Res. 35477-2026 Sala Constitucional · Sala Constitucional · 16/09/2026
OutcomeResultado
The Chamber summarily rejected the amparo: the environmental complaint must be pursued before the competent authorities, and the ownership and possession dispute belongs in the relevant Indigenous customary and statutory-law procedures, including the administrative-litigation and criminal proceedings already underway.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) summarily rejected an amparo application by a Maleku Indigenous person alleging tree felling and an irregular award of possession over a parcel within Maleku Indigenous Territory. It stated that environmental complaints must first be brought before the competent authorities and that amparo is not a channel for complaints requiring complex evidence. The Chamber also held that it could not determine ownership or possession of the parcel, which must be resolved through Indigenous customary law and the applicable statutory-law procedures. It noted that the dispute was already before the administrative-litigation and criminal jurisdictions, where interim measures could be sought.
Key excerptExtracto clave
The purpose of an amparo proceeding is to provide timely protection against direct infringements or threats to fundamental rights and freedoms, not to serve as a general instrument for channeling other kinds of requests. Accordingly, the amparo procedure cannot be used to turn the Constitutional Chamber into a mere office for processing complaints or reports, since that would require complex evidentiary proceedings incompatible with the summary nature of this forum, as well as directly replacing administrative decision-making and supplanting public offices in matters within their competence. In this regard, it should be clarified that it is not for this Constitutional Chamber to determine, based on the applicable statutory-law rules and the ancestral principles, beliefs, and customs of the Maleku Indigenous community, matters concerning ownership and possession of the property or who holds rights over the parcel at issue. That exceeds both the summary nature of the amparo proceeding and this Tribunal’s competence; it also forms part of the Indigenous community’s own internal law, whose disputes must be resolved through the procedures and mechanisms provided by Indigenous customary law and the statutory-law legal system.

035477-26. ACCUSES THE FELLING OF TREES IN MALEKU INDIGENOUS TERRITORY, AND ALSO ALLEGES THAT POSSESSION OF HIS PROPERTY WAS IRREGULARLY AWARDED. SUMMARY DISMISSAL BECAUSE A COMPLAINT WAS FILED WITH THE CHAMBER INSTEAD OF FIRST BEING SUBMITTED TO THE COMPETENT AUTHORITIES; FURTHERMORE, THE CHAMBER HAS NO AUTHORITY TO DETERMINE OWNERSHIP AND POSSESSION OF THE PROPERTY. SUMMARY DISMISSAL. RGS09/2026 “(…) The applicant states that he is Indigenous and belongs to the Maleku ethnic group. He asserts that he is the registered owner of property number [Valor 003], located within Maleku Indigenous Territory, with a consolidated registry history dating from 1974, that is, before the promulgation of Indigenous Law No. 6172 of 1977. (…)” “(…) . The purpose of an amparo proceeding is to provide timely protection against direct violations or threats to fundamental rights and freedoms, not to serve as a general instrument for channeling other types of requests.
Accordingly, the Constitutional Chamber (Sala Constitucional) cannot be expected to act, through amparo, as a mere processing body for complaints or reports, since doing so would not only require the taking of complex evidence, which is incompatible with the summary nature of this forum, but would also directly replace administrative discretion and usurp the role of public offices in handling matters within their jurisdiction. For this reason, the Chamber has declined to hear environmental complaints directly. (…)” “(…) In this regard, it should be clarified that this Constitutional Chamber (Sala Constitucional) is not responsible for determining, on the basis of the applicable infra-constitutional regulations, as well as the ancestral principles, beliefs, and customs of the Maleku Indigenous community, matters relating to ownership and possession of the property or who has rights to the property in question, because that not only exceeds the summary nature of the amparo proceeding and this Court’s jurisdiction, but is also part of the community’s own internal law, and its disputes must be resolved through the procedures and mechanisms provided for that purpose under Indigenous customary law and the infra-constitutional legal order …
(…)” “(…) In any event, as the applicant himself indicates, the dispute is already before the administrative-litigation jurisdiction in the proceedings being handled under case file number 26 002909-1027-CA, as well as in the criminal forum, through the complaint being handled under case file number 26-001132-0306-PE. Accordingly, it is in those proceedings that the applicant must not only argue the merits of the matter, but also seek any interim measures deemed appropriate so that the matter may be resolved as the law requires. Consequently, the amparo is inadmissible with respect to this matter, as is hereby declared. (…)” “(…) The amparo application is summarily dismissed.”
035477-26. ACUSA LA TALA DE ÁRBOLES EN TERRITORIO INDÍGENA MALEKU, ADEMÁS QUE EXISTE UNA ADJUDICACIÓN IRREGULAR DE POSESIÓN SOBRE SU FINCA. RECHAZO DE PLANO POR FORMULAR UNA DENUNCA ANTE LA SALA Y NO INTERPONERLA PRIMERO ANTE LAS AUTORIDADES COMPETENTES, ASIMISMO A LA SALA NO LE COMPETE DETERMINAR LO RELATIVO A LA TITULARIDAD Y POSESIÓN DEL BIEN. RECHAZO DE PLANO. RGS09/2026 “(…) (…)” “(…) Se rechaza de plano el recurso.”
