THE AMPARO APPLICATION IS DECLARED PARTIALLY WITH MERIT SOLELY AS TO THE RESPONDING PARTY’S OMISSIONS IN SENDING WATER TANKER TRUCKS OR TAKING OTHER INITIATIVES DURING THE SERVICE INTERRUPTION, AND IN ADEQUATELY INFORMING THE COMMUNITY OF THAT INTERRUPTION. The foregoing is subject to the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs, damages, and losses caused by the acts on which this declaration is based, which shall be quantified in enforcement of judgment in the administrative-litigation jurisdiction. The ASADA de Piedras Negras de Mora is also ordered to pay the costs, damages, and losses caused by the acts on which this declaration is based, which shall be quantified in enforcement of judgment in civil proceedings. In all other respects, the amparo application is dismissed. Notify the parties.”
035629-26. ACUSA QUE EN PIEDRAS NEGRAS DE MORA NO SE OTORGA UN SERVICIO DE AGUA POTABLE CONTINUO, SUFICIENTE Y EFECTIVO YA QUE SON REITERADOS LOS CORTES DEL SERVICIO. SE DECLARA PARCIALMENTE CON LUGAR ÚNICAMENTE POR LAS OMISIONES DE LA PARTE RECURRIDA EN ENVIAR LOS CAMIONES CISTERNA CON AGUA U OTRAS INICIATIVAS, DURANTE LA INTERRUPCIÓN DEL SERVICIO, Y EN COMUNICAR DE FORMA ADECUADA A LA COMUNIDAD DE DICHA INTERRUPCIÓN. Lo anterior, bajo apercibimiento que, de conformidad con lo establecido en el artículo 71, de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo, y no la cumpliere o hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Asimismo, se condena a la ASADA de Piedras Negras de Mora al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo civil.
