SummaryResumen

The Constitutional Chamber (Sala Constitucional) granted an amparo proceeding filed in defense of the collective public interest and the diffuse interests of residents of the San Francisco neighborhood in Belén, Carrillo. The applicant alleged that a road segment beside the Génesis supermarket and the sports field lacked stormwater drainage, causing flooding and road deterioration during the rainy season, affecting vulnerable populations, and obstructing the movement of police and Costa Rican Red Cross vehicles. The Municipality reported that it had declared a procurement procedure unsuccessful because the proposed solution contained technical deficiencies and had returned the project to preliminary studies. It also stated that hydrological designs were being prepared and that an extension of the relevant agreement was being processed before INDER. The Chamber found that the problem remained unresolved, to the evident detriment of local residents, and ordered the necessary measures within municipal authority to resolve it within six months after notification of the judgment.

036638-26. ALLEGES THAT THE RESIDENTS OF BARRIO SAN FRANCISCO, BELÉN, CARRILLO, ARE AFFECTED BY A ROAD SECTION LOCATED BESIDE THE SPORTS FIELD THAT LACKS STORMWATER DRAINAGE (CANALIZACIÓN PLUVIAL), CAUSING THE STREET TO DETERIORATE DURING THE RAINY SEASON. GRANTED, ORDERING THE DIRECTOR OF MUNICIPAL ENGINEERING AND SERVICES, BOTH OF THE MUNICIPALIDAD DE CARILLO, TO TAKE THE NECESSARY STEPS WITHIN THE SCOPE OF THEIR AUTHORITY SO THAT, WITHIN SIX MONTHS OF NOTICE OF THIS JUDGMENT, THE SITUATION RAISED BY THE AMPARO APPLICANT IS RESOLVED. RGS09/2026

“(...) The amparo applicant explained that he files this amparo proceeding in defense of the collective public interest and diffuse interests on behalf of all the residents of Barrio San Francisco, Belén, Carrillo (...) He stated that in that neighborhood, specifically along the road section next to Súper Génesis and beside the sports field, there is no stormwater drainage, which has caused the street to deteriorate, especially during the rainy season. He adds that particularly vulnerable populations live in and travel through that community (...) He states that the flooded road obstructs the operations of the police station and the movement of Costa Rican Red Cross vehicles. (...)”
“(...) Based on the review conducted and taking into consideration the applicable provisions of the Ley General de Contratación Pública, it was concluded that, from a technical and planning standpoint, it would be more appropriate first to develop the project’s final designs and, once they had been obtained, proceed with the corresponding procurement process for construction of the works. Although the bidding process had been conducted, it was decided to declare the process unsuccessful and return to the preliminary studies, as required by law. This was because, as concluded, the project put out to bid would not fulfill its intended purpose, since it contained a series of technical deficiencies: according to a diagram that may be seen in the annex, the water channeled through the storm sewer system included in the bid would pass beneath the channel of Río Belén, where the stormwater would purportedly be discharged. This situation is entirely unacceptable for a project of such magnitude. Because the elevations did not work, it was decided to retain the company Cacisa, which is currently preparing the hydrological designs needed to produce construction plans for a viable and genuine solution to the stormwater problem in the aforementioned locality. The change in the procurement strategy is attributable to the need to strengthen the project’s planning and design stage, with a view to obtaining an adequate technical definition of the required works before beginning their execution. This measure also makes it possible to reduce the risks associated with potential contract modifications, addenda, and change orders, as well as to promote more efficient and responsible use of the public resources allocated to the project. In view of the foregoing, the Municipalidad de Carrillo requested from the Instituto de Desarrollo Rural (INDER) an addendum extending the performance period under the agreement entered into by the two institutions, in order to obtain the time necessary to complete the stages required for execution of the project. That request is currently being processed by INDER. Once the corresponding extension has been formalized, the Municipality will take the necessary steps to initiate the procurement process for design services, for the purpose of obtaining the final plans and other technical documents required for the project. Subsequently, based on those designs, the procurement procedure will be undertaken for construction of the road network and storm sewer system improvements.

It follows from the established facts that the problem identified by the amparo applicant has indeed not been resolved, to the evident detriment of the residents. Accordingly, the amparo application must be granted. (...)”

036638-26. ACUSA QUE LOS VECINOS DE BARRIO SAN FRANCISCO, BELÉN CARRILLO SE VEN AFECTADOS POR UN TRAMO VIAL UBICADO A UN LADO DE LA PLAZA DE DEPORTES, EL CUAL NO CUENTA CON CANALIZACIÓN PLUVIAL, LO QUE PROVOCA DETERIORO DE LA CALLE EN EPOCA LLUVIOSA. CON LUGAR ORDENANDO AL DIRECTOR DE INGENIERÍA Y SERVICIOS MUNICIPALES, AMBOS DE LA MUNICIPALIDAD DE CARILLO, QUE REALICEN LAS GESTIONES NECESARIAS EN EL ÁMBITO DE SUS COMPETENCIAS, PARA QUE EN EL PLAZO DE SEIS MESES CONTADOS A PARTIR DE LA NOTIFICACIÓN DE ESTA SENTENCIA, SE RESUELVA LA SITUACIÓN PLANTEADA POR EL RECURRENTE. RGS09/2026 “(…)
