ORDINARY PROCEEDING (PROCESO ORDINARIO) brought by ISRAEL RODRÍGUEZ MORA, of legal age, single, farmer, resident of Bajo Rodríguez, San Ramón, identity card number two - two hundred forty-nine - one hundred forty-six; against CONSTRUCTORA OAS SOCIEDAD ANÓNIMA, corporate identification number three - zero twelve - five hundred eighty-four thousand two hundred seventy-two, represented by its general attorney-in-fact without limitation as to amount (apoderado generalísimo sin límite de suma), Mr. Gilmar Andrade Fernández, residence card number one zero seven six zero zero zero six four one seven one six. The following act as special judicial attorneys-in-fact (apoderados especiales judiciales): for the plaintiff, attorney María Isabel Rodríguez Herrera, Bar number seven thousand one hundred eighty-eight; and for the defendant entity, attorneys Manuel Enrique Ventura Rodríguez, Bar card thirteen thousand six hundred eight, and Marco Solano Gómez, identity card number nine - one hundred five - eight hundred sixteen.

The matter was heard before the Agrarian Court of the Third Judicial Circuit of Alajuela, sitting in San Ramón, and subsequently by the Agrarian Tribunal of the Second Judicial Circuit of San José, which issued judgment 516-F-2018 at eleven twenty a.m. on June fourteenth, two thousand eighteen, against which the plaintiff filed an appeal on points of law (recurso de casación).

Justice Vargas Vásquez writes the opinion; and,

WHEREAS

I.According to the judicial record, an area of approximately ten thousand five hundred meters of Mr. Israel Rodríguez’s property, registered under number 300656-000, was used without permission or compensation—as stated by the plaintiff—by the defendant to establish spoil-disposal site (escombrera)—a deposit of soil, plant material, and other materials—N° 15 for the Balsa Inferior Hydroelectric Project in Santa Rita, San Carlos, Alajuela. He therefore brought this ordinary agrarian proceeding, valued at forty million colones, in which he requested:

  • 1)that the complaint be granted;
  • 2)that the defendant be ordered to remove the debris deposited on the undersigned’s property so that the land is restored to the condition it was in before the deposit, or with the least possible damage, and that the cost of removing such material be borne by the defendant;
  • 3)that the defendant be ordered to pay both categories of litigation costs (ambas costas del proceso);
  • 4)that the defendant be ordered to pay the undersigned for the damages and losses (daños y perjuicios) caused by the deposit of debris on my property without my authorization and consent (…). The defendant denied the complaint and raised the defenses (excepciones) of lack of jurisdiction (resolved by interlocutory ruling), compulsory joinder of necessary defendants (litisconsorcio pasivo necesario) (resolved by interlocutory ruling), lack of standing as a defendant (falta de legitimación pasiva), failure to state a legal right (falta de derecho), and lack of a present interest (falta de interés actual). In first-instance judgment number 2016000126, Judge Carlos Eduardo González Mora of the Agrarian Court of San Ramón partially granted the complaint filed by Israel Rodríguez Mora against Constructora OAS Sociedad Anónima, ordering the defendant to pay ¢13.187.500 de colones (thirteen million one hundred eighty-seven thousand five hundred colones) as compensation for the property damage (daño material) caused to the plaintiff by rendering an area of 10500 metros (ten thousand five hundred square meters) unusable. The judgment held as follows: “As to the claim seeking to order the defendant to pay for the damages and losses caused to the plaintiff by the deposit of debris on his property, it was established that the plaintiff was the person who initially offered the property for that purpose; nevertheless, it is evident that he received no compensation whatsoever, and therefore this judge finds that the plaintiff must indeed be compensated for that impairment of his property, in accordance with the doctrine and case law concerning strict liability (responsabilidad objetiva)...".. Subsequently, the Agrarian Tribunal of the Second Judicial Circuit of San José, composed of Judge ANTONIO DARCIA CARRANZA, Judge ENRIQUE ULATE CHACÓN, and Judge XINIA PATRICIA GONZÁLEZ GRAJALES, at eleven twenty a.m. on June fourteenth, two thousand eighteen, issued second-instance judgment (sentencia de segunda instancia) N° 516-F-2018, at eleven twenty a.m. on June fourteenth, two thousand eighteen, partially reversing the judgment rendered and, in its place, dismissing the claim for property damage. The judgment was affirmed in all other respects. Dissatisfied, the plaintiff filed an appeal on points of law.

II.On procedural grounds, the plaintiff raises a single argument, which he numbered as his second ground for disagreement. He alleged a violation of Article 153 of the Code of Civil Procedure on account of inconsistency in the judgment (incongruencia en la sentencia). He argues that the Tribunal analyzed the defense of “lack of standing as a defendant” in a manner demonstrating that the defendant company and Consorcio OAS – Engevix S.A. form part of an economic interest group (grupo de interés económico), because they share representatives, stationery, and an actual place of business. It then concluded, however, that there was a lack of standing as a defendant, which is inconsistent with its own reasoning. Finally, the plaintiff states that the Tribunal’s judgment causes him serious harm because it changes the first-instance judgment in its entirety. He states that, because of the property’s geographical location, its value depends largely on the agricultural production that can be obtained from it, and that the condition in which the property was left makes it entirely unsuitable for agriculture, which also causes him non-pecuniary damage (daño moral) through the suffering of great anxiety.

III.Regarding inconsistency. As a preliminary matter, the appellant alleges the defect of inconsistency. On numerous occasions, this collegiate body had held that, in agrarian matters, an appeal on points of law was admissible only on substantive grounds and not on procedural issues. That criterion derived from the interpretation of section 559 of the Labor Code, applicable to proceedings of this type pursuant to the express referral made by section 61 of the Agrarian Jurisdiction Act. Nevertheless, its admissibility on procedural grounds has been recognized in certain circumstances. To date, these circumstances have been specifically defined as limited to defects involving inconsistency and reformation to the appellant’s detriment (reforma en perjuicio). On this point, see decisions number 583-F-2004 of 11 hours 35 minutes on July 14, 2004 and 1074-F-04 of 11 hours 20 minutes on December 16, 2004.

The appellant on points of law (casacionista) asserts that the recitals of the judgment analyzed the economic interest group of which the defendant forms part and that the defendant therefore did have standing, but that the operative portion (parte dispositiva) of the judgment ultimately declared the contrary. That argument must be rejected. The alleged lack of harmony he describes does not constitute one of the circumstances giving rise to the defect he alleges. This Chamber has already stated that consistency of the judgment, established in Article 155, opening paragraph, of the repealed Code of Civil Procedure and, in the case of the agrarian jurisdiction, derived from section 54 of the Act governing that subject matter, consists of the necessary relationship and harmony that must be evident between the ruling set forth in the judgment’s operative portion and the limits established by the parties’ substantive claims and the matters litigated.

Thus, the judge may not omit a ruling on any disputed issue (minima petita), grant more than was requested, that is, exceed the relief sought (ultra petita), or add matters not contemplated by the litigants (extra petita). It would also arise where the judgment contains contradictory rulings. Stated differently, there is no inconsistency between the judgment’s reasoning and the ruling in its operative portion (to the same effect, see decision number 00728 – 2007). Therefore, because what the appellant alleges is precisely a hypothetical divergence between the contents of the various recitals and what was ultimately ordered in the “Por tanto,” the ground of appeal must be rejected without more. In any event, the alleged contradiction should have been raised before the Tribunal through a motion to supplement and clarify (adición y aclaración) in order to rule out a clerical error (error material). Accordingly, the alleged irregularity does not exist.

IV.On substantive grounds, in the first ground of the appeal on points of law, the plaintiff alleges a violation of Article 330 of the Code of Civil Procedure, improper assessment of the evidence, and violation of the rules of sound judicial evaluation (Sana Crítica). He states that the judgment erroneously refers to Ms. Ana Garro Araya and Fray Rodríguez Araya as his representatives, since they did not possess the legal authority to authorize actions concerning his property. He contends that the registry certification shows that he is the sole owner and therefore the person with standing to authorize, consent to, or issue permits regarding what may or may not be done on his property (violation of Art. 45 of the Constitution). He argues that deed 168-6 from the notarial protocol of Marco Solano Gómez, signed on March 15, 2013, does not establish that he made the property available for use as a spoil-disposal site.

He contends that the letter addressed to Mr. Sergio Garro Vargas of CNFL was an offer to make his land available for use as a spoil-disposal site, which in no way constituted permission for the defendant company to use his land at its convenience and without consideration in return, since that was never his intention. In his view, that document constituted a contractual offer whose formalization required another instrument setting forth the governing contractual clauses, but no such instrument ever existed; the defendant merely submitted deed 168-6 executed by Ana Garro Araya, who is not the owner of the property in question. He argues that, contrary to the evidence in the record, the Tribunal determined that no agricultural or grazing activity was being carried out on the land before its use as a spoil-disposal site, without considering: the expert report (peritaje), which states that the owner exercised possessory acts (actos posesorios), such as planting agricultural products, leasing the farm, selling grass, and keeping livestock; and the testimonial evidence, emphasizing that Mr.

Jaime Chávez León testified on April 04, 2010 that the land was devoted to pasture and livestock raising. Thus, the plaintiff maintains that damage was caused because he sold grass, leased the farm to Agrita S.A., and also kept a considerable number of cattle on the land. He challenges the Tribunal’s finding that the land remains suitable for agricultural purposes, which discredited the damage caused to the property based on the existence of plants and poró trees established during the judicial inspection (reconocimiento judicial) conducted by the lower-court judge (Aquo). He argues that this constitutes an erroneous assessment of the evidence because an inspection consists of preparing a record literally detailing what is observed, without the technical and detailed analysis involved in expert evidence (prueba pericial), which in this case concluded that the agrarian damage (daño agrario) was total because, due to the quantity and nature of the material, the land cannot be used for agriculture or for planting crops or pasture; therefore, damage does in fact exist and has been duly established.

V.Insofar as relevant, the Agrarian Court reversed the trial court judgment and dismissed the complaint, on the grounds that it was “evident and manifest that the plaintiff granted permission for his property to be used as a spoil disposal site (escombrera), and that this is deemed proven in the judgment under proven fact 4), which states: ‘On February 24, 2012, Mr. Israel Rodríguez Mora formally offered in writing the use of his property, registration number 300656-000, for the disposal of soil and plant material from the Balsa Inferior Hydroelectric Project, owned by the Compañía Nacional de Fuerza y Luz (documentary evidence submitted with the answer to the complaint).’ Based on the foregoing, the Court found that the plaintiff attempted to disregard the permission by asserting that he had never authorized the use of his land as a spoil disposal site; however, the activity carried out by that company was consistent with the use specified in the environmental feasibility approval (viabilidad ambiental) issued by SETENA, which designates the plaintiff’s property, registration number 300656-000, as spoil disposal site No. 15, in connection with the authorization given by Mr.

Israel Rodríguez Mora. The Court maintains that no unlawful act was committed, since it was an act consented to by the plaintiff, who in turn assumed the risk of what might occur when his property was used as a spoil disposal site. It adds that no wrongful act was committed that would give rise to the payment of damages (daños y perjuicios) by the defendant. It therefore found that the trial court judge committed a serious error because, when giving authorization, the plaintiff did not negotiate any compensation for the use of his land; thus, the matter would be decided on the basis of an erroneous criterion because that is not what is at issue in these proceedings: ‘the collection of compensation for the use of the land as a spoil disposal site.’ These proceedings concern the recovery of damages, which led the Court to uphold the appellant’s grounds of appeal.

VI.Although the plaintiff appeals to this Chamber alleging a violation of Article 330 of the Code of Civil Procedure and of the rules of sound judicial discretion (Sana Crítica), the proper course would have been to allege a violation of Article 54 of the Agrarian Jurisdiction Law, because in this area the governing system is one of free assessment of the evidence (libre valoración de la prueba), as prescribed by Article 54 of the Agrarian Jurisdiction Law. Nevertheless, the fact remains that the appellant in cassation (casacionista) did state clear and precise reasons warranting admission of the appeal, pursuant to Article 557 of the Labor Code (now repealed), read in conjunction with Article 61 of the Agrarian Jurisdiction Law. Thus, according to the cited case law, in agrarian matters an error in the assessment of evidence may be alleged without the need to cite either the evidentiary provisions or the substantive provisions violated. Accordingly, in light of the foregoing considerations, this Chamber proceeds to examine the plaintiff’s ground of appeal.

VII.The appellant asserts that the decision improperly assessed the evidence, and his claim seeks to establish that the evidence contained in the case file attests that damage to the property did occur and must be compensated. The appellant in cassation attributes the following quotation or statement to the Court: “there has always been the plaintiff’s full consent, and that of his representatives, to the use of the land.” On this basis, he alleges that the judges were referring to Ana Garro Araya and Mr. Fray Rodríguez Araya as his representatives. However, upon review of the judgment, that statement forms part of the defendant’s arguments in its appeal—transcribed in Considerando IV, “the defendant’s appeal”—and not the Court’s reasoning. Although the judges found that the plaintiff’s authorization and consent had always existed, the challenged judgment was not based on the purported authorization or loan granted by Ms.

Ana Garro Araya in deed 168; the existence or nonexistence of that notarized instrument in no way undermines the authorization that the registered owner of the property gave to the Compañía Nacional de Fuerza y Luz for that property to be used as a spoil disposal site (letter dated February 24, 2012). That deed was not considered by the Agrarian Court, and consequently the evaluative judgment set forth in the appeal is unavailing. It is likewise important to emphasize that the Court rejected the complaint based on the plaintiff’s consent, as expressed in the offer made by Mr. Israel Rodríguez on February 24, 2012, to the CNFL, which allowed it to conclude that there was no damage warranting the award of any type of compensation. Accordingly, it is appropriate to transcribe the written communication dated February 24, 2012, as follows: “I, the undersigned, Israel Rodríguez Mora, of legal age, holder of identity card number 202490146, hereby formally inform you that I am offering the C.N.F.L. a parcel of land owned by me that is suitable for the disposal of soil and plant material originating from the Balsa Inferior Hydroelectric Project and community works.

Its location is: 100m west of the bridge over the Río Balsa in Bajo Rodríguez, district of los Ángeles, canton of San Ramón, province of Alajuela, information corresponding to the property recorded under registration number 2-300656-000. In that regard, I hereby authorize the C.N.F.L to undertake the required procedures and obtain the necessary permits from the competent institutions (SETENA and MINAET). Should the property be suitable for that purpose and have the necessary permits, I will be willing to execute a document –that– formalizes the present arrangement (emphasis in the original).” This Chamber considers it correct to state that the plaintiff gave authorization and consent, but the compensation awarded by the A quo does not form part of any agreement and is not the subject matter of the dispute, as the Ad quem held. Although it was established that the plaintiff’s land was used for the disposal of soil, plant material, and other material from the Balsa Inferior Hydroelectric Project, owned by the Compañía Nacional de Fuerza y Luz, it was also established that the plaintiff consented to that use before the CNFL, which processed the project’s environmental feasibility plan, culminating in the authorization issued by the Secretaría Técnica Ambiental, as found under proven fact five in the trial court judgment—a permit that was never challenged or alleged to be void.

Thus, the defendant used the plaintiff’s property as spoil disposal site No. 15 on the basis of the plaintiff’s authorization and the SETENA permit. This Chamber finds nothing in the appeal in cassation (recurso de casación) capable of rebutting the Court’s ruling or establishing that the defendant’s acts were unlawful, because the plaintiff, through the formal communication transcribed above, indeed informed the Compañía Nacional de Fuerza y Luz not only that his land was suitable for the disposal of soil, plant material, and community works, but also that he authorized it to undertake the required procedures and obtain the necessary permits from the competent institutions. This goes beyond a mere contractual offer, as the appellant seeks to portray it. Furthermore, that document did not state that his intention was to receive financial compensation in return, and it would therefore be erroneous to reach that conclusion.

It should be noted that the central claim in this lawsuit is that the defendant be ordered to pay damages caused by depositing debris on the plaintiff’s property without his authorization and consent. The plaintiff was therefore required to prove that the letter referenced above did not constitute authorization and consequently did not reflect his final decision. It bears recalling that the manner in which agrarian proceedings have been structured allows judges broad discretion in assessing the facts alleged by the parties. This system is not arbitrary; on the contrary, the free assessment of evidence must be reasoned and critical and must be based on logic, experience, and psychology. Subject to these principles, this Chamber agrees with the Court of Second Instance that this is a case of contributory fault of the victim (culpa de la víctima). This is because, after arranging for and authorizing the use of his property for what was later designated “spoil disposal site number fifteen,” Mr.

Israel Rodríguez also allowed the work to proceed and never stopped it, which is inconsistent with the purported intention to receive consideration in return. Thus, the use of the land as a spoil disposal site was consistent with the plaintiff’s initial authorization and SETENA’s feasibility approval, and the corresponding activities or implementation continued for almost one year, with only the technical closure contemplated in the environmental feasibility approval being prevented. Furthermore, the allegation of improper assessment of the testimonial evidence (prueba testimonial), judicial inspection (reconocimiento judicial), and expert evidence (prueba pericial) in the record cannot be accepted, because, as this was a situation to which the plaintiff consented, it is irrelevant to determine whether actual damage occurred or whether the property, before and after the use made of it, had agrarian or forestry characteristics.

As stated, the plaintiff assumed the risk by consenting to the deposit of debris on his property and to its approval by the Secretaría Nacional Ambiental on the basis of that authorization. In any event, it bears emphasizing that the entire property was not used as a “spoil disposal site,” but only a 10,550-square-meter section, as established in the expert report. Moreover, even before the spoil-disposal activities began, the environmental feasibility approval or license granted by SETENA established that the land at that time was pastureland on which no agricultural or grazing activity was taking place and that all existing vegetation consisted of grass. It indicated that the topography of the land presented an elevation difference along its entire length, forming a kind of step approximately 5 meters high, and that this section of the land was intended to be used for placing the material while also fulfilling the owner’s expectation of leveling the entire property—an issue which, it bears repeating, was never challenged in these proceedings.

In addition, the expert report found no standing water or foul odors; it considered that, because the land was compacted, there was no apparent danger of any type of landslide due to water saturation or other natural events such as earthquakes; it stated that the spoil disposal site had slopes with an appropriate gradient and drainage ditches for water discharge and that, in the northern section, water-capture works had been constructed to ensure proper drainage. It further found no sedimentation or alteration caused by the debris in the Río La Balsa or along its banks. Accordingly, this evidence instead allows this Chamber to determine that no ecological, environmental, or landscape damage exists. Nor is there any non-pecuniary damage (daño moral), considering that the events allegedly causing it were consented to by the plaintiff, who assumed the risk under his sole responsibility, as explained above (contributory fault of the victim). Accordingly, the ground of appeal must be rejected.

VIII.In light of the foregoing, the challenged judgment does not contain the violations alleged in the appeal under consideration; consequently, the appeal must be dismissed.

POR TANTO

The appeal is dismissed. The challenged decision is affirmed.

PROCESO ORDINARIO establecido por ISRAEL RODRÍGUEZ MORA, mayor, soltero, agricultor, vecino de Bajo Rodríguez, San Ramón, cédula de identidad número dos - doscientos cuarenta y nueve - ciento cuarenta y seis; contra CONSTRUCTORA OAS SOCIEDAD ANÓNIMA, cédula jurídica tres - cero doce - quinientos ochenta y cuatro mil doscientos setenta y dos, representada por su apoderado generalísimo sin límite de suma el señor Gilmar Andrade Fernández, cédula de residencia uno cero siete seis cero cero cero seis cuatro uno siete uno seis. Actúan como apoderados especiales judiciales: del actor, la licenciada María Isabel Rodríguez Herrera, colegiada siete mil ciento ochenta y ocho; y de la entidad demandada los letrados Manuel Enrique Ventura Rodríguez, carné trece mil seiscientos ocho, y Marco Solano Gómez, cédula de identidad número nueve - ciento cinco - ochocientos dieciséis. Tramitado ante el Juzgado Agrario del Tercer Circuito Judicial de Alajuela, con sede en San Ramón y luego por el Tribunal Agrario del Segundo Circuito Judicial de San José, quien emite la sentencia 516-F-2018 de las once horas y veinte minutos del catorce de junio de dos mil dieciocho, contra la cual el actor interpone recurso de casación.

Redacta la Magistrada Vargas Vásquez; y,

CONSIDERANDO

I.Según consta en el expediente judicial, un área de aproximadamente diez mil quinientos metros de la propiedad del señor Israel Rodríguez matrícula 300656-000, fue utilizada sin permiso ni remuneración –según lo indica el actor– por la demandada para establecer la escombrera -depósito de tierra, material vegetal y otros- N° 15 del Proyecto Hidroeléctrico Balsa Inferior de Santa Rita, San Carlos, Alajuela, por lo cual entabló este proceso ordinario agrario, estimado en cuarenta millones de colones, en el que solicitó:

  • 1)se declare con lugar la demanda;
  • 2)se ordene a la demandada sacar los escombros depositados en la propiedad del suscrito de manera que se deje el terreno como estaba antes del depósito o causando el menor daño posible y que el costo de sacar ese material sea a costa de la parte demandada;
  • 3)Se condene a la demandada al pago de ambas costas del proceso;
  • 4)Que se condene a la demandada a pagar los daños y perjuicios ocasionados al suscrito por el depósito de escombros en mi propiedad sin mi autorización y consentimiento (…). La parte demandada contestó negativamente la demanda e interpuso las excepciones de falta de competencia (resuelta interlocutoriamente), litisconsorcio pasivo necesario (resuelta interlocutoriamente), falta de legitimación pasiva, falta de derecho y falta de interés actual. En sentencia de primera instancia número 2016000126 el juez Carlos Eduardo González Mora del Juzgado Agrario de San Ramón, declaró parcialmente con lugar la demanda presentada por Israel Rodríguez Mora contra Constructora OAS Sociedad Anónima, condenando a la demandada al pago de ¢13.187.500 de colones (trece millones ciento ochenta y siete mil quinientos colones) por concepto de daño material ocasionado al actor por la inutilización de un área de 10500 metros (diez mil quinientos metros cuadrados) en el fallo se tuvo lo siguiente: “En cuanto a la pretensión de condenar a la demandada a pagar daños y perjuicios ocasionados al actor por el depósito de escombros en su propiedad, quedó acreditado que el actor fue quien en primer término ofreció la propiedad para tal efecto, no obstante es evidente que no recibió compensación alguna, por lo cual considera este juzgador sí debe retribuirse al actor por dicha afectación a su propiedad, de conformidad con la doctrina y jurisprudencia sobre responsabilidad objetiva...".. Luego, el Tribunal Agrario del Segundo Circuito Judicial de San José integrado por el juzgador ANTONIO DARCIA CARRANZA, por el juez ENRIQUE ULATE CHACÓN y la juzgadora XINIA PATRICIA GONZÁLEZ GRAJALES, a las once horas y veinte minutos del catorce de junio de dos mil dieciocho, emite la sentencia de segunda instancia N° 516-F-2018, de las once horas y veinte minutos del catorce de junio de dos mil dieciocho, en el cual se revoca parcialmente la sentencia dictada y en su lugar rechaza la demanda en cuanto al daño material. En lo demás se confirma el fallo dictado. El actor inconforme, interpone recurso de casación.

II.Por razones procesales la parte actora alega un único motivo, el cual enumeró como segundo motivo de inconformidad. Se planteó una violación al artículo 153 del Código Procesal Civil por incongruencia en la sentencia. Argumenta que el Tribunal hace un análisis de la excepción de “falta de legitimación pasiva” con el cual pone en evidencia que la empresa demandada y Consorcio OAS – Engevix S.A. conforman parte de un grupo de interés económico pues comparten representantes, papelería, y domicilio real. Pero luego, concluye que existe una falta de legitimación pasiva, lo que es incongruente con su propio razonamiento. Finalmente, el actor indica que el fallo del Tribunal le causa un grave perjuicio pues le cambia la totalidad de la sentencia de primera instancia. Indica que la propiedad por su ubicación geográfica, su valor depende en gran media sobre la producción agraria que de ella se pueda extraer y por las condiciones en que se ha dejado la propiedad esta se encuentra totalmente imposibilitada para la agricultura, lo que también le genera un daño moral por el sufrimiento de grandes preocupaciones.

III.Sobre la incongruencia. Como aspecto inicial el recurrente acusa el vicio de incongruencia. En múltiples ocasiones, este órgano colegiado había indicado que en materia agraria, el recurso de casación era de recibo únicamente por motivos de fondo, no así por cuestiones procesales, criterio que derivaba de la interpretación realizada del numeral 559 del Código de Trabajo, de aplicación en este tipo de procesos de conformidad con la remisión expresa que hace el numeral 61 de la Ley de la Jurisdicción Agraria. Empero, se ha determinado su procedencia, en ciertos supuestos, por motivos de índole procesal. A la fecha, se han definido particularmente, circunscritos a los vicios por incongruencia y por reforma en perjuicio. Sobre el particular véanse las resoluciones número 583-F-2004 de las 11 horas 35 minutos del 14 de julio de 2004 y 1074-F-04 de las 11 horas 20 minutos del 16 de diciembre del 2004.

El casacionista aduce, que en los considerandos del fallo se realizó un análisis del grupo de interés económico del que forma parte el demandado y que por ende sí existía legitimación pasiva pero finalmente en la parte dispositiva de la sentencia declara lo contrario. Ese alegato debe ser rechazado. La supuesta desarmonía que expone, no constituye uno de los supuestos que configuran el defecto que acusa. Ya esta Sala ha indicado que la congruencia de la sentencia, consagrada en el artículo 155, párrafo inicial, del derogado Código Procesal Civil, y en el caso de la jurisdicción agraria, derivada del numeral 54 de la Ley de esa materia, consiste en la necesaria relación y armonía que debe evidenciarse entre lo dispuesto en la parte dispositiva del fallo y los límites fijados por las pretensiones materiales de las partes y lo debatido. Así, el juez no puede omitir pronunciamiento sobre algún punto de contienda (mínima petita), otorgar más de lo pedido, sea superar lo pretendido (ultra petita), o bien, agregar extremos no contemplados por los litigantes (extra petita).

También se daría cuando existan pronunciamientos contradictorios en la sentencia. Dicho en otros términos, no hay incongruencia entre las consideraciones de la sentencia y lo resuelto en la parte dispositiva (en igual sentido véase el voto número 00728 – 2007). Por ende, siendo que lo alegado por el casacionista es precisamente una hipotética divergencia entre el contenido de los diversos considerandos y lo que en definitiva se dispuso en el “por tanto”, sin más, el agravio debe ser rechazado. En todo caso, la contradicción que se endilga, debió ser reclamada ante el Tribunal mediante una adición y aclaración a efectos de poder descartar un error material. Así las cosas, no existe la anomalía acusada.

IV.Por razones de fondo, en el primer motivo de casación, la parte actora alega violación al artículo 330 del Código Procesal Civil, indebida apreciación de la prueba e infracción a las reglas de la Sana Crítica. Indica que, es un error que en la sentencia se refieran a la señora Ana Garro Araya y Fray Rodríguez Araya como sus representantes, pues ellos no tenían esas facultades legales para autorizar acciones sobre su propiedad, aduce que, de la certificación registral se desprende que él es el único propietario y por ende legitimado para autorizar, consentir, o emitir permisos sobre lo que se puede o no hacer en su propiedad (violación del Art. 45 de la Carta Magna). Argumenta que de la escritura 168-6 del protocolo de Marco Solano Gómez firmada el 15 de marzo de 2013 no se desprende que él haya dispuesto de la propiedad para uso del depósito de escombros. Aduce que la carta dirigida al señor Sergio Garro Vargas de la CNFL es un ofrecimiento de su terreno para ser utilizado como escombrera, lo cual no implica de ninguna manera un acto permisivo para que la empresa demandada utilizara su terreno a conveniencia y sin contraprestación a cambio, pues esa nunca fue su intención, dicho documento, a su juicio, consiste en una oferta contractual que para su formalización requería de otro acto que estipulara las cláusulas contractuales que regirían, lo cual nunca existió, el demandado se limitó a aportar la escritura 168-6 suscrita por Ana Garro Araya quien no es la titular de la propiedad en cuestión.

Arguye que, contrario a la prueba que consta en autos, el Tribunal determinó que en el terreno no se desarrollaba ninguna actividad agrícola ni de pastoreo antes del uso como escombrera, sin tomar en consideración: el peritaje, en el cual se indica que el propietario ejercía actos posesorios como la siembra de productos agrícolas, alquiler de finca, venta de pasto, manutención de ganado; y la declaración testimonial, enfatizando que el señor Jaime Chávez León el 04 de abril de 2010 declaró que ese terreno estaba dedicado al pasto y ganadería. Así, el actor, sostiene que existe un daño causado pues él se dedicaba a la venta de zacate, al alquiler de la finca a Agrita S.A., y además en el terreno sí mantenía una cantidad considerable de ganado. Reprocha que el Tribunal afirmara que el terreno sigue siendo apto para fines agrícolas, desacreditando el daño ocasionado en la propiedad, con base en la existencia de plantas y árboles de poró que acreditó con el reconocimiento judicial realizado por el Aquo, lo que constituye una errónea apreciación de la prueba por cuanto el reconocimiento consiste en levantar un acta en donde se detalla literalmente lo que se observa, sin análisis técnico y pormenorizado que sí conlleva una prueba pericial, la cual en la especie arrojó como conclusión que el daño agrario fue total ya que por la cantidad y por la naturaleza del material, el terreno está imposibilitado para hacer agricultura, siembra de cultivos o pastos, por lo que efectivamente existe un daño y este se encuentra debidamente acreditado.

V.En lo que interesa, el Tribunal Agrario, revocó la sentencia de primera instancia y declaró sin lugar la demanda, basado en que les resultó “evidente y manifiesto que el actor otorgó los permisos para que su finca fuera utilizada como escombrera y que ello se tiene por demostrado en la sentencia en el hecho probado 4), el cual señala: "En fecha 24 de febrero del 2012, el señor Israel Rodríguez Mora ofrece formalmente y por escrito, el uso de su finca matrícula 300656-000 para el depósito de tierra y material vegetal del proyecto Hidroeléctrico Balsa Inferior, propiedad de la Compañía Nacional de Fuerza y Luz (documental aportada con la contestación de la demanda)". Partiendo de lo anterior, para el Tribunal, el actor trató de obviar el permiso indicando que él nunca autorizó la utilización de su terreno como escombrera, sin embargo, la actividad realizada por dicha empresa conforme al uso consignado en la viabilidad ambiental aprobada por SETENA donde se tiene como la escombrera N° 15 la finca del actor, matrícula 300656-000, ello, con relación a la autorización dada por el señor Israel Rodríguez Mora.

El Tribunal sostiene que no se está realizando un acto contrario a derecho, pues es un acto consentido por el actor, quien a su vez asumió el riesgo de lo que pudiera pasar al utilizarse como escombrera su finca, agrega que, no se ha realizado ningún acto ilícito que genere el pago de daños y perjuicios por parte de la demandada, por lo que consideró que el Juez de primera instancia cometió un error grave por cuanto la parte actora con la autorización dada no negoció alguna compensación por el uso de su terreno, por lo que se estaría resolviendo con base en un criterio errado, ello por cuanto, no es lo que se discute en este proceso, "el cobro de compensación por el uso del terreno como escombrera". Este proceso versa sobre el cobro de daños y perjuicios, lo que hizo darle la razón al apelante en sus agravios.

VI.A pesar de que el actor recurre ante esta Sala alegando violación al artículo 330 del Código Procesal Civil y a las reglas de la Sana Crítica y lo correcto era señalar una violación al 54 de la Ley de la Jurisdicción Agraria, ya que en esta materia lo que rige es un sistema de libre valoración de la prueba conforme lo preceptúa el artículo 54 de la Ley de la Jurisdicción Agraria. Ahora bien, lo cierto es que, el casacionista sí señaló las razones claras y precisas que ameritan la procedencia del recurso, conforme al 557 del Código de Trabajo (hoy derogado) en correlación con el 61 de la Ley de la Jurisdicción Agraria, así, según la jurisprudencia citada, en agrario se puede acusar de error en la valoración de la prueba, sin necesidad de citar ni las normas de prueba ni las de fondo violadas. Así las cosas, de conformidad con las consideraciones anteriores, esta Cámara se dispone a conocer el agravio interpuesto por el actor.

VII.La parte recurrente advierte que el pronunciamiento incurrió en una indebida valoración de la prueba y su reclamo tiene por finalidad acreditar que las probanzas que constan en el expediente, dan fe de que sí existió un daño a la propiedad y que debe ser indemnizado. El casacionista atribuye al Tribunal la siguiente cita o frase: “siempre ha existido pleno consentimiento del actor y sus representantes para la utilización de los terrenos”, con ello alega que los jueces se refieren a Ana Garro Araya y al señor Fray Rodríguez Araya como sus representantes, sin embargo, revisada que fue la sentencia, tal manifestación forma parte de las argumentaciones de la accionada en su apelación (transcritas en el considerando IV “apelación de la demandada”) y no a los razonamientos del Tribunal. Si bien, para los jueces siempre ha existido autorización y consentimiento del actor, la sentencia impugnada no se basó en la supuesta autorización u otorgamiento en calidad de préstamo que concedió la señora Ana Garro Araya en la escritura 168 otorgando, la existencia o no de dicho actor protocolar en nada desvirtúa la autorización que el dueño registral de la finca le otorgó a la Compañía Nacional de Fuerza y Luz para que esa propiedad sea utilizada como escombrera (carta de 24 de febrero de 2012).

Esa escritura no fue considerada por parte del Tribunal Agrario y por consiguiente el juicio de valor plasmado en el recurso resulta estéril. Asimismo, es relevante recalcar que el Tribunal rechazó la demanda basado en el consentimiento del actor, según ofrecimiento realizado por don Israel Rodríguez el 24 de febrero de 2012 ante la CNFL, lo que le permitió concluir que no existe daño alguno que justifique la imposición de cualquier tipo de indemnización. Siendo así, conviene transcribir el memorial de fecha 24 de febrero de 2012 así: “El suscrito Israel Rodríguez Mora, mayor, con cédula de identidad número 202490146 me permito comunicarle formalmente que ofrezco a la C.N.F.L., un terreno de mi propiedad apto para el depósito de tierra y material vegetal proveniente del Proyecto Hidroeléctrico Balsa Inferior y de obras comunales. Su ubicación corresponde a: 100m al oeste del puente sobre el Río Balsa en Bajo Rodríguez, distrito los Ángeles, cantón de San Ramón, provincia de Alajuela, información que se ajusta a la propiedad inscrita a la finca matrícula 2-300656-000.

A ese respecto, declaro autorizar a la C.N.F.L para proceder a gestionar ante las instituciones competentes (SETENA y MINAET) en los trámites y permisos requeridos a ese respecto. En caso de ser apta dicha propiedad a ese fin y cuente con los permisos necesarios, estaré dispuesto a formalizar un documento –que- consolide la presente diligencia (el resaltado pertenece al original)”. Para esta Cámara sí es correcto afirmar que existe autorización y consentimiento por parte del actor, pero la compensación otorgada por el A quo no forma parte de ningún acuerdo ni es el fondo del asunto tal y como lo resuelve el Ad quem. Si bien, quedó demostrado que el terreno del actor fue utilizado para el depósito de tierra, material vegetal y otros del proyecto Hidroeléctrico Balsa Inferior, propiedad de la Compañía Nacional de Fuerza y Luz, también quedó demostrado que ese uso fue consentido por el actor ante la CNFL, quien gestionó el plan de viabilidad ambiental del proyecto que se concretó con la autorización emitida por la Secretaría Técnica Ambiental lo que se tuvo por probado en el hecho cinco en la sentencia de primera instancia, permiso que nunca se combatió ni se alegó como nulo.

Así, la parte demandada utilizó la finca del accionante como escombrera N° 15 con base en esa autorización del actor y el permiso de SETENA. Esta Cámara no encuentra dentro del recurso de casación elementos que permitan desvirtuar lo resuelto por el Tribunal, o que permita acreditar que los actos del demandado sean contrarios a derecho, ya que en efecto, el actor formalmente mediante el oficio transcrito supra, le indicó a la Compañía Nacional de Fuerza y Luz, no solo que su terreno era apto para el depósito de tierra, material vegetal y obras comunales, sino que lo autorizaba para proceder a gestionar ante las instituciones competentes los trámites y permisos requeridos a ese respecto, lo que dista de una simple oferta contractual tal y como lo pretende hacer ver el recurrente. Adicionalmente, en dicho documento no se estableció que su intención era recibir a cambio una compensación económica, por lo que sería errado llegar a esa conclusión.

Nótese que la pretensión medular de esta demanda es que se condene al demandado al pago de daños y perjuicios ocasionados por el depósito de escombros en su propiedad sin su autorización y consentimiento, por lo que, debió el actor demostrar que la carta indicada supra, no era una autorización y que por ende no fue su decisión final. Recordemos que la forma como ha sido concebido el proceso agrario le permite al juez valorar ampliamente los hechos alegados por las partes. Dicho sistema no es arbitrario, por el contrario en la libre valoración de la prueba la misma deber ser razonada, crítica, basarse en la lógica, la experiencia y la sicología, y es con sujeción a estos máximas que esta Cámara concuerda con el Tribunal de Segunda Instancia, al indicar que estamos ante una situación de culpa de la víctima. Lo anterior, en virtud de que el señor Israel Rodríguez tras gestionar y autorizar el uso de su finca para lo que luego se denominó “escombrera número quince”, también permitió que la obra se desarrollara y nunca la detuvo, lo que es contrario a la supuesta intención de percibir una contraprestación a cambio.

De esta manera, el uso del terreno como escombrera, es conforme a la autorización inicial del actor y a la viabilidad de SETENA, cuyas actividades o ejecución de lo previsto se extendió por casi un año, impidiéndose únicamente la realización del cierre técnico previsto en la viabilidad ambiental. Por otra parte, no es de recibo la indebida valoración que acusa respecto a la prueba testimonial, reconocimiento judicial y pericial que consta en autos, toda vez que, al ser una situación consentida por el actor, deviene irrelevante determinar si hubo o no un daño real o si la finca antes y después del uso que se le dio, tiene condiciones agrarias o forestales, pues como se dijo, el riesgo fue asumido por el actor al consentir le depositaran escombros en su propiedad y así aprobarlo la Secretaría Nacional Ambiental en virtud de dicha autorización. En todo caso, valga resaltar que no toda la finca fue utilizada como "escombrera", sino solo un sector de 10,550 metros cuadrados, según se determinó en el informe pericial.

Asimismo, desde antes de iniciadas las actividades de escombrera, en la viabilidad ambiental o licencia otorgada por la SETENA se estableció que el terreno para ese momento era un potrero en el cual no se desarrollaba ninguna actividad agrícola ni de pastoreo y que la vegetación existente en su totalidad era zacate, indicó que la topografía del terreno presentaba una diferencia de nivel a todo lo largo del terreno formando una especie de grada de aproximadamente 5 metros de altura y que esa sección del terreno se pretendía aprovechar para colocar el material y a la vez cumplir con la expectativa del dueño de dejar todo el terreno con un mismo nivel, lo que –se insiste- nunca se combatió en el presente proceso. Además, véase que en el informe pericial, se determinó la inexistencia de aguas estancadas y malos olores, se consideró que al estar el terreno compactado, no se observa peligro de ningún tipo de deslizamiento por saturación de aguas u otras eventualidades naturales como temblores, se indicó que la escombrera tiene taludes con buen declive y cuneteado para el desfogue de aguas y que en la parte norte hay un trabajo de captación de aguas para el desfogue adecuado de las mismas, además que no se observó ningún tipo de sedimentación o alteraciones que estos escombros estén produciendo sobre el Río La Balsa o su litoral.

Así las cosas, dichas pruebas más bien permiten a esta Cámara determinar la inexistencia de un daño ecológico, ambiental o paisajista. Tampoco existe daño moral si se considera que los hechos que lo provocaron fueron consentidos por el actor quien asumió el riesgo bajo su entera responsabilidad según lo expuesto supra (culpa de la víctima). Así las cosas, lo procedente es el rechazo del agravio.

VIII.En virtud de lo expuesto, no presenta el fallo impugnado las infracciones alegadas en el recurso de mérito, en consecuencia, debe declararse sin lugar.

POR TANTO

Se declara sin lugar el recurso. Se confirma la resolución recurrida.
