OutcomeResultado
The Chamber ordered the Mayor of Limón to answer, within ten days after notification of the judgment, the information request concerning the Limón Urban Regulatory Plan and the Moín coastal aquifer that the Municipality received and processed despite its submission through an unofficial email address.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo application concerning the failure to answer an information request about the monitoring of case file 25-018602-0007-CO, the Limón Urban Regulatory Plan, and the Moín coastal aquifer. Although the request was sent on 22 June 2026 to the Mayor’s Office email rather than to the municipality’s authorized single-window address, the Municipality admitted that it had received, processed, and learned of the request. Its Engineering Directorate had even issued document DIM-ML-0828-2026, dated 2 September 2026, to address questions about construction blocks, the validity of document DIM-ML-0592-2026, and the plan’s regulations. The Chamber concluded that, by undertaking to process the request, the Administration became bound under Article 27 of the Political Constitution to provide a substantive response within the applicable period. It ordered the Mayor of Limón to answer the request within ten days after notification of the judgment.
Key excerptExtracto clave
In this regard, the Chamber finds it established that, as of that date, no substantive response had been issued to document AL-FPFA-15-OFI-0035-2026, sent on 22 June 2026, because, as explained by the respondent mayor, the amparo applicant sent her request to the Mayor’s Office email address, which is not the formal channel for institutional submissions. Against this background, the amparo must be granted because, consistent with the Chamber’s line of case law in such matters, although the email address to which the interested party sent her petition is not an official channel for receiving such requests, the respondent admitted that it had proceeded to process the request, had knowledge of it upon receipt, and took the corresponding action, including the issuance of a final report by the Engineering Directorate of the respondent municipality to provide the protected person with the requested information. Accordingly, the respondent Administration treated itself as having knowledge of the request and took the corresponding steps to provide the required response, thereby becoming bound under Article 27 of the Political Constitution. Consequently, because the amparo applicant’s right of petition and prompt resolution was not satisfied within the ten-day period, the application must be granted, with the corresponding consequences.

035830-26. ALLEGES THAT SHE REQUESTED INFORMATION REGARDING THE LIMÓN URBAN REGULATORY PLAN AND THE MOÍN COASTAL AQUIFER. THE AMPARO APPLICATION IS GRANTED. THE MAYOR OF LIMÓN IS ORDERED, WITHIN TEN DAYS OF SERVICE OF THIS JUDGMENT, TO RESPOND TO THE REQUEST SUBMITTED BY THE AMPARO APPLICANT THAT IS THE SUBJECT OF THIS AMPARO. RGS09/2026 “(…) The applicant maintains that, on 22 June 2026, she sent official letter AL-FPFA-15-OFI-0035-2026 to the email address alcaldia@municlimon.go.cr of the mayor of the Municipalidad de Limón, requesting information on the follow-up to expediente 25-018602-0007-CO concerning the Limón Urban Regulatory Plan and the Moín coastal aquifer; however, as of this date, she has received no response to her request. (…)” “(…) “Within the framework of the information and knowledge society, fundamental rights may be exercised through new information technologies. As regards the right to petition and receive a prompt response, the use of electronic means introduces new considerations that must be weighed.
While always taking into account their progressive and expanding effectiveness, but also bearing in mind that fundamental rights are not absolute, it may be concluded that, to exercise the right to petition and receive a prompt response using the means facilitated by new technologies, it is important for the request to be submitted through a freely accessible website of the public entity or body. (…)” “(…) “Now, in view of the foregoing and after analyzing the evidence entered into the record, the Chamber considers that the applicant’s complaint in this respect is well-founded because, although the email address to which the interested party sent his request is not an official channel for receiving such submissions, the respondent admitted that it had proceeded to process that request and that, when it received it, it became aware of it (…) (…)” “(…) In this regard, the Chamber finds it established that, as of this date, no substantive response has been issued to official letter AL-FPFA-15-OFI-0035-2026 sent on 22 June 2026.
As explained by the respondent mayor, the applicant sent her request to the Office of the Mayor’s email address, which is not the formal channel for institutional submissions. As publicly stated on the Municipal Corporation’s official website, the only electronic mechanism authorized and established for the formal receipt of users’ submissions and procedures is the address ventanilla.unica@municlimon.go.cr. The respondent mayor herself, however, explains to the Chamber that the respondent Office of the Mayor will immediately issue, sign, and serve the detailed response on Deputy [Name 001]. The final report of the respondent municipality’s Engineering Directorate, issued as Oficio DIM-ML-0828-2026 (dated 2 September 2026), comprehensively answers each question raised concerning the construction restrictions, the continued validity of Oficio DIM-ML-0592-2026, and the regulations under the Regulatory Plan.
That response will be sent as a matter of priority on 2 September 2026 to the email address vianey.mora@asamblea.go.cr. Given these circumstances, the amparo must be granted because, consistent with the Chamber’s line of precedent in these cases, although the email address to which the interested party sent her request is not an official channel for receiving such submissions, the respondent admitted that it had proceeded to process that request and that, when it received it, it became aware of it and took the corresponding action, including the issuance of a final report by the respondent municipality’s Engineering Directorate for the purpose of providing the person protected by the amparo with the requested information. Accordingly, the respondent Administration deemed itself aware of the request and made the corresponding arrangements to provide the requested response, thereby becoming bound under the terms of Article 27 of the Political Constitution.
Consequently, because the applicant’s right to petition and receive a prompt decision was not satisfied within ten days, the appropriate course is to grant the application, with the resulting consequences. (…)”

RGS09/2026 “(…)
