable prerequisites for obtaining the corresponding building permits, all pursuant to the explanation concerning subsection h) of Article 7 of the Municipal Regulations (VII, VIII, IX, and X). Consequently, given that the appellant not only failed to establish that the requirements requested by the Municipalidad de Carrillo in 2005 had been submitted, but also fails to challenge the other arguments set forth by the Court, it is clear that the claim raised is inadmissible and must therefore be rejected.

VII.In the third ground of objection (reparo), it alleges the failure to apply Article 93, subsection 3), of the SETENA Law and the failure to consider the expert report (informe pericial) of engineer José Manuel Blanco Mazariegos. It reproduces the expert’s conclusions. It objects that the Court did not take into account that, according to the environmental expert’s assessment, demolishing the structures would cause greater harm to the environment. Furthermore, the judges likewise made no reference to the possibility of bringing the structures into compliance, given that they are not located in an environmental protection zone or any type of reserve.

VIII.The objection raised is unfounded. Regarding demolition, the Court stated: “It is clear that the expert report submitted in the record shows that demolition of a structure such as the one built could affect the environment, provided, of course, that the corresponding precautions are not taken; however, on the basis of that report, this Court cannot decline to apply the regulations in force and thereby justify the plaintiff’s flagrant noncompliance with the aforementioned land-use regulations (normativa urbanística). Doing so would also entail assuming the role of an active administrative authority (Administración activa), which does not fall within this Court’s jurisdiction, and, more seriously, disregarding the legal requirements that the party failed to satisfy despite being aware of them and of the legal consequences of noncompliance. It should be noted that the demolition must be carried out as provided by the Ley Orgánica del Ambiente, while protecting the environment at all times and minimizing the effects on neighboring communities” (emphasis supplied).

The appellant objects that, instead of demolition, the Court should have considered another compensatory or mitigation measure and should even have referred to the possibility of bringing the structures into compliance; however, it does not refute—with duly reasoned arguments—the panel of judges’ conclusion that proceeding in that manner would entail assuming the role of an active administrative authority and even substituting itself for the municipal authority that issued the demolition order. In addition, this Chamber notes that this proceeding does not seek a declaration of nullity (declaratoria de nulidad) of the municipal decision ordering demolition of the structures; consequently, any discussion regarding the suitability and legality of the sanction imposed, or the possibility of replacing it with another punitive measure, falls outside the scope of the subject matter of this action, and this Chamber cannot issue any ruling on those matters. Accordingly, the ground asserted must be rejected.

IX.In view of the foregoing, the appeal on points of law (recurso de casación) filed by the plaintiff corporation shall be dismissed, and it shall be ordered to pay the costs incurred as a result thereof (Article 150, subsection 3), of the Código Procesal Contencioso Administrativo).

Documento PJEDITOR Res. 000624-F-S1-2024 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas dos minutos del trece de junio de dos mil veinticuatro.

En el proceso de conocimiento promovido por LITTLE DREAM SOCIEDAD ANÓNIMA, representada por su apoderado generalísimo sin límite de suma Francisco Alvarado Arrieta; contra la MUNICIPALIDAD DE CARRILLO GUANACASTE, representada por su Alcalde Carlos Gerardo Cantillo Álvarez; la sociedad actora formula recurso de casación contra la sentencia no. 31-2022 de las 11 horas 40 minutos del 05 de abril de 2022, dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda, Sección VIII, integrada por los jueces Laura García Carballo, Jonatán Canales Hernández y Paulo André Alonso Soto. Intervienen, en calidad de apoderados especiales judiciales: de la actora, el licenciado William Charpentier Morales; del municipio, el señor César Reyes Carvajal.

CONSIDERANDO

I.Según los hechos tenidos por probados en la sentencia recurrida, y no impugnados por la casacionista, Little Dream Sociedad Anónima es la propietaria registral del inmueble de la provincia de Guanacaste, folio real no. 68201, derecho 000, plano catastrado G-0735777-1988. Mediante nota sin firma, presentada el día 30 de marzo de 2005 ante el Ing. José Valencia Álvarez, Jefe Cantonal del Coco, del Instituto Costarricense de Acueductos y Alcantarillados, se presentó solicitud de disponibilidad de agua, para la construcción de condominios Little Dream, precisando que se construirían 70 filiales. El Lic. José M. Valencia Álvarez extendió constancia de fecha 6 de abril de 2005, indicando la disponibilidad de agua en la propiedad de plano número G-735777-1988, a nombre de Condominios Little Dream; precisando que: "AYA está en condiciones de brindar dicho servicio una vez que los interesados cumplan con las (sic) requisitos establecidos en el reglamento de prestación de servicios al cliente según CAP-IV-ART-18, 19).

Little Dream S.A. presentó ante la Municipalidad de Carrillo, con fecha 12 de agosto de 2005, el formulario de solicitud de permiso de construcción a nombre de "Little Dream S.A", cédula jurídica 3-1010394126, en Playas del Coco, en relación a la finca folio real matrícula no. 68201, plano G-735777-88; ello para la construcción de apartamentos con un área total de 2780,00 m2 y un valor de la obra de ¢233.210.000. Dicha empresa, en fecha 17 de enero de 2006, depositó la suma de ¢2.332.100.00 ante el Banco Nacional de Costa Rica, por concepto de pago de impuesto de construcción, a favor de la Municipalidad de Carrillo. El Ing. Juan José Rojas Pastrana, del Departamento de Ingeniería y Construcciones de la Municipalidad de Carrillo, en fecha 20 de enero de 2006, le comunicó a Little Dream S.A. que la solicitud de permiso de construcción no había sido aprobada dado que no se habían presentado los siguientes requisitos: "Solicitud firmada por el propietario o representante legal.// Plano catastrado de la propiedad, visado por la Municipalidad de Carrillo.// Cédula jurídica.// Personería Jurídica, original y certificada. // Boleta o constancia extendida por el Departamento de Contabilidad de que se encuentra al día en todos los tributos municipales.// Póliza de Riesgo de Trabajo (INS) // Estudio de Viabilidad Ambiental (SETENA).// Favor presentar lo solicitado para el trámite de su respectivo permiso de construcción”.

El día 12 de octubre de 2006, el Departamento de Ingeniería y Construcciones de la Municipalidad de Carrillo, le comunicó a Little Dream S.A. el rechazo de la licencia constructiva, en relación a la propiedad plano catastrado G-735777-88, proyecto de apartamentos Little Dream, señalando lo siguiente: "Se le informa que no se ha aprobado su permiso de construcción debido a que faltan los siguientes requisitos: // (...) (*) Póliza de Riesgo de Trabajo (INS) // (...) (*) Estudio de Viabilidad Ambiental (SETENA)// (...)// Favor presentar lo solicitado para el trámite de su respectivo permiso de construcción". El Inspector Mario Moraga, le comunicó a la Alcalde Municipalidad de Carrillo, en fecha 22 de enero de 2007, con ocasión de las construcciones en Mapache Playas del Coco (sic), que: "PROYECTO LITTLE DREAM S..A Se inspecciona y se verifica 66 villas de 30 mts. cuadrados c/u la construcción está totalmente terminada”.

Bajo el recibo no. 151645, de fecha 9 de marzo de 2007, consta que la Municipalidad de Carrillo recibió la suma de ¢2.332.100,00 por concepto de multa por infracción a la Ley de Construcciones. El Departamento de Ingeniería y Construcciones de la Municipalidad de Carrillo, en fecha 16 de diciembre de 2008, le comunicó a Little Dream S.A. que contaba con el plazo de 30 días hábiles para que presentara, ante la Municipalidad de Carrillo, los permisos de construcción de la piscina y jacuzzi, con un área aproximada de 180 m2 y de un rancho de 35 m2. El representante de Little Dream S.A., el día 5 de mayo de 2009, presentó nueva solicitud de construcción, ante el Departamento de Ingeniería y Construcción de la Municipalidad de Carrillo, para construcción de condominio, en la propiedad plano catastrado G-735777-88. Ese Departamento, en fecha 12 de mayo de 2009, le comunicó a Little Dream S.A. lo siguiente: "En razón de que usted no tiene Permiso de Construcción y con fundamento en el Art. 93 y 94 de la Ley de Construcciones se le otorga un plazo improrrogable de treinta días para que obtenga la licencia referida de la obra que se detalla a continuación: Departamentos y Parqueos terminados con áreas iguales a los que consta en planos constructivos C.F.I.A A/OC-351460 y piscina de 80 m2 y rancho con área de 35 m2. // Se le recuerda que para el otorgamiento del respectivo Permiso de construcción, además del cumplimiento de los requisitos, deberá cancelar el Impuesto de Construcción correspondiente al 1% del monto tasado para la obra, así como el pago de la multa respectiva, caso contrario, de no cumplir con esta disposición dentro del término citado, se procederá según corresponde conforme a la ley".

Mediante oficio MC-VM-622-2009, del día 25 de junio de 2009, el Departamento de Catastro y Bienes Inmuebles de la Municipalidad de Carrillo, denegó la solicitud de visado de plano catastrado G-735777-1988. La Msc. Sonia Espinoza Valverde, Secretaria General de la Secretaría Técnica Nacional Ambiental, del Ministerio de Ambiente, Energía y Telecomunicaciones, mediante oficio SG-AJ-0902-2010-SETENA, certificó a las 10 horas con 20 minutos del día 29 de julio de 2010, con relación al proyecto en cuestión, que: “… revisado en nuestra base de datos, que lleva esta Secretaría, con lo referente a si la Sociedad LITTLE DREAM S.A. realizó solicitud de Viabilidad Ambiental, o cuenta con expediente para proyecto Construcción de Apartamentos, ubicado carretera a Ocotal, 4 kilómetros Sur del Súper Compro de Playas del Coco, no consta se haya realizado algún trámite al respecto por dichas (sic) persona jurídica".

El Lic. Olman Jiménez Cerdas, de la Oficina del AyA de Sardinal de Carrillo, Guanacaste, en fecha 16 de agosto de 2010, según oficio OCPC-RCH-2010-39, y ante la consulta realizada por la Ing. Maureen Brenes Acuña, sobre si el proyecto contaba con disponibilidad de agua, respondió: "En atención a su oficio MC-IM-605-10 le indicó: "El proyecto es abastecido por un medidor de media pulgada. // Actualmente no cuenta con infraestructura y producción adecuada para abastecer el proyecto, por lo que no cuenta con disponibilidad. // Nota de disponibilidad ya esta vencida y no indica que va a construir o si existe viabilidad para el proyecto. // Además de acuerdo a mencionado RCH-2008-037 del 18-01-2008, solo se darán disponibilidades para vivienda familiar. (Se anexa copia de la directriz). // Por lo anterior no cuenta con disponibilidad para el proyecto antes mencionado”. El Departamento de Administración Tributaria de la Municipalidad de Carrillo, mediante certificación del 9 de marzo de 2011, señaló que, según los Registros Contables, Little Dream S.A., está inscrita como contribuyente de la Ley del Impuesto de Bienes Inmuebles, pero no inscrita como contribuyente por “Servicios, Tasas e Impuestos y Otros Servicios”, ni por la Ley de Impuestos Municipales del Cantón de Carrillo y sus servicios, ni por la Ley de Licores y su Reglamento.

El Alcalde Municipal, por resolución de las 09 horas 47 minutos del 10 de marzo de 2011, con fundamento en los ordinales 169 de la Constitución Política; 162 de Ley 7794; 15 y 57 de la Ley 4240; 74, 88 y 96 de la Ley 833, conminó a Little Dream S.A. al desalojo y demolición de las edificaciones y construcciones ilegales. En la parte dispositiva se indicó: "POR TANTO: Expuestos los anteriores argumentos de hecho y de derecho, comprobado fehacientemente el incumplimiento tanto de la normativa supracitada como de los plazos y prórrogas que operaban incluso en favor del administrado, se previene a la sociedad LITTLE DREAM S.A. con cédula jurídica 3-101-394126, para que en el término improrrogable y perentorio de cinco días hábiles contados a partir de la notificación de esta resolución, proceda en definitiva y voluntariamente al desalojo y demolición de las edificaciones y construcciones ilegales erigidas en la finca ubicada bajo Plano Catastrado número G-735777-88, so pena de proceder, vencido dicho término, al desalojo y/o demolición por parte de esta Municipalidad, en su función dada por ley con los gastos por ello implique a su cargo.

Contra la presente resolución cabrán los recursos de Revocatoria ante esta Alcaldía y de Apelación para ante el superior correspondiente dentro del plazo de cinco días contados a partir de la notificación de la presente Resolución. Es todo. Notifíquese". Dicha resolución fue notificada a la interesada el 12 de marzo de 2011. El señor José Francisco Alvarado Arrieta, en su condición de apoderado generalísimo sin límite de suma de la sociedad Little Dream S.A., presentó incidente de suspensión del acto administrativo y recurso de apelación. La Sección Tercera del Tribunal Contencioso Administrativo y Civil de Hacienda, en función de superior jerárquico bifásico, mediante resolución no. 460-2013, de las 15 horas 45 minutos del 31 de octubre de 2013, indicó: “XIII.- Corolario. Este Tribunal debe ser explícito al indicar que por la manera en que ocurrieron los eventos, tomando en consideración que el proyecto presentó desde un inicio problemas con su implementación, al carecer de elementos esenciales como el debido suministro de agua potable, la falta de estudio de impacto ambiental y la ausencia del plano de la finca debidamente visado, son claro reflejo de que se han burlado los estándares urbanísticos y se ha evadido el sometimiento a los instrumentos de regulación en la materia.

Estas actuaciones son un claro desacato al ordenamiento territorial por parte de la impugnante, arribándose a la unívoca conclusión de que no era posible para el gobierno local, en estas condiciones, conferir la licencia constructiva. El procedimiento previsto en los numerales 93 y siguientes de la Ley de Construcciones ha sido cumplido a satisfacción, dándose al propietario la oportunidad de poner en orden su desarrollo y cumplir con todos los requisitos de ley. Sin embargo, en esta causa es claro que existen dos exigencias legales insalvables, que son la ausencia de viabilidad ambiental y la ausencia de disponibilidad de agua, lo cual llevó a clausurar obras en un primer momento. Aun así, el desarrollador no respetó las órdenes de clausura que desde el año 2006 se emitieron y continuó y culminó las obras constructivas, asumiendo por su propio riesgo, los efectos nocivos que su propia negligencia acarrea.

Dada la abierta transgresión de las cargas y deberes legales que recaen sobre el administrado, en este caso no quedó más remedio para el Alcalde, como en rigor procedía, de ordenar el desalojo y la demolición resultando entonces que lo actuado por el jerarca municipal se encuentra apegado a derecho. Por ende, no se aprecia ilegalidad alguna en lo resuelto, ni transgresión al principio de legalidad administrativa ni al debido proceso, puesto que las actuaciones municipales impugnadas son conformes con el ordenamiento, debiendo ser rechazados los agravios expresados, por resultar jurídicamente incorrectos. Así las cosas, lo procedente es confirmar la resolución del Alcalde de Carrillo, de las 9:47 horas del 10 de marzo el 2011 y, no quedando ulterior recurso, deberá darse por agotada la vía administrativa. Dado que dentro de la causa judicial que se sustancia en este mismo Tribunal, expediente No. 11-001707-1027-CA, se ordena agregar una copia de la presente resolución, a efecto de que el juez tramitador disponga como proceda en derecho.// POR TANTO // Se confirma la resolución del Alcalde de Carrillo, de las 9:47 horas del 10 de marzo del 2011.

Se da por agotada la vía administrativa. Agréguese una copia de la presente resolución, dentro del expediente No. 11-001707-1027-CA que se tramita ante el Tribunal Contencioso Administrativo y Civil de Hacienda. Evelyn Solano Ulloa //Francisco Javier Muñoz Chacón Jorge Leiva Poveda".

II.Con fundamento en lo anterior, Little Dream S.A. demandó a la Municipalidad de Carrillo, pretendiendo: “(…) se obligue a la Municipalidad de Carrillo Guanacaste a otorgar a mi representada los permisos de construcción correspondientes al proyecto ya terminado LITTE DREAMS ubicado carretera a Ocotal Guanacaste, Cantón de Carrillo.// Asimismo solicito se condene a la demandada al pago de ambas costas de este proceso”. El Municipio accionado contestó negativamente y opuso excepciones de falta de legitimación activa y falta de derecho. El Tribunal Contencioso Administrativo y Civil de Hacienda, Sección VIII, integrada por los jueces Laura García Carballo, Jonatán Canales Hernández y Paulo André Alonso Soto, mediante sentencia no. 31-2022 de las 11 horas 40 minutos del 05 de abril de 2022, dispuso: “Se rechaza la excepción de falta de legitimación activa. Se acoge la excepción de falta de derecho. Se rechaza la demanda interpuesta por LITTLE DREAM S.A. contra la MUNICIPALIDAD DE CARRILLO GUANACASTE. Son las costas a cargo de la parte demandante y a favor de la Municipalidad demandada. Firme esta resolución, levántese la medida cautelar”. Inconforme con lo resuelto, la actora plantea recurso de casación.

III.En el primer agravio acusa existencia de un litisconsorcio necesario incompleto. Sostiene, desde la presentación de la demanda (hecho 11) señaló que existía una gran cantidad “de ocupantes, llámese propietarios” que no han sido notificados de la demolición ordenada por la Municipalidad. Explica, si bien en este asunto figura una sociedad mercantil como actora, lo cierto es que en la realidad material lo que subsiste es la construcción de 66 apartamentos que tienen propietarios independientes, y la relación subyacente es la de un condominio de hecho. Prosigue, ante cualquier desalojo administrativo, la ley exige notificar a todos los ocupantes e inclusive determinar si hay menores de edad, adultos mayores y personas con discapacidad; todo lo cual con mayor razón debe cumplirse en el caso de una demolición. Reprocha, yerra la sentencia en cuanto tiene como hecho no probado la existencia de otros propietarios del inmueble del partido de Guanacaste Folio Real no. 68201, derecho 000; ello por cuanto, desde el inicio de la demanda, la representación de la actora se refirió a esa situación en el hecho décimo primero de la demanda, y la Municipalidad -al contestar- reconoció tener conocimiento de la existencia de esos ocupantes.

IV.No ha lugar al cargo aducido. De conformidad con la doctrina de los ordinales 106 del Código Procesal Civil derogado (Ley 7130; vigente al momento de interposición de la demanda), y 22.1 del Código Procesal Civil vigente (Ley 9342), el litisconsorcio necesario se configura cuando, por disposición de la ley o por la naturaleza de la relación jurídica material, se exige que los sujetos a quienes afecta la resolución, actúen conjuntamente, como litisconsortes, de manera que queden vinculados al proceso y consecuentemente a los efectos de la sentencia. El litis consorcio necesario implica la existencia de relaciones jurídicas materiales respecto de las cuales no es posible pronunciarse fraccionándolas o calificándolas sólo en relación de algunos de los sujetos, pues la decisión engloba y obliga a todos. La presencia de todos los sujetos es indispensable para que la relación procesal se complete y sea posible decidir en sentencia sobre el fondo de aquella.

En la especie, no se configura el litisconsorcio necesario, en ninguna de sus modalidades. Nótese que la pretensión de la demanda es que: “(…) se obligue a la Municipalidad de Carrillo Guanacaste a otorgar a mi representada los permisos de construcción correspondientes al proyecto ya terminado LITTE DREAMS ubicado carretera a Ocotal Guanacaste, Cantón de Carrillo. // Asimismo solicito se condene a la demandada al pago de ambas costas de este proceso”. Tal pretensión en nada obliga a los supuestos ocupantes de los apartamentos del proyecto Little Dreams, pues no se pide nada contra ellos, ni de ellos se exige algún tipo de obligación. Luego, tampoco el municipio demandado formuló reconvención, ejerciendo pretensión alguna contra esos supuestos “condóminos de hecho”. Tampoco la naturaleza de la relación jurídico material que se discute en este proceso exige la participación de esos supuestos ocupantes.

Según se desprende de los hechos de la demanda, y así se tuvo por demostrado en sentencia, la sociedad demandante, en tanto propietaria del inmueble del Partido de Guanacaste folio real no. 68201, derecho 000, presentó ante la Municipalidad de Carrillo, con fecha 12 de agosto de 2005, el formulario de solicitud de permiso de construcción a nombre de "Little Dream S.A", cédula jurídica 3-1010394126, en Playas del Coco, en relación a la finca indicada, para la construcción de apartamentos con un área total de 2780,00 metros cuadrados y un valor de la obra de ¢233.210.000. En atención a lo anterior, la relación jurídica material que subyace a este proceso obedece a esa solicitud que, en cabeza propia, realizó Little Dream S.A ante la Municipalidad de Carrillo, para la obtención de los permisos de construcción correspondientes para su proyecto de apartamentos, y que le fueron denegados; de ahí que, como pretensión de la demanda, solicite se le ordene al municipio conceder los permisos respectivos.

La relación jurídica material subyacente tiene como génesis esa solicitud formal ante el ente municipal y su correspondiente denegatoria, en la cual no hubo otros intervinientes mas que la sociedad solicitante y la Municipalidad, y es entre ellas que se ventila la discusión sobre la procedencia jurídica o no de los permisos de construcción pretendidos. Ahora bien, la actora recurrente aduce que en la especie se está en presencia de un litisconsorcio necesario incompleto, porque los ocupantes de los apartamentos no han sido notificados de la orden de demolición emitida por la Municipalidad, y ésta les afecta. No obstante, tal argumento no resulta de recibo, toda vez que ese hecho corresponde a un eventual vicio de fondo de los actos administrativos municipales que decretaron la demolición de las obras carentes de permisos de construcción, pero, en su demanda, la actora no formuló pretensión anulatoria alguna contra esos actos municipales, de manera que no podría pretender aducir esa supuesta circunstancia -ahora como un defecto procesal-, cuando queda claro que escapa a los alcances y no tiene relación alguna con el objeto del proceso, porque no está siendo discutida la validez del acto que ordena la demolición, según se analizó supra en lo relativo a las pretensiones y a la relación jurídico material subyacente a esta litis. En consecuencia, se denegará el reproche formulado.

V.En el segundo agravio refuta los hechos no probados 1), 3) y 10). Acusa, existió error valorativo de la declaración del ingeniero municipal Lucas Baldioceda y la prueba documental de folio 135, donde consta un documento suscrito por ese profesional, en el que se indican los requisitos para la construcción en el cantón de Carrillo. Acota, esa prueba no señala que se trate de requisitos de construcción para una vivienda unifamiliar, como lo quiso hacer ver el día del juicio el abogado de la Municipalidad de Carrillo. En el mismo sentido aduce, en folio 124 se lee carta fechada del 16 de octubre de 2014, suscrita por el Ingeniero Lucas Baldioceda Rodríguez -quien ya no era ingeniero municipal- y enviada al entonces ingeniero municipal Celso Cortés, donde ratifica que los hechos ocurrieron tal y como los narró el señor Carlos Arroyo Quirós (representante del Grupo Mapache), y que, para los años cuando se construyó el Proyecto Little Dreams, no existían los requisitos que posteriormente impuso la Municipalidad de Carrillo.

Asevera, con lo anterior queda claro que la Municipalidad de Carrillo varió los requisitos de construcción con posterioridad a la solicitud de los permisos, y pretendió que el desarrollador los cumpliera cuando ya la obra se encontraba avanzada. Alega, a raíz de lo indicado, se conculcaron los artículos 82.5, 87, 89 y 90 de la Ley de Construcciones, y el principio de confianza legítima.

VI.El cargo aducido resulta inútil para quebrar el fallo recurrido, pues no combate integralmente los argumentos jurídicos y fácticos que le sirven de sustento, según se pasa a explicar. Señala la casacionista, el entonces ingeniero municipal -Lucas Baldioceda-, en el año 2005, le extendió un documento con los requisitos para la construcción en el cantón de Carrillo, los cuales se enlistaban así: “1. Solicitud de construcción en el formulario que la Municipalidad le facilitara (firmada por el dueño, o el representante legal de la propiedad y además por el solicitante si es el caso) la cual deberá de venir acompañada de un timbre municipal de 100.00 cien colones) // 2. Presentar una copia de la escritura de la propiedad o informe registral. // 3. Presentar copia del plano catastrado de la propiedad. // 4. Presentar boleta o constancia extendida por el departamento de contabilidad de que se encuentran al día con todos los tributos municipales. // 5.

Presentar los planos de la construcción debidamente firmados por un ingeniero civil, ingeniero constructor o arquitecto, debidamente incorporado al Colegio de C.F.I.A. ya sea para construcción nueva o ampliación hasta segunda planta. // 6. Visto bueno del Ministerio de Salud de Carrillo. // 7. Presentar copia de recibo de cancelación, de la póliza de Riesgo de trabajo (I.N.S). // 8. Cancelación del 1% del valor de la obra (licencia que le da derecho para construir)” (folio 125 del expediente judicial). Según se tuvo por demostrado, y no ha sido refutado por la promovente: “6) El Ing. Juan José Rojas Pastrana, del Departamento de Ingeniería y Construcciones de la Municipalidad de Carrillo, en fecha 20 de enero de 2006, le comunicó a Little Dream S.A. que la solicitud de permiso de construcción no había sido aprobada dado que no se habían presentado los siguientes requisitos: "Solicitud firmada por el propietario o representante legal.// Plano catastrado de la propiedad, visado por la Municipalidad de Carrillo.// Cédula jurídica.// Personería Jurídica, original y certificada. // Boleta o constancia extendida por el Departamento de Contabilidad de que se encuentra al día en todos los tributos municipales. // Póliza de Riesgo de Trabajo (INS) // Estudio de Viabilidad Ambiental (SETENA).// Favor presentar lo solicitado para el trámite de su respectivo permiso de construcción”.

Sobre el particular, el Tribunal analizó: “En el presente caso, observa esta Cámara que la parte demandante solicita se obligue a la Municipalidad de Carrillo a que le otorgue los permisos de construcción del proyecto ya terminado denominado Little Dream S.A, por considerarse que efectivamente la demandante cumplió oportunamente con todos los requisitos que la corporación municipal le solicitó inicialmente, sin que se haya impugnado de nulidad alguna las diversas actuaciones administrativas dispuestas en este expediente, por lo que éstas se encuentran firmes y eficaces. Así, de la revisión de los hechos probados, se desprende que la Municipalidad de Carrillo -recibió- la solicitud de permiso constructivo de fecha 12 de agosto de 2005, y procedió a rechazar el permiso constructivo el día 20 de enero de 2006, e indicó dentro los motivos del rechazo los siguientes: [los ya indicados en el hecho probado 6)].

Dicho esto, es claro que considerando que se le hubiere requerido inicialmente ciertos requisitos por parte del Ing. Lucas Baldioceda Rodríguez, (…) es lo cierto, que se denota del primer rechazo que la parte demandante -originalmente- no cumplió con acreditar ante el Departamento de Ingeniería y Construcciones, ante el Ing. a cargo, la totalidad de los requisitos solicitados, por lo que tampoco se puede alegar la existencia de un derecho subjetivo a su favor”. Es decir, aún asumiendo hipotéticamente que los requisitos solicitados a la actora para tramitar el permiso de construcción fueron únicamente los consignados en el documento suscrito por el ingeniero Lucas Baldioceda, lo cierto del caso es que éstos tampoco fueron cumplidos a cabalidad por la solicitante, de manera que no podría pretender beneficiarse de un derecho subjetivo inexistente. Nótese que la recurrente no hace lo propio por desvirtuar ese hecho probado sexto, con lo cual se mantiene incólume la sentencia en cuanto al particular, y el agravio resulta inocuo a efectos de casar el fallo.

Aunado a lo anterior, como un segundo motivo de improcedencia del reparo formulado, se tiene que el Tribunal de instancia advirtió lo siguiente: “La tesis de la parte actora ha girado siempre y ahí se ha mantenido, de forma equivoca, como se motivará más adelante- en que cumplió con "todos" los requisitos que se le pidieron originalmente, lo cual ya se evidenció supra no fue así, sin embargo, conforme la Constitución Política, debe recordarse que "La administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal (..)", ello según el artículo 169 constitucional. Y este artículos constitucional ha sido desarrollado, entre otras normas, por el Código Municipal, la Ley de Construcciones, Ley de Planificación Urbana y el denominado: "Reglamento de Construcciones, Reparaciones y Ampliaciones; así como visados de planos, fiscalización de obras, movimientos de tierra y permisos de demolición"; según acuerdo N° 2, de la sesión extraordinaria N° 30-2003 del día 1° de octubre de 2003, de la Municipalidad de Carrillo, ello con fundamento en el Código Municipal, artículo 13 inciso c), hoy derogado por el Reglamento Municipal N° 27, acuerdo 2 del día 3 de julio de 2018, pero vigente al momento de los hechos ocurridos con ocasión a este proceso; el cual en su artículo 7 estipulaba: "Artículo 7º-Para los efectos de tramitar el respectivo permiso municipal de construcción, lo cual incluye construcción de obra nueva, reparación, ampliación, movimiento de tierra, demolición de alguna ya existente, los interesados deberán presentar al Departamento de Construcciones, los siguientes documentos: // a) La solicitud de permiso de construcción, reparación, ampliación, movimiento de tierra o demolición en el formulario que la Municipalidad suministrará con tal propósito.

El formulario deberá venir firmado por el dueño de la propiedad o su representante legal con poder suficiente para el acto, y además, y por el solicitante de la construcción, en el caso de que el solicitante y el propietario no correspondan a la misma persona. // b) El interesado deberá presentar con la solicitud, fotocopia de la escritura de la propiedad, certificación literal o informe registral que compruebe las características del inmueble y la indicación de su propietario, copia de la certificación de la personería jurídica y de la cédula jurídica, en caso de que el propietario sea una persona jurídica y copia cuando corresponda, de la sentencia o documento judicial, administrativo o de carácter privado, equivalente, que compruebe el derecho de propiedad o el ejercicio legítimo de la posesión. Deberá aportar además, una fotocopia del plano catastrado de la propiedad. En caso de duda se verificará la información con el Departamento de Catastro, además cuando las construcciones se realizan frente a una ruta nacional el MOPT indicará el retiro correspondiente. // c) La solicitud debe venir acompañada con un timbre municipal de (100,00) colones los cuales se adherirán en la portada del formulario de solicitud. // d) Con la solicitud, el interesado deberá aportar constancia extendida por el Departamento de Contabilidad de que se encuentra al día con todos los impuestos, cánones y/o servicios municipales. // e) Señalar dentro del cantón, lugar para recibir notificaciones, por cualquier medio autorizado por la ley, es decir: lugar del domicilio dentro del perímetro de la jurisdicción de la Municipalidad, casilla de correo, fax, número de teléfono. // f) Comprobar de previo a los inicios del trabajo, que canceló la póliza de riesgos de trabajo al INS, en los casos que corresponda. // g) Con base en el valor tasado de la construcción, deberá cancelar el impuesto de construcción equivalente al 1% del valor del valor de la obra.

En el caso de vivienda o construcción de interés social, el impuesto corresponde el 0,5%, según la ley y la normativa vigente. // h) Cualquier otro que por disposición legal, reglamentaria o norma técnica se deba aportar o se considere pertinente solicitar, a juicio del funcionario que tramite la solicitud. (…) En relación a lo anterior, es claro que el "derecho a edificar" no es un derecho absoluto, sino que se encuentra sujeto a razones de orden público, y sometido al ordenamiento público que regula el planeamiento, ordenación territorial, construcciones, etc, y que establece de forma expresa los requisitos legales que debe cumplir toda edificación, de forma tal que se dé de la mejor forma el aprovechamiento urbanístico de las ciudades, sin dejar de lado la protección al medio ambiente, según las diversas regulaciones existentes. Denota este Tribunal que dentro de los requisitos que establece el Reglamento Municipal -supracitado-, ciertamente, no se indicaba de forma expresa como requisitos la viabilidad ambiental, el visado municipal del plano catastrado y la disponibilidad de agua, lo cual como se indicará obedece a que ello lo regulan otras normas y no debido a una ausencia de regulación.

Ahora, también observa esta Cámara, que la empresa demandante, no cumplió tampoco inicialmente, con aportar todos y cada uno de los requisitos previstos en el Reglamento Municipal de forma exacta, y aún los que acusa le indicó el Ingeniero Municipal apellidado Baldioceda. Ello se concluye con vista en el rechazo de la licencia constructiva de fecha 20 de enero de 2006, en donde claramente se dispuso por parte de la Corporación Municipal: "No ha sido aprobada por cuanto no han presentado los siguientes requisitos: Solicitud firmada por el propietario o representante legal.// Plano catastrado de la propiedad, visado por la Municipalidad de Carrillo. // cédula jurídica// Personería Jurídica, original y certificada. // Boleta o constancia extendida por el Departamento de Contabilidad de que se encuentra al día en todos los tributos municipales. // Póliza de Riesgo de Trabajo (INS)// Estudio de Vialidad Ambiental (SETENA)".

Así, obsérvese que el mismo Reglamento N° 30 de la Corporación Territorial, remite a en el inciso h) a cualquier otro requisitos que por disposición legal, reglamentaria o norma técnica se considere pertinente por el funcionario que tramite la solicitud, como en este caso, así lo consideró el Ing. Juan José Rojas Pastrana, el Ingeniero Municipal a.i., que le correspondió conocer y analizar de esta solicitud y no otro según la prueba documental; situación que facultaba al funcionario en cuestión y entiéndase a la Administración Municipal, a requerir además de los insumos previstos, o requisitos, que no estaban determinados por el Reglamento Municipal, pero que si lo estaban por otras disposiciones normativas (…) (el énfasis es suplido). La parte recurrente insiste en su postura en cuanto a que el ingeniero municipal Baldioceda únicamente le solicitó ciertos requisitos para tramitar el permiso de construcción, que posteriormente la Municipalidad pretendió ampliar cuando ya las obras estaban avanzadas; empero, omite por completo combatir el razonamiento jurídico del Tribunal en cuanto a la habilitación normativa contenida en el artículo 7 del Reglamento Municipal no. 27- vigente al momento de los hechos aquí discutidos-, en el sentido de que, además de los requisitos expresamente establecidos en ese precepto, además podían exigirse otros que -por disposición legal, reglamentaria o norma técnica- se considerasen pertinentes por el funcionario que tramitara la solicitud.

De igual manera, omite refutar el análisis normativo realizado por el Tribunal en cuanto a la exigencia legal de contar con la viabilidad ambiental, el visado municipal del plano catastrado y la disponibilidad de agua, como requisitos indispensables para obtener los permisos de construcción correspondientes, todo ello al amparo de lo explicado en torno al inciso h) del artículo 7 del Reglamento Municipal (VII, VIII, IX, y X). En consecuencia, visto que el recurrente no solo no acreditó haber cumplido con la presentación de los requisitos solicitados por la Municipalidad de Carrillo en el año 2005, sino que tampoco ataca los otros argumentos esbozados por el Tribunal, es claro, la censura planteada no resulta admisible, por lo que deberá de rechazarse.

VII.En el tercer reparo acusa inaplicación del artículo 93 inciso 3) de la Ley de Setena y preterición del informe pericial del ingeniero José Manuel Blanco Mazariegos. Transcribe las conclusiones del perito. Censura, el Tribunal no tomó en consideración que, de acuerdo con la valoración del perito ambiental, la demolición de las obras causaría un mayor daño al ambiente. Aunado a ello, los jueces tampoco hicieron referencia a la posibilidad de regularizar las obras, partiendo del hecho de que no se está en presencia de zona de protección ambiental, ni de reserva alguna.

VIII.La disconformidad planteada no resulta procedente. Respecto del tema de la demolición, el Tribunal indicó: “Es claro que el informe pericial rendido en autos, denota que una demolición de una obra como la construida podría afectar el ambiente, ello claro está, si no se toman los reparos correspondientes, mas no es posible para este Tribunal con fundamento en ese informe desaplicar la normativa vigente y así justificar el incumplimiento flagrante de la parte actora de la normativa urbanística supracitada. Lo anterior implicaría además asumir una posición de Administración activa, que no es competencia de este Tribunal, y lo que es aún más grave soslayando los incumplimientos legales, que la parte omitió satisfacer, pese al conocimiento de los mismos y de las consecuencias legales de su inobservancia. Cabe señalar que para la ejecución de la demolición deberá realizarse conforme lo prevé la Ley Orgánica del Ambiente, siempre en tutela del ambiente y minimizar los efectos de las poblaciones aledañas” (el énfasis es suplido).

La recurrente reprocha que, en lugar de la demolición, el Tribunal debió considerar alguna otra medida compensatoria o de mitigación, incluso hacer referencia a la posibilidad de regularizar las obras, pero, no refuta -de forma debidamente razonada- el criterio del colegio de jueces en cuanto a que, un proceder en ese sentido, implicaría asumir una posición de Administración activa, sustituyendo incluso a la autoridad municipal que dictó la orden de demolición. Además de lo anterior, advierte esta Sala, en este proceso no ha sido demandada la declaratoria de nulidad de la resolución municipal que ordenó la demolición de las obras; por consiguiente, cualquier discusión acerca de la idoneidad y legalidad de la sanción adoptada, o la posibilidad de sustituirla por otra medida sancionatoria, escapa a los alcances del objeto de esta demanda y no podría esta Sala emitir ningún pronunciamiento sobre tales aspectos. Así las cosas, se impone el rechazo del cargo formulado.

IX.En mérito de lo expuesto, procederá declarar sin lugar el recurso de casación planteado por la sociedad actora, a quien se impondrán las costas generadas con su ejercicio (artículo 150 inciso 3) del Código Procesal Contencioso Administrativo).
