SummaryResumen

The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding against the owners of property containing infrastructure for the water-supply system managed by the ASADA of Pueblo Nuevo de Duacarí, Guácimo. Although a dispute existed over ownership and the legal regularization of the land, the owners had installed a gate, lock, and fences restricting access to facilities essential to approximately three hundred active service connections. The Chamber held that this dispute, which must be resolved through ordinary proceedings, did not authorize the owners to prevent accredited ASADA personnel or competent officials of the Instituto Costarricense de Acueductos y Alcantarillados from entering to perform operational work, inspections, maintenance, monitoring, and emergency response. It ordered the owners to permit those activities immediately and refrain from obstructing them, without prejudice to their right to pursue claims in the appropriate ordinary forums. The alleged cutting of pipes was not established. The amparo was denied as to AyA because the challenged restrictions were caused by private persons.

Key excerptExtracto clave

Thus, this Chamber considers that, although there is a dispute between third parties that this Chamber lacks jurisdiction to resolve, arising from the unresolved legal status of the property where infrastructure for the water-supply system managed by the ASADA of Pueblo Nuevo is located, the fact remains that the property owners may not prevent personnel duly authorized and identified by the ASADA, or competent officials of the Instituto Costarricense de Acueductos y Alcantarillados, from accessing the sites where the aqueduct-system infrastructure is located in order to conduct operations, inspections, preventive maintenance, corrective maintenance, monitoring, and responses to potential emergencies, so as to guarantee the continuity, quality, and safety of the public drinking-water supply service. This is without prejudice to the owners asserting their rights or raising their objections and claims in the ordinary forums. Consequently, the application is granted, subject to the order that will be issued in the operative portion of this ruling. VII.- Finally, because the conduct challenged in this proceeding was caused by the respondent private persons and not by the Instituto Costarricense de Acueductos y Alcantarillados, the application is denied insofar as that institute is concerned. 037628-26. PRIVATE-LAW ENTITY. PUBLIC SERVICES. IT IS ALLEGED THAT THE OWNERS OF A PROPERTY ON WHICH INFRASTRUCTURE USED BY THE ASADA DE PUEBLO NUEVO DE DUACARÍ, GUÁCIMO, IS LOCATED PREVENTED ACCESS FOR MAINTENANCE WORK AND THREATENED TO RESTRICT ITS OPERATION, IN THE CONTEXT OF A DISPUTE CONCERNING THE USE OF THE PROPERTY. IT IS HELD THAT DISPUTES RELATING TO PROPERTY RIGHTS AND THE LEGAL REGULARIZATION OF THE LAND DO NOT JUSTIFY PREVENTING THE WORK NECESSARY TO ENSURE THE CONTINUITY OF THE PUBLIC DRINKING-WATER SERVICE. THE AMPARO APPLICATION IS PARTIALLY GRANTED, SOLELY AGAINST THE PRIVATE OWNERS, WHO ARE ORDERED TO ALLOW ACCREDITED ASADA PERSONNEL IMMEDIATE ACCESS TO PERFORM THE NECESSARY WORK AND MAINTENANCE AND TO REFRAIN FROM OBSTRUCTING SUCH WORK. THE AMPARO APPLICATION AGAINST AYA IS DENIED. VCG10/2026 “(…) VI.- MERITS. In the present case, the amparo applicant seeks an order from this Chamber requiring that they be allowed access to private property on which the water-storage tank belonging to the ASADA it represents is located, because the respondents installed a gate and padlock to control access. The applicant also reports that piping in the drinking-water supply system was cut.

In that regard, property registered under real-property folio No. 7-22351 is recorded as comprising several ownership interests belonging to the respondents Sánchez Granados, and infrastructure for the water-supply system administered by the ASADA de Pueblo Nuevo is located on that property. In addition, on 18 September 2025, the Dirección de Agua del Ministerio de Ambiente y Energía inspected the sources used by the ASADA de Pueblo Nuevo and determined that two springs (nacimientos) were being exploited without having been duly registered, ordering the immediate cessation of their unlawful exploitation and completion of the corresponding procedures if there remained an interest in using them. Accordingly, on 23 March 2026, representatives of the ASADA de Pueblo Nuevo and the respondents Sánchez Granados participated in a meeting at which the need to regularize the property’s legal status was raised.

The respondents Sánchez Granados, owners of the property on which the supply system administered by the ASADA de Pueblo Nuevo is located, acknowledge that they restricted free and unrestricted access to the property and state: ‘(..) We installed a gate and padlock for the purpose of controlling access to our private property after the efforts undertaken to regularize the situation failed to produce a solution. Nevertheless, it must be made absolutely clear to this Chamber that WE HAVE NOT CUT ANY PIPING IN THE DRINKING-WATER SUPPLY SYSTEM. We categorically deny the assertion in the application that we cut one of the conveyance pipes (..).’ It was also verified that, on an unspecified date in 2026, the ASADA de Pueblo Nuevo requested institutional assistance from the Oficina Regional de Acueductos Comunales Huetar Caribe of the Instituto Costarricense de Acueductos y Alcantarillados to regularize the property’s legal status.

That request was forwarded to the legal department on 27 July 2026 to seek the following: ‘(…) advice regarding the steps to be followed and the assistance necessary to address the request submitted by ASADA Pueblo Nuevo de Duacarí, taking into consideration the requirements and conditions for regularizing the registration status of the land occupied by this water-supply system (…).’ In addition, the Executive President of the Instituto Costarricense de Acueductos y Alcantarillado states that, through the Oficina Regional de Acueductos Comunales Huetar Caribe, it has provided ongoing technical assistance to the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Pueblo Nuevo and recommended applying to the appropriate bodies so that the competent authorities would allow them access to the ASADA’s infrastructure. Thus, this Chamber has no evidence that the respondents Sánchez Granados, the owners of the property, cut any piping in the drinking-water supply system.

It is established, however, that they installed a padlock and fences restricting access by the ASADA and the Instituto Costarricense de Acueductos y Alcantarillados. This occurred even though such work is essential to ensure the operation and continuity of the public drinking-water supply service that the ASADA provides to the community. The Executive President of the Instituto Costarricense de Acueductos y Alcantarillados states that the system supplies approximately three hundred active service connections, and therefore any impairment of its operation could directly affect the continuity and quality of the service provided to the user population.

Accordingly, this Chamber considers that, although there is a dispute between third parties that this Chamber has no jurisdiction to resolve and that originates from the failure to settle the legal status of the property on which infrastructure belonging to the water-supply system administered by the ASADA de Pueblo Nuevo is located, the fact remains that the property owners may not prevent personnel duly authorized and identified by the ASADA, or the competent officials of the Instituto Costarricense de Acueductos y Alcantarillados, from accessing the sites where the water-supply system’s infrastructure is located to perform operational work, inspections, preventive maintenance, corrective maintenance, monitoring, and responses to potential emergencies, in order to ensure the continuity, quality, and safety of the public drinking-water supply service. This is without prejudice to the owners’ right to assert their rights or submit their objections and claims through ordinary proceedings. Consequently, the amparo application is granted, subject to the order set forth in the operative part of this decision.

VII.Finally, because the actions at issue in these proceedings were caused by the respondent private-law entities and not by the Instituto Costarricense de Acueductos y Alcantarillados, the amparo application is denied insofar as it concerns that institute. (…)”

037628-26. SUJETO DE DERECHO PRIVADO. SERVICIOS PÚBLICOS. SE ALEGA QUE LOS PROPIETARIOS DE UNA FINCA DONDE SE ENCUENTRA INFRAESTRUCTURA UTILIZADA POR LA ASADA DE PUEBLO NUEVO DE DUACARÍ, GUÁCIMO, IMPIDIERON EL ACCESO PARA REALIZAR LABORES DE MANTENIMIENTO Y AMENAZARON CON RESTRINGIR SU FUNCIONAMIENTO, EN EL CONTEXTO DE UNA CONTROVERSIA SOBRE EL USO DEL INMUEBLE. SE CONSIDERA QUE LOS CONFLICTOS RELACIONADOS CON EL DERECHO DE PROPIEDAD Y LA REGULARIZACIÓN JURÍDICA DEL TERRENO NO JUSTIFICAN IMPEDIR LAS LABORES NECESARIAS PARA GARANTIZAR LA CONTINUIDAD DEL SERVICIO PÚBLICO DE AGUA POTABLE. SE DECLARA PARCIALMENTE CON LUGAR EL RECURSO, ÚNICAMENTE CONTRA LOS PROPIETARIOS PARTICULARES, Y SE LES ORDENA PERMITIR DE INMEDIATO EL INGRESO DEL PERSONAL ACREDITADO DE LA ASADA PARA EFECTUAR LAS OBRAS Y EL MANTENIMIENTO NECESARIOS, ASÍ COMO ABSTENERSE DE OBSTACULIZAR ESAS LABORES. SE DESESTIMA EL RECURSO CONTRA EL AYA. VCG10/2026 “(…)
