The Chamber determined that non-retroactivity protects acquired rights and consolidated legal situations but does not preclude enforcing current environmental duties or inspecting continuing effects, without authorizing the removal of old buildings outside the appropriate procedure.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) analyzes the guarantee of non-retroactivity under Article 34 of the Political Constitution and holds that it must also be respected in environmental matters. It distinguishes retroactively imposing legal consequences on events completed under earlier rules from currently enforcing environmental protection duties or inspecting situations whose effects persist. Under the criterion developed in Judgment No. 2004-014576, the age of an activity does not, by itself, create an acquired right to continue operating outside legitimate requirements protecting the environment, health, life, and safety. That doctrine, however, does not authorize authorities to disregard consolidated legal situations or to order the removal of old buildings without the appropriate procedure. Non-retroactivity therefore cannot be invoked automatically as a basis for authorities to refrain from exercising their present environmental oversight and protection powers. The supplied extract does not include the disposition of the case.

Article 34 of the Political Constitution provides that no law shall be given retroactive effect to the detriment of any person, their acquired property rights, or consolidated legal situations. The guarantee of non-retroactivity must also be respected in environmental matters. Judgment No. 2004-014576, issued at 16:04 on 21 December 2004 and invoked even in the proceedings incorporated into the case file, established that, when the protection of the environment, health, life, and safety is at issue, the age of an activity does not, by itself, constitute an acquired right to continue conducting it outside the requirements legitimately imposed by the legal system to protect those constitutional interests.

PRINCIPLE OF NON-RETROACTIVITY “(…) V.- ON THE PRINCIPLE OF NON-RETROACTIVITY AND ITS RELATIONSHIP TO ENVIRONMENTAL PROTECTION. Article 34 of the Political Constitution provides that no law shall be given retroactive effect to the detriment of any person, that person’s acquired property rights, or settled legal situations. The guarantee of non-retroactivity must also be respected in environmental matters. Nevertheless, its application requires distinguishing between retroactively imposing legal consequences on acts completed under prior regulations and requiring present compliance with environmental-protection duties or overseeing situations whose effects continue in the present.

Judgment N° 2004-014576, issued at 16:04 on 21 December 2004 and cited even in the documents incorporated into the case file, explained that, with respect to the protection of the environment, health, life, and safety, the longstanding nature of an activity does not, in itself, constitute an acquired right to continue carrying it out without regard to the requirements legitimately imposed by the legal system to protect those constitutional interests. That standard does not authorize disregarding settled legal situations, nor does it permit ordering the removal of longstanding structures without proceedings; it does, however, preclude automatically invoking non-retroactivity as grounds for refraining from exercising current oversight and protection powers.
