035619-26. ALLEGES THE PERSISTENCE OF NOISE POLLUTION AT AN ESTABLISHMENT THAT HAS A HEALTH ORDER THAT THE RESPONDENT HAS NOT EXECUTED. PARTIALLY GRANTED, ORDERING THE DIRECTOR OF THE HEALTH AREA OF SANTO DOMINGO OF THE MINISTRY OF HEALTH TO FORMALLY NOTIFY THE APPLICANT OF THE FINAL OUTCOME OF THE COMPLAINT REGARDING NOISE POLLUTION FILED AGAINST THE ESTABLISHMENT. RGS09/2026 “(…) The applicant alleges that the Ministry of Health did not effectively enforce the health order that suspended the shooting activity of Club de Tiro Rancho Arizona, despite complaints of noncompliance. However, the administration maintains that, because documentation had been submitted concerning a dispute over whether the area where both the applicant’s property and the shooting area are located is for residential or mixed use—a distinction it considered relevant because the noise limit differs in each case—it deemed it advisable to await resolution of the challenges. Thus, the Chamber notes that, in this respect, the administration’s decision was based on that criterion of convenience and opportunity. Any discussion of the matter would therefore concern ordinary legality and would not be a matter for this jurisdiction.
VII.Lastly, the applicant’s objections to the methodology used for the May measurement, the number of plans admitted, the calculation of subsequent challenges, and the closure of the file raise disputes concerning subsequent actions and matters of technical and procedural legality that exceed the scope of the original matter, without prejudice to the corresponding ordinary avenues. Nor is it appropriate for this Chamber to directly order cancellation of the health permit or permanent closure without a current technical finding to justify it. Accordingly, the application is denied as to this point. (…)”
035619-26. ACUSA LA PERSISTENCIA DE CONTAMINACIÓN SÓNICA EN ESTABLECIMIENTO QUE TIENE ORDEN SANITARIA Y QUE EL RECURRIDO NO HE EJECUTADO. PARCIALMENTE CON LUGAR ORDENANDO A LA DIRECTORA DEL ÁREA RECTORA DE SALUD DE SANTO DOMINGO DEL MINISTERIO DE SALUD, COMUNIQUE FORMALMENTE A LA RECURRENTE EL RESULTADO DEFINITIVO DE LA DENUNCIA POR CONTAMINACIÓN SÓNICA PRESENTADA CONTRA EL ESTABLECIMIENTO. RGS09/2026 “(…) La recurrente alega que el Ministerio de Salud no ejecutó eficazmente la orden sanitaria que suspendió la actividad de tiro del Club de Tiro Rancho Arizona, pese a las denuncias de incumplimiento. La referencia a una reunión presencial celebrada el 15 de diciembre de 2025 no permite tener por satisfecha esa obligación, pues en ese momento el procedimiento administrativo aún no había concluido. Tampoco consta que, una vez practicada la medición del 17 de mayo de 2026 y dictada la resolución que tuvo por cumplida la orden sanitaria y dispuso el cierre del expediente, se hubiera comunicado formalmente a la recurrente lo resuelto respecto de su denuncia. En consecuencia, se constata una lesión de los derechos reconocidos en los artículos 41 y 50 de la Constitución Política.
En cuanto a las manifestaciones de la recurrente respecto de la ejecutoriedad del acto administrativo, consta que la orden de cierre notificada al propietario de Rancho Arizona el 2 de diciembre de 2025 fue recurrida por el interesado, situación que por sí misma no determina la imposibilidad de ejecución de lo dispuesto; no obstante, la administración aduce que ante la presentación de documentación relacionada con una controversia en torno a si el área donde se ubica tanto la propiedad de la recurrente como el área de tiro es un área de uso residencial o de uso mixto, situación que estimó como relevante ya que el límite de ruido en uno y otro caso es distinto, se determinó como conveniente esperar la resolución de los recursos. De tal manera, advierte la Sala que, en cuanto a este aspecto, la decisión de la administración se sustentó en dicho criterio de conveniencia y oportunidad, por lo que toda discusión al respecto sería un tema de legalidad ordinaria, y no de planteamiento ante esta jurisdicción.
VII.Por último, las objeciones formuladas por la recurrente contra la metodología de la medición de mayo, el número de planes admitidos, el cómputo de los recursos posteriores y el cierre del expediente plantean controversias sobre actuaciones sobrevenidas y aspectos de legalidad técnica y procedimental que exceden el objeto original, sin perjuicio de las vías ordinarias correspondientes. Tampoco corresponde a esta Sala ordenar directamente la cancelación del permiso sanitario o la clausura permanente sin una comprobación técnica actual que lo justifique. En consecuencia, se declara sin lugar el recurso en cuanto a este extremo. (…)”
