Document Review Res. 002364-C-S1-2022 FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten thirty-four a.m. on veintisiete de octubre de dos mil veintidos.
In the ordinary agrarian proceeding (proceso ordinario agrario) brought by EDWIN GUEVARA MORA and EMILCE JIMENEZ AGÜERO, represented by Reyner Muñoz Piedra, against the ASOCIACION DE DESARROLLO INTEGRAL DE RESERVA INDIGENA DE SALITRE DE BUENOS AIRES, represented by Francisco Salomon Ortiz Ortiz. The INSTITUTO DE DESARROLLO RURAL (INDER), represented by Margarita Elizondo Jimenez; the COMISIÓN NACIONAL DE ASUNTOS INDÍGENAS (CONAI), represented by Vicente Aguirre Mendoza; and the ESTADO, represented by Heilyn Saenz Calderón, are deemed intervening parties (partes intervinientes). The Tribunal Agrario declared that it lacked subject-matter jurisdiction (incompetencia por razón de la materia) to hear this matter and therefore referred the case record to the Tribunal Contencioso Administrativo y Civil de Hacienda. The plaintiffs challenge the ruling, and the jurisdictional dispute was therefore referred to this Chamber.
WHEREAS
I.The plaintiffs instituted ordinary proceedings, seeking the following: “1) That this ordinary agrarian action for a superior right of possession (mejor derecho de posesión) and payment for agricultural improvements (mejoras agrarias) made in good faith be granted in all respects.
II.By Ruling (resolución) No. 06-C-21 at 11:49 a.m. on 07 de enero de 2021, the Agrarian Court declared that it lacked subject-matter jurisdiction (competencia por razones de materia), stating: “…Article 10 of the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo) provides that the purpose of contentious-administrative jurisdiction (jurisdicción contencioso-administrativa) is to safeguard the legal interests of every person, guarantee or restore the legality of any conduct by the Public Administration subject to Administrative Law, and hear and decide the various aspects of public-law relationships; and Article 2°, subsection b, provides that the Contentious-Administrative and Civil Court for Treasury Matters (Jurisdicción Contencioso-Administrativa y Civil de Hacienda) shall also hear ‘matters concerning the financial liability (responsabilidad patrimonial) of the Public Administration and its officials.’ In bringing the claim before the agrarian jurisdiction (jurisdicción agraria), the plaintiffs seek the annulment of administrative acts (actos administrativos) of the Instituto de Desarrollo Rural and also assert State liability for the actions of the Administration through an administrative act, seeking compensation or expropriation.
Article 10 of the Contentious-Administrative Procedure Code provides that the purpose of contentious-administrative jurisdiction is to safeguard the legal interests of every person, guarantee or restore the legality of any conduct by the Public Administration subject to Administrative Law, and hear and decide the various aspects of public-law relationships; therefore, this matter does not fall within the jurisdiction of the agrarian courts.” The appellant, for its part, stated that both the land located in Puntarenas and the plaintiffs are engaged in agriculture and that, consequently, the proceeding must remain within the agrarian jurisdiction. –
III.In this matter, the plaintiffs seek, among other relief, a declaration that the real property located in Buenos Aires de Puntarenas forms part of the Reserva Indígena de Salitre and, on that basis, compensation for the damages and losses caused by the State. In this regard, the matter concerns land protected under international conventions, whose protection is entrusted to the Costa Rican State. Furthermore, Article 49 of the Constitución Política establishes the scope and reach of contentious-administrative jurisdiction by providing: “…contentious-administrative jurisdiction is hereby established as a function of the Judiciary, for the purpose of guaranteeing the legality of the administrative functions of the State, its institutions, and every other public-law entity. Misuse of authority (desviación de poder) shall constitute grounds for challenging administrative acts; the law shall protect, at a minimum, the individual rights (derechos subjetivos) and legitimate interests (intereses legítimos) of governed persons…”.
Pursuant to this constitutional mandate, contentious-administrative jurisdiction is vested with subject-matter jurisdiction, as well as oversight of any specific manifestation of administrative conduct, whether by act or omission, and any potential administrative liability arising therefrom. Consistent with the foregoing, Article 1 of the Contentious-Administrative Procedure Code establishes that the purpose of this jurisdiction is to safeguard the legal interests of every person and to guarantee or restore the legality of any conduct by the Public Administration subject to Administrative Law. Article 2 of that body of law, for its part, establishes: “The Contentious-Administrative and Civil Court for Treasury Matters shall also hear the following: b) Matters concerning the financial liability of the Public Administration and its officials.” In view of the relief sought, it follows that the Contentious-Administrative Court has jurisdiction to hear this matter. –
POR TANTO

Revisión del Documento Res. 002364-C-S1-2022 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas treinta y cuatro minutos del veintisiete de octubre de dos mil veintidos .
En proceso ordinario agrario interpuesto por EDWIN GUEVARA MORA y EMILCE JIMENEZ AGÜERO, representado por Reyner Muñoz Piedra, contra la ASOCIACION DE DESARROLLO INTEGRAL DE RESERVA INDIGENA DE SALITRE DE BUENOS AIRES, representada por Francisco Salomon Ortiz Ortiz. Se tiene como parte interviniente al INSTITUTO DE DESARROLLO RURAL (INDER) representado por Margarita Elizondo Jimenez, COMISIÓN NACIONAL DE ASUNTOS INDÍGENAS (CONAI) representado por Vicente Aguirre Mendoza, y el ESTADO representado por Heilyn Saenz Calderón. El Tribunal Agrario se declaró incompetente por razón de la materia para conocer el presente asunto, por lo que remitió los autos al Tribunal Contencioso Administrativo y Civil de Hacienda. La parte actora plantea disconformidad en contra de lo resuelto, por lo que se remitió el asunto en conflicto ante esta Sala.
CONSIDERANDO
I.La parte actora interpuso proceso ordinario, donde solicita lo siguiente: "1) Se declare con lugar en todos sus extremos la presente demanda ordinaria agraria de mejor derecho de posesión y pago de mejoras agrarias realizadas de buena fe.
II.Mediante resolución No. 06-C-21 de las 11 horas 49 minutos del 07 de enero de 2021, el Tribunal Agrario se declaró incompetente por razones de materia, señalando: “…el artículo 10 del Código Procesal Contencioso Administrativo dispone, la jurisdicción contencioso administrativa tiene por objeto tutelar las situaciones jurídicas de toda persona, garantizar o restablecer la legalidad de cualquier conducta de la Administración Pública sujeta al derecho Administrativo, así como conocer y resolver los diversos aspectos de la relación jurídico administrativa y el artículo 2° inciso b, dispone que también conocerá la Jurisdicción Contenciosa Administrativa y Civil de Hacienda de "las cuestiones de responsabilidad patrimonial de la Administración Pública y sus funcionarios". Al incoar la demanda ante la jurisdicción agraria, la parte actora pide la nulidad de actos de la administración (Instituto de Desarrollo Rural), y además exige una responsabilidad del Estado por el actuar de la administración, a través de un acto administrativo, demandando una indemnización o expropiación.
El artículo 10 del Código Procesal Contencioso Administrativo dispone, la jurisdicción contencioso administrativa tiene por objeto tutelar las situaciones jurídicas de toda persona, garantizar o restablecer la legalidad de cualquier conducta de la Administración Pública sujeta al derecho Administrativo, así como conocer y resolver los diversos aspectos de la relación jurídico administrativa, por lo que el presente asunto no es de conocimiento de la jurisdicción agraria.” Por su parte, el recurrente señaló que, tanto el terreno ubicado en Puntarenas, así como los actores, se dedican a la agricultura, por lo cual, el procedo debe mantenerse en la jurisdicción agraria. –
III.En el presente asunto, la parte actora solicita, entre otras pretensiones, se declare que el bien inmueble ubicado en Buenos Aires de Puntarenas, se encuentra integrado a la Reserva Indígena de Salitre, y de ahí, se le indemnice por los daños y perjuicios ocasionados por parte del Estado. En ese sentido, se está en presencia de terrenos protegidos convencionalmente, cuya protección se encomienda al Estado Costarricense. Además, el ordinal 49 de la Constitución Política, establece la extensión y alcance de la jurisdicción contencioso-administrativa al indicar: “…establécese la jurisdicción contencioso administrativa como atribución del Poder Judicial, con el objeto de garantizar la legalidad de la función administrativa del Estado, de sus instituciones y de toda otra entidad de derecho público. La desviación de poder será motivo de impugnación de los actos administrativos, la ley protegerá, al menos los derechos subjetivos y los intereses legítimos de los administrados…”.
Dada esta orden constitucional, se encomienda a la jurisdicción contencioso administrativa la competencia material, así como la fiscalización de cualquier manifestación específica de la conducta administrativa por acción u omisión y de su posible responsabilidad administrativa. En concordancia con lo anterior, el artículo 1 del Código Procesal Contencioso Administrativo establece que esta jurisdicción tiene por objeto tutelar las situaciones jurídicas de toda persona, así como garantizar o restablecer la legalidad de cualquier conducta de la Administración Pública, sujeta al Derecho Administrativo. Por su parte, el ordinal segundo de ese cuerpo normativo, establece: “La Jurisdicción Contencioso-Administrativa y Civil de Hacienda también conocerá lo siguiente: b) Las cuestiones de responsabilidad patrimonial de la Administración Pública y sus funcionarios”. En virtud de lo pretendido, se colige que, la jurisdicción Contencioso Administrativa es la competente para conocer del presente asunto. –
POR TANTO
