SummaryResumen

The Constitutional Chamber (Sala Constitucional) granted the amparo proceeding concerning flooding in homes near National Route 128 in Santa Bárbara de Heredia. It was alleged that the drainage system was old and insufficient. Although CONAVI had carried out inspections and maintenance and had scheduled a hydrological and hydraulic study, the problem persisted and required an effective infrastructure solution. The majority ordered the necessary actions and works to be carried out within 18 months to solve the flooding. Justice Garro Vargas dissented only on enforcement: she proposed placing that phase before the Enforcement Area of the Administrative Litigation and Civil Tax Court, under Article 56 of the Constitutional Jurisdiction Law. She considered that the works involve technically complex issues and that this jurisdiction allows it to monitor compliance stages, request schedules, and impose fines. The source does not state that the majority ordered enforcement through that route.

IT IS ALLEGED THAT THE DRAINAGE SYSTEM OF NATIONAL ROUTE 128 IN SANTA BÁRBARA DE HEREDIA IS OLD AND HAS INSUFFICIENT CAPACITY, CAUSING FLOODING IN HOMES IN THE AREA. IT IS CONSIDERED THAT, ALTHOUGH CONAVI HAS CARRIED OUT INSPECTIONS AND MAINTENANCE AND HAS SCHEDULED A HYDROLOGICAL AND HYDRAULIC STUDY, THE PROBLEM PERSISTS AND REQUIRES AN EFFECTIVE INFRASTRUCTURE SOLUTION. THE AMPARO PROCEEDING IS GRANTED. THE NECESSARY ACTIONS AND WORKS TO SOLVE THE FLOODING ARE ORDERED WITHIN 18 MONTHS. In this specific case, given the scope of the order to carry out the necessary road infrastructure actions and works to solve the flooding problems in the area identified by the applicant, I consider that the appropriate course is to place the enforcement phase of the matter within the administrative-litigation jurisdiction.SE ALEGA QUE EL SISTEMA DE ALCANTARILLADO DE LA RUTA NACIONAL 128, EN SANTA BÁRBARA DE HEREDIA, ES ANTIGUO Y DE CAPACIDAD INSUFICIENTE, LO QUE PROVOCA INUNDACIONES EN VIVIENDAS DEL SECTOR.

034888-26. IT IS ALLEGED THAT THE SEWER SYSTEM ON NATIONAL ROUTE 128 IN SANTA BÁRBARA DE HEREDIA IS OLD AND HAS INSUFFICIENT CAPACITY, CAUSING FLOODING IN HOMES IN THE AREA. IT IS CONSIDERED THAT, ALTHOUGH CONAVI HAS CONDUCTED INSPECTIONS AND MAINTENANCE AND HAS SCHEDULED A HYDROLOGICAL AND HYDRAULIC STUDY, THE PROBLEM PERSISTS AND REQUIRES AN EFFECTIVE INFRASTRUCTURE SOLUTION. THE AMPARO APPLICATION IS DECLARED WITH MERIT. THE NECESSARY ACTIONS AND WORKS TO SOLVE THE FLOODING ARE ORDERED TO BE CARRIED OUT WITHIN 18 MONTHS. RGS09/2026 “(…) DISSENTING OPINION OF JUSTICE GARRO VARGAS ON ENFORCEMENT OF THE JUDGMENT.

I dissent with respect to enforcement of the judgment, so that, pursuant to art. 56 of the Constitutional Jurisdiction Act (LJC), it is assigned to the Enforcement Area of the Administrative Litigation and Civil Treasury Court.

Enforcement of orders issued by the Constitutional Chamber (Sala Constitucional) is, in principle, to be supervised by the Chamber itself. However, that provision provides for exceptions in which, at the Chamber’s own determination, enforcement of the judgment may be assigned to the administrative litigation jurisdiction:

“Art. 56. Enforcement of judgments falls to the Constitutional Chamber, except as regards the assessment and satisfaction of compensation and monetary liabilities, or other matters that the Chamber itself deems appropriate, in which case it shall be carried out through the administrative litigation route under the judgment enforcement procedure provided for in the law governing that jurisdiction.” (Emphasis not in the original.)

Recall that the draft law debated for the LJC originally provided as follows:

“Art. 56. Judgments in favor of the applicant shall be enforced through the administrative litigation route under the judgment enforcement procedure provided for in the law governing that jurisdiction.” (Emphasis not in the original.)

However, the text was amended by motion so that the provision would be consistent with the provisions of art. 153 of the Political Constitution, but the following explanation was given:

“THE SECRETARY:

Motion No. 68 (32-19) by Deputy Chacón Jiménez:

“Article 57 (formerly 56): to have the text read as follows: ‘Enforcement of judgments falls to the Constitutional Chamber, except as regards the assessment and satisfaction of compensation or monetary liabilities, or other matters that the Chamber itself deems appropriate, in which case it shall be carried out through the administrative litigation route under the judgment enforcement procedure provided for in the law governing that jurisdiction.’ THE PRESIDENT:

Is the motion just read open for discussion?

Doctor Piza Escalante:

There was a contradiction here with the general position that courts enforce their own judgments, and it sent all enforcement to the Administrative Litigation Jurisdiction; then the other articles that allowed the Chamber to enforce them were left hanging.

Deputy Corrales Bolaños:

That part says: ‘or other matters that the Chamber itself deems appropriate…’; what is it referring to?

Doctor Piza Escalante:

The idea is that the Chamber, through the judgment enforcement procedure, resolves what it considers to be within its remit. The rest is sent to the Administrative Litigation route.

THE SECRETARY:

Is the motion considered sufficiently discussed?

THE PRESIDENT:

Discussed. Approved (unanimously, five deputies present).” (sic). See the minutes approving the LJC. Emphasis not in the original.)

On the basis of the foregoing, it is clear that the LJC itself authorizes this Chamber to assess and decide whether it is necessary to refer all or some aspects relating to enforcement of the judgment to the administrative litigation jurisdiction.

In this specific case, given the scope of the order to carry out the actions and works necessary for road infrastructure to solve the flooding problems in the area identified by the applicant, I consider that the appropriate course is to assign the enforcement phase of the matter to the administrative litigation jurisdiction. This is because the rules governing this constitutional jurisdiction provide no suitable mechanisms for monitoring the orders set out in this judgment, which involve highly complex technical aspects.

By contrast, the provisions of the Administrative Litigation Procedure Code on enforcement (art. 155 et seq.) offer clear advantages, such as the possibility of requesting schedules, imposing fines, establishing liability, monitoring stages of compliance, etc. Therefore, pursuant to art. 56 of the LJC, I consider that the enforcement phase should take place before the Enforcement Area of the Administrative Litigation and Civil Treasury Court, under the judgment enforcement rules of that Code. RGS09/2026 “(…)
