PJEDITOR Document Decision No. 000506-F-S1-2021 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine twelve a.m. on March ninth, two thousand twenty-one.
Ordinary proceedings (proceso de conocimiento) declared to involve pure questions of law (Puro Derecho), brought by Miguel Carabaguíaz Murillo, of legal age, against the State, represented by Procurador B Alonso Arnesto Moya, of legal age, married, attorney, resident of Heredia, and the Contraloría General de la República, represented by Jaínse Marín Jiménez, of legal age, single, attorney, resident of Escazú, and Francella Navarro Moya, of legal age, single, attorney, resident of Heredia.
Justice Seing Murillo writes the opinion; and,
CONSIDERING
I.Miguel Carabaguías Murillo filed suit against the Contraloría General de la República (hereinafter CGR) and the State. He stated that during 2004 and 2005 he served as Director of the IDA. He asserted that on July 12, 2000, through Executive Decree No. 28746-MINAE-MAG, published in La Gaceta No. 134, the Executive Branch transferred, free of charge, to the Instituto de Desarrollo Agrario (now INDER, hereinafter IDA) an area of land located within the territory defined in section 1 of the decree, for the creation of the “Programa de Titulación Los Santos.” He stated that the decree’s ultimate purpose was to transfer land to agricultural occupants in the area. He asserted that occupants of parcels whose possession of those properties had not been regularized had been located there for several years. He partially transcribed the text of the cited Decree. He disclosed that on August 12, 2002, pursuant to section 179 of the Ley del ITCO (now INDER), the IDA Board of Directors, in Article 2 of Session 055-02, approved the “Reglamento para la Titulación de Tierras en Reservas Naturales” (hereinafter RTTRN), published in La Gaceta No. 173 of September 10, 2001.
He explained that sections 1, 2, 4, 6, 13, 15, and 16 of the Ley del IDA required that institution to issue title to any lands transferred to it for any reason, creating a legal impediment to retaining them without any function. He stated that during his tenure, the Board of Directors allocated to five parcel holders farms located in the area defined by Decree No. 28746-MINAE-MAG, in the exercise of the powers granted by section 30 of the Ley del IDA. He identified the beneficiaries and the survey-plan number. He emphasized that, at the express request of the interested occupants, the Program Coordinator of the Land Titling Division of the IDA’s Departamento Ordenamiento Agrario (hereinafter Reglamento de Titulación) requested authorization from the Board of Directors to award and issue title to those lands, advising the Board that they complied with institutional policies, the recommendation of the regional offices, the approval of the Direcciones Regionales, and the other requirements of the RTTRN.
He recounted that, among the requirements imposed on interested parties, section 11 of the Reglamento de Titulación in force at that time required an “original certificate issued by MINAE stating that the land to be titled, according to the registered survey plan, is not affected by or located within conservation areas or the State’s natural heritage.” He stated that, through official letters No. ACOPAC-OTC-119-03 of April 25, 2003, ACOPAC-OTC-065 of November 25, 2002, ACOPAC-OTC-219-03 of July 16, 2003, and ACOPAC-OTC-259-03 of August 7, 2003, the Coordinator del Ordenamiento Territorial del Área de Conservación Pacífico Central, Sistema Nacional de Aéreas de Conservación del Ministerio de Ambiente y Energía (hereinafter COTPACSINAC), with full knowledge of the titling purposes for which the certificates were requested, certified that the properties were outside Protected Wildlife Areas (Áreas Silvestres Protegidas) and were not subject to section 33 of the Ley Forestal.
In view of this, he contended that, because the interested parties met the statutory requirements for issuing title to those properties, the Board of Directors authorized it pursuant to Resolution No. 32 of Ordinary Session No. 016-04 of May 13, 2004, and Resolution No. 31 of Session 005-05 of February 7, 2005. Nevertheless, he clarified that in 2007 the CGR filed a criminal complaint against him and other IDA officials for the offenses of unlawful adjudication (prevaricato) and embezzlement (peculado) (criminal case 07-000026-621-PE), on the ground that the titled properties formed part of the State’s Natural Heritage (Patrimonio Natural del Estado, hereinafter PNE). He specified that, subsequently, through official letters No. ACOPAC-OT-001-10 of May 7, 2010, concerning report ACOPAC-PNE-027-2010; No. ACOPAC-OT-C-002-10 of May 7, 2010, concerning report ACOPAC-PNE-025-2010; and No. ACOPAC-OT-C-003-2010, concerning report ACOPAC-PNE-026-2010, SINAC certified that the areas of the farms in question did not form part of the PNE.
He stated that, by judgment issued at 4:30 p.m. on September 9, 2013, the Juzgado Penal del II Circuito Judicial de San José ordered a final dismissal (sobreseimiento definitivo) in his favor on the ground that he had acted in accordance with mandatory internal regulations and the principle of legality (principio de legalidad). Despite this, he stated that on July 4, 2013, almost eight years later, the CGR initiated administrative proceedings (procedimiento administrativo) against him concerning the titling under review (case file DJ-32-2013). He asserted that, notwithstanding the cited dismissal, in the final administrative decision in those proceedings—PA-22-2013, issued at 10:00 a.m. on November 1, 2013—he was found administratively liable for having acted with gross negligence (culpa grave) and for having engaged, through his vote, in negligence and recklessness in the administration of land forming part of the PNE.
He concluded that, by Decision R-DC-032-2014, issued at 1:00 p.m. on April 23, 2014, he was barred from holding public office for six years. He requests that the judgment declare: a) Decision No. PA-22-2013, issued at 10:00 a.m. on November 1, 2013, and Decision No. R-DC-032-2014, issued at 1:00 p.m. on April 23, 2014, as well as all proceedings conducted in case file DJ-32-2013, null and void; 3; b) that the administrative proceedings instituted against him by the CGR are time-barred (prescripción); c) that those administrative proceedings could not have been initiated while there was a final criminal judgment finding that the underlying facts had not been proven, and that they are therefore contrary to the legal system, in violation of res judicata (cosa juzgada) and the prohibition against double jeopardy (non bis in ídem) (section 42 of the Constitución Política); d) that he bears no administrative liability for the alleged acts and did not act with gross negligence; and e) that the co-defendants bear the litigation costs (costas).
As ancillary relief, he sought payment of subjective non-pecuniary damages (daño moral subjetivo) in the amount of ¢64.800.000,00 and objective non-pecuniary damages (daño moral objetivo) in the amount of ¢43.200.000,00. The co-defendants denied the claim. They raised the defense of lack of legal entitlement (falta de derecho). The Tribunal upheld that defense. It dismissed the action. It ordered the claimant to pay the costs, and he, disagreeing with that decision, now appeals in cassation (casación).
Appeal on Procedural Grounds
II.In the sole claim of this nature, the appellant alleges infringement of substantive res judicata (cosa juzgada material). He notes that the challenged judgment finds as proven that he was subjected to criminal proceedings for embezzlement and unlawful adjudication, in which a final dismissal was ordered. He argues that the criminal judgment concluded that the evidence available to the members of the IDA Board of Directors when issuing title to the land did not indicate that it formed part of the PNE. He outlines that the criminal judges analyzed the offenses of unlawful adjudication, breach of official duties (incumplimiento de deberes), and embezzlement, and that their assessments yielded proven and unproven facts that led them to determine that his conduct was lawful and did not constitute any of those offenses. He states that the criminal judgment has the effect of substantive res judicata and that it is incorrect to say that the analysis performed was limited to whether the investigated offenses had been committed, because the judgment also reached a conclusion regarding the legality of the conduct reviewed.
He indicates that if the conduct was lawful in the view of the Criminal Court, it cannot be unlawful in the view of the CGR or the Administrative Litigation Court. He asserts that the judgment is conclusive as to his conduct, characterizing it as valid and lawful, which has res judicata effect in both the administrative and administrative-litigation proceedings. He explains that the criminal judgment states: “That is, prior to this date, there would be no sound basis for stating that the accused acted contrary to law.” (…) “However, at the time of its creation and application, the IDA officials did not act contrary to law but under its protection; and although it was subsequently declared unconstitutional, it was in force when applied, and the provision granted them that authority.” (…) “The officials acted on the basis of mandatory internal regulations, under the duty of obedience, and in compliance with the principle of legality that must govern the conduct of every public official.” He insists that the transcribed assessments establish that the criminal proceedings characterized his conduct as lawful, a characterization that constitutes res judicata and prevents the CGR from recharacterizing it and issuing the decisions he has challenged in these proceedings; consequently, the challenged judgment is null and void.
He states that the decision under challenge disregards res judicata by ruling contrary to what was decided in the criminal proceedings. He cites a judgment of the Sala Constitucional in support of his position. He states that the challenged judgment commits a serious error of law by indicating that there was no res judicata in the criminal proceedings because the ruling was a final dismissal. He specifies that, although the CGR initiated the administrative proceedings to determine whether the conduct analyzed in the criminal forum gave rise to administrative liability, it did so while completely disregarding the criminal court’s conclusion that the conduct was lawful and consistent with the law in force at that time. He continues that the Tribunal thereby disregarded the full content of the criminal judgment by reviewing the conduct again and reaching the opposite conclusion. He states that the CGR’s order instituting proceedings is null and void because the grounds used to justify it had already been decided in the criminal forum.
He provides a comparative table of the CGR’s allegations in its order instituting proceedings, the rulings in the criminal forum, and the challenged administrative-litigation judgment. He thus maintains that the CGR should not even have instituted proceedings concerning the same facts already reviewed in the criminal forum. He complains that the judgment acknowledges the existence of substantive res judicata but limits it by concluding that the outcome of that ruling is confined to the analysis of the offenses. He objects, however, that the substance of the criminal ruling clearly characterizes his conduct as lawful, which creates res judicata with respect to the administrative proceedings. Accordingly, he reiterates that, consistent with the line of authority followed by the Sala Constitucional, although criminal and disciplinary proceedings may validly be conducted independently, if the criminal forum establishes that the acts did not occur, that finding must prevail over decisions reached in other forums.
Based on the foregoing, he alleges infringement of the authority of substantive res judicata attaching to the criminal judgment, as well as of the rules governing res judicata, due to the failure to apply the law, specifically sections 162 and 163 of the Código Procesal Civil and the principles of res judicata and legal certainty (seguridad jurídica) protected by constitutional provision 42. He states that this entails an erroneous interpretation by the Tribunal of section 313 of the CPC, a provision that was violated because the Tribunal relied on it to determine that the facts clearly established in the dismissal judgment do not attain certainty for purposes of any other administrative or judicial proceedings. He cites foreign legal scholarship in support of his position. He further objects that the criminal judgment expressly mentioned that PGR opinion C-321-2003 was not binding on the IDA directors, a determination that should have been respected by the CGR and the Tribunal. He emphasizes that this was because the opinion had been requested by MINAE, not by the IDA. Finally, he alleges infringement of section 13 of the Ley de la Jurisdicción Constitucional.
III.Regarding the alleged violation of the principle of Non Bis In Ídem and material res judicata (Cosa Juzgada Material), the Court stated that it is clear that the same act may lead to the initiation of proceedings and procedures in several jurisdictions—criminal, civil, and administrative—as these are different and independent spheres of liability. It clarified that there is a binding effect or a form of primacy regarding what has been deemed proven in judicial proceedings; therefore, if a judicial authority finds that a fact has been established in a decision having the authority of material res judicata, that fact could not be deemed unproven in administrative proceedings. Conversely, it explained, a particular fact may have been deemed unproven in judicial proceedings but subsequently proven in administrative proceedings for purposes of financial or disciplinary liability. It stated that the relevant point is that this primacy refers exclusively to what was deemed established, and the Public Administration may not disregard that circumstance without violating both Non Bis In Idem and res judicata.
However, it observed, in the case of a judgment of final dismissal (sentencia de sobreseimiento definitivo) that contains no findings of fact whatsoever and is based on the conclusion that the alleged acts do not fit the statutory definitions of Embezzlement (Peculado) and Malfeasance in Office (Prevaricato) because those offenses require intent, and taking into account that the Criminal Code does not provide for a negligent form of those offenses, that judgment cannot bind the Public Administration with respect to administrative liability for gross negligence (culpa grave). It argued that this is so because the judgment in question does not conduct that analysis. It explained that what the Criminal Court sought to determine was whether the defendants’ actions had intentionally violated the legislation governing the matter and that, for that reason, their conduct was not subject to criminal censure.
It asserted that the foregoing does not negate the Public Administration’s power and duty to investigate whether such conduct falls within the grounds for administrative liability based on intent or gross negligence established by the legal system. It therefore rejected the argument that the contents of the final-dismissal decision were binding. It also rejected the claimant’s arguments concerning criteria of the Constitutional Chamber under which an administrative sanction could not be imposed when the criminal offense already provided for it as part of the Judge’s sanctioning authority. It noted that the constitutional judgment cited by the plaintiff—no. 1798-1997 de las 15:15 horas del 2 de abril 1997—clearly and precisely states that “The principle, which is an element of due process (debido proceso), would be infringed if the criminal court examining the case... could, in the event of a conviction, impose as an ancillary penalty any sanction relating to the defendant’s ethical responsibility as a member of a political party, an evidently absurd hypothesis.” It stated that, for this scenario to apply, the defendant would have to be sentenced in criminal proceedings, by means of a conviction, solely to the principal penalty prescribed for the criminal offense, even though the imposition of an ancillary penalty of a disciplinary nature, such as disqualification (inhabilitación), was also possible. It stipulated that this was clearly not what occurred in the claimant’s case and therefore found that argument untenable.
IV.This Chamber has consistently held that material res judicata consists of the bar against relitigating, on a subsequent occasion, a dispute already resolved by the competent court, meaning that the decision is immutable and final. It is a procedural-law doctrine (instituto de naturaleza procesal) that applies to the substantive legal relationship (relación sustancial) and requires complete identity between the dispute decided and the dispute subsequently raised; that is, identity of the parties, subject matter, and cause of action. Along the same lines, this Chamber has stated that it arises when “[…] two proceedings conducted before the courts involve the same parties, subject matter, and cause. From the subjective standpoint, the final judgment binds and obligates the participants, who are legally barred from submitting the dispute again to another body. The subject matter and cause, in turn, are the objective criteria on the basis of which it must be determined whether material res judicata exists in a particular case.
The former consists of what is claimed; that is, it comprises ‘the right recognized, declared, or modified in the judgment in relation to one or more specific things, or the legal relationship declared, as applicable’ (sentencia 740 de las 14 horas 45 minutos del 1 de diciembre de 1999, reiterated by citation in fallos 933 de las 9 horas 40 minutos del 24 de noviembre de 2006 and 710 de las 14 horas 15 minutos del 23 de octubre de 2008). The latter, also known as causa petendi, is identified as the basis of the relief sought; it is ‘the factual ground stated in the complaint as the basis of the claim. It [sic] consists of the set of facts alleged as the basis of the complaint’ (sentencia no. 985-F-S1-2009 de las 11 horas 5 minutos del 18 de setiembre de 2009).” This adjudicative body has also explained that liability for the same conduct may be determined in different jurisdictions. On this issue, it stated in sentencia no. 728, de las 9 horas 50 minutos del 29 de setiembre de 2005, that “in accordance with the prevailing doctrinal position—which this Chamber shares—it has been concluded that the same act or conduct by a person may give rise to different types of liability, whether civil, criminal, administrative, or employment-related.
The same conduct may give rise to employment, criminal, and civil liability, each of which is independent in terms of the effects, consequences, and liabilities arising from that conduct or material act. From this standpoint, the principle of liability for causing harm to third parties requires liability ex delicto to be distinguished from the consequences that may arise from the punishable act in criminal proceedings.” (See also, along the same lines, fallo 1350-2011 de las 10 horas 25 minutos del 25 de octubre de 2011). It is therefore clear that liability arising from administrative conduct may properly be examined in different jurisdictions without that fact alone constituting a violation of material res judicata. This is because it has been stated that: “Exoneration from criminal liability does not automatically entail exoneration from financial liability,” (resolución no. 8-2013 de las 9 horas 30 minutos del 17 de enero de 2013), and the matter therefore requires a more detailed examination.
From that perspective, although the present case refers to the judgment of final dismissal contained at folios 1 a 22 of the court record (expediente judicial), issued in criminal proceedings in favor of the claimant at 16 horas 30 minutos del 9 de setiembre de 2013, this in no way precludes the financial or disciplinary consequences of the conduct in question from being litigated in these proceedings. Based on the analysis conducted by this adjudicative body, it is clear that the Criminal Court’s declaration that the conduct allegedly constituting the offenses with which the claimant was charged at the time complied with the legal system (folios 19 a 22 del expediente) does not preclude examination of the financial or disciplinary consequences of the administrative conduct under review. The claim alleging violation of material res judicata must therefore be rejected.
Appeal on substantive grounds
V.The appellant in cassation raises five grievances (agravios) of this nature. In the first, he alleges a violation of substantive rules when facts are deemed proven or unproven contrary to the evidence in the proceedings. He asserts that, by virtue of his position, before casting his vote in favor of granting title to the lands, he had obtained the prior favorable opinion of all competent IDA bodies. He notes that the minutes of Ordinary Session no. 01604 of May 13, 2004 and Ordinary Session no. 005-05 of February 7, 2005 of the Board of Directors establish the participation of a legal adviser. He states that this assertion was included as the fifth fact in the complaint. He notes that, at folio 538 of the administrative record, Mr. Gilberto Rodríguez Soto (Coordinator of Titling Programs) and Eng. Juan Carlos Solórzano Morales (Head of the Agrarian Land-Use Planning Department), in official letter No. STA-010-2005, stated: “In compliance with institutional policies and upon the recommendation of the BATAAN regional office, pursuant to official letter ORS-10742004, the approval of the HUETAR ATLANTICA Regional Directorate pursuant to an undated official letter, and the review by the Regional Agrarian Coordinator of the requirements applicable to the titling procedure, and in accordance with the Board of Directors Resolution described in Article XX of Session 065- 00 of September 11, 2000, and all requirements established in the regulations governing the titling of lands in national reserves, published in the official gazette La Gaceta no. 173 of September 10, 2002, having been fulfilled, pursuant to Ley de Tierras y Colonización no. 2625 of October 14, 1981 and the law creating the Instituto de Desarrollo Agrario no. 6735 of March 29, 1982, I request authorization to subdivide and transfer the 11 parcel lots described below, so that the corresponding supplementary title of ownership (título supletorio de dominio) may be issued.” He explains that an official letter of the same nature appears at folios 38 and 39 of the administrative record for the other properties titled in 2004.
He contends that the Tribunal’s decision deliberately omits the existence of this official letter, which was not only alleged as a fact in the complaint (see fifth fact) and supported by evidence admitted in these proceedings (Folios 538, 539 and 38, 39), but is also especially significant. He maintains that the official letter established that, before casting his vote in favor of granting title, he had received and reviewed at least five prior opinions from the competent IDA technical and legal bodies. He states that the official letter confirms that all necessary studies and procedures contemplated in the Titling Regulations were completed. He asserts that these official letters containing the approval of the responsible technical and legal departments, together with Decreto No. 28746, which expressly stated that the lands were not subject to Ley Forestal, and the MINAE certifications to the same effect, constitute three compelling facts mitigating any possible “gross” fault in his conduct.
He states that he does not understand why he was required to doubt or question the legality of the titling when he had several official letters evidencing approval by the competent IDA officials, MINAE certifications, and a Decree expressly stating that the lands were not subject to Ley Forestal and did not form part of Protected Areas (Áreas Protegidas). Unfortunately, in his view, the Tribunal violates the rules of reasoned evaluation of evidence (sana crítica racional), entirely omits the fifth fact, and conducts a biased and isolated analysis of the facts that led him to approve the titling. He finds it striking that the judgment does not deem any facts “unproven.” He emphasizes that at least the facts on which the complaint was based should have been deemed unproven if the judge dismissed the complaint. He interprets that, in a judgment, it is precisely the unproven facts that cause a complaint to fail, but here no fact is characterized as such.
From his perspective, the ruling violated mandate 15.3.d of the Code of Civil Procedure (Código Procesal Civil) by failing to apply it, as that provision requires the court to state the reasons why certain facts alleged in the complaint were not deemed proven. In this case, he states, the fifth fact in the complaint was of decisive importance to the proceedings and was fully proven, yet the judgment made no reference to it. He asserts that section 199 of Ley General de la Administración Pública (hereinafter LGAP) and section 72 of Ley Orgánica de la Contraloría (hereinafter LOCGR) were also violated through improper application; the Tribunal relied on those provisions as the criterion for attributing subjective liability (responsabilidad subjetiva). He concludes: a) folios 38, 39, 538 and 539 of the administrative record contain two official letters from a competent IDA body reporting several approvals for titling the lands, which were constituent requirements of the administrative act (acto administrativo); b) the existence of those official letters was alleged as the “fifth fact” in the complaint; c) the challenged judgment makes no reference to that fact or to the aforementioned official letters, omitting them without stating its reasons; they were assessed neither as evidence nor as applicable law.
He explains that this fact is crucial to his defense because it precludes any characterization of his conduct as grossly contrary to the duties inherent in his position as Director and, consequently, affects the degree of liability arising from the adoption of the resolutions. He maintains that this omission rendered him defenseless. He concludes that the challenged judgment violates article 153.3.d of the CPC, which requires the identification of unproven facts and the reasons why they were deemed unproven. In his second objection, the appellant argues that substantive rules were violated because the evidence was improperly assessed or disregarded. He says that the judgment did not assess the evidence as a whole in accordance with the rules of reasoned evaluation of evidence (Art. 82.4 of the CPCA and section 330 of the CPC). He adds that it neither assessed nor considered all the evidence, but relied solely on part of the content of the certifications issued by MINAE, which were required under the procedure established in sections 6 and 10 of Reglamento para la Titulación de Tierras en Reservas Nacionales (hereinafter RTTRN), applicable at that time.
He states that both provisions were violated through failure to apply them. He explains that the Tribunal failed to indicate that the certifications were issued by MINAE as part of the requirements necessary to grant title to the lands and also failed to state that, although they indicated the existence of “forest cover (cobertura boscosa)” or “forest (bosque),” they also disclosed that the lands fell outside every restriction established in Ley Forestal. In this regard, he cites documents a) ACOPAC-OTC-119-03 of April 25, 2003; b) ACOPAC-OTC-065 of November 25, 2002, c) ACOPAC OTC-219-03 of July 16, 2003; and d) ACOPAC-OTC-259-03 of August 7, 2003. He argues that the foregoing is important for understanding that, when considered together with the other evidence (art. 330 CPC) reviewed by IDA in authorizing the transfers, it was impossible to suspect the existence of any irregularity. Thus, he emphasizes, the judgment is based on an error of fact in finding that the transferred lands could fall within the exceptions established by ley 2825, Ley de Tierras y Colonización, and Ley no. 7575 Ley Forestal.
In his view, he was provided, in his capacity as a member of the IDA Board of Directors, with sufficient evidence confirming that the lands did not form part of the State Natural Heritage (Patrimonio Natural del Estado, PNE). He clarifies, however, that the judge did not consider it in the judgment, even though it was submitted with the complaint, appears in the administrative record, and was admitted at the preliminary hearing. He warns that the judge deemed only the existence of PNE proven, insofar as the judge considered “forest cover” or “forest” equivalent to PNE. He states that, in proven facts 1, 2 and 3, the judges fail to address the express content of sections 1 and 2 of Decreto 28.746, provisions that were not applied and whose violation is alleged, which clearly state that the nature of the transferred lands made them suitable for titling. He adds that the third fact is limited to a partial transcription of the certifications issued by MINAE, without stating why they were required or that MINAE certified to IDA that those parcels were not part of PNE and therefore could indeed be titled or allocated by IDA.
He notes that the subsequent proven facts concern his membership on the IDA Board of Directors, (5), the resolutions authorizing the titling (6), the criminal complaint (7), the omission of the soil study (8), the annulment of the awards by final judgments (9), and the fact that in 2010 MINAE again stated that the lands did not form part of PNE, evidence that is invalid for the reasons stated by this Chamber (10). He argues that facts 12, 13 and 14 concern the challenged CGR decisions. He alleges that Decreto Ejecutivo no. 28746-MINAE-MAG was disregarded; it expressly stated that the properties fell outside the exceptions established by leyes 2825 and 7575. Indeed, he emphasizes, considerando V clearly states that the project in question contains lands not covered by the exceptions set forth in those laws and that their transfer should therefore be authorized. He asserts that, from the outset, the IDA Board of Directors was instructed that the lands to be allocated were not covered by any exception preventing IDA from allocating them.
He maintains that Decreto 28.746, in article 2, stated that the lands referred to in the decree were devoted to pasture and agriculture; accordingly, if MINAE itself signed the Decree and subsequently issued the certifications needed to complete the requirements for finalizing the titling, he considers it unreasonable to ask why he should have suspected or inferred that the properties were subject to PNE. He says that the foregoing entailed disregarding section 13 of LGAP, a provision also alleged to have been violated through failure to apply it. From another perspective, he says, he could not disobey an administrative act that could not be regarded as manifestly unlawful or contrary to the principles of logic, technical expertise, or reason. In his view, this argument alone proves that sections 199 of LGAP and 72 of LOCGR are inapplicable to the sub judice matter (sub-lite); consequently, the rules of reasoned evaluation of evidence were violated through improper application of the law.
He adds that the constitutionality of the Decree was also reviewed by the Constitutional Chamber (Sala Constitucional) in 2001, when it answered a judicial consultation concerning Ley de Titulación de Tierras en Reservas Nacionales, concluding that it was unconstitutional. He emphasizes, however, that it found Decreto 28746 was not unconstitutional because it was based on Ley 2825. He partially transcribes ruling 8560-2001 of the Constitutional Tribunal. He states that the constitutional challenge to the Decrees was also rejected because it was concluded that the purpose of the decrees was fulfilled by permitting the lands governed by them to be acquired by third parties under the terms of 2825. He states that, by 2001, the constitutionality of decreto 28746 had already been reviewed for the first time, and its content showed that the transferred properties were free of restrictions preventing their continued use as pasture and agricultural land.
He specifies that the Constitutional Chamber’s decision was a decisive factor that gave the IDA Board of Directors and him confidence to continue the procedures, as recorded in resolution no. 32, folio 2587 of the administrative record. This was because, he explains, pursuant to section 13 of Ley de la Jurisdicción Constitucional, they acted in accordance with a binding erga ommes decision; accordingly, his conduct cannot be characterized as gross negligence (culpa grave), thereby demonstrating the improper application of sections 199 of LGAP and 72 of LOCGR.
She states that it is irrelevant whether the Decree was subsequently annulled, since she could not have foreseen a later declaration of unconstitutionality; at the time under examination, it had been reviewed and found consistent with the constitutional text. She specifies that the contrary would entail a direct violation of Article 34 of the Political Constitution—the principle of non-retroactivity—through failure to apply it. She explains that, when it was applied, the Decree was valid and effective, with no reason to doubt its content or constitutionality. Regarding the MINAE certification, she recalls that MINAE was subsequently asked to review whether the lands—as indicated by Decreto 28746—could be allocated to third parties. She notes that, at that time, the RTTRN required that MINAE be asked to certify whether the properties were affected by or located within conservation areas or the State Natural Heritage (Patrimonio Natural del Estado, PNE) (Articles 6 and 10).
She maintains that, accordingly, MINAE certified that they were outside protected areas and zones and that there was no PNE. She emphasizes that the challenged judgment found this sufficient to disregard all the evidence and conclude that the lands contained forest, and therefore could not be titled, thereby confusing the definition of “forest” in provision 3 of Ley 7575 with any forest cover (cobertura boscosa), as well as with the concept of PNE. She reiterates that MINAE inspected the lands and stated: “they are located outside Protected Wildlife Areas. Nor does it appear that Article No. 33 of Ley Forestal No 7575 del 05 de febrero de 1996 and its amendments are affected (...);” which it reiterated in 2010. She insists that MINAE issued the certification for purposes of Article 6 of the regulations then in force and applicable, without objecting, without warning IDA that those lands could not be titled, and without withholding the certification requested precisely on the ground that they were subject to PNE.
Despite this, she states, the judgment reiterates that the certifications refer to the presence of “forest” as grounds for attributing liability to her for failing to suspect the presence of PNE. She indicates that the land-allocation process therefore continued without her incurring gross negligence by allowing it to proceed, since MINAE issued the certification required for its continuation while aware of the titling purpose for which it had been requested. She states that Ley Forestal establishes a general obligation to protect PNE, assigning MINAE the duty to certify its existence based on a field study. In her view, moreover, the Court failed to assess that the titled lands had been occupied by the applicants for more than 10 years, including when MINAE issued the certification. She clarifies that the foregoing is crucial if one considers that both this Chamber and the Constitutional Chamber have held that not every forest is inalienable, since it could be acquired through a minimum of 10 years of possession by acquisitive prescription (usucapión).
She alleges that there was no prior instruction from MINAE, PGR, or CGR concerning the titling of the lands indicating to her that every forest constitutes PNE, much less that the lands under review could not be titled. She thus asserts that she did not participate in any irregularity, because none of the evidence cited ever informed her of any impossibility or irregularity that would have caused her to question Decreto 28746, the Constitutional Chamber’s judgment 8560 del 28 de agosto del 2001, the MINAE certifications issued for that purpose, or the actions or recommendations of the IDA offices responsible for the proceeding. On the contrary, she states that, under the IDA Law, its ordinary course of business is the titling of land to private parties. She adds that Decreto 28746 MINAE-MAG transferred lands to it for allocation, and the Constitutional Chamber confirmed in judgment 8560-2001 that the purpose of the properties was their allocation to third parties.
Furthermore, she alleges that notices of each transfer were published in La Gaceta, yet neither PGR nor MINAE spoke out or objected, in violation of provisions 12 and 13 of the RTTRN; if applied, those provisions would establish a clear mitigation of fault in her conduct, which would also render articles 199 LGAP and 72 LOCGR inapplicable. She adds that the properties were registered and that, under the RTTRN, there was a period of 4 years in which to object—the principle of public notice through the land registry (principio de publicidad registral)—and rule 15 RTTRN was likewise disregarded. She adds that PGR did not challenge the 2002 RTTRN until 2006, 4 years later. She notes that, in other words, when she served as a board member and participated in the vote authorizing the allocations, there was not a single warning or grossly evident irregularity that would have given her reason to suspect that what she was doing might be unlawful or harmful to State property.
She observes that she is not an attorney, which mitigates any “gross” negligence; moreover, she was advised by the IDA office responsible for the titling proceeding and had before her a Decree transferring lands to IDA for allocation, as well as certifications from MINAE, the “entity responsible for protecting PNE,” which, for titling purposes, allowed the proceeding to continue. She argues that even the Board members who were attorneys neither noticed nor had reason to notice any irregularity, because there were insufficient factual circumstances to raise doubts about legality. She asserts that even CGR closed the first proceeding against her because it found that there was uncertainty regarding the nature of the land. She emphasizes that the judgment disregarded the value of the overlooked evidence, unlawfully reaching factual conclusions incompatible with its text. She stresses that she does not seek to establish that the titled lands were not part of PNE, but rather to demonstrate that the evidence she had before her and reviewed when casting her vote and approving the titling process indicated that the lands were not PNE, much less that the action was irregular.
She therefore states that there was no gross negligence, recklessness, or negligence on her part. Regarding memorandum DIR-ACOPAC-154 del 7 abril 1999, she specifies that it was deemed proven fact no. 1 in the challenged decision, while the Court failed to indicate that it was addressed to MINAE, not IDA, and therefore never formed part of the titling process or came to the attention of the Board of Directors. What is serious, she states, is that the Court relied on it to hold her liable and justify the alleged “seriousness” of the violation. The foregoing, she argues, constitutes an additional infringement arising from an error of law concerning mandates 82.4 of the CPCA and 330 of the CPC, as well as provisions 199 LGAP and 72 LOCGR. She further notes that the Court failed to indicate that this memorandum formed part of the record used by the Executive Branch to issue Decreto 28746. She emphasizes that the only fact proved by that memorandum is that MINAE—not the undersigned—knew of its existence, despite which it signed the Decree transferring the lands for allocation to private parties.
Accordingly, she argues, sole responsibility in this case lies with MINAE, which failed in its duty to safeguard PNE. She adds that PGR should have objected and asserted that part of the lands constituted PNE when the notices published in La Gaceta appeared, and MINAE should likewise have objected. She therefore alleges an improper application of provision 72 of the LOCGR and rule 199 of the LGAP.
VI.In the first ground for appeal, the appellant in cassation alleges a violation of Article 138(b) of the CPCA. He argues, in essence, that the Tribunal committed the cited ground for cassation, which arises when facts are deemed proven or unproven in contradiction with the evidence in the proceedings. Such would be the case of a judgment that deems proven facts that were not proven, or deems unproven facts that were in fact established. In a different vein, the claim was framed to assert that the judges deliberately omitted analysis of evidence that, in his view, established the absence of gross negligence (culpa grave) on his part. The ground also refers to a biased analysis of the evidence, subsequently indicating that the judgment failed to deem such facts unproven. From the foregoing, it is unquestionable that the ground set forth in Article 138(b) of the CPCA bears no relation to the allegations made. Whereas the provision contemplates a contradiction between what was or was not actually proven and what was accordingly included in the list of proven or unproven facts, the claim maintains that, although evidence was disregarded, this was not included in the judgment as an unproven fact. While that argument might be valid as such, it does not conform to the structure of the defect described in the cited provision, and must therefore be rejected.
VII.Regarding the second charge, the Court indicated that, as concerns the nature of the awarded properties and the lack of diligence attributed to the plaintiff, it had been established that he did have access to information regarding the forest suitability (aptitud forestal) of the awarded properties, which was recorded in the following documents: a) Official Letter No. ACOPAC-OTC-062 dated November 25, 2002: "...the property corresponding to cadastral plan SJ-600333-99, with an area of 35 ha 0082,59 m2, located in Sabana de la Legua de Aserrí, San José, belonging to FR 1219039-000, in the name of RONALD ELIZONDO SOLANO, ID No. 1-709-134, was inspected; it is land with natural forest cover (cobertura de Bosque natural) and early-successional forest." b) Official Letter No. ACOPAC-OTC-119-03 dated April 25, 2003: "...the property corresponding to cadastral plan SJ-703262-2001 , with an area of 12 ha7380,37 m2, located in Canet de San Marcos de Tarrazú, San José, belonging to FR 12199039-000 in the name of LILLIANA RODRÍGUEZ CHAVEZ, ID No. 2-224-235, was inspected.
The property is devoted to protection and contains dense forest." c) Official Letter No. ACOPAC-OTC-219-03 dated July 16, 2003: "...the property corresponding to cadastral plan SJ-866425-2003, with an area of 59 ha 0252,66 m2, located in Diamante de San Lorenzo de Tarrazú, San José, belonging to FR 1219039-000 and possessed by MIGUEL ALVARADO GRANADOS, ID No. 1-384-993, was inspected. The property is used for agriculture and for protection through dense forest." d) Official Letter No. ACOPAC-OTC-259-03 dated August 07, 2003: "...the property corresponding to cadastral plan SJ-871001-03 with an area of 52 ha 5037,62 m2, located in Caite de SanLuis de Turrubares, San José, belonging to FR 1219039-000 and possessed by FELICIA JIMÉNEZ PORRAS, ID No. 1-596-432, was inspected. The property has climax-successional primary forest cover." e) Certification No. SINAC-DS-OFAU-C-1228-2004 dated March 29, 2004, in which the head of the User Services Office of the National System of Conservation Areas of the then MINAE certified that: "...based on the location recorded in cadastral plan number 7-908302-2004, in the name of IDA, possessor BERTILIO BARRANTES SOLÍS, it has been determined that the plan describes a property located outside any Protected Wildlife Area (Área Silvestre Protegida), irrespective of the management category administered by the Ministry of Environment and Energy.
However, it partially constitutes State Natural Heritage (Patrimonio Natural del Estado), pursuant to Articles 13, 14, and 15 of Ley Forestal 7575 dated April 16, 1996." f) Official Letter No. DIR-ACOPAC-154 dated April 7, 199, signed by Alfonso Duarte Marín, Director of Área de Conservación del Pacífico Central, stated: "...After analyzing and verifying the corresponding 1:50:000-scale map sheets, we have concluded that the plan submitted by IDA to this Area (sic) of Conservation concerning the ‘Proyecto de Titulación Los Santos’ is located outside the boundaries of the Protected Wildlife Areas Reserva Forestal Los Santos and Reserva Biológica Cerro Vueltas. I must also emphasize the importance of this project incorporating the official land-use capability (capacidad de Uso del Suelo) methodology, so that soils classified as having forest suitability are set aside for protection, since attempting to exploit these lands through agricultural and livestock activities poses a substantial risk to the socioeconomic and environmental well-being of the parcel holders." The contents of the aforementioned documents are unquestionably connected to the provisions of Article 15 of the Ley Forestal, which provides that "Public Administration bodies may not exchange, transfer, dispose of in any manner, convey, or lease rural lands owned or administered by them unless they have first been classified by the Ministry of Environment and Energy.
If they are forested, they shall automatically be incorporated into the State Natural Heritage, and a restriction shall be established that must be recorded in the Public Registry." (Emphasis in the original). In its view, based on the information described above, it was reasonable to expect that, in light of his position and because that information concerned forestry and land use, among other matters, the plaintiff would take every necessary precaution to prevent the award of properties whose forest suitability had been clearly and expressly identified. It stated that this was contrary not only to Article 15 of Ley 7575—among other provisions of that same body of law—but also to Article 27 of the Ley de Uso, Manejo y Conservación del Suelo, which provides: “It shall be mandatory for the Instituto de Desarrollo Agrario to obtain land-use capability studies before acquiring land for titling purposes.
Every award of land shall be subject to the restriction that the use of the awarded land may not conflict with its land-use capability. Failure to comply with this provision shall result in revocation of the award, in addition to any other penalties that may be imposed for attributable offenses." (Boldface added). In the Court’s view, the clarity of the foregoing provisions is beyond question; despite this, the plaintiff admits that he voluntarily decided not to apply those provisions, particularly the aforementioned Article 27, stating in allegations 15 and 16 of his complaint that: "15. At that time, INTA had no established mechanisms for issuing soil-capability studies. This further reduces the degree to which the undersigned’s conduct in approving the resolutions may be deemed blameworthy, because, as between the technical and financial impossibility of submitting the study and the fact that its submission could not be required, on the one hand, and the public interest in legalizing the legal status of the peasant landholders, on the other, the latter had to prevail." (Boldface in the original).
"16. As a board member, the undersigned was legally charged with the duty to decide the titling applications submitted to the Board of Directors that met all requirements prescribed by the titling regulations then in force, as explained in allegation three of this complaint. The undersigned could not disclaim that authority and allow land without a designated purpose to remain in the hands of IDA, as that would have been unlawful and contrary to my duties as a public official. The responsible administrative bodies provided the Board with all required documentation and a recommendation that the land be awarded; therefore, there was no legal basis for denying titling or refusing to approve the resolutions." (Boldface in the original). Along these lines, it observed that the plaintiff’s reasoning regarding the precedence of the interests of the "peasant landholders" over the public interest was entirely unfounded.
First, it stated, satisfaction of the interest favored by the plaintiff obviously required compliance with all requirements established by the legal system, and because one of them—the land-use capability studies—was missing, that interest plainly could not be satisfied. It found that the interest had to be satisfied in accordance with the legal system unless an emergency existed—which was not the case—in which the principle of legality would yield to the principle of necessity; in the matter under review, provisions such as the aforementioned Article 27, Article 15 of 7575, and Article 50 of the Political Constitution were inexcusably violated, to mention or reiterate only some of those identified at the time by the oversight body in the challenged acts. Second, it explained that the plaintiff’s conduct, allegedly intended to satisfy an interest of the "peasant landholders" while disregarding a study required by the legislature, was clearly contrary not only to Article 27 of the aforementioned Law but also to Article 50 of the Constitution and, consequently, to Articles 13, 14, 15, and 33 of the Ley Forestal, as the oversight body repeatedly pointed out to him.
Accordingly, it concluded that, because the five parcels to be awarded and titled clearly possessed undeniable forest suitability, the minimum precaution and diligence required of the plaintiff was to comply with Article 27 of the Ley de Uso, Manejo y Conservación de Suelos, hereinafter LUMCS, and to take the necessary steps to dispel any doubt concerning the nature of the land and its soil capability. It explained that, despite the information concerning the types of forest and the general forestry conditions of the awarded properties, the claimant decided—without valid and reasonable justification—to disregard the requirement established in Article 27 of the aforementioned Law and, showing manifest disregard for the environment, conveyed properties of unquestionable forest suitability so that they could be devoted to agricultural activity. In this regard, it asserted that it was no justification for him to have imagined or presumed that, because the State had conveyed such land to the Institute, the land-use capability studies had already been conducted: he never reviewed them, did not ask whether they had been conducted, and, despite lacking certainty or clarity as to whether they existed, voluntarily decided, without any concern, not to apply Article 27 of LUMCS.
It emphasized that the plaintiff himself states—in allegation No. 21 of his complaint—that, "in any event, as established by the evidence submitted concerning allegation ten of this complaint, in 2010 MINAE expressly certified that the properties in question ‘DO NOT FORM PART OF THE STATE NATURAL HERITAGE.’" (Boldface and capitalization in the original). It disagreed, finding that this was not what had actually occurred, since the plaintiff generalized the foregoing assertion, whereas certifications ACOPAC-OT-C-001-10, 002-10, and 003-10, all dated May 7, 2010, established that the properties registered under plans SJ-866425-03, owned by Miguel Ángel Alvarado Granados; SJ-871001-03, owned by Felicia Jiménez Porras; and SJ-703262-01, owned by Lilliana Rodríguez Chaves, did not "FORM PART OF LANDS OF THE STATE NATURAL HERITAGE. The foregoing is consistent with the provisions of Article No. 13 of the Ley Forestal..." (Emphasis in the original).
It stated that the certification concerned three specific properties, not all of the awarded properties, as the plaintiff claimed. Furthermore, it noted that the plaintiff failed to mention that this evidence postdated the acts attributed to him and that, in connection with one of the judicial proceedings seeking annulment of the award and corresponding title—Exp. No. 08-001308-1027-CA—this Chamber took testimony from the official who issued those certifications, stating the following in judgment No. 1070-2010 at 9:40 a.m. on September 3, 2010: "VI.- Evidence obtained for further consideration. In that capacity, this Chamber admitted the certification issued by Eng. Carlos Vinicio Cordero, Director of Área de Conservación Pacífico Central, Sistema Nacional de Áreas de Conservación, of the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET). The aforementioned professional was also summoned to appear at the scheduled public hearing, and MINAET was required to submit: field inspection report ACOPAC-PNE-026-2010, the Dota 3344 map sheet from the basic map of Costa Rica, at a scale of 1:50.000, as well as the accompanying administrative record. Certification ACOPAC-OT-C-003-10, dated May 7, 2010, signed by Eng.
Carlos Vinicio Cordero Valverde, director of ACOPAC, states: “Having conducted a review of field inspection report ACOPAC-PNE-026-2010 and the corresponding review of the -Dota-3341 I map sheet of the base map of Costa Rica, scale 1:50.000, it has been determined, based on the recorded location and technical criteria, that the property identified by Real Property Folio registration number 562189-000, described in cadastral plan number SJ-703262-01, which lists Ms. Lilliana Rodríguez Chaves, identity card N° 2-244-235, as its owner, DOES NOT FORM PART OF THE STATE NATURAL HERITAGE (PATRIMONIO NATURAL DEL ESTADO). The foregoing is consistent with the provisions of Article N° 13 of Ley Forestal N° 7575 of 16 de abril 1996. Issued at the request of the interested party, at eleven thirty on 07 de mayo de dos mil diez” (see folio 852). This document, issued by a public official after the judgment under appeal was rendered, categorically sets forth an assertion that contradicted the evidence in the case file, inasmuch as a public official reaffirmed that the property at issue in these proceedings lay outside the State natural heritage.
In an effort to ascertain the truth, testimony was taken from Eng. Cordero Valverde, who stated at the hearing that, in preparing that certificate, despite the existence of a field study—to which reference was made—the factor considered in reaching the stated determination was the property’s registration status. He also indicated that, because the property is currently registered in the name of a private individual, that fact alone was sufficient for him to determine that it lay outside the State natural heritage. However, given that the present matter seeks the nullity (nulidad) of the acts and contracts that allowed the aforementioned property to leave State ownership and pass into private hands, the opinion expressed by Eng. Cordero Valverde, both in document ACOPAC-OT-C-003-10 and in his testimony, is wholly inadequate to alter the Tribunal’s ruling, since it is an established fact that the land at issue in these proceedings formed part of an asset that was initially owned by the State, which transferred it without registration to IDA; IDA then registered it in its own name and subsequently subdivided a parcel (segregó un lote), which it transferred to Ms.
Lilliana Rodríguez, although it had been covered by forest even before its registration. Therefore, the criterion for determining whether the property forms part of the State natural heritage cannot be limited to whether a private individual holds registered title (titularidad registral); rather, the property’s history must be investigated to establish whether it was owned by the State or any of its institutions and whether it is covered by forest, both of which are answered affirmatively, as analyzed in the challenged judgment in light of the discussion above. Likewise, report ACOPAC-PNE-026-2010, consisting of an inspection of the property at issue in these proceedings conducted on 19 de enero de 2010, reaffirmed that most of the land is covered by primary forest (bosque primario).” (Boldface in the original). Accordingly, it stated that not only does the certificate lack the general applicability that the plaintiff has been alleging, but its evidentiary value (valor probatorio) was entirely discredited by this Chamber, as demonstrated. It reiterated that the very official communications invoked by the plaintiff himself unquestionably establish his gross negligence (culpa grave).
VIII.This Chamber observes that, in order to decide the claim under review, it is necessary to determine whether the documentation presented to the IDA board members at the time of the events, on the basis of which they were required to establish the legality of their resolutions, would have compelled a reasonably informed person to conclude that the properties intended to be allocated for titling belonged to the State Natural Heritage (Patrimonio Natural del Estado, PNE). From that standpoint, official letter DIR-ACOPAC-154 of 7 de abril de 1999 (addressed by the Director of ACOPAC, Mr. Alfonso Duarte Marín, to the Director General of SINAC, Luis Rojas Bolaños) is significant, as it states that, following a review of the cartographic sheets, the map submitted by the IDA concerning the Proyecto de Titulación Los Santos was located: “…outside the boundaries of the Protected Areas, Reserva Forestal Los Santos and Reserva Biológica Cerro Vueltas…” (administrative record, digitized version, FOLIO 2).
Although that document adds that an official land-use capability methodology (metodología oficial de capacidad de uso de suelo) was required in order to protect lands classified as suitable for forestry, it undeniably states expressly that the aforementioned parcels were located outside the protected zones and forest reserves in question. For its part, Decreto no. 28746-MINAE-MAG, in its recital V, provides: “That the ‘Proyecto de Titulación Los Santos,’ promoted by the Instituto Desarrollo (sic) Agrario, contains lands that do not fall within the exceptions specified by laws no. twenty-eight twenty-five ‘Ley de Tierras y Colonización’ and Law no. seventy-five seventy-five ‘Ley Forestal,’ and therefore the free transfer thereof by the State to the Instituto Desarrollo (sic) Agrario must be authorized.” Likewise, recital VI of that Decreto states that: “…pursuant to articles six and seven of the Ley de Titulación de Tierras ubicadas en Reservas Nacionales number seven thousand five hundred ninety-nine and article fifteen of the Ley Forestal number seven thousand five hundred seventy-five, the Instituto de Desarrollo Agrario afforded the Ministerio de Ambiente y Energía an opportunity to be heard, and the latter, through official letter number DIR-ACOPAC-154 dated siete de Abril de mil novecientos noventa y nueve, authorized the titling of the lands included within the Programa de Titulación ‘Los Santos,’ because they did not fall within the management categories regarded as Patrimonio Natural del Estado…” (folios 3 to 6 of the administrative record).
Consequently, that Decreto ordered the transfer to the IDA of the lands in question, which were subsequently allocated by that institution to smallholders who had occupied them for more than 10 years. The documentation clearly provides no basis for concluding that, at the time of the events, any legal reason existed that would have prevented the transfer of the aforementioned properties to the smallholders. Indeed, although it is argued that the Decreto in question was declared unconstitutional, this did not occur until 13 de junio de 2007 (Sala Constitucional no. 8457-2007); (fact deemed proven 2), that is, years after the Board of Directors’ resolutions that gave rise to the sanctions under review. A similar situation applies to official letters ACOPAC-OTC-065 del 25 de noviembre de 2002, ACOPAC-OTC-119-03 del 25 de abril de 2003, ACOPAC-OTC-219-03 del 16 de julio de 2003, and ACOPAC-OTC-259-03 del 07 de agosto de 2003 (folios 425 of the electronic administrative record).
Even though they refer to the existence of forest on the properties, it is clear that, in those letters, MINAE certified to the IDA that those parcels were not part of the PNE and therefore could be titled or allocated by the IDA. Furthermore, in 2001, the Sala Constitucional reviewed the constitutionality of the aforementioned Decreto as part of the judicial consultation concerning the Ley de Titulación de Tierras en Reservas Nacionales, concluding that Decreto 28746 was consistent with the Constitución Política because it was based on Ley 2825. Consequently, when the claimant served as an IDA board member and cast his vote to authorize the allocation of the lands, there was no sufficient warning that would have enabled a person without legal qualifications to suspect that the administrative conduct in question might be unlawful. Accordingly, there was no gross negligence (culpa grave), recklessness, or negligence of the kind required to sanction him, resulting in a violation of provisions 82 subsection 4) of the CPCA and 330 of the CPC, as well as the improper application of provisions 72 of the LOCGR, 199 of the LGAP, and 34 of the Constitution, grounds that require this objection to be upheld. In view of the manner in which the case will be decided, the remaining grievances and supplemental arguments raised by the cassation appellant will not be examined.
IX.In his ancillary claim, the claimant seeks compensation for non-pecuniary harm (daño moral) arising from the disciplinary proceedings and the sanction unlawfully imposed upon him by the CGR, despite its knowledge of the prior final criminal judgment of acquittal having the force of res judicata (cosa juzgada), as well as the absence of fault in his conduct. He contends that subjective non-pecuniary harm (daño moral subjetivo) consists of the emotional injury to his psyche and personal dignity; his feelings of sadness and frustration from being subjected to public scorn and to gestures of disapproval and rejection when news of his dismissal and disqualification became known; the disruption within his family; and financial concern caused by having to seek employment in the private sector when he was more than 50 years old. He adds that, after more than six years of criminal proceedings against him, he was subjected to a new administrative case for another two years, which caused him significant mental exhaustion and prevented him from having the psychological stability necessary and optimal to face everyday life, as well as from enjoying good health in the broad sense of the term.
He further seeks compensation for objective non-pecuniary harm (daño moral objetivo), consisting of the negative public exposure of his image before Costa Rican society when the media reported his dismissal and disqualification from holding public office, taking into consideration that, at the time the sanction was imposed, he held public office as the highest-ranking official of the Instituto Costarricense de Ferrrocarriles. He assessed the subjective non-pecuniary harm at ¢64.800.000,00 and the objective non-pecuniary harm at ¢43.200.000,00.
X.According to this Chamber’s settled case law, subjective non-pecuniary harm may be assessed in re ipsa. It is evident that, in the matter under review, the claimant was subjected to administrative proceedings even though there was no sufficient warning that would have enabled a person without legal qualifications, such as the claimant, to suspect that the administrative conduct in question might be unlawful. As stated in recital IV of this judgment, although in this case the administrative acts through which the IDA transferred to private parties lands that, according to the CGR, formed part of the PNE were consistent with the administrative legal order, the oversight body decided to initiate new administrative proceedings against him, in which he was sanctioned by being disqualified from holding public office. Indeed, it was established that official letter DIR-ACOPAC-154 of 7 de abril de 1999 determined that, following a review of the cartographic sheets, the map submitted by the IDA concerning the Proyecto de Titulación Los Santos was located: “…outside the boundaries of the Protected Areas, Reserva Forestal Los Santos and Reserva Biológica Cerro Vueltas…”.
For its part, Decreto no. 28746-MINAE-MAG, in its recitals V and VI, stipulated that the lands included in the “Proyecto de Titulación Los Santos” did not fall within the exceptions specified in laws no. 2825 and 7575, and therefore their transfer to the IDA was required to be authorized. It likewise states that MINAE, in official letter number DIR-ACOPAC-154 del 7 de abril de 1999, “…authorized the titling of the lands of the Programa de Titulación ‘Los Santos,’ because they were not included within the PNE…”. Accordingly, the existing documentation did not support an interpretation that any legal objections existed which, at the time of the events, would have prevented the transfer of the aforementioned properties to the smallholders. It is therefore reasonable to conclude that the claimant suffered emotional harm, since he was sanctioned in the proceedings conducted by the CGR without any evident grounds for doing so, causing him feelings of sadness, anguish, and frustration.
This requires an award for subjective non-pecuniary harm, although not in the amount claimed by the claimant, but rather in the amount of ¢5.000.000,00, which is more consistent with the awards previously granted by this Chamber in similar circumstances. As for objective non-pecuniary harm, it must be denied for lack of supporting evidence, since the record contains no elements from which it could be established that harm of this nature actually occurred.
XI.In view of the foregoing, the appeal will be partially granted. Consequently, the judgment will be vacated. Ruling on the merits, the defense of lack of legal entitlement (falta de derecho) will be denied. The complaint will be partially granted, solely as stated herein. The resolutions of the Contraloría General de la República issued in administrative proceeding DJ-32-2013—no. PA-22-2013 de las 10:00 horas del 1 de noviembre de 2013 and no. R-DC-032-2014 de las 13:00 del 23 de abril de 2014—as well as all actions taken in expediente No. DJ-32-2013, are declared absolutely null and void. The sum of ¢5.000.000,00 will be awarded for subjective non-pecuniary harm. Costs shall be borne by the State and the Contraloría General de la República, pursuant to provision 193 of the Código Procesal Contencioso Administrativo, and shall be assessed during enforcement of the judgment. It is unnecessary to state that, in view of the manner in which the case is decided, no ruling is issued regarding the claimant’s remaining grievances and supplemental arguments.
XII.Dissenting opinion (voto salvado) of Magistrada Rojas Morales. I depart from the majority opinion with respect to the amount awarded for subjective non-pecuniary harm for the following reasons: the cassation appellant bases his claim on this issue on the fact that he was subjected to improper disciplinary proceedings for two years, which caused him pain, sadness, hopelessness, and compelled him to seek employment in the private sector when he was fifty years old. These considerations cannot be disregarded by the Chamber, given the circumstances surrounding this matter, in which harm of particular intensity did in fact occur, which the petitioner was under no obligation to endure, given the clarity of the documents in the record, which supported different conclusions, as stated in the judgment. Nevertheless, in my opinion, the amount awarded for subjective non-pecuniary harm is excessive, insofar as the claimant has received restorative justice from this Chamber through the annulment of the sanction and of the disciplinary proceedings instituted against him, as he requested.
Nor can it be overlooked that the cassation appellant held a position of political trust, meaning that he did not enjoy the security of tenure that accompanies the indefinite appointment of an official selected through a public competitive process and possessing employment stability. I believe this factor must also be considered when awarding the requested compensation, since the position he held did not guarantee stability, and the possibility that he might have to seek other employment is inherent in this type of appointment and cannot be regarded as an additional injury. For the reasons stated, I consider that the compensation should be set at the sum of two million colones.
THEREFORE
By majority, the appeal (recurso) is partially granted. The appealed judgment is vacated. In its place, ruling on the merits, the defense of lack of legal right (falta de derecho) is denied. The complaint (demanda) is partially granted, and resolutions no. PA-22-2013 of the Contraloría General de la República, issued at 10:00 hours on 1 de noviembre de 2013, and no. R-DC-032-2014, issued at 13:00 hours on 23 de abril de 2014, as well as all proceedings conducted in administrative proceeding (procedimiento administrativo) no. DJ-32-2013, are declared absolutely null and void. The amount of ¢5.000.000,00 is awarded for subjective moral damages (daño moral subjetivo). Costs (costas) shall be borne by the State and the Contraloría General de la República. Magistrada Rojas Morales dissents.

Proceso de conocimiento declarado de Puro Derecho, interpuesto por Miguel Carabaguíaz Murillo, mayor, contra el Estado, representado por el Procurador B, Alonso Arnesto Moya, mayor, casado, Abogado, vecino de Heredia y la Contraloría General de la República, representada Jaínse Marín Jiménez, mayor, soltero, Abogado, vecino de Escazú y Francella Navarro Moya, mayor, soltera, Abogada, vecina de Heredia.

CONSIDERANDO
I.Miguel Carabaguías Murillo demandó a la Contraloría General de la República (en adelante CGR); y, al Estado. Puntualizó, durante los años 2004 y 2005 fungió como Director del IDA. Manifestó, el 12 de julio de 2000, mediante Decreto Ejecutivo no. 28746-MINAE-MAG publicado en la Gaceta no. 134, el Poder Ejecutivo traspasó en forma gratuita al Instituto de Desarrollo Agrario (hoy INDER, en adelante IDA), un área de tierras comprendidas en el territorio definido en el cardinal 1 del decreto para crear el “Programa de Titulación Los Santos”. Dijo, el fin último del decreto era traspasar terrenos a favor de ocupantes agrícolas en la zona. Aseguró, ahí se ubicaban desde hace varios años, ocupantes de predios que no tenían regularizada la posesión de esos inmuebles. Transcribió parcialmente el texto del Decreto de cita. Reveló, el 12 de agosto de 2002, conforme al numeral 179 de la Ley del ITCO (hoy INDER), la Junta Directiva del IDA, en artículo 2 de la sesión 055-02, aprobó el “Reglamento para la Titulación de Tierras en Reservas Naturales” (en adelante RTTRN), publicado en la Gaceta no. 173 del 10 de setiembre de 2001.
Explicó, la Ley del IDA obligaba en sus numerales 1, 2, 4, 6, 13, 15, 16 a esa institución a titular las tierras que por cualquier motivo le fueran traspasadas, creando un impedimento legal para conservarlas sin función alguna. Expresó, durante su ejercicio, la Junta Directiva asignó a cinco parceleros fincas ubicadas en la zona definida por el Decreto no. 28746-MINAE-MAG, ello en ejercicio de las facultades otorgadas por el canon 30 de la Ley del IDA. Citó los beneficiarios asignados y el número de plano. Enfatizó, por solicitud expresa de los ocupantes interesados, el Coordinador de Programas del Área de Titulación del Departamento Ordenamiento Agrario del IDA (en adelante Reglamento de Titulación) requirió autorización a la Junta Directiva, para adjudicar y titular esas tierras, indicando a la Junta, que éstas cumplían con las políticas institucionales, recomendación de las oficinas regionales, visto bueno de la Direcciones Regionales y los demás requisitos del RTTRN.
Relató, como parte de los requisitos que se exigían a los interesados, el numeral 11 del Reglamento de Titulación vigente a esa data contemplaba una “certificación original extendida por el MINAE en donde conste que el terreno a titular según el plano catastrado no está afectado o inmerso dentro de áreas de conservación, patrimonio natural del Estado.” Refirió, mediante oficios no. ACOPAC-OTC-119-03 de 25 de abril de 2003, ACOPAC-OTC-065 de 25 de noviembre de 2002, ACOPAC –OTC-219-03 de 16 de julio de 2003, y ACOPAC-OTC-259-03 de 7 de agosto de 2003, del Coordinador del Ordenamiento Territorial del Área de Conservación Pacífico Central, Sistema Nacional de Aéreas de Conservación del Ministerio de Ambiente y Energía (en lo que sigue COTPACSINAC), con pleno conocimiento de los fines de titulación para los cuales se le solicitaban, certificó que las propiedades se encontraban fuera de Aéreas Silvestres Protegidas, sin afectación al numeral 33 de la Ley Forestal.
En virtud de ello, adujo, visto que los interesados cumplían los requisitos de ley para titular tierra esas heredades, la Junta Directiva así lo autorizó, según acuerdos no. 32 de la sesión ordinaria no. 016-04 del 13 de mayo de 2004 y no. 31 de la sesión 005-05 del 7 de febrero de 2005. No obstante, aclaró, en el año 2007 fue querellado por la CGR junto con otros funcionarios del IDA por los delitos de prevaricado y peculado (causa penal 07-000026-621-PE), por considerar, los inmuebles titulados forman parte del Patrimonio Natural del Estado (en lo que sigue PNE). Estipuló, posteriormente, mediante oficios no. ACOPAC-OT-001-10 de 7 de mayo de 2010, relativo a informe ACOPAC-PNE-027-2010, no. ACOPAC-OT-C-002-10 de 7 de mayo de 2010, relativo a informe ACOPAC- PNE-025-2010, y no. ACOPAC-OT-C-003-2010, relativo a informe ACOPAC-PNE-026-2010, el SINAC certificó que las áreas de las fincas en cuestión, no forman parte del PNE.
Comentó, por sentencia de las 16 horas 30 minutos del 9 de setiembre de 2013, el Juzgado Penal del II Circuito Judicial de San José, dictó sobreseimiento definitivo en su favor por considerar, actuó conforme a la reglamentación interna de acatamiento obligatorio y al principio de legalidad. A pesar de ello, manifestó, el 4 de julio de 2013, casi ocho años después, la CGR inició procedimiento administrativo en su contra, por la titulación de examen (expediente DJ-32-2013). Afirmó, a pesar del sobreseimiento de cita, en el acto final del procedimiento en cuestión, -PA-22-2013 de las 10 horas del 1º de noviembre de 2013-, se le declaró administrativamente responsable de haber actuado con culpa grave e incurrir con su voto en negligencia e imprudencia, en la administración de terrenos parte del PNE. Concluyó, en resolución R-DC-032-2014 de las 13 horas del 23 de abril de 2014, se le impuso una prohibición para ostentar cargos públicos por seis años.
Solicita en sentencia se declare: a) la nulidad de las resoluciones no. PA-22-2013 de las 10:00 horas del 1 de noviembre de 2013 y no. R-DC-032-2014 de las 13:00 del 23 de abril de 2014, así como todo lo actuado en el expediente DJ-32-2013. 3; b) la prescripción del procedimiento administrativo instaurado por la CGR en su contra; c) que dicho procedimiento administrativo no podía ser iniciado existiendo una sentencia penal en firme la cual tuvo por no demostrados los hechos que lo sustentaron, por lo cual es contrario al ordenamiento jurídico, quebrantando la cosa juzgada y el non bis in ídem (numeral 42 de la Constitución Política); d) no es responsable administrativamente en los hechos imputados ni actuó con culpa grave; e) son las costas a cargo de las codemandadas. Accesoriamente, requirió el pago de daño moral subjetivo por ¢64.800.000,00; y, daño moral objetivo por ¢43.200.000,00. Los codemandados contestaron negativamente. Opusieron la defensa de falta de derecho. El Tribunal la acogió. Declaró sin lugar la demanda. Impuso las costas al accionante, quien inconforme acude en casación.
Recurso por razones procesales
II.En el único cargo de esta naturaleza, el recurrente acusa violación de la cosa juzgada material. Revela, en la sentencia que ataca se tiene por probado, fue objeto de un proceso penal por peculado y prevaricato, en el cual se dictó un sobreseimiento definitivo. Esgrime, la sentencia penal concluyó, los elementos de prueba que tuvieron los miembros de la Junta Directiva del ID, para titular los terrenos, no indicaban se estaba en presencia del PNE. Esboza, los jueces penales analizaron los tipos penales de prevaricato, incumplimiento de deberes y peculado, apreciaciones de las cuales derivan hechos probados y no probados que les motivaron a establecer, su actuar fue lícito sin que se llegara a configurar ninguno de los delitos. Expresa, el fallo penal tiene efectos de cosa juzgada material, sin que sea cierto que el análisis realizado se limitara a la comisión de los delitos investigados, pues también se concluye sobre la legalidad de las actuaciones revisadas.
Indica, si los hechos son lícitos para el Juez Penal no pueden ser ilícitos para la CGR ni para el Juez Contencioso. Invoca, la sentencia es concluyente en cuanto a su conducta, calificando las conductas como válidas y lícitas lo cual produce efectos de cosa juzgada respecto tanto en la vía administrativa como en la contenciosa. Explica, la sentencia penal refiere: “Es decir, previo a esta fecha, no se podría indicar fundadamente que los imputados actuaron contrario a la ley”. (…) “Sin embargo, al momento de su creación y aplicación, los personeros del IDA no actuaron contrario a la ley, sino amparados a la misma y aunque posteriormente se declarara inconstitucional, al momento de su aplicación estaba vigente y la norma les daba esa facultad” (…) “Los funcionarios actuaron basados en una reglamentación interna de acatamiento obligatorio y bajo el deber de obediencia y en cumplimiento del principio de legalidad que debe regir la actuación de todo funcionario público”.
Insiste, de las apreciaciones trascritas se concluye, en la vía penal se calificaron sus hechos como lícitos, calificación que produce cosa juzgada e impide a la CGR recalificarlos y dictar las resoluciones que ha impugnado en este proceso, por lo cual la sentencia atacada es nula. Manifiesta, el fallo que combate desconoce la cosa juzgada pronunciándose de manera contraria a lo resuelto en vía penal. Cita fallo de la Sala Constitucional en apoyo de su tesis. Menciona, la sentencia que combate comete grave error de derecho al señalar, no hubo cosa juzgada en el proceso penal, porque es una sentencia de sobreseimiento definitivo. Precisa, si bien la CGR abrió el proceso administrativo para determinar si la conducta analizada en sede penal generó alguna responsabilidad administrativa, lo hizo ignorando por completo que en la vía penal se concluyó, las actuaciones eran lícitas y acorde a la ley vigente en ese momento.
Prosigue, desconoció de esa manera el Tribunal, el contenido absoluto de la sentencia penal, al revisar nuevamente las conductas y concluir lo contrario. Dice, el auto de apertura de la CGR es nulo, pues los motivos que utiliza para justificarlo ya habían sido resueltos en sede penal. Aporta cuadro comparativo entre lo alegado por la CGR en el auto de apertura, lo resuelto en sede penal y en la sentencia contenciosa que ataca. De esa manera, expone, la CGR ni siquiera debió abrir un proceso por esos mismos hechos ya revisados en la vía penal. Reclama, la sentencia reconoce que si hay cosa juzgada material más la limita, al considerar, el resultado de ese fallo se circunscribe al análisis de los delitos. Sin embargo, recrimina, el fondo de lo resuelto en sede penal es claro en calificar sus actuaciones como lícitas, de manera, que eso produce cosa juzgada respecto de la vía administrativa.
De esa suerte, reitera, acorde a la línea seguida por la Sala Constitucional, aunque sea válido tramitar de manera independiente un proceso penal y uno disciplinario, si en la vía penal se establece que los hechos no existieron, ello debe prevalecer sobre lo resuelto en otras vías. De lo expuesto, reclama la violación de la autoridad de cosa juzgada material de la sentencia penal, así como de las normas que regulan la cosa juzgada, por falta de aplicación del derecho, sean los numerales 162 y 163 del Código Procesal Civil y de los principios de cosa juzgada y seguridad jurídica protegidos por la disposición 42 Constitucional. Ello, refiere, implica que el Tribunal interpreta erróneamente el cardinal 313 del CPC, norma que se ve conculcada pues de ella parte para determinar que los hechos claramente establecidos en la sentencia de sobreseimiento, no alcanzan certeza para los efectos de cualquier otro proceso administrativo o jurisdiccional.
Cita doctrina extranjera en apoyo de su tesis. Adicionalmente reprocha, la sentencia penal hizo expresa mención de la no vinculatoriedad del dictamen C-321-2003 de la PGR para los directivos del IDA, lo cual debió respetar la CGR y el Tribunal. Ello, resalta, en virtud de que fue requerida en consulta por el MINAE no por el IDA. Finalmente, alega violentado el precepto 13 de la Ley de la Jurisdicción Constitucional.
III.El Tribunal indicó, referente a la alegada vulneración del principio de Non Bis In Ídem y la Cosa Juzgada Material, es claro que un mismo hecho puede motivar la apertura de procesos y procedimientos en varias vías -penal, civil y administrativa, siendo ellas esferas de responsabilidad diferentes e independientes. Aclaró, existe una vinculatoriedad o especie de preeminencia de lo que se tenga por probado en sede jurisdiccional, por lo cual, si una autoridad judicial tiene por acreditado un hecho en una resolución con autoridad de cosa juzgada material, éste no podría tenerse por indemostrado en sede administrativa. A la inversa, relató, es posible que en sede judicial se haya tenido como no acreditado un hecho en particular, que sí logró probarse posteriormente en sede administrativa para efectos patrimoniales o disciplinarios. Reveló, lo relevante es que esa prevalencia se refiere exclusivamente a lo que se tuvo por acreditado, no pudiendo la Administración Pública desconocer tal circunstancia, so pena, de quebrantar tanto el Non Bis In Idem como la cosa juzgada.
Ahora bien, comentó, tratándose de una sentencia de sobreseimiento definitivo que carece por completo de hechos probados y que tiene su fundamento en que los hechos acusados no se adecúan a los tipos penales de Peculado y Prevaricato por tratarse de figuras dolosas; y, tomando en cuenta que el Código Penal no contempla un tipo penal culposo de tales delitos, no es dable que ese fallo vincule a la Administración Pública en cuanto a la responsabilidad administrativa por culpa grave. Lo anterior, argumentó, en tanto el fallo de comentario no realiza ese análisis. Explicó, lo que el Juzgado Penal trató de determinar es que el actuar de los imputados no quebrantó dolosamente la legislación atinente a la materia y por ello, su accionar no resultaba penalmente reprochable. Lo anterior, acusó, no enerva la potestad y el deber de la Administración Pública de investigar si tales conductas resultan adecuadas a los supuestos de responsabilidad administrativa que por dolo o culpa grave contempla el ordenamiento jurídico.
Así rechazó la tesis de la vinculatoriedad de lo consignado en la resolución de sobreseimiento definitivo. También los alegatos del accionante en cuanto a criterios de la Sala Constitucional según los cuales, no sería dable imponer una sanción administrativa cuando el tipo penal ya la contemplaba como potestad sancionatoria del Juez. Refirió, la sentencia constitucional que menciona el demandante -no. 1798-1997 de las 15:15 horas del 2 de abril 1997-, en forma clara y precisa, indica que "El principio, constitutivo del debido proceso quedaría infringido si el órgano jurisdiccional penal que examina la causa... pudiera imponer, en caso de fallo condenatorio, como pena accesoria alguna sanción relativa a la responsabilidad ética del imputado como miembro de un partido político, hipótesis evidentemente absurda." Expresó, para estar dentro de este supuesto, se requeriría imponer en sede penal mediante sentencia condenatoria al imputado, solamente la pena principal prevista en el tipo penal, pese a que también resultara viable, la imposición de una pena accesoria -de tipo disciplinaria- como la inhabilitación. Estipuló, evidentemente eso no fue lo que sucedió en el caso del accionante, por lo que estimó inatendible ese alegato.
IV.Es la posición reiterada de esta Cámara, que la cosa juzgada material consiste en el impedimento para discutir, en una nueva ocasión, una contienda ya resuelta por el órgano jurisdiccional competente, lo que significa que esa decisión tiene carácter inmutable y definitivo. Es un instituto de naturaleza procesal que recae sobre la relación sustancial, requiere coincidencia plena entre la controversia decidida y la ulteriormente planteada, esto es, identidad en los sujetos, el objeto y la causa. En esa misma línea, esta Sala ha señalado que se produce cuando “[…] entre dos procesos tramitados en sede judicial existe identidad respecto de las partes, del objeto y de la causa. Desde el plano subjetivo, el fallo firme vincula y obliga a los intervinientes, quienes se hayan impedidos, jurídicamente, para someter, de nuevo, la disputa ante otro órgano. Por su parte, el objeto y la causa son los criterios objetivos con base en los cuales se debe determinar si en un caso concreto existe cosa juzgada material.
El primero consiste en aquello que se reclama, es decir, se encuentra constituido por “el derecho reconocido, declarado o modificado en la sentencia, en relación con una cosa o varias cosas determinadas, relación jurídica declarada, según el caso” (sentencia 740 de las 14 horas 45 minutos del 1 de diciembre de 1999, reiterada mediante cita en los fallos 933 de las 9 horas 40 minutos del 24 de noviembre de 2006 y 710 de las 14 horas 15 minutos del 23 de octubre de 2008). La segunda, también denominada causa petendi, se identifica como el fundamento de lo pretendido, es “la razón de hecho enunciada en la demanda como fundamento de la pretensión. Esta [sic] conformada por el conjunto de hechos alegados como base de la demanda” (sentencia no. 985-F-S1-2009 de las 11 horas 5 minutos del 18 de setiembre de 2009). También ha esbozado este órgano decisor, existe la posibilidad de determinar responsabilidad por una misma conducta en diversas sedes, aspecto sobre el cual ha indicado, en sentencia no. 728, de las 9 horas 50 minutos del 29 de setiembre de 2005, que “acorde con la posición doctrinaria dominante (que esta Sala comparte), se ha concluido que un mismo acto o comportamiento de un sujeto, es susceptible de generar distintos tipos de responsabilidades, sea civiles, penales, administrativas o laborales.
De una misma conducta puede derivar una responsabilidad laboral, una penal y una civil, que resultan independientes en cuanto a los efectos, consecuencias y responsabilidades que derivan de dicho comportamiento o acto material. Desde este punto de vista, el principio de responsabilidad por la generación de daños a terceros exige una separación de la responsabilidad ex delicto respecto a las consecuencias que puedan generarse del hecho punible en sede penal.” (Consúltense también en esa línea el fallo 1350-2011 de las 10 horas 25 minutos del 25 de octubre de 2011). De esa suerte es claro, la responsabilidad por conducta administrativa, puede perfectamente ser analizada en diversas sedes sin que ello implique por si solo, se quebrante la cosa juzgada material. Ello por cuanto, se ha esbozado que: “La exoneración de la responsabilidad penal, no implica automáticamente exoneración de la responsabilidad patrimonial”, (resolución no. 8-2013 de las 9 horas 30 minutos del 17 de enero de 2013), de ahí que requiera un estudio más detallado.
Desde esa arista, si bien en la especie, se alude a la sentencia de sobreseimiento definitivo, constante a folios 1 a 22 del expediente judicial, dictada en sede penal a favor del accionante, de las 16 horas 30 minutos del 9 de setiembre de 2013, ello no descarta en absoluto, se discutan en esta vía, las consecuencias patrimoniales o disciplinarias de la conducta de cita. De lo abordado en el estudio realizado por este órgano decisor, es claro, la declaratoria de conformidad con el ordenamiento jurídico por parte del Juzgado Penal de las conductas supuestamente constitutivas de delitos que en su momento se le atribuyeron(folios 19 a 22 del expediente), no impide el estudio de las consecuencias patrimoniales o disciplinarias de las conductas administrativas de examen, razón que obliga al rechazo del cargo por violación de la cosa juzgada material.
Recurso por razones sustantivas
V.El casacionista formula cinco agravios de esta naturaleza. En el primero reclama violación a normas sustantivas cuando se tengan por demostrados o indemostrados hechos en contradicción con la prueba que consta en el proceso. Acusa, en razón de su cargo, de previo a concurrir con su voto para la titulación de las tierras, contó con el criterio previo favorable de todos los órganos competentes del IDA. Apunta, de hecho, en las actas de la Sesión Ordinaria no. 01604 del 13 de mayo de 2004 y de la Sesión Ordinaria no. 005-05 del 7 de febrero de 2005 de la Junta Directiva, se acredita la participación de un asesor legal. Señala, esta afirmación fue insertada como hecho quinto de la demanda. Denota, a folio 538 del expediente administrativo, los señores Gilberto Rodríguez Soto (Coordinador de Programas de Titulación) y el Ing. Juan Carlos Solórzano Morales (Jefe del Departamento Ordenamiento Agrario), mediante oficio No. STA-010-2005, manifestaron: "En cumplimiento a las políticas instituciones y con la recomendación de la oficina regional de BATAAN, según oficio ORS-10742004 y el visto bueno de la Dirección Regional de HUETAR ATLANTICA según oficio S/N y la revisión de los requisitos exigidos para el trámite de titulación por parte del Coordinador Agrario Regional y de conformidad con el Acuerdo de Junta Directiva descrito en el Artículo XX Sesión 065- 00 del 11 de setiembre del 2000, y habiéndose cumplido con todos los requisitos que establece el reglamento para la titulación de tierras en reservas nacionales publicado en el diario oficial la gaceta no. 173 del 10 de setiembre del 2002, al amparo de la ley de Tierras y Colonización no. 2625 del 14 de octubre de 1981 y la ley de creación del Instituto de Desarrollo Agrario no. 6735 del 29 de marzo de 1982, solicito la autorización para segregar y traspasar 11 lote parcela que a continuación describo, para que se le extienda el correspondiente título supletorio de dominio.” Explica, un oficio de la misma naturaleza se observa a folios 38 y 39 del expediente administrativo para las otras fincas tituladas en el año 2004.
Considera, la resolución del Tribunal omite deliberadamente la existencia de este oficio, el cual no solo fue expuesto como un hecho de la demanda (ver hecho 5to) y amparado por prueba admitida en este proceso (Folios 538, 539 y 38, 39), sino que tiene una especial trascendencia. Estima, el oficio acreditó que, previo a concurrir con su voto favorable a la titulación, contó y tuvo a la vista, al menos cinco criterios previos de los órganos técnicos y legales competentes del IDA. Manifiesta, el oficio confirma se realizaron todos los estudios y trámites necesarios contemplados en el Reglamento de la Titulación. Expresa, estos oficios que contienen el Visto Bueno de los departamentos técnicos y legales encargados, aunados al Decreto No. 28746 que expresamente indicaba que los terrenos no estaban afectos a la Ley Forestal, junto con las certificaciones del MINAE en el mismo sentido, son tres hechos contundentes que mitigan cualquier posible culpa "grave" en su actuación.
Expone, no comprende el motivo por el cuál estaba obligado a dudar o cuestionar la legalidad de la titulación cuando tenía oficios varios de visto bueno de los funcionarios competentes del IDA, certificaciones del MINAE y un Decreto que expresamente había indicado que los terrenos no estaban afectados a la Ley Forestal y no formaban parte de Áreas Protegidas. Lastimosamente, opina, el tribunal vulnera la sana crítica racional, omite el hecho quinto por completo, realizando un análisis parcializado y aislado sobre los hechos que le llevaron a aprobar la titulación. Considera, llama la atención que en la sentencia no se tengan por "indemostrados" hechos. Resalta, al menos los hechos en que se sustentó la demanda debieron tenerse por no probados si el juez declaró sin lugar la demanda. Interpreta, en una sentencia, precisamente los hechos no probados son la causa de que no prospere la demanda, pero en este caso, no hay ninguno con esa característica.
Desde su perspectiva, el fallo conculcó el mandato 15.3.d del Código Procesal Civil por desaplicación, el cual exige indicar las razones por las cuales no se tuvieron como probados algunos de los hechos de la demanda. En este caso, menciona, el hecho quinto de la demanda era de trascendental incidencia en el proceso, fue plenamente demostrado, pero no hubo referencia a éste en la sentencia. Estipula, también se vulneran los numerales 199 de la Ley General de la Administración Pública (en lo que sigue LGAP) y 72 de la Ley Orgánica de la Contraloría (en lo sucesivo LOCGR), por indebida aplicación, normas en las cuales se basó el Tribunal como criterio de imputación de responsabilidad subjetiva. Concluye: a) a folios 38, 39, 538 y 539 del expediente administrativo constan dos oficios de un órgano competente del IDA que daba cuenta de varios vistos buenos para titular los terrenos, requisitos constitutivos del acto administrativo; b) la existencia de esos oficios se hizo constar como "hecho quinto" de la demanda; c) la sentencia impugnada no hace referencia a ese hecho ni a los oficios aludido, omitiéndolos sin brindar las razones para ello; no hay valoración como prueba ni como derecho aplicable.
Detalla, es un hecho trascendental para su defensa porque elimina cualquier calificación de conducta grave en contra de los deberes inherentes al cargo de Director; y, por ende, el grado de responsabilidad en la adopción de los acuerdos. Estima, tal omisión le causa indefensión. Finaliza, la sentencia impugnada vulnera el artículo 153.3.d del CPC, que obliga a indicar los hechos no probados y brindar razones de por qué se tuvieron por indemostrados. En el segundo reproche, el recurrente argumenta, violación de normas sustantivas por haberse atribuido a la prueba una indebida valoración, o haberse preterido. Dice, la sentencia no valoró la prueba en su conjunto acorde a las reglas de la sana crítica (Art. 82.4 del CPCA y ordinal 330 del CPC). Agrega, tampoco valoró ni consideró la totalidad de la prueba, sino que se fundó únicamente en una parte del contenido de las certificaciones emitidas por el MINAE, requeridas en razón del procedimiento establecido en los cardinales 6 y 10 del Reglamento para la Titulación de Tierras en Reservas Nacionales (en lo consecutivo RTTRN), aplicable en ese momento.
Comenta, ambas disposiciones fueron quebrantadas por falta de aplicación. Explica, el Tribunal omitió indicar que las certificaciones las emitió el MINAE, como parte de los requisitos necesarios para titular las tierras, omitió además señalar que aunque indicaron había "cobertura boscosa" o "bosque", también revelaron que estaban fuera de cualquier limitación establecida en la Ley Forestal. Cita en ese sentido los documentos a) ACOPAC-OTC-119-03 de 25 de abril de 2003; b) ACOPAC-OTC-065 de 25 de noviembre de 2002, c) ACOPAC OTC-219-03 de 16 de julio 2003; y d) ACOPAC-OTC-259-03 de 7 de agosto de 2003. Analiza, lo anterior es importante para comprender que, junto con la demás (art. 330 CPC) considerada por el IDA para autorizar los traspasos, resultaba imposible sospechar que existiera alguna irregularidad. Así, subraya, la sentencia parte de un error de hecho, al considerar que los terrenos traspasados podían estar comprendidos dentro de las excepciones de la ley 2825, Ley de Tierras y Colonización y Ley no. 7575 Ley Forestal.
A su juicio, contó con prueba suficiente, que se le entregó, en su condición de directivo del IDA, la cual confirmaba, no estaba ante terrenos que formaran PNE. Sin embargo, aclara, el juez no la consideró en la sentencia, a pesar de que fue aportada con la demanda, consta en el expediente administrativo y fue admitida en la audiencia preliminar. Advierte, el juez únicamente tuvo por demostrada la existencia de PNE, ello en tanto consideró, la "cobertura boscosa" o de "bosque", equivale a PNE. Afirma, en los hechos tenidos por probados 1, 2 y 3, los jueces omiten referirse al contenido expreso de los preceptos 1 y 2 del Decreto 28.746, normas dejadas de aplicar y cuya violación se acusa, claros en indicar que la naturaleza de los terrenos traspasados era apta para titulación. Agrega, el tercer hecho se limita a una transcripción parcial de las certificaciones emitidas por el MINAE, sin referir para qué se requirieron ni que el MINAE certificó al IDA, que esas parcelas no son parte del PNE y por tanto, sí podían ser tituladas o asignadas por el IDA.
Apunta, los siguientes hechos tenidos por probados se refieren a que integró la Junta Directiva del IDA, (5), los acuerdos que autorizaron la titulación (6), la denuncia penal (7), que se omitió el estudio de suelos (8), que por sentencias firmes se anularon las adjudicaciones (9), y que en el 2010 el MINAE volvió a señalar que los terrenos no formaban parte del PNE, prueba que no es válida por las razones que indicó esta Sala (10). Argumenta, los hechos 12, 13 y 14 refieren las resoluciones de la CGR impugnadas. Alega preterido el Decreto Ejecutivo no. 28746-MINAE-MAG; el cual expresamente señalaba que los fundos estaban fuera de las excepciones de las leyes 2825 y 7575. En efecto, subraya, en el considerando V, se indica con claridad, que el proyecto en cuestión contiene tierras no comprendidas en la excepciones indicadas por dichas leyes, por lo cual debía autorizarse su traspaso. Asevera, desde un inicio se instruyó a la Junta Directiva del IDA, que tierras a asignar no estaban comprendidas dentro de ninguna excepción que impidiera al IDA asignarlas.
Considera, Decreto 28.746, en su artículo 2, decía que las tierras a las cuales se refería el decreto se dedicaban a potrero y agricultura, por lo cual, resulta irrazonable considerar, si el propio MINAE suscribió el Decreto, y posteriormente generó las certificaciones que permitían completar los requisitos para culminar la titulación, ¿por debía sospechar o inferir, que los fundos estaban afectados por el PNE? Dice, lo anterior implicaba desconocer el ordinal 13 de la LGAP, norma que también se estima quebrantada, por falta de aplicación. Desde otro ángulo, dice, no podía desobedecer un acto administrativo no pudiera reputarse manifiestamente ilegal o contrario a los principios de la lógica, la técnica o la razón. En su criterio, con sólo este alegato, se comprueba, los mandatos 199 de la LGAP y 72 de la LOCGR, son inaplicables al sub-lite, por ende, fueron violadas las reglas de la sana crítica racional por indebida aplicación del derecho.
Agrega, además la constitucionalidad del Decreto fue revisada por la Sala Constitucional en el año 2001, al evacuarse consulta judicial sobre la Ley de Titulación de Tierras en Reservas Nacionales, concluyéndose era inconstitucional. Enfatiza, sin embargo, consideró que el Decreto 28746 no era inconstitucional, por estar fundado en la Ley 2825. Transcribe parcialmente el fallo 8560-2001 del Tribunal Constitucional. Enuncia, el rechazo de la inconstitucionalidad de los Decretos se da además porque al concluir, se cumple el objeto de los decretos al permitir que los terrenos regulados por éstos podían ser adquiridos por terceros en los términos de la 2825. Exterioriza, ya para el año 2001, se había revisado por primera vez la constitucionalidad del decreto 28746, desprendiéndose de su contenido, que los predios traspasados carecían de limitaciones que impidieran continuar su aptitud de potrero y agricultura.
Puntualiza, el voto de la Sala Constitucional fue un elemento determinante, dio confianza a la Junta Directiva del IDA y a su persona para continuar los trámites, según consta en el acuerdo no. 32, folio 2587 del expediente administrativo. Esto, detalla, por cuanto, en aplicación del numeral 13 de la Ley de la Jurisdicción Constitucional, se actuó conforme a una resolución vinculante erga ommes, por ende, no puede calificarse de culpa grave su actuación, demostrándose la indebida aplicación de las disposiciones 199 de la LGAP y 72 de la LOCGR. Concreta, resulta irrelevante si el Decreto fue posteriormente anulado, pues no tenía cómo prever una declaratoria de inconstitucional posterior, pues para el momento de examen, había sido revisado y encontrado conforme al texto Constitucional. Precisa, lo contrario implicaría un quebranto directo al artículo 34 de la Constitución Política, (principio de no retroactividad), por falta de aplicación.
Especifica, al momento de aplicarlo el Decreto era válido y eficaz, sin razones para dudar de su contenido o constitucionalidad. En cuanto a la certificación del MINAE, evoca, posteriormente se solicitó al MINAE revisar si los terrenos, -tal y como indicaba el Decreto 28746-, podían ser asignados a terceros. Comenta, el RTTRN establecía en ese momento como requisito, la solicitud al MINAE a fin de certificar, si los fundos estaban afectados o inmersos en áreas de conservación o del PNE (Artículos 6 y 10). Sostiene, en esa línea el MINAE certificó que se econtraban fuera de áreas y zonas protegidas, y, que no había PNE. Resalta, la sentencia impugnada, consideró, ello era suficiente para desvirtuar todo la prueba y concluir estaban ante bosque, por lo cual no podían titularse, ello al confundir la definición de "bosque" del precepto 3 de la Ley 7575, con cualquier cobertura boscosa, además del concepto de PNE.
Recalca, el MINAE revisó los terrenos y señaló: "se encuentran fuera de Áreas Silvestres Protegidas. No se observa además, que se afecte el artículo No. 33 de la Ley Forestal No 7575 del 05 de febrero de 1996 y sus reformas (...);" lo cual, reiteró en el año 2010. Insiste, el MINAE emitió la certificación, para efectos del artículo 6 del Reglamento vigente aplicable en ese momento, sin oponerse, sin advertir al IDA que esos terrenos no podían titularse o sin retener la certificación solicitada precisamente por considerar que están afectos por PNE. A pesar de ello, manifiesta, la sentencia reitera que las certificaciones refieren la presencia de "bosque" como criterio para imputarle responsabilidad, por no haber dudado de la presencia de PNE. Indica, así el proceso de asignación de tierras continuó su trámite, sin que incurriera en culpa grave al permitirlo, puesto que el MINAE emitió la certificación requerida para continuarlo, a sabiendas del propósito de titulación para el que fue solicitada.
Expresa, la Ley Forestal contempla una obligación genérica de proteger el PNE, atribuyendo al MINAE el deber de certificar su existencia conforme a un estudio de campo. A su juicio, además, el Tribunal omite valorar que las tierras tituladas estaban ocupadas por los solicitantes desde hacía más de 10 años, incluso, cuando el MINAE emitió la certificación. Aclara, lo anterior es trascendental si se toma en cuenta que tanto esta Sala, como la Constitucional, han indicado que no todo bosque es inalienable, pues podía ser adquirido por ocupación mínima de 10 años (usucapión). Acusa, no existió instrucción previa del MINAE, de la PGR, ni de la CGR, a la titulación de los terrenos, que le indicara cualquier bosque es PNE, menos aún, que los terrenos de análisis no podían ser titulados. Así advierte, no participó en ninguna irregularidad, pues de la prueba citada nunca se la instruyó sobre la imposibilidad o irregularidad, que le hiciera cuestionar el Decreto 28746, el voto de la Sala Constitucional 8560 del 28 de agosto del 2001, las certificaciones del MINAE emitidas a ese fin, las actuaciones o recomendaciones de las oficinas del IDA encargadas del trámite.
Por el contrario, afirma, conforme a la Ley del IDA, su giro ordinario es la titulación de tierras a particulares. Agrega, el Decreto 28746 MINAE-MAG le traspasó tierras para asignarlas, la Sala Constitucional confirmó en el voto 8560-2001 que el objeto de las heredades era su asignación a terceros. Además, alega, de cada traspaso se publicaron los edictos en la Gaceta, sin embargo ni la PGR, ni el MINAE se manifestaron ni opusieron, quebrantando los preceptos 12 y 13 del RTTRN , ya que de aplicarse se configuraría una clara mitigación de la culpa en su actuar, lo que haría también inaplicables los artículos 199 LGAP y 72 LOCGR. Agrega, las propiedades fueron inscritas, y conforme al RTTRN había un plazo de 4 años para oponerse, (principio de publicidad registral), desaplicándose también el canon 15 RTTRN. Añade, la PGR atacó el RTTRN del 2002, hasta el año 2006, 4 años después. Apunta, es decir, para el momento en que funge como directivo, y concurre en la votación para autorizar las asignaciones, no existió ni una sola advertencia o irregularidad groseramente evidente, que le permitiera dudar, que lo que estaba haciendo podía ser ilegal o lesionar los bienes del Estado.
Considera, no es abogado, lo cual es un atenuante de cualquier culpa "grave", además fue asesorado por la oficina del IDA competente para el trámite de titulación, tuvo a la vista un Decreto que le traspasaba al IDA terrenos para ser asignados, además de las certificaciones del MINAE, “ente protector del PNE”, que para efectos de la titulación, permitieron continuar el trámite.. Argumenta, tampoco los integrantes de la Junta que son abogados notaron ni tenían por qué notar alguna irregularidad porque no existían situaciones de hecho suficientes para generar duda acerca de la legalidad. Asegura, incluso la CGR archivó el primer proceso en su contra, por considerar que existía duda sobre la naturaleza del terreno. Destaca, la sentencia desconoció el valor de la prueba preterida, concluyendo ilegalmente hechos incompatibles con su texto. Enfatiza, no pretende concluir que los terrenos titulados no eran parte del PNE, sino demostrar, que los elementos de prueba que tuvo a la vista y revisó, al concurrir con su voto y aprobar el proceso de titulación, indicaban, no se estaba ante el PNE, y mucho menos ante una actuación irregular.
Por ello, exterioriza, no hubo culpa grave, imprudencia o negligencia de su parte. Sobre el oficio DIR-ACOPAC-154 del 7 abril 1999, puntualiza, fue considerado como hecho probado no. 1 según la resolución impugnada, omitiendo indicar el Tribunal que fue dirigido al MINAE, no al IDA, por lo cual nunca formó parte del proceso de titulación ni fue del conocimiento de la Junta Directiva. Lo grave, estipula, es que fue tomado en cuenta por el Tribunal para achacarle responsabilidad y justificar la supuesta "gravedad" de la falta. Lo anterior, esgrime, se traduce en una vulneración adicional, por error de derecho de los mandatos 82.4 del CPCA y 330 del CPC, así como de los cardinales 199 LGAP y 72 LOCGR. Esboza, omite también el Tribunal indicar que ese oficio formó parte del expediente para el dictado del Decreto 28746 por parte del Poder Ejecutivo. Resalta lo único que prueba ese oficio es que el MINAE conocía -no el suscrito- de su existencia, a pesar de lo cual firmó el Decreto para traspasar las tierras para su asignación a privados.
De esa forma, invoca, la única responsabilidad en este caso corresponde al MINAE, quien incumplió su deber de velar por el PNE. Agrega, la PGR debió oponerse y reclamar que los terrenos tenían parte PNE al publicarse los edictos publicados en La Gaceta, a lo cual debió también oponerse el MINAE. Señala por ello una indebida aplicación del ordinal 72 de la LOCGR y el canon 199 de la LGAP.
VI.En el primer agravio, el casacionista reclama la violación del numeral 138 inciso b) del CPCA. Esgrime en esencia, el Tribunal incurre en la causal citada, la cual se presenta cuanto se tienen por demostrados o indemostrados hechos en contradicción con la prueba que consta en el proceso. Tal sería es el supuesto de una sentencia que tiene por demostrados hechos que no lo fueron, o indem ostrados, hechos que efectivamente fueron acreditados. De manera diversa, el cargo ha sido planteado en el sentido de que, los juzgadores omitieron deliberadamente el análisis de probanzas que en su criterio acreditaban la ausencia de culpa grave de su parte. También refiere el motivo, un análisis parcializado de la prueba, para posteriormente indicar, como ausente en el fallo, que se tuvieran por indemostrados tales hechos. De lo expuesto resulta incuestionable, la causal del inciso b) del mandato 138 del CPCA, no guarda relación con lo expuesto. Mientras la norma plantea un escenario de contradicción entre lo que fue efectivamente probado o no, y lo que en ese sentido fue incluido en el elenco de hechos probados o no, el cargo sostiene que aunque se pretirió prueba, ello no fue incluido en el fallo como un hecho no demostrado, argumentación que si bien pudiera ser válida como tal, no guarda similitud con la estructura del vicio que expone el precepto de cita, razón que obliga a su rechazo.
VII.Referente al segundo cargo, el Tribunal indicó, en lo que atañe a la naturaleza de los inmuebles adjudicados y a la falta de diligencia endilgada el actor, se ha tenido por acreditado, sí tuvo acceso a información sobre la aptitud forestal de los inmuebles adjudicados, la cual fue consignada en los siguientes documentos: a) Oficio No. ACOPAC-OTC-062 del 25 de noviembre de 2002: "... inspeccionada la finca correspondiente a plano catastrado SJ-600333-99, con área de 35 ha 0082,59 m2, ubicada en la Sabana de la Legua de Aserrí, San José, perteneciente a FR 1219039-000, a nombre del señor RONALD ELIZONDO SOLANO, céd. 1-709-134, que es terreno que se encuentra con cobertura de Bosque natural y bosque en sucesión temprana." b) Oficio No. ACOPAC-OTC-119-03 del 25 de abril de 2003: "...inspeccionada la finca correspondiente a plano catastrado SJ-703262-2001 , con área de 12 ha7380,37 m2, ubicada en Canet de San Marcos de Tarrazú, San José, perteneciente a FR 12199039-000 a nombre de LILLIANA RODRÍGUEZ CHAVEZ, céd. 2-224-235.
La propiedad se encuentra dedicada a la protección con bosque denso." c) Oficio No. ACOPAC-OTC-219-03 del 16 de julio de 2003: "...inspeccionada la finca correspondiente a plano catastrado SJ-866425-2003, con área de 59 ha 0252,66 m2, ubicada en el Diamante de San Lorenzo de Tarrazú, San José, perteneciente a FR 1219039-000, en posesión de MIGUEL ALVARADO GRANADOS, céd. 1-384-993. La propiedad se utiliza en agricultura y a la protección a través de bosque denso." d) Oficio No. ACOPAC-OTC-259-03 del 07 de agosto de 2003: "...inspeccionada la finca correspondiente a plano catastrado SJ-871001-03 con área de 52 ha 5037,62 m2, ubicada en el Caite de SanLuis de Turrubares, San José, perteneciente a FR 1219039-000, en posesión de FELICIA JIMÉNEZ PORRAS, céd. 1-596-432. La propiedad se encuentra con cobertura de bosque primario en sucesión clímax." e) Certificación No. SINAC-DS-OFAU-C-1228-2004 del 29 de marzo de 2004, el encargado de la Oficina de Atención al Usuario del Sistema Nacional de Áreas de Conservación del entonces MINAE, certificó que: "...se ha determinado con base en la ubicación consignada en el plano catastrado número 7-908302-2004 a nombre del IDA, poseedor BERTILIO BARRANTES SOLÍS, que este describe un inmueble que se ubica fuera de cualquier Área Silvestre Protegida, sea cual sea su categoría de manejo administrada por el Ministerio de Ambiente y Energía.
Sin embargo constituye parcialmente Patrimonio Natural del Estado, según artículos 13, 14 y 15 de la Ley Forestal 7575 del 16 de abril de 1996." f) Oficio No. DIR-ACOPAC-154 del 7 de abril de 199, suscrito por Alfonso Duarte Marín, Director del Área de Conservación del Pacífico Central, se consignó: "... Después de haber analizado y verificado en las hojas cartográficas correspondientes escala 1:50:000 correspondientes, hemos llegado a la conclusión que en el plano presentado por el IDA a esta Area (sic) de Conservación, sobre el "Proyecto de Titulación Los Santos", se encuentra ubicado fuera de los límites de las Áreas Silvestres Protegidas; Reserva Forestal Los Santos y la Reserva Biológica Cerro Vueltas. No omito manifestarle la importancia de que este proyecto contemple la metodología oficial de capacidad de Uso del Suelo, con el objetivo de que se dejen para protección los suelos clasificados como de aptitud forestal, ya que pretender explotar estas tierras con actividades agropecuarias constituye un gran riesgo para el bienestar socioeconómico y ambiental de los parceleros." El contenido de los mencionados documentos, tiene una incuestionable vinculación con lo establecido en el artículo 15 de la Ley Forestal, norma la cual establece que los "organismos de la Administración Pública no podrán permutar, ceder, enajenar, de ninguna manera, entregar ni dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el Ministerio del Ambiente y Energía.
Si están cubiertos de bosque, automáticamente quedarán incorporados al patrimonio natural del Estado y se constituirá una limitación que deberá inscribirse en el Registro Público." (El destacado es del original). En su criterio, a partir de la información señalada, era esperable que en razón de su cargo y por referirse la misma al tema forestal y al uso del suelo entre otros, el demandante tomara todas las previsiones necesarias para evitar se adjudicaran bienes cuya vocación forestal había sido clara y expresamente advertida. Dijo, ello a contrapelo no sólo del ordinal 15 de la Ley 7575 -entre otras normas de ese mismo cuerpo normativo-, sino además, de lo normado en el artículo 27 de la Ley de Uso, Manejo y Conservación del Suelo, la cual dispone: “ Será obligatorio para el Instituto de Desarrollo Agrario disponer de estudios de capacidad de uso de la tierra, antes de adquirir terrenos para fines de titulación.
Toda adjudicación de terrenos deberá tener como limitación que el uso del terreno adjudicado no pueda ir en contra de su capacidad de uso. El incumplimiento de esta disposición acarreará la revocatoria de la adjudicación, aparte de otras penas con que se pueda castigar por los delitos que le sean imputables." (La negrita es propia). A juicio del Tribunal, la claridad de las anteriores disposiciones es incuestionable, pero pese a ello, el actor acepta que por su propia voluntad decidió inaplicar las normas dichas y más particularmente el ordinal 27 antes mencionado, señalando en los hechos 15 y 16 de su demanda que: "15. El INTA no tenía para esa fecha, mecanismos previstos para otorgar estudios de capacidad de suelos. Esto disminuye aún más el grado de reprochabilidad de la conducta del suscrito en la aprobación de los acuerdos, ya que entre la imposibilidad técnica y económica de aportar el estudio y la inexigibilidad de su aportación; y el interés público de legalizar la situación jurídica de los campesinos poseedores de tierras, debía privar este último." (La negrita es del original).
"16. El suscrito, como directivo, estaba impuesto legalmente del deber de resolver las solicitudes de titulación que se le presentasen a la Junta Directiva, y que cumplieran todos los requisitos exigidos en el reglamento de titulación vigente en ese momento, tal y como se expuso en el hecho tercero de esta demanda. No podía el suscrito renegar de dicha competencia y consentir la conservación de tierras sin destino específico en manos del IDA, pues ello sería ilegal y contrario a mis deberes como funcionario. Los órganos administrativos encargados aportaron a la Junta todos los requisitos exigidos y una recomendación de adjudicación de las tierras, por lo que no había motivo legal para negar la titulación y no aprobar los acuerdos." (La negrita corresponde al original). En esta línea, apuntó, el razonamiento del actor sobre la prevalencia del interés de los "campesinos poseedores" por sobre el interés público, carece de todo sustento.
En primer lugar, estipuló, la satisfacción de ese interés por el que se inclinó el demandante obviamente exige el cumplimiento de todos los requisitos previstos en el ordenamiento jurídico y faltando uno -los estudios de capacidad de uso de la tierra-, obvio es que ese interés no podía ser satisfecho. Valoró, la satisfacción del interés debe hacerse conforme al ordenamiento jurídico, salvo que exista una situación de emergencia -que no es el caso-, donde el principio de legalidad se vea desplazado por el de necesidad y en el caso bajo estudio se quebrantaron inexcusablemente normas como el mencionado ordinal 27, el precepto 15 de la 7575 y el 50 de la Constitución Política, solamente por citar o reiterar algunos de los que en su momento indicó el órgano contralor en los actos impugnados. En segundo lugar, precisó, es evidente que la conducta del actor dirigida según dice a satisfacer un interés de los "campesinos poseedores", obviando un estudio exigido por el legislador, resulta contrario no sólo al artículo 27 de la mencionada Ley, sino al 50 constitucional y consecuentemente a la Ley Forestal en los ordinales 13, 14, 15 y 33 que reiteradamente le señaló el órgano contralor.
Así las cosas, concretó, al resultar evidente que los cinco terrenos que iban a ser adjudicados y titulados, tenían una innegable aptitud forestal, el mínimo de precaución y diligencia exigible al actor, era cumplir con lo normado en el artículo 27 de la Ley de Uso, Manejo y Conservación de Suelos en adelante (LUMCS), así como realizar las acciones necesarias para despejar cualquier duda respecto a la naturaleza de los terrenos y la capacidad de sus suelos. Detalló, el accionante ante la información sobre los tipos de bosques y en general las condiciones forestales en que se encontraban los inmuebles que se adjudicaron, decidió -sin una justificación válida y razonable-, obviar el requisito contemplado en el ordinal 27 de la mencionada Ley y en un evidente desprecio por el ambiente, entregó bienes de incuestionable aptitud forestal, para que se destinaran a la actividad agrícola. En este sentido, alegó, no cabe como justificación, que él se imaginó o presumió que si el Estado entregó tales terrenos al Instituto, ya los estudios de capacidad de uso de suelo se habían realizado, pues nunca los tuvo a la vista, tampoco preguntó si se habían realizado y pese a no tener certeza ni claridad respecto a la existencia de los mismos, decidió por su propia voluntad desaplicar sin reparo alguno, el artículo 27 de la LUMCS.
Puntualizó, el propio actor señala –hecho no. 21 de su demanda- que de "todas maneras, como se acredita con la prueba aportada respecto al hecho décimo de esta demanda, en el año 2010 el MINAE certificó expresamente que los terrenos en cuestión "NO FORMAN PARTE DEL PATRIMONIO NATURAL DEL ESTADO ". (La negrita y mayúscula corresponden al original). Discrepó, esto no es lo realmente acaecido, pues generaliza lo antes afirmado, cuando se ha tenido por demostrado, mediante certificaciones ACOPAC-OT-C-001-10, 002-10 y 003-10, todas de 7 de mayo de 2010, que los inmuebles catastrados bajo los planos SJ-866425-03, propiedad del señor Miguel Ángel Alvarado Granados, SJ-871001-03, propiedad de Felicia Jiménez Porras y SJ-703262-01, propiedad de Lilliana Rodríguez Chaves, no formaban "PARTE DE TERRENOS DEL PATRIMONIO NATURAL DEL ESTADO. Lo anterior en concordancia con lo expuesto en el Artículo No. 13 de la Ley Forestal..." (El énfasis corresponde al original).
Exteriorizó, lo certificado versaba sobre tres inmuebles en particular y no sobre la totalidad de inmuebles adjudicados, como lo plantea el actor. Además, enunció, omite señalar el demandante que esa prueba es posterior a los hechos a él endilgados, y, que, con ocasión de uno de los procesos judiciales de anulación de la adjudicación y respectiva titulación -Exp. No. 08-001308-1027-CA-, esta Sala, recabó el testimonio del funcionario emisor de aquellas, indicando en sentencia no. 1070-2010 de las 9:40 horas del 3 de setiembre de 2010, lo siguiente: "VI.- Prueba para mejor resolver. Esta Sala admitió en esa condición, la certificación extendida por el Ing. Carlos Vinicio Cordero, Director del Área de Conservación Pacífico Central, Sistema Nacional de Áreas de Conservación, del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET). Asimismo, se citó al profesional de referencia para que compareciera a la audiencia pública señalada, y se requirió al MINAET presentar: el informe de inspección de campo ACOPAC-PNE-026-2010, la hoja cartográfica Dota 3344 del mapa básico de Costa Rica, escala 1:50.000, así como el expediente administrativo que lo acompaña.
La certificación ACOPAC-OT-C-003-10, de fecha 7 de mayo de 2010, suscrita por el Ing. Carlos Vinicio Cordero Valverde, director de ACOPAC, indica: “Realizado el estudio del informe de inspección de campo ACOPAC-PNE-026-2010 y la revisión respectiva en la hoja cartográfica -Dota-3341 I del mapa básico de Costa Rica, escala 1:50.000, se ha determinado con base en la ubicación consignada y los criterios técnicos que el inmueble Folio Real matrícula número 562189-000, descrito en el plano catastrado número SJ-703262-01, en que aparece como propietaria la señora Lilliana Rodríguez Chaves, cédula identidad N° 2-244-235 NO FORMA PARTE DE TERRENOS DEL PATRIMONIO NATURAL DEL ESTADO. Lo anterior en concordancia con lo expuesto en el Artículo N° 13 de la Ley Forestal N° 7575 del 16 de abril 1996. Se extiende a solicitud del interesado, a las once horas treinta minutos del día 07 de mayo de dos mil diez” (véase folio 852).
Este documento, emitido por un funcionario público con fecha posterior al dictado de la sentencia recurrida, refiere de manera categórica, una afirmación que resultaba contraria a la prueba constante en el expediente, en el sentido de que, se reafirma por un funcionario público, que la finca objeto de este proceso, estaba fuera del patrimonio natural del Estado. En aras de llegar a la verdad, se procedió a tomarle declaración al Ing. Cordero Valverde, quien afirmó en la audiencia, que para la elaboración de dicha constancia, pese a existir un estudio de campo -al cual se le hizo referencia-, el aspecto que se valoró para determinar lo afirmado, fue la situación registral del inmueble. También indicó, que como la finca aparece actualmente registrada a nombre de un particular, este hecho le bastó para determinar que se encuentra fuera del patrimonio natural del Estado. Pero, partiendo de que, el presente asunto pretende la nulidad de los actos y contratos que permitieron que la finca aludida saliera del dominio del Estado, y pasara a manos de particulares, el criterio externado por el Ing. Cordero Valverde tanto en el documento ACOPAC-OT-C-003-10, como en su declaración, resulta del todo improcedente para modificar lo resuelto por el Tribunal, ya que es un hecho demostrado, que el terreno objeto de este proceso formaba parte de un bien, que primero fue propiedad del Estado, quien lo trasladó sin inscribir al IDA, ente que lo inscribió en el Registro a su nombre, y posteriormente segregó un lote, el cual traspasó a la señora Lilliana Rodríguez, siendo que desde antes de su inscripción, estaba cubierto de bosque.
Por lo tanto, el criterio para determinar si el inmueble forma parte del patrimonio natural del Estado no se puede limitar a que un particular ostente la titularidad registral, sino que se debe investigar los antecedentes de la finca, con el afán de precisar, si estuvo dentro del dominio del Estado o alguna de sus instituciones; y, si está cubierta de bosque, aspectos que tienen respuesta afirmativa según se analiza en la sentencia cuestionada, al tenor de lo expuesto líneas atrás. En igual sentido, el informe ACOPAC-PNE-026-2010, consistente en una inspección en la finca objeto de este proceso practicado el 19 de enero de 2010, reafirmó que el terreno, en su mayoría, está cubierto de bosque primario." (La negrita es del original). Así las cosas, enunció, no sólo la certificación carece de la generalidad que viene aduciendo el actor, sino que su valor probatorio, fue totalmente desvirtuado por esta Sala según fue demostrado. Reiteró, la existencia de los oficios que el mismo demandante invoca, son los que evidencian sin duda alguna, la culpa grave en el actuar del mismo.
VIII.Observa esta Sala, a fin de resolver el cargo de examen interesa determinar, si la documentación presentada a los señores directores del IDA al momento de los hechos, conforme a la cual debían establecer la legalidad de sus acuerdos, obligaba a concluir a una persona medianamente informada, la pertenencia al PNE de las propiedades que se pretendían asignar para efectos de titulación. Desde esa arista, resulta de importancia el oficio DIR-ACOPAC-154 de 7 de abril de 1999, (dirigido por el Director de ACOPAC, -señor Alfonso Duarte Marín-, al señor Director del General del SINAC, -Luis Rojas Bolaños-), en el cual consta, que de la revisión de las hojas cartográficas, el plano presentado por el IDA, sobre el Proyecto de Titulación Los Santos, se encontraba ubicado: “…fuera de los límites de las Áreas Protegidas, Reserva Forestal Los Santos y la Reserva Biológica Cerro Vueltas…” (expediente administrativo, versión digitaliza, FOLIO 2).
Si bien, dicho documento añade la necesidad de contar con una metodología oficial de capacidad de uso de suelo, a fin de proteger los clasificados como aptitud forestal, resulta innegable, expresamente refiere que los predios de cita, se encuentran fuera de las zonas protegidas y reservas forestales de interés. Por su parte el Decreto no. 28746-MINAE-MAG, en su considerando V, establece: “Que el “Proyecto de Titulación Los Santos”, impulsado por el Instituto Desarrollo (sic) Agrario, contiene tierras que no están comprendidas dentro de las excepciones que indican las leyes no. veintocho veinticinco “Ley de Tierras y Colonización” y la Ley no. setenta y cinco setenta y cinco “Ley Forestal, por lo que debe autorizar el traspaso de las mismas, en forma gratuita, por parte del Estado al Instituto Desarrollo (sic) Agrario”. Igualmente refiere dicho Decreto, en su considerando VI, que: “…al tenor de los artículos seis y siete de la Ley de Titulación de Tierras ubicadas en Reservas Nacionales número siete mil quinientos noventa y nueve y artículo quince de la Ley Forestal número siete mil quinientos setenta y cinco, el Instituto de Desarrollo Agrario otorgó audiencia al Ministerio de Ambiente y Energía y este mediante oficio número DIR-ACOPAC-154 de fecha siete de Abril de mil novecientos noventa y nueve autorizó la Titulación de las Tierras comprendidas dentro del Programa de Titulación “Los Santos”, por no estar las mismas dentro de las categorías de manejo consideradas Patrimonio Natural del Estado…” (folios 3 al 6 del expediente administrativo).
En consecuencia, dicho Decreto ordenó el traspaso al IDA de las tierras en cuestión, las cuales fueron posteriormente asignadas por dicha institución a parceleros que contaban con más de 10 años de ocuparlas. Claramente, de la documentación, no es dable extraer, existiera alguna razón de orden jurídico, que al momento de los hechos, impidiera traspasar los bienes de cita a los parceleros. De hecho, si bien se argumenta, el Decreto en cuestión fue declarado inconstitucional, esto solo ocurrió hasta el 13 de junio de 2007 (Sala Constitucional no. 8457-2007); (hecho tenido por acreditado 2), es decir, años después de los acuerdos de Junta Directiva que propiciaron las sanciones de estudio. Similar situación se presenta respecto de los oficios ACOPAC-OTC-065 del 25 de noviembre de 2002, ACOPAC-OTC-119-03 del 25 de abril de 2003, ACOPAC-OTC-219-03 del 16 de julio de 2003, ACOPAC-OTC-259-03 del 07 de agosto de 2003 (folios 425 del expediente administrativo electrónico).
Aún y cuando éstos refieren la existencia de bosque en los predios, es claro, en ellas el MINAE certificó al IDA, que esas parcelas no son parte del PNE, por lo cual si podían ser tituladas o asignadas por el IDA. Además en el año 2001, la Sala Constitucional revisó la constitucionalidad del Decreto ibídem, como parte de la consulta judicial sobre la Ley de Titulación de Tierras en Reservas Nacionales, concluyéndose el Decreto 28746, era acorde a la Constitución Política, por estar fundado en la Ley 2825. En consecuencia, al momento en que el actor fungió como directivo del IDA y concurrió con su voto para autorizar las asignaciones de los terrenos, no existió advertencia suficiente que permitiera a una persona, sin títulos en derecho, dudar, que la conducta administrativa en cuestión, pudiera ser ilegal. De esa suerte, no se presentó la culpa grave, imprudencia o negligencia requerida a fin de sancionarle, incurriéndose en la violación de los preceptos 82 inciso 4) del CPCA y 330 del CPC, así como la indebida aplicación de los numerales 72 de la LOCGR, 199 de la LGAP y 34 Constitucional, motivos que obligan a acoger el reproche. Por la forma en que se resolverá no se entrará al examen de los demás agravios y ampliaciones del casacionista.
IX.En su pretensión accesoria, el accionante reclama el pago de daño moral con ocasión del procedimiento disciplinario y de la sanción que le fue impuesta en forma ilegítima por parte de la CGR, a sabiendas de la sentencia penal absolutoria con carácter de cosa juzgada dictada previamente, así como la ausencia de culpa en su actuar. Estima que el daño moral subjetivo consiste en la afectación emocional a la psiquis y dignidad personal, los sentimientos de tristeza y frustración, al verse sometido al escarnio público y los gestos de desaprobación y rechazo cuando se conoció la noticia del despido e inhabilitación, la conmoción intrafamiliar y preocupación económica por tener que buscar trabajo en el sector privado, teniendo mas de 50 años de edad. Adiciona, luego de más de seis años de un proceso penal en su contra, se vio sometido a una nueva causa administrativa, durante otros dos años, lo cual le generó un agotamiento mental importante, ello le impide contar con una estabilidad psicológica necesaria y óptima para enfrentar la cotidianidad, así como gozar de buena salud en un sentido amplia del término.
Agrega a ello una petición por daño moral objetivo, consistente en la exposición pública negativa ante la sociedad costarricense a la que fue sometida su imagen, al publicarse en medios de comunicación su despido e inhabilitación para ejercer cargos públicos, tomando en consideración que al momento de la sanción, ocupaba un cargo público como funcionario de mayor jerarquía del Instituto Costarricense de Ferrrocarriles. Estimó el daño moral subjetivo en la cantidad de ¢64.800.000,00; y, el daño moral objetivo en ¢43.200.000,00.
X.Conforme a la tesis reiterada de esta Cámara, el daño moral subjetivo puede ser valorado in re ipsa. Es evidente, en el asunto de examen, el accionante fue sometido a un procedimiento administrativo a pesar que no existió advertencia suficiente que permitiera a una persona, sin títulos en derecho, como el actor, dudar, que la conducta administrativa en cuestión, pudiera ser ilegal. Como se indicara en el considerando IV de este fallo, aunque en la especie, existió conformidad con el ordenamiento administrativo de los actos administrativos por los cuales el IDA traspasó a particulares, terrenos que según la CGR formaban parte del PNE, el órgano contralor determinó iniciar un nuevo procedimiento administrativo en su contra, en el cual se le aplicó una sanción de inhabilitación para el ejercicio de cargos públicos. En efecto, se acreditó, el oficio DIR-ACOPAC-154 de 7 de abril de 1999, determinó que de la revisión de las hojas cartográficas, el plano presentado por el IDA, sobre el Proyecto de Titulación Los Santos, se encontraba ubicado: “…fuera de los límites de las Áreas Protegidas, Reserva Forestal Los Santos y la Reserva Biológica Cerro Vueltas…”.
Por su parte el Decreto no. 28746-MINAE-MAG, en sus considerandos V y VI, estipuló, que las tierras contenidas en el “Proyecto de Titulación Los Santos”, no están comprendidas dentro de las excepciones que indican las leyes no. 2825 y la 7575, por lo que correspondía autorizarse su traspaso al IDA. Igualmente hace constar que el MINAE en oficio número DIR-ACOPAC-154 del 7 de abril de 1999, “…autorizó la Titulación de las Tierras del Programa de Titulación “Los Santos”, por no estar comprendidas dentro del PNE…” De esa suerte, de la documentación existente, no era dable interpretar, existieran objeciones de naturaleza jurídica, que al momento de los hechos, impidieran traspasar los bienes de cita a los parceleros. Por consiguiente, es lógico considerar, el accionante se vio sometido a una afectación emocional, toda vez que fue sancionado en el procedimiento tramitado por la CGR, sin razones evidentes para ello, lo cual provocó sentimientos de tristeza, angustia y frustración.
Lo anterior obliga a un reconocimiento del daño moral subjetivo, mas no en la cantidad reclamada por el actor, sino en el monto de ¢5.000.000,00, el cual se ajusta más a las reparaciones concedidas en el pasado por esta Cámara por situaciones similares. Referente al daño moral objetivo, a falta de prueba que lo acredite, este deberá rechazarse, pues no obran en el expediente elementos que permitan establecer en efecto se haya dado una afectación de esta naturaleza.
XI.En mérito de lo expuesto, se declarará parcialmente con lugar el recurso. En consecuencia, se anulará la sentencia. Fallando por el fondo, se denegará la falta de derecho. Se declarará parcialmente con lugar la demanda, solo en lo que se dirá. Se declaran absolutamente nulas las resoluciones de la Contraloría General de la República dictadas dentro del procedimiento administrativo DJ-32-2013 no. PA-22-2013 de las 10:00 horas del 1 de noviembre de 2013, no. R-DC-032-2014 de las 13:00 del 23 de abril de 2014, así como todo lo actuado en el expediente No. DJ-32-2013. Por daño moral subjetivo se concederá la suma de ¢5.000.000,00. Son las costas a cargo del Estado y de la Contraloría General de la República, conforme al numeral 193 del Código Procesal Contencioso Administrativo, las cuales serán liquidadas en ejecución de sentencia. Demás está indicar que por la forma cómo se resuelve, se omite pronunciamiento sobre los restantes agravios y ampliaciones formulados por el accionante.
XII.Voto salvado de la Magistrada Rojas Morales. Me aparto del voto de mayoría, en relación con el monto otorgado por daño moral subjetivo por las siguientes razones: el casacionista sustenta su reclamo sobre este extremo, en el hecho de que fue sometido a un procedimiento disciplinario indebido durante dos años, que le causó dolor, tristeza, desesperanza y le obligó a buscar trabajo en el sector privado, cuando tenía cincuenta años de edad. Estos aspectos no pueden ser obviados por la Sala, dadas las circunstancias que rodean el presente asunto, en el que efectivamente se produjo un daño de especial intensidad, que el gestionante no estaba en obligación de soportar, dada la claridad del contenido de los documentos que constan en el expediente, que permitían arribar a conclusiones distintas, tal y como se ha indicado en el fallo; sin embargo, en mi opinión, el monto otorgado por daño moral subjetivo es excesivo, en el tanto el actor ha recibido justicia restaurativa por parte de esta Sala, al anular la sanción y el procedimiento disciplinario incoado en su contra, según lo peticionó.
Tampoco se puede dejar de considerar que, el casacionista tenía un nombramiento de confianza política, lo que implica que no gozaba de la estabilidad propia, que acompaña el nombramiento indefinido de un funcionario sometido a concurso público y con estabilidad laboral; aspecto que estimo también debe ser considerado a efectos de otorgar la indemnización solicitada, ya que el cargo que desempeñaba no le garantizaba estabilidad y, la posibilidad de tener que acudir a buscar otro trabajo, está implícita en este tipo de nombramientos y no puede considerarse una afectación adicional. Por las razones dichas, estimo que la indemnización debe ser fijada en la suma de dos millones de colones.
POR TANTO
Por mayoría, se declara parcialmente con lugar el recurso. Se anula la sentencia recurrida. En su lugar, fallando por el fondo, se deniega la falta de derecho. Se declara parcialmente con lugar la demanda y absolutamente nulas las resoluciones de la Contraloría General de la República no. PA-22-2013 de las 10:00 horas del 1 de noviembre de 2013, no. R-DC-032-2014 de las 13:00 horas del 23 de abril de 2014, así como todo lo actuado en el procedimiento administrativo no. DJ-32-2013. Se concede por daño moral subjetivo la cantidad de ¢5.000.000,00. Son las costas a cargo del Estado y de la Contraloría General de la República. Salva el voto la Magistrada Rojas Morales.
