SummaryResumen
The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding because of delays by the Tribunal Ambiental Administrativo in processing and deciding complaints concerning alleged harm to natural resources and activities subject to environmental oversight. It held that the claim was not governed by the ten-day deadline applicable to the right of petition because the matters required investigation, evidence, and, where appropriate, adversarial proceedings. The controlling standard was the right to prompt and effective justice under Article 41 of the Constitution, read together with the environmental protection guaranteed by Article 50. The Chamber did not determine whether environmental damage occurred, whether the reported persons were liable, or whether any activity required environmental feasibility approval. It ordered immediate action in files 019-25-01-TAA, 262-24-01-TAA, and 171-25-03-TAA, with final decisions within six months. For file 243-04-02-TAA, it ordered that the hearing occur no later than 5 November 2026 and that a final decision be issued within the following two months. It also granted relief regarding file 066-22-03-TAA to the extent provided by Article 52 of the Ley de la Jurisdicción Constitucional.
Key excerptExtracto clave
The claim does not seek preexisting information or an answer to a simple petition. It seeks the completion of investigations that require evidentiary activity and, where appropriate, adversarial proceedings. The central standard is therefore Article 41 of the Constitution, in connection with Article 50, rather than the ten-day period established for the right of petition in Article 32 of the Ley de la Jurisdicción Constitucional. The environmental dimension of the claim prevents it from being reduced to an ordinary dispute over administrative deadlines: delay may undermine the effectiveness of natural-resource protection. The constitutional analysis is limited to determining whether the authority processed and decided the complaints within a reasonable time. It is not appropriate here to establish the liability of the reported persons, declare that environmental damage exists, or decide whether each activity required environmental feasibility approval. Those matters must be resolved through the competent proceedings, with respect for the right of defense.

036732-26. THE APPLICANT ALLEGES THAT THE TRIBUNAL AMBIENTAL ADMINISTRATIVO HAS LEFT SEVERAL CASE FILES CONCERNING COMPLAINTS OF ALLEGED HARM TO NATURAL RESOURCES AND ACTIVITIES SUBJECT TO ENVIRONMENTAL OVERSIGHT UNRESOLVED. THE AMPARO APPLICATION IS PARTIALLY GRANTED. THE PRESIDENT OF THE TRIBUNAL AMBIENTAL ADMINISTRATIVO, AND THE VICE PRESIDENT AND HEAD OF GROUP 03, BOTH OF THE TRIBUNAL AMBIENTAL ADMINISTRATIVO, ARE ORDERED TO ISSUE THE APPROPRIATE INSTRUCTIONS, SECURE THE NECESSARY AGREEMENTS, AND CARRY OUT THE ACTIONS WITHIN THEIR POWERS SO THAT THE PROCESSING OF CASE FILES 019-25-01-TAA, 262-24-01-TAA, AND 171-25-03-TAA PROCEEDS IMMEDIATELY; THE OUTSTANDING REPORTS ARE OBTAINED THROUGH EFFECTIVE COORDINATION AND FOLLOW-UP; AND THE LEGALLY APPROPRIATE FINAL DECISION IN EACH CASE IS ISSUED AND COMMUNICATED WITHIN SIX MONTHS FROM NOTICE OF THIS JUDGMENT. WITH RESPECT TO CASE FILE 243-04-02-TAA, THEY SHALL TAKE THE ACTIONS WITHIN THEIR POWERS SO THAT THE SCHEDULED HEARING IS HELD ON 5 NOVEMBER 2026, UNLESS IT HAS BEEN HELD EARLIER, AND THE FINAL DECISION IS ISSUED AND COMMUNICATED WITHIN TWO MONTHS FROM THE DATE OF THAT HEARING.
RGS09/2026 “(…) The amparo applicant alleges that the Tribunal Ambiental Administrativo has left case files 019-25-01-TAA, 066-22-03-TAA, 262-24-01-TAA, 171-25-03-TAA, 172-25-01-TAA, 222-14-03-TAA, and 243-04-02-TAA, concerning complaints of alleged harm to natural resources and activities subject to environmental oversight, without a final decision… (…)” “(…) The relief sought does not consist of obtaining preexisting information or a response to a straightforward request. The applicant seeks the completion of investigations that require the taking of evidence and, where appropriate, adversarial proceedings. Therefore, the principal standard is Article 41 of the Constitution, in conjunction with Article 50, rather than the ten-day period governing the right of petition under Article 32 of the Ley de la Jurisdicción Constitucional. The environmental dimension of the claim prevents its reduction to an ordinary dispute over administrative deadlines: the delay may undermine the effectiveness of the protection of natural resources.
The constitutional analysis is limited to determining whether the authority processed and resolved the complaints within a reasonable period. It is not appropriate here to determine the liability of the persons against whom the complaints were filed, declare that environmental damage exists, or decide whether each activity required environmental approval (viabilidad ambiental). Those matters must be determined in the competent proceedings, with due respect for the right of defense. (…)” “(…) The references to amparo proceedings N° 25-010935-0007-CO and N° 25-027496-0007-CO are not, by themselves, sufficient to establish that their subject matter is identical to the entirety of the delay examined here. The analysis of this issue concerns the prolongation of the investigations reflected in the current reports, particularly the periods following the steps taken in November and December 2025; it does not review what was decided in those proceedings.
Accordingly, the amparo application must be granted on these three issues. The Tribunal must take the necessary steps to advance and coordinate the proceedings, complete the investigation, and issue and communicate the legally appropriate decision within a maximum period of six months. This period reflects the need to obtain specialized input and, where appropriate, bring charges and hold a hearing. Preparatory steps must begin immediately and may not be deferred until that period expires. (…)” “(…) The supervening nullity declared in September 2026 and the new statement of charges constitute acts advancing the case file. They are not equivalent to the issuance of a final decision and do not eliminate the delay that had already occurred. The duty to preserve the validity of the proceeding must be fulfilled in a timely manner; otherwise, each procedural correction would operate as a new starting point that would make it impossible to review the duration of the administrative action.
Nor does the date on which the applicant joined the proceeding alter the length of time for which a complaint related to environmental protection has remained unresolved. The protected interest extends beyond his individual position as an intervening supporting party (coadyuvante). The violation arises from the absence of a timely administrative determination, and establishing that violation does not require the alleged harm attributed to the persons against whom the complaints were filed to be treated as proven.
Consequently, this issue must be granted, and the hearing scheduled for 5 November 2026 must be held, unless it has been held earlier, and the final decision must be issued and communicated within one month following the hearing, with due respect for due process. The new hearing notice does not, by itself, satisfy the object of the amparo application; therefore, there has not been a complete cessation of the conduct that would make Article 52 of the Ley de la Jurisdicción Constitucional applicable. (…)” “(…) The amparo application must be partially granted because of the delays established in case files 019-25-01-TAA, 262-24-01-TAA, 171-25-03-TAA, and 243-04-02-TAA, as well as with respect to 066-22-03-TAA to the extent provided in Article 52 of the Ley de la Jurisdicción Constitucional. The orders are directed to those who exercise responsibility for presiding over and managing the matters, so that they act within the scope of their powers and secure any necessary agreements of the collegial body. The ruling granting relief concerns the duty to process and resolve the matters in a timely manner. It does not require the complaints to be upheld, a particular sanction to be imposed, or indispensable evidence to be dispensed with. (…)”
036732-26. ACUSA QUE EL TRIBUNAL AMBIENTAL ADMINISTRATIVO MANTIENE SIN RESOLUCIÓN VARIOS EXPEDIENTES RELATIVOS A DENUNCIAS POR SUPUESTAS AFECTACIONES A RECURSOS NATURALES Y ACTIVIDADES SOMETIDAS A CONTROL AMBIENTAL. SE DECLARA PARCIALMENTE CON LUGAR EL RECURSO. SE ORDENA A LA PRESIDENTA DEL TRIBUNAL AMBIENTAL ADMINISTRATIVO, Y LA VICEPRESIDENTA Y ENCARGADA DEL GRUPO 03, AMBAS DEL TRIBUNAL AMBIENTAL ADMINISTRATIVO, QUE GIREN LAS ÓRDENES PERTINENTES, PROMUEVAN LOS ACUERDOS NECESARIOS Y LLEVEN A CABO LAS ACTUACIONES COMPRENDIDAS DENTRO DE SUS COMPETENCIAS PARA QUE, DE FORMA INMEDIATA, SE IMPULSE LA TRAMITACIÓN DE LOS EXPEDIENTES 019-25-01-TAA, 262-24-01-TAA Y 171-25-03-TAA, SE PROCURE MEDIANTE COORDINACIÓN Y SEGUIMIENTO EFECTIVO LA OBTENCIÓN DE LOS INFORMES PENDIENTES Y SE DICTE Y COMUNIQUE LA RESOLUCIÓN DEFINITIVA QUE EN DERECHO CORRESPONDA EN CADA UNO DE ELLOS, DENTRO DEL PLAZO DE SEIS MESES, CONTADO A PARTIR DE LA NOTIFICACIÓN DE ESTA SENTENCIA.
EN CUANTO AL EXPEDIENTE 243-04-02-TAA, DEBERÁN REALIZARSE LAS ACTUACIONES DENTRO DE SUS COMPETENCIAS PARA QUE LA AUDIENCIA AGENDADA SE CELEBRE EL 5 DE NOVIEMBRE DE 2026, SI NO SE HUBIERE CELEBRADO ANTES, Y SE DICTE Y COMUNIQUE LA RESOLUCIÓN DEFINITIVA DENTRO DEL PLAZO DE DOS MESES, CONTADO A PARTIR DE LA CELEBRACIÓN DE DICHA AUDIENCIA. RGS09/2026 “(…)
