SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo proceeding solely against the Ministerio de Salud and the Ministerio de Obras Públicas y Transportes because a complaint filed on 29 April 2026 had not been finally resolved. The complaint concerned the irregular occupation of State-owned property beside the Bernardo Soto highway, allegedly used as a clandestine vehicle depot and causing environmental and public-health risks. The Chamber ordered the heads of both ministries, or whoever holds those offices, to issue the necessary instructions within their respective powers so that the complaint is finally resolved as appropriate within one month after notice of the judgment. In a separate note, Justice Castillo Víquez reiterated his view that, apart from constitutional-law exceptions recognized by the Chamber itself, disputes alleging a violation of the right to prompt and effective administrative justice belong before the judges of the administrative-litigation jurisdiction rather than the Constitutional Chamber.

THE AMPARO PROCEEDING IS GRANTED SOLELY AGAINST THE MINISTERIO DE SALUD AND THE MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES. THE MINISTER OF HEALTH AND THE MINISTER OF PUBLIC WORKS AND TRANSPORTATION, OR WHOEVER HOLDS THOSE OFFICES, ARE ORDERED TO ISSUE THE NECESSARY INSTRUCTIONS WITHIN THE SCOPE OF THEIR POWERS SO THAT THE COMPLAINT FILED BY THE AMPARO APPLICANT ON 29 APRIL 2026 IS FINALLY RESOLVED AS APPROPRIATE, WITHIN ONE MONTH AFTER NOTICE OF THIS JUDGMENT. I have supported this Court’s position that, when a person seeking judicial protection alleges a violation of the right to prompt and effective justice at the administrative level, the legal dispute must be heard by the Administrative-Litigation Courts and not by this Chamber.SE DECLARA CON LUGAR EL RECURSO, ÚNICAMENTE EN CONTRA DEL MINISTERIO DE SALUD Y EL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES.

ALLEGES THAT HE REPORTED THE IRREGULAR OCCUPATION OF STATE-OWNED REAL PROPERTY LOCATED ALONG THE BERNARDO SOTO HIGHWAY, WHICH IS BEING USED AS A CLANDESTINE VEHICLE STORAGE SITE, CREATING ENVIRONMENTAL AND HEALTH RISKS. THE AMPARO APPLICATION IS GRANTED SOLELY AGAINST THE MINISTERIO DE SALUD AND THE MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES. THE MINISTER OF HEALTH AND THE MINISTER OF PUBLIC WORKS AND TRANSPORTATION, OR WHOEVER HOLDS THOSE OFFICES, ARE ORDERED TO ISSUE THE NECESSARY DIRECTIONS WITHIN THE SCOPE OF THEIR AUTHORITY SO THAT THE COMPLAINT FILED BY THE AMPARO APPLICANT ON 29 APRIL 2026 IS FINALLY RESOLVED AS APPROPRIATE WITHIN ONE MONTH OF NOTICE OF THIS JUDGMENT. RGS09/2026 “(…) NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a person seeking judicial relief alleges a violation of the right to prompt and effective justice in administrative proceedings, jurisdiction over the legal dispute lies with the administrative-litigation courts (Tribunales de lo Contencioso-Administrativo), rather than with this Chamber.
However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration’s material conduct, administrative acts, or response is affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must alter its line of precedent, since, pursuant to Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may properly be heard in this jurisdiction through the constitutional protective proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545, issued at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction.
All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, constitutional law (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system. (…)”
