In the ordinary proceeding (proceso de conocimiento) brought by MIGUEL CARABAGUÍAS MURILLO against the CONTRALORÍA GENERAL DE LA REPÚBLICA (hereinafter, CGR) and the ESTADO, the Court considers the motions for supplementation and clarification (solicitudes de adición y aclaración) filed by both the oversight body (órgano contralor) and the Estado concerning resolution 000506-F-S1-2021, issued by this Chamber at 09:12 on 09 de marzo de 2021.
CONSIDERING
I.The Contraloría General de la República files what it calls an “incident seeking nullity and motion for supplementation and clarification” (“incidente de nulidad y gestión de solicitud de adición y aclaración”) concerning ruling 506-F-S1-2021 of 09:12 on 09 de marzo de 2021, which vacated the judgment under appeal, granted the complaint in part, and declared CGR resolutions PA-22-2013 of 10:00 on 1 de noviembre de 2013 and R-DC-032-2014 of 13:00 on 23 de abril de 2014, as well as all proceedings conducted in administrative proceeding (procedimiento administrativo) DJ-32-2013, absolutely null and void. It also awarded subjective non-pecuniary damages (daño moral subjetivo) in the amount of ¢5.000.000,00 and ordered the Estado and the CGR to pay costs (costas).
II.In the so-called “incident seeking nullity and motion for supplementation and clarification,” Ms. Francella Navarro Moya, special judicial attorney-in-fact (apoderada especial judicial) for the CGR, states that jurisdiction (competencia) over this matter lies with the Tribunal de Casación de lo Contencioso Administrativo y Civil de Hacienda. She maintains that the subject matter of these proceedings concerns Public Treasury administrative proceeding DJ-32-2013, conducted by the CGR, in which resolution PA-22-2013 of 10:00 on 1° de noviembre de 2013 found the plaintiff administratively liable (administrativamente responsable). She states that this resolution barred the plaintiff from entering or reentering any Public Treasury position, pursuant to section 72 of law no. 7428, “Ley Orgánica de la Contraloría General de la República.” She recounts that the claimant challenged those actions and that, by resolution 017-2016-VII of 09:49 on 22 de febrero de 2016, the Court dismissed the complaint, a decision challenged on cassation (casación) and resolved by this Chamber in judgment 000506-F-S1-2021.
She therefore considers that this Chamber lacked jurisdiction because, under sections 136(2) of the CPCA, 94 bis(2) of the Ley Orgánica del Poder Judicial, and 51(2) of the Reglamento de Organización y Servicio de la Jurisdicción Contencioso-Administrativa y Civil de Hacienda, the competent body is the Tribunal de Casación, insofar as the dispute concerns a sanctioning proceeding (proceso sancionatorio) conducted at the administrative level; nevertheless, it was decided by the Sala Primera. She maintains that this lack of jurisdiction is particularly significant because it prevents her from filing a cassation appeal in the interest of the legal order (recurso de casación en interés del ordenamiento jurídico), as provided in Chapter III of the CPCA. She explains that this is because, under subsection 1) of that body of law, a cassation appeal in the interest of the legal order may be brought before the Sala Primera against final judgments (sentencias firmes) issued by the Tribunal de Casación Contencioso Administrativo y Civil de Hacienda that have the force of res judicata on the merits (cosa juzgada material), “(...) when, having not been heard by the Sala Primera, they are deemed to violate the legal order.” She adds that the decision could be considered contrary to the application of constitutional and statutory provisions governing environmental and public-treasury matters, as well as to final decisions of the Tribunal upheld by this Chamber, and therefore the prescribed appellate remedy would be a cassation appeal in the interest of the legal order.
In her view, this Chamber’s consideration and resolution of the extraordinary cassation appeal (recurso extraordinario de casación) filed by the plaintiff prevents the CGR from pursuing the appellate avenue established in section 153.1 of the CPCA; this impediment would not exist if the Tribunal de Casación had considered and decided that appeal. She cites decisions of this Chamber in support of her position. Accordingly, she states that, because this defect cannot be cured, she requests that the incident seeking nullity be granted and the referenced resolution be vacated; she further requests that the matter be transferred to the Tribunal de Casación so that, as the competent body, it may decide the cassation appeal, pursuant to provision 33.1 of the CPC, which applies supplementarily to this matter as indicated in section 220 of the CPCA. She adds that, to avoid causing a denial of the right to a defense (indefensión), should the request for nullity and/or ex officio review be denied, she requests clarification and/or supplementation of the resolution to state the reasons why this Chamber deemed itself competent to hear and decide the cassation appeal under review, as well as supplementation concerning the appellate remedy available before this forum so that the CGR—should it deem it appropriate—may challenge the referenced resolution through a “Cassation Appeal in the Interest of the Legal Order,” thereby exempting it from the limitation established in section 153(1) of the CPCA.
She adds that resolution 000506-F-S1-2021 states in Considering VIII that “(...) In view of the manner in which the matter will be decided, the remaining grounds of appeal and supplements submitted by the appellant in cassation will not be examined”; from this, she understands that the plaintiff supplemented the cassation appeal and that the Sala Primera admitted the supplement but, because of the manner in which it ruled, did not examine it. She believes that this violates due process (debido proceso) and section 143(2) of the CPCA because the referenced supplemental filing was not brought to her attention. She emphasizes that she learned of the filed supplement only through decision 506-F-S1-2021. She therefore considers that she was denied the right to a defense and requests that decision 506-F-S1-2021 be vacated and the case file returned so that the judicial proceedings may follow their normal course at the cassation stage, in accordance with section 143 of the CPCA; she further requests that the justices recuse themselves (separándose) from hearing the appeal in order to guarantee absolute impartiality, as provided in Article 12(16) of the CPC. She cites decisions in support of her position.
III.Additionally, he requests supplementation and clarification in order to understand the public-domain status (demanialidad) of the titled property as a matter of mere verification. He refers to judgments of this Chamber that annulled, among other administrative acts, the resolutions of the IDA Board of Directors—concerning articles 32 and 31 of sessions 16-04 of May 3, 2001 and 005-05 of February 7, 2005—which resulted in public-domain property (bienes demaniales) being titled in favor of private individuals. He considers that, in those decisions, this Chamber endorsed the Tribunal’s statement that the public-domain status of those lands was a matter of mere verification. He considers that, by endorsing the Tribunal’s analysis regarding the status as PNE of the property titled in favor of private individuals and, consequently, the nullity of the IDA Board of Directors’ resolutions in various decisions, this Chamber considered official letters ACOPAC-OTC-119-03 of April 25, 2003 and ACOPAC-OTC-219-03 of July 16, 2003, issued by the Ministry of Environment and Energy (hereinafter MINAE), on which the IDA—now INDER—Board of Directors relied in titling public-domain property.
Nevertheless, he states, despite the foregoing, in decision 506-F-S1-2021, when considering, among other documents, official letters ACOPAC-OTC-119-03 and ACOPAC-OTC-219-03, this Chamber stated: “(...) Even though they refer to the existence of forest on the properties, it is clear that in them MINAE certified to IDA that those parcels are not part of the PNE and therefore could be titled or allocated by IDA”; this despite the fact that the plaintiff himself stated in his appeal in cassation (recurso de casación) that it could not be concluded that the titled lands were not part of the PNE. He considers that the titling of the properties was annulled by five final judgments of the Contentious-Administrative Tribunal, affirmed by this Chamber, because it determined that they were part of the PNE—an issue that, it stated, was a matter of mere verification—and that the existence of forest determines the lands’ status as PNE; the resolutions of the IDA Board of Directors were also annulled as a result, and the Tribunal even ordered it to establish the corresponding administrative liabilities through an administrative proceeding (procedimiento administrativo), which it did.
Nevertheless, under the judgment being examined and according to the same official letters, it is clear that those parcels are not part of the PNE and could be titled; he therefore requests supplementation of the decision under analysis to establish whether the Chamber is changing its position and the reasons for doing so, together with an analysis of the implications this would entail. He argues that, in various decisions, this Chamber affirmed those of the Tribunal in which, among other administrative acts, the resolutions of the IDA Board of Directors—articles 32 and 31 of sessions 16-04 and 005-05—which resulted in public-domain property being titled in favor of private individuals, were annulled. He contends that, in the appeals in cassation, the unsuccessful parties argued that the Tribunal had allegedly improperly assessed the evidence when annulling the administrative acts. He states that, in that regard, this Chamber dismissed the appeals and found that the evidence introduced in the judicial proceedings had been properly assessed under the rules of sound judicial evaluation (reglas de la sana crítica).
He complains that, despite the foregoing, in decision 506-F-S1-2021 this Chamber concluded that, upon analyzing the documentation submitted to IDA at the time of the events, on the basis of which the legality of its resolutions had to be determined, no legal reason could be inferred that would have prevented the transfer of the property in question to the parcel holders at that time, thereby upholding the plaintiff’s claim of error concerning the improper assessment of the evidence due to a violation of the rules of sound judicial evaluation; he requests clarification of this point, as well as an indication of whether the Chamber is changing its position and the reasons for doing so. He reiterates the same argument regarding the land-use capability study (estudio de capacidad de uso del suelo) as a prerequisite for titling property. In support of his hypothesis, he cites judgments of this Chamber which, he says, affirmed decisions of the Tribunal that annulled, among other administrative acts, the resolutions of the IDA Board of Directors—concerning articles 32 and 31 of sessions 16-04 and 005-05—which resulted in public-domain property being titled in favor of private individuals, upon finding that cassation would serve no useful purpose; this was because, on that occasion and in each case, the appellant in cassation challenged the public-domain status of the property.
Nevertheless, he emphasizes that the nullity of the resolutions and administrative acts was based not only on the property’s public-domain status but also on the procedure followed in issuing the Board of Directors’ resolutions, including the omission of a land-use capability study before titling, a substantive requirement that should have been verified before property was titled in favor of private individuals. He reiterates that, despite this, in decision 000506-F-S1-2021 this Chamber stated: “From that standpoint, official letter DIR-ACOPAC-154 of April 7, 1999, (sent by the Director of ACOPAC, Mr. Alfonso Duarte Marín, to the Director General of SINAC, Luis Rojas Bolaños), is significant, as it records that, following a review of the cartographic sheets, the plan submitted by IDA concerning the Proyecto de Titulación Los Santos was located: ‘...outside the boundaries of the Protected Areas, Reserva Forestal Los Santos and Reserva Biológica Cerro Vueltas...’” He considers that, although that document adds that an official land-use capability methodology was needed in order to protect lands classified as suitable for forestry, it expressly states that the properties in question lie outside the relevant protected areas and forest reserves.
He therefore again requests clarification and/or supplementation as to whether the Chamber is changing its position and the reasons for doing so. In the same terms, he refers to the lack of a sufficient warning and the lack of a law degree as grounds exempting the plaintiff from liability as a member of the IDA Board of Directors. He again cites judgments of this Chamber in which, he alleges, decisions of the Tribunal endorsing the procedure followed by the CGR were analyzed. He adds that this Chamber has recognized the liability of a public official when that official heads the entity’s bodies, and also that the Board of Directors was a political—not a technical—body, for which reason the only legally viable means of deciding the matters submitted for its consideration was to rely on the technical and legal recommendations provided to it. He continues that, nevertheless, the Chamber found that there had been negligence or gross fault (culpa grave) in the performance of his duty because, as president, he directed that board.
He states that this Chamber has indicated that when administrative conduct (active or passive) is substantially inconsistent with the legal system and, consequently, results in manifest illegality (ilegalidad manifiesta), the Administration is required to initiate the appropriate internal actions to establish financial or administrative liability. He interprets the characterization of “manifest illegality” as not being limited solely to the adoption of unlawful decisions despite opinions issued as warnings (art.199 of the LGAP), but as also encompassing actions in which the official was able to recognize that the action contravened the legal system and nevertheless, through willful misconduct (dolo) or gross fault, caused the administrative conduct. He objects that, in judgment 506-F-S1-2021, this Chamber found that there had been no sufficient warning that would have enabled a person without a law degree to doubt that the administrative conduct in question might be unlawful, and therefore that no gross fault, recklessness, or negligence had occurred.
Accordingly, he requests clarification and/or supplementation as to whether the recently cited decision changes the Chamber’s position and the reasons for doing so; he also requests citation of the provisions that exempt a member of a collegial body (órgano colegiado) from liability on the ground that the member is not responsible because he lacks a law degree, even though, under the Constitución Política, no one may plead ignorance of the law. He further asks why the plaintiff is exempted from compliance with sections 211 subsections 1) and 2) and 213 of the Ley General de la Administración Pública, as well as section 112 of the Ley General de la Administración Pública y Presupuestos Públicos, and from the responsibilities that the Ley de Control Interno assigns to senior officials. He provides details of the legal provisions in force when the resolutions of the IDA Board of Directors under analysis were adopted, as well as the documents available to the members of the Board of Directors.
He reiterates his analysis of the violations he believes occurred. Consequently, he requests supplementation and/or clarification of the reasoning and operative provisions (extremos considerativos y dispositivos) of the cited judgment.
IV.For his part, the representative of the State, Mr. Alonso Arnesto Moya, states that, with a view to the future judgment-enforcement proceeding (proceso de ejecución de sentencia) and to expedite payment of the award, he requests clarification that the budget responsible for the sum of ₡ 5.000.000,00 awarded to the plaintiff as subjective non-pecuniary damages (daño moral subjetivo) is that of the Contraloría General de la República and not that of the Procuraduría General de la República. This is because all the actions annulled in the operative part belong to the Órgano Contralor, including those documented in administrative proceeding no. DJ-32-2013, and because the Procuraduría’s participation in these proceedings arose from the statutory mandate in subsection 5), letter a) of article 12 of the CPCA. He emphasizes that, with respect to costs (costas), the judgment did specify that they are to be borne by the State and the Contraloría, but it omitted any such indication regarding the principal amount of the award. Finally, he also requests supplementation of the operative part of the aforementioned judgment regarding the period to be granted for depositing the stated sum of five million colones, since it is a substantial amount that would require the corresponding budgetary adjustments, which ordinarily cannot be made immediately.
V.Regarding the “motion for nullity (incidente de nulidad)” filed by the Contraloría General de la República, the representation of the Órgano Contralor should note that the procedural legislation currently in force does not provide for an autonomous interlocutory motion; rather, such a motion may be filed only together with the corresponding appeal, when the challenged decision permits it (article 33.2 third paragraph of the CPC, pursuant to the general cross-reference in provision 220 of the CPCA). In this case, it is indisputable that the decision is a judgment of a Chamber of Cassation, against which no appeal lies, a circumstance that, without further analysis, precludes filing the proposed motion for nullity because, to be admissible, it must be filed together with the applicable appeal. Because no appeal lies against cassation judgments, the proposed motion is inadmissible, and it shall be so declared.
VI.Pursuant to the general referral made by provision 220 of the CPCA, and because the correction of rulings (rectificación de resoluciones) is not expressly provided for in this body of law, the provisions of the Code of Civil Procedure governing supplementation and clarification (adición y aclaración) are applicable. That latter legal text, in its provisions 58.3 and 63, establishes that such relief is available, on the court’s own motion or at a party’s request, in two circumstances: first, when a concept is unclear; and second, when there are omissions concerning matters disputed in the litigation. Clarifications or supplements shall be available only with respect to the operative part (parte dispositiva). Its purpose is therefore to clarify confusing points and issues and to remedy omissions in the operative part of the ruling, not to answer questions or expand upon statements made in the text of the judgment, since doing so would be incompatible with revoking or modifying the ruling on the merits.
VII.In the present matter, with respect to the supplementation and clarification requested by the Contraloría General de la República, this adjudicatory body finds no omission or unclear issue in the operative part of the judgment for which clarification has been requested. It should be noted that the matters the applicant seeks to supplement or clarify relate to issues discussed in other proceedings and to the positions held by the CGR in that regard, rather than to what was ordered in the operative part of the decision. Furthermore, contrary to the applicant’s arguments, this adjudicatory body considers the judgment entirely clear as to the reasons that led it to declare the administrative proceeding conducted and the acts issued by the CGR null and void. It is equally clear as to the reasons that led to the finding of subjective non-pecuniary harm (daño moral subjetivo). Accordingly, the request for supplementation and clarification submitted by the oversight body (órgano contralor) must be denied.
VIII.Regarding the request made by the State’s representatives, this adjudicatory body considers it appropriate to clarify that the budget responsible for paying the sum of ₡5.000.000,00 awarded to the plaintiff—by way of subjective non-pecuniary harm—is that of the Contraloría General de la República, not that of the State, given that the actions annulled by the judgment were those of the Órgano Contralor. Accordingly, the request for supplementation and clarification is granted as to the foregoing. It is denied in all other respects because it concerns matters to be determined in judgment-enforcement proceedings (ejecución de sentencia).

The motion for nullity (incidente de nulidad) is dismissed as procedurally improper. The request for supplementation and clarification submitted by the Contraloría General de la República is denied. The request for supplementation and clarification submitted by the State is granted in part; and it is clarified and added that the budget responsible for paying the sum of ₡ 5.000.000,00 (five million colones) awarded to the plaintiff by way of subjective non-pecuniary harm is that of the Contraloría General de la República. The remainder is denied because it concerns matters to be determined in judgment-enforcement proceedings.

Documento PJEDITOR Res. 001700-F-S1-2021 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas treinta y cinco minutos del siete de octubre de dos mil veintiuno.
Dentro de proceso de conocimiento promovido por MIGUEL CARABAGUÍAS MURILLO contra la CONTRALORÍA GENERAL DE LA REPÚBLICA (en adelante CGR) y el ESTADO, se conocen solicitudes de adición y aclaración presentadas tanto por el órgano contralor, como por el Estado, respecto de la resolución 000506-F-S1-2021 de las 09:12 horas del 09 de marzo de 2021, emitida por esta Sala.
CONSIDERANDO
I.La Contraloría General de la República plantea lo que denomina “incidente de nulidad y gestión de solicitud de adición y aclaración” respecto del pronunciamiento 506-F-S1-2021 de las 09:12 horas del 09 de marzo de 2021, en el cual, se anula la sentencia recurrida, se declara parcialmente con lugar la demanda y absolutamente nulas las resoluciones de la CGR números PA-22-2013 de las 10:00 horas del 1 de noviembre de 2013, R-DC-032-2014 de las 13:00 del 23 de abril de 2014, así como todo lo actuado en el procedimiento administrativo DJ-32-2013. Asimismo, concedió daño moral subjetivo en la cantidad de ¢5.000.000,00 y las costas a cargo del Estado y de la CGR.
II.En el denominado “incidente de nulidad y gestión de adición y aclaración”, la señora Francella Navarro Moya, apoderada especial judicial de la CGR, indica que la competencia en el presente asunto corresponde al Tribunal de Casación de lo Contencioso Administrativo y Civil de Hacienda. Valora, el objeto del presente proceso versa sobre el procedimiento administrativo de la Hacienda Pública DJ-32-2013 sustanciado por la CGR, en el que se resolvió mediante resolución PA-22-2013 de las 10:00 horas del 1° de noviembre de 2013, declarar administrativamente responsable al actor. Menciona, en dicha resolución se le impuso al actor la prohibición de ingreso o reingreso para ejercer cualquier cargo de la Hacienda Pública, lo anterior con sustento en el numeral 72 de la ley no. 7428 “Ley Orgánica de la Contraloría General de la República”. Relata, dichas conductas fueron cuestionadas por el accionante y por resolución 017-2016-VII de las 09:49 horas del 22 de febrero de 2016 el Tribunal declaró sin lugar la demanda, resolución que es cuestionada en casación, lo que se resuelve mediante sentencia de esta Sala 000506-F-S1-2021. Por ello aprecia una falta de competencia, en razón de que, según los numerales 136 inciso
III.Adicionalmente solicita adición y aclaración, dice, a fin de comprender, la demanialidad de los bienes titulados, como un aspecto de mera constatación. Refiere fallos de esta Cámara, anularon, entre otros actos administrativos; los acuerdos de la Junta Directiva del IDA -referidos a los artículos 32 y 31 de las sesiones 16-04 del 3 de mayo del 2001 y 005-05 del 7 de febrero del 2005- que llevaron a titular bienes demaniales a favor de particulares. Considera, en dichas resoluciones esta Sala avaló lo señalado por el Tribunal al indicar, que la demanialidad de dichos terrenos era de mera constatación. Considera, esta Sala -al avalar el análisis del Tribunal respecto de la naturaleza de PNE de los bienes titulados a favor de particulares y con ello la nulidad de los acuerdos de la Junta Directiva del IDA en diversas resoluciones-, apreció los oficios ACOPAC-OTC-119-03 del 25 de abril de 2003 y ACOPAC-OTC-219-03 del 16 de julio de 2003 emitidos por el Ministerio de Ambiente y Energía (en adelante MINAE), sobre los cuales se basó la Junta Directiva del IDA -ahora INDER- para titular bienes demaniales.
Ahora bien, esboza, pese a lo señalado, mediante la resolución 506-F-S1-2021, esta Sala al apreciar entre otros, los oficios ACOPAC-OTC-119-03 y ACOPAC-OTC-219-03 señala: “(...) Aún y cuando éstos refieren la existencia de bosque en los predios, es claro, en ellas el MINAE certificó al IDA, que esas parcelas no son parte del PNE, por lo cual si podían ser tituladas o asignadas por el IDA”; ello pese a que el mismo actor indicó en su recurso de casación que no concluye que los terrenos titulados no eran parte del PNE. Considera, las titulaciones de los predios fueron anuladas por cinco sentencias firmes del Tribunal Contencioso, confirmadas por esta Sala, en tanto estimó, eran parte del PNE, aspecto que indicó, era de mera constatación y que la existencia de bosque define la naturaleza de PNE de los terrenos, con ello además se anularon los acuerdos de la Junta Directiva del IDA, e inclusive el Tribunal le solicitó establecer mediante procedimiento administrativo las responsabilidades administrativas correspondientes; lo que llevó a cabo.
Ahora bien, con la sentencia de examen, según los mismos oficios, es claro que dichas parcelas no son parte del PNE y podían ser tituladas, por lo que solicita adicionar la resolución de análisis, a fin de establecer si se está cambiando de criterio y las razones para ello, sumado al análisis de las implicaciones que ello tendría. Argumenta, esta Sala en diversas resoluciones, confirmó las del Tribunal, en las cuales se anularon, -entre otros actos administrativos-; los acuerdos de la Junta Directiva del IDA, -artículos 32 y 31 de las sesiones 16-04 y 005-05- que llevaron a titular bienes demaniales a favor de particulares. Arguye, en los recursos de casación, las partes perdidosas plantearon que el Tribunal incurrió en una presunta indebida valoración de la prueba al anular los actos administrativos. Dice, al respecto, esta Sala declaró sin lugar los recursos y estimó que la prueba traída al proceso judicial fue valorada correctamente, con base en las reglas de la sana crítica.
Reclama, pese a lo señalado, en la resolución 506-F-S1-2021, esta Sala concluyó, que al analizar la documentación presentada al IDA al momento de los hechos, conforme a la cual debían establecer la legalidad de sus acuerdos, no era dable extraer, existiera alguna razón de orden jurídico, que en ese momento, impidiera traspasar los bienes de cita a los parceleros, acogiendo el agravio presentado del actor sobre la indebida valoración de la prueba por vulneración a las reglas de la sana crítica, aspecto que solicita aclarar, asimismo, indicar si está cambiando de criterio, y las razones para ello. Reitera lo mismo con respecto al estudio de capacidad de uso del suelo como requisito previo a la titulación de bienes. Cita fallos de esta Sala, en apoyo de su hipótesis, los cuales dice, confirmaron resoluciones del Tribunal, mediante las cuales se anularon, entre otros actos administrativos; los acuerdos de la Junta Directiva del IDA -referidos a los artículos 32 y 31 de las sesiones 16-04 y 005-05- que llevaron a titular bienes demaniales a favor de particulares; al estimar, una casación inútil; ello por cuanto, el casacionista en aquella oportunidad y para cada caso cuestionó la demanialidad de los bienes.
No obstante, subraya, la nulidad de los acuerdos y actos administrativos se basó, además de la naturaleza demanial del bien, en el procedimiento seguido para el dictado de los acuerdos de la Junta Directiva, en cuenta la omisión del estudio de la capacidad de uso del suelo de previo a la titulación, requisito sustancial que debió ser verificado antes de titular bienes a favor de particulares. Reitera, pese a ello, en la resolución 000506-F-S1-2021, esta Sala apunta: “Desde esa arista, resulta de importancia el oficio DIR-ACOPAC-154 de 7 de abril de 1999, (dirigido por el Director de ACOPAC, -señor Alfonso Duarte Marín-, al señor Director del General del SINAC, -Luis Rojas Bolaños-), en el cual consta, que de la revisión de las hojas cartográficas, el plano presentado por el IDA, sobre el Proyecto de Titulación Los Santos, se encontraba ubicado: “…fuera de los límites de las Áreas Protegidas, Reserva Forestal Los Santos y la Reserva Biológica Cerro Vueltas…” Considera, si bien, dicho documento añade la necesidad de contar con una metodología oficial de capacidad de uso de suelo, a fin de proteger los clasificados como aptitud forestal, expresamente refiere que los predios de cita, se encuentran fuera de las zonas protegidas y reservas forestales de interés.
Por ello, nuevamente solicita aclarar y/o adicionar si se está cambiando de criterio y las razones para ello. En los mismos términos refiere la falta de advertencia suficiente y falta de título de derecho, como eximentes de responsabilidad de la parte actora como miembro de la Junta Directiva del IDA. De nuevo cita fallos de esta Sala, en los que alega, se analizaron resoluciones del Tribunal, que avalaron el procedimiento seguido por la CGR. Agrega, esta Sala ha previsto la responsabilidad del funcionario público cuando es titular de los órganos del ente, además, que la Junta Directiva era un órgano político -no técnico-, razón por la cual, la única forma legalmente viable para resolver los temas sometidos a consideración era con el respaldo de las recomendaciones técnicas y jurídicas que les brindaban. Continúa, no obstante, consideró, existió negligencia o culpa grave en el cumplimiento de su deber, pues en su condición de presidente, dirigía dicha junta.
Refiere, esta Sala ha indicado, que cuando una conducta administrativa (activa o pasiva) resulte sustancialmente disconforme con el ordenamiento y, en consecuencia, se produzca una ilegalidad manifiesta, la Administración está obligada a iniciar las acciones internas pertinentes a fin de establecer las responsabilidades pecuniarias o administrativas. Interpreta, la calificación de “ilegalidad manifiesta” no debe concebirse únicamente como la adopción de decisiones antijurídicas pese a los criterios emitidos como advertencias (art.199 de la LGAP), sino que debe también relacionarse con actuaciones en las cuales el funcionario tuvo la posibilidad de apreciar que la acción contradecía el ordenamiento jurídico y, pese a ello con su dolo o culpa grave causó la conducta administrativa. Recrimina, en el fallo 506-F-S1-2021, esta la Sala estimó, no existió advertencia suficiente que permitiera a una persona, sin títulos en derecho, dudar, que la conducta administrativa en cuestión pudiera ser ilegal, por lo que no se presentó culpa grave, imprudencia o negligencia.
Por lo anterior, solicita aclarar y/o adicionar si con la resolución de reciente cita, se está cambiando de criterio y las razones para ello, asimismo dice, citar las normas que eximen de responsabilidad a un integrante de un órgano colegiado, al considerar que no es responsable por no tener títulos en derecho; pese a que, según la Constitución Política, nadie puede alegar ignorancia de la ley. Además, porqué se le exime de cumplir con los ordinales 211 incisos 1) y 2) y 213 de la Ley General de la Administración Pública, así como de lo dispuesto en el ordinal 112 de la Ley General de la Administración Pública y Presupuestos Públicos; y las responsabilidades que la Ley de Control Interno le atribuye a los jerarcas. Aporta detalle de las normas jurídicas vigentes en el momento de la adopción de los acuerdos de la Junta Directiva del IDA de análisis, así como de los documentos con los que contaron los miembros de la Junta Directiva. Reitera análisis sobre las infracciones que estima se produjeron. En consecuencia, adicionar y/o aclarar los extremos considerativos y dispositivos de lo resuelto en la sentencia de cita.
IV.Por su parte el representante del Estado, señor Alonso Arnesto Moya, indica, con miras al futuro proceso de ejecución de sentencia y que se pueda agilizar el trámite de pago de la condenatoria, solicita se sirva aclarar que el presupuesto que debe responder por la suma concedida a favor de la parte actora por ₡ 5.000.000,00, a título de daño moral subjetivo, corresponde al de la Contraloría General de la República y no al de la Procuraduría General de la República. Lo anterior, tomando en cuenta que las actuaciones anuladas en la parte dispositiva pertenecen todas al Órgano Contralor, incluidas las documentadas en el procedimiento administrativo no. DJ-32-2013; y que la participación de la Procuraduría en este proceso obedeció al mandato legal del apartado 5), letra a) del artículo 12 del CPCA. Resalta, respecto a las costas, si se hizo en sentencia la precisión de que son a cargo del Estado y de la Contraloría, pero respecto al monto principal de la condena omitió hacer una indicación al respecto. Finalmente, solicita adicionar también la parte dispositiva del aludido fallo respecto al plazo que se estaría otorgando para proceder al depósito de la suma dicha de cinco millones de colones, en tanto se trata de un monto elevado que obligaría a hacer los respectivos ajustes presupuestarios, los que normalmente no operan de forma inmediata.
V.Tocante al “incidente de nulidad” que formula la Contraloría General de la República, note la representación del órgano contralor, en la legislación procesal vigente, no existe la figura del incidente autónomo, sino que este solo puede ser formulado concomitantemente con el respectivo recurso, cuando la resolución atacada lo admita (artículo 33.2 párrafo tercero del CPC, según remisión general del mandato 220 del CPCA). En la especie, resulta incuestionable, se está ante una sentencia de una Sala de Casación, contra la cual, no existe recurso alguno, situación que sin más análisis impide formular el incidente de nulidad que se pretende, pues a efectos de su admisibilidad, éste requiere ser presentado en conjunto con el recurso que proceda. Al no existir recurso contra las sentencias de casación, el pretendido incidente resulta improcedente, y así se declarará.
VI.De conformidad con la remisión general que efectúa el precepto 220 del CPCA y por no encontrarse la rectificación de resoluciones contemplada expresamente en este cuerpo normativo, resultan aplicables las disposiciones del Código Procesal Civil sobre la adición y aclaración. Este último texto legal, en sus cánones 58.3 y 63, establece su procedencia, de oficio o a gestión de parte, en dos supuestos; el primero, cuando exista algún concepto oscuro y segundo, ante omisiones relativas a lo discutido en el litigio, aclaraciones o adiciones que solo procederán en cuanto a la parte dispositiva. Su propósito es por tanto esclarecer puntos y aspectos confusos, y suplir omisiones de la parte dispositiva de la resolución, no responder dudas, ni ampliar exposiciones hechas en el texto de la sentencia, pues resulta incompatible con la revocatoria o modificación del pronunciamiento de fondo efectuado.
VII.En el presente asunto, respecto a la adición y aclaración gestionada por la Contraloría General de la República, no encuentra este órgano decisor alguna omisión o aspecto confuso que se haya solicitado aclarar en la parte dispositiva de la sentencia. Nótese que los aspectos que se solicita adicionar o aclarar, se relacionan con aspectos discutidos en otros procesos y las tesis que la CGR posee al respecto, mas no con lo ordenado en la parte dispositiva del fallo. Adicionalmente, contrario a los alegatos de la solicitante, estima este órgano decisor, la sentencia es absolutamente clara, en cuanto a las razones que llevaron a determinar la nulidad del procedimiento administrativo realizado y los actos dictados por la CGR. Igualmente, en cuanto a las razones que llevaron a establecer la existencia de un daño moral subjetivo. Por lo anterior, procede denegar la solicitud de adición y aclaración que formula el órgano contralor.
VIII.Tocante a lo solicitado por la representación estatal, considera este órgano decisor procedente aclarar, que el presupuesto que debe responder por la suma concedida a favor de la parte actora por ₡5.000.000,00, -a título de daño moral subjetivo-, es el de la Contraloría General de la República y no el del Estado, lo anterior tomando en cuenta que las actuaciones anuladas en sentencia corresponden al Órgano Contralor. Por lo anterior, en cuanto a lo enunciado, se acoge la solicitud de adición y aclaración. En lo demás se rechaza, pues refiere aspectos a determinar en sede de ejecución de sentencia.
POR TANTO
Se rechaza por improcedente, el incidente de nulidad. Se deniega la solicitud de adición y aclaración gestionada por la Contraloría General de la República. Se acoge parcialmente la solicitud de adición y aclaración formulada por el Estado; y se aclara y adiciona que el presupuesto que debe responder por la suma concedida a favor de la parte actora por ₡ 5.000.000,00 (cinco millones de colones), a título de daño moral subjetivo, es el de la Contraloría General de la República. Lo demás se rechaza, pues refiere aspectos a determinar en sede de ejecución de sentencia.
