SummaryResumen

The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding against the Municipalidad de Escazú because, although the municipality had inspected the site, cleaned channels and drains, pumped accumulated water, and assessed the stormwater system, its actions did not effectively and promptly resolve the persistent water stagnation outside the applicant’s home. The conditions caused flooding, mosquitoes, foul odors, health risks, and access difficulties, particularly affecting an older adult and a person with a severe disability. The Chamber ordered the mayor to coordinate and carry out, within six months after notice of the judgment, the technical, administrative, and operational measures needed to ensure proper stormwater drainage and eliminate the reported sanitary and environmental impacts. The municipality must maintain interim mitigation measures while implementing the permanent solution. The amparo was denied as to the Ministerio de Salud because it had continuously exercised its sanitary oversight and enforcement powers, although it must continue monitoring the administrative file and compliance with the sanitary orders.

The established facts show that the problem reported by the amparo applicant persisted for a prolonged period and, when this proceeding was filed, had not been definitively resolved. Although the municipal authorities took various steps to address the situation, those actions were insufficient to remedy the reported conditions effectively, and those conditions continued to affect the applicant and her household. Indeed, the municipality itself acknowledges that the permanent solution for the stormwater drainage system remains under technical assessment. Accordingly, this Chamber finds that the response provided by the Municipalidad de Escazú was neither effective nor timely in comprehensively resolving the problem, thereby violating the applicant’s fundamental rights, particularly the rights to health, a healthy and ecologically balanced environment, and an adequate quality of life. The appropriate disposition is therefore to partially grant the application against the Municipalidad de Escazú under the terms set forth in the operative part of this judgment.

036873-26. ENVIRONMENT. THE APPLICANT ALLEGES THAT SHE FACES A PROBLEM OF STAGNANT, FOUL-SMELLING WATER COMING FROM THE PUBLIC ROAD IN FRONT OF HER HOME IN ESCAZÚ AND THAT THE AUTHORITIES’ ACTIONS HAVE BEEN PARTIAL AND INSUFFICIENT, HARMING AN OLDER ADULT AND A PERSON WITH A DISABILITY. THE AMPARO APPLICATION IS GRANTED IN PART, SOLELY AGAINST THE MUNICIPALIDAD DE ESCAZÚ. CONSEQUENTLY, THE MAYOR OF THE MUNICIPALIDAD DE ESCAZÚ IS ORDERED TO ISSUE THE PERTINENT INSTRUCTIONS AND COORDINATE THE APPROPRIATE ACTIONS, WITHIN THE SCOPE OF HIS AUTHORITY, SO THAT, WITHIN SIX MONTHS OF NOTIFICATION OF THIS JUDGMENT, THE TECHNICAL, ADMINISTRATIVE, AND OPERATIONAL MEASURES NECESSARY TO EFFECTIVELY ADDRESS THE PROBLEM REPORTED BY THE AMPARO APPLICANT REGARDING WATER STAGNATION AND ACCUMULATION NEAR HER HOME ARE ADOPTED AND IMPLEMENTED, SO AS TO ENSURE PROPER STORMWATER DRAINAGE AND ELIMINATE THE REPORTED HEALTH AND ENVIRONMENTAL IMPACTS.

LIKEWISE, WHILE THE PERMANENT MEASURES ARE BEING IMPLEMENTED, HE MUST MAINTAIN AND IMPLEMENT SUCH INTERIM MEASURES AS MAY BE NECESSARY TO MITIGATE THE EFFECTS OF THE PROBLEM AND PREVENT FURTHER HARM TO THE HEALTH, INTEGRITY, AND QUALITY OF LIFE OF THE AMPARO APPLICANT AND THE PERSONS RESIDING AT THE PROPERTY. THE AMPARO APPLICATION IS DENIED WITH RESPECT TO THE MINISTERIO DE SALUD. THE AUTHORITIES OF THE MINISTERIO DE SALUD SHALL TAKE NOTE OF THE PROVISIONS OF REASON VII OF THIS JUDGMENT. VCG10/2026 “(…) VI.- MERITS. In the matter at hand, the amparo applicant complains that, for more than a year, she has faced a persistent problem of stagnant, foul-smelling water coming from the public road in front of her home in Escazú, a situation that causes flooding, mosquito proliferation, foul odors, health risks, and difficulties accessing the property, particularly considering that persons in especially vulnerable circumstances live in the household, including her 83-year-old mother and her daughter, who has a severe disability.

She maintains that, despite the multiple requests and complaints submitted to the Municipalidad de Escazú and the Ministerio de Salud, the authorities have not adopted effective measures to resolve the problem permanently, limiting themselves to partial and insufficient actions.

In this regard, the respondent authorities state in their reports submitted under oath—with due warning of the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—that they have taken various actions aimed at addressing the reported situation. In particular, the Municipalidad de Escazú states that it has conducted on-site inspections, cleaned drainage channels and storm drains, periodically pumped out accumulated water, constructed a sidewalk providing access to the amparo applicant’s home, and performed technical assessments of the stormwater drainage system. For its part, the Ministerio de Salud reports that it processed the complaint submitted by the person protected by the amparo (amparada), conducted health inspections and traceability tests, issued technical reports and health orders directed to the persons identified as responsible for some of the detected discharges, and has kept the corresponding administrative file active.

The established facts show that the problem reported by the amparo applicant has persisted for a prolonged period and that, as of the filing of this amparo application, it had not been permanently resolved. Although the municipal authorities have taken various steps to address the situation, those actions have not been sufficient to effectively remedy the reported conditions, which continue to adversely affect the amparo applicant and her family. Indeed, the municipality itself acknowledges that a permanent solution for the stormwater drainage system is still undergoing technical assessment.

Consequently, this Chamber finds that the response provided by the Municipalidad de Escazú has been neither effective nor timely in comprehensively resolving the problem presented, thereby violating the amparo applicant’s fundamental rights, particularly her rights to health, a healthy and ecologically balanced environment, and an adequate quality of life. The appropriate disposition is therefore to grant the amparo application in part against the Municipalidad de Escazú, under the terms to be stated in the operative portion of this judgment.

VII.With respect to the Ministerio de Salud, the evidence in the record establishes that this authority has continuously exercised its health-monitoring and oversight powers by conducting inspections and traceability tests, issuing technical reports and health orders, and monitoring compliance with those orders within the corresponding administrative file. Accordingly, no omission warranting the granting of the amparo application against it has been established.

Nevertheless, given that the reported problem has not yet been permanently remedied and in view of the powers assigned to those authorities by the legal system concerning the protection of public health, they shall take note and are urged to continue monitoring administrative file N° 065-26 and overseeing compliance with the health orders issued, as well as to adopt the appropriate measures within the scope of their authority in an effort to remedy the health conditions detected. Consequently, the amparo application is denied with respect to the Ministerio de Salud. (…)”

036873-26. AMBIENTE. ACUSA QUE ENFRENTA UNA PROBLEMÁTICA DE AGUAS ESTANCADAS Y MALOLIENTES PROVIENIENTES DE LA VÍA PÚBLICA FRENTE A SU CASA EN ESCAZÚ Y QUE LAS ACTUACIONES DE LAS AUTORIDADES HAN SIDO PARCIALES E INSUFICIENTES, LO QUE PERJUDICA A UNA PERSONA ADULTA MAYOR Y UNA PERSONA CON DISCAPACIDAD. SE DECLARA PARCIALMENTE CON LUGAR EL RECURSO, ÚNICAMENTE CONTRA LA MUNICIPALIDAD DE ESCAZÚ. EN CONSECUENCIA, SE ORDENA AL ALCALDE DE LA MUNICIPALIDAD DE ESCAZÚ, QUE GIRE LAS INSTRUCCIONES PERTINENTES Y COORDINE LO CORRESPONDIENTE, DENTRO DEL ÁMBITO DE SUS COMPETENCIAS, PARA QUE, DENTRO DEL PLAZO DE SEIS MESES, CONTADO A PARTIR DE LA NOTIFICACIÓN DE ESTA SENTENCIA, SE ADOPTEN Y EJECUTEN LAS MEDIDAS TÉCNICAS, ADMINISTRATIVAS Y OPERATIVAS NECESARIAS PARA ATENDER DE MANERA EFECTIVA LA PROBLEMÁTICA DENUNCIADA POR LA RECURRENTE RELACIONADA CON EL ESTANCAMIENTO Y ACUMULACIÓN DE AGUAS EN LAS INMEDIACIONES DE SU VIVIENDA, DE MANERA QUE SE GARANTICE LA ADECUADA EVACUACIÓN DE LAS AGUAS PLUVIALES Y SE ELIMINEN LAS AFECTACIONES SANITARIAS Y AMBIENTALES DENUNCIADAS.

ASIMISMO, MIENTRAS SE EJECUTAN LAS ACCIONES DEFINITIVAS, DEBERÁ MANTENER E IMPLEMENTAR LAS MEDIDAS PROVISIONALES QUE RESULTEN NECESARIAS PARA MITIGAR LOS EFECTOS DE LA PROBLEMÁTICA Y EVITAR MAYORES AFECTACIONES A LA SALUD, INTEGRIDAD Y CALIDAD DE VIDA DE LA RECURRENTE Y DE LAS PERSONAS QUE HABITAN EL INMUEBLE. SE DECLARA SIN LUGAR EL RECURSO RESPECTO DEL MINISTERIO DE SALUD. TOMEN NOTA LAS AUTORIDADES DEL MINISTERIO DE SALUD DE LO DISPUESTO EN EL CONSIDERANDO VII DE ESTA SENTENCIA. VCG10/2026 “(…)
