CONSIDERATIONS

The plaintiffs’ representative filed a complaint stating that his clients are co-owners of the property registered in San José under folio 702599-000-001 and 002, whose cadastral survey plan (plano catastrado) is 1-2188847-2020. He explained that approximately more than one year ago, a group of people entered that property, including the defendant, who occupies land within the property on the northeastern side, comprising an area of approximately 200 square meters, where he constructed a very precarious building using secondhand wood and sheets of corrugated zinc. He stated that, although his clients have asked the defendant on several occasions to vacate voluntarily the space he occupies, the defendant refuses to do so. He alleges that the defendant knows he is occupying land that forms part of a property duly registered in the names of his clients, without lawful title (justo título) legitimizing his occupation and without authorization from anyone empowered by his clients to grant it.

He requested: “(...)1-) That this complaint be granted in all respects. 2-) Given that his clients are the registered owners of the property recorded in the San José Registry District under folio number 702599-001 and 002, and that the defendant is unlawfully occupying an area of approximately 200 square meters within the plaintiff companies’ property, he requests that said area be restored to his clients through an action for recovery of ownership (acción reivindicatoria) and that the defendant be ordered to vacate that land. 3-) That the defendant be declared to be in unlawful possession (posesión) of the disputed area, without lawful title legitimizing such possession, and that, accordingly, the full right of ownership be restored to his client, reinstating her in the exercise of total possession of the property. He therefore requests that his clients be placed in possession of the area unlawfully occupied by the defendant. 4-) That the defendant be ordered not to enter his clients’ property again and be warned that, should he fail to comply with that order, he may be charged with the offense of disobedience to authority. 5-) That the defendant also be ordered to pay the procedural and attorney costs (costas procesales y personales) of this proceeding.

(...).” The defendant denied the complaint. By judgment 2022000244 issued at 11:47 on 13 de octubre de 2022, the Tribunal Colegiado de Primera Instancia Civil del III Circuito Judicial de San José, composed of judges Rosny Arce Jiménez, María Mora Saprissa, and Ana Felicia Córdoba, granted the complaint, ordered recovery of the property, eviction, and placement in possession of the property, and ordered the defendant to pay the costs of this proceeding, setting attorney’s fees at one million one hundred thirty thousand colones and leaving the remaining indispensable expenses of the proceeding and items comprising costs not yet determined for the enforcement-of-judgment stage (ejecución de sentencia).

In a decision issued at ten hours forty-one minutes on veinte de febrero de dos mil veintitrés, this Chamber admitted the defendant’s appeal.

The first ground alleges a violation of substantive law. It identifies Articles 279 subsection 2°, 284, and 285 of the Código Civil as provisions that were not applied. It explains that, pursuant to Article 279 subsection 2 of the Código Civil, possession is acquired independently of ownership of real property by retaining possession for more than one year, beginning when possession is taken publicly or, if taken clandestinely, when the dispossessed party becomes aware of it. It contends that, in this case, Jorge Arturo Mora Barteles’s testimony establishes that the defendant’s “shack” had existed since 2018 and, moreover, that when the complaint was filed, more than one year had already elapsed since they became aware that he was occupying part of the plaintiffs’ property, without their taking any action. Accordingly, he asserts that the defendant acquired the right of possession over that part of the property, as provided in Article 279 subsection 2° of the Código Civil.

He adds that the party testimony (declaración de parte) and the testimony of Grace Castro Castrillo and Susan Bustamante Sánchez demonstrated that, pursuant to Article 285 of the Código Civil, the defendant believed he had the right to possess the land when he took possession, thereby establishing his good faith (buena fe), and that at that time he had no doubt whatsoever that his possession was in good faith, as provided in Article 284 of the Código Civil. He alleges that the court below (Tribunal a quo) neither assessed nor applied any of these provisions when rendering its judgment or when rejecting the defense of lack of legal entitlement (excepción de falta de derecho).

Regarding the first issue, the Tribunal explained that, based on its assessment of the evidence submitted to the record according to the criteria of logic, experience, science, and sound human understanding, pursuant to Article 45.1 of the Código Procesal Civil, in support of the facts constituting the basis of the claim (causa de pedir) and the legal characterization of the case under review, the requested action for recovery of ownership was proper because: a) with respect to the first requirement, namely, standing to sue (legitimación activa), it was established that INVERSIONES INMOBILIARIAS MARVI S.A and CORPORACIÓN FARO NEGRO S.A are co-owners of the property in the San José Registry District, seven hundred two thousand five hundred ninety-nine, under ownership interests zero zero one and zero zero two, respectively, which, according to the registry and cadastral survey plan SJ-2188847-2020, has an area of thirty thousand sixty-five square meters, thereby supporting their assertion of their ownership right over that property. b) Regarding standing to be sued (legitimación pasiva) and the identity of the property, the appropriate evidence on the matter—namely, the expert evidence (prueba pericial) of Engineer Anyury Rodríguez Acuña—essentially established that the land occupied by the defendant Mora Castro is indeed an area of 120 square meters located within the plaintiff companies’ property, namely the San José property seven hundred two thousand five hundred ninety-nine-zero zero one and zero zero two, in the northern sector, as is also shown in the sketch submitted for that purpose.

It added that although the defendant and his witnesses stated that they entered the land through a sale made to them by a man named “Enrique,” without providing any further identifying information about that person, the fact remains that no instrument transferring title was submitted for assessment that could establish any lawful title relating to his occupation of the property; the matter therefore remained mere allegations without legal substance. In other words, it stated that the defendant failed to establish through appropriate evidence that his possession was lawful, in contrast with the full ownership (dominio pleno) held by the plaintiff companies as owners of the property.

Contrary to the appellant’s contention, the Tribunal clearly and precisely explained that no evidence was introduced in the proceeding to prove the defendant’s allegation regarding the purchase that he claims supports his possession and that could have been assessed against the plaintiffs’ title, which was established through public instruments (documentos públicos). The appellant says nothing in response to that finding of insufficient evidence and instead bases his objection on the argument that he is a possessor in good faith, without presenting substantiated legal grounds supporting that assertion. Accordingly, this Chamber agrees with the reasoning set forth in the judgment concerning the existence of the elements necessary to grant the action for recovery of ownership and finds nothing in this appeal demonstrating any error by the Tribunal that could warrant reversal of the judgment. The ground of appeal must therefore be rejected.

In the second ground, he alleges a violation of law. He states that the Tribunal failed to apply Article 73.2 of the Código Procesal Civil, particularly subsection 4 of that provision. He states that he acted loyally at all times toward both the plaintiff and the Tribunal, that his conduct was consistent with good faith, and that his statements were always consistent with the evidence submitted; consequently, the proper course in this case was to apply Article 73.2.4.

Regarding costs, the Tribunal stated in the judgment: “VIII. Economic consequences of the procedural activity. Costs. Pursuant to Article 73.1 of the Código Procesal Civil, because the defendant was the losing party, he is ordered to pay the costs of this proceeding; attorney’s fees are hereby set, based on the amount in controversy established in this proceeding and the fee schedule for professional legal and notarial services number N° 41457 -JP, at one million colones, plus thirteen percent value-added tax, for a total payable amount of one million one hundred thirty thousand colones.” Regarding the appellant’s argument concerning the award of costs, this Chamber has repeatedly held that, in civil proceedings, pursuant to Article 73 of the CPC, the ruling on the costs of the proceeding must be made sua sponte (de oficio), ordering the losing party to pay them. Consequently, costs are imposed upon the losing party by virtue of having lost, as the Tribunal did in the case under review.

In other words, they are imposed for losing the litigation, without this meaning that the party lacked sufficient grounds to litigate or is considered a reckless or bad-faith litigant. Article 73.2 of the CPC itself, in turn, provides the circumstances under which a party may be exempted from payment. In this case, the appellant challenges the award of costs, alleging that he litigated in good faith and asserting the honorable and upright nature of his defense. The provision on which he seeks to base the exemption from costs—Article 73.2.4 of the Código Procesal Civil—does authorize an exemption where the party’s conduct conformed to good faith, loyalty, integrity, and rational use of the procedural system. Nevertheless, considering that the defendant opposed all the claims and that they were granted in full, this Chamber finds no sufficient grounds to apply the exemption and instead concludes, as did the Tribunal, that the procedural rule requiring costs to be imposed on the losing party applies. The objection must therefore be denied.

Consequently, for all the reasons stated, the appeal must be denied, with its costs borne by the losing party.

THEREFORE

CONSIDERANDO

El representante de las actoras presentó demanda en la que indicó, sus representadas son copropietarias de la finca inscrita en San José, matrícula 702599-000-001 y 002, cuyo plano catastrado corresponde al 1-2188847-2020. Explicó, hace aproximadamente más de un año, un grupo de personas se introdujo en ese inmueble, entre ellas el demandado, quien ocupa el terreno dentro de la finca por el rumbo noreste, siendo el área en ocupación de aproximadamente 200 metros cuadrados, donde construyó una edificación muy precaria con materiales de segunda madera y latas de zinc. Indicó, a pesar de que sus representadas, en varias oportunidades le han solicitado al demandado el desalojo voluntario del espacio que ocupa, este se niega a hacerlo. Acusa, el demandado conoce que está ocupando un terreno que es parte de una finca debidamente inscrita a nombre de sus representadas, sin tener justo título que lo legitime, ni cuenta con una autorización de persona facultada por sus representadas para ello.

Peticionó: “(...)1-) Se declare con lugar en todos sus extremos la presente demanda. 2-) Dado que sus representadas son propietarias registrales de la finca inscrita al Partido de San José matrícula número 702599-001 y 002, y el demandado está ocupando de manera ilegitima un área aproximada a los 200 metros cuadrados, dentro de la propiedad de las sociedades actoras, solicita se reivindique a sus representadas de dicha área y se ordene el desalojo del demandado de dicho terreno. 3-) Que se declare que el demandado se encuentra poseyendo el área en litis de manera ilegítima, sin un justo título que la legitime y en virtud de ello se reivindique el derecho integral de propiedad a su representada, reintegrándole el ejercicio de la posesión total del inmueble. Por ello solicita se ordene la puesta en posesión a sus representadas del área ocupada ilegalmente por el demandado. 4-) Que se ordene al demandado no volver a ingresar a la finca de sus representadas y se le haga Ia advertencia que en caso de incumplir dicha orden se le podrá acusar del delito de desobediencia a la autoridad. 5-) Asimismo se condene al demandado al pago de las costas procesales y personales de este proceso.

(...).” El demandado contestó negativamente. Mediante sentencia 2022000244 de las 11 horas 47 minutos del 13 de octubre de 2022, el Tribunal Colegiado de Primera Instancia Civil del III Circuito Judicial de San José, integrado por las personas juzgadoras Rosny Arce Jiménez, María Mora Saprissa y Ana Felicia Córdoba, declaró con lugar demanda, ordenó la reivindicación, el desalojo y puesta en posesión del inmueble, así como la condena al demandado al pago de las costas de este proceso, quedando fijado los honorarios de abogado en la suma de un millón ciento treinta mil colones y dejando para ejecución de sentencia, los demás gastos indispensables del proceso y rubros que comprendan las costas no fijadas.

En resolución de las diez horas cuarenta y un minutos del veinte de febrero de dos mil veintitrés, esta Cámara admitió el recurso del demandado.

El primer motivo acusa violación de normas sustantivas. Señala como inaplicados los artículos 279 inciso 2°, 284 y 285 del Código Civil. Explica, de conformidad con el artículo 279 inciso 2 del Código Civil, se adquiere la posesión independientemente de la propiedad sobre un bien inmueble, por el hecho de conservar la posesión por más de un año, que corre desde que se toma públicamente la posesión o si fuere tomada en forma clandestina desde que eso conste al despojado. Aduce, en este caso, de la declaración de Jorge Arturo Mora Barteles se establece que desde 2018 se da la existencia del "rancho" del demandado, y, además que, al momento de interponer la demanda, ya había pasado más de un año desde que se percataron que estaba ocupando parte de la finca de las actoras, sin que hicieran nada. De tal forma, asegura, el demandado adquirió el derecho de posesión sobre esa parte del inmueble tal cual lo dispone el artículo 279 inciso 2° del Código Civil.

Añade, mediante la declaración de parte y los testimonios de las señoras Grace Castro Castrillo y Susan Bustamante Sánchez quedó demostrado que, conforme lo establecido por el numeral 285 del Código Civil, el demandado creía tener el derecho de poseer al momento en que tomó posesión, demostrando así su buena fe, sin que en ese momento tuviese duda ninguna sobre su posesión de buena fe, tal cual lo dispone el artículo 284 del Código Civil. Acusa, ninguna de estas normas fue valorada ni aplicadas al caso por el Tribunal a quo al momento de dictar su sentencia, ni al momento de rechazar la excepción de falta de derecho.

En cuanto relación con primer aspecto, el Tribunal explicó que, de la valoración de la prueba aportada a los autos, de acuerdo a criterios de lógica, experiencia, ciencia y correcto entendimiento humano, conforme al artículo 45.1 del Código Procesal Civil, en sustento a los hechos como causa de pedir, y encuadre jurídico del caso en estudio, en la especie, resulta procedente la acción reivindicatoria peticionada, porque: a) respecto al primer presupuesto, sea la legitimación activa, quedó demostrado que las sociedades INVERSIONES INMOBILIARIAS MARVI S.A y CORPORACIÓN FARO NEGRO S.A, son copropietarias del inmueble del Partido de San José, setecientos dos mil quinientos noventa y nueve mil, bajo los derechos cero cero uno y cero cero dos, respectivamente, misma que tiene una medida según registro y plano catastrado SJ-2188847-2020, de treinta mil sesenta y cinco metros cuadrados, lo que garantiza el reclamo que pueden ejercer de su derecho de propiedad, sobre tal inmueble. b) En cuanto a la legitimación pasiva y la identidad del bien, según se llegó a acreditar esencialmente con la prueba idónea al respecto, sea la pericial del Ingeniero Anyury Rodríguez Acuña, que efectivamente el terreno ocupado por el demandado Mora Castro, es de una área de 120 metros cuadrados, el cual se encuentra dentro de la propiedad de las sociedades actoras, sea la finca de San José setecientos dos mil quinientos noventa y nueve mil-cero cero uno y cero cero dos, por el sector norte, lo que igualmente se visualiza en el croquis aportado al efecto.

Añadió, si bien el demandado como sus testigos hicieron indicación de que ingresaron al terreno a través de una venta que les hizo un señor de nombre "Enrique", sin precisar demás calidades de tal persona, lo cierto del caso, que no se aportó ningún documento traslativo de dominio-a valorar- que permitiera acreditar algún justo título con relación a la ocupación del inmueble que ostenta, quedando en meras alegaciones sin contenido legal; es decir, señaló, no logró acreditar el demandado mediante prueba idónea que su posesión fuera legítima en contraste con el dominio pleno que tienen las sociedades actoras como dueñas del inmueble.

Contrario a lo alegado por el recurrente, el Tribunal de forma clara y precisa, explicó que no se trajo al proceso ningún elemento probatorio que demostrara el alegato del demandado respecto de la compra que aduce respalda su posesión y que pudiera ser valorada a efectos de confrontar la titularidad demostrada, con documentos públicos, por las actoras. Contra esa afirmación de carencia probatoria nada dice el recurrente, y por el contrario sustenta su reproche en el argumento de ser poseedor de buena fe, sin presentar razones jurídicas demostradas que sustenten ese dicho. En ese sentido, concuerda entonces esta Sala con lo esbozado en la sentencia respecto de concurrencia de los elementos para declarar con lugar la acción reivindicatoria y no encuentra en este recurso elemento que pueda demostrar yerro alguno por parte del Tribunal, que pudiera quebrar el fallo. Así, el agravio debe rechazarse.

En el segundo motivo acusa violación normativa. Dice, el Tribunal no aplicó el numeral 73.2 del Código Procesal Civil, particularmente por lo dispuesto por el inciso 4 de dicha norma legal. Dice, en todo momento se actuó con lealtad tanto para con la parte actora como para con el Tribunal, su conducta se ajustó a la buena fe, sus manifestaciones siempre fueron contestes con la prueba aportada; por lo cual lo procedente en este caso era aplicar lo dispuesto por el numeral 73.2.4 En la sentencia el Tribunal respecto de las costas dijo: “VIII. Repercusión económica de la actividad procesal. Costas. Al tenor del artículo 73.1 del Código Procesal Civil, resultado vencida la parte accionada, se le condena al pago de las costas de este proceso, dejando fijados los honorarios de abogado, al socaire de la cuantía fijada en este proceso y el arancel de honorarios por servicios profesionales de abogacía y notariado número N° 41457 -JP, en la suma de un millón de colones, más el trece por ciento del Impuesto de valor agregado, el total a cancelar son de un millón ciento treinta mil colones” En relación con el alegato de la casacionista, referente a la condenatoria en costas; esta Cámara ha manifestado en reiteradas ocasiones que, sobre el tema, en procesos civiles, de conformidad con el canon 73 del CPC, el pronunciamiento sobre las costas del proceso debe hacerse de oficio, condenando al vencido a su pago.

Por consiguiente, la condenatoria se impone al perdidoso por el hecho de serlo, según procedió el Tribunal en el caso de examen. Es decir, por perder el litigio, sin que ello signifique no haya tenido motivo bastante para litigar, ni se le considere litigante temerario o de mala fe. Por su parte, el propio numeral 73.2 del CPC, dispone los supuestos por los cuales podrá eximírsele de su pago. En el caso concreto, reclama contra la condena en costas, alegando que ha litigado de buena fe, aduciendo nobleza y rectitud de defensa. El precepto con el cual pretende sustentar la exoneración en costas –artículo 73.2.4 del Código Procesal Civil-, sí habilita la exención en caso de que la parte haya ajustado su conducta a la buena fe, la lealtad, la probidad y al uso racional del sistema procesal, no obstante, tomando en cuenta que la actora se opuso a la totalidad de las pretensiones y que, estas fueron acogidas de forma total, estima esta Cámara, no encontrar razones suficientes para aplicar la exoneración y, por el contrario, considera tal y como lo hizo el Tribunal, procede la regla procesal de condena al perdidoso. De ahí que el reparo deba de denegarse.

En consecuencia, por todas las razones señaladas, el recurso deberá declararse sin lugar, con sus costas a cargo del perdidoso.

POR TANTO
