The Chamber denied the amparo because the ICAA disconnected unauthorized connections and the regularization request, filed after the shutoff, had been pending for only three days when the application was brought.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) denied the amparo application challenging the disconnection of water service to several homes in Guácima, Alajuela, and the alleged failure to answer a regularization request. Although it recognized that access to drinking water is indispensable to life, health, and human dignity, the Chamber held that this right must be exercised under the technical and legal rules governing the public service and does not require unauthorized connections to remain active. The evidence established that the service lines were connected directly to infrastructure administered by the ICAA without authorization, confirmation of service availability, or approval for new customers. Their suspension was therefore supported by Article 108(i) of the Reglamento para la Prestación de los Servicios de AyA. Furthermore, the pending administrative request was filed after the disconnection and only three days before the amparo application, which was insufficient time to establish a violation of the right to prompt and effective administrative justice.

First, although constitutional case law has repeatedly recognized that access to drinking water is an indispensable prerequisite for the enjoyment of other fundamental rights, particularly life, health, and human dignity, it has also held that this right must be exercised within the legal framework governing the provision of the corresponding public service. Consequently, constitutional protection of access to drinking water cannot be interpreted as authorization to disregard the procedures, technical requirements, and regulatory provisions governing that service, or as a mechanism for legitimizing factual situations contrary to the legal system. From that perspective, it is not constitutionally admissible to maintain that the Administration was required to keep an unauthorized connection active while a potential request for water availability was being evaluated. The opposite conclusion would require the Administration to continue a situation expressly prohibited by the legal system, distorting the procedures established for allocating public services and compromising the principle of legality governing all administrative action. It must be recalled that, under Articles 11 of the Political Constitution and 11 of the General Law of Public Administration, public authorities may act only within the powers and conditions expressly established by the legal system. Accordingly, it is not for this constitutional jurisdiction to order the restoration of connections acknowledged to be unlawful or to use the amparo proceeding to validate or conceal situations contrary to the rules in force.

038644-26. PUBLIC SERVICES. THE DISCONNECTION OF THE WATER SUPPLY TO SEVERAL HOMES AND THE FAILURE TO RESOLVE AN APPLICATION FOR REGULARIZATION ARE CHALLENGED. THE CHAMBER FINDS THAT THE CONNECTIONS WERE UNAUTHORIZED AND THAT THE PENDING APPLICATION WAS FILED AFTER THE DISCONNECTION, THREE DAYS BEFORE THE AMPARO APPLICATION. THE RIGHT TO WATER DOES NOT REQUIRE UNLAWFUL CONNECTIONS TO BE MAINTAINED OR EXEMPT APPLICANTS FROM TECHNICAL AND LEGAL REQUIREMENTS. THE APPLICATION IS DENIED. VCG10/2026 “(…) IV.- MERITS. The amparo applicant alleges that the respondent authorities violated the applicant’s fundamental rights by disconnecting, on 12 August 2026, the water supply serving several homes on a property located in Guácima de Alajuela, even though, according to the applicant, an administrative application to regularize the service through the installation of meters was pending. The applicant also contends that the right to prompt and effective proceedings was violated because the petition submitted to the respondent institution had not been resolved.

Having examined the evidence entered into the case file, this Chamber finds no constitutional violation as alleged.

First, although constitutional case law has repeatedly recognized that access to drinking water is an indispensable prerequisite for the enjoyment of other fundamental rights, particularly life, health, and human dignity, it has also held that this right must be exercised within the legal framework governing the provision of the corresponding public service. Consequently, the constitutional protection of access to drinking water cannot be construed as authorization to disregard the procedures, technical requirements, and regulatory provisions governing the provision of that service, or as a mechanism for legitimizing factual situations that are contrary to the legal system.

In this case, the evidence submitted to the case file shows that the amparo applicant is incorrect in asserting that the disconnection of the service was arbitrary or unfounded. On the contrary, the report submitted under oath by the respondent authorities establishes that the installations supplying water to the homes in question were unauthorized or unlawful connections made to infrastructure administered by the ICAA. Specifically, the respondent institution explained that it detected, in the sector known as Calle Camboya, several service connection points connected directly to a transmission pipeline administered by that entity, without institutional authorization, certification of service availability, or any approval for the connection of new subscribers. Faced with this situation, it disconnected those branches, an action expressly based on Article 108(i) of the Reglamento para la Prestación de los Servicios de AyA, which provides that the existence of unlawful connections constitutes grounds for suspension of the supply.

It has also been established that the ICAA never made a temporary connection to the water main to supply the homes involved, nor did it approve the installation of individual meters for that housing project. Nor was the applicant’s assertion substantiated that a master meter had previously existed and that the institution had been asked, but failed, to replace it. Rather, the technical evidence submitted by the respondent shows that there is no record of any application of that nature and that the only applications on record concern service-availability procedures initiated in May and August 2026.

Of particular significance is the fact that the situation for which the applicant seeks protection arose precisely from an irregular condition that had not previously been authorized by the Administration. It should be noted that the disconnection occurred on 12 August 2026, when the unlawful connections were detected, whereas the new administrative application invoked by the applicant to justify regularizing the situation was not filed until 14 August 2026, that is, after the challenged administrative action. Thus, the chronology established in the record shows that the institution did not thwart an already established regularization process; rather, a new application seeking a technical and legal assessment of the project was initiated only after the irregular connections had been removed.

From that perspective, it is not constitutionally permissible to maintain that the Administration was required to keep an unauthorized connection active while a possible application for water availability was under review. A contrary conclusion would require the Administration to perpetuate a situation expressly prohibited by the legal system, thereby undermining the procedures established for the allocation of public services and compromising the principle of legality governing all administrative action. It must be recalled that, pursuant to Articles 11 of the Constitución Política and 11 of the Ley General de la Administración Pública, public authorities may act only within the powers and under the conditions expressly provided for by the legal system. Accordingly, it is not for this constitutional jurisdiction to order the restoration of connections acknowledged to be unlawful or to use an amparo proceeding to validate or conceal situations contrary to the regulations in force.

Moreover, the documentation submitted shows that the sector where the property is located is subject to water-resource and hydraulic restrictions that require the respondent institution to conduct prior technical assessments before authorizing new services. It was precisely for this reason that the initial application filed on 7 May 2026 for eight water services was subsequently canceled after the interested party changed the purpose of the procedure and later filed a new application for a different project. This circumstance shows that the legal situation concerning the possible provision of the service was still pending technical and legal review; it therefore cannot reasonably be asserted that there was an established right to receive the supply under the conditions sought by the applicant.

Nor, furthermore, is there any violation of the right enshrined in Article 41 of the Constitución Política. The record shows that the administrative application pending at the time of the events was filed on 14 August 2026 under reference number 2026-00018834-1. This amparo application, in turn, was filed only three days later, on 17 August 2026. It is evident that such a brief period does not support a finding that the Administration incurred an undue, unreasonable, or disproportionate delay in processing the application.

Constitutional case law has held that determining whether there may have been a violation of the right to obtain a response within a reasonable time requires consideration of the complexity of the matter submitted to the Administration, the actions necessary to resolve it, and the amount of time that has actually elapsed without a response. In this case, the application requires a technical analysis to determine whether water-resource, hydraulic, and legal feasibility exists for a housing project located in an area that, according to the respondent, is subject to restrictions on service provision. Consequently, an immediate resolution could not be required, nor could a constitutional violation be deemed established when, at the time this constitutional jurisdiction was petitioned, the application had been pending for only three days.

In sum, the evidence gathered demonstrates that the disconnection of the supply resulted from the existence of unlawful connections detected by the institution administering the service and not from an arbitrary or capricious decision by the respondent authority. It has likewise been established that the administrative application invoked by the applicant was filed after the challenged disconnection and that, when this amparo application was filed, insufficient time had elapsed to consider the right to prompt and effective administrative justice violated. Consequently, because no violation of the invoked fundamental rights has been established, the application must be denied. (…)”

038644-26. SERVICIOS PÚBLICOS. SE CUESTIONA LA DESCONEXIÓN DEL SUMINISTRO DE AGUA A VARIAS VIVIENDAS Y LA FALTA DE RESOLUCIÓN DE UNA SOLICITUD DE REGULARIZACIÓN. LA SALA CONSTATA QUE LAS CONEXIONES NO ESTABAN AUTORIZADAS Y QUE LA GESTIÓN VIGENTE SE PRESENTÓ DESPUÉS DE LA DESCONEXIÓN, TRES DÍAS ANTES DEL AMPARO. EL DERECHO AL AGUA NO OBLIGA A MANTENER CONEXIONES ILÍCITAS NI EXIME DE LOS REQUISITOS TÉCNICOS Y LEGALES. SE DECLARA SIN LUGAR EL RECURSO. VCG10/2026 “(…)
