OutcomeResultado
Justice Salazar Alvarado states that the administrative-litigation jurisdiction ordinarily applies once the Public Administration has intervened, but that he reaches the merits of the amparo here because of the alleged unresolved harm to health, quality of life, and a healthy environment; the fragment does not disclose the majority’s disposition.
SummaryResumen
In his separate note to the ruling, Justice Salazar Alvarado states that when the Public Administration has already intervened in an environmental matter, its examination and resolution ordinarily fall within the administrative-litigation jurisdiction. Nevertheless, he considers it appropriate to reach the merits in an amparo proceeding when the pollution source also implicates the affected persons’ rights, including health, quality of life, and the right under Article 50 of the Political Constitution to a healthy, pollution-free environment. He applies that criterion here because the amparo applicant states that he reported, without obtaining a resolution, pollution caused by heavy vehicles parked on Calle 57. As recounted in the note, the alleged situation affects the protected person and other residents’ enjoyment of a healthy and ecologically balanced environment and a dignified quality of life. The supplied fragment contains only this separate note and does not disclose the majority’s disposition or the ruling’s operative section.

I consider that, in environmental matters, if the Public Administration has already intervened, their examination and resolution fall within the administrative-litigation jurisdiction. Nevertheless, I do examine the merits when other rights of the persons affected by the pollution source are at stake, including health, quality of life, and the right to enjoy a healthy, pollution-free environment (Article 50 of the Political Constitution), as occurs in this case, in which the amparo applicant states that he reported the pollution problem caused by heavy vehicles parked on Calle 57, which affects the protected person and other residents’ right to enjoy a healthy and ecologically balanced environment and a dignified quality of life, but the complaint has not been resolved.

I consider that, in environmental matters, where the Public Administration has already intervened, jurisdiction to hear and resolve the matter lies with the administrative-litigation jurisdiction. Nevertheless, I do examine the merits when other rights of the persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Political Constitution), as is the case here, in which the amparo applicant states that he reported the pollution problem caused by the parking of heavy vehicles on Calle 57, which affects the protected person’s and the other residents’ right to enjoy a healthy and ecologically balanced environment and a dignified standard of quality of life, but that the matter has not been resolved.
