OutcomeResultado
The mayor of Goicoechea was ordered to determine within one month whether illegal structures exist in the La Cangreja River protection area and, if confirmed, to design within three months a plan addressing the unlawful encroachment.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo application because the Municipality of Goicoechea failed to demonstrate diligent action to determine which structures lie within the protection area of the La Cangreja River and to distinguish structures apparently predating Forestry Law No. 4465 of 1969 from later expansions, reconstructions, modifications, or new buildings subject to the applicable rules. Aerial images from 1963 and 1965 indicated that structures already existed within ten meters of the bank, but this historical information neither automatically proved their legality nor conferred absolute immunity from administrative action. The Chamber ordered the mayor of Goicoechea to coordinate the necessary measures and determine, within one month of notification, whether illegal structures exist in the protected area. If they do, the mayor must design, within three months of notification, a plan addressing the alleged unlawful encroachment on the protected area.
Key excerptExtracto clave
“(…) Accordingly, although the respondent local government considers that there are structures within 10 meters of the aforementioned stream and that the setback area prescribed by the Forestry Law would not apply to them because they were built before that Law entered into force, it has not been established that all buildings at the site are in the same circumstances. In this regard, the explanation provided by the mayor of Goicoechea is significant: ‘The historical information is not invoked as automatic proof of the legality of the structures or as a source of absolute immunity from all administrative action. (…)’ “(…) Thus, the Court does not consider it established that the Municipality of Goicoechea acted diligently to distinguish structures within the protection area of the La Cangreja River that were built before the Forestry Law entered into force from those built afterward in violation of the applicable rules. The amparo application must therefore be granted as specified in the operative portion of this matter. (…)”“(…) (…)”

036726-26. THE AMPARO APPLICANT ALLEGES THAT THE RESPONDENT MUNICIPALITY HAS BEEN NOTIFIED OF CONSTRUCTION WITHIN THE PROTECTION ZONE (ÁREA DE PROTECCIÓN) OF THE RÍO LA CANGREJA; HOWEVER, IT HAS NOT RESOLVED THE PROBLEM. THE AMPARO APPLICATION IS GRANTED. THE MAYOR OF GOICOECHEA IS ORDERED TO UNDERTAKE THE NECESSARY COORDINATION, ADOPT THE APPROPRIATE MEASURES, AND ISSUE THE RELEVANT ORDERS WITHIN THE SCOPE OF HIS AUTHORITY SO THAT, WITHIN A MAXIMUM PERIOD OF ONE MONTH FROM NOTICE OF THIS JUDGMENT, IT IS DETERMINED WHETHER ANY ILLEGAL STRUCTURES ARE LOCATED WITHIN THE PROTECTION ZONE OF THE RÍO LA CANGREJA. FURTHERMORE, IF SO, WITHIN A MAXIMUM PERIOD OF THREE MONTHS FROM NOTICE OF THIS RULING, HE SHALL DESIGN A PLAN TO ADDRESS THE PROBLEM ALLEGED BY THE AMPARO APPLICANT REGARDING THE UNLAWFUL ENCROACHMENT UPON THE PROTECTED ZONE OF THE RÍO LA CANGREJA. RGS09/2026 “(…) The amparo applicant states that the Municipality of Goicoechea has acknowledged the existence of structures within the protection zone of the Río La Cangreja.
He explains that several residents have requested that the local government ensure compliance with the aforementioned protection zone; nevertheless, no action has been taken to ensure that the area remains free of structures. He alleges that the municipal authority purportedly sent an official communication to SINAC, but the structures encroaching upon the protection zone remain. He requests that the Municipality of Goicoechea be ordered to take the appropriate steps to ensure that there are no structures within the protected area. (…)” “(…) In accordance with the inquiries made to the Instituto Geográfico Nacional (IGN), access was obtained to aerial images taken in 1963 and 1965 of the Quebrada Cangrejos area. These images reveal that, in those years, structures already existed less than 10 meters from the bank of Quebrada Cangrejos, demonstrating that this situation had become established before the enactment of Ley Forestal number 4465 of 1969.
(…)” “(…) The historical information is not invoked as automatic proof of the legality of the structures or as a source of absolute immunity from all administrative action. Its relevance lies in the fact that it precluded treating all the works as recent construction and required a distinction between structures apparently in existence before 1969 and any extensions, reconstructions, modifications, or new buildings undertaken thereafter. (…)” “(…) Accordingly, although it is apparent that the respondent local government considers that there are structures less than 10 meters from the aforementioned stream and that the setback (área de retiro) established in Ley Forestal would not apply to them because they were built before it entered into force, it is nonetheless true that it has not been established that all buildings at the site are in the same circumstances. In this regard, the explanation provided by the mayor of Goicoechea is important, namely: ‘The historical information is not invoked as automatic proof of the legality of the structures or as a source of absolute immunity from all administrative action.
(…)’” “(…) Thus, the Court does not find it established that the Municipality of Goicoechea acted diligently to distinguish between structures located within the protection zone of the Río La Cangreja that were built before Ley Forestal entered into force and those built thereafter in violation of the applicable regulations. The amparo application must therefore be granted, as stated in the operative portion of this matter. (…)”
036726-26. ACUSA QUE SE HA DENUNCIADO A LA MUNICIPALIDAD RECURRIDA SOBRE CONSTRUCCIONES EN EL AREA DE PROTECCIÓN DEL RIO LA CANGREJA; SIN EMBARGO, NO HAN SOLUCIONADO EL PROBLEMA. SE DECLARA CON LUGAR EL RECURSO. SE LE ORDENA AL ALCALDE DE GOICOECHEA, COORDINAR LO NECESARIO, TOMAR LAS MEDIDAS ADECUADAS Y GIRAR LAS ÓRDENES QUE CORRESPONDAN DENTRO DEL ÁMBITO DE SUS COMPETENCIAS, A FIN DE QUE, EN EL PLAZO MÁXIMO DE UN MES, CONTADO A PARTIR DE LA NOTIFICACIÓN DE ESTA SENTENCIA, SE DETERMINE SI EXISTEN CONSTRUCCIONES ILEGALES UBICADAS DENTRO DEL ÁREA DE PROTECCIÓN DEL RÍO LA CANGREJA. ADEMÁS, DE SER ASÍ, EN EL PLAZO MÁXIMO DE TRES MESES, CONTADO A PARTIR DE LA NOTIFICACIÓN DE ESTE PRONUNCIAMIENTO, DISEÑE UN PLAN A FIN DE ATENDER LA PROBLEMÁTICA ACUSADA POR LA PARTE RECURRENTE EN CUANTO A LA INVASIÓN ILEGÍTIMA DE LA ZONA PROTEGIDA DEL RÍO LA CANGREJA. RGS09/2026 “(…)
