Ordinary proceeding (proceso de conocimiento) heard by the Administrative Litigation Court, filed by VILLY ZÚÑIGA MORALES against LUIS DIEGO GUTIÉRREZ RODRÍGUEZ, ALBERT MORENO HERNÁNDEZ, ALEXANDER SÁNCHEZ CHAVARRÍA, ARNULFO ROSALES VILLALOBOS, all in their capacity as public officials, the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), and the STATE. Attorney Carlos Enrique Aguirre Gómez appears as special counsel (apoderado especial) for the plaintiff; the defendants are represented by ANEP, whose counsel is attorney Rosa Virginia Romero Bejarano; SINAC is represented by attorney Róger Francisco Gutiérrez Vindas; and the STATE is represented by State Attorney Laura Araya Rojas. The plaintiff filed an appeal in cassation (recurso de casación) against judgment no. 94-2019-V, issued at 13 hours 17 minutes on 11 de noviembre de 2019 by the Administrative Litigation Court, Fifth Section, Second Judicial Circuit of San José.

CONSIDERING

This matter arose from the complaint filed on 07 de noviembre de 2013 before the Administrative Litigation Court, in which the plaintiff stated that he held a harvesting permit (permiso de aprovechamiento) for four trees—three cedar trees (cedro odorata) and one oak tree (tabebuia rosea)—granted by SINAC, Área de Conservación Tempisque, through resolution ACT-072-2007-PALECO. He asserted that, while the permit remained valid, he cut down the authorized trees and sawed the cedar wood into boards of various sizes and the oak wood into slats. He explained that, on 29 de enero de 2008, four officials—who are among the defendants—came to his property to measure the wood against the permit granted. He stated that, once they had finished measuring it, one of the officials said that the volume of cedar wood exceeded the authorized amount, and they therefore told him that they had to seize (decomisar) all the sawn wood and place it at the disposal of the judicial authority.

They explained that, although some of the wood had been lawfully authorized, some had not and, given the uncertainty, both had to be seized. He alleged that he protested the unlawfulness of the order because authorized wood was being seized, but the officials “turned a deaf ear to my protest.” He maintained that, on a mere whim, the officials seized 119 cedar boards and 34 oak slats of differing characteristics. He stated that the seizure report (acta de decomiso) indicated: “The reason for the seizure is as follows: Under the authorized permit, a cedar tree whose cutting had been denied was cut down. It was cut down without authorization.” He explained that the report was served on him at the same place and time that the defendants carried out the confiscation. He charged that the defendants loaded the wood onto a dump truck and transported it to the yard where the MINAET office in Jicaral is located.

He recounted that they dumped it there without taking any care with such a fragile product and complained that this caused it to break or crack. He further complained that they left it piled as it had fallen after being dumped, in an uncovered area exposed to sun and rain and without any protection, from 29 de enero de 2008 until 10 de diciembre de 2012. He said that, on that day, the defendant officials returned the remaining wood to him pursuant to an order of the Court of the Second Judicial Circuit of Guanacaste (Nicoya). He complained that the defendants reported him to the Public Prosecutor’s Office, Nicoya Prosecutor’s Office, for the offense of damage to natural resources, which gave rise to case number 08-000196-0414-PE. He asserted that he was acquitted by a ruling issued at 07 hours and 38 minutes on 14 de octubre de 2011 and related that the ruling ordered MINAET officials to return the unlawfully seized wood.

He emphasized that, on 10 de diciembre de 2012, two of the defendant officials delivered to him 82 pieces of cedar and 4 oak slats; in his view, 37 pieces of cedar wood and 30 pieces of savanna oak were missing. He alleged that one of the officials sued herein, in official communication ACT-OSRLP-617-2012 addressed to the Nicoya Trial Court, stated that “the reason for the shortage is (as indicated as early as 07 de febrero del año 2008, through official communication ACT-OSRLP-071-2008) the lack of security conditions at the yard of this office, where the wood has remained since the time of its seizure (29-01-2008),” and continued by stating that “throughout the proceedings, from the seizure to the present, it has been necessary to move the wood internally on multiple occasions in an effort to place it under the least unfavorable conditions to prevent its loss and deterioration.” He complained that, while the wood was under the care and responsibility of the four defendant officials, they unlawfully disposed of and appropriated 37 cedar boards and 30 pieces of oak.

He further maintained that the 82 cedar boards and 4 oak strips that were delivered to him and that he accepted under protest were completely deteriorated. Some were cracked, either because of the careless manner in which the defendants unloaded them on 29 de enero de 2008 or because of the effects of the sun’s heat to which they were exposed outdoors for four years. He argued that all of them were rotten and damaged by wood fungus because they had been exposed to water for four years without any protection. Based on the foregoing, he requested that the judgment declare: “1) That the defendants caused me damages and lost profits (daños y perjuicios) through their unlawful and negligent administrative conduct by arbitrarily seizing wood belonging to me and keeping it in their custody in a state of complete abandonment for four years, which caused its total destruction.

  • 2)That the defendants are jointly and severally liable (solidariamente) to pay me two million one hundred sixty thousand colones as damages and one million three hundred forty-seven thousand colones as lost profits.
  • 3)That the defendants are jointly and severally liable to index, from 28 de enero de 2008 until the date on which payment is made to me, the amount that they are ordered to pay me as established in the judgment.
  • 4)That the defendants are jointly and severally liable to pay the attorney’s fees and litigation costs (costas personales y procesales) of this action.” The defendant public officials denied the complaint and raised the defenses of lack of standing and lack of capacity to be sued (Falta de legitimación activa y pasiva), as well as failure to state a legal right (Falta de Derecho). SINAC likewise denied the complaint and raised the defense of failure to state a legal right. The State also denied the complaint and raised the defenses of failure to state a legal right and statute of limitations (Prescripción).

II.In resolution no. 94-2019-V, issued at 13 hours 17 minutes on 11 de noviembre de 2019, the Administrative Litigation Court ruled: “The defense of Lack of Capacity to Be Sued is sustained. The COMPLAINT filed by VILLY ZÚÑIGA MORALES AGAINST Luis Diego Gutiérrez Rodríguez, Albert Moreno Hernández, Alexander Sánchez Chavarría, Arnulfo Rosales Villalobos, SINAC, and the State is declared INADMISSIBLE. The plaintiff shall bear both categories of costs in this action.” Dissatisfied with the ruling, the plaintiff filed an appeal in cassation on procedural grounds.

III.As the sole ground of appeal (agravio) based on procedural grounds, he alleges a violation of procedural rules, pursuant to articles 57, 134.1, 135.1, 137. d) and 139. 1), 2) and 3), all of the Administrative Judicial Procedure Code (Código Procesal Contencioso Administrativo, CPCA). He considers that the major premise of this judgment, which is the product of the intellectual exercise of logically analyzing the elements submitted for examination and is reflected as the product of an intellectual act of inference or deduction, is that no participation by the defendants that could have caused the damages (daños y perjuicios) claimed and sought to be declared in the judgment can be inferred from the complaint filed to seek an order against them. He points out that none of the 32 established facts (hechos probados) states that, once the defendant officials filed the criminal complaint with the Nicoya Prosecutor’s Office, the seized timber was placed at the disposal of that judicial office and that responsibility for safeguarding it lay with that office.

He states that established fact 16 determined that the official assigned to environmental control and protection for Área de Conservación Tempisque “indicated that the timber has been in the custody of the Conservation Area since its seizure and that, despite efforts to care for it, it has deteriorated considerably, although much of it was still usable; he therefore requested that the application be decided as promptly as possible due to the beginning of the rainy season and the accelerated deterioration of the timber.” He contends that the judgment introduces a false premise that is nonexistent and contradicts the established factual record, namely that “in this case, and without dispute, it has been established that, after the timber was seized from Mr. Zúñiga, it was taken to the SINAC facilities in Jicaral and that, for that reason, in the criminal complaint filed, as stated in article 54 of the Ley Forestal, the reporting officials, who are also defendants herein, in fulfillment of their legal duty, proceeded to issue the corresponding police report, namely, the complaint, in which they placed the seized timber at the disposal of the Nicoya Prosecutor’s Office.

Therefore, in this Court’s view, once the matter was referred to the criminal jurisdiction (jurisdicción penal), in this case to the Nicoya Prosecutor’s Office, the seized property was placed precisely at the disposal of that authority, which was then required, as appropriate, to take whatever measures were pertinent with respect to the seized property. Nevertheless, the timber remained at the SINAC facilities without the corresponding criminal authority making any determination regarding its location or actual custody.” He emphasizes that the judgment under appeal does not find it proven that the SINAC officials placed the timber at the disposal of the Nicoya Prosecutor’s Office; he asserts that the Court fabricated this finding in order to reach the conclusion that the lack of standing to be sued (falta de legitimación pasiva) applies to all defendants. He argues that the defendant officials seized the timber and kept it in their custody, in their capacity as SINAC officials, from the very moment of its seizure until the very moment of its delivery, as established, he contends, in numbered fact 16, cited supra.

He objects that neither the Nicoya Prosecutor’s Office, the Nicoya Criminal Court, nor the Nicoya Criminal Trial Court is declared to be the custodian (depositario) of the timber in the judgment under appeal. He alleges that the criminal complaint filed by the defendant officials with the Nicoya Prosecutor’s Office does not presuppose delivery of the timber to that office. He stresses that, in criminal matters, the commission of an unlawful act is established through the seizure and delivery of the property to the appropriate authority, provided that the property was the instrument used to violate the law—that is, that it constitutes evidence that the offense was committed with it. In his view, the seized timber had no procedural relevance to the criminal proceedings; for that reason, he considers it improper for the timber to have been delivered to that authority, since the conduct classified as a potential offense was the illegal felling of a cedar tree, a circumstance proven before the authority by the seizure report signed by the defendant officials and the plaintiff.

He criticizes the Court for, with the pernicious aim of evading resolution of this matter on the terms stated in the complaint—namely, the responsibility to determine the existence of damages, subjective liability (responsabilidad subjetiva) for them, and their quantification, which should have led it to conduct an exhaustive analysis of all the allegations and evidence entered into the record—having instead discerned the possible existence of an action attributable to persons other than those involved in the dispute (litis). He charges that the Court created the premise that, once the complaint was submitted to the Prosecutor’s Office, all the timber was placed at its disposal; that it was due to the negligence of the Judicial Branch itself that the timber belonging to the claimant was stolen and deteriorated; and that, from that moment onward, the officials and the other defendants ceased to have any interest in the seized property and, therefore, ceased to bear responsibility for what subsequently occurred.

IV.With respect to the challenged finding, the Administrative Court ruled: “I.- Established facts. (…) 8) By official letter N° ACTOSPA-061-2008, dated 31 January 2018 (sic), Luis Diego Gutiérrez Rodríguez, Albert Moreno Hernández, Alexander Sánchez Chavarría, and Arnulfo Rosales Villalobos, officials of the Paleco Subregional Office of Área de Conservación Tempisque of the Sistema Nacional de áreas de Conservación, signed a ‘Police Report’ through which they notified the Nicoya Prosecutor’s Office of the illegal felling of a tree on the property of Mr. Villy Zúñiga morales. The report details all actions taken, including the seizure, the quantities and description of the timber, and states: ‘Disposition of the seized property: the seized timber remains under cover at the PALECO Subregional Office in Jicaral, at the disposal of the Nicoya Prosecutor’s Office’ (Page 25 of administrative file N° TE-04-PP-067-2007, certified by the Coordinator of the Legal Advisory Office of Área de Conservación Tempisque, and Page 2 of judicial file N° 08-000196-414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya). 9) In official letter N° ACT-OSPA-071-2008 of 7 February 2008, the official of the Paleco Subregional Office of Área de Conservación Tempisque of SINAC informed the Nicoya Public Prosecutor’s Office that the timber seized from Mr.

Zúñiga Morales ‘...remains under cover and 90% protected from the sun.’ He further stated that they did not have a suitable warehouse in which to store the timber securely, much less surveillance outside working hours, and that, despite their efforts, they had been unable to find a better storage location. He therefore stated that it ‘...will remain at the facilities of this office until your authority determines otherwise...’ In light of all the foregoing, he requested that the Nicoya Public Prosecutor’s Office ‘...please promptly determine the disposition of the timber referred to throughout this official letter’ (Page 28 of administrative file N° TE-04-PP-067-2007, certified by the Coordinator of the Legal Advisory Office of Área de Conservación Tempisque, and Page 46 of the

judicial case file N° 08-000196-414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya). Said official letter appears as having been received by the Nicoya Prosecutor’s Office at 11:10 hours on 6 de marzo de 2008 (Page 50 of judicial case file N° 08-000196-414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya). 10) On 12 de marzo de 2008, the Assistant Prosecutor of Nicoya requested that the Criminal Court of Nicoya set a time and date for the public auction of timber seized according to report ACT-OSPA-061-2008, all in accordance with the provisions of section 65 of the Ley Forestal (Page 52 of judicial case file N° 08-000196-414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya). (…)

  • 14)In judgment N° 87-2011, issued at 7:38 hours on 11 de octubre de 2011, the Trial Court of the Second Judicial Circuit, Nicoya, ordered dismissal on statute-of-limitations grounds (sobreseimiento por prescripción) in case N° 08-000196-414-PE brought against Villy Zúñiga Morales for illegal logging and violation of the Ley Forestal, to the detriment of Natural Resources (Image 115 of the digital judicial case file, Page 48 of administrative case file N° TE-04-PP-067-2007, certified by the Legal Advisory Coordinator of the Área de Conservación Tempisque, and Page 204 of judicial case file N° 08-000196-414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya).
  • 15)On 5 de diciembre de 2011, in view of the dismissal ordered in the case, Mr. Villy Zúñiga requested that the Criminal Judge of Nicoya order the return of the timber seized from him, which he stated was located at the offices (sic) of the Ministerio de Ambiente y Energía in the Jicaral office (Page 210 of judicial case file N° 08-000196- 414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya).
  • 16)By official letter N° ACT-OSRLP-236-2012 dated 17 de mayo de 2012, the official assigned to environmental control and protection at the Área de Conservación Tempisque requested that the Trial Court of Nicoya order forfeiture (comiso) of the timber to the State so that it could be donated to one of the schools that had submitted requests to use the timber to construct signs promoting environmental conservation and protection at schools and secondary schools. He further stated that the timber had remained in the custody of the Conservation Area since its seizure and that, despite efforts to care for it, it had deteriorated considerably, but was still usable to a large extent; he therefore requested that the matter be resolved as soon as possible because of the beginning of the rainy season and the timber’s accelerated deterioration (Page 45 of administrative case file N° TE-04-PP-067-2007, certified by the Legal Advisory Coordinator of the Área de Conservación Tempisque, and Page 217 of judicial case file N° 08-000196-414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya).” In its analysis, the lower court (A quo) states: “This action was taken in accordance with the provisions of section 54 of the Ley Forestal, which provides as follows: ‘...The officials of the State Forestry Administration shall have the status of police authorities and, as such and in accordance with this law, shall report any violations committed to the competent authorities. (…) In carrying out their duties, these officials, upon presenting their respective identification cards, shall be entitled to travel through and conduct inspections on any rural property or forestry-industrial facility, except for dwellings located thereon; they may also seize timber and other forest products unlawfully harvested or processed and impound, as security for any eventual penalty, the equipment and machinery used in the unlawful act. They shall also seize any means of transportation used as an instrument or facilitator in the commission of the offense, after preparing the corresponding record. All of the foregoing shall be placed at the disposal of the competent judicial authority within a period not exceeding three days.’ (underlining not in the original). As can be inferred from a simple reading of the cited provision, upon encountering the possibly unlawful cutting of trees beyond what had been authorized—an issue the plaintiff does not dispute in this action—the officials sued herein did, in fact, proceed in accordance with the law to seize the timber. Because they acted as police officers, they then proceeded, as provided in the final paragraph transcribed above, to place the matter at the disposal of the judicial authority, in this case the Nicoya Prosecutor’s Office. They did so through the complaint contained in official letter N° ACT-OSPA-061-2008, dated 31 de enero de 2018 (Page 25 of administrative case file N° TE-04-PP-067-2007, certified by the Legal Advisory Coordinator of the Área de Conservación Tempisque, and Page 2 of judicial case file N° 08-000196-414-PE of the Court of the Second Judicial Circuit of Guanacaste, Nicoya), in which they described the actions taken and the other necessary details; indeed, one portion of that document clearly stated: ‘Disposition of the seized property: the seized timber remains under cover at the PALECO Subregional Office in Jicaral, at the disposal of the Nicoya Prosecutor’s Office.’”

V.The doctrine of standing (legitimación en la causa), both active and passive, has been extensively developed by this Chamber on numerous occasions. In this regard, decision No. 000883-F-S1-2011 at 09 hours 05 minutes on 28 de julio de 2011 explained: “Under procedural doctrine, so-called active or passive ‘legitimatio ad causam,’ also known as standing or capacity to sue or be sued (legitimación para obrar), refers to the status of the holder of the right (the plaintiff) and the party obligated to perform (the defendant). In other words, the persons with standing are those whose rights will be legally and directly affected by the judgment. Along these lines, this Chamber has held that standing is: ‘…a prerequisite of the claim asserted in the complaint and of the opposition raised by the defendant, making possible a judgment on the merits that resolves them; consequently, standing does not constitute a procedural prerequisite, insofar as it does not concern the procedure or the valid exercise of the action, but instead concerns the substantive relationship that must exist between the plaintiff and the defendant and the substantive interest disputed in the proceeding.

Standing concerns the substantive relationship alleged to exist between the parties to the proceeding and the substantive interest in dispute. The defendant must be the person who, by law, is entitled to oppose the plaintiff’s claim or against whom the law permits a declaration of the substantive legal relationship that is the subject of the complaint; and the plaintiff must be the person who, under the law, may assert the claims in the complaint, even if the substantive right claimed does not exist or belongs to another. … Depending on the party with standing or that party’s position in the procedural relationship, a distinction may be made between active and passive standing: the former belongs to the plaintiff and to persons who subsequently intervene to defend the plaintiff’s cause, while the latter belongs to the defendant and to those who intervene to contest and oppose the plaintiff’s claim.

Lack of standing constitutes a substantive impediment; if the adjudicator becomes aware of such a lack, it must be declared sua sponte (de oficio) and a judgment declining to rule on the merits (sentencia inhibitoria) must be entered, without prejudice to its being timely raised as a preliminary defense (excepción previa). … In addition to determining who may participate in the proceeding with the right to obtain a judgment on the merits, standing indicates or determines who must be present for such a judgment to be possible. This means that, in certain proceedings, the participation of several persons as plaintiffs or defendants (necessary co-parties (litisconsortes necesarios)) is indispensable for a decision on the requests to be possible, because their absence precludes a decision on the merits of the claims asserted in the complaint. Accordingly, legitimatio ad causam may be lacking in two cases: a) when the plaintiff and defendant wholly lack standing because they are not the persons entitled to assert or contest the claims, and b) when persons who should have been parties in those positions jointly with others have not appeared in the proceeding.’ no. 794 at 16 hours 5 minutes on 16 de octubre de 2002.

Consequently, standing is the legal capacity to be a party in a specific proceeding and may be active or passive, depending on the conditions established by law for that purpose with respect to the procedural claim. Thus, active legitimatio ad causam, which is relevant to the case under consideration, is the capacity to bring suit, a status arising from the position of the person in relation to the procedural claim asserted. In short, it is the necessary identity that must exist between the plaintiff and the right claimed in court.” (In the same vein, see, among others, this Chamber’s decisions numbers 976 at 7 hours 40 minutes on 19 de diciembre de 2006, 89 at 14 hours 50 minutes on 19 de junio de 1991, 83 at 15 hours 15 minutes on 24 de septiembre de 1997, 604 at 10 hours on 17 de agosto de 2007, and 1023-A-S1-2009 at 14 hours 50 minutes on 1ero. de octubre de 2009).

VI.In accordance with the foregoing, this Decision-Making Body concurs with the challenged decision, insofar as there is an express legal provision under section 54 of the Ley Forestal (Ley No. 7575), which establishes the obligation to place all property seized by Forestry Administration officials acting in their capacity as law-enforcement authorities at the disposal of the competent judicial authority. In its decision, the Court described the entire proceeding conducted following the seizure (decomiso), including a detailed account of the actions taken by the Fiscalía de Nicoya in connection with the criminal case heard by the Tribunal de Juicio del II Circuito Judicial de Guanacaste, as well as the impossibility of disposing of the seized timber without authorization from the criminal judge. Accordingly, the appellant is incorrect in asserting that the timber was of no relevance to the criminal proceedings, since the law provides that timber and other forest products unlawfully harvested or processed must be seized; the actions of SINAC officials therefore have a legal basis.

Regarding those actions, the Sala Constitucional, in decision N.º 05836 - 2018 at 09 hours 30 minutes on 13 de abril de 2018, ruled: “According to the information provided by the competent respondent authority, the officials against whom the complaint was filed not only acted in fulfillment of their duty in response to an encroachment upon and environmental damage to the Refugio Nacional de Vida Silvestre Barra del Tortuguero, but were also legally authorized to do so under section 54 of the Ley Forestal. Likewise, regarding placing it at the disposal of the Fiscalía, the Tribunal Constitucional, in decision Nº 13254 – 2014 at 09 hours 05 minutes on 14 de agosto de 2014, stated: ‘In this regard, section 54 of the Ley Forestal authorizes the respective administrative authorities to “enter and conduct inspections on any rural property or forest-industry premises, except dwellings located thereon; to seize timber and other forest products unlawfully harvested or processed; and to impound, as security for a potential penalty, the equipment and machinery used in the unlawful act.

They shall also seize any means of transportation used as an instrument or facilitating means in the commission of the offense, after preparing the corresponding official record.”’ Furthermore, as detailed above, the actions taken and the seized items were placed at the disposal of the Ministerio Público, which assumed operational control (dirección funcional) of the investigation into the unlawful act at issue. In this respect, it was reported and verified that criminal case No. 14-200750-413-PE is being investigated for the alleged commission of the offenses of transporting illegal timber, making a false statement in a public document (falsedad ideológica), and use of a forged document, and that the respective prosecutorial authority determined that the evidence in the case file was sufficient to order the seizure of both the truck and the timber being transported unlawfully. Accordingly, pursuant to law, the timber was placed at the disposal of the Fiscalía de Nicoya, which assumed operational control of the investigation against the claimant, as well as responsibility for the seized property; therefore, this ground of appeal must be rejected.

VII.In view of the foregoing, the appeal (recurso) filed must be dismissed. Consequently, the appellant in cassation (casacionista) shall be ordered to pay the costs (costas) associated with this appeal, pursuant to section 150, subsection 3), of the Código Procesal Contencioso Administrativo.

POR TANTO

The appeal is dismissed. The appellant in cassation is ordered to pay the costs associated with this appeal.

Documento PJEDITOR Res. 000795-F-S1-2021 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas treinta minutos del ocho de abril de dos mil veintiuno.

Proceso de conocimiento tramitado en el Tribunal Contencioso Administrativo, interpuesto por VILLY ZÚÑIGA MORALES contra LUIS DIEGO GUTIÉRREZ RODRÍGUEZ, ALBERT MORENO HERNÁNDEZ, ALEXANDER SÁNCHEZ CHAVARRÍA, ARNULFO ROSALES VILLALOBOS, todos en su carácter de funcionarios públicos, el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) y El ESTADO. Figura como apoderado especial del actor, el licenciado Carlos Enrique Aguirre Gómez y de los demandados, representados por la ANEP cuya apoderada es la licenciada Rosa Virginia Romero Bejarano, el SINAC por el licenciado por Róger Francisco Gutiérrez Vindas y del ESTADO por la Procuradora Laura Araya Rojas. La accionante formula recurso de casación contra la sentencia no. 94-2019-V de las 13 horas 17 minutos del 11 de noviembre de 2019, dictada por el Tribunal Contencioso Administrativo, Sección Quinta, Segundo Circuito Judicial de San José.

Redacta la Magistrada Vargas Vásquez;

CONSIDERANDO

El presente asunto se origina con motivo de la demanda interpuesta el 07 de noviembre de 2013 ante el Tribunal Contencioso Administrativo, en la cual el actor señaló, contaba con un permiso de aprovechamiento de cuatro árboles (tres árboles de cedro (cedro odorata) y un árbol de roble (tabebuia rosea), otorgado mediante resolución ACT-072-2007-PALECO del SINAC, Área de Conservación Tempisque. Aseveró, dentro de la vigencia del permiso, procedió a cortar los árboles autorizados y aserró la madera de cedro en tablas de diversos tamaños y la de roble en tablillas. Explicó, el 29 de enero de 2008, se presentaron a su propiedad cuatro funcionarios -quienes figuran entre los demandados- para medir la madera con base en el permiso otorgado. Detalló, una vez que terminaron con la medición, uno de los funcionarios manifestó que había más volumen de madera de cedro del autorizado, razón por la cual le indicaron que debían decomisar toda la madera aserrada y ponerla a la orden de la autoridad judicial, justificaron que, si bien dentro de dicha madera había una legalmente autorizada, también había otra que no y que, ante la incertidumbre, se debía decomisar ambas.

Alegó, protestó la ilegalidad de la orden, por que se estaban decomisando madera autorizada y los funcionarios se “hicieron oídos sordos a mi protesta”. Consideró, los funcionarios decomisaron por simple capricho 119 tablas de cedro y 34 tablillas de roble, de diferentes características. Señaló, en el acta de decomiso, indicaron “El motivo del decomiso es el siguiente: Dentro del permiso autorizado fue cortado un árbol de la especie cedro, el cual había sido denegado. Este se corta sin autorización.”, describió, ésta le fue notificada en el mismo sitio y en el mismo momento de practicarse la confiscación por parte de los demandados. Acusó, los demandados procedieron a cargarla en una vagoneta y a trasladarla a los patios en donde se encuentra la oficina del MINAET en Jicaral. Relató, allí la vaciaron sin tomar cuidado alguno ante producto tan frágil que llevaban, reprochó, esa acción provocó que la misma se quebrara o se rajara.

Recriminó, la dejaron apilada en la manera en que quedó una vez vaciada en un área al descubierto, llevando sol y agua y sin ninguna protección desde el 29 de enero de 2008 hasta el 10 de diciembre de 2012. Dijo, ese día recibió por parte de los funcionarios demandados la madera existente por orden del Tribunal del II Circuito Judicial de Guanacaste (Nicoya). Reprochó, los aquí demandados lo denunciaron ante el Ministerio Público, Fiscalía de Nicoya, por el delito de daño a los recursos naturales, lo que dio pie a la cauda número 08-000196-0414-PE, de la que afirmó, resultó absuelto por resolución de las 07 horas y 38 minutos del 14 de octubre de 2011 y relató, ahí se ordenó a los funcionarios del MINAET que devolviera la madera decomisada ilegalmente. Subrayó, el 10 de diciembre de 2012, dos de los funcionarios demandados le hicieron entrega de 82 piezas de cedro y 4 tablillas de robre, en su criterio, hubo un faltante de 37 piezas de madera de la especie de cedro y 30 piezas de la especie roble sabana.

Endilgó, uno de los funcionarios aquí demandado, mediante oficio ACT-OSRLP-617-2012, dirigido al Tribunal de Juicio de Nicoya, indicó “el motivo del faltante obedece (tal como se indicó desde fecha 07 de febrero del año 2008, mediante oficio ACT-OSRLP-071-2008) a la falta de condiciones de seguridad del plantel de esta oficina, mismo en el cual ha permanecido la madera desde el momento del decomiso (29-01-2008)” y continúa, que “durante el proceso desde el decomiso a la actualidad ha sido necesario mover internamente la madera en múltiples ocasiones procurando que se ubicara en las menos malas condiciones para evitar su pérdida y deterioro”. Reprochó, durante el tiempo en que la madera estuvo bajo cuidado y responsabilidad de los cuatro funcionarios demandados, éstos dispusieron y se apropiaron, ilegalmente, de 37 tablas de madera de la especie cedro y de 30 unidades de la especie roble, además, sostuvo, las 82 tablas de la especie cedro y las 4 reglas de la especie de roble, que le fueron entregadas y recibió bajo protesta, expresó, se encuentran en total estado de deterioro, unas están rajadas, ya sea por la acción de la descuidada descarga que hicieron los aquí demandados el día 29 de enero de 2008 o por efectos del calor solar al que estuvieron expuestas al aire libre por cuatro años.

Arguyó, todas se encuentran podridas y dañadas por el hongo de la madera en razón de haber estado expuestas, durante cuatro años, al agua y sin ninguna protección. En razón de lo anterior, solicitó, en sentencia se declare: "1) Que los demandados me causaron daños y perjuicios con su actuación administrativa ilegal y negligente al decomisarme la madera de mi propiedad arbitrariamente y haberla mantenido bajo su custodia en total estado de abandono por espacio de cuatro años, lo que ocasionó que la misma se destruyera en su totalidad.

  • 2)Que los demandados quedan obligados, solidariamente, a pagarle por concepto de daños la suma de dos millones ciento sesenta mil colones y por concepto de perjuicios la suma de un millón trescientos cuarenta y siete mil colones.
  • 3)Que los demandados quedan obligados a indexarme, solidariamente, desde el día 28 de enero de 2008 hasta el día en que me hagan efectivo el pago, el monto del que resulten obligados a pagarme según lo fijado en sentencia.
  • 4)Que los demandados quedan obligados, solidariamente, a pagarme las costas personales y procesales de este juicio." Los funcionarios públicos demandados contestaron de manera negativa y opusieron las defensas de Falta de legitimación activa y pasiva, así como la Falta de Derecho. El SINAC igualmente contestó en forma negativa y opuso la defensa de Falta de Derecho. El Estado también contestó negativamente y opuso la defensa de Falta de Derecho y Prescripción.

II.El Tribunal Contencioso Administrativo, en resolución no. 94-2019-V dictada a las 13 horas 17 minutos del 11 de noviembre de 2019 dispuso: "Se acoge la defensa de Falta de Legitimación Pasiva. Se declara INADMISIBLE LA DEMANDA incoada por VILLY ZÚÑIGA MORALES CONTRA Luis Diego Gutiérrez Rodríguez, Albert Moreno Hernández, Alexander Sánchez Chavarría, Arnulfo Rosales Villalobos, el SINAC y el Estado. Son ambas costas de esta acción a cargo del actor." Inconforme con lo resuelto, la parte actora interpuso recurso de casación por motivos procesales.

III.Como único agravio por razones procesales, alega violación a las normas procesales, de conformidad con el artículo 57, 134.1, 135.1, 137. d) y 139. 1), 2) y 3), todos del Código Procesal Contencioso Administrativo (CPCA). Considera, la premisa mayor de este fallo, que es producto del ejercicio intelectual del análisis lógico de los elementos sometidos a estudio y se refleja como producto de un acto intelectivo de inferencia o deducción, es que en la demanda presentada para solicitar la condena de las partes demandadas no se llega a inferir ninguna participación de esas partes que generase los eventuales daños y perjuicios que se reclamaron y se solicitó declarar en sentencia. Apunta, en ninguno de los 32 hechos probados se establece que la madera decomisada, una vez que los funcionarios demandados interpusieron la denuncia penal ante la Fiscalía de Nicoya, quedase a la orden de esta Oficina judicial y que el resguardo de ella fuese de su responsabilidad.

Manifiesta, en el hecho 16 tenido por probado, se estableció que el funcionario asignado a control y protección ambiental del Área de Conservación Tempisque "indicó que la madera ha estado bajo la custodia Área de Conservación desde su decomiso y que pese al esfuerzo por cuidarla se ha deteriorado bastante, pero que aún era aprovechable en gran medida, por lo que solicitó sea resuelto lo pedido a mayor brevedad debido al inicio de la estación lluviosa y el acelerado deterioro de la madera". Acusa, en el fallo se introduce una premisa falsa por inexistente y contradictoria con el elenco factual acreditado probado, cual es que "en este caso, y sin ser controvertido, se ha tenido que, luego del decomiso de la madera al señor Zúñiga, la misma fue conducida a las instalaciones del SINAC en Jicaral y que por esa razón, en la denuncia penal presentada, conforme lo indica el artículo 54 de la Ley Forestal; los funcionarios denunciantes y aquí demandados, cumpliendo su deber legal, procediendo a emitir el informe de Policía correspondiente, sea la denuncia y en ésta dejaron a la orden de la Fiscalía de Nicoya la madera decomisada, por lo que, a criterio de este Tribunal, una vez trasladado en asunto a la jurisdicción penal, en este caso a la Fiscalía de Nicoya, los bienes decomisados quedaron precisamente a la orden de aquella autoridad, quien debía, como corresponde, a partir de este momento, tomar las disposiciones que fueran pertinentes al respecto de los bienes decomisados.

No obstante, la madera se mantuvo en las instalaciones del SINAC sin que la autoridad penal correspondiente dispusiera sobre su ubicación, ni custodia propiamente dicha". Recalca, el fallo recurrido, no tiene por demostrado que los funcionarios del SINAC hayan puesto a la orden de la Fiscalía de Nicoya la madera; asevera, eso lo crea, ficticiamente, el Tribunal para arribar a la conclusión de que opera la falta de legitimación pasiva que cobija a todos los demandados. Argumenta, los funcionarios demandados decomisaron la madera, la mantuvieron bajo su custodia desde el mismo momento del decomiso hasta el momento también mismo de la entrega en su condición de funcionarios del SINAC, aduce, según queda acreditado en el hecho numerado 16, citado supra. Reprocha, ni la Fiscalía de Nicoya, ni el juzgado Penal de Nicoya, ni el Tribunal de juicio Penal de Nicoya aparecen declarados como depositarios de la madera en el fallo recurrido.

Alega, la denuncia penal formulada por los funcionarios aquí demandados ante la Fiscalía de Nicoya no presupone la entrega de la madera a éste, subraya, en materia penal, la comisión de un ilícito se comprueba con el decomiso y entrega del bien a la Autoridad correspondiente siempre y cuando sea éste el medio con el que se quebrantó la Ley; es decir, que figure como un medio probatorio de que con él se cometió. En su parecer, la madera decomisada no representa ninguna relevancia procesal para el proceso penal; en razón de ello, considera, resulta improcedente que la misma hubiese sido entregada a dicha Autoridad, pues la acción tipificada como un eventual delito es la tala ilegal de un árbol de cedro, circunstancia que resulta probada ante la Autoridad con el acta de decomiso, que firmaron los funcionarios demandados y el actor. Recrimina, el Tribunal con el pernicioso interés de escamotear la resolución de este asunto en los términos que se plantearon en la demanda, es decir la responsabilidad de determinar la existencia de daños y perjuicios, la responsabilidad subjetiva de los mismos, su cuantificación que debió de haberlo llevado a un análisis exhaustivo de todo lo alegado y de la prueba allegada a los autos, concluye, vislumbró la posible existencia de una acción atribuible a sujetos diferentes de los involucrados dentro de la litis.

Endilga, el Tribunal creó la premisa de que, una vez que la denuncia fue puesta a la Fiscalía, la madera toda quedó a la orden de ésta y que fue, por negligencia del mismo Poder Judicial, que se produjo el robo y el deterioro de la madera propiedad del accionante, y que los funcionarios y demás partes demandadas, a partir de ese momento, salieron de la esfera de interés del bien decomisado y, por lo tanto, de la esfera de responsabilidad por lo ocurrido posteriormente.

IV.Con relación al cargo reprochado, el Tribunal Contencioso Administrativo resolvió: " I.- Hechos probados. (…) 8) Mediante oficio N° ACTOSPA-061-2008, fechado 31 de enero de 2018 (sic), los funcionarios de la oficina Subregional Paleco del Área de Conservación Tempisque del Sistema Nacional de áreas de Conservación Luis Diego Gutiérrez Rodríguez, Albert Moreno Hernández, Alexander Sánchez Chavarría, Arnulfo Rosales Villalobos, rubricaron "Informe Policial" mediante el cual comunicaron a la Fiscalía de Nicoya la tala ilegal de un árbol en la finca del señor Villy Zúñiga morales, en el cual se detalla todo lo actuado incluido el decomiso realizado con cantidades y descripción de la madera y de la cual se indicó: "Destino del decomiso: la madera decomisada permanece bajo techo en la Oficina del Subregional PALECO de Jicaral, a las órdenes de la Fiscalía de Nicoya" (Folio 25 del expediente administrativo N° TE-04-PP-067-2007, certificado por el Coordinador de la Asesoría Legal del Área de Conservación Tempisque, y Folio 2 del expediente judicial N° 08-000196-414-PE del Tribunal del Segundo Circuito Judicial de Guanacaste, Nicoya). 9) En oficio N° ACT-OSPA-071-2008 de 7 de febrero de 2008, el funcionario de la Sub Regional Paleco del Área de Conservación Tempisque del SINAC, puso en conocimiento del Ministerio Publico de Nicoya que respecto de la madera decomisada al señor Zúñiga Morales, indicó que la misma: "...permanece bajo techo y protegida al 90% del sol".

Le expresó además que no tienen una bodega apropiada para el seguro almacenaje de la madera y mucho menos de vigilancia fuera de las horas de trabajo y que pese a intentarlo, no han conseguido un mejor lugar para almacenar por lo que indica: "...permanece en las instalaciones de esta oficina hasta que su autoridad así lo determine...", por todo lo anterior, le solicitó al Ministerio Público de Nicoya que: "...por favor se determine con prontitud el destino de la madera a que se ha hecho referencia en el transcurso del presente oficio" (Folio 28 del expediente administrativo N° TE-04-PP-067-2007, certificado por el Coordinador de la Asesoría Legal del Área de Conservación Tempisque, y Folio 46 del

V.El instituto de la legitimación en la causa tanto activa como pasiva ha sido ampliamente desarrollado por esta Sala en reiteradas ocasiones. Al respecto, en la resolución No. 000883-F-S1-2011 las 09 horas 05 minutos del 28 de julio de 2011, se explicó: “De conformidad con la doctrina procesalista, la denominada “legitimatio ad causam” activa o pasiva o, como también se le denomina, legitimación en la causa o legitimación para obrar, alude a la condición de titular del derecho (el actor) y de obligado a la prestación (el demandado). Es decir, están legitimados en la causa las personas que jurídica y directamente van a ser afectadas en sus derechos por la sentencia. En esta línea de pensamiento, esta Sala ha señalado que la legitimación es: “…un presupuesto de la pretensión formulada en la demanda y de la oposición hecha por el demandado, para hacer posible la sentencia de fondo que las resuelve; consecuentemente la legitimación en la causa no constituye un presupuesto procesal, en tanto no se refiere al procedimiento o al válido ejercicio de la acción, antes bien se refiere a la relación sustancial que debe existir entre actor y demandado y al interés sustancial que se discute en el proceso.

La legitimación en la causa se refiere a la relación sustancial que se pretende existente entre las partes del proceso y el interés sustancial en litigio. El demandado debe ser la persona a quien le corresponde por la ley oponerse a la pretensión del actor o frente a la cual la ley permite que se declare la relación jurídica sustancial objeto de la demanda; y el actor la persona que a tenor de la ley puede formular las pretensiones de la demanda, aunque el derecho sustancial pretendido no exista o le corresponda a otro. … De acuerdo al sujeto legitimado o a su posición en la relación procesal se puede distinguir entre legitimación activa y pasiva, la primera le corresponde al actor y a las personas que con posterioridad intervengan para defender su causa, la segunda le pertenece al demandado y a quienes intervengan para discutir y oponerse a la pretensión del actor. La ausencia de legitimación en la causa constituye un impedimento sustancial, si el juzgador se percata de la falta de la misma, así debe declararlo de oficio y dictar una sentencia inhibitoria, lo que no es óbice para que sea alegada oportunamente como excepción previa. …

La legitimación en la causa además de determinar quiénes pueden actuar en el proceso con derecho a obtener sentencia de fondo, señala o determina a quiénes deben estar presentes para hacer posible la sentencia de fondo. Lo anterior significa que en determinados procesos es indispensable la concurrencia de varias personas (litisconsortes necesarios) en calidad de actores o demandados para que la decisión sobre las peticiones se haga posible, pues la ausencia de éstas impide la decisión de fondo, de las pretensiones deducidas en la demanda. Por ello la legitimatio ad causam puede estar ausente en dos casos: a) cuando actor y demandado carecen absolutamente de legitimación en la causa, por tratarse de personas diferentes a quienes correspondía formular las pretensiones o contradecirlas, y b) cuando los que debían ser parte en tales posiciones en concurrencia con otras personas, no han comparecido al proceso”. no. 794 de las 16 horas 5 minutos del 16 de octubre de 2002.

En consecuencia, la legitimación es la aptitud para ser parte en un proceso concreto, puede ser activa o pasiva, lo cual dependerá de las condiciones que para tal efecto establezca la ley en cuanto la pretensión procesal. Así, la legitimación ad causam activa, que interesa en el caso en estudio, es la capacidad para demandar, carácter que nace de la posición en que se halle el sujeto, respecto a la pretensión procesal promovida. En suma, es la identidad necesaria que debe darse entre el actor y el derecho que pretenda en juicio.” (. En igual sentido, pueden consultarse, entre otras, las resoluciones de esta Sala números 976 de las 7 horas 40 minutos del 19 de diciembre de 2006, 89 de las 14 horas 50 minutos del 19 de junio de 1991, 83 de las 15 horas 15 minutos del 24 de septiembre de 1997, 604 de las 10 horas del 17 de agosto de 2007 y 1023-A-S1-2009 de las 14 horas 50 minutos del 1ero. de octubre de 2009).

VI.De conformidad con lo anterior, este Órgano Decisor comparte la resolución recurrida, en el tanto existe norma legal expresa al tenor de lo dispuesto en el numeral 54 de la Ley Forestal (Ley No. 7575), en la cual se establece la obligación de poner a la orden de la autoridad judicial competente todos los bienes que han sido decomisados por los funcionarios de la Administración Forestal en su carácter de autoridad de policía. El Tribunal a través de su resolución desarrolló todo el proceso que se llevó a cabo a partir del decomiso y en el cual efectivamente se detallaron las actuaciones realizadas por la Fiscalía de Nicoya con ocasión de la causa penal llevada en el Tribunal de Juicio del II Circuito Judicial de Guanacaste, así como la imposibilidad de disponer de la madera decomisada sin autorización del juez o la jueza penal. Por lo cual, no lleva razón el recurrente en indicar que la madera no representaba ninguna relevancia para el proceso penal, ya que la ley dispone que se deberá decomisar la madera y los demás productos forestales aprovechados o industrializados ilícitamente, por lo cual encuentra respaldo normativo el actuar de los funcionarios del SINAC.

Sobre dichas actuaciones, la Sala Constitucional mediante resolución N.º 05836 - 2018 de las 09 horas 30 minutos del 13 de abril de 2018 resolvió: “De lo informado por la autoridad recurrida competente, se tiene que los funcionarios denunciados no sólo actuaron en cumplimiento de su deber, ante una invasión y daños ambientales al Refugio Nacional de Vida Silvestre Barra del Tortuguero, sino porque cuentan con la autorización legal en los artículos 54 de la Ley Forestal. Asimismo, en cuanto a ponerla a la orden de la Fiscalía, el Tribunal Constitucional en voto Nº 13254 – 2014 de las 09 horas 05 minutos del 14 de agosto de 2014 indicó: “En ese sentido, artículo 54 de la Ley Forestal faculta a las respectivas autoridades administrativas a “transitar y a practicar inspecciones en cualquier fundo rústico o industrial forestal, excepto en las casas de habitación ubicadas en él; así como decomisar la madera y los demás productos forestales aprovechados o industrializados ilícitamente y secuestrar, en garantía de una eventual sanción, el equipo y la maquinaria usados en el acto ilícito.

También, decomisarán el medio de transporte que sirva como instrumento o facilitador para la comisión del delito, previo levantamiento del acta respectiva”. Asimismo, según se detalló, las actuaciones y los objetos decomisados fueron puestos a la orden del Ministerio Público, órgano que asumió la dirección funcional en la investigación del ilícito en cuestión. Al respecto, se informó y se constató que se está instruyendo la causa penal No. 14-200750-413-PE por la presunta comisión del delito de movilización de madera ilegal, falsedad ideológica y uso de documento falso, siendo que, la respectiva autoridad fiscal determinó que con la prueba que consta en el expediente es suficiente para ordenar el decomiso tanto del camión como de la madera que se transportaba ilícitamente. En ese sentido, la madera fue puesta a la orden de la Fiscalía de Nicoya, por disposición de ley, quién asumió la dirección funcional en la investigación contra la parte actora, así como la responsabilidad por los bienes decomisados, de modo que este agravio debe ser rechazado.

VII.En mérito de lo expuesto, se deberá declarar sin lugar el recurso interpuesto. En consecuencia, se condenará a la casacionista al pago de las costas correspondientes a este recurso, de conformidad con el artículo 150 inciso 3) del Código Procesal Contencioso Administrativo.

POR TANTO

Se declara sin lugar el recurso. Se condena a la casacionista al pago de las costas correspondientes a este recurso.
