The latter expressed disagreement with that ruling, and the matter therefore comes before this Chamber for mandatory review (consulta).

WHEREAS

I.The plaintiff filed a plenary proceeding in which it requests the following declarations: “A) Because the following Decisions and Actions, the conduct of those who participated in them, and the related Acts and Actions detrimental to public-domain property are inconsistent with the Legal System, the absolute nullity (Nulidad Absoluta) of the following Decisions, Acts, or Actions shall be declared, as follows: 1. Absolute nullity of the decision issued by Notary Fabian Benavides Acosta at 15:30 hours on 16 de julio de 2003 in the proceedings to locate interest 001 (diligencias de localización del derecho 001) in property G- 3282, insofar as it orders that the case file be opened and declares that he has jurisdiction to hear that location proceeding concerning property situated in the maritime-terrestrial zone (Zona Marítimo Terrestre). 2. Absolute nullity of the Final Decision issued by Notary Fabián Benavides Acosta in the city of Heredia at 11:30 hours on 18 de marzo de 2004, in the Case File for the Location of Interest 001 in Property G-3282 of the Province of Guanacaste, because the location lies within the maritime-terrestrial zone and because of the other legal irregularities it contains. 3.

Absolute nullity of Deed Number 78, executed on 30 de marzo de 2004 before Notary Fabián Benavides Acosta, by means of which he notarized and entered into the protocol (protocoliza) the location of interest 001, appearing on the reverse of folio 55 of Volume One of his Notarial Protocol, for the same reasons. 4. Absolute nullity of the registration of property 136639-000 of the Guanacaste Registry District, arising from the location of interest 001 in the maritime-terrestrial zone and registered in Volume 552 -Entry 1287- Consecutive 01. 5. Absolute nullity of the registration of the sale of property 136639-000 of the Guanacaste Registry District, carried out personally by María Ocampo Baltodano in favor of the company La Finca Ocampo y Baltodano S.A., represented by her sons Eugenio and Luis Alejandro Román Ocampo, registered in the Registro Público, Guanacaste Registry District, in Volume 552, Entry 01287 Consecutive 01. 6.

Absolute nullity of the ‘transfer’ in the Registro Público de Bienes Inmuebles of Concepción Rivas y Peña’s interest from the first entry for property G-3282 to the Mechanized Real Folio system (Folio Real Mecanizado), made in the margin of registry entry # 29 for that property by means of a stamp and signature dated 4 de octubre de 2005, by Registry official Luis G. Matamoros Quesada at the request of his hierarchical superior, the Director del Registro de Bienes Inmuebles, because it changed the area of that interest without any notarial or registry basis whatsoever. 7. Absolute nullity of the Decision issued by the Acting Deputy Director of the Registro de Bienes Inmuebles, Lic. Arturo Ortiz Castro, at 10 hours on 31 de mayo de 2006, appearing in Administrative File #254-2006 of that Registry, because it is inconsistent with the Legal System, specifically the Laws and Regulations relating to that Registry. 8.

Absolute nullity of the Decision issued by Notary Mónica Cuellar González on 21 de junio de 2006 in the case file for the Location of interest 005 in property G-3282, which is File 0001-2006 of her Notarial Office, concerning her jurisdiction to conduct location proceedings regarding property belonging to the maritime-terrestrial zone. 9. Absolute nullity of Deed No. 64, executed before Notary Mónica Cuellar González at 9 hours on 6 de octubre de 2006, appearing on the reverse of folio 137 of volume two of her Notarial Protocol, which is the notarization and entry into the protocol of the location of interest 005 in property No. 3282 of the Guanacaste Registry District. 10. Absolute nullity of the registration of property 153441-000 of the Guanacaste Registry District, arising from the location of interest 005 in the maritime-terrestrial zone and registered in Volume 570-Entry 8321-Consecutive 01. 11.

Absolute nullity of the Deed executed before Notary Fernando Vargas Cullell at 14 hours on 22 de diciembre de 2006, appearing on the front of folio 165 of Volume 15 of his Notarial Protocol, as shown by the registry certification submitted to the record, in which Inversiones Román y Ocampo S.A. sells to Gill Hectáreas de Litoral S.A. property Number 153441-000 of the Guanacaste Registry District, which is the independent property created as a result of the location of interest 005 in property G-3282 and is situated entirely within the maritime-terrestrial zone; that document was registered in Volume 570, Entry 08321 Consecutive 01, and its registration must also be annulled. B) Consequently, by virtue of the Declaration of Nullity of the aforementioned Actions, Decisions, and Registrations, the parcels illegally located within inalienable public-domain property (bienes demaniales) and registered in the names of private individuals or commercial companies shall be restored to their status as part of the maritime-terrestrial zone, and the measures necessary for the full restitution of such property to the Estado shall be adopted, including an order requiring the current defendants holding those parcels to vacate them and to demolish, without any compensation, everything illegally built on them.

  • C)The defendants shall be ordered to refrain from adopting or carrying out any conduct that could impair the Estado’s lawful ownership, possession, and usufruct of the aforementioned property. E) The Registro Público de Bienes Inmuebles shall be ordered to cancel the registrations annulled by the Judgment and to cancel the corresponding Entries. F) The companies Inversiones Román y Ocampo S.A., La finca Ocampo y Baltodano S.A., and Gill Hectáreas de Litoral S.A. shall be held liable for the illegal appropriation of public-domain property, specifically property within the maritime-terrestrial zone. María Ocampo Baltodano shall likewise be held personally liable for her intentional participation in the illegal appropriation of property situated in the maritime-terrestrial zone, knowing that the surface area of the Santo Tomás property did not include the maritime-terrestrial zone. G) It shall be declared that, from its inception, the Santo Tomás property did not include the maritime-terrestrial zone of the el Carbonal and el Cabuyal beaches.
  • H)The defendants, personally or through their representatives, shall be ordered to refrain from adopting or carrying out any conduct that could interfere with the free enjoyment of the public property restored to the Estado Costarricense by this judgment. I) All defendants shall be held jointly and severally liable, with the amount to be determined subsequently (en abstracto), for payment of the damages and losses caused by their conduct. J) All defendants shall be ordered to pay both categories of costs (ambas costas).”

II.In decision no. 1405-2019, issued at 10 hours 50 minutes on 8 de agosto de 2019 during the preliminary hearing, the Tribunal de lo Contencioso Administrativo y Civil de Hacienda denied the objection for lack of subject-matter jurisdiction and stated: “The issue under discussion is whether this is private property or public-domain property, and because that dispute is entirely encompassed within the subject matter of the proceeding, the Sala Primera de la Corte Suprema de Justicia has already clearly determined that, when the issue is simply whether property is or is not in the public domain, the only jurisdiction competent to hear the matter is the administrative-litigation jurisdiction (jurisdicción contencioso administrativa).” The defendant Sucesión de José Víctor Rivas Vargas expressed disagreement with that ruling, stating: “This case must be regarded as a matter falling within the jurisdiction of the agrarian courts (jurisdicción agraria), because, as will be explained below, the Santo Tomás property has, from its inception, been devoted to the agricultural and livestock activity of cattle raising from colonial times to the present; accordingly, any issue relating to that property, its location, and its dimensions must be heard by the agrarian courts.” The matter therefore comes before this Chamber for mandatory review.

III.The issue is whether jurisdiction over the proceeding lies with the administrative-litigation courts or the agrarian courts. Pursuant to the ruling of the Sala Constitucional in judgment no. 2010-9928, issued at 15 hours on 9 de junio del año 2010 and supplemented by vote no. 2010-11034 of that same year, determining jurisdiction in jurisdictional conflicts requires an examination of the legal regime applicable to the relationship and the substantive content of the relief sought. In this matter, the plaintiff seeks a declaration of nullity with respect to a series of actions, decisions, and registrations that resulted in the registration of properties allegedly situated within the maritime-terrestrial zone, which constitute public-domain property. Article 108 of the Ley de Biodiversidad (Ley 7788) provides: “Jurisdiction. In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative-litigation courts.

As exceptions to the foregoing rule, offenses against biodiversity shall be tried by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or the public domain shall fall within the jurisdiction of the agrarian courts.” Accordingly, because this case challenges actions of the administration and concerns the determination of public-domain property, jurisdiction over the proceeding clearly lies with the administrative-litigation courts and not the agrarian courts, pursuant to Article 108 of the Ley de Biodiversidad, which extends to any matter in which the Estado has a direct interest, and pursuant to the provisions of Article 2 of the Código Procesal Contencioso Administrativo.

THEREFORE

Jurisdiction over this proceeding is declared to lie with the Tribunal de lo Contencioso Administrativo y Civil de Hacienda. En proceso de conocimiento de la ASOCIACIÓN DE RESCATE DE LA ZONA MARÍTIMO TERRESTRE, representada por la licenciada Guiza Pinchansky Binderosky, contra INVERSIONES ROMÁN Y OCAMPO S.A. representados por el magíster Rolando Segura Ramírez, el ESTADO representado por la licenciada Silvia Quesada Casares, MARIANA ROMÁN OCAMPO, MARÍA OCAMPO BALTODANO y LA FINCA OCAMPO BALTODANO S.A. representadas por el Dr. Manuel Enrique Jiménez Mesa, GILL HECTÁREAS DE LITORAL S.A representados por el Dr. Aldo Milano Sánchez, MARÍA DALAIS MAYELA RIVAS CORTÉS, representada por el licenciado Sabino Quintanilla Medina, SUCESIÓN JOSÉ VÍCTOR RIVAS VARGAS representado por el licenciado Buck Ronald Calvo Canales, JUNTA ADMINISTRATIVA DEL REGISTRO NACIONAL representada por la licenciada Gabriela Carranza Araya, SUCESORIO DE CONCEPCIÓN, JOAQUÍN Y APOLONIA RIVAS PEÑA, representada por el licenciado Edgar Porras González, y SUCESIÓN DE EVANGELINA, JOAQUÍN JOSÉ, VÍCTOR MANUEL RIVAS VARGAS y LUCAS RIVAS ÁLVAREZ, representados por el licenciado Juan Francisco Ruiz Monge, el Tribunal de lo Contencioso Administrativo y Civil de Hacienda, rechazó excepción de incompetencia en razón de materia, interpuesta por la parte demandada (Sucesión José Víctor Rivas Vargas), este último presentó inconformidad contra lo resuelto, por lo que se conoce el asunto en consulta ante esta Sala.

CONSIDERANDO

I.La parte actora interpuso proceso de conocimiento, donde solicita se declare: “A) Que por existir disconformidad con el Ordenamiento Jurídico de las Resoluciones y Actuaciones que a continuación indicamos y la conducta de quienes participaron en las mismas y de los Actos y Actuaciones conexas en daño de bienes del dominio público, se declare la Nulidad Absoluta de las siguientes Resoluciones, Actos o Actuaciones tal y como sigue: 1. Nulidad Absoluta de la resolución del Notario Fabian Benavides Acosta de las 15:30 horas del día 16 de julio de 2003 en las diligencias de localización del derecho 001 de la finca G- 3282 en cuanto ordena la apertura del expediente y se declara competente para conocer de dicha localización sobre un bien ubicado en la Zona Marítimo Terrestre. 2. Nulidad Absoluta de la Resolución Final del Notario Fabián Benavides Acosta, emitida en la ciudad de Heredia a las 11:30 horas del 18 de marzo de 2004, en Expediente de Localización del Derecho 001 de la Finca G-3282 de la Provincia de Guanacaste, por estar ubicada la localización en la ZMT, y las demás irregularidades legales que contiene. 3.

Nulidad Absoluta de la Escritura Número 78, otorgada el día 30 de marzo de 2004 ante el Notario Fabián Benavides Acosta por medio de la cual protocoliza la localización del derecho 001, visible al folio 55 vuelto del Tomo Primero de su Protocolo, por las mismas razones. 4. Nulidad Absoluta de la inscripción del inmueble del Partido de Guanacaste 136639-000 originado en la localización del derecho 001 en la Zona Marítimo Terrestre, inscrita al Tomo 552 -Asiento 1287- Consecutivo 01. 5. Nulidad Absoluta de la inscripción de la compraventa de la finca 136639-000 del Partido de Guanacaste efectuada por María Ocampo Baltodano personalmente a favor de la sociedad La Finca Ocampo y Baltodano S.A. representada por sus hijos Eugenio y Luis Alejandro Román Ocampo, inscrita en el Registro Público, Partido de Guanacaste, al Tomo 552, Asiento 01287 Consecutivo 01. 6. Nulidad Absoluta del "traslado" en el Registro Público de Bienes Inmuebles del derecho de Concepción Rivas y Peña del asiento primero de la finca G-3282 al sistema de Folio Real Mecanizado, efectuada al margen del asiento registral # 29 de dicha finca, mediante sello y firma de fecha 4 de octubre de 2005, por el funcionario del Registro Luis G. Matamoros Quesada, a solicitud de su superior jerárquico, el Director del Registro de Bienes Inmuebles, por cambiar la medida de dicho derecho sin fundamento notarial ni registral alguno. 7.

Nulidad Absoluta de la Resolución del Subdirector a.i. del Registro de Bienes Inmuebles, Lic. Arturo Ortiz Castro, de las 10 horas del día 31 de mayo de 2006 que aparece en Expediente Administrativo #254-2006 de ese Registro, por su disconformidad con el Ordenamiento Jurídico, específicamente con las Leyes y Reglamentos relacionados con dicho Registro. 8. Nulidad Absoluta de la Resolución de la Notaria Mónica Cuellar González de 21 de junio de 2006 en expediente de Localización del derecho 005 de la finca G-3282, que es Expediente 0001-2006 de su Notaría, sobre su competencia para tramitar las diligencias de localización sobre un bien perteneciente a la Zona Marítimo Terrestre. 9. Nulidad Absoluta de la Escritura No. 64 otorgada ante la Notaria Mónica Cuellar González de las 9 horas del 6 de octubre de 2006 visible al folio 137 vuelto del tomo dos de su Protocolo que es la protocolización de la localización del derecho 005 de la finca del Partido de Guanacaste No. 3282. 10.

Nulidad Absoluta de la inscripción del inmueble del Partido de Guanacaste 153441-000 originada en la localización del derecho 005 en la Zona Marítimo Terrestre, inscrita al Tomo 570-Asiento 8321-Consecutivo 01. 11. Nulidad Absoluta de la Escritura otorgada ante el Notario Fernando Vargas Cullell otorgada a las 14 horas del 22 de diciembre de 2006, visible al folio 165 frente del Tomo 15 de su Protocolo, como consta de certificación registra! aportada a los autos, en la cual Inversiones Román y Ocampo S.A. vende a Gill Hectáreas de Litoral S.A. la finca del Partido de Guanacaste Número 153441-000 que es la finca independiente constituida a raíz de la localización del derecho 005 de la finca G-3282, y ubicada en su totalidad en la Zona Marítimo Terrestre, documento inscrito al Tomo 570, Asiento 08321 Consecutivo 01, inscripción que también debe anularse. B) Que en consecuencia, en virtud de Declaratoria de Nulidad de las Actuaciones, Resoluciones e Inscripciones mencionadas se restablezca la condición de Zona Marítimo Terrestre de las parcelas que ilegalmente fueron localizadas en bienes demaniales e inscritas a nombre de particulares o de sociedades mercantiles, y se adopten las medidas necesarias para la total restitución de dichos bienes al Estado, incluyendo la condenatoria a los demandados actuales detentadores de dichas parcelas a desocuparlas y a destruir lo construido ilegalmente sobre las mismas sin indemnización alguna.

  • C)Se ordene a los demandados que se abstengan de adoptar o ejecutar cualquier conducta que pueda atentar contra la debida propiedad, posesión y usufructo del Estado sobre los bienes ya mencionados. E) Se ordene al Registro Público de Bienes Inmuebles efectuar las cancelaciones de las inscripciones que por Sentencia resulten anuladas y se cancelen los Asientos respectivos. F) Que se condene a las sociedades Inversiones Román y Ocampo S.A., La finca Ocampo y Baltodano S.A., Gill Hectáreas de Litoral S.A. por la apropiación ilegal de bienes de dominio público, concretamente de la Zona Marítimo Terrestre. Igualmente que personalmente se condene a la Señora María Ocampo Baltodano por su participación intencionada en la apropiación ilegal de bienes ubicados en la Zona Marítimo Terrestre, a sabiendas de que la finca Santo Tomás no incluía en su superficie la Zona Marítimo Terrestre. G) Se declare que la finca Santo Tomás no incluía desde sus orígenes la Zona Marítimo Terrestre de las playas el Carbonal y el Cabuyal.
  • H)Que se ordene a las partes demandadas en persona o a sus representantes abstenerse de adoptar o ejecutar cualquier conducta que pueda interferir en el libre goce de los bienes públicos que por esta sentencia se restablecen a favor del Estado Costarricense. I) Se condene solidariamente en abstracto a todos los demandados al pago de los daños y perjuicios originados con su conducta. J) Se condene al pago de ambas costas a todos los demandados“.

II.En resolución no. 1405-2019 de las 10 horas 50 minutos del día 8 de agosto de 2019, dictada en audiencia preliminar, el Tribunal de lo Contencioso Administrativo y Civil de Hacienda, rechazó la excepción de incompetencia en razón de la materia interpuesta, señaló “Se está discutiendo si es bien privado o si es bien de demanio público y al estar esa discusión meramente inmersa en el objeto del proceso, claramente ha sido definido ya por la Sala Primera de la Corte Suprema de Justicia, que el solo hecho de determinar si es o no demanio público, la única jurisdicción competente para conocer dicha situación es la jurisdicción contencioso administrativa”. La demandada Sucesión de José Víctor Rivas Vargas, manifestó su inconformidad contra lo resuelto, indicó “El presente caso, debe valorarse como un asunto que corresponde a la competencia de la jurisdicción agraria, en virtud de que, como se explicará de seguido, la finca Santo Tomás, desde sus orígenes, se ha encontrado dedicada a la actividad agropecuaria de ganadería desde tiempos de la colonia y hasta la fecha, por lo que cualquier cuestión relacionada con dicha propiedad, su localización y dimensiones, deben ser ventiladas en la jurisdicción agraria”, por lo que se conoce el asunto en consulta ante esta Sala.

III.Se discute si el conocimiento del proceso corresponde a la jurisdicción Contencioso Administrativa o Agraria. Según lo dispuesto por la Sala Constitucional en la sentencia no. 2010-9928, de las 15 horas del 9 de junio del año 2010, que se adicionó por voto no. 2010-11034 de ese mismo año, para la definición de la competencia en los conflictos jurisdiccionales, se deberá revisar el régimen jurídico aplicable a dicha relación y el contenido material de la pretensión. En el presente asunto se pretende la declaratoria de nulidad de una serie de actuaciones, resoluciones e inscripciones, que originaron la inscripción de propiedades supuestamente dentro de la zona marítimo terrestre, los cuales corresponden a bienes de dominio público. Ahora bien, el numeral 108 de la Ley de Biodiversidad (Ley 7788) establece: “Competencia jurisdiccional En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa.

Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria”. De conformidad con lo anterior, dado que en el caso se impugnan actuaciones de la administración, así como la determinación de bienes de dominio público, es claro que el conocimiento del proceso corresponde a la jurisdicción Contenciosa Administrativa y no a la jurisdicción Agraria, de conformidad con lo establecido en el ordinal 108 de la Ley de Biodiversidad, extensiva a cualquier asunto en los que el Estado tenga interés directo y conforme lo preceptuado en el canon 2 del Código Procesal Contencioso Administrativo.

POR TANTO

Se declara que el conocimiento del presente proceso le corresponde al Tribunal de lo Contencioso Administrativo y Civil de Hacienda.
