In the plenary proceeding (proceso de conocimiento) filed by María Isabel Umaña Chaverri, represented by her special judicial attorney-in-fact (apoderado especial judicial), Jorge Méndez Zamora, attorney, Costa Rican Bar Association membership number 7788, against the CONSEJO NACIONAL DE VIALIDAD (CONAVI), represented by its special judicial attorneys-in-fact, Olga Martha Fallas Ramírez and Óscar Eduardo Romero Aguilar, both attorneys, Costa Rican Bar Association membership numbers 14160 and 18889, respectively, and the ESTADO, represented by Procuradora Guiselle Jiménez Gómez, attorney, identity card number 1-0898-0817. CONSIDERING

I. 1.- The plaintiff filed a plenary proceeding before the Tribunal Contencioso Administrativo y Civil de Hacienda, requesting in the complaint, as established at the preliminary hearing: “1. I request that this ordinary plenary proceeding be granted in all respects. Consequently, the conduct of CONAVI and El [sic] Estado shall be declared inconsistent with the legal system because they constructed a culvert within a protected area and directed its flow toward a spring (naciente) used for human consumption. 2. That the Consejo Nacional de Vialidad, CONAVI, and the Estado be ordered to remove or relocate the culvert that discharges stormwater through my property, affecting and contaminating the spring, so that henceforth it does not affect either my property or the spring. The foregoing shall be completed within a judicially prescribed period of one month from the date the judgment becomes final.

In the event of noncompliance, the trial court [sic] shall authorize me to perform what the judgment orders at the expense of CONAVI and the Estado, which shall also pay the resulting damages. If the work is performed differently from what was ordered, the work performed shall be demolished and the order shall be complied with, in which case CONAVI shall bear all expenses and damages caused by the Defective Performance. 3. If it is not possible to remove or relocate the culvert, they shall be ordered to carry out the necessary mitigation works and soil management and conservation measures, such as gabions or any other technique recommended by best practices, so that the water does not enter my property but instead flows into the nearest possible stream or creek located outside my property; the foregoing shall be completed within a judicially prescribed period of one month from the date the judgment becomes final.

In the event of noncompliance, the trial court [sic] shall authorize me to perform what the judgment orders at the expense of CONAVI and the Estado, which shall also pay the resulting damages. If the work is performed differently from what was ordered, the work performed shall be demolished and the order shall be complied with, in which case CONAVI shall bear all expenses and damages caused by the improper management. 4. That CONAVI and the Estado be ordered to fully repair the environmental and erosion damage caused to my property and to the spring, within a judicially prescribed period of one month from the date the judgment becomes final. In the event of noncompliance, the trial court [sic] shall authorize me to perform what the judgment orders at the expense of CONAVI, which shall also pay the damages caused by the defective performance. 5. That the defendants be ordered to pay the damages caused, both as to their existence and amount, as well as both categories of costs (ambas costas).

The damages caused were specified as follows: a) Environmental damage caused: This arises from the large volume of contaminated water and waste discharged [sic] from the culvert installed by CONAVI less than one hundred meters from the spring located on my property. It is more than evident that they violated the laws protecting nature in our country. The environmental damage consists of the destruction and contamination of the natural resource caused by the large quantities of sediment and garbage carried by the culvert toward the spring whose water is collected for human use: I estimate it, as a matter of reasonable discretion, at five million colones; b) Damage to the land caused by contamination and erosion: It is caused by the culvert installed by CONAVI, which discharges a large volume of rainwater and water collected from the public roadway onto my property and into the spring located there.

This problem has resulted in water containing sediment and garbage from the culvert being discharged into the spring. During the rainy season, the increase in collected water is significant, causing severe erosion on my land; it has even dug out [sic] the spring, making the water unfit for human consumption [sic]. It is estimated, as a matter of reasonable discretion, at ten million colones; c) Loss of appreciation or property value: The large volumes of stormwater and water collected from the public roadway that constantly flow through my property from the aforementioned culvert have created enormous holes and formed substantial channels, whose depth is conspicuous and evident. Water flows through my property so constantly that the land is extremely wet and unstable. My fear is greater when it rains because I am constantly concerned that the next powerful flow of water passing through my land will completely destroy the spring, carry away a large amount of soil from my property, and leave it entirely worthless.

My land is no longer the same; it used to be flat, very beautiful, full of vegetation, and possessed the great attraction of the spring, but the continuous flow of water from the culvert has progressively eroded and destroyed it, carving large channels throughout my property, to the point that I no longer know whether it has any economic value. I estimate it, as a matter of reasonable discretion, at ten million colones; d) Non-pecuniary damage (daño moral): Legal scholarship has also referred to it as incorporeal, non-economic, emotional, and so forth; it occurs when an individual’s sphere of non-economic interests is harmed. In my specific case, I claim it because the actions of CONAVI and the Estado have unjustly disturbed my emotional well-being, in that what has happened to my property causes me distress, discouragement, anguish, and emotional and psychological suffering from seeing the property that my father gave me through great effort, and which represents something very precious and invaluable, deteriorating because of the large volumes of water flowing from the culvert installed by CONAVI.

Even greater is the suffering caused by knowing that the spring used for human consumption is being completely damaged. This has become a source of tremendous frustration, helplessness, anxiety, unease, and disappointment for me because I know that I can do nothing to stop the enormous flow of water passing through my property and destroying everything in its path. I have even been prescribed treatment for the anxious depression—for the anxious depression—that I have suffered as a result of everything described above. It is estimated, as a matter of reasonable discretion, at ten million colones. 6. All damages identified in the preceding numbered paragraphs of the claim are estimated as a matter of reasonable discretion, without prejudice to the final valuation to be made by an expert in the field, and I expressly request that the defendant be ordered to pay the final amounts established in the expert report.

I further request that all amounts awarded in the judgment be indexed and paid, together with the corresponding interest.” 2.- CONAVI’s legal representative denied the allegations and raised the defenses (excepciones) of lack of standing to be sued on the merits (falta de legitimación ad causam pasiva) and failure to state a valid claim (falta de derecho); counsel also requested that the complaint be dismissed and that the plaintiff be ordered to pay costs. Counsel for the Estado likewise opposed the complaint and raised the defenses of lack of passive and active standing (falta de legitimación pasiva y activa), failure to state a valid claim, and the statute of limitations (prescripción), which was adjudicated at the preliminary hearing. Counsel requested that the complaint be denied, that the plaintiff be ordered to pay both categories of costs, and that interest on those costs be awarded until paid in full. 3.- The preliminary hearing was held on June 15, 2016.

The case-management judge did not address any of the preliminary defenses raised. 4.- The Tribunal Contencioso Administrativo y Civil de Hacienda, Fourth Section, composed of Judges Felipe Córdoba Ramírez, Judith Reyes Castillo, and Alexandra Zúñiga Mora, ruled in judgment no. 94-2018-IV, issued at 13:10 hours on October 16, 2018: “The statute-of-limitations defense raised by counsel for the Estado is denied. Because it is unnecessary, no ruling is issued on the failure-to-state-a-valid-claim defense raised by the Estado. Because it is unnecessary, no ruling is issued on the failure-to-state-a-valid-claim defense raised by the Estado. Insofar as María Isabel Umaña Chaverri directed the complaint against the Estado, the defense of lack of passive standing on the merits is granted and, consequently, the complaint is denied in all respects. The plaintiff is ordered to pay both categories of costs incurred by the Estado in this action, on which she must pay interest at the statutory rate, calculated from the date on which the ruling finally approving the assessment of those costs is entered until they are paid in full.

The defense of lack of active standing raised by counsel for the Consejo Nacional de Vialidad is denied. Insofar as María Isabel Umaña Chaverri directed the complaint against the Consejo Nacional de Vialidad, the failure-to-state-a-valid-claim defense is partially granted and shall, for all purposes, be deemed denied as to the relief awarded to the plaintiff. The Consejo Nacional de Vialidad is ordered to perform such work as is necessary, appropriate, and sufficient with respect to the stormwater drainage system on national route 317, considered as a whole, to ensure that the discharge of that water poses no risk of contaminating the spring located on the plaintiff’s property. It is granted a period of six months from the date this judgment becomes final to complete that work. The Consejo Nacional de Vialidad is ordered to pay both categories of costs to the plaintiff. In both instances, the amount of the costs shall be determined by the competent judge during the judgment-enforcement phase, upon application by the prevailing party.”.

II.The representatives of the Consejo Nacional de Vialidad (CONAVI) and the plaintiff’s special judicial attorney timely file appeals on points of law (recursos de casación) before this Chamber. In the appeal filed by the representatives of co-defendant CONAVI, the fifth ground alleges a violation of substantive rules through improper interpretation (pursuant to Article 138(a) of the CPCA), in connection with Article 12.2 of that same procedural code, Transitory Provision I of Ley no. 7798 (Ley de Creación del Consejo Nacional de Vialidad), Article 2 of Ley no. 3155 (Ley de Creación del Ministerio de Obras Públicas y Transportes), and Article 11 of Ley no. 9329 (Ley Especial para la transferencia de competencias y atención plena y exclusiva de la red cantonal). They argue that the judgment imposed relief solely against CONAVI, finding that the defense of lack of standing to be sued (falta de legitimación ad causam pasiva) applied to the State, which consequently prevailed insofar as the plaintiff was ordered to pay the costs of the proceedings in its favor.

They contend that, by imposing solely upon CONAVI an order to perform (condena de hacer) and payment of the costs of the plenary proceedings, the judgment overlooked the fact that CONAVI is a subordinate public entity belonging to the structure of the State (specifically, the Ministerio de Obras Públicas y Transportes); they state that CONAVI does not, by itself, have full standing to appear unless the superior public entity, represented by the Procuraduría General de la República, is also present. They add that the compulsory joinder (litis consorcio necesario) that required bringing the State into the dispute was justified under Article 12.2 of the CPCA, which mandates a form of joint representation with the Procuraduría General de la República because CONAVI does not possess full legal personality; nevertheless, Article 4 of Ley no. 7798, Ley de Creación del Consejo Nacional de Vialidad and its amendments, provided for the intersubjective transfer of ownership and exercise of specific and exclusive powers; however, the powers of direction, planning, coordination, and oversight were reserved to the State, in addition to the fact that, by express statutory provision, MOPT has powers of intervention over the national road network.

They contend that a lack of standing to be sued cannot apply so as to exempt the State from its responsibilities regarding the conduct that gave rise to this lawsuit and that, in the Tribunal’s view, may result in liability. The legal personality held by CONAVI allows certain acts to be attributed to it independently of the State, but only those related to the transferred powers. They add that the judgment determined that the culvert had been constructed by MOPT and, consequently, they consider it technically erroneous to enter an order against CONAVI. They contend that the ruling disregards and declines to apply legal rules governing the capacity and representation of bodies with instrumental legal personality, such as CONAVI, resulting in an order against the subordinate public body as though it were possible for that body to litigate in the administrative litigation jurisdiction without the State’s participation.

In their view, the reasoning and ruling on the merits set forth in the judgment are contradictory: “it partially granted the complaint; entered judgment against CONAVI; relieved the State from costs; and ordered the plaintiff to pay the State’s costs.” They add that the structure and limits of legal personality and representation fall within the legislature’s authority and that, in CONAVI’s case, the legislature provided that joint representation with the State would not be severed. They state that the Tribunal erroneously understood that, although the State was responsible for the conduct challenged by the plaintiff, its standing as a defendant was limited to the effects of the judgment, thereby excluding any possibility of linking the composite standing as defendant (State–Subordinate Public Entity) to the cause of action (causa petendi) that may have been proven or disproven in the plenary proceedings.

They consider the treatment of the superior public entity that was found responsible to be counterproductive; they cite decision no. 00031211-F-S1-2011. They assert that any obligation sought to be imposed must take into account that:

  • 1)CONAVI is a deconcentrated body that forms part of the structure of the State;
  • 2)responsibility for construction of the culvert lies with MOPT, which carried out the work; and
  • 3)MOPT holds powers of direction, planning, and oversight with respect to subordinate public entities, in addition to powers of intervention over the national road network. They allege improper application of Article 12.2 of the CPCA; they state that the judgment failed to recognize that MOPT retains responsibility for the execution of its works and their consequences, because that responsibility was not transferred to CONAVI pursuant to Transitory Provision no. I of Ley de Creación del CONAVI (Ley no. 7798). They contend that CONAVI should not be required to remedy or provide compensation for works constructed under MOPT’s administration and arising from MOPT’s own actions. They argue that the Tribunal erroneously ordered CONAVI to perform, believing that MOPT lacked the legal authority to do so, when it stated: “…The administration of these roads and their associated infrastructure is entrusted to the Consejo Nacional de Vialidad under its organic law, such that, from the outset, an obligation of this kind cannot legally be imposed upon the State….” They argue that the Tribunal overlooked the legislature’s amendment of the law creating MOPT (Ley no. 9329), which restored the following powers to it: “Article 2. The purpose of the Ministerio de Obras Públicas y Transportes is: a) Without prejudice to the powers of the Consejo Nacional de Vialidad, to plan, construct, maintain, and improve the highways and roads in the national road network.” They request that the judgment be quashed, that the appeal be granted, and that, should it be determined that work must indeed be performed within the right-of-way (derecho de vía), the resulting order to perform be imposed upon MOPT because it caused the event giving rise to liability, without CONAVI being required to assume that obligation.

PLAINTIFF’S APPEAL

III.Meanwhile, Master Jorge Méndez Zamora, in his capacity as special judicial attorney for María Isabel Umaña Chaverri (plaintiff), files an appeal on points of law, arguing in the third objection under the first ground that Article 193(b) of the Código Procesal Contencioso Administrativo was violated. Specifically, the judgment ordered the plaintiff to pay the costs of the proceedings in favor of the State even though sufficient grounds existed to litigate against it, since it was not known precisely which administrative body had constructed the culvert at issue in these proceedings; because the Consejo Nacional de Vialidad has existed only since 1998, it was deemed necessary to join the State (Ministerio de Obras Públicas y Transporte) in the litigation to prevent the court from being unable to issue a ruling on the merits due to improper joinder of the parties. As part of his argument, he cites Article 3 and Transitory Provision I of Ley de Creación del Consejo Nacional de Vialidad (CONAVI), Ley no. 7798, which entered into force on May 29, 1998.

He argues that, because CONAVI is an administrative body with instrumental legal personality (personalidad jurídica instrumental), the provisions of Article 12 of the Código Procesal Contencioso Administrativo were followed. He adds that the claims in the initial pleading were directed against the State (Ministerio de Obras Públicas y Transportes) in view of the provisions of Ley no. 3155, entitled “Crea el Ministerio de Transportes en sustitución del actual Ministerio de Obras Públicas,” which defined the following as one of that Ministry’s powers: “a) Without prejudice to the powers of the Consejo Nacional de Vialidad, to plan, construct, maintain, and improve the highways and roads of the national road network. To regulate and control the rights-of-way of existing or planned highways within that network. To regulate, control, and oversee traffic and transportation on public roads. To exercise supervision and technical leadership in matters of road infrastructure, by virtue of which it must advise and coordinate with local governments regarding the essential technical and logistical regulations concerning the proper functionality of the cantonal road network, considered separately and in conjunction with the national road network.” It was deemed appropriate, in defense of the plaintiff’s interests, to direct her claims against both MOPT (the State) and CONAVI, since both share powers over the same matters; moreover, although the latter body possesses instrumental legal personality, it remains attached to the Ministerio de Obras Públicas y Transportes.

He therefore states that sufficient grounds for litigation existed, which, he asserts, must be understood in light of the administrative relationship between the defendant administrative bodies and the statutory powers they share; accordingly, he contends that an award of costs in favor of the State is unwarranted. The third objection under the fourth ground challenges the “violation of the constitutional principles of reasonableness and proportionality arising from the order requiring the plaintiff to pay costs in favor of the State.” He states that the judgment under appeal ordered the plaintiff to pay costs in favor of the State (Ministerio de Obras Públicas y Transportes), even though the defendant administrative authorities are connected to the administrative operations alleged to have caused the damage to the plaintiff’s land. He adds that, because they are administrative bodies with similar and closely related statutory powers, he deemed their joinder in the litigation appropriate so as to place the adjudicator in a position to grant the claims asserted in the initial pleading.

Furthermore, the Consejo Nacional de Vialidad is an administrative body with instrumental legal personality attached to the Ministerio de Obras Públicas y Transportes; in that regard, the Código Procesal Contencioso Administrativo provides that, in cases involving bodies of this kind, the body to which they are attached must also be deemed a defendant, interpreted in accordance with the principles of reasonableness and proportionality. Based on the foregoing, he asserts that there were sufficient grounds to litigate against the defendant administrative authorities for the purpose of defending her subjective rights (derechos subjetivos) and legitimate interest (interés legítimo), in accordance with the legal interests protected by the administrative litigation jurisdiction. He contends that the decision does not reflect an interpretation of Article 193 of the CPCA consistent with the body of constitutional law (bloque de constitucionalidad).

Appeal on points of law for substantive violations

IV.First. CONAVI (in the fifth ground of its appeal) alleges a direct violation, due to failure to apply, Transitory Provision I of Ley no. 7798 (Ley no. Law Creating the Consejo Nacional de Vialidad); Article 2(a) of Ley no. 3155, “Law Creating the Ministerio de Obras Públicas y Transportes”; and Article 11 of Ley no. 9329 (Special Law for the Transfer of Powers: Full and Exclusive Responsibility for the Cantonal Road Network). This is because only CONAVI was ordered to take action and to pay the litigation costs (costas) of the plenary proceeding, disregarding the fact that CONAVI is a lesser public entity (sic) belonging to the structure of the State, specifically to the Ministerio de Obras Públicas y Transporte; it does not, by itself, have full standing (legitimación plena) to participate in these proceedings unless the greater public entity, represented by the Procuraduría General de la República, is also present.

This entailed the obligation to join the State in the dispute, in compliance with section 12.2 of the Código Procesal Contencioso Administrativo, which imposes a joint-representation arrangement. It is argued that the legal personality of the Consejo Nacional de Vialidad is not plenary, since the Legislature reserved to the State the powers of direction, planning, coordination, and oversight; moreover, by express provision of law, MOPT has powers to intervene in the national road network. Therefore, they challenge the judgment for finding that the State lacked passive standing on the merits (legitimación ad causam pasiva) and exempting it from liability for the conduct that prompted the filing of this action (construction of the culvert along the northern boundary of the plaintiff’s property, which discharges stormwater from national route 317), although, according to the judgment, such conduct may give rise to administrative liability (responsabilidad administrativa).

Moreover, given the legal personality held by CONAVI, only acts relating to the transferred authority may be attributed to it independently of the State; in this specific case, according to the Judgment, it was determined that the culvert had been built by MOPT. It was therefore technically erroneous to order CONAVI alone to perform the works and pay costs when it was not responsible. In appealed judgment no. 94-2018-IV of 13:10 hours on 16 October 2018, the Tribunal Contencioso ruled in recital X, entitled “Regarding the defenses asserted: 2. Regarding the defenses of lack of active and passive standing”: “This Tribunal considers that the defense must be rejected insofar as it was asserted by CONAVI’s representative. From the claimant’s perspective, it is clear that her property borders to the north on a national route from which stormwater is discharged into the plaintiff’s property and which is currently under the administration of that administrative organization.

This places the plaintiff and defendant in a legal relationship arising from the existence of a statutory easement (servidumbre legal), even if that relationship concerns public-domain property from an environmental standpoint; therefore, the action has been properly brought against this defendant. It must be borne in mind that, when CONAVI was created pursuant to its enabling law, a transitory provision stipulated that all rights and obligations undertaken by the Ministerio de Obras Públicas y Transportes, arising from works, supply, service, and any other contracts connected with the objectives of the Consejo Nacional de Vialidad, would become part of its assets. Furthermore, this does not constitute procedural succession (sucesión procesal), since it refers only to the exercise of the functions that had previously fallen to the Ministry for the administration of national routes. Thus, although the road may have been built by the Ministry, including the possible placement at the site in question of the culvert at issue here, the fact remains that, with respect to the portions of this action that have been granted, that Ministry lacks legal authority to carry out what is being ordered.

This required denial of the relief sought against the State because the State lacked standing on the merits to be sued. As a necessary logical consequence, this entails dismissing the action in all respects insofar as it was brought against the State.” Meanwhile, point 3, entitled “Regarding costs,” provided: “…Insofar as the action was brought against the State, the State was the prevailing party; therefore, for the same reasons, the plaintiff is ordered to pay, in its favor, both categories of costs incurred as a result of these proceedings. As requested by the State’s representative, on the amount of costs ultimately established in their assessment, the plaintiff shall pay interest at the statutory rate, calculated from the date the ruling approving that assessment becomes final until actual payment…”.

V.This Chamber considers that the Tribunal Contencioso failed to apply Article 12(2) of the Código Procesal Contencioso Administrativo, which provides that “the following shall be deemed defendants (…) 2) Administrative bodies with instrumental legal personality (personalidad jurídica instrumental), insofar as they are the authors of the administrative conduct at issue in the proceeding, jointly with the State or entity to which they are attached” (the bold type does not appear in the original). The requirement of complete mandatory joinder of defendants (litis consorcio pasivo necesario completo) between the decentralized body with instrumental legal personality and the State has been affirmed in decisions such as 000840-F-S1-2016 of 9 hours 50 minutes on 11 August 2016, which stated, insofar as relevant: “Following the recent line of decisions of this Chamber (judgment no. 000293-F-S1-2016 of 9 hours 40 minutes on 7 April 2016), it must be stated that, after further examination of the issue of the liability of bodies with instrumental legal personality, it has concluded that, in such circumstances, the proper course is to impose subsidiary liability (responsabilidad subsidiaria) on either the State or the entity to which they are attached, for the reasons set forth below.

It should be recalled that the assignment of instrumental juridical personality (personería jurídica instrumental) to certain bodies originated in the need to alleviate, to some extent, the operational deficiencies of the Central Government and decentralized entities. Undoubtedly, its purpose is to enable them to administer their own budgets, enter into their own contracts, and, to a large extent, simplify the system for appointing their officials. Accordingly, compared with the traditional Public Administration, this provided them with flexibility and equipped them with optimal management tools. Thus, bodies with instrumental legal personality are created to facilitate their operation, avoid controls, and simplify requirements. Nevertheless, it must not be overlooked that they remain attached to a Ministry or greater entity and subject to directives and instructions. Consequently, it is clear that those attached to a Ministry form an integral part of a broader whole, namely the Central Administration or State Apparatus, which remains a single entity (unity of the State, Administration as the greater entity).

Those attached to a decentralized entity likewise remain part of that entity. Consequently, in matters of liability, it is neither appropriate nor legally viable to exonerate the State or decentralized entity completely because, as stated, it was that entity that created such bodies to facilitate their operation, but they do not thereby cease to be part of the broader whole comprising the Central Administration or decentralized entity. Likewise, it is not feasible to disregard citizens’ right to full compensation (Article 41 of the Constitución Política) to such an extent that this right would be adversely affected because the body lacks budgetary funds or has ceased to exist. In this way, it is clear that the person subject to the Administration (administrado) will have a broader sphere of protection and safeguards regarding claims for the losses sustained. The foregoing is consistent with sections 9 of the Carta Magna, which establishes that the Government of the Republic is liable, and 161(1)(b) of the CPCA, the source of the subsidiary liability discussed above.” In this specific case, based on the foregoing, instead of finding that the State lacked standing on the merits, it must be held subsidiarily liable with the Consejo Nacional de Vialidad for performing the works that, under the challenged judgment, the Consejo Nacional de Vialidad (CONAVI) must carry out, and it must be ordered subsidiarily to pay costs in favor of the plaintiff.

Consequently, the ground must be sustained and, ruling on the merits, the fifth ground of CONAVI’s appeal is granted. The challenged judgment shall be partially vacated insofar as it sustained the defense that the State lacked passive standing on the merits and dismissed the action in all respects, as well as insofar as it ordered the plaintiff to pay costs to the State, together with interest at the statutory rate on that amount.

VI.Second. Plaintiff (first ground, third section, and fourth ground, third section, of her appeal). In the third objection under the first ground, the judgment is challenged for ordering the plaintiff to pay the costs of the proceeding in favor of the State, since it is argued that there were sufficient grounds to litigate against it, given that the precise administrative body that had built the culvert at issue in these proceedings was unknown. Likewise, in the third objection under the fourth ground, disagreement is expressed on the basis of a violation of the constitutional principles of reasonableness and proportionality, due to the decision ordering the plaintiff to pay costs and interest thereon. In accordance with the ruling in the preceding recital, which sustains the fifth ground of the appeal filed by CONAVI, both grounds asserted by the plaintiff are sustained for the same reasons and, consequently, the challenged judgment is partially vacated.

Por tanto:

The fifth ground of the cassation appeal (recurso de casación) filed by the Consejo Nacional de Vialidad is granted. The first ground, third section, and the fourth ground, third section, of the appeal filed by the plaintiff are granted. The challenged judgment is partially vacated. Ruling on the merits, the State is held subsidiarily liable with the Consejo Nacional de Vialidad for performing the works that the Consejo Nacional de Vialidad (CONAVI) must carry out and for subsidiarily assuming the award of costs in favor of the plaintiff.

En el Proceso de conocimiento, interpuesto por María Isabel Umaña Chaverri, representado por su apoderado especial judicial, Jorge Méndez Zamora, abogado, portador del carné del Colegio de Abogados número 7788, contra el CONSEJO NACIONAL DE VIALIDAD (CONAVI), representado por sus apoderados especiales judiciales, Olga Martha Fallas Ramírez y Óscar Eduardo Romero Aguilar, ambos abogados, portadores del carné del Colegio de Abogados números 14160 y 18889, respectivamente y el ESTADO, representando por la señora Procuradora Guiselle Jiménez Gómez, abogada, portadora de la cédula de identidad número 1-0898-0817. Formulan recurso de casación la representación del codemandado Consejo Nacional de Vialidad (COSEVI) y el representante de la parte actora, impugnando la sentencia número 94-2018-IV, emitida por la Sección Cuarta del Tribunal Contencioso Administrativo y Civil de Hacienda a las 13 horas del 16 de octubre de 2018.

CONSIDERANDO

I. 1.- La parte actora formula proceso de conocimiento ante el Tribunal Contencioso Administrativo y Civil de Hacienda, peticionando en la demanda y según se establecido en la audiencia preliminar: “1. Solicito se declare con lugar en todos sus extremos el presente proceso de conocimiento común. En consecuencia, se declarará la disconformidad de la conducta del CONAVI y de El (sic) Estado con el ordenamiento jurídico, al haber construido un paso de alcantarilla dentro de un área protegida y dirigir su causa hacia una naciente de agua de consumo humano. 2. Que se condene al Consejo Nacional de Vialidad, CONAVI, y al Estado a eliminar o cambiar de ubicación la alcantarilla que desfoga el agua pluvial a través de la propiedad de la suscrita impactando y contaminando la naciente de aguas, de modo que en lo sucesivo no afecte el inmueble de mi propiedad ni la naciente de agua. Lo anterior, dentro del plazo judicial de un mes a contar de la firmeza de la sentencia.

Si no cumpliere, el Tribunal de sentencia (sic) autorizará a la suscrita para que haga lo que ordena el fallo, por cuenta del CONAVI y el Estado, quien deberá, además, pagar los daños y perjuicios ocasionados. Si lo hiciere de modo distinto a lo ordenado, se destruirá lo hecho y se cumplirá lo ordenado, en cuyo caso estará a cargo del CONAVI todos los gastos y daños y perjuicios ocasionados por la Mala Ejecución. 3. En caso de no resultar posible eliminar o reubicar la alcantarilla, se les condenará a realizar las obras de mitigación, así como el manejo y conservación de suelos que resulten necesarias, como gaviones o cualquiera otra técnica y las mejores prácticas recomienden, para que las aguas no ingresen a mí propiedad, sino que discurran a la quebrada o riachuelo que se ubique de forma de la forma (sic) más cercana posible pero fuera de mi inmueble, lo anterior, dentro del plazo judicial de un mes a contar de la firmeza de la sentencia.

Si no cumpliera, el Tribunal de sentencia (sic) autorizará a la suscrita para que haga lo que ordena el fallo, por cuenta de CONAVI y el Estado, quien deberá además pagar los daños y perjuicios ocasionados. Si lo hiciere de modo distinto al ordenado, se destruirá lo hecho y se cumplirá lo ordenado, en cuyo caso estarán a cargo de CONAVI todos los gastos y daños y perjuicios ocasionados por la mala gestión. 4. Que se ordene al CONAVI y al Estado reparar totalmente el daño ambiental y de erosión causado a mi propiedad y a la naciente de aguas, dentro del plazo judicial de un mes a contar de la firmeza de la sentencia. Si no cumpliera, el tribunal de sentencia (sic) autorizará a la suscrita para que haga lo que ordena el fallo, por cuenta del CONAVI, quien deberá además pagar los daños y perjuicios ocasionados por la mala ejecución. 5. Que se ordene a las demandadas al pago de daños y perjuicios ocasionados, tanto en su existencia y cuantía, así como al pago de ambas costas.

Los daños y perjuicios causados los concretó de la siguiente manera: a) Daño ambiental causado: Se origina por la gran cantidad de agua contaminada y desechos que desfoga (sic) desde la alcantarilla colocada por CONAVI a menos de cien metros del naciente de agua que existe en mi propiedad. Donde es más que evidente que violentaron las normas legales que protegen la naturaleza en nuestro país. El daño ambiental consiste en la destrucción y contaminación del recurso natural, producto de las grandes cantidades de sedimentos y basura que arrastra la alcantarilla hacia el (sic) naciente de agua captada para uso humano: lo estimo prudencialmente en la suma de cinco millones de colones; b) Daño provocado en el terreno por contaminación y erosión: Es generado por la alcantarilla colocada por el CONAVI que desemboca gran cantidad de agua llovida y la colectada en vía pública hacia mi propiedad y al naciente de agua que existe dentro de ella.

Esta problemática ha generado que por la cantidad de agua que proviene de la alcantarilla con sedimentos y basura sean desfogados en el naciente de agua. Y en temporada de invierno el aumento de agua colectada es significante lo que produce gran erosión en mi terreno, incluso ha cabado (sic) naciente, lo que provoca se haga imposible el consumo de agua humano (sic). Se estima prudencialmente en la suma de diez millones de colones; c) Pérdida de plusvalía o valor del inmueble: Debido a las grandes cantidades de agua pluvial y la recolectada de la vía pública que constantemente pasan por mi propiedad provenientes de la alcantarilla citada, ha producido huecos gigantes y formados canales de importancia, siendo sobresaliente y notoria la profundidad que han tomado esos canales. Es tan constante el paso de agua por mi propiedad que el terreno se encuentra extremadamente húmedo e inestable. Es mayor el temor cuando llueve porque me genera una preocupación permanente que con la próxima corriente de agua fuerte que pase por mí terreno termine de destruir la naciente y arrastre gran cantidad de material del suelo de mi propiedad y lo deje sin valor alguno.

Ya mi terreno no es el mismo, antes era plano, muy bonito, llego de vegetación y con la gran atracción como lo es el naciente, pero con el paso permanente de esas aguas que provienen de la alcantarilla se ha venido erosionando, destruyendo con grandes canales por toda mi propiedad que ya no se sí tiene algún valor económico. Lo estimo prudencialmente en la suma de diez millones de colones; d) Daño moral: También se ha llamado en doctrina como incorporal, extrapatrimonial, de afección, etc.; y se verifica cuando se lesiona la esfera de interés extrapatrimonial del individuo. En mi caso concreto lo reclamo en vista de que la acción de CONAVI y el Estado me perturba de una manera injusta en mis condiciones anímicas, las cuales traduzco en que este hecho que afecta mi propiedad me genera disgusto, desánimo, angustia, padecimiento emocional y psicológico de ver que la propiedad la cual con mucho esfuerzo mi padre me donó y que representa algo muy preciado e invaluable, se está deteriorando por las grandes cantidades de agua que discurren producto de la alcantarilla colocada por el CONAVI y aún más es el sufrimiento de saber que el naciente para el consumo humano se está dañando completamente.

Esto se convierte para mi persona en una gran frustración, impotencia, ansiedad, intranquilidad y desilusión al saber que no puedo hacer nada que detenga esa corriente gigantesca de agua que pasa por mi propiedad y destruye todo a su paso. Incluso se me ha medicado algún tratamiento para la depresión-ansiosa para la depresión- ansiosa que he sufrido producto de todo lo narrado anteriormente. Se estima prudencial ente es la suma de diez millones de colones. 6. La estimación de todos los daños y perjuicios indicados en los numerales anteriores de la pretensión procesal se realiza de forma prudencial, sin perjuicio de la valoración definitiva que hará el perito experto en la materia, a cuyos extremos finales fijados en la pericia expresamente solicito que sea condenada la parte demandada. Además, solicito que todos los montos que sean reconocidos en sentencia se indexen y se paguen, así como los intereses respectivos.” 2.- El representante legal del CONAVI contestó negativamente e interpuso las excepciones de falta de legitimación ad causam pasiva y falta de derecho; asimismo, solicitó se rechace la demanda y condene a la actora al pago de costas.

Por su parte, la representación del Estado del mismo modo se opuso a la demanda e interpuso las defensas de falta de legitimación pasiva y activa, y falta de derecho, así como de prescripción resuelta en la audiencia preliminar. Peticionó, se declare sin lugar la demanda y condene a la actora al pago de ambas costas y reconozca intereses sobre las mismas y hasta su cancelación. 3.- La audiencia preliminar se realizó el 15 de junio de 2016. La jueza tramitadora no se refirió a ninguna de las excepciones previas interpuestas. 4.- El Tribunal Contencioso Administrativo y Civil de Hacienda, Sección Cuarta, integrado por los jueces Felipe Córdoba Ramírez, Judith Reyes Castillo y Alexandra Zúñiga Mora, mediante sentencia no. 94-2018-IV de las 13:10 horas del 16 de octubre de 2018, resolvió: “Se rechaza la excepción de prescripción interpuesta por la representación del Estado. Por innecesario se omite pronunciamiento sobre la excepción de falta de derecho interpuesta por el Estado.

Por innecesario se omite pronunciamiento sobre la excepción de falta de derecho interpuesta por el Estado. En lo que la demanda se dirigió por parte de la señora María Isabel Umaña Chaverri en contra del Estado, se acoge la excepción de falta de legitimación pasiva en la causa y en consecuencia, se declara sin lugar la demanda en todos sus extremos. Se condena a la actora al pago en favor del Estado de ambas costas de la presente acción, sobre las que deberá reconocer intereses al tipo legal, que se habrán de computar a partir del fallo que apruebe en firme tal liquidación y hasta su efectivo pago. Se rechaza la excepción de falta de legitimación activa interpuesta por la representación del Consejo Nacional de Vialidad. En lo que la demanda se dirigió en contra del Consejo Nacional de Vialidad por parte de la señora María Isabel Umaña Chaverri, se acoge parcialmente la excepción de falta de derecho, debiéndose entender para todos los efectos en rechazada en lo concedido a la actora.

Se ordena al Consejo Nacional de Vialidad ejecutar las obras que resulten necesarias, idóneas y suficientes en función del sistema de evacuación de aguas pluviales existente sobre la ruta nacional 317 entendido integralmente, para garantizar que producto del desfogue de esas aguas no exista peligro de contaminación de la naciente existente en la propiedad de la actora, para lo que se le concede el plazo de seis meses contados a partir de la firmeza del presente fallo. Se condena al Consejo Nacional de Vialidad al pago de ambas costas en favor de la actora. La determinación de lo correspondiente a las costas en cuanto a su importe en ambos casos se habrá de definir por el juez competente en la fase de ejecución de sentencia a ruego de la parte vencedora.”.

II.Ante esta Cámara formulan en tiempo recurso de casación los representantes del Consejo Nacional de Vialidad (CONAVI) y el apoderado especial judicial de la parte actora. En el recurso planteado por los representantes de la codemandada CONAVI, se arguye en el quinto cargo, violación de normas sustantivas, por indebida interpretación (de conformidad con el artículo 138 inciso a) del CPCA), relacionándolo con los ordinales 12.2 de ese mismo cuerpo procesal, transitorio I de la Ley no. 7798 (Ley de Creación del Consejo Nacional de Vialidad), artículo 2 de la Ley no. 3155 (Ley de Creación del Ministerio de Obras Públicas y Transportes); artículo 11 de la Ley no. 9329 (Ley Especial para la transferencia de competencias y atención plena y exclusiva de la red cantonal). Arguyen, la sentencia impone una condena únicamente al CONAVI, estimando, operante la excepción de falta de legitimación ad causam pasiva al Estado, resultando en consecuencia victorioso, en tanto condenó a la parte actora al pago de las costas del proceso a su favor.

Estiman, al imponerse únicamente al CONAVI una condena de hacer y pago de las costas del proceso plenario, se obvió que el CONAVI es un ente público menor que pertenece a la estructura del Estado (específicamente al Ministerio de Obras Públicas y Transportes); señalan, el CONAVI, por sí mismo no ostenta legitimación plena para actuar, si no se encuentra el ente público mayor, representado por la Procuraduría General de la República. Agregan, el litis consorcio necesario que implicó la obligación de traer al Estado a la contienda se justificó en el artículo 12.2 del CPCA, que impone una fórmula de representación compuesta con la Procuraduría General de la República, por cuanto, la personalidad jurídica del CONAVI no es plena; no obstante, el artículo 4 de la Ley no. 7798, Ley de Creación del Consejo Nacional de Vialidad y sus reformas dispuso la transferencia inter subjetiva de la titularidad y ejercicio de competencias específicas y exclusivas; no obstante, se reservó para el Estado las potestades de dirección, planificación, coordinación y control; aunado, a que por disposición expresa de ley; el MOPT posee potestades de intervención en la red vial nacional.

Consideran, no podría ser aplicable una falta de legitimación ad causam pasiva y eximir de sus responsabilidades en la conducta que ocasionó esta demanda; que a criterio del Tribunal puede causar responsabilidad. La personalidad jurídica que ostenta el CONAVI permite imputarle determinados actos con independencia del Estado, pero únicamente los relacionados con la competencia transferida. Agregan, la sentencia determinó que la construcción de la alcantarilla fue obra del MOPT, en consecuencia, estiman técnicamente errado ordenar una condena contra el CONAVI. Consideran, el fallo desvincula y desaplica normas jurídicas relativas a la capacidad y representación de los órganos con personalidad jurídica instrumental como el CONAVI, con la consecuente condena contra el órgano público menor, como si fuera posible, que pueda litigar en la jurisdicción contencioso administrativa sin la participación del Estado.

A su criterio, los razonamientos y la decisión de fondo esbozados en la sentencia resultan contradictorios: “declaró parcialmente con lugar la demanda; condenó al CONAVI; exoneró de costas al Estado y condenó a la parte actora a pagarle costas al Estado”. Agregan, el diseño y límites de la personalidad jurídica y la representación es una potestad del legislador que dispuso en el caso del CONAVI no se rompiera representación conjunta con el Estado. Señalan, el Tribunal entendió erróneamente que, aunque el Estado fue el autor de la conducta que la parte accionante reclamó, ostenta una legitimación pasiva que se la circunscribe a los efectos de la sentencia, excluyendo cualquier posibilidad de vincular la legitimación pasiva compuesta (Estado-Ente Público Menor), con la causa petendí que hubiera sido probada o desvirtuada en el plenario. Consideran, contraproducente relación del ente público mayor que resulto responsable; citan el voto no. 00031211-F-S1-2011. Aseguran, cualquier obligación que pretenda imponerse debe tomar en cuenta:

  • 1)El CONAVI es un Órgano desconcentrado que forma parte de la estructura del Estado;
  • 2)La responsabilidad en la construcción de la alcantarilla, es una obra del MOPT;
  • 3)MOPT ostenta potestades de dirección, planificación y control respecto de los entes públicos menores; aunado, a las potestades de intervención sobre la red vial nacional. Acusan, indebida aplicación del artículo 12.2 del CPCA; señalan se inobservó que el MOPT mantiene su responsabilidad por la ejecución de sus obras, así como de sus consecuencias, en tanto, no fue trasladado al CONAVI esa responsabilidad, de conformidad con el transitorio no. I de la Ley de Creación del CONAVI (Ley no. 7798). Consideran, el CONAVI no debe corregir e indemnizar por obras construidas bajo la administración del MOPT y derivadas de sus propias actuaciones. Argumentan, el Tribunal de manera equivocada condena al CONAVI a hacer; creyendo que el MOPT no tiene competencia legal para hacerlo, al señalar: “…La administración de estas vías y la infraestructura que comprenden se encuentran en manos del Consejo Nacional de Vialidad según su ley orgánica, de modo que de entrada una imposición de este tipo no puede ser jurídicamente endosada al Estado…”. Arguyen, el Tribunal obvia que el legislador reformó la ley de creación del MOPT (Ley no. 9329), regresándole las siguientes facultades: “Artículo 2. El Ministerio de Obras Públicas y Transportes tiene por objeto: a) Sin perjuicio de las potestades del Consejo Nacional de Vialidad, planificar, construir, mantener y mejorar las carreteras y caminos en la red vial nacional”. Peticionan, se case la sentencia, se declare con lugar el recurso, y en el caso que se determine que sí se deben ejecutar obras en el derecho de vía, dicha condena de hacer recaiga en el MOPT, por haber sido el causante del hecho generador de responsabilidad, sin que deban ser asumidas por el CONAVI.

RECURSO PARTE ACTORA

III.Entretanto, el Master Jorge Méndez Zamora, en su condición de apoderado especial judicial de la señora María Isabel Umaña Chaverri (actora), formula recurso de casación, argumentando en el primer cargo, tercer reproche, violación del artículo 193 inciso b) del Código Procesal Contencioso Administrativo. En tanto, la sentencia condenó a la actora al pago de las costas del proceso a favor del Estado, cuando se dan motivos bastantes para litigar contra éste; al no conocerse con exactitud cual órgano administrativo había construido la alcantarilla que ha sido objeto de este proceso; siendo que el Consejo Nacional de Vialidad, existe a partir de 1998, se consideró necesario integrar la litis al Estado (Ministerio de Obras Públicas y Transporte, para evitar que el pronunciamiento de fondo no se pudiere dictar, por no haberse integrado la litis correctamente. Cita, como parte de su argumentación el numeral 3 y el Transitorio I, de la Ley de Creación del Consejo Nacional de Vialidad (CONAVI), Ley no. 7798, que entró en vigencia el 29 de mayo de 1998.

Arguye, en consideración que el CONAVI constituye un Órgano Administrativo con personalidad jurídica instrumental, se siguió lo establecido en el numeral 12 del Código Procesal Contencioso Administrativo. Agrega, las pretensiones del escrito inicial, se dirigieron contra el Estado (Ministerio de Obras Públicas y Transportes) en consideración con lo dispuesto en la ley no. 3155 denominada: “Crea el Ministerio de Transportes en sustitución del actual Ministerio de Obras Públicas” y que definió como una competencia de dicho Ministerio: “a) Sin perjuicio de las potestades del Consejo Nacional de Vialidad, planificar, construir, mantener y mejorar las carreteras y caminos de la red vial nacional. Regular y controlar los derechos de las vías de las carreteras de dicha red existentes o en proyecto. Regular, controlar y vigilar el tránsito y el transporte por los caminos públicos. Ejercer la fiscalización y la rectoría técnica en materia de infraestructura vial, en virtud de lo cual debe asesorar y coordinar, con los gobiernos locales, sobre las regulaciones técnicas y logísticas indispensables que atañen a la adecuada funcionalidad de la red vial cantonal, considerada por separado y en integración con la red vial nacional”.

Se consideró pertinente para la defensa de los intereses de la parte actora, dirigir sus pretensiones tanto contra el MOPT (el Estado) como contra el CONAVI, puesto que ambos comparten competencias sobre las mismas materias; y este último órgano posee personalidad jurídica instrumental, no obstante, continúa estando adscrito al Ministerio de Obras Públicas y Transportes. Por lo que refiere, existió suficiente motivo para litigar, lo cual afirma debe entenderse desde la relación administrativa que poseen los órganos administrativos accionados y las competencias legales que comparten; de forma que estima no procede la condenatoria en costas a favor del Estado. Se impugna en el cuarto cargo tercer reproche: “violación a los principios constitucionales de razonabilidad y proporcionalidad, al condenarse a la actora al pago de las costas a favor del Estado”. Indica, en la sentencia recurrida se condenó a la accionante al pago de las costas en favor del Estado (Ministerio de Obras Públicas y Transportes), a pesar de que las administraciones accionadas se encuentran vinculadas con el funcionamiento administrativo que se achaca como productor del daño en el terreno de la actora.

Agrega, por tratarse de órganos administrativos con competencias jurídicas similares e íntimamente relacionadas, estimó pertinente su integración en la litis para colocar al juzgador en la posición de poder conceder las pretensiones esgrimidas en el escrito inicial. Además, el Consejo Nacional de Vialidad, es un Órgano administrativo con personalidad jurídica instrumental, adscrito al Ministerio de Obras Públicas y Transportes, en tal sentido el Código Procesal Contencioso Administrativo, establece en órganos de esta clase, se debe considerar demandado el órgano al cual se encuentra adscrito; lo anterior, interpretándolo con los principios de razonabilidad y proporcionalidad. Por lo anterior, asegura se actuó con suficiente motivo para litigar contra las administraciones accionadas, teniendo como cometido la defensa de sus derechos subjetivos e interés legítimo de conformidad con los bienes jurídicos tutelados por la jurisdicción contencioso administrativa. Estima, lo resuelto, no corresponde a una interpretación conforme al bloque de constitucionalidad del numeral 193 del CPCA.

Casación por violaciones sustantivas

IV.Primero. CONAVI (en el cargo quinto de su recurso) reprocha violación directa, por falta de aplicación, del transitorio I de la Ley no. 7798 (Ley no. Ley de Creación del Consejo Nacional de Vialidad); artículo 2 inciso a) de la Ley no. 3155 “Ley de Creación del Ministerio de Obras Públicas y Transportes”, artículo 11 de la Ley no. 9329 (Ley Especial para la Transferencia de Competencias: Atención Plena y Exclusiva de la Red Vial Cantonal). Lo anterior, por imponerse únicamente al CONAVI una condena de hacer y al pago de las costas del proceso plenario, obviándose, el hecho de que el CONAVI es un ente público menor (sic) que pertenece a la estructura del Estado, específicamente al Ministerio de Obras Públicas y Transporte; no ostentando, por sí mismo legitimación plena para actuar en este proceso, sino se encuentra el ente público mayor, representado por la Procuraduría General de la República; lo que implicó, la obligación de traer al Estado a la contienda, en cumplimiento del ordinal 12.2 del Código Procesal Contencioso Administrativo, que impone una fórmula de representación conjunta.

Se arguye, que la personalidad jurídica del Consejo Nacional de Vialidad no es plena, en tanto, el Legislador reservó al Estado, las potestades de dirección, planificación, coordinación y control; aunado, a que por disposición expresa de Ley; el MOPT tiene potestades de intervención en la red vial nacional. Por lo tanto, cuestionan el fallo, al aplicar una falta de legitimación ad causam pasiva al Estado y eximirlo de responsabilidad en la conducta que ocasionó la presentación de esta demanda (construcción de la alcantarilla en el lindero norte de la propiedad de la actora, que desfoga aguas pluviales de la ruta nacional 317); en tanto, a criterio del fallo, puede causar una responsabilidad administrativa. Aunado, a que de acuerdo a la personalidad jurídica que ostenta el CONAVI, únicamente se le pueden imputar actos con independencia del Estado relacionados con la competencia transferida, que, en el caso concreto, de acuerdo con la Sentencia, se determinó que la alcantarilla fue construida por el MOPT, resultando técnicamente errado ordenar solamente al CONAVI la realización de obras y la condena en costas, cuando no fue el responsable.

En la sentencia recurrida no. 94-2018-IV de las 13:10 horas del 16 de octubre de 2018, el Tribunal Contencioso, en el considerando X, denominado: “Sobre las excepciones interpuestas 2. Sobre las excepciones de falta de legitimación activa y pasiva”, resolvió: “Considera este Tribunal que la excepción debe rechazarse en lo que fue interpuesta por la representación del CONAVI. Desde la perspectiva de la accionante, es claro que su propiedad colinda al norte con una ruta nacional de la que son desfogadas aguas pluviales al interior de la propiedad de la actora y hoy se encuentran en administración de esa organización administrativa, lo que vincula a la actora y demandada en relación jurídica a partir de la existencia de una servidumbre legal, aún y si lo es en relación a bienes del dominio público en un plano ambiental, por lo que la demanda se encuentra adecuadamente dirigida en contra de esta parte demandada.

Debe tenerse en cuenta, que con la creación del CONAVI conforme su ley constitutiva, en efecto se dispuso como disposición transitoria que todos los derechos y las obligaciones contraídos por el Ministerio de Obras Públicas y Transportes, derivados de contratos de obra, suministros y servicios y cualquier otro, vinculados con los objetivos del Consejo Nacional de Vialidad, pasarán a ser parte de su patrimonio. Esto por demás no constituye una sucesión procesal, siendo que solo refiere al ejercicio de las funciones que previamente recaían en el Ministerio para la administración de las rutas nacionales. Luego y pese a que posiblemente la carretera fue construida por el Ministerio, incluyendo la posible ubicación de la alcantarilla que nos ocupa en el sitio de interés, es lo cierto que en lo que la presente demanda se ha declarado con lugar, dicho Ministerio carece de competencias legales para realizar lo que se encuentra siendo ordenado, lo que impuso el rechazo de lo concedido en lo que se peticionó en contra del Estado con causa en que medió una falta de legitimación en la causa para accionar en su contra.

Esto implica como consecuencia lógica necesaria, declarar sin lugar la demanda en todos sus extremos en lo que se dirigió en contra del Estado”. Entretanto en el punto 3, denominado: “Sobre las costas”, se dispuso: “…En lo que la demanda se dirigió en contra del Estado, la parte vencedora la ha sido este, por lo que con causa en las mismas razones, se condena a la actora al pago en su favor, de ambas costas generadas con causa en la tramitación del presente proceso. Habiéndolo solicitado así la representación del Estado, sobre el importe correspondiente a las costas que se llegue a probar en su liquidación, deberá la actora reconocer intereses al tipo legal, que se habrán de computar a partir del fallo que apruebe en firme tal liquidación y hasta su efectivo pago…”.

V.Considera esta Cámara, que el Tribunal Contencioso omitió aplicar lo dispuesto en el inciso 2) del artículo 12 del Código Procesal Contencioso Administrativo, norma según la cual, “se considerará parte demandada (…) 2) Los órganos administrativos con personalidad jurídica instrumental, en tanto sean autores de la conducta administrativa objeto del proceso, conjuntamente con el Estado o ente al que se encuentren adscritos” (la letra negrita no está así en el original). La exigencia de un litis consorcio pasivo necesario completo entre el órgano desconcentrado con personalidad instrumental y el Estado ha sido afirmada en resoluciones como la 000840-F-S1-2016 de 9 horas 50 minutos del 11 de agosto de 2016, en la cual, en lo que interesa, señaló: “Siguiendo la línea reciente de esta Sala (sentencia no. 000293-F-S1-2016 de las 9 horas 40 minutos del 7 de abril de 2016), ha de indicarse, luego de un nuevo estudio del tema de la responsabilidad de los órganos con personalidad jurídica instrumental ha estimado, en tales supuestos, lo procedente es condenar subsidiariamente ya sea al Estado o al ente al cual se encuentran adscritos, por las razones que de seguido se expondrán.

Recuérdese, la asignación de personería jurídica instrumental a ciertos órganos tuvo su génesis en la necesidad de paliar en alguna medida las deficiencias operativas del Gobierno Central, así como de los entes descentralizados. Es indudable, su objeto es que administren su propio presupuesto, realicen sus propias contrataciones, y en gran medida para simplificar el sistema de nombramiento de sus funcionarios. De ahí, que les proporcionara flexibilidad y los dotara de instrumentos de gestión óptimos, si se les compara con los de la Administración Pública tradicional. Así, los órganos con personalidad jurídica instrumental se crean para facilitar su operación, evitar controles y simplificar requisitos. Pero no puede dejarse de lado, continúan estando adscritos a un Ministerio o ente mayor con sujeción a directrices e instrucciones. Consecuentemente, es claro, en el caso de los adscritos a algún Ministerio, son parte integral de un todo más amplio, a saber, la Administración Central o Aparato Estatal que continúa siendo uno solo (unidad del Estado, Administración como ente mayor).

Por su lado, los adscritos a un ente descentralizado continúan formando parte de este. Por consiguiente, en aspectos de responsabilidad, no es apropiado ni jurídicamente viable, exonerar por completo al Estado o al ente descentralizado, porque como se dijo, fue quien dio vida a tales órganos con el fin de facilitar su funcionamiento, pero no por ello dejan de ser parte de ese todo más amplio que constituye la Administración Central o ente descentralizado. Asimismo, no es factible dejar de lado el derecho de los ciudadanos a recibir un resarcimiento pleno (artículo 41 de la Constitución Política), al punto que tenga que verse afectado por el hecho que el órgano no cuente con contenido presupuestario, o porque dejó de existir. De dicha manera, es evidente, el administrado tendrá un mayor ámbito de protección y garantía, frente a sus reclamos por los detrimentos soportados. Lo anterior va de la mano con lo estipulado en los cardinales 9 de la Carta Magna, el cual establece que el Gobierno de la República es responsable, y 161 inciso 1) apartado b) del CPCA, fuente de la responsabilidad subsidiaria comentada”.

En el caso concreto, de acuerdo a lo expuesto, al contrario de declarar una falta de legitimación en la causa a favor del Estado, es condenarlo a una responsabilidad subsidiaria con el Consejo Nacional de Vialidad a ejecutar las obras que dispone el fallo conculcado debe realizar el Consejo Nacional de Vialidad (CONAVI) y condenarlo subsidiariamente al pago de las costas a favor de la actora. En consecuencia, se debe acoger el agravio y resolviendo por el fondo, se declara con lugar el recurso quinto del CONAVI, se anulará parcialmente la sentencia impugnada en cuanto, se acogió la excepción de falta de legitimación pasiva en la causa a favor del Estado y se declaró sin lugar la demanda en todos sus extremos; así como en cuanto a la condena en costas a la actora al pago en favor del estado reconociéndosele intereses al tipo legal sobre este extremo.

VI.Segundo. Parte actora (primer cargo, tercer apartado y cuarto cargo, tercer apartado, de su recurso). En tanto, en el primer cargo, tercer reproche, se cuestiona la sentencia por la disposición de condenar a la actora al pago de las costas del proceso a favor del Estado, en tanto, se estima se dan motivos bastantes para litigar contra éste; al no conocerse con exactitud cual órgano administrativo había construido la alcantarilla que ha sido objeto de este proceso. Del mismo modo, en el cuarto cargo, tercer reproche, se señala disconformidad, con sustento en una violación de los principios constitucionales de razonabilidad y proporcionalidad; por esa decisión de condenar en costas e intereses sobre las mismas, a la actora. Conforme a lo resuelto en el anterior considerando que acoge el agravio quinto del recurso formulado por el CONAVI, por las mismas razones se acogen ambos agravios formulados por la actora y en consecuencia anulando parcialmente el fallo conculcado.

Por tanto:

Se declara con lugar el agravio quinto del recurso de casación formulado por el Consejo Nacional de Vialidad. Se declara con lugar los agravios primero, apartado tercero y cuarto apartado tercero del recurso planteado por la actora. Se anula parcialmente la sentencia impugnada. Resolviendo por el fondo, se dispone condenar al Estado a una responsabilidad subsidiaria con el Consejo Nacional de Vialidad a ejecutar las obras que deberá realizar el Consejo Nacional de Vialidad (CONAVI) y asumir subsidiariamente la condena en costas a favor de la actora.
