Ordinary proceedings (proceso de conocimiento) brought by F K FER KAR SOCIEDAD ANÓNIMA against the INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA. Ronald Cruz Barahona appears as special judicial attorney-in-fact for the plaintiff, and Heiner Jorge Méndez Barrientos for the defendant. The plaintiff company filed an appeal on points of law (recurso de casación) against judgment no. 119-2016-I issued at 2:00 p.m. on December 19, 2016, by the Tribunal Contencioso Administrativo y Civil de Hacienda.

CONSIDERANDO
I.On November 20, 2012, F K FER KAR filed suit against the Instituto Costarricense de Pesca y Acuicultura (hereinafter, Incopesca). It stated that it held sardine fishing license no. H-0302-12-GTO for the vessel “El Caballero” (which had been transferred to it by sociedad manglares del Sur), valid until April 21, 2014. It alleged that, on July 18, 2012, it submitted an application to Incopesca’s Oficina Regional de Golfito for vessel substitution (sustitución de embarcación), for the purpose of using that license on the vessel Princesa Primera (because the latter had greater capacity and range). It maintained that it received no response from the Institute and therefore considered that constructive approval (silencio positivo) had occurred pursuant to Articles 331 and 332 of the Ley General de la Administración Publica (LGAP). It asserted that Incopesca’s omission prevented its economic and social development, affecting its property and employment interests.
Accordingly, it sought the following relief in the judgment (claims adjusted at the preliminary hearing): “A) That this action be granted in all respects. B) That, as a consequence of the foregoing, and as a result of its omission and because constructive approval occurred, the defendant Administration be ordered to grant a Sardine Fishing License by vessel substitution; in this case, that the Instituto Costarricense de Pesca y Acuacultura (INCOPESCA) be ordered to renew and authorize a Sardine Fishing License for the vessel named "PRINCESA PRIMERA," REGISTRATION L-000611, so that it may operate by vessel substitution under the same status and conditions as the previous vessel. C) That, as a result of the foregoing and because of the undue delay attributable to the defendant Administration, since the vessel could not be substituted within the statutory time limits and the plaintiff commercial company could not conduct fishing operations throughout this period, the Fishing License for that vessel be extended, as compensation for loss (perjuicio), after its expiration for a period equal to the period from submission of the substitution application until the License is actually granted, calculated from the expiration date of April 21, 2014.
(…). In accordance with the attached accounting study, based on the parameters established by Incopesca for this type of work and offered as evidence, operating expenses claimed as pecuniary damage are hereby quantified at ONE HUNDRED FORTY-TWO MILLION FIVE HUNDRED THOUSAND COLONES (¢142.500.000,00). B.- Pecuniary damage, second category: in this case, the debts incurred by the company, which it must pay daily, but which, due to the cessation of fishing activity and the resulting lack of income, the company, through its shareholders, has had to obtain external financing in order to remain current on payments of the company’s debts; accordingly, and pursuant to the attached Accounting Report, the amount is quantified at SIXTY-SIX MILLION NINETY-ONE THOUSAND SEVENTY-NINE COLONES (¢66.091.079,00), plus the principal payments and interest paid to date on the company’s debts, totaling TWENTY-EIGHT MILLION NINE HUNDRED FOURTEEN THOUSAND FIVE HUNDRED SEVENTY-SIX COLONES AND FORTY CENTIMOS (¢28.914.5786,40). 2.- LOSSES: C.- LOST PROFITS: In this case, based on the company’s line of business, the fishing industry, and in accordance with the Accounting Report, the total profits not received are quantified at TWO HUNDRED THIRTEEN MILLION SEVEN HUNDRED FIFTY THOUSAND COLONES (¢213.750.000,00).
D.- Pursuant to Article 1163 of the Código Civil, legal interest on the amounts approved or generally granted be awarded from July 17, 2012, until actually paid. E.- OBJECTIVE NON-PECUNIARY DAMAGE (DAÑO MORAL OBJETIVO): Because this is a commercial company whose line of business is fishing activity, the abrupt cessation caused by the Administration’s omission depends exclusively upon that activity and has resulted in indebtedness and personal suffering for its shareholders, who have had to assume the company’s accounts payable to prevent it from falling into misfortune and "bankruptcy." Because it has generated no income, its commercial image has ceased; accordingly, since the damage is in re ipsa, I quantify objective non-pecuniary damage at TWENTY MILLION COLONES (¢20.000.000,00).” In a filing dated March 17, 2014, the defendant opposed the claim for damages. The First Section of the Tribunal Contencioso Administrativo y Civil de Hacienda, composed of Judges Otto González Vílchez, Claudia Bolaños Salazar, and Carlos Espinoza Salas, ruled as follows, insofar as relevant, in decision no. 119-2016-I issued at 2:00 p.m. on December 19, 2016: “(…) The defense of lack of legal entitlement (falta de derecho) is granted.
This action is denied in all respects. The plaintiff company is ordered to pay the court costs and attorneys’ fees of these proceedings.” Dissatisfied, the plaintiff filed an appeal on points of law on substantive grounds, which was admitted by this Chamber.
II.As its first ground of appeal, it alleges improper assessment of evidence (indebida valoración probatoria), in violation of Articles 16, 140, 239, and 240 of the LGAP, as well as Article 82 of the CPCA. It states that the Judges failed to analyze the administrative acts (actos administrativos) that gave rise to the granting of its fishing license, which establish, contrary to Incopesca’s statement in the challenged resolution, that the license authorized was not an artisanal, small-scale license. In that regard, it lists the following documents from the administrative record (expediente administrativo) for the vessel El Caballero: the document issued by the “COMISION ASESORA DEL PACIFICO SUR, CAPS23 DE MARZO DE 1997” (folio 11), Incopesca decision no. H-0029-97-G of April 8, 1997 (folios 14 to 16), a copy of the license granted (folio 17), and Board of Directors resolution no. AJDIP/037-97 of February 5, 1997 (general resolution governing sardine fishing).
It also refers to official letter DGT130-07-2012 of July 20, 2012, signed by Antonio Porras Porras—Director General Técnico—and addressed to Heiner Méndez Barrientos—head of the Asesoría Legal—both of Incopesca. It asserts that none of those documents states that the license granted was for artisanal fishing; rather, those specific, valid, and effective acts, pursuant to Articles 239 and 240 of the LGAP, show that the vessel El Caballero was granted a sardine fishing license authorizing the following fishing gear (artes de pesca): purse seine net, with a maximum length of 450 meters. It notes that the only document stating “artisanal fishing” appears at folio 12 of the administrative record and consists of a “notice of resolution” issued by Heiner Méndez Barrientos, acting secretary of Incopesca’s Board of Directors, in which a transcription error indicated that what had been granted was a permit for artisanal sardine fishing pursuant to resolution AJDIP/037/97.
It complains that, contrary to the administrative acts that gave rise to the granting of the license at issue, the Judges credited a report submitted by Heiner Méndez Barrientos on November 30, 2012, and addressed to the Institute’s Board of Directors, which lacks legal and technical support and includes false facts (because it refers to an alleged change from artisanal to semi-industrial sardine harvesting and to the granting of an artisanal license to the plaintiff company). It asserts that no change of activity occurred, as demonstrated by official letter ORG-128-2012 of July 18, 2012, through which Incopesca’s Oficina Regional de Golfito reported that there was no objection to substituting the vessel Princesa Primera for El Caballero. It maintains that, by basing their decision on the report issued by Mr. Méndez Barrientos and the opinion of official Porras Porras, the Judges violated the principles of proportionality, equality, legal certainty, sound judicial assessment (sana critica), and the binding force of one’s own acts (intangibilidad de los actos propios). It insists that the license granted to the vessel El Caballero is not an artisanal license.
III.In examining the grounds for nullity (vicios de nulidad) that the plaintiff company attributed to Board of Directors Resolution no. AJDIP/461-2012, whereby its vessel-substitution permit was denied, the Court deemed it appropriate to begin by analyzing the type of fishing license (licencia de pesca) held by the plaintiff. In that regard, it found it proven that on April 8, 1997, by Board of Directors Resolution AJDIP/102/97, fishing license no. P-0029-97-G was granted to the vessel El Caballero, owned at that time by the company Manglares del Sur, for the artisanal harvesting of sardines for bait, with the following authorized fishing gear (artes de pesca): purse seine, with a maximum length of 450 meters. The Judges stated that this was the original fishing license authorized for the then-owner of the vessel El Caballero and that no permit was ever granted for fishing other species or for semi-industrial fishing.
Furthermore, they found it established that on April 22, 2008, the legal representative of Manglares del Sur requested renewal of the fishing license, which was granted, insofar as relevant, according to the following specifications: authorized type of fishing, bait; vessel, El Caballero; fishing gear, purse seine: multifilament, with a maximum length of 450 meters and a depth of less than 44 meters; effective from April 22, 2008, to April 21, 2014; purse-seine fishing for sardine bait is permitted in zone 3 (northern zone) and zone 4 (southern zone). The Judges indicated that this license renewal was granted for a six-year term pursuant to the Ley de Pesca y Acuicultura, no. 8436, and that the original conditions of the license were maintained, namely, to fish for sardines for bait and therefore on an artisanal and small-scale basis (in accordance with section 2, subsection 26, of the cited Law).
This situation was confirmed during the oral and public trial by the expert witness, Antonio Porras Porras, who testified that the fishing license granted to the vessel El Caballero is artisanal (meaning that mechanical means are not used), and that the authorized activity is bait fishing (not fishing for human consumption, in which case the license would be semi-industrial and mechanical means would be used). Based on that technical opinion, the Court was satisfied that the fishing license authorized for the vessel El Caballero is artisanal and was never semi-industrial.
IV.This Decision-Making Body agrees with the position of the lower-court Judges. Irrespective of the fact that fishing license no. P-0029-97-G, granted to the vessel El Caballero, owned by Manglares del Sur and subsequently transferred together with the vessel to the plaintiff, does not state that it was artisanal and small-scale, as the appellant in cassation (casacionista) argues, the fact remains that the authorized fishing activity was sardines for bait (an uncontested fact). This was established in resolution INCOPESCA-H-0029-97 dated April 8, 1997, in the corresponding license, and in the document entitled “COMISION ASESORA DEL PACIFICO SUR, SEDE GOLFITO, CAPS 23 DE MARZO 1997” (all of which were cited by the appellant). Regarding that specifically authorized activity, the expert witness Mr. Antonio Porras Porras, in his capacity as a biologist and General Technical Director of Incopesca, testified during the oral and public trial that the mere fact that the license was granted for sardine fishing for bait excludes it from the scope of semi-industrial fishing.
The expert explained that bait licenses are those involving the sale of the product to other fishers or among the fishers themselves, but for that purpose: as bait; that is, it may be marketed solely as bait for the fishing sector itself, no mechanical means are used to harvest the sardines, and the activity is conducted essentially by persons authorized by Incopesca; therefore, from a technical standpoint, it qualifies as an artisanal license. By contrast, the witness clarified, semi-industrial licenses are commercial licenses intended primarily for human consumption (approximately 90%, with the remaining 10% intended for bait), and they authorize the use of mechanical means when carrying out the sardine purse-seining or encircling operations. Mr. Antonio emphasized that a fishing license for bait cannot be treated as equivalent to a semi-industrial license, because the latter has a commercial purpose or is intended for human consumption in at least 90% of cases.
This technical opinion is consistent with the provisions of Articles 66 of the Ley de Pesca and 56 of its Regulations, which provide: “Article 66. INCOPESCA may authorize sardine fishing solely for use for human consumption or as bait. Sardine waste resulting from processing for human consumption may be used for other purposes.” “Article 59. INCOPESCA may authorize sardine fishing solely for use as bait by the national fishing fleet or for human consumption.” Emphasis added. It follows from the transcribed provisions that the aforementioned Institute authorizes only two types of licenses for sardine fishing: for bait or for human consumption. Consequently, if the license granted to the vessel El Caballero, owned by Manglares del Sur and subsequently transferred to the plaintiff company, expressly states that the authorized activity is sardine fishing for bait (only), that condition alone rules out its being a semi-industrial license (because, as reiterated, the fishing authorized under the latter is for human consumption).
This reasoning is consistent with the document entitled “Comunicación de Acuerdo 1997” (appearing at folio 12 of the administrative record (expediente administrativo) for the vessel El Caballero), whereby Mr. Heiner Méndez Barrientos, acting secretary of the Board of Directors of Incopesca, notified the Executive Presidency of Resolution A.J.D.I.P./102-97 dated April 8, 1997, insofar as relevant: “To grant a permit for the artisanal fishing of sardina gallera (…)” to the vessel El Caballero. Boldface added. Likewise, the record contains the lease agreement (contrato de arrendamiento) executed on June 7, 2012, between Mr. Carlos Andrés Bolaños Chaves and the plaintiff company, which states verbatim (folios 158 and 159 ibidem)”: “(...) The undersigned, (...) Carlos Andrés Bolaños Chaves (...) as owner of the vessel Princesa Primera, registration L-611, hereinafter referred to as the lessor, and F-K FERKAR S A, (...) represented herein by Francisco Javier Fernández Vásquez (...) in his capacity as a general attorney-in-fact with unlimited authority, owner of the vessel El Caballero, registration PG 5085, holding an artisanal bait-fishing license using purse-seine fishing gear, granted by Incopesca under Number H0302-12-GTO, expiring on April 21, 2014, hereinafter referred to as the lessor, STATE that they have agreed to enter into this lease agreement, which shall be governed by the following clauses: (...) THIRD: Carlos Bolaños Zamora, attorney-in-fact for the owner of Princesa Primera, leases his vessel to F-K Ferkar s.a. for use in fishing operations with purse-seine fishing gear under license No H0302-12-GTO owned by the lessor, subject to prior authorization by INCOPESCA.
FOURTH: the term of this agreement shall be one year from the date on which Incopesca grants the vessel-substitution permit, (...)”. Boldface added. In any event, it bears emphasizing that the record contains no evidence that the plaintiff engaged in semi-industrial sardine fishing using the vessel El Caballero, as it now claims. Accordingly, because the Judges’ assessment is consistent with the evidence submitted in the proceedings, insofar as the license granted to the plaintiff company was for sardine fishing for bait and was therefore artisanal rather than semi-industrial, the claims of improper assessment of the evidence (indebida valoración probatoria) and violation of law (quebranto normativo) must be rejected.
V.As its second ground of challenge, it alleges the improper application of sections 329, 330, and 331 of the LGAP. It states that the Court rejected the requested declaration of positive administrative silence (silencio positivo), citing the existence of natural resources, noncompliance with the requirements established for vessel substitution, and the fact that the Board of Directors of Incopesca did rule on the application submitted. However, it argues that the request was not for the granting of a fishing license or for any change in the exercise of the current license, but merely for the substitution of a vessel under the license already granted. That application was endorsed by the regional office of that Institute in Golfito (official letter ORG-128-2012). In that regard, it contends that the argument concerning “natural resources” is unfounded. Regarding the alleged failure to complete the procedure for placing the fishing license for the vessel Princesa Primera on inactive status, it emphasizes that the defendant did not dispute that issue.
In any event, it states that the administrative record demonstrates compliance with that requirement and completion of the corresponding inspections by Incopesca officials. In addition, it identifies as its final act as a party, undertaken in compliance with the requirements preceding substitution, its July 14, 2012 notification to the Regional Chief of Golfito that “(…) in accordance with official letter ORG-122-2012, the vessel El Caballero, registration PG-5085, remains in dry dock at the industrial workshop of Mr. Manuel Arroyo, located at KM 2 in Golfito” (folio 168 of the administrative record). It states that the next official letter communicated to it was ORG-128-2012 dated July 18, 2012, indicating that the regional office had no objection to the requested substitution. It further states that the only act subsequently issued by the Administration was the one on the basis of which the Judges found that the submitted application had indeed been decided, namely, the Board of Directors Resolution dated December 7, 2012 (which it considers void for the reasons that will be detailed in the fourth objection raised). Accordingly, it concludes that the claimed positive administrative silence did arise in this case.
VI.The trial judges (Juzgadores de instancia) found that, in this particular case, the doctrine of positive administrative silence (silencio positivo) governed by provision 331 of the LGAP did not apply, for the following reasons: first, because fishing activity is related to the exploitation of natural resources—specifically, the sustainable use of aquatic species—which is an environmental matter, as follows from Articles 1 and 5 of the Ley de Pesca y Acuicultura. Consequently, they stated, the rulings of the Sala Constitucional in judgments numbers 820-95 at 18 hours 54 minutes on February 8, 1995, and 2954-94 at 9 hours 9 minutes on June 17, 1994, are applicable; namely, that positive administrative silence does not apply to the exploitation of natural resources, since that would permit the irrational exploitation of such resources. In this case, they argued, the plaintiff company applied for a vessel-substitution permit based on a fishing license, which means that the application is related to the exploitation of aquatic fisheries resources; hence, the alleged positive administrative silence is inapplicable.
Second, because when the plaintiff filed the vessel-substitution application, it failed to comply with the legal requirements established for that purpose (subsection 1 of provision 331 of the LGAP). The judges stated that, on June 18, 2012, the plaintiff company applied for authorization to substitute the vessel El Caballero with the Princesa Primera, and a note was entered in the lower-right portion of that document stating: “Note: To complete the substitution procedure, the company must register with the C.C.S.S and arrange the inactive status of Princesa I and the Vessel Inspection.” They reasoned: “(…) from the very moment the plaintiff company submitted its application for a vessel-substitution permit to INCOPESCA, it was noted that not all the requirements had been submitted with that application, including the registration of the defendant company with the CCSS, as well as the documentation proving the inspection and approval of the inactive-status permit for the vessel Princesa Primera.” This situation was substantiated in official letter ORG-128-2012 from Mr.
Gerardo Zamora Ovares, Head of the Oficina Regional de Golfito. The Court explained that the plaintiff did not demonstrate that it had submitted documentation concerning the inactive status of the fishing license for the vessel Princesa Primera during the proceeding to substitute the vessel El Caballero, a necessary requirement for approval of the requested change. This failure was confirmed in official letter ORG-145-2012 of August 27, 2012, in which official Zamora Ovares informed the plaintiff company that the documentation sent by mail had been received and did not list among it the documents relating to the inspection and approval of the inactive-status permit in question. Third, because INCOPESCA engaged in no administrative omission (conducta omisiva). The judges found that the vessel-substitution application was filed on July 18, 2012, and that the Board of Directors denied it on the following December 7, that is, in less than six months.
They further noted that the company was informed of the processing and denial of the permit before the Board of Directors adopted resolution AJDIP/461-2012, as stated at the oral trial by witness Francisco Javier Fernández (the plaintiff’s legal representative) and confirmed in official letter AL-01-133-11-2012 of November 30, 2012.
VII.Regarding positive administrative silence, provisions 330 and 331 of the LGAP provide: “330. 1. The Administration’s silence shall be deemed positive when expressly so established or when it concerns authorizations or approvals that must be granted in the exercise of oversight and supervisory functions. 2. Silence shall also be deemed positive when it concerns applications for permits, licenses, and authorizations. 331. 1. The period for positive administrative silence to arise shall be one month from the date on which the body receives the application for approval, authorization, or a license together with the legal requirements.” It must be made clear that positive administrative silence does not operate without restriction or automatically; for it to apply, the Administration must have failed to act upon an application by an interested party (administrado), and that inactivity must also be subject to positive administrative silence, together with compliance with the requirements and conditions prescribed by the legal system for the application submitted.
Furthermore, case law has established that positive administrative silence does not apply in every proceeding in which permits, authorizations, or licenses are requested. Both the Sala Constitucional and this Collegiate Body (Órgano Colegiado) have held that—in matters involving authorizations and permits—there are exceptions to the application of positive administrative silence. Along those lines, it has been held that, in environmental matters, because of their significance to the community, no right arising merely from the passage of time may properly be asserted in response to the Administration’s failure to decide applications submitted by interested parties to obtain an authorization or approval that, in one way or another, could alter and jeopardize the fundamental right to a healthy and ecologically balanced environment (in this regard, judgments numbers 1886 at 9 hours 12 minutes on April 7, 1995, and 2063 at 14 hours 45 minutes on February 14, 2007, of the Sala Constitucional, as well as 0397-F-2001 at 15 hours 25 minutes on June 6, 2001, and 001195-F-S1-2013 at 9 hours 45 minutes on September 18, 2013, both from this Chamber, may be consulted).
Along the same lines, provision 4 of the Ley Forestal establishes: “In matters concerning natural resources, the positive administrative silence contemplated in Articles 330 and 331 of the Ley General de la Administración Pública shall not apply. When the Administración Forestal del Estado does not resolve matters submitted for its consideration within the periods stipulated in the Ley General de la Administración Pública, the responsible official shall be subject to the sanctions prescribed by law.” In this specific case, the application filed by the plaintiff company concerns using, on the Princesa Primera, the fishing license granted to the vessel El Caballero. As indicated in Considerando IV of this judgment, that license authorized only sardine fishing for bait (that is, on an artisanal basis). It should be emphasized that fishing activity has been declared a matter of public utility and social interest and is related to the exploitation and use of natural resources, specifically the sustainability and conservation of marine species (provisions 1 and 5 of the Ley de Pesca).
Consequently, for any license, permit, or authorization related to that activity or that could entail the irrational exploitation of fisheries resources and jeopardize the right to a healthy and ecologically balanced environment, it cannot be claimed that the requested approval was granted by positive administrative silence, even if the appellant believes that the application submitted complied with the applicable legal requirements. That reason alone is sufficient to reject the objection raised. In any event, for the sake of completeness, that doctrine likewise did not apply because the plaintiff submitted the vessel-substitution application—on July 18, 2012—without complying with the relevant legal requirements, a circumstance governed by provision 331 of the LGAP as a condition for positive administrative silence to apply. The application filed expressly included the following “note”: “To complete the substitution procedure, the company must register with the CCSS and arrange the inactive status of Princesa I and the vessel inspection” (folio 166 of the administrative record (expediente administrativo) for the vessel El Caballero).
This failure was confirmed in official letter ORG-128-2012 of July 18, 2012 (the same date on which the Institute received the vessel-substitution application), issued by Mr. Gerardo Zamora Ovares, Head of INCOPESCA’s Oficina Regional de Golfito, in which he informed the plaintiff company that it was required to render the license of the vessel Princesa Primera inactive and that, once all the documentation was in order, it was required to appear at that office so the new license could be prepared and the corresponding fee paid. In this regard, the record shows that it was not until July 30, 2012, that the owner of the vessel Princesa Primera applied for the inactive-status permit; on the following August 5, INCOPESCA conducted the corresponding inspection; and on the 9th day of the same month and year, the application was granted through official letter PRI-642-08-2012. These events rule out the possibility that the plaintiff company submitted the required documentation together with its vessel-substitution application; for that reason, the claimed positive administrative silence is also inapplicable.
Finally, the judges are correct in arguing that no administrative omission occurred, because the application filed by the plaintiff on July 18, 2012, was denied by resolution of the INCOPESCA Board of Directors no. AJDIP/461-2012 of the following December 7, that is, within a period of less than six months, which is considered reasonable (given that the application entailed a review of legality as well as of the advisability of the requested substitution, in view of the significance of the natural resources involved). In accordance with the foregoing, the objection must be dismissed.
VIII.As a third ground of challenge, the appellant alleges the failure to apply provisions 35, 65, and 118 of the CPCA in relation to provision 155 of the Código Procesal Civil (CPC). The appellant asserts that the judges departed from the terms of Article 65 of the CPCA, under which a declaration of default (declaratoria de rebeldía) results in the allegations of fact in the complaint being deemed admitted. The appellant maintains that the manner in which the judges decided the issue violates the principles of equality, legality, and objectivity. The appellant states that, following a declaration of default, a judgment granting relief must be entered if the relief requested in the complaint does not contravene the legal system. The appellant argues that justifying the Administration’s defaulting conduct by invoking the filing of a simple submission within the period granted to answer the action is contrary to law. The appellant emphasizes that the filing of January 18, 2013, appearing at folio 51 of the judicial record (expediente judicial), is merely an objection and not an answer to the complaint, as the Court incorrectly reasoned solely to uphold the challenged resolution of the INCOPESCA Board of Directors. The appellant contends that, had the judgment been rendered in accordance with law, the nine allegations of fact in the complaint would have been deemed proven.
IX.Regarding the declaration of default (declaratoria de rebeldía) against the defendant Institute, the trial judges reasoned: “(…) this Tribunal, as a judicial body, has an obligation to review, analyze, and determine whether the facts, law, and arguments of the defendant institution have a legal basis, even where, as in the present case, a declaration of default exists due to the alleged failure to answer the complaint filed against it, entered by the Case-Management Judge at the preliminary hearing held on 12 de junio del 2013. This conclusion is based on the following reasons:
X.Regarding default, this Chamber has stated: “As to an answer filed after the time allowed for appearance (emplazamiento), section 65 of the CPCA provides that, in such a situation, the complaint shall be deemed answered in the affirmative, but only with respect to the facts, without prejudice to the adjudicator’s ability to obtain any evidence deemed necessary and relevant to resolving the case in accordance with law (…)”. Judgment no. 94-2010 at 14 horas 50 minutos del 14 de enero de 2010. To the same effect, see resolutions numbers 1420-2013 at 9 horas 25 minutos del 24 de octubre de 2013 and 149-2017 at 14 horas 10 minutos del 21 de febrero de 2017. Although section 65 of the CPCA provides that, as a consequence of failing to comply with the duty to answer the complaint within the time allowed for appearance, the complaint shall be deemed answered in the affirmative, the omission or late filing of such an answer is not, by itself, sufficient grounds for deeming the allegations in the complaint established, because the judicial authority is required to verify the factual record against the evidence appearing in the case file and to analyze whether the claim is well-founded.
Nor does the sanction provided for in section 65 of the CPCA impair the defendant’s ability to enter an appearance (apersonarse) in the proceedings at any time—accepting them in their then-current state—and offer relevant evidence to clarify the facts, which the judge may admit—or order sua sponte—as evidence to assist in adjudication (prueba para mejor resolver). Thus, where contrary evidence exists, the presumption of truth is rebutted, and the allegations in the complaint must be deemed unproven. Proceeding in this manner is consistent with article 82.1 of the CPCA, insofar as it expressly imposes upon the administrative-litigation judge the duty to seek the substantive truth (verdad real) concerning the facts relevant to the proceedings and, for that purpose, grants the authority to order and conduct the evidentiary measures necessary to achieve that end. In the present case, the appellant seeks to have the allegations in the complaint automatically deemed proven because the defendant was declared in default during the preliminary hearing.
However, what occurred lacks the evidentiary value that the party seeks to attribute to it; it does not constitute conclusive evidence (plena prueba). Rather, the Tribunal was required to assess the body of evidence entered into the record in accordance with the rules of sound judgment (sana crítica) (provision 82.4 of the CPCA), particularly because the record contains the defendant’s written opposition to the request for positive administrative silence—the plaintiff’s initial claim—filed within the period granted to answer the action. To reiterate, the law requires the administrative-litigation judge to seek the substantive truth concerning the facts relevant to the proceedings, a determination that assumes particular importance in fulfilling the purposes entrusted to the Administrative Litigation Jurisdiction (sections 49 of the Constitución Política, 1 and 82.1 of the CPCA). Consistent with the foregoing, with respect to the matter challenged, this Chamber finds no grounds for quashing (casar) the contested judgment, because the trial judges proceeded as required by procedural law in this type of case: they analyzed whether the claims were well-founded on the basis of the evidentiary record (acervo probatorio) contained in the proceedings and verified the substantive prerequisites for any judgment. Accordingly, the asserted ground must be rejected.
XI.As a fourth ground, the appellant alleges an improper interpretation of articles 239 to 243, 334, and 335 of the LGAP, as well as section 153 of the CPCA. Contrary to the Tribunal’s conclusion, the appellant contends that agreement no. AJDIP/461-2012 of the Junta Directiva del Incopesca is null, unlawful, and arbitrary because it is inconsistent with the request to replace the vessel and violates the principle that an authority may not derogate from its own acts (principio de intangibilidad de los actos propios); moreover, it was not served upon the appellant and was issued in violation of section 331 of the LGAP. The appellant explains that the contested agreement denied the request, revoked, and annulled a valid and effective administrative act (acto administrativo), namely the fishing license granted to conduct sardine-fishing operations, as provided in agreement AJDIP/037-97. The appellant argues that, contrary to what was stated in the administrative act at issue (no.
AJDIP/461-2012), the application was not for a semi-industrial fishing license to catch sardina gallera, but solely for a change of vessel under the original license. The appellant adds that the agreement is inconsistent because it transformed an application for authorization into a modification of the terms of the license granted, thereby violating the principle that an authority may not derogate from its own acts. The appellant further states that the judges accorded validity and effect to an act that was not served upon it, thereby preventing it from challenging that act through administrative proceedings (sede administrativa) (noting that it was never asked to provide a method or address for receiving notices). The appellant emphasizes that, pursuant to sections 239 and 240 of the LGAP, every specific procedural act affecting the rights or interests of the parties or a third party must be communicated to the affected person, even if by publication (section 241 ibidem).
The appellant adds that proper notice to the administered party (administrado) is a prerequisite for the effectiveness of an administrative act, pursuant to provision 334 of the LGAP. The appellant asserts that although the challenged judgment acknowledges that agreement AJDIP/461-2012 was not served upon it, in violation of the provisions discussed above, that agreement was included among the judgment’s established facts (hechos probados), rendering the judgment null. In addition, the appellant argues that the agreement in question violates section 331 of the LGAP because positive administrative silence had occurred, given the expiration of the one-month period set forth in that provision and the adverse nature of the act at issue.
XII.The Court found inadmissible the grounds for nullity (vicios de nulidad) that the plaintiff attributed to agreement AJDIP/461-2012, whereby the Board of Directors of Incopesca denied the requested vessel-substitution permit, an act deemed proven fact no. 20, for the following reasons. First, as stated in Considerando III of this judgment, it found it established that the original fishing license assigned to the vessel El Caballero, in the name of the company Manglares del Sur, was for artisanal fishing of sardines for bait. Second, it found it proven that said license was transferred to the plaintiff company, maintaining the original conditions under which it had been granted since 8 de abril de 1997. The transfer was authorized by the Executive President of Incopesca in administrative decision no. PEP-0253-02-2012 of 27 de febrero de 2012, pursuant to the provisions of the Ley de Pesca.
The Judges noted that the cited administrative decision transferred to the plaintiff the right to operate the fishing license assigned to the vessel El Caballero under the same conditions under which it had been operated by Manglares del Sur, that is, for artisanal fishing of sardines for bait. Third, notwithstanding that administrative decision PEP-0253-02-2012 created the plaintiff’s individual right (derecho subjetivo) to operate the fishing license transferred to it, license no. H-0302-12-GTO was issued to it with the following specifications: authorized species, bait; fishing gear (artes de pesca), purse seine: multifilament, with a maximum length of 450 metros and a depth of 44 metros. The Court held: “(…) Specifically, the expert witness, Porras Porras, explained that when the license was transferred (…) an administrative error was made by the Golfito Regional Office, consisting of changes to the original license regarding the dimensions or size of the fishing gear, since the dimensions specified in the original license were intended for manual, non-mechanized work.
He opined that the error resulted from a misinterpretation of the existing regulations. He explained that the error did not authorize fishing gear suitable for semi-industrial fishing, because the license itself stated that fishing was limited to sardines for bait, and that fact alone placed it outside the scope of semi-industrial fishing. Specifically, this Court considers that this error did not grant the plaintiff any additional individual right to change the fishing license from artisanal and small-scale to a semi-industrial license (…)”. Fourth, despite the plaintiff company’s clear understanding that its fishing license was artisanal and small-scale, as demonstrated by the lease agreement (contrato de arrendamiento) executed between the owner of the vessel Princesa Primera and the plaintiff company dated 7 de junio de 2012 (which expressly stated that the vessel El Caballero held artisanal fishing license for bait no. H-0302-12-GT), the plaintiff attempted to expand its fishing exploitation rights by replacing the vessel El Caballero with the Princesa Primera, the latter having greater operating capacity, as indicated in the letter sent by the plaintiff on 28 de mayo de 2012 to the director of the Incopesca Regional Office in Golfito.
The Judges stated that the intention was to use an artisanal fishing license with a vessel that was not suited to that type of fishing, but rather to larger-scale fishing. Fifth, the Board of Directors of Incopesca adopted agreement AJDIP/461-2012 on the basis of the technical opinion issued by Mr. Porras Porras, which was expanded upon during the oral and public trial, when the expert witness explained that the denial of the vessel-substitution permit was due to the fact that the purpose of the fishing license granted (small-scale) was being changed, since the greater fishing capacity of the vessel Princesa Primera meant that the request would, in practice, entail granting a semi-industrial license, which would cause a greater impact on the sardine resource (and thus on the entire food chain). Based on the content of the challenged agreement and the statements of Mr. Porras Porras, the Judges reasoned that the principle of consistency with one’s own acts (principio de intangibilidad de los actos propios) had not been violated, because the act merely denied the applicant the requested vessel substitution while preserving the right to operate the license under its original terms (for artisanal bait fishing).
They added that the aforementioned agreement complied with the body of applicable law (bloque de legalidad), because under sections 16 of the LGAP and 103 of the Ley de Pesca, it would not only be unlawful to convert a small-scale artisanal license into a semi-industrial license, but doing so would also threaten fishery resources, since an increase in fishing capacity directly harms the sustainability of such natural resources. They noted that Incopesca is legally prohibited from authorizing licenses or permits that cause the depletion of or harm to fishery resources (the cited section 103). In addition, the Court found that the failure to notify the agreement was the plaintiff’s own responsibility, because when filing the vessel-substitution permit application it provided only one telephone number, corresponding to the location of the dock where it stated that the vessel Princesa Primera was located, but did not provide any other telephone number, fax number, or means by which Incopesca could notify it of the decision on the submitted application. Accordingly, it concluded that the challenged agreement contained no ground for nullity.
XIII.This Chamber agrees with the ruling in the judgment under appeal, because agreement no. AJDIP/461-2012 adopted by the Board of Directors of Incopesca is in accordance with the law. Contrary to the appellant’s claims, the administrative act (acto administrativo) is neither inconsistent nor in violation of the principle of consistency with one’s own acts. The application submitted by the plaintiff company sought to replace the vessel El Caballero with the Princesa Primera, using the license granted to the former vessel. The defendant Institute denied the application because it deemed the request unfeasible, as it implicitly entailed the conversion and recognition in favor of the applicant of a semi-industrial sardine-fishing license, whereas what had initially been authorized was an artisanal, small-scale fishing license for bait. Incopesca determined, on the basis of the technical opinion of Mr.
Porras Porras, the Institution’s General Technical Director (an expert witness in these proceedings), that it was not feasible to permit the license granted to the vessel El Caballero to be used by the Princesa Primera, because the latter had greater operating capacity, greater range (as acknowledged by the plaintiff in the substitution document submitted to the Institute), and a length exceeding that authorized for an artisanal fleet, since this would entail changing the nature of the license granted or disguising the recognition of a license that had not been granted to the plaintiff. For the foregoing reasons, the Institute’s Board of Directors expressly agreed: “POR TANTO: It is agreed: 1- To deny the application submitted by the Legal Representative of Sociedad FK FER S.A, owner of the vessel named EL CABALLERO, Certificate of Registration PG-5085, for recognition of a semi-industrial fishing license for the capture of sardines (…), and therefore the fishing license must remain subject to the conditions under which it was initially granted (…)”.
The denial ordered by Incopesca and its corresponding justification refute the alleged inconsistency and purported violation of the principle of consistency with one’s own acts. To be clear, although through agreement AJDIP/461-2012 the aforementioned Institute denied the requested authorization, it in no way disregarded, revoked, or annulled the fishing license initially granted to Manglares del Sur and subsequently transferred to the plaintiff. The transcribed administrative act preserved the plaintiff’s right to operate the license under its original terms with the vessel El Caballero; as detailed in Considerando IV of this judgment, those conditions refer to artisanal fishing of sardines for bait, not semi-industrial fishing. Accordingly, the challenged act did not extinguish, restrict, or deny the plaintiff any individual right (section 136 LGAP). Regarding the failure to notify the challenged agreement, the record contains certifications dated 11 y 13 de diciembre de 2012, issued by Messrs.
Guillermo Ramírez Gatjens and Heiner Méndez Barrientos in their capacities as heads of the Technical Secretariat and Legal Advisory Office, respectively, both of Incopesca, attesting that it was impossible to notify the plaintiff company of the act in question because it had not provided an address for service of notices and because the only telephone number listed in the vessel-substitution application did not belong to the plaintiff. Under those circumstances, responsibility for the failure to provide notice of that specific administrative act is clearly attributable to the applicant, which in any event has demonstrated in these proceedings that it was aware of the decision; therefore, there is no defect to be declared. Finally, as to the nullity alleged on the ground that affirmative administrative silence (silencio positivo) had occurred, the argument is rejected on the basis of the reasons set forth in Considerando VII of this judgment, to which reference is made in order to avoid unnecessary repetition. Accordingly, the trial Judges were correct in ruling that the challenged agreement does not suffer from the alleged grounds for nullity; therefore, the objection raised must be rejected.
XIV.In view of the foregoing, the appeal shall be dismissed, with costs assessed against the appellant pursuant to section 150 subsection 3) of the CPCA.
POR TANTO
The appeal is dismissed, with costs assessed against the plaintiff.

Proceso de conocimiento establecido por F K FER KAR SOCIEDAD ANÓNIMA; contra el INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA. Figuran como apoderados especiales judiciales de la parte actora, Ronald Cruz Barahona; de la parte demandada, Heiner Jorge Méndez Barrientos. La sociedad actora formula recurso de casación contra la sentencia no. 119-2016-I de las 14 horas del 19 de diciembre de 2016 emitida por el Tribunal Contencioso Administrativo y Civil de Hacienda.

CONSIDERANDO
I.El 20 de noviembre de 2012 la sociedad F K FER KAR demandó al Instituto Costarricense de Pesca y Acuicultura (en adelante Incopesca). Señaló, que ostenta licencia de pesca de sardina no. H-0302-12-GTO con la embarcación “El Caballero” (misma que le fue traspasada de la sociedad manglares del Sur), con fecha de vigencia hasta el 21 de abril de 2014. Adujo, el 18 julio de 2012 presentó ante el Incopesca, Oficina Regional de Golfito, solicitud de sustitución de embarcación, con la finalidad de utilizar dicha licencia en la embarcación Princesa Primera (por contar esta con mayor capacidad y autonomía). Sostuvo, no recibió respuesta alguna por parte del Instituto, por lo que estima que operó el silencio positivo, al tenor de los artículos 331 y 332 de la Ley General de la Administración Publica (LGAP). Afirmó, esa conducta omisiva del Incopesca le impidió el desarrollo económico y social, afectando sus intereses patrimoniales y laborales.
Así las cosas, solicitó en sentencia (pretensiones ajustadas en la audiencia preliminar): “A) Con lugar en todos sus extremos la presente demanda. B) Que como consecuencia de lo anterior, y a raíz de su conducta omisiva, y por haber operado el silencio positivo, se obligue a la Administración demandada a otorgar Licencia de Pesca de Sardina, por sustitución de embarcación, en este caso se obligue al Instituto Costarricense de Pesca y Acuacultura (INCOPESCA), a renovar y autorizar Licencia de Pesca de Sardina en la embarcación denominada "PRINCESA PRIMERA" MATRÍCULA L-000611, para que opere por sustitución de embarcación, en la misma situación y condición de la anterior. C) Que a raíz de lo anterior, y por el atraso indebido atribuible a la Administración accionada, al no poder sustituir dentro de los plazos legales la embarcación, y ejecutar la sociedad comercial actora, las labores de pesca en todo este tiempo, a título de perjuicio, se prorrogue después del vencimiento de la Licencia de Pesca de dicha embarcación al período igual desde su presentación de la solicitud de sustitución hasta el efectivo otorgamiento de la Licencia, tomando como partida la fecha de vencimiento que es el 21 de abril de año 2014.
Por escrito presentado el 17 de junio de 2013, la accionante aclaró la pretensión de daños y perjuicios en los siguientes términos: "1.- DAÑOS Y PERJUICIOS: A.- DAÑO MATERIAL: El mismo está relacionado con el cese y giro comercial de la actividad pesquera, extracción del recurso pesquero, para el cual está autorizado legalmente y la posterior venta del recurso marino, el cual constituye el daño material y emergente. (…). De conformidad con el estudio contable adjunto, con base en los parámetros que da Incopesca para este tipo de labor, y que se ofrece como prueba, se procede a liquidar por gastos operativos, por concepto de daño material; la cantidad de CIENTO CUARENTA Y DOS MILLONES QUINIENTOS MIL COLONES, (¢142.500.000,00). B.- Daño material en segundo término: en este caso, son las deudas adquiridas por la empresa, y que debe cancelar día con día, pero que debido al cese de actividad pesquera, y no generar ingresos, la empresa a través de su socios, han tenido que acudir al endeudamiento externo, para estar al día con los pagos de las deudas de empresa, en tal sentido y de acuerdo con el Informe Contable adjunto, se liquida la cantidad de SESENTA Y SEIS MILLONES NOVENTA Y UN MIL SETENTA Y NUEVE COLONES (¢66.091.079,00), más los abonos e intereses que se han cancelado por deudas de la empresa a la fecha, que suma la cantidad de VEINTIOCHO MILLONES NOVECIENTOS CATORCE MIL QUINIENTOS SETENTA Y SEIS COLONES CON CUARENTA CENTIMOS.
(¢28.914.5786,40). 2.- PERJUICIOS: C.- LUCRO CESANTE: En este caso y de acuerdo con el giro comercial de la empresa, industria pesquera, de conformidad con el Informe contable, como total de utilidades no percibidas, se liquida en la cantidad de DOSCIENTOS TRECE MILLONES SETECIENTOS CINCUENTA MIL COLONES, (¢213.750.000,00). D.- De conformidad con el artículo 1163 del Código Civil, por las sumas aprobadas, o acogidas de manera general, se condene así pago de los intereses legales, desde el 17 de julio del 2012. Y hasta su efectivo pago. E.- DAÑO MORAL OBJETIVO: Al tratarse de una sociedad comercial, cuyo giro lo es la actividad pesquera, el cese intempestivo, por la conducta omisiva de la administración, depende exclusivamente de ello, lo cual ha acarreado a sus socios, el endeudamiento, y sufrimiento personal, para asumir las cuentas por pagar de la empresa, para que no caigan en desventura y la "bancarrota".
Al no generar ingresos, su imagen comercial ha cesado, en tal sentido al ser in re ipsa, liquido por daño moral objetivo, la cantidad de VEINTE MILLONES DE COLONES, (¢20.000.000,00)". Por escrito del 17 de marzo de 2014, el demandado se opuso al pedimento de daños y perjuicios. El Tribunal Contencioso Administrativo y Civil de Hacienda, Sección Primera, integrado por los jueces Otto González Vílchez, Claudia Bolaños Salazar y Carlos Espinoza Salas, por resolución no. 119-2016-I de las 14 horas del 19 de diciembre de 2016, en lo de interés dispuso: “(…) Se declara con lugar la falta de derecho. Se declara sin lugar en todos sus extremos la presente demanda. Se condena a la sociedad actora al pago de las costas procesales y personales de este proceso”. Inconforme la accionante plantea recurso de casación por motivos sustantivos, el cual fue admitido por esta Sala.
II.Como primer agravio, acusa, indebida valoración probatoria en quebranto de los cánones 16, 140, 239 y 240 de la LGAP, así como, del numeral 82 del CPCA. Expresa, los Juzgadores no analizaron los actos administrativos que dieron origen al otorgamiento de su licencia de pesca y de los cuales se acredita, contrario a lo establecido por el Incopesca en el acuerdo impugnado, que lo autorizado no fue una licencia de tipo artesanal y de pequeña escala. En ese sentido enlista, del expediente administrativo de la embarcación El Caballero, los siguientes: documento de la “COMISION ASESORA DEL PACIFICO SUR, CAPS23 DE MARZO DE 1997” (folio 11), resolución de Incopesca no. H-0029-97-G del 8 de abril de 1997 (folios 14 a 16), copia de la licencia otorgada (folio 17) y, acuerdo de la Junta Directiva no. AJDIP/037-97 del 5 de febrero de 1997 (acuerdo general para la pesca de sardina). Refiere también al oficio DGT130-07-2012 del 20 de julio de 2012, suscrito por el señor Antonio Porras Porras -Director General Técnico- y dirigido al señor Heiner Méndez Barrientos -jefe de la Asesoría Legal- ambos del Incopesca.
Asevera, en ninguno de esos documentos se indica que la licencia concedida era para pesca artesanal, por el contrario, de esos actos concretos, válidos y eficaces, de conformidad con los preceptos 239 y 240 de la LGAP, se desprende que lo otorgado a la embarcación El Caballero fue una licencia de pesca para sardina, autorizando como artes de pesca: red de cerco, longitud máxima de 450 metros. Acota, el único documento donde se expresa “pesca artesanal” rola a folio 12 del expediente administrativo, el cual corresponde a una “comunicación de acuerdo” emitida por el señor Heiner Méndez Barrientos, secretario a.i de la Junta Directiva del Incopesca y donde, por error de trascripción se indicó que lo otorgado era un permiso para la pesca de sardina en forma artesanal, al tenor del acuerdo AJDIP/037/97. Reclama, los Jueces en contraposición a los actos administrativos que originaron el otorgamiento de la licencia en cuestión, dieron validez a un informe rendido por el señor Heiner Méndez Barrientos en fecha 30 de noviembre de 2012 y dirigido a la Junta Directiva del Instituto, el cual carece de sustento jurídico y técnico e inserta hechos falsos (pues alude a un supuesto cambio de actividad artesanal a semiindustrial de extracción de sardina y, del otorgamiento de una licencia de tipo artesanal a la Sociedad actora).
Afirma, no hubo cambio de actividad y así se demuestra en el oficio ORG-128-2012 del 18 de julio de 2012, mediante el cual la Oficina Regional de Golfito del Incopesca informó que no existía objeción para la sustitución de la embarcación El Caballero por la Princesa Primera. Sostiene, al fundamentar los Jueces su decisión en el informe extendido por el señor Méndez Barrientos y en el criterio del funcionario Porras Porras, violentó los principios de proporcionalidad, igualdad, seguridad jurídica, sana critica e intangibilidad de los actos propios. Insiste, la licencia otorgada a la embarcación El Caballero no es de tipo artesanal.
III.Al examinar los vicios de nulidad que la sociedad actora le imputó al acuerdo de Junta Directica no. AJDIP/461-2012, mediante el cual le fue denegado el permiso de sustitución de embarcación, estimó el Tribunal procedente comenzar por analizar el tipo de licencia de pesca de la que es titular la accionante. En esa dirección, tuvo por demostrado que el 8 de abril de 1997, por acuerdo de Junta Directiva AJDIP/102/97 se otorgó licencia de pesca no. P-0029-97-G a la embarcación El Caballero, propiedad en ese momento de la sociedad Manglares del Sur, para la captura de sardina para carnada, en forma artesanal y autorizándose como artes de pesca, red de cerco: longitud máxima 450 metros. Señalaron los Juzgadores que esa es la licencia de pesca original autorizada a la entonces propietaria de la embarcación El Caballero y que, nunca se dispuso permiso alguno para la pesca de otras especies ni que fuera de tipo semiindustrial.
Por otra parte, tuvieron por acreditado que el 22 de abril de 2008 el representante legal de la empresa Manglares del Sur solicitó la renovación de la licencia de pesca, la cual fue concedida, en lo de interés, según las siguientes especificaciones: tipo de pesca autorizada, carnada; embarcación, El Caballero; artes de pesca, red de cerco: multifilamento con longitud máxima 450 metros con una profundidad menor de 44 metros; fecha de vigencia del 22 de abril de 2008 al 21 de abril de 2014; se permite la pesca con redes de cerco para carnada de sardina en la zona 3 (zona norte) y en la zona 4 (zona sur). Indicaron los Jueces que dicha renovación de licencia se otorgó por un plazo de seis años, al tenor de la Ley de Pesca y Acuicultura, no. 8436 y en ella se mantuvieron las condiciones originarias de la licencia, es decir, para realizar pesca de sardina para carnada, por lo tanto artesanal y de pequeña escala (conforme el numeral 2 inciso 26 de la Ley de cita).
Situación confirmada durante el juicio oral y público por el testigo-perito, Antonio Porras Porras, quien declaró que la licencia de pesca otorgada a la embarcación El Caballero es artesanal (lo que significa que no se utilizan medios mecánicos), donde la actividad autorizada es la pesca para carnada (no para consumo humano, en cuyo caso la licencia sería de tipo semiindustrial y en la cual sí se utilizan medios mecánicos). Con base en ese criterio técnico, tuvo claro el Tribunal que la licencia de pesca autorizada a la embarcación El Caballero es artesanal, nunca semiindustrial.
IV.Comparte este Órgano Decisor la posición de los Juzgadores de instancia. Al margen de que la licencia de pesca no. P-0029-97-G otorgada a la embarcación El Caballero propiedad de la Sociedad Manglares del Sur y luego traspasada junto con la embarcación a la accionante, no indica que era de tipo artesanal y de pequeña escala, como reprocha la casacionista, es lo cierto que la pesca autorizada fue: sardina para carnada (hecho no controvertido). Así establecido en la resolución INCOPESCA-H-0029-97 del 8 de abril de 1997, en la respectiva licencia y en el documento denominado “COMISION ASESORA DEL PACIFICO SUR, SEDE GOLFITO, CAPS 23 DE MARZO 1997” (todos ellos aludidos por el recurrente). Sobre esa actividad específica autorizada, declaró durante el juicio oral y público el testigo-perito señor Antonio Porras Porras, en su condición de Biólogo y Director General Técnico del Incopesca, que el solo hecho de que la licencia se otorgue para la pesca de sardina para carnada, la excluye del ámbito de la pesca semiindustrial.
Explicó el perito, las licencias para carnada son aquellas que refiere a un uso de venta del producto hacia otros pescadores o entre ellos mismos, pero con esa finalidad: para carnada, es decir; comercializable únicamente a nivel de carnada para el mismo sector pesquero, donde no se utilizan medios mecánicos para la extracción de la sardina y son operadas básicamente por los autorizados por el Incopesca, de manera que, desde un punto de vista técnico califica como una licencia artesanal. Por el contrario, aclaró el testigo, las de tipo semiindustrial son licencias comerciales para consumo humano mayoritariamente (cerca de un 90% y el restante 10% para carnada) y en ella se autoriza el empleo de medios mecánicos al llevar a cabo las labores de bolicheo o cerco de la sardina. Resaltó don Antonio que una licencia de pesca para carnada no puede asimilarse a una de tipo semiindustrial, pues esta ultima tiene una finalidad comercial o para consumo humano en al menos un 90%.
Criterio técnico que resulta congruente con lo establecido en los artículos 66 de la Ley de Pesca y 56 de su Reglamento, normas que establecen: “Articulo 66. El INCOPESCA podrá autorizar la pesca de sardina únicamente para ser utilizada para el consumo humano o como carnada. Los desechos de sardina, producto de la industrialización para el consumo humano, podrán ser aprovechados para otros fines”. “Artículo 59. El INCOPESCA podrá autorizar la pesca de sardina únicamente para ser utilizada como carnada por la flota pesquera nacional o para el consumo humano”. Lo subrayado es suplido. De los preceptos trascritos se colige que, únicamente, son dos los tipos de licencia para pesca de sardina que autoriza el referido Instituto, sea para carnada o para consumo humano. Por consiguiente, si la licencia otorgada a la embarcación El Caballero, propiedad de Manglares del Sur y luego traspasada a la sociedad actora, de forma expresa indica que la actividad autorizada es la pesca de sardina para carnada (solamente), tal condición por sí sola descarta que se trate de una licencia semiindustrial (pues se insiste, en esta la pesca autorizada es para consumo humano).
Razonamiento que deviene acorde con el documento denominado “Comunicación de Acuerdo 1997” (visible a folio 12 del expediente administrativo de la embarcación El Caballero), mediante el cual el señor Heiner Méndez Barrientos, secretario a.i de la Junta Directiva del Incopesca, puso en conocimiento de la Presidencia Ejecutiva el acuerdo A.J.D.I.P./102-97 del 8 de abril de 1997, en lo de interés: “Conceder permiso para la pesca de sardina gallera en forma artesanal (…)” a la embarcación El Caballero. La negrita es suplida. En el mismo sentido, consta en autos el contrato de arrendamiento suscrito el 7 de junio de 2012 entre el señor Carlos Andrés Bolaños Chaves y el sociedad actora, donde textualmente se consignó (folios 158 y 159 ibidem)”.: “(...) Los suscritos, (...) Carlos Andrés Bolaños Chaves (...) como propietario de la embarcación Princesa Primera, matrícula L-611, en adelante conocida como arrendante, y F-K FERKAR S A, (...) representada en este acto por Francisco Javier Fernández Vásquez (...) en calidad de apoderado generalísimo sin límite de suma, propietario de la embarcación El Caballero, matrícula PG 5085 y con licencia artesanal de pesca de carnada con arte de pesca de cerco, otorgada por Incopesca Número H0302-12-GTO con fecha vencimiento el 21 de abril 2014, en adelante conocido como la arrendadora Y dicen que han convenido celebrar el presente contrato de arriendo que se regirá por las siguientes cláusulas: (...) TERCERA; Carlos Bolaños Zamora, apoderado del propietario de Princesa Primera, otorga en alquiler su barco a F-K Ferkar s.a. para utilizarlo en labores de pesca con arte de pesca cerco aprovechando la licencia No H0302-12-GTO propiedad de la arrendadora, previa autorización del INCOPESCA.
CUARTA; el plazo del presente contrato es por un año, a partir de la fecha que Incopesca otorgue el permiso de sustitución de la embarcación, (...)". La negrita es suplida. En todo caso, valga destacar, no consta en autos que la actora haya ejercicio la actividad de pesca de sardina a nivel semiindustrial con la embarcación El Caballero, como ahora reclama. Así las cosas, al resultar coincidente el criterio de los Jueces con la prueba aportada al proceso, en cuanto a que la licencia otorgada a la sociedad accionante lo era para la pesca de sardina para carnada, por ende, artesanal y no semiindustrial, la indebida valoración probatoria y el quebranto normativo invocados devienen de rechazo.
V.Como segunda censura, endilga, indebida aplicación de los preceptos 329, 330 y 331 de la LGAP. Apunta, el Tribunal rechazó la declaratoria de silencio positivo invocando la existencia de recursos naturales, incumplimiento de los requisitos establecidos para la sustitución de embarcación y que la Junta Directiva del Incopesca sí resolvió la gestión planteada. Sin embargo, reprocha, lo solicitado no es el otorgamiento de una licencia de pesca, tampoco la variación en el ejercicio de la licencia actual, sino la simple sustitución de embarcación con fundamento en la licencia concedida. Gestión que fue avalada por la oficina Regional de ese Instituto en Golfito (oficio ORG-128-2012). En ese sentido, manifiesta, el argumento de los “recursos naturales” deviene improcedente. En cuanto al incumplimiento del trámite de inactividad de la licencia de pesca a la embarcación Princesa Primera, destaca, tal aspecto no fue discutido por el demandado.
En todo caso, señala, del expediente administrativo se colige el cumplimiento de ese requisito y de las respectivas inspecciones por parte de los funcionarios del Incopesca. Aunado a lo anterior, refiere como último acto de parte y en cumplimiento de los requisitos previos a la sustitución, que el 14 de julio de 2012 le informó al Jefe Regional de Golfito “(…) de acuerdo con el oficio ORG-122-2012, la embarcación El Caballero, matricula PG-5085 permanece en el dique seco, en el taller industrial del señor Manuel Arroyo, sita en KM 2 de Golfito” (folio 168 del expediente administrativo). Dice, el siguiente oficio que le fue comunicado es el ORG-128-2012 del 18 de julio de 2012, donde se indica que no había objeción por parte de esa oficina regional para la sustitución requerida. Con posterioridad, señala, el único acto emitido por la Administración es aquel con fundamento en el cual los Juzgadores estimaron que sí se resolvió la solicitud planteada, sea el acuerdo de Junta Directiva del 7 de diciembre de 2012 (mismo que considera nulo, por las razones que se detallaran en el cuarto reparo formulado). Así las cosas, concluye, en la especie sí operó el silencio positivo reclamado.
VI.Estimaron los Juzgadores de instancia que en el caso particular no operó la figura del silencio positivo regulada en el canon 331 de la LGAP, por los siguientes motivos: primero, dado que la actividad pesquera se relaciona con la explotación de recursos naturales, en concreto, con el aprovechamiento sostenible de las especies acuáticas que es materia medioambiental, según se desprende de los artículos 1 y 5 de la Ley de Pesca y Acuicultura. En consecuencia, señalaron, deviene aplicable lo dispuesto por la Sala Constitucional en las sentencias números 820-95 de las 18 horas 54 minutos del 8 de febrero de 1995 y 2954-94 de las 9 horas 9 minutos del 17 de junio de 1994, sea: que tratándose de la explotación de recursos naturales no opera el silencio positivo, pues ello permitiría una explotación irracional de tales recursos. En la especie, argumentaron, la sociedad actora solicitó permiso de sustitución de embarcación con base en una licencia de pesca, lo que implica que dicha gestión está relacionada con la explotación de recursos acuáticos pesqueros, de ahí, la improcedencia del silencio positivo alegado.
Segundo, porque al presentar la solicitud de sustitución de embarcación la accionante incumplió con los requisitos legales establecidos al efecto (inciso 1 del numeral 331 de la LGAP). Manifestaron los Jueces, el 18 de junio de 2012 la empresa demandante solicitó permiso de sustitución de la embarcación El Caballero por la Princesa Primera, en la parte inferior derecha de ese documento se consignó una nota que dice: “Nota: Para Finiquitar el trámite de sustitución la empresa debe inscribirse en la C.C.S.S y realizar la inactividad Princesa I y Inspección de la Embarcación". Razonaron: “(…) desde el preciso momento en que la empresa actora presentó su solicitud de permiso de sustitución de embarcación, ante el INCOPESCA, se consignó que no se habían presentado con esa gestión todos los requisitos, como lo son la inscripción de la sociedad demandante ante la CCSS, así como la documentación que acreditara la inspección y la aprobación del permiso de inactividad de la embarcación Princesa Primera”.
Situación acreditada en el oficio ORG-128-2012 del señor Gerardo Zamora Ovares, Jefe de la Oficina Regional de Golfito. Detalló el Tribunal, la actora no demostró haber presentado documentación respecto a la inactividad de la licencia de pesca de la embarcación Princesa Primera, en el trámite de sustitución de embarcación El Caballero, requisito necesario para que procediera la aprobación del cambio requerido. Incumplimiento confirmado en el oficio ORG-145-2012 del 27 de agosto de 2012, donde el funcionario Zamora Ovares informó a la empresa accionante el recibido de la documentación enviada por correo y dentro de la cual, no enlistó los documentos relativos a la inspección y aprobación del permiso de inactividad de comentario. Tercero, ante la inexistencia de una conducta omisiva del Incopesca. Analizaron los Juzgadores, la solicitud de sustitución de embarcación se presentó el 18 de julio de 2012 y la Junta Directiva la denegó el 7 de diciembre siguiente, es decir, en un plazo menor a los seis meses.
Incluso, apuntaron, la empresa fue informada del trámite y del rechazó del permiso antes de que la Junta Directiva adoptara el acuerdo AJDIP/461-2012, así declarado en el juicio oral por el testigo Francisco Javier Fernández (representante legal de la actora) y confirmado en el oficio AL-01-133-11-2012 del 30 de noviembre de 2012.
VII.Respecto al silencio positivo, los cardinales 330 y 331 de la LGAP disponen: “330. 1. El silencio de la Administración se entenderá positivo cuando así se establezca expresamente o cuando se trate de autorizaciones o aprobaciones que deban acordarse en el ejercicio de funciones de fiscalización y tutela. 2. También se entenderá positivo el silencio cuando se trate de solicitudes de permisos, licencias y autorizaciones. 331. 1. El plazo para que surja el silencio positivo será de un mes, a partir de que el órgano reciba la solicitud de aprobación, autorización o licencia con los requisitos legales”. Téngase claro, el silencio positivo no opera de manera irrestricta o automática, para su procedencia es necesaria una conducta omisiva de parte de la Administración ante una solicitud del administrado y además, que esa inactividad esté sancionada con el silencio positivo, aunado al cumplimiento de los requisitos y exigencias que en relación a la gestión formulada, el ordenamiento jurídico disponga.
Además, vía jurisprudencial se ha establecido que no en cualquier procedimiento en el que se soliciten permisos, autorizaciones y licencias, es aplicable el silencio positivo. Tanto la Sala Constitucional como este Órgano Colegiado han dispuesto que –en materia de autorizaciones y permisos- existen excepciones a la aplicación de la figura del silencio positivo. En esa dirección, se ha sostenido que en materia ambiental, por su trascendencia para la colectividad, no resulta de recibo alegar derecho alguno sobre él originado en el mero transcurso del tiempo, ante la actitud omisiva de la Administración en resolver las gestiones formuladas por los administrados para obtener alguna autorización o aprobación que, de una u otra forma, pueda alterar y comprometer el derecho fundamental a un ambiente sano y ecológicamente equilibrado (en este sentido pueden consultarse las sentencias números: 1886 de las 9 horas 12 minutos del 7 de abril de 1995 y 2063 de las 14 horas 45 minutos del 14 de febrero de 2007 de la Sala Constitucional, así como, la 0397-F-2001 de las 15 horas 25 minutos del 6 de junio de 2001 y 001195-F-S1-2013 de las 9 horas 45 minutos del 18 de setiembre de 2013, ambas de esta Sala).
En la misma dirección, establece el numeral 4 de la Ley Forestal: “En materia de recursos naturales no operará el silencio positivo, contemplado en los artículos 330 y 331 de la Ley General de la Administración Pública. Cuando la Administración Forestal del Estado no resuelva los asuntos sometidos a su conocimiento, dentro de los plazos estipulados en la Ley General de la Administración Pública, el funcionario responsable se expondrá a las sanciones dispuestas en las leyes”. En el caso concreto, la gestión planteada por la sociedad actora es la utilización de la licencia de pesca otorgada a la embarcación El Caballero en la Princesa Primera. Licencia, según se indicó en el Considerando IV de este fallo, donde lo autorizado fue únicamente la pesca de sardina para carnada (sea, en forma artesanal). Cabe destacar, la actividad pesquera ha sido declarada de utilidad pública e interés social, la misma se relaciona con la explotación y el aprovechamiento de recursos naturales, en concreto, con la sostenibilidad y conservación de las especies marinas (cánones 1 y 5 de la Ley de Pesca).
Por consiguiente, en toda licencia, permiso o autorización relacionado a dicha actividad o que puede conllevar una explotación irracional del recurso pesquero y comprometer el derecho a un ambiente sano y ecológicamente equilibrado, no es posible alegar que la aprobación pretendida operó positivamente, aún y cuando el recurrente estime que la gestión planteada cumplía con los requisitos legales exigidos. Motivo de suyo suficiente para rechazar la censura esgrimida. En todo caso, a mayor abundamiento de razones, tampoco operó esa figura por cuanto la accionante presentó la solicitud de sustitución de embarcación -en fecha 18 de julio de 2012- sin cumplir con los requisitos legales al efecto, supuesto regulado en el numeral 331 de la LGAP para la procedencia del silencio positivo. En la gestión incoada expresamente se consignó a modo de “nota”: “Para finiquitar el trámite de sustitución la empresa debe inscribirse en la CCSS y realizar la inactividad Princesa I y inspección de la embarcación” (folio 166 del expediente administrativo de la embarcación El Caballero).
Incumplimiento confirmado en el oficio ORG-128-2012 del 18 de julio de 2012 (misma fecha cuando el Instituto recibió la solicitud de sustitución de la embarcación), emitido por el señor Gerardo Zamora Ovares, Jefe de la oficina regional de Golfito del Incopesca, en el que informó a la sociedad accionante que debía proceder a inactivar la licencia de la embarcación Princesa Primera y una vez que toda la documentación estuviera en regla debía presentarse a esa oficina para confeccionar la nueva licencia y pagar el canon correspondiente. En esa dirección, consta en autos, hasta el 30 de julio de 2012 el propietario de la embarcación Princesa Primera gestionó el permiso de inactividad, el 5 de agosto siguiente el Incopesca realizó la inspección correspondiente y el día 9 del mismo mes y año, por oficio PRI-642-08-2012 se acogió la solicitud. Tales acontecimientos, descartan que la empresa demandante haya presentado junto con el permiso de sustitución de embarcación la documentación exigida al efecto, por este motivo tampoco deviene procedente el silencio positivo reclamado.
Finalmente, llevan razón los Juzgadores al argumentar que no existió ninguna conducta administrativa omisiva, dado que la solicitud planteada por la accionante el 18 de julio de 2012 fue rechazada mediante acuerdo de Junta Directiva del Incopesca, no. AJDIP/461-2012 del 7 de diciembre siguiente, es decir, en un plazo menor a los seis meses y el cual se estima razonable (dado que lo gestionado conllevaba un examen de legalidad, así como, de la conveniencia de la sustitución requerida por la trascendencia de los recursos naturales involucrados). De conformidad con lo expuesto, lo procedente será desestimar el reproche.
VIII.Como tercer reparo, recrimina, falta de aplicación de los mandatos 35, 65 y 118 del CPCA, en relación al canon 155 del Código Procesal Civil (CPC). Afirma, los Juzgadores se apartaron de lo estipulado en el artículo 65 del CPCA, en cuanto a que la declaratoria de rebeldía da lugar a que se tengan por contestados afirmativamente los hechos de la demanda. Asevera, la forma como los Jueces resolvieron el tema quebranta los principios de igualdad, legalidad y objetividad. Dice, ante la declaratoria de rebeldía se debe dictar sentencia estimatoria si lo pedido en el escrito de demanda no contraviene el ordenamiento jurídico. Arguye, justificar la conducta rebelde de la Administración invocando la presentación de un simple escrito dentro del plazo otorgado para contestar la acción, es contrario a derecho. Resalta, el escrito del 18 de enero de 2013, visible a folio 51 del expediente judicial, es una simple oposición y no la contestación de la demanda, como mal argumentó el Tribunal con el único fin de tener por válido el acuerdo de la Junta Directiva del Incopesca impugnado. Reclama, de haberse dictado el fallo conforme a derecho los nueve hechos de la demanda se tendrían como probados.
IX.Sobre la declaratoria de rebeldía del Instituto demandado, razonaron los Jueces de instancia: “(…) este Tribunal, como órgano jurisdiccional que es, tiene la obligación de revisar, analizar y de determinar si los hechos, el derecho y los argumentos de la institución demandada, tienen sustento jurídico, aunque exista, como en el presente caso, una declaratoria de rebeldía por la supuesta no contestación de la demanda en su contra, realizada por la Jueza Tramitadora en la audiencia preliminar realizada el 12 de junio del 2013. Lo indicado se sustenta en las siguientes razones:
X.Sobre la rebeldía, esta Cámara ha indicado: “En cuanto a la contestación realizada fuera del emplazamiento, el ordinal 65 del CPCA, establece que ante esa situación se tiene por contestada afirmativamente la demanda, pero lo es en cuanto a los hechos, sin perjuicio, de que el Juzgador pueda hacer llegar cualquier elemento probatorio que estime necesario y relevante para la resolución del caso conforme a Derecho (…)”. Sentencia no. 94-2010 de las 14 horas 50 minutos del 14 de enero de 2010. En igual sentido, puede consultarse las resoluciones números 1420-2013 de las 9 horas 25 minutos del 24 de octubre de 2013 y 149-2017 de las 14 horas 10 minutos del 21 de febrero de 2017. Si bien el canon 65 del CPCA dispone que como consecuencia de la inobservancia al deber de contestar la demanda dentro del emplazamiento, se tendrá por contestada afirmativamente, la omisión o presentación tardía de tal contestación por sí solas no son criterio suficiente para tener por acreditados los hechos de la demanda, porque la autoridad jurisdiccional se encuentra en la obligación de verificar el cuadro fáctico con sujeción a los elementos de prueba obrantes en el expediente y de analizar la procedencia de la pretensión.
La sanción prevista en el numeral 65 del CPCA tampoco enerva la posibilidad de que el accionado pueda apersonarse en cualquier tiempo al proceso (tomándolo en el estado en que se encuentre) y ofrecer elementos de prueba pertinentes para el esclarecimiento de los hechos y que el juez los admita –o los ordene de oficio- en carácter de prueba para mejor resolver. Así, en caso de constar prueba en contrario, la presunción de verdad queda desvirtuada, debiendo tenerse por indemostrados los hechos de la demanda. El proceder en el sentido apuntado resulta congruente con el artículo 82.1 del CPCA, en tanto expresamente impone al juzgador contencioso el deber de buscar la verdad real de los hechos relevantes en el proceso, y para ello le concede la potestad de ordenar y practicar las diligencias de prueba necesarias para la consecución ese fin. Ahora bien, en la especie, la recurrente pretende que por haberse declarado rebelde el accionado durante la audiencia preliminar, automáticamente se tengan por probados los hechos de la demanda.
No obstante, la situación ocurrida carece del valor probatorio que la parte busca de darle; no se está en presencia de plena prueba, sino que el Tribunal debía valorar la comuna probatoria traída a los autos de conformidad con las reglas de la sana crítica (precepto 82.4 del CPCA), máxime que consta en autos el escrito de oposición al pedimento de silencio positivo (pretensión inicial de la actora), presentado por el demandado dentro del plazo otorgado para contestar la acción. Se reitera, la ley le impone al juez contencioso la búsqueda de la verdad real de los hechos relevantes del proceso, determinación que adquiere especial relevancia en la consecución de los fines encomendados a la Jurisdicción Contencioso Administrativa (numerales 49 de la Constitución Política, 1 y 82.1 del CPCA). En consonancia con lo expuesto, en lo que ha sido objeto de agravio, considera esta Sala que no hay motivo para casar el fallo impugnado, pues los Juzgadores de instancia procedieron conforme la ley procesal se lo exige en este tipo de asuntos, esto es, analizando la procedencia de las pretensiones a partir del acervo probatorio constante en autos y de la verificación de los presupuestos sustantivos de toda sentencia. Así las cosas, el cargo esgrimido deberá ser desestimado.
XI.Como cuarto motivo, reclama, indebida interpretación de los artículos 239 a 243, 334 y 335 de la LGAP, así como, del ordinal 153 del CPCA. Contrario al criterio del Tribunal, acusa, el acuerdo de la Junta Directiva del Incopesca no. AJDIP/461-2012 es nulo, ilegal y arbitrario, porque deviene incongruente con la petición de sustitución de embarcación y violatorio del principio de intangibilidad de los actos propios, además, no le fue notificado y se dictó en infracción del numeral 331 de la LGAP. Detalla, el acuerdo impugnado le denegó la solicitud planteada, revocó y anuló un acto administrativo válido y eficaz, consistente en la licencia de pesca otorgada para faenar labores de pesca de sardina, según lo dispuesto en el acuerdo AJDIP/037-97. Arguye, contrario a lo dispuesto en el acto administrativo en cuestión (no. AJDIP/461-2012) lo gestionado no fue una licencia de pesca semiindustrial para la captura de sardina gallera, sino, únicamente, un cambio de embarcación con base en la licencia original.
Agrega, el acuerdo deviene incongruente al transformar una solicitud de autorización en una modificación de las condiciones de la licencia otorgada, violentando el principio de intangibilidad de los actos propios. Por otra parte, señala, los Jueces dan validez y eficacia a un acto que no le fue notificado, lo que le impidió recurrirlo en sede administrativa (apunta, nunca se le pidió un medio o lugar para recibir notificaciones). Destaca, al tenor de los cardinales 239 y 240 de la LGAP todo acto concreto de procedimiento que afecte derechos o intereses de las partes o de un tercero, debe ser comunicado al afectado, aunque sea por publicación (canon 241 ibidem). Agrega, es requisito de eficacia del acto administrativo su debida comunicación al administrado, de conformidad con el precepto 334 de la LGAP. Manifiesta, a pesar de que la resolución recurrida reconoce que el acuerdo AJDIP/461-2012 no le fue notificado, en infracción de las normas de comentario, se incorporó en los hechos probados de la sentencia, de ahí su nulidad.
Aunado a lo anterior, arguye, el acuerdo de referencia es violatorio del cardinal 331 de la LGAP al haber operado el silencio positivo (por el trascurso del plazo mensual contenido en esa norma y dado el carácter denegatorio del acto en cuestión).
XII.Estimó el Tribunal improcedentes los vicios de nulidad que la parte actora le imputa al acuerdo AJDIP/461-2012, mediante el cual la Junta Directiva del Incopesca le denegó el permiso de sustitución de embarcación gestionado, acto tenido como hecho probado no. 20, por las siguientes razones. Primera, como se indicó en el Considerando III de esta sentencia, tuvo por acreditado que la licencia de pesca original asignada a la embarcación El Caballero, a nombre de la empresa Manglares del Sur, fue para pesca de sardina para carnada, de tipo artesanal. Segunda, tuvo por demostrado que dicha licencia fue trasladada a la sociedad accionante, manteniendo las condiciones originales que fueron otorgadas desde el 8 de abril de 1997. Movimiento autorizado por el Presidente Ejecutivo del Incopesca en resolución administrativa no. PEP-0253-02-2012 del 27 de febrero de 2012 y al tenor de lo establecido en la Ley de Pesca.
Apuntaron los Juzgadores, la resolución administrativa de cita le transfirió a la demandante el derecho de explotar la licencia de pesca asignada a la embarcación El Caballero bajo iguales condiciones que la explotó Manglares del Sur, es decir, para pesca de sardina para carnada, de manera artesanal. Tercera, no obstante que la resolución administrativa PEP-0253-02-2012 constituyó el derecho subjetivo de la actora para explotar la licencia de pesca que le fue trasferida, a ésta se le emitió la licencia no. H-0302-12-GTO, con las siguientes especificaciones: especies autorizadas, carnada; artes de pesca, red de cerco: multifilamento con longitud máxima de 450 metros con una profundidad de 44 metros. Consideró el Tribunal: “(…) Precisamente, el testigo perito, Porras Porras, explicó que cuando se dio el traslado de la licencia (…) se cometió un error administrativo por parte de la Oficina Regional de Golfito, consistente en que se dieron variaciones a la licencia original en cuanto a las medidas o tamaño del arte de pesca, ya que las medidas que estaban contempladas en la licencia original eran para un trabajo de tipo manual no mecanizado.
Opinó, que el error obedeció a una mala interpretación de la normativa existente. Explicó, que el error no autorizó un arte de pesca propio de una pesca semiindustrial, ya que el indicarse en la misma licencia que la pesca era únicamente para sardina para carnada, solo ese hecho lo está sacando del ámbito de la pesca semiindustrial. Precisamente, considera este Tribunal, que este error no le otorgó a la parte actora ningún derecho subjetivo adicional consistente en variar la licencia de pesca de artesanal y de pequeña escala a una licencia semiindustrial (…)”. Cuarta, a pesar de que la empresa accionante tuvo claro que su licencia de pesca era artesanal y de pequeña escala, lo cual se demostró con el contrato de arrendamiento suscrito entre el propietario de la embarcación Princesa Primera y la sociedad actora de fecha 7 de junio de 2012 (donde expresamente se consignó que la embarcación El Caballero ostentaba una licencia artesanal de pesca para carnada, no. H-0302-12-GT), la demandante trató de ampliar sus derechos de explotación pesquera por medio de la sustitución de la embarcación El Caballero por la Princesa Primera, ésta última con una mayor capacidad de operación, así indicado en la nota remitida por la actora el 28 de mayo de 2012 al director de la oficina Regional del Incopesca en Golfito.
Manifestaron los Juzgadores, lo pretendido fue utilizar una licencia de pesca artesanal con una embarcación que no se adecuaba a ese tipo de pesca, sino a una de mayor escala. Quinta, la Junta Directiva del Incopesca adoptó el acuerdo AJDIP/461-2012, con fundamento en el criterio técnico externado por el señor Porras Porras y el cual fue ampliado durante el juicio oral y público, momento en el que el testigo-perito explicó que el rechazo del permiso de sustitución de embarcación obedeció a que se estaba variando el fin de la licencia de pesca otorgada (en pequeña escala), pues al tener mayor capacidad de pesca la embarcación Princesa Primera lo gestionado implicaba, en la práctica, conceder una licencia semiindustrial, lo cual traía aparejado una mayor afectación del recurso sardina (y con ello de toda la cadena alimenticia). Con base en el contenido del acuerdo impugnado y las declaraciones del señor Porras Porras, razonaron los Jueces que no se violentó el principio de intangibilidad de los actos propios, pues el acto solo le denegó a la gestionante la sustitución de embarcación solicitada, manteniendo el derecho a explotar la licencia en los términos originales (para pesca de carnada artesanal).
Agregaron, el referido acuerdo deviene conforme al bloque de legalidad, pues al tenor de los numerales 16 de la LGAP y 103 de la Ley de pesca no solo sería ilegal modificar una licencia de menor escala y artesanal por otra de tipo semiindustrial, sino que ello atentaría contra los recursos pesqueros, dado que un aumento de capacidad de pesca perjudica directamente la sostenibilidad de ese tipo de recursos naturales. Apuntaron, Incopesca se encuentra impedida legalmente para autorizar licencias o permisos que atenten con la disminución o afectación de los recursos pesqueros (numeral 103 de cita). Aunado a lo anterior, examinó el Tribunal que la falta de notificación del acuerdo fue responsabilidad de la propia demandante, quien al presentar la solicitud de permiso de sustitución de embarcación solo aportó un número telefónico, correspondiente a la ubicación del muelle donde señaló que se encontraba la embarcación Princesa Primera, pero no indicó ningún otro número telefónico, fax o medio donde el Incopesca le pudiera notificar lo resuelto respecto a la gestión planteada. Así las cosas, concluyó no existe ningún vicio de nulidad en el acuerdo impugnado.
XIII.Comparte esta Sala lo resuelto en la sentencia recurrida, toda vez que el acuerdo adoptado por la Junta Directiva del Incopesca no. AJDIP/461-2012 se encuentra ajustado a derecho. Contrario a los reclamos de la casacionista, el acto administrativo no resulta incongruente ni violatorio del principio de intangibilidad de los actos propios. La gestión planteada por la sociedad actora consistió en el cambio de embarcación El Caballero por la Princesa Primera, utilizando la licencia otorgada a esa primera embarcación. Solicitud denegada por el Instituto demandado al considerar inviable lo peticionado, toda vez que ello traía aparejado como un pedimento implícito la transformación y reconocimiento a la gestionante de una licencia de pesca de sardina semiindustrial, cuando lo autorizado inicialmente fue una licencia de pesca para carnada de tipo artesanal y de menor escala. Valoró el Incopesca, con fundamento en el criterio técnico del señor Porras Porras.
Director General Técnico de la Institución (testigo-perito en este proceso), que permitir el uso de la licencia concedida a la embarcación El Caballero en la Princesa Primera, siendo que ésta última tiene más capacidad operativa, mayor autonomía (así reconocido por la actora en el documento de sustitución presentado al Instituto) y cuya eslora rebasa la autorizada para el tipo de flota artesanal, no resultaba factible, pues implicaba variar la naturaleza de la licencia concedida o encubrir el reconocimiento de una licencia no otorgada a la demandante. En razón de lo anterior, expresamente acordó la Junta Directiva del Instituto: “POR TANTO: Acuerda: 1- Rechazar la solicitud planteada por el Representante Legal de Sociedad FK FER S.A, propietaria de la embarcación denominada EL CABALLERO, Certificado de Matrícula PG-5085, para el reconocimiento de la licencia de pesca semiindustrial para la captura de sardina (…), razón por la cual deberá mantenerse la licencia de pesca en las condiciones bajo las cuales inicialmente fue otorgada (…)”.
El rechazo dispuesto por el Incopesca y su respectiva justificación, descartan la incongruencia reprochada y el supuesto quebranto del principio de intangibilidad de los actos propios. Téngase claro, si bien mediante acuerdo AJDIP/461-2012 el referido Instituto denegó la autorización gestionada, de modo alguno desconoció, revocó o anuló la licencia de pesca otorgada inicialmente a Manglares del Sur y luego traspasada a la accionante. El acto administrativo trascrito mantuvo el derecho de la actora a explotar la licencia en los términos originales con la embarcación El Caballero y según se detalló en el Considerando IV de esta sentencia, tales condiciones refieren a la pesca de sardina para carnada y de tipo artesanal, más no una de tipo semiindustrial. Así las cosas, el acto cuestionado no suprimió, limitó o denegó derecho subjetivo alguno a la demandante (canon 136 LGAP). En cuanto a la falta de notificación del acuerdo impugnado, consta en autos las constancias de fechas 11 y 13 de diciembre de 2012, emitidas por los señores Guillermo Ramírez Gatjens y Heiner Méndez Barrientos, en su condición de jefes de la Secretaria Técnica y de la Asesoría Legal, ambas del Incopesca, donde se hace constar la imposibilidad de comunicarle a la sociedad actora el acto en cuestión, al no haber señalado lugar para recibir notificaciones y dado que el único número telefónico consignado en la solicitud de sustitución de embarcación no pertenecía a la accionante.
Antes esas circunstancias, resulta evidente, la responsabilidad por la no notificación de ese acto administrativo concreto es atribuible a la gestionante, quien en todo caso se ha manifestado conocedora de lo resuelto en este proceso, por lo que no existe vicio alguno que declarar. Finalmente, en cuando a la nulidad invocada por haber operado el silencio positivo, se rechaza el argumento con base en los motivos expuestos en el Considerando VII de este fallo y al cual se remite para evitar reiteraciones innecesarias. Así las cosas, llevan razón los Jueces de instancia al disponer que el acuerdo impugnado no adolece los vicios de nulidad endilgados, ergo, el reparo esgrimido deberá ser rechazado.
XIV.En mérito de lo expuesto procederá declarar sin lugar el recurso, con sus costas a cargo de la promovente, conforme al precepto 150 inciso 3) del CPCA.
POR TANTO
Se declara sin lugar el recurso, con sus costas a cargo de la parte actora.
