The Chamber granted the amparo and ordered the mayor of Goicoechea to determine within one month whether illegal structures exist in the La Cangreja River protection area and, if confirmed, to design a response plan within three months, with a dissent that would assign enforcement to the Tribunal Contencioso Administrativo y Civil de Hacienda.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo application concerning the municipality’s failure to resolve complaints about construction in the protection area of the La Cangreja River. It ordered the mayor of Goicoechea to coordinate the necessary action, adopt appropriate measures, and issue the corresponding directives to determine, within one month after service of the judgment, whether illegal structures exist in the protected area. If their existence is confirmed, the mayor must design, within three months after service, a plan addressing the alleged unlawful encroachment. Justice Garro Vargas dissented only regarding enforcement. Given the technical complexity of the orders and the monitoring tools available under administrative-litigation procedure, she considered that enforcement should be assigned to the Enforcement Area of the Tribunal Contencioso Administrativo y Civil de Hacienda, pursuant to Article 56 of the Ley de la Jurisdicción Constitucional. Her separate opinion did not alter the majority’s disposition granting amparo or the substantive municipal duties imposed.

036726-26. THE AMPARO APPLICANT ALLEGES THAT THE RESPONDENT MUNICIPALITY HAS BEEN NOTIFIED OF CONSTRUCTION WITHIN THE PROTECTION AREA OF THE RÍO LA CANGREJA; HOWEVER, IT HAS NOT RESOLVED THE PROBLEM. THE AMPARO APPLICATION IS GRANTED. THE MAYOR OF GOICOECHEA IS ORDERED TO COORDINATE AS NECESSARY, TAKE APPROPRIATE MEASURES, AND ISSUE THE RELEVANT ORDERS WITHIN THE SCOPE OF HIS AUTHORITY SO THAT, WITHIN A MAXIMUM PERIOD OF ONE MONTH FROM NOTICE OF THIS JUDGMENT, IT IS DETERMINED WHETHER ANY ILLEGAL CONSTRUCTION EXISTS WITHIN THE PROTECTION AREA OF THE RÍO LA CANGREJA. FURTHERMORE, IF SO, WITHIN A MAXIMUM PERIOD OF THREE MONTHS FROM NOTICE OF THIS RULING, HE SHALL DESIGN A PLAN TO ADDRESS THE PROBLEM ALLEGED BY THE AMPARO APPLICANT REGARDING THE UNLAWFUL ENCROACHMENT UPON THE PROTECTED AREA OF THE RÍO LA CANGREJA. RGS09/2026 “(…) DISSENTING OPINION OF JUSTICE GARRO VARGAS REGARDING ENFORCEMENT OF THE JUDGMENT.
I dissent with respect to enforcement of the judgment and would order that, pursuant to Art. 56 of the Ley de la Jurisdicción Constitucional (LJC), enforcement be assigned to the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda.
Enforcement of the orders issued by the Constitutional Chamber (Sala Constitucional) must, in principle, be supervised by this same jurisdiction. However, that provision establishes exceptions under which, as determined by this Court, enforcement of the judgment may be assigned to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa):
“Art. 56. The Constitutional Chamber shall be responsible for enforcing judgments, except with respect to the assessment and payment of damages and monetary liabilities, or with respect to other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure prescribed by the law governing that jurisdiction.” (Emphasis not in the original).
It should be recalled that the bill debated prior to enactment of the LJC originally provided as follows:
“Art. 56. Judgments favorable to the amparo applicant shall be enforced through administrative-litigation proceedings under the judgment-enforcement procedure prescribed by the law governing that jurisdiction.” (Emphasis not in the original).
However, the text was amended by motion so that the provision would be consistent with Art. 153 of the Constitución Política, and the following explanation was provided:
“THE SECRETARY:
Motion No. 68 (32-19) by Deputy Chacón Jiménez:
‘Article 57 (formerly 56): that the text read as follows: “the Constitutional Chamber shall be responsible for enforcing judgments, except with respect to the assessment and payment of damages or monetary liabilities, or with respect to other matters that the Chamber itself deems appropriate, in which case enforcement shall take place through administrative-litigation proceedings under the judgment-enforcement procedure prescribed by the law governing that jurisdiction”.’ THE PRESIDENT:
Is the motion as read open for discussion?
Dr. Piza Escalante:
There was a contradiction here with the general principle that courts enforce their own judgments, because it referred all enforcement to the Administrative-Litigation Jurisdiction; the other articles authorizing the Chamber to enforce them were therefore left unsupported.
Deputy Corrales Bolaños:
That part says: ‘or with respect to other matters that the Chamber itself deems appropriate...’; what does that refer to?
Dr. Piza Escalante:
The idea is that the Chamber, during judgment-enforcement proceedings, will decide those matters that it considers fall within its purview. It refers everything else to administrative-litigation proceedings.
THE SECRETARY:
Is the motion considered to have been sufficiently debated?
THE PRESIDENT:
Debate concluded. Approved (unanimously, with five deputies present).” (sic). See the records approving the LJC. Emphasis not in the original).
It is clear from the foregoing that the LJC itself authorizes this Chamber to assess and decide whether all or some matters relating to enforcement of the judgment must be referred to the administrative-litigation jurisdiction.
In this specific case, given the nature of the orders being issued by this Court, I consider it appropriate to assign the enforcement phase of the matter to the administrative-litigation jurisdiction. This is because the legislation governing this constitutional jurisdiction does not provide suitable mechanisms for monitoring compliance with the orders set forth in this judgment, which involve highly complex technical matters.
By contrast, the provisions of the Código Procesal Contencioso-Administrativo governing enforcement (Art. 155 et seq.) offer clear advantages, such as the ability to require timetables, impose fines, determine liability, supervise stages of compliance, and so forth. Accordingly, pursuant to Art. 56 of the LJC, I consider that the enforcement phase should be conducted before the Enforcement Division of the Tribunal Contencioso Administrativo y Civil de Hacienda, under the judgment-enforcement rules established in that Code. RGS09/2026 “(…)
