SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, at thirteen hours and six minutes on doce de octubre del año dos mil veintiuno.
In the ordinary proceeding (proceso de conocimiento) brought before the Eighth Section of the Tribunal Contencioso Administrativo by Álvaro Ramírez Campos, identification card 1-432-402, and Noily Barboza Valverde, identification card 1-534-344, married to each other and residents of Los Chiles de Daniel de Pérez Zeledón, against the State, the Sistema Nacional de Áreas de Conservación, and the Instituto de Desarrollo Rural. The parties are represented by special judicial counsel (apoderados especiales judiciales), attorneys Ricardo Zeledón Zeledón (plaintiffs), Adriana Bonilla Bonilla (SINAC), Verónica Ulloa Herrera (INDER), and Susana Fallas Cubero (State).

I.According to the facts deemed proven, on 20 de noviembre de 1974, Compañía Osa Productos Forestales Sociedad Anónima (hereinafter Osa Productos) and the Instituto de Tierras y Colonización (ITCO) entered into an agreement to offer a fair and appropriate solution to the conflicts existing between farmers and occupants of the plots located within the properties owned by Osa Productos. The aim was to provide economically productive land, recognize the value of improvements, and create employment opportunities for those who demonstrated that they had exercised stable and effective acts of possession (actos de posesión) quietly, openly, peacefully, and continuously, based on the censuses conducted by the ITCO. On 28 de abril de 1978, through Decreto Ejecutivo no. 8494, the Reserva Forestal de Golfo Dulce was created, and the national lands within its boundaries were declared inalienable. It was provided that registered properties, or properties held under ten-year or precarious possession (posesión decenal o precaria), located within the boundaries of the Reserve would automatically become subject to the Forestry Regime (Régimen Forestal).
It was also determined that the Dirección General Forestal would arrange for the direct purchase or expropriation of privately owned lands located within the boundaries of the Reserve, and that occupants who had possessed land within the Reserve for more than 10 years would be resettled with the involvement of the ITCO. It so happened that three of the properties belonging to Osa Productos were located within the aforementioned reserve. Accordingly, through Decreto Ejecutivo no. 10244 of 5 de julio de 1979, the acquisition of those properties was proposed to Osa Productos, which agreed to the expropriation. Thus, three of the expropriated properties were consolidated to form the parcel registered under number 39334-000, owned by the State, on which the Asentamiento Campesino Osa was established. In 1980, it was agreed that the lots in Osa Forestal would be awarded to beneficiaries who met the legal requirements and conditions for issuance of the corresponding supplementary title of ownership (título supletorio de dominio).
Subsequently, in 1993, the Instituto de Desarrollo Agrario conducted censuses to identify those possessing the land. Through resolution no. 44-05 of 14 de noviembre de 2005, the Board of Directors of the IDA authorized a special procedure for granting title deeds to persons who demonstrated possession for at least 10 years prior to 1 de junio de 1978 of property 39334-000, which comprises the Asentamiento Campesino Osa located in the Reserva Forestal Golfo Dulce. Because of the length of that process, the Sindicato de Productores Agrícolas Independientes del Cantón de Osa filed constitutional protection petitions (recursos de amparo) seeking to compel the administrations involved to commence the expropriation proceedings. One was granted in 1997, while the other was summarily dismissed on the merits in 2007. In the latter, it was determined that there was a material impossibility of granting title to land within the forest reserve because doing so would be unconstitutional; nevertheless, the rights of those who had acquired in good faith had to be protected.
In light of that position, the IDA Board found that the designation of the disputed lands as a Forest Reserve meant that they automatically formed part of the natural heritage (patrimonio natural); consequently, it was definitively barred from granting title deeds to private parties. For that reason, through resolution 40-2007 of 19 de noviembre de 2007, that same Board decided to revoke the aforementioned resolution 44-05. That decision was challenged as unconstitutional; however, Sala IV determined that the revocation was lawful because the resolution did not constitute a declaration of rights in favor of any person, as it merely created an expectation of a right (expectativa de derecho) conditioned upon compliance with various requirements. It determined that such annulment did not require either the declaration of nullity provided for in section 179 of the Ley General de la Administración Pública or a declaration that the act was adverse to the public interest (declaratoria de lesividad), because, as stated, there was no act declaring the grant of any benefit.
Mr. Álvaro Ramírez and Ms. Noilyn Barboza brought contentious-administrative proceedings (vía contenciosa) against the State, the Sistema Nacional de Áreas de Conservación, and the Instituto de Desarrollo Rural. They alleged that they had acquired portions of the property at issue by adverse possession (usucapido) for more than 50 years. They stated that their possession had been quiet, open, peaceful, interrupted, and in good faith, and therefore asserted that they were entitled to payment of damages arising from the value of what they regarded as their property, as well as from the effects of the restrictions imposed by the forestry regime. In summary, they sought annulment of the resolutions that prevented their land from being titled, delivery of the deeds recognizing them as adverse possessors (usucapientes) without any restrictions, and payment of the damages caused. In addition, they sought ₡50.000.000,00 for subjective emotional distress (daño moral subjetivo), based on the situations they alleged they and their children had experienced due to the illnesses and dangers caused by living in the mountains while subject to forestry restrictions that prevented them from improving their circumstances.
In the alternative, they sought payment of the value of the property expropriated in 1978. All three defendants denied the complaint. As relevant here, they jointly raised the defense of lack of legal entitlement (excepción de falta de derecho). In deciding the case, the Tribunal conducted an extensive and detailed analysis of the contents of the aforementioned decrees. It emphasized that when the Reserva Forestal Golfo Dulce was created, Ley Forestal no. 4465 was in force. It referred to the provisions most relevant to the particular case, emphasizing sections 25 and 57, which clearly establish that possession of land subject to the forestry regime does not create rights of any kind, nor does it bar the State’s action to recover possession (acción reivindicatoria); therefore, such land may not be colonized or transferred without authorization from the Asamblea Legislativa. On that basis, the judges found that the Executive Branch had created a contradiction by establishing, on the one hand, a forest reserve subject to a forestry regime and, on the other, providing that those lands were to be allocated to landless farmers so that they could engage in agricultural activities.
In view of that conflict, the judges found that the legally appropriate course—in accordance with the constitutional principle of the supremacy of statutes—was to decline to apply Decreto Ejecutivo 10088 because it contradicted section 57 of the Ley Forestal. All claims were dismissed in their entirety. The judges established that the plaintiffs had failed to prove that they possessed the land for which title was sought before the decree creating the Forest Reserve entered into force, or that there was a chain of possession (cadena posesoria) commencing 10 years before that decree took effect. It was established that there had never been any acts declaring rights, but only preparatory acts within the expedited land-titling procedure (procedimiento abreviado de titulación de tierras); therefore, no proceeding seeking a declaration that an act was adverse to the public interest (proceso de lesividad) was warranted.
The judges stated that recognition of a perfected title deed (título de propiedad perfecto) was impossible because of the legal prohibition against transferring the State’s Natural Heritage (Patrimonio Natural del Estado). The claim for damages was dismissed because possession of the land before the Forest Reserve was created had not been proven. In the judges’ view, the essential element of good faith was also absent because the plaintiffs knew of the reserve’s existence. The claim for subjective emotional distress was dismissed for the same reasons, since the alleged unhealthy conditions and isolation likewise were not established because possession had not been proven. The judgment explains that there is a serious inconsistency contradicting the plaintiffs’ theory of the facts in this case regarding the date on which they began possessing the disputed land and the chain of possession—an inconsistency the plaintiffs never managed to clarify.
Based on the foregoing, the Tribunal upheld the defense of lack of legal entitlement, dismissed the complaint in all respects, and ordered the plaintiffs to pay costs, with interest. Dissatisfied, the plaintiffs appeal.
II.The appellant in cassation (casacionista) submits an extensive brief raising a total of seven challenges, all concerning the merits. In the first, he alleges an indirect violation of substantive rules due to the failure to consider testimonial and documentary evidence (preterición de prueba testimonial y documental). He transcribes the facts stated in the complaint. He asserts that all the documentation arising from the administrative proceeding before the IDA was disregarded, from which—as he maintains—it follows that they were recognized as having possessed land within Reserva Forestal Golfo Dulce for 41 years. He likewise states that the testimonial evidence was disregarded. He proceeds to transcribe all the witnesses’ statements. He argues that the judgment is based solely on a case file from the Juzgado Agrario de Corredores submitted by the Procuraduría General de la República. He cites decrees 8494-A of April 28, 1978, 9388 of November 30, 1978, and 10088-G-H of May 2, 1979 as the body of rules infringed.
He states that the violation occurred when the State transferred to the ITCO land that was inalienable and not subject to acquisitive prescription (imprescriptible). In his view, the applicable rules should have been examined more thoroughly to understand that the State offered several solutions to the adverse possessors (usucapientes), all of which have failed because the State did not fulfill what it promised. He states that, in light of those breaches, the plaintiffs were compelled to resort to the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa) with two types of claims, which he summarizes. He asserts that the Sala Primera must distinguish between two different legal situations: first, the State’s obligation to issue the deeds, and second, its duty to compensate them. He concludes that an in-depth analysis of the evidence would allow the finding of fact deemed unproven to be removed, and he transcribes how, in his view, it should be worded.
SECOND: He alleges an indirect violation of substantive rules by improperly assigning weight to a negative, undisputed, and publicly known fact. He expresses disagreement with fact no. 2, which the Tribunal deemed unproven. In a confusing manner, he refers to an evident “deference or subrogation to the deed in the typical expression ‘there is no evidence to that effect in the record’….” He then once again transcribes his claims. At the end of his brief, he expresses dissatisfaction with the failure to notify the plaintiffs of the administrative act adopted by the IDA Board of Directors at ordinary session no. 40-2007. THIRD: He alleges a violation of rules. He transcribes unproven fact no.3. He asserts that this was a true and undisputed fact. He refers to the finding that it was not proven that the plaintiffs had resided on parcel no 160 of Asentamiento Campesino Osa. He demands that this proven fact be removed because, he asserts, it was the application of the Ley Forestal that prevented them from living there, rather than merely a personal decision; more precisely, they could not continue exercising possession indefinitely in light of so many restrictions.
He once again cites as violated rules the decrees mentioned in the summary of the first challenge. He continues to oppose the Tribunal’s position that the land was inalienable and that deeds to it could not be issued. FOURTH: He again alleges a violation of substantive rules. He states that the plaintiffs have a legitimate interest (interés legítimo) arising from the interlocutory act having independent effects (acto de trámite de efectos propios) constituted by the administrative proceeding; therefore, in his view, it is impossible to uphold the defense of lack of a right (excepción de falta de derecho). He asserts that the decrees recognize the adverse possessors’ right to have their property expropriated. From his perspective, a legal relationship (relación jurídica) was created when the documents were submitted to participate in the procedure promulgated by the IDA, without any expectation that it would later be halted and repealed.
He transcribes sections 1, 9, 10, 34, 42, and 122 of the Código Procesal Contencioso Administrativo (CPCA), as well as legal scholarship concerning the concept of a legal relationship. Once again, he reproduces the list of his claims. FIFTH: He alleges a violation of substantive rules. He again identifies the aforementioned decrees as having been violated. He states that the violation occurred when the State transferred the properties to the ITCO. In this challenge, he again reiterates what he stated in the first. It is virtually a reproduction of the first challenge. He insists that, as purchasers, don Álvaro and doña Noily had a right to be relocated or expropriated. The defendant authorities tarnished the ideals of former presidents Oduber and Carazo, who issued those historic decrees. He again discusses factual aspects of the case and the administrative proceeding. He transcribes part of one of the constitutional judgments concerning land titling (titulación de tierras).
He provides an extensive list of comments concerning the decrees and his personal views on the conduct of the defendant institutions. SIXTH. The appellant in cassation alleges the violation of legal rules. He then expresses disagreement with the position set forth in the judgment regarding the judges’ determination that there was no evidence demonstrating the plaintiffs’ acquisitive prescription (usucapión). He insists that this Chamber must declare their right. He reiterates that the documentation contained in the administrative case file and the testimonial evidence were disregarded. He transcribes a series of articles without indicating the body of law to which they belong. SEVENTH: He invokes a violation of section 193 of the CPCA. He maintains that, given the nature of the issues disputed, there was sufficient cause to litigate. He states that the decrees established rights for possessors and that this expectation was later denied.
He explains that one of the constitutional decisions directed the petitioners to seek review of the matter in the ordinary courts. To that extent, he considers that an exemption from costs (eximencia en costas) is possible.
III.Regarding the admissibility of the appeal, this Chamber has emphatically held that appellants must employ proper cassation technique (técnica casacional) when presenting their arguments, pursuant to article 139 subsection 3) of the Código Procesal Contencioso Administrativo (CPCA). An appellant must explain clearly and precisely the nature of the alleged error. If there was a direct violation of law, the appellant must state not only which rule was improperly interpreted or left unapplied, but must also challenge the judgment on legal grounds. Likewise, if indirect defects are alleged, the appellant in cassation must cite the substantive rule infringed by the challenged decision, identify the error committed by the Tribunal, and explain the effect of that error on the operative portion of the judgment (dispositivo del fallo). The cited provision establishes that the appeal must contain the relevant legal and factual grounds.
In judgment n.° 356-A-S1-2010 at 15 hours 18 minutes on March 11, 2010, this Chamber stated regarding those requirements that: “(…) it may be understood, grosso modo, as technical legal reasoning that mentions a series of articles or legal rules interwoven or linked together and reasonably connected from two perspectives: to the arguments in the appeal and to the judgment being challenged. (Emphasis added) Insofar as a body of legal rules (or, where appropriate, a single rule) is cited that is pertinent and clearly connected to the challenged judgment (whether its factual or legal basis) and the arguments in the appeal, legal grounds have been provided.” Consistent with the foregoing, an appeal in cassation (recurso de casación) generally entails basic requirements without which this Chamber cannot examine the alleged errors. The appeal must be self-contained; this means that the objecting party must identify and specify the nature of the claim, because it is not the role of this collegiate body to undertake an interpretive exercise to decipher the challenge and determine what the dissatisfied party intended to say. Accordingly, for the challenge to be examined, the grounds for the appeal must be specifically explained and accompanied by proper factual and legal support.
V.In the opinion of this Chamber, the appeal developed in the grounds of grievance (agravios) numbered one through six is wholly lacking in clarity, precision, and supporting grounds. There is no way to extract from its text clear ideas that would make it possible to determine the potential errors in the challenged judgment. Regarding the first ground, evidentiary omission (preterición probatoria) is alleged because, in his view, the testimony given at trial was not properly analyzed. He refers to several of the statements without indicating, with respect to each one, how those statements could have changed the Tribunal’s ruling. Regarding the regulations he cites, he refers to errors committed not by those who adjudicated the matter, but by the State. He maintains that the judges understood the issue; however, he concludes the thought by stating that the regulations must be reviewed in depth.
As can be seen, the appellant in cassation (casacionista) fails to satisfy the fundamental requirement for this type of challenge, because he does not cite the substantive provision (norma por el fondo) that he considers to have been violated and, as stated, he does not specifically allege an error committed in the judgment, but instead directs his disagreement against the defendant administrative authorities. It should be noted that the provisions he invokes as having been violated are the same decrees that constitute the factual basis of the case, without asserting any error by the judges in their analysis thereof. Numerous statements concerning the specific case and what occurred therein may also be observed; these are entirely disconnected from the challenged ruling, which is ultimately what this Cassation Chamber reviews. He completely fails to challenge the grounds on which the adjudicators concluded that the plaintiffs had not proven possession of the lands.
The second objection exhibits the same deficiencies. In an obscure and confusing manner, the objector provides a list of his claims, without this Chamber being able to determine the purpose of that transcription. At the end, he maintains that there are grounds to quash (casar) the judgment because the Tribunal found it proven that the plaintiffs had not been notified of the administrative provisions. Nothing stated alleges any error or inconsistency that this Chamber must review on the merits (por el fondo). In its ruling, the Tribunal addressed at length the issue of that lack of notice. It ruled that, even though the act had not been served on the plaintiffs, the titling proceeding (procedimiento de titulación) was manifestly unlawful and incapable of succeeding; consequently, that omission did not affect the plaintiffs’ rights or cause them harm, and invalidity therefore could not be declared merely for invalidity’s sake.
Notwithstanding the foregoing, the appellant challenged none of the grounds provided. He alleged a violation of law (quebranto normativo) without identifying any provision that had been violated. The third objection also lacks the required supporting grounds. It should be noted that he does not allege any error in the judgment. He merely offers subjective comments opposing what was established in proven fact no. 3. Nor does he challenge the reasons given by the Tribunal. The fourth ground, besides being confusing and ambiguous, also fails to comply with the formal requirements. As can be seen from the summary, the appellant in cassation reiterates the alleged right of the plaintiffs to be compensated or, alternatively, to receive the deeds to the parcels, without challenging the reasoning contained in the ruling. He transcribed a series of legal provisions without connecting them to the judgment.
It cannot be determined whether those rules were allegedly violated or instead serve as the basis for his assertions. He opposes the sustaining of the defense of lack of legal entitlement (excepción de falta de derecho) without attributing any error to the judgment. The fifth objection likewise fails to satisfy the formal requirements. It contains only subjective statements that provide no support for the objection. It alleges no error in the ruling and identifies no provision violated by the judgment. The sixth challenge also fails to satisfy the formal requirements. The appellant in cassation again omits the necessary supporting grounds, as he reiterates that the plaintiffs have a right and that evidence was omitted, without challenging the grounds stated by the judges in the ruling. In light of the foregoing, it is clear that the appeal, insofar as it concerns the aforementioned grounds, is manifestly deficient in form for the reasons extensively set forth; accordingly, there is no alternative but to dismiss them summarily pursuant to numeral 140 subsection c) of the CPCA.
VI.Having analyzed the arguments raised by the complainant in the seventh objection, this Chamber considers that they should be reviewed on the merits. The objector stated that, based on the factual circumstances of the case, the plaintiffs should be exempted from payment of legal costs (costas). Having reviewed that position, this Chamber considers that the appellant is correct. Numeral 193 of the CPCA authorizes an exemption based on the nature of the claim, which makes it possible to determine whether the dispute was necessary to establish which party was supported by the legal system. In this case, and based on what was set forth in the first recital (considerando), it may be observed that the persons occupying the disputed lands had a possible expectation of rights. Decrees were issued authorizing the commencement of an administrative proceeding (procedimiento administrativo) to arrange for the titling of the lands located within the boundaries of a forest reserve (reserva forestal).
Subsequently, however, the IDA revoked the resolution proceeding in that direction, establishing that the lands’ designation as Natural Heritage (Patrimonio Natural) barred it from granting property titles to private parties. Likewise, as the appellant indeed indicates, one of the constitutional decisions included a constitutional ruling directing the parties involved to the contentious-administrative jurisdiction (vía contenciosa). All of the foregoing leads this Chamber to conclude that, although the plaintiffs—as determined in the challenged ruling—were the unsuccessful parties at trial because they failed to prove possession of the lands before the forest reserve was created, the fact remains that the record did establish that by 1998 they already held the status of possessors. That circumstance and the other matters discussed support the conclusion that, based on the provisions of the decrees and the IDA resolutions, the latter had at least an expectation of a right that ultimately had to be resolved in this forum.
Thus, it is the opinion of this Chamber that don Álvaro and doña Noily did have sufficient grounds to institute these proceedings. Accordingly, it is considered appropriate to grant them an exemption from costs pursuant to the cited numeral 193. The ground of grievance must therefore be sustained.
VII.Consequently, the judgment is partially quashed, solely with respect to the award of costs imposed on the unsuccessful plaintiffs. Ruling on the merits, the award imposed is vacated and, in its place, it is declared that no special award of costs shall be made.

The appeal is declared partially well-founded. The judgment is partially quashed, solely with respect to the award of costs. In its place, each party shall bear its own expenses. SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las trece horas con seis minutos del doce de octubre del año dos mil veintiuno.
En el proceso de conocimiento establecido ante la sección octava del Tribunal Contencioso Administrativo Álvaro Ramírez Campos, cédula 1-432-402 y Noily Barboza Valverde, cédula 1-534-344, casados entre si y vecinos de Los Chiles de Daniel de Pérez Zeledón; contra el Estado, el Sistema Nacional de Áreas de Conservación y el Instituto de Desarrollo Rural. Figuran como apoderados especiales judiciales de las partes los licenciados Ricardo Zeledón Zeledón (actores), Adriana Bonilla Bonilla (SINAC), Verónica Ulloa Herrera (INDER) y Susana Fallas Cubero (Estado).

I.De acuerdo con los hechos que se tuvieron por demostrados, el 20 de noviembre de 1974, la Compañía Osa Productos Forestales Sociedad Anónima (en adelante Osa Productos) y el Instituto de Tierras y Colonización (ITCO), establecieron un convenio, a fin de ofrecer una solución justa y adecuada a los conflictos existentes entre campesinos y ocupantes de las parcelas ubicadas dentro de los inmuebles propiedad de Osa Productos. La idea, era dotar de tierras económicamente explotables, reconocer el valor de mejoras y crear fuentes de trabajo a quienes demostraran haber realizado actos de posesión estables y efectivos de forma quieta, pública, pacífica e ininterrumpida; ello con base en los censos que llevara a cabo el ITCO. Para el 28 de abril de 1978, mediante Decreto Ejecutivo no. 8494, se crea la Reserva Forestal de Golfo Dulce y se declaran inalienables los terrenos nacionales que se encuentren dentro de esa delimitación.
Se dispuso, las propiedades inscritas, con posesión decenal o precaria que estuvieran dentro de los límites de la Reserva, quedarían automáticamente sometidas al Régimen Forestal. Asimismo, se determinó que la Dirección General Forestal, gestionaría la compra directa o expropiación de los terrenos reducidos a dominio particular que se encontraran en la demarcación de la Reserva y que el reasentamiento de los ocupantes con más de 10 años de poseer terrenos dentro de la Reserva, se haría con la intervención del ITCO. Así, se da el caso, que tres de las propiedades de Osa Productos se encontraban dentro de la citada reserva y es de esa manera, que por Decreto Ejecutivo no. 10244 del 5 de julio de 1979, se propone a esta última, la adquisición de esos bienes, la cual manifestó su conformidad con la expropiación. Es así como tres de las fincas expropiadas se reúnen y forman el terreno con matrícula 39334-000, propiedad del Estado y donde se crea el Asentamiento Campesino Osa.
En el año 1980, se acuerda la adjudicación de los lotes en Osa Forestal a los adjudicatarios que cumplieran con los requisitos y condiciones legales para que se les extienda el correspondiente título supletorio de dominio. Luego, en 1993, el Instituto de Desarrollo Agrario, levanta censos para determinar a los poseedores de los terrenos. Por acuerdo no. 44-05 del 14 de noviembre de 2005, la Junta Directiva del IDA, dispone la autorización de un procedimiento especial a fin de otorgar títulos de propiedad a quienes demostraran tener una posesión de por lo menos 10 años con anterioridad al 1 de junio de 1978; en la propiedad 39334-000 que conforma el Asentamiento Campesino Osa ubicado en la Reserva Forestal Golfo Dulce. Dada la duración de dicho proceso, por parte del Sindicato de Productores Agrícolas Independientes del Cantón de Osa, se plantearon recursos de amparo con el objeto de que se obligara a las administraciones involucradas al inicio de las diligencias de expropiación.
Uno de ellos se declaró con lugar en el año 1997 y el otro, fue rechazado de plano por el fondo en el 2007. En este último, se determinó que existe una imposibilidad material para titular los terrenos dentro de la reserva forestal por resultar tal proceder inconstitucional; no obstante, debían de salvaguardarse los derechos a quienes adquirieron de buena fe. Atendiendo a esa posición, la Junta del IDA, estimó que la afectación de Reserva Forestal de los terrenos en discusión, hace que estén afectos automáticamente a patrimonio natural; por lo que en definitiva le estaba vedado el otorgar títulos de propiedad a particulares. Por esa razón, esa misma Junta, mediante acuerdo 40-2007 del 19 de noviembre de 2007, opta por revocar el acuerdo 44-05 antes referido. Esa decisión fue impugnada de inconstitucional, sin embargo, la Sala IV, determinó que esa revocatoria era legítima dado que no constituía una declaración de derecho para ninguna persona; pues se trataba únicamente de una expectativa de derecho condicionada al cumplimiento de diversos requisitos.
Determinó, que, para esa anulación no era necesaria la declaratoria de nulidad prevista en el canon 179 de la Ley General de la Administración Pública, ni tampoco la declaratoria de lesividad; en el tanto como se dijo, no existe acto alguno que declare el otorgamiento de ningún beneficio. Don Álvaro Ramírez y doña Noilyn Barboza, acudieron a la vía contenciosa en contra del Estado, el Sistema Nacional de Áreas de Conservación y el Instituto de Desarrollo Rural. Aducen, haber usucapido terrenos de la finca en discusión por más de 50 años. Señalaron haber poseído de manera quieta, pública, pacífica, interrumpida y de buena fe, por lo que consideran tener derecho al pago de los daños y perjuicios derivados del valor de la que consideran es su propiedad; además de los efectos que generaron las limitaciones impuestas por el régimen forestal. Exigen en resumen, la nulidad de los acuerdos que impidieron la titulación de sus terrenos, la entrega de las escrituras como usucapientes sin limitación alguna, y el pago de los daños y perjuicios ocasionados.
Sumado a ello, piden el tanto de ₡50.000.000,00 por el daño moral subjetivo, ante las situaciones que acusan experimentaron con sus hijos por las enfermedades y peligros que se generaron al vivir en la montaña y teniendo impuestas limitaciones forestales que no les permitía salir adelante. Subsidiariamente, piden se le cancele el valor de la finca expropiada desde el año 1978. Las tres partes accionadas contestaron de forma negativa la demanda. Opusieron en común y en lo de interés, la excepción de falta de derecho. El Tribunal al resolver hizo un extenso y detallado análisis del contenido de los decretos referidos. Resaltó, cuando se creó la Reserva Forestal Golfo Dulce, se encontraba vigente la Ley Forestal no. 4465. Hizo mención de los cardinales más relevantes en la aplicación del caso concreto, acentuando en lo preceptuado por los cánones 25 y 57, los cuales establecen claramente que la posesión de terrenos que estén afectos al régimen forestal no causará derechos de ninguna especie ni la acción reivindicatoria del Estado; así que no es posible que estos se colonicen ni enajenen sin la autorización de la Asamblea Legislativa.
Con base en ello, estimaron los juzgadores, que el Poder Ejecutivo incurrió en una contradicción en el tanto por un lado creó una reserva forestal sometido a un régimen forestal y por otro dispone que esos terrenos sean asignados a campesinos que no tengan tierras para que ejerzan actividades agrícolas. Ante esa divergencia, estimaron los jueces que lo propio en derecho –en atención al principio constitucional de supremacía de las normas de rango legal- era desaplicar el Decreto Ejecutivo 10088 por contradecir esto lo previsto en el artículo 57 de la Ley Forestal. En cuanto a las pretensiones, todas se rechazaron en su totalidad. Establecieron quienes juzgaron, que los actores no lograron demostrar haber tenido posesión sobre el terreno respecto del cual se reclama la titulación antes de la entrada en vigencia del Decreto que creó la Reserva Forestal, ni que existiera una cadena posesoria que se haya iniciado 10 años antes de la entrada en vigencia de ese decreto.
Se estableció que nunca hubo actos declarativos de derechos sino preparatorios dentro del procedimiento abreviado de titulación de tierras; por lo que no procedía proceso de lesividad alguno. El otorgamiento de un titulo de propiedad perfecto, era imposible de reconocer, -dijeron-ante la imposibilidad legal que existe para enajenar el Patrimonio Natural del Estado. Los daños y perjuicios se rechazaron en virtud de la falta de demostración de posesión del terreno antes de creada la Reserva Forestal. En criterio de los jueces, tampoco existe el elemental factor de buena fe, dado que los actores eran conocedores de la existencia de la reserva. El daño moral subjetivo es rechazado por las mismas razones, dado que la insalubridad y aislamiento aducido tampoco se demostró al no probarse la posesión. Se explica en el fallo, que existe una grave discordancia que contradicen la teoría de hecho en este caso en cuanto a la fecha que los actores empezaron a poseer los terrenos en disputa y a la cadena posesoria; divergencia que no lograron los accionantes aclarar en ningún momento.
Con base en lo explicado, el Tribunal acoge la falta de derecho, declara sin lugar en todos sus extremos la demanda e impone a los accionantes el pago de las costas con sus intereses. Estos últimos inconformes recurren.
II.Plantea el casacionista un amplio escrito donde plantea un total de siete censuras. Todas de fondo. En la primera, acusa violación indirecta de normas sustantivas al preterir prueba testimonial y documental. Transcribe los hechos de la demanda. Asegura, se pretirió toda la documentación derivada del procedimiento administrativo ante el IDA, de la cual se extrae –según sostiene- se les reconoció una posesión de 41 años dentro de la Reserva Forestal Golfo Dulce. Asimismo, dice, se pretirió la prueba testimonial. Procede a transcribir todas las declaraciones de los testigos. Aduce, la sentencia solo se basa en un expediente del Juzgado Agrario de Corredores aportado por la Procuraduría General de la República. Cita como conjunto de normas transgredidas los decretos 8494-A del 28 de abril de 1978, 9388 del 30 de noviembre de 1978 y el 10088-G-H del 2 de mayo de 1979. Señala, la violación se da cuando el Estado traspasa al ITCO terrenos que eran inalienables e imprescriptibles.
En su criterio, debió profundizarse en la normativa para comprender que el Estado le ofreció varias soluciones a los usucapientes y que en todas han fracasado porque no cumplen con lo prometido. Dice ante esos incumplimientos los actores debieron recurrir a la Jurisdicción Contenciosa con dos tipos de pretensiones y ofrece un resumen de estos. La Sala Primera, expresa, debe distinguir que hay dos situaciones jurídicas diferentes la primera la obligación del Estado de otorgar las escrituras o bien su deber de indemnizar. Concluye, con el análisis a fondo de la prueba puede eliminarse el hecho no probado y transcribe la forma como en su criterio debería de ir redactado. SEGUNDA: Acusa violación indirecta de normas sustantivas por atribuirle indebida valoración a un hecho negativo, no controvertido y de conocimiento público. Muestra su discrepancia con el hecho no. 2 que tuvo por no probado el Tribunal.
De manera confusa, alude a que es evidente la “pleitesía o subrogación hacia la escritura en la típica expresión “no consta prueba en autos en ese sentido”…”. Luego, procede a transcribir nuevamente sus pretensiones. A final de su redacción, muestra su inconformidad con la ausencia de notificación a los actores del acto administrativo tomado por la Junta Directiva del IDA en la sesión ordinaria no. 40-2007. TERCERO: Acusa quebranto de normas. Transcribe el hecho no probado no.3. Asegura, este fue un hecho cierto y no controvertido. Se refiere a que no quedó demostrado que los actores hayan residido en la parcela no 160 del Asentamiento Campesino Osa. Exige se elimine ese hecho probado porque asegura fue la aplicación de la Ley Forestal la que impidió poder vivir ahí y no meramente una decisión personal; mejor dicho, la posesión no la podían ejercer por siempre ante tantas restricciones. Cita nuevamente como normas quebrantadas los decretos citados en el resumen del primer reparo.
Insiste en oponerse a la postura del Tribunal de que los terrenos eran inalienables y que no se podía entregar escrituras sobre estas. CUARTO: Acusa nuevamente, violación de normas sustantivas. Afirma, los actores tienen un interés legítimo por el acto de trámite de efectos propios constituido por el procedimiento administrativo; por ello es imposible en su pensar el acogimiento de la excepción de falta de derecho. Asegura, los decretos le reconocen el derecho a los usucapientes de ser expropiados. Desde su perspectiva, se creó una relación jurídica con la presentación de los documentos para acogerse al procedimiento promulgado por el IDA, sin pensar que lo iban a detener y a derogar después. Transcribe los numerales 1, 9, 10, 34, 42 y 122 del Código Procesal Contencioso Administrativo (CPCA) y doctrina relacionada con el concepto de relación jurídica. Nuevamente, reproduce el listado de sus pretensiones.
QUINTO: Acusa violación de normas sustantivas. Refiere quebrantadas nuevamente los decretos mencionados. Señala que el quebranto se da cuando el Estado traspasa al ITCO las fincas. Vuelve en este cargo a reiterar lo dicho en el primero. Es prácticamente una reproducción de la primera censura. Insiste, don Álvaro y doña Noily tenían como adquirentes un derecho a ser reubicados o expropiados. Las autoridades demandadas, mancillaron los ideales de los expresidentes Oduber y Carazo que dictaron esos decretos históricos. Comenta nuevamente aspectos fácticos del proceso y del procedimiento administrativo. Transcribe, parte de una de las sentencias constitucionales relativas al tema de la titulación de tierras. Emite una extensa lista de comentarios en torno a los decretos y a sus consideraciones personales en torno al actuar de las instituciones demandadas. SEXTO. Advierte el casacionista de la vulneración de normas jurídicas.
Acto seguido, muestra su divergencia con la posición esbozada en el fallo, en torno a la postura de los jueces cuando determinaron la inexistencia de prueba que demostrara la usucapión de los actores. Insiste, esta Sala debe declarar el derecho de estos. Reitera una preterición probatoria de la documentación constante en el expediente administrativo y de la testimonial. Transcribe una serie de artículos sin indicar a qué tipo de cuerpo normativo pertenecen. SÉTIMO: Invoca quebranto del numeral 193 del CPCA. Sostiene que por la naturaleza de las cuestiones debatidas existió suficiente motivo para litigar. Dice, los decretos establecieron derechos a los poseedores y luego esa expectativa fue negada. Uno de los pronunciamientos constitucionales, explica, remitió a los recurrentes a la revisión del asunto a la sede ordinaria. En ese tanto, considera es posible la eximencia en costas.
III.En lo que atañe a la admisibilidad del recurso, esta Cámara ha sido enfática en que el recurrente debe cumplir con una debida técnica casacional al momento de exponer sus argumentaciones; ello al amparo de lo que postula el artículo 139 inciso 3) del Código Procesal Contencioso Administrativo (CPCA). Quien recurre, debe explicar con claridad y precisión en qué consiste el agravio. Si hubo quebrando directo de ley, es preciso que exprese no sólo cuál norma se vio indebidamente interpretada o inaplicada, sino que debe combatir jurídicamente la sentencia. Al igual que en el caso anterior, si lo que se acusa son vicios indirectos, el casacionista debe citar la norma de fondo que fue transgredida con la decisión que se impugna, puntualizar cuál fue la incorrección cometida por el Tribunal y la trascendencia de ese yerro en el dispositivo del fallo. La norma citada, establece que el recurso deberá contener la fundamentación jurídica y fáctica pertinente.
Esta Cámara, en la sentencia n.° 356-A-S1-2010 de las 15 horas 18 minutos del 11 de marzo de 2010 señaló, en cuanto a esos requerimientos que:“(…) puede entenderse, grosso modo, como aquella argumentación técnico-jurídica en la que se mencionan una serie de artículos o reglas jurídicas entrelazadas o concatenadas entre sí y vinculadas razonablemente en una doble perspectiva: con los argumentos del recurso y con la sentencia que se ataca. (El resaltado es suplido) En la medida en que se cite un conjunto de normas jurídicas (o si es del caso, una sola de ellas), atinente y vinculada de manera clara con la sentencia combatida (ya sea en el sustento de hecho o de derecho) y los argumentos del recurso, hay fundamentación jurídica.”. A tono con lo dicho, el recurso de casación en general contiene exigencias elementales, sin cuya observancia resulta imposible para esta Sala ingresar al análisis de los agravios invocados.
El recurso debe bastarse así mismo, ello significa que el objetante debe puntualizar y precisar en qué consiste su reclamo; pues no le corresponde a este órgano colegiado llevar a cabo una labor interpretativa a fin de desentrañar el reparo y establecer que fue lo que quiso decir el inconforme. Así, para que la impugnación sea objeto de análisis, requiere de una explicación puntual de los motivos del recurso acompañada de la debida fundamentación fáctica jurídica.
V.En criterio de esta Sala, el recurso desarrollado en los agravios que van del primero al sexto carece de absoluta claridad, precisión y fundamentación. No hay forma de extraer de su texto ideas claras que permitan determinar los posibles yerros que hubiese tenido la sentencia controvertida. En lo relativo al primer cargo, se acusa preterición probatoria al no analizarse como corresponde, en su criterio, los testimonios vertidos en juicio. Refiere a varias de las declaraciones sin indicar respecto de cada una de estas, de qué manera hubiesen podido esas manifestaciones variar lo resuelto por el Tribunal. En lo relativo a la normativa que cita, refiere a yerros pero no cometidos por quienes juzgaron, si no por el Estado. Sostiene, los jueces comprendieron la problemática, sin embargo, cierra la idea indicando que la normativa debe revisarse con profundidad. Como puede verse, el casacionista incumple con el requisito fundamental para este tipo de censuras pues se extraña la cita de la norma que por el fondo se estima vulnerada, y como se indica, no acusa en concreto un yerro cometido en la sentencia si no que su disconformidad la enfoca en contra de las Administraciones demandadas.
Nótese, los preceptos que invoca como vulnerados son los mismos decretos que resultan ser la base fáctica del caso, sin expresar yerro alguno por parte de los jueces en torno a su análisis. Se observan también, muchas expresiones relacionadas con el caso concreto y lo sucedido en éste; divorciándose en lo absoluto del fallo impugnado que en última instancia es lo que revisa esta Sala de Casación. Prescinde por completo de combatir los sustentos que tuvieron las personas juzgadoras para considerar que los actores no demostraron haber poseído los terrenos. En el segundo reparo se observan las mismas falencias. El objetante de forma oscura y confusa, ofrece un listado de sus pretensiones, sin que esta Sala pueda determinar el objetivo de dicha transcripción. Al final sostiene que hay razón para casar la sentencia, al tener por probado el Tribunal que los actores no fueron notificados de las disposiciones administrativas.
De todo lo dicho, no se extrae la acusación de ningún yerro o inconsistencia que por el fondo deba revisar esta Cámara. El Tribunal se refirió en el fallo ampliamente al tema de esa falta de notificación. Resolvió: que aún y cuando el acto no fue notificado a los actores, el procedimiento de titulación era abiertamente ilegal e imposible de fructificar; en ese tanto, esa omisión en nada afectó los derechos de los actores, ni se les causó perjuicio, no pudiéndose entonces declarar la invalidez por la invalidez misma. Luego de lo dicho, ninguno de los sustentos ofrecidos, fueron combatidos por el recurrente. Refirió quebranto normativo, sin hacer referencia a norma alguna vulnerada. El tercer reparo carece también de la fundamentación debida. Nótese que no alega error alguno a la sentencia. Se opone simplemente con comentarios subjetivos a lo establecido en el hecho probado no. 3. Tampoco se combaten las razones ofrecidas por el Tribunal.
El cuarto cargo, además de confuso y ambiguo incumple también con los requisitos de formalidad. Como se puede notar del resumen, el casacionista reitera el supuesto derecho que tienen los actores de ser resarcidos o bien se les entregue las escrituras de las parcelas, sin combatir la sustanciación que consta en el fallo. Transcribió una serie de normas jurídicas sin engarzarlas con la sentencia. No se puede extraer si esos postulados fueron vulnerados o se trata más bien del fundamento que da a sus ideas. Se opone al acogimiento de la excepción de falta de derecho sin atribuir ningún yerro a la sentencia. El quinto reparo carece también de los requisitos de formalidad. Contiene únicamente manifestaciones subjetivas que no dan sustento al reparo. No acusa ningún error en el fallo ni refiere norma alguna quebrantada con la sentencia. La sexta inconformidad, incumple también con los requisitos de formalidad.
El casacionista incurre nuevamente en omisiones de fundamentación pues reitera que los actores cuentan con un derecho y que hubo prueba que les fue preterida sin combatir los sustentos ofrecidos por los jueces en el fallo. Con lo dicho, es claro que el recurso, en lo que atañe a los cargos mencionados, resulta abiertamente informal por las razones ampliamente expuestas; de ahí que no quede más que desestimarlos y rechazarlos de plano a la luz del numeral 140 inciso c) del CPCA.
VI.Analizada la argumentación planteada por el quejoso en el sétimo reparo, estima esta Cámara que procede ser revisada por el fondo. Indicó el objetante, que de acuerdo con el cuadro fáctico del caso, los actores deberían de ser eximidos del pago de las costas. Revisada que fue tal postura, considera esta Sala que el recurrente lleva razón. El numeral 193 del CPCA habilita la exención por la naturaleza de lo reclamado que permite colegir si el debate era necesario a fin de dilucidar a quien asistía el ordenamiento jurídico. En la especie y de lo planteado en el primer considerando, se observa que había una posible expectativa de derechos para las personas que ocupaban las tierras en disputa. Existieron decretos que autorizaron la apertura de un procedimiento administrativo a fin de gestionar la titulación de los terrenos que estaban dentro de los límites de una reserva forestal. Sin embargo, posteriormente, el IDA revocó el acuerdo que iba en esa línea, estableciendo que esa afectación al Patrimonio Natural, le vedaba la posibilidad de otorgar títulos de propiedad a particulares.
Asimismo, en efecto, como lo indica el recurrente, en uno de los pronunciamientos constitucionales existió un pronunciamiento constitucional que definió la remisión de los involucrados a la vía contenciosa. Todo lo comentado, lleva a concluir a esta Sala, que si bien los actores -según lo resuelto en el fallo impugnado- resultaron vencidos en juicio al no lograr demostrar la posesión de las tierras con anterioridad a la creación de la reserva forestal, lo cierto es que si constó que posteriormente en el año 1998 ya tenían condición de poseedores. Ese y el resto de aspectos comentados, permiten considerar que estos últimos con base en lo resuelto por los decretos y por los acuerdos del IDA, tuvieron al menos una expectativa de derecho que en definitiva tendría que ser dilucidada en esta sede. Así, es criterio de esta Cámara que don Álvaro y doña Noily si tuvieron razones suficientes para venir al proceso. En tal virtud, se estima que es posible habilitar la exención en costas a favor de estos últimos al amparo del numeral 193 citado. En esos términos corresponde acoger el agravio.
VII.En consecuencia, se casa parcialmente la sentencia, únicamente en lo tocante a la condena en costas impuesta a los actores vencidos. Fallando por el fondo, se anula la condena impuesta y en su lugar se declara el asunto sin especial condenatoria en costas.

Se declara el recurso parcialmente con lugar. Se casa parcialmente la sentencia, únicamente en lo relativo a la condena en costas. En su lugar, cada una de las partes sufragará sus propios gastos.
