Ordinary proceedings brought before the Tribunal Contencioso Administrativo y Civil de Hacienda by EUROCOSTARICAN CONSULTING SOCIEDAD ANÓNIMA and INMOBILIARIA ROSENBERG SOCIEDAD ANÓNIMA, represented by their special judicial attorney-in-fact, Livia Meza Murillo, against the STATE, represented by State Attorney Silvia Quesada Cásares. CONSIDERING

I.Attorney Livia Meza Murillo, acting as general attorney-in-fact with unlimited authority for Eurocostarican Consulting S.A. and Inmobiliaria Rosenberg S.A., filed suit against the State on October 5, 2012, based on the following facts. She stated that the companies she represents are equal co-owners of the property recorded under real-property folio registration no. 592763-000-001-002, which was acquired through purchase from Supercalifragilístico Espidalidoso S.A. She added that this property resulted from the consolidation of two adjoining properties registered in the San José Registry District under real-property folio registration nos. 111809-000 and 111811-000, survey plans nos. SJ 599188-1999 and SJ599187-1999, respectively. She indicated that broker Rosemary Guzmán, who was marketing the property in question, had requested information from the Municipality regarding the restrictions applicable in the Canton to the construction of condominiums; at that time, feasibility was confirmed and no spring (naciente) was mentioned.

She stated that, on August 12, 2008, she requested land-use permits (usos de suelo) for commercial activity, offices, earthworks (movimiento de tierra), and a condominium on the property in question, without any restriction being indicated. Nevertheless, she added, the Municipalidad de Montes de Oca declared that property incompatible, based on the Regulatory Plan published in La Gaceta 165 Alcance 51 of August 29, 2006, and Municipal Mayor’s Directive 14, with the activities of condominiums, a church, an educational center, a shopping center, condominiums, and offices, respectively. She clarified that none of the activities authorized by the Municipality was compatible and that, in addition, attorney Gustavo Lara Barquero of the Oficina de Gestión Ambiental stated in a memorandum dated June 29, 2011, that, in view of the property’s history, the encumbrance on the property remained because a stream originating at a spring 30 meters east of the property existed; and although the spring was not located within the property, the property was affected by the Ley Forestal by virtue of the stream’s protection area (área de protección).

Accordingly, on the basis of the protection of water resources and the precautionary principle (principio precautorio), he did not recommend approving the applicant’s request. She noted that, on October 28, 2004, the Área de Conservación Cordillera Volcánica Central of the Sistema Nacional de Áreas de Conservación (hereinafter ACCVC) of the Ministerio de Ambiente y Energía y Telecomunicaciones (hereinafter MINAET) issued Report CPI-001-005 concerning an inspection that had been conducted. The report indicated that, less than 30 meters from the stream passing through the co-plaintiffs’ property, on property belonging to Migue Lizano Mena, there was a spring, and that the stream disappeared beyond the wall of the house adjoining the land on its southeastern side. She explained that the case file of the Tribunal Ambiental Administrativo—hereinafter TAA—no. 338-04-TAA, which contains the aforementioned report, arose from a complaint filed by Jenny Villalobos Fallas on October 24, 2004, and that, as of the relevant date, no decision on the merits had been issued.

Given that omission, she added, on August 21, 2012, she filed an amparo for protection of legality (recurso de amparo de legalidad) against the TAA for violation of the principle of prompt and effective justice (principio de justicia pronta y cumplida), as well as the right of petition; as of the date on which the complaint was filed, it had not been decided. In view of the administrative inaction, she stated, the co-plaintiffs went to the property of Miguel Lizano Mena, the owner of the property where the spring was allegedly located, and verified that what existed was a pipe from which rice, beans, and other materials emerged, as well as a drainage ditch into which that water flowed. She added that, on March 2, 2012, engineer Jesús Monge Mejía—an employee of MINAET, now MINAE—and Ms. Lilliana Gómez Pacheco—an employee of the co-plaintiff companies—went to Mr. Lizano Mena’s house and determined that there was no spring; rather, there was a pipe coming from the property of Mr.

Adrián Herrera Arias and a drainage ditch into which that water flowed on Mr. Lizano Mena’s property. She asserted that engineer Monge did not know why a spring had been identified on that property. She explained that, on the following March 29, engineer Monge returned with his supervisor, attorney Alvaro Porras Vega. They verified that there was no spring on don Migue Lizano’s property, but climbed onto the wall and took photographs of the adjoining land belonging to Adrián Herrera Arias, locating the alleged spring on that property without any study or technical basis. Based on the foregoing, she requested: a) that the opinion dated May 14, 2012, namely AT-1642-2012, be declared null and void because it classified a body of water as a spring; b) a declaration that what enters and exits the tank classified as a spring on the property of Mr. Adrián Herrera Arias is not a usable water resource; c) a declaration that the water in that tank is not potable water but contaminated water originating from wastewater and rainwater; d) a declaration that the irrigation ditch (acequia) passing through the property is not a permanent watercourse (cauce permanente) and contains contaminated water; e) if the foregoing claims were upheld, an order requiring the State to pay damages arising from conduct by MINAET officials that violated the legal system; f) if it were determined that a spring did in fact exist within the property of Mr.

Adrián Herrera Arias, an order requiring the State to compensate the plaintiffs because the existence of the spring had not been publicly recorded in the Property Registry, since they would not have acquired the property in question had they known of its existence; she prudently estimated this claim at $500.000, although the amount was to be determined by an expert qualified in both professions—civil engineering and land surveying; and g) an order requiring the State to pay both categories of costs (ambas costas), interest, and indexation. In a filing dated November 21, 2012, she added two facts. She stated that, on October 19, 2012, the TAA ruled on the environmental-damage complaint filed by a neighbor in 2004, which was dismissed; that complaint was the source from which the “spring” came into legal existence. She added that the Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA) issued her a certificate stating that it had no record of a “spring” body at the coordinates where MINAET had located it.

The State denied the complaint and raised the defense of lack of legal entitlement (falta de derecho). The Tribunal dismissed the complaint, upheld the asserted defense, and ordered the co-plaintiff companies to pay costs. Dissatisfied, the unsuccessful parties appeal to this Chamber.

II.In the appeal on points of law (recurso de casación), the representative of the co-plaintiff companies raises two grounds alleging violations of substantive rules and constitutional principles. In the first, she alleges a failure to determine the established facts clearly and precisely, or that the decision was based on illegitimate evidence or evidence unlawfully introduced into the proceedings. She contends that it is absurd to establish the existence of a spring based on statements by officials who lacked the proper professional qualifications and conducted no study whatsoever to determine whether the water in question constituted a spring, as they made that classification “by sight.” She considers that the principles of reasoned evaluation of evidence (sana crítica racional) were violated and that paragraph 4 of Article 82 of the CPCA was disregarded. She adds that the record established that the study requested by the appellant from the head of the Departamento de Aguas was not conducted, as reflected in the recording, when he stated verbatim: “they are relying on an article of the law, although he could recall neither the law nor the article, and under that article they incur no further responsibility beyond adding that it is a publicly owned watercourse.” She therefore concludes that, because the officials bore no further responsibility, they merely classified something that was not a spring as one, based on the pro natura principle, indicating that their responsibility ended there.

In her opinion, the Tribunal violated the law because the three officials who conducted the study were not geologists. She further argues that the court below (A quo) gave no weight to the expert evidence because the report had not been compared with and evaluated by the Dirección de Aguas. She asserts, however, that no rule requires that opinion to be reviewed against the findings of the Dirección de Aguas. She clarifies that the Tribunal did not apply Article 153 of the Ley General de Administración Pública (hereinafter LGAP). In addition, she contends that, for purposes of better adjudication (para mejor resolver), the challenged decision admitted a plan from 1972 depicting a spring on the Herrera family’s property; nevertheless, she insists that it is not a spring, as shown by photographs in the administrative case file. In the second challenge, she alleges that Articles 152, 153, 158, 199, and 225, all of the LGAP, were disregarded by omission, as were the principles of publicity and equality.

She reiterates that no technical study was conducted to classify the feature as a spring; on the contrary, the expert evidence establishes that the spring does not exist and, therefore, she considers that there are no grounds for departing from the expert’s opinion. She states that evidence from the Servicio de Aguas Subterráneas, SENARA, demonstrates that no spring exists at that location. She maintains that, if a spring existed, it should have been recorded against the affected property, as should the parcels containing protected areas; because this was not done, she asserts that the principle of publicity was violated. She also considers that the principle of equality before the law—Article 33 of the Constitución Política—was violated because, in her view, she proved through an expert study performed by an expert appointed by the Tribunal that no spring existed, yet despite such evidence she was denied the right to equality before the law.

She likewise considers Article 158 of the LGAP to have been violated because the official surnamed Malomuzh and officials Jesús Monge Mejía and Alvaro Porras V. failed to fulfill the obligations imposed by Article 199 of the LGAP, since classifications of this kind cannot be made without a technical study. Nor, in this case, was SENARA’s historical database—which indicates that no spring exists—reviewed. She states that, when don Alvaro was asked why no technical study was conducted when the co-plaintiffs requested one, he answered: “what has been legally established in the Dirección de Aguas is that they rely on ‘an article of the law that he does not recall’ and that they incur no further responsibility beyond adding that it is a publicly owned watercourse.” She alleges a violation of paragraph 1 of Article 225 of the LGAP, as well as Articles 11 and 140, paragraph 8, of the Constitución Política, because the officials acknowledged that they had conducted no technical study but had relied solely on “expert visual” observation. Finally, she requests that this Chamber admit a new expert assessment as evidence for purposes of better adjudication, to determine whether a spring exists on the property at issue.

III.This Chamber finds that, although in the first objection the appellant in cassation (casacionista) mentions a procedural ground, she is in fact challenging an erroneous assessment of the evidence and the corresponding violation of law. Given this Chamber’s authority to hear the grievance according to its true nature, it will be analyzed on the merits. And although two grounds alleging violations of substantive rules are raised, given how they will be decided, they will be analyzed jointly. For greater clarity in analyzing the case, reference will be made to the findings of the Tribunal. That court stated in the judgment under appeal that it was established that, on October 28, 2004, ACCVC officials issued report GPI-001-005, official communication OSJ-129, concerning an inspection conducted on properties located in Vargas Araya, district of Sabanilla, canton of Montes de Oca, province of San José, exactly 50 meters east of Súper Nápoli, ABRA map sheet, coordinates 523.178, 213.239, following a complaint filed with the TAA, identifying the inspected properties by cadastral plan numbers SJ-5991188-99 and SJ-599187, corresponding to real-property folios 1118111-000 and 111809-000, registered to Supercalifragilístico Espialidoso S.A., legal-entity identification number 3-101-236932.

The Tribunal stated that the Water Department of MINAET, through official communication IMN-DA-930-05 of April 19, 2005, reported that a permanent spring (nacimiento de agua) was located at approximate grid coordinates latitude 213.260 and longitude 532.240, Moravia map sheet (3345-I-5), scale 1:10000, at the northeastern end of Mr. Miguel “Lizo” Mena’s property in Vargas Araya, district of Sabanilla, canton of Montes de Oca. It follows from the judgment that the Municipalidad de Montes de Oca declared the land use (uso de suelo) for the construction of condominiums, a church, an educational center, and a shopping center on property registered under real-property folio no. 592763-000-001-002, owned by the co-plaintiffs, to be incompatible. For this purpose, it considered the statements contained in official communication OGA-63-11 of June 29, 2011, from the municipal entity’s Oficina de Gestión Ambiental, which, insofar as relevant, states: “That, according to the records concerning the property in question dating from 2004, together with the various complaints regarding the environmental damage that occurred, case file N. 338-04-TAA before the Tribunal Ambiental Administrativo, and report DPDU-e-990-10-2004 of the Dirección de Planificación Urbana, the encumbrances affecting the property remain in effect.

That, as indicated by the field findings of the ACCVC, San José office, CPI-001-005, there is a stream bordering the property along its southeastern boundary that originates at a spring 30 meters east of the property in question, coordinates: 532226 and 213224. That, as indicated in said field-visit report, taking into account the spring’s protection area (área de protección), even though the spring is not located within the property in question, together with the stream’s protection area, the land remains subject to the Ley Forestal, as provided by the statutory provisions protecting water resources, and, in addition, under the precautionary principle (principio de precautoriedad), approval of the application is not recommended.” Several official communications concerning the spring in question were issued. Official communication no. AT-1645-2012 of May 14, 2012, issued by the Dirección de Aguas of MINAET and addressed to the representatives of the co-plaintiff companies, provided them with information concerning the spring’s location, noting that its location had been determined in official communication AT-1642-2012 of the same date as the preceding communication.

It indicated that the difference from the previous location may have arisen because geographic information systems and tools such as GPS devices were unavailable during the prior assessments; such devices vary in accuracy from 3 to 15 meters, depending also on satellite coverage at the time of measurement. The court below (A quo) added that, through official communication OSJ-603-12 of August 3, 2012, the ACCVC of MINAET provided the co-plaintiffs with information concerning the spring in question; among other things, it informed them that part of the property was affected by the spring’s protection area and that the land was bordered to the south by an unnamed stream and was therefore affected by two protection areas that had to be observed, one extending 10 meters and the other covering approximately 2700 m2. It recommended consulting a surveying professional to conduct a precise study of the affected area.

The trial Tribunal stated that the evidence submitted by MINAET officials, specifically those from the Water Department, was not addressed by the expert examination (peritaje); although it was a detailed and carefully prepared report, it had not been validated by the Department technically competent to do so and to provide scientific certainty.

IV. In their appeal, the appellants offer EVIDENCE TO ASSIST IN REACHING A DECISION (PRUEBA PARA MEJOR RESOLVER), stating

“…I request that this Honorable Chamber, TO ASSIST IN REACHING A DECISION, order NEW technical evidence IN THE COMPANY OF MINAET OFFICIALS, which may be prepared by the same expert or by another expert selected by this Chamber….” This Chamber considers it important to clarify that the evidence to assist in reaching a decision provided for in section 148 of the CPCA is a discretionary power of the court hearing the extraordinary appeal (recurso extraordinario); that is, this Body is responsible for determining its relevance and necessity for rendering the final judgment. This Cassation Body finds that the expert evidence (prueba pericial) offered to assist in reaching a decision is not appropriate at this appellate stage because the record already contains an expert report to which, in observance of the right of defense (derecho de defensa), all parties have had access and which, together with the other evidence submitted, provides ample and sufficient evidentiary support. Thus, admitting an expert examination at this time, besides potentially conflicting with the aforementioned right of defense, would amount to unnecessary duplicative evidence (sobre prueba). On that basis, the requested evidence is denied.

V.In view of the issue addressed by the appeal in cassation (recurso de casación), this Chamber considers it important to state that the purpose of an expert examination is to assist or guide the judge regarding scientific knowledge outside the judge’s expertise, as clearly provided by section 401 of the Código Procesal Civil—hereinafter CPC—which applies supplementarily pursuant to section 220 of the CPCA and which, insofar as relevant, is reproduced as follows: “expert evidence shall be admissible when facts or circumstances requiring specialized knowledge outside the law must be assessed….” Likewise, section 330 of the CPC addresses a central point in the matter submitted for review: judges shall assess the evidence as a whole in accordance with the rules of sound judgment (reglas de la sana crítica), unless otherwise provided by law; that is, the conclusions of an expert examination do not replace the assessment and decision that the adjudicator must make.

Consistent with the foregoing, consideration must also be given to article 28 of the Reglamento para Regular la Función de los Ejecutores y Peritos del Poder Judicial, which establishes the guidelines to be followed by professionals appointed by the judicial office to provide their expert opinion on the disputed issue; among other requirements, their opinions must be clear, complete, and precise. From its analysis of the evidence and the arguments in the appeal, this Chamber concludes that the Tribunal assessed the expert evidence, analyzed it, and compared it with the other evidence entered into the record, namely, the statements of officials from the Water Department of MINAET—now MINAE.

VI.In this specific case, the appellant in cassation alleges that greater weight was given to the statements of the three MINAET—now MINAE—officials than to the expert examination, even though they were not specialists in the subject addressed by their report and conducted no technical studies. The appellant therefore considers it absurd to establish the existence of a spring on the basis of those officials’ statements while denying all weight to the expert examination, which determined that no spring existed. She further argues that the A quo gave no weight to the expert evidence because the report had not been reviewed and evaluated by the Dirección de Aguas, even though no provision establishes such a requirement. This adjudicative Body finds that the ruling in the challenged decision is consistent with the rules of sound judgment and that the evidence was analyzed together with the other evidence in the record, for the reasons set forth below.

At minute 1:07:35 of his testimony, Jesús Raúl Monge Mejía, an engineer and official of the Dirección de Aguas of MINAE, stated that a person who disagrees with the determinations issued by that administrative office—and there are many such persons—submits a study appropriate to the subject matter, after which the office evaluates whether it is coherent. The procedure is not regulated; when the nature of a water outflow (brote de agua) is reclassified, the practice is to accept the findings of the retained professional together with the evidence submitted. He added that, if an opinion contrary to his own were submitted, the case study would be assigned to another colleague in the interest of transparency, since nothing is set in stone. He stated that the essential point is for some evidence or a study to be submitted, after which it is analyzed. The witness noted that he had not seen the Expert Report submitted in the proceeding.

He continued by stating that, if the document were submitted to the Dirección de Aguas, it would be officially received and the technician responsible for assessing it would be selected; if its findings were indeed correct, and to the extent that the document was valid and conclusive, the prior determination would be changed. This Chamber observes that this is a procedure whose absence the witness noted in the case under review, since he stated that, in many other instances, the determination had been reversed whenever the interested party submitted a conclusive technical opinion. Nevertheless, this Chamber finds that the appellant companies filed separate challenges disputing the existence and location of a water outflow recorded by the Administration, the existence of which was confirmed repeatedly by both public officials and the expert examination entered into the record. It is in the designation of that water outflow that this adjudicative Body found disagreement between the two sets of evidence: some referred to it as a spring, whereas the expert examination stated that it could not be designated as a natural spring (manantial), spring, or seep (ojo de agua). In light of the foregoing, a review will be undertaken of certain principles of environmental law and of the protection of water resources, as addressed in the decisions of the Sala Constitucional.

VII.In environmental matters, several principles apply, among which the pro natura principle and the precautionary principle (principio precautorio) stand out because of their relevance. The Rio de Janeiro Declaration refers to the latter in the sense that, where there is a threat of serious or irreversible damage, lack of absolute scientific certainty shall not be used as a reason for postponing effective measures to prevent environmental degradation. Along those lines, this Chamber, in Resolution 90 at 8:50 a.m. on February 3, 2011, stated: “[...] under the precautionary principle and (sic) in dubio pro natura, the State may take such anticipatory actions as are necessary to protect and conserve the environment and human health when there is a risk that they may be adversely affected.” Furthermore, the Constitutional Chamber, in a fairly detailed decision—6340 at 9:15 a.m. on May 5, 2017—addressed the definition of water resources (recurso hídrico) and their protective regime.

Some excerpts from that decision relevant to the case under review are set forth below: “V.- On the protection of groundwater (aguas subterráneas). In Judgment No. 2004-1923 at 2:55 p.m. on February 25, 2004, the Chamber addressed the protection of groundwater as an essential part of our ecosystem, as follows: “V.- GROUNDWATER. In contrast to waters referred to as surface waters (aguas superficiales), insofar as they flow over the Earth’s crust and may be subject to common or special uses, there is groundwater. Groundwater is water found beneath the Earth’s surface, occupying empty spaces in soil or rock; its most important source is rainfall that infiltrates the soil. […] it is an essential part of the hydrologic cycle (ciclo hidrológico); of all the water in the hydrosphere, 2.4% is fresh water, of which 78.1% is frozen, 21.5% is groundwater, and 0.4% is surface water found in rivers and lakes. [...] the Mining Code, Law No. 6797 of October 4, 1982, as amended, provided in section 4 as follows: “(...) mineral springs and waters, and groundwater and surface water, are reserved to the State and may be exploited only by the State, by private parties in accordance with the law, or by means of a special concession granted for a limited period and subject to the conditions and stipulations established by the Legislative Assembly (...)”; in this manner, all groundwater in the country was brought into the public domain and nationalized, including groundwater brought to the surface through a well located on private property for domestic use or ordinary needs.

Subsequently, the Organic Law of the Environment, No. 7554 of October 13, 1995, as amended, in section 50—whose heading is “Public Ownership of Water”—reinforced that declaration of public-domain status (demanialidad) and prescribed that “Water is in the public domain; its conservation and sustainable use are matters of social interest.” This legislative instrument expressly subjects inland waters (surface water and groundwater—because it does not distinguish between them—) to the State’s public domain and classifies their protection, preservation or conservation, and sustainable or rational use as matters of social interest, thereby clearing the way for potential expropriations or restrictions on grounds of social interest (Article 45 of the Political Constitution). VIII.- AQUIFERS, RECHARGE AREAS, AND DISCHARGE AREAS. [...] Natural aquifer recharge (recarga natural de los mantos acuíferos) consists of the volume of water that enters aquifers during a given period through the infiltration of rainfall or a watercourse (e.g., influent rivers).

Recharge areas (áreas de recarga), therefore, are all areas of the ground surface where rainfall infiltrates the soil until reaching the saturated zone and entering the aquifer. Ley Forestal No. 7575 of February 13, 1996, in Article 3, subsection l), defines aquifer recharge areas (áreas de recarga acuífera) as “Surfaces on which infiltration occurs that replenishes aquifers and river channels (...)”. Natural discharge (descarga natural) is the volume of water that, during a given period, naturally leaves the aquifer through surface, subfluvial, or submarine springs, through evapotranspiration, or through vertical percolation into lower aquifers. Artificial discharge (descarga artificial) occurs through the extraction of water by means of wells, ditches, trenches, or tunnels. Groundwater discharge areas (áreas de descarga de las aguas subterráneas) encompass all points at which the water table or phreatic level intersects the ground surface—springs, spring sources (nacientes), seepage—a river channel, or marine or lake beds. [...].” .

VIII.Based on the evidence entered into the record and the matters stated in the preceding recital (considerando), this adjudicative body finds that the Tribunal properly assessed the evidence in accordance with the principle of sound judicial evaluation (sana crítica), in conjunction with the precautionary and pro natura environmental principles. This adjudicative body observes that, although the expert report at issue states that, given the conditions in the area, the water emergence (brote de agua) cannot be described as a spring (manantial), spring source, or water source (ojo de agua) because its hydraulic connection is directly with the volcanic soil located above it, which is recharged by rainwater, the fact remains that, in light of the testimony given at the Oral Hearing, this collegiate body does not consider the expert report absolutely reliable enough to contradict the institutional opinion.

This is because, at minute 2:09:18 of the recording, the expert stated that, to conduct the study, he drilled into the soil to a depth of 1.5 meters in every instance, and at minute 2:13:20 he stated that, at a depth of 3 meters, there is a piping phenomenon (fenómeno de tubificación)—like a natural underground pipe—through which rainwater collected by the coffee plantation travels and then surfaces at the water emergence under analysis. At minute 2:16:40, one of the judges asked whether there was certainty regarding the connection between the water emergence and the coffee plantation. The expert replied that, under the hydrogeological model (modelo hidrogeológico) being used, there should be a connection with a receiving area. If one starts from that premise, then if the coffee plantation is lost, there is no reason for the piping to contain water. Because it is the only area that has remained covered by absorbent material, the water emergence should disappear.

And at minute 01:16:27, the expert added that the hydraulic connection (conexión hidráulica) had to be examined. Hydrogeologically, there is a phenomenon called piping: where there is impermeable material and where there are elements that alter the soil’s porosity—roots, insects...—water flows through it and creates a conduit—a pipe—between one area of the surface and another. Here, there is an area acting like a sponge and a conduit connecting it to the water emergence—subsurface water (agua subsuperficial). Rainwater is absorbed and seeks an outlet. He had access to the coffee plantation and to adjoining properties. There are techniques for identifying and observing this conduit, but due to budget constraints—it is very expensive—there was a limitation: he was unable to observe or demonstrate, using an indirect technique, where the conduit runs, although this falls within the range of conditions that can occur in nature. —emphasis not in the original—.

In the opinion of this Chamber, despite his specialization in hydrogeology, the expert does not clearly refute the statements made by officials of the Administration competent in the matter at issue. This is because, although he states that, given the topographic conditions of the area, the possibility exists in nature that the water that fell as rain and was stored in the coffee plantation is the water emerging from the water emergence under analysis, he indicates that an indirect technique cannot demonstrate where the water conduit runs; that is, it could not be determined with absolute certainty that the water emerging at coordinates 213.273N /532.238E is in fact rainwater stored and filtered through the land on which the coffee plantation is located. Consequently, this collegiate body finds that the expert report does not refute the officials’ statements that, in this case, the feature is a spring source.

Nevertheless, as public servant Jesús Monge indicated, given that natural conditions change, even if the Water Directorate issues an opinion, it may be reviewed upon the submission of technical evidence demonstrating otherwise. Therefore, in the opinion of this judicial body, this decision elects not to overturn the opinion issued by the Administration, in view of the lack of absolute certainty of a contrary opinion concerning the classification of the existing water emergence at this point in time and on the basis of the evidence in the record; that is, the existence of a spring source was not disproved. Accordingly, the in dubio pro natura or Precautionary Principle must be applied, Principle 15 of the Rio Declaration, Article 5 of the World Trade Organization Agreement on the Application of Sanitary and Phytosanitary Measures, Article 3 of the Protocol to the London Convention, and Articles 158 and 167 of the United Nations Conference on Sustainable Development. The foregoing does not preclude pursuing the procedure before the appropriate administrative authorities so that the matter may be reviewed in light of changing natural conditions.

XI.With respect to the second ground alleged, concerning the violation of constitutional principles in the challenged judgment, the fact remains that all arguments made by the appellants in cassation (casacionistas) are confined to the Tribunal’s assessment of the evidence; that evidence has already been described and that issue addressed by this body, and the claim of error must therefore be rejected. It is understood that the judgment did not fail to comply with the provisions of the sections of the General Law of Public Administration cited by the appellants, or with the principles outlined in the appeal, because, as stated, this is an analysis of evidence in which the Tribunal applied the rules of sound judicial evaluation in accordance with what has already been explained. In light of the foregoing, the claims of error must be rejected. Based on the matters analyzed, the appeal shall be denied.

XII.In a submission dated July 26, 2018, the appellant in cassation supplemented the appeal. This Chamber admitted the objection concerning costs (costas), which states, in essence, that the appellant litigated in good faith because, before purchasing the property, a land-use certificate (uso de suelo) was requested from the Municipalidad de Montes de Oca, which authorized any activity. Nevertheless, the appellant states that, when it was updated, the property was declared unsuitable for any purpose because there is a spring source on a neighbor’s property and the area is protected. The appellant maintains that harm was caused as a result of that municipal action. The appellant contends that, pursuant to section 193(b) of the CPCA, it should be exempted from paying costs at both levels of proceedings.

XIII.Regarding the appellant in cassation’s argument concerning the award of costs, it must be stated that, on this issue, in administrative-law proceedings (procesos contenciosos administrativos), this Chamber considers, pursuant to provision 193 of the CPCA, that the ruling on the costs of the proceedings must be made sua sponte, ordering the unsuccessful party to pay them. Accordingly, costs are imposed on the unsuccessful party merely by virtue of having lost, as the Tribunal did in the case under review. That is, for losing the litigation, without this meaning that the party lacked sufficient grounds to litigate or is considered a reckless or bad-faith litigant. Provision 193 of the CPCA itself establishes the circumstances under which a party may be exempted from payment. In this regard, although this is a discretionary power, it is not immune from review in cassation (control casacional), since both its exercise and its nonapplication may entail a violation of law; to that extent, an improper omission is not, and must not be, synonymous with arbitrariness committed, in such a case, by the Judge himself.

This is especially so where the judge has been granted authority subject to specific conditions that limit judicial discretion in this matter. Consequently, on this particular issue, it is considered that the mere application of the general rule under Article 193 of the CPCA—ordering the unsuccessful party to pay both categories of costs—does not foreclose an appeal in cassation (recurso de casación). On the contrary, the matter is admissible for review on the merits (provided that the statutory requirements are met) where there may have been an omission in applying the statutory provisions authorizing exemption from such costs (provision 193 of the CPCA). Thus, depending on the circumstances of the case, an appeal in cassation may indeed be appropriate. In this specific case, the appellant challenges the award of costs, alleging that she litigated in good faith, believing that she held a legitimate right.

Contrary to her assertion, this Chamber finds that proper procedural conduct does not, in itself, warrant exemption from costs; rather, exemption is warranted when the nature of the claim permits the conclusion that the dispute was necessary to determine which party was supported by the legal order (Ordenamiento Jurídico). Considering that the plaintiff failed to substantiate her allegations and that the nonexistence of the spring (naciente) was not established, this Chamber does not find that the litigation was necessary to determine the validity of the challenged actions. Accordingly, this objection must also be denied.

XIV.By virtue of the foregoing reasoning, the appeal shall be denied, and its costs shall be assessed against the appellants pursuant to provision 150.3 of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo).

POR TANTO

The evidence offered to assist in adjudication (prueba para mejor resolver) is rejected. The appeal is denied, with costs assessed against the parties who filed it.

Revisión del Documento *120055241027CA* Res. 001132-F-S1-2019 SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA.- San José, a las dieciséis horas del cuatro de julio de dos mil diecinueve.

Proceso de conocimiento interpuesto en el Tribunal Contencioso Administrativo y Civil de Hacienda, por EUROCOSTARICAN CONSULTING SOCIEDAD ANÓNIMA e INMOBILIARIA ROSENBERG SOCIEDAD ANÓNIMA, representado por su apoderada especial judicial Livia Meza Murillo, contra el ESTADO, representado por la procuradora Silvia Quesada Cásares. Las personas físicas son mayores de edad, casadas y abogadas.

CONSIDERANDO

I.La abogada Livia Meza Murillo, en su condición de apoderada generalísima sin límite de suma de las sociedades Eurocostarican Consulting S.A. e Inmobiliaria Rosenberg S.A. demandó al Estado, el 5 de octubre de 2012, con fundamento en los siguientes hechos. Señaló, sus representadas son propietarias por partes iguales, del inmueble matrícula de folio real no. 592763-000-001-002, el cual fue adquirido por compra a la sociedad Supercalifragilístico Espidalidoso S.A. Agregó, esa finca es el resultado de la reunión de dos inmuebles contiguos, inscritos en el Partido de San José, matrícula de folio real no. 111809-000 y 111811-000, planos no. SJ 599188-1999 y no. SJ599187-1999 respectivamente. Indicó, la corredora Rosemary Guzmán, quien corría el inmueble en cuestión, había solicitado a la Municipalidad información sobre las restricciones del Cantón para construir condominios, momento cuando se dio la viabilidad y no se mencionó nada de ninguna naciente.

Manifestó, el 12 de agosto de 2008, solicitó para el inmueble en cuestión, usos de suelo para actividad comercial, oficinas, movimiento de tierra y condominio, sin indicar ninguna restricción. Sin embargo, agregó, la Municipalidad de Montes de Oca, declaró no compatible ese inmueble, basado en el Plan Regulador publicado en La Gaceta 165 Alcance 51 del 29 de agosto de 2006 y la directriz 14 del Alcalde Municipal para la actividad de condominios, iglesia, centro educativo, centro comercial, condominios y oficinas respectivamente. Aclaró, no había compatibilidad para ninguna actividad otorgada por el Municipio, y además, el licenciado Gustavo Lara Barquero, de la Oficina de Gestión Ambiental expuso, en nota del 29 de junio de 2011, conforme a los antecedentes del inmueble, hace que la afectación dentro de la finca continúe, porque existe una quebrada que proviene de una naciente 30 metros al este de la finca; y aunque la naciente no esté dentro del inmueble, queda afectado por la Ley Forestal, en virtud del área de protección de la quebrada; entonces, por la protección al recurso hídrico y al principio precautorio, no recomendó la solicitud de la petente.

Comentó, el 28 de octubre de 2004, el Área de Conservación Cordillera Volcánica Central del Sistema Nacional de Áreas de Conservación (en adelante ACCVC) del Ministerio de Ambiente y Energía y Telecomunicaciones (en lo sucesivo MINAET) rindió Informe CPI-001-005, respecto a inspección realizada, donde se indica, la quebrada que pasa por la propiedad de las co-accionantes tiene a menos de 30 metros, en propiedad de Migue Lizano Mena, una naciente; y que la quebrada desaparece después de la tapia de la casa colindante con el terreno en lado sudeste. Explicó, el expediente del Tribunal Ambiental Administrativo –en adelante TAA- no. 338-04-TAA, donde consta el Informe recién citado, surgió a raíz de una denuncia de Jenny Villalobos Fallas el 24 de octubre de 2004; y a la fecha no tiene resolución de fondo. Dada la anterior omisión, agregó, el 21 de agosto de 2012, interpuso recurso de amparo de legalidad por violación al principio de justicia pronta y cumplida; así como el derecho de petición, contra el TAA, el cual, hasta la fecha de interposición de la demanda, no había sido resuelto.

Vista la inercia administrativa, refirió, las co-accionantes fueron a la propiedad de Miguel Lizano Mena, propietario del inmueble donde supuestamente está la naciente; y comprobaron que lo que hay es un tubo del cual sale arroz, frijoles y otros; así como un caño al cual caen esas aguas. Agregó, el 2 de marzo de 2012, el ingeniero Jesús Monge Mejía–funcionario del MINAET hoy MINAE- y doña Lilliana Gómez Pacheco –trabajadora de las empresas co-accionantes-, se presentaron en la casa del señor Lizano Mena, determinando que no hay ninguna naciente; lo que hay es un tubo proveniente de la propiedad del señor Adrián Herrera Arias; y el caño donde caen esas aguas en la propiedad del señor Lizano Mena. Adujo, el ingeniero Monge ignoró la razón por la cual se sitúa una naciente en esa propiedad. Explicó, el 29 de mazo siguiente, volvió el ingeniero Monge con su superior, el licenciado Alvaro Porras Vega, quienes comprobaron que no hay naciente en la propiedad de don Migue Lizano, pero se subieron a la tapia, tomaron fotos del terreno colindante, de Adrián Herrera Arias, situando la supuesta naciente en esa propiedad, sin estudio ni tecnicismo.

Con fundamento en lo anterior, solicitó: a) la nulidad del dictamen del 14 de mayo de 2012 sea el AT-1642-2012 por cuanto califica de naciente a un cuerpo de agua; b) que lo que ingresa y sale del tanque calificado como naciente en la propiedad del señor Adrián Herrera Arias, no es ningún recurso hídrico utilizable; c) que el agua de dicho tanque no es agua potable, sino agua contaminada que proviene de aguas residuales y de lluvia; d) la acequia que pasa por la propiedad no es un cauce permanente y es agua contaminada; e) si se acogen los puntos anteriores, pidió condenar al Estado al pago de daños y perjuicios, originados en la conducta violatoria del ordenamiento por parte de funcionarios del MINAET; f) si se determinara que en efecto existe una naciente dentro de la propiedad del señor Adrián Herrera Arias, se condene al Estado a indemnizar a las accionantes dada la falta de publicidad registral de la existencia de la naciente, pues si hubieran sabido de su existencia, no hubieran adquirido la propiedad en cuestión; extremo que prudencialmente estimó en la suma de $500.000, pero el monto debería ser fijado por un perito con ambas profesiones –ingeniero civil y topógrafo-; g) condenar al Estado al pago de ambas costas, intereses e indexación.

En escrito del 21 de noviembre de 2012, adicionó dos hechos. Dijo, el 19 de octubre de 2012, el TAA resolvió la denuncia de daño ambiental incoada en el año 2004 por una vecina; la cual fue declarada sin lugar; y de esa denuncia fue de donde salió a la vida jurídica la “naciente”. Agregó, el Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), le extendió una certificación, donde consta que con las coordenadas donde el MINAET localizó un cuerpo “naciente”, no lo tienen registrado. El Estado, contestó de forma negativa e interpuso la excepción de falta de derecho. El Tribunal declaró sin lugar la demanda, acogió la defensa incoada; e impuso las costas a las empresas co-actoras. Las perdidosas, inconformes, acuden a esta Sala.

II.En el recurso de casación, la representante de las sociedades co-actoras interpone dos motivos por quebranto de normas sustantivas y principios constitucionales. En el primero, alega falta de determinación clara y precisa de los hechos acreditados, o por haberse fundado en medios probatorios ilegítimos o introducidos ilegalmente al proceso. Increpa, es absurdo acreditar la existencia de una naciente con el dicho de los funcionarios, quienes no estaban debidamente acreditados profesionalmente ni realizaron ningún tipo de estudio para determinar si el agua en cuestión, era una naciente; pues la calificación la realizaron “a simple vista”. Estima quebrantados los principios de sana crítica racional e irrespeto del numeral 82 inciso 4) del CPCA. Agrega, en autos se comprobó no se realizó el estudio que la casacionista solicitó al jefe del Departamento de Aguas, según consta en la grabación, cuando textualmente él dijo: “ellos están amparados en un artículo de la ley que no se acordó ni de la ley ni del artículo y que con ese artículo no le generen más responsabilidad que agregar que es un cauce de dominio público.” Entonces, deduce, como los funcionarios no tienen más responsabilidad, se limitaron a calificar como naciente algo que no lo era, con fundamento en el principio pro natura; indicando que hasta ahí llegaba su responsabilidad.

A su juicio, el Tribunal violentó la ley, porque los tres funcionarios que hicieron el estudio, no eran geólogos. Por otro lado, argumenta, el A quo, no le dio valor a la prueba pericial porque el informe no fue contrastado y evaluado por la Dirección de Aguas; sin embargo, asevera, no existe norma alguna, donde se estipule la necesidad de confrontar con la Dirección de Aguas ese Dictamen. Aclara, el Tribunal no aplicó el canon 153 de la Ley General de Administración Pública (en lo conducente LGAP). Además de lo anterior, aduce, en la resolución cuestionada se acoge para mejor resolver un plano del año 1972, donde hay dibujada una naciente en la propiedad de la familia Herrera, sin embargo, insiste en que eso no es una naciente –según fotos del expediente administrativo-. En el segundo embate, alega irrespeto por omisión a los artículos 152, 153, 158, 199 y 225 todos de la LGAP; así como los principios de publicidad e igualdad.

Reitera, no se ha realizado un estudio técnico para hacer la calificación de naciente, por el contrario, la prueba pericial determina la inexistencia de esa naciente, por lo cual estima, no hay mérito para variar el criterio del perito. Dice, conforme a la prueba del Servicio de Aguas Subterráneas, SENARA, se demuestra que en el lugar no hay ninguna naciente. Sostiene, si había una naciente, debía inscribirse en la propiedad afectada; y además, los predios que tienen área protegida; y al no haberse realizado, asevera, se violentó el principio de publicidad. También estima quebrantado el principio de igualdad ante la ley –artículo 33 de la Constitución Política-, porque según su criterio, ha comprobado que no hay naciente, mediante un estudio pericial por un experto nombrado por el Tribunal, pero aún así, no se le otorga el derecho de igualdad ante la ley, ante tal probanza. También considera quebrantado el precepto 158 de la LGAP, porque la funcionaria de apellido Malomuzh, así como los servidores Jesús Monge Mejía y Alvaro Porras V., faltaron a las obligaciones impuestas en el mandato 199 de la LGAP, pues no es posible hacer ese tipo de calificaciones sin un estudio técnico.

Y en este caso, tampoco se revisó la base de datos histórica de SENARA –donde se indica que no hay naciente-. Refiere, cuando se le pregunta a don Alvaro, la razón por la cual no se realizó un estudio técnico cuando las co-accionantes lo solicitaron, contestó: “lo que legalmente se ha establecido en la Dirección de Aguas es que ellos están amparados en “un artículo de la ley que no recuerda” y que a ellos no le generan más responsabilidades que agregar que es un cauce de dominio púbico.” Argumenta violación al precepto 225 inciso 1) de la LGAP, así como a los numerales 11 y 140 inciso 8) de la Constitución Política, pues los funcionarios aceptaron no haber realizado ningún estudio técnico, sino sólo “visual experto”. Finalmente le solicita a esta Sala, admitir como prueba para mejor resolver, un nuevo peritaje, para determinar si existe o no naciente, en el predio en litis.

III.Esta Sala estima, aunque en el primer reparo la casacionista mencione una causal procesal, lo cierto es que increpa errónea valoración probatoria con el correspondiente quebranto normativo. Dada la facultad de esta Cámara para conocer el agravio según su verdadera naturaleza, se analizará por el fondo. Y aunque se aleguen dos motivos por violación de normas sustantivas, dado cómo se resolverá, se analizarán en forma conjunta. Para mayor claridad en el análisis del caso, se hará referencia a lo dispuesto por el Tribunal. Esa instancia, indicó en la sentencia que se recurre, se logró acreditar que el 28 de octubre de 2004, funcionarios del ACCVC, rindieron un informe sea el GPI-001-005 oficio OSJ-129 respecto de la inspección realizada en unas propiedades ubicadas en Vargas Araya, distrito de Sabanilla del cantón de Montes de Oca, provincia de San José, exactamente 50 metros al este del Súper Nápoli, hoja cartográfica ABRA, coordenadas 523.178, 213.239 por denuncia interpuesta ante el TAA, identificando las propiedades objeto de inspección bajo los números de plano catastrado SJ-5991188-99 y SJ-599187 correspondientes a los folios reales 1118111-000 y 111809-000 a nombre de la sociedad Supercalifragilístico Espialidoso S.A., cédula de persona jurídica no. 3-101-236932.

Señaló el Tribunal, el Departamento de Aguas del MINAET mediante oficio IMN-DA-930-05 del 19 de abril de 2005, informó, en las coordenadas planas aproximadas latitud 213.260 y Longitud 532.240 hoja cartográfica Moravia (3345-I-5) escala 1:10000, en el extremo noreste de la propiedad del señor Miguel “Lizo” Mena en Vargas Araya, distrito Sabanilla cantón de Montes de Oca se ubica un nacimiento de agua de carácter permanente. Se extrae de la sentencia, la Municipalidad de Montes de Oca declaró como no compatible el uso de suelo para construcción de condominios, iglesia, centro educativo y centro comercial en el inmueble matrícula folio real no. 592763-000-001-002, propiedad de las co-accionantes; para lo cual se consideró lo mencionado en el oficio OGA-63-11 del 29 de junio de 2011 de la Oficina de Gestión Ambiental del ente municipal, el cual en lo conducente señala:”Que según los antecedentes de la finca en cuestión desde el 2004, junto a las diferentes denuncias por los daños ambientales ocurridos, el expediente ante el Tribunal Ambiental Administrativo N. 338-04-TAA, Informe Dirección de Planificación Urbana DPDU-e-990-10-2004; hace que las afectaciones dentro de la finca continúen.

Que como lo indican los resultados de campo del ACCVC, oficina de San José, CPI-001-005 existe una quebrada que colinda la propiedad de su lindero sureste y proviene de una naciente 30 metros al este de la finca en cuestión coordenadas: 532226 y 213224. Que como se indica en dicho informe de gira, tomando el área de protección de la naciente, aunque esta no se encuentre dentro de la finca en cuestión, más el área de protección de la quebrada, queda el terreno afectado por la Ley Forestal como los artículos de protección al recurso hídrico lo indica la ley, sumándole el principio de precautoriedad no se recomienda dicha solicitud”. Que se emitieron varios oficios referidos a la naciente en cuestión. En el oficio no. AT-1645-2012 del 14 de mayo de 2012, emitido por la Dirección de Aguas del MINAET; y dirigido a las representantes de las empresas co-actoras, se les brinda información acerca de la ubicación de la naciente, reseñando que ella se dictaminó en el oficio AT-1642-2012 del mismo día que el anterior, e indican que la diferencia con la ubicación anterior, pudo deberse a que durante las valoraciones previas no se contaba con los sistemas de información geográfica y sus herramientas como lo son los GPS, los cuales varían con una precisión de 3 a 15 metros, así como la cobertura de los satélites al momento de la medición.

Agregó el A quo, mediante oficio OSJ-603-12 del 3 de agosto de 2012 el ACCVC del MINAET se brinda información a las co-actoras sobre la naciente en cuestión; y entre otros se les indica que una parte de la propiedad está afectada por el área de protección de la naciente; además, que el terreno limita en su parte sur con una quebrada sin nombre por lo que se encuentra afectado por dos áreas de protección que se deben respetar, una por 10 metros y la otra por aproximadamente 2700 m2; y se recomienda consultar con un profesional en topografía para que realice un estudio preciso del área afectada. Señala el Tribunal de instancia, la prueba aportada por los funcionarios del MINAET, específicamente del Departamento de Aguas, no fue confrontada por el peritaje realizado; que si bien es un informe detallado y elaborado no fue homologado por el Departamento competente técnicamente para hacerlo y dar certeza científica.

IV.Las recurrentes ofrecen en su recurso PRUEBA PARA MEJOR RESOLVER indicando: “…solicito a esta Honorable Sala, para MEJOR RESOLVER una NUEVA prueba técnica EN COMPAÑÍA DE LOS FUNCIONARIOS DEL MINAET que puede ser por el mismo perito o por otro que esta Sala escoja…”. Para esta Sala es importante aclarar que la prueba para mejor resolver señalada en el numeral 148 del CPCA obedece a una facultad de quien conoce el recurso extraordinario; es decir, corresponde a este Órgano determinar su pertinencia y necesidad para el dictado del fallo final. Estima este Órgano Casacional, la prueba pericial ofrecida para mejor resolver no resulta oportuna en esta etapa recursiva, en virtud de que en autos consta ya un peritaje al que, en respeto del derecho de defensa, han tenido acceso todas las partes y que es, en conjunto con los demás elementos aportados, sustento probatorio amplio y suficiente. Así, admitir un peritaje en este momento, además de que podría resultar contrario al derecho de defensa aludido, vendría a constituir en una sobre prueba innecesaria. Con base en esa tesitura, la prueba solicitada se rechaza.

V.Visto el tema sobre el cual versa el recurso de casación, para esta Cámara resulta de importancia indicar, el objeto del peritaje radica en auxiliar u orientar al juez(a) en conocimientos científicos que le son ajenos; según lo señala claramente el ordinal 401 del Código Procesal Civil –en adelante CPC- de aplicación supletoria por mandato del ordinal 220 del CPCA, que en lo de interés se transcribe: “procederá la prueba pericial cuando haya que apreciar hechos o circunstancias que exijan conocimientos especiales extraños al Derecho…”. Asimismo el ordinal 330 del CPC, señala un punto medular en lo sometido a conocimiento; y es que los jueces apreciarán los medios de prueba en conjunto, de acuerdo con las reglas de la sana crítica, salvo texto legal en contrario; es decir, que las conclusiones de un peritaje no sustituyen la valoración y decisión que debe adoptar el juzgador. En concordancia con lo anterior debe apreciarse además lo señalado en el artículo 28 del Reglamento para Regular la Función de los Ejecutores y Peritos del Poder Judicial, en donde se establecen los lineamientos que deben cumplir los profesionales designados por el Despacho judicial para emitir su experticia sobre el punto en disputa; entre ellos se establece que deben ser claros, completos y precisos.

Del análisis de la prueba y de lo argumentado en el recurso, esta Cámara desprende, el Tribunal aprecia la prueba pericial, la analiza y confronta con las demás probanzas aportadas a los autos; sea lo dicho por los funcionarios del Departamento de Aguas del MINAET –hoy MINAE-.

VI.En el caso concreto, alega la casacionista, se le dio mayor valor al dicho de los tres funcionarios del MINAET –hoy MINAE- que al peritaje; siendo que ellos no son especialistas en el tema sobre el cual rindieron el informe, ni realizaron estudios técnicos. Por ello, estima la recurrente, es absurdo acreditar la existencia de una naciente con el dicho de esos servidores, restándole todo el valor al peritaje donde se establece la inexistencia de la naciente. Por otro lado, argumenta, el A quo, no le dio valor a la prueba pericial porque el informe no fue contrastado y evaluado por la Dirección de Aguas, siendo que ese requisito no lo establece norma alguna. Considera este Órgano decisor, lo resuelto en el pronunciamiento cuestionado, se ajusta a las reglas de la sana crítica y se analiza en forma conjunta con la prueba constante en autos, según las razones que se dirán. El funcionario de la Dirección de Aguas del MINAE, Ingeniero Jesús Raúl Monge Mejía, al minuto 1:07:35 de su declaración señaló, la persona que no está de acuerdo con los dictámenes de esa Dependencia Administrativa, que son bastantes, lo que hace es presentar un estudio, acorde a la materia, y ellos valoran si tiene coherencia.

No está regulado, lo que se hace cuando se cambia la naturaleza de un brote de agua, es aceptar lo que dice el profesional contratado, con las pruebas que se hagan llegar. Agrega, si se presentara un criterio en contra del realizado por él, se le pasa el estudio del caso a otro compañero, por el tema de transparencia, pues nada está escrito en piedra. Dice, todo está en que presenten alguna prueba, o un estudio y se analiza. Acota el testigo, él no ha visto el Informe Pericial aportado al proceso. Y continúa diciendo, si se presentara a la Dirección de Aguas, el documento se ingresa y se escoge el técnico que lo vaya a valorar; y si efectivamente corresponde, en la medida que sea válido y contundente, se cambiaría el criterio. Esta Sala observa, este es un trámite que echa de menos el testigo en el caso de análisis, pues aduce, en muchos otros supuestos han revertido el criterio siempre y cuando la parte interesada presente un criterio técnico contundente.

Sin embargo, esta Cámara concibe, las empresas recurrentes interpusieron sendas impugnaciones, donde reclamaban la existencia y ubicación de un brote de agua, consignado por la Administración, cuya existencia fue confirmada una y otra vez, tanto por los funcionarios públicos, como por el peritaje aportado a los autos. En la denominación de ese brote de agua, es donde este Órgano decisor encontró disidencia entre ambas probanzas, en unas se le llamaba nacimiento de agua; pero el peritaje señaló que no podía denominarse como manantial, naciente u ojo de agua. En razón de lo anterior, se procederá a hacer un recuento de algunos principios de derecho ambiental; así como sobre la protección del recurso hídrico, según se ha pronunciado la Sala Constitucional.

VII.En materia ambiental, rigen varios principios dentro de los que destacan por su relevancia, el principio pro natura y el precautorio. La Declaración de Río de Janeiro, se refiera a este último, en el sentido de que, ante un peligro de daño grave o irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces, que impidan la degradación del ambiente. En esa línea, esta Sala, en resolución 90 de las 8 horas 50 minutos del 3 de febrero de 2011, señaló: “[...] con el principio precautorio y en (sic) in dubio pro natura, el Estado puede adoptar acciones anticipadas, necesarias para proteger y conservar el ambiente y la salud de las personas, cuando exista riesgo de afectación para aquellos.” Por, otra parte, la Sala Constitucional, en una resolución bastante detallada –6340 de las 9 horas 15 minutos del 5 de mayo de 2017-, se ha referido a la definición del recurso de hídrico y su régimen de protección.

Algunos extractos de ese pronunciamiento, atinentes al caso de estudio, serán expuestos de seguido: “V.- Sobre la protección de las aguas subterráneas. En sentencia No. 2004-1923 de las 14:55 horas del 25 de febrero de 2004, la Sala se refirió a la tutela de las aguas subterráneas, como parte esencial de nuestro ecosistema, en el siguiente sentido: “V.- AGUAS SUBTERRÁNEAS. Frente a las aguas denominadas superficiales, en cuanto discurren sobre la corteza terrestre, y pueden ser objeto de aprovechamientos comunes o especiales, se encuentran las subterráneas. Las aguas subterráneas son aquellas que se encuentran bajo la superficie terrestre ocupando los espacios vacíos en el suelo o las rocas, su fuente más importante lo son las precipitaciones pluviales que se infiltran en el suelo. […] son parte esencial del ciclo hidrológico, así del total del agua de la hidrosfera el 2,4% es agua dulce, de esta un 78,1% se encuentra congelada, un 21,5% corresponde a las aguas subterráneas y un 0,4% son superficiales que se encuentran en ríos y lagos. [...] el Código de Minería, Ley No. 6797 del 4 de octubre de 1982 y sus reformas, en su numeral 4° dispuso lo siguiente “(...) las fuentes y aguas minerales y las aguas subterráneas y superficiales, se reservan para el Estado y sólo podrán ser explotados por éste, por particulares de acuerdo con la ley, o mediante una concesión especial otorgada por tiempo limitado y con arreglo a las condiciones y estipulaciones que establezca la Asamblea Legislativa (...)”, de esta forma se produjo una publificación y nacionalización de todas las aguas subterráneas del país, incluso las que son alumbradas mediante un pozo ubicado en un predio particular para uso domésticos o necesidades ordinarias.

Ulteriormente, la Ley Orgánica del Ambiente, No. 7554 del 13 de octubre de 1995 y sus reformas, en el numeral 50 -cuyo epígrafe es “Dominio público del agua”- reforzó esa declaratoria de demanialidad y preceptúo que “El agua es de dominio público, su conservación y uso sostenible son de interés social”, este instrumento legislativo supone una afectación expresa, de las aguas continentales (aguas superficiales y subterráneas -al no distinguirlas-) al demanio público del Estado y califica de interés social, con lo que se dejó expedito el camino para eventuales expropiaciones o limitaciones por razón de interés social (artículo 45 de la Constitución Política), su protección, preservación o conservación y uso sostenido o racional. VIII.- MANTOS ACUÍFEROS, ÁREAS DE RECARGA Y DESCARGA. [...] La recarga natural de los mantos acuíferos se produce por el volumen de agua que penetra en éstos durante un período de tiempo a causa de la infiltración de las precipitaciones pluviales o de un curso de agua (v. gr. los ríos influentes).

Las áreas de recarga, por consiguiente, son todas las zonas de la superficie del suelo donde las precipitaciones pluviales se filtran en el suelo hasta alcanzar la zona saturada incorporándose al acuífero. La Ley Forestal No. 7575 del 13 de febrero de 1996, en su artículo 3°, inciso l), define las áreas de recarga acuífera como “Las superficies en las cuales ocurre la infiltración que alimenta los acuíferos y cauces de los ríos (...)”. La descarga natural es el volumen de agua que, durante un período de tiempo, sale naturalmente del acuífero a través de los manantiales superficiales, subfluviales o submarinos, por evapotranspiración o por percolación vertical hacía acuíferos inferiores. La descarga artificial se produce a través de la extracción del agua mediante pozos, zanjas, trincheras o túneles. Las áreas de descarga de las aguas subterráneas comprenden todos aquellos puntos en los que la tabla de agua o nivel freáctico intersecta la superficie del suelo –manantiales, nacientes, filtraciones- el curso de un río o los lechos marinos o lacustres. [...].” .

VIII.Conforme las probanzas aportadas a los autos y lo señalado en el considerando anterior, este Órgano decisor concibe, el Tribunal apreció adecuadamente la prueba al resolver conforme al principio de la sana crítica, en concordancia con los principios ambientales precautorio y pro natura. Este Órgano decisor observa, el peritaje en cuestión, si bien señala: dadas las condiciones de la zona, el brote de agua no puede denominarse manantial, naciente ni ojo de agua porque la conexión hidráulica es directa con el suelo volcánico localizado superiormente, el cual se recarga a través del agua de lluvia; lo cierto es que conforme a la declaración rendida en la Audiencia Oral, para este Órgano colegiado, el peritaje no merece fe absoluta, como para contradecir el criterio institucional. Ello por cuanto, al minuto 2:09:18 de la grabación, el perito dijo, para realizar el estudio, perforó el suelo hasta 1.5 metros en todos los casos, y al minuto 2:13:20 señaló, que a 3 metros de profundidad existe el fenómeno de tubificación, -como un tubo natural subterráneo- por el que viaja el agua de lluvia captada por el cafetal, y que aflora en el brote de agua en análisis.

Al minuto 2:16:40, uno de los jueces, pregunta si hay certeza de la conexión entre el brote y el cafetal. Y el perito dijo, con el modelo hidrogeológico que se está tomando, debería haber una conexión con un sector receptor. Si se parte de esa premisa, si el cafetal se pierde, no hay razón para que la tubificación tenga agua. Como es el único sector que ha permanecido por material de absorción, el brote debería desaparecer. Y al minuto 01:16:27, agrega el perito, había que revisar la conexión hidráulica. Hidrogeológicamente existe un fenómeno que se llama tubificación: donde hay un material impermeable, donde hay elementos que alteren la porosidad del suelo –raíces, insectos..- el agua discurre por ahí y genera un conducto –tubo- entre un sector de la superficie con otro. Aquí tenemos un sector como esponja y un conducto que se conecta con el brote de agua –agua subsuperficial-. El agua que llueve, se absorbe y busca una salida.

Tuvo acceso al cafetal, y a propiedades colindantes. Hay técnicas para definir este conducto y observarlo, pero por presupuesto –es muy caro-, hubo una limitante, no pudo observar o demostrar con una técnica indirecta por dónde transcurre el conducto, aunque está dentro de las condiciones posibles que ocurren en la naturaleza. –el resaltado no es del original-. A juicio de esta Sala, el perito, pese a su especialización en hidrogeología, no logra desvirtuar claramente lo dicho por los funcionarios de la Administración competente en el tema de marras. Ello por cuanto, aunque señala que dadas las condiciones topográficas de la zona, existen las condiciones posibles que ocurren en la naturaleza de que el agua llovida y almacenada en el cafetal sea la que sale por el brote en análisis, indica que no se puede demostrar con una técnica indirecta por dónde transcurre el conducto de agua; es decir, no se pudo dictaminar en grado de certeza absoluta que el agua que brota en las coordenadas 213.273N /532.238E, es efectivamente el agua de lluvia almacenada y filtrada por el terreno donde se encuentra el cafetal.

En consecuencia, para este Órgano colegiado, el peritaje no logra desvirtuar el dicho de los funcionarios, quienes adujeron, en la especie se trata de una naciente. Sin embargo, tal y como lo indicó el servidor Jesús Monge, en vista de que las condiciones de la naturaleza son cambiantes; aunque la Dirección de Aguas emita un criterio, es revisable con prueba técnica que demuestre lo contrario. Por ello, a juicio de este Órgano judicial, en esta resolución se opta, por no revocar el criterio vertido por la Administración, vista la falta de certeza absoluta, de un criterio contrario en cuanto a la calificación del brote de agua que existe, en este momento histórico y con la prueba constante en autos, sea que no se desmintió la existencia de una naciente, debiendo aplicarse el principio In dubio pro natura o Precautorio, Principio 15 de la Declaración de Río, artículo 5 del Acuerdo de la Organización Mundial del Comercio sobre la Aplicación de Medidas Sanitarias y Fitosanitarias, artículo 3 del Protocolo del Convenio de Londres, artículos 158 y 167 de la Conferencia de la Organización de las Naciones Unidas sobre Desarrollo Sostenible. Lo anterior no obsta, sea seguido el procedimiento en las instancias administrativas correspondientes, para que el tema sea revisado, dadas condiciones cambiantes de la naturaleza.

XI.En cuanto al segundo motivo alegado sobre violación de principios constitucionales en la sentencia impugnada, lo cierto es que todo lo alegado por las casacionistas se circunscribe a la valoración probatoria por parte del Tribunal; prueba ya descrita y aspecto abarcado por este Órgano, por lo que el agravio debe rechazarse. Entendiéndose que no existió en la sentencia inobservancia a lo estipulado en los ordinales de la Ley General de la Administración Pública señalados por las recurrentes; ni a los principios esbozados en el recurso; ya que se está, como se dijo, ante un análisis de prueba en donde se aplica por parte del Tribunal las reglas de la sana crítica de acuerdo a lo que ya se ha expresado, de lo expuesto los agravios deberán ser rechazados. En mérito de lo analizado se declarará sin lugar el recurso.

XII.En escrito del 26 de julio de 2018, la parte casacionista amplió el recurso. Esta Sala admitió el reparo sobre costas, el cual, en lo medular indica, ha litigado de buena fe, porque de previo a la compra del inmueble se solicitó un uso de suelo a la Municipalidad de Montes de Oca, el cual dio para cualquier actividad. No obstante, señala, al actualizarlo, se declaró que la propiedad no es apta para nada, porque hay una naciente donde un vecino y es zona protegida. Estima, se le ha producido un daño en virtud de ese actuar municipal. Considera, con fundamento en el canon 193 inciso b) del CPCA, se le debe exonerar del pago de ambas costas.

XIII.En relación con el alegato de la casacionista, referente a la condenatoria en costas; ha de manifestarse que sobre el tema, en procesos contenciosos administrativos, esta Sala estima, de conformidad con el precepto 193 del CPCA, que el pronunciamiento sobre las costas del proceso debe hacerse de oficio, condenando al vencido a su pago. Por consiguiente, la condenatoria se impone al perdidoso por el hecho de serlo, según procedió el Tribunal en el caso de examen. Es decir, por perder el litigio, sin que ello signifique no haya tenido motivo bastante para litigar, ni se le considere litigante temerario o de mala fe. Por su parte, el propio numeral 193 del CPCA, dispone los supuestos cuando podrá eximírsele de su pago. Al respecto, aunque se trate de una facultad, es lo cierto que no se encuentra inmune al control casacional, pues tanto en su ejercicio como en su inaplicación, puede operar una violación de ley, y en esa medida, la indebida omisión no es ni debe ser, sinónimo de arbitrariedad, en tal caso, cometida por el propio Juzgador.

Máxime si se trata de un apoderamiento al juez otorgado con supuestos específicos que limitan su poder discrecional en esta materia. En consecuencia, sobre este particular, se estima, con la sola aplicación de la regla general del artículo 193 del CPCA (condenatoria al vencido al pago de ambas costas), no se cierran las puertas al recurso de casación, pues por el contrario, el asunto es admisible para su examen de fondo (siempre y cuando se cumplan los requisitos de ley) ante un eventual vicio omisivo en la aplicación de las disposiciones legales que autorizan la exoneración de dichas costas (canon 193 del CPCA). Entonces, según las circunstancias del caso, sí puede resultar procedente un recurso de casación. En el caso concreto, reclama contra la condena en costas, alegando que ha litigado de buena fe, con la convicción de tener un derecho legítimo. Esta Sala concibe, contrario a lo que afirma, no habilita la exención de costas; en caso de una adecuada conducta procesal, sino porque la naturaleza de lo reclamado, permita colegir que el debate era necesario para dilucidar a quién asistía el Ordenamiento Jurídico.

Tomándose en cuenta que la parte actora no alcanzó a acreditar sus alegatos y que no se llegó a establecer la inexistencia de la naciente, no estima esta Cámara que el litigio revistiera necesidad para dilucidar la validez de las conductas impugnadas. Luego, el reparo también debe denegarse.

XIV.En virtud de lo razonado y expuesto, procederá denegar el recurso, y establecer las costas de este a cargo de las recurrentes conforme al canon 150.3 del Código Procesal Contencioso Administrativo.

POR TANTO

Se rechaza la prueba para mejor resolver. Se declara sin lugar el recurso con las costas a cargo de las promoventes.
