Ordinary proceeding (proceso de conocimiento) brought by DENNIS LACOMBE MARTÍNEZ against MUNICIPALIDAD DE SANTA ANA, represented by its special judicial attorney (apoderada especial judicial), attorney Andrea Robles Álvarez, and against LINDORA PROJECT MIL OCHOCIENTOS SOCIEDAD ANÓNIMA, corporate identification number three - one hundred one - six hundred eleven thousand six hundred nine, represented by Alberto Kader Israeliski. The plaintiff files an appeal on points of law (recurso de casación) against judgment no. 003-2022-IV, issued at 11:53 a.m. on January 07, 2022, by judges Judith Reyes Castillo, Elías Baltodano Gómez, and Felipe Córdoba Ramírez of the Contentious-Administrative Court, Fourth Section. WHEREAS
I.This matter arose from the construction of the Centro Comercial Terrazas de Lindora. In essence, the plaintiff stated that, on 4 de septiembre de 2009 and on subsequent dates, Mr. Alberto Kader, representative of Rutilo S.A., which later merged with Lindora Project Mil Ochocientos S.A., sent a letter to the Director of Land-Use Planning of the Municipalidad de Santa Ana requesting that industrial land use (uso industrial) be established for the property then registered as number 1-464397-000, under survey plan SJ-361033-96. He explained that the letter stated that the reason for that modification was that a portion of the property apparently already had that status. He asserted that, pursuant to section 2 of the Plan Regulador de Santa Ana, it could be extended to the remainder of the property. He objected that what was not disclosed, or was omitted, was that only 0,02% of the entire property was actually designated for industrial use.
He stated that, through official letter MSA-DOT-APU-USV-03-157-2009, engineer Jeffrey Zumbado, Director of Land-Use Planning of the Municipalidad de Santa Ana, informed Mr. Kader of the uses permitted on the property under the Plan Regulador. He asserted that, concurrently with the first request, on 30 de setiembre del citado año, Mr. Kader expanded his application before the same office, requesting that the land-use designation (afectación) of the property as Green Area (Área Verde, AV) be lifted so that it could be declared an Industrial Zone. He explained that, one day later, Eng. Zumbado referred the application to the Municipality’s Legal Advisory Office for a formal legal opinion on the relief sought by the company’s representative. He detailed that Licda. Andrea Robles stated that the application had to be reviewed by the Municipal Council to determine the appropriate course of action, because the Mayor’s Office lacked authority to modify the land use (uso de suelo) established in the Plan Regulador Vigente.
He argued that the Municipal Council’s legal advisor recommended returning the file so that the various administrative departments could issue opinions on the requested change from a Low-Density Residential Zone (Zona Residencial de Baja Densidad, ZRBD) to an Industrial Zone (Zona Industrial, ZI). He added that the legal advisor’s opinion was approved by resolution of the Municipal Council of Santa Ana at ordinary session no. 181 of 8 de diciembre de 2009, set forth in article III. He alleged that this effectively repealed article 14 of the Plan Regulador Vigente without following the corresponding legal procedure. He recounted that, through official letter MSA-DOT-03-607-2009, Eng. Zumbado stated: “Por tanto, a land-use certificate (certificado de uso de suelo) will be issued certifying the extension of the Industrial Zone over the Low-Density Residential Zone (…) resulting in 78.27% of the property being classified as Industrial Zone and, following the present disapplication of the public-use reservation (reserva de uso público), 21,37% as Low-Density Residential Zone.” In his view, Eng.
Zumbado lacked authority to convert the property into an industrial-use zone, leaving only the green area as part of the low-density residential zone. He added that, being dissatisfied with this decision, Mr. Kader filed an appeal (recurso de apelación) with the Mayor on 17 de diciembre de 2009. He stated that, on 9 de febrero de 2010, through decision MSA-Alc-04-099-10, Lic. Gerardo Oviedo Espinoza, Mayor of Santa Ana, granted the appellant’s request and ordered the Land-Use Planning Department, following the disapplication of the public-use reservation approved by the Municipal Council, to declare the entire property 100% Industrial Zone. In his view, that decision was entirely devoid of reasoning and contained no factual or legal analysis. He stated that, through resolution 9 adopted at ordinary session number 233, held on 21 de octubre de 2014, the Municipal Council approved the construction permit for the Proyecto Centro Comercial Terrazas Bloque B, Comercio y Sótanos.
He objected that none of the actions taken were ever referred or notified to any local resident, Asociación de Desarrollo Integral, or other organizations, because the matter was handled with absolute secrecy. He complained that his views were never sought, even though he lives adjacent to the site where the shopping center, a hotel, and other premises are being built. He explained that he therefore brought this action; moreover, the property where he resides is located adjacent to the development of the aforementioned project, on property number 1-0015181-F-000, owned by the company also represented by the plaintiff, Corporación B L Veintiuno de Santa Ana S.A, corporate identification number 3-101-128794, located in the Distrito de Pozos de Santa Ana, unit number 21 of the Urbanización Bosques de Lindora. He stated that the work being performed on the aforementioned project causes disturbances in the residential development where he lives.
He argued that no procedure whatsoever was followed to amend the Plan Regulador, that no authorization from INVU was obtained, and that there was no indication that SETENA had analyzed the illegal and unconstitutional amendment of the Plan Regulador within the scope of its authority, or that the Minister of the Environment had addressed the evident environmental and noise pollution. He added that no action by MOPT was apparent concerning the regulation and mitigation of the traffic problem occurring in the area, nor was there any public-health review by the Ministry of Health. He alleged that observation of the structure already erected revealed windows facing the plaintiff’s residence, including the patio area, which, in his opinion, clearly infringes his privacy. He emphasized that the Municipality authorized and issued permits to the defendant company to develop a second building adjacent to the first.
He objected that noise is being generated by the construction work, the increasing traffic, and the entry of large vehicles into the construction sites. He stated that he lives beside the green area, which is being affected without any intervention by the Municipality. He concluded that complaints are heard every day because it is impossible to travel through the area, causing substantial pollution affecting not only noise levels but also nature. The plaintiff filed the complaint on 11 de mayo de 2016, and the relief sought, as adjusted at the preliminary hearing, was as follows: “ 1- Because all municipal actions are contrary to law, I request that the defendant municipality and, jointly and severally, the defendant company be ordered to pay compensation for the damage caused, consisting, in the case of material damage, of the loss associated with the current diminished value of the property, equitably assessed at $400.000,00 (four hundred thousand exact dollars). / 2- Withdrawn / 3- Because the Resolution of the Concejo Municipal de Santa Ana adopted at Ordinary Session Nº 181 of 8 de diciembre del 2009, set forth in article III, and the various actions of the municipal bodies are unconstitutional and illegal, order the defendant company and the defendant Municipality to pay compensation for the objective non-pecuniary damage (daño moral objetivo) caused by the violation of my rights to the environment, privacy, and health, equitably assessed at $100.000 (one hundred thousand exact dollars). / 4- Because the Resolution of the Concejo Municipal de Santa Ana adopted at Ordinary Session Nº 181 of 8 de diciembre del 2009, set forth in article III, and the various actions of the municipal bodies are unconstitutional and illegal, order the defendant company and the defendant Municipality to pay compensation for the subjective non-pecuniary damage (daño moral subjetivo) caused by the violation of my rights to the environment, privacy, and health, equitably assessed at $150.000 (one hundred fifty thousand exact dollars) / 5- Because the Resolution of the Concejo Municipal de Santa Ana adopted at Ordinary Session No. 181 of 8 de diciembre del 2009, set forth in article III, and the various actions of the municipal bodies are unconstitutional and illegal, order the defendant company and the defendant Municipality to pay compensation for the physical harm caused by the violation of my rights to the environment and health, equitably assessed at $ 100.000 (one hundred thousand exact dollars) / 6- Given (sic) the continuing violation of my aforementioned rights, and because construction of the second building is to begin, order that no new adjacent building be constructed until the Plan Regulador has been amended and my aforementioned rights are respected. / 7- Given (sic) the continuing violation of my aforementioned rights, and because work is being performed in the green area, order that no work whatsoever be performed in that area and that it be restored to its original status as a green area. / 8- Order the respondent company to undertake the necessary work to avoid infringing the privacy of the undersigned and the residents of the area. / 9- Without prejudice to the damages sought in this proceeding, if demolition of the building is not approved, I request that the defendant Municipality and company undertake the necessary actions to mitigate the ongoing violation of the rights to privacy, the environment, and health, including both physical health and freedom from noise pollution, in order to lessen the effects of the development of this project, including eliminating any commercial and social activities that infringe those rights, such as by closing the windows facing my residence. / 10- Order the Municipality to instruct the development company to undertake the necessary actions to avoid infringing privacy. / 11- Order the Municipality to instruct the development company to undertake the necessary actions to avoid infringing the scenic landscape (espacio escénico). / 12-Refer the relevant records to the Ministerio Público so that officials of the various institutions may be investigated for possible offenses of breach of official duties (incumplimiento de deberes). / 13- Order the defendants to pay the indexation of the amounts claimed, accrued interest, and both categories of litigation costs associated with this proceeding.” Both defendants opposed the action.
The Municipality raised the defense of lack of a legal right (falta de derecho). Lindora Project Mil Ochocientos S.A. asserted the preliminary defenses (defensas previas) of failure to join an indispensable defendant (integración de la litis consorcio pasivo necesario), statute of limitations (prescripción), and an act not subject to challenge (acto no susceptible de impugnación), which were rejected through interlocutory decisions no.1692-2019-T of 14 horas 20 minutos del 18 de setiembre de 2019 and no 1490-2020-T of 08 horas 15 minutos del 28 de setiembre de 2020; it also raised the defenses of lack of a legal right, lack of a present interest (falta de interés actual), and expiration of the filing period (caducidad). The Tribunal Contencioso Administrativo y Civil de Hacienda, Sección V, in judgment no. 003-2022-IV of 11 horas 53 minutos del 07 de enero del 2022, ruled: “The Court sua sponte finds a lack of standing to sue (falta de legitimación activa).
The complaint filed by Dennis Lacombe Martínez against the Municipalidad de Santa Ana and Lindora Project Mil Ochocientos S.A. is dismissed in its entirety. Costs shall be borne by the plaintiff.” Dissatisfied with the ruling, the plaintiff filed an appeal in cassation (recurso de casación), which was admitted by this Chamber.
Cassation on Procedural Grounds
II.In the sole grievance of this nature, he alleges failure to observe the rules established in the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo, CPCA) governing deliberation, the time limit for rendering the judgment, or the drafting of the ruling with respect to its essential elements, seeking to have it declared absolutely null and void. He explains that the challenged judgment was served on him by email on January 10, 2022, and therefore is deemed served on the next business day, namely January 11. In his view, this violates the provisions of Article 111 of the CPCA and Articles 79 and 82 of the Autonomous Regulations on the Organization and Service of the Administrative Litigation and Civil Treasury Jurisdiction (Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda). He notes that the trial was held on Friday, December 3, 2021, when the testimonial evidence was taken and closing arguments were presented.
He objects that the proceeding was declared complex, without any reasoning whatsoever, for the purpose of applying the 15-business-day period for serving the judgment. He states that he was informed that the judgment would be issued in writing and served on the parties through the designated means. He asserts that Friday, April 10 (sic), 2021 was declared a judicial holiday for the Poder Judicial and that it was on vacation from December 21 through 31, 2021. He contends that the maximum period available to the Tribunal to issue and serve the judgment expired on Friday, January 7, 2022. He states that Judgment No. 003-2022-IV was rendered at 11:53 a.m. on January 7, 2022. However, it was sent to the plaintiff by email on Monday, January 10, and was not deemed served until the following day, January 11, 2022; for that reason, he considers it untimely. He argues that, as the Sala Primera itself has stated, Article 111 of the CPCA reflects the principle of immediacy (principio de inmediación) and seeks to ensure that, when rendering judgment, the judges retain in their memory, with the greatest possible clarity, the evidence taken during the trial, thereby preventing the passage of time from eroding their comprehensive assessment of that evidence.
He cites Ruling No. 1096-F-S1-2011 of this Sala, issued at 9:45 a.m. on September 8, 2011, which held that failure to comply with the time limit for deliberating and rendering judgment is sanctioned by nullity. He argues that Article 38 of the Judicial Service of Process Law (Ley de Notificaciones Judiciales) provides that, when an email address has been designated, the person shall be deemed served on the business day following transmission. He asserts that the Sala Primera, in Judgment No.0001527-F-S1-2012, stated that “by the service of the judgment (September 12, the final act), the 15-business-day period established in the provisions cited in this recital had more than elapsed, having expired on September 30, and therefore the grievance raised must be upheld.” He objects that he is certain the judgment was both rendered and served after the deadline. He considers that the judicial holiday may not be counted for purposes of extending the deadline, but that even with such an extension, the specified 15-day period was not met. He adds that the declaration that the matter was complex lacks reasoning. He complains that there was no explanation for serving the judgment on January 11, 2021.
III.With regard to the time limit for deciding and serving the judgment, this Sala has stated: “…Article 111 of the Administrative Litigation Procedural Code (hereinafter CPCA) establishes that, once the hearing has concluded, the Tribunal must deliberate and render judgment immediately, while providing for an exception to this obligation in cases classified as complex, in which event the judgment must be served within a maximum period of 15 business days, calculated from the conclusion of the hearing. As stated, the provision reflects the principle of immediacy—which is the normative value that the provision under discussion seeks to protect—and seeks to ensure that, when rendering judgment, the judges retain in their memory, with the greatest possible clarity, the evidence taken during the trial, thereby preventing the passage of time from eroding their comprehensive assessment of that evidence.
Consistent with the foregoing, Articles 82.1 and 79.4 of the Autonomous Regulations on the Organization and Service of the Administrative Litigation and Civil Treasury Jurisdiction provide that deliberation may be extended for up to two days, in which case the operative portion must be communicated to the participants together with a concise statement of its grounds, and the full text of the judgment must be provided within the aforementioned 15-day period. Both the statutory provision and the regulatory provisions cited establish a benchmark from which it may be presumed that the oft-cited principle of immediacy has been violated. This is, of course, a legal presumption established for review purposes, and it cannot be inferred from the foregoing that judges are unable to retain the details of the proceeding for a longer period. It is simply the establishment of a tolerance limit by the legislature or, in other words, a normative convention.
Accordingly, noncompliance was sanctioned by nullity.” (Judgment 1527-2012, issued at 8:30 a.m. on November 20, 2012, reiterated in Judgments No. 1972-2020, issued at 11:20 a.m. on June 3, 2020, and No. 001266-F-SI-2022, issued at 2:20 p.m. on May 26, 2022). In this dispute, the oral and public trial was held at 08:41 a.m. on Friday, December 03, 2021. As can be determined from the hearing audio at 11:56 a.m., the matter was declared complex pursuant to Article 73.10 of the Autonomous Regulations on the Organization and Service of the Administrative Litigation and Civil Treasury Jurisdiction. Consequently, the judgment had to be rendered and served no later than 15 business days after that date, that is, between December 06, 2021 and January 10, 2022, taking into consideration that the Poder Judicial remained closed on December 10, 2021 (resolution of the Consejo Superior adopted at Session Nº 87-2021, held on October 07, 2021, Article LXII) and for the collective year-end closure from Monday, December 20 through Friday, December 31, 2021 (resolution of the Consejo Superior del Poder Judicial adopted at Session N°81- 21, held on September 16, 2021, Article LXI).
The record establishes that the judgment was rendered on January 07, 2022 and served on the parties on January 10, 2022, that is, within the period specified in Article 111 of the CPCA. It should be emphasized that the argument advanced by the appellant in cassation (casacionista)—namely, that service occurred after the deadline because it was effected by email on January 10, 2022 and therefore should not be deemed completed until January 11, 2022—is unsupported, because Article 38 of the Judicial Service of Process Law establishes that rule solely for purposes of commencing the calculation of time limits, as indicated by the heading of that article. Consequently, the appellant is incorrect, and the challenge shall be rejected.
Cassation on substantive grounds.
IV.As his first grievance on substantive grounds, he alleges improper assessment and omission of the evidentiary record (elenco probatorio). He notes that the Tribunal stated: “2) The plaintiff did not establish that he acted on behalf of the owner company: the plaintiff failed to comply with the Case-Management Judge’s order to clarify whether the company listed in the registry as the owner was also bringing suit and to submit proof of its legal representation. For that reason, by order issued at 11:00 a.m. on May 26, 2017, the Case-Management Judge recognized Mr. Dennis Lacombe as the sole plaintiff and served the claims on the defendants with only one individual plaintiff (proven fact N° 5). Because the plaintiff did not challenge that order, it became final.” He notes that it was never disputed that the plaintiff resides in the property; all parties accepted this as true. He asserts that, if any doubt existed, then in pursuit of the substantive truth (verdad real), evidence to that effect should have been requested from him.
He points out that the expert clearly states in his report that the plaintiff resides in the property. He emphasizes that the Tribunal, improperly and without examining either the case file or the expert evidence presented at the hearing—during which the judges questioned that professional at great length—stated that there was no evidence establishing the relationship between the property and the claimant. He criticizes the court below (A quo) for failing to review the expert evidence, failing to order additional evidence to facilitate its decision (prueba para mejor resolver), as judges are empowered to do in pursuit of the substantive truth, and failing to make any statement concerning the trial hearing that was held. He argues that they cannot state that the fact was not established because they did not assess the evidentiary record. He states that the harm is linked to the individual: health, noise, the environment, among other matters.
In his view, it may even be asserted that the right to the environment confers standing based on a diffuse interest (interés difuso), which likewise was not analyzed. He requests that, based on the violation of Articles 11 and 49 of the Constitution, Article 11 of the General Public Administration Law (Ley General de la Administración Pública), and Articles 137 and 138 of the CPCA, the judgment be reversed on cassation and annulled.
V.Regarding this matter, the challenged judgment ruled: “VII.- Regarding the lack of standing to sue (legitimación activa) in the complaint. As follows from the foregoing citation, it is clear that standing (legitimación) is a substantive prerequisite of every judicial proceeding and is subject to review sua sponte; it concerns the capacity of the participating parties to be parties to a proceeding and arises or originates from the relationship between their sphere of individual interests and rights and the challenged conduct. As established by the relationship between Article 49 of the Constitution and Article 1 of the Code of Administrative Litigation Procedure, the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa) permits the protection of subjective rights (derechos subjetivos) and legitimate interests (intereses legítimos), which entails broad access to actions in defense of persons subject to the Administration.
In this regard, standing to sue, strictly speaking, consists of the ability to appear as an actor or plaintiff, based on the assumption that the person holds the alleged right or legitimate interest. Standing to be sued (legitimación pasiva) is the capacity to be the defendant in the proceeding. In the present matter, Mr. Dennis Lacombe Martínez filed the complaint solely in his capacity as a natural person. Furthermore, the record did not establish the existence of any contract or legal relationship linking the plaintiff, Denis Lacombe Martínez, to Corporación B L Veintiuno de Santa Ana S.A., the registered owner of the property at issue in the proceeding and in relation to which compensation for damages is sought. Nor was it established that Mr. Denis Lacombe Martínez exercises any form of representation of Corporación B L Veintiuno de Santa Ana S.A., because no certificate of legal representation (personería jurídica) was submitted, despite the order to do so issued by the Case-Management Judge (Juez Tramitador) in the ruling handed down at 10:58 hours on February 20, 2017 (proven fact No. 3).
Moreover, the record does not show that the plaintiff challenged the ruling of 11:00 hours on May 26, 2017, whereby the Case-Management Judge recognized Mr. Dennis Lacombe as the sole plaintiff and served notice of the claims on the defendants with only one natural person as plaintiff (proven fact No. 5); consequently, that ruling became final. The claims asserted by the plaintiff seek monetary compensation for the harm sustained by the property adjoining Centro Comercial Terrazas Lindora, which he described as loss of current value, interference with intimacy and privacy due to noise pollution, and views into the property. The plaintiff is deemed to lack standing to sue for the following reasons:
VI.Regarding standing to sue. It should be noted that, as this Chamber has repeatedly stated, judicial proceedings are an instrument intended to resolve legal disputes. They are governed by formal or procedural prerequisites and material or substantive prerequisites. The former are intended to ensure the validity of the proceedings through jurisdiction, subject-matter competence, and the capacity of the parties. The latter, known as substantive prerequisites (presupuestos de fondo), relate to whether the claim may properly be granted and concern standing in both of its forms, the right, and the current interest. Among the indispensable requirements for granting a complaint, the plaintiff must maintain all three prerequisites cited supra throughout the proceedings; otherwise, a judgment granting relief would not be appropriate. For this reason, the case law of this Chamber has established that those elements must be reviewed sua sponte.
Substantive prerequisites must be reviewed by judges at all times to verify that a valid ruling may be issued on the matters disputed in the proceeding (see, in this regard, judgments of this Chamber number 604 of 10 hours on August 17, 2007, and 288 of 9 hours and 50 minutes on March 6, 2014). It should be noted that the right, standing, and current interest each possess distinct characteristics that preclude their being confused with one another; likewise, each has different consequences. Before issuing a judgment granting relief, it is of utmost importance to analyze the issue of standing, which is the capacity to be a party to a specific proceeding. Standing may be active or passive, depending on the conditions established by law for that purpose in relation to the procedural claim (pretensión procesal). Thus, active standing ad causam, which is the form relevant to this specific case, is the capacity to bring suit and arises from the position occupied by the person with respect to the procedural claim asserted.
In other words, the persons with proper standing in the case are those whose rights will be legally and directly affected by the judgment. In judgment number 794 of 16 hours and 5 minutes on October 16, 2002, this Chamber stated that standing consists of: “(…) On numerous occasions, this Chamber has stated that standing is: ‘…a prerequisite of the claim asserted in the complaint and of the defense raised by the defendant, making possible a judgment on the merits that resolves them; consequently, standing in the case does not constitute a procedural prerequisite, insofar as it does not concern the procedure or the valid exercise of the action, but rather concerns the substantive relationship that must exist between the plaintiff and the defendant and the substantive interest disputed in the proceeding. Standing in the case refers to the substantive relationship alleged to exist between the parties to the proceeding and the substantive interest in dispute.
The defendant must be the person who, by law, is entitled to oppose the plaintiff’s claim or against whom the law permits the substantive legal relationship forming the subject matter of the complaint to be declared; and the plaintiff must be the person who, pursuant to law, may assert the claims in the complaint, even if the substantive right claimed does not exist or belongs to another. Depending on the person having standing or that person’s position in the procedural relationship, a distinction may be drawn between standing to sue and standing to be sued: the former belongs to the plaintiff and to persons who subsequently intervene to defend the plaintiff’s cause, while the latter belongs to the defendant and to those who intervene to contest and oppose the plaintiff’s claim (…)’.” Indeed, standing, strictly speaking, itself entails a special relationship between a person and a legal situation in dispute, by virtue of which that person is the one who must act as plaintiff or defendant in the proceeding; it is a requirement for admitting the claim as to the merits of the matter, rather than a requirement for the existence of the proceeding.
In addition, standing ad causam may be absent when the plaintiff and defendant wholly lack standing in the case because they are persons other than those entitled to assert or contest the claims, or when those who should have been parties do not participate in the proceeding. In relation to the foregoing, it is important to note that the right, standing, and interest constitute the so-called substantive prerequisites necessary for a judgment granting the complaint and may be reviewed sua sponte. See, in this regard, judgments of this Chamber no. 1266 of 14 hours 35 minutes on July 11, 2019, and no.00667 – 2021 of 15 hours 40 minutes on March 18, 2021.
VII.In the case under review, the complaint filed by Dennis Lacombe Martínez reveals his intention to seek compensation for damages arising both from the harm sustained by the property adjoining Centro Comercial Terrazas Lindora, which he described as the loss of its current value, and from infringements of intimacy and privacy, harm to the environment and health, noise pollution, and views into the property. Having reviewed the case file, this Chamber agrees with the Tribunal’s ruling, insofar as there was no objective evidence demonstrating, first, that although he was not the owner of the property, there was any contract or legal relationship linking the plaintiff to the company that owned it, Corporación B L Veintiuno de Santa Ana S.A., or, alternatively, that he was acting on its behalf. The processing judge ordered him to cure this deficiency in the ruling issued at 10:58 a.m. on February 20, 2017; however, the plaintiff failed to do so (as recorded in image 153 of the electronic case file).
Likewise, he did not establish through suitable evidence that he used the house as his residence, since the expert’s statements—as the appellant in cassation contends—cannot be relied upon for those purposes, insofar as the expert report was requested to determine “the value of the property at the time of purchase and its current value, identifying the reasons for the change.” Along the same lines, the plaintiff’s argument that the Tribunal was responsible for failing to question him or request evidence if it had doubts as to whether he resided in that property is likewise inadmissible. Although Article 81.2 of the CPCA provides that “The judge shall order and conduct all evidentiary proceedings necessary to determine the actual truth of the facts relevant to the proceeding,” this in no way relieves a party of the obligation to support its assertions with suitable evidence, particularly here, where legal standing (legitimación) constitutes a minimum prerequisite for granting the complaint, as explained in the preceding recital (considerando).
In addition, the appellant in cassation contends that he should have been deemed to have standing based on a diffuse interest (interés difuso) with respect to the right to the Environment; however, this argument is inadmissible because it was not raised during the proceeding pursuant to Article 10(c) of the Código Procesal Contencioso Administrativo or Article 50 of the Constitución Política, which provides broad standing to bring matters that are strictly environmental in nature. Accordingly, this ground of appeal must be denied.
VIII.Regarding the evidence submitted in cassation. By way of further explanation, it should be noted that, at this appellate stage, the plaintiff now submits as evidence to assist in adjudication (prueba para mejor resolver) a document entitled “Certificate of Residence issued by the Operations Manager of Condominio Bosques de Lindora, Mr. José R. Rivera S, a document establishing Mr. Dennis Lacombe Martínez’s residence in the property at issue,” dated January 24, 2022—after the challenged judgment—which certifies his residence, together with a series of security logs from that condominium. Pursuant to Article 145 of the Código Procesal Contencioso Administrativo (CPCA), at this stage only documentary evidence that the appellant swears was previously unknown may be submitted, provided that it relates to facts that are new or arose after the judgment under appeal (to the same effect, see rulings no. 000814-F-S1-2012 of 09:05 a.m. on July 05, 2012, and no. 00790–2021 of 11:05 a.m. on April 08, 2021).
The evidence submitted does not fall within those circumstances; it does not concern facts that are new or arose after the judgment under appeal. On the contrary, it is a certificate concerning factual circumstances that occurred before the challenged judgment, and its untimely submission has not been justified. It should therefore have been submitted at the appropriate procedural stage, rather than only now in cassation. Consequently, it must be rejected.
IX.As his second challenge on substantive grounds, he alleges a violation of rules or principles of constitutional law, including reasonableness, proportionality, legal certainty, and equality. He asserts that the application of Article 49 of the Constitución Política is contravened because the preliminary acts and the final act comply with the law. He adds that the omission of Article 11 of the Constitución Política, not only with respect to the merits of the judgment but also with respect to the alleged extension for serving notice thereof, is based on arbitrary assessments lacking legal foundation. He continues by asserting that the immediacy inherent in oral proceedings is violated because the outcome of an oral proceeding is made perpetual and Article 111 of the CPCA is rendered inapplicable by serving notice after the deadline. On those grounds, he requests that the judgment be reversed in cassation and that the partially annulled official communications remain undisturbed, as well as the defense of absence of a legal right (falta de derecho) in its entirety, which he states was partially upheld.
X.This ground of appeal must be rejected without addressing the arguments presented because, in addition to the lack of coherence and informality of the submission, it is evident that those arguments relate to a proceeding other than the present one, making it impossible for this Chamber to consider them.
XI.As his third claim, he alleges inadequate reasoning regarding the award of costs because the judgment merely transcribed Article 193 of the CPCA. He contends that the entire body of evidence establishes the plaintiff’s good faith and that he was not permitted to have a judicial inspection (reconocimiento judicial) conducted, which would have convinced the judges of the existence of clear instances of harm.
XII.This Collegiate Body agrees with the award. This Chamber has held that costs must be ruled upon sua sponte (de oficio), with the unsuccessful party ordered to pay merely because that party was unsuccessful, without this meaning that the losing party is deemed a reckless or bad-faith litigant (see, to that effect, rulings No. 4146-F-S1-2019 of 04:10 p.m. on November 26, 2019, No. 3877-2019 of 11:45 a.m. on November 14, 2019, and No. 1029-F-S1-2018 of 10:20 a.m. on November 28, 2018, among others). The general rule is that costs are imposed on the unsuccessful party for the benefit of the successful party, because the latter was required to defend its right or interest against interference by a third party or against claims brought against it. The opposing party was compelled to litigate and incur various expenses to maintain its legal defense; consequently, the unsuccessful party must bear the financial consequences of the proceeding.
Article 193 of the CPCA establishes the circumstances in which a party may be relieved of that financial obligation: “...a) The judgment is issued on the basis of evidence whose existence the opposing party plausibly did not know of and, as a result, that party’s opposition was justified. b) In the Tribunal’s judgment, the nature of the issues debated provided sufficient grounds for litigation.” However, when these exceptions have been improperly applied, the judge’s evaluative determination may be reviewed in cassation; that is, the judge is required to state the reasons for the award only when applying one of the grounds for exemption, because such determinations are exceptional in nature. Accordingly, in this Chamber’s view, the judges in this case did not commit the alleged violation of law by imposing payment of costs on the unsuccessful party, as provided by the aforementioned rule. Consequently, the challenge raised must be denied.
XIII.In view of the foregoing, the documentary evidence offered before this Chamber shall be rejected, and the appeal filed by the plaintiff shall be denied. The appellant shall bear the costs, pursuant to Article 150(3) of the Código Procesal Contencioso Administrativo.

The evidence offered before this Chamber is rejected. The appeal filed by the plaintiff is denied. The party who filed it shall bear the costs. Proceso de conocimiento establecido por DENNIS LACOMBE MARTÍNEZ, contra MUNICIPALIDAD DE SANTA ANA, representado por su apoderada especial judicial, la licenciada Andrea Robles Álvarez, y contra LINDORA PROJECT MIL OCHOCIENTOS SOCIEDAD ANÓNIMA, cédula jurídica número tres - ciento uno - seiscientos once mil seiscientos nueve, representada por Alberto Kader Israeliski. La parte actora presenta recurso de casación contra de la sentencia no. 003-2022-IV de las 11 horas 53 minutos del 07 de enero del 2022, dictada por las personas juzgadoras Judith Reyes Castillo, Elías Baltodano Gómez y Felipe Córdoba Ramírez, del Tribunal Contencioso Administrativo, Sección Cuarta. Figuran como apoderados especiales judiciales de la parte actora el licenciado Jimmy Álvarez García y la licenciada Victoria Medrano Guevara; y de la demandada, el licenciado Jonatan Picado León.
Redacta la magistrada Jessica Jiménez Ramírez;
CONSIDERANDO
I.El presente asunto se origina con motivo de la construcción del Centro Comercial Terrazas de Lindora. En lo medular el actor señaló, el día 4 de septiembre de 2009 y en fechas posteriores, el representante de la empresa Rutilo S.A, el señor Alberto Kader, que luego se fusionó con la empresa Lindora Project Mil Ochocientos S.A., envió nota al Director de Ordenamiento Territorial de la Municipalidad de Santa Ana, para que se estableciera uso industrial en la finca que en ese momento era el número 1-464397-000, con plano SJ-361033-96. Expuso, en esa nota indicaba que la razón para dicha modificación era que aparentemente una porción de dicho inmueble poseía esa condición. Refirió, en consonancia con el ordinal 2 del Plan Regulador de Santa Ana, era posible extenderlo al resto de la propiedad. Reprochó, lo que no expresó u omitió, fue que en realidad solamente el 0,02% de la totalidad del inmueble se determinaba como de uso industrial.
Afirmó, mediante oficio MSA-DOT-APU-USV-03-157-2009, el ingeniero Jeffrey Zumbado, Director de Ordenamiento Territorial de la Municipalidad de Santa Ana, le señaló al señor Kader cuáles eran los usos permitidos en la citada propiedad de acuerdo con el Plan Regulador. Aseveró, de forma concomitante con la primera solicitud, el 30 de setiembre del citado año, el señor Kader amplía su solicitud para gestionar ante la misma oficina, que se levantara la afectación de la propiedad dada por el uso de suelo tipo Área Verde (AV) para declararla Zona Industrial. Explicó, un día después el Ing. Zumbado trasladó la solicitud a la Asesoría Legal de la Municipalidad, a efectos de emitir formal criterio sobre lo pretendido por el representante de dicha empresa. Detalló, la Licda. Andrea Robles manifestó que la solicitud debía ser analizada por el Consejo Municipal para determinar lo procedente, siendo que la Alcaldía no tenía competencia para realizar una modificación de uso de suelo en el Plan Regulador Vigente.
Esgrimió, el asesor legal del Consejo Municipal recomendó devolver el legajo para que las diferentes dependencias administrativas se pronunciaran sobre la solicitud de cambio de Zona Residencial de Baja Densidad (ZRBD) a Zona Industrial (ZI). Adicionó, el criterio del asesor legal fue aprobado mediante acuerdo del Consejo Municipal de Santa Ana, en sesión ordinaria no. 181 del 8 de diciembre de 2009, contenido en el artículo III. Reclamó, lo que hizo fue derogar el artículo 14 del Plan Regulador Vigente sin que se haya realizado el trámite legal correspondiente. Relató, por oficio MSA-DOT-03-607-2009, el Ing. Zumbado indicó: “Por tanto, se emitirá un certificado de uso de suelo en el que se acreditará la extensión de Zona Industrial sobre la Zona Residencial de Baja Densidad (…) resultando un 78.27% del inmueble de Zona Industrial, y con la presente desaplicación de reserva de uso público, un 21,37% en Zona Residencial de Baja densidad.”.
En su criterio, no tenía competencia para convertir la citada finca en zona de uso industrial, quedando solamente la zona verde como parte de la zona residencial de baja densidad. Agregó, al no encontrarse conforme con esta resolución, el señor Kader formuló el 17 de diciembre de 2009, recurso de apelación ante el Alcalde. Indicó, el 9 de febrero de 2010 mediante resolución MSA-Alc-04-099-10, el Lic. Gerardo Oviedo Espinoza, Alcalde de Santa Ana, aceptó la solicitud del recurrente y le ordena a la Dirección de Ordenamiento Territorial, con la desaplicación de la reserva de uso público acordada por el Consejo Municipal, la totalidad del inmueble se declara como 100% Zona Industrial. En su parecer, dicha resolución carece de total motivación y no contiene razonamientos fáctico-jurídicos. Señaló, el Consejo Municipal en acuerdo 9 de la sesión ordinaria número 233, celebrada el 21 de octubre de 2014, aprobó el permiso de construcción del Proyecto Centro Comercial Terrazas Bloque B, Comercio y Sótanos.
Reprochó, de todo lo actuado nunca se dio traslado ni se notificó a ningún vecino de la zona, Asociación de Desarrollo Integral u otras organizaciones, pues el tema se manejó con absoluto secretismo. Endilgó, a él nunca se le tomó parecer, siendo que vive contiguo a donde se construye el centro comercial y un hotel, entre otros locales. Explicó, por esa razón interpone la presente acción; además, la propiedad donde habita se encuentra situada contiguo al desarrollo de la citada obra, en la finca número 1-0015181-F-000, propiedad de la empresa que también representa el actor, Corporación B L Veintiuno de Santa Ana S.A, cédula 3-101-128794, ubicada en el Distrito de Pozos de Santa Ana, unidad número 21 de la Urbanización Bosques de Lindora. Refirió, a raíz de las obras en el proyecto mencionado, se percibe molestias en el residencial donde habita por las labores que se realizan. Esgrimió, no se observó la realización de procedimiento alguno para la modificación del Plan Regulador, tampoco autorización alguna por parte del INVU, ni se infirió que SETENA haya analizado la modificación ilegal e inconstitucional del Plan Regulador para lo de su competencia; o del Ministro de Ambiente por la evidente contaminación ambiental y sónica.
Agregó, tampoco se percibió una actuación del MOPT en materia de la regulación y mitigación del problema de tránsito que se está dando en la zona; ni revisión en materia de salud por parte del Ministerio de Salud. Acusó, de la observación del inmueble que ya se levantó, se determina que existen ventanales cuya visibilidad se dirige a la casa donde habita el actor, incluyendo la zona del patio, lo cual, en su opinión, genera una clara violación a su intimidad. Recalcó, la Municipalidad autorizó y brindó permisos a la empresa demandada para desarrollar un segundo edificio contiguo al primero. Reprochó, hay ruido por el desarrollo de las obras, por el tránsito cada vez mayor, y por la entrada de grandes vehículos a las obras. Afirmó, vive por la zona verde que está siendo afectada sin reparo alguno de la Municipalidad. Concluyó, todos los días se escuchan quejas de las personas porque es imposible transitar por el lugar, produciendo una alta contaminación, no sólo sónica sino también a la naturaleza.
El actor interpuso la demanda en fecha 11 de mayo de 2016, cuyas pretensiones que fueron ajustadas en la audiencia preliminar, son las siguientes: " 1- Al ser inconforme a derecho toda la actuación municipal solicito se condene a la municipalidad accionada y de forma solidaria a la empresa demandada, al pago de los daños ocasionados, en el caso material en el menoscabo ligado al valor actual de la propiedad disminuido, prudencialmente en la suma de $400.000,00 (cuatrocientos mil dólares exactos). / 2- Desiste / 3- Al ser inconstitucional e ilegal el Acuerdo del Concejo Municipal de Santa Ana de Sesión Ordinaria Nº 181 del 8 de diciembre del 2009, contenido en el artículo III y las diferentes actuaciones de los entes municipales, condenar a la empresa accionada y a la Municipalidad demandada, el pago del daño moral objetivo ocasionado por violación a mis derechos al ambiente, a la intimidad y a la salud, prudencialmente por la suma de $100.000 (cien mil dólares exactos). / 4- Al ser inconstitucional e ilegal el Acuerdo del Concejo Municipal de Santa Ana de Sesión Ordinaria Nº 181 del 8 de diciembre del 2009, contenido en el artículo III y las diferentes actuaciones de los entes municipales, condenar a la empresa accionada y a la Municipalidad demandada, el pago del daño moral subjetivo ocasionado por violación a mis derechos al ambiente, a la intimidad y a la salud, prudencialmente por la suma de $150.000 (ciento cincuenta mil dólares exactos) / 5- Al ser inconstitucional e ilegal el Acuerdo del Concejo Municipal de Santa Ana de Sesión Ordinaria No. 181 del 8 de diciembre del 2009, contenido en el artículo III y las diferentes actuaciones de los entes municipales, condenar a la empresa accionada y a la Municipalidad demandada, al pago del daño físico ocasionado por violación a mis derechos al ambiente y a la salud, prudencialmente por la suma de $ 100.000 (cien mil dólares exactos) / 6- Cierto (sic) persistente mi violación a los derechos ya mencionados, y siendo que se iniciará la construcción del segundo edificio, ordenar la no realización de un nuevo edificio aledaño hasta tanto no se haya dado la modificación del Plan Regulador y se respeten mis derechos antes indicados. / 7- Cierto (sic) persistente mi violación a los derechos ya mencionados, y siendo que se están desarrollando obras en la zona verde, ordenar la no realización de obra alguna en dicha zona y regresar a zona verde original. / 8- Ordenar a la empresa recurrida realizar las labores pertinentes para no violentar la intimidad del suscrito y de los habitantes de la zona. / 9- Sin perjuicio, de los daños que se pretenden reparar en este proceso solicito de no aprobarse el derribo del edificio que se realicen los actos pertinentes por parte de la Municipalidad y empresa demandadas para que se mitiguen la violación actual a los derechos de privacidad, intimidad, al ambiente, a la salud, tanto física como de contaminación sónica a efecto de apaciguar los efectos del desarrollo de dicha obra incluyendo la eliminación de aquellas actividades comerciales y sociales que violenten estos derechos, como el cierre de los ventanales que se dirigen hacia mi casa de habitación. / 10- Ordenar a la Municipalidad que instruya a la empresa desarrolladora para que se realizan las acciones pertinentes para no incurrir en violación a la intimidad. / 11- Ordenar a la Municipalidad que instruya a la empresa desarrolladora para que se realicen las acciones pertinentes para no incurrir en violación al espacio escénico. / 12-Remitir piezas ante el Ministerio Público para que se investigue a los funcionarios de las diferentes instituciones por posibles delitos de incumplimiento de deberes. / 13- Condenar a las accionadas al pago de la indexación de las sumas pretendidas, a los intereses generados y al pago de ambas costas ligadas a este proceso".
Ambos demandados contestaron de forma negativa la acción. La Municipalidad opuso la excepción de falta de derecho. La empresa Lindora Project Mil Ochocientos S.A. alegó las defensas previas de integración de la litis consorcio pasivo necesario, prescripción y acto no susceptible de impugnación, rechazadas de forma interlocutoria en resoluciones no.1692-2019-T de las 14 horas 20 minutos del 18 de setiembre de 2019 y no 1490-2020-T de las 08 horas 15 minutos del 28 de setiembre de 2020, también opuso las excepciones de falta de derecho, falta de interés actual y caducidad. El Tribunal Contencioso Administrativo y Civil de Hacienda, Sección V, mediante sentencia no. 003-2022-IV de las 11 horas 53 minutos del 07 de enero del 2022, dispuso: “De oficio se declara la falta de legitimación activa. Se declara improcedente en todos sus extremos la demanda interpuesta por Dennis Lacombe Martínez contra la Municipalidad de Santa Ana y Lindora Project Mil Ochocientos S.A. Son las costas a cargo de la parte actora.” Inconforme con lo resuelto, la parte actora presentó recurso de casación, el cual fue admitido por esta Sala.
Casación por razones procesales
II.En el único agravio de esta naturaleza reclama inobservancia de las reglas previstas en el Código Procesal Contencioso Administrativo (CPCA) para la deliberación, el plazo de dictado de la sentencia o la redacción del fallo en sus elementos esenciales, con el fin de que sea sancionada con la nulidad absoluta. Explica, la sentencia impugnada se le notificó vía correo electrónico el 10 de enero de 2022 por lo que se tiene por notificada el día siguiente hábil, sea el 11 de enero. En su parecer, ello violenta lo preceptuado por los artículos 111 del CPCA, 79 y 82 del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda. Apunta, el día del juicio fue el viernes 3 de diciembre de 2021, en el cual se evacuó la prueba testimonial y se emitieron conclusiones. Reprocha, el proceso lo declararon de carácter complejo, sin motivación alguna, con el objetivo de aplicar los 15 días hábiles para notificar la sentencia.
Refiere, le indicaron que la sentencia se emitiría por escrito y notificada a las partes por los medios señalados. Manifiesta, el viernes 10 de abril (sic) de 2021 fue declarado asueto para el Poder Judicial y se encontraban de vacaciones del 21 al 31 de diciembre de 2021. Expone, el plazo máximo que tenía el Tribunal para emitir y notificar la sentencia era el viernes 7 de enero de 2022. Afirma, la sentencia no. 003-2022-IV fue dictada a las 11 horas 53 minutos del 7 de enero de 2022. Sin embargo, fue remitida al actor, el lunes 10 de enero por correo electrónico, siendo que se da por notificada hasta el día siguiente 11 de enero de 2022, por tal razón considera que está fuera de plazo. Argumenta, como lo indica la misma Sala Primera, el numeral 111 del CPCA responde al principio de inmediación y procura que los juzgadores al dictar el fallo retengan en su memoria, con la mayor claridad, los elementos probatorios evacuados durante el juicio, y de esta forma evitar que el paso del tiempo erosione la valoración integral que de ellos puedan realizar.
Cita, el voto de esta Sala no. 1096-F-S1-2011 de las 9 horas 45 minutos del 8 de setiembre de 2011, en el cual se indicó que se sanciona con nulidad el incumplimiento del plazo para deliberar y dictar la sentencia. Arguye, el ordinal 38 de la Ley de Notificaciones Judiciales señala que cuando se señale un correo electrónico, la persona quedará notificada al día hábil siguiente de la transmisión. Sostiene, la Sala Primera en sentencia no.0001527-F-S1-2012 señaló que “la notificación de la sentencia (12 de setiembre, último acto), transcurrió -de sobra- el plazo de 15 días hábiles previsto en la normativa mencionada en este considerando, el cual feneció el 30 de setiembre, motivo por el cual resulta obligatorio acoger el agravio formulado”. Reprocha, tiene la certeza que la sentencia fue dictada y también notificada fuera del plazo. Considera, el asueto no puede ser contado para efectos de prorrogar el plazo, pero aún con él no se cumplió con los 15 días señalados. Agrega, existe falta de motivación para que se declarara de trámite complejo. Increpa, no había explicación para que la notificación de la sentencia se realizara el día 11 de enero de 2021.
III.En lo que respecta al plazo para resolver y notificar la sentencia, esta Sala ha expuesto que: “…el numeral 111 del Código Procesal Contencioso Administrativo (en lo sucesivo CPCA) establece que, una vez finalizada la audiencia, el Tribunal deberá deliberar y dictar la sentencia en forma inmediata, previendo la posibilidad de exceptuar esta obligación en aquellos casos que se califiquen como complejos, en cuyo caso, la sentencia deberá notificarse dentro del plazo máximo de 15 días hábiles, computados a partir de la finalización de la audiencia. Como se indicó, la norma responde al principio de inmediación –siendo este el valor normativo que se pretende tutelar en el precepto que se comenta- y procura que los juzgadores al dictar el fallo retengan en su memoria, con la mayor claridad, los elementos probatorios evacuados durante el juicio, y de esta forma evitar que el paso del tiempo erosione la valoración integral que de ellos puedan realizar.
En línea con lo anterior, los artículos 82.1 y 79.4 del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda disponen que la deliberación se podrá extender hasta por dos días, en cuyo caso, se debe comunicar a los intervinientes la parte dispositiva con una exposición lacónica de sus fundamentos, y el texto completo de la sentencia en el ya referido término de 15 días. Tanto la norma legal como las reglamentarias a que se ha hecho referencia establecen un parámetro con base en el cual se puede presumir que ha existido un quebranto del tantas veces citado principio de inmediación. Se trata, claro está, de una presunción legal fijada para efectos de control, sin que de lo indicado pueda colegirse que los jueces no puedan retener los detalles del proceso por un período más extenso. Se trata, simplemente, del establecimiento de un límite de tolerancia por parte del legislador, o lo que es lo mismo, un convencionalismo normativo.
Por ello, su inobservancia fue sancionada con la nulidad”. (Sentencia 1527-2012 de las 8 horas 30 minutos del 20 de noviembre de 2012, reiterada en las Sentencias no, 1972-2020 de las 11 horas 20 minutos del 3 de junio de 2020 y no. 001266-F-SI-2022 de las 14 horas 20 minutos del 26 de mayo de 2022). En esta litis, el juicio oral y público fue celebrado a las 08 horas 41 minutos del viernes 03 de diciembre del 2021, según se obtiene del audio de la audiencia a las 11 horas y 56 minutos, donde consta que el asunto fue declarado como complejo de acuerdo a lo que prevé el numeral 73.10 del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda, por lo que, el dictado y notificación de la sentencia debía darse a más tardar 15 días hábiles después de ese día, es decir, entre el 06 de diciembre de 2021 y el 10 de enero de 2022, lo anterior tomando en consideración que el Poder Judicial permaneció cerrado el 10 de diciembre de 2021 (acuerdo del Consejo Superior en sesión Nº 87-2021, celebrada el 07 de octubre de 2021, artículo LXII) y por cierre colectivo de fin de año del lunes 20 al viernes 31 de diciembre de 2021 (acuerdo del Consejo Superior del Poder Judicial en sesión N°81- 21 celebrada el 16 de setiembre de 2021, artículo LXI.) En el proceso consta que la sentencia fue dictada el 07 de enero de 2022 y notificada a las partes el 10 de enero de 2022, es decir, dentro del plazo señalado por el numeral 111 del CPCA.
Cabe resaltar que el argumento pretendido por el casacionista, en relación con lo alegado de que la notificación se encuentra fuera del plazo, debido a que fue efectuada mediante correo electrónico el 10 de enero de 2022 y por tal razón debe tenerse por notificada hasta el 11 de enero de 2022, no encuentra asidero, puesto que el artículo 38 de la Ley de Notificaciones Judiciales establece dicha regulación únicamente para efectos del inicio del cómputo de los plazos, tal como lo señala el título de dicho ordinal. Por consiguiente, no lleva razón el recurrente, y se procederá al rechazo de la censura.
Casación por razones sustantivas.
IV.Como primer agravio por razones sustantivas, acusa indebida valoración del elenco probatorio y su preterición. Señala, el Tribunal indicó “2) El actor no demostró actuar en representación de la empresa propietaria: la parte actora incumplió con la prevención del Juez Tramitador de aclarar si la empresa propietaria registral también demanda y de aportar la personería jurídica. Razón por la cual, mediante la resolución de las 11:00 horas del 26 de mayo de 2017, el Juez Tramitador tuvo como única parte actora al señor Dennis Lacombe y dicto el traslado de cargos contra las partes demandadas únicamente con un actor persona física (hecho probado N° 5), sin que fuera impugnada por el actor, la misma alcanzo firmeza.” Apunta, nunca fue un hecho controvertido que el actor es el habitante del inmueble, para todas las partes era cierto. Manifiesta, si existía duda lo que procedía era que, en aras de la verdad real se le solicitara prueba en ese sentido.
Alude, el perito claramente indica en su informe que el actor habita el inmueble. Subraya, el Tribunal de forma indebida, sin analizar el expediente, ni la prueba pericial en la audiencia celebrada, en donde las personas juzgadoras fueron muy prolijas en preguntas a dicho profesional, indican que no hay prueba que demuestre la relación entre el inmueble y el accionante. Recrimina, el A quo no revisa la prueba pericial, no solicita prueba para mejor resolver, potestad de los jueces en aras de la verdad real, y no se observa que efectuaran manifestación en cuanto a la audiencia de juicio realizada. Esgrime, no pueden decir que el hecho no es demostrado porque no hicieron una valoración del elenco probatorio. Expresa, los daños se vinculan a la persona física: salud, ruido, ambiente, entre otros. En su criterio, hasta se puede señalar que el derecho al ambiente le provoca una legitimación por interés difuso, el cual tampoco se analizó. Solicita, en violación a los ordinales 11 y 49 constitucionales, 11 de la Ley General de la Administración Pública, y 137 y 138 del CPCA, se case la sentencia y se anule la misma
V.Sobre el particular, la sentencia impugnada resolvió: “VII.- Sobre la ausencia de legitimación activa en la demanda. Derivado de la cita anterior, resulta claro que la legitimación es un presupuesto de fondo de todo proceso jurisdiccional y de revisión oficiosa, que atañe a la aptitud de los sujetos intervinientes para ser parte en un proceso; se deriva o se origina en la relación existente entre la esfera de intereses y derechos particulares con la conducta impugnada. La jurisdicción contencioso-administrativa admite según lo establece la relación de los artículos 49 Constitucional y 1 del Código Procesal Contencioso Administrativo, la tutela de los derechos subjetivos y de los intereses legítimos, lo que implica una amplia posibilidad de acciones en defensa de los administrados. En este sentido, la legitimación activa propiamente, consiste en la posibilidad de figurar como actor o demandante, al suponerse que ostenta una titularidad con el derecho o interés legítimo alegado.
La legitimación pasiva, es la aptitud para ser la parte demandada del proceso. En el presente asunto, el señor Dennis Lacombe Martínez presentó la demanda en su condición de persona física exclusivamente. Además, no quedó demostrado en autos que entre el actor Denis Lacombe Martínez y la empresa Corporación B L Veintiuno de Santa Ana S.A. propietaria registral de la finca objeto del proceso y respecto de la cual se pretende una indemnización por daños y perjuicios, exista contrato o relación jurídica que los vincule. Tampoco se acreditó que el señor Denis Lacombe Martínez ejerza algún tipo de representación de la empresa Corporación B L Veintiuno de Santa Ana S.A., esto debido a la falta de presentación de la personería jurídica, que fue prevenida por el Juez Tramitador mediante resolución dictada a las 10:58 horas del 20 de febrero de 2017 (hecho probado Nº 3). Por otro lado, no consta en autos que la parte actora hubiera impugnado la resolución de las 11:00 horas del 26 de mayo de 2017, mediante la cual el Juez Tramitador tuvo como única parte actora al señor Dennis Lacombe y dictó el traslado de cargos contra las partes demandadas únicamente con un actor persona física (hecho probado Nº 5), razón por la cual lo resuelto alcanzó firmeza.
Teniendo en cuenta que las pretensiones planteadas por el actor consisten en una indemnización económica por la afectación sufrida por el inmueble colindante al Centro Comercial Terrazas Lindora, daños que describió como la pérdida del valor actual, afectaciones a la intimidad y privacidad por contaminación sónica y las vistas hasta la propiedad. Se estima que la parte actora carece de legitimación activa por las siguientes razones:
VI.Sobre la legitimación activa. Se debe indicar que conforme lo ha señalado reiteradamente esta Sala, el proceso es un instrumento que busca la solución de controversias jurídicas. Este se rige por presupuestos formales o procesales y materiales o sustantivos. Los primeros, tienen como finalidad garantizar la validez del procedimiento por medio de la jurisdicción, la competencia y la capacidad de las partes. Los segundos, llamados de fondo, se vinculan con la procedencia de la pretensión y se refieren a la legitimación en sus dos modalidades, el derecho y el interés actual. Dentro de los requisitos indispensables para la estimación de una demanda, se exige a la parte actora conservar durante todo el proceso los tres presupuestos citados supra, pues de lo contrario no resultaría procedente una sentencia estimatoria. Es por dicha razón que la jurisprudencia de esta Cámara ha establecido el análisis oficioso de dichos elementos.
Los presupuestos de fondo deben ser revisados por las personas juzgadoras en todo momento con la finalidad de verificar que se presente un pronunciamiento válido sobre lo debatido en el proceso (véase al respecto las sentencias de esta Sala número: 604 de las 10 horas del 17 de agosto de 2007 y 288 de las 9 horas y 50 minutos del 6 de marzo de 2014). Cabe señalar que el derecho, la legitimación y el interés actual revisten características propias que impiden su confusión; asimismo, cuenta con consecuencias distintas. Previo al establecimiento de una sentencia estimatoria, es de suma relevancia analizar el tema de la legitimación, constituyéndose esta en la aptitud para ser parte en un proceso concreto, puede ser activa o pasiva, lo cual va a depender de las condiciones que para dicho efecto establezca la ley en cuanto a la pretensión procesal. Así, la legitimación ad causam activa, que es la que en el caso concreto interesa es la capacidad para demandar y nace de la posición en que se halle el sujeto, respecto a la pretensión procesal pretendida.
Es decir, se encuentran debidamente legitimados en la causa las personas que jurídica y directamente van a ser afectadas en sus derechos por la sentencia. Esta Cámara ha señalado mediante la sentencia número 794 de las 16 horas y 5 minutos del 16 de octubre de 2002 que la legitimación consiste en: “(…) En múltiples ocasiones, esta Sala ha expresado que la legitimación es: “…un presupuesto de la pretensión formulada en la demanda y de la oposición hecha por el demandado, para hacer posible la sentencia de fondo que las resuelve; consecuentemente la legitimación en la causa no constituye un presupuesto procesal, en tanto no se refiere al procedimiento o al válido ejercicio de la acción, antes bien se refiere a la relación sustancial que debe existir entre actor y demandado y al interés sustancial que se discute en el proceso. La legitimación en la causa se refiere a la relación sustancial que se pretende existente entre las partes del proceso y el interés sustancial en litigio.
El demandado debe ser la persona a quien le corresponde por la ley oponerse a la pretensión del actor o frente a la cual la ley permite que se declare la relación jurídica sustancial objeto de la demanda; y el actor la persona que a tenor de la ley puede formular las pretensiones de la demanda, aunque el derecho sustancial pretendido no exista o le corresponda a otro. De acuerdo con el sujeto legitimado o a su posición en la relación procesal se puede distinguir entre legitimación activa y pasiva, la primera le corresponde al actor y a las personas que con posterioridad intervengan para defender su causa, la segunda le pertenece al demandado y a quienes intervengan para discutir y oponerse a la pretensión del actor (…)”. En efecto, la legitimación propiamente dicha, implica por sí, una relación especial entre una persona y una situación jurídica en litigio, en virtud de la cual es esa persona la que debe actuar como parte actora o demandada en el proceso; se constituye en un requisito de admisión de la pretensión en cuanto al fondo del asunto y no de la existencia del proceso.
Aunado a ello, la legitimación ad causam puede estar ausente cuando el actor y el demandado carecen de manera absoluta de la legitimación en la causa, por tratarse de personas distintas a quienes les correspondía formular las pretensiones, o bien, contradecirlas, y cuando los que debían ser parte no concurren al proceso. En relación con lo anterior, es importante señalar que, el derecho, la legitimación y el interés configuran los denominados presupuestos de fondo, necesarios para una sentencia estimatoria de la demanda, son revisables de oficio. Ver en este sentido sentencias de esta Sala no. 1266 de las 14 horas 35 minutos del 11 de julio de 2019 y no.00667 – 2021 las 15 horas 40 minutos del 18 de marzo de 2021.
VII.En el caso de estudio, en la demanda interpuesta por Dennis Lacombe Martínez, se extrae su intención de buscar resarcimiento por daños tanto por la afectación sufrida en el inmueble colindante al Centro Comercial Terrazas Lindora, que describió como la pérdida de su valor actual, así como afectaciones a la intimidad y privacidad, al ambiente, a la salud, por contaminación sónica y las vistas hasta la propiedad. Revisado el expediente, esta Cámara coincide con lo resuelto por el Tribunal, en el tanto no existió prueba objetiva, por un lado que al no ser propietario del inmueble, le permitiera demostrar la existencia de algún contrato o relación jurídica que vinculara al actor con la empresa dueña de éste, Corporación B L Veintiuno de Santa Ana S.A., o en su defecto, acreditar que actuaba en su representación, situación que fue prevenida por el juez tramitador en resolución de las 10 horas y 58 minutos del 20 de febrero de 2017, sin embargo no fue atendida por el actor (según consta en imagen 153 del expediente electrónico).
Asimismo, tampoco demostró con prueba idónea el uso de la casa de habitación por parte del actor, siendo que las afirmaciones realizadas por el perito -como pretende el casacionista- no pueden ser tomadas para esos fines en el tanto el informe del experto fue solicitado para determinar “el valor de la propiedad al momento de compra y el valor actual de la misma; estableciendo las razones del cambio”. En esa línea, tampoco es admisible el argumento del actor para atribuirle la responsabilidad al Tribunal de no haberle consultado o pedido prueba si tenía dudas de que era el habitante de dicho inmueble, pues si bien el artículo 81.2 del CPCA establece que “La jueza o el juez ordenará y practicará todas las diligencias de prueba necesarias, para determinar la verdad real de los hechos relevantes en el proceso.”, ello no significa en ninguna medida que releva a la parte de sustentar con prueba idónea sus afirmaciones y en la especie, al tratarse la legitimación de un presupuesto mínimo para poder ser acogida la demanda, tal como se explicó en el considerando anterior.
Aunando a lo anterior, pretende el casacionista que se le considerara legitimado por interés difuso en cuanto al derecho al Ambiente; sin embargo, es improcedente por cuanto no fue invocado dentro del proceso conforme al artículo 10 inciso c) del Código Procesal Contencioso Administrativo o el 50 de la Constitución Política que supone una legitimación amplia para plantear asuntos propiamente ambientales. De modo que el agravio deberá denegarse.
VIII.Sobre la prueba presentada en casación. A mayor abundamiento de razones, nótese que el actor viene en esta sede recursiva a presentar como prueba para mejor resolver un documento denominado “Constancia de Domicilio extendida por el Gerente de Operaciones del Condominio Bosques de Lindora señor José R. Rivera S, documento legitimante de la habitación del señor Dennis Lacombe Martínez en el inmueble de autos” con fecha 24 de enero de 2022 -posterior a la sentencia impugnada- en la que hace constar su domicilio, así como una serie de actas de vigilancia en dicho condominio. De conformidad con lo preceptuado por el canon 145 del Código Procesal Contencioso Administrativo (CPCA), en esta instancia solo se podrá aportar prueba documental que la parte recurrente jure no haber conocido con anterioridad, relacionada a hechos nuevos o posteriores a la sentencia recurrida (en este mismo sentido ver votos no. 000814-F-S1-2012 de las 09 horas 05 minutos del 05 de julio de 2012 y no. 00790–2021 de las 11 horas 05 minutos del 08 de abril de 2021).
La probanza aportada no se enmarca en esos supuestos; no alude a hechos nuevos o posteriores a la sentencia recurrida. Por el contrario, se refiere a una constancia sobre situaciones fácticas sucedidas con anterioridad al fallo cuestionado y que no se justifica su presentación extemporánea. Por ende, debió aportarse en el momento procesal oportuno, no hasta ahora en casación. En consecuencia, se impone su rechazo.
IX.En segundo reproche por motivos de fondo, acusa violación a normas o principios del derecho constitucional, entre otros, la razonabilidad, proporcionalidad, seguridad jurídica e igualdad. Refiere, se transgrede la aplicación del artículo 49 constitucional porque los actos previos y el acto final se encuentran apegados a derecho. Agrega, la omisión del artículo 11 constitucional, no sólo en cuanto al fondo de la sentencia sino también en cuanto a la supuesta prórroga para notificarla, se encuentra basada en valoraciones antojadizas sin fundamento legal. Continúa, violenta la inmediatez de la oralidad, puesto que hace perpetuo el resultado de un proceso oral e inaplicable el artículo 111 del CPCA al notificar fuera del plazo. Por lo anterior, solicita se case la sentencia y se mantengan incólumes los oficios anulados parcialmente y en todo la defensa de falta de derecho, la cual señala, fue dada con lugar de forma parcial.
X.Sobre este agravio, procederá su rechazo sin entrar a resolver los argumentos presentados, pues además de la falta de coherencia e informalidad del planteamiento, resulta evidente que refieren a alegatos que tienen relación con un proceso distinto al presente y por lo cual, para esta Cámara se torna imposible su conocimiento.
XI.Como tercer reclamo, acusa indebida motivación en cuanto a la condenatoria en costas debido a que el fallo sólo hizo la transcripción de la norma 193 del CPCA. Endilga, todo el elenco probatorio establece la buena fe del actor a quien no le permitieron que hiciera un reconocimiento judicial, lo que hubiera generado la convicción en las personas juzgadoras de la existencia de situaciones claras de daño.
XII.Este Órgano Colegiado comparte lo dispuesto en la condenatoria. Esta Sala ha indicado que las costas son un pronunciamiento oficioso, condenando al vencido por el solo hecho de serlo, sin que ello permita considerarse al perdidoso como un litigante temerario o de mala fe (véase en ese sentido los votos Nro. 4146-F-S1-2019 de las 16 horas con 10 minutos del 26 de noviembre de 2019, Nro. 3877-2019 de las 11 horas con 45 minutos del 14 de noviembre de 2019, Nro. 1029-F-S1-2018 de las 10 horas con 20 minutos del 28 de noviembre de 2018, entre otros). La regla general es la imposición de las costas al vencido como reconocimiento al ganancioso, al haber tenido este que defender su derecho o interés, ante la perturbación de un tercero o ante la defensa de pretensiones ejercidas en su contra. La contraparte se vio obligada a litigar e incurrir en diversos gastos para sostener su defensa técnica, esto genera que la parte perdidosa deba asumir las consecuencias económicas del proceso.
El artículo 193 del CPCA, fija los supuestos para relevar a la parte de esa obligación patrimonial: "...a) La sentencia se dicte en virtud de pruebas cuya existencia verosímilmente no haya conocido la contraria y, por causa de ello, se haya ajustado la oposición de la parte. b) Por la naturaleza de las cuestiones debatidas haya existido, a juicio del Tribunal, motivo bastante para litigar.”. Sin embargo, cuando se ha hecho una indebida aplicación de estas excepciones, resulta factible revisar en casación el ejercicio valorativo de la persona juzgadora, es decir, tiene la obligación de motivar su condena, únicamente cuando aplica alguno de los supuestos de exoneración, ya que tales consideraciones gozan de excepcionalidad. En ese sentido, a criterio de esta Cámara, en la especie las personas juzgadoras no incurrieron en el quebranto legal aducido al imponer el pago de las costas a la parte vencida tal como lo señala la citada norma. De modo que la censura esgrimida deberá ser denegada.
XIII.En mérito de lo expuesto, se procederá a rechazar la prueba documental ofrecida ante esta sede y declarar sin lugar el recurso presentado por la parte actora. Serán las costas a cargo del recurrente, de conformidad con el artículo 150 inciso 3) del Código Procesal Contencioso Administrativo.
POR TANTO
Se rechaza la prueba ofrecida en esta sede. Se declara sin lugar el recurso presentado por la parte actora. Son las costas a cargo de quien lo interpuso.
