035629-26. ALLEGES THAT A CONTINUOUS, SUFFICIENT, AND EFFECTIVE DRINKING WATER SERVICE IS NOT PROVIDED IN PIEDRAS NEGRAS DE MORA, AS SERVICE INTERRUPTIONS ARE REPEATED. THE AMPARO APPLICATION IS DECLARED PARTIALLY WITH MERIT SOLELY ON ACCOUNT OF THE RESPONDING PARTY’S OMISSIONS IN SENDING WATER TANKER TRUCKS OR TAKING OTHER INITIATIVES DURING THE SERVICE INTERRUPTION, AND IN ADEQUATELY NOTIFYING THE COMMUNITY OF THAT INTERRUPTION. THEY ARE ALSO TO ENSURE THAT THE COMMUNITY IS EFFECTIVELY NOTIFIED OF SUCH INTERRUPTIONS. RGS09/2026 “(…) The applicant alleges a violation of the fundamental rights of the amparo beneficiary, stating that she is a resident of Piedras Negras, Mora, San José. However, she alleges that a continuous, sufficient, and effective drinking water service is not provided in that area, as the service is repeatedly interrupted. (…)” “(…) According to the information provided by the president of the Board of Directors of the ASADA de Piedras Negras de Mora, that organization communicates with the owners of the service connections through a WhatsApp group whose members are subscribers who have expressed interest in joining the group. Water rationing schedules are also communicated through this channel. Accordingly, it was not established that the ASADA de Piedras Negras de Mora had effectively notified the community of Piedras Negras de Mora in San José about the water rationing.
Nor was it established that the ASADA de Piedras Negras de Mora or the Instituto Costarricense de Acueductos y Alcantarillados had taken alternative measures to provide users with drinking water on a regular basis while the water rationing was in effect.
In this regard, this Constitutional Chamber, in numerous judgments, has held that the supply of drinking water is a public service and that, as such, any public service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and to adapt to technological changes (see Judgments No. 2001-09676, at 11:25 a.m. on 26 September 2001, and No. 2004-08161, at 10:53 a.m. on 23 July 2004). For that reason, from the time the responding authority learned of the interruption to the water supply for the community in question, it should have sent a tanker truck or used another means to provide water to its residents. The record does not show that it did so, or that it used other means under the “Protocol for responding to events affecting or potentially affecting the quality of the water resource used for public supply.” It is important to remember that water is fundamental to everyone’s daily life; its absence directly affects the health and well-being of citizens.
Therefore, upon learning of an interruption in the water supply, the authorities must seek to resolve the problem so that citizens have at least a temporary solution to mitigate the situation. They are likewise required to adequately notify the community of such interruptions. Again, the record does not show that this was done, since only a few people in a WhatsApp group were notified, and other people in the community were not. Note that, although the ASADA de Piedras Negras de Mora is the authorized operator in that community, the Instituto Costarricense de Acueductos y Alcantarillados must also ensure that the service is properly provided, which did not happen. Accordingly, the responding party’s omissions in sending water tanker trucks or taking other initiatives during the service interruption, or in adequately notifying the community of that interruption, violate the fundamental rights of the amparo beneficiary and the community’s residents.
Consequently, when the rationing period lasts many hours or occurs several times a week, the Instituto must provide other drinking water supply options, whether by distributing water in tanker trucks or by taking other appropriate measures, in order to reduce the affected community’s lack of drinking water as much as possible.
VII.- Conclusion. In light of the foregoing, the amparo application is declared partially with merit solely on account of the responding party’s omissions in sending water tanker trucks or taking other initiatives during the service interruption, and in adequately notifying the community of that interruption. In all other respects, the amparo application is denied. (…)”
035629-26. ACUSA QUE EN PIEDRAS NEGRAS DE MORA NO SE OTORGA UN SERVICIO DE AGUA POTABLE CONTINUO, SUFICIENTE Y EFECTIVO YA QUE SON REITERADOS LOS CORTES DEL SERVICIO. SE DECLARA PARCIALMENTE CON LUGAR ÚNICAMENTE POR LAS OMISIONES DE LA PARTE RECURRIDA EN ENVIAR LOS CAMIONES CISTERNA CON AGUA U OTRAS INICIATIVAS, DURANTE LA INTERRUPCIÓN DEL SERVICIO, Y EN COMUNICAR DE FORMA ADECUADA A LA COMUNIDAD DE DICHA INTERRUPCIÓN. SE ORDENA AL GERENTE GENERAL DEL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, Y AL PRESIDENTE DE LA JUNTA DIRECTIVA DE LA ASADA DE PIEDRAS NEGRAS DE MORA, GIRAR DE INMEDIATO LAS ÓRDENES QUE ESTÉN DENTRO DEL ÁMBITO DE SUS COMPETENCIAS, PARA QUE SE ADOPTEN LAS MEDIDAS NECESARIAS Y EJECUTEN LAS ACCIONES PERTINENTES PARA FACILITAR A LA COMUNIDAD DE PIEDRAS NEGRAS DE MORA OTRAS OPCIONES DE SUMINISTRO DE AGUA POTABLE CUANDO LA SUSPENSIÓN DEL SERVICIO SEA PROLONGADA, YA SEA A TRAVÉS DEL REPARTO DE AGUA MEDIANTE CAMIONES CISTERNA U OTRAS MEDIDAS PERTINENTES, PARA DISMINUIR AL MÁXIMO LA CARENCIA DEL AGUA POTABLE EN LA COMUNIDAD.
ASIMISMO, SE PROCEDA A COMUNICAR DE FORMA EFECTIVA A LA COMUNIDAD DICHAS INTERRUPCIONES. RGS09/2026 “(…) El recurrente reclama violación a los derechos fundamentales de la amparada, pues señala que es vecina de San José, Mora, Piedras Negras. Acusa que, sin embargo, en ese sector no se otorga un servicio de agua potable continuo, suficiente y efectivo, ya que se producen cortes reiterados de dicho servicio. (…)” “(…) de acuerdo con la información suministrada por el presidente de la Junta Directiva de la ASADA de Piedras Negras de Mora, dicha organización se comunica con los dueños de la prevista por medio de un grupo de WhatsApp en el cual están los abonados que han manifestado su interés en pertenecer a ese grupo. Los horarios de racionamientos también los comunican por este medio. Por ende, no se tuvo por demostrado que la ASADA de Piedras Negras de Mora le haya comunicado de forma efectiva a la comunidad de Piedras Negras de Mora en San José sobre los racionamientos de agua.
Asimismo, tampoco se demostró que la ASADA de Piedras Negras de Mora o el Instituto Costarricense de Acueductos y Alcantarillados hayan realizado medidas alternas para proveer de agua potable a los usuarios de forma regular mientras se mantenían los racionamientos de agua.
Al respecto, esta Sala, en múltiples sentencias ha señalado que el suministro de agua potable es un servicio público y que, como tal, cualquier prestador de servicios públicos –sea sujeto público o privado-, está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véanse al respecto las Sentencias N° 2001-09676, de las 11:25 horas del 26 de setiembre de 2001 y N° 2004-08161, de las 10:53 horas del 23 de julio de 2004). Es por ello que, a partir del momento en que la autoridad recurrida tuvo noticia de la interrupción en el suministro de agua para la comunidad en cuestión debió haber enviado un camión cisterna u otro medio que proveyera de agua a los habitantes de la misma, lo cual no consta que lo haya hecho o bien, otros medios utilizados, según el “Protocolo para la atención de eventos de afectación o potencial afectación en la calidad del recurso hídrico utilizado para el abastecimiento poblacional”.
Es importante recordar, que el agua es fundamental en la vida diaria de cualquier persona; su falta, afecta directamente la salud y el bienestar de los ciudadanos. De ahí que, ante la noticia de una interrupción en el abastecimiento de agua, las autoridades deben procurar solventar el problema, para que los ciudadanos puedan contar, al menos, con una solución temporal que mitigue la situación. Igualmente, están en la obligación de comunicar de forma adecuada a la comunidad sobre dichas interrupciones, lo cual, se refirma, no consta que se haya realizado, pues solo se les comunicó a unas cuantas personas que conforman un grupo de WhatsApp, no así, a otras personas de la comunidad. Nótese que, si bien la ASADA de Piedras Negras de Mora es el operador autorizado en dicha comunidad, también es cierto que el Instituto Costarricense de Acueductos y Alcantarillados debe velar por el buen funcionamiento de la prestación del servicio, lo cual no sucedido.
Por ello, dichas omisiones de la parte recurrida en enviar los camiones cisterna con agua u otras iniciativas, durante la interrupción del servicio, o en comunicar de forma adecuada a la comunidad de dicha interrupción, lesiona los derechos fundamentales de la amparada y los habitantes de la comunidad. En consecuencia, cuando el período de racionamiento es por muchas horas o varias veces por semana, el Instituto debe de facilitar otras opciones de suministro de agua potable, ya sea a través del reparto de agua mediante camiones cisterna u otras medidas pertinentes, para disminuir al máximo la carencia del agua potable en la comunidad afectada.
VII.Conclusión. En virtud de lo expuesto, se declara parcialmente con lugar el recurso únicamente por las omisiones de la parte recurrida en enviar los camiones cisterna con agua u otras iniciativas, durante la interrupción del servicio, y en comunicar de forma adecuada a la comunidad de dicha interrupción. En lo demás, se declara sin lugar el recurso. (…)”
