SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo proceeding concerning the failure to decide an incidente de nulidad, a request to annul an administrative act, filed against Resolution No. 682-2018-SETENA, which had granted environmental viability to a condominium project processed under file D1-18944-2016-SETENA. The respondent authority argued that it could not address the request while the original physical file remained with the Minister’s office for decisions on related proceedings and that, after its return on 20 August 2026, the procedure had advanced through notices, hearings, and technical reports. The Chamber nevertheless found that SETENA had not acted to secure a timely decision on the pending matter or the return of the file. It also found no evidence substantiating the reported procedural activity and no probable date for a decision. It therefore ordered SETENA’s Director General to arrange and coordinate the necessary measures so that the annulment proceeding is decided and the parties are notified within one month after notice of the judgment.

In this regard, notwithstanding the respondent authority’s assertion that the Technical Secretariat had been unable to address the request filed, the fact remains that, although the proceeding was brought more than three months before the appeal was decided, SETENA did nothing to have that superior authority decide the pending matter and return the physical file so that SETENA could rule on the request whose lack of resolution is challenged. In addition, although it is reported that the Secretariat is processing the proceeding through the legally required notice, hearings, and technical reports, there is no evidentiary basis substantiating that assertion, nor is there even a probable date on which the delayed request will be decided. Accordingly, the Chamber finds that the alleged violation exists. On that basis, the amparo must be granted, as set forth below.

"The amparo applicants state that, in mid-March of the current year, an annulment proceeding was filed against National Environmental Technical Secretariat Resolution No. 682-2018-SETENA, issued at 7:00 a.m. on 17 April 2018, which granted environmental viability to the project processed under administrative file D1-18944-2016-SETENA; however, three and a half months later, no final decision had been issued on that request, which they consider contrary to their fundamental rights."

036651-26. THE AMPARO APPLICANTS ALLEGE THAT THEY FILED A MOTION FOR NULLITY (INCIDENTE DE NULIDAD) AGAINST THE SETENA DECISION THAT GRANTED ENVIRONMENTAL VIABILITY TO A CONDOMINIUM PROJECT, AND NO DECISION HAS YET BEEN ISSUED. THE AMPARO APPLICATION IS GRANTED. THE DIRECTOR GENERAL OF THE SECRETARÍA TÉCNICA NACIONAL AMBIENTAL IS ORDERED TO MAKE AND COORDINATE THE NECESSARY ARRANGEMENTS SO THAT, WITHIN ONE MONTH OF SERVICE OF THIS JUDGMENT, THE MOTION FOR NULLITY FILED BY THE AMPARO APPLICANTS IS DECIDED AND THE PARTIES ARE NOTIFIED. RGS09/2026 “(…) The amparo applicants state that, in mid-March of this year, a motion for nullity was filed against Secretaría Técnica Nacional Ambiental Decision No. 682-2018-SETENA, issued at 7:00 a.m. on 17 April 2018, which granted environmental viability to the project being processed under administrative file number D1-18944-2016-SETENA; however, three and a half months later, no final decision has been issued on that application, which they consider contrary to their fundamental rights.
(…)” “(…) According to the respondent authority, while the original physical file had been transmitted to the Minister’s Office to determine the finality and validity of interlocutory and oversight acts issued in the same file, no administrative delay could be attributed to it, because a material impediment made it impossible to consider the application submitted by the amparo applicants. Consequently, because the file was returned on 20 August 2026, after the head of the institution ruled on the motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) filed against the decision concerning the complaint lodged by the same applicants, the period for SETENA to take the challenged action regarding nullity runs from that date. The institution is conducting the procedural steps—statutory notice, hearings, and technical reports—within a reasonable period, demonstrating that the matter is being continuously advanced procedurally, which categorically disproves the existence of the alleged constitutional harm.
In this regard, notwithstanding the respondent authority’s contention that the Secretaría Técnica was unable to consider the application submitted, the fact remains that, although the motion was filed more than three months before the appeal was decided, SETENA took no steps to have that head of the institution decide that procedural matter and return the physical file so that it could rule on the application whose lack of resolution is challenged. In addition, although it is reported that the Secretaría is conducting the procedural steps—statutory notice, hearings, and technical reports—not only is there no evidence substantiating that assertion, but there is not even a probable date by which the application alleged to have been delayed will be decided. Accordingly, the Chamber finds that the alleged violation occurred. On this understanding, the amparo application must be granted, as set forth below. (…)”
036651-26. ACUSA QUE PLANTEÓ UN INCIDENTE DE NULIDAD CONTRA LA RESOLUCIÓN DE SETENA QUE OTORGÓ VIABILIDAD A UN PROYECTO DE CONDOMINIO Y AÚN NO EXISTE PRONUNCIAMIENTO. SE DECLARA CON LUGAR EL RECURSO. SE ORDENA AL DIRECTOR GENERAL DE LA SECRETARÍA TÉCNICA NACIONAL AMBIENTAL, QUE DISPONGA Y COORDINE LO NECESARIO A EFECTO QUE EN EL PLAZO DE UN MES, CONTADO A PARTIR DE LA NOTIFICACIÓN DE ESTA SENTENCIA, SE RESUELVA EL INCIDENTE DE NULIDAD PLANTEADO POR LOS RECURRENTES Y SE NOTIFIQUE A LAS PARTES. RGS09/2026 “(…)
