SummaryResumen

The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding concerning repeated low pressure and interruptions in the drinking-water service in San Rafael Abajo de Desamparados. It acknowledged that the ICAA faced reduced production in the Puente Mulas system and undertook works and technical measures, including sectorization, advanced pressure management, flow redistribution, and pipe replacement. Those measures, however, did not exhaust its constitutional obligations: the institution failed to establish that rationing followed clear schedules communicated in a timely manner or that tanker trucks provided a daily, sufficient, and accessible supply during prolonged interruptions. The Chamber found a violation of the fundamental right to drinking water and ordered the ICAA to plan and immediately communicate rationing schedules and to guarantee a daily supply while prolonged interruptions persist. It also ordered the ICAA to pay costs and damages. The amparo was denied as to the Municipalidad de Desamparados because it neither operates the aqueduct nor failed to address a specific request from the applicant.

Nevertheless, under the cited case law, the existence of an objective technical cause and the execution of works do not exhaust the service provider’s constitutional obligations. While interruptions capable of depriving the population of access to drinking water persist, the ICAA must establish effective contingency measures that allow people to prepare and meet their basic needs. Consequently, although the technical actions undertaken are acknowledged, a violation of the fundamental rights of the amparo applicant and the affected population is established. The ICAA did not demonstrate that the interruptions were implemented under a clear and timely communicated schedule or that a sufficient temporary alternative was guaranteed during prolonged periods without service. The application must therefore be granted as against that institution under the terms of the operative portion.

038604-26. PUBLIC SERVICES. REPEATED AND PROLONGED INTERRUPTIONS OF THE DRINKING-WATER SERVICE IN SAN RAFAEL ABAJO DE DESAMPARADOS ARE ALLEGED. THE CHAMBER ACKNOWLEDGES THE TECHNICAL CAUSES AND THE WORK PERFORMED, BUT FINDS THAT ICAA DID NOT ESTABLISH THAT CLEAR SCHEDULES OR AN ADEQUATE ALTERNATIVE SUPPLY HAD BEEN PROVIDED. THE APPLICATION IS GRANTED IN PART SOLELY AGAINST THAT INSTITUTION, WHICH IS ORDERED TO IMMEDIATELY PLAN AND ANNOUNCE WATER-RATIONING SCHEDULES AND GUARANTEE A DAILY SUPPLY DURING PROLONGED INTERRUPTIONS. ICAA IS ORDERED TO PAY COSTS AND DAMAGES. VCG10/2026 “(…) IV.- The fundamental right to drinking water and water rationing. This Chamber has recognized, as part of constitutional law, a fundamental right to drinking water, derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others.

It has also acknowledged that the service provider may face material limitations or implement water rationing due to technical or climatic causes or force majeure. Such circumstances, however, do not relieve it of its planning, information, and contingency duties.

In judgment no. 2026014440, issued at 9:20 a.m. on 24 April 2026 in a matter concerning interruptions of the drinking-water service in San Miguel de Desamparados, this Court specified that water rationing must be implemented in a planned manner, under a schedule communicated in a timely fashion, and accompanied by remedial mechanisms when the population may lose access to the resource:

“ICAA may ration its services, but it must do so in a planned manner, making the necessary arrangements and taking action to guarantee continuity of service, such as establishing and adhering to a schedule, which must be communicated in a timely fashion to the communities that will be affected. [...] In addition, the institution must establish remedial plans, such as continuous distribution by tanker trucks, also setting a schedule for that purpose, which would allow people to stock up on water and thereby meet their needs.” Likewise, in judgment no. 2026027927, issued at 9:25 a.m. on 23 July 2026, the Chamber held that merely communicating water-rationing schedules is insufficient when interruptions exceed a reasonable period, because in such cases an adequate alternative supply must also be guaranteed to meet the population’s basic needs.

V.The specific case. In the matter under examination (sub examine), it has been established that San Rafael Abajo de Desamparados has experienced low pressure and intermittent interruptions of the drinking-water service. The respondent authority itself acknowledges that the Puente Mulas system suffered a significant decline in production and that this reduction affected the replenishment of the Bello Horizonte tank. It also concedes that at times the pressure fell all the way to zero.

The Chamber recognizes that ICAA did not remain inactive. The institution established that it had implemented sectorization measures, advanced pressure management, flow redistribution, and the replacement of pipelines and household connections. These actions are relevant and rule out the possibility that the problem resulted from an arbitrary decision or complete inaction by the Administration.

Nevertheless, under the cited case law, the existence of an objective technical cause and the performance of works do not exhaust the provider’s constitutional obligations. While interruptions capable of depriving the population of access to drinking water persist, ICAA must establish effective contingency measures that allow people to prepare in advance and meet their basic needs.

In this case, ICAA stated generally that service suspensions are announced through its official channels. It did not, however, provide specific notices concerning the interruptions at issue or establish the existence of and compliance with a clearly defined schedule for San Rafael Abajo. It therefore cannot be concluded that the population had reliable and timely information allowing it to stock up before each interruption.

Similarly, the authority reported that it coordinates water distribution by tanker trucks and stated that distribution records exist. The documents in the record, however, do not specify the dates, routes, schedules, volumes, or distribution points for San Rafael Abajo. Nor do they show that this mechanism guaranteed a daily, adequate, and accessible supply during prolonged interruptions. The general assertion that tanker trucks were used does not make it possible to verify the measure’s effectiveness.

Consequently, although the technical measures implemented are acknowledged, a violation of the fundamental rights of the amparo applicant and the affected population is established. ICAA did not establish that the interruptions were implemented according to a clear and timely communicated schedule or that an adequate temporary alternative was guaranteed during prolonged periods without service. The application must therefore be granted as to that institution, under the terms of the operative provisions.

As for the Municipalidad de Desamparados, it has not been established that it operates the water-supply system serving San Rafael Abajo. Nor is there evidence that the applicant submitted a specific request that the local government failed to address. Consequently, the application must be denied as to that authority. (…)”

038604-26. SERVICIOS PÚBLICOS. SE DENUNCIAN INTERRUPCIONES REITERADAS Y PROLONGADAS DEL SERVICIO DE AGUA POTABLE, EN SAN RAFAEL ABAJO DE DESAMPARADOS. LA SALA RECONOCE LAS CAUSAS TÉCNICAS Y LAS OBRAS EJECUTADAS, PERO CONSTATA QUE EL ICAA NO ACREDITÓ HORARIOS CLAROS NI UN SUMINISTRO ALTERNATIVO SUFICIENTE. SE DECLARA PARCIALMENTE CON LUGAR ÚNICAMENTE CONTRA ESA INSTITUCIÓN Y SE ORDENA, DE FORMA INMEDIATA, PLANIFICAR Y COMUNICAR LOS RACIONAMIENTOS Y GARANTIZAR ABASTECIMIENTO DIARIO DURANTE INTERRUPCIONES PROLONGADAS. SE CONDENA AL ICAA AL PAGO DE COSTAS, DAÑOS Y PERJUICIOS. VCG10/2026 “(…)
