CONSIDERING
I.As may be gathered from the record, on 21 y 22 de noviembre del 2011, Mr. Efraín Artavia Sánchez, together with other residents of Barrio Jesús de Atenas, filed a health complaint (denuncia sanitaria) with SENASA and the Área de Salud de Atenas of the Ministerio de Salud, respectively, against Granja Avícola Lulú for alleged environmental pollution (foul odors, dust, and noise), as well as health problems, respiratory problems, and allergies. Consequently, on 6 de enero del 2012, through official letter no. RCN-ARSAT-AT-IF-009-2012, Lic. Eithel Angulo Angulo of the Área Rectora de Salud de Atenas informed Dr. Marjorie Campos Segura, Director of that department, that he had conducted an inspection at the Farm and had found none of the reported irregularities; he stated that he had directed the complainants to SENASA because it was the agency with jurisdiction over problems caused by animals.
On 3 de febrero de 2015, the plaintiff and other residents of Barrio Jesús de Atenas again filed a complaint, this time with SENASA and the Área Rectora de Salud de Atenas, against Granja Avícola Lulu, asking those two institutions to close the farm and alleging the same facts asserted in the first complaint. They added that it did not comply with the distances prescribed by the Reglamento sobre Granjas Avícolas N°31088-S. In response to that complaint, on 9 de febrero del 2015 SENASA reported that, after conducting the requested inspection, it had found certain instances of noncompliance, which were addressed in a health order (orden sanitaria) and subsequently corrected within the prescribed period. Disagreeing with the administrative decision, the claimant filed the ordinary remedies (recursos ordinarios) of reconsideration (revocatoria) and appeal (apelación), both of which were denied.
On 25 de febrero del 2015, through official letter CN-ARS-AT-IT-096-2015, Lic. Eithel Angulo Angulo informed Dr. Marjorie Campos Segura that on 24 de febrero de ese año he had conducted another inspection at the Farm and that, at the time of the visit, no foul odors, noise, or dust were detected either inside or around the Farm; he again referred the complaint to SENASA. Once again dissatisfied with the prior decision, the plaintiff filed the ordinary remedies of reconsideration and appeal, both of which were denied. On 25 de octubre del 2016, SENASA conducted another inspection visit at Granja Avícola Lulu and reported that no foul odors were perceived during the inspection and that the establishment was generally in good sanitary condition. After the complaints and administrative measures undertaken to secure the closure of Granja Avícola Lulú proved unsuccessful, plaintiff Efraín Artavia Sánchez sued the Estado, SENASA, and Hernán González Rodríguez, owner of Granja Avícola Lulú, seeking the following: “That both the Ministerio de Salud and the Ministerio de Agricultura y Ganadería be ordered to comply with the legal system and to close or relocate Granja Avícola Lulú, owned by Mr.
Hernán González Rodríguez. That Operating Health Permit (Permiso Sanitario de Funcionamiento) ARSAT-0226-2005, unlawfully issued on 24 de junio de 2005 by the Ministerio de Salud, be declared null and void.” Following an order to cure defects (prevención) issued by the Case Management Judge, the relief sought was modified at the preliminary hearing as follows: “a) That both the Ministerio de Salud and the Ministerio de Agricultura y Ganadería be ordered to restore the lawful operation of Granja Avícola Lulú, owned by Hernán González Rodríguez, through the exercise (sic) of their respective administrative powers, because that Farm has never complied with the required distances from adjoining properties or from the EBAIS de Barrio Jesús de Atenas, in violation of the applicable regulations. b) That the unlawfully issued Operating Health Permit ARSAT-0226-2005 be declared null and void, together with its subsequent renewals through Veterinary Operating Certificate (Certificado Veterinario de Operación) DO-DRC0-4118 and the currently valid Veterinary Operating Certificate, the number of which is unknown to us, all pertaining to Granja Avícola Lulú. c) That an award of the costs of this proceeding be entered.” The Estado’s representative opposed the complaint and raised the preliminary defenses (excepciones previas) of failure to join a necessary defendant (falta de integración de la litis consorcio pasivo necesario) and expiration (caducidad), as well as the defense on the merits (excepción de fondo) of failure to state a legal right to relief (falta de derecho).
He also requested payment of both categories of litigation costs. By interlocutory ruling, co-defendant Hernán González Rodríguez was declared in default, and SENASA was joined as a party to the proceedings. Mr. González Rodríguez subsequently filed an untimely answer to the complaint, raising the defenses of statute of limitations (prescripción), lack of standing and capacity to be sued (falta de legitimación activa y pasiva), and existence of a legal right (derecho). Finally, SENASA opposed the action and raised the defenses of lack of a current interest (falta de interés actual) and failure to state a legal right to relief. It also requested an award of both categories of costs in this proceeding. The Tribunal, composed of Judges Otto González Vílchez, Claudia Bolaños Salazar, and Carlos Espinoza Salas, issued judgment no. 86-2017-I at 15 horas del 13 de setiembre de 2017, in which, insofar as relevant, it dismissed the complaint. Dissatisfied, the plaintiff filed an appeal in cassation (recurso de casación), which was admitted by this Chamber. He alleges defects of various kinds, which are summarized in the following section.
II.The plaintiff offers, as “evidence to assist adjudication” (prueba para mejor resolver, PMP), testimony from the following persons, who are residents and witnesses to the foul odors emitted by Granja Avícola: “Ingeniero Topógrafo Gaston Gomez Castillo, carne IT17462, Lucía Rodríguez Quesada, cédula 2- 0439-0153, Kenneth Salazar Serrano, cédula 2-0586-0437, María Isabel Rojas Castro, cédula 2-0347-0924, Valeria Artavia Gonzalez, cédula 2-0675-0621, Katherine Marín Gonzalez, cédula 1-1391-0841, Rocío Rodriguez Quesada, cédula 2-0328-0711, y Ulises Jimenez Alvarado, cédula 2-0417-0330”. To decide the request, it is necessary to clarify the distinction between the evidence contemplated in Article 145 and that established in provision 148, both of the Código Procesal Contencioso Administrativo (CPCA). The former provides that, while the appeal is pending, the parties may submit documentary evidence (prueba documental) concerning facts that are new and subsequent to the challenged judgment and that they swear they did not previously know.
This is an extension of the right to offer evidence as a corollary of the burden of proof borne by the parties, provided that the requirements set forth in the provision under discussion are satisfied. The nature of the document that may be submitted is not restricted, with the clear purpose of allowing the submission of both public and private documents. Evidence to assist adjudication, governed by provision 148 thereof, is for the adjudicator and constitutes a second means by which evidentiary material may be added. It recognizes the authority of the judges hearing the cassation appeal to take evidence on their own initiative at this stage. Another difference lies in the forms of evidence that may be admitted. Whereas all admissible forms of evidence are contemplated as evidence to assist adjudication, evidence offered by a party is limited to documentary evidence, whether public or private, as provided in Article 145, subsection 3), of the CPCA.
In this case, analysis of the request shows that, although the applicant characterizes her offer as evidence to assist adjudication, because she submitted it, it must satisfy the statutory requirements prescribed by the cited provision 145; those requirements have not been met. For this adjudicative body to bring it into the proceedings under Article 148 of the CPCA, the body must determine that it is necessary. Furthermore, the party seeking cassation should note that evidence to assist adjudication is an instrument intended for the adjudicative body, allowing it to clarify disputed facts when it considers the evidence offered and taken to be insufficient. It presupposes that the parties have already performed the evidentiary work incumbent upon them at the appropriate procedural stages, in accordance with the burden of proof imposed on them by law (provision 317 of the Código Procesal Civil, applied supplementally by express reference in Article 220 of the CPCA).
Accordingly, this procedural mechanism may not be used to correct omissions, negligence, or oversights by the parties with respect to that burden of proof, or to remedy technical deficiencies in their defense. This must be weighed by adjudicators, both at trial and at this cassation stage, in order to uphold their duty of impartiality and maintain the balance between the parties. It bears repeating that this is a discretionary power of the adjudicative body, which, for the reasons stated, may reject a party’s submission offered in that capacity even though it is not an instrument available to the party, because the party must use the mechanism made legally available to it under the conditions already stated. In this regard, reference may be made to decisions 600-F-SI-2017, 409-F-SI-2019, and 1899-F-S1-2020 of this Chamber. Accordingly, because the evidentiary submission entered in this matter and identified as evidence to assist adjudication is an instrument of this cassation body, its admission is deemed unnecessary.
The plaintiff had the opportunity to present those witnesses at the corresponding stage, which is now procedurally foreclosed (precluida). Moreover, in this Chamber’s view, the evidence in the record is sufficient to reach a legally sound conclusion. Therefore, this Chamber finds no need to order and receive the specified testimony as evidence to assist adjudication, and the request is denied.
III.First. He alleges denial of the right to a defense (indefensión) and violation of due process (debido proceso), insofar as the Court failed to assess important evidence. a) In this regard, he states that documents appearing at folio 4 of the judicial record (expediente judicial) and folios 01, 03, 04, 05 and 06 of the administrative record (expediente administrativo) establish that the operations of Granja Avícola Lulú, owned by Mr. Hernán González Rodríguez, began for the first time in the year 2005. He explains that folio 4 of the judicial record contains official letter CN-ARS-AT-069-2015 dated 13 de febrero de 2015, from which it follows that it was not until 08 de noviembre de 2004 that Mr. González Rodríguez first applied to the Ministerio de Salud for an operating health permit (permiso sanitario de funcionamiento; hereinafter, permit or PSF), which is consistent with folio 01 of the administrative record, where the PSF application form appears.
Likewise, he notes that folios 04 and 05 of the administrative record show that Mr. González Rodríguez was authorized to operate a Type C poultry farm until 21 de junio de 2005 through official letter 462-05, a technical report issued by Área Rectora de Atenas del Ministerio de Salud. In addition, he states that folio 06 of the administrative record establishes that, as of 02 de marzo de 2010, Mr. Hernán González Rodríguez still lacked a land-use permit (permiso de uso de suelos) to conduct the commercial activity of operating a Type C poultry farm, an indispensable requirement for carrying out that activity. Accordingly, he argues that he was denied the right to a defense because the evidence was not assessed as a whole, since the Court held that the provisions of Article 9 of Decreto 31088-S applied only to new farms. For that reason, he asserts that he does not understand how, when the evidence shows that the permit was first requested in the year 2004 and granted beginning in febrero de 2005, when the Reglamento sobre Granjas Avícolas was already in force (since the year 2003), the farm was deemed not to be new.
Hence the erroneous interpretation of the provision, because, in his view, businesses must be considered to have commenced operations when they have the legal authorization allowing them to operate within the applicable regulatory framework. He acknowledges that he stated in the complaint that the farm had been operating for more than 30 years; however, he clarifies that this does not mean that it was operating as a Type C poultry farm within the legal framework. He notes that it was previously a smaller-scale domestic, rather than commercial, operation. He asserts that, as established at folio 04 of the administrative record, Granja Lulú was already producing 350 cartons of eggs per day, a circumstance that the Court also failed to analyze when rendering its decision, because producing that number of cartons of eggs requires at least 8400 birds, a total number of hens exceeding the authorization granted for a Type C poultry farm.
He demands the proper application of the existing regulations, because he considers that the Ministerio de Salud granted a PSF even though Mr. Hernán González did not meet the statutory requirements, specifically those concerning the distances from adjoining properties (colindancias) and healthcare facilities. Although this argument was analyzed, he says, the analysis departs from reality because the Court assumed that the farm was not new, but failed to consider that the initial issuance of permit ARSAT-0226-2005 was what enabled Mr. González, in the year 2010, to obtain SENASA’s authorization of CVO-086866-01 pursuant to the Transitional Provision (Transitorio) of Decree number 34859-MAG. Nevertheless, he explains, the Court failed to analyze that the same Transitional Provision directs that the operating health permits granted by that ministry shall remain in force provided that the applicable regulations are complied with, and that, following expiration of the permit, a CVO must be requested from SENASA in compliance with the law, which, in his view, leads back to Decreto 31088-S.
Finally, the appellant challenges the argument that Executive Decree 31088-S was impliedly repealed (derogación tácita) upon the entry into force of Executive Decree 34859-MAG, Reglamento General para el Otorgamiento del Certificado Veterinario de Operación, dated 20 de octubre de 2008. He considers the Court’s reasoning incorrect because, first, the Constitución Política assigns the Asamblea Legislativa exclusive authority to repeal statutes, among other powers. Moreover, he states that those decrees do not conflict in substance; the logical principle of noncontradiction remains intact, since Decree 31088-S establishes minimum distances, whereas Decree 34859-MAG indicates that responsibility must be exercised over the location of farms, which, by interpretation, would mean 100 meters from healthcare facilities and 15 meters from adjoining properties. Second: He alleges improper assessment of evidence (indebida valoración probatoria) and the failure to consider evidence (preterición de prueba).
Regarding the first ground, he reiterates the point made in the first objection concerning the improper assessment of official letter ARSAT-0226-2005, which demonstrates that this is indeed a new farm because its PSF was issued in the year 2005. He then explains that the expert report (peritaje) appearing at folios 275 through 297 was disregarded; in that report, Surveying Engineer Gastón Gómez Castillo, professional license IT17462, demonstrated that the distances between Granja Avícola Lulú and the adjoining properties, as well as the EBAIS de Atenas healthcare facility, were shorter than those established by law. He adds that this is a scientific document containing the technical specifications of the equipment used, the prescribed methodology, and a description of both the fieldwork and office work. Likewise, folio 296 sets forth the distances on the plan designated modelo 3, which show that the distances among the adjoining properties, the EBAIS, and the farm do not conform to the measurements established by law.
He explains that, as shown in that expert report, the property being analyzed is 2-20937-000, where the poultry farm is located. He alleges that this evidence was admitted by the case-management judge (juez tramitador) during the preliminary hearing and appears in the judicial record, which is why the trial court was required to analyze it when rendering its decision. Third: He alleges a direct violation of law (violación directa de Ley). He reiterates the alleged violation of Article 9 of Decree no. 31088-S regarding distances. Finally, he alleges violation of the constitutional principles of reasonableness, proportionality, legal certainty, and equality, insofar as greater weight was given to a private interest—the farm’s economic activity—than to the rights of the residents of Barrio Jesús de Atenas. The record contains a complaint from the adjoining property owners (see folios 189 through 195 of the judicial record), in which they describe health problems and further state that the residences existed before the farm was issued its CVO.
More than thirty people signed those complaints, reporting foul odors, pollution, noise, dust, and flies; therefore, it cannot be possible to consider only the testimony of Ms. Mayela González, the defendant’s sister, who occasionally works at the farm. According to her testimony, she smells nothing, and no one is ill or dissatisfied with the situation; she further stated that she lives more than 100 meters from the farm. He explains that giving credibility to that testimony would discredit the testimony of 30 people who appeared before the administrative authorities to express their dissatisfaction. Furthermore, the record contains a notarized instrument (acta notarial) issued by Licenciado Esteban Esquivel Zúñiga, stating that he conducted an inspection and detected strong manure odors, as well as noise from the hens (folio 300). He adds that report SENASA-RCOC-071-2015 dated 27 de marzo de 2015 (folio 206) states that the farm owner was required to install devices preventing feathers and dust from escaping and to repair damaged mesh; indeed, it should be noted that a health order (orden sanitaria) was issued, one poultry shed was closed for failing to comply with the required distances from adjoining properties, and the depopulation of another was ordered.
In sum, he alleges infringement of Articles 34, 39 and 74 of the Constitución Política because the Court omitted any analysis of the arguments concerning the nonapplication of Executive Decree 31088-S and failed to analyze the evidence as a whole, all of which, he says, denied him the right to a defense and therefore violated the constitutional principle of due process. He concludes that the stated omission constitutes a denial of justice (denegación de justicia).
IV.Before ruling on the claims raised, it is appropriate to ascertain the Tribunal’s position on the matter. First, it must be noted that the judgment declares the action to challenge permit ARSAT-0226-2005 on grounds of nullity to be time-barred (caducidad de la acción), and rejects that defense with respect to veterinary operating certificate (certificado veterinario de operación, hereinafter the certificate or CVO) DO-DRCO-0418). In recital (considerando) IX, entitled “Absence of Grounds for Nullity of Veterinary Operating Certificate (CVO) No. DO-DRCO-4118. Lawfulness of the Operation of Granja Avícola Lulú,” the judges explain that the minimum distances required under the Reglamento sobre Granjas Avícolas do not apply to the CVO. They analyze the Reglamento sobre Granjas Avícolas (Decreto Ejecutivo N° 31088-S), stating that this regulatory provision entered into force on 7 de mayo del 2003 and was intended to regulate poultry-farming activities for the purpose of obtaining the sanitary operating permit (permiso sanitario de funcionamiento, PSF) issued by the Ministerio de Salud.
The Chamber further stated that section 9 of the aforementioned regulation governed the minimum distances with which new poultry farms were required to comply—that is, farms established after that regulation entered into force, on 7 de mayo del 2003. They stated that, in order to obtain approval, such farms were required to have “Location Approval” (“Visto Bueno de Ubicación”) from the Área Rectora del Ministerio de Salud for their respective region. The judges further noted that Article 9 must be read in conjunction with Article 13 of the same regulation, which set forth the procedure for obtaining a PSF. The judges concluded that this provision established three situations: “1- Poultry farms established before the publication of the Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, which at some point held a sanitary operating permit; 2- Poultry farms established before the publication of the Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, which never held a sanitary operating permit; 3- Poultry farms established after the publication of the Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, that is, new farms…” The judges stated that the applicable requirements differed.
They explained that poultry farms established before the publication of the aforementioned regulation that had never held a sanitary operating permit were subject to very general requirements, such as a detailed sketch of the facilities, a cadastral survey plan (plano catastrado) showing the location of the poultry sheds, a waste-management plan, and sanitary oversight by the Ministerio de Salud during the production cycle, as well as the absence of any unresolved complaints against them or unfulfilled sanitary orders. In the case of poultry farms established after the publication of Decreto EjecutivoN°31088-S—that is, new farms—they indicated that a series of requirements applied, one of which was to “Have Location Approval.” All the foregoing led them to conclude that the minimum distances required by Article 9 of the Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, applied to new poultry farms, meaning those established after the publication of that regulation, because poultry farms established before the publication of that Decreto Ejecutivo that did not hold a PSF were not subject to the requirement under section 9.
The judges then reasoned that, considering that Granja Avícola Lulú had operated for more than 20 years, as shown by the plaintiff’s own statements in its complaint, other submissions made by it during the proceedings, and witness testimony at the oral and public trial, it had clearly been established before the publication of the regulation in question. The judges likewise inferred that, as of 7 de mayo del 2003, that poultry farm did not hold a PSF, as demonstrated by the fact that codefendant Hernán González Rodríguez applied for one for the first time on 8 de noviembre del 2004 before the Área Rectora de Salud de Atenas del Ministerio de Salud, located in Barrio Jesús de Atenas. Accordingly, Granja Avícola Lulú was not required at that time to satisfy the “Location Approval” requirement. They therefore concluded that, although the action concerning sanitary operating permit N°ARSAT-0226-2005 issued by the Ministerio de Salud was declared time-barred, the permit was not unlawfully issued by the Administration because the specified requirement was not required at that time under Decreto Ejecutivo N°31088-S.
V.This Chamber observes that the appellant bases its disagreement with the judgment on the contention that sufficient evidence establishes that Granja Avícola Lulú was new when Decreto Ejecutivo no. 31088-S entered into force and that, consequently, Article 9 of that body of law applied to it, including the distances established therein from neighboring properties and the EBAIS. As evidence, it cites documents establishing that the farm’s operating permit was first applied for in 2004 and obtained in 2005. As a corollary, it alleges a failure to apply section 9 of the regulation in question, as well as a violation of the constitutional principles of reasonableness, proportionality, legal certainty, and equality. It is first necessary to clarify that the grounds stated in the appeal seek to lead this Chamber to conclude that sanitary operating permit ARSAT-0226-2005 is null because, as a new farm—according to the appellant—that began operating after the Reglamento sobre Granjas Avícolas entered into force, it was subject to the distances specified in section 9 of that body of law and therefore operates unlawfully.
In this regard, the appellant in cassation (casacionista) must recall that the Tribunal declared the action challenging that act time-barred, and that ruling was not contested and therefore became final. Consequently, the arguments presented on the issue are unavailing because they do not challenge the principal ground—namely, that the action concerning the operating permit was time-barred—but instead indirectly challenge the additional reasoning offered by the Tribunal. In sum, this cassation court finds that all arguments seeking to challenge permit ARSAT-0226-2005 are unavailing because they cannot overturn the judgment in view of the declaration that the action was time-barred. Moreover, the appellant in cassation likewise does not challenge the judges’ arguments concerning the lawfulness of certificate n°DO-DRCO-4118, insofar as they found that the minimum distances governed by the aforementioned section 9 of Decreto Ejecutivo N°31088-S did not apply to it.
The judges found that all matters concerning poultry farms came under the oversight of SENASA rather than the Ministerio de Salud; consequently, authorization to conduct poultry-farming activities would be granted through CVOs rather than through the operating permit issued by the Ministerio de Salud. That panel of judges found that the Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, had been implicitly repealed (derogado tácitamente) by the Ley General del Servicio Nacional de Salud Animal, N°8495, and the Reglamento General para el Otorgamiento del Certificado Veterinario de Operación, Decreto Ejecutivo N°34859-MAG, because Decreto Ejecutivo N°31088-S had been designed to regulate poultry farms and the method of obtaining the corresponding sanitary operating permit. However, those authorizations ceased with the entry into force of the aforementioned SENASA regulations, since the Ministerio de Salud was no longer the competent authority to issue sanitary operating permits for poultry farms; consequently, the minimum distances governed by the aforementioned section 9 of Decreto Ejecutivo N°31088-S are not a requirement applicable to the issuance of a CVO.
The appellant’s sole argument concerning the foregoing reasoning is that Decretos Ejecutivos 31088-S and 34859-MAG can coexist because they do not conflict in substance, a conclusion with which this Chamber disagrees. Decreto 31088-S cannot coexist with the latter regulation, because it was issued by the Ministerio de Salud to regulate and oversee all matters relating to the operation of poultry establishments. That ministry is no longer competent to oversee that subject matter following the creation of Senasa, the body now responsible for regulating it through veterinary operating certificates; in other words, the two sets of regulations directly conflict. In sum, this Chamber agrees with the Tribunal that the Reglamento sobre Granjas Avícolas, Decreto EjecutivoN°31088-S, was implicitly repealed by the Ley General del Servicio Nacional de Salud Animal, N°8495, and the Reglamento General para el Otorgamiento del Certificado Veterinario de Operación, Decreto Ejecutivo N°34859-MAG.
VI.Regarding the alleged environmental pollution (contaminación ambiental) (foul odors, dust, and noise), as well as the health problems, respiratory conditions, and allergies caused by Granja Avícola Lulú, the Court found that none of those allegations had been proven and that the Farm therefore operates lawfully. The appellant alleges that the case file contains complaints from neighboring property owners describing health problems, as well as the notarial record issued by Licenciado Esteban Esquivel Zúñiga, stating that he had conducted an inspection and that strong manure odors were indeed being emitted; he also recorded the existence of noise from the chickens. Although the established facts show that multiple complaints were filed by the plaintiff and other neighbors with both the Ministerio de Salud and SENASA, it is also true—and was not refuted by the appellant—that, as a result of those complaints, both administrative bodies inspected the Farm and found no evidence supporting the allegations.
This is documented in the following official communications: a) RCN-ARSAT-AT-IF-009-2012 dated 6 de enero del 2012, b) the official communication dated 9 de febrero del 2015 from Dr. Martín García Umaña of the Dirección Regional Central Occidental, oficina cantonal de Atenas, SENASA, c) CN-ARS-AT-IT-096-2015 from the Ministerio de Salud, and d) the inspection report, health order 040632 dated 25 de octubre del 2016, from SENASA. The plaintiff even filed motions for reconsideration with subsidiary appeals (recursos de revocatoria con apelación en subsidio) against the negative inspection findings issued by the Ministerio de Salud and Senasa; those motions were denied because both institutions agreed that neither foul odors nor dust had been detected in the vicinity of the Farm. In addition, the record contains testimony from Mayela González Rodríguez and Rodolfo González González, who stated during the public oral trial that they were residents of Barrio Jesús de Atenas, that they knew the co-defendant González Rodríguez’s Granja Avícola Lulu, and that they had lived near the site for many years without perceiving foul odors, noise, or dust originating from that poultry farm.
The foregoing demonstrates that there were no pollution problems, a fact established by much more than Mayela González Rodríguez’s testimony alone (as the appellant claims). Her testimony could not be discredited merely because she is the sister of both co-defendant González Rodríguez and the plaintiff’s wife, since her account is consistent with the other testimony received. This Chamber notes that complaints were repeatedly filed with the Ministerio de Salud and Senasa, but the inspections conducted always produced the same favorable result for co-defendant González Rodríguez. In duly processing the second complaint, Senasa explained the reasons why the Veterinary Operating Certificate (Certificado Veterinario de Operación, CVO) had been granted to Granja Avícola Lulú. In short, this Chamber finds that the allegedly overlooked evidence (prueba preterida) is insufficient to refute the extensive evidence submitted by the co-defendants, which establishes that the pertinent studies were conducted and that the alleged pollution could not be detected. Consequently, it likewise cannot be concluded that the constitutional principles of reasonableness, proportionality, legal certainty, and equality were violated.
VII.Based on the foregoing, the appeal filed by the plaintiff shall be denied, and the plaintiff shall bear the costs of the appeal (canon 150 subsection 3 of CPCA).
POR TANTO
The request to admit evidence to aid adjudication (prueba para mejor resolver) is denied. The appeal is denied, with costs to be borne by the appellant.

CONSIDERANDO
I.Tal y como se extrae de los autos, el señor Efraín Artavia Sánchez en conjunto con otros vecinos del Barrio Jesús de Atenas, interpusieron el 21 y 22 de noviembre del 2011 denuncia sanitaria ante SENASA y el Área de Salud de Atenas del Ministerio de Salud respectivamente, contra la Granja Avícola Lulú, por supuesta contaminación ambiental (malos olores, polvo y ruido), así como problemas de salud, respiratorios y alergias. En razón de lo anterior, el 6 de enero del 2012, por oficio no. RCN-ARSAT-AT-IF-009-2012, el Lic. Eithel Angulo Angulo, del Área Rectora de Salud de Atenas informó a la Dra. Marjorie Campos Segura, Directora de dicho departamento, que realizó una inspección en la Granja, y que no encontró ninguna de las anomalías denunciadas y dice, remitió a los denunciantes a acudir a SENASA por ser la competente para conocer los problemas ocasionados por animales. El 3 de febrero de 2015, el actor y otros vecinos del Barrio Jesús de Atenas, presentaron nuevamente denuncia esta vez ante el SENASA y ante el Área Rectora de Salud de Atenas, contra la Granja Avícola Lulu solicitando a éstas dos instituciones el cierre de esa granja, argumentando los mismos hechos acusados en la primera queja.
Agregaron, que no cumple con las distancias reguladas en el Reglamento sobre Granjas Avícolas N°31088-S. En razón a esa denuncia, SENASA el 9 de febrero del 2015 informó que luego de hacer la inspección solicitada encontraron algunas inconformidades que fueron prevenidas en la orden sanitaria y posteriormente cumplidas en el plazo establecido. En desacuerdo con lo resuelto administrativamente, el accionante presentó recursos ordinarios de revocatoria y apelación, los cuales fueron rechazados. El 25 de febrero del 2015, por oficio CN-ARS-AT-IT-096-2015, el Lic. Eithel Angulo Angulo se dirigió a la Dra. Marjorie Campos Segura, indicándole que el 24 de febrero de ese año realizó nueva inspección en la Granja y que en el momento de la visita no se detectaron malos olores, ruido, o polvo, dentro ni en los alrededores de la Granja, remitiendo nuevamente la denuncia a SENASA. Nuevamente inconformes con lo resuelto anteriormente, el actor presentó recursos ordinarios de revocatoria y apelación, los cuales fueron rechazados.
El 25 de octubre del 2016, SENASA realizó a la Granja Avícola Lulu, otra visita de inspección donde informa, no se perciben malos olores durante el recorrido y que, en general, el establecimiento se encuentra en buenas condiciones sanitarias. Al resultar infructuosas las denuncias y gestiones administrativas realizadas para que se ordene el cierre de la Granja Avícola Lulú, el actor Efraín Artavia Sánchez demandó al Estado, a SENASA y a Hernán González Rodríguez propietario de la Granja Avícola Lulú pidiendo lo siguiente: “Se ordene tanto al Ministerio de Salud como al Ministerio de Agricultura y Ganadería proceder cumplir con el ordenamiento jurídico y proceder con el cierre o el traslado de la Granja Avícola Lulú propiedad del señor Hernán González Rodríguez. Se declare la nulidad del Permiso Sanitario de Funcionamiento ARSAT-0226-2005 emitido, ilegalmente, el 24 de junio de 2005 por el Ministerio de Salud.".
Por prevención realizada por el Juez Tramitador la pretensión se ajustó en la audiencia preliminar de la siguiente manera: “a) Se ordene tanto al Ministerio de Salud como al Ministerio de Agricultura y Ganadería restablecer la legalidad del funcionamiento de la Granja Avícola Lulú propiedad de Hernán González Rodríguez, en virtud del ejercicio (sic) sus respectivas potestades Administrativas, debido a que dicha Granja nunca ha cumplido con las distancias respecto de las colindancias y respecto al EBAIS de Barrio Jesús de Atenas, irrespetando la normativa al respecto. b) Se declare la nulidad del Permiso Sanitario de Funcionamiento ARSAT-0226-2005 emitido ilegalmente, así como la nulidad de sus posteriores renovaciones mediante el Certificado Veterinario de Operación DO-DRC0-4118 y el Certificado Veterinario de Operación vigente del cual desconocemos la numeración, todos de la Granja Avícola Lulú. c) Se condene al pago de las costas este proceso.".
La representación del Estado, contestó de manera negativa la demanda, presentó las excepciones previas de falta de integración de la litis consorcio pasivo necesario y caducidad, así como la excepción de fondo de falta de derecho. Además, requirió el pago de ambas costas del proceso. Interlocutoriamente se declaró rebelde al codemandado Hernán González Rodríguez y fue integrada a la litis a SENASA. Luego en forma extemporánea el señor González Rodríguez contestó la demanda, interpuso las excepciones de prescripción, falta de legitimación activa y pasiva, y derecho. Finalmente, SENASA, contestó de manera negativa la acción e interpuso las excepciones de falta de interés actual y falta de derecho. Además, solicitó la condena al pago de ambas costas de este proceso. El Tribunal integrado por los jueces Otto González Vílchez, Claudia Bolaños Salazar y Carlos Espinoza Salas emitió el fallo no. 86-2017-I de las 15 horas del 13 de setiembre de 2017, donde, en lo de interés, declaró sin lugar la demanda. Inconforme la parte actora presenta recurso de casación el cual es admitido por esta Sala. Acusa vicios de distinta índole los cuales se resumen en el siguiente apartado.
II.La parte actora ofrece como prueba “para mejor resolver” (PMP) las declaraciones de las siguientes personas, los cuales son vecinos y testigos de los malos olores expedidos por la Granja Avícola: “Ingeniero Topógrafo Gaston Gomez Castillo, carne IT17462, Lucía Rodríguez Quesada, cédula 2- 0439-0153, Kenneth Salazar Serrano, cédula 2-0586-0437, María Isabel Rojas Castro, cédula 2-0347-0924, Valeria Artavia Gonzalez, cédula 2-0675-0621, Katherine Marín Gonzalez, cédula 1-1391-0841, Rocío Rodriguez Quesada, cédula 2-0328-0711, y Ulises Jimenez Alvarado, cédula 2-0417-0330”. A efectos de resolver la solicitud planteada, se estima necesario aclarar la distinción entre la probanza contenida en el artículo 145 y la establecida en el canon 148 ambos del Código Procesal Contencioso Administrativo (CPCA). El primero, prevé la posibilidad para las partes, durante el trámite del recurso, de aportar prueba documental sobre hechos nuevos y posteriores al fallo recurrido, que juren no haber conocido con anterioridad.
Se trata de una extensión del derecho de ofrecer prueba como correlato de la carga demostrativa que pesa sobre las partes, siempre y cuando se cumplan con los requisitos previstos en la disposición en comentario. No se califica la naturaleza del documento que se puede aportar, con la clara finalidad de que se presenten tanto los públicos como los privados. Aquella para mejor proveer, regulada en el mandato 148 ibídem, es del juzgador, y corresponde a un segundo escenario mediante el cual se pueden incorporar elementos de convicción. Se trata del reconocimiento de la iniciativa probatoria oficiosa a cargo, en esta etapa, de los jueces casacionales. Otra diferencia radica en los medios probatorios que pueden ser incorporados. Mientras que mediante la prueba para mejor resolver, se contemplan todos aquellos medios que resulten admisibles, en el caso de la ofrecida por la parte, se limita a la documental (pública o privada, conforme lo prevé el numeral 145 inciso 3) del CPCA).
En la especie, del análisis de la solicitud presentada, se colige, pese a que la solicitante califica su ofrecimiento como prueba para mejor resolver, al ser por ella aportada debe cumplir con los presupuestos normativos exigidos en el precepto 145 de cita, los cuales se observa no se cumplen. Para hacerla traer a la litis acudiendo al ordinal 148 del CPCA, debe este órgano jurisdiccional observar su necesidad. Por otra parte, note la parte casacionista que la prueba para mejor resolver es un instrumento concebido para el órgano juzgador, a fin de que obtenga claridad sobre los hechos controvertidos cuando estime que los medios de prueba ofrecidos y practicados resultan insuficientes. Presupone que las partes hayan desplegado ya la labor demostrativa que les corresponde en los momentos procesales oportunos, de conformidad con la carga probatoria que les impone el ordenamiento jurídico (canon 317 del Código Procesal Civil, aplicado supletoriamente por remisión expresa del ordinal 220 de CPCA).
De ahí que el instituto no puede utilizarse para corregir omisiones, negligencias o descuidos de las partes respecto de esa carga probatoria, ni para subsanar deficiencias técnicas de su defensa. Esto ha de ser ponderado por los juzgadores, tanto los de instancia como los de esta fase de casación, en aras de mantener el respeto a su deber de imparcialidad y el equilibrio entre las partes. Se insiste, consiste en una facultad del órgano juzgador quien, por lo dicho, ante un ofrecimiento de una parte en esa calidad, a pesar de que no es un instrumento a su disposición, puede desecharlo, pues la parte debe hacer uso de la herramienta que le fue habilitada legalmente y en las condiciones ya señaladas. En ese sentido pueden consultarse las resoluciones de esta Cámara, 600-F-SI-2017, 409-F-SI-2019 y 1899-F-S1-2020. Así las cosas, en cuanto la proposición probatoria incorporada en este asunto identificada como prueba para mejor resolver, al ser un instrumento de este órgano de casación, se estima innecesaria su admisión.
La actora, tuvo la oportunidad de presentar dichos testigos en la etapa correspondiente, precluida para este momento. Amén de que, en criterio de esta Cámara la probanza constante en autos es suficiente para llegar a una conclusión ajustada a derecho. Ergo, no observa esta Sala, la necesidad de ordenar y recibir los testimonios indicados como prueba para mejor resolver por lo que se rechaza.
III.Primero. Acusa, indefensión y violación del debido proceso en el tanto el Tribunal dejó de valorar prueba importante. a) En ese sentido, indica, consta en los folios 4 del expediente judicial y 01, 03, 04, 05 y 06 del expediente administrativo documentos que acreditan que la actividad de la Granja Avícola Lulú propiedad del señor Hernán González Rodríguez dio inicio por primera vez en el año 2005. Explica, a folio 4 del expediente judicial figura el oficio CN-ARS-AT-069-2015 del 13 de febrero de 2015, de donde se extrae que fue hasta el 08 de noviembre de 2004 que el señor González Rodríguez solicitó por primera vez ante el Ministerio de Salud el permiso sanitario de funcionamiento (en adelante permiso o PSF), lo cual es acorde con el folio 01 del expediente administrativo donde se visualiza el formulario de solicitud de PSF. De igual manera, señala, de folios 04 y 05 del expediente administrativo, se desprende que se le autorizó al señor González Rodríguez la actividad de granja avícola tipo C hasta el 21 de junio de 2005 mediante oficio 462-05, informe técnico emitido por Área Rectora de Atenas del Ministerio de Salud.
Aunado a lo anterior, expresa, en folio 06 del expediente administrativo consta que el señor Hernán González Rodríguez para el 02 de marzo de 2010 aun no contaba con permiso de uso de suelos para explotar la actividad comercial de granja avícola tipo C, requisito indispensable para desarrollar esa actividad. Así las cosas, reclama, se le causa indefensión en virtud de que no se analizó la prueba de forma integral, ya que el Tribunal afirmó que lo dispuesto en el artículo 9 del Decreto 31088-S, era de aplicación solamente para granjas nuevas. En razón de lo anterior, alega, no entiende como si de la prueba se extrae que el permiso se solicitó por primera vez en el año 2004, otorgado a partir de febrero de 2005, cuando ya era vigente el Reglamento sobre Granjas Avícolas (desde el año 2003), se consideró que no es una granja nueva. De ahí la mala interpretación que se hace de la norma, pues estima, los negocios deben considerarse iniciados, cuando cuenten con el aval legal que les permita funcionar dentro del marco normativo aplicable.
Reconoce que en la demanda indicó que la granja tenía más de 30 años de operar, sin embargo, acota, eso no significa que estuviera funcionando como tipo de granja avícola C dentro del marco de la ley. Apunta, antes era una actividad menor de explotación doméstica y no comercial. Asevera, tal y como consta en el folio 04 del expediente administrativo, la Granja Lulú ya estaba produciendo 350 cartones de huevos por día, situación que también quedó fuera de análisis por parte del Tribunal al momento de resolver, ya que para la producción de esa cantidad de cartones de huevos se requiere como mínimo 8400 picos, cuyo total de gallinas es superior al permiso otorgado para una granja avícola tipo c). Exige la aplicación correcta de la normativa existente, pues considera se otorgó un PSF por parte del Ministerio de Salud sin contar el señor Hernán González con los requisitos exigidos por la Ley, específicamente a lo referente a las distancias entre colindancias: centros de salud.
Este alegato, dice, a pesar de ser analizado, se aleja de la realidad al asumir el Tribunal que la granja no es nueva, pero no analiza que el otorgamiento por primera vez del permiso ARSAT-0226-2005, es lo que le permitió al señor González para el año 2010, que SENASA autorizara con ocasión del Transitorio del decreto número 34859-MAG, el CVO-086866-01. Sin embargo, expone, no se analizó que el mismo transitorio instruye que se mantendrán vigentes los permisos sanitarios de funcionamientos otorgados por esa cartera ministerial siempre y cuando cumpla con la normativa vigente y que luego del vencimiento del permiso, se deberá solicitar el CVO ante SENASA cumpliendo con la Ley, lo que, en su criterio lleva, nuevamente al Decreto 31088-S. Para finalizar, combate el recurrente el argumento de la derogación tácita del decreto ejecutivo 31088-S con la entrada en vigencia del decreto ejecutivo 34859-MAG Reglamento General para el Otorgamiento del Certificado Veterinario de Operación del 20 de octubre de 2008.
Considera, no lleva el Tribunal la razón, pues en primer término la Constitución Política establece como atribución exclusiva de la Asamblea Legislativa, entre otras, la derogación de leyes. Por otro lado, expresa, dichos decretos no se contradicen en su esencia, es claro que se mantiene el principio lógico de no contradicción, pues en el decreto 31088-S se establecen distancias mínimas mientras que en el decreto 34859-MAG se indica que le corresponde velar por la ubicación de las granjas, que por interpretación se estaría hablando de 100 metros respecto a centros de salud y de 15 metros respecto a colindancias. Segundo: Acusa se da una indebida valoración probatoria y también preterición de prueba. En relación a la primera causal, reitera lo indicado en el primer reparo, sobre la indebida valoración del oficio ARSAT-0226-2005 con lo que demuestra que sí es una granja nueva, pues su PSF fue expedido en el año 2005.
Luego, expone, se pretirió el peritaje visible a folios 275 al 297, donde el Ingeniero Topógrafo Gastón Gómez Castillo, carnet IT17462 demostró que las distancias existentes entre la Granja Avícola Lulú y sus colindantes, así como con el centro de Salud de atención médica EBAIS de Atenas eran inferiores a las establecidas por la Ley. Nótese, agrega, que se está en presencia de un documento científico, que incluye especificaciones técnicas del equipo empleado, la metodología definida y descripción del trabajo, tanto de campo como de escritorio. De igual manera a folio 296 se establecen las distancias en el plano denominado modelo 3, que denotan que las distancias entre colindancias, Ebais y la granja no se ajustan a las medidas establecidas por Ley. Véase, expone, en dicho peritaje, la finca que se analiza es la 2-20937-000 donde se encuentra la granja avícola. Alega, esta prueba fue aceptada por el juez tramitador durante la audiencia preliminar y consta en el expediente judicial, razón por la cual debía ser analizada por el tribunal de juicio al momento de resolver.
Tercero: Imputa, violación directa de Ley. Reitera la acusada trasgresión del artículo 9 del Decreto no. 31088-S, respecto a las distancias. Finalmente, acusa violación de principios constitucionales, de razonabilidad, proporcionalidad, seguridad jurídica e igualdad, en el tanto se le da mayor valor a un interés particular -actividad económica de la granja- con respecto a los derechos de los vecinos de Barrio Jesús de Atenas. Consta en el expediente queja de los colindantes, (ver folio 189 al 195 del expediente judicial), en la que expresan los problemas de salud, y además que las casas de habitación estuvieron antes de que se le otorgara el CVO a la Granja. En dichos reclamos existen más de treinta personas firmando, quejándose de los malos olores, contaminación, ruido, polvo y moscas, por lo que no puede ser posible que solamente se considere el testimonio de la señora Mayela González, hermana del demandado, quien trabaja en la granja ocasionalmente.
Según su dicho, no huele nada y no hay gente enferma ni inconforme con la situación, esto aunado a que indicó vivir a más de 100 metros de la granja. De darle credibilidad a dicho testimonio, expone, se estaría desvirtuando entonces el de 30 personas, que se han presentado ante las autoridades administrativas a demostrar su inconformidad. Aunado a que en el expediente existe acta notarial emitida por el Licenciado Esteban Esquivel Zúñiga, donde indica haber realizado una inspección y encontrar fuertes olores a estiércol; además de la existencia del ruido de las gallinas, (folio 300). Agrega, en el informe SENASA-RCOC-071-2015 del 27 de marzo de 2015 (folio 206), se indica que se le requirió al dueño de la granja colocar dispositivos que eviten la salida de plumas y polvo además de reparar mayas en mal estado, incluso nótese donde se le giro orden sanitaria, se cerró un galerón por no cumplir con lo dispuesto en distancias con sus colindantes y se le ordenó despoblar otro.
En suma, acusa infracción a los artículos 34, 39 y 74 de la Constitución Política, al omitir todo análisis sobre los alegatos respecto a la no aplicación del Decreto Ejecutivo 31088-S, al no analizar la prueba de manera integral, todo lo cual, dice, le causa indefensión y por ende violación al principio constitucional del debido proceso. Concluye, la omisión indicada constituye una denegación justicia.
IV.Conviene previo a resolver los reclamos planteados, conocer la posición del Tribunal al respecto. En primer lugar, es menester indicar, que el fallo, declara la caducidad de la acción para conocer los alegatos de nulidad planteados contra el permiso ARSAT-0226-2005, y rechaza dicha excepción contra el certificado veterinario de operación (en lo sucesivo certificado o CVO) DO-DRCO-0418). En el considerando IX titulado “Inexistencia de vicios de nulidad del certificado veterinario de operación (CVO) n°DO-DRCO-4118. Legalidad en el funcionamiento de la Granja Avícola Lulú”, los jueces, explican que al CVO, no le son aplicables las distancias mínimas exigidas en el Reglamento sobre Granjas Avícolas. Hacen un análisis del Reglamento sobre Granjas Avícolas (Decreto Ejecutivo N° 31088-S), expresando que dicha disposición reglamentaria entró en vigencia a partir del 7 de mayo del 2003 y tuvo la finalidad de regular la actividad avícola, para la obtención del PSF, que otorgaba el Ministerio de Salud.
Más adelante, manifestó aquella Cámara, el canon 9 del citado reglamento regulaba las distancias mínimas que debían cumplir las granjas avícolas nuevas, es decir, las que se instalaran a partir de la vigencia de ese reglamento, -7 de mayo del 2003-. Expresaron, para cumplir con la aprobación, debían contar con el "Visto Bueno de Ubicación" del Área Rectora del Ministerio de Salud de su respectiva región. Por otra parte, refirieron los jueces, ese artículo 9 debe relacionarse con el 13 del mismo reglamento, el cual decantaba el procedimiento para la obtención del PSF. Esa norma concluyeron los jueces, establecía 3 supuestos: “1- Las granjas avícolas instaladas antes de la publicación del Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, y que en algún momento contaron con permiso sanitario de funcionamiento; 2- Las granjas avícolas instaladas antes de la publicación del Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, y que nunca contaron con permiso sanitario de funcionamiento; 3- Las granjas avícolas que se instalen a partir de la publicación del Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, es decir granjas nuevas…” Los requisitos que debían cumplir, dijeron los jueces, eran distintos.
Explicaron, que para las granjas avícolas instaladas antes de la publicación del reglamento citado, y que nunca contaron con permiso sanitario de funcionamiento, se les establecían requisitos muy generales como el croquis detallado de las instalaciones, plano catastrado con la ubicación de las instalaciones de los galpones, plan de manejo de desechos y, control sanitario durante el ciclo productivo por el Ministerio de Salud, así como no tener pendientes la resolución de denuncias en su contra u órdenes sanitarias sin cumplir. Ahora, en el caso de las granjas avícolas que se instalen a partir de la publicación del Decreto EjecutivoN°31088-S, es decir nuevas, indicaron, se les exigió una serie de requisitos, y uno de éstos era "Contar con Visto Bueno de Ubicación". Todo lo anterior, llevó a concluir, que las distancias mínimas exigidas en el artículo 9 del Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, eran para granjas avícolas nuevas, es decir, aquellas que se instalaran en fecha posterior a la publicación de ese reglamento, ya que para la granjas avícolas instaladas antes de la publicación de ese Decreto Ejecutivo, y que no contaban con PSF, no se les exigió el requisito del numeral 9.
De seguido, dedujeron los jueces, considerando que la Granja Avícola Lulú ha operado desde hace más de 20 años, lo cual se extrajo de lo dicho por la propia parte actora en su escrito de demanda, así como en otras alegaciones dadas por éste durante el proceso y, por testigos en el juicio oral y público, era evidente estaba instalada antes de la publicación del Reglamento en mención. Asimismo, coligieron los juzgadores, esa granja avícola no contaba para el 7 de mayo del 2003, con un PSF, lo que demuestra que el codemandado, Hernán González Rodríguez, lo solicitó por primera vez, el 8 de noviembre del 2004, ante el Área Rectora de Salud de Atenas del Ministerio de Salud, ubicada en Barrio Jesús de Atenas. Por lo que, la Granja Avícola Lulú, no tenía que cumplir para ese entonces, con el requisito del “Visto Bueno de Ubicación”. Por lo tanto, concluyeron, pese a que se declaró la caducidad del Permiso Sanitario de Funcionamiento del Ministerio de Salud N°ARSAT-0226-2005, éste no fue otorgado por la Administración de manera ilegal, debido a que el requerimiento indicado, no era un requisito exigido para ese momento por el Decreto Ejecutivo N°31088-S.
V.Observa esta Sala, centra la parte recurrente su inconformidad con la sentencia, en que hay prueba suficiente de que la Granja Avícola Lulú era nueva para cuando entró en vigencia el Decreto Ejecutivo no. 31088-S y, por ende, le era aplicable lo dispuesto en el artículo 9 de dicho cuerpo legal, es decir las distancias ahí establecidas con las propiedades vecinas y el EBAIS. Como prueba de ello, hace referencia a documentos que establecen que el permiso de funcionamiento de la Granja, se gestionó por primera vez en el 2004 y se obtuvo en el 2005. Corolario de lo anterior, atribuye falta de aplicación del precepto 9 del reglamento en mención, así como la violación de principios constitucionales de razonabilidad, proporcionalidad, seguridad jurídica e igualdad. Precisa en primer término aclarar, que la exposición de los motivos del recurso pretende llevar a esta Sala a la conclusión que el permiso sanitario de funcionamiento ARSAT-0226-2005 es nulo, en el tanto, al ser una granja nueva -según la parte recurrente- por empezar su funcionamiento luego de entrar en vigencia el Reglamento sobre Granjas Avícolas, le era aplicable las distancias indicadas en el canon 9 de dicho cuerpo legal y por ello opera ilegalmente.
Al respecto, debe recordar el casacionista, el Tribunal declaró la caducidad de la acción sobre la impugnación de dicho acto, caducidad que no fue combatida con lo que adquirió firmeza. Por ende, los argumentos expuestos relativos al tema son inútiles, ya que no ataca el argumento principal, que es la caducidad de la acción respecto de permiso funcionamiento, sino, que combate de manera circulante, lo dicho por el Tribunal a mayor abundamiento de razones. En suma, estima este Órgano casacional, todos los argumentos dirigidos a combatir el permiso ARSAT-0226-2005, carecen de utilidad en el tanto no pueden quebrar el fallo, dada su declaratoria de caducidad. Aunado a lo anterior, tampoco combate el casacionista los argumentos expuestos por los jueces en relación a la legalidad del certificado n°DO-DRCO-4118, en el tanto consideraron que las distancias mínimas reguladas en el citado numeral 9 del Decreto Ejecutivo N°31088-S, no les eran aplicables.
Estimaron los jueces, todo lo concerniente a granjas avícolas, pasó a ser controlado por el SENASA, y no por el Ministerio de Salud, en consecuencia, la autorización para realizar actividades avícolas, se otorgaría por medio de los (CVO), y, ya no por el permiso de funcionamiento que otorga el Ministerio de Salud. Consideró aquella cámara de jueces, que el Reglamento sobre Granjas Avícolas, Decreto Ejecutivo N°31088-S, quedó tácitamente derogado por la Ley General del Servicio Nacional de Salud Animal, N°8495, y por el Reglamento General para el Otorgamiento del Certificado Veterinario de Operación, Decreto Ejecutivo N°34859-MAG, debido a que el Decreto Ejecutivo N°31088-S, fue diseñado para regular las granjas avícolas y la forma de obtener el respectivo permiso sanitario de funcionamiento. No obstante, esas autorizaciones finalizaron con la entrada en vigencia de la normativa citada del SENASA, ya el Ministerio de Salud dejó de ser el competente para emitir permisos sanitarios de funcionamiento para granjas avícolas, y como consecuencia de ello, las distancias mínimas reguladas en el citado numeral 9 del Decreto Ejecutivo N°31088-S, no son un requisito aplicable para el otorgamiento del CVO.
El único argumento presentado por el recurrente sobre la argumentación anterior, es que los Decretos Ejecutivos 31088-S y 34859-MAG pueden coexistir, pues no se contradicen en su esencia, conclusión con lo cual disiente esta Sala. No puede coexistir el Decreto 31088-S en el tanto fue creado por el Ministerio de Salud para regular y controlar todo lo relativo al funcionamiento de establecimientos de aves. Dicha cartera ministerial ya no es competente para fiscalizar esa materia, por el nacimiento de Senasa, órgano ahora encargado de regular la materia, por medio de los certificados veterinarios de operación, es decir, ambas normativas chocan frontalmente. En suma coincide esta Sala con el Tribunal en el sentido de que el Reglamento sobre Granjas Avícolas, Decreto EjecutivoN°31088-S, quedó tácitamente derogado por la Ley General del Servicio Nacional de Salud Animal, N°8495 y, por el Reglamento General para el Otorgamiento del Certificado Veterinario de Operación, Decreto Ejecutivo N°34859-MAG.
VI.Sobre la acusada contaminación ambiental (malos olores, polvo y ruido), así como problemas de salud, respiratorios y alergias producidos por la Granja Avícola Lulú, el Tribunal fundamentó que ninguna de esas acusaciones quedó demostrada, por lo que la Granja opera legalmente. El recurrente acusa, que constan en el expediente quejas de los colindantes donde expresan los problemas de salud, así como el acta notarial emitida por el Licenciado Esteban Esquivel Zúñiga, donde indica haber realizado una inspección y que efectivamente si se emanaban fuertes olores a estiércol, además, consignó la existencia del ruido de las gallinas. Si bien es cierto, consta como hechos probados que se interpusieron múltiples denuncias de parte del actor y otros vecinos, tanto ante el Ministerio de Salud como en SENASA, también es cierto, ya que no fue desvirtuado por la parte recurrente, que a raíz de esas denuncias, ambas instancias administrativas realizaron inspecciones en la Granja, obteniéndose un resultado negativo sobre lo denunciado.
Así consta en los oficios: a) RCN-ARSAT-AT-IF-009-2012 de fecha 6 de enero del 2012, b) oficio del 9 de febrero del 2015, del Dr. Martín García Umaña de la Dirección Regional Central Occidental de la oficina cantonal de Atenas del SENASA, c) CN-ARS-AT-IT-096-2015, del Ministerio de Salud y d) hoja de visita, orden sanitaria 040632 del 25 de octubre del 2016, de SENASA. Contra el resultado negativo de las inspecciones realizadas el Ministerio de Salud y Senasa, la accionante planteó incluso recursos de revocatoria con apelación en subsidio, los cuales resultaron denegados, ya que ambas instituciones coincidieron en que no se detectaron malos olores, ni polvo en los alrededores de la granja. Aunado a esto, constan las declaraciones de Mayela González Rodríguez y Rodolfo González González, quienes en el juicio oral y público, manifestaron ser vecinos de Barrio Jesús de Atenas y que conocen la Granja Avícola Lulu del codemandado, González Rodríguez, así como que han vivido durante muchos años cerca del lugar y no han percibido los malos olores, ruidos o polvo provenientes de esa granja avícola.
Lo anterior demuestra, que no hubo problemas de contaminación, hecho acreditado con mucho más que la sola declaración de Mayela González Rodríguez (como indica el recurrente), cuyo testimonio no pudo ser desacreditado, por ser hermana tanto del codemandado González Rodríguez, como de la esposa del actor pues su dicho es conforme con los demás testimonios recabados. Observa esta Sala, que la queja ante el Ministerio de Salud y Senasa se repitió en varias ocasiones, obteniéndose siempre de las inspecciones realizadas, el mismo resultado positivo para el codemandado González Rodríguez. Senasa, dándole un debido trámite a la segunda denuncia, explicó las razones por las cuales se otorgó el CVO a la granja avícola Lulú. En suma, estima esta Sala, la prueba que se acusa preterida no tiene la virtud de desvirtuar la abundante prueba que aportaron los codemandados, en la que acredita que se han hecho los estudios pertinentes y que no se logró apreciar la contaminación aludida, de ahí que tampoco se pueda concluir que se violaron los principios constitucionales de razonabilidad, proporcionalidad, seguridad jurídica e igualdad.
VII.Con fundamento en lo expuesto, procederá declarar sin lugar el recurso interpuesto por la parte actora, quien deberá cargar con las costas del recurso (canon 150 inciso 3 de CPCA).
POR TANTO
Se rechaza la prueba para mejor resolver solicitada. Se declara sin lugar el recurso, con sus costas a cargo de la parte recurrente.
